[1:14] Good evening, ladies and gentlemen, and welcome to the September 2nd, 2026 [1:19] meeting of the Hide Park Planning Board. Um, you'll notice on your screens that [1:25] the uh public water ban has been lifted. Please visit Duchess County website for [1:31] more information on what to do or Hyde Park uh should have it also up on their [1:35] website. But the water has water ban has been lifted. If you could now please [1:39] stand with me and say the pledge of allegiance. [1:44] » I pledge allegiance to the flag of the United States of America and to the [1:49] republic for which it stands, one nation under God, indivisible, with liberty and [1:55] justice for all. [2:01] Our first item on the agenda is a continued public hearing for the [2:05] Bellefield Phase 4 FDP condos. Come on down, gentlemen. [2:28] Good evening. Good [clears throat] evening and thank you for having us back [2:32] back tonight. Larry Budro with Belf, Jared Okconor to my left and uh we're [2:38] back to give the board an update. Um >> before you uh get going, could I get a [2:45] motion to open the public hearing? >> So moved. [2:48] » Second. All in favor, please say I. >> I. I. [2:51] » Thank you. [2:54] » So, we were uh you know, working pretty hard to get through all the comments and [3:00] then the board issued some preliminary conditions to approval and I believe, [3:06] you know, there was a significant amount of them and we plowed through all those. [3:09] Of course, one of them was getting the approval from the Roosevelt Fire [3:14] Department and we did get some lastm minute um comments that we wanted to, [3:20] you know, uh, you know, get addressed right away. We were fortunate to meet [3:25] with Dan Nichols this morning uh at at 11:30 and thank you Don, you know, for [3:31] helping with that and of course an um thank you for being there and Tom Harvey [3:36] was there. Uh Dan Nichols and Ryan were both there and of course our team, you [3:42] know, Tom Malroy was there. Um he was uh glad to meet us and we had the [3:49] architects LMV there, Tom and um and Mike McCormack. [3:55] Their uh issue was the egress out of the buildings and as we showed it in the [4:01] plans we submitted on August 18th show the egress going into the courtyard. [4:05] They didn't like that. Uh so uh it was a really not hard to do. We just needed to [4:11] understand that. Uh so now we [clears throat] put the egress out [4:16] towards the parking lot side of the building. So we changed that. We um uh [4:22] updated the plans and resubmitted it back to him so he would be in a pos [4:26] position to write an approval letter back back and forth. Um uh the other [4:33] thing we did for him is we removed the retaining. Oh Jared, you probably show [4:37] it. [4:43] So we do have it here. We did uh include it in the PowerPoint. [4:50] But as as that comes up, the other thing we did was you might remember there was [4:54] a retaining wall uh on the on the east and the north end of the courtyard and [5:02] that was an accessibility issue for them. So we took that out and we graded [5:06] it down at 3:1. Uh the garage the wall is already there with the parking [5:12] garage. So we just sloped it right down. >> And you put a stairway there. [5:16] » Yeah. And a stair access. Where where is this again? [5:21] » Yeah, I'll show you when it comes up. [5:27] » It's 3,3100 on the east end, [5:31] » right? >> Yep. Yep. [5:33] » Yep. >> Cynthy, what did you do? [5:41] » It's loading. >> Looks good. [5:45] » A little temperamental tonight. I think the other thing we did memory [5:50] » and Dan had a concern with was the uh pool house amenity was a little close to [5:56] the actual residential building condo. So um the architect said well we'll [6:03] rotate it 90 and so he was happy with that. Uh and then he wanted a note on [6:09] the plan specifically referring to uh NFPA13 [6:15] as a code requirement. We did look up the code and it is required for the [6:20] height of this building. So that we will be sprinklering the buildings at NFPA [6:25] NFPA13. So that note was added to the cover sheet as note number 10. Uh, so I [6:31] forward him an email with uh with uh a note explaining all of that with the [6:37] three attachments, the cover sheet, grading, and layout plan. So I'll show [6:41] you what we did here. [6:47] I can then a good one. [6:53] » That won't be won't be as clear. [7:00] » Oh yeah, you can't there. There you go. So stair egress here. We added this this [7:06] right here. So now you can come out the stair tower and out to the parking area, [7:12] not the courtyard. So, one here, one here, one here, one [7:17] here. [7:21] This this wall was taken out and uh you'll see in the grading plan we [7:26] added the stairs to get out. This uh we rotated it 90° [7:34] and we had to go from 40 to 35 ft in order to work with the grade. So this is [7:42] a lot more room in between the buildings now. [7:47] Oops. [7:51] Same thing here. This wall was taken out. Stair access down. And this was [7:56] rotated 90 to give more room between the buildings. And we added egress here, [8:03] here, there, and there. and Jared will get us [8:08] to the grading plan, but um uh we had to make sure all the grades work. So, we [8:13] went to the grading plan, put the spot grades on, made sure everything worked. [8:17] » It it Larry, is it ADA now through the structure? Is that is that how how does [8:23] a handicap get into there without accessing those stairs on the [8:28] » uh which structure? >> On on your on that structure there? You [8:33] see you see the courtyard? >> Yeah. Now you have the stairs, right? [8:37] » So, so they would access it through the building. Is that correct? [8:42] » Yes. Okay. I just >> Yeah. So, it's interesting the way, let [8:45] me grab that. The way this lobby works, the lobby is 2 feet above the uh garage [8:52] elevation and uh we provided the the uh floor plan of that um layout. But the [9:01] two feet there then there's elevator access to it and you go up to whatever [9:05] floor you want and >> okay [9:08] » but yeah you would not be able to do this. You can see the grade difference. [9:12] That was one of the concerns uh Dan had was uh you know how does he [9:17] get you know to this courtyard you know uh up this stair tower coming up some 12 [9:24] feet up here with all their equipment that kind of stuff. So, this this was a [9:30] a valid concern. We had to know what it was and we addressed it. So, here's the [9:35] grading plan. We had to work with the grades a little bit. We had to pull this [9:39] back a little bit to get that guy in. Um, same thing here. [9:46] Now, he also had some comment, wasn't it, about the stair tower it from the [9:52] from the garage level and reworking that ramp or [9:56] » Well, his his concern was if there was a fire in the garage, he didn't want the [10:01] smoke going up the stair to the stair tower that goes out has no [10:07] access to the garage. >> Okay. Right. So, the smoke can't go. [10:12] Okay. >> They're separate through it. Separate. [10:14] » Separate. Okay, good. So, uh we made progress on that and uh [10:21] he was very helpful in saying, you know, what do I need to do um you know to help [10:26] move this forward and so I think uh I think that box will be checked. [10:34] Couple other things to give the board an update. We did receive REIA comments. Uh [10:40] we're working through them. comments seven and nine. You know, of the 20 [10:46] three uh 23 original comments, um we're we've addressed [10:53] most of them. I've seen personally seven and nine are addressed. Uh we have 13, [11:01] 16, 17, and 21 to complete. I just got a text message that they're, you know, [11:07] they're basically done. Um the last comment 23 [11:14] uh and I'll just read it here uh remains Bellefield it said the uh in uh building [11:20] inspector zoning administrator town engineer should agree on the [11:24] requirements for the building permit and CO occupancy. So this refers to the CO [11:30] occupancy phasing plan and for each of those phasing plans we're saying what [11:35] has to be in place >> in order you know to get the CO and the [11:40] comment says that the zoning administrator town engineer should agree [11:45] on it. So um you know that we would need a response [11:51] from from them [11:55] and we can follow up. >> Right. The four the four parties need to [12:00] get together. >> We'll follow up with them. [12:06] Um Larry, I did just want to note that um comment 15 was not turned red, but it [12:13] is also a remaining comment and was not addressed. It's in black. [12:21] » Oh, yeah. Okay. >> All right. Just want to highlight that. [12:24] » Yeah. Okay. [12:29] All right. Um the interpretive plan we'd like to go over. Um [12:35] the interpretive plan we presented it to um the intent was it to establish the [12:44] design intent of the interpretive you know features. So you can go to that [12:51] » um an interpretive plan meaning >> the the the around the pond [12:54] » sheet C1 >> the recreation. [12:56] » Yeah. Okay. Yeah. [13:02] So, the idea is that we're presenting to the board. Um, you know, our intent, uh, [13:10] I think there's like almost 20 different different design elements. Um some are [13:17] repeated, but um the uh we met with Dylan [13:22] yesterday and the idea was you know how does this work at at you know final [13:28] approval and so we were working through that today and we have some thoughts and [13:33] we'll go through them. I'll go through the big picture. Jared can go through [13:37] some of the details, but the idea is that you know the plan being presented [13:43] is um is our design intent for what we want to [13:48] do. Uh the final design elements would the idea we're thinking the final design [13:54] elements would be approved by staff and installed prior to the co. So what we [14:00] would do is uh tie a certain number of elements. We say in the note on the [14:05] upper left that three or four of the interpretive elements would be required [14:10] to be in per CO and you take three * 4 and that's 12 of course or four * 4 is [14:17] 16. So we'll capture all the the uh design elements within the there's [14:24] there's four cos right one no two three four five six six six cos right so 6 * 3 [14:31] is 18 6 * 4 is 24 so it's three to four elements per co [14:36] » then we so because we're not going to build the whole thing at once right [14:40] » and only have 30 people there right so the idea is to sequence it with the co [14:48] beef it up as you go. >> Yeah. And and then we have some thoughts [14:52] on on sequencing it and we can share that. But the idea would be obviously [14:57] for building 30,000 we the pond would be in the trail around [15:02] the pond would be done. The stone tower park would be done. So all those [15:07] elements would be done and then in the next co we'll come up with another list [15:11] and that kind of thing. So I think we can confidently provide [15:18] the list of what would be done on the first CO. Now [15:20] » yes, oh sorry, >> we can confident confidently provide or [15:24] provide a list that confidently says what we can deliver uh for the first CO [15:29] » because a lot of the earth work has to happen for the pond. Makes sense to put [15:33] in the trails. >> Some of your larger elements will have [15:35] to have been in place. >> Exactly. Because we don't have to go [15:37] back and try to do that when the other buildings are being done. So, but then [15:41] once we move beyond that, um, we've got some thoughts on trying to give us some [15:44] flexibility to deliver certain elements that meet the intent of what we're [15:48] showing here. So, >> can I after I was thinking about this [15:51] after we met yesterday, um, and I I wonder if you could say a little more [15:56] like I'm it surprises me as I think about it, how much uncertainty you have [16:02] about like what space you're going to have or what things are going to look [16:05] like when you're done. Can you talk a little like I'm accustomed to seeing in [16:09] the plan that you've you know what's going to happen in enough detail that [16:12] you're able to site a playground piece of playground equipment, right? So why [16:15] isn't that the the case with with this particular piece of property in this [16:19] project? Well, the uh you know the whole thing [16:23] with Bellefield is you know when we were doing this trail by the by the uh uh [16:29] hotel, right? We show it on plan, but when we actually were doing it out in [16:34] the field, you know, we were working more with the contours, with the rocks [16:38] that are there, with the trees that are there. So, uh, we need that flexibility [16:44] to I mean, we could show the trail, we could show the playground feature, but [16:49] we I I believe we need the flexibility to work with what's actually out there. [16:55] Uh, the trees, the rock outcrops, or whatever else we may find. Um, that was [17:00] what we were >> Yeah, I I guess I I understand that from [17:03] a concept plan or when looking at the whole property, but when we get into [17:06] this scale and this level of detail for a site plan, uh, you know, [17:13] shouldn't we have a sense of where the trees are and actually have it kind of [17:18] mapped out a little more clearly, cleanly? [17:19] » Well, well, when I say trees, I'm saying, you know, uh, [17:25] » a bunch of trees. Well, u you know, a nice sycamore that doesn't show up on an [17:29] aerial, you know, that you want to pop around, you know, that kind of thing. [17:34] » A rockout crop that doesn't show up on the on the topo. Uh and that's what we [17:39] did with that trail. We worked around some rockout crops and stuff like that. [17:44] Um >> so the the topography is coming into [17:47] play. Yeah. >> As you as you as you dig out the pond, [17:51] your things might not be what you expect. [17:52] » That's the idea. Um but this will be um as we were speaking yesterday the final [17:59] design element the idea I mean like a bench you know how [18:04] you know we'll show the detail what we're going to do and we'll show where [18:09] » after the pond is is built we'll have a really good idea where that thing would [18:14] fit and so then we can site it you know specifically like that. So, we're [18:19] committing to however many bench benches we have in there, you know, we'll we'll [18:24] show up. Um, I I really like having uh I used to do a [18:31] lot of golf courses, right? So, when you do a golf course, you lay it out on [18:35] plan, but it's all done in the field. You know, you're working with the [18:39] contours, you're moving things around, and that's kind of what, you know, what [18:44] I see here. But we're identifying specifically, you know, ideas that that [18:51] we're going going to put out there. Um, you know, so it's not, you know, I mean, [18:57] like that bench there, we want to have a natural, [19:00] you know, kind of wood type bench. So, [cough] will be there. It will be, [19:05] it'll be in the area of the location that we identify. Uh, but it might be a [19:10] little left or right of it or >> So, Larry, if I'm understanding [19:14] correctly, you're you since you've done golf courses and all, you're saying that [19:19] you're gonna you're going to it's it's fine on paper, but as you get out into [19:24] the field, you might come across something naturally beautiful that you [19:28] don't want to the bench is going to sit right there and you're going to have to [19:31] take it out and remove it. You you could just shift it over 5T and have the best [19:36] of both worlds. That's your intention is to make it better than actually what [19:41] you're presenting. >> Yes, [19:42] » that's correct. >> Yes. [19:43] » Okay, >> that's the idea. [19:46] » Well, the the other issue I think you have on the site is the understory is [19:49] [clears throat] so thick, >> the topography [19:52] » from the topo maps, you're not seeing a lot of the elements that are within the [19:57] site. So, as you start uh grubbing the understory and cleaning that all out, [20:03] you're talking about large scale landscaping, not building structures. [20:07] So, as you build that landscape, you'll see and landscape architects and [20:12] designers will look at it and go, "It was supposed to go here, but it looks [20:16] better here." >> And as you build the pond, [20:18] » Yeah. >> everything's going to mirror off of that [20:21] pond. >> Yeah, that's that's the idea. I mean, [20:24] these things here, um, the gazebo, the Jarro and I were talking about this [20:30] today, but, uh, where is the best spot for the dock? You know, that's going to [20:35] go out in the water. We show it there to the right. Yeah, right there. We show it [20:40] there, but actually when we get the pond in, you know, we might want to move it a [20:45] little bit. So, >> or angle it or something. [20:47] » Angle it. Angle it. And there are some areas, you know, right here in this bend [20:52] is very steep on the slope. And so when we get in there and find a way like what [20:57] is the trail actually going to look like for that section, that might spark more [21:00] ideas on what else might make sense to put here given the topography of it if [21:04] there's other elements we want to put there. So that's those are like the [21:07] level of details that we don't have now, but we're committing to, you know, go [21:12] through and do that work. >> That answers my question. Thank you. [21:14] » Yeah. and and and these items lend themselves to that flexibility, you [21:19] know. So that's why it >> I mean just to play de devil's advocate [21:24] here, I think the the only concern would be that by staging it um we won't see [21:30] some of these elements. So as long as there is a list to have flexibility to [21:35] be able to work them into the landscape in the proper way sounds fantastic. as [21:41] long as we still retain all of the elements throughout the project. [21:47] » I I think we're gonna be a little careful with the wording here, too. This [21:50] this has the potential to be kind of subjective, what's acceptable and what's [21:53] not. And that's our job, not staff's job. um when it comes to those sorts of [21:59] subjective >> well I think the board has also been [22:02] very clear on some of the items that they want to see like they want to see a [22:06] grouping of some of these recreational equipments together rather than all all [22:11] spread out oneonone. So if we can get the wording in there that says that [22:16] there is at least one place where there's multiple recreation structures [22:23] then that carries through what the board has been asking for. Yeah, I I agree [22:28] » without you actually having to say, "Well, it's going to go exactly here." [22:31] » Yeah. And and I do agree, you know, with with that. Um [22:35] » so So there is um a condition that discusses [22:42] looking at interpretive trails and and adding additional um equipment, it said [22:49] to the satisfaction of the planner. But I really think that should all be [22:54] revised and it really should be. I think to your point this is conceptual and [22:59] just maybe at another date you can come back with you know ha have the list as [23:06] you say but then once you're really out there and you've started construction [23:11] I'm sure a good chunk of what's showing is park is going to be graded so you'll [23:17] have I think you know a little bit better of a canvas to figure out where [23:22] you're going to put things you know so for example there was there there was a [23:26] swing set and I think the group had said we want more equipment. So I saw one [23:32] additional swing set but I don't know that that's I don't think I'm the one [23:36] that would say that's adequate. I think you all have to say this is appropriate [23:41] for a park that's serving this area. >> Right. Well, and I think we've been [23:45] specific in asking for an actual >> playground area. [23:49] » Yeah. where you have multiple options, right, [23:52] » for multiple ages to play fairly close by to each other so that [23:57] » mom's not chasing after >> Yeah. [24:00] » Yeah. And and I think that's just something that's going to work itself [24:03] out. So, it's it's almost better. Okay. you show conceptually, [24:07] » you can get a park and trails in and then just come back um once you've [24:13] started the construction to nail down ex exactly the program that you think is [24:18] » appropriate for this area. >> So, how would that be worded on a [24:22] resolution? >> Yeah, we have to change that. [laughter] [24:25] » I'm going to Henry will take care of that. [24:26] » I'm going to take a shot at it. I'll take a shot at it. Then Jerry will jump [24:30] in as he [clears throat] always does. [laughter] Yeah. [24:33] » Uh final design design elements must be approved by uh planning board and [24:38] installed prior to CO >> building. [24:42] » So maybe we be we become specific about which COS, right? [24:45] » Yes. And that >> a schedule of that with so once you [24:48] develop their schedule >> like like you said at the very first one [24:52] we're going to have all of the you will have had all of these elements that have [24:55] to be in place >> as you do 3,000. [24:58] » Yes. included in that might be the first round of the recreation area. [25:03] » Yeah. >> Spelled out. [25:05] » Yeah. As Jared said, we we have a pretty good idea of what we want to do for [25:09] 30,000. That's the >> So, just to understand kind of [25:13] mechanically what this would mean, is this a condition to the site plan [25:16] approval for the whole phase or it's a condition that applies in post site plan [25:24] in the construction phase? you you pretty clearly need it or want certainly [25:28] want it to be not a condition of site plan. Correct. You need the site plan [25:32] approved forward. So that's just what we're talking [25:35] » but just as we're talking about the phasing so that you can finish one [25:38] element of the site plan and get a co so you don't have to have everything in [25:43] place. This would work its way into that. I think once those building [25:47] locations are tagged and set where they are and then the trail the pond goes in [25:52] and the trail goes around it, you're it's going to answer its own questions. [25:56] It's going to fall once those buildings are staked and [26:01] pinned and cleared and then the pond is in. [26:04] » We want to get the pond done by the end of the year so that baby's, you know, [26:08] up. >> Just what what what sort of technical [26:10] mechanism are we talking about here? It would be nice if it's not like a full [26:14] amended site plan, right? If it's >> now we phase 4 a [26:21] » for pond. >> Yep. [26:23] » Maybe it's all attached to a 4A. >> Is that [26:26] » if is that a a way of handling it? If it's attached to that as a separate [26:31] heading, >> would that hold up? [26:33] » It has to be on this one. Okay. >> Well, I think we'll figure out the [26:36] mechanism. >> Yeah. And then the other advantage is [26:39] just once you started grading and some trees etc. Even the planning board could [26:44] go out there and and with you and then say all right this is a perfect location [26:48] for XYZ. >> So again I think there should be some [26:52] conceptual expectations of what you're going to put there and at [26:57] least maybe yeah some preliminary quantities lists. So you've you've [27:03] already expanded it immensely since we first talked to you by talking about the [27:07] number of elements and you know instead of just saying yeah exactly. So now [27:12] you're talking about 18 different >> we can detail this a little bit more by [27:16] uh at least identifying for the first co what to do then the others we can put a [27:22] number on it. >> Yep. [27:24] » Yeah. >> Yeah. to be determined. But um I like [27:28] that approach. >> And it may be that by the time you're [27:32] getting your first CEO, things are grubbed and cleared and things and you [27:37] sort of have an idea and come back for all of the approvals for us. You don't [27:43] have to come back every every time or anything. Right. [27:46] » Right. Um Yeah. And it'll still be tied to the CEO, but it'll be approved. [27:51] » Correct. Right. And and of course there's certain items [27:54] in landscaping and probably recreation that are movable, [27:59] » right? And that that our zoning administ she may deem some of these things as [28:04] dimminimous. >> Okay. [28:05] » So, you know, we I heard terms like we would move it over 5T. I think RZA would [28:10] say something like that is dimminimous >> anyway. Um, we're just like if we if you [28:17] drew a big circle and said this is where we're going to put a huge group of of [28:20] elements and then you go in you're like oh no now we got to shift it over you [28:23] know 250 ft. That starts changing the whole lay of the land. [28:28] » Mhm. >> So I think I think we're [28:31] » sounding like we're all singing to the same tune at this point. [28:34] » Yeah. Well, we agree with that. >> Cool. All right. Okay. [28:38] The um so the question I have to the board is [28:43] we made changes to the plan because of the fire chief. So we have those we [28:48] issued those to the fire chief and I did copy you and Cynthia [28:53] » and he said he's going to be preparing uh like his official response [28:58] » that would say comment 15 has been addressed and [29:02] » that he has no other concerns. >> Right. Do you want us to resubmit the [29:06] set um for u the 16th, you know, with the [29:13] updated fire chief's comments in there? And and and we have most of the rena [29:18] comments done. >> I imagine there also been any new [29:21] elevations for the amenity building since you [29:24] » flipped. That's all been flipped. >> And in order to have done that, you [29:27] would have had to submit yesterday, right? [29:29] » Um I mean, you guys are It's up to you obviously. Um, [29:33] » well, I would also remind that you're out next week, so [29:36] » I am out next week. Um, but I would imagine the board needs to especially [29:41] see this sheet so that you can approve the kind and quantity of the recreation [29:48] that then would be dealt with in some kind of phase. [29:52] » Well, this this sheet was submitted. >> So, this is so Yeah, I mean, I guess if [29:57] the question is, do we want a whole brand new site plan set? Well, I'm [30:01] asking you what do you want in >> she is is it five sheets have changed? [30:07] » You might also the changes for the fire department those egress go right out [30:12] into the landscaping currently. >> Oh yeah. Definitely [30:16] updated the >> landscaping. So it's it's pretty [30:18] intense. I mean to >> Well, um it would be the uh cover sheet, [30:23] site plan. Yeah. Or layout, grading, landscape, [30:29] » elevation. um this sheet because we'll uh provide a little bit more I [snorts] [30:34] think five sheets [30:38] » and then that just we're not there's going to be some conditions right [30:43] » on the 16 we'll get most of them >> whatever you submit is not going to be [30:47] what gets signed >> yeah yeah most of them will be addressed [30:52] » including the fire department >> right [30:55] » I would suggest doing getting the board or at least the file [31:00] any altered sheets and then I would do a digital set of the entire set and then [31:06] on the table of contents indicate the sheets that [31:11] » which have been updated [laughter] but make it an inclusive set digitally of [31:16] all of the sheets >> all of the ones that have changed so the [31:21] board can >> that makes sense those [31:23] » sorry printed printed of the ones that are changed and digital of everything [31:27] » digital of everything can embed and all the sheets that are altered and then [31:32] ghost >> and then five physical copies [31:35] » in the digital set. So at any given time they have a full set of all the sheets. [31:40] » And if I may, I mean, don't kill yourself, Larry, cuz you may have to [31:43] change these things a little bit like this amenity with just the stairs and no [31:47] ramp for ADA strollers or anything like that. I don't [31:51] » It's It's tofi great change. >> Just be prepared. So, we have ad access [31:57] into the [clears throat] lobby. And then >> I I get that. I understand. But it's [32:01] supposed to, you know, be the same for everyone and so you may get some push [32:05] back and you might have to edit a little bit. So, don't kill yourself on this set [32:09] until you get approvals >> because as you saw from your the comment [32:14] letters that have come through, the 60 plus conditions have been we're down to [32:20] manageable numbers. Now, >> are you intending to update the lighting [32:27] plan or are you going to address that as a condition? [32:32] » Oh, >> because you're going to have exits now [32:36] where you didn't have >> and there are [32:38] » we'll add those. >> Bonnie had a a comment that that um [32:42] there are some there are uh inaccuracies on the lighting plan. There's it looks [32:46] like it maybe some fixtures got updated, but the photometrics didn't. It doesn't [32:50] quite line up. >> That's already a condition. [32:53] » No. So, I'll send you Larry. What I did was I went through [32:57] » more comments. >> So, I went through the resolution and [33:01] where all my comments were embedded so that I could say addressed so we could [33:05] take it off or and there were some that there were still some questions and one [33:09] of them for example is where the dumpster is as an example uh top right [33:15] » by 3,300. The dumpster for 3,300. >> Yeah. [33:18] » Yeah. >> 3300. There was a fixture there. So you [33:21] have that you have those kind of foot candles. [33:24] » Yeah, there's a fixture here. >> There used to be one there, right? And [33:28] now it moved. So it's not a So there's something off. [33:31] » Yeah, that's that's clearly off. >> Yeah. So So I think [33:35] » the courtyard seemed funny, too. >> And the court and the other thing is I [33:38] think the way the courtyards at least you have it set up right now is I [33:43] believe the only lighting. >> Yeah, we didn't put any lighting in [33:46] there. Uh we'll put some lighting in there. Yeah, ballards, whatever you [33:50] want. But it's just I don't know that you're really going to not have any [33:53] lighting in the in the courtyard in the evening. [33:56] » I think I saw like a 14t candle level underneath one of those lights in the [34:00] courtyard, too. >> I know. I [laughter] I didn't think it [34:04] might be. >> I didn't think that was the sun. [34:06] » The sun, [laughter] >> you know. Also, the pool the pool being [34:10] lit, right? >> The pool will have to be lit to a [34:12] certain degree, right? If it's >> Yeah. I mean, unless you're covering it. [34:16] I that's actually worth checking in with the health department about that because [34:20] they have got requirements for >> for lighting up [34:23] » lighting on swimming pools. >> Yeah. Um this doesn't approve the [34:29] swimming pool. This has to go to the health department. Is [34:32] » Sure. But if they come back and say I I think they their requirements are like [34:35] 30 foot candles or something over swimming pools. [34:38] » Oh lord. >> They want 30. [34:39] » They're really heavy cuz Yeah. So it's [laughter] [34:44] » but you're gonna have lights in the pool. You're gonna have all kinds of [34:47] things. It's gonna be reflective. >> There's all that. Um but again that's a [34:51] you know would be a health department separate if it ends up significantly [34:56] changing a lot. >> Yeah. But I think Cynthia's got the the [34:59] right approach. >> Yes. [35:00] » The sheets that change to show the change that we discussed with the fire [35:05] department >> that helps their conditions to go away. [35:10] bring those out and then we're going to still have conditions [35:14] » that will need to be met. Lighting is an excellent example. [35:18] » Um, >> yeah, that's that's that's fine. [35:21] » I'll send you my comments. I don't know that you're going to want to deal with [35:24] them. >> Crazy doing the lighting plan because I [35:27] wouldn't go crazy adjusting the lighting plan because you're going to have to [35:30] readjust. >> It's going to be a condition anyway. So, [35:33] » yeah, that's fine. Uh, the main thing I want to get off is the fire department. [35:37] » Yes. >> Yeah. Yes. All the others are will [35:41] manage here. >> Yeah. Yeah. And um [35:47] » Okay, great. Terrific. Um so we know what we need to do. Uh anything else, [35:52] Jar? >> That covers it. [35:54] » I think it covers it. Again, thank you for having us [35:57] » here and we'll adjourn to the 16th. >> To do their [36:01] » Oh, right. So, [laughter] [36:05] » is there anybody here? Is there anybody here in from the public who would like [36:08] to speak to this application? >> Right. [36:11] » If not, may I get a motion to adjourn the public hearing to [clears throat] [36:17] what do we say? September 16th. >> 16th. Yeah. [36:20] » September 16th. >> Yeah. [36:22] » So moved. >> Second. [36:23] » All in favor, please say I. >> I. [36:25] » I. >> Motion carries. [36:26] » I just want to know where's the ferris wheel going to go. [36:30] » Oh, that could be cool. >> Yeah. Midway. So this mountain [36:34] » right on the overlook. >> When we get it all cleared and ready, [36:37] you come on out, pick a spot. >> There you go. [36:40] » Thank you very much. >> Thank you, Larry. [36:42] » Guys, have a great night. [36:46] » There are no more public hearings scheduled for the evening. We're going [36:50] into workshop. Our next item on the agenda is the Goran timber harvest [36:54] application. It is not 5 after 12. It is 6:36 [37:00] now, right? [37:05] » [clears throat] [37:13] » Good evening. >> Good evening. [37:14] » Good evening. Um my name is Christopher Apprentice with Lower Hudson Forestry [37:19] Services. Uh here representing uh the Goran Trust uh for Timber Harvest at uh [37:26] 959 Violet Avenue. Um parcel is uh 6164-01-458755. [37:38] Um totals 175.76 acres uh of which we're proposing uh commercial timber harvest [37:45] on 90 of those acres. Um property has been managed uh under DC approved um 48A [37:53] forest management plan since 1982. um has been harvested uh numerous times [37:59] over the years um and we are just continuing with the um management plan [38:06] that was approved um back in 2023. Um trees to be harvested uh mix of [38:13] hardwood and softwood all marked by a certified forester with blue paint. Uh [38:18] there's 1438 trees uh across the 90 acres to be harvested. It averages about [38:24] 16 trees per acre. Um the plan is to um lop all the tops uh down to 3 ft high or [38:34] lower. Uh helps with the uh breakdown um and deterioration of the uh the slash [38:39] that's left behind. um erosion control plan is uh will be [38:44] following the state's best management practices for timber harvesting. Most of [38:49] the topography is very flat rolling. Um so slopes are not really a concern. Um [38:56] but anywhere there are trails and there's numerous old trails left from [39:01] the previous harvests. um they will be smoothed um free of debris and uh any [39:08] erosion control devices will be installed as necessary. Uh there is a [39:12] DEC classified stream and wetlands um in the application packet. We've gotten the [39:19] approval for a DEC um stream crossing and wetland um crossing permit. Uh we'll [39:28] be crossing with um wooden crane mats. uh approximately 100 foot uh section of [39:34] the the wetland and the stream. Um that crossing will then be removed at the [39:40] completion of the uh uh the process and [clears throat] um it will be restored [39:45] back to what it is currently. Um there's also uh DC um rare threatened endangered [39:52] species, the uh Blandings turtle. So, uh, there's a letter in the application [39:58] that, uh, the DEC's provided for, um, seasonal restrictions. They'll [40:03] basically, uh, only allow us to harvest between October 16th and April 14th. Um, [40:10] there is also a letter from the New York State Parks, Recreation, Historical [40:14] Preservation. Um, the property did get a hit on the, uh, EF mapper for being in a [40:21] potential historic or archaeological sensitive site. Um the letter states [40:26] that this project won't have any u uh bearing on anything that they have [40:31] found. Um access to the property is going to be off of State Route 9G. [40:36] There's a pre-existing old abandoned orchard that's there. Um there's two old [40:41] breaks in the stone wall that were used for access to the orchard. Um what we [40:46] plan on doing is um putting in a tracking pad um to prevent mud and [40:52] debris from entering onto the highway. Um, I did speak with the DOT, uh, Tina [40:57] Riley. She sent me an email that I can present. Um, but basically, um, [41:05] since we don't have a contractor yet, I can't apply for a DOT temporary access [41:11] permit because of the bonds and insurance. But, um, I can give you this. [41:17] Basically, it says that, uh, let the planning board know that we don't have [41:20] any objections to this type of work. uh and you know an application can be put [41:25] in once a contractor is found. Um so um I know that visuals was a big um [41:33] item because this is a special use permit. Um the harvest is actually um a [41:40] long ways from the the state highway. Um you know 800 feet is as close as it [41:46] comes. um more of the property is over 1,000 ft past um the the the Route 9J. [41:54] So, um aesthetically, no one's really going to notice that it's what's going [41:59] on back there. Um there's a few houses um that the harvest will be near, but um [42:06] I visually I don't think that will impact them at all. Um the hope is that [42:12] you know with weather um cooperating that it would take approximately three [42:17] three and a half months to complete the the process. Um you know if we couldn't [42:22] finish before the April 14th deadline then um obviously we would have to come [42:26] back the following year. Um I think that's all I have. [42:32] » Thank you very much. Very thorough and I know you've been working really closely [42:36] uh with Tad on this. Yeah. >> Excellent. All right. I'm going to Let's [42:41] see. Miss Bonnie, any questions on this? [42:46] » No, I do not. Thank you, [clears throat] >> Mr. Renia. [42:49] » No comments, >> Mr. Hensman. [42:52] » I was just going to confirm that you will get with the zoning administrator [42:55] to figure out what sheets to include in the site plan application. [43:00] » Uh, yes. Okay. >> Thank you, [43:04] Mr. Tuttle. >> No comments. Thank you, [43:07] » Mr. Waters. I >> I just had a question for interest. Uh [43:12] what what happens to the harvest? Is that up to the contractor yourself? What [43:17] what does the wood is it stay in the community? Is it forest? Is it broken [43:23] down into lumber, timber since it's hardwoods and stuff? I I just wanted to [43:27] know, do you know how that process works? [43:30] » [clears throat] >> Um [43:32] the lower grade firewood and stuff like that more likely than not would stay in [43:36] the community. And I mean when I say community, Duchess County, [43:39] » Duchess, >> um soft wood more likely than not goes [43:43] to Canada. >> Um hardwood kind of average grade will [43:49] probably stay somewhere in New York. Higher grade, [43:53] » um China, >> wherever the market is. um Japan, Korea, [43:59] it's a pretty worldwide uh uh you know process. So [44:05] » um surprisingly, you know, round logs get stuffed into rectangular shipping [44:11] containers and put on boats and they go across the world. So um that's where a [44:16] lot of uh of wood from New York goes now. [44:18] » Wow. >> Just wanted to know. [44:21] » Excellent question. >> Good good question. [44:23] » Yeah. Thank you, >> Mr. Ve. Uh, no comment, [44:26] » Mr. Oliver. >> No comments. [44:28] » Miss Lee, >> no comments. Thank you. [44:31] » Um, I guess my only question is did you that uh letter that you just pointed out [44:36] from did that get sent over to the planning office? [44:40] » No, I have just gotten it. So, >> okay. If you could forward that over to [44:43] Cynthia, that would be great. >> Okay. [44:46] » Just add that to your file. >> Okay. Um, so we do have a resolution [44:51] tonight to classify the project and circulate to the agencies that need to [44:56] be circulated to. Uh, Mr. Tuttle, I believe you have this one. [44:59] » I do. Resolution to classify project and [45:03] circulate to Duchess County Planning and Development. Goran Timber Harvest, [45:06] September 2nd, 2026. Resolution 2026-26. Whereas, whereas, whereas [45:13] Now therefore, be it resolved that the planning board hereby classifies the [45:16] project as an unlisted action under seeker and determines to conduct an [45:20] uncoordinated review. Be it further resolved that the planning board directs [45:24] the secretary to refer the project to the Duchess County Department of [45:27] Planning and Development pursuant to section 239M of the general municipal [45:30] law. Be it further resolved that the planning board directs the secretary to [45:34] send a courtesy referral to the New York State Department of Transportation. [45:38] » Second. Is there any discussion? All in favor, please say I. [45:42] » I. >> Any nays or abstensions? Motion carries [45:45] unanimously. >> Thank you for coming out tonight. [45:49] » Thank you. [45:52] » We need to set a public hearing. Sorry. >> Set a public hearing. [45:54] » May I get a motion to set a public hearing for September 16th? [45:57] » I'll make that motion. >> Second. [45:59] » All in favor, please say I. >> I. [46:01] » I. >> There you go. Now you're all set. [46:03] » Okay. >> Thank you. Thank you for the uh update [46:06] on what happens to it. That's It's important to know that. Yeah. [46:10] » Thank you. >> It is. [46:10] » I will see you in a few weeks. >> Thank you. [46:12] » Got it. >> Thank you. [46:14] » Have a good night. >> You too. [46:17] » Our next item on the agenda is uh other business with the CIA hotel and villas. [46:22] Uh they are looking to do a phase three recovery plan study uh on their site to [46:28] see if it's uh usable for expanded villas and um other items on their site [46:37] plan. This is uh just an authorization that [46:41] would allow them to do just just the study and [46:46] see am I missing anything? [46:53] » Bonnie, do you have any input on this? >> Yes. So, we're we're literally [46:58] talking about this trying to sort it out. So, so this is a recovery plan. [47:04] We're saying we're authorizing a recovery plan. the recovery plan results [47:08] in disturbance. So on the one hand it's a mitigation but on the other hand [47:12] you're disturbing you know 8 acres of the site that wasn't accounted for in [47:18] seeker. So I was just looking at this to see if there was any you know paragraph [47:25] that says something to the effective and we find that this isn't a significant [47:30] impact. Um, >> yeah, if we could just to add some kind [47:35] of sentence that you're cognizant that [47:40] this this has implications from a secret perspective, too. [47:45] » I think that's a fine idea. I think we can have that absolutely significant [47:48] that it won't affect the prior >> Yeah. that that it's that it's not [47:52] right. And ultimately, it is a recovery plan. And it's a it's a type of [47:55] mitigation, but the fact that they're going to be cutting into this area and [47:59] digging it out is also a disturbance. So, just if we could put some wording in [48:03] there. >> Yeah. [48:06] » Can we collectively come up with a uh a sentence or so to put in there? [48:11] » Um, reference the last [48:16] reaffirmation resolution date. [48:21] » Oh, right. Um >> where something like whereas the [48:26] planning board acknowledges that this will this may result in [48:32] additional.8 acres of disturbance [48:38] that comma period. However, the recovery plan is a form of [48:44] mitigation and the planning board finds it won't [48:49] result in a significant adverse impact. >> So, to be clear, um what's being [48:56] approved here is a phase three [49:01] » recovery plan >> plan. [49:04] So they >> a data recovery plan [49:06] » they are >> what what what is the scope of work [49:10] exactly that's entailed in that? Are they are they going to dig out the [49:13] entirety of that 8 acres? Are they doing >> a grid pattern? Right. They do a grid [49:18] pattern and they right they they dig [clears throat] up shovel holes every [49:22] » and to a point where I I for in my brain I recall that there might be some [49:27] percentage that they have to dig up 60% or whatever may have been there and [49:34] collect it. Um and then there's a whole process of cataloging it [49:39] » putting it in a museum etc etc. But but so it's an archaeological in [49:45] investigation but there is disturbance. So that's I'm just [49:48] » right entire it's across8 acres >> but it's not entire acres I don't [49:56] » well >> the way this whereas is written [49:59] » there's this whereas in here in order to evaluate the impacts of the project [50:03] changes in the approximately 6 and2 acre pre-cond sites. [50:09] Uh Chipo requested that the applicant undertake a phase three recovery plan [50:12] which involves physical digging on the property which implies to me that they [50:15] could still say they could do they they're digging out like samples [50:20] essentially and then Chipo could say nope too valuable stop and don't do [50:25] anymore. Right? Is that is that accurate >> in theory? Yeah. I was just reacting to [50:29] the the phrase you just used involves physical digging of the property. So I [50:34] just want to say somehow that you know the planning board acknowledges [50:38] um that there's some dis some limited disturbance however [50:44] » I like that term >> some limited disturbance however this [50:48] isn't considered significant >> you know is not a significant [50:53] » adverse impact >> that's good [50:55] » and and the planning board otherwise affirms its prior seeker determination [51:00] » yeah get that Henry [laughter] Maybe [51:04] too >> and it is temp is just temporary. They [51:08] dig it up and then they put it back. >> Yeah, they usually Yeah, they they put [51:11] it back. >> Well, but I think they're doing this [51:13] because they want to put buildings on it. [51:15] » Well, that but that comes that when that will be that's going to be a separate [51:19] plan when they disturb it. They have to investigate first and then to disturb [51:24] » later. >> Exactly. [51:25] » Well, no, they're disturbing now. >> They don't have authority. You can't we [51:29] can't even consider that area >> allows Shipo to continue. [51:33] » Correct. >> Yes. [51:33] » Correct. >> Correct. [51:36] » Yes. This this doesn't this does not decide one way or the other whether or [51:40] not the land can be usable >> for for any kind of development. [51:44] » Right. They have an application into Shipo that's something separate whether [51:48] they're going to authorize it. >> I saw a project that actually had to do [51:51] that. Um, and you know, they didn't find anything, but [51:56] they they did these little they went out like with little tools. [52:00] » Yeah, >> it was [laughter] very funny. It was an [52:02] archaeological dig. It was >> fascinating. [52:03] » It was a full scale, but you know, they took out, you know, a quart of dirt [52:08] [laughter] >> every five feet. [52:11] » I I just I know of one that was really significant, phase three. And these [52:15] things, if they find stuff, >> they're going to have to keep digging. [52:18] » Yeah. Yeah. So, but we don't know at this point. [52:21] » Correct. So I think we just acknowledge that there's some disturbance. [52:24] » I think but that it's >> I like what you had said there. [52:27] » Yeah. >> That we do acknowledge that there will [52:29] be disturbance. >> Yep. [52:31] » Thank you, Bonnie. >> Thank you. [52:34] » That was my comment. >> Excellent. [52:40] » And Henry, when you do have it written, what we tend to do is we read it up to a [52:44] point and then we point to you and you can read the part that you just wrote. [52:52] A lot of pressure, honey. [laughter] [52:58] » That's cooling. Going to work now. [53:03] Baptism by fire. [laughter] >> Used to ride my motorcycle back there. I [53:08] lost a pair of riding goggles. Maybe they'll find them. [laughter] [53:14] » And you know what? Depending on how old and how old you are, they might find [53:17] them to be archaeologically significant. [53:24] » Yeah, [laughter] [53:29] » I think it's worse for you today because they're just afraid to speak one [53:39] of >> Yes. Yes. I think that would be lovely. [53:42] Whereas the planning board acknowledges that the data recovery plan may result [53:45] in limited disturbance that will not result in a significant environmental [53:49] impact. and has determined [53:52] » that this disturbance will not result in a significant environmental [53:57] impact [54:02] but has determined [54:08] that the disturbance will not result in a significant [54:12] environmental impact. >> That sounds good. Try one more time. [54:17] Whereas the planning board acknowledges that the data recovery plan may result [54:20] in limited disturbance but has determined that the disturbance will not [54:24] result in a significant environmental impact.
