If you want to sign up to speak, please do so. Um, 98 00:07:44,595 --> 00:07:48,455 before we get to the end, we will do both ordinances one at a time. 99 00:07:49,315 --> 00:07:53,255 um, and do me a favor and tell me if you're speaking, uh, for or against when 100 00:07:53,535 --> 00:07:57,355 you come up. Um, and we will take it in that way. So, um, 101 00:07:58,535 --> 00:08:02,435 hearings. Thank you madam clerk. If you'll join us and you 102 00:08:02,555 --> 00:08:06,435 get to sit next to our wonderful county executive here while you speak, make sure you please speak 103 00:08:06,675 --> 00:08:10,595 in, uh, speaking to the microphone, um, and make sure that 104 00:08:10,775 --> 00:08:14,755 it is on and ready to go so that we can, uh, have those 105 00:08:14,995 --> 00:08:18,855 who are listening online, also hear the legislation or 106 00:08:19,075 --> 00:08:22,995 let hear your testimony. Uh, so at this time, the kind of legislature will hold a 107 00:08:23,115 --> 00:08:26,755 public hearing on ordinance 60 50 prohibiting law enforcement officers from concealing 108 00:08:27,155 --> 00:08:30,515 their faces or badges during performance of their official duties and establishing 109 00:08:31,235 --> 00:08:34,595 penalties and exemptions. We will also then hear on ordinance 6 0 6 1 110 00:08:35,835 --> 00:08:39,595 prohibiting all permits and zoning approvals for non county or municipal government owned detention 111 00:08:40,125 --> 00:08:43,855 facilities. So first we will start with 60 50. We 112 00:08:44,275 --> 00:08:47,115 have before us, um, ms. Ingrid 113 00:08:48,285 --> 00:08:51,495 flags poller, I'm sorry, when I butcher your names. So, uh, 114 00:08:52,755 --> 00:08:56,685 ingrid, if you'll join us, um, question on process. Yes, mr. Chair. Uh, we need 115 00:08:56,805 --> 00:09:00,715 to have them sworn in that, um, I was also gonna ask, 116 00:09:01,195 --> 00:09:04,995 are we, um, gonna hear from somebody in favor of and 117 00:09:05,215 --> 00:09:09,175 then opposed to kind of go back and forth? Unfortunately, I don't have that information in front of me 118 00:09:09,295 --> 00:09:13,155 to do that. So we're just gonna read straight down the list and speaking to process. Yep. 119 00:09:13,515 --> 00:09:17,335 is there a time limit? Um, yeah. We'll 120 00:09:17,615 --> 00:09:21,575 do two minute times and I'll ask that, uh, clerk, if you, one of the clerk staff 121 00:09:21,855 --> 00:09:25,715 will execute a timer for us, please. And are we going to 122 00:09:26,285 --> 00:09:30,135 request that people not be repetitive if the same testimonies already been provided? 123 00:09:30,995 --> 00:09:34,965 uh, I'll let people say what they want for their two minutes. Um, so that's what I'll, I'll 124 00:09:35,255 --> 00:09:39,035 stick to there. Ah, thank you mr. Executive. Um, 125 00:09:40,435 --> 00:09:43,945 so with that said, uh, clerk's office, you all good with the timer? 126 00:09:45,355 --> 00:09:49,255 two minutes. Uh, and again, if you will, when you stand up to join us, 127 00:09:49,635 --> 00:09:53,345 um, madam clerk, can we call those who are gonna testify and swear 128 00:09:53,815 --> 00:09:57,815 'em in, I guess? Okay. So that we have that official process 129 00:09:58,115 --> 00:10:01,735 as well. So if you plan to testify today on ordinance 60 50 or 60 61, 130 00:10:02,495 --> 00:10:03,935 please stand up and raise your right hand. 131 00:10:08,915 --> 00:10:12,895 do you swear under the penalty of perjury that the testimony you're about to give in the matter and issue is 132 00:10:13,055 --> 00:10:16,935 the truth, the whole truth, and nothing but the truth? So help me. God. 133 00:10:18,105 --> 00:10:22,025 thank you all. All right, well, welcome up ingrid flags. Poer glass 134 00:10:22,485 --> 00:10:25,735 poer. Sorry if I'm mispronouncing that. Is there an ingrid? 135 00:10:30,155 --> 00:10:32,035 all right, we'll move on to charlotte turgen. 136 00:10:39,285 --> 00:10:43,015 no, charlotte. All right. Beverly harvey. This 137 00:10:43,305 --> 00:10:47,145 is fun. . Okay, I'm sorry. Which 138 00:10:47,385 --> 00:10:50,975 one is this one? . So 60 50 is the mask, 139 00:10:51,445 --> 00:10:55,325 uh, ordinance. Mask, yep. You wanted me to tell where I'm 140 00:10:55,545 --> 00:10:59,105 from? Yeah, just tell, yeah. If you join us here at the testifying witnesses 141 00:10:59,735 --> 00:11:02,885 side and tell us at least where, what city you're, you reside in. 142 00:11:04,735 --> 00:11:08,705 yeah. And what's your name? Beverly harvey. I'm with 143 00:11:08,935 --> 00:11:11,575 indivisible, uh, here in kansas city. 144 00:11:14,025 --> 00:11:17,565 and probably if I didn't tell you who I was, you wouldn't know, 145 00:11:18,255 --> 00:11:22,115 right? You wouldn't know who prove the point. Why? Because 146 00:11:22,625 --> 00:11:25,485 I'm word enough. We can't even, speaking of the, 147 00:11:28,405 --> 00:11:32,385 I just wanted to prove a point there that when people wear a mask, you can't tell who 148 00:11:32,605 --> 00:11:36,405 they are. All right. So the only people 149 00:11:36,625 --> 00:11:40,525 who wear masks are people who are committing crimes who do not want to be identified. 150 00:11:41,225 --> 00:11:45,005 let me repeat. The only people who wear masks are people who are committing 151 00:11:45,405 --> 00:11:49,325 crimes who do not want to be identified. Why do they not want to be identified? 152 00:11:49,645 --> 00:11:53,545 because they know or they are committing a crime. Trump has created an 153 00:11:53,765 --> 00:11:57,245 armed gestapo. He's doing exactly what hitler did in the 1930s. 154 00:11:58,315 --> 00:12:01,965 pick an enemy and blame them for everything that is wrong or bad. That is called scapegoating. 155 00:12:03,055 --> 00:12:07,045 after world war ii, hitler began to blame the jews for after world 156 00:12:07,345 --> 00:12:11,185 war I. Hitler began to blame the jews for the economic and 157 00:12:11,485 --> 00:12:15,465 political problems that of the day. And we all know how that turned out. We 158 00:12:15,685 --> 00:12:19,625 all know that illegal immigrants make up a very small number of the population, and 159 00:12:19,845 --> 00:12:23,785 even a smaller number of illegal aliens are criminals. So we all 160 00:12:24,005 --> 00:12:27,525 know that is an excuse to blame and create hate. Here we are 161 00:12:28,125 --> 00:12:32,005 debating on whether a gestapo should or should not wear a mask. What we should 162 00:12:32,245 --> 00:12:36,155 be talking about is why we are even allowing ice trump's gestapo 163 00:12:36,755 --> 00:12:40,735 into our cities. We've all seen the horror of what ice agents bring. 164 00:12:41,435 --> 00:12:45,405 they murder people, they beat people up, they maim them, they spray pepper spray them, 165 00:12:45,565 --> 00:12:49,435 they tear gas them. They harass american citizens. They 166 00:12:49,725 --> 00:12:53,565 illegally enter people's homes and businesses, and they kidnap children and their 167 00:12:53,765 --> 00:12:57,285 parents. They ship them off. God knows where. 168 00:12:57,785 --> 00:13:01,765 and then most recently dropped off an elderly blind man after he was 169 00:13:02,085 --> 00:13:05,945 released from their custody, custody, who was not an illegal immigrant at 170 00:13:06,205 --> 00:13:10,085 a location far from his home, late at night, at a location that was closed, 171 00:13:10,465 --> 00:13:14,245 and then lied about it later because the man was found dead soon after being dropped 172 00:13:14,625 --> 00:13:18,485 off. So why should ice agents not wear masks? The question should 173 00:13:18,805 --> 00:13:22,135 be why are we allowing the gestapo in our city? Let's be real. Immigrants 174 00:13:23,225 --> 00:13:27,125 are not the problem. Trump and the gestapo are the people who support 175 00:13:27,525 --> 00:13:31,355 trump are the problem. People have been brainwashed by fox news and others. They 176 00:13:31,645 --> 00:13:35,605 feed lies to the american public. Trump is a monster. He lies, he cheats, he steals. 177 00:13:36,385 --> 00:13:40,205 he is a racist, a misogynist, a pedophile. He is the best example of what 178 00:13:40,405 --> 00:13:44,325 the most horrific human can be. We are all immigrants of this nation. 179 00:13:44,625 --> 00:13:48,525 unless you are native american, you are a descendant of an immigrant mr. Chair. 180 00:13:49,345 --> 00:13:53,155 if the city council allow ice trump's gestapo to wear masks, you are just as evil 181 00:13:53,445 --> 00:13:57,165 as he is. I should be banned from kansas city in the surrounding area. 182 00:13:57,595 --> 00:13:59,845 time limit. No respected. Thank you. 183 00:14:03,615 --> 00:14:06,415 we'll, welcome up claudia toman. 184 00:14:08,355 --> 00:14:08,935 claudia toman, 185 00:14:12,395 --> 00:14:16,375 please again, look out for the timer so we can stop you so I don't have to reign 186 00:14:16,815 --> 00:14:20,815 everyone in, please. Okay. Are you 187 00:14:21,055 --> 00:14:24,535 starting it? Tell me when to start as soon as you start off. Yep. Clock. 188 00:14:25,715 --> 00:14:29,655 um, well, somebody needs 189 00:14:29,935 --> 00:14:33,695 to say something about, um, all the lies that we just heard because we were, 190 00:14:34,155 --> 00:14:38,155 we swore to tell the truth, the whole truth, and nothing but the truth. But in fact, can 191 00:14:38,375 --> 00:14:41,975 you tell us what city you're from? Oh, I'm sorry. Kansas city, missouri. Thank you. 192 00:14:42,715 --> 00:14:46,595 um, much of what, uh, the, the young lady who just spoke was 193 00:14:46,815 --> 00:14:50,735 a lie, especially what she said about donald trump. And, and I take exception to 194 00:14:50,855 --> 00:14:54,505 it. But here, we're here to talk about the mass. And 195 00:14:55,025 --> 00:14:58,685 one of the other things she said that was in fact correct, is that the pe people 196 00:14:59,145 --> 00:15:03,025 who are committing crimes and don't want anyone to know who they are, are 197 00:15:03,525 --> 00:15:07,305 criminals. And during the biden administration, during the pandemic, we 198 00:15:07,625 --> 00:15:11,205 saw, um, hundreds of people, if not thousands, 199 00:15:11,695 --> 00:15:15,215 committing crimes all over the country and wearing masks. 200 00:15:16,035 --> 00:15:19,705 they were wearing masks, supposedly because there was a pandemic. But anyone 201 00:15:20,125 --> 00:15:23,885 who knows anything about biology knows that you don't get a virus 202 00:15:24,315 --> 00:15:27,965 from being outside in the open air in, uh, a 203 00:15:28,595 --> 00:15:32,145 dispersed, um, area. You get that when you're, uh, 204 00:15:33,185 --> 00:15:37,025 in, uh, small areas when, when you're, uh, 205 00:15:37,305 --> 00:15:40,125 in densely populated areas and closed environments. 206 00:15:41,905 --> 00:15:45,775 um, but they have created, particularly during 207 00:15:46,055 --> 00:15:49,075 the biden administration when, um, over two, 208 00:15:50,315 --> 00:15:54,215 uh, over 25 million people were led into this 209 00:15:54,375 --> 00:15:58,055 country, and in fact, encouraged to come into this country and sometimes even 210 00:15:58,545 --> 00:16:02,495 flown into this country and around this country by our government, 211 00:16:03,815 --> 00:16:06,995 supposedly our government, although clearly it's not. Um, 212 00:16:08,355 --> 00:16:11,875 and they were given all kinds of advantages. And 213 00:16:12,885 --> 00:16:16,145 basically what was done was that we admitted the enemy 214 00:16:16,925 --> 00:16:20,835 into our homes. And it is, and now 215 00:16:21,275 --> 00:16:25,195 the government is trying to rectify the situation and 216 00:16:25,435 --> 00:16:29,265 get the invading army out. These are murderers, these are pedophiles. 217 00:16:29,985 --> 00:16:33,495 these are horrible, horrible, many of them horrible, horrible people. 218 00:16:34,205 --> 00:16:38,055 they are, are gangs and, uh, they raped and murdered 219 00:16:39,525 --> 00:16:43,335 time. Okay, margaret, 220 00:16:44,275 --> 00:16:48,125 how, how this, 221 00:16:49,365 --> 00:16:50,955 okay. Thank you. Yep. 222 00:16:55,995 --> 00:16:59,875 my name is margaret. How I live in mission, kansas. I'm 223 00:17:00,095 --> 00:17:03,465 here to speak today as a resident of the greater kansas city metro. 224 00:17:04,595 --> 00:17:08,475 I'm speaking to advocate for banning face masks on 225 00:17:08,795 --> 00:17:12,695 ice agents and anyone who enforces laws. No one, 226 00:17:13,045 --> 00:17:16,745 even criminals, who, by the way, are supposed to be innocent until 227 00:17:17,095 --> 00:17:20,775 proven guilty, should be confronted and detained 228 00:17:21,155 --> 00:17:24,895 by someone wearing military gear, carrying a gun, and wearing 229 00:17:25,485 --> 00:17:29,215 face covering. How are we to know any of us 230 00:17:29,915 --> 00:17:33,295 if we're being lawfully detained, if they cannot be identified? 231 00:17:34,195 --> 00:17:38,015 is this a kidnapper, a law officer, someone else 232 00:17:39,195 --> 00:17:43,125 please vote to require ice agents to bear their faces, wear 233 00:17:43,855 --> 00:17:47,495 identification, and clearly define who they are and who they 234 00:17:48,095 --> 00:17:50,005 represent. Thank you very much. 235 00:17:56,855 --> 00:18:00,765 thank you for the clapping. I I wanna reign that in as well so that we can keep things moving as quickly as we 236 00:18:00,885 --> 00:18:02,285 can. Uh, dennis roland, 237 00:18:06,985 --> 00:18:10,875 good afternoon. My name is dennis roland. I'm a resident of 238 00:18:11,035 --> 00:18:14,935 jackson county in specifically kansas city, and in 239 00:18:15,155 --> 00:18:19,015 particular on addressing 6 0 5 oh, I, um, 240 00:18:19,515 --> 00:18:23,235 I like to offer a different perspective. Uh, I do support the, uh, uh, 241 00:18:23,625 --> 00:18:27,375 intention of, uh, banning mask in, uh, as 242 00:18:27,775 --> 00:18:31,415 the ordinance provides that, uh, during, 243 00:18:32,415 --> 00:18:35,705 uh, uh, performance of their official duties. However, 244 00:18:36,475 --> 00:18:39,635 I believe that the ordinance is problematic, at least as drafted, 245 00:18:40,655 --> 00:18:43,955 um, while I support the premises and goals. 246 00:18:45,095 --> 00:18:49,025 uh, the, uh, um, 247 00:18:50,555 --> 00:18:54,325 there's no language contained in either proposed ordinance in either 248 00:18:54,585 --> 00:18:58,465 in the ordinance itself that, uh, is, 249 00:18:58,745 --> 00:19:02,565 uh, where will it be codified, for example. And these are 250 00:19:02,815 --> 00:19:06,765 minor issues, and what code number will it be, uh, issued? And in 251 00:19:06,985 --> 00:19:10,905 6 0 5 oh, uh, has no language which provides for 252 00:19:11,185 --> 00:19:15,035 any financial penal punishment for, uh, the ordinance 253 00:19:16,045 --> 00:19:19,925 specifically says the purpose is to provide punishment, but the ordinance itself doesn't 254 00:19:20,285 --> 00:19:23,885 have it. That language in there, uh, there's no effective date 255 00:19:24,665 --> 00:19:27,625 of the, uh, second, whereas the purpose, uh, 256 00:19:29,105 --> 00:19:32,995 of concealing identities, unless a valid exemption applies, there's basically 257 00:19:33,705 --> 00:19:37,245 no definition of a valid exemption other than what you put in the ordinance. 258 00:19:38,385 --> 00:19:38,385 uh, 259 00:19:43,375 --> 00:19:44,015 the, uh, 260 00:19:47,605 --> 00:19:51,515 exemptions that you've, uh, applied seem to be 261 00:19:51,875 --> 00:19:55,205 limiting. So I believe it should, uh, contain language, which, 262 00:19:55,935 --> 00:19:59,185 uh, includes other 263 00:20:00,375 --> 00:20:02,965 potential, uh, incidents. And 264 00:20:05,405 --> 00:20:09,305 the other section where it says written documentation, I believe is 265 00:20:09,535 --> 00:20:13,025 also problematic time. Thank you, sir. 266 00:20:13,965 --> 00:20:17,865 um, well, one last comment. Uh, with all due respect, the ordinance 267 00:20:18,265 --> 00:20:22,065 hasn't been signed by the county counselor. It shouldn't even be up for consideration, 268 00:20:22,805 --> 00:20:26,265 but I do. Thank you, sir. I do support. Thank you. That's the time. Thank you. 269 00:20:26,825 --> 00:20:30,405 I do support the premise kenda to 270 00:20:30,935 --> 00:20:34,365 mcclain. Sorry if I'm missing the mispronouncing 271 00:20:35,165 --> 00:20:36,285 names here. Beautiful job 272 00:20:51,455 --> 00:20:54,865 for the record, it's ken toms mcclain. And I am opposed 273 00:20:55,535 --> 00:20:59,395 to this ordinance, our law enforcement city, sorry, tyler 274 00:20:59,705 --> 00:21:03,115 city, uh, kansas city, missouri jackson, jackson county. 275 00:21:03,925 --> 00:21:07,375 thank you. Uh, this ordinance is 276 00:21:08,015 --> 00:21:11,435 flawed in many respects, but predominantly law enforcement 277 00:21:12,335 --> 00:21:16,135 are allowed to wear masks when, if there are gas 278 00:21:16,355 --> 00:21:19,595 attacks, if there are other reasons. And these ice officers 279 00:21:20,775 --> 00:21:24,375 are simply doing a job. These laws are not new. 280 00:21:25,045 --> 00:21:28,865 these ice, these, uh, federal laws that they're enforcing have 281 00:21:29,155 --> 00:21:33,005 been around since many years, including under president obama. 282 00:21:33,495 --> 00:21:37,435 and they were used by him, president biden, many others. So this is nothing 283 00:21:37,735 --> 00:21:41,495 new. And therefore, the problem is 284 00:21:41,785 --> 00:21:44,925 that the anti-age ice protestors 285 00:21:45,855 --> 00:21:49,695 are using, if they see the face or 286 00:21:49,915 --> 00:21:53,905 if they see their badge number, they are doxing. These people, they are not only attacking 287 00:21:54,815 --> 00:21:58,715 the ice officers themselves, but they are going to their homes and causing 288 00:21:59,205 --> 00:22:03,045 disruption, and they're going into their children's schools and causing disruption. 289 00:22:04,175 --> 00:22:07,705 so it's a very dangerous job when they are simply enforcing 290 00:22:08,315 --> 00:22:12,155 federal law, which again, has been around a long time. 291 00:22:12,545 --> 00:22:16,285 this is nothing new. This is not the gestapo, this is a law en a valid 292 00:22:17,015 --> 00:22:20,665 law enforcement activity. These people are in the country illegally. 293 00:22:22,025 --> 00:22:25,995 they have been given a hearing. There's so that all of 294 00:22:26,115 --> 00:22:29,915 that is not disputed. These people have, the ice agents have a lawful reason 295 00:22:30,195 --> 00:22:33,825 to be in those communities, and they should not be fearing for their lives from 296 00:22:34,895 --> 00:22:38,595 all kinds of people that have nothing to do with the situation. 297 00:22:39,055 --> 00:22:42,825 so I would strongly urge you to vote against 298 00:22:43,465 --> 00:22:47,335 this. This is a very destructive thing. We do not want our law 299 00:22:47,555 --> 00:22:51,475 enforcement to be under attack by everyday citizens and people 300 00:22:51,985 --> 00:22:55,985 running into their community, near their homes and harassing them. That is totally 301 00:22:56,575 --> 00:23:00,355 unfair and bad. Thank you. Thank you. 302 00:23:00,945 --> 00:23:01,515 greg ellerman. 303 00:23:19,675 --> 00:23:23,485 thank you. My name is greg ellerman. I'm a, uh, 304 00:23:23,885 --> 00:23:27,825 I'm a resident, long-term resident of kansas city, missouri. I'm a retired 305 00:23:28,505 --> 00:23:32,245 clinical psychologist, and I'm in favor, I'm in favor of 306 00:23:32,705 --> 00:23:36,045 banning the wearing of masks in jackson county for 307 00:23:36,725 --> 00:23:39,735 law enforcement officers for the following reason. 308 00:23:42,015 --> 00:23:44,225 on the one hand, the mask officers are more anonymous, 309 00:23:46,735 --> 00:23:48,285 which can lead to less accountability 310 00:23:50,825 --> 00:23:54,755 and therefore greater aggression. On 311 00:23:54,975 --> 00:23:58,125 the other hand, the people may feel more dehumanized 312 00:24:00,165 --> 00:24:03,825 due to the masking, which also can lead to greater 313 00:24:04,245 --> 00:24:06,345 aggressiveness in response. 314 00:24:09,585 --> 00:24:13,245 in summary, in my opinion, masking of officers 315 00:24:14,545 --> 00:24:17,965 is likely related to greater chance of violence, 316 00:24:19,255 --> 00:24:22,785 whereas no masks is likely related 317 00:24:23,885 --> 00:24:27,745 to greater safety for officers and the 318 00:24:27,945 --> 00:24:29,505 people. Thank you. 319 00:24:35,935 --> 00:24:35,935 patricia parks. 320 00:24:44,925 --> 00:24:48,765 I'm patricia parks, a retired teacher from blue springs. And 321 00:24:49,145 --> 00:24:53,145 I was just coming and I wasn't going to speak, but then I thought, if I'm just sitting 322 00:24:53,385 --> 00:24:57,385 there, you won't know what I'm thinking. So here I am with nothing written down 323 00:24:57,725 --> 00:25:01,405 and I won't use two minutes. Everyone signed up to do that. But anyway, I'm 324 00:25:01,935 --> 00:25:05,745 very much against the mask for the reasons that a lot of people have already said here, 325 00:25:05,985 --> 00:25:09,455 and I don't need to go through 'em again. But I think it's very un-american 326 00:25:10,165 --> 00:25:14,065 for them to have these masks and hiding their identity. And besides that, 327 00:25:14,345 --> 00:25:18,205 they're poorly trained. I will add that, that's all I need to say. I'm 328 00:25:18,425 --> 00:25:19,065 definitely against it. 329 00:25:23,125 --> 00:25:23,415 joy rush. 330 00:25:32,825 --> 00:25:36,805 my name is joy rush. I live in blue springs, like patricia. I 331 00:25:36,925 --> 00:25:40,865 also didn't come prepared to speak. I have no prepared remarks. Um, 332 00:25:41,195 --> 00:25:45,085 however, I have been reading, and there is a lot of speaking 333 00:25:45,215 --> 00:25:48,905 about how we can't make a law in jackson county 334 00:25:49,515 --> 00:25:53,145 that supersedes what is federal law and the doxing 335 00:25:54,005 --> 00:25:57,755 situation. And in my humble opinion, even 336 00:25:58,225 --> 00:26:01,405 if the legislature would pass a resolution 337 00:26:02,905 --> 00:26:06,805 to forbid masks, which I would be in favor of, of the people 338 00:26:07,905 --> 00:26:11,725 of ice in jackson county, I think it's a 339 00:26:12,045 --> 00:26:14,675 symbolic thing that needs to be done. And the more 340 00:26:16,375 --> 00:26:19,755 government entities that do that symbol symbolism 341 00:26:20,875 --> 00:26:24,705 will make an effect at a nationwide level. And all 342 00:26:24,925 --> 00:26:28,635 of you gentlemen, ladies sitting here in the legislature, 343 00:26:30,385 --> 00:26:34,125 you all, none of you have on masks. You're all capable of being 344 00:26:34,575 --> 00:26:38,525 doxed. You're all capable of having somebody come to your house to do all 345 00:26:38,685 --> 00:26:42,165 these things that some of the people here mentioned previously. But you're here without 346 00:26:42,695 --> 00:26:46,625 masks. So why can't the people that we as 347 00:26:47,165 --> 00:26:50,765 taxpayers are paying to do the job of, and I'm not against 348 00:26:51,395 --> 00:26:54,765 enforcement, I'm just not for this type of enforcement. 349 00:26:55,465 --> 00:26:59,165 so I'm hoping you all will stand up and do, if nothing else 350 00:26:59,765 --> 00:27:03,685 symbolically say, jackson county is against 351 00:27:04,665 --> 00:27:07,245 masked men in our county. Thank you. 352 00:27:12,295 --> 00:27:13,245 david brock, urman, 353 00:27:24,445 --> 00:27:28,255 sorry about your name. Sure. I pronounced it. No, that's good enough. David broman. 354 00:27:28,775 --> 00:27:32,675 I'm, um, here in kansas city, missouri. Um, thanks for allowing us the 355 00:27:32,875 --> 00:27:36,585 opportunity to speak. Um, yeah, 356 00:27:37,105 --> 00:27:41,105 it's, you don't have to go very far 357 00:27:41,425 --> 00:27:44,385 to see, to find evidence of 358 00:27:46,495 --> 00:27:50,265 what a group of masked individuals, the effect that 359 00:27:50,505 --> 00:27:54,165 that has on a, on people in front of them. And, 360 00:27:54,565 --> 00:27:58,145 um, one of the primary 361 00:27:59,025 --> 00:28:02,835 purposes of law enforcement is to deescalate situations. 362 00:28:05,125 --> 00:28:06,735 and it seems that 363 00:28:09,655 --> 00:28:13,485 coming on a scene, take aside, 364 00:28:14,115 --> 00:28:17,525 I mean, setting aside extenuating circumstances or situations 365 00:28:18,215 --> 00:28:22,195 in which, um, clearly it might be necessary for law enforcement to 366 00:28:22,415 --> 00:28:26,135 use masks. Um, that's 367 00:28:26,555 --> 00:28:29,925 not what we're talking about. We're talking about these general, these large gatherings 368 00:28:30,595 --> 00:28:34,395 where, um, it seems that there's 369 00:28:34,995 --> 00:28:38,435 a default starting at an escalated point. 370 00:28:39,775 --> 00:28:41,035 and that tension, 371 00:28:43,795 --> 00:28:47,695 I mean, we see, we see the possibilities of what can happen and this, um, 372 00:28:48,865 --> 00:28:52,725 there's an opportunity here to stand 373 00:28:53,095 --> 00:28:56,835 up and do what we can to try and prevent 374 00:28:58,025 --> 00:29:01,375 bloodshed and violence in our cities that might be 375 00:29:02,055 --> 00:29:04,985 in our city, that could have possibly been avoided 376 00:29:06,465 --> 00:29:09,905 by, by a deescalated state. And, 377 00:29:11,595 --> 00:29:15,585 um, I don't 378 00:29:15,785 --> 00:29:19,605 think it takes a lot of common sense to see that. And I would echo our mayor's, um, 379 00:29:21,745 --> 00:29:25,705 sentiments on the detention center. I don't think we 380 00:29:25,865 --> 00:29:29,405 wanna be in the business of storing and shipping human beings 381 00:29:30,215 --> 00:29:33,875 time, especially in terrible situations. Thank you very much. Thank 382 00:29:34,225 --> 00:29:34,225 you 383 00:29:38,435 --> 00:29:39,265 sarah ferentz. 384 00:29:52,685 --> 00:29:56,015 um, my name is sarah farn and I live in kansas city, 385 00:29:56,985 --> 00:29:59,965 missouri. Um, I also am a college student. So, 386 00:30:01,445 --> 00:30:05,205 um, I wanna start off by pointing out how insane 387 00:30:06,245 --> 00:30:09,905 it is that we even have to be here today to try to do anything in our power 388 00:30:10,285 --> 00:30:13,825 to prevent mass individuals, um, in our, from terrorizing 389 00:30:14,525 --> 00:30:17,985 our community and our immigrant neighbors. Many times 390 00:30:19,125 --> 00:30:22,745 may I add without a warrant, it's right in front of our faces. Let's see it. 391 00:30:23,405 --> 00:30:27,305 um, when did it become okay to kidnap people without a warrant? If you're 392 00:30:27,545 --> 00:30:31,505 denying what is happening and can't realize that this is fascism, then I don't know what 393 00:30:31,665 --> 00:30:35,545 will. Um, the real criminals, pedophiles, and rapists 394 00:30:35,785 --> 00:30:37,285 are in the white house. Um, 395 00:30:40,205 --> 00:30:43,665 we must do everything in our power, um, to resist what is happening 396 00:30:44,485 --> 00:30:48,235 and the dismantling of our government. So I support banning masks 397 00:30:48,685 --> 00:30:52,345 for ice agents. The trump administration is destroying the country, 398 00:30:53,005 --> 00:30:56,855 and we must do anything in our power to show that what is happening is not okay. Even 399 00:30:57,305 --> 00:31:01,125 with ordinances like this. Um, even small things are 400 00:31:01,345 --> 00:31:05,345 making a point against fascism. Um, this is why I support banning, 401 00:31:05,805 --> 00:31:08,705 um, masks. Um, we must support the dem masking 402 00:31:10,005 --> 00:31:13,895 to show our humanity and our empathy for living, breathing 403 00:31:14,635 --> 00:31:18,485 human beings. This is beyond political, okay? So any 404 00:31:18,715 --> 00:31:22,665 small thing we can do to stand up and say, hey, this isn't okay, because we're 405 00:31:22,985 --> 00:31:26,865 all immigrants of this nation. If you're white, you weren't born here originally. You come from 406 00:31:27,345 --> 00:31:30,865 european immigrants. So I think we need to realize that. Thank you. 407 00:31:35,015 --> 00:31:35,545 antoine jennings. 408 00:31:45,975 --> 00:31:49,515 antoine jennings from blue springs, missouri. What about biden? 409 00:31:50,735 --> 00:31:54,625 this is not about biden. This is about where we are today in 2026. 410 00:31:55,965 --> 00:31:59,945 yes, president biden is retired. He's in delaware 411 00:32:00,185 --> 00:32:04,185 doing his thing. This is not about biden. This is not about obama. This is about 412 00:32:04,305 --> 00:32:08,185 donald trump. This is about this legislature. And the fact that the 413 00:32:08,345 --> 00:32:11,305 county executive is not sitting in here listening to these 414 00:32:12,605 --> 00:32:16,225 is because the county executive should be in here 415 00:32:16,885 --> 00:32:20,865 the end of the day. Whether not you vote on, he has to sign it, 416 00:32:22,065 --> 00:32:24,455 where is he? It's travesty. 417 00:32:26,535 --> 00:32:30,525 every single person's sitting up on there, you all voted into office, 418 00:32:31,405 --> 00:32:34,525 represent people. Whether or not this passes 419 00:32:35,435 --> 00:32:39,365 some court is immaterial. The simple 420 00:32:39,755 --> 00:32:43,565 fact of you passing this ordinance, it's gonna show the 421 00:32:43,765 --> 00:32:47,035 people that voted for you that you care about them. 422 00:32:48,355 --> 00:32:52,145 this is about the people. May I remind you, we, the 423 00:32:52,365 --> 00:32:55,325 people of the united states of america, a 424 00:32:58,435 --> 00:33:02,435 a more perfect union, every single one of you up there were, was elected 425 00:33:02,815 --> 00:33:05,635 for a reason. My expectation 426 00:33:07,075 --> 00:33:10,205 from my legislature, from my legislator who was not here, 427 00:33:11,745 --> 00:33:15,315 is that they would vote for because we 428 00:33:15,875 --> 00:33:17,455 the people, it, 429 00:33:20,205 --> 00:33:24,125 I don't see, uh, kansas city police department, independent police department, 430 00:33:25,305 --> 00:33:27,965 blue springs police department, we don't see them wearing masks. 431 00:33:29,525 --> 00:33:33,425 don't act like you care about children and about safety. When 432 00:33:33,715 --> 00:33:36,675 we have legislators getting killed and murdered at their 433 00:33:38,045 --> 00:33:41,915 homes, don't act like you care. What about humanity? 434 00:33:43,415 --> 00:33:47,305 this is not, this is not about democrat or republican. This is about humanity. 435 00:33:47,855 --> 00:33:49,745 this is not about documented undocumented. 436 00:34:01,445 --> 00:34:05,265 we rolled through two individuals at the beginning of this. I just wanna make sure if they are here 437 00:34:05,465 --> 00:34:09,085 and they did wanna speak, they have that opportunity. Ingrid fla poller, 438 00:34:10,525 --> 00:34:14,305 mr. Chairman, we have a video of this proceeding 439 00:34:15,205 --> 00:34:18,545 out here, so I was able to watch everything. I'm watching everybody's 440 00:34:19,305 --> 00:34:23,285 testimony, so thank you. Thank you for your comment, but I need to see you. You 441 00:34:23,505 --> 00:34:27,505 got, you got me. I need to see you. You got it. Because you work for me. I need to see you. 442 00:34:27,585 --> 00:34:31,425 you do. All right. Charlotte turin, just making 443 00:34:31,705 --> 00:34:35,445 sure. Okay. Anyone else that wants to speak on behalf of 444 00:34:36,275 --> 00:34:40,135 50 60? Okay. If you would sign in there. Um, and then just 445 00:34:40,425 --> 00:34:42,585 tell us your name and your city, um, as you, 446 00:34:44,605 --> 00:34:47,305 uh, you all, I think were here when you, when everyone was sworn in, correct? 447 00:34:49,385 --> 00:34:50,645 everyone was sworn in. Yes, sir. Yep. 448 00:34:56,045 --> 00:34:59,185 is kind my guess in the order that you've stood up there, please. 449 00:35:14,815 --> 00:35:18,795 all right. So just tell us your name, the city, and then go for it for you. Certainly. My name is rebecca 450 00:35:19,385 --> 00:35:22,955 oman. I live in kansas city, missouri. I would like to read a few statements 451 00:35:24,305 --> 00:35:27,245 from a recent court, um, settlement 452 00:35:29,015 --> 00:35:32,625 by, sorry. Federal 453 00:35:33,205 --> 00:35:36,915 judge joseph goodwin. The founders 454 00:35:37,565 --> 00:35:41,565 recognize that freedom is imperiled not only when government actions lack legal 455 00:35:42,035 --> 00:35:45,925 justification, but also when those actions are carried out by 456 00:35:46,125 --> 00:35:49,685 agents whose authority is unchecked and whose actions cannot 457 00:35:50,185 --> 00:35:54,155 be traced. When officers can wear a mask, fail 458 00:35:54,445 --> 00:35:58,405 to verify their credentials, refuse to disclose their names, 459 00:35:59,225 --> 00:36:02,885 arrive in unmarked vehicle and neglect to provide 460 00:36:03,405 --> 00:36:06,325 a justification for their seizure of an individual. 461 00:36:07,625 --> 00:36:11,625 the constitutional protection that the framers envisioned has not 462 00:36:11,845 --> 00:36:14,635 just been corroded, it has been eviscerated. 463 00:36:16,075 --> 00:36:20,035 when officers can conceal their identity, the system effectively 464 00:36:21,325 --> 00:36:25,185 collapses. Individuals lack the information necessary to 465 00:36:25,405 --> 00:36:29,305 report misconduct for meaningful judicial review or 466 00:36:29,885 --> 00:36:33,515 internal investigation. Officers are thereby 467 00:36:34,325 --> 00:36:38,185 emboldened to exercise their power in an arbitrary and 468 00:36:38,405 --> 00:36:41,395 oppressive manner, and public trust is decimated. 469 00:36:44,075 --> 00:36:47,925 then he addresses imposters, who could just randomly pick people up 470 00:36:48,185 --> 00:36:52,035 off the street. Mask does 471 00:36:52,345 --> 00:36:56,205 one thing. It hides the face of the officer wearing it on a public 472 00:36:56,445 --> 00:37:00,045 highway, and a civil arrest of a person suspected of no crime. 473 00:37:01,065 --> 00:37:04,725 the only purpose served by hiding the officer's face is to prevent 474 00:37:05,085 --> 00:37:08,905 his identification and preventing identification serves 475 00:37:09,395 --> 00:37:13,075 only to eliminate accountability. A law enforcement 476 00:37:14,165 --> 00:37:17,965 practice whose sole operational effect is the elimination of accountability 477 00:37:19,265 --> 00:37:22,325 is not a safety measure. It is a constitutional deficiency 478 00:37:23,595 --> 00:37:27,305 wearing the name of one, and it goes on and on. 479 00:37:33,905 --> 00:37:37,445 and forgive me if this is not in the right order here. So is ashley morgan 480 00:37:38,195 --> 00:37:40,195 next, sir. Okay. 481 00:37:46,025 --> 00:37:49,255 thank you for oh, ashley morgan lee summit missouri. 482 00:37:50,545 --> 00:37:53,895 thank you for the opportunity to speak. I'm here to state my strong support 483 00:37:54,595 --> 00:37:58,245 for the jackson county mask ban. My position is informed both 484 00:37:58,795 --> 00:38:02,375 as, uh, by my work as an attorney, and by my lived experience as a woman. 485 00:38:03,255 --> 00:38:06,135 I understand professionally and personally how critically 486 00:38:07,455 --> 00:38:11,445 critical, uh, visibility and identifiability are to public safety. When 487 00:38:11,735 --> 00:38:15,415 individuals fully conceal their faces in public, it heightens the vulnerability 488 00:38:16,085 --> 00:38:19,655 that women already navigate every day. It is essential to 489 00:38:20,095 --> 00:38:23,775 remember that being unmasked has long been the standard on expected and public 490 00:38:24,125 --> 00:38:27,975 life. For many years, even ice officers conducted public 491 00:38:28,385 --> 00:38:32,175 operations without covering their faces. The recent 492 00:38:32,445 --> 00:38:36,365 move away from that transparency is a sharp break from established practice and 493 00:38:36,565 --> 00:38:40,555 has created real risks. We are now seeing individuals in this area attempt 494 00:38:41,045 --> 00:38:45,035 to impersonate law enforcement, including federal agents to intimidate harm 495 00:38:45,505 --> 00:38:49,305 and abduct women. When faces are hidden, the public has no reliable way 496 00:38:49,525 --> 00:38:53,405 to distinguish legitimate authority from those who intend to exploit it. 497 00:38:54,205 --> 00:38:58,205 I do support law enforcement. I do not support them being masked. This is 498 00:38:58,325 --> 00:39:02,225 not a theoretical concern. It is a direct threat to public safety, allowing people to 499 00:39:02,445 --> 00:39:05,995 obscure their identity without cause. Undermines accountability, invites 500 00:39:06,495 --> 00:39:10,075 abuse and creates opportunities for bad actors to operate without consequence. 501 00:39:11,015 --> 00:39:14,645 women in particular bear the brunt of that danger. The proposed mass 502 00:39:15,085 --> 00:39:18,315 ban does not impose a new bo burden. It restores a longstanding norm, 503 00:39:19,145 --> 00:39:23,025 one that supports safety, accountability, and trust in our public shared 504 00:39:23,545 --> 00:39:27,435 spaces. Visible identifiable presence is a basic expectation 505 00:39:28,125 --> 00:39:32,005 in any community that values order and public confidence. For these 506 00:39:32,165 --> 00:39:36,045 reasons, I strongly urge you firmly and without my reservation to support 507 00:39:36,625 --> 00:39:40,165 the mask, ban and uphold the principles of transparency and safety that our communities 508 00:39:40,685 --> 00:39:41,645 depend on. Thank you, 509 00:39:50,795 --> 00:39:54,125 paul. Sir. Thank you . 510 00:39:58,425 --> 00:40:02,245 mr. Chairman, members board, thank you for, uh, uh, allowing me to speak. Paul salvi, 511 00:40:02,485 --> 00:40:06,405 south kansas city, a rise in opposition to the band measure. Uh, the reason 512 00:40:06,605 --> 00:40:10,405 I rise in opposition. Why are they wearing masks? Well, they're under a force protection measure. They're 513 00:40:10,685 --> 00:40:14,665 under clear and present danger from insurgents dallas sniper attack on 514 00:40:15,005 --> 00:40:18,045 'em. They're using vehicle ramming on these agents, on these police officers. 515 00:40:19,065 --> 00:40:23,005 that's why they're wearing masks. Secondly, in the army, when we staff an action and regulation, 516 00:40:23,525 --> 00:40:27,245 that staffing action has to go through a concurrence, non concurrence. And a comment. 517 00:40:28,145 --> 00:40:32,085 my question is, has this ordinance been through the jttf, the us attorney for 518 00:40:32,285 --> 00:40:36,185 the western district of missouri, the sheriff's department, the chief of police at 519 00:40:36,405 --> 00:40:40,285 the kansas city police department, us marshals and special agent in charge of the fbi, because 520 00:40:40,695 --> 00:40:44,485 those coalition forces have to know what this ordinance means. 521 00:40:44,925 --> 00:40:48,925 secondly, what's the rules of engagement? If a deputy from sheriff forte comes up on 522 00:40:49,165 --> 00:40:52,885 a, uh, uh, federal police officer in the middle of a mission, is he gonna use deadly 523 00:40:53,245 --> 00:40:56,765 force? They're both armed, highly trained, uh, quality weapon systems. 524 00:40:58,125 --> 00:41:01,915 I know you're shaking your head, but I've seen it happen overseas. When coalition forces have 525 00:41:02,265 --> 00:41:05,885 an adverse effect, will this turn a coalition 526 00:41:06,495 --> 00:41:10,445 force of, uh, cooperation between law enforcement into adversarial, uh, condition? 527 00:41:11,795 --> 00:41:15,625 and then finally, I would just close with, um, if you guys pass this, 528 00:41:15,965 --> 00:41:19,865 uh, both these ordinances, will you go on record to guarantee that any american 529 00:41:19,985 --> 00:41:23,985 citizen, whether they live in jackson county or visit, will not be harmed or 530 00:41:24,105 --> 00:41:26,665 killed by an illegal criminal alien. Thank you for your time, 531 00:41:33,435 --> 00:41:34,345 deborah par, 532 00:41:38,265 --> 00:41:40,015 sorry to have you go up and down. 533 00:41:52,255 --> 00:41:56,195 my name is deborah par and I live in kansas city, missouri. 534 00:41:57,375 --> 00:42:00,875 and if I was approached by these people in totally 535 00:42:01,845 --> 00:42:05,235 black outfits masked with no identification, 536 00:42:06,755 --> 00:42:10,405 I would think I was being kidnapped. And I would either try to fight 537 00:42:11,055 --> 00:42:14,895 or run. And this has happened to many of the 538 00:42:15,115 --> 00:42:18,715 people. Ice is nothing but trump's private 539 00:42:19,385 --> 00:42:22,865 army, and they are like 540 00:42:23,415 --> 00:42:27,095 the brown shirts of hitler. But hitler's brown shirts 541 00:42:27,735 --> 00:42:30,865 did not wear masks, and they wore in uniform. 542 00:42:32,335 --> 00:42:35,205 and the people, they are arresting illegal immigrants. 543 00:42:36,385 --> 00:42:40,255 it's a mist of being to be in this country, not 544 00:42:40,875 --> 00:42:44,755 a felony. And many of these people have lived here 545 00:42:45,095 --> 00:42:48,765 for years and years, and they have paid taxes. 546 00:42:50,025 --> 00:42:53,895 they have paid social security, which they will never get 547 00:42:54,345 --> 00:42:58,255 back, but they are keeping social security to 548 00:42:58,475 --> 00:43:01,665 be functional. I totally support 549 00:43:02,595 --> 00:43:04,635 banning masks. Thank you. 550 00:43:12,815 --> 00:43:13,255 shelly rogers. 551 00:43:24,895 --> 00:43:27,305 hi, my name is shelly rogers. I live in pleasant hill, 552 00:43:29,135 --> 00:43:32,635 and I'm, I'm here because I, 553 00:43:33,535 --> 00:43:36,925 the idea of masked men is petrifying. 554 00:43:38,435 --> 00:43:41,485 I have never thought about needing to carry 555 00:43:43,015 --> 00:43:46,635 or be armed until I started seeing our government running around 556 00:43:47,845 --> 00:43:51,825 fully masked where, like, how beverly 557 00:43:52,685 --> 00:43:56,535 first introduced you did not, you couldn't see anything of 558 00:43:56,775 --> 00:44:00,735 her. The idea, I was just seeing, thank goodness we 559 00:44:00,955 --> 00:44:04,915 have people recording because we get to actually control the 560 00:44:05,115 --> 00:44:08,655 narrative when we are recording and we've watched plenty 561 00:44:09,175 --> 00:44:12,675 of people getting kidnapped, no identifying information, 562 00:44:13,415 --> 00:44:17,275 and they go into a car and there are people that are still not being 563 00:44:17,705 --> 00:44:21,455 located. That the idea of being snatched by an 564 00:44:22,555 --> 00:44:25,525 a masked group of people is petrifying 565 00:44:27,055 --> 00:44:30,755 and does not make us safe. It, it literally makes me want to 566 00:44:31,145 --> 00:44:35,005 be armed. Just the idea of our government just being able to snatch 567 00:44:35,325 --> 00:44:38,845 people up with no rhyme or reason and just because 568 00:44:41,745 --> 00:44:44,795 we don't like trump or whatever, it's just, it's, 569 00:44:48,115 --> 00:44:51,905 it's so un-american. It's absolutely un-american to, 570 00:44:52,265 --> 00:44:55,795 uh, just keep us fearful 571 00:44:56,985 --> 00:45:00,765 of our own government. I don't, I don't fear the immigrants. I, 572 00:45:01,005 --> 00:45:04,125 I fear my government. That's who I fear is my government. 573 00:45:05,105 --> 00:45:08,945 you know, if I could get my passport and go to a country that actually gives us 574 00:45:09,265 --> 00:45:13,205 rights, that actually looks at us as human beings instead of caring 575 00:45:13,515 --> 00:45:16,685 more about what billionaires care about, you know, 576 00:45:17,565 --> 00:45:20,615 I don't know. I'd like to see america be great again, 577 00:45:22,265 --> 00:45:24,085 but ain't gonna be, well we got trump. 578 00:45:29,925 --> 00:45:33,805 benjamin rosler did you say benjamin? 579 00:45:34,065 --> 00:45:34,065 yep. 580 00:45:41,985 --> 00:45:45,695 thank you for having this public hearing for the citizens. My name's benjamin 581 00:45:46,055 --> 00:45:49,775 resler. I live in the historic northeast kansas city in a neighborhood called pendleton 582 00:45:50,255 --> 00:45:53,815 heights. There's a reason that these hearings are held in public because 583 00:45:54,755 --> 00:45:58,515 the business of government is supposed to be done in the sunlight. Uh, 584 00:45:58,915 --> 00:46:02,895 and it's for that reason that we're asking that law enforcement identify themselves. And I think 585 00:46:02,975 --> 00:46:06,675 that's pretty straightforward, where everyone, wherever anyone 586 00:46:07,195 --> 00:46:11,055 stands on the issue of immigration, professional 587 00:46:12,035 --> 00:46:15,755 law enforcement who work for a legitimate government agency 588 00:46:17,055 --> 00:46:20,725 identify themselves. Pirates conceal 589 00:46:21,225 --> 00:46:24,085 their identities, thieves 590 00:46:25,785 --> 00:46:29,535 kidnappers, conceal their identities. Professional 591 00:46:30,515 --> 00:46:34,175 law enforcement wear badges and they provide identification 592 00:46:35,125 --> 00:46:38,935 that has an identifying number and their face and the name 593 00:46:39,195 --> 00:46:42,855 of the agency they work for. And they also come with things like 594 00:46:43,695 --> 00:46:47,615 judicial warrants signed by judges. This is 595 00:46:47,815 --> 00:46:51,815 very simple. This is a matter of how law functions and how it's supposed 596 00:46:51,935 --> 00:46:55,915 to serve the people. Now, of course, anyone can 597 00:46:56,135 --> 00:46:59,975 understand why an officer might say on a motorcycle, choose to wear something 598 00:47:00,375 --> 00:47:03,455 to protect their face from the wind in the cold, as has been brought up. 599 00:47:04,435 --> 00:47:08,055 and we all know very well that the brave first responders who were law enforcement 600 00:47:08,455 --> 00:47:12,315 during the covid pandemic were especially at risk to exposure. And 601 00:47:12,535 --> 00:47:15,535 so, of course, one would understand why they might wanna wear some kind of protective 602 00:47:16,955 --> 00:47:20,535 device to protect themselves from catching or transmitting 603 00:47:21,255 --> 00:47:24,845 pathogens, but surely we can come to a middle ground between 604 00:47:26,245 --> 00:47:30,245 they're allowed to do that and they're allowed to not identify themselves 605 00:47:31,305 --> 00:47:34,985 at all on the matter 606 00:47:35,325 --> 00:47:39,025 of the detention facility. It's incredibly inappropriate 607 00:47:40,645 --> 00:47:44,625 to try to take a building. Ms. Rosler, sorry, I have to interrupt you on that one. We have to do that one 608 00:47:44,905 --> 00:47:48,785 separately. Okay. Apologies. Jason, thank you for the correction. I'd like to comment on that as well. 609 00:47:48,975 --> 00:47:48,975 time, 610 00:47:55,725 --> 00:47:58,645 uh, looks like deborah hayes is our last one for, 611 00:48:00,245 --> 00:48:03,345 um, the mask ordinance 60 50. 612 00:48:06,255 --> 00:48:10,145 thanks. I'm hayes 613 00:48:10,495 --> 00:48:14,435 and I live in kansas city, missouri. I do have one question. Um, 614 00:48:14,655 --> 00:48:18,375 first I think maybe I haven't read it, clarified it enough, but does this include 615 00:48:18,985 --> 00:48:22,815 local, county and state and federal 616 00:48:24,475 --> 00:48:27,835 police that we're talking about? Or are we just focusing on ice? 617 00:48:28,915 --> 00:48:32,695 or are we talking about kansas city, missouri? Uh, I'm a, that's 618 00:48:32,975 --> 00:48:36,635 a, I can't answer unfortunately, a little confus then I have a statement. So can 619 00:48:37,115 --> 00:48:40,615 can anybody clarify that? We will, but it has be later. Go ahead. Okay. Thank you. 620 00:48:41,675 --> 00:48:44,765 um, I live in the west side, which is along southwest boulevard 621 00:48:45,795 --> 00:48:48,815 and we have a very, um, I've lived there for seven years 622 00:48:49,875 --> 00:48:53,275 and we have a wonderful community police, 623 00:48:54,075 --> 00:48:57,895 two policemen, chaco and john, who come to our neighborhood meetings. 624 00:48:58,875 --> 00:49:02,575 and the last time they came, they explained to us that they've always 625 00:49:02,895 --> 00:49:06,885 worked with ice in a very well 626 00:49:07,175 --> 00:49:11,165 runway where they have the warrants, they 627 00:49:11,455 --> 00:49:15,285 don't wear a mask, and, and they take care 628 00:49:15,595 --> 00:49:19,445 of what, if anybody is breaking the law, they 629 00:49:19,735 --> 00:49:23,575 will go. They don't crash into the doors or anything, but they, it's been going on 630 00:49:23,935 --> 00:49:27,355 for quite a while, believe it or not, that we have had ice 631 00:49:28,175 --> 00:49:32,135 officers come in and we have had people take it, 632 00:49:32,925 --> 00:49:36,205 they haven't worn masks, they've played by the rules, they 633 00:49:37,015 --> 00:49:40,935 followed all the laws, and so it's worked. And I 634 00:49:41,055 --> 00:49:44,695 don't think anybody, the west side is made up of mostly hispanic people. 635 00:49:45,555 --> 00:49:49,335 and I don't think, um, if there was, what is going on 636 00:49:49,715 --> 00:49:53,675 now, if that was what was happening, no one would want that at 637 00:49:53,895 --> 00:49:57,725 all. But the people who live in the neighborhood understand if people have 638 00:49:58,015 --> 00:50:01,915 really committed crimes, criminal crimes and 639 00:50:02,135 --> 00:50:05,695 having a warrant, then yes. But, um, I guess I'm just saying 640 00:50:06,615 --> 00:50:10,435 I feel for the officers that we have, because it's really made it hard for them to 641 00:50:10,655 --> 00:50:14,375 do their job. I think we ought to time. Okay. I just, 642 00:50:14,675 --> 00:50:18,425 um, I'm supporting the ban on the mask. Thank 643 00:50:18,975 --> 00:50:22,435 you. Alright, so 644 00:50:23,475 --> 00:50:27,270 at this point, uh, we have no more, uh, folks who would like to testify on, on ordinance 645 00:50:27,630 --> 00:50:31,565 60 50. Um, just as a point of understanding, for those who are watching 646 00:50:31,685 --> 00:50:35,405 and listening, uh, we will take up the legislation and take up actions within that. 647 00:50:35,735 --> 00:50:39,405 we'll help define for some of the questions that were asked of us, uh, within that discussion, 648 00:50:40,185 --> 00:50:43,545 uh, as well as hear from general counsel, anyone else, uh, in regards to 649 00:50:44,395 --> 00:50:48,285 some of the other things that are brought up. So, um, if you have questions, ask them, 650 00:50:48,425 --> 00:50:52,305 but we can't an we can't answer them in that moment of your public hearing. So, uh, 651 00:50:52,525 --> 00:50:55,905 we'll move on to ordinance 6 0 6, 1 of the moratorium for, 652 00:50:56,665 --> 00:51:00,365 uh, ice detention facilities. So, uh, with that, 653 00:51:00,775 --> 00:51:03,665 sorry, I forgot. That's also my job. Uh, charlotte turgen? 654 00:51:07,735 --> 00:51:08,945 no, charlotte. All right. Beverly harvey. 655 00:51:21,225 --> 00:51:24,935 hello and thank you for, uh, letting everybody talk today. My name is beverly harvey. 656 00:51:26,335 --> 00:51:30,245 I, uh, live in independence, and I am the founder of indivisible, kansas city. 657 00:51:31,075 --> 00:51:34,895 so detention centers the year 2026, and here we are discussing detention 658 00:51:35,455 --> 00:51:39,415 centers, concentration camps, really, uh, these are not detention centers. 659 00:51:39,695 --> 00:51:43,375 they are concentration camps. We all see what ice agents do in public. 660 00:51:44,075 --> 00:51:48,065 it makes me sick to think of what they do behind closed doors, 661 00:51:49,115 --> 00:51:53,035 starve people, rape women, beat people, probably kill people. No 662 00:51:53,255 --> 00:51:57,015 one knows, as we have no idea what they do. And the 663 00:51:57,335 --> 00:52:01,335 question is, if trump wants to deport people, why does he need hundreds 664 00:52:01,815 --> 00:52:04,975 of concentration camps that will hold thousands of people? 665 00:52:05,985 --> 00:52:09,875 don't you find it odd that he says he wants to deport illegal immigrants, but 666 00:52:10,095 --> 00:52:13,975 instead he's actually building concentration camps that would be able to hold 667 00:52:14,615 --> 00:52:18,415 thousands of people? This does not pass the smell test. He is 668 00:52:18,785 --> 00:52:22,655 lying. Again, his goal is to rid american 669 00:52:23,245 --> 00:52:26,955 america criminals and drugs. His goal is to instill fear in 670 00:52:27,455 --> 00:52:31,335 americans, to divide america, to have a gestapo that can keep people from voting 671 00:52:31,765 --> 00:52:35,695 just like hitler did. Once he puts up this concentration cap, what comes next? 672 00:52:36,375 --> 00:52:40,335 crematoriums we see every day on tv and our, and our phones 673 00:52:40,645 --> 00:52:44,455 that anyone who goes against him or says anything negative about him, he goes 674 00:52:44,655 --> 00:52:48,245 after them. He wants to be a dictator. He wants to rule america. 675 00:52:49,195 --> 00:52:52,655 we as midwesterners know for our hard work and our upstanding values, 676 00:52:53,315 --> 00:52:57,085 having concentration camps in missouri, kansas, or anywhere in america, goes 677 00:52:57,375 --> 00:53:01,235 against every fiber of americans. Millions of women and 678 00:53:01,515 --> 00:53:04,855 men have sacrificed their lives and lives to protect this great nation. 679 00:53:05,555 --> 00:53:09,245 and yet, trump wants to defile america with his hatred, his gustapo, 680 00:53:10,715 --> 00:53:14,695 his concentration camps, and his wars in iran. If we follow 681 00:53:15,025 --> 00:53:18,495 trump to have a concentration camp here in kansas city or missouri, 682 00:53:19,515 --> 00:53:23,415 or anywhere in the united states, then we do not deserve to be called american. 683 00:53:24,965 --> 00:53:28,705 started a war, another big distraction from the epstein files. The americans will die, 684 00:53:29,245 --> 00:53:32,785 thousands of others will die for what his ego, his desire to war. 685 00:53:33,385 --> 00:53:37,325 we cannot let this go. And building a concentration camp in kansas city would be 686 00:53:37,445 --> 00:53:41,365 disastrous. I beg you to stop to not allow the hatred to continue. 687 00:53:41,725 --> 00:53:42,025 I say, no. 688 00:53:48,035 --> 00:53:51,125 claudia truman. Claudia truman. 689 00:53:58,075 --> 00:54:01,035 I'm against the ban on mass and I am for the detention center. 690 00:54:02,235 --> 00:54:06,055 I'm sorry with it. Sorry. Scoot this back. Oh, okay. A little bit when you speak. It's 691 00:54:06,595 --> 00:54:10,495 too loud. Sorry. No, you're fine. Sorry to interrupt. Alright, we can start. Can we start again? Start your, yeah, 692 00:54:10,705 --> 00:54:14,615 we'll start your time over. I am. I am against 693 00:54:15,115 --> 00:54:18,755 the ban on the masks for ice, specifically for 694 00:54:19,195 --> 00:54:22,885 ice, and I am for the detention center. And furthermore, 695 00:54:24,575 --> 00:54:28,255 I am offended deeply, deeply offended 696 00:54:29,485 --> 00:54:33,485 that anyone should consider the current, uh, federal 697 00:54:33,995 --> 00:54:37,595 administration and the forces that work for them to be 698 00:54:38,245 --> 00:54:42,095 gestapo, to be hitler liked to be, and for donald trump to 699 00:54:42,295 --> 00:54:46,075 be considered hitler. I am offended because I had 700 00:54:46,315 --> 00:54:49,575 family that we were, that were lost in germany 701 00:54:50,675 --> 00:54:54,135 in during world war ii. I am of a jewish 702 00:54:54,745 --> 00:54:57,895 background on both sides of my family, 703 00:54:58,835 --> 00:55:02,375 and I lost family during that and during the pilgrims in russia, 704 00:55:04,815 --> 00:55:08,615 um, we need the, the detention facility because there are so 705 00:55:08,835 --> 00:55:12,595 many people in kansas city who, um, and the 706 00:55:12,995 --> 00:55:16,275 surrounding areas who, uh, 707 00:55:17,525 --> 00:55:20,485 they, they hide and they support and they promote 708 00:55:21,725 --> 00:55:25,135 illegal immigration. And they, they support and promote 709 00:55:26,155 --> 00:55:29,775 the lives of foreigners over american citizens. 710 00:55:30,515 --> 00:55:34,395 and we need to get those people out of our country, and 711 00:55:34,635 --> 00:55:38,215 we need to stop the people who support them and promote them 712 00:55:38,795 --> 00:55:42,715 who are against, um, a better union for 713 00:55:42,965 --> 00:55:46,935 ourselves and our posterity. That's all. Thank you. 714 00:55:47,995 --> 00:55:51,955 as a reminder, if you'd like to testify, please sign up on that sheet if you haven't already. Um, 715 00:55:53,535 --> 00:55:57,125 everyone who has signed in said that they wanted to speak, so I'm gonna read through the names. If you don't, then 716 00:55:57,795 --> 00:56:01,315 that's that. Ma'am, please keep your comments to yourself. Thank you, dennis. 717 00:56:02,055 --> 00:56:02,055 roland, 718 00:56:11,135 --> 00:56:14,845 thank you again for allowing me to speak. Uh, as far as the detention center is concerned, 719 00:56:15,425 --> 00:56:18,215 uh, I, I do support the, uh, moratorium, 720 00:56:19,465 --> 00:56:22,645 but I have concerns in that, uh, uh, a moratorium, 721 00:56:23,565 --> 00:56:26,555 absolute moratorium on any facility has to pass cons, 722 00:56:28,055 --> 00:56:31,775 has to pass constitutional muster, otherwise, you're subjecting this, uh, 723 00:56:32,215 --> 00:56:36,005 uh, body to further litigation. And I, I refer 724 00:56:36,375 --> 00:56:40,255 to, uh, a federal district court hearing decision on, uh, 725 00:56:41,415 --> 00:56:45,035 uh, judge christina snyder in california, who addressed 726 00:56:45,675 --> 00:56:49,495 a similar situation as far as masks are concerned. She said that, uh, 727 00:56:49,975 --> 00:56:53,475 if not applied equally, it, uh, would be struck down. 728 00:56:54,335 --> 00:56:58,115 I'd like to see that detention centers are somewhat struck 729 00:56:58,475 --> 00:57:02,135 down, but I'd like to see without, uh, uh, 730 00:57:02,485 --> 00:57:05,835 subjecting the, um, legislature to ongoing litigation. 731 00:57:06,895 --> 00:57:10,475 and I refer to the core civic matter over in kansas. That court 732 00:57:10,905 --> 00:57:14,895 also, the appellate court also suggested, uh, cited with the city. Um, 733 00:57:16,135 --> 00:57:20,075 but they couldn't prevent the location, but they 734 00:57:20,275 --> 00:57:23,285 have to reapply. So, uh, this moratorium, 735 00:57:24,415 --> 00:57:28,315 uh, I believe would prevent even the location, even though I do 736 00:57:28,475 --> 00:57:32,475 support it in whole. We need to revise the statute at it 737 00:57:32,635 --> 00:57:36,595 as it's presented so that we can avoid any further, any future litigation. 738 00:57:37,815 --> 00:57:41,595 that's all. Thank you. Uh, ken thomas mcclain. 739 00:57:56,935 --> 00:57:59,875 I'm against the moratorium, just like the mask 740 00:58:02,155 --> 00:58:05,855 ban ban. I am for the citizens of this city. The 741 00:58:06,355 --> 00:58:09,895 citizens of this city do not, should not be subjected to 742 00:58:10,715 --> 00:58:14,655 a outright restriction on the use of their property, the 743 00:58:14,875 --> 00:58:18,795 lease of their property, or the selling of their property. They should not be told 744 00:58:19,145 --> 00:58:22,625 what they can do with their property unless they have a proper hearing 745 00:58:23,935 --> 00:58:27,315 and due diligence. It is a violation of constitutional 746 00:58:28,015 --> 00:58:31,535 law, 14th amendment and federal law to 747 00:58:32,215 --> 00:58:36,155 do a blanket ban to say what you someone can do with their property 748 00:58:36,275 --> 00:58:39,345 and what someone cannot do with their property. This ordinance 749 00:58:40,695 --> 00:58:44,695 is absolutely abhorrent to our constitution, and 750 00:58:45,015 --> 00:58:49,015 it is a hitler like tactic to say that one 751 00:58:49,535 --> 00:58:53,195 use that is lawful is restricted. 752 00:58:53,615 --> 00:58:57,505 so it's, it's very sad to me to see this chamber 753 00:58:58,225 --> 00:59:01,835 take up an ordinance like this to even consider doing something like this, 754 00:59:02,365 --> 00:59:06,355 which restricts americans use of their property and 755 00:59:06,555 --> 00:59:10,385 their ability to sell it, promote it, develop it, et cetera. That 756 00:59:10,675 --> 00:59:13,705 is not the country that we live in. We live in a free country, 757 00:59:14,915 --> 00:59:17,675 a free society, and this is not freedom. 758 00:59:19,045 --> 00:59:21,445 thank you. Antoine jennings. 759 00:59:32,265 --> 00:59:36,175 antoine jennings, again, blue springs, missouri. You know, it's funny because the, 760 00:59:36,415 --> 00:59:40,165 uh, government tells us, um, if we wanna add an 761 00:59:40,485 --> 00:59:44,165 addition to our home, we gotta go through the government. 762 00:59:45,545 --> 00:59:49,205 if we wanna take out an addition to our home, we gotta go through the government. 763 00:59:49,825 --> 00:59:53,665 and now we wanna say, oh, the 14th amendment. By 764 00:59:54,015 --> 00:59:57,985 golly, g golly, what about the 10th amendment? What 765 00:59:58,275 --> 01:00:02,095 about state's rights? The federal government does not get to tell the 766 01:00:02,315 --> 01:00:05,995 states what to do under their supervision 767 01:00:06,575 --> 01:00:09,835 as long as it's not against the constitution of the united states of america. 768 01:00:11,415 --> 01:00:14,665 the 10th amendment. I suggest you read it. 769 01:00:16,475 --> 01:00:19,875 I suggest you read it. I'm very well versed in the constitution of the united states. 770 01:00:22,025 --> 01:00:25,865 we absolutely have laws not only in 771 01:00:26,085 --> 01:00:29,885 this county, but in the city, in the cities in which we live, 772 01:00:30,755 --> 01:00:34,645 that we have to abide by laws that we don't like, laws that we 773 01:00:34,805 --> 01:00:38,665 don't agree with, but yet the government tells us on 774 01:00:38,925 --> 01:00:42,845 a daily basis, we can't even drive a vehicle without having what? A 775 01:00:42,965 --> 01:00:46,925 driver's license. License. We can't drive a vehicle without what the government tell 776 01:00:47,205 --> 01:00:51,165 us, telling us we have to have insurance. So absolutely, 777 01:00:51,555 --> 01:00:55,545 this body has the absolute right to 778 01:00:55,765 --> 01:00:59,595 state what they want in their county because 779 01:01:00,145 --> 01:01:03,965 you represent us, the people I 780 01:01:04,325 --> 01:01:08,205 reminded you before, we voted you in for a reason. And that 781 01:01:08,445 --> 01:01:12,325 reason is for us to see you act on our 782 01:01:12,545 --> 01:01:13,565 behalf. Thank you. 783 01:01:18,845 --> 01:01:18,845 patricia parks. 784 01:01:24,735 --> 01:01:28,385 okay. Patricia parks from blue springs. 785 01:01:28,805 --> 01:01:32,745 and again, I didn't prepare anything, but I just want you to know my feelings. I think those detention 786 01:01:33,185 --> 01:01:37,025 centers are horrible. People get disappeared. Uh, I have seen several 787 01:01:37,265 --> 01:01:41,225 instances where, um, or the representatives in washington dc have tried 788 01:01:41,425 --> 01:01:45,425 to go to these detention centers and they're not allowed. So, and that's supposed 789 01:01:45,545 --> 01:01:49,505 to be their right and their duty to do that. And they're frustrated. They're 790 01:01:49,785 --> 01:01:53,735 not being allowed to go in and see what's going on in those detention centers. And there's 791 01:01:54,225 --> 01:01:57,825 like thousands in them. It's, it's just wrong. So I'm definitely 792 01:01:58,265 --> 01:01:59,185 against the detention centers. 793 01:02:05,995 --> 01:02:08,665 david broman, did I get it right this time? 794 01:02:11,225 --> 01:02:15,045 . Oh, thank you. 795 01:02:16,695 --> 01:02:20,685 david broman, kansas city, missouri. That's alright. Thank you 796 01:02:20,805 --> 01:02:24,705 again for allowing us to speak. Um, yeah, I, uh, 797 01:02:26,085 --> 01:02:29,305 I have to definitely echo what this gentleman said and 798 01:02:31,765 --> 01:02:35,715 , I, I mean, 799 01:02:36,575 --> 01:02:40,565 it couldn't be a more, uh, 800 01:02:43,105 --> 01:02:46,375 a more supportive thing of what we're seeing go on with, 801 01:02:47,325 --> 01:02:51,205 um, with the ice agency and all the 802 01:02:51,425 --> 01:02:54,345 issues that we're seeing around here to say, yeah, let's bring it here. 803 01:02:55,675 --> 01:02:59,675 let's bring it here and put it, put it right down the road, right down, right 804 01:03:00,025 --> 01:03:03,495 down the street from my boy's school. You know, um, 805 01:03:04,335 --> 01:03:07,745 that's saying, I mean, that is just saying, yeah, we approve of this 806 01:03:09,025 --> 01:03:12,935 foul mistreatment of human beings and, you know, show us an 807 01:03:13,155 --> 01:03:16,255 agency that's above reproach, that is willing to 808 01:03:17,485 --> 01:03:20,395 stand in front of you and say, I'm gonna arrest you for this. 809 01:03:21,585 --> 01:03:24,555 show you my face, my badge, willing to be accountable. 810 01:03:28,655 --> 01:03:32,415 then you know that, that's it. That's an agency that you can, you can talk 811 01:03:32,705 --> 01:03:36,295 to about doing something like putting a, an actual 812 01:03:37,145 --> 01:03:40,165 detention center, you know, in a community. 813 01:03:42,025 --> 01:03:45,015 not just turning a, you know, an old shipping house 814 01:03:46,755 --> 01:03:50,725 next to a trail, a train yard sure brings up some images of the twenties. 815 01:03:54,675 --> 01:03:58,645 let's just not do it. It doesn't make any sense. 816 01:04:01,545 --> 01:04:05,525 do we really want to be a part of that? Usher it 817 01:04:05,685 --> 01:04:09,475 in. I don't. 818 01:04:09,935 --> 01:04:13,155 and I hope that, uh, I hope you don't either. Thank you very much, 819 01:04:18,465 --> 01:04:19,135 paul svi. 820 01:04:22,635 --> 01:04:23,925 thanks again. Mr. Chairman. Members, 821 01:04:26,915 --> 01:04:29,815 uh, paul svi, south kansas city. Uh, first of all the, uh, 822 01:04:30,955 --> 01:04:34,415 the analogy of the concentration camps. I'm a jewish american living in the diaspora. 823 01:04:35,285 --> 01:04:39,175 this in tka, sobi door, bergen be, and auschwitz. They're not dropping cryon b 824 01:04:39,325 --> 01:04:43,015 down a slot with 500 jewish people in a, in a supposed shower. 825 01:04:43,555 --> 01:04:46,795 so anyway, I'll move on. Uh, the defensive facility first, uh, responsibility 826 01:04:47,695 --> 01:04:51,655 of government officials, protected citizens. Part of that is putting a physical security 827 01:04:51,775 --> 01:04:55,735 barrier between the law abiding citizens and the criminals and those that mean 828 01:04:55,895 --> 01:04:59,775 to do harm to those citizens. Detention facilities, just like in afghanistan, we took 829 01:04:59,935 --> 01:05:03,435 the taliban off the battlefield. We took 'em in detention facilities in canada to armed ba why? 830 01:05:04,035 --> 01:05:07,405 so they wouldn't harm or kill coalition forces and hurt afghanistan. 831 01:05:08,205 --> 01:05:12,185 afghanistan natives. So the, the issue is just like 832 01:05:12,385 --> 01:05:16,145 in kansas over in, uh, kansas city, kansas, when you had the domestic violence issue with the illegal 833 01:05:16,665 --> 01:05:20,525 criminal aliens that shot the woman, had she been in a detention facility, she might still be 834 01:05:20,685 --> 01:05:24,565 alive. So that's an issue that these detention facilities work to help 835 01:05:24,835 --> 01:05:28,375 protect people and also give 'em the processing again, 836 01:05:28,905 --> 01:05:32,775 um, a rising opposition. Uh, those two brothers, they're on the property, uh, management 837 01:05:33,445 --> 01:05:37,445 company that were terrorized and doxed and harassed 838 01:05:37,785 --> 01:05:41,605 by, by officials. It, it was shameful. And, uh, thank you again. 839 01:05:41,805 --> 01:05:45,445 appreciate it. Just wait. Benjamin rustler, 840 01:05:49,905 --> 01:05:53,865 uh, and final folks that, uh, are interested in speaking, please sign up there. Um, 841 01:05:54,565 --> 01:05:58,465 I think we're wrapping up on the public hearing section. Thank you. Yes, I'm 842 01:05:58,845 --> 01:06:02,745 benjamin wrestler again. Uh, well, I thank the gentleman for his service, but 843 01:06:03,005 --> 01:06:06,665 I think it's interesting to compare his time in combat 844 01:06:07,115 --> 01:06:10,675 theater to how we run jackson county, missouri. Yeah. 845 01:06:11,955 --> 01:06:15,745 what are we talking about? It is outrageous to 846 01:06:15,965 --> 01:06:19,855 even consider that a building that is built to house consumer goods 847 01:06:20,305 --> 01:06:24,015 in transit can somehow be made to humanely house 848 01:06:24,855 --> 01:06:28,405 human beings. What are we talking about? Restrictions 849 01:06:29,205 --> 01:06:33,125 on what you can use your property for. There are rules for residential construction. 850 01:06:35,985 --> 01:06:39,525 you can't turn a warehouse into a prison. And these people's record, 851 01:06:40,025 --> 01:06:43,995 dozens of people died in their custody last year from sheer neglect from 852 01:06:44,285 --> 01:06:48,065 not getting their medicine, from not being treated for the hypothermia that they contracted in 853 01:06:48,415 --> 01:06:52,285 those facilities. Any other prison that operated in such a fashion 854 01:06:52,615 --> 01:06:56,445 would be shut down. Legitimate corrections 855 01:06:56,845 --> 01:07:00,765 facilities don't do this. And as was also pointed out in this hearing, if the 856 01:07:00,925 --> 01:07:04,885 goal was deportation, then why house? Thousands of them here 857 01:07:05,225 --> 01:07:08,605 in jackson county where a legal form of slavery 858 01:07:09,305 --> 01:07:12,895 in the 14th amendment can be used to exploit them for their labor. 859 01:07:13,435 --> 01:07:15,325 what are we talking about? This is the united states. 860 01:07:17,625 --> 01:07:20,865 we don't do this. These are human beings. 861 01:07:23,475 --> 01:07:26,895 and even if it were a criminal offense to be in the united states 862 01:07:27,495 --> 01:07:31,415 without authorization, which it is not, even if it were, 863 01:07:32,275 --> 01:07:35,675 you are required to prove it in a court of law. 864 01:07:37,025 --> 01:07:40,855 these enforcement activities are an insult to the letter and spirit 865 01:07:41,875 --> 01:07:45,575 of every due process law in this country. And the idea that a nation 866 01:07:46,615 --> 01:07:50,495 conceived in liberty is for this is insulting 867 01:07:51,155 --> 01:07:51,575 and a joke. 868 01:07:56,575 --> 01:07:58,885 these are not legitimate law enforcement operations 869 01:08:00,785 --> 01:08:04,285 and this is not a legitimate way to treat human beings. Thank you. 870 01:08:09,785 --> 01:08:12,145 ashley morgan. Ashley morgan. 871 01:08:22,815 --> 01:08:25,285 hello. Thank you. Ashley morgan lee, summit, missouri. 872 01:08:26,835 --> 01:08:30,715 uh, thank you for the opportunity to speak again. I'm 873 01:08:30,935 --> 01:08:34,095 here, um, to oppose any iced detention 874 01:08:35,055 --> 01:08:38,735 warehouses in in jackson, uh, county. Our community understands 875 01:08:39,335 --> 01:08:43,305 exactly what these facilities are. Large industrial detention sites 876 01:08:43,795 --> 01:08:47,275 or camps, uh, in which to concentrate brown people in. 877 01:08:48,155 --> 01:08:51,815 um, they are designed to confine people and isolating conditions 878 01:08:52,525 --> 01:08:55,915 with minimal oversight. Changing the terminology of 879 01:08:56,805 --> 01:09:00,495 detention centers does not change the reality across the country. 880 01:09:00,905 --> 01:09:04,495 these immigration camps have been repeatedly cited for unsafe conditions, 881 01:09:05,325 --> 01:09:09,115 rape, torture, and there has been a confirmed murder and 882 01:09:09,535 --> 01:09:13,255 adequate medical care, lack of transparency and limited access to legal support, 883 01:09:13,835 --> 01:09:17,575 if any at all. Aligning jackson county with a system that is such troubling 884 01:09:18,135 --> 01:09:22,095 record would be a serious mistake. Residents are also raising a 885 01:09:22,415 --> 01:09:25,335 critical point here today. And, uh, in my conversations, 886 01:09:26,865 --> 01:09:30,815 there are not enough immigrant immigrants in the us to fill the detention camps being built 887 01:09:31,295 --> 01:09:35,055 nationwide. Existing facilities often sit partially empty to this day, 888 01:09:35,315 --> 01:09:39,175 yet new ones continue to be proposed that raises real concerns about the motivations 889 01:09:39,735 --> 01:09:43,675 behind these projects and whether they mirror the private prison model. Profit driven, opaque, 890 01:09:44,095 --> 01:09:47,825 independent on keeping beds filled. Bringing these warehouses here would 891 01:09:48,175 --> 01:09:51,895 create fear among immigrant families, discourage people from reporting crimes 892 01:09:52,915 --> 01:09:56,815 or seeking services and undermine trust in the institutions that 893 01:09:57,015 --> 01:10:00,735 are already struggling here. It would also divert land and 894 01:10:01,095 --> 01:10:05,095 resources away from housing, healthcare, education, community safety programs that actually 895 01:10:05,455 --> 01:10:09,175 strengthen our county residents are asking fair questions. Who truly 896 01:10:09,815 --> 01:10:13,535 benefits from this? Why should our county bear the moral and social cost of hosting detention 897 01:10:14,265 --> 01:10:18,185 camps? And why expand detention capacity when the population, these 898 01:10:18,535 --> 01:10:22,455 facilities target does not justify it? Jackson county deserves development that 899 01:10:22,615 --> 01:10:26,615 reflects our values. We should be building a community where people can live time and contribute. 900 01:10:27,625 --> 01:10:28,055 thank you 901 01:10:35,685 --> 01:10:39,495 deborah parma and sarah ferris, just so that you guys can navigate 902 01:10:39,695 --> 01:10:42,335 the audience. I, 903 01:10:55,035 --> 01:10:58,275 deborah parma, kansas city, missouri detention 904 01:10:59,295 --> 01:11:03,175 facilities is just a euphemism for prisons. Trump 905 01:11:03,545 --> 01:11:07,425 was supposed to go after the worst of the worst. It's proven 906 01:11:08,995 --> 01:11:12,685 that immigrants do less than 907 01:11:13,115 --> 01:11:16,805 half the number of crimes than american citizens 908 01:11:17,265 --> 01:11:21,195 do. The people they are putting in these prisons, 909 01:11:22,095 --> 01:11:25,515 again, are people that are mostly just here 910 01:11:26,435 --> 01:11:30,425 illegally, which is a misdemeanor, like a traffic ticket, 911 01:11:32,465 --> 01:11:36,105 and they are being mistreated in there. I'm 912 01:11:36,765 --> 01:11:40,265 a really sad story. I read the other day, is this prison in 913 01:11:40,865 --> 01:11:44,835 dly, which has families, children that 914 01:11:45,445 --> 01:11:49,205 recently has been too cold for them to go outside. There's no 915 01:11:49,745 --> 01:11:53,245 tv or anything. The children would draw pictures. 916 01:11:54,385 --> 01:11:57,605 the guards came in and took the pictures, the paper, 917 01:11:58,545 --> 01:12:02,545 the crayons, the pencils, the 918 01:12:02,925 --> 01:12:05,825 children cried. There's nothing for them to do. 919 01:12:07,955 --> 01:12:11,705 it's just horrible. Uh uh, 920 01:12:12,075 --> 01:12:15,665 it's just to be mean to these people. And 921 01:12:16,705 --> 01:12:20,465 so thousands, hundreds of thousands they think to 922 01:12:20,715 --> 01:12:23,965 hold, well, if he actually deports these people, 923 01:12:24,855 --> 01:12:28,565 who's gonna fill 'em talk. What do you think about trump? 924 01:12:29,155 --> 01:12:31,135 what about the people who oppose trump? 925 01:12:34,415 --> 01:12:37,785 what do you think might happen to them and where would they put them? 926 01:12:41,435 --> 01:12:45,325 I just say you should consider that . Sarah 927 01:12:45,915 --> 01:12:45,915 ferris. 928 01:13:01,215 --> 01:13:05,005 hello. Um, my name is sarah farn and I am, I live in kansas city. 929 01:13:06,145 --> 01:13:09,845 um, I'm also a college student. Um, and obviously 930 01:13:10,365 --> 01:13:14,265 I'm speaking for myself, but I also want to speak for the youth. Um, 931 01:13:14,585 --> 01:13:18,565 we see mass walkouts in our area against ice operations and detention 932 01:13:18,885 --> 01:13:22,205 centers. The people have spoken. Um, and I hope that, 933 01:13:23,065 --> 01:13:26,485 um, my elected representatives will do their job and hear our voices 934 01:13:27,305 --> 01:13:31,145 to act. Um, additionally, I attend school, um, 935 01:13:31,365 --> 01:13:34,525 classes with many international students and people from different cultures. 936 01:13:35,625 --> 01:13:39,605 um, different backgrounds, different countries. These people are here, student visas, they're here 937 01:13:39,645 --> 01:13:43,345 legally. We see those people being taken up by ice 938 01:13:44,465 --> 01:13:47,765 and detained, even if they're not citizens, they're here legally. 939 01:13:48,905 --> 01:13:52,805 um, so we should be against, um, detention centers. If we 940 01:13:52,925 --> 01:13:56,395 wanna talk about legality. Let's bring up liam ramos, 5-year-old 941 01:13:57,165 --> 01:14:00,445 from minneapolis, taken from school to an ice detention 942 01:14:01,245 --> 01:14:05,165 facility. Okay, you're worried about criminals, let's focus on that because that's what's actually happening. 943 01:14:06,425 --> 01:14:08,885 um, and I just wanna say, you know, 944 01:14:10,565 --> 01:14:14,015 I love this city. I love this. I love these people. I love our diversity 945 01:14:14,635 --> 01:14:18,135 and our different cultures, you know, and I think that we should do everything 946 01:14:18,835 --> 01:14:22,735 in our power to prevent a detention center. We don't want that 947 01:14:22,935 --> 01:14:26,805 blood on our hands. We don't want those people being hurt 948 01:14:27,095 --> 01:14:30,955 under our watchful eyes. Um, you know, if 949 01:14:31,175 --> 01:14:35,175 we're worried about due process, that's not what, that's not what's happening, and that's not what happens in those 950 01:14:35,295 --> 01:14:37,295 detention centers. Thank you 951 01:14:41,465 --> 01:14:42,105 brian lambe. 952 01:14:50,885 --> 01:14:54,755 thank you. Thanks for allowing us all that, the 953 01:14:54,915 --> 01:14:58,875 opportunity to speak. I'm glad I just followed someone who brought up the word do pro or the phrase due process, 954 01:14:59,075 --> 01:15:02,765 because to me that's the most important thing we're talking about here. We've 955 01:15:03,115 --> 01:15:06,815 had people mostly in support of the ban and 956 01:15:07,435 --> 01:15:10,745 opposing the detention facilities speak about un-american 957 01:15:12,785 --> 01:15:16,115 actions implications, and then other people who support, 958 01:15:17,175 --> 01:15:20,675 who oppose the mask, ban and support the detention facilities 959 01:15:21,235 --> 01:15:24,785 making the same argument. We all like to use the argument of like, this is anti-american. 960 01:15:25,635 --> 01:15:29,555 what's happening here? What does that mean? What does it mean to be anti-american. What 961 01:15:29,755 --> 01:15:33,455 does it mean to be american? Fundamentally, the the thing that makes our 962 01:15:33,875 --> 01:15:37,425 constitution special is the bill of rights. The bill of rights protects, 963 01:15:38,605 --> 01:15:42,565 uh, or prevents, protects for citizens and prevents the arbitrary use of 964 01:15:42,995 --> 01:15:46,285 state power. That's what we're talking about. That's what masks do. 965 01:15:47,135 --> 01:15:50,505 they allow what's essentially a federalized police force 966 01:15:51,605 --> 01:15:55,215 to create a chilling effect by, by fearmongering 967 01:15:56,065 --> 01:16:00,065 it's scaring people. Rightly so. Okay, so we're talking 968 01:16:00,225 --> 01:16:04,145 about due process. We wanna say that what's happening 969 01:16:04,525 --> 01:16:07,935 is on american, you have to focus on due process. Okay. 970 01:16:09,425 --> 01:16:11,495 mass detention facilities are 971 01:16:14,555 --> 01:16:18,435 movements in contravention to the bill of rights, 972 01:16:18,895 --> 01:16:22,795 to the, the spirit of this country. The literal spiritual soul of this country 973 01:16:23,255 --> 01:16:26,115 is the bill of rights due process. That's it. Thanks. 974 01:16:31,085 --> 01:16:34,875 without any testimony, uh, any further testimony. That concludes our 975 01:16:35,275 --> 01:16:39,155 public hearings for 60 50 and 60 61. Uh, 976 01:16:39,375 --> 01:16:43,215 we will now move into, uh, communications and reports from our county 977 01:16:43,405 --> 01:16:47,155 executive, uh, any reports from our county executive. Very briefly, mr. 978 01:16:47,655 --> 01:16:51,575 chairman, I wanna inform this body 979 01:16:51,775 --> 01:16:53,775 that the budget books are gonna be online, 980 01:16:56,235 --> 01:17:00,135 uh, by the end of next week. And we have hard copies being printed out for each of you 981 01:17:00,805 --> 01:17:04,695 with, uh, our tabs. Everyone wanted the tabs, so we're gonna make sure the 982 01:17:04,855 --> 01:17:08,735 tabs were in there. Uh, I wanted mr. Mr. Executive, if, if we could just pause 983 01:17:09,105 --> 01:17:12,885 one second. Okay. Just for the folks who are leaving, um, note that the actions 984 01:17:13,205 --> 01:17:17,085 will take place immediately upon his report. So, just fyi. Um, so 985 01:17:17,285 --> 01:17:21,285 if you want to go, you're more than welcome to do so. Um, respectfully of our 986 01:17:21,405 --> 01:17:25,345 county executive, but just wanted to give you that heads up. So, thank you, mr. Executive. And, uh, 987 01:17:25,675 --> 01:17:29,645 very briefly, I wanna inform this legislative body. Uh, we have a, a, a 988 01:17:29,925 --> 01:17:33,885 position of a county veteran services officer. Um, thank you 989 01:17:34,005 --> 01:17:37,885 for legislator marshall smith, who's talked to me about that 990 01:17:38,105 --> 01:17:42,035 and, and kept coming to the administration about that. It's been budgeted last year. It's 991 01:17:42,325 --> 01:17:46,245 an advocate position for veterans. It's been budgeted by this body. It hasn't been 992 01:17:46,365 --> 01:17:50,245 filled, and it continues not to be filled. We found out that it got caught up 993 01:17:50,405 --> 01:17:54,405 in hr, didn't go anywhere. So there are applicants for that position 994 01:17:54,585 --> 01:17:58,405 of a county veteran service officer. That's a very important position to help advocate 995 01:17:59,165 --> 01:18:03,105 veterans on all sorts of things. Not just a county issue. It's a, they would help veterans, uh, 996 01:18:03,545 --> 01:18:07,445 on all sorts of. So we're moving forward on that and gonna be doing some 997 01:18:07,605 --> 01:18:11,185 interviews and get someone in that position as soon as possible. You founded it. 998 01:18:11,665 --> 01:18:15,285 you thought it was a great idea there, and we need to implement it, and we will. 999 01:18:15,745 --> 01:18:19,605 um, that's all I have. Thank you. Questions and comments for county 1000 01:18:19,885 --> 01:18:23,825 executive? All right. Hearing none, we'll move 1001 01:18:23,905 --> 01:18:26,675 into the perfection of proposed ordinances and reports of committees 60 50 1002 01:18:28,185 --> 01:18:32,125 prohibiting law enforcement officers from concealing their faces or badges 1003 01:18:32,545 --> 01:18:36,295 during performance of their official duties in establishing penalties and exemptions legislature 1004 01:18:36,985 --> 01:18:40,525 as a whole. Can I ask our general counsel? Um, I think I have passed out. 1005 01:18:41,045 --> 01:18:44,805 um, this, uh, looks like january 28th, um, 1006 01:18:45,715 --> 01:18:49,385 supplement. Uh, can I ask our general counsel to read that for record, please? 1007 01:18:50,245 --> 01:18:53,825 we need it. Here it is. Yes, mr. Chairman, I'll, uh, I'll condense it 1008 01:18:54,285 --> 01:18:58,065 to the specific issues in it so we, I won't have to read the whole entirety of it. 1009 01:18:59,005 --> 01:19:02,615 uh, the county council's office did not sign, uh, ordinance 1010 01:19:03,395 --> 01:19:07,025 60 50 as to form and cannot recommend its passage or enforcement 1011 01:19:08,085 --> 01:19:11,985 as the county does not have the authority to require a order federal law enforcement 1012 01:19:12,385 --> 01:19:16,325 officers to abide by any local ordinances that are not also captured in federal law. 1013 01:19:17,095 --> 01:19:20,185 federal law due to the supremacy clause that the us constitution 1014 01:19:21,115 --> 01:19:24,985 supersedes any state or local law. To the contrary, while it 1015 01:19:25,145 --> 01:19:28,785 is true that a municipality can make its own laws and can in certain instances 1016 01:19:30,005 --> 01:19:34,005 exceed the strictness of federal or state law, it is not allowed to make or 1017 01:19:34,225 --> 01:19:37,585 enforce law that is an opposition to federal law. For example, 1018 01:19:38,665 --> 01:19:42,485 a state could not amend its own constitution to repudiate the first amendment to 1019 01:19:42,705 --> 01:19:46,585 the us constitution and require all news to be reviewed and approved 1020 01:19:47,165 --> 01:19:50,975 before publishing or dissemination. This principle was recently upheld 1021 01:19:51,615 --> 01:19:55,315 by the federal courts in a challenge made to missouri's second amendment protection 1022 01:19:55,955 --> 01:19:59,955 act, which sought to abrogate specific federal laws within the state of 1023 01:20:00,235 --> 01:20:03,715 missouri. This was soundly rejected as a violation of supremacy clause. 1024 01:20:05,455 --> 01:20:09,205 in this instance, there is no us code provision that prohibits federal 1025 01:20:09,505 --> 01:20:13,425 law enforcement officers from wearing face masks. Attire is set 1026 01:20:13,665 --> 01:20:17,565 by agency policy, not statute, with no authority to change the agency policy 1027 01:20:18,375 --> 01:20:22,365 state and municipalities cannot change or restrict the requirements of federal 1028 01:20:22,705 --> 01:20:26,245 law enforcement officers uniform and the realm of law enforcement. Municipalities 1029 01:20:27,545 --> 01:20:30,925 are not authorized to dictate or restrict the operations of law enforcement 1030 01:20:31,835 --> 01:20:35,725 that is not under its direct supervision. And even agencies that do not 1031 01:20:35,885 --> 01:20:39,275 act under the authority of municipality, of protect, have protections against 1032 01:20:40,005 --> 01:20:42,445 undue interference on their activities by a municipality. 1033 01:20:45,085 --> 01:20:49,085 I point all these out. We've had a similar situation just recently occurred 1034 01:20:49,935 --> 01:20:53,925 where this body passed a, a gun ordinance that was more restrictive 1035 01:20:54,445 --> 01:20:57,725 than the state, and it was kind of in between what the federal law was. 1036 01:20:59,225 --> 01:21:03,075 um, we're in a time 1037 01:21:03,365 --> 01:21:07,285 where there's lawfare and, and everything becomes litigation, and we 1038 01:21:07,445 --> 01:21:11,365 got sued by the attorney general's office on that matter. Um, you know, 1039 01:21:11,865 --> 01:21:15,825 not to go into too much detail, it's a nominal case at 1040 01:21:16,045 --> 01:21:19,835 this point, but they're moving forward with it and they'll get attorney fees, 1041 01:21:20,185 --> 01:21:23,945 and that could cost the taxpayers of jackson county a lot of money. So, 1042 01:21:24,625 --> 01:21:28,165 as much as I understand the symbolism of passing a law like this 1043 01:21:29,315 --> 01:21:33,125 with the supremacy clause that's on the books, and that has prevented other municipalities 1044 01:21:33,905 --> 01:21:37,835 and taxing jurisdictions to do something of this nature, I would be concerned that 1045 01:21:38,155 --> 01:21:41,685 we'd be facing litigation on this matter like we have in the press. 1046 01:21:43,145 --> 01:21:46,965 if you have any questions, please lemme know. Questions, 1047 01:21:47,365 --> 01:21:51,325 comments for our general counsel? Yep. Vice chair. So, I, I 1048 01:21:51,445 --> 01:21:55,255 noticed that mr. Kavinsky, as well as, uh, one person in the audience or wearing masks, 1049 01:21:55,745 --> 01:21:59,685 I'm gonna make an assumption that this is either for your protection or for the protection of others. 1050 01:22:00,785 --> 01:22:04,765 um, yes, it was a horrible time for me to get sick for the 1051 01:22:04,845 --> 01:22:08,365 first time in 10 years, and I, I, I wanted to come in today, but yeah, I could also 1052 01:22:08,905 --> 01:22:12,905 try to others, and I didn't, I didn't wanna to pry into your health, but, but thank you for that. Yeah. And, and I guess the 1053 01:22:13,245 --> 01:22:17,025 question is, um, did you have permission from the legislature to 1054 01:22:17,355 --> 01:22:21,025 wear a mask today? ? No, I did not. Trying 1055 01:22:21,445 --> 01:22:25,325 to. So you, you used your judgment that it might be best for your protection or the protection 1056 01:22:25,725 --> 01:22:29,635 of others to wear a mask today. And, and that judgment will 1057 01:22:30,225 --> 01:22:34,065 be different tomorrow or a few days from now. Um, and, and 1058 01:22:34,285 --> 01:22:37,035 I bring that up just to say, um, legislating 1059 01:22:38,355 --> 01:22:40,985 like this, present legislation is, um, 1060 01:22:42,465 --> 01:22:46,085 to, to mandate something first, that, as the county counselor 1061 01:22:46,625 --> 01:22:50,625 has stated, we don't have the authority to do anything about, uh, 1062 01:22:50,845 --> 01:22:54,595 that can and will cost taxpayers money to defend because, 1063 01:22:55,785 --> 01:22:59,785 um, the county's responsible for defending ordinances that we pass, um, 1064 01:23:00,505 --> 01:23:04,405 is all a representation of irresponsible government. And I'll ask 1065 01:23:04,605 --> 01:23:08,045 the county executive, um, if we pass this ordinance, 1066 01:23:08,955 --> 01:23:12,715 will you sign this ordinance? Or will you veto this ordinance? Or have you, have 1067 01:23:13,005 --> 01:23:16,925 you developed a position at this point? I'll tell you what, I'm listening and the position comes 1068 01:23:17,165 --> 01:23:20,505 if this body passes something, it will come from me for my review. Okay. Um, 1069 01:23:21,745 --> 01:23:25,525 and, and finally, I just wanna say that, that we have an option 1070 01:23:26,025 --> 01:23:29,965 as a legislative body to make, um, statements that we, 1071 01:23:30,165 --> 01:23:34,165 that we feel as a body, we wanna make a majority that aren't subject 1072 01:23:34,465 --> 01:23:38,425 to a veto and aren't subject necessarily to litigation and, and, 1073 01:23:39,185 --> 01:23:42,685 and enforcement. Um, that, that is the resolution process 1074 01:23:43,385 --> 01:23:47,375 in this case. The, um, sponsor of this ordinance, uh, legislator 1075 01:23:48,045 --> 01:23:52,025 of barca, chairman of barca, um, is, is placing the 1076 01:23:52,245 --> 01:23:55,845 county at risk to make a philosophical statement that might be popular 1077 01:23:56,275 --> 01:24:00,085 with the community, but, but is doing so via an 1078 01:24:00,325 --> 01:24:02,785 avenue, an ordinance, which, um, 1079 01:24:04,425 --> 01:24:08,325 is not enforceable, but will have to be defended at a cost to 1080 01:24:08,525 --> 01:24:12,405 the county. And, and therefore, it just smacks to me of 1081 01:24:12,795 --> 01:24:16,195 irresponsible government, um, if we choose to pass this. 1082 01:24:16,845 --> 01:24:20,765 I guess, um, the, the last thing I'll say, aside from the idea that a, a 1083 01:24:21,125 --> 01:24:25,105 resolution would maybe be the correct avenue given, um, the 1084 01:24:25,385 --> 01:24:29,045 desire to make a statement while no, um, enforcement is 1085 01:24:29,445 --> 01:24:33,185 possible, um, that placing laws on the books filing 1086 01:24:33,825 --> 01:24:37,005 and, and passing ordinances that are 1087 01:24:37,865 --> 01:24:41,825 not enforceable actually serves to erode the law. 1088 01:24:42,355 --> 01:24:46,085 meaning if people see that we have a code of ordinances, and some of them 1089 01:24:46,585 --> 01:24:50,295 are subject to enforcement, and others are subject to being ignored, we're 1090 01:24:50,645 --> 01:24:54,565 we're actually compounding the problem of lawlessness that the resolution 1091 01:24:55,365 --> 01:24:59,105 purports to try to solve. It purports to try to say, um, 1092 01:25:00,175 --> 01:25:03,835 peace officers, police officers, law enforcement officers should be open. 1093 01:25:04,265 --> 01:25:08,165 and, and if you accept, accept that premise and think that that should be 1094 01:25:08,285 --> 01:25:12,205 part of the law, there are avenues to get that made part of the law at a federal 1095 01:25:12,375 --> 01:25:16,165 level. And instead of exercising those, we have distracted 1096 01:25:16,565 --> 01:25:20,385 people wasted their time and brought them here to, to advocate for 1097 01:25:20,705 --> 01:25:24,415 or against something that, that can simply have no legal 1098 01:25:25,145 --> 01:25:29,085 impact. Um, so I'll just kind of pause there. Like I said, I, I wanted to 1099 01:25:29,675 --> 01:25:33,635 emphasize the idea that people wear masks sometimes for reasons that 1100 01:25:33,925 --> 01:25:37,885 are specific and to their individual judgment. Um, and I 1101 01:25:38,005 --> 01:25:41,845 also know and wanna note that we did hear from the county sheriff, the only 1102 01:25:42,585 --> 01:25:46,545 agency law enforcement agency that might be subject to this ordinance, um, 1103 01:25:47,025 --> 01:25:50,445 as far as enforcement and, and it being a lawful ordinance. 1104 01:25:51,225 --> 01:25:54,765 and there are times when officers do wear masks for their own safety. 1105 01:25:55,585 --> 01:25:58,385 um, sometimes there are arresting individuals that, uh, 1106 01:25:59,865 --> 01:26:03,715 um, might be affiliated with gangs and therefore have dangerous gang 1107 01:26:04,005 --> 01:26:07,675 members who might seek to retaliate. Um, there are such 1108 01:26:08,085 --> 01:26:12,055 a large swath of potential reasons why law enforcement might 1109 01:26:12,545 --> 01:26:16,465 choose to do something or choose not to do something that for us to, to try 1110 01:26:16,685 --> 01:26:19,925 to, um, legislate that, uh, without 1111 01:26:21,005 --> 01:26:24,885 a thorough understanding, a lot more language, a lot more advice and consent 1112 01:26:25,325 --> 01:26:29,325 from law enforcement, um, seems to me to to be a mistake. 1113 01:26:30,305 --> 01:26:34,115 um, so I'll, I'll, I'll pause there in case my colleagues want 1114 01:26:34,405 --> 01:26:38,365 to, um, ask other questions, questions, 1115 01:26:38,725 --> 01:26:39,445 comments, thoughts. 1116 01:26:42,835 --> 01:26:45,735 all right. I'm gonna pass the gavel to you, sir, so that you can acknowledge me. 1117 01:26:47,615 --> 01:26:50,555 acknowledged. Thank you. Uh, so 1118 01:26:52,205 --> 01:26:56,055 lots of comments. First, thank you all for being here, for testifying, for sharing. Uh, part of this process 1119 01:26:56,315 --> 01:26:59,255 is your public testimony, whether you're for or against any of these, these efforts. 1120 01:27:00,435 --> 01:27:04,195 um, I, I think that the legal opinion here is, is 1121 01:27:05,095 --> 01:27:08,855 interesting. Um, mr. Kavinsky, there is nothing, 1122 01:27:09,115 --> 01:27:13,055 and I think you ci it. Um, there is no us code provision that prohibits federal 1123 01:27:13,275 --> 01:27:17,165 law enforcement officers from wearing face masks. Thus, without 1124 01:27:18,535 --> 01:27:21,695 a prohibition or a, I guess, decision, 1125 01:27:22,765 --> 01:27:26,535 what prevents us from creating, uh, an enforceable local ordinance violation, 1126 01:27:28,355 --> 01:27:32,175 the supremacy would intend that there's a law that we would be violating. So what's 1127 01:27:33,255 --> 01:27:37,255 a, again, it's a supremacy issue. We can't tell a 1128 01:27:37,375 --> 01:27:41,295 federal agent how to, how to address when they're in the state of missouri, 1129 01:27:41,455 --> 01:27:44,655 because it's a, the federal law expands all states 1130 01:27:45,835 --> 01:27:49,775 in the country. But, but what's the law that they're possession of? Well, that protect, 1131 01:27:50,135 --> 01:27:53,935 they have agency policies that will determine whether or not they can do it, 1132 01:27:54,585 --> 01:27:57,275 which is not law. Right. Which is not law. 1133 01:27:58,615 --> 01:28:02,535 I mean, you can say it's not law, but if the agency has a policy 1134 01:28:02,795 --> 01:28:06,735 on what their agents can wear, that's what they will intend to enforce. 1135 01:28:07,655 --> 01:28:11,535 a big issue here is whether or not an action can be taken in federal court or state 1136 01:28:11,775 --> 01:28:15,735 court, and in this case it's municipality. And that's where, again, the supremacy 1137 01:28:16,095 --> 01:28:20,075 clause would prevent us from doing it. Sure. Um, so do, do, 1138 01:28:20,295 --> 01:28:24,175 in that opinion, do ice agents have to follow speed limits? 1139 01:28:26,685 --> 01:28:30,375 of course, that has nothing to do with their enforcement, but that's a local enforcement. 1140 01:28:31,125 --> 01:28:34,885 the state prohibit prohibition. There's nothing that says they don't have to follow it. So 1141 01:28:35,325 --> 01:28:39,305 I'm trying to follow the same coordination here of process. There's nothing that says 1142 01:28:39,505 --> 01:28:43,285 they have to, so why do they have to? I think 1143 01:28:43,945 --> 01:28:47,805 that's a reasonable statute or ordinance that's on the books. 1144 01:28:48,225 --> 01:28:52,125 it has nothing to do with the law enforcement action. And, you know, 1145 01:28:52,825 --> 01:28:56,405 for them to follow the local laws when it comes to speeding 1146 01:28:56,905 --> 01:29:00,485 and all of that, um, is a whole different matter of whatsoever. 1147 01:29:01,985 --> 01:29:05,855 so I think my point here is that there are some means in which local 1148 01:29:06,355 --> 01:29:09,995 laws dictate participation and enforcement of, because 1149 01:29:10,485 --> 01:29:14,485 if they violated, police officers can pull them over. Um, police officers 1150 01:29:14,925 --> 01:29:18,195 have pulled over other police officers violating law. It doesn't prohibit them from 1151 01:29:19,185 --> 01:29:23,085 not participating because they're a higher authority. Um, so there's some legal 1152 01:29:24,005 --> 01:29:27,795 opinions there that I'm sure we can figure out. The other question, uh, that 1153 01:29:28,125 --> 01:29:31,775 I have, uh, or, or I guess reference, um, is, is really about 1154 01:29:32,355 --> 01:29:36,005 understanding how, from one side of the argument, 1155 01:29:36,705 --> 01:29:40,405 six years ago, folks didn't wanna wear masks to protect 1156 01:29:41,075 --> 01:29:44,565 them from public health arguments. And yet now they're advocating for 1157 01:29:45,225 --> 01:29:49,225 hiding behind masks because they're too much of a snowflake, um, 1158 01:29:49,585 --> 01:29:53,565 to try and understand how ice agents have some 1159 01:29:53,765 --> 01:29:57,165 incredibly hard and challenging job to round up 5-year-old children. 1160 01:29:57,785 --> 01:30:01,725 so, I, I don't quite understand how we can have both in our county, because this body 1161 01:30:01,985 --> 01:30:05,645 has regulated masks, um, has faced challenges both federally and locally. 1162 01:30:06,505 --> 01:30:10,365 um, and seemingly, uh, we have similar people who are advocating one, 1163 01:30:10,585 --> 01:30:14,325 one way or another. So tell us about our mask ordinance 1164 01:30:14,845 --> 01:30:18,605 processes. I think that was a health issue and it, it applied 1165 01:30:18,965 --> 01:30:22,685 throughout the state, or in this instance in the county. 1166 01:30:23,545 --> 01:30:27,465 um, we actually had lawsuits with the state agency for 1167 01:30:27,685 --> 01:30:31,085 our mask ordinances. Right. And it's, it's just a, it's a different 1168 01:30:31,705 --> 01:30:35,405 animal when you're talking about protecting your own citizens in your county 1169 01:30:36,025 --> 01:30:39,965 versus law enforcement from the federal level being in your 1170 01:30:40,165 --> 01:30:44,165 county. And whether or not they would be under more restrictions 1171 01:30:45,745 --> 01:30:49,155 for wearing when they, when they have a explanation 1172 01:30:49,845 --> 01:30:53,605 for why they're doing what they're doing, I'm not taking an opinion on it, 1173 01:30:53,905 --> 01:30:57,695 I'm just telling you what the supremacy clause stands for. Yeah. Um, which 1174 01:30:58,125 --> 01:31:01,655 I appreciate that part. Um, would you be opposed to third party counsel evaluating 1175 01:31:02,325 --> 01:31:05,565 this, um, externally and giving us some understanding and perspective 1176 01:31:06,555 --> 01:31:10,555 if, if either you think that would be helpful to you? Um, not, not 1177 01:31:10,895 --> 01:31:14,735 to dismiss your, your report, but just to seek 1178 01:31:14,935 --> 01:31:18,795 additional guidance on constitutionality and means for which we can, uh, 1179 01:31:19,015 --> 01:31:22,925 implement this? Because I, I do think that there's some balance of federal 1180 01:31:23,555 --> 01:31:27,495 law enforcement officers have to follow a speed limit that's a local regulation. So how can we 1181 01:31:27,615 --> 01:31:31,255 find an opportunity here to protect citizens? Because as you've suggested, 1182 01:31:32,075 --> 01:31:35,975 uh, we have, um, the opportunity to protect folks, uh, two people were at least 1183 01:31:36,095 --> 01:31:39,975 killed by mass agents in minneapolis. Um, there's also that requirement of 1184 01:31:40,135 --> 01:31:44,075 protection as well. Um, and so, you know, the, the 1185 01:31:44,295 --> 01:31:48,175 protection of massed men, um, or women, I guess from 1186 01:31:48,555 --> 01:31:52,455 ice, doing a job that they signed up to do voluntarily is not really 1187 01:31:52,635 --> 01:31:56,615 my problem. That's their problem. Um, so I'm not 1188 01:31:56,735 --> 01:32:00,655 as worried about that part. Um, and if they're too scared to do that job, don't 1189 01:32:01,005 --> 01:32:04,965 do it. That's the reality of that. Um, so I 1190 01:32:05,085 --> 01:32:08,985 would like to seek third party counsel, um, in that means to, to 1191 01:32:09,205 --> 01:32:13,205 get us some more understanding about this ordinance. If we're gonna default to, it's not legal to do. 1192 01:32:13,985 --> 01:32:17,885 um, I think we can follow up and get some additional guidance on this. 1193 01:32:18,755 --> 01:32:22,685 there's been a suggestion of third party counsel, legislator anderson. 1194 01:32:23,625 --> 01:32:26,665 uh, mr. Chairman, I'd like to move to hold ordinance 6 0 5 0 1195 01:32:27,905 --> 01:32:31,365 second. It's been moved and seconded and thirded to hold ordinance 6 0 5 0 1196 01:32:32,425 --> 01:32:35,905 at this time. All those in favor by sign of aye. Aye. Aye. 1197 01:32:36,665 --> 01:32:40,205 aye. I'll abstain. I think the ayes have it 1198 01:32:40,715 --> 01:32:44,685 over the, over the intercom internet there. Uh, legislator smith 1199 01:32:44,965 --> 01:32:48,825 and legislator franklin, are you okay 1200 01:32:49,105 --> 01:32:52,185 with the hold? Hold is fine by me. 1201 01:32:54,285 --> 01:32:58,215 okay. I think that's, I think we should do a roll call though. Alright. If you're 1202 01:32:58,495 --> 01:33:01,955 not sure who is in favor or not, I, we had, um, 1203 01:33:02,965 --> 01:33:06,765 four here that were yes. And legislator franklin makes five. Legislature as a whole. There a motion 1284 01:39:14,225 --> 01:39:17,955 move. I'd like to ask that we get a legal opinion on this one. It feels like 1285 01:39:18,275 --> 01:39:21,995 a violation of the 14th amendment that gives people the right to their property, 1286 01:39:22,655 --> 01:39:25,715 and we are proactively, uh, essentially eliminating, 1287 01:39:26,975 --> 01:39:30,755 uh, the right to use their property as they see fit to every jackson county 1288 01:39:31,395 --> 01:39:35,355 resident and property owner without any due process. 1289 01:39:37,865 --> 01:39:41,595 okay. Um, 1294 01:40:02,545 --> 01:40:05,535 no. Smith? 1295 01:40:07,635 --> 01:40:10,735 yes. Husky? Yes. Franklin? 1296 01:40:12,675 --> 01:40:16,675 yes. Mcgee lauer smith? Yes. 1297 01:40:18,045 --> 01:40:21,435 abca? No. Four. Yes. 1298 01:40:24,755 --> 01:40:28,185 three. No one absent. One excused. 1299 01:40:29,435 --> 01:40:33,435 remind us, madam clerk, do we have to have a certain number two. We, 1300 01:40:33,675 --> 01:40:37,625 we need a five. Five. Okay. So the hold fails. So, um, other 1301 01:40:37,975 --> 01:40:41,735 actions for ordinance 60 61? Mr. Chairman? 1302 01:40:42,155 --> 01:40:46,095 uh, yes. Legislator anderson. Mr. Chairman, I move to perfect. 1303 01:40:47,005 --> 01:40:49,915 okay. There's a motion to perfect. Is there a second? Second. 1304 01:40:51,125 --> 01:40:54,585 okay. Uh, is there a discussion on the ordinance, mr. Chairman? Yes, mr. Anderson. 1305 01:40:55,425 --> 01:40:59,425 mr. Chairman. Uh, as we have seen over the last, uh, 1306 01:40:59,675 --> 01:41:02,945 year and a half, um, uh, really 1307 01:41:04,235 --> 01:41:07,645 ever since the beginning, the creation of ice, we have seen 1308 01:41:08,385 --> 01:41:12,145 an attack on individuals, uh, human beings 1309 01:41:13,145 --> 01:41:17,025 who may not be american citizens, but are still human beings. At 1310 01:41:17,245 --> 01:41:20,335 the end of the day, the discussions that have gone on today 1311 01:41:21,635 --> 01:41:25,405 have been focused on, uh, not only about if, 1312 01:41:25,965 --> 01:41:29,805 if we, uh, choose to do what is right, whether it is by 1313 01:41:30,085 --> 01:41:34,085 the citizens of jackson county, or, uh, whether that, uh, 1314 01:41:34,355 --> 01:41:37,965 means how we personally feel about what's going on 1315 01:41:38,405 --> 01:41:42,385 in our country. Uh, I believe that both are in one and the same 1316 01:41:43,445 --> 01:41:47,165 as we look at this and we have documentation of 1317 01:41:48,175 --> 01:41:51,845 what has happened, even when these opened up. Uh, some have argued 1318 01:41:52,265 --> 01:41:56,265 about, uh, under, uh, president obama or president bush, 1319 01:41:56,505 --> 01:42:00,405 president obama, president biden, president trump, I 1320 01:42:00,525 --> 01:42:04,245 will say they've all been wrong. They've all been a 1321 01:42:04,645 --> 01:42:08,285 horrible human rights violation and wrong. 1322 01:42:10,425 --> 01:42:13,555 these camps, 1323 01:42:14,635 --> 01:42:16,965 these, uh, uh, uh, 1324 01:42:18,905 --> 01:42:22,905 buildings that the current secretary of the department of homeland security 1325 01:42:23,775 --> 01:42:27,705 uses to parade herself in front of. When you 1326 01:42:27,905 --> 01:42:31,885 have human beings stacked on each other with one 1327 01:42:32,385 --> 01:42:36,025 bathroom, if they're lucky, with one air conditioner, if they're lucky 1328 01:42:37,335 --> 01:42:41,185 with any type of medical aid, if they're lucky, but you 1329 01:42:41,385 --> 01:42:45,325 have thousands and thousands of people being forced into 1330 01:42:46,015 --> 01:42:49,835 a cell and to say, well, they'll be fine. They've 1331 01:42:50,325 --> 01:42:52,945 just broken the law. The reason why 1332 01:42:55,165 --> 01:42:59,005 I believe that this ordinance, I think anything relating to 1333 01:42:59,205 --> 01:43:01,485 the challenges that we face now is so crucial 1334 01:43:03,345 --> 01:43:07,285 is because we are slowly but surely losing our humanity 1335 01:43:07,865 --> 01:43:11,655 in this country. At 1336 01:43:11,895 --> 01:43:15,695 one time in this country, it was illegal for 1337 01:43:15,935 --> 01:43:19,635 my mother to be married to my father. At one time, 1338 01:43:20,775 --> 01:43:24,715 it was illegal for me to exist. One time it was 1339 01:43:24,875 --> 01:43:28,835 illegal for my colleagues on this legislature, the women that are on this 1340 01:43:28,995 --> 01:43:32,195 legislature, to even hold public office or to be able to vote. 1341 01:43:35,995 --> 01:43:39,885 when we look back at our history, and people will say, this is not america. We have done this before, 1342 01:43:41,125 --> 01:43:44,595 , I'm still very proud of my country because 1343 01:43:45,185 --> 01:43:49,085 one thing that my country has decided to do is that even if it is 1344 01:43:49,325 --> 01:43:53,195 a small, and forgive me for the real robert f. Kennedy quote here, 1345 01:43:53,955 --> 01:43:57,725 even if it is a small ripple, it can can create a wave 1346 01:43:58,235 --> 01:43:59,515 that destroys injustice. 1347 01:44:03,875 --> 01:44:07,495 so I will say, so if the federal government 1348 01:44:07,935 --> 01:44:11,815 wants to come for us, so be it. If the state wants to come for 1349 01:44:11,975 --> 01:44:15,805 us, so be it. And let me tell you why. I'm now in my seventh year 1350 01:44:16,355 --> 01:44:19,945 on this legislature, I've been through the fights during 1351 01:44:20,365 --> 01:44:24,115 2020 and the mass mandate I've seen lives destroyed. 1352 01:44:25,875 --> 01:44:28,545 I've seen p advocates, uh, killed. 1353 01:44:30,005 --> 01:44:33,705 I have seen friends who have lost their lives. Not only 1354 01:44:34,595 --> 01:44:38,465 those individuals, and I'm not saying this on behalf of me because I take this on the chin. 1355 01:44:39,175 --> 01:44:41,865 when you serve in public office, you are beholden to the public. 1356 01:44:44,365 --> 01:44:48,365 but when you decide to attack a woman who is dedicated her 1357 01:44:48,585 --> 01:44:51,995 life to being a nurse for well over 45 years, 1358 01:44:53,695 --> 01:44:57,655 and to say that you will find her and that you will do 1359 01:44:58,075 --> 01:45:01,955 terrible things, and when you decide that you'll show up to 1360 01:45:02,395 --> 01:45:06,315 wherever her doctor's appointment is and to do 1361 01:45:06,435 --> 01:45:10,115 unspeakable things, that tells you the mentality 1362 01:45:10,555 --> 01:45:13,855 of those individuals who are anti mask all those years ago. 1363 01:45:15,335 --> 01:45:19,065 and now I find it fascinating, and we now have these same individuals 1364 01:45:20,775 --> 01:45:24,755 who are saying, well, these people will be doxed. Well, these people will face 1365 01:45:25,035 --> 01:45:28,665 all these different challenges. Well, these camps will keep us safe. 1366 01:45:32,535 --> 01:45:36,145 what does not keep the people safe is when fellow citizens 1367 01:45:37,165 --> 01:45:41,005 to say to, even though it is my mother that she should die. 1368 01:45:43,605 --> 01:45:47,215 what does not speak to the advocacy of law and order 1369 01:45:50,335 --> 01:45:52,975 is that individuals are seen as lesser. 1370 01:45:56,035 --> 01:45:59,995 I know the argument will be said again, that this idea that we are impeding on someone's 1371 01:46:00,475 --> 01:46:04,355 right to do what they want with their land. But I will 1372 01:46:04,535 --> 01:46:08,195 say, let jackson county draw the line in the sand. 1373 01:46:10,005 --> 01:46:13,935 because if we look at this as a whole, if we look at the 1374 01:46:14,135 --> 01:46:18,055 amount of children who've been taken in, when we look at the 1375 01:46:18,175 --> 01:46:22,095 amount of those who've been dis who are disabled, who've been taken in and put in 1376 01:46:22,255 --> 01:46:26,215 these camps, if you look at the amount of pregnant women who have 1377 01:46:26,335 --> 01:46:30,195 been put in these camps, if you look at the individual just trying to 1378 01:46:30,635 --> 01:46:34,615 get by in this world, who have been put in these camps, they are 1379 01:46:34,775 --> 01:46:38,495 the vast majority. The president 1380 01:46:38,815 --> 01:46:42,775 has lied. He has lied about what he had 1381 01:46:43,135 --> 01:46:46,975 promised, that these will be criminals and those who threaten our society 1382 01:46:47,455 --> 01:46:47,775 as a whole. 1383 01:46:53,955 --> 01:46:57,275 I know the arguments. I've been here, like I said, seven years, understanding 1384 01:46:58,615 --> 01:47:01,315 how this place works, and I know our limitations. 1385 01:47:03,695 --> 01:47:06,665 but if we refuse to even acknowledge 1386 01:47:08,415 --> 01:47:12,235 to even push back, then what will then be said of us 1387 01:47:13,305 --> 01:47:14,265 when we're no longer here? 1388 01:47:17,475 --> 01:47:21,145 again, many will probably will say, oh, he's just being dramatic. 1389 01:47:22,665 --> 01:47:26,025 referencing slavery, referencing jim crow era laws 1390 01:47:27,785 --> 01:47:31,645 referencing this push by, uh, even during 1391 01:47:31,965 --> 01:47:35,115 the times of busing that we could, uh, 1392 01:47:36,045 --> 01:47:39,975 pick up families and, and, and as so many of the parts down in the 1393 01:47:40,095 --> 01:47:43,975 south wanted to do that, if you were caught a black family 1394 01:47:44,505 --> 01:47:48,255 going into another, uh, school district because the government had 1395 01:47:48,695 --> 01:47:52,405 told you to that we'll put you in a camp, make you feel 1396 01:47:53,045 --> 01:47:56,775 this pain. I urge everyone to read fannie lou 1397 01:47:57,055 --> 01:47:59,495 hamer's statements on that during the sixties. 1398 01:48:01,905 --> 01:48:05,875 this was not that long ago. This should give us great. 1399 01:48:08,525 --> 01:48:09,805 and what we should understand is 1400 01:48:13,785 --> 01:48:16,825 I do not know how 1401 01:48:18,065 --> 01:48:21,965 any individual of this country, or by my faith as a 1402 01:48:22,085 --> 01:48:24,885 christian or even those who are nonbelievers of another faith, 1403 01:48:26,665 --> 01:48:30,605 if you can agree that an individual who's not 1404 01:48:30,765 --> 01:48:34,315 here legally, who is in 1405 01:48:34,895 --> 01:48:38,675 a retirement home and has, uh, 1406 01:48:39,925 --> 01:48:42,855 some sort of a disease that's happened in arizona, 1407 01:48:44,045 --> 01:48:47,995 that individual dragged out, thrown into one 1408 01:48:48,215 --> 01:48:52,045 of these camps and then die because they don't get access to medical care. 1409 01:48:53,255 --> 01:48:56,745 I don't know how an individual can say that. A 5-year-old child, 1410 01:48:57,595 --> 01:49:01,335 the 12-year-old child, the 13-year-old child, the american citizen, 1411 01:49:02,155 --> 01:49:06,135 the american citizen, again, who's been put in these camps because of the color of 1412 01:49:06,335 --> 01:49:09,895 their skin and the language that they speak deserves 1413 01:49:10,455 --> 01:49:13,885 to be in camps where you are not allowed access to medical help, 1414 01:49:14,715 --> 01:49:18,175 access to any constitutional rights, any access to international 1415 01:49:18,875 --> 01:49:22,865 law rights, anything, how we can sit and say, 1416 01:49:24,015 --> 01:49:27,525 well, we have no power. You should just sit by. 1417 01:49:29,585 --> 01:49:32,945 I believe we're better than that. So, mr. Chairman, that is why 1418 01:49:34,065 --> 01:49:36,765 I move that we perfect. Ordinance 6 0 6 1. 1419 01:49:38,665 --> 01:49:42,475 thank you. Other comments from legislators? Mr. Chairman? Uh, 1420 01:49:42,695 --> 01:49:46,455 mr. Vice chair. So, um, for, for our county counselor, 1421 01:49:47,685 --> 01:49:51,525 apparently we're not gonna take the time to get a legal opinion on this one. Um, you signed 1422 01:49:51,845 --> 01:49:55,805 this one. So you consider this to be a lawful ordinance consistent with the constitution of 1423 01:49:55,885 --> 01:49:59,765 the united states? Yes. I do think we have the authority in the 1424 01:49:59,965 --> 01:50:03,875 unincorporated area to ban a zoning situation. Okay. 1425 01:50:04,165 --> 01:50:08,125 whereas if they processed it, that was the ordinance would then apply. That was gonna 1426 01:50:08,245 --> 01:50:12,025 be one of my questions was, was, uh, uh, this only applies to 1427 01:50:12,505 --> 01:50:16,485 unincorporated jackson county. Yeah. I would have 1428 01:50:16,685 --> 01:50:19,725 to review the municipality that they don't have a zoning, 1429 01:50:21,185 --> 01:50:25,025 uh, division. Yeah. Whether or not it applies, but, and, and 1430 01:50:25,345 --> 01:50:29,065 so within unincorporated jackson county, we can preemptively say 1431 01:50:30,305 --> 01:50:34,245 to property owners that they can't use their property 1432 01:50:34,545 --> 01:50:38,485 for a lawful purpose. That, that we as a legislative body happen to have 1433 01:50:38,565 --> 01:50:42,245 an object, an an objection to I think 1434 01:50:42,585 --> 01:50:46,225 so. So without giving them a chance to apply for 'cause 'cause understand there is no 1435 01:50:47,325 --> 01:50:51,005 facility, this is not a question for my colleagues, for the audience. There is no 1436 01:50:51,485 --> 01:50:55,345 facility being contemplated that I'm aware of that's asked for a permit in 1437 01:50:55,565 --> 01:50:58,645 unincorporated jackson county. And we are saying preemptively 1438 01:51:00,015 --> 01:51:04,005 don't bother. We are gonna say no. That feels to me like 1439 01:51:04,285 --> 01:51:07,885 we have reduced property owners' rights, that they bought that 1440 01:51:08,325 --> 01:51:12,285 property. They should have the opportunity to come to us, have due process and say, I want to 1441 01:51:12,405 --> 01:51:16,405 zone this property and have a special use permit for, in this case, a detention 1442 01:51:16,745 --> 01:51:20,705 center. No, nobody's asking for that. But we're preemptively saying to 1443 01:51:20,925 --> 01:51:24,605 every property owner in unincorporated jackson county, you are 1444 01:51:25,005 --> 01:51:28,725 absolutely not allowed to use it that way. I think the authority 1445 01:51:29,305 --> 01:51:33,085 of this elected board can, can do that with the zoning power that it has. 1446 01:51:33,875 --> 01:51:37,845 okay. I, I disagree as a lay person. Uh, it seems 1447 01:51:38,515 --> 01:51:42,455 problematic to me, but, um, I, I think we're gonna, there 1448 01:51:42,805 --> 01:51:45,555 again, have, uh, potentially 1449 01:51:46,885 --> 01:51:50,835 somebody try to litigate that we're gonna take time to litigate something that 1450 01:51:51,565 --> 01:51:55,315 probably wouldn't otherwise have been subject to challenge. Somebody will say, well, 1451 01:51:55,605 --> 01:51:59,605 that's exactly what I was planning to use my property for, and now it's worth less than 1452 01:51:59,885 --> 01:52:03,885 it would've been if I had had that option. And we can, I certainly understand. Be paying them 1453 01:52:04,045 --> 01:52:08,045 damages. So, um, I just wanted to get your clarification that, that 1454 01:52:08,325 --> 01:52:12,325 you signed off on this. You think this is okay? Yes. I think we have 1455 01:52:12,485 --> 01:52:15,995 that authority as an elected body. Thank you. Other 1456 01:52:16,705 --> 01:52:19,805 questions, comments from colleagues? No, uh, online 1457 01:52:20,715 --> 01:52:24,665 legislator smith or franklin? Anything from you all? I'm sorry, I didn't 1458 01:52:24,945 --> 01:52:28,655 realize your hand was up. Legislator smith? Yes. Thank you, mr. 1459 01:52:29,055 --> 01:52:32,595 chairman. Um, mr. Kavinsky, you stated that this was just for 1460 01:52:33,475 --> 01:52:36,005 the unincorporated area that the county owns. 1461 01:52:37,815 --> 01:52:41,735 and my question to you is, do we have a process 1462 01:52:42,045 --> 01:52:45,885 already in place for applicants to submit zoning, uh, special 1463 01:52:46,265 --> 01:52:50,185 use permit zoning applications, all the ones that are listed here in this ordinance? Yes, 1464 01:52:50,405 --> 01:52:53,715 we do. So is there anything stopping, 1465 01:52:54,535 --> 01:52:58,315 uh, a potential applicant who may want to 1466 01:52:58,995 --> 01:53:01,965 put up one of these type of facility facilities from 1467 01:53:03,015 --> 01:53:05,975 applying for, um, a conditional use permit? 1468 01:53:07,195 --> 01:53:10,785 because I don't see that listed in here. I mean, it, it doesn't prevent them from doing so. 1469 01:53:12,245 --> 01:53:15,865 um, but the commission would most likely take into account the ordinances 1470 01:53:16,385 --> 01:53:20,345 passed by this body. Okay. So I 1471 01:53:20,465 --> 01:53:24,145 guess my statement would be to the body that we already have a process in place to vet 1472 01:53:24,805 --> 01:53:28,505 all types of applications, um, that seems to be working 1473 01:53:28,815 --> 01:53:32,625 very well for all types of, uh, rezoning and zoning 1474 01:53:33,015 --> 01:53:36,825 type of projects. So to double down on something that we already have a process 1475 01:53:37,245 --> 01:53:40,445 for, uh, I really don't think there's a need for that. 1476 01:53:52,585 --> 01:53:54,045 any other comments? Ms. Legislator smith? 1477 01:53:57,065 --> 01:54:00,965 all right. Legislator anderson, did you have something you said? Uh, just a quick question. 1478 01:54:01,345 --> 01:54:05,285 um, what did we do in, uh, conjunction 1479 01:54:05,995 --> 01:54:09,765 with, um, the, I know we, we shut down 1480 01:54:10,205 --> 01:54:14,065 a adult entertainment shop, something along those lines. Didn't 1481 01:54:14,485 --> 01:54:18,005 we make it that we can't have any more of those things in unincorporated 1482 01:54:18,645 --> 01:54:22,515 jackson county? Isn't that what that legislation was about? Yeah, it's 1483 01:54:22,805 --> 01:54:26,505 been a number of years. I know we changed the timeframe of when they could, uh, 1484 01:54:27,585 --> 01:54:30,915 be open that, uh, in essence then 1485 01:54:31,685 --> 01:54:35,525 I believe shut it down. But I'd have to look back at the ordinance to remember what specifically 1486 01:54:36,505 --> 01:54:40,075 we wrote specifically on the actual business. Because 1487 01:54:40,645 --> 01:54:44,045 I remember the, the timeframe of when they could be open was an issue. 1488 01:54:45,385 --> 01:54:49,325 and the reason why I brought that up is, again, I, 1489 01:54:49,525 --> 01:54:52,705 I appreciate both smith's statements, but, uh, 1490 01:54:54,025 --> 01:54:57,865 we do this, we, we do this because the 1491 01:54:58,085 --> 01:55:01,845 thing is, is that we knew that that adult, whatever it was, 1492 01:55:02,625 --> 01:55:06,575 was having possibly, well, we, 1493 01:55:07,095 --> 01:55:10,335 it wasn't possibly, it was in the police report that they had, 1494 01:55:11,135 --> 01:55:15,045 uh, uh, underage individuals who were being trafficked, that they had drugs, 1495 01:55:15,665 --> 01:55:19,645 that they were having all these different types of, of, of horrible things going 1496 01:55:19,995 --> 01:55:23,955 on. And we said, you know what? I don't think we should allow this. What's the core issue of 1497 01:55:24,075 --> 01:55:27,835 it? I think we should be done with it. Well, we shouldn't allow that to happen. 1498 01:55:28,375 --> 01:55:32,335 people of blue summit deserve better. So when we decide, 1499 01:55:33,615 --> 01:55:37,435 uh, and I think, forgive, forgive me, I think it was called whatever the spot or something, 1500 01:55:37,955 --> 01:55:41,605 whatever it was, when we say, let's not get too specific, 1501 01:55:42,095 --> 01:55:45,875 we've had this here, here before. Nothing stopped those places from 1502 01:55:46,275 --> 01:55:50,125 keeping their doors open until this body made a 1503 01:55:50,365 --> 01:55:53,735 decision. That's all. Mr. Chairman, 1504 01:55:55,025 --> 01:55:58,835 thank you, mr. Chairman. Uh, vice chair. So in, in 1505 01:55:59,055 --> 01:56:02,245 that instance, there was a business that was violating 1506 01:56:03,195 --> 01:56:06,885 law, and we sought to place restrictions that 1507 01:56:07,205 --> 01:56:11,175 made them less profitable. We didn't tell them that they couldn't 1508 01:56:12,065 --> 01:56:15,815 still have a building. We didn't tell them how they could or couldn't use it, 1509 01:56:16,155 --> 01:56:19,995 but we do that from time to time. Um, generally the, 1510 01:56:20,435 --> 01:56:24,245 the goal of zoning and the goal of, of issuing 1511 01:56:24,805 --> 01:56:28,485 permits is to approve an individual property owner's, 1512 01:56:29,395 --> 01:56:32,735 yes or no. Um, that is very different 1513 01:56:33,605 --> 01:56:36,875 than saying to all property owners, we're going to 1514 01:56:37,695 --> 01:56:41,285 prohibit you from an otherwise lawful use without having seen 1515 01:56:41,725 --> 01:56:45,415 that there was a specific problem with that business owner. So I, I think 1516 01:56:46,035 --> 01:56:49,955 the legislator's, uh, comment is, is, you know, understandable. 1517 01:56:51,535 --> 01:56:55,095 I, I, I see these as distinct things. I see this as a fundamental, 1518 01:56:56,115 --> 01:57:00,065 um, violation and frankly, extremely performative given 1519 01:57:00,415 --> 01:57:04,295 that we have no currently contemplated facilities that anybody's asking 1520 01:57:04,675 --> 01:57:08,595 for a permit for, and that we would've the ability to, to restrict the permit if 1521 01:57:08,815 --> 01:57:12,695 they did choose to apply for it. So, um, it feels like an ordinance without 1522 01:57:12,935 --> 01:57:16,695 a home. And finally, um, mr. Kavinsky, if the federal 1523 01:57:17,055 --> 01:57:20,885 government bought land or took existing land that 1524 01:57:21,175 --> 01:57:24,865 they own inside of jackson county and decided to build 1525 01:57:25,375 --> 01:57:29,215 a detention center, do, do we as a county legislative body, 1526 01:57:29,725 --> 01:57:33,285 have the right to preempt their use of that 1527 01:57:33,895 --> 01:57:37,755 facility for these purposes? Yeah, again, it would be, uh, 1528 01:57:38,025 --> 01:57:41,195 applicable to the unincorporated area, right? So, 1529 01:57:42,115 --> 01:57:45,935 so if an unincorporated jackson county, the federal government owns 40 acres and they decide 1530 01:57:46,215 --> 01:57:50,135 to put a building up and they decide that they wanna keep detainees there, can we 1531 01:57:50,255 --> 01:57:54,165 stop them through a county ordinance? If they, I do think if we have an ordinance 1532 01:57:54,445 --> 01:57:58,445 that says that there could be litigation to support the ordinance and the, 1533 01:57:58,625 --> 01:58:02,425 and the supremacy clause, the united states constitution wouldn't allow them to 1534 01:58:02,645 --> 01:58:06,605 say, this is government property. We own it. We're gonna use it in a lawful manner 1535 01:58:07,225 --> 01:58:11,145 in accordance with federal law as we see fit. I'd have to look into 1536 01:58:11,435 --> 01:58:15,075 it more, more in depth. But we do have the authority to determine 1537 01:58:15,495 --> 01:58:19,235 zoning in the jackson county. And so I do feel strongly that 1538 01:58:19,515 --> 01:58:23,305 we have that ability to do that. Thank you. I'll 1539 01:58:23,595 --> 01:58:24,035 give you this 1540 01:58:27,605 --> 01:58:29,975 quiet. Um, so 1541 01:58:31,655 --> 01:58:35,515 couple things. Um, first I think it's important, again, we think for those 1542 01:58:35,695 --> 01:58:39,505 who are still here, uh, watching this process happen, um, obviously 1543 01:58:40,115 --> 01:58:43,865 this was, uh, a great discussion for both the municipalities who've 1544 01:58:44,285 --> 01:58:48,065 already done this, including kansas city, missouri, and others, um, throughout the country, to 1545 01:58:48,395 --> 01:58:51,985 dictate that we are not gonna allow the caging of people. Um, 1546 01:58:52,445 --> 01:58:56,245 I want to share, um, because although, uh, vice chair smith may not be aware, 1547 01:58:56,985 --> 01:59:00,645 um, I told me directly that they have been pursuing several other 1548 01:59:01,285 --> 01:59:05,245 locations in addition to the one in kansas city, missouri. Um, they are seeking a 1549 01:59:05,685 --> 01:59:09,565 facility that will hold 7,600 people. Uh, ice turns over beds at least 1550 01:59:09,725 --> 01:59:13,605 every 51 days. That is 54,392 people 1551 01:59:13,805 --> 01:59:17,565 that would be effectively detained potentially over a 1552 01:59:17,925 --> 01:59:20,705 year in a facility in jackson county. Um, 1553 01:59:22,615 --> 01:59:26,475 that's a significant amount of population. Um, the reality that 1554 01:59:26,775 --> 01:59:30,715 was said about the population of undocumented immigrants even present, would not 1555 01:59:30,965 --> 01:59:34,825 exist here. Thus, we're looking at regionally grabbing folks from 1556 01:59:35,115 --> 01:59:38,515 their homes, taking them from their family, and incarcerating them, 1557 01:59:39,295 --> 01:59:42,895 um, not deporting them, quickly, incarcerating them. So 1558 01:59:43,655 --> 01:59:46,925 the reality of this situation is going to be of moral, 1559 01:59:47,775 --> 01:59:51,715 uh, suggestion on what you choose to focus your time on. A 1560 01:59:51,835 --> 01:59:55,445 lot of folks are making justifications as to why not. No one yet 1561 01:59:55,885 --> 01:59:59,525 has seemingly said, do you stand for the concentration of 1562 01:59:59,995 --> 02:00:03,885 54,392 people? Yes or 1563 02:00:04,165 --> 02:00:08,125 no? That is a reality. I wouldn't stand for that for a jail, for 1564 02:00:08,345 --> 02:00:12,325 people that would quote unquote be criminals. The reality of 1565 02:00:12,545 --> 02:00:16,105 this situation is far worse than a code or a zoning ordinance 1566 02:00:16,725 --> 02:00:20,665 or not. This is about humanity. This is about what we believe 1567 02:00:20,985 --> 02:00:24,945 democracy will stand on or fall on. I wanna remind 1568 02:00:25,345 --> 02:00:29,245 us about this little piece. Not 1569 02:00:29,465 --> 02:00:33,105 like the brazen giant of great greek fame with conquering 1570 02:00:33,635 --> 02:00:37,125 limbs destroyed from land to land. Here at our sea wash, sunset 1571 02:00:37,835 --> 02:00:41,275 gates shall stand a mighty woman with the torch, whose flame 1572 02:00:42,645 --> 02:00:46,165 is the imprisoned lighting, and her name, mother of exiles 1573 02:00:46,935 --> 02:00:50,845 from her beacon hand glows worldwide, welcome her 1574 02:00:51,145 --> 02:00:54,735 mild eyes command the air breathed harbor that 1575 02:00:55,465 --> 02:00:59,225 twi city's frame keep ancient lands, your storied pump 1576 02:01:00,285 --> 02:01:04,125 cry. She with silent lips. Give me your tired, your pur 1577 02:01:04,575 --> 02:01:07,815 poor, your hurled masses yearning to breathe free. 1578 02:01:09,325 --> 02:01:12,905 the wretched refuse of your teaming shore. Send these, 1579 02:01:13,925 --> 02:01:17,825 the homeless tempest tossed to me. I 1580 02:01:17,945 --> 02:01:20,255 lift my lamp besides the golden door. 1581 02:01:21,965 --> 02:01:25,845 that's the new colossus by emeral lazarus from 1883. That's 1582 02:01:26,465 --> 02:01:29,145 impended and apart of the statue of liberty, 1583 02:01:30,775 --> 02:01:34,435 the reality that in 1883 we had more humanity and dignity 1584 02:01:34,975 --> 02:01:38,555 of people coming to our country than now is atrocious. 1585 02:01:41,225 --> 02:01:44,495 I don't ask you to vote for this because I think it's not duplicative 1586 02:01:45,485 --> 02:01:49,115 or because it's not, uh, impugned to legal 1587 02:01:49,785 --> 02:01:53,705 challenges. I ask you to vote for this because I don't think we should incarcerate 1588 02:01:54,155 --> 02:01:58,145 54,392 people in jackson county, whether that's 1589 02:01:58,385 --> 02:02:02,105 in kansas city, in independence, and anywhere 1590 02:02:02,405 --> 02:02:06,405 in jackson county. Unincorporated or not planned or zoned or not. 1591 02:02:07,005 --> 02:02:09,765 we should not imprison that quantity of people, period. 1592 02:02:11,015 --> 02:02:14,035 thus, I'll ask you to vote for this moratorium. 1593 02:02:15,835 --> 02:02:19,775 and if you don't, I hope the people in this room who stand up 1594 02:02:20,035 --> 02:02:23,815 and ask you to do it, remove you from office. Thank you. 1595 02:02:32,195 --> 02:02:35,875 so shall we go, sir? No, I'd 1596 02:02:36,295 --> 02:02:40,135 like to respond. Mr. Vice chair. So the statue of liberty, 1597 02:02:41,555 --> 02:02:44,895 uh, sits in conjunction with ellis island, 1598 02:02:46,175 --> 02:02:49,375 a place where immigrants came to the united states 1599 02:02:50,435 --> 02:02:54,175 to be lawfully processed, tested for diseases, checked to make 1600 02:02:54,535 --> 02:02:58,335 sure that they were safe to the best of our ability at the time, run background checks 1601 02:02:58,755 --> 02:03:02,615 and understand if they were coming to the united states to be productive members of society. 1602 02:03:04,085 --> 02:03:07,775 that is not what happened over the last four years where we had essentially, 1603 02:03:08,795 --> 02:03:12,275 uh, a unregulated open border 1604 02:03:13,365 --> 02:03:17,045 that has resulted in millions of people entering the country without 1605 02:03:17,535 --> 02:03:21,455 us knowing who they are and the law that allows us 1606 02:03:21,655 --> 02:03:25,415 to deport them through an administrative judge and administrative hearing process. 1607 02:03:26,005 --> 02:03:29,895 like we have administrative hearings for so many things, not through 1608 02:03:30,135 --> 02:03:34,015 the full judicial process, unless exceptions exist from time to time. 1609 02:03:34,745 --> 02:03:38,515 these are very different circumstances. And when you say 1610 02:03:38,875 --> 02:03:42,815 we are not going to have a building here that holds people, what you're saying 1611 02:03:43,115 --> 02:03:46,925 is, we would rather not have this here, well-regulated, well 1612 02:03:47,215 --> 02:03:50,735 understood, well monitored, and instead leave it somewhere 1613 02:03:51,525 --> 02:03:55,375 with less moral people. 'cause the fact is, the federal government, 1614 02:03:56,315 --> 02:04:00,115 if they need to build a facility, will find a place to do it. And 1615 02:04:00,395 --> 02:04:04,085 if you'd rather have that be somewhere that's farther from 1616 02:04:04,615 --> 02:04:07,855 civilization, farther from monitoring, farther 1617 02:04:08,725 --> 02:04:12,595 from keeping an eye on things outside of our zoning and, 1618 02:04:12,995 --> 02:04:16,975 and ability to demand what that facility needs to have, well, then 1619 02:04:17,195 --> 02:04:21,175 you're basically saying that, that you think that not having this 1620 02:04:21,655 --> 02:04:24,815 facility here is gonna keep those things from happening that you've mentioned. 1621 02:04:25,715 --> 02:04:29,645 and the reality is you're just going to put it further into rural america, 1622 02:04:30,485 --> 02:04:34,255 someplace where they're happy to have probably those jobs and those temporary facilities, 1623 02:04:35,275 --> 02:04:38,755 and you're going to place people more at risk. When we legislate, 1624 02:04:39,585 --> 02:04:43,585 we have to think to ourselves, what is the unintended consequence of 1625 02:04:43,805 --> 02:04:47,685 what I'm saying and doing? And the fact is that prohibiting 1626 02:04:48,085 --> 02:04:51,645 these facilities proactively. First off, I disagree with our county counselor, 1627 02:04:52,125 --> 02:04:55,945 and there's several court cases I was just able to find that indicate that the 1628 02:04:56,165 --> 02:05:00,045 federal government can build whatever they want on property that they own, no matter what 1629 02:05:00,245 --> 02:05:04,085 the local zoning ordinances are. Um, but there's also just the 1630 02:05:04,285 --> 02:05:08,205 fact that I think if this is going to happen, I'd much rather have it 1631 02:05:08,365 --> 02:05:12,195 happen near where we can keep an eye on it and have some influence over 1632 02:05:12,485 --> 02:05:15,995 the quality and visibility as opposed to further away. 1633 02:05:16,765 --> 02:05:20,615 I think you're placing people more at risk for performative politics, consistent 1634 02:05:21,355 --> 02:05:25,325 with simply trying to placate people, when in reality 1635 02:05:25,865 --> 02:05:29,295 we need to pass responsible legislation that helps keep people safer 1636 02:05:29,985 --> 02:05:33,845 and doesn't pretend to do things that we simply don't have the authority to do. 1637 02:05:34,225 --> 02:05:37,605 that's all. Thanks. Comments, questions, uh, legislators, 1638 02:05:39,205 --> 02:05:43,165 I just wanted to state for the record that I don't know how you got a background check in 1896 1639 02:05:44,605 --> 02:05:48,525 , um, from anybody who's come from all over the world, but fine. The other 1640 02:05:48,705 --> 02:05:52,595 aspect of this is, is that it, it, it will never stop 1641 02:05:53,075 --> 02:05:56,865 because even if, let's say they build it here and it's a beautiful building and 1642 02:05:57,545 --> 02:06:01,385 by golly, and, and we wanna, we're going to be able to watch it by 1643 02:06:01,605 --> 02:06:05,405 god, we're gonna be able to say, you know what, that doesn't look right. Distill, the same 1644 02:06:06,005 --> 02:06:09,985 argument would happen again. Well, it's the federal government. We 1645 02:06:10,205 --> 02:06:14,095 have no way to change it whatsoever. No matter what, what 1646 02:06:14,385 --> 02:06:18,305 happens. So that's what I asked my friend. What, what would 1647 02:06:18,545 --> 02:06:22,385 happen if the federal government built something, if they built 1648 02:06:22,585 --> 02:06:26,505 something and we didn't like it, what are we gonna do? What would 1649 02:06:26,785 --> 02:06:30,785 a legislative body do if they don't have air conditioning, if they don't 1650 02:06:30,985 --> 02:06:34,975 have restrooms? What are we gonna do? Waiting 1651 02:06:35,575 --> 02:06:39,175 till you're ready. So, oh, please, please, go ahead. Yeah, 1652 02:06:39,645 --> 02:06:43,465 so, so again, we've got a county counselor telling us we can regulate 1653 02:06:43,665 --> 02:06:47,545 things. So we would have the option of trying, as opposed to 1654 02:06:47,885 --> 02:06:51,805 if this is something in, I don't know, let's say cooper county, 1655 02:06:53,375 --> 02:06:57,105 then we have no authority. So would you rather have 1656 02:06:57,385 --> 02:07:01,215 something exist that you might have a chance to regulate and improve? Also, 1657 02:07:01,505 --> 02:07:05,295 we have a very active local media here. We have active people who care 1658 02:07:05,585 --> 02:07:09,365 about immigrants here. If we go far, far out into the country, what's 1659 02:07:09,785 --> 02:07:13,655 the likelihood that that same level of visibility is gonna help keep people safe? 1660 02:07:14,045 --> 02:07:17,925 and the answer is obvious. The answer is, if we ship these people to 1661 02:07:18,145 --> 02:07:22,065 the moon, they're much less safe than if they're here. If we send them to 1662 02:07:22,285 --> 02:07:26,145 cooper county in a detention center where there's very few people keeping 1663 02:07:26,465 --> 02:07:30,125 an eye out for their safety, it's worse. It just is. 1664 02:07:30,565 --> 02:07:34,425 and I know that's not the answer you want because the population has gotten 1665 02:07:34,665 --> 02:07:38,525 worked up about something that they've seen for the most part on tv or social 1666 02:07:38,805 --> 02:07:42,725 media. But the fact is that whatever's happening, if you want 1667 02:07:42,965 --> 02:07:46,905 it to happen in the cold, harsh light of reality, the 1668 02:07:47,125 --> 02:07:50,845 closer it is to being in a media market where people 1669 02:07:51,185 --> 02:07:55,085 pay attention, the better, not the worst. Um, as to the 1670 02:07:55,365 --> 02:07:59,245 question of, of, um, how people were vetted, they, they 1671 02:07:59,525 --> 02:08:03,405 were required to provide information upon their, uh, arrival. And often 1672 02:08:03,755 --> 02:08:07,525 that included letters of recommendation from people who already lived here. Often 1673 02:08:07,805 --> 02:08:11,735 it was families that essentially vouched for their, their peers. 1674 02:08:12,545 --> 02:08:16,515 no, it's not perfect, just like it's not perfect today. People come from places that have very 1675 02:08:16,805 --> 02:08:20,625 little record keeping, and we still accept them, but we do our best. The 1676 02:08:20,845 --> 02:08:24,245 point is, when you just opened the border and had no vetting, 1677 02:08:24,915 --> 02:08:28,825 then you really left us in a very bad place where we have bad people who 1678 02:08:29,045 --> 02:08:32,725 might do bad things. And if we don't provide the resources 1679 02:08:33,385 --> 02:08:37,205 or if we try to restrict the resources of federal government to try to fix the problem that 1680 02:08:37,485 --> 02:08:41,385 was created, then we are doing ourselves a disservice. Mr. 1681 02:08:41,845 --> 02:08:45,165 chairman, and then I'm, I'm I just really quickly, 1682 02:08:46,105 --> 02:08:49,715 um, I appreciate that legislator about, um, that 1683 02:08:50,285 --> 02:08:53,645 somebody could find a letter with them from a family member, 1684 02:08:54,665 --> 02:08:58,605 uh, to hand to the united states government, and they'll let you in, 1685 02:08:59,225 --> 02:09:03,225 uh, because somebody vouched for you. Also, there was no way to verify 1686 02:09:04,105 --> 02:09:06,405 if those individuals just wrote it on the ship. 1687 02:09:10,165 --> 02:09:14,155 there just wasn't. So, uh, and, and also what I think is 1688 02:09:14,355 --> 02:09:17,495 quite interesting in the next breath, you say 1689 02:09:18,425 --> 02:09:21,915 that, well, this can be built here. And as what our county counselor has said, 1690 02:09:22,695 --> 02:09:26,395 uh, we can have control over this. But that's something I didn't say control. 1691 02:09:28,185 --> 02:09:32,075 what do we do then? If someone builds something, we don't like it. What is that? We don't have control over 1692 02:09:32,235 --> 02:09:36,095 it. Well, first off, we would try to use our zoning requirements, but 1693 02:09:36,315 --> 02:09:39,855 you disagree with it and our, and our building requirements, you disagree with what he's saying? No, 1694 02:09:40,475 --> 02:09:44,435 I didn't say we couldn't have somebody request a zoning permit. Tell us what 1695 02:09:44,595 --> 02:09:48,275 the facility's gonna look like. Tell us what, tell us what its characteristics 1696 02:09:49,015 --> 02:09:52,915 are, and then make a zoning decision. I think if we said no, the federal government 1697 02:09:53,435 --> 02:09:57,375 maybe could do it anyway, but at least we would have the opportunity to say yes 1698 02:09:58,415 --> 02:10:02,275 before they just go build whatever inhumane thing that you think they want 1699 02:10:02,515 --> 02:10:06,425 to go build. I, I, it seems obvious to me that 1700 02:10:06,715 --> 02:10:10,585 we would rather have something that we have a little bit of say in potentially than 1701 02:10:10,935 --> 02:10:14,705 no say at all. And a moratorium just says, don't bring it here, send 1702 02:10:14,995 --> 02:10:18,835 it somewhere where people don't care. That's what you're doing. You're saying, we don't want it here, so 1703 02:10:19,295 --> 02:10:22,995 I'm gonna rec they don't. So what I think is interesting is that you mentioned cooper county. 1704 02:10:23,655 --> 02:10:27,595 are you saying to the government of cooper county, they don't care? I'm giving an example. Thank you. I 1705 02:10:27,675 --> 02:10:30,675 just don't need that further away. But what the whole fact of the matter is, let's be honest here. 1706 02:10:32,195 --> 02:10:36,125 republican tactics are what? Being used an open 1707 02:10:36,425 --> 02:10:40,245 border by god, they were sending all of these people, you wouldn't even believe it. 1708 02:10:40,555 --> 02:10:44,435 they're running the streets. We can't even walk outside without running into 1709 02:10:44,925 --> 02:10:48,655 somebody who wants to just take us out. Oh, and you're also influenced, you know, young jalen 1710 02:10:49,205 --> 02:10:53,045 anderson, you're influenced by what the public thinks. Well, my god, what 1711 02:10:53,325 --> 02:10:57,305 an idea. You're influenced by what the public thinks. You're 1712 02:10:57,725 --> 02:11:01,465 influenced by what they've seen on tv. Thank god we have phones now, 1713 02:11:01,755 --> 02:11:05,455 because you know, what we witnessed on a phone is that an individual being 1714 02:11:05,915 --> 02:11:09,845 shot because they were trying to take care of somebody else. Thank god. 1715 02:11:10,345 --> 02:11:14,085 we have this ability to see that when a child is taken into a 1716 02:11:14,445 --> 02:11:18,405 facility and not given medical care or the individual from 1717 02:11:18,685 --> 02:11:22,485 arizona who's taken in without medical care or this us citizen 1718 02:11:22,845 --> 02:11:26,105 that's taken in because of the color of their sin skin, thank god, 1719 02:11:27,955 --> 02:11:31,605 I will say, thank god we can see it. Thank 1720 02:11:32,215 --> 02:11:35,835 god people are outraged because you should be. 1721 02:11:37,155 --> 02:11:41,005 it is not this idea of, well, you know, if you just sit back and, and will 1722 02:11:41,295 --> 02:11:45,295 be able to control all this and will be able to do all these different types of things. We've got the media 1723 02:11:45,605 --> 02:11:49,495 here. The people are everywhere. The people have the 1724 02:11:49,795 --> 02:11:52,775 access to film anything at any time, at any point. 1725 02:11:53,875 --> 02:11:57,675 so let's get around this whole idea of that. Well, we 1726 02:11:57,895 --> 02:12:01,175 would be along with this. We would be the compassionate conservative 1727 02:12:02,115 --> 02:12:04,675 if we could just do it here. No, 1728 02:12:06,435 --> 02:12:10,245 no. They have it in florida. They have it in texas. They 1729 02:12:10,535 --> 02:12:14,485 have plenty, lots more money than this county does. What do they have? What 1730 02:12:14,775 --> 02:12:18,535 have they been able to stop? Nothing. That's what we've seen. 1731 02:12:19,285 --> 02:12:22,975 it's nothing. So why would we let the werewolf 1732 02:12:23,495 --> 02:12:27,315 into the house? Why would we let these people come after all 1733 02:12:27,535 --> 02:12:31,375 of our citizens, those individuals who are part of our community for years and years 1734 02:12:31,575 --> 02:12:35,295 and years, why do we say, well, we tried, we let 1735 02:12:35,655 --> 02:12:39,015 'em on in here, but it just didn't work out. But at least 1736 02:12:39,675 --> 02:12:43,645 we have a medium market. At least we have a possibility of laws 1737 02:12:44,365 --> 02:12:48,175 that we might be able to say. Somebody comes up here and says, oh, don't worry, 1738 02:12:48,705 --> 02:12:52,595 don't worry. We'll be able to get you medical care. Don't worry. We're gonna have a place for 1739 02:12:52,815 --> 02:12:56,695 people to, to, uh, have air conditioning, to have heat, to have an 1740 02:12:56,855 --> 02:13:00,595 actual space to live in. Not treat it just like cattle or 1741 02:13:00,985 --> 02:13:04,975 worse than cattle. But then what happens? They go out and they 1742 02:13:05,095 --> 02:13:08,265 do the complete opposite. I've seen it several times. 1743 02:13:09,175 --> 02:13:12,985 this is a new one. Government people lie to government and this body 1744 02:13:13,805 --> 02:13:14,185 all the time. 1745 02:13:20,515 --> 02:13:23,365 I'll, I'll, I'll, um, I'm done. 1746 02:13:25,105 --> 02:13:28,535 any other comments? Uh, legislator smith. Megan smith. 1747 02:13:29,205 --> 02:13:32,615 sorry. You have your hand up? Yes. Tha thank you, mr. Chairman. 1748 02:13:33,235 --> 02:13:36,885 um, I'll just start by saying I, I do plan to support 1749 02:13:37,375 --> 02:13:40,935 this ordinance, uh, primarily for the reason that the council just stated 1750 02:13:41,685 --> 02:13:45,095 with, um, I mean, I understand that this only impacts the unincorporated area. 1751 02:13:45,875 --> 02:13:49,655 um, and we do have, uh, partnerships with the federal government in unincorporated 1752 02:13:50,295 --> 02:13:54,095 areas. So we would have, if I'm understanding you right, mr. Kavinski, 1753 02:13:54,995 --> 02:13:58,535 uh, some sort of legal standing if that were to ever happen in the unincorporated 1754 02:13:59,215 --> 02:14:03,215 area. So for that reason, I, I will be supportive, but I also think it's important 1755 02:14:03,375 --> 02:14:07,295 to state for the record, um, you know, let's not get to 1756 02:14:08,875 --> 02:14:12,395 q with, you know, with quoting lazarus 1757 02:14:12,885 --> 02:14:16,725 and the statue of liberty. Because just as a, a historical reminder since reciting history 1758 02:14:17,505 --> 02:14:21,245 during that time, there was people who looked like me, who were just fresh out of emancipation 1759 02:14:21,845 --> 02:14:25,645 and dealing with jim crow, who were not welcome in this country and who weren't 1760 02:14:25,885 --> 02:14:29,385 brought, brought here through immigration. Rather, it was forced 1761 02:14:30,085 --> 02:14:34,005 enslavement and forced migration. So I, um, we should tread lightly when we 1762 02:14:34,125 --> 02:14:37,955 start quoting those types of things. They don't apply to everyone. Um, I've 1763 02:14:38,245 --> 02:14:42,205 served for 20 years in this country. I've seen detention centers, I've seen the flaws in them. 1764 02:14:42,905 --> 02:14:46,785 um, our country was just as much flaw then as it's now. So, 1765 02:14:47,065 --> 02:14:50,445 um, I just wanna state that for the record, but I'll be supporting this ordinance. 1766 02:14:53,075 --> 02:14:56,925 any other comment, questions, thoughts? All right. Uh, 1767 02:14:57,195 --> 02:15:00,945 mayor jo, please call the roll. I'm sorry 1768 02:15:01,345 --> 02:15:05,025 I didn't get the mover and seconder on the move. I'm I, second. I was the mover. 1769 02:15:05,715 --> 02:15:09,065 mover and seconder. Okay. Jaylen and donna. Okay. Sorry. Two. This is a perfect 1770 02:15:13,225 --> 02:15:17,145 anderson. Yes. Peyton? Yes. Smith? Yes. 1771 02:15:18,375 --> 02:15:21,765 husky. Yes. Franklin? Yes. 1772 02:15:23,235 --> 02:15:26,855 mcgee, lauer smith? No. Abar. 1773 02:15:27,825 --> 02:15:30,785 absolutely. Six. Yes. 1774 02:15:32,185 --> 02:15:35,805 one, no. One abstine. One abstain. Or I'm sorry, one absent. One 1775 02:15:36,405 --> 02:15:40,365 chairman. Yep. I'm to adopt. It's been a motion to adopt. Is 1776 02:15:40,565 --> 02:15:44,555 there? Objection. Objection. Seconded. Wait, what are we doing? There's an objection. Wait, 1777 02:15:44,995 --> 02:15:47,205 what are we doing? Motion to adopt. Move to adopt. 1778 02:15:49,025 --> 02:15:52,595 motion to adopt necessary. Okay. And there's an objection. Okay. 1779 02:15:53,145 --> 02:15:56,805 we are we still on 60 61? Yes. We already, 1780 02:15:57,985 --> 02:16:01,925 we oh, we already, we already, we already perfected it. I thought with the voice vote. Do we not? 1781 02:16:02,345 --> 02:16:06,225 no. No, we not. Okay. No. Okay. Got it. So, 1782 02:16:06,505 --> 02:16:09,605 uh, madam clerk, can you remind us, uh, what an objection dictates 1783 02:16:11,555 --> 02:16:14,965 objection would, would then mean that they need six votes to adopt. 1784 02:16:15,595 --> 02:16:19,285 okay. So there's a motion to second, um, for adoption. 1785 02:16:19,785 --> 02:16:23,685 the motion was, yep. And any discussion? You were the second. 1786 02:16:25,545 --> 02:16:29,005 all right. Uh, mary jo, please call the roll. And sean ob 1787 02:16:29,725 --> 02:16:33,635 objected. Yes. Yes. Okay. So now, 1788 02:16:35,055 --> 02:16:38,795 anderson? Yes. Peyton? Yes. Smith? Yes. 1789 02:16:39,945 --> 02:16:43,475 husky? Yes. Franklin? Yes. 1790 02:16:44,545 --> 02:16:48,065 mcgee lauer smith? No. A barca? 1791 02:16:48,855 --> 02:16:52,815 absolutely. Six. Yes. One, no. One absent. One excused. We'll be 1792 02:16:52,895 --> 02:16:56,095 sending that to the county executive for signature. It did pass. 1793 02:16:57,915 --> 02:17:01,695 moving on. Uh, madam 1794 02:17:02,155 --> 02:17:06,095 or mr. Chairman? Yeah. Mr. Franklin. Legislative franklin. 1795 02:17:06,755 --> 02:17:10,635 uh, I re I, uh, move that we waive the reading on 6 0 6 4 1796 02:17:11,965 --> 02:17:15,935 through 6 0 6 8. And that there's gonna be a public hearing 1797 02:17:16,435 --> 02:17:20,095 on all of those on march the 23rd at one o'clock. 1798 02:17:22,505 --> 02:17:26,285 all right, I'll second the waiving. It's been moved in second. Any discussion? 1799 02:17:27,435 --> 02:17:31,365 hearing none. Mary jo, would you, you could just do by voice vote. 1800 02:17:31,665 --> 02:17:35,625 oh, just, okay. All those in favor, please indicate by the sign of aye. Aye. Aye. Aye. Any 1801 02:17:35,845 --> 02:17:39,805 opposed? Ayes have it. Ayes do indeed have it. I drafted, 1811 02:18:21,205 --> 02:18:25,105 uh, proposed amendment and send it to the county counselor's office late last week. I 1812 02:18:25,225 --> 02:18:28,415 don't know that they've had time to fully vet that and take care of it yet. Okay. 1813 02:18:29,485 --> 02:18:33,345 uh, motion to hold. Moved to hold or second to hold. Moved and seconded. 1814 02:18:33,665 --> 02:18:35,825 all right. Without any objection. Uh, unfortunately the public works committee did not meet today. I understand 1821 02:19:07,625 --> 02:19:11,385 legislative franklin might have a request to withdraw, or, I'm sorry, not 1822 02:19:11,665 --> 02:19:13,615 withdraw. Um, break outta a committee. Authorizing 1835 02:20:06,645 --> 02:20:10,495 the chair of the jackson county drug task force to execute a legal services agreement with williams and campo 1836 02:20:11,145 --> 02:20:15,045 pc of lee summit, missouri to provide legal services for the task force at a cost the 1837 02:20:15,205 --> 02:20:19,045 county not to exceed $3,500. Anti-crime committee report from, uh, committee. 1838 02:20:19,715 --> 02:20:23,475 committee recommends adoption. All right. Without 1839 02:20:23,965 --> 02:20:26,325 any objection, we'll advance to the consent agenda. 1840 02:20:28,625 --> 02:20:32,605 2 2 1 6 0 authorizing the county council to execute a legal services agreement with 1841 02:20:32,805 --> 02:20:36,685 certain lawyers and law firms at an aggregate cost of the county not to exceed $50,000. Finance 1842 02:20:37,025 --> 02:20:40,685 and audit committee. Um, the committee did not meet. 1843 02:20:41,135 --> 02:20:44,945 there is a request, um, to discharge this, um, 1844 02:20:45,825 --> 02:20:49,725 as the sponsor. I will give that to you, sir. Mr. Chair, I'd like 1845 02:20:49,845 --> 02:20:53,645 to move to discharge, uh, this from committee. It's been 1846 02:20:53,895 --> 02:20:56,015 moved. Is there a second? Second discussion? 1847 02:20:59,465 --> 02:21:02,805 um, I, uh, if I could, mr. Chairman, I'll throw it to general counsel 1848 02:21:03,505 --> 02:21:06,845 or administration to talk about this ordinance a resolution. 1849 02:21:08,995 --> 02:21:12,885 this resolution is to hire grade counsel allison bergman, to help 1850 02:21:13,195 --> 02:21:16,475 with some chapter 100 tax incentive 1851 02:21:17,615 --> 02:21:21,025 legal issues. It has been on the agenda for 1852 02:21:21,655 --> 02:21:25,655 three weeks, maybe, uh, awaiting a committee hearing. Um, there 1853 02:21:26,005 --> 02:21:29,925 was a request, I think, from at least our county executive to add the legislature as a 1854 02:21:30,045 --> 02:21:33,925 means of who can utilize her advisement. So is that something that can be added 1855 02:21:34,145 --> 02:21:37,925 as a friendly amendment or is there, I I don't 1856 02:21:38,165 --> 02:21:41,795 know that it would even need an amendment because it all just goes through the county counselor. So just, 1857 02:21:42,865 --> 02:21:46,765 um, he would direct whatever work the legislature needs, in my opinion. 1858 02:21:47,185 --> 02:21:51,135 but yeah, I, I'm not, say that 1859 02:21:51,255 --> 02:21:54,915 again, I'm sorry. So, in the ordinance or in the resolution, it says specifically that the, 1860 02:21:55,595 --> 02:21:59,575 uh, ms. Bergman's law firm would be accountable to both the county executive and 1861 02:21:59,775 --> 02:22:03,655 general counsel, excluding the legislature. So I just wanna make sure. I think that was a friendly 1862 02:22:03,785 --> 02:22:07,405 suggestion that we add to make sure that we also have the ability to request 1863 02:22:07,895 --> 02:22:11,795 from her what feedback she provides. So 1864 02:22:13,075 --> 02:22:16,975 it directly is opposed to through anyone's office, we, we put this board 1865 02:22:17,465 --> 02:22:21,455 based on the administration's request. Um, you know, they're, they are 1866 02:22:21,755 --> 02:22:25,625 the executive of the administration. So, um, 1867 02:22:26,905 --> 02:22:29,765 you know, it, it's up to what the elected officials would like to do. 1868 02:22:33,945 --> 02:22:37,645 mr. Chair, um, I don't know if you've heard the words, economic development, 1869 02:22:38,685 --> 02:22:42,625 . We haven't been spoken in this courthouse for a lot. Um, this attorney is 1870 02:22:42,845 --> 02:22:46,595 specialized in that, uh, chapter 100 and learn is a very 1871 02:22:46,885 --> 02:22:50,585 good vehicle. And ms. Bergman's firm is, uh, very good at that. Um, 1872 02:22:50,965 --> 02:22:54,645 I, I don't have anything when we asked to, to hire this firm, 1873 02:22:55,225 --> 02:22:59,085 any of that excluded the legislature in any feedback that this law firm would 1874 02:22:59,365 --> 02:23:03,225 give us in any advice that give us in moving forward on anything like that. So, 1875 02:23:03,745 --> 02:23:07,725 um, I, I'm not, I don't have the actual, uh, legislation in front 1876 02:23:07,845 --> 02:23:11,605 of me. I don't, I I hope it doesn't exclude or specifically exclude it. If it does, 1877 02:23:12,405 --> 02:23:16,405 I would ask for a friendly amendment to make sure the legislature, uh, is I, now I have the, the county council 1878 02:23:16,645 --> 02:23:20,645 would say the agent, that, that would report to my office and the county council's office. 1879 02:23:20,685 --> 02:23:24,565 and the county council is also your lawyer also. Uh, so I don't know anything to 1880 02:23:24,765 --> 02:23:28,315 exclude it, but let me go on record, make sure that I don't want any, uh, counsel 1881 02:23:28,865 --> 02:23:32,525 to come in and exclude the legislature from any sort of their feedback or contact. 1882 02:23:33,825 --> 02:23:37,775 I think in, in the past we've had, like when we did the, um, the general 1883 02:23:38,665 --> 02:23:42,205 contract for negotiations with the stadiums, we just listed all three. That way there was no 1884 02:23:42,995 --> 02:23:46,425 discretion one way or another, or, or not. 'cause they're under different administration. 1885 02:23:47,265 --> 02:23:51,165 I think there was some challenges with who, what worked for 1886 02:23:51,645 --> 02:23:55,505 and that interest. I think since it's such a small change, you can just move 1887 02:23:55,745 --> 02:23:59,505 to amend to add the word county legislature. Okay. Wherever it lists 1888 02:23:59,805 --> 02:24:03,265 the other two. Um, I'll make a motion to adopt. 1889 02:24:05,125 --> 02:24:09,085 are we adopting an amendment? You have to accept an amendment. Are we doing an amendment or 1890 02:24:09,725 --> 02:24:13,045 we have had the county executive, um, 1891 02:24:13,775 --> 02:24:17,705 make a statement that on the record, that we would not be excluded 1892 02:24:17,865 --> 02:24:21,745 just as we are not as excluded with our county council. Or do we need an amendment? 1893 02:24:24,505 --> 02:24:28,445 I would like to move that we add the county legislature to 1894 02:24:28,665 --> 02:24:32,345 this. Alright, you second, move in second. It's been moved and seconded to 1895 02:24:32,835 --> 02:24:36,445 amend 2 2 1 16 0 to add the legislature as 1896 02:24:36,985 --> 02:24:40,535 a part of the group that this 1897 02:24:41,025 --> 02:24:45,005 attorney would engage with. Um, all those in favor by sign of aye. Aye. 1898 02:24:45,325 --> 02:24:49,015 aye. Aye. Aye. I think the ayes have it, but just in case. Are there any nays? 1899 02:24:50,385 --> 02:24:54,245 I don't hear any so. We'll, I'll make a motion to adopt as 1900 02:24:54,615 --> 02:24:58,185 amended. It's been moved to adopt as amendment. And seconded. 1901 02:24:59,205 --> 02:25:02,095 um, there's discussion mr. Chair. Have, 1902 02:25:03,565 --> 02:25:07,175 and, uh, mr. Barca, can I give this back to you? Are you done? Okay. 1903 02:25:07,765 --> 02:25:11,425 and then you could, uh, legislative smith, has the motion 1904 02:25:11,815 --> 02:25:15,705 been made to discharge this for from committee? 'cause we're making amendments or 1905 02:25:15,825 --> 02:25:19,185 something that's stuck in committee. Oh, that's a good point. Say that again. Sorry. 1906 02:25:21,085 --> 02:25:24,845 we haven't discharged this from committee yet. And we're making amendments on something 1907 02:25:25,165 --> 02:25:29,085 that is stuck in committee. So procedurally we should discharge it first, make amendments 1908 02:25:29,745 --> 02:25:33,585 and then proceed with adoption. There was a motion 1909 02:25:33,805 --> 02:25:37,605 and a second to discharge. Was there not, not a vote, no. 1910 02:25:37,895 --> 02:25:41,625 okay. I don't have a vote. I don't have a vote issued. So it, it, they breathe. 1911 02:25:42,405 --> 02:25:46,325 so it's been moved and seconded to discharge from committee . I'm gonna pretend I'm 1912 02:25:46,545 --> 02:25:50,465 still the chair 'cause I think that was my miss. Um, all those in 1913 02:25:50,665 --> 02:25:53,705 favor to discharge, uh, from the finance and audit committee. 1914 02:25:54,905 --> 02:25:57,805 resolution 2, 2 1 6 0 by sign of aye. Aye. Aye. Aye. 1915 02:25:59,005 --> 02:26:02,265 all those not in favor of discharging from committee 1916 02:26:04,235 --> 02:26:08,225 hearing none. 2, 2, 1. Six zero is discharged from committee. And just to dot 1917 02:26:08,445 --> 02:26:11,925 our I's and cross our t's. Is there a motion to amend to include the legislature, 1918 02:26:12,465 --> 02:26:16,065 mr. Chairman, now that it's been discharged? Mr. Chairman? Yes. Mr. Anderson, uh, 1919 02:26:16,665 --> 02:26:20,065 uh, . Mr. Str, um, 1920 02:26:20,865 --> 02:26:24,505 uh, I'd like to make an amendment that the legislature is added in 1921 02:26:25,055 --> 02:26:28,965 along with the county executive and the counselor's office. You second 1922 02:26:29,985 --> 02:26:33,885 to amend it. It's been moved and seconded to amend it as per mr. Anderson. All 1923 02:26:34,085 --> 02:26:38,055 those in favor by sign? Aye. Aye. Aye. I make a motion to adopt 1924 02:26:38,545 --> 02:26:42,535 as amended. I second it. It's been moved and seconded to adopt 1925 02:26:43,225 --> 02:26:47,225 the as amended and, and now for discussion. And, and 1926 02:26:47,505 --> 02:26:50,985 my, I just have a couple of questions. Yep. Mr. Vice chair. Um, 1927 02:26:51,745 --> 02:26:55,175 and thank you by the way, legislator, uh, megan smith 1928 02:26:56,145 --> 02:27:00,105 for catching that we hadn't discharged it. So my question is, um, did 1929 02:27:00,325 --> 02:27:04,205 we do any kind of a formal selection process or bid process to determine which 1930 02:27:04,765 --> 02:27:08,605 attorney to hire for this purpose? Because I know that there's lots of people 1931 02:27:08,825 --> 02:27:12,725 who kind of specialize in chapter 100. We did. We did not. This is a, a, a 1932 02:27:13,645 --> 02:27:17,565 a firm that we have had contracts with before and they're specialized in 1933 02:27:17,725 --> 02:27:21,025 this is a firm who we chose to go with. Okay. Um, 1934 02:27:22,665 --> 02:27:26,605 so that's just a personal concern for me that we just pick somebody 1935 02:27:26,685 --> 02:27:30,645 that we've worked with before and didn't do any kind of selection process. I know from time to time 1936 02:27:30,805 --> 02:27:34,355 that's necessary. When things are urgent, is there a specific urgency 1937 02:27:34,845 --> 02:27:38,805 associated with this that you can, uh, tell me yes or no? And then if 1938 02:27:38,925 --> 02:27:42,805 so, is it an urgency that you can disclose without creating a problem? Not an urgency. It's based on 1939 02:27:42,965 --> 02:27:46,745 law. Uh, attorney and law firms based on experience and certain issues are 1940 02:27:47,325 --> 02:27:51,245 entirely different than other agencies that are contracting. And it's, it's not apples to oranges. 1941 02:27:52,285 --> 02:27:55,865 um, this firm has been productive in this, have experience in this. 1942 02:27:56,405 --> 02:28:00,215 um, this is the firm that we chose to go with and, and the firm name 1943 02:28:00,565 --> 02:28:04,465 you mentioned a lawyer's name. Is that the firm name? The firm name is specifically 1944 02:28:05,175 --> 02:28:08,585 grid counsel, gray grid, gid. 1945 02:28:09,735 --> 02:28:13,585 okay. So we're contracting with that firm, but we named a particular, 1946 02:28:14,105 --> 02:28:17,885 it's a solo firm individual. It's a solo firm. Solo firm. Got it. Thank you. Um, 1947 02:28:18,565 --> 02:28:22,525 so yeah, that's, that's, it's a concern for me that we are doing a no bid contract 1948 02:28:22,865 --> 02:28:26,725 for $50,000 for an attorney that obviously somebody knows and we've 1949 02:28:26,965 --> 02:28:30,845 done business with in the past. I, um, I know that we do this from 1950 02:28:31,045 --> 02:28:34,405 time to time, but if there's no urgency, I don't understand why we wouldn't have, 1951 02:28:35,185 --> 02:28:38,905 um, sought bids from qualified participants. So 1952 02:28:40,165 --> 02:28:43,715 I, I would just speak to the council is entirely different than, 1953 02:28:44,505 --> 02:28:48,365 uh, any sort of other bid process. Um, they're intangibles that 1954 02:28:48,705 --> 02:28:52,605 as the account executive, I need to choose someone that I'm comfortable with the exact same 1955 02:28:53,105 --> 02:28:57,025 way this legislature would choose and has chosen law firms in 1956 02:28:57,245 --> 02:29:00,685 the past that they were comfortable with. Do you wanna give general counsel 1957 02:29:01,595 --> 02:29:05,465 your opinions on well, the selection of, no, my 1958 02:29:05,845 --> 02:29:09,665 question was actually related to the amendment. I'm looking at the language here and 1959 02:29:09,885 --> 02:29:13,845 it doesn't actually list the county executive anywhere. So I wasn't sure where you 1960 02:29:14,005 --> 02:29:18,005 wanted it to say county legislature, unless I'm yeah. Not looking at 1961 02:29:18,125 --> 02:29:21,945 she should say in the last paragraph, and maybe I'm look obviously on a phone, so maybe I'm missing it. 1962 02:29:23,125 --> 02:29:27,005 I just wanna know exactly where you want it. Just to clarify, did the general counsel wanna provide 1963 02:29:27,325 --> 02:29:30,125 context for a selection of your own legal advisors 1964 02:29:34,775 --> 02:29:38,665 told in here? What I'm afraid that, which, sorry, which 1965 02:29:38,865 --> 02:29:42,685 paragraph did you want in? I'm working on that part. But you wanna give the opinion on the 1966 02:29:43,145 --> 02:29:46,145 selection of the administration's opinion on, uh, legal advisors. 1967 02:29:48,755 --> 02:29:52,505 sorry, I don't think I heard the question. Y you, you all have the ability to choose your 1968 02:29:52,785 --> 02:29:56,065 legal advisors third party counsel, do you? Not 1969 02:29:57,345 --> 02:30:01,185 actually. It, uh, legislator smith is correct, but when time is 1970 02:30:01,385 --> 02:30:05,025 of the essence, many times we can't go through that process. And it is 1971 02:30:05,535 --> 02:30:09,505 discretionary then to not do it that way. And in this specific instance, 1972 02:30:10,205 --> 02:30:13,945 uh, it was conveyed to us that, uh, this firm, the grid council, 1973 02:30:14,965 --> 02:30:18,905 was specifically interested in working with the administration and they had worked 1974 02:30:19,065 --> 02:30:22,885 with them previously. Is was, I know there was a question about the 1975 02:30:23,215 --> 02:30:27,125 exclusivity of the work. Is that a sole source or is this something that's beyond 1976 02:30:27,645 --> 02:30:31,205 normal uniqueness? It's not a so source. 1977 02:30:31,785 --> 02:30:35,145 I mean, the sole source is, is something 1978 02:30:36,095 --> 02:30:39,345 when it's a unique practice. But when you're talking legal profession, 1979 02:30:40,365 --> 02:30:44,305 you want to work with someone who you trust and who you have worked with in the past. 1980 02:30:44,605 --> 02:30:48,505 and so I don't necessarily believe sole source is necessarily applicable 1981 02:30:49,135 --> 02:30:52,945 when you're dealing with someone who is representing the county. You want someone 1982 02:30:53,245 --> 02:30:57,105 you comfortable with, just as an individual would want somebody that they were 1983 02:30:57,265 --> 02:31:01,205 comfortable with. My doctor, if I 1984 02:31:01,325 --> 02:31:05,285 may. Uh, yes. Vice chair. Yeah. That notion. I 1985 02:31:05,445 --> 02:31:09,285 I would say we could say, I wouldn't say be true of a construction project. 1986 02:31:09,705 --> 02:31:13,525 why wouldn't the same be true of picking a janitorial supply vendor? I, 1987 02:31:13,725 --> 02:31:17,585 I mean, I understand lawyers know lawyers, and that's great that we have a lawyer as 1988 02:31:17,805 --> 02:31:21,765 a county executive and we, we have a county counselor's office. I, I just, I think 1989 02:31:21,925 --> 02:31:25,505 that our procurement policies are put in place, um, both to 1990 02:31:25,935 --> 02:31:29,825 avoid the appearance of impropriety and favoritism as 1991 02:31:30,045 --> 02:31:33,965 well as to make sure that, um, we, since we're spending the public's 1992 02:31:34,325 --> 02:31:38,205 money, we entertain the idea of doing business with as 1993 02:31:38,365 --> 02:31:42,185 many people of the public as possible. Otherwise, we're essentially creating an 1994 02:31:42,405 --> 02:31:46,365 exclusive club. If I know somebody at the county, I might get to work with the 1995 02:31:46,485 --> 02:31:50,425 county. Um, I, so I'm really uncomfortable with this the more I hear. So 1996 02:31:51,525 --> 02:31:55,325 I will say the code specifically carves out legal services for that reason. 1997 02:31:55,805 --> 02:31:59,565 I I understand it's not an explicit violation in terms of our code. 1998 02:31:59,985 --> 02:32:03,805 I'm not arguing that. Okay. I'm saying if there's not a specific reason, more so 1999 02:32:04,005 --> 02:32:07,445 than I know the person that I'm comfortable with them, that it makes me very uncomfortable. 2000 02:32:08,605 --> 02:32:12,485 I don't think anyone said they'd know the person legislative smith. And this is why we come before 2001 02:32:12,725 --> 02:32:16,525 this body and this body gets to approve that if they want, don't like the counsel that we're 2002 02:32:16,805 --> 02:32:20,485 suggesting this body can vote that down, but at some point, legal service 2003 02:32:20,825 --> 02:32:24,785 are not like janitorial services. They're not like construction. Those are measurable things 2004 02:32:25,205 --> 02:32:29,165 to do. Legal counsel is important for us to put the trust of faith in 2005 02:32:29,365 --> 02:32:32,785 the, the, uh, reputation and the experience that someone has. 2006 02:32:33,385 --> 02:32:37,365 you can't just bid out, well, you could just bid out for lawyers. You get a first year lawyer, 2007 02:32:37,645 --> 02:32:41,485 come out with cheaper. And that's not how I want to choose when 2008 02:32:41,685 --> 02:32:45,585 I'm representing the people of who I'm having to hire this, I wanna have someone that I, that has 2009 02:32:45,805 --> 02:32:49,565 the experience to work in chapter 100 thing. So it's my position to bring it to you. 2010 02:32:50,105 --> 02:32:54,005 um, it's your position to review it and review this firm. If you don't like 2011 02:32:54,165 --> 02:32:57,885 it, you can vote it up or down. Um, but, but this legal issues are entirely 2012 02:32:58,395 --> 02:33:02,045 different than our procurement processes. They're, they're 2013 02:33:02,805 --> 02:33:06,325 actually being able to evaluate it across the board on the people who provide 2014 02:33:07,685 --> 02:33:11,585 construction and janitorial providing a, a lawyer is not 2015 02:33:11,875 --> 02:33:15,845 able to do that. And so that's my professional opinion that, that this firm would be 2016 02:33:15,965 --> 02:33:19,885 good. The, the professional opinion of the county counselors. Not that I know them. I've never 2017 02:33:20,145 --> 02:33:24,125 worked with this ca this attorney before, but I know what she does. I know experience. 2018 02:33:24,525 --> 02:33:28,485 so, uh, it should not be something you're uncomfortable with. I understand from 2019 02:33:28,725 --> 02:33:32,625 an overview. It is, but this is why I bring this to this legislature for 2020 02:33:32,845 --> 02:33:36,205 your review on this specific agenda. Yeah. And, and in particular 2021 02:33:37,105 --> 02:33:41,105 the fact that it was assigned to a committee and the committee hasn't had a chance to meet yet. Um, 2022 02:33:41,325 --> 02:33:44,815 oftentimes if we're hearing from a vendor, that's when we do it, now all of a sudden we're 2023 02:33:45,845 --> 02:33:49,825 discharging it from the or we have discharged it from the committee. Um, and, 2024 02:33:50,505 --> 02:33:54,045 and just didn't avail ourselves of that opportunity. I'm, I'm just saying it makes me uncomfortable. 2025 02:33:54,585 --> 02:33:58,365 I'm not trying to convince my colleagues to pass or not pass this. I'm just saying 2026 02:33:58,785 --> 02:34:02,515 for, for me, if there's no urgency and there was no kind 2027 02:34:02,805 --> 02:34:06,605 of broad net cast, whether it's for somebody we're hiring 2028 02:34:07,025 --> 02:34:10,805 or for, in this case, hiring an attorney, that, that just concerns me. 2029 02:34:11,125 --> 02:34:14,965 I I know when we were looking for a new attorney for assessment, um, I had 2030 02:34:15,165 --> 02:34:19,085 some concerns because the person didn't have the right background. But that was the person we could find willing 2031 02:34:19,365 --> 02:34:23,365 to do the work, and ultimately we approved it. But that was after some discussion and some 2032 02:34:23,565 --> 02:34:27,405 opportunity to make sure that, that we were really using the public's money for the, 2033 02:34:27,865 --> 02:34:31,705 for the person who was the best fit, um, and available and willing. Um, 2034 02:34:32,225 --> 02:34:35,985 and, and I understand it's not janitorial services. I I get all that, but, 2035 02:34:36,385 --> 02:34:39,765 uh, it just, it strikes me that, that we skipped the process. 2036 02:34:40,865 --> 02:34:44,705 um, and if you said, well, if we don't, we have to be in court next week for 2037 02:34:45,085 --> 02:34:48,905 x, y, z or we might lose this opportunity to work with somebody who needs to 2038 02:34:49,235 --> 02:34:53,125 work with us on these chapter 100 things. I, I'd say, okay, maybe there's a 2039 02:34:53,245 --> 02:34:55,685 reason. But now we're just urgent because 2040 02:34:57,485 --> 02:35:00,805 I I, I'm just not comfortable with the urgency, given that we kinda skipped the process 2041 02:35:01,995 --> 02:35:05,955 just to respond. We met with this firm in talking about chapter one hundreds over 2042 02:35:06,365 --> 02:35:10,325 a month ago. And, uh, we've been wanting to work on some projects and we've been 2043 02:35:10,405 --> 02:35:14,405 waiting to get it in front of this body. So I, the, if, if you needed another 2044 02:35:14,645 --> 02:35:18,525 week to do something, I'm fine with that. I I was hoping we could get this moving. We get this 2045 02:35:18,835 --> 02:35:22,485 firm on board and start, uh, exploring some of these opportunities 2046 02:35:23,145 --> 02:35:26,835 we have for the county to raise some revenue. I'm not against this sitting 2047 02:35:27,595 --> 02:35:31,565 here for another week or so, but, uh, I didn't know it would have any, 2048 02:35:31,985 --> 02:35:35,965 uh, issues with it. But if it's something you're uncomfortable with, I can definitely inform the, 2049 02:35:36,185 --> 02:35:40,125 the firm that we're gonna go through the committee. Um, I, I, 2050 02:35:40,445 --> 02:35:44,105 I want you to be comfortable with the decisions that I'm making from my office 2051 02:35:44,525 --> 02:35:48,525 that I'm bringing to you. Um, but the, there shouldn't be something that, that concerns 2052 02:35:48,925 --> 02:35:52,765 you. It is of an urgency issue. We're not in court tomorrow, but we wanna move on these 2053 02:35:52,985 --> 02:35:56,845 issues. And we've, uh, met with this firm for over a week. I mean, excuse me, over 2054 02:35:57,125 --> 02:35:58,805 a month and they're ready to go on it. 2055 02:36:03,145 --> 02:36:06,845 any other questions, comments, thoughts? Yes. To inquire 2056 02:36:07,305 --> 02:36:11,205 mr. Chair? Yeah. Uh, legislator smith. Um, I would 2057 02:36:11,365 --> 02:36:14,645 that inquire of, uh, council and administration, uh, because 2058 02:36:15,715 --> 02:36:19,665 like the vice chair, I'm concerned about impropriety as well. Are you aware that the 2059 02:36:20,215 --> 02:36:24,085 individual listed with this firm has political ties to soliciting sitting legislators, 2060 02:36:24,765 --> 02:36:26,925 including campaign donations, things like that? 2061 02:36:30,485 --> 02:36:34,145 are you inquiring of me? Yes. I was asking if you are aware what counsel's 2062 02:36:34,545 --> 02:36:38,105 aware I have no knowledge of this firm being involved in anybody in the legislature. No. 2063 02:36:39,495 --> 02:36:42,465 okay. Well, I think that, that that deserves, uh, further 2064 02:36:43,625 --> 02:36:47,105 investigation. Um, and considering that there's been concerns in the past, 2065 02:36:47,965 --> 02:36:51,665 um, both with this leadership and the leadership from last year, the legislature about 2066 02:36:52,245 --> 02:36:55,585 no bid contracts, um, I think we should follow that same script 2067 02:36:56,375 --> 02:37:00,145 with any contract that we're bidding out. Um, 'cause just by looking at this contract, 2068 02:37:00,695 --> 02:37:04,265 there's no clear scope of work that we're supposed to be expected, 2069 02:37:05,005 --> 02:37:08,655 uh, communication schedule that we're expected throughout this next year. 2070 02:37:09,645 --> 02:37:13,365 um, and that's concerning considering everything else I just mentioned. 2071 02:37:16,125 --> 02:37:19,775 I would assume that if any member of this legislature had any relationship 2072 02:37:20,495 --> 02:37:24,335 with an attorney in a given campaign donations, they would abstain. So I'm not, 2073 02:37:24,635 --> 02:37:28,455 I'm not familiar who you're talking to, but I have the utmost faith in 2074 02:37:28,655 --> 02:37:32,615 the people in this legislative body that they would not vote if they thought there was a conflict of interest. 2075 02:37:33,315 --> 02:37:37,175 I'm not familiar with that at all. This firm was based on their experience and what they've 2076 02:37:37,335 --> 02:37:40,895 done for the county before and the experience they've done in this realm and this 2077 02:37:41,535 --> 02:37:45,355 actually area of the law. And they're, they're very competent in that. I'd 2078 02:37:45,575 --> 02:37:49,575 like to move to hold. There's a motion. Is there a second we can 2079 02:37:49,655 --> 02:37:53,415 hold until we investigate? Second spend moved and seconded. 2080 02:37:53,955 --> 02:37:57,615 any opposition? All right. We'll hold ordinance in legislature 2081 02:37:58,175 --> 02:38:01,895 as a whole. Um, I'm sorry, I lost my place there. 2 2 1 6 0 2082 02:38:02,845 --> 02:38:05,155 will be held in legislature as a whole. Uh, 2 2 1 6 3 2083 02:38:08,455 --> 02:38:12,135 awarding a contract for the furnishing of items for resell by the parks plus rec department of dunlop 2084 02:38:12,495 --> 02:38:15,855 sports of dallas, texas as a proprietary, as proprietary 2085 02:38:16,815 --> 02:38:19,875 purchases public works committee committee did not meet. So it'll be held 2 2 1 6 5 2086 02:38:21,705 --> 02:38:25,335 award, a 12 month contract with three 12 month options to extend for the furnishing of independent 2087 02:38:25,775 --> 02:38:29,655 auditing services for use by the finance and purchasing department to clifton larson, allen, 2088 02:38:30,095 --> 02:38:34,015 llp of kansas city, missouri, under the terms and conditions of request for proposals number 25 2089 02:38:34,415 --> 02:38:38,055 dash 53. And it cost the county for 2026 not to exceed $150,000 2090 02:38:39,295 --> 02:38:43,255 finance and audit committee. Um, the committee did not 2091 02:38:43,415 --> 02:38:47,335 meet. Um, there is an effort to hold this, although I think the finance department 2092 02:38:47,815 --> 02:38:51,645 is asked for us to remove this. I I I'll 2093 02:38:51,935 --> 02:38:55,175 yield to the county executive if he wants to justify and advocate for that effort 2094 02:38:56,595 --> 02:39:00,535 or if we can hold it for another week. It's your prerogative. Yeah. Could we 2095 02:39:00,735 --> 02:39:03,635 hold that? Okay. Uh, will be, it will be held 2 2 1 7 0. 2096 02:39:05,065 --> 02:39:09,055 we're in contract for the purchase of a deep core airier for use by the park plus rec department. 2097 02:39:09,415 --> 02:39:13,255 two for the fred urbana golf course to some north america inc. Valley 2098 02:39:13,615 --> 02:39:17,535 park, missouri, under the terms and conditions of invitation have been number 25 dash five five 2099 02:39:18,075 --> 02:39:22,015 at cost the county not to exceed $52,541. Public works 2100 02:39:22,295 --> 02:39:24,875 committee. Committee did not meet. So this will be held 2 2 1 7 1 2101 02:39:26,385 --> 02:39:30,335 award, a contract for the furnishing of two ford f 600 trucks and installed snow 2102 02:39:31,335 --> 02:39:35,215 snowplow packages for used by the public works department to viking thieves midwest 2103 02:39:35,615 --> 02:39:39,485 of morley, missouri under the terms and conditions set forth inable contract number 0 6 2 2 2 2 2104 02:39:41,695 --> 02:39:45,695 vcm and existing competitively, big government contract and actual cost the county in the amount 2105 02:39:45,855 --> 02:39:49,755 of $287,050 public works committee. Uh, 2106 02:39:49,975 --> 02:39:52,555 the committee did not meet. So we'll hold that. Uh, 2 2 1 7 2 2107 02:39:55,775 --> 02:39:59,415 recognizing the honorarium payments to community volunteers who assisted in the evaluation 2108 02:39:59,975 --> 02:40:03,705 of nonprofit grant applications, legislatures a whole move to adopt. There. 2109 02:40:04,055 --> 02:40:08,045 a second. Second. It's been moved. Objection. Any discussion? There's 2110 02:40:08,535 --> 02:40:12,535 no objection. There's no objection. One objection. Um, and that would mean that 2111 02:40:12,695 --> 02:40:16,425 we need six votes at this point for resolution. Oh, I'm sorry. No 2112 02:40:16,995 --> 02:40:20,915 five votes. My apologies. I'm just not clear on what an objection for resolution does. 2113 02:40:21,465 --> 02:40:23,635 touche. Is there anybody wanna clarify? 2114 02:40:25,655 --> 02:40:29,515 all right, mr. Kavinsky, you take the vote 2115 02:40:30,175 --> 02:40:34,155 at that time, judge, do you not? Yeah. Rather than wait until the confront 2116 02:40:34,315 --> 02:40:38,275 agenda. Okay. Um, so, uh, with that 2117 02:40:38,575 --> 02:40:42,355 we will do a roll call vote. Is there any discussion or point 2118 02:40:42,595 --> 02:40:45,875 of information? Uh, no. Go ahead. Adam clark. 2119 02:40:47,295 --> 02:40:51,235 two thirds majority needed front. Objection, majority. 'cause 2120 02:40:51,315 --> 02:40:54,355 there's an objection, correct. Two thirds majority, which would give us how many votes? 2121 02:40:55,865 --> 02:40:59,725 six. Sit those present tion. That's what it's saying right 2122 02:40:59,965 --> 02:40:59,965 here. 2123 02:41:06,955 --> 02:41:07,665 okay. So 2124 02:41:13,345 --> 02:41:14,045 paying his friend. 2125 02:41:19,595 --> 02:41:22,535 um, I thought, I thought we already voted on that. 2126 02:41:28,015 --> 02:41:28,875 so is it 2127 02:41:40,115 --> 02:41:40,475 a lot of money? 2128 02:41:45,995 --> 02:41:49,725 is this record setting for our longest meeting in like this, this, 2129 02:41:50,395 --> 02:41:54,135 no, not the legislate, but this, this term, this group of legislators. 2130 02:41:54,875 --> 02:41:58,865 no. ? No. No. 'cause we, no. Yes, we've 2131 02:41:59,375 --> 02:42:02,535 had a meeting longer than this order. . 2132 02:42:03,645 --> 02:42:07,525 okay. Come on. Let remember, let's just go on in the back row and get it over with 2133 02:42:08,415 --> 02:42:10,815 a stack of papers. Yeah, there was a stack. Yeah, there was a stack. 2134 02:42:12,575 --> 02:42:16,525 I think I was absent the next day. Yeah, we we had a longer meeting than 2135 02:42:16,815 --> 02:42:20,735 that. Was I remote and on vacation? Because it might seem 2136 02:42:20,935 --> 02:42:24,875 like it's going faster if I had a cocktail. Uh, mme. Clark, go ahead. I'm sorry. Is 2137 02:42:25,095 --> 02:42:28,735 she just objecting to it going on the consent? So she wants a roll call. Is that the objection? 2138 02:42:29,905 --> 02:42:33,825 legislative smith. That's what we're trying to find. Can you repeat that? I didn't hear the 2139 02:42:34,185 --> 02:42:37,805 question. Go ahead and repeat it again, madam clerk. Oh, 2140 02:42:38,995 --> 02:42:42,985 we're wanting to know. Do you, are you just objecting that it goes on to the consent agenda and 2141 02:42:43,185 --> 02:42:47,125 you want a roll call vote? Yes. 2142 02:42:47,345 --> 02:42:49,545 and I wanted to have discussion. That was the point of my objection. 2143 02:42:54,275 --> 02:42:58,085 okay, so, so we'll move on with the vote vote. Uh, we'll, we'll 2144 02:42:58,285 --> 02:43:01,245 give a discussion. So go, go ahead and, uh, discuss legislator smith. 2145 02:43:02,615 --> 02:43:06,255 which one is that? What you okay, well, I just want the point. Oh, go ahead, mr. Chairman legislator. 2146 02:43:07,055 --> 02:43:08,975 megan swift smith. Sorry. 2147 02:43:11,605 --> 02:43:15,325 I just wanted to point out and make the, the body aware that, uh, resolution 2148 02:43:15,665 --> 02:43:19,185 2 2 1 7 2, um, is seriously legally flawed 2149 02:43:19,745 --> 02:43:23,635 as well as ethically flawed, um, legally flawed because it's 2150 02:43:23,925 --> 02:43:26,865 stated and well known that these individuals that were seeking to pay 2151 02:43:28,325 --> 02:43:32,265 are volunteers and they were under no contract, nor were they expecting any type 2152 02:43:32,505 --> 02:43:35,985 of compensation. And so in addition to that, 2153 02:43:36,515 --> 02:43:39,655 there was also an open encumbrance that was created january 2154 02:43:40,605 --> 02:43:44,425 the 27th, um, which is an earmarked amount of money to 2155 02:43:44,625 --> 02:43:48,385 pay someone for that current fiscal year of work. Um, and we know 2156 02:43:48,695 --> 02:43:52,535 that this, uh, quote unquote work that was done by these evaluators was done last 2157 02:43:52,825 --> 02:43:56,615 fiscal year. So to open up another, uh, line 2158 02:43:56,905 --> 02:43:59,745 of, uh, uh, of funding this fiscal year is fiscally improper. 2159 02:44:00,935 --> 02:44:04,825 that violates the, the missouri state statute as well as the missouri constitution 2160 02:44:05,325 --> 02:44:09,225 is fiscal procedures. Um, so if, if that's not 2161 02:44:09,345 --> 02:44:13,075 enough to understand the serious legality of this, uh, the ethical flaws 2162 02:44:14,735 --> 02:44:18,425 of these individuals that we're seeking to pay. Um, 2163 02:44:18,935 --> 02:44:22,765 these specific volunteers have political ties and have made political 2164 02:44:23,245 --> 02:44:27,085 donations to current city members of the legislature, myself included. 2165 02:44:27,665 --> 02:44:31,155 uh, which is why I take this very seriously because I was not involved in selecting 2166 02:44:31,765 --> 02:44:35,665 any of these volunteers. Uh, these volunteers were selected, uh, 2167 02:44:35,945 --> 02:44:39,885 by four members of the legislature, uh, one being the chairman from last 2168 02:44:40,045 --> 02:44:43,245 year, chairman from this year, as well as the budget chair and finance and audit chair. 2169 02:44:44,805 --> 02:44:48,535 and so, um, so go a step further with the, 2170 02:44:48,855 --> 02:44:51,755 uh, impropriety since we, we just stated we didn't like impropriety. 2171 02:44:52,895 --> 02:44:56,875 uh, one of these volunteers is a current treasurer of an active campaign of one of 2172 02:44:56,995 --> 02:45:00,995 our legislators, legislator mcgee. Um, and another is also 2173 02:45:01,355 --> 02:45:05,195 a board member of one of the organizations that received money from those 2174 02:45:05,545 --> 02:45:09,055 evaluations that they did for the arpa funding. So, 2175 02:45:09,695 --> 02:45:13,425 um, considering all of the investigations going on in our metro area 2176 02:45:13,725 --> 02:45:16,965 right now about fiscal impropriety and, and illegality, 2177 02:45:17,915 --> 02:45:21,825 I think we need to tread lightly when we try to do things retroactively that 2178 02:45:22,275 --> 02:45:26,145 we're not legally obligated to do. So I'm not supporting this 2179 02:45:26,465 --> 02:45:30,455 resolution. I forgot the light. Uh, you 2180 02:45:30,695 --> 02:45:34,515 may, if you would forward those over to the general counsel's office for evaluation and then we can take this 2181 02:45:34,715 --> 02:45:38,485 up. I think if there's move to hold. Thank you. Is there a second? Second? Any objection? 2182 02:45:39,345 --> 02:45:42,625 yep. No objection. But I have a question. Yeah. Um, 2183 02:45:43,785 --> 02:45:47,025 can we make publicly known that list of people that would be 2184 02:45:47,845 --> 02:45:51,845 f this were to pass be receiving an honorarium?
