[8:42] uh, which the, uh, the owner has, uh, filed [8:46] in the county records, uh, approval to lift this restriction to [8:50] this specific lot and this specific lot only, uh, [8:55] from a a, a majority of the owners in this area. So, [8:59] as far as the restrictions are concerned, they don't exist as far as subdividing [9:04] this plot, uh, at at least, uh, kind of in a legal sense. [9:08] they, they were previously, but then a majority of the owners decided [9:12] to lift it and it's been lifted. So as far as the, [9:16] the, the legal, uh, framework [9:21] for this, the, the lot is able to be subdivided. And [9:25] it's up to the county commissioners you guys to decide whether or not, uh, you [9:29] think the, the other owner's rights have been [9:34] infringed, uh, to a a degree that is, [9:39] uh, unnecessary essentially. So I, I just [9:43] wanted to provide you guys with that kind of legal background on that. But if you have any [9:47] questions, I'm more than willing to, to take. Okay. So questions, guys. You have [9:51] to make the decision. Well, this is the deal. We had this before, right? Yes. [9:55] and I know when they came up last time, then we wasn't sure about the legalities [9:59] of the vote. 'cause the people were up here talking before was saying it [10:03] wasn't done right. So [10:08] when this initially came before the commissioner's court several months [10:12] ago, we were really concerned especially about whether the notice had [10:16] been given to the property owners. And so we really determined that it had [10:20] been given to the property owners. And so basically in this neighborhood, [10:25] in the, um, the restrictions in the, the neighborhood, [10:30] there is a, um, within the deeds, if you, [10:34] there's a provision that if you have a multitude, uh, or majority, not [10:38] a multitude of majority of the property owners that agree [10:43] with changing a restriction, that [10:47] you can make that change. And so that is how, [10:51] how basically you get around the deed restrictions [10:56] is, is basically there is an agreement among a majority of the property owners [11:00] to make a change. And, um, it, it's an unusual legal [11:05] document. I know, but it's still a legal document that runs with the land. [11:09] is is it an hoa? Um, it's, it is, [11:13] what is it? It doesn't appear to be an hoa it is, it's strictly a restrictive [11:18] covenant on what you can and can't. Okay. In hd does that? Yeah. Okay. [11:22] so, so it's a little different than like an a nor what I consider a normal or [11:26] the usual hoa, but it is a deed restriction that's a [11:30] covenant that runs with the land. And that's a provision that is in those deed restrictions [11:35] to make changes. And so the, I believe the property owner went [11:39] through the proper process of, of, um, from what I know [11:44] determined is that a majority of the property owners agreed with it. And [11:48] so when that happened, they filed in the deed records, [11:53] the change mm-hmm . Um, in the deeds that could take place. [11:58] and do you have any more to add to that from a legal perspective? No. That, that appears [12:02] to be, uh, everything that karen said is okay. So [12:06] do we have, uh, confirmation that the majority did? Yes. It, it [12:10] filed in the, the county records for this, uh, this property. Okay. Yeah. [12:14] and, and that's why it really took several months to come back, because I know that I was at [12:18] one of the meetings and then mark took over and he was at the meetings. And we've met with property [12:22] owners and the property developer. We've actually gone, the county's [12:26] actually gone with the development services the whole length [12:30] to make sure that everything is, is proper and legal. So I know it's something that [12:35] everybody may not agree with, but it is legally [12:39] and it's in a correct position legally. Okay. And [12:43] I understand where you're coming from. Uh, you [12:47] know, I want property out in the county and you hate to, you buy [12:51] it to be, uh, private [12:56] and then people move in on you and there's not much you could do about it [13:00] that I understand that. Well, my point is, [13:05] you'll have to come back up here. My [13:09] point is, if I would've known this, me and mr. Martin would've [13:13] happily bought that property and done it and developed it ourselves. Right. You know [13:17] what I'm saying? But I mean, we, we was, we was going [13:21] by, we wanted to stay with the restrictions. But I mean, [13:26] it, it's all, it's all about kaufman county because it's tax revenue. [13:30] I know that. Well, the legality is that that provision is in [13:34] the deed and I guess he's found a way to do it by around [13:38] it. Yeah. Yes, sir. Like our attorney said, well, I think it's in the deed that they can vote [13:42] on it, the owners. Well, and, and I did owners [13:46] and I did meet with, uh, monique about this and [13:51] he's been very challenged in getting this done. So I have to say that, 'cause that was part of [14:08] the meeting. But, and just to add to that, um, we did mail the note, the notifications [14:13] to all the property owners, uh, for the third time, uh, the ad was running, the [14:17] paper posted online. So we did go through the proper steps as laid out in texas [14:21] local government code, um, to make sure that everyone was aware that we were [14:25] bringing this back today. And, um, just so you are aware, the, [14:29] these lots can only have one home and one septic. They do not meet, they, [14:33] they're not large enough to put multiple septics and homes on being 1.5 acres. [14:38] but, but what's going to happen, because this is going to turn around to be a domino [14:42] event because they got some more property right next door to it. [14:46] and you, they can, you can tell me, but once you, I see that coman [14:51] county's gonna let this happen, it's gonna be a domino effect, then the next person's [14:55] gonna do the same thing. [16:30] um, it addresses the youth violence, truancy and juvenile delinquency. [16:36] it is, um, through a coordinated evidence-based and community-centered [16:40] approach, focus on early identification, prevention, and [16:45] positive youth development. So we've created this program that [16:49] has it. It's working. I mean, we, we, we just kind of got into it because the funding [16:54] was late. Okay. Trying to do something. Um, [17:35] this focuses on the spay and neuter of animals, [17:39] um, that are within our county. I mean, we will apply for that, [17:44] but it's animals that are in, um, our owned or in the custody [17:48] of texas residents rescues organizations, shelters [17:52] or government. Government entities. So we can apply for, uh, [17:56] spay and neuter sterilization for animals that are in our sh in our shelter. [18:01] we can help the rescues and we can help the public because we will have, [18:05] we be able to have vouchers. Um, finding a veterinarian [18:10] has been tasked or been a hard task, but we're, we're at that point [18:14] now. Um, we, we had about 130 [18:19] spayed and neu out of our shelter last year that we paid out of our pocket. And [18:23] so that will definitely help us. So I'm going to ask for over 300 [18:27] surgeries and I would love to ask for more. But the veterinarians, they [18:32] would not be able to do that many. Right. So it's a way for us to [18:36] help keep the public, um, safe by having these animals spayed and neuter cutting [18:40] down on that population. And it helps the people too. It does help the [18:44] people. I get a lot of calls of people that need help just to get and neuter. [18:48] they can't be having litters and puppies out here. That comes back to the shelter, which is another expense [18:53] and works on the sheriff's. Yep. People and pick 'em up all the time. So [18:57] that's great. I now want to add that the spay and neuter, [19:01] um, there was a, I was here recently, I think we talked about the anonymous donor [19:06] that donated a lot of funding for kaufman county zip codes [19:10] to have sp and neuter. There had been over, um, [19:14] probably about 1500 now. So we were at 1100 a month ago. [19:18] that's amazing. It is in kaufman county. We have gone down to where [19:22] the zip codes are and to find out maybe where we do need to do more education [19:27] in those zip codes. But, um, forney, forney's ahead of everybody, [19:31] you know, even my little town of roster, there were seven, seven animals that, that [19:35] got spayed or neutered because of this. So it's 20, it's $40 when [19:40] you sign up and then you get $20 back. So $20 for spay and neuter. [19:44] that money will be running out soon. And then we can jump into this.
