Um, and so meeting with our [1:51] city really means a lot. Um, we are, so [1:55] I'm just going to officially announce [1:57] this is for the record. Um, we're [1:59] opening the meeting here at the [2:00] Tibonogus School District Board here at [2:02] 5:15 p.m. on Monday, May 4th here in the [2:05] Lynen City Chambers. And I'll be [2:08] conducting Mayor Carolyn Lumbard here [2:10] for this work session. Um, so welcome. [2:13] We wanted this to be down here and kind [2:17] of like a council circle versus you [2:18] looking up at us on the DAS. [laughter] [2:21] So, [2:23] comfortable and we can just speak freely [2:24] and and uh yeah, we're excited about [2:27] what's going to be happening in the [2:28] future with you all. So, we listed here [2:32] um a number of discussion items that we [2:34] had thought of and certainly uh anything [2:37] that you want to discuss with us in ways [2:39] that we can help as a city we certainly [2:42] welcome and this is going to be a true [2:45] partnership in our minds as a council [2:48] staff. So, um hopefully you had a kind [2:52] of look over this list and um [2:56] >> yes so first of all who who is kind of [2:59] our [3:01] >> great so first of all we want to excuse [3:04] Sterling Hilton and Grace Rex they were [3:06] unable to make it other Sterling may [3:09] come but he did know he could reorganize [3:11] his schedule at times so um want to [3:14] excuse them and we are also excited to [3:16] be here to to get this this partnership [3:20] kind of continue to like strengthen. Um [3:23] we want to talk about our [3:24] accomplishments first. So since we met [3:27] last as the interlocal with the pass off [3:30] meeting with the interlocal and passing [3:33] things off to us to start getting to [3:34] work, we did we were able to hire a [3:38] superintendent. We want to thank the the [3:40] city of Lynon for utilizing this space [3:42] to do our interviews. It worked so well [3:44] and and we are a little we were a little [3:48] homeless at that point. We didn't have a [3:50] So, it was nice to be able to come here [3:52] and and have the help your your staff [3:55] was so helpful with that. We're [3:56] appreciative of that. Um, so we've hired [3:58] Joe Dr. Joe Jensen as our superintendent [4:00] and then shortly after that we hired [4:02] Jason Sunberg as our business [4:03] administrator and then they hired Karen [4:06] Carter who is our executive assistant [4:08] and we're so I'm so grateful for her. [4:10] She's taken [4:12] >> taken a lot of things off of my plate [4:13] that have been um yeah, just she's just [4:17] been very helpful. So, we've also then [4:20] Joe started organizing. It was quick. We [4:22] wanted to get things going as far as [4:24] hiring employees and getting things [4:26] started. So, they have done a great job [4:28] doing that. Um, we were able to have our [4:30] kickoff in March. I don't know who was [4:32] able to attend um that. It was a great [4:36] start. We have a lot of momentum. We [4:38] have a lot of excitement from a lot of [4:40] our administrators, teachers [4:46] with what we've been able to accomplish [4:48] in these what five six months that we've [4:52] been that we've been working. [4:55] Um so next discussion item is our is [4:58] there any questions about that about the [5:01] progress? No, we're we're thrilled. I [5:04] mean that was one of the reasons why the [5:05] interlocal wanted the legislature to [5:07] change that you could be sworn in [5:09] immediately not wait till January one [5:10] because I think you know they're doing [5:12] tremendous job very [5:16] » yeah can you talk to about our school we [5:19] opened up because that will affect some [5:21] women students [5:23] >> yeah so um we worked uh withd [5:27] and identified the fact that our Dan [5:30] Pearson school was going to be [5:42] short-term solution for those students [5:45] to have a place to receive some [5:48] >> special needs like profoundly disabled [5:51] students. [5:51] >> So, it'll help students that will be [5:53] coming from the Dan Peterson School in [5:55] American Fork. Um, they will be educated [5:59] hopefully. Our hope is that that will [6:01] start in August of this year. So any [6:04] students that are in London that will be [6:07] I mean for Lynon I think it's pretty [6:09] probably equidistant between Peterson [6:12] and the Sharon school but it will be [6:13] more a better location for some of our [6:18] >> also opened up another school in the [6:20] same facility for the 18 to 22 year olds [6:24] >> who post high school transition. So if [6:26] you think kids who are in the Pleasant [6:29] Ohio that have special needs that are [6:32] served at the local schools, they would [6:34] come and be served at the uh TEK or [6:39] whatever we end up naming. Anything else on the uh [9:50] accomplishments or overview of your [9:52] first five months? [9:54] I think that's a very short overview, [9:57] but with the five minutes that's Yeah. [9:59] >> Okay. Fantastic. [10:01] >> Um, boundary study status update. Yeah, [10:03] we are starting our boundary study. So, [10:05] this is going to be comprehensive [10:06] boundary study. We call it the MOABs, [10:07] the mother of all boundary studies. And [10:09] we're [laughter] looking from the north [10:11] end of the district all the way to the [10:12] south because we recognize that things [10:14] have been kind of um yeah, just as [10:18] development has happened, it hasn't been [10:21] cohesive a lot of times. And so, we're [10:22] looking trying to [10:25] look at all of that, but also our main [10:27] objective is to create robust and [10:30] thriving schools from kindergarten up to [10:32] 12th grade. We want our schools to have [10:35] um the amount of students that will will [10:39] help facilitate good collaboration [10:42] between teachers and be able to have [10:44] enough specialties. We're also looking [10:47] to our principles and some staff and our [10:52] parents to get our criteria. So, we know [10:55] as a board, we recognize that we're [10:57] seven people and we have an idea of what a robust elementary and secondary [11:02] schools look like. But we also recognize [11:04] as I think we've learned in all this [11:06] process that the more information we [11:08] gather from constituents just learning [11:11] going to other schools, I mean other [11:12] districts and collaborating with them, [11:14] we're finding we don't know everything. [11:16] And so, it's very helpful. So, we are [11:18] crafting actually a process for our [11:20] boundary study that will allow us to set [11:22] a criteria for what we want our schools [11:25] to kind of have a a framework, right? [11:27] You would say framework for um as we're [11:30] doing this boundary study, how we're [11:31] going to do that. So, so is there going [11:33] to be a public official public input [11:35] process? [11:36] >> Yeah, we're but we're in early stages. [11:38] So, that's [11:40] >> we're gonna have we're going to start [11:41] with some focus groups. Um we're going [11:43] to have some we just talked about this [11:45] in leadership, so I'm saying maybe some [11:47] of the board doesn't even know yet, but [11:50] >> boundary studies. [laughter] [11:56] » Um, we're creating committees that will [11:58] have board members and principles and [12:00] staff on them. And then we also want to help just set the criteria. That's [12:05] going to be our first step. We want to [12:06] know, okay, what are we looking at when [12:08] we're looking at this boundary study and [12:09] trying to make all these changes and use [12:12] this wonderful tool that actually Alpine [12:13] School District has created that we can [12:16] see, we can plug in addresses, right? Or [12:19] create a Jason's going to be doing that [12:21] part. That's why I keep looking at him. [12:24] >> Yeah. That we can we can put a boundary [12:26] and say, "Okay, what's this going to [12:27] look like? What's how's this going to [12:29] work?" And we can keep playing with it. [12:31] But until we have that criteria of what [12:33] we're looking to create a thriving [12:36] school. Um then we don't have a lot of [12:39] information. [12:40] >> Our agenda this this uh Wednesday will [12:43] include a study session wherein we'll [12:46] talk about what a healthy school looks [12:47] like [12:48] >> at the elementary level and then we're [12:52] also officially launching the boundary [12:55] study which is has a timeline that's [12:58] regulated by law. [12:59] >> Yeah. So it's there are certain things [13:01] and we don't want to just hit those required by law. Our goal is to go [13:06] above and beyond to make sure our [13:08] constituents feel heard and that we are [13:12] fully informed as to to what we want to [13:15] do. And we're looking our goal is to [13:17] look very far ahead like 20 or 30 years [13:21] down the road. We don't want to be [13:22] making decisions that are just good for [13:24] the [13:25] >> people feel disrupted. [13:26] >> Yeah, some years down the road that [13:29] sounds great. [13:30] >> That will also include a study of [13:32] programs. [13:44] I've been impressed just how transparent [13:46] this board is about [13:52] to be completely open. [13:58] I would simply add again to your point [13:59] about public input. I think it's we want to provide mult points for that. [14:05] Not just [14:10] when we're establishing the criteria. [14:31] The main focus I think of the [14:33] staff through the summer. So, we plan to [14:37] >> and I know that our staff communicates [14:39] well, particularly with your city [14:41] planner. [14:44] I think we need to to be talking with [14:46] each other. [14:54] » Okay. The tsd projected financial over [15:01] » [laughter] [15:02] >> I think we're down to two. [15:05] >> Yeah, just kind of a high level summary [15:08] here. So what for many years we've [15:11] looked at Alpine looked at okay if this [15:14] configuration was in district split or [15:16] this one what would it look like once we [15:18] have the full data so the last year we [15:20] were able to do that where we have [15:21] actuals is for fiscal year 25 which [15:24] ended last June June of 25 and so in [15:28] looking at that the schools that are in [15:30] the Tempoga school district and the [15:32] estimated revenue that would come just [15:35] when we're looking at operations [15:37] estimated about an 18 to20 million [15:40] annual deficit [15:44] how the schools with the expenses that [15:46] are at the schools actual expenses and [15:48] then looking at okay there was this many [15:50] students and this is an estimated [15:53] overhead cost per student at the [15:55] district level we estimated that so [15:59] something we're we're looking at. Um and [16:01] that's that 20 million or 18 to 20 [16:04] million is about um 8 to 10. [16:10] So looking at ways I did a presentation [16:14] to the school board back in December [16:17] just looking how can we make that how [16:19] can we correct that deficit. So there's [16:22] really three ways to do that. Just keep [16:24] expenses where they are and raise [16:25] revenue which would be through property [16:26] taxes or be able to lower the expenses [16:30] um in the the schools and keep revenue [16:33] where it is or some combination of both. [16:36] So, as we're looking at things, we're [16:37] thinking that option three is going to [16:39] be the most likely as we're looking at [16:41] different things to be able to make that [16:43] work. Um the nice thing right now Alpine [16:47] School District could set up a building [16:48] fund in the capital fund that generates [16:51] for Tempog would generate about $20 [16:54] million per year. So, if there's [16:58] the combination there. We won't have to [16:59] necessarily do it all through raising [17:02] taxes. There's some movement that can [17:03] happen between taxes [17:06] that we close as Alpine closes this [17:10] fiscal year that'll end in a month or [17:11] so. We'll do another [17:26] starting December [17:31] first [17:37] is that what's been helpful. We've been [17:39] working with ASD and as we hire from [17:42] employees that are current ASD [17:44] employees. Uh ASD is continuing to pay [17:47] their salaries because we don't our $60 [17:50] a student that we're getting would not [17:52] cover the staff that we've hired to this [17:54] point. So that is being covered by ASD [17:56] because they so they will continue to [17:58] work for ASD like Dave and Zach are [18:01] still working for ASD and are [18:03] technically ASD employees through July [18:05] of 2027. But is going to allow them to [18:10] be our [18:12] um work for us maybe one day a week [18:14] starting in July and they can have time [18:18] that they can help us right now too. But [18:19] so it's kind of this graduated um [18:23] step by step transition to come in and [18:26] work for us. So we're not paying [18:31] » and and Joe work Joe is working he um [18:33] with Joel Perkins who is the Aston Peak [18:36] superintendent and Vicky Carter who is [18:38] the Lake Mountain superintendent. So [18:40] they coordinate that so and they try to [18:42] keep it even and fair as far as as [18:45] hiring you say they're working well [18:47] together. We are yeah I think a couple [18:50] things that people have brought up is [18:52] are there well you know interlocal [18:54] agreement opportunities to [18:57] you know. [18:57] >> Yeah. And we're working on that [18:59] >> versus reinventing the wheel for all [19:00] three. [19:01] >> Yeah, we're working on that with [19:02] negotiations. So, Sterling and I and Joe [19:04] are on the committee that is negotiating [19:06] with Lake Mountain and Aspen piece. And [19:08] so, yeah, we are like people we have [19:13] various things that we're like we're [19:14] working on. Intellectual property, how [19:16] are we going to handle stuff that was [19:18] created [19:20] >> IP? So, intellectual property, how are [19:22] we going to handle that? [19:24] services, transportation, there's a [19:26] whole host of things that we are it's in flow. So, it's not that we can [19:32] say or report anything, but it is in [19:35] discussion. [19:36] >> Are there any uh bonds that are falling [19:39] off in the near future where you know [19:41] you could have a new bond that just [19:43] replaces an old bond so for the general [19:45] public taxes just stay? [19:48] >> Yeah, it's a great question. So, there [19:50] the last few years there's been [19:53] debt a big drop off now it's kind of [19:55] stable but the next 8 to 10 years the [19:57] geo bond debt will go away the least [19:59] revenue bond goes out to about 15 or 16 [20:06] that's something we'll Look at [20:30] » the LB is kind of an internally [20:33] funded based revenue is not require [20:39] But we are limited as to how much we [20:46] » three years and the the payment for [20:47] those can't come from the debt service [20:50] levy that the geo bond generates. So [20:53] with the general obligation bond the [20:56] voters have approved that. So whatever [20:58] interests [21:16] me an understanding potentially save the [21:18] cost of standing up from scratch [21:22] maybe on a smaller scale initially [21:25] >> most of them [21:27] Peak and [21:29] just because [21:31] >> there's more there's more between as [21:34] peaks and typographically [21:37] >> but there are a handful that include all [21:39] three [21:44] » and nothing has been signed. Those will [21:46] be coming you know as they're created. [21:49] You know how it works with you have [21:51] three different entities and something [21:52] comes it's like oh I don't like the way [21:54] this we need to change this a little bit [21:56] then it goes back to the drawing board [21:57] and so it's just it's just a process [22:07] » um moving on the uh drop off and pickup [22:10] traffic and parking congestion safety at [22:12] some of our schools. Yeah. So this was [22:15] um I talked I Just in the first [22:19] iteration of this, it mentioned Oak [22:20] Canyon. And so I went and met with Oak [22:23] Canyon about their issues and they [22:27] recognized that there is a lot of [22:32] uh but they have also [22:35] done they've worked with they've hired a [22:37] traffic engineer to come and work and [22:39] they have closed some entrance and exits [22:42] to try to make the flow be more just one [22:45] way. Um options that they suggested but [22:48] would be on on your end as far as the [22:52] city would be um to the west and being [22:56] able to create a turn lane on Canal or [22:58] Eagles whatever canal drive right there [23:02] and then the other would be making [23:06] and so people could only come in from the south and then exit out through [23:12] canal drive some of the flow our [23:15] engineers haveordinated some improvement [23:17] on flow. Parking is still and I know [23:21] maybe um our city administrator Adam [23:23] Cowi could kind of share on the map, [23:32] » you know, and for time here tonight, [23:35] maybe it's just it's we'll we'll look at [23:38] this really fast, but maybe just point [23:39] us [23:40] >> point us in the right direction for who [23:42] we can talk with in the future. So, [23:47] This was never a problem when Steve and [23:48] I were the assistant and just to make it [23:51] clear we figured that out. [23:55] >> All right. [23:56] >> So, so right now we've and you're [23:58] probably most of you are familiar with [23:59] this is where we've got parents that [24:01] stack all the way down this side of the [24:04] roadway and there's really not enough [24:05] room for them to park. Um, and then we [24:09] have a huge amount of kids that I think [24:11] their parents are just saying go over to [24:13] the church. And so this this becomes a [24:15] drop off and pickup area and a lot of [24:16] congestion with kids on this [24:18] intersection. And [24:20] >> over 100 cars to park there within a [24:22] 15inute period of time. [24:26] >> So I think for the purposes of tonight [24:30] uh we we can introduce ourselves to your [24:32] facilities [24:34] >> uh director there and and talk more [24:36] about this. We know this is still Alpine [24:38] School District, but just wanted to give [24:40] you a heads up and and and to kind of [24:42] lead into the SRO conversation on that [24:44] next bullet point, a similar issue. We [24:47] know that's currently Alpine, but um [24:49] Jason and I have had a few conversations [24:51] and we'd love to talk more about that in [24:53] the future. So, [24:54] >> Adam, would you just share the quick [24:55] couple of ideas like to to use that back [24:58] area a little bit more and utilize that [25:00] for parking? [25:01] >> Yeah, our city engineer actually met [25:02] with um some of the people here at [25:04] Alpine. It's probably been a year and a [25:07] half or two years ago. Um, this this [25:09] space back here, you can see actually [25:10] it's underutilized with parking and [25:13] there is a little access road that goes [25:15] around the back of the school. And so [25:16] we've we've been curious if there's [25:19] ability to put more teacher parking back [25:22] here perhaps where it frees up some [25:23] space out front. Just [25:25] >> throwing that out. [25:31] a lot of students and where that's [25:33] almost kind of a blind corner. They're [25:35] concerned about they talked about also [25:37] putting having buses do that and then [25:39] they could capture that that north [25:43] parking lot a little bit better and [25:44] utilize that for drop off. But that turn [25:48] a school bus just can't do it. It can't [25:51] turn that 90 [25:54] additional parking back. [25:56] >> They do use that green space. So they [25:58] have a nine square permanent nine square [26:00] now um back in that green space and they [26:02] are encouraging students to use the [26:05] green space between the buildings [26:08] >> a little bit more with the new cell [26:09] phone policy up [clears throat] [26:14] » this is part of the concern right now is [26:16] we have a lot of parents that line the [26:17] street and we've got kids jumping across [26:19] the road way while there's also traffic [26:21] going through it and so we'll we'll just [26:24] wanted to introduce the issue to you [26:26] tonight and then we'll keep talking [26:27] about though they know they have that [26:30] entrance. There's no exit there anymore. [26:32] So that that traffic flow should not be [26:34] coming in and out right there. It should [26:36] just be going in. And then you should [26:38] just have it. And they've encouraged [26:40] parents to just drop off actually up at [26:43] that that more northern where it's just [26:46] grass and not do it in the parking lot [26:48] area. So there should be a a cue, but [26:52] >> you know do what you tell them to do. [26:57] sometimes doesn't work very well. Also, [26:59] that back area. So, we have the the [27:00] trailers back there. There is a little [27:02] bit of parking back in in that on that [27:05] northeast corner, but that is also the [27:08] that's where students go. So, they come [27:09] out that very north end and then they [27:11] walk over to the trailers. So, we would [27:13] want it makes sense that they keep that [27:16] traffic minimized just because there is [27:20] >> the road there has had no parking signs [27:22] all along that west boundary because the [27:24] road isn't wide enough. Yeah. So, I was [27:27] talking with Ben about that and it is [27:29] it's the the canal is open to about [27:31] halfway through where those trees are. [27:33] Um, is it possible to pave because I did [27:36] I searched the plat map and it's owned [27:37] by Ali School District, but is there can [27:41] we pave over that area? [27:45] >> Could we widen the road a little bit so [27:46] there's actual proper parking? You can [27:48] see in that photoally parking [27:50] >> when you say parking mean standing like [27:53] >> they're not parking and going into the [27:55] school. Some of them are in the evening, [27:57] especially for evening activities. That [27:58] whole road says no parking, but it's [28:00] filled with people parking and like Adam [28:02] said, kids are running across the road [28:04] because parents are waiting over there, [28:05] but it's a it's an unsized road profile [28:08] already. [28:09] >> Yeah. So, [28:10] >> what because I had been told as just as [28:12] a parent that um you oh, we can't pave [28:15] over canal, but then we followed that [28:17] canal as it goes all the way through [28:19] Orum and Pleasant Grove and there's [28:22] plenty of places where it's paved over. [28:24] It's built over. So I I don't know. [28:27] >> Can it be done? Yes, it would be very [28:29] expensive because we would have to make [28:30] sure that that canal pipe that's [28:32] underneath it either supports that [28:34] traffic load or is removed. [28:36] >> And so there's some footage though like [28:39] the grass there was a distance before [28:41] the pipe. [28:42] >> Not to belabor this, but you're asking [28:43] to park vehicles here and then have kids [28:46] cross the street. Oh, I my ask would be [28:49] to keep it that way and we enforce that [28:51] there's no parking there, but to give a [28:53] third lane, have a turn lane. And then our our chief had brought up some additional things [29:36] with the agreement that we'd like to see [29:39] um addressed or looked at in the future. We actually [32:00] brought someone from MEO to help explain [32:02] it and there wasn't much interest there [32:04] from the current folks, but if we could [32:07] just look at that and see if we could [32:09] just be a real good partner and we take [32:13] care of the janitor service and city, [32:15] you know, we just be a really good [32:17] partner. We clean up. We take care of [32:19] the buildings as if they were ours and [32:21] the school district would do the same [32:22] for facilities that they need from us. [32:25] In Limon, it'll be a little different. [32:26] We don't have a lot that the school [32:27] district wants, but we also don't have a [32:29] high school. So, we've got a junior high [32:31] gym and and a couple elementary gyms. Years ago, the school district, I [33:23] don't know if they did it inadvertently [33:25] or not, but it seemed that they put like [33:27] the uh AAOU basketball as a priority [33:30] ahead of the city rec programs. So, [33:33] those those groups were getting priority [33:35] gym time because of the revenue, I'm [33:37] sure, but that really hurts us for [33:41] charging $30 a kid for recreation [33:44] basketball. So you [clears throat] [35:36] know our community center is very [35:38] interchangeable. [35:40] We also do many grants to all the [35:42] teachers out of our budget every year. [35:45] We I think how many how many grants did [35:48] we get? 22 [35:51] teachers that they can apply for Aspen [35:54] Oak Canyon all thearies. Our main focus of this board [45:26] and I think of our staff is going to be [45:28] providing the best education. We have [45:30] three new districts that are going to be [45:33] in close geographical proximity. So, and [45:36] one of and I've talked with Carolyn [45:38] about this before. We want to attract [45:41] our students back and so we're focused [45:45] on on doing [45:47] >> on doing that the best way solve the [45:49] revenue issue is attracting back people [45:51] who have chosen other education [45:53] platforms [45:54] >> and Lindon that's there's a big example [45:56] of that. [45:57] >> So um [45:59] >> so that's what you're going to hear our [46:00] focus is going to be a lot on what is [46:03] creating the best schools what is that [46:06] going to look like and I agree that [46:09] there's going to be some cost savings [46:10] that will come along with that, but [46:11] that's not going to be our why. Our why [46:14] is what is going to be best for teaching [46:17] our students. [46:18] >> To to Van's point though about the [46:21] meetings and possibly even having a [46:23] meeting here, one of the things I [46:25] appreciated about our visit with Orum is [46:27] they talked about [46:29] using ORM's communications platforms to [46:32] help get our message out. And so those types of things would be really [46:36] helpful as well. Um I think anytime we [46:40] can get as many stakeholders and you [46:42] guys are obviously very influential [46:44] stakeholders, [46:46] you know, helping promote a message of [46:49] this is about robust schools and [46:50] >> positive, [46:52] >> right? And and that's going to help [46:54] because it's no matter what we do with [46:58] any kind of consolidation, it's going to [47:00] be high emotion. [47:01] >> Yes, it will be. It's challenging. [47:03] >> So how we do it matters and we the [47:06] messaging getting everyone on board, [47:08] feeling heard and on board. And I just [47:10] have to to to give Van some kudos. I [47:13] think to what Van is speaking to and [47:15] what this council demonstrates, what [47:16] this staff demonstrates is in Lynon, we [47:19] are small town, big amenities, but we [47:22] often find out of the box solutions to [47:25] minimize raising taxes and fees, but not [47:29] compromise service and quality of life [47:31] in our community. So, I think that's I [47:34] think that's the spirit of the message. [47:36] >> Absolutely. the student experience. [47:38] That's why we do this. [47:40] >> It's it's really easy to raise a tax and [47:42] a fee versus just dig deep and find ways [47:45] to justize and still get a great [47:47] >> Well, that's what I'm excited about with [47:49] um you know, the way Joe has set up his structure is it's hyper it's super [47:55] focused on that teaching and learning. [47:57] And what that actually does is there [48:00] could be some savings costwise as far as [48:02] having a smaller district [48:06] some smaller district staff and just [48:07] replicating everything that we need and [48:10] you know replicating what ASD has done [48:12] and so his his attention at having these [48:15] this we call him the super six so it was [48:17] the first six hires that he did um they [48:20] also are going to be supervising schools [48:21] so that takes out a layer of supervisors [48:24] that ASD currently has just because of [48:26] their size that they have the cabinet [48:28] level then they have supervisors then [48:30] you have the schools [48:31] >> that's a great [48:32] >> so so we are we're trying to think [48:34] outside the box and it also puts district very close to [48:40] schools which sometimes that distance [48:43] creates some issues. Something that I [48:45] think I've heard and I'm sure you're [48:47] hearing and will hear is um when it [48:50] became a east versus west kind of tribal [48:53] situation before the split, you know, um [48:56] a lot of people here are saying we still [48:58] want to have we don't want these big [49:01] giant magnet schools that everyone's [49:03] commuting to and driving to and then [49:05] they're huge. We still want to have that [49:07] balance of the walkable bikable for the [49:11] children neighborhood schools. They [49:12] really are an asset in the what they do [49:16] for quality of life and economic [49:18] prosperity and just the kids having that [49:21] maker. So we hope that the mindset for [49:24] this district will be not gigantic super [49:27] schools that are everyone has a drive to [49:28] but [49:30] we understand there's going to [49:32] potentially be some property boundary [49:35] shuffling the deck whatever but [49:38] >> I've understood when you talk about [49:41] schools that the concept I've understood [49:44] it. [49:45] >> Yeah. Is being able to provide [49:46] >> robust schools. You got everything in [49:49] that area. [49:51] >> Being able to provide like we're looking [49:53] at specialty and programs and [49:59] bulk of our payments or our costs as a [50:02] district are going to be people, right? [50:09] And we want to maximize that. Not don't [50:13] maximize that we're going to make huge [50:15] schools, but it's just maximizing each [50:17] property to be able to impact each [50:20] student's learning at the highest level. [50:23] So, we want our students to have choice. [50:26] And sometimes when our schools get so [50:28] small, they don't have choices. [50:36] » You get a small school, [50:38] >> you can't have art and music and PE as a [50:40] specialty. And so, impacts the whole [50:43] school, all the kids and the teachers. [50:45] >> And sometimes principles are forced to [50:47] make those hard decisions whether he [50:49] combines he or she combines grades which [50:51] is the worst [50:54] math this year next year is going to [50:56] have a first second grade split. So you [50:59] will have a class that has half first [51:01] graders and half graders [clears throat] [51:03] and that teacher has to try to manage [51:06] that and that is a function of it's a [51:08] small school and they don't have as much [51:21] population. [51:23] >> These are all things that we want to [51:24] discuss in public. [51:26] >> Part of the criteria, [51:28] >> it's going to be part of the criteria [51:29] that we're looking at as we're crafting [51:30] this whole [51:32] framework on how we're going to be [51:34] looking through the lens through which [51:35] we're [51:35] >> kind of what what student populations [51:38] and I I love that you said too, you [51:40] won't necessarily be like what's the [51:42] population these schools will have in [51:44] 2027 or 2028. Yeah. [51:46] >> But what's a starting point that we can [51:48] at least make sense financially, but I'm [51:52] assuming we're going to grow because [51:53] we're going to win back some of the [51:55] families that have left [51:57] >> public ed and then right [52:02] and um so I didn't mention it in our [52:03] accomplishments, but I'm very proud of [52:06] us for having done this. So I want to [52:08] mention it maybe we can end with it. [52:12] But um we visited as a board holy um we noticed our field trips and we [52:18] visited every physical facility in our [52:21] area plus a couple in Aspen Peaks area. [52:24] Um we made the decision early on that we [52:27] can't make decisions about properties [52:29] we've never seen. [52:31] Informed our understanding in so many [52:33] ways to actually have boots on the [52:35] ground at all. Now currently we're in [52:37] the middle of doing our vision tour. [52:40] call it. Um Joe is presenting our vision [52:42] for the district at each school to a [52:44] group of administrators, the teachers or [52:48] staff, uh students, which has been so [52:50] fun. And um parents, [52:54] they're involved there in the school as [52:55] we've been trying to craft our vision. [52:57] So that's something that we're almost [52:59] done with. But that's caused some [58:44] families to not enroll in Lynon [58:47] Elementary because they think it's been [58:49] on this closure discussion for six [58:51] years. And I know I Mayor Lumbberg [1:14:10] needs to just walk me up center street [1:14:11] in Provo and drop me off because [1:14:14] [laughter] why do I keep doing this? And [1:14:15] I I was just sharing with your chief, my [1:14:18] boys were helping me load the truck to [1:14:19] go to an event and one of them stopped [1:14:21] and said, "Mom, do you just love public [1:14:24] ridicule? Um, I was on the city or city [1:15:50] council for 12 years and I didn't get [1:15:52] elected in December, so lost by 200 [1:15:55] votes. So I decided to throw my hat in [1:15:56] the ring for Utah County Commissioner [1:15:58] seat B. And uh the concern I have with [1:16:01] the county is [1:16:03] in the [snorts] 12 years I was on the [1:16:05] council, I didn't have one commissioner [1:16:07] come to ORM and ask what our needs were. [1:16:10] And I think that's a that's a a misstep [1:16:12] on their part where they represent the [1:16:14] citizens plus they represent the cities [1:16:16] in Utah County. So I feel that my plan [1:16:20] is I want to go to every city, look at [1:16:22] your master plan, your transportation [1:16:23] plan, see what your needs are, and then [1:16:25] be able to because I believe that uh [1:16:27] Utah County were fragmented. [1:16:30] everybody's doing their own thing. So, [1:16:31] if we can get on the same page, then we [1:16:33] can go to the legislature and really [1:16:34] fight for dollars for Utah County. And I [1:16:37] believe that the legislature, the uh the [1:16:40] leadership is pretty much in in Davis [1:16:43] County, so they get a lot of the money, [1:16:45] right? So, [1:16:47] Utah County is the fastest growing [1:16:49] county, right? So, we need to make sure [1:16:50] that we get the dollars for our cities [1:16:53] in Utah County. Um, I have a lot of good [1:16:55] ideas. There's a transparency port I [1:16:57] want to bring to the county because [1:16:59] >> [clears throat] [1:16:59] >> county commissioners now you don't even [1:17:00] know if they go to their meetings how do [1:17:02] they vote you know are they traveling [1:17:05] foolishly when if you're a Utah county [1:17:07] commissioner [1:17:09] you should stay in Utah county or go to [1:17:11] let's say legisl you need to go to back [1:17:13] to Washington because that's why you [1:17:14] have congressmen and senators so I'm [1:17:18] here to represent the cities you know I [1:17:20] love warm I love Lynon I remember I [1:17:22] spoke at your Lynon city council way [1:17:24] back in the day with the utopia but I'm [1:17:26] here to serve the people and uh make [1:17:28] sure that we come together as cities. I [1:18:14] know you're been a huge partner [1:18:16] proponent with the first responders and [1:18:18] ORM and we have this interlocal [1:18:20] agreement with ORM Lindon Vineyard and [1:18:22] you are kind of the the main liaison guy [1:18:25] for OMC on all that. [1:18:26] >> I support the first responders 100% [1:18:28] because they keep us safe and we have to [1:18:32] make sure that our citizens are safe [1:18:34] because that's your police, fire, water, [1:18:36] roads and sewer. That's the city's [1:18:37] responsibility for the citizens and that [1:18:40] that's the top of the list. So I think [1:18:42] as ORM we have a great police department [1:18:44] and a fire department and you use Orm's [1:18:46] fire department and they're the best and [1:18:48] um we're glad that we can keep you know [1:18:51] Lyndon citizens safe but I am a I'm pro [1:18:54] first responders because they put their [1:18:56] life on the line every day and they [1:18:57] might not come home to their families [1:19:01] because they they gave their life. So [1:19:03] very important that we have to make sure [1:19:04] we we keep them safe and we give them [1:19:06] money they need to help us be safe. So [1:19:10] thank you. [1:19:10] >> All right. [1:20:11] Michelle Kussi was mayor and my parents [1:20:13] who live um by one of the temples could [1:20:17] kept talking about her and Dave Spencer [1:20:20] actually assisted in my current [1:20:22] apartment in Oram, the driveway being [1:20:25] fixed. Um so I really appreciate and I [1:20:27] do think he is someone who um stands by [1:20:31] his word and the citizens of Utah [1:20:33] County. And I would I I can't say enough [1:20:37] how good of a job you're all doing in [1:20:39] Lynen and and I love the model that [1:20:43] you've held in Utah County for getting [1:20:46] results for citizens and that's what I [1:20:49] want to talk about today. I spoke [1:20:51] earlier the previous month because I [1:20:54] felt like the voice of the youth needs [1:20:56] to be heard and instead of division we [1:20:59] need to be collaborating together. And [1:21:01] with the recent events of the Trump [1:21:04] assassination and the gas prices being [1:21:07] increased, espec including here due to [1:21:10] the Iran war, I feel like my voice does [1:21:13] need to be heard again. And I wanted to [1:21:16] make three points today. Um the first [1:21:18] one was a culture of safety. And I feel [1:21:23] like at this time it's important for us [1:21:25] to come together and to bond on our [1:21:29] shared goals and to and to really look [1:21:33] out for each other's security and safety [1:21:36] and and maintain a culture of safety, [1:21:39] meaning we all get together and care [1:21:41] about each other and each other's shared [1:21:44] issues. And [1:21:46] the second point is what I feel the [1:21:49] city's already doing the energy and [1:21:51] resource issue. We condemn international [1:21:54] violence but not because we want to get [1:21:57] into fights with the entire world but [1:21:59] because we want to focus on local issues [1:22:04] and not allow distant conflicts to bring [1:22:06] us down the drain. every dollar of the [1:22:10] and of every gallon of gas counts during [1:22:14] these troubling times. And the last [1:22:18] point I wanted to make is about refusing [1:22:22] to allow the outside world to consume [1:22:24] our sovereignty. Um, Lyndon is a great [1:22:28] place and I I love driving here, going [1:22:32] to shop here and [1:22:36] it these outside conflicts can really [1:22:41] allow us to stop thinking about local [1:22:43] issues and our own local freedoms. And I [1:22:47] feel like we've all seen those things [1:22:49] before. and the future of a city will [1:22:53] not be a side effect of global markets [1:22:56] if we dictate our own destiny. Um, I [1:22:59] feel like this is a moment where we need [1:23:01] to remember um our local communities and [1:23:05] to for the city to continue getting the [1:23:08] results they've been getting and talking [1:23:10] to my local officials to maybe get give [1:23:14] them those ideas [1:23:16] um and to not let um outside results take [1:23:22] away the progress that we've been [1:23:24] making. On the 18th, our next [1:27:59] council meeting will be introducing the [1:28:02] new council to this council. They're [1:28:05] looking forward to that. Um, and then [1:28:07] they will uh be going out and planting [1:28:10] flowers in the city cemetery in [1:28:11] preparation for the Memorial Day program [1:28:13] which will be on May 25th at 9:00 a.m. [1:28:16] at the city cemetery. and we're looking [1:28:17] forward to participating in that with [1:28:20] our youth council and with everyone [1:28:22] else. We love that program and everybody [1:28:24] involved. And I'd just like to make a [1:28:25] note that really enjoyed our our Utah [1:28:28] League of Cities and Towns midyear [1:28:29] conference in St. George with most of [1:28:31] you. I think almost all of us are there [1:28:33] and really enjoyed that time of learning [1:28:35] and and camaraderie. [1:28:38] >> Thank you so much. You all do so great [1:28:41] with your liaison assignments and [1:28:42] reports. [1:28:44] Uh we had um NextGen Motors did their [1:28:48] ribbon cutting. Thank you for those who [1:28:50] were able to come. I know it was it was [1:28:52] on a a busy night. Um but they're doing fantastic um and doing [1:28:58] great sales already. Um something [1:29:01] communitywide of note is the uh Lynen [1:29:03] City Temple dedication this Sunday that [1:29:06] incorporated um residents in part of PG [1:29:10] Pleasant Grove as well as ORM. So, that [1:29:12] was a pretty significant event. Um, [1:29:14] thank you again to Chief and all the [1:29:17] staff that um that was a a lot of um [1:29:21] service and coordination and um a lot of [1:29:25] hard work to just pull off having nearly [1:29:28] 300,000 visitors come for that. Um [1:29:33] we also had uh [1:29:36] interestingly Pleasant Grove City had a [1:29:38] special uh presentation of um a [1:29:43] photography collection that was really [1:29:45] quite fascinating. I should have made a [1:29:47] note of the there was a gentleman a [1:29:50] hundred years ago who just bought this [1:29:52] amazing camera and he just had an [1:29:54] artistic eye and he took a lot of [1:29:57] historical photos and I went because I [1:29:58] wanted to see what did he catch about [1:30:00] Lyndon and there was potentially and our [1:30:04] um historian Brett Swberg was there so I [1:30:06] was like okay we're good Brett's on it. [1:30:08] So, um, anyways, pretty interesting [1:30:10] collection. The family had donated to [1:30:12] BYU and then a a a lady just out of her [1:30:16] own passion went and just has digit is [1:30:19] going to digitize the whole thing and [1:30:21] published a book about it. And so, it's [1:30:23] really fascinating to see our [1:30:25] community's um images that don't exist, [1:30:30] many buildings anymore, and just what [1:30:32] life was like back in the day. So, um, [1:30:36] looking forward and our museum just [1:30:38] continues to have incredible, um, [1:30:40] displays and donations that our historic [1:30:43] committee is working on. So, lots of [1:30:46] thanks to them. There's also, [1:30:49] um, a Lynden Yard of the summer um, [1:30:53] nomination process that's going to be [1:30:55] happening. Um, so we'd love to encourage [1:30:59] just people wanting to beautify their [1:31:02] properties and their homes and get some [1:31:04] recognition going for that. So there's a [1:31:07] wonderful newsletter that comes out [1:31:09] every month. Um, it doesn't mail to each [1:31:12] home. Um, can people still pick up a [1:31:14] hard copy here at the city center if [1:31:16] they want a hard copy or you can opt in [1:31:18] to get it by email. So that just has all [1:31:22] we just have constant amazing activities [1:31:24] and initiatives that are going on that [1:31:26] and education um for the community. Uh, [1:32:24] I very much felt that they were partners [1:32:27] in this meeting. It was refreshing and I [1:32:31] think they've they've made an effort uh [1:32:34] to try to make sure that we feel that [1:32:35] way. uh even so much that things such as [1:32:39] hey if we have to we have a large amount [1:32:42] of money that we'll be needing to pay [1:32:44] back uh where they're using cash that [1:32:47] they've saved um and they're willing to [1:32:50] just match or it's the public [1:32:52] treasurer's investment fund PTI where [1:32:55] we're able to put money into a state [1:32:57] fund that earns an interest rate it's [1:33:00] actually what the state dictates we all [1:33:03] of our general fund our savings and [1:33:04] everything is in this PTI fund and they [1:33:07] even went so far as to say we'll just [1:33:10] charge that. So, they aren't trying to [1:33:12] mark up an interest rate to be repaid [1:33:15] which was again very refreshing. So, um [1:33:18] some positive moves there. We'll keep uh [1:33:21] you informed as Noah is looking at some [1:33:23] options to try to lessen the burden on [1:33:27] residential uh fee increases and see how [1:33:30] we can make sure that all different uses [1:33:33] and different zoning uh in the city are [1:33:35] equally uh treated as far as the sewer [1:33:39] processing and treatment that we have to [1:33:41] perform. Uh 1,200 West in the in [1:35:56] this section and 200 north um [1:35:59] highlighted in green there. Uh at the [1:36:02] last meeting uh one of the [1:36:04] representatives for Schaefer Industries [1:36:07] was not able to make it. He asked that [1:36:09] the meeting be continued and so the the [1:36:11] commit the council continued that [1:36:13] meeting and to give the property owners [1:36:15] the three prop main property owners MS [1:36:17] Properties um Pacific Bridge and Steel [1:36:20] and Schaefer Industries time to talk and re uh review the proposal. Um, in [1:36:27] your packet, one of the items we [1:36:30] discussed last time as well was could [1:36:33] the property be have a culde-sac coming [1:36:35] from State Street or sorry, Center [1:36:37] Street North. Uh, these are the two UD [1:36:40] do detention basins. They um receive [1:36:43] water uh that Lynden helps maintain in [1:36:46] those storm water basins. But, you know, [1:36:48] this this is what the culde-sac could [1:36:51] potentially look like as an option. um [1:36:56] uh is an as an alternative as well. So, [1:36:59] um, [1:37:01] as of late today, the the property [1:37:04] owners, [1:37:06] um, [1:37:08] had also reached out to me about with [1:37:10] the potential of maybe just, um, having [1:37:15] the discussion about, [1:37:17] uh, removing this section from the map, [1:37:21] uh, transportation map highlighted in [1:37:23] green, and and leaving the rest of the [1:37:26] map uh, the way it is um I know there's [1:37:30] the property owners can discuss this. [1:37:32] there's some, you know, preferences and [1:37:35] things um for 200 north here. The, you [1:37:39] know, Martin Snow would would prefer not [1:37:41] to have this bisect his two properties [1:37:43] here. Um and so that this may need an [1:37:46] alternative route, but um so there's [1:37:49] been some different discussions whether [1:37:51] to do a culde-sac, whether to remove [1:37:53] both roads segments, whether just to [1:37:56] remove a portion of 1200 West. And so [1:37:59] the council's got a number of items to [1:38:01] consider with this. Um we've prepared it [1:38:06] as the application has was originally [1:38:09] submitted with both roads being removed. Um and so all of those [1:40:17] them would have to work together for [1:40:19] those roads to go through. We're not [1:40:21] adjusting any zoning uh with this [1:40:23] application. The heavy industrial zoning [1:40:26] or whatever zoning is currently in place [1:40:28] is not affected by these applications. And it came up in [1:42:42] the meeting that if we would [1:42:45] to settle this, we were gonna [1:42:49] take this proposed road, remove it off [1:42:51] the master plan, take the bond money [1:42:54] that we have here, and then we're going [1:42:56] to go develop it and finish this road [1:43:00] through here and give the property to [1:43:02] the city for the rightway and the needs [1:43:04] to get that road in place. And then I [1:43:08] think this summer sheer shadow mountain [1:43:12] is supposed to be developing this road [1:43:14] through here. And I think they only go [1:43:18] up to here. So that and we'll go to this [1:43:21] intersection right there. There'll be a [1:43:24] little piece here that we call the group [1:43:26] home property that still needs to be [1:43:30] figured out to get past it, but [1:43:33] basically that's going to open up that [1:43:36] 1400 or Anderson Lane. I think we we [1:43:40] call it 1400. The old map was 14. But [1:43:43] then it's going to allow access to come [1:43:45] from Center Street up through here. And [1:43:48] now you can work your way out this way [1:43:50] or you can go out that way. So I think [1:43:53] in the discussions with the city they [1:43:56] said well [1:43:58] we don't really need this road through [1:44:00] here and it's a definite safety hazard [1:44:03] going between our buildings and then in [1:44:06] the the other point came up was a safety [1:44:10] fac or hazard going through here because [1:44:13] of all the Utah Pacific's big steel [1:44:18] ridge beams and girders and overhead [1:44:20] cranes and so you guys went through that [1:44:24] last time. So, I think when we left off [1:44:26] at the last meeting, we were discussing [1:44:28] a culde-sac [1:44:31] up in here to come here. Uh, Shadow [1:44:34] Mountain has concerns because they have [1:44:37] 27 acres over here that they haven't [1:44:40] really decided what they're going to do [1:44:43] in there yet. uh the city. I think what [1:44:47] Adam and and and Mike Florence are [1:44:50] saying is uh we can put these roads back [1:44:54] in. We can move these roads. [1:44:58] One of my thoughts I brought up last [1:45:00] time was maybe this road should be [1:45:03] straight. It comes off of here. you [1:45:05] know, maybe it could. There's a lot of [1:45:08] options, but I think the property owners [1:45:11] need to decide where they want the road [1:45:13] through there because they're serving [1:45:15] their development, whereas we're already [1:45:18] developed and we know the road doesn't [1:45:20] work in Utah Pacific, it's pretty much [1:45:23] developed in here. And that's just is [1:45:27] kind of where we let off or at the at [1:45:31] the last meeting. So, I think the [1:45:34] decision was let everybody voice their [1:45:36] opinions and and we'll see what happens. [1:45:40] This road here doesn't doesn't really [1:45:43] it's kind of an issue here because it [1:45:45] goes through my property there and then [1:45:48] it splits right through Utah Pacific and [1:45:51] gives them it basically gives them two [1:45:54] little parcels right here and this one [1:45:57] bisects Utah Pacific again. So that's [1:46:02] and I don't see the use changing in the [1:46:04] future for either us or Utah Pacific and [1:46:09] uh because we're both established and [1:46:12] been there 40 plus years. So I don't I [1:46:16] don't think anything's going to change [1:46:18] for that and I guess that's uh that's the reason for the proposal and [1:46:25] that's how it's sitting. [1:46:28] So, I'm a little bit unclear. Um, Mr. [1:46:32] Snow, are you wanting as you applied [1:46:37] to is that what you want the council to [1:46:38] still consider or have you changed your [1:46:40] mind? I think I think the city I haven't [1:46:45] I proposed what was suggested by the [1:46:47] city uh because it was the most [1:46:51] practical idea was to take it all out [1:46:54] because I think the city said well we're [1:46:57] never going to be able to put that road [1:46:59] through here and it doesn't look like [1:47:03] it's going to be a benefit down here for [1:47:05] the existing use. So that was my [1:47:08] application and then there were you know [1:47:12] the city's opinion at that time was we [1:47:15] can put these roads in wherever we need [1:47:17] to when this development comes up. So I [1:47:21] mean [1:47:23] for my personal benefit it really [1:47:26] doesn't matter. I mean, I'd need to get [1:47:28] the road out on the top. And that was my [1:47:31] agreement with the city was you get rid [1:47:34] of this, I'll settle with you over [1:47:37] there, you know. So, [1:47:39] >> and then I believe that's probably your [1:47:43] legal or Mr. pause, but I think he made [1:47:46] the comment in the last meeting that [1:47:48] it's up to the council or that the [1:47:50] council has the authority to approve all [1:47:53] of it, part of it or right [1:47:55] >> or some alternates. So, [1:47:58] >> okay, [1:47:59] >> I'm just going to leave it at that and [1:48:00] I'll let the rest of them give you their [1:48:03] opinion of what they need and [1:48:05] >> all right, [1:48:06] >> we'll hope we get a good decision from [1:48:08] everybody. [1:48:09] >> Right. So, as Mr. Florence mentioned [1:48:12] this has completely unrelated to zoning [1:48:15] and and uses that are allowed here. This [1:48:17] is just and maybe you could speak to [1:48:20] everyone in the room a little bit about [1:48:22] when we have a street master plan. It's [1:48:24] kind of calling out future places to [1:48:27] have that connectivity and the proper [1:48:29] flow um and and not strand any property [1:48:33] owners for example if they need it. Um [1:48:36] but at the same time [1:48:39] these lines that are future roads are [1:48:42] somewhat flexible because as you [1:48:45] mentioned the individual property owners [1:48:47] certainly a 27 acre piece may need a [1:48:51] particular configuration when the time [1:48:53] comes that they have actual development [1:48:55] or whatever may happen if what you do [1:48:58] with your business um expands or has [1:49:02] additional buildings or uses. So maybe [1:49:05] you could speak to just [1:49:08] the roads themselves and permanence or [1:49:11] not permanence and what they're calling [1:49:12] out. [1:49:14] >> Yeah. I mean if this green road if it it [1:49:17] needed to shift slightly like it came to [1:49:20] here and needed to come down. I mean the [1:49:23] purpose is that the road goes through [1:49:26] according to the master plan. If it had [1:49:28] to make some minor tweaks that that's [1:49:30] okay um in the in the future. Um but But [1:49:34] you're you're correct that it's it's a plan for the future for [1:49:38] circulation and and uh you know trying [1:49:41] to help help all the property owners and [1:49:44] not segment anything that won't be [1:49:46] unbuildable. [1:49:49] >> And and I think it's important to mayor [1:49:50] to to realize that these maps were [1:49:53] originally adopted if I'm remembering [1:49:55] right this was originally adopted either [1:49:57] 69 or 89. [1:50:00] >> Um and we we last time we had our [1:50:03] They're not here tonight, but our [1:50:05] engineers have gone through and looked [1:50:06] at traffic and with traffic and [1:50:09] development that has changed, these [1:50:11] roads don't necessarily need to be [1:50:13] exactly in this spot. There's a lot of [1:50:15] room for us to be able to work. So, our [1:50:17] engineers have looked at this and and [1:50:19] they're they feel comfortable with these [1:50:20] changes as well. So, that's important. [1:50:22] >> Are you saying in removing both of [1:50:24] those, the blue and the green, they're [1:50:26] comfortable? [1:50:27] >> The engineers were okay with that [1:50:28] because again, when those developments [1:50:30] come in, they are going to have to roads [1:50:33] and they they can configure that, but [1:50:36] because of the heavy industry that's [1:50:39] going through that main road going north [1:50:41] and south, we're not going to have a lot [1:50:43] of traffic flowing through there. And so [1:50:45] there will have to be some [1:50:46] configurations for the green line. And [1:50:48] as a development comes in, we'll have an [1:50:50] opportunity to to get a alignment that [1:50:53] works best. [1:50:53] >> Okay. So you're saying if we eliminated [1:50:55] now the blue and the green later on, [1:50:57] somebody come and say, "Hey, we want to [1:50:58] develop this in this way. We'd like a [1:51:00] road cut in here." And then we're [1:51:02] addressing that as the issue. [1:51:03] >> That's why our engineers felt fine [1:51:05] taking them all off. [1:51:06] >> Although my question would be is if a [1:51:08] road is eliminated and let's say one [1:51:11] property says I want that road but their [1:51:14] neighbor says I don't want the road. And [1:51:16] if the road is not on the map master [1:51:18] plan does that create [1:51:20] >> what that how that works right now is is [1:51:22] both property owners still have a right [1:51:24] to say I don't want that road there [1:51:26] right now. But what can happen is one [1:51:29] property owner can say, "Well, that's [1:51:31] fine. I'll put the whole cost of the [1:51:32] road in now." But I'll ask for what's [1:51:35] called a reimbursement agreement that if [1:51:37] the other property develops within a [1:51:39] certain amount of time, typically those [1:51:40] are 10-year period. If you develop [1:51:42] within 10 years, um, and you get the [1:51:46] benefit of that road for that [1:51:47] developing, you have to reimburse that [1:51:49] first property owner for that. And so so [1:51:53] that would go that that ability to to do [1:51:56] a road and and to get the council to do [1:51:59] a reimbursement agreement that works [1:52:01] when two properties above each other. [1:52:03] And so if we move this road off, we [1:52:05] probably wouldn't be able to do a [1:52:07] reimbursement agreement or you know in [1:52:09] that circumstance. So that is one thing [1:52:12] that probably changes [1:52:13] >> mayor. [1:52:15] Well, we do have a representative from [1:52:19] Bridge Pacific Bridge and Bridge and [1:52:21] Schaefer Industries as well. Um there's [1:52:25] it's a little bit complex on the the [1:52:27] possibilities here and I I think it's [1:52:30] important to understand the perspective [1:52:33] of the other property owners that are [1:52:34] potentially impacted here. Um, I'd like [1:52:38] to invite you to come forward [1:52:43] and maybe [1:52:44] >> so some of you weren't here last two [1:52:46] months ago. I'm Clark Olsen, uh, with [1:52:48] Utah Pacific Bridge, one of the founders [1:52:50] and president. [clears throat] [1:52:54] Uh, the way we left it last or two [1:52:56] months ago was because of safety issues. [1:52:58] I'm I'm very similar to Martin Snow. You [1:53:02] know, we've got 200 foot girders, 150 [1:53:05] tons sitting there uh with five 150 ton [1:53:10] mobile cranes passing back and forth [1:53:13] with that property line. Uh so it's a [1:53:16] safety issue. I you know I just don't [1:53:17] want a road there. However, uh we [1:53:22] >> and road there, let's be specific. That [1:53:24] would be in the blue. Well, really [1:53:26] neither one. Number one, the north south [1:53:30] because it uh it it uh adjoins our [1:53:34] property and the east west the green [1:53:37] road uh you know would collect [1:53:42] from that subdivision area cars to go [1:53:46] from there to the east and then south on uh 200 north so that you know that's [1:53:53] our concern is just generating traffic [1:53:56] there now two months ago [1:53:59] uh Schaefer indust industries couldn't [1:54:02] be here, but they did propose a letter, [1:54:05] a culde-sac that was that was presented [1:54:08] at least [1:54:09] um and Clark Taylor with Schaefer uh [1:54:15] called me shortly after, wanted to meet. [1:54:17] I' I've been gone for about a month, but [1:54:19] anyway, we did meet last Wednesday and [1:54:22] uh Mr. Taylor presented that same [1:54:25] shortened culde-sac running north south [1:54:27] from Center Street of which uh I could [1:54:32] do. I mean I I don't want a road at all, [1:54:34] but I I told him that we would agree to [1:54:37] that. It's shortened. It doesn't get [1:54:39] north uh uh so far as to uh to bisect, [1:54:46] you know, my two pieces to the north. [1:54:49] And also more importantly, it doesn't [1:54:51] have an east west road, 1,200 west or a [1:54:55] 200 north road to collect traffic. So I [1:55:00] thought we I thought we were good. Um [1:55:03] but he but Clark called me at noon today [1:55:05] and said they don't want to do that. [1:55:07] They want all all the roads for I don't [1:55:09] know why because he's the one that rep [1:55:11] proposed it in the first place. But so [1:55:13] that's where I am. [1:56:17] >> My name is Clark Taylor [1:56:21] and I'm executive vice president, [1:56:23] general counsel for Schaefer and its [1:56:25] affiliate [1:56:27] Shadow Mountains. [1:56:30] and appreciate uh you continuing this to [1:56:34] today. [1:56:35] I had a family medical emergency and I [1:56:39] appreciate the opportunity to appear and [1:56:41] get to present our position [1:56:44] and I should uh state greetings to the [1:56:48] mayor, [1:56:49] uh the council members, [1:56:52] uh madame reporter and the city planner [1:56:56] and attorney and [1:56:59] administrator. You've I've worked with [1:57:01] the city for many years. I remember [1:57:04] going back through the old building, [1:57:06] the the little building we've had. We [1:57:08] work [1:57:09] >> we've worked together. We've really [1:57:11] tried to be good corporate citizens. [1:57:14] Schaefer Industries [1:57:16] um manufactures [1:57:18] structural pipe and tube. [1:57:21] Uh so structural pipe and tube basically [1:57:25] there are two things that hold up [1:57:26] America. [1:57:28] One is concrete and two with steel. And [1:57:31] we're a leading manufacturer in the [1:57:32] western United States with our [1:57:34] geographic area being from [1:57:37] we do have some clients back east, our [1:57:39] customers, but generally from Colorado [1:57:42] to Hawaii and generally border to [1:57:44] border, but in the western United [1:57:46] States, we're a leading manufacturer. [1:57:49] For example, if you pull this drywall [1:57:51] down, you'd see our our steel here. It [1:57:55] holds up billboards. that holds up [1:57:57] gates, fences, bullards. If you just [1:58:00] walk outside, you could name 30 uses of [1:58:03] our steel just from your front porch [1:58:06] here. Uh we've been and we have 27 acres [1:58:09] there with four large facilities. I [1:58:12] think some of you are familiar. If not dropped by anytime, I'll give you a [1:58:16] tour. Uh we in addition and we came in 1988. [1:58:22] Um, [1:58:24] and we built we started our campus the [1:58:26] 27 acres that just is off the screen [1:58:28] there. [1:58:33] » Uh, [1:58:34] and then then the northern 27 acres is [1:58:37] depicted on the the uh map and I've [1:58:42] highlighted that in blue in the first [1:58:45] handout [1:58:46] >> and that currently is undeveloped land. [1:58:49] >> That's undeveloped land. I will note [1:58:51] that uh a couple of years ago the city [1:58:54] and we've really tried to be good [1:58:56] corporate citizens and I want to commend [1:58:58] the city staff. We've we've worked well [1:59:01] together for decades. [1:59:04] >> Um [1:59:05] >> thank you. [1:59:10] So, we've worked we've worked uh [1:59:12] tremendously together and the city [1:59:14] wanted to place see the fill on the [1:59:18] south part of the 27 acres. Uh we had [1:59:21] that in green belt and the city came to [1:59:23] us and and said we need to dispose of [1:59:27] our dirt and like like we always get [1:59:30] along. So, we said no problem. None of [1:59:32] us anticipated that the county wasn't [1:59:34] going to cooperate. [1:59:36] >> And so now this we got a almost $350,000 [1:59:40] bill from the county because they've [1:59:43] changed the zoning. And that will be a [1:59:45] huge bill that will go on into the [1:59:46] future. [1:59:48] But the the property other than the [1:59:51] accommodating the city is undeveloped. [1:59:54] Uh except for on the west corridor. Uh [2:00:00] Mr. [2:00:00] highlighters right there if you need. [2:00:02] >> Oh, I you know, I don't know if I'm [2:00:03] steady enough to to do that, but maybe [2:00:06] I'll be [2:00:08] [clears throat] the when Ivory Homes [2:00:10] went in, [2:00:11] the city needed to connect here [2:00:16] um so that they could have the water uh [2:00:19] sewer, both pressure and normal flow. [2:00:22] So, four lines in through there. And the [2:00:26] ultimate resolution was we let the lines [2:00:29] go in and the city engineered the road [2:00:30] and we anticipate we've already had our [2:00:32] pre-construction meeting building that [2:00:34] this summer. And of course this is a a [2:00:38] road that is a a residential [2:00:41] uh road on the the master plan. You [2:00:44] you've seen the master plan. Um [2:00:47] so it's it's undeveloped. However, we [2:00:51] have relied on the master plan for [2:00:54] years. [2:00:56] Um, so if you go to the the handout, [2:00:59] skip the second page and and go to the [2:01:03] third page. Um, I've tracked it back, [2:01:06] council said it goes back further, but [2:01:08] I've tracked tracked back as far as I [2:01:10] can. This is 1995 a master plan to 2000. [2:01:16] And you can see that the 1200 west is on [2:01:19] there. And then you can see the next one [2:01:22] is 2000 to 2005. [2:01:25] There we have the east west 1200 on [2:01:28] there as well. [2:01:31] Uh and the next uh is 2006. [2:01:35] You'll see both roads are are on there. [2:01:39] And [2:01:41] then we see the same in 2011. [2:01:44] And that brings us to 2013. So, so [2:01:48] Schaefer Industries Shadow Mountain, [2:01:50] we've relied on the master plan for [2:01:54] decades, literally decades, with respect [2:01:57] to the development. Now, we recognize [2:02:00] that the city came in and put Ivory [2:02:02] Homes in, which may impact us with [2:02:05] respect to development plans, but that's [2:02:07] for something down the road. [2:02:11] One thing I want you to note while [2:02:13] you're looking at [2:02:15] the if you go to the U first page of the [2:02:19] handout, [2:02:21] we [2:02:22] and I'm going to use Schaefer for short [2:02:25] for the full designation. [2:02:30] We are the land owners that are most [2:02:32] impacted by this. And I did a real rough [2:02:35] calculation off of Google Earth. We have [2:02:38] some 1,400 ft approximately at issue. Uh [2:02:43] Mr. Snow has roughly 950, [2:02:46] Mr. Olson about 750. [2:02:49] But again, you have to understand we [2:02:51] have been relying on these and to adopt [2:02:54] the proposal as made [2:02:58] landlocks our property [2:03:01] from the current zoning and from the [2:03:04] master plan which is light industrial. [2:03:06] landlockwalks this completely because [2:03:08] people say, "Well, you've got the road [2:03:10] on the that you're putting in and then [2:03:12] it continues up the east side of Ivory. [2:03:14] That's a residential road that is not [2:03:16] going to handle the traffic. [2:03:19] It's not going to if we put a [2:03:20] distribution center in there, it's not [2:03:22] going to handle the traffic. If we go [2:03:24] with heavy industrial, it won't handle [2:03:25] the traffic. if if virtually you're [2:03:28] going to landlock the property that [2:03:30] we've relied on for decades. And so I [2:03:32] thought, well, there must be some big [2:03:35] public interest at issue [2:03:38] for for this issue to bubble up to the [2:03:41] surface at this point in time. So I [2:03:43] thought, well, let me refresh my memory [2:03:45] on master plans. So I went to the [2:03:48] statute and I thought, well, let's start [2:03:50] with our state law. And our state law [2:03:54] requires a master plan. And under state [2:03:58] law that it the master plan has to have [2:04:00] two items. [2:04:02] It must have it must address the future [2:04:05] and present needs of the municipality [2:04:08] and I would suggest that means the [2:04:10] public at large not a single property [2:04:13] owner [2:04:14] and it has to address the growth and [2:04:17] development [2:04:18] of any or part of the land within the [2:04:22] city within the municipality. So that's [2:04:25] state law and the focus is on future. [2:04:30] So then I thought well let's let's see [2:04:32] what the state has said what how do how [2:04:35] do we teach the cities this? So I went [2:04:37] to the general planning guide that the [2:04:39] state puts out and it says on its face [2:04:42] in the introduction [2:04:44] this guide will help you understand the [2:04:46] role that the general plan should play [2:04:49] in your community. [2:04:52] And let me tell you in in that uh first [2:04:55] few pages it says planning and we're [2:04:57] talking about planning [2:04:59] also allows stakeholders Schaefer for [2:05:02] decades [2:05:04] to know what to expect from your city. [2:05:07] What are we going to expect? We're going [2:05:09] to expect that we can develop that [2:05:11] property in 1988. We could literally see [2:05:13] from here to to the point of the [2:05:15] mountains before all the growth came in. [2:05:18] The general plan outlines your city's [2:05:20] vision. We're talking about vision for [2:05:23] the future and describes how that vision [2:05:25] will be achieved. Residents, developers, [2:05:27] business, state government, and others [2:05:29] interested parties should be able to see [2:05:31] how your city will change by reviewing [2:05:34] the general plan. So, the general plan [2:05:36] is very, very important. And that gets [2:05:38] to the heart of your question. It really [2:05:41] matters if we're on the general plan. It [2:05:43] does. And in fact, if the proposal is is [2:05:47] adopted as is, it will have a draconian [2:05:51] effect on our property, including the [2:05:52] value and landlocking is not fun. Well, [2:05:56] I went on to the next step trying to [2:05:58] track this through. What does what does [2:06:00] the state say about drafting? Not only [2:06:02] the policy, but what does it say about [2:06:04] drafting? [2:06:07] And it says the same thing. general [2:06:09] plans, also called master plans or com [2:06:14] comprehensive plans, guide. So guide, [2:06:16] we're talking about the future, your [2:06:19] community in its decision making by [2:06:21] describing its current and future needs [2:06:23] and then it goes on. But that's that's [2:06:25] how this is what we're supposed to [2:06:28] follow in drafting these. So then I [2:06:30] thought, well, what did we draft? [2:06:33] So I looked at our master plan and our [2:06:38] master plan says right at the beginning [2:06:40] what is a general plan. The general plan [2:06:43] serves as an advisory document [2:06:46] that helps guide the future growth. [2:06:48] We're talking about the future growth. [2:06:50] We're not talking about landlocking [2:06:52] people who've relied for decades who are [2:06:54] the most impacted owners and land use [2:06:58] decisions. It indicates the location and [2:07:00] type of land uses and it goes on [2:07:05] » u skipping down the general plan not [2:07:08] only helps guide future development. So [2:07:11] future development and it it goes on [2:07:14] after that. So that's what we've we've [2:07:17] addressed and so again I'm thinking [2:07:20] there must be some big public interest [2:07:22] that's come up for this about phase of [2:07:25] this issue that's been resolved for [2:07:27] decades. [2:07:28] And you know, I started digging into it [2:07:30] and let me tell you what I found. I [2:07:34] found out and I and I'm gonna tip my [2:07:36] hand up front because I want I'm gonna [2:07:38] bore you a little bit, but I'm going to [2:07:39] tell you what this is all about is to [2:07:42] resolve private litigation with the [2:07:44] contract. That's not what master [2:07:46] planning is for. It's not to resolve [2:07:48] litigation. That's nowhere in the [2:07:50] statute. It's nowhere in the in the the [2:07:54] guide. It's nowhere in the the [2:07:56] discussion about how we draft these. [2:07:58] It's nowhere in our master plan [2:08:01] resolving private disputes because Ivory [2:08:04] and the city have an issue with Mr. [2:08:09] Martin and we love Mr. Martin and [2:08:11] respect him. That shouldn't dictate what [2:08:14] we've relied on for years. Litigation [2:08:17] resolution is not an appropriate [2:08:19] consideration for for planning. So um [2:08:24] Mr. Taylor, thank you. I just in the [2:08:26] interest of time. Um I think we hear you [2:08:30] and uh so I have I have kind of some [2:08:33] general questions. Um I think in this [2:08:36] instance everything that you stated [2:08:38] there in those documents is true. They [2:08:40] are advisory. They are vision and it is [2:08:44] we this body has had numerous times [2:08:47] where you know like we said this vision [2:08:50] this advisory flow has been created many sometimes decades ago. We do [2:08:57] revisit with the realities of today of [2:09:00] how maybe things have changed and the [2:09:02] way the direction development has gone. [2:09:04] Um it is appropriate for bodies to [2:09:07] sometimes review the practicality [2:09:10] of those road plans and we do make [2:09:13] adjustments and tweaks and that's um [2:09:16] again we we we want to make a good [2:09:18] decision that is practical and balances [2:09:21] the interests of everyone that's [2:09:22] impacted and also what's really [2:09:25] happening with the growth because like [2:09:27] you said when you were there and you [2:09:29] could see the point of the mountain who [2:09:30] we didn't know what was coming but there [2:09:33] so sometimes change. We can tweak things [2:09:35] and that's appropriate legally. Um so my [2:09:39] question for you is um obviously you do [2:09:44] you imagine with this 27 acres do you [2:09:46] have a plan of what you plan to do with [2:09:49] that? Are you going to sell it? Are you [2:09:51] going to do you have imminent you said [2:09:53] you were kind of relying on these roads [2:09:56] as you've seen them for this amount of [2:09:58] time. Do you anticipate you are going to [2:10:01] determine what comes here or are you [2:10:03] going to sell the property and have a [2:10:05] another entity come and say you know [2:10:07] what actually we want maybe the [2:10:09] circulation to be different. I mean I'm [2:10:11] sure you would want that flexibility [2:10:13] within your 27 acres as well but when [2:10:17] you say you've relied on it do you have [2:10:20] a plan currently in mind of what's [2:10:22] happening there? [2:10:24] >> I'll answer the question by saying very [2:10:26] short no. However, [2:10:29] we had a plan and we bought the property [2:10:32] for an expansion site. [2:10:33] >> Okay, [2:10:34] >> that's why we bought it and that's why [2:10:36] we've held on to it. It's in heavy [2:10:38] industrial. However, the city came in [2:10:41] however many handful of years ago and [2:10:44] put a residential area right next to us [2:10:47] and that's caused us to rethink things. [2:10:50] But let me tell you, with respect to the [2:10:52] affected roads, with respect to Mr. [2:10:54] Rollson. Nothing's changed there. And [2:10:57] the and eliminating the these roads, I [2:11:00] mean, he's been swinging these beams and by the way, if he's swinging these [2:11:04] beams and and it's dangerous, he [2:11:06] shouldn't be allowed to do it in the [2:11:07] public road. That should be barred. And also, Mr. Martin's use hasn't [2:11:12] changed. There's been no change in our [2:11:15] area other than the city zoning [2:11:18] residential, which is on the other side. [2:11:20] And so, no, we don't have a current [2:11:22] plan. We're going to have a plan, but we [2:11:24] don't want to to be frozen out by a [2:11:26] change in a master plan that we've [2:11:29] relied on for decades. [2:11:30] >> But you might want flexibility to [2:11:32] potentially determine how things are [2:11:35] developed out as well. I would imagine [2:11:38] you're not saying do these roads and [2:11:39] never change them. [2:11:41] >> We are not saying that. And in fact, we [2:11:43] considered the culde-sac, but we want to [2:11:45] be good neighbors and I have done that. [2:11:48] I've done my level best to get this [2:11:49] resolved. Unfortunately, and and I think [2:11:52] the other the opposing sides, we're all [2:11:54] friends, and I think they'll they will [2:11:57] recognize I've been the one running [2:11:58] around trying to get this resolved. And [2:12:01] we hoped a culde-sac would work, but it [2:12:03] doesn't work because of the city [2:12:04] ordinances. We studied it. The city [2:12:06] engineers drafted a couple of proposals, [2:12:09] but it doesn't get us far enough into [2:12:11] our property so that we can do [2:12:13] something. So, we and we don't want to [2:12:15] be disadvantaged by having these roads [2:12:17] stripped off of our property. the [2:12:19] developers won't want it. They're going [2:12:21] to say, "What's the city going to do?" [2:12:23] So, we need certainty. [clears throat] [2:12:24] We need to have the roads there. And the [2:12:27] there is a quotation I have down here [2:12:30] from I think the planning department [2:12:31] where they say the reason we're doing [2:12:33] this is so that the roads can be [2:12:35] developed in accordance or put in in [2:12:38] accordance with the development. That is [2:12:40] completely backwards planning. You you [2:12:43] don't do it that way. It flies in the [2:12:45] face of what we've done. And that is [2:12:46] under the purpose section. [2:12:50] of the the planning report. I wish I [2:12:55] could put my hands right on it [2:12:58] because it just it says right on its [2:13:00] face. Let me see if I can turn to it. [2:13:04] >> So, you did at one point think the [2:13:06] culde-sac might be an option that [2:13:08] >> we did that and and what specifically? [2:13:11] So, now you're concerned it doesn't [2:13:13] >> it won't work. It won't work. We we have looked at we've looked at a [2:13:17] couple of auctions. I've looked at the [2:13:19] code the everybody can back me up. It [2:13:22] just won't work. If you look at it, it [2:13:25] just tips into our It won't work. If we [2:13:28] could take that and extend it a couple [2:13:30] of hundred feet. Well, maybe that would [2:13:32] work. But the problem is is where it [2:13:35] sits so far. We can't do what we need to [2:13:38] do. I mean, it would be another problem [2:13:40] with access. [2:13:41] >> Okay. So actually maybe culstack is [2:13:44] still on the table if it just had a you [2:13:47] said a few hundred feet further in to [2:13:51] your joining properties. [2:13:52] >> It is an option. It's not a desirable [2:13:54] option and not by far what we want but [2:13:57] trying to be good neighbors. We tried to [2:14:00] brainstorm what we've looked at every [2:14:02] possible angle. Every possible angle. [2:14:05] And I want to read you that quote. The [2:14:07] purpose of the request is to allow [2:14:11] street alignments to be determined at [2:14:14] the time property is developed. That is [2:14:16] backwards planning. You put the roads [2:14:18] in. It's the future. It's the vision on [2:14:20] the master plan so that people know [2:14:22] what's coming. So we we've really really [2:14:26] tried to resolve this. Now, all of that [2:14:28] said, I I have to tell you, [2:14:34] somebody's going to be unhappy with the [2:14:36] result tonight. [2:14:38] What we are, if you'll go to the second [2:14:41] handout, we are okay [2:14:45] as an alternative [2:14:48] to deleting the road. [2:14:52] You can see it on there [2:14:54] >> that is between Mr. snows buildings from [2:14:58] the master plan. He gets his bond. The [2:15:00] city gets the money to rectify the [2:15:02] litigation over at Ivy, which is what [2:15:04] this is all about, which is improper [2:15:06] legally. [2:15:08] We're okay with the as long as we get to [2:15:10] keep what we've had on the master plan [2:15:13] for decades. So, we're not landlocked. [2:15:16] Again, we can't access it for what the [2:15:18] current or proposed use is [2:15:21] >> from the the west, but we've got to [2:15:23] access it from the east. So, if I [2:15:26] understand clearly, it sounds like all [2:15:28] three party business owners are in [2:15:32] agreement that area that you have [2:15:35] crossed out that that's not an issue for [2:15:37] any of the parties to to for that. [2:15:39] >> It's not an issue for us. We then we [2:15:41] support that. [2:15:42] >> Okay. Well, we're on the same page with [2:15:43] that one issue. That's that's good news. [2:15:45] I would like to allow my council to [2:15:48] maybe ask questions um as well on what [2:15:54] is in front of us here to any of the [2:15:56] parties. [2:15:58] >> So um apologize. Last time I was in the [2:16:02] cloud, but I was here, right? And and I [2:16:04] was the one that was kind of leaning [2:16:06] towards continuing it to make sure we [2:16:08] could get everybody's needs addressed. [2:16:12] Um I'm I'm a huge advocate [2:16:16] of the general plan. It It's important [2:16:19] for cities to plan a city council. Yes, [2:16:23] we need to deal with what's going on [2:16:24] today, but we've got to look 50 and 100 [2:16:27] years. And all of us are gone and your [2:16:29] property belongs to someone else. Even [2:16:30] your right, your your business that's [2:16:33] there, your businesses that are there. [2:16:35] So, what I'd like to see is something [2:16:37] that works today for you today, but [2:16:41] still helps in this future. And this is [2:16:43] not swayed by what Mr. Taylor has said, [2:16:46] although it aligns a lot with what he [2:16:48] has said, that's been I will I want to [2:16:51] protect master plans as much as [2:16:54] possible. Um, so I think it's great to [2:16:59] remove that that one slide that Mike [2:17:01] showed with the green road. I'm [2:17:04] completely in favor in facilitating some [2:17:06] of the needs that that provides [2:17:08] >> the entire green road. [2:17:10] >> No, his short segment. [2:17:12] >> Yes. on snow properties. [2:17:14] >> So, I'm I'm I think that makes [2:17:16] everyone's happy. I think the mayor just [2:17:17] pointed that out. I think that works for [2:17:19] everyone. The other roads that are there [2:17:22] on the general plan, [2:17:26] they're there, but you keep doing your [2:17:28] stuff, right? You keep running your [2:17:30] business. You keep running your [2:17:32] business. Mr. Snow, we can meet those [2:17:35] needs. Um I'm one that would be happy to [2:17:38] make a motion for that. But I don't need [2:17:40] to make it right now because I don't [2:17:41] want to cut Steve off for others. [2:17:42] >> Yeah. I just want some clarification [2:17:44] too, kind of going beyond where you are [2:17:46] because I was going to mention that, but [2:17:49] with the two roads that are in place [2:17:51] beyond just the one you're talking about [2:17:53] eliminating in the future, if those were [2:17:56] to be developed, that would be some [2:17:59] agreement between two property owners [2:18:01] that and and what does that look like [2:18:03] and how does that what's that process? [2:18:06] So, typically you'll you'd have a [2:18:08] subdivision plat dedicating right of way [2:18:11] and so they will have to sign a [2:18:13] subdivision plat or one person would [2:18:16] need to buy one property owner would [2:18:17] need to buy right ofway width from them. [2:18:20] So, a couple different options. Um, but [2:18:24] >> so even if those stayed on the plan, uh, [2:18:26] it still requires all the parties to be [2:18:28] involved in how that will end up being [2:18:31] developed. Correct. So, everybody still [2:18:32] has a voice in what happens. [2:18:34] >> Yes. Okay, [2:18:35] >> if I may, that's there's one additional [2:18:38] option is condemnation. He cooperated [2:18:50] or we're going to condemn it. It doesn't need to [2:23:43] connect on the center street. If we put [2:23:45] that culde-sac in which Schaefer [2:23:47] recommended and we could have we could [2:23:49] have passed this, if I would have agreed [2:23:52] to it, it would have been changed two [2:23:54] months ago because Schaeer requested the [2:23:58] culde-sac, [2:23:59] >> but I didn't want anything, [2:24:01] >> right? And we elected we made [2:27:43] that election timely and writing. But [2:27:46] that was our idea because we know that road as currently [2:27:51] drafted on the master plan won't work [2:27:54] for the development of this property. So, if [2:28:38] Anderson Lane you feel is not wide [2:28:40] enough [2:28:41] um and then your segment that connects [2:28:44] to Anderson Lane [2:28:47] um [2:28:48] has that same profile adoption which was [2:28:51] skinny up the road a little bit. Then [2:30:53] Ivory shrunk it down to 15 foot so they [2:30:56] could build a little closer. We run a [2:30:59] lot of trucks through there every day. [2:31:01] Probably 10 or 15 trucks because they [2:31:04] come straight down Anderson Lane. They [2:31:06] come around, go through our shipping [2:31:07] yard. It is a lot tighter than it would [2:31:11] be if it was 66 feet wide, but the [2:31:13] trucks are still going through there and [2:31:16] but there's not much traffic now. So for um the [2:49:46] affordable housing funds um [2:49:50] uh other than that there's uh a couple of uh I I don't know tons not tons of [2:50:00] changes to the 700 North CDA and the uh [2:50:04] and sorry I call them RDA RDA not CDA [2:50:07] >> over the uh over the years I guess the [2:50:09] acronym has changed for uh redevelopment [2:50:12] area. Um [2:51:06] and I [2:51:08] Kristen told me to note that um [2:51:10] currently in the affordable housing uh [2:51:12] we have 50,000 $57,581 [2:51:18] and we'll be moving uh by the end of the [2:51:20] year. We anticipate having a by the end [2:51:22] of the fiscal year um we anticipate [2:51:26] having uh 189,693 [2:51:31] u in that account. [2:51:34] Um and that was essentially the notes [2:51:38] that I uh that I have. If there's uh [2:51:40] specific questions I'll probably have to [2:51:43] get back to you on, but [laughter] I'm [2:51:44] happy to happy to field what I can. [2:51:47] >> I I can add a few items to that. Um, so [2:51:51] like we have two RDA areas, the 700 [2:51:54] North RDA and the Lynen Park CRA. The current state law says that [2:52:11] after uh RDA expires, you've you've got [2:52:15] to move that housing into or you've got [2:52:18] to move those any remaining funds into [2:52:20] housing. Now, that changes on Wednesday [2:52:24] and it says on Wednesday, it says you've [2:52:27] got to go back and find out who all the [2:52:29] texting entities are and if there's any [2:52:32] additional funds, you have to reimburse [2:52:34] all those taxing entities with that [2:52:36] remaining budget. And so, that kind of [2:52:39] partic uh kind of helped move this [2:52:42] forward that [laughter] [2:52:44] um as we're reading the new state code [2:52:45] last week, uh we said, "Well, let's not [2:52:49] give all this money back. Let's move it [2:52:51] under the current law to affordable [2:52:54] housing and then we'll figure out how to [2:52:57] apply that in the future. [2:53:01] » Good to know. [2:53:04] >> And then the three districts that are no [2:53:06] longer collecting tax increment and have [2:53:08] this leftover fund balance. [2:57:08] >> Yeah. And so these RDAs, they were [2:57:10] created in the 80s um between 82 and 89. [2:57:14] Um we haven't collected any uh you know [2:57:18] increment taxes off those since you know [2:57:21] between tw 2009 and 2019. Um they've all [2:57:25] been successful. They've they've met [2:57:26] their purpose especially where Home [2:57:28] Depot and Murdoch Hyundai I mean that has created some of our top sales [2:57:33] tax producers. So those are great to set up. Uh the west side was set up to [2:57:39] basically help where Schaefer Industries [2:57:41] is and and those industrial properties [2:57:44] to help improve our industrial sector [2:57:47] and um the State Street sounded like [2:57:50] there was some issues of blight they [2:57:52] were dealing with in the 80s and I think [2:57:54] State Street looks a lot better in those [2:57:56] areas that were redeveloped. So, but [2:57:58] they've outlived their their time and um [2:58:01] it's now we're bringing forward a [2:58:03] process to dissolve those three areas. [2:58:05] We've created the processes. We have to [2:58:08] um approve those by the dissolution by [2:58:11] resolution and then the city council has [2:58:14] to approve it by an ordinance. [2:58:19] » When you say they're expired, what does [2:58:21] that mean? When they're first created, [2:58:23] they were created for certain period of [2:58:24] time [2:58:25] >> typically. Yeah. like this 700 North [2:58:27] RDA. It it it was only created to last [2:58:30] till 20 or 2037 and then during COVID [2:58:34] state law allowed us to expand it give [2:58:36] an additional two years. So it'll expire [2:58:39] in 2039. So yeah, they all have a [2:58:41] project area plan and budget that [2:58:43] expires you typically 20 to 25 years. [2:58:47] >> Those time limits were imposed by the [2:58:49] state. [2:58:49] >> Yep. [2:58:50] >> Yeah. [2:58:51] >> And in order to I mean they expire when [2:58:53] they expired by date. [2:59:29] >> Hyundai um [2:59:32] >> could have used RDA funds, but we did [2:59:34] have an incentive package with Hyundai [2:59:36] and we exchanged some property. we used [2:59:38] to have where part of their parking lot [2:59:41] uh is currently it used to be just an [2:59:43] open detention basin and so we [2:59:45] transferred that property to them and [2:59:47] allowed them to bury that detention [2:59:49] system and so they have a subsurface [2:59:52] detention basin under their parking lot [2:59:54] so we we traded some land as part of the [2:59:57] incentive to get them here [2:59:59] >> and that was I don't know I don't [3:00:02] believe there was any direct RDA [3:00:04] reimbursement but they did have a sales [3:00:06] tax performanc [3:00:08] plan [clears throat] similar to what KIA [3:00:09] is doing. So if they hit certain [3:00:11] benchmarks, we would pay them back a [3:00:13] certain amount. [3:00:15] >> And KIA is knocking it out of the park. [3:00:16] They that was set up as a five-year RDA [3:00:20] and they're going to we're going to be [3:00:22] closing that out in three and a half or [3:00:24] within [3:00:27] ahead of schedule. So what I did, just so you [3:10:31] know, I took these [3:10:33] applications and I reviewed them. I [3:10:36] think they all pretty much because of [3:10:38] their plan of what they'd like to do, [3:10:39] they fit that category of doing [3:10:41] something in Lynen for Lynen. Uh some of [3:10:44] the asks were were quite big. Um and [3:10:48] then we've got a situation like Lynen [3:10:51] Elementary who has been awarded year [3:10:54] after year after year after year. So [3:10:56] they have their arts program is is [3:10:58] really amazing. So, um, from those seven [3:11:01] applications, are there any questions [3:11:03] about any of them that you might have? [3:11:07] So, when they request, for example, [3:11:09] Lyndon requested 8856 [3:11:12] >> and they specified three specific areas. So that's something that [3:12:34] >> and all all those mayors, all all the [3:12:36] ones that we talked to this time agreed [3:12:37] that they would make it work with a [3:12:39] parter portion that we recommended. Six [3:12:41] and seven were both ones that looked [3:12:43] that they significantly less than what [3:12:46] they were requesting [3:12:47] >> and five five requested 8,000 although [3:12:51] last year uh it was a little bit less [3:12:53] than that. But they're going to have to [3:12:55] come up with money now just for the [3:12:56] building rental because remember that [3:12:59] garden pipe band. It really was about [3:13:02] the $6,000 level [clears throat] that [3:13:04] paid for all of their reservation fees [3:13:06] which all they do is I award them the [3:13:08] check and they pay it back to the city. [3:13:10] >> Yeah, that's [3:13:12] >> and it's been nice for them and they [3:13:13] have been great tenants and have done [3:13:16] some amazing things. So I I some of the [3:13:20] smaller grant requests um like the [3:13:23] United Angels Foundation, they do those [3:13:25] special needs classes in our building. [3:13:27] That's another one that building is a a [3:13:29] great portion of the amount that that [3:13:31] we're allowing them for the rental. Uh [3:13:34] the Shantanet Lady Choir really uh would [3:13:38] really like to use the Vets Hall for [3:13:40] their opening and closing social, but [3:13:42] they sing in the spring [3:13:46] >> gardens And they they they make [3:13:48] available their free concerts to anybody [3:13:52] at any time. And they've got a lot of [3:13:54] Lynden ladies that participate in that [3:13:55] large group as well. And I think one of [3:13:58] the things that's important to note is [3:13:59] um some of these like Heath is [3:14:01] mentioning, it's not really outofpocket [3:14:04] cash for the city. Sometimes these turn [3:14:06] into pretty significant partnerships in [3:14:09] a way because they're providing [3:14:12] activities or classes or different [3:14:15] things for people in the community to [3:14:17] enjoy. It's almost like an extension of [3:14:19] our recreation programs. Is that fair to [3:14:22] say? So I think it fits [3:14:24] >> the money is kind of a wash because it's [3:14:26] in kind for use of [3:14:29] >> and often when the building is empty, [3:14:31] not necessarily on Thursday nights when [3:14:33] the garden, but I get requests for [3:14:35] Thursday nights. Uh and it's they're [3:14:38] kind of in there, but we're not losing [3:14:40] any revenue because other times are [3:14:41] available. If if maybe I could ask maybe [3:14:44] we could just look at number six, [3:14:46] Nashville and the Rockies. um they want [3:14:49] to have a large concert in this area in [3:14:52] this venue and uh I had a hard time uh [3:14:57] figuring with the other asks that we [3:14:59] would pay for travel uh you know and pay [3:15:02] for uh hotels for Nashville artists when [3:15:06] there's some pretty good talent around [3:15:08] here and and I understand that they want [3:15:09] to make it uh big but that's that's why [3:15:12] that one was was cut down to just maybe [3:15:14] a venue rental for them if they wanted [3:15:17] Yeah. [3:15:59] >> Yeah. Yeah. Go ahead. [3:16:01] >> Bonner, the the really well-known Bonner [3:16:04] family. So, Yahoo sang at one of our [3:16:07] Christmas events a couple years ago. And [3:16:10] you know, the Bonner family um [3:16:11] African-American family, super talented [3:16:14] musically. He and his brother are on [3:16:16] stage in once on [clears throat] this [3:16:17] island at the Hail or at the [3:16:19] >> Yeah. [3:16:19] >> roof. So they perform professionally. [3:16:22] They do a lot of videos. They're pretty [3:16:24] high-profile. But Deborah is the mother [3:16:26] of the clan and she has an really [3:16:29] amazing program of gospel choir music. [3:16:33] It's it's not just religious, but it's [3:16:35] just all uplifting music. So they've [3:16:37] been rehearsing in Trordia here in [3:16:39] London. They've been like a corporate [3:16:42] sponsor just allowing them to use their [3:16:44] space and uh they recently had a [3:16:47] performance. Um it's a free choir for [3:16:51] people to join and they had a gayla [3:16:54] fundraiser they invited me to and the [3:16:57] stories of how they really do transform [3:17:00] lives. It's it's really quite remarkable [3:17:03] um people getting involved in this and [3:17:06] um they said we want to partner with [3:17:09] Lynen City. are already in Lynden. We [3:17:11] want to now start a children's [3:17:14] um choir initiative. This other one has [3:17:17] been adult. So they would want we want [3:17:20] they said that we want to be an arm of [3:17:23] Lynen City Recreation [3:17:25] um where we provide this children's [3:17:27] choir. Um and so again I think a lot of [3:17:31] the funding here is for use of space. So [3:17:35] they came and met with Heath and I. We [3:17:38] showed them the vet hall and they have [3:17:40] big plans like if it could start out [3:17:42] once a week. Kids could come to the [3:17:44] choir and then they would have um [3:17:46] profession they have a professional [3:17:48] pianist, jazz pianist. He's pretty [3:17:50] amazing. He lives in Vegas. They fly him [3:17:53] up or he travels up every Thursday for [3:17:57] their things they're doing with the [3:18:00] adult groups. And so they would have him [3:18:03] also stick around to work with the [3:18:05] youth. and he can take I mean he's just [3:18:08] incredible. And then they talked about [3:18:09] they have other professional people who [3:18:11] had potentially they could start um [3:18:14] professional uh acting drama. They had a [3:18:18] whole bunch of ideas of how it could [3:18:20] potentially expand. So [3:18:22] >> this uh mayor, as I recall going over [3:18:24] their grant, this grant request is not [3:18:26] for that children's choir. It's for [3:18:29] their choir. And so because we were so [3:18:31] jammed with time, they didn't know what [3:18:34] they should ask for and it wasn't put [3:18:36] together yet. So that might need to be [3:18:38] clarified if because they want to start [3:18:41] the children's choir as a partnership. [3:18:43] But this request was for their regular [3:18:45] choir. [3:18:45] >> Okay. [3:18:46] >> To fly their their people in and and [3:18:49] hire their professional. [3:18:51] >> But I think the goal was that they would [3:18:54] do the adult and children's in [3:18:56] conjunction. [3:18:58] they've pretty much announced [3:19:00] publicly [3:19:02] starting the youth [3:19:05] um version of of what their initiative [3:19:08] their mission. [3:19:10] >> Yeah. So, as the grant was written, [3:19:11] we'll have to split hairs if we want to [3:19:13] on that because they just wanted it for [3:19:14] their regular choir, not the children's [3:19:17] choir. But, and they're pretty specific. [3:19:19] You can look, you can prove that if you [3:19:20] want and see what you think. [3:19:23] Uh so that fits pretty well. So what I [3:19:27] did at the end, you can see that I took [3:19:29] that those tables and just kind of [3:19:31] looked at it a couple of different ways. [3:19:34] Uh way number one is if we go with at [3:19:38] all organizers benefit, all [3:19:39] organizations benefit a little and [3:19:42] everybody gets a chunk of the pie. uh [3:19:44] you have the ability of course to to [3:19:46] decide that those that are for the best [3:19:51] interests of the Lynon to fund [3:19:52] completely which would be kind of the [3:19:54] table number two uh and and that's not [3:19:57] the order that they were received that [3:19:59] was the order in which I could foresee [3:20:02] that being a immediate benefit to the [3:20:06] schools and to the art programs. This is [3:20:08] the first time in a long time Rocky [3:20:09] Mountain El Elementary Elementary has [3:20:11] applied and they want to do a show and [3:20:14] they wanted mic packs and a and a script [3:20:18] set as well. Uh or u you could do it. I [3:20:22] just I just figured that we could do it [3:20:26] those couple ways or we can award [3:20:28] whatever we want. But there was a [3:20:29] $38,000 $686 ask this year. [3:20:34] So, whatever you'd like to do there, if [3:20:36] there's questions, [3:20:38] >> the total amount available, [3:20:40] >> it's 15,000 budgeted. So, they're over [3:20:43] >> So, all of this is over budget. Okay. [3:20:46] >> But I took that because of the last two [3:20:48] years in in option number one. I took [3:20:50] that and got it close to what you've [3:20:51] approved in the last year or two, which [3:20:54] is 18. No, that's going to be 19. So, that in kind, they just want [3:22:48] to take the portion that they didn't [3:22:51] specify and they really didn't do a very [3:22:54] good job specifying. [3:22:55] >> Yeah. Their biggest desire is to [3:23:02] bring in this jazz musician and anybody [3:23:05] else they contract and hire to bring in [3:23:07] to help this help the choir and the kids [3:23:10] choir. [3:23:11] >> The choir would be weekly. This [3:23:14] Nashville thing is kind of a one-off [3:23:15] event. [3:23:16] >> Deborah asked for it. She'd take it [3:23:19] daily. I do know that [3:24:54] they offer lessons to Lynon residents at [3:24:58] no cost and that's also not bag pipes, [3:25:01] that's drums. They do a big drumming [3:25:03] section. [3:29:48] >> So, we have a I mean, you have a [3:29:50] significant fund balance, but we're earmarking it for things [3:29:55] potentially in the future. And so, [3:29:56] checking with Kristen, she felt like in [3:29:58] that 19,000 range is is totally doable. [3:30:02] Um I this would dramatically change [3:30:05] things, but you have the ability. I [3:30:07] mean, you could make this a $100,000. I [3:30:09] mean, and but that's going to change how [3:30:12] we're paying for some other things in [3:30:14] the city. And so, but the 19 range, she [3:30:17] was totally comfortable going more than [3:30:19] the 15 that's budgeted [3:30:21] >> because if we did the full ask of [3:30:25] everyone except well the fir the full [3:30:29] ask of our previous applicants um and [3:30:34] then didn't charge the pipe and their [3:30:37] rent. So they only needed $1,000 [3:30:41] and then gave 2,200 to the gospel choir [3:30:44] to pay for the professional and not [3:30:47] include Nashville Rockies. That would [3:30:49] put us at $18,000. [3:30:52] >> And that begs the question, I know we [3:30:53] had the policy of, hey, you got to pay a [3:30:57] rental fee because we had some groups [3:30:59] come and say, oh, we're we're going to [3:31:00] do all this for the city. And then [3:31:01] sometimes it didn't really materialize. [3:31:03] So we said, "Okay, we need to have a [3:31:04] policy. There's a room rental [3:31:07] >> and it's a washroom. [3:31:10] >> But but at the same time, the discussion [3:31:12] you and I had with Unity Gospel Choir, [3:31:14] and you mentioned, Heath, that maybe [3:31:16] it's time with the Garden Valley pipe [3:31:20] band, they've proven their return on [3:31:23] investment, their value in the [3:31:24] community, and we do just pull them in [3:31:27] and say this is an extension almost of [3:31:30] parks and wreck in a way. I I mean is [3:31:33] that [3:31:34] >> it's kind of interesting. We just don't [3:31:36] charge them a rental. I don't I just [3:31:37] don't think we can be [3:31:39] >> subjective. [3:33:29] I think her I mean she's wanting this to [3:33:32] be duplicated in other mark cities [3:33:34] potentially further away from London [3:33:37] than just next door. I have not checked with [3:34:02] Jamie to see if she could put a program [3:34:05] like this in her grant and extend the [3:34:07] reach of non-smoking and the non-smoking [3:34:09] grant and that might be able to fund a [3:34:11] program in a different way. Uh it is [3:34:14] certainly park tax eligible with park [3:34:17] tax money. Um but I and I think they [3:34:21] would be just excited to have a good [3:34:23] place to practice. [3:34:25] Um, but the kids choir becoming a Lynen [3:34:29] City kids choir, that's what it would [3:34:30] amount to. This is just kind of summarizing [3:43:27] uh the agreement that you have in place [3:43:29] uh in front of you in your staff report. [3:43:31] Um we've been contracted with Republic [3:43:34] Services for a long time. It's probably [3:43:37] been uh 20 years and so we had several [3:43:42] opportunities to renew or extend an an [3:43:45] existing contract. Uh this is an [3:43:47] addendum to an existing contract that [3:43:51] we've had in place. It's a three-year [3:43:52] extension. And let me just kind of [3:43:55] outline what's in in this proposal. Uh [3:43:58] in the first year this coming fiscal [3:44:00] year, there would be a 6% increase. Uh [3:44:04] and we've [3:44:05] uh discussed with you previously in a in [3:44:08] a prior meeting to be able to handle [3:44:10] that increase uh collectively with our [3:44:13] garbage and recycling. We have a fund [3:44:15] balance as a city. Um and that balance [3:44:19] kind of es and flows as new accounts [3:44:22] sign on or as people drop cans or [3:44:24] things. And so, uh, it's built up a [3:44:27] little bit and Kristen feels that we can [3:44:29] absorb for garbage that full 6% increase [3:44:32] this first fiscal year. For recycling, [3:44:35] um, we would absorb 1% and then pass on [3:44:39] a 5% increase to our customers. And so, [3:44:41] just to the right there would be our [3:44:44] current rate for garbage then, uh, for [3:44:46] this proposed fiscal year would not [3:44:48] change. And then the recycling would go [3:44:50] up just that that little bit, uh, about [3:44:52] 30 cents or so. [3:44:55] um on the contract. Then on year two and [3:44:58] three, um it creates a floor of a 2 and [3:45:01] a.5% increase and a ceiling of a 6 and a [3:45:05] half% increase. And these increases are [3:45:08] based off of the consumer price index, [3:45:10] the CPI. There's a specific garbage and [3:45:13] trash listing out of hundreds of things [3:45:15] that they index. Um just as a FYI, in [3:45:19] some prior years, here's some of those [3:45:21] rates. um January to January of this [3:45:26] last 25 to 26 was about 5%. Um but [3:45:31] February to February is what the [3:45:32] contract says. Um and so you can see in [3:45:35] one of those years it would have capped [3:45:38] at that 6 and a half% ceiling. Um but [3:45:41] traditionally we're hovering around that [3:45:43] 5% increase every year. [3:45:47] the floor. I realistically it probably [3:45:51] won't go below that, but is that [3:45:53] necessary to have in there? [3:45:55] >> That was something that I I'll let [3:45:57] Ashley dis discuss. We really [3:46:42] appreciate it. uh straightforwardly we [3:46:44] really appreciate too your just uh [3:46:46] geographical significance with the [3:46:48] transfer station. It's very helpful to [3:46:49] us. Um so looking at this contract we [3:46:53] previously have been capped at a 4% um [3:46:57] under this previous amendment that [3:46:59] really hurt us. Um just transparently [3:47:03] cost of service has gone up so much. Uh [3:47:05] we've tied your annual price increase to [3:47:09] the garbage and trash CPI, but again [3:47:13] just honestly the cost of doing service [3:47:15] for us is always going to be above 3%. [3:47:17] So uh I got a hard bargain from Adam. We [3:47:21] [laughter] [3:47:22] uh I I'm not going to say on record what [3:47:25] the official ask was from my higherups [3:47:27] in area, but it was higher than what uh [3:47:29] he got out of me. And uh this is what we [3:47:32] came to. uh I have to get my area [3:47:36] approval to put these prices together. [3:47:38] It's a long process. They have a big [3:47:40] spreadsheet, no formula. So, we put in [3:47:42] 2.5. That's where we feel like it we're [3:47:45] always going to be having to pay more [3:47:47] higher drivers, etc., but we're good [3:47:49] with that amount. We can take that [3:47:51] floor. Um ceiling. Hopefully, it doesn't [3:47:54] get up to that with the economy, but you [3:47:56] never know. But that's uh Council Member [3:47:57] Hulie. That's where that came from. [3:48:00] >> Will that help with service delivery? We [3:48:03] had, I think, two instances where [3:48:04] Republic couldn't help us out as [3:48:07] intended this last year. [3:48:09] >> So, I wasn't here. I was in California, [3:48:12] but I came back. Um, I've known about [3:48:14] that. [3:48:16] It's an industry-wide challenge, and [3:48:19] here in Utah County, we have had [3:48:21] challenges hiring drivers with CDLs. Uh, [3:48:23] we've raised our rates and our wages, [3:48:25] hence, you know, that 2.5 floor. We feel [3:48:28] really good about it right now. Our [3:48:30] trucks are holding up. We continue to [3:48:31] hire. We're even offering uh people who [3:48:34] are interested in getting their CDL to [3:48:35] go out to Texas and we'll pay for it. [3:48:37] So, but we're feeling better and good. [3:48:40] >> So, yes, fingers crossed. I can't [3:48:42] promise it will always be perfect, but [3:48:43] that's what we hold ourselves to. [3:49:38] And he would hold it for us quite often. [3:49:41] So, um we we appreciate those [3:49:46] accommodations. Something that's been [3:49:48] beneficial for us that's remaining in [3:49:50] the contract is right now Republic [3:49:51] actually covers the cost of emptying all [3:49:54] of our city facilities. And so we do not [3:49:57] pay for garbage services disposal for [3:50:00] any city facilities. So that was [3:50:02] something that they we we kicked that [3:50:05] around as an option, but we we would [3:50:07] prefer to keep that. They've [3:51:24] put in some things and then have changed [3:51:27] from what I can gather they've changed [3:51:29] some parent company [3:51:32] um [3:51:34] sorry ownership issues and they wanted [3:51:36] to get a separate uh agreement that was [3:51:39] just first digital um instead of through [3:51:43] a subsidiary or parent company. And so [3:51:46] uh we've sent them a sample agreement [3:51:48] that we've used in the past. They were [3:51:51] just fine with it. Signed it, sent it [3:51:52] back, and they've paid their application [3:51:54] fee. So, this is a draft that we've [3:51:57] actually prepared as a city. We're [3:51:58] comfortable with this being approved [3:52:00] 100%. So, [3:52:01] >> awesome.
