Then next up, the minutes for the [7:48] June 15th regularly scheduled council [7:50] meeting. [7:51] >> Any approvals or [7:53] >> did did we approve all three of those or [7:55] are we doing them? [7:56] >> Can we do all three in one or do they [7:58] have to be [7:59] >> You you can do all three. [8:00] >> Okay. Well, I'll ask for approval for [8:02] the remaining uh the June 15th regular [8:05] scheduled council meeting as well as the [8:07] June 16th special council meeting. Goal [8:09] setting. [8:10] >> Yes. I'll make that motion. Mayor [8:11] >> second. [8:13] >> We'll go ahead and vote. [8:15] >> Street. [8:15] >> Yes. [8:16] >> Al Jans. [8:16] >> Yes. [8:17] >> Gdome. [8:18] >> Yes. [8:18] >> Mallister Atkins. [8:19] >> Yes. [8:21] >> That noted noted for next time. Uh [8:24] persons preparing for council. Uh we [8:27] have Mason, senior project engineer with [8:30] OM advisors. Um so you can come on up. I [8:34] believe you can. Is the microphone [8:36] hooked on the podium? [8:42] Okay. [8:44] >> Floor is yours. [8:44] >> Well, hello. My name is Jason. First, I [8:48] want to say this is a great time. I was [8:51] actually [8:53] building 550. [8:59] Yeah, I'm with Advisors. It's nice to [9:01] meet everybody. I'm going to give you a [9:03] quick history of the firm or quick run [9:05] down. I know you got a busy schedule [9:07] tonight. [9:08] Advisor is a multi-disiplinary [9:10] engineering firm. Our mission is [9:12] advancing communities and our niche is [9:15] really stacking federal and state [9:17] funding working with the administration [9:20] and the capital improvement plan [9:21] marrying the two so we can expand [9:30] a firm over 800 right now. We have [9:32] experts in all kinds of fields. I would [9:35] be your main point of contact. But we [9:36] have traffic people, bridges, parks, [9:38] planning, corridor studies, you name it. [9:40] Anything municipal related [9:41] infrastructure, we have expert [9:46] help. [9:49] I've worked with the city of Massland [9:50] before the city of several times. I'm [9:53] very familiar with SCW [10:02] involved. So it's [10:04] hit the street. [10:06] If you have any questions, I'd be happy [10:07] to answer that. [10:13] » We're certainly happy to have you. [10:14] >> Thank you very much. Appreciate it. [10:15] >> We we should say that the firm was [10:18] selected through a a qualificationsbased [10:21] selection process um and was selected by [10:24] an evaluation committee of of city staff [10:27] and they they certainly came out on top [10:29] and we're looking forward to working [10:31] with them. And I personally have a lot [10:33] of experience with [10:35] zoning. [10:38] Any way I can help, just give us a call. [10:40] >> Perfect. [10:42] >> Thank you. [10:42] very much. [10:46] » Okay. Next up is ordinance number 26-31 [10:50] >> being an ordinance amending part 11, [10:52] planning and zoning of the codified [10:53] ordinances of the city of Lewisville. [10:56] I'll make a motion that um we bring [10:58] ordinance 26-31 to the table for its [11:01] second reading. [11:03] >> Second. [11:04] >> Mayor, this is the ordinance second [11:06] reading of the ordinance uh that amends [11:08] part 11 planning and zoning uh to [11:11] streamline and simplify the process for [11:14] designating minor subdivisions. [11:19] » Know we talked about this before. Is [11:21] there any any additional questions, [11:23] comments, concerns? I don't think so. [11:27] >> Let's go ahead and vote. [11:29] >> Street. [11:29] >> Yes. [11:30] >> Al Janac, [11:30] >> yes. [11:31] >> Gdone, [11:32] >> yes. [11:32] >> Mallister Atkins, [11:33] >> yes. [11:35] >> Okay, let's move to ordinance number [11:38] 26-33. [11:40] >> Seeing an ordinance authorizing and [11:42] directing the finance director to [11:44] execute a contract with regional council [11:46] of governments for the purpose of [11:48] administration and collection of [11:49] municipal income tax in the city of [11:51] Lewisville. I'll make a motion that we [11:53] bring ordinance 2633 to the table for [11:56] its second reading by emergency. [11:59] >> Second. [12:01] >> Uh, mayor, this is the ordinance that [12:03] will allow us to transition the [12:05] administration of our income tax to the [12:09] Rita program. [12:11] >> And you had indicated that it's a [12:13] contract or a timelines though. Why do [12:15] we have the emergency requested? [12:17] >> Correct. the the emergency is to meet [12:18] their their timeline so that this can be [12:20] implemented by 2027, [12:23] >> right? Yeah. We wanted to get it [12:24] implemented as soon as possible so that [12:25] we have a little bit of overlap with [12:27] Rita coming on before Lori retires to [12:30] kind of help, you know, ease that that [12:33] hump a little bit. And um they can't [12:36] start doing some of their their data [12:38] extractions to make sure everything is [12:40] ready to go and and balances are whole [12:42] until uh the agreement is signed. [12:44] agreement can't be signed until this [12:46] goes into [12:48] >> Okay. [12:50] >> And again, Rita, a lot of local [12:51] communities use it. It'll we'll see a [12:54] cost savings. Um [12:55] >> yeah, that that's really that's really [12:57] what this comes down to for me. Um we'll [12:59] still have Teresa with us as we [13:01] discussed before. So people can still [13:02] come into city hall and get that that [13:04] personal service. Uh if they want it [13:06] face to face, they can also do that [13:08] through Rita. They can call Rita. [13:11] This will give them, you know, online [13:13] filing, a more streamlined online [13:15] payment and payment plan structure. Rita [13:19] does a really good job keeping all of [13:20] their uh technology up to date, things [13:23] like that, improving all the time. So, [13:25] it'll really keep us on sort of the the [13:26] cutting edge and all that at a a cost to [13:29] the taxpayers that is less than what it [13:32] costs to replace that position. [13:34] >> Great. Thank you. Well, again, Matt, we [13:37] certainly appreciate you having [13:39] experience with this coming from Ripman [13:40] where you certainly had that installed [13:42] there. Yeah. Yeah, it does help. [13:45] >> Okay, let's go ahead and vote. [13:47] >> Street, [13:48] >> yes. [13:49] >> Aljanser, [13:49] >> yes. [13:50] >> Gdome, [13:51] >> yes. [13:51] >> Mallister, [13:52] >> yes. [13:54] >> Okay, I'll make a motion that we suspend [13:55] the rules and adopt ordinance number [13:57] 26-33 by emergency. [13:59] >> Second. [14:01] >> Let's go ahead and vote. [14:03] >> Street, [14:04] >> yes. Aljansk. [14:06] >> Yes. [14:06] >> Gdone. [14:07] >> Yes. [14:07] >> Mallister Atkins. [14:09] >> Yes. [14:10] >> Okay. Let's move to ordinance number [14:12] 26-34. [14:16] » Being an ordinance accepting the amended [14:17] final plat for Aspire at Orchard Park [14:20] Town Homes number two located within the [14:22] corporate limits of the city of [14:23] Louisisville, Ohio. [14:26] >> I'll make the motion that we bring [14:27] ordinance number 26-34 to the table for [14:30] its second reading. [14:32] >> Second. [14:34] All right, mayor. This uh amends the [14:36] final plot to Orchard Park Town Homes [14:38] number two. This is uh the area or the [14:41] town homes that are located just north [14:43] of Peach Avenue. Uh and really the [14:46] difference is that the current builder, [14:48] Dr. Horton, intends to build slightly [14:51] smaller town homes than what was [14:53] originally planned by K. Hovanian Homes. [14:56] That's the difference or what the [14:57] amendment is about. [14:59] >> We're asking for it by emergency. Well, [15:00] the the developer asked for it by [15:02] emergency and we're asking for it by [15:04] emergency. It's well understood what the [15:06] need for housing in Stark County is. Uh [15:08] so we're hoping not to delay the [15:10] amendment so that we can get started on [15:11] the construction or they can get started [15:14] on the construction of those homes. [15:16] >> And it's still single family. It's still [15:18] owner occupied. [15:19] >> Yes. [15:21] Dave, I appreciate what you did for me [15:23] today, going over the um the prints and [15:27] uh also showing me some of the uh [15:30] designs that um Dr. Horton has that [15:33] they're going to be put in place over [15:34] there. It looks like it's going to be a [15:37] nice development and some needed housing [15:39] for our community. [15:42] >> Okay, let's go ahead and vote. [15:45] >> Stre [15:46] >> Al Janser, [15:47] >> yes. [15:47] >> Gdone, [15:48] >> yes. Mallister Atkins. [15:50] >> Yes. [15:51] >> Make a motion to suspend the rules and [15:53] adopt ordinance number 26-34 by [15:56] emergency. [15:57] >> Second. [16:00] >> Let's go ahead and vote. [16:01] >> Street. [16:02] >> Yes. [16:02] >> Al Jansk. [16:03] >> Yes. [16:04] >> Gdone. [16:05] >> Yes. [16:05] >> Mallister Atkins. [16:06] >> Yes. [16:08] >> All right. That brings us to ordinance [16:10] number 26-37. [16:13] being an ordinance authorizing the city [16:14] manager to provide a notice of award and [16:16] enter into a contract along with [16:18] executing all necessary documents for [16:21] the 2026 road paving project with Barbus [16:24] Paving LLC. [16:26] >> I'll make a motion that we bring [16:28] ordinance 2637 to the table for its [16:30] first reading. [16:32] >> I'll second. [16:34] This is the 2026 paving program after a bidding process that was delayed a [16:39] little bit because we were revamping the [16:40] bid documents. Uh Barbus Paving is who [16:44] uh was determined to be the lowest and [16:46] best bidder and we are asking this one [16:49] by emergency so that we don't run into [16:52] any weather related issues with with a [16:55] little bit of a late start and of course [16:57] getting on their schedule is going to [16:59] probably not happen right away. [17:01] >> Have Have we used them before, Andy? [17:03] >> This is the first time um that we've [17:05] used them. Uh I know that they're [17:07] familiar. Um, is it was it you or Corey [17:10] who was aware of them doing other work? [17:12] >> Yeah, they've done work up towards [17:14] Summit County where I live in the town [17:16] of Jack area. I'm familiar with them [17:18] from that. [17:19] >> I did see that they were in Stark County [17:21] also in the recent past. At least on [17:22] their website, it shows that they have [17:24] done some stuff in Stark, but I don't [17:27] really have any [17:29] background on them other than that [17:30] though. They've done good work from what [17:32] you've seen. [17:32] >> Yeah, from what we've seen other [17:37] » Okay. Okay. And [17:38] >> then just ask that when we have the [17:41] dates that we have everything posted [17:43] with the roads that are getting done. [17:45] It'd be nice to have that list. [17:46] >> Sure. [17:47] >> List out there when when we know. [17:49] >> Okay. [17:49] >> Yes. [17:50] >> Okay. Let's go ahead and vote. [17:52] >> Street. [17:53] >> Yes. [17:54] >> Al Jans. [17:54] >> Yes. [17:55] >> Gdone. [17:56] >> Yes. [17:56] >> Mallister Atkins. [17:58] >> Yes. [17:59] >> Okay. I'll make a motion we suspend the [18:02] rules and consider ordinance number [18:05] 26-37 [18:08] on a second reading. [18:10] >> Second. [18:12] >> Go ahead and read it again or after we [18:15] vote. [18:16] >> Street. [18:17] >> Yes. [18:17] >> Al Janth, [18:18] >> yes. [18:19] >> Gdone, [18:19] >> yes. [18:20] >> Mallister Atkins, [18:21] >> yes. [18:22] >> Okay, now we can read it again. being an [18:24] ordinance authorizing the city manager [18:26] to provide a notice of award and enter [18:28] into a contract along with executing all [18:30] necessary documents for the 2026 road [18:33] paving project with Barbus Paving LLC. [18:42] » I'll make the motion we bring ordinance [18:43] number 26-37 to the table for it second [18:45] reading. [18:46] >> Second. [18:47] >> Okay, [18:49] no further questions we can go ahead and [18:51] vote. Street. [18:53] >> Yes. [18:54] >> Al Jansek, [18:54] >> yes. [18:55] >> Gdone, [18:56] >> yes. [18:56] >> Mallister Atkins, [18:57] >> yes. [18:58] >> That was a close one. [19:03] » Uh, okay. Uh, now we have resolution uh [19:07] 26-38 [19:09] >> being a resolution authorizing the city [19:10] manager to enter into an agreement with [19:12] the Stark County Board of Commissioners [19:14] for the purpose of amending the count [19:16] community development block grant [19:17] program agreement. [19:20] I'll make the motion we bring resolution [19:22] 26-38 to the table. [19:24] >> Second. [19:26] >> Mayor, this simply um authorizes a new [19:29] agreement with the county uh so that we [19:32] despite not having been eligible in the [19:34] past that we remain eligible for uh [19:37] community development block grant funds. [19:40] >> Okay. [19:44] » You work closely with the county [19:46] commissioners on this, right, Andy? [19:49] really with the uh regional planning. [19:51] >> Yeah, regional planning [19:52] >> and they tell us that these continually [19:55] change they may have some more options. [19:58] >> We just don't want to limit our [20:00] >> potential for funding even though again [20:02] historically we've not received many. [20:04] >> Okay. [20:05] >> And that's that's due to income. [20:07] >> Yes. It's correct. [20:09] >> Things like that. So [20:10] >> it's it's and and this is if you'll remember we did not [20:16] get much money art money and and those [20:19] funds were based on the same formula um [20:23] with this grant is that's why we didn't [20:25] answer much. [20:27] >> Okay. [20:28] >> Let's go ahead and vote. [20:30] >> Street [20:31] >> yes. [20:31] >> Aljansk [20:32] >> yes. [20:32] >> Gdon [20:33] >> yes. [20:34] >> Mallister [20:35] >> yes. [20:36] >> Okay. Next up is ordinance number 26-39 [20:41] >> being an ordinance authorizing the city [20:42] manager to enter into an amended [20:44] contract with Hammond Construction. [20:46] Change order number 16 for the city of [20:49] Lewisville Fire Emergency Medical [20:51] Services Facility Project. Original [20:53] contract authorized by ordinances number [20:55] 2415 and 2439. [20:58] >> I'll make a motion that we bring [21:00] ordinance number 2639 to the table for [21:02] its first reading. [21:04] >> Second. [21:05] I know this probably feels like a blast [21:07] from the past, but this is the last [21:09] change order for this building, and it's [21:11] actually a reduction for uh funds that [21:15] they didn't use related to their their [21:17] fees in their bond. Um, we were waiting [21:20] on this and one other final thing uh [21:23] that we needed to receive from them [21:25] before we could close the contract. And [21:27] once we do that, that remaining money [21:28] will become available for the city hall [21:30] project. [21:32] And so, we're asking for it for an uh by [21:35] emergency for that purpose to get the [21:37] contract closed to free up those funds. [21:40] >> We will gladly take their money back [21:42] quicker. Our money back. [21:44] >> Yes. Yeah. [21:45] >> Something we don't see too often. [21:46] >> Great. [21:47] >> Yep. All right. Let's go ahead and vote. [21:52] >> Street. [21:52] >> Yes. [21:53] >> Al Jans. [21:53] >> Yes. [21:54] >> Gdone. [21:55] >> Yes. [21:55] >> Mallister. [21:56] >> Yes. [21:57] >> Make a motion we suspend the rules to [21:59] consider ordinance number 26-39 [22:02] by emergency. Second. [22:06] >> Let's go ahead and vote. [22:07] >> Street. [22:08] >> Yes. [22:08] >> Al Janek, [22:09] >> yes. [22:10] >> Gdone, [22:10] >> yes. [22:11] >> Mallister Atkins, [22:12] >> yes. [22:14] >> Two, three. [22:16] >> I'll make the motion that we bring [22:18] ordinance number D uh 26-39 to the table [22:21] for its second reading. [22:23] >> Second. [22:26] >> Okay. [22:27] >> Further comments or questions? [22:28] >> I don't have any further or questions. [22:30] >> We can go ahead and vote. Would would [22:32] you like that read again for second [22:33] reading? [22:34] >> Yes. [22:35] >> Being an ordinance authorizing the city [22:36] manager to enter into an amended [22:38] contract with Hammond Construction [22:40] change order number 16 for the city of [22:42] Lewisville Fire Emergency Medical [22:44] Services Facility Project original [22:46] contract authorized by ordinances number [22:48] 2415 and 2439. [22:52] >> Okay. Is is what guy did still okay? [22:54] Yes. [22:54] >> Okay. So now [22:56] >> now we can [22:57] >> street. [22:58] >> Yes. [22:58] >> Aljanthic. [22:59] >> Yes. [22:59] >> Gdome. [23:00] >> Yes. Mallister Atkins. [23:02] >> Yes. [23:04] >> Okay. Next up is ordinance number 26-40. [23:11] » Being an ordinance authorizing the city [23:13] manager to enter into a purchase [23:14] agreement with Miller Builders for the [23:16] acquisition of a Salt Dome building. [23:20] >> I'll make the motion we bring ordinance [23:21] number 26-40 to the table for its first [23:25] reading. [23:26] >> Second. [23:29] Okay, [23:30] >> mayor. Uh, so I think all of council is [23:32] familiar with the salt shed that exists [23:34] behind the police department. It has a [23:37] concrete foundation and then a metal [23:39] structure that holds the um the canvas [23:42] style roof. So the the structure is in poor repair. It's we think roughly 25 [23:48] years old, but the structure is in need [23:50] of replacement, as is the the vinyl. It [23:53] was at one point struck by a truck that [23:55] was dumping salt in the in the shed and [23:57] tore it. Uh but at any rate, this um [24:01] ordinance will authorize a purchase [24:02] agreement with uh Miller Builders who [24:06] was um secured through Sourcewell, which [24:09] is a cooperative that satisfies the [24:11] state competitive bidding requirement. [24:13] Uh so this will authorize a contract for [24:16] $99,461 [24:19] to replace both the the structure and [24:22] the vinyl over the salt dome. [24:25] >> So like at the same place, [24:26] >> same place. It'll everything will be the [24:28] same. It'll just be a new frame and new [24:30] vinyl or canvas. [24:33] >> What's the expected lifespan? [24:36] >> That's a good question. Um, [24:38] >> yeah, I think it depends on what you're [24:39] using it for. Obviously, these you're [24:41] using it for a long, they're going to [24:43] take a lot more beating. The one that [24:45] was there originally was galvanized, but [24:48] when they inspected it, they said that [24:49] they only galvanized it the outside of [24:51] the pipe. So, once it started eating the [24:54] welds away and getting inside of it, [24:56] sped things up and just kind of brought [24:59] it from the inside out. So I I mean I'd [25:02] say 25 years on a salt film like that is [25:05] probably doing pretty good. I think that [25:06] the fact the concrete and stuff still in [25:08] great shape is obviously [25:11] >> so the new one this would be the same [25:12] galvanization issue maybe or [25:14] >> the No, the new one is supposed to be [25:17] inside and outside the different [25:18] processes. [25:20] >> Great. [25:22] >> Yeah. [25:24] So way longer than 25 years is what [25:26] you're saying. [25:27] >> Yeah. I mean, [25:29] >> yeah, [25:29] >> I'm pretty sure I was on council when [25:30] that went in the first time. [25:32] >> We We think it was in the early two Jim [25:34] McBth was a service director at the [25:35] time. We think it was in the early 2000s [25:37] >> because a lot of that was done in house [25:38] if I remember right. [25:39] >> Yes. Yes, it was. [25:41] >> Just nice to know where to point the [25:42] finger. [25:44] >> Nobody who is currently here was any [25:46] talk. So [25:48] >> the concrete's held up. So good job. [25:49] >> There we [25:51] go. [25:52] Okay, let's go ahead and vote. [25:55] >> Street, [25:55] >> yes. [25:56] >> Aljansk, [25:56] >> yes. [25:57] >> Gdome, [25:58] >> yes. [25:58] >> Mallister Aken, [25:59] >> yes. [26:00] >> All right, I'll make a motion that we [26:02] suspend the rules and consider ordinance [26:04] number 26-40 [26:06] by emergency. [26:07] >> Second. [26:09] >> Let's go ahead and vote. [26:12] >> Street, [26:12] >> yes. [26:13] >> Aljansk, [26:14] >> yes. [26:14] >> Gdone, [26:15] >> yes. [26:15] >> Mallister, [26:16] >> yes. [26:17] >> All right. Can you read it again? being [26:19] an ordinance authorizing the city [26:21] manager to enter into a purchase [26:23] agreement with Miller Builders for the [26:25] acquisition of a salt zone building. [26:27] >> I'll make the motion we bring ordinance [26:29] 26-40 to the table for its second [26:31] reading. [26:32] >> Second [26:36] » Street, [26:36] >> yes. [26:37] >> Al Jans, [26:38] >> yes. [26:38] >> Gdone, [26:39] >> yes. [26:39] >> Mallister Atkins, [26:40] >> yes. Okay, [26:45] moving on to ordinance 26-41 [26:49] >> being an ordin ordinance making [26:51] appropriations for current expenses and [26:53] other expenditures of the city of [26:55] Louisisville, Stark County, state of [26:56] Ohio for the year beginning January 1st, [26:59] 2026. [27:02] » I'll make the motion we bring ordinance [27:04] 26-41 to the table for its first [27:06] reading. [27:07] >> Second. Second. [27:10] >> All right, mayor. This uh ordinance does [27:12] a couple of things. Uh first, it adds uh [27:14] $5,010 in revenue to the general fund uh [27:18] that came from two ebike um I believe [27:20] one was a donation, one was a grant, but [27:23] money that we received for ebikes and [27:25] then it appropriates that some same [27:27] money in the police budget. It also [27:30] transfers $720,000 from the general fund [27:33] to the capital fund. uh 622,000 of that [27:37] is for the city hall building and it's [27:39] that amount because what it does is [27:42] bring the um cash balance of the general [27:45] fund down to the reserve. This doesn't [27:47] take into consideration the end of year [27:48] balance. It's just from a cash flow [27:50] perspective. It keeps that reserve in [27:53] the general fund. And then $98,000 [27:57] also transferred to the capital fund. [27:59] Um, if you'll remember, there were some [28:02] when the baseball fields were put in, [28:04] there were some issues related to the [28:05] contract language and things that we [28:07] were purchasing versus the um the [28:11] contractor. And so, um, some of that has [28:14] to be paid for. So, that's what some of [28:16] this money is for. And then there were [28:18] also some expenses related to the um [28:21] concession standrestrooms [28:24] that weren't accounted for when the when [28:26] the um estimate for it to be put in um [28:29] was done. So these uh funds, this [28:32] $98,000 [28:34] um covers all of those unanticipated [28:36] expenses and uh issues stemming from the [28:40] completion of the the ball fields with [28:42] the the contractor. [28:44] >> Okay. [28:45] >> Then [28:47] thought I was done, but I'm not. Um, it [28:50] takes that $720,000 that I just [28:54] explained and $221,000 [28:57] that we received from the Rotary through [29:01] the Lewisville Community Foundation and [29:03] appropriates it as revenue [29:06] um in the capital fund and then [29:07] appropriates it for spending on those [29:10] two issues as well as the amphitheater [29:14] that the Rotary has has funded. So the [29:17] amphitheater money will be added to the [29:19] money that already exists and we should [29:21] be going out to bid here very shortly [29:24] for that project. Great. [29:26] >> What is do we know the timeline for the [29:29] amphitheater? [29:30] >> So we are waiting for the final big pack [29:33] bid package um which again we should [29:37] have this week. Once we receive that, we [29:41] have roughly 30 days or five five weeks [29:43] or so of adver well 30 days of [29:45] advertising, but probably a week before [29:47] we can get it out. Once the uh bids are [29:51] received, we'll select the lowest and [29:53] best pretty quickly and then following [29:55] that, we're told it should be about a [29:57] 90day build. So, we're still hoping to [29:59] have it done by by the fall. [30:02] >> Okay. [30:03] >> Um is is still the the goal. I mean, [30:05] that's of course subject to everything [30:06] going [30:07] >> right, but that's that's that's the [30:09] goal. [30:09] >> Okay. [30:10] >> And and I should back up. Obviously, the [30:12] Rotary wanted to have this done [30:14] >> considerably sooner, [30:16] but when we started receiving that state [30:18] and federal grant money, uh it then [30:22] involved all the the rules and and [30:25] requirements that we have to to satisfy [30:27] the um the processes that we have to and [30:31] that of course slows things down. [30:34] So definitely up and running for all of [30:36] you this summer. So [30:37] >> there's absolutely no reason to think [30:38] that it won't be. [30:39] >> Nice. All right, [30:41] >> I'll say that. [30:42] >> It's fair. [30:44] >> Any other questions? That's all I have. [30:48] >> Let's go ahead and vote. [30:50] >> Street. [30:50] >> Yes. [30:51] >> Aljansk, [30:52] >> yes. [30:52] >> Gdone, [30:53] >> yes. [30:53] >> Mallister Atkins, [30:55] >> yes. [30:56] >> Make a motion we suspend the rules to [30:57] consider ordinance number 26-41 [31:01] by emergency. Second. [31:03] >> Let's go ahead and vote. [31:05] >> Street. [31:06] >> Yes. [31:06] >> Alans, [31:07] >> yes. [31:12] >> Can you read it again? [31:13] >> Being an ordinance making appropriations [31:16] for current expenses and other [31:17] expenditures of the city of Lewisville, [31:19] Stark County, state of Ohio for the year [31:22] beginning January 1st, 2026. [31:25] >> I'll make a motion that we bring [31:26] ordinance 2641 to the table for the [31:29] second reading. I'll second that. [31:34] >> Let's go ahead and vote. [31:35] >> Street, [31:36] >> yes. [31:36] >> Al Janser, [31:37] >> yes. [31:38] >> Gdone, [31:38] >> yes. [31:39] >> Mallister Atkins, [31:40] >> yes. [31:42] >> Okay. [31:44] Next up is ordinance number 26-42 [31:47] >> being an ordinance amending chapter 192 [31:50] income tax effective January 1st, 2016 [31:53] of the codified ordinances of the city [31:55] of Lewisville. [31:56] I'll make a motion we bring ordinance [31:58] 26-42 to the table for its first [32:00] reading. [32:02] >> Second. [32:04] >> Uh I should point out first this does [32:05] not change our income tax structure at [32:07] all. What it does is updates the [32:09] language in the ordinance uh to reflect [32:12] what it will need to be as we transition [32:14] to Rita. And then it also adds a [32:16] provision that automatically kind of [32:18] incorporates any state law changes that [32:21] we would be required to uh to adapt to [32:24] in the future. [32:27] Now, is the 2016 do we have to go back a [32:31] certain number of years? Is that a typo? [32:33] Do we have to go back like 10 years for [32:36] >> No. So, there was a a a large change in [32:39] state tax code in 20 well 15 that was [32:42] effective in 2016. So, chapter 191 of [32:46] our ordinances is actually the tax the [32:49] previous tax code that existed through [32:52] December 31st, 2015. We only need to [32:54] change [32:55] here going forward in 192. [32:57] >> Okay. [32:59] >> And it's uh uh I can read all 60 pages [33:03] if you want, but [33:04] >> took me all weekend. [33:06] >> It's mostly uh changing tag. Most of it [33:09] is changing tax commissioner to tax [33:10] administrator just as more blanket [33:12] language for whoever. [33:16] » Yeah, [33:17] >> I was hoping for cliff notes. [33:19] >> Yeah. [33:19] I read it twice. [33:20] >> I can throw in some jokes. [33:22] >> Always does. always does. Okay, let's go [33:26] ahead and vote. [33:27] >> Street, [33:28] >> yes. [33:28] >> Al Janser, [33:29] >> yes. [33:29] >> Gdone, [33:30] >> yes. [33:30] >> Mallister Atkin, [33:31] >> yes. [33:33] >> Okay, next up is ordinance number 26-43 [33:38] >> being an ordinance authorizing the city [33:40] manager to enter into a contract with [33:42] Horn and King Architects for [33:43] architectural services for the [33:45] Lewisville City Hall new construction [33:47] project. [33:48] >> Make the motion we bring ordinance 26-43 [33:50] to the table for its first reading. [33:53] Second. [33:55] >> All right, mayor. So, since the scope of [33:57] the contract has changed um relative to [34:00] the renovation of the existing city [34:02] hall, uh we are doing a new contract [34:05] with the architects. The estimated cost [34:09] at this time is not 4.4 [34:14] million24,420,000. [34:18] It's slightly less than that. it'll be [34:19] just under4 million uh $400,000. So, [34:24] consistent with what the estimates to [34:26] renovate city hall were. But I I think [34:28] it's also important to point out uh the contingency funds that were in the [34:33] renovation portion of the um [34:38] uh or the funds that were contingency in [34:42] the contract for renovation. I think [34:45] it's fair to say those likely would have [34:48] been used if not more based on what they [34:51] found when they got under construction. [34:53] With new construction, um it's less [34:57] likely, not that they won't get used, [34:59] but it's less likely that those [35:01] contingency funds would be used because [35:02] there's a lot less question marks and [35:04] there's over just over $400,000 in [35:07] contingency funds in this contract. So I [35:10] guess all I'm saying is ideally we will [35:12] come in uh below 4 million um in in in a perfect world. Um but that is in [35:20] fact the estimate currently for the [35:22] construction of a new city hall. [35:24] >> We sure have a lot better shot now [35:25] anyway. Right. [35:26] >> Definitely. Yeah. Yeah. I I and and and [35:30] if you'll remember, that was a [35:31] consistent warning with the architects [35:34] that once renovation on that building [35:36] began and and you're you're in it. [35:39] There's no turning [35:40] back. Um it's entirely possible that [35:43] things could have been discovered that [35:45] would have u you know up the price. So [35:49] yeah, a lot less question marks with new [35:51] construction. Certainly. [35:53] >> Right on. Um, does this this price [35:56] include the parking lot, include [35:58] everything? [35:59] >> It's it's it's the entire the entire [36:01] package, correct? [36:02] >> Entire pick. [36:03] >> Okay. [36:04] >> I know this has been discussed before, [36:07] but I I think it's worth repeating that [36:09] the city has been planning for this for [36:11] years, so this isn't like pulling money [36:14] out of the air. Yes, it it it goes it [36:17] goes back over a decade that um previous [36:20] councils have attempted to address uh [36:23] the issues that we're we're working to [36:25] address now. Yes. [36:27] >> And if people have questions about why [36:28] this is needed, they can reach out to [36:30] you. [36:31] >> Absolutely. We'll be happy to happy to [36:33] provide them with information. [36:34] >> Thank you. And there was previous [36:37] renderings I think I don't know if it [36:39] was six years ago, eight years ago now [36:41] that on a much larger scale of of a city [36:44] hall and it had a lot of different [36:46] components to it and mixed use and I [36:48] >> Yes. [36:49] >> This is just this is just the city [36:53] government essential functions. There's [36:55] nothing extra. [36:56] >> No, there are no bells or whistles or [36:58] extras. Correct. Yeah. But the, you [37:00] know, the exterior um is is going to be [37:03] done in in such a way that it will [37:05] complement the historic downtown [37:07] corridor. [37:09] >> That'll be nice. Yeah, [37:11] >> I mean I just think I think it's [37:12] positive when people are coming through [37:14] town, you know, they see you see see a [37:16] new fire station, you see, you know, if [37:18] you're coming up Nickel Plate, the the [37:19] library, you know, the you would see, [37:23] you know, a city hall building that [37:24] would, [37:25] >> you know, not not be imposing, but [37:27] reflect the, you know, the neighbors [37:30] around it and, you know, going back to, [37:33] I mean, when we're the fastest growing [37:35] community in Stark County, according to [37:37] the article in the Rep um last week, I I [37:40] mean, that's those are the kind of [37:41] things I think that we want to attract [37:43] people and people would see and they'd [37:45] see [37:46] >> momentum happen in the right direction. [37:48] >> Agreed, Mayor. [37:49] >> And not and not to mention the [37:52] current liabilities that we have in our [37:55] current city hall. Do you mind outlining [37:59] some of those? The so so the way it was [38:02] explained to me is there are there are [38:04] some public buildings that are not ADA [38:07] compliant, but somebody who was either [38:09] wheelchair bound or relied on um other means to to for mobility could [38:16] still navigate the the building. Uh that [38:19] is not the case with ours. I I think [38:21] many of the council members have seen [38:23] some of what we deal with at city hall. [38:25] If someone were to apply uh for an open [38:30] position at city hall and they happen to [38:33] be wheelchair bound, uh we would not be [38:37] able to accommodate them. Um it's it's that bad. Uh it's um [38:44] it's it's bad. There's no other way to [38:45] describe it. We are the furthest thing [38:46] that you could be from uh being [38:49] handicapped accessible. And and that is [38:52] probably one of the most important [38:54] things that we we need to fix. And we [38:56] could fix it in this building, but you [38:59] saw what the cost was. That was one of [39:01] the drivers is the fact that that [39:04] building actually exists on four [39:05] different elevations and you would have [39:08] to make accommodations between each of [39:10] those elevations for wheelchair access. [39:13] >> Yes. [39:13] >> And some of those restrooms are like [39:15] three foot wide [39:17] >> if Yeah. It's Yes. It's [39:21] Yeah, none of the restrooms meet the ADA [39:23] requirements. Um, but to your point, one [39:26] of them is literally you you walk in [39:30] forward and you walk out backward. It's that small. [39:33] >> Then you have you and you have asbestous [39:36] issues they got into. [39:37] >> Yes, there are asbestous issues. As you [39:39] know, there's flooding issues in the [39:40] basement. [39:41] >> Yes. Which could bring mold. [39:43] >> They the architects did raise the [39:44] concern about uh about mold in the [39:46] basement. Um the HVAC system is failing. [39:52] >> Yeah. The mechanical systems are are in [39:55] very poor repair and failing. The [39:57] electrical systems if if we were to have [40:00] moved forward with the renovation of [40:03] city hall. It literally would have been [40:05] stripped down to the to the bare bones [40:07] and and everything would have been [40:08] replaced. [40:11] >> And this is the building that houses the [40:13] people that are running our city. So, I [40:15] think it's important that it is up to [40:16] code and it's, you know, functional and [40:19] safe for everybody. [40:19] >> And that's that's the other part um is the security factor. Somebody anybody [40:25] could walk into city hall and access [40:28] quite frankly every part of the [40:30] building. And if somebody was, I guess, [40:32] savvy enough, they could enter city [40:33] hall, not leave and and and be there [40:36] overnight. And unless we swept the [40:39] entire building every night, we would we [40:41] would never know that. [40:42] >> Um, so I think we do have application. [40:45] Uh first to ensure that we have those [40:47] protections in place for our employees [40:50] and then secondly that we have those [40:52] protections in place for the information [40:53] that exists at city hall. [40:57] >> Plus, we'll be on Main Street. We're not [40:58] going to be hidden behind our downtown [41:00] anymore, which I think is a [41:01] >> I think it' be it'll be an asset. It [41:04] should be an asset. [41:05] >> Absolutely. [41:06] >> Agreed. [41:07] >> Okay. [41:08] >> Thank you. [41:09] >> All right. Let's go ahead and vote. [41:12] >> Street. [41:13] >> Yes. Al Jansik. [41:14] >> Yes. [41:14] >> Gdone. [41:15] >> Yes. [41:16] >> Mallister. [41:17] >> Yes. [41:18] >> And [41:20] Andy, do you mind explaining just real [41:21] quick why we're requesting this or why [41:23] it's requested by emergency as well? [41:25] >> Uh essentially it's so that we can uh [41:28] continue to move forward at you know any delays in times, risk, cost [41:31] escalation. And we're actually you know [41:34] the contract already exists. A a [41:36] contract already exists with the with [41:38] the architects. This is just changing [41:40] the terms of it a little bit to [41:42] accommodate the new building versus the [41:43] renovation. So, uh, our I I think one of [41:46] our biggest interest is to again control [41:49] the cost as much as we can to [41:51] potentially get it under um under [41:55] underway before before the winter. [41:58] >> Yeah. Because you could you could [41:59] potentially have at least another 45 [42:01] days, right? you know [42:02] >> well what what'll happen at this point [42:03] assuming this passes uh we are prepared [42:07] to go out to uh to to do what's called a [42:11] request for qualifications to ultimately [42:14] hire a construction manager at risk and [42:16] then that that company that firm will [42:18] work side by side with the architects in [42:21] the interest of keeping costs down with [42:23] their expertise and knowledge about [42:24] materials and the availability of [42:26] materials and things like that. So that of course is a little bit of a [42:30] process but we'll start that here very [42:32] quickly [42:34] and then again the engineering will be [42:38] done within a couple of months and we we [42:42] obviously need to get it going as [42:43] quickly as possible. [42:45] >> Okay, [42:45] >> there's several more steps to take and [42:47] we we don't want to just sit and wait. [42:50] And last thing before I make a motion [42:53] here, I just wanted to double check, you [42:55] know, the few things that we had come [42:57] back with like uh you know, there's no [43:00] need for a mayor's office and things [43:01] like that. Have they already addressed [43:04] that or will they address that when it [43:06] goes out before it goes out to bid? [43:07] >> This this cost does incorporate the [43:10] modifications or the changes that were [43:12] requested. So, I'm sorry to say that the [43:14] mayor's office does not exist in the [43:16] most recent rendering. [43:17] >> The mayor's office is not needed. Does [43:18] not exist. Sounds great. the other side [43:21] of the building that airlock area is [43:23] also uh the size was also reduced. [43:25] >> Okay. All right. [43:26] >> So, it's a smaller footprint than what [43:29] was originally [43:30] >> correct here. [43:31] >> I should point out that this, [43:33] >> you know, ultimately we'll get a [43:35] guaranteed maximum price. These numbers [43:37] are the engineers estimate. If in the [43:39] end it comes in at some, you know, [43:42] outrageous price, this contract only [43:44] binds us to the architectural work. [43:47] There will be several steps where [43:48] council will have the um or be in a [43:51] position to continue the process or stop [43:53] the process if in the unlikely event [43:55] something would would cause it to need [43:57] to stop. [43:59] >> Good to know. [44:00] >> I'll make a motion we suspend the rules [44:02] to consider ordinance number 26-43 [44:05] by emergency. [44:07] >> Second. [44:10] » I'll make the motion when you bring [44:12] ordinance number [44:15] three. [44:17] Just a minute. [44:19] >> Oh, we have to vote on the suspension of [44:21] the rules, right? [44:22] >> Just a moment. You're ready. Okay. [44:24] Street. [44:25] >> Yes. [44:25] >> Aljansk. [44:26] >> Yes. [44:26] >> Gdone. [44:27] >> Yes. [44:27] >> And Aken? [44:29] >> Yes. [44:29] >> All right. Can you read it again, [44:30] please? [44:31] >> Yes. Being an ordinance authorizing the [44:33] city manager to enter into a contract [44:35] with Horn and King Architects for [44:37] architectural services for the [44:39] Lewisville City Hall new construction [44:41] project. Well, now I'll make the motion [44:42] that we bring ordinance number 26-43 to [44:45] the table for its second reading. [44:48] >> Second. [44:49] >> Any further discussion? [44:52] >> Okay, let's go ahead and vote. [44:54] >> Street, [44:55] >> yes. [44:55] >> Al Jans, [44:56] >> yes. [44:57] >> Gdone, [44:57] >> yes. [44:58] >> Mallister Atkins, [44:59] >> yes. [45:00] >> All right, that brings us to new [45:03] business. [45:04] >> Fine. [45:06] >> Nothing like a thin agenda right after [45:08] the 4th of July, [45:09] >> right? [45:10] >> New business. We would, mayor, if you [45:13] would be so kind, we'd like to recognize [45:14] two employees for their accomplishments. [45:17] The first is assistant fire chief Hinkle [45:19] and Chief Border will read his citation. [45:40] Okay. Uh, this certificate is where [45:42] Assistant Chief Henle has recently [45:43] completed 12week program of the NFPA [45:46] 1021 fire officer 3 and four [45:49] certifications online through the [45:51] Cleveland State University. This is in [45:53] conjunction with what he has previously [45:54] done of officer 1 and two that he had. [45:57] this which will help assistant chief hle [45:59] to acquire his fire credentiing [46:01] certification. [46:03] The Ohio fire credentiing certification [46:05] is completed through the Ohio Fire [46:06] Chiefs Association and the Ohio Fire [46:09] Emergency Foundations to where they have [46:11] identified the need to further enhance [46:12] the professionalism of the chief fire [46:14] officers through the state of Ohio to [46:16] the establishment of the uniform [46:17] credentiing program. So this was a [46:20] 12-week program that was pretty easy for [46:22] assistant chief Hinkle, at least I think [46:24] so. He does not. He wrote numerous papers on this on this process. [46:28] He done very very well with it and I [46:31] congratulate him for this. [46:42] » The next is finance director Matt Bup. [46:45] If you come to the center, [46:47] >> please. [46:52] » Is Matt a fireman then? [46:58] In a continuing effort to bring the [47:00] highest level of financial [47:02] responsibility to the city of [47:03] Lewisville, finance director Matt Bup [47:06] earned the certified public funds [47:08] investment management credential after [47:10] successfully completing a comprehensive [47:13] investment training program that meets [47:15] the standards established by the [47:18] Association of Public Treasures of the [47:20] United States and Canada. [47:23] Wow, [47:25] that's [47:47] » not going to lose you to the Canadians [47:49] now, are they? [47:51] already got booted out of the World [47:52] Cup, so [47:58] on to page four, city manager report. Uh [48:02] just a few things, mayor. Um the [48:05] documents from the impact group, you [48:07] should have from the email last week. Uh [48:10] if you want to review them, uh and and [48:13] let us know if it in fact captures what [48:15] you intended it to capture. And then uh [48:18] and you can let me know throughout the [48:20] week if it if it does, we can bring them [48:22] back at the next meeting for for [48:24] >> Can I get copies of them or do I have to [48:28] >> Oh, that's Yeah, we Yes, we'll give you [48:29] copies. I [48:30] >> Thank you. [48:30] >> We'll give you copies. Matter of fact, [48:32] I'll give them to you tonight. [48:35] >> And if you just let us know that it it [48:36] does or doesn't capture what you [48:38] intended and then if it does, we'll [48:39] bring them back for formal adoption. And [48:42] then also [48:44] uh to make sure the the public is fully [48:45] aware, the mayor and I talked about pro [48:48] providing a statement to the public [48:49] regarding the city hall building. So you [48:51] have that same thing. If you can uh let [48:54] me know if you feel that captures the [48:56] reasons why you're moving forward with [48:58] the new city hall, well then we'll we'll [49:00] make that available to the public or [49:02] publish that. [49:02] >> Great. [49:03] >> Yeah. [49:03] >> Okay. [49:05] And that is all I have. [49:09] >> Okay. Any questions for Amy? [49:12] >> Oh, no. That's all I have. Mayor. [49:14] >> Okay. [49:16] Um, Chief, [49:17] >> thank you. Thank you, Mayor. Um, the [49:19] only thing I got is is Friday, July 3rd [49:23] was the busiest day that I've had or we [49:27] the department has had that I've known [49:28] of. We had 17 runs back [49:30] >> in a 24-h hour period. [49:32] >> Um, so that's that's extremely busy. Um, [49:35] we've had EMS calls to accidents to to [49:38] everything. So, [49:39] >> is it holiday related? [49:41] >> No, none of it is related to Fourth of [49:43] July type firework incidents. Even on [49:45] Fourth of July, we only had three runs. [49:47] >> Uh, nothing related to fireworks. But [49:50] Friday, July 3rd, for some reason, was [49:51] really crazy. And it wasn't just [49:54] Lewisville. Osberg was busy. New [49:56] Michelle was busy. Camp Township was [49:58] busy. We were pulling ambulances out of [50:00] Quad, which is down on the other side of Camp South. So, [50:04] >> wow. [50:04] >> Um, it was it was a crazy day for us. I [50:07] commend the ladies and gentlemen that [50:09] ran that day and and they worked hard [50:10] for their money. [50:13] >> So other than that, that is that is all [50:15] I have. [50:16] >> Okay. [50:16] >> Wow. [50:18] >> All right, Dave. [50:19] >> Mayor, council, I really don't have [50:20] anything. I just wanted to thank you [50:21] again for council for passing the minor [50:24] subision requirements to make. I think [50:27] it it will streamline the process and [50:29] make it more efficient for our citizens [50:32] with regards to the process timely as [50:35] far as [50:37] to do extra steps. I anticipate that [50:40] we're going to bring some additional [50:42] amendments to the major subdivision [50:44] which deals with development rules and [50:46] stuff. Uh clean we're in the process of [50:48] developing some new legislation for that [50:51] just to clean up with regards to these [50:54] develop. [51:03] Well, you certainly make it easy to [51:05] pass, Dave, because you're you're always [51:06] there with the information that I'm [51:08] looking for, and I appreciate that. [51:09] >> I appreciate that. [51:12] >> Okay, Darl. [51:14] >> Yeah, just uh couple quick things. Just [51:17] pointing out the the guys in the service [51:19] department have been working hard lately [51:20] setting up for events. I think a lot of [51:22] them have gone well from what I've [51:23] heard. I know that the fire department's [51:26] done a lot with the fireworks and things [51:27] for chamber. From everything we heard [51:29] it, it all went pretty well. So, um, [51:32] thank you to them. Well, I'm excited. [51:34] Um, I don't know that I got to say it at [51:36] the time when we were at goal setting, [51:37] but I appreciate you guys letting me [51:40] give [51:41] and speak to you about what's going on [51:43] in the public works department and what [51:45] we see that needs to happen moving [51:47] forward. So, thank you for that. But, [51:50] yeah, otherwise I don't really have [51:51] anything else to report. [51:53] >> Thanks, [51:55] Rie. [51:56] >> Don't have anything else. [51:58] >> Fourth of July, you don't have anything. [52:00] Wow. [52:00] >> I was good. [52:01] >> Wow. [52:02] >> Okay. [52:03] >> Apparently, we gave it all to [52:04] >> Ro. [52:08] As I was hearing booms, I thought, "Oh, [52:09] the police the police department must be [52:11] busy." [52:12] >> Okay. [52:13] >> No news is good news for police [52:14] department. [52:15] >> Yeah. [52:16] >> All right, Matt. [52:17] >> Um, yeah, just a couple quick things. [52:19] First of all, uh, as far as the [52:21] transition to Rita goes, I want to thank [52:23] council for working with me on that and city manager and everybody else. And [52:27] I also wanted to um thank Lori uh for [52:32] being a a very important part of this [52:34] process. She's been extremely helpful. [52:36] She has a really good relationship with [52:38] um our current uh income tax software [52:41] vendor to make sure that that data is [52:43] shared with Rita and everything. So [52:44] she's been uh invaluable. So I want to [52:47] say thank you to her. Uh also just real [52:50] briefly um the the Ritman officer uh who [52:54] was tragically [52:56] killed in the line of duty last night. I [52:58] knew him. Uh he was a really really good [53:01] guy and it's it's just always sad. So [53:03] thoughts thoughts and prayers with his [53:05] family and and the victims of that as [53:08] well. [53:10] >> That's terrible. [53:18] » Anything else? [53:21] >> Uh yeah. The only thing I'd like to [53:22] mention is I I thought we had a great [53:26] goal setting session. I was glad to see [53:28] it come back. I appreciate the teamwork [53:33] that we have here like you can't [53:35] believe. I've been to a lot of goal [53:37] setting sessions. We've had a lot of [53:38] good productive ones over the years, but [53:41] this one was really, really done well. [53:44] Um I just appreciate the teamwork, the [53:47] department heads, Andy and Tiffany. The [53:50] way it was put together was fantastic. [53:53] >> Yes. A lot of great information. [53:55] >> Thank you. [53:56] >> Yes. [53:58] >> Okay. I echo that as well. Um and I'll [54:02] entertain a motion to move into [54:05] executive session for the purpose to [54:07] consider the appointment, employment, [54:08] dismissal, discipline, promotion to [54:10] motion, or compensation of a public. [54:13] >> I'll make that motion. Mayor [54:16] >> second. [54:18] Go ahead and vote. [54:20] >> Street, [54:21] >> yes. [54:21] >> Alexander, [54:22] >> yes. [54:23] >> Gdon, [54:23] >> yes. [54:24] >> Mallister, [54:25] >> yes. [54:26] >> And no, no action to follow. Um, hope to [54:30] see everybody at second Friday. [54:32] >> This is going to be a fun one. [54:33] >> It will. And who? Who do you want to [54:35] stay? [54:36] >> Take our time in executive session. I [54:38] want to go out. [54:43] Everybody else should be good.
