This is where any [14:02] commissioner, staff member, or anyone in [14:03] attendance who would like to have an [14:05] item on the consent agenda removed for [14:07] further discussion can request so now. [14:10] Is there a request for the removal of [14:11] any item on the consent agenda? [14:14] No objections, Madame President. We'll [14:15] make a motion to accept the consent [14:17] agenda. [14:18] » Second. [14:19] » A motion from Vice President Ngi and a [14:21] second from Commissioner Moler. Any [14:23] questions or comments? [14:24] » Okay. Hearing none, I'll call for the [14:26] vote. All those in favor, please say I. [14:29] » I. [14:29] » Any opposed? [14:30] » I. [14:31] » Any opposed? Motion carries five to [14:34] zero. And the consent agenda is [14:35] approved. Um, our next item is to accept [14:39] a motion to appoint Alex J. as the [14:41] alternate member on the zoning hearing [14:43] board for the remainder of the term [14:44] ending December 31st, 2027. [14:49] » Second. [14:50] » I have a motion from Commissioner [14:51] Mochler and a second from Commissioner [14:53] Brown. Any questions or comments? [14:56] » Okay. All those in favor, please say I. [15:00] » I. [15:01] » I. [15:02] » Any opposed? [15:04] Mot motion carries five to zero. [15:07] And thank you to uh to this alternate [15:11] member on the zoning hearing board. [15:12] We're excited to have an alternate [15:16] participation. [15:18] Next, we will turn to human resources. [15:21] And I believe Director Cone, you have [15:22] two items for us tonight. [15:25] » Yes, Madam President. Uh first item up [15:28] is uh approving the completion of the [15:31] pro or yeah discussion possible action [15:32] approving completion of probate of the [15:34] probationary period and granting regular [15:37] full-time status to police corporal Tory [15:39] Shily and that would be effective August [15:41] 25th 2026 if approved. He's met all of [15:44] his requirements and has had excellent [15:45] evaluation. [15:47] » Wonderful. [15:49] » Any questions on this potential motion? [15:53] » No questions. I'll make a motion to [15:54] approve the um completion of the [15:57] probationary period and grant regular [15:59] full-time status to police corporal Tory [16:01] Shily effective August 25th, 2026. [16:05] » Second. [16:05] » We have a motion from Commissioner Brown [16:07] and a second from Commissioner. Any [16:09] questions or comments? [16:11] Okay, I'll call for the vote. All those [16:13] in favor, please say I. [16:15] » I. [16:17] » I. [16:18] » Any opposed? Motion carries 5 to Z. [16:24] All right. And the next item is [16:26] discussion and possible action accepting [16:27] the retirement of David L. Hall, [16:29] Director of Public Safety, effective [16:31] September 4th, 2026. [16:35] » I make a motion to accept the retirement [16:37] of David L. Hall, Director of Public [16:39] Safety, effective September 4th, 2026. [16:44] » Second. [16:45] » I have a motion from Commissioner Brown [16:46] and a second from Commissioner. Any [16:49] questions or comments? [16:52] I'd like to thank Dave for his lifelong [16:53] commitment to public safety and public [16:55] service and wish him happy. [16:58] » Thank you. Any further questions or [17:00] comments? [17:02] » Okay, hearing none. I'll call for the [17:03] vote. [17:03] » Just real briefly, [17:06] » I'm sorry. I just wanted to apologize to [17:08] Director Hall for not being there in [17:10] person tonight. Um if it wasn't for a [17:12] family emergency, I I would be there to [17:15] uh um to uh wish you the best. But u [17:20] anyway, I just wanted to [17:21] Thank you. [17:23] » Thank you, Commissioner Schwarz. And I [17:25] should note for the record, Commissioner [17:26] Schwarz attendance virtually is [17:29] acceptable. [17:33] » Any further questions or comments? [17:36] Okay, hearing none, I'll call for the [17:37] vote. All those in favor, please say I. [17:41] » I. [17:42] » Okay. Any opposed? Motion carries five [17:45] to zero. And again, on behalf of the [17:47] board, we wish Mr. Hall a very wonderful [17:51] retirement. [17:54] » Okay. Thank you, director. [17:55] » Thank you, Madam President. [17:58] » There's no items for public safety, so [18:00] we'll move on to community economic [18:01] development director, please. [18:04] » Thank you, Madam President. Uh the first [18:06] item is just a update on zoning hearing [18:08] board. Uh there was no meeting in [18:10] August. Uh and we have not received any [18:12] applications to the deadline for the [18:14] September meeting. So there will not be [18:16] a September zoning. [18:21] Uh second item uh is discussion and [18:23] possible action approving the uh [18:25] following waiverss associated with storm [18:27] water management system for the proposed [18:29] parking expansion at 30 385 Gettysburg [18:32] road dairy farmers of America. Um and [18:36] forgive me hindsight I probably should [18:37] have provided a memo to the board. Um [18:39] but just just to give a little context [18:42] uh if the board may recall uh the [18:44] Gettysburg portion of the old portion of [18:47] Gettysburg road along dairy farmers was [18:49] vacated. Um the right of way uh and [18:52] there was a subdivision plan lot [18:55] consolidation that the board approved [18:57] and was supported as well. Uh what what [19:00] that did was was help the existing dairy [19:02] farmers of America parcel uh just just [19:06] get in line with with a lot of [19:08] nonconformities which included their lot [19:10] coverage. Uh what they have done and [19:14] they're they proposed a parking [19:16] expansion which still complies with the [19:19] existing law coverage but it will really [19:21] help them out. Uh if the board recalls [19:24] when when PepsiCo did when dairy farmers [19:26] did the um a couple of presentation that [19:30] they've done they just they just have a [19:32] a large amount of a large volume of the [19:36] Frappuccino that comes in and out of [19:38] there and they have a they have a really [19:39] tough time with their parking their [19:41] trucks. [19:42] this parking expansion, this uh they've [19:45] proposed the storm water management uh [19:47] system. Uh we've it's under review at [19:50] this point, but with it uh they've got [19:53] zero infiltration out there. Uh and [19:55] because of that uh they are proposing [19:57] the the managed release concept and with [20:00] that of course the the volume from our [20:04] storm water storm management ordinance. [20:07] Also, um the minimum 12 in diameter pipe [20:12] uh is is not necessary for the discharge [20:15] pipe as we're reviewing this. So, [20:17] they're also requesting um a a waiver of [20:21] that and then the alternate proposed a [20:23] discharge. [20:27] So, our township engineer and staff [20:30] would recommend. [20:34] » Okay. Thank you, director. Any [20:36] questions? [20:37] engineer or director on these two items. [20:50] Um if no questions, I will go ahead and [20:53] make a motion to um [20:56] approve the proposed parking expansion [20:58] at 3805 Gettysburg Road to Dairy Farmers [21:01] of America with the [clears throat] [21:03] following waiverss. Section 184 [21:07] to require the removal of storm water [21:09] volume and in the alternate permit [21:11] Pennsylvania Department of Environmental [21:13] Protection's managed release concept [21:15] methodology. [21:18] » Second. [21:19] » We have a motion from Commissioner Brown [21:20] and a second from Vice President Navy. [21:22] Any questions or comments? [21:25] » Okay, hearing none, I'll call for the [21:26] vote. All those in favor, please say I. [21:28] » I. [21:30] » I. [21:30] » Any opposed? Motion carries. 5 to Z. [21:34] Also, uh, section 184-19.G18 [21:39] to require a minimum 12in pipe diameter [21:42] and privately owned storm water [21:44] facilities and then the alternate allow [21:46] a 6 in discharge. [21:48] » Second. [21:49] » I have a motion from Commissioner Brown [21:50] and a second from Commissioner. [21:54] Any questions or comments? [21:56] » Okay. All those in favor, please say I. [21:59] » I. [22:01] » I. [22:01] » Any opposed? Motion carries. [22:05] Okay, moving on to the next item, [22:08] please. [22:08] » Thank you, Madam President. Uh, the next [22:10] item is discussion of SLD [22:14] number 2026-04. [22:16] This is the Liberty Forge phase one [22:18] final subdivision and land development [22:20] plan. Um, just I I'll just give a a [22:23] brief um just a just a brief summary of [22:27] of the plan itself. Um, if the board [22:30] recalls, uh, [22:33] preliminary plan was was approved on [22:36] January 26th of 2026. Uh that proposes [22:40] 193 dwelling units [22:42] uh age restricted 55 plus. Uh the the [22:46] phase one plan before you is the final [22:49] plan uh and it proposes the subdivision [22:51] of the existing creekide mini golf [22:54] course um and driving range. Um and lot [22:57] two proposes the construction of 53 of [23:00] the dwelling units, a community building [23:04] and associated storm water open space, [23:06] water line extension along Lisburn Road, [23:09] and the roadway improvements. [23:12] Uh tonight, uh RGS and the rest of the [23:15] development team are here to present [23:35] Good evening. Jake Kger from RGS [23:37] Associates uh here on behalf of the [23:39] applicant. Um EG Stoulles Foods. Um [23:42] we're in front of you back in January as [23:44] Isaac uh mentioned. Um so I'll be I'll [23:47] be brief and just our review and um then [23:49] we can I'll take any questions you might [23:50] have. Um as mentioned the project's [23:53] located at the old Liberty Forge at the [23:55] location at the Liberty Forge golf [23:57] course and uh dividing into two lots uh [24:01] on the north side the driving range and [24:02] restaurant and mini golf will remain um [24:04] with the development um happening on the [24:07] other the uh south side of Lisburn Road. [24:10] Um the uh the district the zoning [24:13] district is R2 with um and proposing an [24:16] open space overlay. Um and as mentioned [24:19] um phase one will include 53 uh units [24:22] for um for phase one. Um a left turn [24:25] lane along with pedestrian crossing [24:27] signal is proposed at the site entrance [24:29] um off of Lisburn Road. Uh and this HOP [24:32] is currently in process at at PennDOT. [24:35] Um emergency access will also be [24:37] provided um through the existing drive [24:39] paving um and with a temporary drive [24:41] connection um [24:44] temporary drive connection kind of off [24:46] this edge here that will kind of connect [24:48] to some of the existing paving for phase [24:49] one. [24:52] Um all waiverss proposed with this [24:54] project are um for phase one are in line [24:56] with the preliminary plans. Um and these [24:58] were uh all recommended with the [25:00] exception of the sidewalk modification [25:02] along Lisburn. Um where in addition to a [25:05] 10-ft trail of sidewalk on the on the [25:08] north side um the board moved to defer [25:10] sidewalk on the opposite side of Lisburn [25:12] Road. Um I'm happy to review any other [25:15] waivers that you have uh questions you [25:16] have in regard to any waivers if [25:18] desired. Um and then um the preliminary [25:21] plan conditions have all been um all [25:24] been addressed related to plan work um [25:26] or will be addressed prior to recording. [25:28] Uh remaining comments are uh [25:30] administrative um in nature. Um and in [25:34] addition, we've received a couple [25:35] conditions from the planning commission [25:36] and those have all been addressed as [25:38] well um with the recommendation. So, I'm [25:40] happy to answer any other questions you [25:42] might have um or discussion um and we [25:45] request your approval of the waiverss [25:47] deferral and the plan tonight. Thank [25:49] you. [25:50] » Thank you. [25:51] » Um I'll just start out. So, can you just [25:53] specify what the condition was from the [25:55] planning commission? Was that with [25:56] respect to the lighting for the [25:57] mailboxes? [25:58] » Yes. [25:59] » Was there anything else added? [26:01] » The other conditions were for the tree [26:04] cleanup along Lisburn um and um and that [26:07] was already kind of addressed on the [26:08] plans previously. So, the only new [26:11] additional one was the lighting at the [26:12] mailbox. [26:13] » Okay. Thank you. [26:15] » Okay. I'll open it up to the board for [26:18] questions. [26:24] » I guess I'll start. Madam President, so [26:26] in the the memo information [26:28] » We got I guess we'll go to Director [26:30] Sweeney. Um, [26:33] you know, sometimes a lot of our [26:35] waiverss are to actually [26:38] permit the applicant not to do things [26:40] that they should be, you know, or due to [26:42] certain specific reasons. But in this [26:44] case, it actually seems like several of [26:46] these are [26:49] they're doing an alternate thing that's [26:50] more preferential that actually would be [26:53] better in the long term. Is that my [26:55] understanding for several of these? [26:58] I was gonna say given the site [27:00] conditions [27:02] and working through plan commission [27:05] in a lot of cases all [27:08] » Okay so in this case it's less of kind [27:11] of exempting them from following certain [27:13] rules and more so getting something [27:15] better for what will be long term for [27:18] the that community and the development [27:20] » That is correct I mean the plane [27:22] commission had strong feelings about the [27:25] connectivity and walking [27:36] Yeah, because I think I saw in that [27:38] specific one, the sidewalk deferral [27:40] number three by moving it to the the [27:43] other side of Lisburn, it actually makes [27:45] it a much safer walkway, getting it [27:47] further off Lisburn Road than even [27:50] though ideally it would be the same side [27:52] as the development, but by crossing it [27:55] over you safer walkway. Is that my [27:57] understanding? [27:58] » That is correct. [27:59] » Okay. [28:01] » Thank you. [28:02] » I think just to add to that too, Vice [28:04] President Naggie, by moving it to the [28:06] other side, it allows more connect [28:08] easier connectivity to the park, which I [28:12] would imagine is the over overall goal [28:14] in this area. [28:17] And with respect to the crosswalk to get [28:19] to the other side of this proposed [28:22] trail, can you just explain sort of the [28:24] safety features that will be in effect [28:26] for the crosswalk? [28:27] » Sure. So, it'll be a striped crosswalk [28:29] and it'll have an overhead warning [28:31] system um that we permitted through the [28:33] PennDOT HOP. Um but it's it's similar to [28:36] one that's proposed somewhere else in [28:38] the township as far as the crossing and [28:40] it's a lighted system. [28:50] Okay. Any other questions from the board [28:52] with respect to these waiverss or [28:55] approvals in the alternate for some of [28:57] these items? [29:00] » From my end, these are pretty identical [29:03] to what we've we've seen just a short [29:05] time ago and approved. So I at this [29:08] point I don't have any questions. [29:12] Commissioner Schwarz, do you have any [29:14] questions or insight from your role with [29:16] the planning commission? [29:20] » Um, the uh the only thing that comes to [29:22] mind from the planning commission was [29:25] the uh that that hasn't already been [29:27] discussed. Um was the uh uh fire [29:32] services uh request to uh use some of [29:35] the existing buildings for training [29:36] purposes. Have y'all been able to uh uh [29:40] connect with somebody on our end about [29:42] that? Uh I wasn't sure if if that had [29:46] been accomplished. [29:48] » Yeah. [29:49] » Yeah. Yes. So that we reviewed that with [29:51] staff and we've made some um adjustments [29:53] as far as making sure we're compliant [29:54] with the turning um and parking and [29:56] things of that nature. [30:02] » Oh, I meant more specifically about uh [30:04] training. [30:05] » Oh, understood. with the existing [30:06] buildings. I I wasn't sure if that um if [30:09] further discussion had been made about [30:11] about that. [30:14] » Oh, I'm sorry. Could you state your [30:17] » Sure. [30:17] » Before you speak. Thank you. [30:19] » Ryan Ball with the applicant. So, that's [30:22] still an open item. We're willing to [30:24] work with emergency services for [30:26] training purposes to the extent [30:28] possible. The closing timeline on the [30:30] project is still a moving target at this [30:32] point. So, it all needs to be [30:34] coordinated closely with that, but we'll [30:36] absolutely follow. [30:41] » Um, Commissioner Schwarz, were you able [30:43] to hear that conversation? [30:47] » I I I heard from the applicant and then [30:49] I heard somebody indicating that they [30:51] received the reach out. I think it might [30:53] have been Captain Deon. [30:54] » That was Yes, that was Captain Deep. [30:56] Yep. Just want to make sure you heard [30:58] that. [31:00] » Okay, perfect. Thank you. That was all [31:02] that that was the only outstanding issue [31:04] that that uh came to mind from from the [31:07] planning commission meeting. So, thank [31:10] you very much. [31:14] » Any other questions from the board? I'll [31:16] open it up to the attendees. And I know [31:19] you have mentioned that you'd like to [31:21] potentially speak. Is there anything [31:22] you'd like to address? Okay. Please come [31:25] to the podium. [31:31] Jamie Gun 3800 road mechanics. [31:35] It's unclear to me on um item [31:40] 1 A under C whether [31:44] the BM on Lisburn Road [31:48] is going to be increased in a way that [31:52] makes it at least for a small section of [31:55] Lisburn Road pass by Vic. [32:01] You know, I understand that there's [32:03] going to be a widening of the road so [32:06] that there are two traffic lanes moving [32:09] in opposite directions and a turn lane, [32:12] but is there going to be additional [32:14] widening of the road that would allow, [32:18] you know, a two foot or [32:22] some some BM beyond the travel or turn [32:26] lanes that make it safe for bicycles or [32:31] students [32:34] » Aside from the trail that would that's [32:36] being [32:37] » Well yeah I mean bicycles go both ways [32:40] so I don't know if your intention is for [32:43] people that are bicycling along Lisburn [32:45] road to use that trail I thought that [32:49] was to be a pedestrian [32:52] » Director who's best to answer that [32:55] question for our [32:57] I can certainly try. I I I'm not I I [33:00] mean there is no the only proposed [33:03] widening is is strictly to add the u the [33:07] the lefth hand turn lane. Um I I believe [33:11] uh that that PDO was not interested in [33:14] in widening [33:16] uh the the road along the frontage uh [33:20] just because of the the oddity and the [33:22] tapering of the widening. the tapering [33:26] of the the lanes and uh the possible [33:29] disorientation that it could cause for [33:31] for drivers with that actual. So I there [33:35] is no widening proposed except for right [33:37] at the entrance to allow for the left [33:40] hand turn. [33:46] So it was mostly the the state's [33:49] determination then on that widening [33:51] abilities and safety of the bicycles. [33:56] » And with regard to bicycles, I I'm not [33:59] sure that I can answer that. I mean, I [34:00] don't I don't know how we feel about [34:02] having bic% [34:07] that [34:09] either. [34:10] » I'm not sure how we would prevent that. [34:13] How would we prevent bicyclist using the [34:15] trail. [34:16] » I don't think that's [34:17] » Just as they would use. [34:18] » I would say that's a good idea. [34:20] » We have bicyclists using our walking [34:22] trail right now behind the Bethany [34:23] Village cottages walkers and not motori [34:27] not not ebikes but bicyclists do use [34:29] that trail. [34:32] I think that would be an option for the [34:34] residents. [34:36] » It just seems a shame to miss an [34:38] opportunity to make road safer for [34:47] » Yeah. I think the other problem is too, [34:49] you know, I live out past this. I drive [34:52] past it several times every day. I I [34:56] know there's a lot of bicycles on [34:58] Lisburn Road, but I all the time Why I [35:02] can think of [35:04] less safe road than a 40 mile per hour [35:07] road with all the ups and downs and the [35:09] sharp turns. This particular section in [35:11] my mind is one of the safer ones because [35:13] you do have a better line of sight. You [35:14] can see the bicycles. When you keep [35:16] going up towards the township, you get [35:18] into by the Canyon Creek development. I [35:21] mean, there's nothing we can do about [35:23] that. I mean this this small section [35:25] here [35:28] you know it's it's kind of a pendot [35:29] thing be tough for us to overroll that [35:32] anyway but I mean Lisburn road is just I [35:36] I just think it's such a unsafe road to [35:39] be traveling on a bicycle because of the [35:41] speed and because of the the lack of [35:44] line of sight you're coming over some of [35:45] these hills when the bicycles you know [35:47] you come over kind of come over down and [35:50] come back up another one the bicycles [35:52] are traveling extremely And you can't [35:54] really see them in a lot of points until [35:55] you're right on top of them. [35:57] » I agree. I would not ble on that road [36:00] and I travel that road frequently as [36:02] well. And if there's something that can [36:04] make it safer for the bicyclist and then [36:07] by default safer for me as a motorist, I [36:11] would be happy to see that type of [36:13] improvement. [36:15] » Yeah. I I don't think this stretch is [36:17] probably our our concerns for bicycles [36:20] on that road though. I mean, this is of [36:25] I think. [36:26] » Thank you for your comments. We [36:28] appreciate it. [36:31] » Okay, I'll turn back to the board to see [36:32] if there's any other questions before we [36:35] consider the waivers that are before us. [36:42] » No other comments or questions. Madam [36:43] President, I'll make a motion to approve [36:46] the waiver section 192-57. [36:50] C.1 [36:52] provide an increase in the pavement [36:53] width of Lisburn Road along the frontage [36:56] of the lot. But in the alternative, they [36:58] will at the entrance provide a left turn [37:01] lane on Lisburn Road with additional [37:03] pavement widening. [37:06] » We have a motion from Vice President Ngi [37:08] and a second from Commissioner Mler. Any [37:10] questions or comments? [37:12] » Okay. All those in favor, please say I. [37:15] » I. [37:15] » I. [37:16] » I. [37:17] » Any opposed? Motion carries. Five to [37:20] zero. [37:21] Next, Madam President, I'll make a [37:22] motion to accept the waiver for section [37:25] 192-57.C.8 [37:28] to provide curbing along Lisburn Road [37:31] and Old Forge Road and 8 in vertical [37:34] curbs along the internal development [37:37] streets. And in the alternate, they will [37:39] install internal slant curbing for all [37:41] internal development streets. [37:44] » Okay, I have a motion from Vice [37:46] President Ngi and a second from [37:47] Commissioner. Any questions or comments? [37:50] Those in favor, please say I. [37:53] » I. [37:54] » Any. [37:55] » Any opposed? Motion carries 5 to zero. [37:59] » Next, Madam President, we'll make a [38:00] motion for the waiver section 192-57. [38:05] C9 to provide sidewalks along both sides [38:08] of internal development streets and [38:11] frontages along Lisburn Road and Old for [38:14] Road, Old Forge Road, excuse me. And in [38:17] the alternate, they will replace with a [38:19] five foot wide sidewalks on one side of [38:21] all internal development streets and a [38:24] six foot wide trail and open space areas [38:27] and a 10- foot wide trail along the [38:30] north side of Lisburn Road and a [38:32] deferral providing sidewalks along [38:35] Lisburn Road and Old Forge Road. And I [38:40] um before I get a second, I just want to [38:42] clarify the other part of that in the [38:45] memo was would include a connection to [38:49] township community. Is that correct? [39:00] » Would it make sense to add that to the [39:02] motion? [39:04] » I think because it's going to be [39:05] depicted on the plan [39:10] as it stands. Okay. [39:14] for a second. [39:16] » Second. [39:17] » Have a motion from Vice President and a [39:19] second from Commissioner Brown. Any [39:21] further questions or comments? [39:24] » All those in favor, please say I. [39:27] » I. [39:28] » Any opposed? [39:33] » Any opposed? Motion carries five to [39:36] zero. [39:37] » Okay. Our next paper [39:39] » Next madam president section 192-57 [39:43] C9C [39:45] to provide level sidewalk areas every [39:48] 100 ft and in the alternate it will be [39:50] replaced with sidewalks to match road [39:53] grade. [39:55] » I have a motion from vice president and [39:57] a second from commissioner. Any [39:59] questions or comments? [40:02] » All those in favor please say I. [40:04] » I. [40:06] Any opposed? Motion carries. 5 to zero. [40:10] » Next, Madam President, section 192-63. [40:14] C.1A [40:16] to provide sidewalks no closer than 5T [40:18] from the curb line and in the alternate [40:21] will replace the sidewalks at 2 feet [40:23] from curb line. [40:26] » We have a motion from Vice President and [40:28] a second from Commissioner. Any [40:30] questions or comments? [40:33] All those in favor, please say I. [40:35] » I. Any opposed? [40:38] » Sorry, Commissioner Schwarz. [laughter] [40:41] Any opposed? Motion carries. Five to [40:44] » Are you [40:45] » Yeah. Am I coming through? Like are are [40:47] you guys able to hear me? [40:48] » Oh, absolutely. I just move on too [40:51] quickly and it's my apology. [40:54] » No, no worries. No worries. Okay. So, [40:58] » Next, Madam President, we'll make a [41:00] motion to accept the waiver for section [41:02] 184-14 [41:04] to require the removal of storm water [41:06] volume and in the alternate permit them [41:09] via the Pennsylvania Department of [41:10] Environmental Protections managed [41:12] release concept methodology. [41:15] » Second. [41:15] » I have a motion from Vice President Ngi [41:17] and a second from Commissioner Mler. Any [41:20] questions or comments on this one? [41:22] Okay. All those in favor, please say I. [41:25] » I. I. [41:27] » I. [41:28] » Any opposed? Motion carries five to [41:30] zero. [41:32] » Oh boy. Next one. Section 192-63.A.2A1, [41:40] section 184-19.G.16, [41:44] and section 184-19.H7.7 [41:49] to provide type C inlet tops with 10in [41:52] reveal and in the alternate permit slant [41:55] top inlets to match the proposed [41:57] curving. [41:59] I have a motion from Vice President and [42:01] a second from Commissioner. Any [42:03] questions or comments [42:06] hearing? None. I'll call for the vote. [42:08] All those in favor, please say I. [42:10] » I. [42:12] » I. [42:13] » Any opposed? Motion carries 5 to Z. And [42:15] looks like our last one, [42:17] » Section 192-57. [42:20] C12B [42:22] and section 184-19.G.21. [42:27] to provide pavement based drains in all [42:30] proposed internal development streets [42:32] and in the alternate permit the [42:34] installation of pavement base drains at [42:36] all low points of the streets. [42:39] » Okay, I have a motion from Vice [42:40] President Ngi and a second from [42:42] Commissioner Butchler. Any questions or [42:44] comments on this last [42:48] call for the vote? All those in favor, [42:49] please say I. [42:51] » I. [42:53] » Any opposed? Last one carries 5 to [42:59] looking for the overall approval of the [43:03] phase one final subdivision. [43:06] » Madam President, if no other questions [43:08] or comments, we'll make a motion to [43:10] approve [43:11] 2026-04 [43:13] Liberty Forge phase 1 final subdivision [43:16] and land development plan with the [43:18] following conditions. [43:20] Satisfy all remaining comments listed on [43:22] RTU's letter dated August 14th, 2026. [43:26] Satisfy all remaining comments listed on [43:28] Cumberland County Planning Department's [43:31] letter dated July 7th, 2026. [43:34] And the planning commission's [43:36] recommendation to provide adequate [43:38] lighting for the residents at the [43:40] cluster mailbox locations. [43:44] » I have a motion from Vice President Ngi [43:46] and a second from Commissioner. Any [43:48] questions or comments? [43:51] Okay, hearing none, I'll call for the [43:52] vote. All those in favor, please say I. [43:55] » I. [43:55] » I. [43:56] » I. [43:57] » Any opposed? [43:59] » Motion carries 5 to zero. And thanks to [44:02] the applicant for their presentation [44:04] today and thank you for the township [44:06] residents input over the course of this. [44:09] And also thank you to our township [44:11] engineer and staff for their help in our [44:14] review of this plan. So, thank you very [44:17] much. And I think that's all you had for [44:18] us tonight, director. [44:20] » Okay. All right. We'll move on to public [44:23] works. Thank you. [44:26] » Thank you, Madam President. Two items on [44:28] the agenda tonight. Public works. First [44:30] is uh for discussion possible action. [44:33] This is for authorizing staff to sign an [44:35] agreement with Mr. Rehab LLC, a co-stars [44:38] vendor for the pipelining work in the [44:41] amount of $146,657.78. [44:46] I gave the I provided the board a memo [44:49] outlining this work. Um I would mention [44:51] in addition to that that this is budget [44:54] item for this year. We have set aside [44:56] $175,000. The work came in a little bit [44:59] less than what we're expecting. So [45:03] this would fall under that line. [45:07] » Any further questions for director on [45:09] this one? [45:10] » Um no other questions. I'd like to make [45:13] a motion to authorize staff to sign an [45:15] agreement with Mr. Rehab LLC, a co-stars [45:17] vendor for the pipelining work in the [45:20] amount of $146,6578 [45:26] uh contingent upon the storm water [45:28] authority approval. [45:32] » I have a motion from Commissioner Brown [45:34] and a second from Commissioner. [45:38] » Any further questions or comments? [45:41] Okay. All those in favor, please say I. [45:44] » I. [45:47] The hem [45:50] any opposed? Motion carries. Five to [45:53] zero. [45:55] » Thank you. [45:56] » He's really going through the right. [45:58] » A poor little thing. [46:03] » And the second item is for discussion, [46:05] possible action. This is for approving a [46:08] change order from EK Services. They're [46:10] our contractor for the infrastructure [46:12] project this year. Um this would be are [46:15] changing the unit price for milling from [46:17] $2.68 per square yard to $310 per square [46:21] yard. And with the quantity that we have [46:24] estimated, this would change the total [46:26] contract price around 20 to $25,000. I [46:30] outlined the reasons why. [46:34] » Any questions for director on this [46:35] change? [46:37] » Just want to say thank you for the memo [46:39] and the detailed information. [46:42] From what I understand, it's like 1.2 2 [46:44] million project. [46:47] » Yeah, that's the contract amount. The [46:49] township will be paying for the asphalt [46:51] separately. So, it is quite a bit more [46:53] than that, but that's our contract [46:56] price. [46:58] » Just hearing all the benefits of what [47:00] everything would bring the 20 to $25,000 [47:03] change order and the $1.2 million seems [47:07] very minuscule. seems like we'd be [47:10] foolish to not get through with it. I [47:13] think it'll be a better product in the [47:15] » End. I would agree. I think it would be [47:17] negligent not to make this change after [47:19] discovering this to to do it the right [47:21] way and ensure it it lasts when it is a [47:24] project of over a million dollars. [47:26] » We are trying to budget too for next [47:28] year just even get proper equipment so [47:30] this doesn't happen again. So hopefully [47:34] that investment will pay off so we're [47:36] not in this place in the future as well. [47:40] Yeah, I'll make a motion to approve the [47:42] change order from EK Services, Inc. Uh, [47:45] changing the unit price for milling from [47:47] $2.68 per square yard to $310 per square [47:51] yard. [47:52] » Second. [47:53] » I have a motion from Commissioner Brown [47:54] and a second from Vice President Nikki. [47:56] Any questions or comments? [47:59] » Okay, hearing none, I'll call for the [48:00] vote. All those in favor, please say I. [48:03] » I. [48:04] » I. [48:05] » Any opposed? Motion carries five to [48:08] zero. [48:11] Thank you, Director Powell. [48:13] And Director, looks like you have one [48:15] item for us tonight. [48:17] » Yes. Thank you, Madam President. Um, we [48:19] received the West Recreation [48:21] Commission's [48:22] budget and their proposed increase on [48:25] the per capita amount that we pay to be [48:27] participants. So, uh, director or I'm [48:30] sorry, manager Davis and I had a meeting [48:32] today with Todd Miller and just because [48:34] I had a couple questions on some of [48:36] their items. So, the increase from last [48:39] year's per capita is 15, which isn't a [48:42] lot. Basically, we're going to be paying [48:44] $2,56455 [48:47] more than we paid um in 26 for 27. And [48:52] since there is going to be the [48:53] natiatorum [48:55] uh renovations this coming year, they [48:58] did decrease the revenues. Um it quite [49:02] in line with how they decrease the [49:04] expenses. The only expense that I had a [49:06] question on was the actual aquatic fee [49:08] that they have listed there because that [49:09] didn't come down much. But he explained [49:11] that is a 7% [49:13] charge on the revenue they make and it's [49:15] based on the previous year. So what they [49:18] what they did in the fall of 26 is what [49:20] they pay in February of 27. So we'll [49:23] actually see that be less in their 28 [49:25] budget for what they do for the fall of [49:28] 27 when the renovations will be going [49:30] on. [49:32] So everything looks in line. They're [49:34] looking for us to um approve and agree [49:38] if we want to be a part of it and then [49:40] sign and return the authorization by [49:42] September 30th. So if um the board would [49:46] have anything want to discuss or [49:49] so inclined to approve [49:52] going forward tonight. [49:55] » Thank you. [49:57] » Any questions or comments for director [49:59] on this item? I think um we do want to [50:02] probably clarify in the motion language [50:05] exactly what portion lower is [50:07] responsible for versus the the total [50:10] aggregate of the five municipalities. So [50:13] maybe if we can [50:15] » I have those. [50:16] I'll but I'll give a chance. I don't [50:17] know if Commissioner Schwarz wants to [50:19] chime in as the um [50:23] from there. Any other further thoughts? [50:29] » Mr. Schwz, do you have anything else to [50:31] add or from being on with the board? [50:35] Uh yeah, the only other thing that I [50:37] would add is uh the the specific [50:40] shortfall that we're expecting for the [50:43] uh mandatory enclosure is about $65,000 [50:46] in revenue. Um which uh the uh the [50:51] increase in the per capita rate uh won't [50:56] cover all of that. We're we're dipping [50:58] into uh the commission's uh general fund [51:02] balance um a bit to help cover that. um [51:06] not putting all of the shortfall onto [51:10] the municipalities but um and uh I also [51:14] wanted to highlight in uh 23 24 and 25 [51:19] we uh approved um uh 10 cent per capita [51:23] increases um to help keep up with uh [51:27] rising costs. And so really uh this is [51:32] more of a 5 cent uh per capita increase [51:36] u attri attributable to the uh to the [51:39] mandatorium closure. So, um I just [51:43] wanted to put that out there for [51:45] perspective. Um and uh so that uh we all [51:50] sort of understand in the grand scheme [51:52] of things it's it's not a huge increase [51:54] and it'll help the organization uh [51:57] continue to remain viable and provide uh [51:59] good services to residents um and good [52:02] recreation activities. So, um, so I'm [52:06] all for it and if, uh, if anybody has [52:09] any question additional questions, [52:12] I'm happy to try to answer the best I [52:15] can. [52:17] » Thank you, Commissioner Schwarz. [52:19] » You know, I would echo those sentiments. [52:21] I think for the the amount we pay, the [52:24] the benefits are definitely mismatched. [52:26] We we do a get a great service from them [52:29] um for what the the true costs are. So, [52:31] I will be happy to uh make the motion [52:34] and accept the Westshore Recreation [52:36] Commission's proposed fee increase from [52:38] $3.30 [52:40] to $345 [52:42] per capita for 2027. [52:45] The increase to Lower Allen Township at [52:48] $2,56455 [52:53] with a total payment of $58,98465. [53:04] A motion from Vice President and a [53:07] second from Commissioner Brown. Sorry, [53:10] it was just because of the time delays, [53:12] but [laughter] [53:13] » That's fine. [53:14] » Okay. [53:16] Um, so we have a a motion and a second, [53:18] so I'll call for the vote. All those in [53:20] favor, please say I. [53:22] » I. [53:22] » I. [53:23] » I. [53:24] » Any opposed? [53:26] Okay. Motion carries five to zero. And [53:28] again, just want to echo every [53:30] sentiments in terms of the um the the [53:32] programs that the commission provides to [53:34] our township and local community and [53:36] we're glad to have them continuing their [53:38] their programs. [53:42] » That's everything from Okay. Thank you, [53:44] Director. And we'll turn to Manager [53:46] Davis. Looks like you have a few items [53:47] to cover. [53:48] » Thank you, Madam President. Appreciate [53:50] it. Um yeah, my first item for [53:52] discussion and possible action would be [53:54] to authorize the manager to provide [53:56] formal notice to the Cland County adult [53:59] probation office that the township will [54:01] not be offering the use of the township [54:03] facilities including Boris Hall meeting [54:06] space for the county's DUI school [54:07] effective January 1st of 2027. [54:10] We've identified that the meeting space [54:12] is no longer conducive for their meeting [54:14] needs and so we'd like to get this [54:16] letter out to them to give them ample [54:17] time to make other arrangements. Thank [54:19] you. Any questions on this item? [54:26] » I'll move to authorize the manager to [54:27] provide formal notice to Cumberland [54:29] County that the township will not be [54:31] offering township facilities [54:34] including meeting space for the county [54:36] program effective January 1st. [54:39] » Second. [54:40] » Okay. I have a motion from Commissioner [54:42] and a second from Commissioner Brown. [54:44] Any questions or comments? [54:47] Hearing none, I'll call for the vote. [54:48] All those in favor, please say I. [54:51] » I. [54:51] » I. [54:52] » I. [54:53] » Any opposed? Motion carries. 5 to zero. [54:57] » Thank you. Next item would be for [54:59] discussion and possible action. This [55:01] would be to approve a policy making the [55:03] health savings account or HSA plan [55:05] mandatory for all new nonuniform [55:08] employees requiring health insurance [55:09] effective August 25th, 2026. I have a [55:13] memo in your packet and as we've [55:14] discussed with the board, [55:16] representatives have indicated that we [55:18] will u continue to receive increases in [55:21] our healthcare costs. Uh we had a 20% [55:23] increase in 26. Uh they're projecting [55:26] 15%. Um we expect to receive those [55:28] numbers in midocctober closer to our [55:30] budget time. Requiring these new hires [55:34] to enroll will help to mitigate the cost [55:35] increase experienced by the township. It [55:38] will take time for the savings to be to [55:40] be quantified but the requirement will [55:41] be the start for for that beginning that [55:44] process as more employees [55:46] plan. Um, it'll also allow employees to [55:50] build uh savings for healthare costs now [55:52] and into retirement. So, I'm just [55:54] looking for discussion from the board [55:57] and we'll help to enter or happy to [55:58] entertain any questions you may have [56:00] about this [56:04] » Question. [56:09] Start day one. [56:11] » Correct. [56:11] » Correct. [56:14] » December. [56:15] um a little earlier than that, November [56:18] for January, but yes, around that time. [56:20] Commissioner Mler, [56:24] » I was just going to say thank you for [56:25] sharing all the information on on the [56:27] plan and it looks like an excellent [56:29] plan. So, [56:31] I have no issue making it mandatory [56:33] because I would really like to have this [56:35] plan myself. So, [56:38] if there's no other questions, I would [56:40] make a motion to approve [56:44] the polic making the health savings [56:46] account plan mandatory for all new [56:48] non-uniform employees requiring health [56:50] insurance effective August 25th, 2026. [56:55] » I have a motion from Commissioner Brown [56:57] and a second from Commissioner. Any [56:59] questions or comments? [57:02] I hear none. I'll call for the vote. All [57:03] those in favor, please say I. [57:06] » I. [57:07] » I. [57:08] » Any opposed? Motion carries 5 to Z. [57:11] Thank you for bringing this to our [57:13] attention. Absolutely. Um the next item [57:16] I have for discussion on possible action [57:18] this would be to authorize a manager to [57:19] establish a public safety committee uh [57:22] including key staff volunteer fire [57:24] company chiefs and appointed [57:25] commissioners as primary leazison and [57:27] alternate or secondary leazison to the [57:29] committee. I included a memo in your [57:32] packet. um happy to entertain any [57:34] questions, but I think it would be [57:35] important for us to uh start this [57:37] committee and have a consistent process [57:39] for reviewing community safety needs, [57:42] developing recommendations concerning [57:44] police, fire, rescue, EMS, and emergency [57:46] management and preparedness matters. And [57:49] I'd like to start meeting um initially [57:51] monthly and then we can determine [57:53] scheduling um from that point forward. [57:57] » Thank you. That sounds like a very very [57:59] good idea. open it up to any questions [58:02] about this committee. [58:04] » No, I think the success of the the [58:06] finance committee, this would apply [58:09] perfectly here. This is a great [58:10] application for that and I think would [58:12] go a long ways to to getting everyone on [58:14] the the same page and bringing the [58:18] volunteers into more of the township [58:19] processes so they're the township [58:22] processes are less of a mystery and less [58:24] misunderstood. So, I think this is a [58:27] great idea to get everyone on the same [58:28] page. [58:33] comments [58:37] for a motion to authorize [58:39] Davis to establish a committee. [58:42] » Madam President, we'll make the motion [58:43] to authorize Manager Davis to establish [58:46] a public safety committee including key [58:48] staff, volunteer fire company, fire [58:50] chiefs, and appointed commissioners as a [58:53] primary liaison and alternate secondary [58:56] liaison. [58:58] » We have a motion Vice President and a [59:00] second from Commissioner Mler. Any [59:02] questions or comments? [59:04] » Madam President, the only question I [59:06] have is I assume I would be keeping the [59:08] leazison the same as we have already [59:09] established for our public safety [59:11] department, which would be Vice [59:12] President Naggie and Commissioner Brown. [59:15] » We can open that up. [59:18] » I'm not opposed to it, but I know we had [59:22] the traffic committee [59:26] on [59:31] more than [59:40] any objections to [59:44] Vice President and Commissioner Brown [59:46] being our objections from any other [59:49] commissioner. [59:52] » I I don't I'm I'm fine with that. Um and [59:56] if they're uh [59:58] If there are uh specific uh uh public [1:00:01] safety initiatives around uh traffic [1:00:04] calming and uh pedestrian bicyclist [1:00:07] safety, uh I would uh probably on an ad [1:00:11] hoc basis express my interest and see if [1:00:13] we can just work something out. So, but [1:00:15] I think for general purposes, I'm [1:00:19] perfectly fine uh uh Vice President Navy [1:00:23] and Commissioner Brown to uh take the [1:00:26] lead on that. [1:00:28] Okay, thank you Commissioner Schwarz. So [1:00:30] I guess could we make the motion twofold [1:00:33] then [1:00:35] authorizing the formation of the [1:00:37] committee and then also appointing our [1:00:39] leaison. [1:00:55] » Okay. [1:00:57] Okay. So, let's um vote. We have a [1:00:59] motion from Vice President Ngi and a [1:01:01] second from Commissioner Moler on the [1:01:02] authorization to establish the [1:01:04] committee. Um all those in favor, please [1:01:06] say I. [1:01:07] » I. [1:01:08] » I. [1:01:09] » I. [1:01:10] » Okay. Any opposed? All right. That [1:01:12] motion carries. And then secondarily, [1:01:15] we'd be looking for a motion just to [1:01:17] underneath this authorization to appoint [1:01:20] the primary and secondary leazison from [1:01:22] the board. [1:01:23] » Make a motion. Vice President. [1:01:33] » Okay, I have a motion from Commissioner [1:01:35] Mler and a second from Commissioner [1:01:37] Schwarz. Any questions or comments? [1:01:40] » Okay, I'll call for the vote. All those [1:01:41] in favor, please say [1:01:42] » I. [1:01:45] » I. [1:01:46] » Any opposed? Okay, motion carries five [1:01:49] to zero. And looks like you have one [1:01:52] more note for us. [1:01:53] » Yes, just one more note to to remind you [1:01:55] that we have an open house scheduled. [1:01:57] It's prior to our next meeting. There's [1:01:59] a flyer in your packets that explains [1:02:00] the details. Um, and we'll also at that [1:02:02] same meeting be having a presentation [1:02:04] from Seth Barry on our solar panels at [1:02:07] the beginning of that meeting. So, just [1:02:08] wanted to remind the commissioners about [1:02:09] that. [1:02:11] » Sounds like a great open house and look [1:02:13] forward to attending it. [1:02:16] » All right. Um, with that, we will open [1:02:19] up the meeting just if there's anything [1:02:20] for the good of the order from our [1:02:22] solicitor, director. Any residents in [1:02:26] attendance? [1:02:28] » Yes, sir. [1:02:36] » Hi. If you could just state your name [1:02:37] and address. [1:02:38] » Paul Stagger, 32 Scarsdale Drive, Ross [1:02:41] Point Manor, Lauren Township. Um, [1:02:45] obviously we've had a big project going [1:02:47] on in our neighborhood. Uh, I just had [1:02:50] some questions I was hoping I could get [1:02:52] some answers on. Um [1:02:56] » The the curbing [1:02:59] is that being replaced as part of the [1:03:01] paving project? [1:03:02] » We'll turn it over to director. [1:03:04] » Curving is not being replaced. Curving [1:03:06] is the ultimate responsibility of the [1:03:08] property. So [1:03:09] » Okay. So even even though the curbing [1:03:11] has a footing that extends 12 in out [1:03:14] into the street, [1:03:15] » The gutter line, we're not repl [1:03:21] in areas where [1:03:23] the the curb line is the curb reveal is [1:03:27] only about one to two inches or totally [1:03:29] deteriorating. [1:03:32] » That's not being replaced. So you're the [1:03:34] the intention is to repave the street [1:03:37] brand new scratch course wearing course. [1:03:42] » So if if a home if a homeowner wants to [1:03:46] replace the curving, [1:03:49] they have to dig up the street. [1:03:51] » Correct. [1:03:53] 12 in out. [1:03:55] » We would we would we would likely just [1:03:58] make them do a vertical curve. We would [1:03:59] not replace the curve gutter because [1:04:01] we're just paving over the curve gutter. [1:04:03] » Okay. [1:04:04] » We're paving over the the concrete [1:04:05] gutter line that's there today. [1:04:08] That's part of the change order that was [1:04:10] so we are milling that down to provide [1:04:13] sufficient cover of the pavement over [1:04:15] top of that existing gut line that we [1:04:18] weren't aware. So to match the curb [1:04:22] reveal [1:04:24] » We'll be we'll be replacing [1:04:26] » You won't be hitting four inches [1:04:29] » Of curb reveal you you might be hitting [1:04:32] one. [1:04:32] » So whatever whatever is there should be [1:04:35] matching. [1:04:36] » Okay. So that is the homeowner's [1:04:37] responsibility. [1:04:38] » So if we want to replace our curving [1:04:41] we have to have someone dig up the brand [1:04:45] new street. [1:04:47] That's why that's why a year ago we had [1:04:49] sent the correspondence out to all the [1:04:51] property owners letting them know if you [1:04:54] need any issues or if you have any [1:04:55] issues with your property and you need [1:04:58] to replace it now is the time to do so [1:05:01] that a year ago. [1:05:07] So ENK [1:05:09] had a change order that increased the [1:05:12] milling [1:05:14] price by about 16%. That was approved. [1:05:21] » Okay. [1:05:24] Does it does this does this seem like it [1:05:28] should fall like when the houses when [1:05:30] the houses were built [1:05:32] did the home the first time home buyers [1:05:36] buy the curb? [1:05:38] » I can't answer. [1:05:45] » I don't have that. I don't have that. Do [1:05:47] do you see where I'm come like where I'm [1:05:50] asking [1:05:51] » Like where I'm coming from with the [1:05:53] question? [1:05:53] » Right. You're you're looking for the [1:05:55] township to replace all the curb as part [1:05:57] » I I'm just I it to it to me it makes [1:06:00] more sense. Why wouldn't the curb be [1:06:03] replaced with if you're doing a full [1:06:05] depth replacement why wouldn't the curb [1:06:08] be replaced? [1:06:10] » I mean part of it concern cost. That's a [1:06:15] that's a huge undertaking. [1:06:16] » Yeah, I No, I I understand that. I'm an [1:06:19] engineer. [1:06:19] » What's the value we're getting back out [1:06:21] of it? [1:06:22] » Okay. You know, [1:06:22] » But have you seen the curbs in Ross? [1:06:25] Man, [1:06:26] » Understand [1:06:30] where we supposed to pull this? We don't [1:06:32] have [1:06:35] » K just asked for a 16% increase in [1:06:38] milling [1:06:39] » On a $1.2 million project. It's going to [1:06:42] cost an additional $20,000. [1:06:47] » Was ENK a low bid, no bid, or merit bid? [1:06:50] » They were the lowest responsible. [1:06:52] » Lowest responsible bidder. Okay. [1:06:57] All right. [1:06:59] So, if we want to replace our curbs, we [1:07:03] are responsible for digging up the [1:07:05] street, right? [1:07:08] And how long has that always been the [1:07:10] boss? [1:07:12] » I I don't know the history of our [1:07:14] ordinances, but that would go back. [1:07:16] » I'm I'm I'm just asking if if that [1:07:19] changed at some point because obviously [1:07:21] you have houses that were built in the [1:07:22] 50s and 60s [1:07:25] that the curbs were all installed when [1:07:29] the street was paved. [1:07:32] So, at what point did it change to where [1:07:37] the homeowner became responsible for the [1:07:39] curb? [1:07:40] » Again, I don't have the answer. [1:07:43] » It just [1:07:45] » Again sir. Yes, the sidewalks and curbs [1:07:48] are are the responsibility of the [1:07:50] property owner of the first class [1:07:51] township code. And that would be true in [1:07:54] any first class township in the [1:07:56] » So even though they have a footing that [1:07:57] goes underneath the public street [1:08:00] » And again [1:08:01] I'm I'm only telling you the general [1:08:03] law. The streets were dedicated when the [1:08:05] developer completed Rossmo Manor. Okay. [1:08:07] So, I don't I and again I don't know who [1:08:09] the engineer approved it that way, but [1:08:11] that those public improvements were [1:08:13] accepted by the township, but the [1:08:15] ongoing maintenance of those curbs and [1:08:17] sidewalks of the property owner and if [1:08:19] they aren't done at some point in time, [1:08:20] there can be assessments levied against [1:08:22] those property owners. [1:08:23] » Okay? Including the footing that goes [1:08:25] underneath the public street just to be [1:08:27] clear. [1:08:28] » And again, if that's part of the the [1:08:30] curving in sidewalk then my answer is [1:08:32] yes. I just I'm not an engineer but I [1:08:34] don't see that plan but that ordinarily [1:08:36] is true of our township and any other [1:08:38] township. [1:08:41] » Are you able to weigh in on this at all [1:08:44] from your engineer perspective? [1:08:47] I was going to say from that [1:08:49] perspective, yes, it is part of the [1:08:51] curve and under the first class code, it [1:08:54] is someone's responsibility because it's [1:08:57] designed as a curve to gutter and it's [1:09:00] considered one. [1:09:05] » Okay. [1:09:06] » So, unfortunately, that sounds like the [1:09:07] way that it [1:09:09] » I just I just wanted to ask [1:09:11] » Yeah. [1:09:12] » Get an answer. And the question is for [1:09:15] from for from for me is you're taking [1:09:17] the time to do this project to repave [1:09:22] the road. Wouldn't it make sense to just [1:09:26] do it all in one? [1:09:28] But I mean, we've had several problems. [1:09:31] I've already replaced the struts on my [1:09:34] Jeep in my just driving down the road. [1:09:38] It's this has been an ongoing problem. [1:09:39] There have been sink holes. [1:09:41] numerous problems and I just don't [1:09:44] understand why we wouldn't [1:09:48] just do it all as one part of [1:09:51] one one single project. [1:09:57] » Again, we're not we haven't been [1:10:00] replacing any curbs. We don't intend to [1:10:01] replace curbs. That's beyond our scope [1:10:04] of work. [1:10:04] » So are you so if we so as a homeowner as [1:10:08] somebody who wants to replace [1:10:10] curb. Is it appropriate to just saw cut [1:10:12] down and leave [1:10:14] » The footing in place? [1:10:16] » Again, that would be the most They're [1:10:18] going to have to excavate that out [1:10:19] anyway, the gutter line. [1:10:22] » Why didn't they do that when they did [1:10:23] the ADA ramps? [1:10:27] » They did. [1:10:29] » Did So, so they did that, but they [1:10:33] » You won't do that with the street, [1:10:36] » Right? Because 16 feet around the corner [1:10:38] of the curve is a lot [1:10:41] That's that's a federal law that comes [1:10:42] into play for the township. [1:10:45] » The ADA is a federal law we have to [1:10:46] adhere to, [1:10:47] » Right? And I'm all in I don't know if [1:10:50] you remember me, I was here before and [1:10:51] in support of the ADA ramps. [1:10:54] » Yes. [1:10:54] » Because there were people who are [1:10:56] opposed to it, [1:10:57] » Right? [1:10:57] » Which I don't understand that. It just [1:11:00] doesn't make sense to me [1:11:03] that these aging curbs which are going [1:11:07] to be deteriorated very soon or already [1:11:10] deteriorated wouldn't be replaced when [1:11:12] you're ready to put a new at least one [1:11:16] and a half inch scratch course and [1:11:17] wearing course on top. [1:11:21] I guess solicitor minor I guess the [1:11:23] answer is it's within within the code [1:11:26] it's not we're not even able to do that. [1:11:29] Is that correct? Well, I think it's a [1:11:31] budget matter as well, but I mean I [1:11:33] think that the rationale with the [1:11:35] legislature when they wrote the code was [1:11:36] that should be the homeowner's [1:11:38] responsibility and and again that's been [1:11:41] that way as long as there's first class [1:11:42] and I think that's also true in other [1:11:44] townships codes. But certainly that's [1:11:45] been true since the first class township [1:11:47] code was enacted and they just [1:11:49] recottified it in 2026. It's still there [1:11:52] » And I just need to comment our last [1:11:54] paving project in Allenale we did not [1:11:55] replace curves and we had some similar [1:11:57] situations. So some home homeowners [1:11:59] maybe cutting at the connection to the [1:12:03] street. But that's been our consistent [1:12:05] process here to follow the first class [1:12:06] township code. So I've been here through [1:12:08] several paving projects. It's consistent [1:12:11] how we've been the projects. [1:12:13] » Okay. Does it does it seem prudent from [1:12:17] a budget standpoint to [1:12:20] saw cut [1:12:22] the curb and just replace it in kind [1:12:25] right there and not replace the footing? [1:12:30] I'm you're saying for the township to do [1:12:33] all that work [1:12:38] some of the neighbors some of the [1:12:39] neighborhoods have the actual gutter the [1:12:41] footing as you're calling it to the curb [1:12:43] some don't in either case no matter [1:12:46] whether it's a straight curve or the [1:12:48] curb and gutter system our intention is [1:12:50] not to [1:12:52] » All right so I I live at the corner of [1:12:54] Scarzil in the Bonsza and we have a [1:12:57] serious drainage issue where every time [1:12:59] it rains [1:13:02] there are puddles on every corner. Is [1:13:05] this is is there any plan for [1:13:09] storm water management improvements that [1:13:12] haven't been done yet? [1:13:13] » Uh with what's been done that that will [1:13:16] be the improvement. We are not coming [1:13:19] back to do anymore. [1:13:21] » So storm water infrastructure is done [1:13:23] instructure is complete. [1:13:28] All right. [1:13:30] Thank you for your time. [1:13:32] » Okay. Thank you for coming tonight. [1:13:36] » Any anything else to go to the order [1:13:38] from any of the director staff? [1:13:44] Okay. All right. We'll move on to [1:13:46] commissioner reports and we'll begin [1:13:47] with Commissioner Schwarz, please. [1:13:51] » Thank you, Madam President. I have any [1:13:54] uh updates other than to uh thank [1:13:56] everybody for uh accommodating uh my [1:13:59] family this evening. I really appreciate [1:14:01] it and I hope everybody has an excellent [1:14:04] rest of your day. [1:14:05] » Thank you, Commissioner Schwarz. And we [1:14:06] we hope uh little Theo feels better. So, [1:14:10] um Commissioner Schwarz or Commissioner, [1:14:14] » A couple of event reminders from the Re [1:14:16] Parks Board coming up on Thursday, [1:14:18] September 17th from 4:30 to 7 at Lower [1:14:21] Community Park. It's [1:14:23] which is a dog friendly event at the dog [1:14:24] park and then Saturday October 17th from [1:14:27] 10 to 2 at [1:14:29] board is sponsoring a fall craft and [1:14:30] harvest fair [1:14:33] which can be more information can be [1:14:34] found on the website and on Facebook [1:14:38] and don't forget tomorrow's first day of [1:14:39] school we all know but stop for buses [1:14:42] watch for kids [1:14:45] » Thank you [1:14:47] » Yeah I was just gonna say um good luck [1:14:49] to all the students returning tomorrow [1:14:52] And um also wanted to uh say to Captain [1:14:55] Folks um you know [1:14:58] coaching baseball and being out in the [1:14:59] community around a 15 year old kids and [1:15:01] and um the success of the the school [1:15:05] resource officer program um and and in [1:15:08] particular officer Lightner at the high [1:15:11] school. Um hearing these young men the [1:15:13] way they talk about Officer Lightner uh [1:15:16] he he has earned their respect and the [1:15:20] improvements and and just [1:15:24] I don't want to get into too much detail [1:15:25] or whatever, but but just how much [1:15:28] better that school is to attend for all [1:15:31] the students because of his presence and [1:15:34] um just the little things. I mean, he [1:15:36] knows their birthdays. He say, you know, [1:15:39] he sees them out in public. He talks to [1:15:40] them. Um a bunch of the students were [1:15:43] doing a pickle ball tournament um and [1:15:45] they were short of team and officer [1:15:47] Lightner and and uh and another has [1:15:51] joined in to to round out the tournament [1:15:53] and then they're apparently pretty good [1:15:55] and disqualified themselves at the end [1:15:57] so they couldn't win it and and let some [1:15:59] other teams go on. But those are the [1:16:01] little things that that really helped [1:16:03] the community and really helped the [1:16:04] school and I think that that school [1:16:06] resource officer program has been a [1:16:08] tremendous success and a large part of [1:16:10] it is because of who's in place there [1:16:13] and so excellent job an excellent job to [1:16:16] officer. Thank you. [1:16:19] I would echo those same sentiments from [1:16:21] feedback from others at the high school. [1:16:23] His presence is certainly very [1:16:25] wellreceived and very positive there. [1:16:27] So, [1:16:30] » Thank you, Madam President. Just uh a [1:16:32] thank you to all the years of service [1:16:34] folks uh tonight. 20 years and 30 years [1:16:36] is a heck of a achievement here to the [1:16:39] uh commendation. Thank you for your [1:16:42] efforts during during the storm. [1:16:45] Thank you. [1:16:48] Um, and I'll just make a quick [1:16:49] announcement. Um, just to remind the [1:16:50] board that the annual Capcog golf and [1:16:53] picnic um, and the annual meeting is [1:16:55] September 21st at the Armadage um, golf [1:16:58] club golf course. Um, also wanted to [1:17:01] just uh, provide a quick shout out. Um, [1:17:04] this past Saturday u, manager Davis and [1:17:06] I were involved in the the county [1:17:09] commission for women and um, we [1:17:13] basically were on the committee [1:17:14] spearheading the women in government [1:17:16] that was hosted here on Saturday. And I [1:17:19] just want to give a a shout out to [1:17:21] Lauren Castleberry and and Megan [1:17:22] Cleansing. Um they were panelists in the [1:17:25] non-elected panel that day and they just [1:17:28] did a fabulous job of really explaining [1:17:31] um sort of how they became involved in [1:17:32] the park and rec board and and sort of [1:17:35] what their purpose is and and um why [1:17:38] they find it to be rewarding. And I I [1:17:40] just think it's they're they're both [1:17:41] very valuable assets on the board and uh [1:17:44] just appreciate them. serving in that [1:17:46] capacity and also participating in our [1:17:49] event this past Saturday. So, kudos to [1:17:51] them. And again, I'll just echo the uh [1:17:54] sentiments of the board that we hope [1:17:56] everyone and all the families in our [1:17:57] township have a wonderful uh first day [1:18:00] back to school and a safe year ahead. [1:18:02] So, um with that, we'll turn to announce [1:18:05] that the next meeting will be Monday, [1:18:07] September 14th, 2026 at 6 o'clock p.m. [1:18:10] here at the township.
