We do Lord, we give things for this day. Here in the middle of summer, we do ask for your blessings and watch fly with those impacted by the heat and by the recent storm. [1:00] And we just ask for your insight in Godence as we handle these matters here today ask always your name. I'm here and then I'd [1:09] like to ask [1:10] Councilman Ryzen if he would lead us in the play to believe this [1:14] I [1:17] pledge allegiance to the flag of the United States of America and to the Republic for which is saying [1:24] One nation under God indivisible with liberty and justice for all our [1:37] first item is retirees recognition [1:40] Mr. Keith Jones, is it here in the house? [1:46] All right, Curly Locklear, all [1:52] right then. [1:54] Mr. Jones had 35 years, and Mr. Locklear had 10. [1:58] We appreciate their service. [2:04] The next item is called to present Mr. John Carroll with pride and [2:14] I [2:17] like asking this Betty Kern, if she would to come up, as I do every month, because I [2:27] like to do it every month. [2:28] We've initiated the Pride and London Community Appearance Award, and I actually received [2:34] a nomination last month about Ms. Betty Kern, George, who has been so well-kept and so well-managed [2:42] Thank you. [2:43] And we are so happy and so proud that we want to present this pride in Lumberton Community [2:49] Appearance Award to her on behalf of the City Council and behalf of all of the staff [2:55] here with the City of Lumberton. [2:56] We appreciate everything that you do. [2:58] You've expressed to me how your husband took so much pride in keeping the yard up and [3:03] you have continued that. [3:04] And I just want to say thank you from me and from present three because we hope that others [3:11] We'll step up and take a little bit more initiative to make lunch and even more beautiful, and I want to present you this. [3:18] Thank you. [3:24] Thank you so much. [3:28] Well, she's not here. It's Ms. Payton. [3:30] And she's not here this morning, so I'll present that to her. [3:35] Thank you, Mayor. [3:44] Yes sir, we have Mr. Bruce Mullis. [3:50] If I could just respectfully remind everybody on the list, we have a three minute. [3:56] Morning Mayor and Council. [3:57] Bruce Mullis, 5,000 white drive in Lumberton, I just wanted to kind of give a brief update on [4:02] the successful season that Lumberton Youth Baseball Association had this summer in conjunction [4:08] with our Recreation Department. We hosted 23 teams this regular season from [4:14] ages 5 to age 15. We had five all-star teams that participated in postseason [4:21] play during our tournament for our eight and nine-year-old kids that played in [4:28] Elizabeth Town. They won the Sportsmanship Award. [4:31] D-Y-B actually is more more proud of a sportsmanship award recipient almost [4:39] and they are the tournament winner. So we were very proud of our kids and our [4:43] coaches and fans. Our six-year-old team, our five-and-six-year-old team also won [4:49] the sportsmanship award. That was during the tournament that we hosted the [4:53] WIBA hosted this year, we hosted a five and six year old state coach pitch state tournament, June 10th through the 13th out at Northeast Park. [5:06] We were the host of that tournament. [5:08] I noticed that Mr. Arnold West was in the audience just wanted to make a comment that we during that tournament we had about 140 plus or minus hotel room nights as a result of hosting this state tournament. [5:23] The state director has actually stated that she wants us to be the permanent site for this so we'll have to take that under consideration because you know there is a lot of volunteer hours and involved in that but we were very proud of to be able to host that tournament once again or host that tournament as we've hosted many state tournaments in the past and been extremely successful but but really proud that we had the hotel room nights and visitors coming in to lumber 10 and spending their money here everything went great out of the ball fields [5:53] Our 13 and 14 and 15-year-old kids played Dixie Boys, which they play on a regulation-size [6:00] field 60-90. [6:01] So they participated this year on field number five, and our 14-year-old team went to [6:06] Town Creek and actually won the state tournament. [6:10] So they will actually be leaving tomorrow to go to Stirlington, Louisiana to represent North [6:17] Carolina in the World Series and the DBB World Series. [6:21] So, we're extremely proud of those kids and going to represent Lumberton in the state of [6:27] North Carolina this week coming up. [6:29] So, I just wanted to give you all that update, a recreation department and us, L-Y-B-A continue [6:34] to have a great working relationship and we have a lot of support from the city and from [6:39] the community and from many of you. [6:41] So, we thank you for that. [6:42] And like I said, I just wanted to present that good news. [6:44] We felt it was really good news to share, so we wanted to do that this morning, so thank [6:49] you. [6:49] Thank you sir. Thank you mayor. [6:54] Our next presenter Mr. Wade Green is going to [7:05] present our audit to us. Thank you Mr. Mayor Council. This I guess you've got a [7:13] copy this is last year's audit. LGC is finally happy that they love to check [7:19] get to this but anyway they're happy. I got my love presentation I'll go over this kind [7:25] of hit the high spots if you would. With that being said if you just flip over to page 2 in it [7:38] your assets and your deferred outflows of resources exceeded your liabilities and deferred [7:43] inflows of resources over 103 million dollars. Your net position or net income if you will [7:50] increase by 8.9 million. That's the full or cruel basis. That's the first two [7:55] statements in the financial. That's really not how you keep your books. That's [8:00] cash basis and that's the rest of them. But any questions on that one, that's [8:05] full or cruel. If not the next one, your general fund, your revenues are 30 million [8:12] In 1996, your expenses, 34,694 revenues over expenditures, minus 4,597,000 to General [8:25] Fund, like a 4.5 million in the whole. [8:29] Does you see your revenues and expenses went up for the year? [8:36] On the next one, fund balance available, cash in the bank after you pay your bills. [8:41] You're in, you had $7,566,000. [8:45] You were 8.2 million last year. [8:47] It went down some. [8:49] But if you'll take this 7.5 million divided [8:52] by the prior charts expenses, [8:54] you get the next one, the percentage. [8:56] This is the one the LGC likes to look at. [8:59] You're at 21.81%. [9:02] LGC would say 75% is excellent shape, [9:06] but most towns 20 to 40% tend to be par, [9:10] so you're just still in good shape in your general fund. [9:14] Any question about your general fund? [9:17] If not the next one, you're light and power fund. [9:22] Revenue's $35,751,000, expenses $36,408,000, [9:30] net loss $657,000 or $44,000. [9:36] As you can see last year you had a lawsuit to me in nine this year 657,000 [9:42] The next one is probably the negative in this your life your fund balance available. You're at a minus [9:48] 370,000 [9:50] 100 [9:53] 370,000 one one seven now within that [9:57] This is from a grant that this city paid past paid old expenses [10:02] but you've got about four million dollars owed to your year end, you just [10:05] haven't gotten it yet. If you had four million, that would be a positive [10:09] but you haven't gotten it yet. So at June 30th, like I said, it's a negative [10:13] $370,000. The next one is the percentage, zero percent. It's probably something [10:20] else you see may have wrote you up for it, but when the four million comes in, [10:27] you [10:42] The next water and sewer fund, revenues over 17 million, your expenses 14 and a half [10:52] million, revenues over expenditures to 2,512,000, as you can see at 287,000 loss last year, [11:02] positive two and a half million this year. [11:06] Fund balance available, $12,578,000. [11:10] It was delivered 10 million last year, [11:13] so your fund balance available went up. [11:16] The percentage, your 86.26 percent, [11:21] you were at 68, well like I said, [11:22] it's 75 percent. [11:24] It's the actual numbers, so your good shape, [11:26] order and so on. [11:29] Your sanitation fund revenue, [11:32] two million six hundred fifty eight thousand. Spence is over two million one [11:37] hundred and seventeen thousand net ink. I mean on revenues over it's [11:41] fences five hundred forty thousand six seventy four. As you see it's had [11:47] positive cash flows that last year. Anyway the fund balance available eight hundred [11:53] sixty thousand two fifty. It was fourteen last year. It was almost doubled from [11:58] prior year. The percentage, 40.62 percent. It was 14.99 last year, so they were going up. [12:12] The next one, just total cash, your governmental, you had a 10.9 million dollars, your enterprise [12:21] funds, 17.6 million. [12:26] The governmentals went down a little bit, but your enterprise funds went up. [12:30] As you see, it's still been kind of going up over the past three years. [12:35] And that's when the long-term debt [12:38] governmental, 56 million, 332 thousand, and 15 million, 284, in your enterprise funds. This year, [12:47] we put up sick leave, something else being on the books, but now we have to put them on the books. So sick leave, [12:52] I think it is in that and it's a pretty good size number so I'll tell you won't pay it [12:59] paper for a tire and put it to the retirement for years of service etcetera but it's [13:04] included. [13:07] Any questions on long-term debt? The next one is just your current tax levy for [13:14] The current year, 12 million, 882 thousand. [13:18] It was 11 million, 456 thousand last year. [13:22] See taxes, what a million for from prior years. [13:28] The next one, your collection rate, 94.83% total, [13:34] 94.27, real and personal, and 100% motor vehicle. [13:39] I was saying the southeast, these counties down here, [13:41] 93% are higher, 10 to be good. [13:44] unless you're at the beach, they tend to bail us a hundred percent. [13:47] So anyway, that's a good rate, 94.8, 3. [13:52] With that, that kind of hits all the hotspots, especially ones LGC likes to look at. [13:58] But this is last year's old at now, 6.35, 7.26. [14:04] Any questions, comments? [14:12] Man, you got anything to add to that? [14:15] Thank you. [14:17] Thank you. [14:18] We'll see you. [14:29] Here. [14:30] Thank you. [14:33] Mayor. [14:34] Could the city manager tell the audience why LGC stands for so that they might understand? [14:42] Sure. [14:43] Well, now what? [14:43] LGC's Food? [14:44] We share with the audience while LGC stands for. [14:47] We refer to LGC. [14:48] You're right. [14:49] Go ahead. [14:49] Through you are all. [14:50] I [15:00] LGC, a local government commission, they have oversight on our financing, they review our audit. And basically, before we can proceed, in this year we have to submit everything, get it approved by them. We were taken off of the watch list last year with our financing, and I think we're all this year also. [15:16] of the state. [15:18] Thank you. [15:26] Thank you. [15:30] Thank you. [15:31] Thank you. [15:32] Thank you. [15:37] This is a motion to accept all the. [15:39] Make a motion to accept the audit but for the year 2,025, we have that's presented by the green [15:48] company. [15:48] Second. [15:49] Motion on a second. [15:50] All those in favor, please say aye. [15:52] Aye. [15:53] Opposed? [15:54] Yeah. [15:54] I have to do the public hearing. [16:01] Next we'll move to category five public hearings. [16:08] Madam Clerk, would you like to read the affidavit for item A, L, Catee, [16:13] Resonings on all the draw? [16:15] This is a continued public hearing. [16:19] OK, so the affidavit was read at the initial presentation. [16:24] OK. [16:25] Got the question. [16:26] Good morning. [16:27] Mayor members of Council and staff. [16:30] Mr. Alcatheav is requesting to rezone two properties located at 2906 Olive Drive. [16:36] The parcel numbers are 3218-01008 and 3218-0100801. [16:46] On February 9th, Mr. Alcatheav asked Council to table this request to allow him to submit [16:52] more information. [16:53] Council voted to send this request back to the planning board on June 8th for further review. [16:59] Attached in your packet is the additional information that was submitted to us. [17:03] The planning board held the public meeting on June 16th and unanimously recommended that [17:07] Council approve the final draft. [17:10] The planning staff and planning board asked Council to hold today's public hearing and [17:13] approve this request. [17:15] Thank you. [17:15] Thank you, we'll open the public hearing, this is a legislative matter so we don't need [17:24] to swear anybody in with the applicant like to be heard on the matter. [17:36] Mayor Council Larry Anderson with Anderson Engineering, Ms. Laney has limited my time today [17:43] and as well as the fact that you have an excellent staff that has covered you with great package [17:49] and great information. [17:50] So, I won't go through my field, we have a good, good project here, a bit great access, [17:59] access, access, it'd be a big benefit to our precincts that way. [18:08] Gentlemen are going to put a lot of money into a fixed asset project, it's going to generate [18:16] revenue for the city be good for the community. [18:22] We did do a preliminary site plan, send your package, and be glad to try to answer any [18:27] questions that may be generated from that. [18:30] Or if you've got any questions overall, I'll be glad to try to answer that. [18:36] We'd like for you to review the package. [18:39] No questions? [18:41] Sound the document and let us go to the next step, which is site development. [18:45] Thank you. [18:45] have a question for you. Yes sir. For our early conversation, you did say there [18:51] would be a road access off of West Drive instead of traffic going on all the [18:55] drive. Yes sir. Yes sir. We've looked at the traffic. We've got a three-throwed [19:01] two three-throwed entrances and exits off of Fist Street. We have service [19:08] equipment that will be exiting to the, I guess that will be to the south on to West [19:13] drive and then on to West Fifth Street. We have segregated this entire [19:21] track of lands three acres or so from olive drive altogether. So we've created [19:29] or planned to create buffers of 20 foot buffer along olive drive as well as a [19:35] six foot OPEC fence on the east side of our property. I've had some concerns from [19:41] the red simulator. One of the concerns was their concerns was a vape shop or a skill [19:48] game activity. Well, anything, that big thing. And with the owners, be willing to work [19:57] with lower enforcement because we have some issues everywhere with some homeless and [20:01] stuff. You do. It's a vague any going on in. And some of the neighbors feel like it would [20:05] be to be in a fit. They feel better about it. If they have a lower enforcement presence [20:11] to see if there may be some new transpastions signs to give the law enforcement authorization [20:16] to do what they need to do to handle on some of those issues. [20:20] Councilman, these folks are putting several millions of dollars into this project and would [20:26] welcome any help and are willing to work with whatever agency they need to to ensure that [20:33] that asset is protected. [20:36] Thank you, sir. [20:37] there. Yes. Excuse me, Eric. On the safe side. Would you like to add those conditions? [20:46] I would definitely. You'll approve. We'll definitely have those. It was going to be my next [20:52] step there willing to. [20:56] I'm representative. Don't have the final say so. I'm sure of those [21:01] that both the clients, both the honors would be more than welcome to. I don't see any [21:11] I'm here, but I'm entering to that agreement. [21:15] I wouldn't, I don't think there will be a problem [21:17] with that being attached to any kind of, [21:19] any kind of approval recommendation. [21:22] Art, Ms. Arbor. [21:23] Yes, I need to say something about that real quick. [21:25] Okay. [21:26] So if we're going to add conditions to the rezoning, [21:29] we have to convert this application [21:30] to a conditional rezoning application. [21:33] So that's the only way that we can add conditions. [21:35] And of course, they would have to approve the conditions. [21:38] Thank you. [21:39] and would it have to come back? [21:41] One point before you could do that. [21:43] You could come back? [21:44] Yes, it would. [21:45] Yeah. [21:46] Yes, it would. [21:47] I mean, if you had someone here [21:49] that could consent to that, probably go forward. [21:52] Yeah, because we could do the application. [21:54] That is not an issue. [21:55] But the property owner would have [21:57] to be here to consent. [22:00] We're looking for your next committee. [22:01] Could. [22:03] What time frame are you all looking? [22:05] It may be trying to get this up and going. [22:12] I think our next meeting will be until September, I believe. [22:16] Councilman Chavis, perhaps if we were to just table this to the end of the meeting and [22:22] he could maybe contact one of the property owners and get them to come between now and [22:26] the time we finish, we might be able to resolve this today. [22:29] I think the manager, he just had an ideal to do a conditional consent, add it in now at [22:40] that motion if they will accept that. Okay, but if not, then we come back. Is that possible? [22:48] Mr. Attorney. Yeah, I mean, I guess you would basically approve it as a conditional [22:52] rezoning with those items. You need to be specific, you know, what you're taking out. Um, [22:58] and then if the client ends up not being fine with that, we'll just revisit it and, um, [23:09] if he's fine, that would be the end. But we need to leave knowing exactly what those conditions [23:15] are. I understand it will be no vape shop. No. Yeah, because we already have two already [23:20] over there. Right. So. And we have a skill machine across just a couple of hundreds of yards [23:29] wafing their property. These are two of the main. I'm pretty sure I knew that 100 problems [23:33] working a law enforcement or whatever it needs to be done but if we can get those two [23:37] items taken care of they have new problems. I personally don't see a problem with that. [23:43] These gentlemen have facilities within our community already and I don't believe they have [23:52] been problems or represented problem establishments. Would you like to contact them and we come back [23:58] I'll try to, you know, to meet and finalize it. [24:01] I'll try to. [24:02] Okay. [24:02] So your concerns are vape shop, skill, skill game, skill game. [24:09] Yeah. [24:09] And then what was the condition about? [24:11] Well, it would help if they would be willing to put some new trust past the signs that [24:17] we give law enforcement something to work with as far as hell, and well, I think I understand [24:21] what you're saying. [24:22] Law enforcement is kind of crippled unless there is a sign that's happened to me saying [24:28] and no trespassing after hours or something similar. [24:31] I guess I run the documents of a friend-in-law enforcement [24:35] after rising down is to act the front of that. [24:39] The other item, if I might raise it, [24:42] not trying to beat up on the applicant, [24:44] but there's been a lot of discussion about the site plan. [24:47] And I think that was maybe a request of sorts [24:50] from the planning board. [24:51] We appreciate the applicant being willing to do that. [24:54] But if we passed it just the way you described, [24:57] that site plan would not be legally binding at all so I don't know if you want to add that as the [25:04] condition with minor changes being allowed by the planning department but I just wanted to [25:09] point that out. If I might interject council the site plan is nowhere near complete. The site plan [25:18] was marked a site plan for an exhibit. There are several permit processes and we have to go [25:25] through before that site plan is is appropriate. [25:30] There's one point out there's some key factors in there. [25:33] Like, no, it's on all the drive and things like that. [25:36] If you're banking on, you [25:40] said that. [25:40] Yeah, I think they already had that in place. [25:42] There's been Mr. Minneson had talked about that previously, [25:45] so in fact, um, yes, but the buffer buffers, uh, and excludes access to all [25:53] drive all right there's an existing two thousand square feet single family [25:59] residents that's going to remain and it will be converted into an office it will [26:05] be within that buffer right behind that buffer be accessed from the the [26:10] shopping center and become part of the complex itself may be office for the [26:17] development. [26:24] Sounds like we're going to maybe wait until the end of the meeting to take [26:28] any action but my only point is you better put it in there as a condition if you want [26:32] it or else it's just a handshake which is fine but I don't say I didn't tell you. [26:41] If you can make contact with those and try to try. I would appreciate it. [26:45] to adjourn that until a later point. [26:47] Okay, thank you. [26:48] Thank you, sir. [26:49] Yes, sir. [26:50] Anything else? [26:51] Okay, before we adjourn it, just for the benefit of, [26:55] is there anyone here, anyone else who would like to speak, [26:58] because we hate for everybody else to have to wait [27:00] to the end if there's somebody. [27:02] Anyone else here that speak on the project? [27:05] I don't see anyone. [27:07] Okay, all right. [27:08] But I was the same as a plan board making [27:10] we didn't have any opposition at all. [27:13] Thank you, Mr. Amish. [27:14] Yes, sir. All right, so that's on hold and we'll move to the next [27:20] public hearing [27:30] I just had to say ordinance this is pertaining to the vehicular [27:37] Automated ordinance that correct. That's correct. Is there an affidavit for that? [27:43] Yes, sir [27:45] The affidavit of publication is from the Robert Stanley and it shows that on June 27th [27:50] July 4th and July 11th, 2026, notices were published here in B. Hill today. [27:57] The purpose of the public hearing is to consider an amendment to the land use ordinance [28:02] by creating an ordinance regulating automotive. [28:08] Thank you. Based on the research, [28:11] we have developed a draft ordinance that we believe is suitable for the city of Lumberton. [28:16] The scope of the, excuse me, the scope of the amendment addresses various types of automotive [28:20] of establishment and outlines general standards for all new and existing establishments. [28:26] It addresses automotive pain and body shops, automotive parts, sales, installation, repair [28:33] and service without pain and body, record services, auto detailing, car wash, tires, mounting [28:41] transmission or muffler shops, and the additional provisions would be to provide one year for [28:47] existing establishments to comply with these standards or face a $200 per day penalty. [28:53] New salvage yards are prohibited in the special flood hazard areas unless a variance is granted. [28:59] And all automotive establishments must comply with the broader city of Lumberton code. [29:04] The planning board held the public meeting on June 16th and unanimously recommended that [29:08] council approve the final draft. [29:11] And the planning staff and planning board asked council to hold today's public hearing and [29:14] and approve the new ordinance regulating automotive establishments within the city's jurisdiction. [29:20] Thank you. [29:21] Thank you. [29:22] Open the public hearing. [29:23] Is there anyone that would like to be heard on this item? [29:32] Close the public hearing. [29:33] What's the pleasure of Council? [29:34] I have a question. [29:37] Dr. Kerstner. [29:38] Yes, sir. [29:39] On the item D on the last page is saying that it's got one year from the effective date of this new ordinance [29:45] to change out the fencing, the screen. [29:49] And it's all everywhere I read saying that it has to be wooden fence for the new, yes, because you all just approved the fence changes. [30:00] Okay, so the existing facilities that don't have those fences, what are we going to do there? Well, with the previous ordinance that we had approved, we're addressing that with that one. So we gave them 90 days to comply, but we really haven't started addressing it yet. What I'm doing is I'm sending our code enforcement officer around just to inform them of the ordinance again and let them know that, you know, they have some time to do so with their time limit is. [30:28] So once we do that first round and then if they haven't complied, then we'll go ahead and send a written notice [30:34] And then that's when the 90 days would start. Yeah, all over town. There's some unsightly places [30:40] Pretty can see it not only from the front of the establishment from the side and so if they're gonna go to wooden fences [30:47] Is that gonna be a burden for many of them? I guess to come up with that kind of a funds to to build those. Well [30:56] Well, yes, we just it could be for some of the businesses. [31:00] Yes, I don't know pretty sure it could be. [31:05] Well, there certainly some places need to be addressed. [31:08] Right. [31:09] Yeah. [31:09] The ones that we are mainly targeting is the it's not vinyl. [31:14] What is it that mesh material that they they use? [31:18] Right. [31:20] We're really addressing a lot of those because they get torn and they don't get replaced. [31:23] And they don't even do what it's supposed to do in that screen. [31:27] You can still see through them, along with the slats as well. [31:30] You can still see through the plastic slats that go through the chain link fence. [31:34] So the intent of the ordinance is to make sure that it's completely screened. [31:38] And those two do not do that. [31:40] Like many ordinances, they're hard to enforce. [31:43] They are. [31:44] So just, you know, want to get everybody's opinion about that as well. [31:48] But there are some places need to be addressed very badly. [31:52] Yes, of course, no, one other question when it does say I would vent for a masonry wall [32:00] You know a lot of people are going with a vinyl dancing now. Would that be considered in that as well? [32:05] As long as it is opaque and you cannot see do it at all. It's the same. Yes, it'll fencing, but it's not wood. It's vinyl [32:12] That is perfectly fine. Okay. Yes, they can do that and this gives us the city of more [32:18] for teeth, so to speak, to make things happen. [32:21] That is correct, yes. [32:24] I appreciate it. [32:26] But very like the Councilman rises here, [32:27] there are some places in Lombard, [32:29] and it really needs cleaning up or some heating. [32:37] Oh, Trill, you talked just a little bit [32:39] about enforcement provision. [32:41] We have folks that they receive notices [32:43] that they basically ignore the notices, [32:45] nor the penalties kind of address enforcement with them. [32:49] Okay, so like I said previously, [32:52] just for that section, what we do is I'll send my [32:55] code enforcement officer, Mr. [32:57] Mons out there to verbally inform them that there's a [33:01] violation and you know what needs to be done to be to [33:05] correct it. Once after a certain period of time, then we'll [33:09] send the written notice if it has not been done already. [33:12] So after that is usually a week or two weeks depending on [33:15] the extent and like I said, depending on the what needs to [33:19] be done, we can kind of link them that time if we know [33:21] was going to be more than two weeks. But if it doesn't comply by then, then we issue [33:27] the monetary fine, which is the citations. [33:32] Or does it go from there or if they don't pay the fines? [33:34] If they don't pay the fines and comply, then it will go up to the city attorney for legal [33:39] actions. [33:41] And what would be the legal action, Mr. Oak? We need to put that out there right now. [33:48] Well, if I'm not mistaken, most of these fines are on a daily basis, is that wrong? [33:53] That's correct. [33:54] The time we get a court, we tell you what it is. [33:56] Over all those days, it's usually $5,000,000. [33:59] So we'd be seeking to collect the fines. [34:02] We'd be seeking an injunction from the court, [34:04] basically saying, Mr. Honor, you are enjoined from further [34:09] a violation of our ordinance. [34:12] And those are the main things. [34:14] And then just a declaration that they [34:16] are in violation of our ordinance. [34:18] So then the benefit of that injunction is now [34:20] you've got the the judge breathed out their net you know it's like one thing you [34:23] want of them your nose at us but now if you violate it they're in contempt and [34:28] so forth so that would be that would be the plan. I guess what I'm looking at [34:34] like we have people with skill games of arcade and we didn't did defines we didn't [34:40] did the court we didn't did the judgment we didn't went through the planning and [34:44] and stuff, and they're still operating. [34:47] So with this, are we still going to be able to do anything? [34:51] Well, Councilman, on that topic, planning Dr. Kirschner, [34:55] Brian and I, Mr. Norley, we met last week [34:59] to kind of say who's still operating on the gaming? [35:02] And so their staff is going to go out and ascertain that. [35:07] And then we want to talk with you all, [35:09] but our plan will be they would need to do some legalization [35:12] on those, you know, you know, because the most visible one has come in, you know, and [35:18] applied for a special use, but it was denied. [35:21] So, you know, and everybody's got eyes on them, and so we certainly don't want to reward [35:27] the ones that didn't even come in. [35:28] So we're going to need to identify everybody that's operating and probably, you know, take [35:33] this same type of approach with them. [35:36] I wanted to, for that community, I know what he got. [35:39] Yeah, if you would like to give us a list, that'll be great as well. [35:43] We have a list, but we might be missing some. [35:47] And would we need to increase our fines if the $200 a is not getting the message across? [35:54] So our- [35:55] Probably not collecting any way, but- [35:57] No, they're not coming in to pay. [35:59] And even the ones that would come in to pay say, oh, we'll be happy to continue paying [36:03] the fines. [36:04] If the continued operate, I tell them it doesn't work that way. [36:06] you have to go ahead and shut down. [36:09] But our violations is $200 a day per violation. [36:13] And we look at the machines as being a violation in itself. [36:17] So it can't get expensive. [36:19] Okay. [36:22] I mean, I'm like, I'm like, [36:23] Councilor Canter, what we're doing just far is not working. [36:27] Right. [36:29] Another issue that kind of have us in a bind [36:32] is we don't know which machines [36:33] North Carolina outlawed and which ones they don't. [36:36] So other than me being trained or us being trained on which one how to identify it [36:41] It's kind of difficult. So we kind of use it as just our [36:45] Ordnance electronic gaming period [36:47] One last question from me [36:51] Since wrong gaming many of those tenants or those leases are [36:57] Raining so who's responsible the the person who is renting the property and the landlord or both responsible or how does that work? [37:06] okay so we can send the notices to the landlord and the tenant [37:12] ultimately it is the property owners responsibility to go in and shut them [37:17] down so if they got to court and got to be in the city of Lumberton won the case [37:22] and still didn't get it they didn't come in to do didn't pay it whatever we could [37:27] attach a lien to the property can we attach a lien to the property well it would have [37:36] And then you again have the junction from the court seems you got to stop stuff it goes far enough [37:42] It gets pretty serious. We would name them both, but really it's true from a zoning standpoint [37:46] You're mainly looking at the property owner, which might be an outener for those landlords [37:52] So [37:54] If we find the land lowest, I think it may move just a little bit quicker [37:59] I think we're [38:01] saying hey I paid a fine because I'm making $5,000 per day. Okay but this landlord you know he's [38:07] only getting $800,000 rent or $2,000 rent. Well I will share this we had a long discussion [38:14] with a fella in blatant accounting who was very involved in their enforcement efforts and he found [38:20] that in probably talking at a school but this is straight from his mouth that the landlord had a [38:25] percentage. So it's a little different than you might expect. And I can't say that [38:31] may not be true for one single property. But that's what I've heard. They're getting [38:36] paid pretty good. [38:37] I'll rest in my case. [38:41] So, are there any other questions back on the automotive? [38:48] I forgot, that's where we've gone. [38:52] Yeah. [38:54] If not, I'd like to commend the planning department for doing such a fine job, because [38:59] I've been getting a lot of calls in my area, and we're slow-moving about some of these automobile [39:04] places. [39:05] is in a, I'd like to come in here for, do you want a great job on getting this together [39:09] and, like I say, putting some teeth into it so we can make some things happen. And if [39:14] anybody else will have anything to see, I'll make a motion to approve. [39:17] I think we still need a public hearing. [39:18] I always do need to close the public here and if there's no further comments, so that's [39:22] closed. [39:23] Thank you. [39:26] I'll make a motion to approve. [39:28] Thank you. [39:29] I'll motion in a second. [39:30] All those in favor, please say aye. [39:31] Aye. [39:32] I'll oppose, before we leave the public here, Mr. Anderson, do you have an answer? [39:39] I was thinking while we're still in public hearings before we all get caught. [39:43] Thank you, Councillor. [39:43] No, I do. [39:45] I was able to speak with the client, and he is, as I thought, very appreciative of that offer [39:53] with the law enforcement, absolutely no question. [39:57] He has no plans for a vape shop. [39:59] He has no plans for a gaming facility. [40:06] So your request and conditions are totally acceptable to the client. [40:13] So we need to make any changes Miss. [40:22] Well, what you want to get out of this is up to you. [40:25] I know the issue with all the drive has been discussed [40:28] at some length. [40:29] If that's something that you absolutely want to happen [40:32] and that probably needs to be in there. [40:35] And the buffer, you know, at least those aspects [40:37] of the site. [40:38] Now, the buffer is, there's already [40:40] a requirement of the zoning order. [40:42] All right, so that's not necessary. [40:44] Now, the access to West Drive, there's no problem with that. [40:47] That can be a condition without question. [40:51] There are 3 or 4 existing curb cuts on all of the drive that enter these 2 residential [41:02] lots. [41:03] The residential lots today that we're trying to reason. [41:07] Those will stay in place, but the buffer, the 25th buffer will be there to eliminate any [41:14] access. [41:14] Right. [41:16] But, yes, sir, without question, that's not a problem, no, so that's maybe a good condition. [41:21] Thank you, sir. [41:23] Yes, sir. [41:24] Anything else? [41:25] Okay. [41:26] That's it. [41:27] So it would be to change it to a conditional reason and with the conditions being no vaping [41:35] establishments, no electronic gaming, no access on our drive. [41:40] I think that was already in place, weren't it? [41:42] Correct. [41:42] The access was already in place, weren't it? [41:45] Yes, sir. [41:46] That was discussed. [41:47] That was part of our study and our development of the preliminary site plan that is attached, which is absolutely not the final site plan. [41:56] All the drive is the one behind it, right? [41:58] That's the resident you drive, that's Chris. [42:00] That's the one you don't want to access. [42:02] Yeah, that's some of the concerns of the residents. [42:06] I'm still not quite clear why we want that as a condition. [42:10] I'm not talking about less drive, that's. [42:11] No, we're talking to head talk one time about coming off a west drive and going in behind [42:16] Burger King using this and it's going to you. [42:18] Is that okay? [42:19] Yeah. [42:20] Okay. [42:20] So west drive is okay. [42:22] We don't need to prohibit that. [42:23] No. [42:24] No, no, no. [42:24] Okay. [42:25] But that was just concerns about a large traffic going down in all of driving. [42:28] And we're doing all have any condition, any concerns over limiting or excluding access to [42:35] all of drive. [42:41] and no access on all the drive. [42:43] Yes, sir. [42:44] Okay. [42:45] That would be the motion to approve as a conditional zone [42:48] or with those conditions. [42:49] And we're starting to point with the police before. [42:52] Yeah. [42:52] I think we're on the right. [42:53] Okay. [42:53] He was excited. [42:55] He was excited about that. [42:57] That's not a condition, right? [42:59] That's just okay. [43:01] That's not really a condition, but I think they work with them. [43:03] Yeah. [43:03] That's to their benefit. [43:05] Yeah. [43:05] That a bit of. [43:06] I didn't want to trust passing signs. [43:08] I can take that off. [43:10] They're going to have to have their trespassions and give the law enforcement [43:14] authorization to do what they need to do. I think that's part of the process [43:22] for my understanding. So we're going to convert it. We're going to convert it [43:28] to a conditional rezoning with no vape shops, no electronic gaming and no access [43:34] us to all of drive. Right. Okay. I got it. Thank you so much. So what we can do, um, once they submit, [43:42] since this is all on record, um, I think can we go ahead and approve it that way? And then they [43:47] just submit us the application. I'll go ahead and write it up that way. I mean, my thinking on that is [43:51] the public has been aware of the rezone request and all you're doing is scaling it back. Yeah. [44:02] I'm [44:02] make a motion to approve of the public hearing from earlier okay close to [44:06] public hearing I'll make a make a motion to approve with the added terms that [44:14] we just added as far as the interests and as a motion the second is all in [44:21] favor thank you thank you that's all the public hearing thank you so much for [44:31] We're doing this little two step for the project. [44:35] Appreciate you having a great time. [44:37] Thanks, sir. [44:41] Kim, Mayor, so we just need the clerk to. [44:45] Mayor, can I make one comment? [44:47] Yes, sir. [44:49] As it involves Dr. Kerstner in that, and what we just talked [44:54] about, the no trespassing sign, no lawtering sign. [44:57] Any business that needs to be done. [45:00] Always have something of that nature in order for our police department to respond when there's a situation like the hobby lobby or something like that. It's just one to ask you why you're here. I know it's not pertinent to that, but I didn't cast a question. I'm sorry. If the likes the money hobby lobby, they've got a problem. Somebody's homeless or un sheltered or somebody's there. The landlord or somebody needs to have a no trespassing agreement or some kind of no ordering signs. [45:29] in order for our police department to come on their private property to enforce. [45:33] Right. [45:33] Is that not correct? [45:34] That is correct, yes. [45:35] And I wish that more of our people in Lumberton would recognize that because that [45:40] gets to be a problem thinking that we can just go on private property and do something [45:45] about it without sign documentation from the landlord and the person running the business. [45:51] Right, that's correct. [45:51] I wish we could advertise that a little bit. [45:54] Maybe I'll put up the information. [45:55] I don't know if you guys know who I am. [45:57] Those forms are available to the police department or our office. [46:03] Thank you. [46:05] Madam [46:09] Clerk, would you like to... [46:11] I'm sorry, is there a motion approved? [46:13] Consent agenda? [46:14] Yes, as written in... [46:16] 18 page document. [46:18] Thank you. [46:20] I'll unpack. [46:21] Hi. [46:23] Sadie Miss Lee. [46:30] Well, the next presenter is Linda Adams. [46:52] The first item I have is for lead service line inventory amendment number four. [46:58] Public works is applied for and receive five grants related to the lead service inventories [47:03] of water popping as required by the U.S. EPA. [47:06] These are related to a requirement for any water service installed prior to 1986 to be inspected to verify pipe zeros on each side of the meter. [47:16] This amendment is for a current contract with the Wooten Company who has been administering the work related to the previous four phases of this project. [47:25] This amendment will allow Wooten Company to continue to perform the same administrative and field work for the newly awarded phase five part of this project. [47:33] This new amendment is for $95,000, which will be paid for out of the DWI grant, which was for $1 million. [47:45] Public Works recommends Council approval for the contract for amendment 4 with the Wooten Company for the lead service image work project with funds being available for the recently awarded base five DWI grants. [47:57] Motion to approve. [47:57] I have a motion on a second. All those in favor, please say aye. [48:01] All opposed. [48:03] Yes, have it for you may continue. [48:06] Next item I have is for high service pump motor purchase. [48:11] Council has previously approved the purchase in a capital budget for a high service pump motor [48:16] for the water treatment plant with a budget of $40,000. [48:20] Well, it works staff have received a quote from American pump corporation in the amount of $38,042 [48:26] dollars and 32 cents for the sole source item. [48:31] Public Works recommends Council approval of the purchase of a spare house service pump [48:36] motor from American pump court in the amount of $38,000 and $42.32 with funds being made [48:43] available from the capital code, $6,082.20, $5860. [48:49] I have a motion and a second. All those in favor, please say aye. All opposed? [48:55] Yes, have it. You may continue. [48:57] This next one, I'm going to kind of gloss over the first part and get through. [49:03] This is a project that's been going on for close to 15 to 20 years. [49:08] Been worked on trying to get to for the Link All Road, Railroad Colbert project. [49:14] This project was originally advertised on April 26th in the Robisonian for a bid opening of May 26th. [49:22] The advertisement for the bids was also submitted to different plan rooms within the Wooten Company. [49:27] They received less than three bids, so it was re-advertised with a bid opening of June 10th, 2026 in the Lumberton Community Room. [49:36] Re-advertisement was issued to all plan holders. [49:42] There were two bids that were received, BCM Construction Management of Lumberton, North [49:47] Carolina, for a bid of $749,501, and the terror group of Lumberton for $756,000. [49:59] The bid received from BCM Construction Management was considered a non-responsible as they [50:04] the appropriate general contractor classification, the instructions to the bidder states that the bidders must have general contractor's license with one of the following classification limitations. [50:16] Highway unclassified was the main one that they lacked. [50:21] Based on that, all of the information as discussed and the attached bid recommendations from the Wooten Company, [50:30] Public Works and the Wooten Company offer no objection to the rejection of the non-responsible bid for B.C.M. Construction Management Inc. and the award of the link-all-road flood mitigation project to [50:42] Terry Group of Lumberton, North Carolina with the bid amount of $756,000. [50:49] I have a motion and a second. All those in favor, please say aye. [50:54] All opposed. I have it. You may continue. [50:58] This next item is for a leaf vac trailer purchase. [51:02] Council has previously approved the purchase of a leaf vac trailer for public work staff to [51:06] use to supplement waste management equipment within the current budget year. [51:11] The budget of the amount was for $121,000. [51:14] Public Work Staff has a quote from Joe Johnson Equipment of Charlotte, North Carolina. [51:19] This is coming from North Carolina Sheriff's Association State Contract. [51:24] Public Works recommends Council approval of this leaf vac trailer from Joe Johnson Equipment [51:29] of Charlotte, North Carolina, in the amount of $120,545 with funds being made available from [51:37] the Capitol Code, 6,780, 147, 4710. [51:42] second? Second. We have a motion and a second. All those in favor please say aye. [51:46] Aye. Aye. All opposed? Yes. [51:49] You may continue Mr. Walton. [51:51] The last item that I have is for led service line replacement and sewer improvements RFQ [52:00] award. Public Works advertised an RFQ for the led service line replacement and sewer improvements [52:06] project on 11 May 2026 with responses due Tuesday, 16 June 2026. Public Works received two [52:15] responses for the RFQ from the Wooten Company and McGill Associates. City staff have evaluated [52:22] the two proposals using the scope categories provided in RFQ and provided the following [52:27] scoring matrices. Based on the scoring matrix, Public Works recommends Council approval of [52:34] RFQ Award to the Wooten Company. [52:38] Motion to approve. [52:40] Second. [52:40] We have a motion, nine a second. [52:42] All those in favor, please say aye. [52:44] All opposed. [52:45] The ayes have it. [52:46] Thank you very much. [52:48] All right, all right. [52:49] Thank you. [52:50] Our next presenter, Dr. Kertzmann. [52:53] Thank you. [52:54] Mr. John Harper is requesting a contiguous annexation [52:58] for properties located on Linkal Road and Metal Road. [53:01] So this request consists of several properties, excuse me, several properties in approximately 395 acres. [53:10] The proposed development known to you all as link off farms is a mixed use subdivision which may include retail general commercial professional offices of school and a mix of residential uses. [53:21] We ask City Council to direct the city clerk to investigate this petition. [53:26] Thank you. [53:29] We have a motion and a second. All those in favor, please say aye. [53:33] All opposed. The ayes have it. You may continue. [53:37] The next one I have is effect effect and open it up is for a good farm. [53:43] They are requesting an annexation as well. [53:47] A continuous annexation. This property is located on metal road. [53:52] The request consists of one parcel which contains approximately 389 acres known as the Good Farms. [53:58] The proposed development is a residential subdivision. [54:02] We ask council to direct the city clerk to investigate this petition. [54:06] Thank you. [54:08] I'll put that in form of a motion. [54:10] Second. [54:11] I have a motion. [54:11] And a second. [54:12] I'll let the favor please say aye. [54:14] All opposed, you may continue. [54:17] Okay, this one, Mr. Craig Hartman, is requesting a special use permit for property located at 5207 Simmons Drive. [54:26] This permit will allow him to construct a 3600 square foot accessory structure that does not meet the requirements of Section 35185 C, [54:36] which states the ground floor area of the residential accessory building till not exceed 50% of the ground floor area of the principal building unless a special use permit is granted. [54:46] In this case, the ground floor area of the principal building is about 4,519 square feet. [54:53] And the maximum is 2,259 and a half square feet, which is over by 1,340 square feet. [55:02] We ask council to review the request, refer the petition to the July 21st planning board meeting, and [55:08] authorize the planning director to set the date of the public hearing. [55:11] Thank you. [55:12] You make a motion to send it to you playing the board second motion.
