Council, in your packet, cover report indicating uh a [7:26] request to conduct a public hearing to receive comments uh regarding the [7:29] proposed code amendments to the zoning ordinance, copy of the proposed [7:34] amendments, the ordinance itself, the house bill, and the advertisement [7:38] including the packet for review. The principal changes focus on um better [7:43] definitions, adding a for data centers, but not to be added as a use in any [7:49] zoning district in town. Like to make that clear. Uh clarify and better define [7:54] public utilities and storage warehouses. Change the off streetet out of rightway [7:58] parking space requirement for multif family housing. We discussed that [8:01] previously, altering chapter 506 uh the parking section for clarity and [8:07] uniformity. and then amending once again the chapter 517 which is u based on the [8:15] solar energy and these are state legislative changes that came down to us [8:20] that were effective July one from the general assembly and signed into law by [8:23] the governor so we really don't have much of an option we cannot be more [8:28] stringent than the state's regulations allow us to be so we're going to have to [8:33] adopt these changes planning commission held uh they did a review on June 10th [8:37] They held a public hearing on July 15th. They recommend approval to zero. And I [8:42] did not receive any comments at all this. [9:11] warehouse. [9:30] » Yeah, I believe that's the intent. a storage warehouse versus an industrial [9:34] complex or a factory or associated with a factory like say for example the door [9:39] plant there on Stony Brook. If they had a material storage wing of that building [9:45] that would be part of that industrial complex but if they had a totally [9:48] separate building but all they did was store goods in that building and then [9:52] retrieve them back and forth. Uh that's a storage warehouse that we'd like to [9:56] better find. That was one of the two that we wanted to clarify. uh because [10:01] other localities have had issues with people misinterpreting that entitle that [10:07] that definition. So we just want to be a little more [10:09] » clear. [10:30] they could lease it or portion of it such as the Wallace building where they [10:34] will lease a portion of that to two different vendors for storage inside [10:37] that structure. Uh, so since our last meeting, I did reach out to Miss Gray uh [12:01] talked to her um about a few different items. I brought up an item that was uh [12:06] suggested here uh you know, in our last meeting. I had the superintendent public [12:11] works go and take a look at that area as well as um I discussed it with chief of [12:17] police. Um the area is not real conducive to a like a turnaround. We [12:24] could build a a tea or a hammerhead turnaround there. Some of the concerns [12:29] that were raised by staff and and and reiterated by Miss Gray was that likely [12:33] that area would be used by the neighborhood for parking. They would [12:37] park vehicles or trailers in those and it would be basically [12:41] not available for turning around because they would use that as additional [12:45] parking. And so she would prefer plus her fence would have to come down the [12:48] fence that blocks through traffic down through her property. She would prefer [12:53] that the town vacated the entire rightway and therefore she got 50% and [12:59] then the adjacent owner was eligible for 50%. [13:03] But in lie of that she said if the town does not wish to vacate that um she [13:08] would hope that we would just do nothing and by do nothing not only not a [13:14] vacation but don't build the road uh through there and I I told her I said I [13:19] don't think that the town has any contemplation of building that roadway. [13:22] It's a very expensive section. I said, "So, I think the two options that are [13:27] available were listed in your staff report here is either we vacate the [13:31] entire thing or we don't vacate any of it." And uh she said she would be happy [13:37] with either of those decisions. She understands the pressures on the town um [13:41] and the fact that this has been a long time [13:44] of use, but she would like to see the town vacated and then that way she could [13:51] at least have the availability for half of that. that street, [13:57] but she has not talked to the adjacent neighbor either. We were not able to [14:01] make contactent. [14:06] Yeah, [14:09] » the house is in not great repair. We we've been after him a couple times. [14:15] I believe that that owner or that owner's representative lives now and so [14:20] we reached out to them up there, but they've not expressed [14:25] What are our next steps if the town would like to consider a vacation [14:30] public hearing not this will be notified as long as well [14:39] and then hold public hearing and then there's no adverse comment there. [14:46] » She has she's built a driveway over the years in half of this roadway and put a [14:51] storage shed there. and she as she's getting older, she [14:57] would like to make sure that area is secure for her children, her future, [15:01] whatever. And she'd just like to do it for that reason. [15:07] » I can't really see any downside. I mean, Jason and I have talked about this. You [15:11] know, once we vacate that thing, roughly half of it, 50% goes to one owner, the [15:15] other 50% goes to the other owner, and the town has no responsibility there. We [15:19] still maintain our uh you know easements through there access way through there [15:24] for like bur utilities and things like that but uh it would be basically you [15:30] know relinquished to those two property owners. [15:35] Well maybe uh you know if they choose not to uh survey it into their property [15:40] and they just kind of let hang out there it wouldn't be part of the real estate. [15:47] She would have to obtain a quick claim deed from that adjacent owner to get his [15:52] hat and she can do that. If you remember, we did a similar activity over [15:57] here in South Alley with 15 camel street where we did a quick clean because it [16:02] abunded our property and we were able to obtain that. But as far as we're concerned, [17:34] it's only whether we vacate it or we don't vacate it. uh we don't really what [17:38] arrangements the two property owners work out in the future is really on them [17:42] and but yeah I agree with you that access point is important for that [17:47] adjacent property and so but maybe they're able to work out something in [17:51] the future [18:07] and half. Um, it is a new [21:14] document and so Brian and I both felt it to give council opportunity to review [21:20] this policy and weigh in on it. Um the council I'm sorry the uh town does not [21:25] currently have a formal policy in place but current practices include adherence [21:30] to adherence to all internal controls policies and audit standards. The [21:35] establishment of the written policy will further define the regulation and [21:39] oversight of the town's purchasing cards and their keeping. Um the institution of [21:45] the policy provides for further efficiency and accuracy and record [21:49] keeping reconciliation and the payment process. Um you may choose to review the [21:56] policy tonight and act on it. Um and if you would like to make any comments to [22:02] future we're happy to hear those as well.
