So, a lot of this BLM land that was sold [3:19] um and things that are going on are really uh in ja- it it it's it's a shame [3:27] with the mega solar panels and everything that's happened it um [3:33] within um Kimberly Dow's [3:37] uh area of [3:40] of being able to, you know, to sell this land and do things um [3:46] is way out of line because these other [3:50] individuals were not on staff. And we also didn't have a [3:55] uh Nevada uh uh [4:01] Sorry. [4:08] The the the the general uh the Nevada well [4:25] engineer, the state engineer. Um and then the uh [4:31] we didn't have we and we didn't have the other uh individuals that I mentioned uh [4:37] yesterday uh that were uh um in and out and were [4:42] temporary and um that's uh vis- Vision [4:46] Gunderson Cruz and um he's with the natural resource conservation [4:52] uh and he's the executive director also for [4:56] the Nevada Association of Counties. Um [5:01] and uh we didn't have uh [5:09] We didn't We didn't have Joe Capacero Capacero the state engineer was also [5:18] um vacant and interim people that were um not [5:23] up to speed on what was going on. County Manager Andrew Askin. [6:38] » Good morning. Andrew Askin, Linn County Manager, for the record. Um if just a [6:43] second, we'll get the um get the PowerPoint up. Just to start [6:47] off, uh um I I didn't include a lot of the [6:50] background information in the presentation just because this board has [6:53] heard uh all of this and been a part of this [6:56] process for the last year, um and so I didn't feel that we needed to do that, [7:02] but if there are any questions about the process or how we got there, I'd be [7:05] happy to um happy to explain it. Next slide, please. [7:09] So, um this is just kind of following up Actually, I meant to take this slide [7:14] out, too. But, on May 15th of last year, the board [7:18] approved a resolution to initiate the formation of the North Linn Power um [7:23] General Improvement District. Um and we have been conducting due [7:27] diligence ever since. The next step in that process is to approve the service [7:31] plan. Um and so [7:37] there are a few requirements um in laid out in ORS 308 that uh [7:44] um the service plan must have it must have a financial survey and a [7:47] preliminary engineering architectural survey showing how the proposed services [7:51] are to be provided and financed. A map of the proposed district [7:55] boundaries, an estimate of the population and assessed valuation of the [7:59] proposed district, description of the facilities to be constructed and the [8:03] standards of such construction, description of the services to be [8:06] provided by the district and an estimate of the cost including the cost of [8:10] acquiring land, engineering services, legal services, proposed indebtedness, [8:14] and any other proposed bonds and any other securities to be issued, annual [8:18] operation and maintenance expenses, and other major expenses related to the [8:23] formation and operation of the district. Um, [8:25] um, all of those elements have been included [8:29] in the service plan that is presented before you today and and was included as [8:34] backup in the packet. [8:38] Um, so, approval of the service plan, as I [8:41] mentioned before, is required before the formation of the district. The service [8:45] plan is incorporated by reference in the organizing ordinance. Uh, [8:49] um, the facility services and financial [8:53] arrangements of the district's district has to conform to the approved service [8:58] plan. So, um, [9:01] the district cannot deviate substantially from what is in the [9:04] service plan, which means that at some point it probably will have to be [9:07] modified um, you know, as this project gets further down the road, but uh um, [9:13] for now we feel that the service plan that is presented today is a good [9:16] starting point and will um, help kick things off. [9:25] Just wanted to touch a little bit on the process for the service plan. It's been [9:29] uh kind of a long road. Uh, [9:31] we uh worked with the developer to draft the service plan. Actually, I think they [9:35] did the heavy lift on the first draft and then we went through it as staff and [9:39] uh um, made some edits and changed some stuff [9:42] in the service plan to conform with state law. [9:45] Um and then we began this process. So [9:50] the service plan was filed with the clerk 10 days prior to a Board of County [9:54] Commissioners meeting which we then agendized for the Board of County [9:58] Commissioners meeting to set this hearing today. [10:01] Um that had to be done within 30 days. So [10:05] we had to do written and legal notice and provide notice to the public. That [10:09] was completed. We had to put it in three separate [10:12] newspapers three different times in order to to do legal notice on this. [10:19] Um the service plan had to be delivered to [10:22] the planning commission. I made a presentation to the planning commission [10:25] yesterday and they appointed me as the representative to make a recommendation [10:29] to you this morning. Um and then from here [10:34] depending on the outcome of this hearing, there's a [10:38] 20-day period we'll have to notice the interested parties of the action and [10:44] then there's a three-week process after that. [10:48] A three-week period after that. So next I'm just going to touch on some [10:52] of the highlights within the service plan. [10:55] Um these are following kind of those requirements [10:58] that are supposed to be in a service plan. Those [11:01] required areas that are supposed to be in a service plan. The first is the [11:05] statutory authority. It's being created under NRS 308 and [11:08] 318. The district boundaries include all of [11:12] Northern Nevada Industrial Center. You can see on the map that [11:16] is included as part of the exhibits. Northern Nevada Industrial Center is [11:20] just south of the city of Fernley city of Fernley. [11:25] Their city limits up USA Parkway north of Silver Springs, so. [11:33] Um the financial survey all infrastructure uh build out and [11:37] construction activities will be fully funded and securitized through private [11:40] development commitments. The district will not finance any development [11:44] activity within the district boundaries, so. [11:49] Uh the district's creation meets the public convenience and necessity [11:53] requirements of NRS 318.055 subsection 4C1. [12:01] Uh currently there is no electric service in in an IC and the district [12:05] will provide an avenue for such electric service because creation of the district [12:09] is anticipated to allow for electric energy service on a timeline years ahead [12:14] of any commercially reasonable alternative creation of the district [12:17] will serve the public convenience and necessity. [12:22] I apologize that this is so small and the backup it it's a it's a fairly big [12:27] sheet but this is the preliminary engineering [12:30] and architectural survey. The district is not proposed to own um [12:37] and operate most of the facilities. So it's a it's a little bit of a a [12:41] different scenario that the NRS didn't necessarily contemplate. [12:46] Um typically if you were building a power plant for example, you would have [12:50] all those engineering reports and everything but since the district itself [12:54] is not doing that and contracting that out there's no need for for those types [12:58] of plans in the service plan. Um [13:02] So this is just kind of a preliminary layout of of the different facilities. [13:08] Um again they may change at some point and we'll bring back a an updated [13:12] service plan when things are a little bit more final and stuff like that. [13:18] Uh population and assessed valuation, currently there's no residents within [13:22] the district and the assessed valuation at the moment is about 1.6 million [13:28] dollars. It's projected to be 279 million by [13:31] 2031. Obviously, that is dependent on [13:36] attracting some development in the area. But, that is the the current projection. [13:44] The economic soundness and feasibility, the proposed district is economically [13:48] sound and financially feasible based upon demand for electric service, the [13:52] proposed privately financed service model secured and executed through [13:56] enforceable contractual arrangements sufficient to support the development, [14:01] operation, and maintenance of the proposed facilities. [14:04] So, electric infrastructure will be [14:07] constructed only when required and financed by the beneficial user of that [14:13] infrastructure through long-term energy supply agreements. So, the district is [14:17] not going to pre-act proactively build this. They'll have to have um [14:22] agreements in place prior to construction of any any facilities. And [14:27] when I say the district, I am also talking in in those terms as a [14:33] part of that third-party uh provider. So, the contractor for the the [14:40] power generation, um they're they're not going to build [14:43] anything until after uh agreements are in place as well. [14:48] Um the beneficial users of infrastructure [14:52] will be evaluated for creditworthiness prior to execution of any such agreement [14:56] and may be required to post financial security instruments to cover all the [15:00] costs. [15:03] And the district's facilities and operations will be financed I've already [15:06] covered this, but will be financed entirely through private capital [15:09] provided by primary generation partners and other development partners. No ad [15:14] valorem taxes, general obligation debt, or financial support from Line County or [15:18] any other governmental entity will be required. [15:23] This next slide is the findings for service plan [15:27] and NRS it's written a little bit different in that these are the findings [15:30] for denial of the service plan and so you have kind of have to think about [15:34] them backwards a little bit. But it says each [15:37] Board of County Commissioners may disapprove the service plan of a [15:41] proposed special district upon satisfactory evidence that A, there is [15:45] insufficient existing and projected need for the organized service in the area to [15:50] be serviced by the proposed district. B, the existing service in the area to be [15:54] served by the proposed district is adequate for present and projected [15:58] needs. C, adequate service is or will be [16:01] available to the area through municipal annexation by other existing municipal [16:07] or quasi municipal corporations within a reasonable time and on a comparable [16:12] basis. D, the proposed special district is [16:16] incapable of providing economic and sufficient service to the area within [16:21] its proposed boundaries. E, the area to be included in the proposed district [16:25] does not have or will not have the financial ability to discharge the [16:29] proposed indebtedness, other securities, or other obligations to be incurred or [16:35] on a reasonable basis. F, the facility is [16:41] facility and service standards of the proposed district are incompatible with [16:45] the facility and service standards of adjacent municipalities and special [16:49] districts or G, the proposed district is being formed for the primary purpose of [16:54] financing the cost of developing private property. [16:57] Um each of these is covered at some point [17:00] in that service plan. I do want to also point out that that [17:06] yesterday the Board of the Planning Commission [17:09] um voted [17:11] to unanimous unanimously there are two vacancies so it was a 5-0 vote [17:16] to recommend approval to the board. [17:20] I'm I'm happy to answer any questions. I went through that really fast, but uh [17:24] » I have one question. >> Sure. Go ahead, Commissioner Hendrix. If it's within [19:32] 7 miles of of the city or within the boundaries of [19:36] the city limits, they have to have to approve that as well. [19:42] Any other questions? Commissioner Jackson. [19:46] Thanks, chair. Um [19:49] I think everybody knows my stance on insurance. [19:54] I'm not a huge fan of it. Not that I don't think you should have [19:58] it, but in the insurance section on page 16 [20:04] to maintain commercial commercially reasonable insurance coverage [20:09] appropriate to their activities. Commercially reasonable insurance [20:15] what does that mean? What is uh [20:20] What are the guidelines on that or >> Yeah, good morning, Commissioner Bob [20:24] Sweeten, counsel for the project. Commissioner, good question. [20:29] The reason we use the term commercially reasonable is that the insurance [20:33] on these types of projects that would obviously have to have to not only cover [20:37] potential harm and loss like a typical policy would, but there could be [20:40] components related to the way the projects are financed so that the county [20:45] doesn't assume any fiscal liability at all. There could be forms of performance [20:49] bonds. I would say the market for these types [20:53] of large infrastructure facilities are dynamic including within the energy. So, [20:58] the forms in which then the the financial instruments that [21:02] might be used to cover build out, but also to restore and [21:06] protect the county could come from a variety mechanisms. [21:10] Uh commercially reasonable in all cases would mean that the county is in uh [21:15] completely indemnified from any harm. And and that is in the another part of [21:20] the service plan. >> Okay. [21:23] Thank you. I'm sorry. [21:26] Okay. Dry [21:28] bloody nose season. >> I agree with that. [21:32] » So, I need some insurance from another company. [21:34] » Um So, with that [21:37] I I can only imagine that insurance companies are absolutely dying to get [21:42] their claws into something like this. Monitors or [21:48] besides what is commercially reasonable, I guess. Is that you as the developer of [21:54] the project, is that the county's [21:56] responsibility? >> No, yeah. That that would be through the [21:59] the oversight of the district board, which at this point it's proposed that [22:03] that would be the the VCC, which would be the board. Yeah. So, you would the [22:08] board would have insight into what those agreements are and whether or not it is [22:11] commercially reasonable. >> Gotcha. All right. Thank you. [25:10] Whereas on May 15th, 2025, the Board of County Commissioners BOCC approved the [25:15] resolution to initiate the formation of the North Lyon Power General Improvement [25:19] District and directed staff to draft a service plan for the General Improvement [25:24] District. Whereas the service plan for the North Lyon County Power District has [25:28] been attached as an appendix to this resolution as exhibit A and incorporated [25:33] herein by reference. And whereas the Lyon County Planning Commission reviewed [25:37] the service plan at their May 12th, 2026 meeting and voted to recommend approval [25:42] of the service plan to the Board of County Commissioners and appointed the [25:45] County Manager as their representative to make a presentation to the Board of [25:48] County Commissioners. And whereas the Board of County Commissioners [25:53] pursuant to NRS 308 has set May 13th, 2026 as the hearing date to review the [25:59] service plan for the North Lyon Power General Improvement District. Now, [26:03] therefore, be it resolved by the Lyon County Board of [26:06] Commissioners that the service plan for the North Lyon County Power District [26:11] meets the requirements set forth in NRS 308 and is hereby approved. So you got chapter 308 and 318. They both work [28:57] together but they have different information in them. [29:01] And so and and honestly we debated on whether or not there was two ordinances [29:06] required or not but in reading the the law it's pretty clear that [29:11] that there is. And so this is the initiating ordinance there will be a [29:16] organizing ordinance or creation ordinance [29:19] at a later date. The initiating ordinance essentially sets the hearing [29:23] date for the organizing ordinance. But it also lays out what what the [29:29] boundaries of the district are, what the name of the district will be and [29:35] and what the what the considerations will be [29:41] by the board as laid out in the NRS. I'll read those considerations really [29:45] quick. This by the way I so today is it's like [29:50] a standard ordinance where today we would be looking for a proposal [29:54] and then I would be bringing it back for adoption [29:57] after we notice it in the newspaper and all of that. [30:02] There will I I already know there's going to have [30:05] to be one change because as Commissioner Hendricks pointed out this this is the [30:08] one that has the wrong map in it. I apologize I grabbed the wrong map when I [30:12] did it. And so the map that was in the service [30:15] plan is the correct one so [30:18] I would ask that if the board chooses to propose this today that that be part of [30:23] that that we propose it with that change with the correct map. And I will double [30:28] check the legal boundary as well or the legal description. I believe the legal [30:31] description matches the map in the service plan but we will double check on [30:36] it. [30:39] So this basically sets the hearing date for the [30:43] um organizing ordinance or the creation [30:46] ordinance for July 2nd, uh 2026 at 9:00 a.m. here in the commission [30:51] chambers. And um [30:55] it provides information so any person who owns property which is located [30:58] within the district may on or before the date of the hearing listed above protest [31:03] against the the establishment of the district in writing. [33:29] This will not because it is a GID, it will not be regulated by the PUC and so [33:33] any expansion, just like this process, I mean, we we did go to the PUC and [33:38] discuss it with them to make sure that, you know, there were no issues or [33:42] concerns. But there weren't. So, if there is an expansion, it would be done [33:47] just like we're creating the district today. There would be a similar process [33:52] that as Andrew uh stated is laid out in statute. We would just come back before [33:56] the board sitting as the county commission to [33:59] get that expansion approved. >> The only place that I can [34:02] » The service plan would be amended in that case. People are so confused. They all argue there's only one lever going in [39:57] north of Yerington, but there's that other one and then we It's all about the [40:01] water.
