[0:44] Good evening. Welcome to the board of [0:46] commissioners regular meeting. Today is [0:48] Wednesday, August 12th, 2026. It is 6:01 [0:52] p.m. City attorney, would you please [0:54] lead us in the invocation and pledge of [0:56] allegiance? [0:57] >> Sure. [0:59] » Sure. [0:59] Our heavenly father, we meet to serve [1:00] our community, to use our resources [1:02] wisely and well, to represent all [1:04] members of our community fairly, and to [1:06] make decisions that promote the common [1:08] good. We recognize our responsibility to [1:11] the past and the future, as well as the [1:12] rights and needs of both individuals and [1:14] our community. As trusted servants, we [1:17] seek blessings on our deliberations this [1:19] evening. This we pray. Amen. [1:23] I pledge allegiance to the flag of the [1:25] United States of America and to the [1:28] republic for which it stands, one nation [1:31] under God, indivisible, with liberty and [1:34] justice for all. Public participation [2:29] is encouraged. If you are addressing the [2:32] commission, step to the podium and state [2:34] your name and address for the record and [2:37] the organization or group you represent. [2:39] Please limit your comments to five [2:41] minutes and do not include any topic on [2:44] the agenda. Public comment on agenda [2:46] items will be allowed when they come up. [2:49] If you would like someone at the city to [2:51] follow up on a comment or question made [2:53] at the meeting, you may fill out a [2:55] comment card with the contact [2:56] information and give it to the city [2:58] manager. Comment cards are available at [3:01] the back table in the commission [3:03] chambers. Completing a comment card is [3:06] not mandatory. [3:07] For any quasi judicial public hearings [3:10] that might be on the agenda, an affected [3:13] person may become a party to a quasi [3:15] judicial proceeding and can be entitled [3:17] to present evidence at the hearing, [3:20] including the sworn testimony of [3:22] witnesses and relevant exhibits and [3:25] other documentary evidence and to [3:27] cross-examine all witnesses by filing a [3:30] notice of intent to be a party with the [3:32] community development director not less [3:34] than 5 days prior to the hearing. Do we [3:37] have any public comment? [3:44] » Hi, Bob Bellow 13301 Golf Lane. Um, I [3:47] apologize if I missed any announcements [3:50] and this is redundant, but I'd like to [3:52] recognize Megan and public works team [3:53] and thank them for their continued work [3:55] with Duke Energy on the undergrounding [3:57] project. Um, as a resident, it's [4:00] exciting to start to see some tangible [4:03] progress. We understand that [4:05] coordinating with Duke has been a [4:06] challenge and the project has [4:08] experienced delays, but recently we've [4:10] seen crews out. They've contacted some [4:13] of the residents such as myself um [4:15] marking sites about two weeks ago. I [4:18] understand there's another round of them [4:21] coming out and doing some site visits [4:23] again probably next week in plan [4:25] preparation for phase one of the storm [4:27] damage repairs. So publicly would like [4:30] to say thank you to Megan and everyone [4:31] else involved for their persistence and [4:33] hard work in moving this project [4:34] forward. Thank you. [4:37] >> Thank you. Do we have any additional [4:39] » Thank you. Do we have any additional [4:39] public comment? [4:41] With no additional public comment, we [4:43] will move move on to the approval of the [4:45] minutes. If the commission has had the [4:48] opportunity to review the minutes and [4:50] there are no changes, do we have a [4:52] commission or do we have a [4:56] motion? [4:58] >> My brain is thinking about something [4:59] » My brain is thinking about something [4:59] else. [5:00] >> Yes. [5:01] » Yes. [5:01] >> I make a motion to approve the minutes. Any member [5:25] of the board of commissioners can ask to [5:27] pull a consent item for separate [5:29] discussion and vote. I will read the [5:31] items. A ITB number 26-04 [5:36] storm water backflow prevention project. [5:39] B. Disaster Debris Management [5:42] Participation Agreement with DRC. [5:45] C. Amendment to RFP number 26-05, [5:50] Marina Seaw Wall replacement number two [5:53] to include 129th Avenue Area 5 seaw wall [5:57] replacement and D interlocal agreement [5:59] with Pineellis County posttorm recovery [6:02] services within geographic Pineellis [6:04] County. [6:08] Madam Mayor, I would like to pull item [6:11] A. Okay. [6:14] >> Any additional comments on the consent [6:17] » Any additional comments on the consent [6:17] agenda? [6:44] >> The [clears throat] motion carried 5 to [6:46] » The [clears throat] motion carried 5 to [6:46] zero. Next on the agenda then will be [6:48] item A, ITB number 2604, storm water [6:52] backflow prevention project. [6:56] Commissioner Go. [6:59] Um, we discussed this at the um, [7:02] previous [clears throat] uh, workshop [7:03] and I'm just not in favor of it and I my [7:06] vote will not be yes. [7:09] >> So, Megan, I think you have something to [7:11] » So, Megan, I think you have something to [7:11] show us. [7:12] >> Tom, can you pause that for a second? [7:16] » Tom, can you pause that for a second? [7:16] >> Thank you. So, I do have a video that is [7:19] » Thank you. So, I do have a video that is [7:19] up on the screens for you all to see. [7:21] This is the valves that we would be [7:23] installing. So, this video is going to [7:25] show you the installation. Actually, go [7:28] ahead and play it, Tom, and I'll walk [7:29] you through. So, this is a storm drain. [7:33] This is the valve that goes inside the [7:35] storm drain. It gets mounted at the [7:38] outfall. The black that you see, that is [7:41] a rubber gasket. So, what you're seeing [7:44] now is the water like if there's a rain [7:46] event. So, that's emptying out into the [7:49] bay. What you're going to see coming now [7:52] would be the tide coming up. [7:56] So that'll show you that as long as that [7:58] valve and that gasket is closed, the [8:01] water is not able to enter back into the [8:03] pipe. Now the pipe filling up is if [8:05] there's a rain event at the same time. [8:08] So this is if there is a title event [8:11] with a rain event and there's not enough [8:13] pressure from the roadway to push that [8:16] gasket open, it is then going to cause [8:19] some minor issues on the roadway with [8:21] flooding. But once once that tide goes [8:25] down, you'll see that that valve opened [8:27] up and was allowed able to empty the [8:30] roadway. So I just thought it was really [8:32] important for you all to see how that [8:33] works. Obviously [8:36] issues that we have had in the past [8:39] would be if there is any type of debris [8:41] that gets stuck within that gasket. We [8:44] have had issues in certain areas. We do [8:46] have these in Boca. We have them in [8:49] 137th Avenue Circle. And then we did [8:52] have one on Puit Drive, but we upsized [8:54] that pipe. So, this project would put [8:57] another valve in that location because [8:59] it is extremely low. [9:02] At the beginning, whenever we first [9:04] received these valves back in 2017, we [9:06] had a big education push that we did [9:09] that helped tremendously with the [9:11] residents. So residents that don't hold [9:13] their landscaping debris in their yards [9:17] and ones that are particularly right at [9:19] the inlets typically are the issue. But [9:23] with the landscape ordinance that Joe is [9:25] working on and Marcy's team, that'll [9:27] help tremendously. But what you've all [9:30] seen, and I'm not sure if anyone has [9:31] driven around, that the title events [9:33] that we've had in the last couple weeks [9:35] in the areas where we do have the [9:37] valves, the water did not did not [9:40] overtake the roadway. Was it in the curb [9:42] line? Probably because water will find [9:44] the path of least resistance. It's not [9:46] going to 100% stop the water, but it [9:49] will slow it down enough to where it [9:50] will not cover the roadway. So this is [9:53] an option that the residents have asked [9:55] us to re to try to you know alleviate. [9:59] This is the best solution for what we [10:02] currently have in place until we start [10:04] being more resilient and raising [10:06] roadways. [10:09] » Do we have any public comment? [10:13] Commissioners, do you have any comments [10:14] or questions? [10:18] » I just appreciate that. It helps me to [10:20] understand. [10:21] >> Absolutely. Oh, that's great that [10:22] » Absolutely. Oh, that's great that [10:22] visual. Thank you. [10:23] >> You're welcome. [10:23] » You're welcome. [10:23] >> The issue in my mind when the water [10:25] » The issue in my mind when the water [10:25] comes up, it basically shuts the flapper [10:28] valve and does not allow the water from [10:30] the street to get to the bay and that [10:33] builds up. [10:35] Until that water goes down in the bay, [10:39] that valve will be shut. [10:42] So, I I'm not in favor of it. I'm sorry. [10:45] >> So, then I have a question [10:48] » So, then I have a question [10:48] to play off of the commissioner's [10:50] comments. [10:51] So if the water in the bay is here and [10:55] the wa and we have a so we have a flood [10:57] and a rain event no water's going [11:00] anywhere. [11:01] >> That is correct without the valve. [11:03] » That is correct without the valve. [11:03] >> So without the valve there if it was [11:05] » So without the valve there if it was [11:05] just open when the bay rises the water [11:08] is going to come up in the pipe and it's [11:10] going to flood the street even if [11:11] there's not a water event. [11:13] >> That is correct. But if the if the valve [11:15] » That is correct. But if the if the valve [11:16] is there and the bay rises and it's not [11:19] raining, then the water the valve is [11:22] going to stay closed and the water is [11:23] not going to go on the road. [11:24] >> Correct. [11:25] » Correct. [11:25] >> Correct. [11:25] » Correct. [11:25] >> Yes. [11:25] » Yes. [11:26] >> So [11:28] » So [11:28] >> the the top of the inlet is typically [11:31] » the the top of the inlet is typically [11:31] I'm going to say maybe a couple of [11:33] inches below the seaw wall. [11:36] So, you know, the the water basically I [11:41] if [11:43] you know, if it rises, it'll go through [11:45] the seaw wall and it'll flood the the [11:48] streets. [11:49] >> 90% of our issues with localized roadway [11:52] » 90% of our issues with localized roadway [11:52] flooding is due to tidal events. [11:55] >> Yeah. Yes, we do have shortterm if if [11:59] » Yeah. Yes, we do have shortterm if if [11:59] the tide is low, we do have shortterm [12:03] localized flooding because the system [12:05] may need a minute to catch up, [12:06] especially in areas where pipes are way [12:08] under sized. [12:10] But along 140th, prime example, if you [12:13] are a few days ago in the the the tide [12:17] that we had at a 3-foot and even along [12:18] North Bay Shore in certain sections, [12:21] >> there is water in the road to where you [12:23] » there is water in the road to where you [12:23] can barely pass one lane. Yeah, the the [12:27] water basically has to go through the [12:28] pipe. It'll come up through if the inlet [12:32] is low. The water obviously will be [12:36] flooding. [12:37] >> All of our inlets are low along with our [12:40] » All of our inlets are low along with our [12:40] roads. [12:41] >> They're all very low. I would say [12:43] » They're all very low. I would say [12:44] >> what happens to the rain when you know [12:45] » what happens to the rain when you know [12:45] when it's raining. So the the valve is [12:48] shut, the water is all the way to the [12:50] top of the grate and and you have a [12:53] rainfall [12:54] >> right now. Currently with no valve, the [12:56] » right now. Currently with no valve, the [12:56] water is not going to go anywhere until [12:57] the tide goes down. [12:59] >> Same as what it would do currently. So [13:01] » Same as what it would do currently. So [13:01] if there's not enough pressure in the [13:03] roadway without a valve, [13:05] >> you will see here and you and I receive [13:07] » you will see here and you and I receive [13:07] several calls if we have a high tide and [13:09] a rain event. [13:11] >> Without any valves, our roadways will [13:13] » Without any valves, our roadways will [13:13] flood. [13:14] >> So really, it's not too much different. [13:15] » So really, it's not too much different. [13:16] You just need a little bit more pressure [13:17] with a valve. [13:19] >> Okay. You'll be driving through fresh [13:21] » Okay. You'll be driving through fresh [13:22] water as opposed to salt water. Correct. [13:24] >> Which is helps the vehicles. Um, how [13:27] » Which is helps the vehicles. Um, how [13:27] many valves? This is this is one thing. [13:31] We've got some valves in place. We've [13:33] got this thing for more valves. How many [13:36] more valves do you see, you know, that [13:40] we could need as a city? this project [13:44] when I was building it out and going out [13:46] for bid and working on budgeting I [13:49] budgeted for to be able to do 13 13 [13:52] valves throughout the city with just [13:55] this project in place now we have seven [13:59] in Bokea and we have three along 137th. [14:04] So then kind of my question is I guess [14:06] is in terms of do you foresee I I have a [14:10] good idea this is going to work very [14:12] well. Do you think we need another 10 20 [14:17] or I mean you or is this too much [14:19] speculation? [14:21] >> I think that we could go for more [14:22] » I think that we could go for more [14:22] funding next year. I think we need to [14:24] look at our capital improvement plan [14:26] because we don't want to buy valves for [14:28] small pipes if that's our next project [14:30] area. So the valves that are within this [14:33] project, we have mostly anywhere from 12 [14:36] in to 15in pipes and then there's a few [14:39] 18-in. So those those valves can move if [14:42] that's like within the next project [14:44] area. So even if it is in a project area [14:46] within the next 2 years, we can then [14:49] move it to say East Madiraa Avenue who [14:52] is a little bit further out on our CIP [14:54] schedule. [14:57] >> So the valves are removable. [14:59] » So the valves are removable. [14:59] >> Yes, absolutely. Thank you. [15:02] » Yes, absolutely. Thank you. [15:02] >> Okay, I have uh just a couple quick [15:04] » Okay, I have uh just a couple quick [15:04] questions. Uh [15:08] these [15:11] uh valves will help with the nuisance [15:14] flooding, right? Correct. [15:16] >> The title flooding. Yes. [15:17] » The title flooding. Yes. [15:17] >> Yes. The nuisance flooding. And we also [15:20] » Yes. The nuisance flooding. And we also [15:20] were awarded a a grant of $100,000. [15:23] >> That is correct. We have a grant from FD [15:25] » That is correct. We have a grant from FD [15:25] for $100,000 and we are matching that [15:27] $100,000. So, total of $200,000 project. [15:32] >> Awesome. And you said um the maintenance [15:36] » Awesome. And you said um the maintenance [15:36] on these valves is quarterly. [15:38] >> We do maintenance on them quarterly. [15:39] » We do maintenance on them quarterly. [15:39] That is correct. So, we have a system [15:41] 4Erunner. The planning and zoning [15:43] department also uses 4Runner. So, we [15:45] have all this information in one [15:47] program. We then document the cleaning [15:50] of those and we are working with 4Runner [15:52] to be able to make sure that we schedule [15:54] those out so we make sure that we're [15:55] hitting them quarterly. We probably do [15:59] clean them more often and if we notice [16:01] that there's an issue, the guys will [16:03] jump in and check it immediately. [16:05] >> Yeah. Thank you for uh [16:08] » Yeah. Thank you for uh [16:08] the tour you gave me for where the [16:09] valves were going to be located. And um [16:12] also [16:15] what is the uh and we had talked about [16:17] that. What is the number uh what's a [16:19] couple of things that really stop the [16:22] valves from working? [16:24] >> Mulch, everyone's favorite. Uh we love [16:27] » Mulch, everyone's favorite. Uh we love [16:27] the mulch we have. Um in the Bokeh [16:30] neighborhood, there is a lot of [16:31] residents who have rock and shell that [16:34] are right all the way up to the curb [16:36] line. They do not have any barriers to [16:39] hold in the landscaping material. So I [16:42] know that Joe asked me about that one. [16:44] So that was made sure to put into the [16:45] new ordinance. Um landscaping debris. I [16:49] know it's amazing, but may a lot of [16:52] people put their piles of brush directly [16:55] on top of the storm drain grates. So, [16:57] that is something that is a big problem. [17:00] So, it it's it's really based upon like [17:03] area. So, 137th, I honestly do not have [17:06] issues, knock on wood, with those [17:08] valves. Bokeh was a big adjustment with [17:11] the landscaping and and educating the [17:14] residents. Basically, we can only clean [17:16] them so often. help us help you. Please [17:19] ensure you keep all your debris [17:21] maintained. If something gets in between [17:23] that valve, as you have you seen, it [17:25] can't close. So, if it can't close and [17:28] it can't stop the water and that was one [17:30] of the major issues. We also found that [17:32] making sure that you hydraulically seal [17:34] around that valve is a big big big [17:37] proponent. So, we that's why we're going [17:39] through this project the way that we [17:41] are. [17:42] >> So, if there barnacles build up, how do [17:44] » So, if there barnacles build up, how do [17:44] you remove the barnacles? same way you [17:47] do a pipe, but the barnacles, knock on [17:48] wood, don't really secure to the the [17:51] rubber. So, mostly the what's what you [17:54] see is exposed is if they do grow, they [17:56] grow on the exterior of it, which [17:58] doesn't affect the valve, but cleaning [18:00] them and have a ma a maintenance [18:02] schedule really helps with that. [18:04] >> Thank you. [18:05] » Thank you. [18:05] >> Thank you. [18:06] » Thank you. [18:06] >> You're welcome. Okay. If we have nothing [18:07] » You're welcome. Okay. If we have nothing [18:07] further, do we have a motion? [23:44] » It is under recreation. [23:44] >> I don't believe that. I believe that um [23:47] » I don't believe that. [23:55] » They had not um processed all theirs. [23:55] So, we're going to approve to provided [23:58] we vote yes. Um this is the first [24:00] reading to approve the changes that [24:02] we've been brought so far. And there [24:03] will be additional changes that will [24:05] come from, I believe, community [24:07] development as well as recreation in a [24:09] future workshop meeting [24:12] >> and we'll workshop whatever those [24:13] » and we'll workshop whatever those [24:13] changes are. [24:17] >> I see. I just have a couple of just a [24:18] » I see. I just have a couple of just a [24:18] quick concerns or or comments. Um, will [24:23] we have to approve it annually to [24:26] continue or will it just go on for as [24:29] long as they want to? [24:30] >> Yeah, I can address that. So the fees [24:33] » Yeah, I can address that. So the fees [24:33] and collections manual, the the fees in [24:34] there remain intact unless changed by [24:38] future ordinance, which would be two [24:39] readings. Typically, we do this exercise [24:41] annually. Um but to the mayor's point, [24:45] we discussed in our workshop the [24:47] prospect of adding community development [24:49] permitting fees uh given the state's [24:52] recent regulatory changes around [24:54] assessing of permitting of permits uh [24:58] permit fees and needing that to be more [25:00] timebased than um as the mechanism. We [25:04] need a little more time to uh put [25:07] together a fee schedule on that. So [25:08] we're delaying that. We do have [25:10] recreation fees, fee changes in here [25:14] that are that are in exhibit B. You can [25:16] see the before and after, but we're also [25:17] going to be looking at recreation a [25:19] little deeper as well and look at per [25:21] program costs a um in a little more [25:24] depth and ensure that you know the the [25:27] fees assessed align well with the actual [25:30] cost of administering the program. So, [25:33] we could see some future changes on the [25:35] rec on the recreation side. When exactly [25:37] that'll take place, not quite sure, but [25:39] future changes could happen in the [25:40] horizon. The one that we discussed that [25:43] you there's pretty much universal [25:45] support for the ones that we discussed [25:46] in the workshop with the exception of [25:48] one in parking on on backing in parking. [25:51] So rest assured we have removed that. So [25:53] please back in away as to your heart's [25:55] content you will not get fined for that. [25:58] So that has been removed. [26:00] >> All right. So, so as far as um solid [26:04] » All right. So, so as far as um solid [26:04] waste and usage of the uh [26:09] sanitary and restrooms with the market, [26:13] Wednesday market, are we charging them? [26:18] Are they paying us a fee for that? [26:22] >> I'm not quite sure about the intricacies [26:25] » I'm not quite sure about the intricacies [26:25] behind that. Max, do you have some any [26:27] comments on the cost around Wednesday [26:30] market? [26:35] » So, traditionally in the past, the [26:37] Wednesday market, they would mainly take [26:38] all their trash with them. Any trash [26:41] that was in what was uh made, if you [26:45] will, in the market was just used uh on [26:47] the trash cans along Madira Way. As for [26:50] restrooms, the local businesses allowed [26:52] patrons and the market vendors to use [26:54] their restrooms. We did not provide any [26:56] restrooms for them. [27:00] So, all we charged them in the past was [27:02] just a street closure fee and then they [27:04] ran the market for us as a as a service [27:08] to the community. [27:09] >> Okay. [27:10] » Okay. [27:10] >> I'm sure there's um cleaning [27:12] » I'm sure there's um cleaning [27:12] [clears throat] for the restrooms and [27:14] things in that nature would would would [27:16] who would clean up the restrooms? [27:18] >> None of the businesses on Madira Way [27:20] » None of the businesses on Madira Way [27:20] like the saltwater hippie beach bar and [27:21] shop. They were the ones who mainly in [27:23] Forbotus would allow patrons and and [27:25] people to come use their restrooms in [27:27] their facilities in their in their [27:29] businesses. They never charged us any [27:31] fees for that. They were just happy to [27:33] have a market in front of their business [27:35] every Wednesday. [27:36] >> Yeah. Thank you. [27:38] » Yeah. Thank you. [27:38] >> With no any addition, [27:39] » With no any addition, [27:39] >> I just have a couple questions for It's [27:41] » I just have a couple questions for It's [27:41] both recreation. Sorry, Max. This splash [27:44] pad and weddings. That's what I'm asking [27:45] about. And the splash pad, uh, it looks [27:47] like there's a fee for the splash pad, [27:48] but that's only if they want to reserve. [27:50] That's that's if just you say you want [27:51] to have your birthday party at the [27:52] splash pad. That's what that is. It's [27:54] just you you have the splash pad [27:56] reserved exclusively for you during that [27:58] during that time. [27:58] >> But otherwise, anybody can [27:59] » But otherwise, anybody can [27:59] >> otherwise anybody is welcome to use the [28:01] » otherwise anybody is welcome to use the [28:01] splash pad for free. That is great. [28:02] >> The other the other one was about [28:03] » The other the other one was about [28:03] weddings on the beach. Uh so it looks [28:06] like even weddings under 50 have to get [28:09] a permit and and does that happen [28:10] regularly with tie the knot and [28:12] >> Yes, that does happen regularly with tie [28:14] » Yes, that does happen regularly with tie [28:14] with all the different beach wedding uh [28:16] with all the wedding planning companies [28:17] we have. [28:18] >> Okay. all up and down the coast there. [28:19] » Okay. all up and down the coast there. [28:19] >> And just just because we the the [28:21] » And just just because we the the [28:21] residents that live on the other right [28:23] there at the beach uh across from Tide [28:25] the Knots and West, they have concerns [28:28] because often times the the problem is [28:31] that they don't hold the weddings in [28:33] front of the city property. They hold [28:35] the weddings in front of their house. [28:37] And one in particular has repairarian [28:39] rights to the water. And anyway, I just [28:42] I just wanted to make sure they they're [28:44] supposed to get a permit even for 50 or [28:46] less. And they have a fee attached. [28:47] Correct. If you're if you're setting up [28:49] an an arch or or any structure on the [28:51] beach, even if you're just renewing your [28:52] vows with with 10 people, we still [28:54] require a beach wedding permit. [28:56] >> And am I correct that they're supposed [28:57] » And am I correct that they're supposed [28:57] to stay in front of the [28:58] >> They are supposed to stay right there [28:59] » They are supposed to stay right there [28:59] pretty much. And like if you're [29:01] referring to where uh uh off the top of [29:03] my head, what I [29:04] >> Bob? [29:04] » Bob? [29:04] >> Uh yeah, it's at 134th. Um we we we [29:08] » Uh yeah, it's at 134th. Um we we we [29:08] instruct them to set up in front of the [29:11] walkway. This is ordinance [30:15] » Thank you mayor. This is ordinance [30:15] 2026-09, an ordinance of the city of [30:17] Madera Beach, Florida, amending chapter [30:19] 110 zoning, article 3, non-conformances [30:22] of the city's land development [30:23] regulations to clarify regulations [30:26] governing non-conforming lots, uses, [30:28] structures, and density. To revise [30:30] rebuilding and redevelopment standards [30:32] following a catastrophic loss, extending [30:35] the deadline for certain repairs related [30:37] to the 2024 hurricanes. [30:39] to wave the business tax receipt [30:42] requirement for structures that were [30:43] damaged during the 2024 hurricanes [30:47] provided that certain conditions are met [30:49] providing for conflict severability [30:51] codification and an effective date. That [30:54] was the first reading of ordinance [30:55] 2026-09 [30:57] by title only. [30:58] >> Do we have any public comment? [31:01] » Do we have any public comment? [31:01] Commissioners, any questions or [31:02] comments? [31:05] >> I've got many. after my drive around [31:08] » I've got many. after my drive around [31:08] with the um [clears throat] lovely [31:11] people that doing the code enforcement. [31:13] Um there's so many places that have just [31:17] been vacated. [31:19] Excuse [clears throat] me. And I've [31:20] asked the city to do a little bit of um [31:23] homework where we extended this 6 months [31:26] already and to extend it another year. I [31:30] was kind of leerary about it. However, I [31:32] was told that we should talk to our [31:35] lawyer to see if there's something about [31:38] the section 180 or one of the laws that [31:42] are going to be passed as to whether or [31:44] not we can not do this. Uh I'd even ask [31:48] so much as to the extent of how many [31:51] people are doing anything and by kicking [31:54] this can down the road are we doing any [31:56] good? [32:01] So, mayor, can I just address that? I [32:03] think that uh Commissioner Dylan is [32:05] referring to Senate Bill 180. There's a [32:08] requirement under that Senate Bill 180 [32:10] that we cannot adopt regulations that [32:14] are more restrictive than what we [32:16] currently have for uh the period of time [32:19] listed in the in in the law. But these [32:22] are making it less restrictive. And so, [32:25] the Senate Bill 180 would not apply. it [32:28] it doesn't prohibit us from adopting [32:30] this ordinance because it's less [32:32] restrictive. [32:34] So, in other words, you're letting more [32:36] things happen than what the code [32:38] currently allows. [32:40] So, [32:40] >> and and one thing I think that comes [32:42] » and and one thing I think that comes [32:42] into play is uh we talked about if and I [32:48] emailed attorney Tras a while ago to [32:50] confirm well if the deadline passes say [32:54] we didn't extend this deadline [32:56] and there's properties that are [32:59] prefirmed. So, they're not elevated, [33:01] they're non-conforming, they haven't [33:02] pulled the permits. Can we take some [33:06] code enforcement action to like force [33:08] demolition? [33:09] And the attorney's interpretation of the [33:12] current code is no. There would need to [33:14] be some kind of other violation of the [33:17] code, whether it's a nuisance or they're [33:19] caught doing work without a permit. So [33:22] essentially what that means is if the [33:24] deadline wasn't extended [33:27] then it would just result in anyone that [33:30] submits a remodel permit after the [33:32] deadline the remodel permit would just [33:34] get denied and then it would potentially [33:38] have the opposite effect that we're [33:39] wanting and the property would sit [33:41] abandoned for even longer because it [33:43] takes longer to get new builds plans [33:46] prepared than a remodel. [33:50] » Okay. So with that in mind then excuse [33:53] me do we just kick it down the road 6 [33:55] months as opposed to a year I mean and [33:58] I'm asking you people for your advice. [34:01] >> So the thing with a year is so Senate [34:03] » So the thing with a year is so Senate [34:03] Bill 180 lapses in about a year. So [34:07] potentially if we extend the deadline [34:11] another year like we're proposing here, [34:13] then possibly we can by then work [34:17] another ordinance that proposes [34:19] something more restrictive where maybe [34:21] we do force demolition if that's a [34:24] route. Um and and go that option once [34:28] both Senate Bill 180 and the new [34:30] deadline passes. [34:33] Well, and I guess my my main concern was [34:36] all the vacant properties. There's so [34:39] many that, you know, and it's easy to [34:41] tell because the post office has put the [34:43] blue tape over their mailboxes. So, as [34:46] to whether or not all of those homes are [34:48] just sitting vacant, you know, [34:50] rodentinfested. [34:52] And that's kind of my concern. and many [34:56] of the other people that were here in [34:58] the original discussion, the real estate [35:01] people, if you're trying to sell your [35:03] house and you're going by all these [35:05] places that are abandoned or look to be [35:08] abandoned, it's not a very good look. [35:11] So, that was my concern about kicking it [35:13] down the line. [35:15] I think that the better conversation for [35:17] us would be to add to our next workshop [35:20] code enforcement because the issue you [35:25] the issue of the abandoned homes and the [35:28] overgrown grass we've talked about we've [35:31] been talking about for over two years [35:32] now uh or almost two years now over two [35:36] years now because we're in August about [35:39] the houses and the the issues and code [35:42] enforcement and getting our deputies [35:45] um a clear definition of what it is [35:48] we're looking for that they are [35:49] responsible for doing and then a better [35:53] definition for our our code enforcers [35:55] that are internal for what we're looking [35:58] for for the community and having some [36:00] sort of reporting system to be able to [36:03] at least once a month provide to the [36:04] community how many properties have been [36:06] code enforced, what happened with them, [36:09] where they're at, not the specific [36:11] properties, but the number. and what [36:13] we're doing and also to educate the [36:15] community and ourselves as well on what [36:18] that looks like. What can we do? What [36:20] can we not do? Part of this conversation [36:23] was there are many people who own [36:26] properties in MadiRaa who are still [36:28] waiting to find out if they're going to [36:30] be approved. There are many people who [36:32] are still waiting on their insurance to [36:34] pay. And so by not extending it for [36:39] another year, then we're telling them [36:42] that, you know what, it doesn't matter. [36:44] Time's up for you. You're done. But we [36:46] still can't make them do anything, you [36:48] know? So, we're giving them a year so [36:50] that they can breathe. They have the [36:52] opportunity um to be able to find out [36:55] whether or not they're going to qualify [36:56] for a program that's going to help them [36:58] with whatever the program is. There's [37:00] there's several different programs out [37:02] there people have applied for. And then [37:04] in the meantime, I think it would be [37:06] best for us in my view that we our next [37:10] workshop doesn't have very much on it [37:12] and that we spend some really good hard [37:14] conversation on what our ordinances says [37:18] we can do with code enforcement and give [37:21] the direction to the people who are [37:23] responsible for enforcing it in what we [37:25] want to see done and that would make a [37:28] difference. I believe [37:29] >> I completely agree but I couldn't talk [37:31] » I completely agree but I couldn't talk [37:31] to you about that. So, it's just like I [37:33] had to bring this up however I could to [37:37] get the ball rolling. And that's where [37:39] um exactly, you know, and as to how [37:42] exactly we can do this, but by working [37:44] with our staff, it's it's phenomenal. [37:47] And that's what I thought, you know, I [37:49] was completely amazed that they go [37:52] around generally speaking twice a day [37:55] doing code enforcement and doing all [37:58] this stuff. And I was like, wow. you [38:00] know where I I didn't think [38:02] [clears throat] that it was done that [38:04] much and that's what I was like okay [38:06] this should be done well it's already [38:08] being done and it's just I didn't see it [38:11] I mean you know but it's it's being done [38:14] and to do continue you know to help not [38:18] to hinder our residents but to help them [38:21] but yet give them that nudge okay so [38:23] like guys [38:25] you got to maintain your properties I [38:28] mean you know and that's just like I [38:29] understand that, you know, rodents, I [38:33] mean, I've got many friends that are [38:34] just like, you know, they they got [38:37] rodents now and it's it's bad, you know. [38:39] So, and that's what understanding, but [38:42] to have more teeth in our ordinances is [38:46] what I'm looking for. So we can't add we [38:49] can't add teeth right now. But what we [38:50] can do is understand the ordinance and [38:54] give the expectation of the commission [38:56] to those that are in charge of enforcing [38:59] it and do it that way. And at the same [39:02] time it will educate the community. I [39:04] drove the um city this weekend and [39:12] my personal view not as the mayor but as [39:14] an Marie Brooks who lives in Mader [39:16] Beach. If I lived on XYZ Street and [39:18] there were three abandoned homes and [39:20] they weren't cutting their grass, I [39:22] would cut their grass. [39:24] That's just me. And I know that there [39:27] are trespass. [39:28] >> No. Well, they're not living there. They [39:30] » No. Well, they're not living there. They [39:30] don't care. [39:31] >> And there are I know from conversations [39:35] » And there are I know from conversations [39:35] with the community that there are many [39:38] people in the city who live on streets [39:40] where there are abandoned homes or homes [39:42] where the people haven't made up their [39:44] mind what they're going to do. And when [39:46] their lawn service comes, the lawn [39:49] service cuts the neighbor's yard in. [39:50] >> Well, good for you in that condo. I [39:52] » Well, good for you in that condo. I [39:52] spent two hours today mowing mine. [39:54] >> I'm I'm saying that there are so that I [39:57] » I'm I'm saying that there are so that I [39:57] mean, the idea wasn't my idea. It came [39:59] from a resident who said they listened [40:01] to someone come and and make comments [40:04] about overgrown grass. And I was [40:06] someplace one day and a resident came [40:08] over and said to me, I watched that on [40:10] the meeting and let me tell you how we [40:12] do it on our street. We cut the grass. [40:15] That's not an option for everybody. I'm [40:16] just saying so I think that we workshop [40:18] this, we can have a conversation and [40:20] maybe we can come up with ideas that [40:21] would be helpful for the community and [40:23] for all of us. Commissioner, [40:24] >> so to go further with this, I went over [40:27] » so to go further with this, I went over [40:27] the the Pine Hills County Sheriff's uh [40:30] contract that we are going to vote on. [40:32] It's we have to have either approve it [40:34] or not approve it by October 1st. Uh and [40:37] a lot of what we're talking about we're [40:39] already has it's already contracted. [40:42] What I would like is during our next [40:43] workshop to have a representative from [40:45] Pineelis County Sheriff's who is [40:47] responsible for this contract to make [40:49] sure that the wording is uh clear and [40:52] what our expectations are. Uh and and I [40:55] I I would like to see a report on a [40:57] regular basis for these non-emergency [40:59] code violations, these short-term [41:01] rentals, these these what some people [41:03] call a nuisance. I think they're more [41:04] than nuisance. So, I I I if that's [41:08] possible, uh Mr. Mr. Hellfrick, I'd love [41:10] to see someone representing the [41:12] sheriff's department at our workshop [41:14] when we're talking about this contract. [41:16] >> Yeah, I I've requested that. I I'll get [41:18] » Yeah, I I've requested that. I I'll get [41:18] with them uh this week and make sure [41:20] that's lined up. [41:21] >> Great. Thanks. And then I had one more [41:23] » Great. Thanks. And then I had one more [41:23] question. Uh the 2024 hurricane damage [41:26] status. I can Can you It says QC. [41:30] There's just a couple things that I [41:31] understand. I'd like to understand QC [41:33] needed. That's a big chunk of [41:35] properties. [41:35] >> Yeah, I can explain that. So, let me go [41:37] » Yeah, I can explain that. So, let me go [41:37] to the pie chart. [41:39] So this comes from 4Runner. So basically [41:42] the way we're tracking [41:44] every property to see if they got a [41:46] permit or not is through these statuses [41:49] and the QC needed one is means that we [41:53] don't know for sure. It looks like [41:55] that's most of them, but that's because [41:57] it's a lot of condo parcels. Like all [41:59] the condo buildings have hundreds of [42:02] parcel IDs, so it's grouping them all [42:04] there. [42:04] >> But what is QC? Uh that's just the code [42:07] » But what is QC? Uh that's just the code [42:07] name that we gave it like quality [42:09] control check needed like [42:10] >> it's the definition would be those [42:12] » it's the definition would be those [42:12] places that they haven't submitted a [42:15] permit request they haven't done any [42:17] work they're just [42:18] >> so let me run through the statuses real [42:20] » so let me run through the statuses real [42:20] quick so QC needed basically is it's [42:25] built so anything that was built before [42:27] 1975 [42:29] and doesn't have a permit we know with [42:32] almost 100% certainty is going to need a [42:35] permit. So, it's pre-firm and there's no [42:39] permit. So, that those go on the no [42:40] permit status. Then, just because it was [42:44] built after 1975 doesn't necessarily [42:47] mean they don't need a permit. So, we [42:49] didn't want to just block those out [42:52] completely. So, those anything built [42:55] after 1975 was put in the QC needed [42:57] status for now, which is just like we'll [42:59] figure it out later. And then anything [43:03] that's on the demolished/substantially [43:06] improved means they got either a full [43:09] structure demo permit or a new build [43:12] permit or an elevate permit since the [43:14] hurricane. Anything that's on the owner [43:17] and communication status means they're [43:20] really they don't have a permit, but [43:22] they have they're working with us in [43:24] some way. Either we've logged like a [43:26] conversation with the owner. They're [43:27] like waiting for Elevate Florida. Maybe [43:29] they have a permit under review. Some of [43:32] those and then the postfirm no damage is [43:36] has the least because those are the ones [43:37] that are mostly QC needed. those [43:40] anything that's on postfirm or no damage [43:42] means that we've manually checked to see [43:47] that it's either an elevated house so we [43:50] don't have to expect a permit from them [43:51] or if it's not an elevated house we have [43:54] substantial evidence that we can produce [43:55] to FEMA when we get audited on why we [43:58] didn't require a permit on that parcel [43:59] either through pictures usually pictures [44:02] showing that they didn't get any damage [44:04] like in some uh unusual situations like [44:07] in the high side of Lilian five. A lot [44:10] of properties are pre-firm and they [44:12] still didn't get much damage. But [44:14] technically, our ordinance requires any [44:16] repairs need a permit. So, by default, [44:18] it would go in one of those statuses. [44:20] >> And I'm sorry, I missed I guess I missed [44:22] » And I'm sorry, I missed I guess I missed [44:22] what you said. What what defines that [44:24] gray area, the no permit. [44:26] >> The no permit, those are the ones that [44:28] » The no permit, those are the ones that [44:28] were built before 1975. So, we know it's [44:32] prefirm. And they didn't they didn't get [44:36] either a remodel, elevation, new builds, [44:38] or full demo permit since Alen, [44:41] >> but you see that work was done. Is that [44:42] » but you see that work was done. Is that [44:42] what you're saying? [44:43] >> No, not necessarily. We just we have so [44:45] » No, not necessarily. We just we have so [44:45] we have data from tidal basin that shows [44:48] the water level across the community and [44:52] we know that obviously every property [44:55] that's prefer was submerged in water. So [44:58] unless and when FEMA comes to audit the [45:01] city, they're going to want [45:02] documentation on why this pre-firm [45:05] structure is still sitting here with no [45:08] permit. So we just put it in the no [45:10] permit status to say like we we need [45:13] some kind of documentation whether a [45:14] permit or something. [45:17] >> Okay. Seems it seems like there's a [45:19] » Okay. Seems it seems like there's a [45:19] little bit of overlap, but I think I [45:20] have a better grasp of that. Thank you. [45:22] >> Yeah, the data the data is a little [45:24] » Yeah, the data the data is a little [45:24] rough and what is what is skewing it is [45:26] the condominium. So this is kind of a [45:28] rough blush at the data. Um and this [45:30] wasn't being captured real time during [45:32] the storm, right? This was all post [45:33] storm. We we got 4Runner, then we were [45:35] able to back in data into it. So it's [45:38] been a a lot of heavy lift. So it does [45:40] need to be cleaned up some. So the the [45:41] data is a little misleading because it [45:43] is picking up the condo parcels. But [45:45] we're going to work with 4Runner to [45:46] start separating that data out so that [45:48] it doesn't throw off the numbers like [45:49] >> but it says updated July 2026. So this [45:52] » but it says updated July 2026. So this [45:52] is where we are. So we just created this [45:55] chart like I know I know you guys wanted [45:57] some numbers so I wanted to give you [45:59] something. This is the best that I that [46:01] I can give you some [clears throat] kind [46:03] of data to show the properties. So [46:06] that's this is our first run of the of [46:09] the data with 4Runner tracking it. They [46:12] actually just released this feature to [46:13] to create a pie chart like a couple [46:15] month like a couple weeks ago. [46:17] >> Thank you. This is very helpful. So [46:19] » Thank you. This is very helpful. So [46:19] that's what the 5261 [46:23] numbers that you've got there. Uh that's [46:26] the total of those. Um so that's all [46:32] how did that's all [46:33] >> that's all the parial IDs in Madura. [46:35] » that's all the parial IDs in Madura. [46:36] >> So but of which like you said 100 could [46:38] » So but of which like you said 100 could [46:38] be in one condo. [46:39] >> Yeah. [clears throat] Correct. Because [46:40] » Yeah. [clears throat] Correct. Because [46:40] each condo is it has its own paral ID. [46:45] >> Okay. Thank you. [46:47] » Okay. Thank you. [46:47] Well, I would also like to add to that [46:50] workshop the uh the abandoned swimming [46:53] pools that uh the residents that have [46:57] reached out to me and my district. [46:59] >> Let's wait and do that when we get to [47:01] » Let's wait and do that when we get to [47:01] the agenda setting. [47:03] >> Okay. [47:03] » Okay. [47:03] >> Adding. [47:06] » Adding. [47:06] >> All right. [47:08] » All right. [47:08] >> Well, I mean, we're talking specifically [47:10] » Well, I mean, we're talking specifically [47:10] about this. So, we're going to add [47:11] >> the next workshop is [47:13] » the next workshop is [47:13] >> when we get to agenda setting, [47:16] » when we get to agenda setting, [47:16] we can add it then. [47:18] >> Sound good? [47:21] » Sound good? [47:21] >> Do we have a motion? [47:28] » Madame Mayor, I would like to adopt [47:30] ordinance 2026-09, [47:33] nonconformances and rebuilding [47:35] regulations. [47:38] >> Do we have a second? [47:38] » Do we have a second? [47:38] >> Second. City clerk, would you call the [47:40] » Second. City clerk, would you call the [47:40] role, please? [47:43] >> Commissioner Gabbay. [47:44] » Commissioner Gabbay. [47:44] >> Yes. [47:44] » Yes. [47:44] >> Commissioner Mcan? [47:46] » Commissioner Mcan? [47:46] >> Yes. [47:48] » Yes. [47:48] >> Commissioner Taglerini? [47:49] » Commissioner Taglerini? [47:49] >> Yes. [47:50] » Yes. [47:50] >> Commissioner Dylan? [47:51] » Commissioner Dylan? [47:51] >> Yes. [47:52] » Yes. [47:52] >> Mayor Brooks? [47:54] » Mayor Brooks? [47:54] >> Yes. [47:55] » Yes. [47:55] >> The motion carried 5 to zero. Next on [47:57] » The motion carried 5 to zero. Next on [47:57] the agenda is ABP2026-01, [48:01] Florida Fisherman, Inc. And I will hand [48:03] this to the city attorney. [48:04] >> Thank you, mayor. [clears throat] The [48:05] » Thank you, mayor. [clears throat] The [48:05] next two items on your agenda are both [48:07] quasi judicial. There's a process that [48:09] as you know that we go through. I'm just [48:10] going to lead you through that process. [48:12] So first of all um on the first one um I [48:16] need to give you the summary of the [48:17] application. Uh, this application is [48:20] requesting authorization from the board [48:22] of commissioners for the approval of a 2 [48:24] cop alcoholic beverage license for the [48:26] sale of beer and wine by the drink or in [48:29] sealed containers for consumption at the [48:31] vessel located at 112 Boardwalk Place, [48:34] 124 Boardwalk Place, 140 Boardwalk Place [48:37] here in MadiRaa Beach. [48:40] The standards that need to be applied [48:42] are those standards set forth in section [48:44] 110-532 of the code. I'm going to read [48:47] them. Uh when considering the alcoholic [48:50] beverage application, the board of [48:51] commissioners shall consider the [48:52] following factors. Number one, the [48:54] extent to which the location and the [48:56] extent to which the proposed alcoholic [48:58] beverage request will adversely affect [49:00] the character of the existing [49:02] neighborhood. Number two, the extent to [49:04] which traffic generated as a result of [49:06] the location of the proposed al [49:08] alcoholic beverage request will create [49:10] congestion or present a safety hazard. [49:13] Number three, whether or not the [49:15] proposed use is compatible with the [49:17] particular location for which is which [49:19] it is proposed. Number four, whether or [49:22] not the proposed use will adversely [49:24] affect the public safety. And number [49:27] five, no application for review under [49:30] this section shall be considered until [49:32] the applicant is paid in full any [49:35] outstanding charges, fees, interest, [49:36] fines, or penalties owed by the [49:38] applicant to the city under any section [49:41] of the code. [49:43] Uh the burden of proof in this case is [49:45] set forth in section 2-10A of your um [49:49] code of ordinances and it reads as [49:51] follows. The applicant shall have the [49:53] burden of proof at the hearing to show [49:55] by a greater weight of the evidence that [49:56] the application is consistent with the [49:59] city's comprehensive plan and complies [50:01] with all procedural requirements of law. [50:04] Conditions may be suggested by the [50:06] applicant, the city or any party or may [50:08] be imposed by the board which are [50:10] intended to assure consistency. [50:14] The parties in this case are the [50:16] applicant Florida Fisherman Inc. and the [50:18] property owner is JE Investments LLC. [50:23] There have been no notices of intent to [50:25] become affected parties. So, we won't be [50:27] adding anybody else. Uh the order of the [50:30] presentation I would propose would be [50:32] the city present its um staff report [50:35] first followed by the applicant. I need [50:38] to go ahead and read the quasi judicial [50:40] procedures that you need to follow [50:42] today. [50:43] This is a quasa judicial proceeding [50:45] where the board of commissioners acts in [50:46] a quasa judicial rather than a [50:48] legislative capacity. At this hearing, [50:50] it's not the board's function to make [50:52] law, but rather to apply law that has [50:54] already been established. In this [50:56] hearing, the board is required by law to [50:58] make findings of fact based upon [50:59] evidence presented at the hearing and [51:01] apply those findings of fact to [51:03] previously established criteria [51:04] contained in the code of ordinances and [51:06] in order in order to make a legal [51:08] decision regarding the application [51:09] before it. The board may may only [51:12] consider evidence at the hearing that [51:14] the law considers competent, [51:15] substantial, and relevant to the issues. [51:18] If the competent, substantial, and [51:20] relevant evidence of the hearing [51:21] demonstrates the applicant has met the [51:23] criteria established in the code of [51:24] ordinances, then the board is required [51:26] by law to find in favor of the [51:28] applicant. By the same token, if the [51:30] competent substantial and relevant [51:32] evidence of the hearing demonstrates the [51:33] applicant has failed to meet the [51:34] criteria established in the code of [51:36] ordinances, then the board is required [51:38] by law to find against the applicant. [51:41] At this point, I need to ask each and [51:43] every commissioner whether or not they [51:45] need to report any ex exparte [51:47] communications with regard to this [51:49] application. [51:51] No, I'm seeing no any conflicts of [51:53] interest that any of the board members [51:55] of the commission need to express at [51:57] this time. Okay. All right. At this [51:59] point, I need to swear in any witnesses [52:01] on this particular agenda item. So, [52:03] anyone that's going to speak on this [52:04] agenda item, if you could stand up, [52:06] raise your right hand, or be sworn under [52:07] oath. So, the applicant's not here, [52:10] Andrew. [52:12] >> Uh, I I'm I mean, they know the date of [52:14] » Uh, I I'm I mean, they know the date of [52:14] the hearing, so All right. So, do you [52:17] swear that you if you swear the [52:19] testimony you're about to give is going [52:20] to be the truth, the whole truth, and [52:21] nothing but the truth? [52:22] >> Okay. All right. We're going to need you [52:24] » Okay. All right. We're going to need you [52:24] to get you in front of that microphone, [52:25] Andrew, so we can hear your voice. [52:27] >> Okay. No problem. [52:28] » Okay. No problem. [52:28] >> All right. You ready to make your [52:30] » All right. You ready to make your [52:30] presentation? [52:31] >> Yes, sir. [52:31] » Yes, sir. [52:32] >> Okay. [52:32] » Okay. [52:32] >> So, so both of these are um these [52:34] » So, so both of these are um these [52:34] applications are pretty similar. Um but [52:37] for alcohol permits there um when it's [52:41] related to a vessel, it has to be for [52:43] each ship. So that's why there's two of [52:44] them. Um so this one is for a dolphin [52:48] quest 2. Um so pursuant to land [52:51] development code article [52:54] let's see division six alcohol beverages [52:57] the applicant for AP 202601 is [53:00] requesting authorization from the board [53:01] of commissioners for approval of a 2COP [53:04] alcoholic beverage license for the sale [53:05] of beer and wine by the the drink or in [53:08] seal containers for consumption at the [53:10] vessel located at 112 Boardwalk Place [53:12] 124 Boardwalk Place and 140 Boardwalk [53:15] Place Madira Beach Florida. This [53:17] establishment is in the C1 Johns Pass [53:19] Village Activity Center zoning district [53:21] and the boardwalk character district. [53:22] The future land use designation for the [53:24] property's activity center. Pursuant to [53:26] section 110 539, the notice of public [53:29] hearing has been properly sent to all [53:31] property owners within 300 ft of the [53:33] subject property 15 days before the [53:35] scheduled consideration by the board of [53:37] commissioners. Such notice has also been [53:38] posted on the subject property at the [53:41] Gulf Beach's public library, city hall, [53:43] and the city of Madira Beach website. [53:45] The public notice, mailing address, and [53:47] posting pictures are included in the [53:48] agenda packet. [53:50] Um, when considering the alcoholic [53:53] beverage license application, the board [53:54] commissioner shall consider the [53:55] following factors. To the extent to [53:57] which the location and extent to which [54:00] the proposed alcoholic beverage requests [54:02] will adversely [54:05] affect the character of the existing [54:06] neighborhood. The proposed alcohol [54:07] beverage license is in the boardwalk [54:09] character district of the John's Pest [54:11] Village Activity Center. The boardwalk [54:12] character district supports various [54:14] commercial uses that are oriented [54:15] towards tourism and maintaining the the [54:18] fishing village character of John's Pest [54:20] Village. Various businesses in the [54:22] boardwalk character district serve [54:23] alcoholic beverages. Serving alcoholic [54:25] beverages on charter boats would not [54:27] adversely affect the character of the [54:28] neighborhood. The extent to which [54:30] traffic generated as a result of the [54:32] location of the proposed alcoholic [54:34] beverage request will create congestion [54:35] or present a safety hazard. Uh the [54:38] affluent listed three parking spaces, [54:40] one handicap parking space and five [54:41] bicycle stalls up to which are worth up [54:45] to three uh parking creds. This property [54:46] is in the John's Pest Village special [54:49] parking area which allows for the [54:51] reduction of the required off- streetet [54:54] parking by 50%. Since the property is [54:56] located in a special parking area, each [54:59] charbo boat would require 1.5 spaces. [55:01] Additional parking is available in a [55:03] privately owned parking garage across [55:05] the street, but the existing on-site [55:07] parking is considered sufficient. It is [55:09] not foreseen that serving beer and wine [55:11] on an existing showboat service would [55:13] create additional congestion or present [55:15] a safety hazard. Whether or not the [55:18] proposed use is compatible with the [55:19] particular location for which it is [55:21] proposed, applicant the applicant says [55:23] that the license would be for selling [55:25] beer and wine and prepackaged drinks on [55:27] a pleasure cruise vessel used for [55:29] dolphin watches and sunset tours. When [55:31] the alcohol is not being sold on the [55:33] charter boats, that alcohol will be [55:34] stored on property. The proposed use of [55:37] selling alcohol beverages on a charter [55:38] boat is compatible with the this [55:40] particular location. Whether or not the [55:42] proposed use will adversely affect [55:44] public safety. Serving beer and wine on [55:46] a churbo boat would not uh adversely [55:49] affect public safety. The proposed [55:50] alcoholic beverage license would be [55:51] replacing an existing alcohol alcoholic [55:54] beverage license because of a change in [55:56] ownership. The vessels are licensed and [55:58] registered with the US Coast Guard. The [56:00] dock where the vessel is located is more [56:01] than 500 ft away from any established [56:04] church, synagogue, temple, or place of [56:06] religious worship, public or private [56:07] school operating for the instruction of [56:10] minors or youth recreation center. No [56:12] application for the review under this [56:14] section shall be considered until the [56:15] applicant has paid in full any [56:18] outstanding charges, fees, interest, [56:19] fines, or penalties owed by the [56:21] applicant to the city under any sections [56:22] of the code. [56:24] applicant has no outstanding fines or [56:28] penalties owed to the city under any [56:29] section of the code. And uh the city [56:32] staff recommends the approval of ABP [56:34] 2026-01. [56:36] Attached are the uh local application [56:39] and support materials and the public [56:41] notice mailing and posting packet which [56:43] shows that we we mailed out and posted [56:46] the the public notice in the required [56:48] time. [56:50] >> Okay. You're asking the city receive [56:52] » Okay. You're asking the city receive [56:52] into evidence your staff report, Mr. [56:54] Morris? [56:55] >> Yes, sir. [56:55] » Yes, sir. [57:07] Anyone in the public want to speak on [57:08] this agenda item? [57:11] It's back to the commission then for [57:12] consideration and approval. [57:15] >> Any questions or comments? [57:18] » Any questions or comments? [57:18] >> I've got one. I was on that ship, the [57:21] » I've got one. I was on that ship, the [57:21] pirate ship many years ago and they [57:22] serve beer. So now they're selling it. [57:25] Is that what the difference is? Or is it [57:28] changing ownership? I think you said [57:30] >> this one was a change change of [57:32] » this one was a change change of [57:32] ownership. Um sometimes when owners ch [57:35] they don't want to transfer the alcohol [57:37] license over uh that they have. So then [57:39] they have then the new owner has to [57:41] apply for a new one. [57:46] » Any additional comments? [57:50] Do we have a motion? [57:53] >> Are we Are we doing both of them or just [57:55] » Are we Are we doing both of them or just [57:55] one at a time? [58:25] >> Thank you. Okay. The summary of this [58:26] » Thank you. Okay. The summary of this [58:26] application is that the applicant is [58:28] requesting authorization from the board [58:29] of commissioners for the approval of a [58:31] two cop alcoholic beverage license for [58:34] the sale of beer and um and wine by by [58:36] the drink or in seal containers for [58:38] consumption at the vessel located at 112 [58:40] Boardwalk Place, 124 Boardwalk Place, [58:42] and 140 Boardwalk Place here in MadiRaa [58:45] Beach. The standards to be applied are [58:47] those that you I just listed in the [58:49] previous application. The burden of [58:51] proof um is the same. The identity of [58:54] the parties are the same. Um the order [58:57] of presentation is going to be the same. [58:59] The quasa judicial procedures follow the [59:02] same as I just read. Any exparte [59:04] communications on this application? [59:06] Anybody needs to report? [59:08] >> No. Um any conflicts of interest that [59:10] » No. Um any conflicts of interest that [59:10] need to be addressed? The only the only [59:21] difference is this is for a pirate ship. [59:25] So other than that, my uh staff reports [59:27] pretty pretty identical to the other [59:29] one. I I think unless you want me to [59:32] reread through it again. Um but that's [59:35] it's for the for the the pirate ship. [59:38] That's not necessary, Mr. Morris, unless [59:41] the commission wants that. I'm not [59:43] seeing any um objection to you. Um do [59:47] you want to submit your report into [59:48] evidence, though? [59:49] >> Yeah. Yes, sir. [59:50] » Yeah. Yes, sir. [59:50] >> Okay. So, that'd be received in evidence [59:52] » Okay. [1:00:36] >> With no unfinished business, next on the [1:00:38] » With no unfinished business, next on the [1:00:38] agenda is contracts and agreements, air [1:00:41] DNA software purchase. And I believe the [1:00:44] city manager will take this or [1:00:49] All right. Um, mayor, vice mayor, [1:00:51] commission. What this contract is is [1:00:54] [clears throat] um software that [1:00:56] identifies short-term vacation rentals. [1:00:58] Uh, BRBO, Airbnb. [1:01:00] Uh, we've had issues. There's been [1:01:02] public comment related to whether um [1:01:06] short-term vacation rentals are legal in [1:01:09] their current setting or where they're [1:01:12] even at. So Marcy and myself, we [1:01:15] [clears throat] sat through many, many [1:01:17] presentations with various um software [1:01:20] programs. This was the most cost [1:01:22] effective. Um it does everything that [1:01:24] all the other ones do. It doesn't have [1:01:25] all the frills and benefits and what [1:01:27] have you, but it gives us the the raw [1:01:29] data that we want. And what that does is [1:01:32] that this will turn into the fee [1:01:35] schedule that you all approved earlier [1:01:37] because now we per Florida state [1:01:40] statute, they have to have a life safety [1:01:41] fire inspection and we charge for that, [1:01:44] you know, and then it will also help [1:01:46] community development. I'll let Marcy [1:01:48] speak on that. And we are looking to [1:01:50] split this down the middle between both [1:01:52] departments. [1:01:54] The the benefit that community [1:01:57] development will see from this is [1:01:58] through the code enforcement and finding [1:02:00] short-term rentals. Uh they'll be able [1:02:02] to provide the data to us in a lat long [1:02:04] format which will then feed into [1:02:06] 4Erunner and it'll interact with our map [1:02:10] that shows where short terminals are [1:02:11] allowed and where they're not and help [1:02:13] flush out the ones that are being [1:02:16] advertised at locations where they're [1:02:17] not legally allowed to operate. So that [1:02:20] would help code enforcement. and they'll [1:02:21] also identify ones that are operating [1:02:23] legally but maybe didn't know they [1:02:24] needed a BTR and stuff like that. So, we [1:02:26] would then be able to contact them. Um, [1:02:28] we would be able to do our rental [1:02:29] inspections as well. So, that would be [1:02:31] helpful in identifying that too. [1:02:35] >> Do we have any public comment? [1:02:41] » Oh, sorry. [1:02:43] >> Hi, Bob 13301 Golf Lane. [clears throat] [1:02:47] » Hi, Bob 13301 Golf Lane. [clears throat] [1:02:47] Uh, prepared a couple notes. I saw the [1:02:50] AirDNA DNA contract on the agenda and as [1:02:54] both the real estate broker and owner of [1:02:56] multiple short-term rental properties, I [1:02:58] wanted to offer some perspective for the [1:03:00] commission's consideration. In reviewing [1:03:02] the memorandum, I understand the primary [1:03:04] purpose of software is to help identify [1:03:06] illegal or unregistered short-term [1:03:08] rentals. I fully support that goal. um [1:03:11] those operating outside the rules can [1:03:13] negatively impact those of us who have [1:03:15] taken the necessary steps to operate [1:03:16] legally and comply with city [1:03:18] requirements. My concern however is with [1:03:21] the accuracy and uh and reliability of [1:03:24] the ARDNA data. In my experience [1:03:27] reviewing ARDNA data, I found it to be [1:03:29] questionable at best. Um for instance, [1:03:33] um the main use of their software is to [1:03:35] project what you will make it as far as [1:03:38] rental income. [1:03:40] it's horribly often from my use cases. [1:03:45] Um, so if their main use is [1:03:50] that poor, it I I'd kind of question [1:03:53] some of the other secondary data they [1:03:55] provide. Um, so more relevant to the [1:03:57] city's proposed use. I'm also aware of [1:04:00] properties that continue to appear in [1:04:02] AirDNA's system even though they've been [1:04:04] dormant and have not operated as [1:04:06] short-term rental for extended periods [1:04:08] of time. sometimes even years because [1:04:11] one of my old properties show up that [1:04:12] way. Um, before the city relies on this [1:04:15] data, I identify potential violations or [1:04:17] send notifications to property owners. I [1:04:19] would encourage commission to make sure [1:04:20] there's additional checks and balances [1:04:22] in place to independently verify the [1:04:24] information. AirDNA may be useful as an [1:04:27] initial screening tool, but I'd caution [1:04:29] against treating its data as definitive [1:04:31] evidence that a property is currently [1:04:33] operating as a legal short-term rental. [1:04:36] Um, is a weird coincidence today. I've [1:04:38] actually received an email from a [1:04:40] property management group um, just [1:04:42] forwarding to me the AirDNA software [1:04:45] telling me how much I can make with one [1:04:47] of my properties as a short-term rental. [1:04:49] The only problem there are projections [1:04:51] for this property. It's not legally [1:04:52] zoned to be a short-term rental. [1:04:55] So, just again, there's some some [1:04:58] challenges. Ultimately, I support the [1:05:00] city's efforts to identify and address [1:05:03] um, illegal short-term rentals. I simply [1:05:05] want to make sure the city's getting [1:05:07] reliable value for the approximately [1:05:10] $22,000 being spent and that property [1:05:12] owners are not being unnecessarily [1:05:14] contacted or subjected to enforcement [1:05:16] efforts because it's inaccurate or [1:05:18] outdated third party data. Thank you for [1:05:20] your consideration. [1:05:22] >> Thank you. Do we have any additional [1:05:23] » Thank you. Do we have any additional [1:05:23] public comment [1:05:25] commissioners? [1:05:28] >> So I thank you for that m Mr. Bellis. [1:05:31] » So I thank you for that m Mr. Bellis. [1:05:31] So, [1:05:33] it seems like this is a a real advantage [1:05:36] for us because in the past code [1:05:38] enforcement has struggled with [1:05:40] identifying without a lot of specific [1:05:43] evidence that there is being a [1:05:45] short-term rental uh in in place. How [1:05:48] will will this help us bypass some of [1:05:50] this? Is is it going to require less, [1:05:53] >> you know, a video of people moving in [1:05:55] » you know, a video of people moving in [1:05:55] and out? Is it going to be [1:05:56] >> Exactly. And this and the backside of [1:05:59] » Exactly. And this and the backside of [1:05:59] this, this will also help with um code [1:06:01] compliance because we were putting [1:06:04] together an actual process now working [1:06:06] with Marcy and PCSO deputies cuz before [1:06:10] there were some um things that were [1:06:12] getting lost in translation. The [1:06:14] deputies might be notified of a [1:06:16] short-term vacation rental that's [1:06:18] operating illegally. They will go out [1:06:20] and notify. they're doing their job, but [1:06:22] then the process ended there. So, we [1:06:25] weren't notified of it as as the city. [1:06:28] So, we're actually implementing new [1:06:30] policies and procedures related to all [1:06:32] of this as a as a whole. [1:06:33] >> Will there be members of of your [1:06:35] » Will there be members of of your [1:06:35] department, the fire department, who are [1:06:37] going to be doing some of this now in [1:06:38] addition to our [1:06:39] >> Absolutely. This is [clears throat] per [1:06:43] » Absolutely. This is [clears throat] per [1:06:43] um the information on the surface that [1:06:45] we got from AirDNA because they they [1:06:47] obviously don't want to give us the all [1:06:49] the information for free, you know. So, [1:06:52] they gave us some information based on [1:06:54] those numbers. That's where the uh [1:06:56] second fire inspector will come into [1:06:58] play. And this is from the on the [1:07:01] surface again on the surface level [1:07:03] numbers that they provided. it will more [1:07:06] than pay for the our half of the [1:07:07] contract and pay for that fire inspector [1:07:09] position and still produce revenue. And [1:07:12] um just to address Mr. Bellow's comment [1:07:15] too, the the AirDNA, they don't they [1:07:18] don't know our zoning. So they just see [1:07:21] a a uh short-term vacation rental, but [1:07:23] when we have that information, it's up [1:07:25] to us to do what we want with it. You [1:07:26] know, they don't know that it's illegal [1:07:28] or not. They don't they don't have [1:07:29] access to the zoning or if they do, [1:07:31] they're not going to dig that deep into [1:07:32] it. Well, then can you see a situation [1:07:34] where something might happen where you [1:07:35] would go to some place uh that I've [1:07:38] identified as a short-term rental and it [1:07:40] turns out some for some reason it's not? [1:07:41] I mean, it's not an automatic ding to [1:07:43] them. Right. [clears throat] [1:07:44] >> Correct. So, what they do is um if if [1:07:48] » Correct. So, what they do is um if if [1:07:48] they have if they are active listed for [1:07:51] even one day in a 30-day period, they [1:07:53] show up on the on our monthly report. [1:07:56] And then if they go dormant, they're [1:07:58] supposed to anyways um pull be dropped [1:08:01] from that list. And then once they go [1:08:03] active again, we'll be 30 days behind, [1:08:05] but then they'll show up on the next [1:08:07] listing, the next monthly report showing [1:08:10] that even for one day, they advertise [1:08:12] that they were available to be rented. [1:08:15] >> Thank you. I sir, I love this idea. [1:08:18] » Thank you. I sir, I love this idea. [1:08:18] >> I thank you for the research you did, [1:08:20] » I thank you for the research you did, [1:08:20] Mr. Bellows. Thank you for yours as [1:08:22] well. And as I recall or believe, it's a [1:08:25] 12-month lease. So, I don't think we can [1:08:28] go wrong with the 12-month lease. And [1:08:31] Bob, you're certainly active in the [1:08:34] city. So, if you keep coming back [1:08:37] occasionally and see and we can kind of [1:08:39] bounce some things off of you. I think [1:08:41] it's a great idea, though. A step [1:08:43] definitely in the right direction. [1:08:45] >> Yes. In speaking with city manager [1:08:47] » Yes. In speaking with city manager [1:08:47] Hellfrick, you know, we they offered a a [1:08:49] little discount going for a two-year [1:08:52] contract. We agreed, you know, sitting [1:08:54] down and discussing it that let's just [1:08:56] see what they're able to do for us for [1:08:58] that first year and then we can go from [1:09:00] there. [1:09:02] >> I'm definitely for it. Great idea. [1:09:05] » I'm definitely for it. Great idea. [1:09:05] >> Thank you. [1:09:06] » Thank you. [1:09:06] >> Is there any competition? [1:09:08] » Is there any competition? [1:09:08] >> Oh, yeah. There's a uh we sat with I [1:09:11] » Oh, yeah. There's a uh we sat with I [1:09:11] don't want to name the companies, but [1:09:13] one was well into the six figures for [1:09:16] their their software. One was um 8 in [1:09:19] the 80s. Another one was 55,000. And [1:09:22] then once we got with AirDNA, I [1:09:25] understand it's not uh the all the [1:09:27] frills and benefits that the other [1:09:29] companies can offer, but we don't need [1:09:31] that. We just need the locations. [1:09:35] >> So yeah, there there's definitely others [1:09:37] » So yeah, there there's definitely others [1:09:37] out there. much much more expensive. [1:09:40] >> So, you're vetted. [1:09:41] » So, you're vetted. [1:09:41] >> Oh, yeah. Yeah. Me, myself, Marcy, her [1:09:44] » Oh, yeah. Yeah. Me, myself, Marcy, her [1:09:44] staff, uh the fire marshall, we sat in [1:09:46] many many presentations [1:09:48] >> to get to the end point where they [1:09:50] » to get to the end point where they [1:09:50] dropped the price on us and we say, "No, [1:09:52] that's we just wasted an hour of our [1:09:54] day." [1:09:55] >> And we sat with me in many presentations [1:09:57] » And we sat with me in many presentations [1:09:57] with AirDNA as well. When we had a [1:10:00] question, I would get with their rep. [1:10:02] She would set up a team's meeting and we [1:10:04] would discuss everything and any [1:10:06] questions we had she would answer. [1:10:08] >> And the fees will be paid upfront or [1:10:10] » And the fees will be paid upfront or [1:10:10] would that be month? [1:10:12] >> It's an annual fee. So we we would go [1:10:14] » It's an annual fee. So we we would go [1:10:14] and do their just like a a regular [1:10:17] business in the city. They would get [1:10:19] their annual life safety inspection [1:10:21] every year and it's per again as per [1:10:23] Florida state statute. We don't ask for [1:10:25] anything more or anything less. [1:10:28] >> Y thank you. [1:10:29] » Y thank you. [1:10:29] >> Yes sir. So, the only question I have on [1:10:31] » Yes sir. So, the only question I have on [1:10:31] the contract is that it is an automatic [1:10:34] renewal, and we don't typically do [1:10:35] automatic renewal contracts. [1:10:39] This one will automatically renew unless [1:10:42] you give 90 days written notice. [1:10:46] I would be in favor of not having that [1:10:48] in there and and removing the 90 days [1:10:51] and h making them have to give us a new [1:10:54] contract every year. [1:10:55] >> Agreed. I [1:10:56] » Agreed. I [1:10:56] >> So that we don't miss it cuz [1:10:57] » So that we don't miss it cuz [1:10:57] >> Yeah. I and I know we don't typically do [1:11:00] » Yeah. I and I know we don't typically do [1:11:00] that. I sorry if I missed that. [1:11:02] >> Yeah, good advice. [1:11:03] » Yeah, good advice. [1:11:04] >> And [1:11:04] » And [1:11:04] >> it's all I have to give input on this. [1:11:06] » it's all I have to give input on this. [1:11:06] >> Yeah. [1:11:06] » Yeah. [1:11:06] >> Attorney Tras, would you like me to send [1:11:08] » Attorney Tras, would you like me to send [1:11:08] that back over to them and copy you or [1:11:10] would you like to [1:11:12] >> handle that? You can tell them what the [1:11:13] » handle that? You can tell them what the [1:11:13] what the commission is considering and [1:11:16] they'll approve it subject to the re the [1:11:17] deletion of that language. [1:11:19] >> Okay. [1:11:19] » Okay. [1:11:19] >> Yeah. [1:11:21] » Yeah. [1:11:21] So, can we have a motion to approve the [1:11:24] contract with the [1:11:26] removal of the 90-day [1:11:29] notice? [1:11:33] » I move that we approve the 12-month [1:11:36] subscription agreement with Air DND LLC [1:11:39] with the removal of the automatic [1:11:42] renewal. [1:11:43] >> We have a second. City clerk, would you [1:11:45] » We have a second. City clerk, would you [1:11:45] call the role, please? [1:11:49] Commissioner Taglerini, [1:11:51] >> yes. [1:11:51] » yes. [1:11:51] >> Commissioner Dylan, [1:11:52] » Commissioner Dylan, [1:11:52] >> yes. [1:11:53] » yes. [1:11:53] >> Vice Mayor McGee, [1:11:55] » Vice Mayor McGee, [1:11:55] >> yes. [1:11:56] » yes. [1:11:56] >> Commissioner Gabbay, [1:11:57] » Commissioner Gabbay, [1:11:57] >> yes. [1:11:57] » yes. [1:11:57] >> Mayor Brooks, [1:11:58] » Mayor Brooks, [1:11:58] >> yes. [1:11:59] » yes. [1:11:59] >> The motion carried 5 to zero. Next on [1:12:01] » The motion carried 5 to zero. Next on [1:12:01] the agenda is the revision to the [1:12:03] Readington EMS station funding [1:12:05] agreement. [1:12:06] >> Yes. [1:12:06] » Yes. [1:12:06] >> Chief, [1:12:07] » Chief, [1:12:07] >> this was the it's basically the same [1:12:09] » this was the it's basically the same [1:12:09] agreement that was presented to the [1:12:10] board uh last month. They sent it back [1:12:13] to us because they wanted the signature [1:12:15] page changed to where the county [1:12:17] administrator could sign versus bringing [1:12:20] it to the board of county commissioners. [1:12:21] And that is the only thing that has [1:12:23] changed. The funding is still 100% [1:12:25] coming from Penllis County. And um city [1:12:28] of Madura Beach is still the project [1:12:29] manager. [1:12:31] >> Do we have any public comment? [1:12:34] » Do we have any public comment? [1:12:34] Commission, do you have any questions or [1:12:35] comments? [1:12:38] If not, do we have a motion? [1:12:42] I make a motion [1:12:45] uh to approve the uh funding agreement [1:12:48] with the uh Bington Beaches EMS station. [1:12:52] >> Do we have a second? [1:12:53] » Do we have a second? [1:12:53] >> Second. [1:12:54] » Second. [1:12:54] >> City clerk, would you call the role, [1:12:55] » City clerk, would you call the role, [1:12:55] please? [1:12:57] >> Vice Mayor McGee? [1:12:58] » Vice Mayor McGee? [1:12:58] >> Yes. [1:12:59] » Yes. [1:12:59] >> Commissioner Dylan? [1:13:00] » Commissioner Dylan? [1:13:00] >> Yes. [1:13:01] » Yes. [1:13:01] >> Commissioner Tagarini? [1:13:02] » Commissioner Tagarini? [1:13:02] >> Yes. [1:13:03] » Yes. [1:13:03] >> Commissioner Gabayi? [1:13:04] » Commissioner Gabayi? [1:13:04] >> Yes. [1:13:05] » Yes. [1:13:05] >> Mayor Brooks? [1:13:06] » Mayor Brooks? [1:13:06] >> Yes. [1:13:07] » Yes. [1:13:07] >> The motion carry 5 to zero. Thank you. [1:13:09] » The motion carry 5 to zero. Thank you. [1:13:09] >> Next on the agenda is new business, the [1:13:11] » Next on the agenda is new business, the [1:13:11] authorization to proceed with due [1:13:13] diligence. And I'm going to give this to [1:13:15] the city manager. [1:13:17] >> Uh mayor and commissioners, um [1:13:20] » Uh mayor and commissioners, um [1:13:20] [clears throat] we have discussed uh [1:13:22] purchasing the 455 property and um we [1:13:27] had an u an agreement that um we have [1:13:32] had reviewed by the city attorney and [1:13:34] also the by uh the sellers attorney. um [1:13:39] I'm sorry, real estate agent and uh we [1:13:43] just uh received [1:13:45] uh the um [1:13:48] their signatures on the document. [1:13:51] However, we have not allowed you all to [1:13:54] review it uh sufficiently at this time. [1:13:57] Um so I s I'm going to suggest that we [1:14:01] maybe have a a special meeting for that. [1:14:05] um or unless you all want to to review [1:14:08] it right now. Uh it's about 16 I think [1:14:13] maybe 17 pages long. Um but I'm going to [1:14:18] leave that up to you to decide how you [1:14:20] wanted to um to proceed. [1:14:24] Um, before we go to public comment, [1:14:26] commission, do you have any questions or [1:14:28] comments or opinions on what the city [1:14:30] may [1:14:31] >> I have a question. [1:14:34] » I have a question. [1:14:34] Why do we need this property? [1:14:37] What is the [1:14:39] end goal? [1:14:43] » I understand we property. [1:14:45] >> Yeah. [1:14:45] » Yeah. [1:14:45] >> Well, there's there's a couple of [1:14:47] » Well, there's there's a couple of [1:14:47] reasons why. um it's splitting the two [1:14:50] properties that we own right now. Uh it [1:14:54] so without owning that, we don't have a [1:14:56] continuous property. The other thing is [1:14:59] is that on the west side of the property [1:15:04] that we just bought for $18 million, we [1:15:08] would not be able to use um that area to [1:15:13] um to dock boats on. So, we would only [1:15:16] have a two-sided [1:15:18] marina instead of a three-sided marina. [1:15:22] Um, and those that would be that would [1:15:25] be my reasons uh for buying it. [1:15:33] I I have obviously I would look at the [1:15:35] full contract, but I in in the memos [1:15:37] that we were provided regarding the [1:15:39] former underground gasoline storage tank [1:15:42] uh and historical petroleum discharge [1:15:44] and soil impacts have bear confirmed not [1:15:47] not fully deliated. That's in the [1:15:49] wording that we saw. Is there anything [1:15:50] that would could be discovered that [1:15:52] would prevent the purchase of the [1:15:54] property? And if there's a substantial [1:15:56] environmental issue, would we be able to [1:15:58] negotiate the price? [1:16:01] Um my understanding is a a an environ [1:16:05] phase one environmental site assessment [1:16:08] is required [1:16:10] uh that um so we would proceed with an [1:16:14] environmental site assessment. If [1:16:16] something came up uh that determined [1:16:19] that we needed to do a a phase two site [1:16:22] assessment, it's in the contract that [1:16:24] says we have um up to 60 days to get a a [1:16:29] phase two. Phase two is sampling and [1:16:32] things of that effect. as we were I was [1:16:35] going through the um the environmental [1:16:38] um I think it's called a supplemental [1:16:40] site assessment that was done that was [1:16:42] the um that's in the um [1:16:48] in your package. Uh it states that that [1:16:52] the contamination was just in the soil [1:16:56] and not in the groundwater. Therefore, [1:16:59] most likely we would not have to proceed [1:17:02] with a an environmental site assessment. [1:17:05] Um, a phase two environmental sight [1:17:07] assessment. Um, [1:17:10] therefore, I I don't think at this point [1:17:14] right now that there's any kind of of of [1:17:17] risk of of contamination there. However, [1:17:21] there is soil contamination. Okay, we [1:17:26] know that from the from the uh report. [1:17:30] So, a reduction in price, I'm not sure [1:17:33] that that's something that [1:17:36] >> Yeah, I I don't believe that. But a [1:17:39] » Yeah, I I don't believe that. But a [1:17:40] phase two of site assessment would be [1:17:43] determined after the phase one site [1:17:46] assessment. [1:17:53] I I I mean, you know, I'm coming into [1:17:55] this kind of blind. Uh the four of you [1:17:59] were [1:18:01] apprised with the other property [1:18:05] beforehand and I had some questions [1:18:08] about that which I can't ask anybody. [1:18:13] So, I'm kind of like with my hands tied, [1:18:15] but here we're jumping. And I was just [1:18:17] looking through here to see if there [1:18:18] were any numbers. But I, you know, I [1:18:21] don't know [1:18:24] in [1:18:25] right faith that we're jumping into the [1:18:28] right thing. And just from a standpoint [1:18:31] of [1:18:33] I understand being the whole continuous [1:18:36] thing, but [1:18:39] um how much grief are we going to be [1:18:42] getting more from this? And and I guess [1:18:44] I'm going back with the thing of I had [1:18:47] talks with Mike about [1:18:50] putting a whole plan together. And you [1:18:54] know, one of the things like I didn't [1:18:57] know going into the idea with a plan. So [1:19:00] by having this piece of property now, [1:19:04] there is another look about plans. And I [1:19:07] guess I'm I'm I'm kind of bambling here, [1:19:10] but I'm like, you know, I know [1:19:12] information, but I don't know [1:19:13] information. And um I need more [1:19:17] information here. I mean, you know, but [1:19:19] I'm just one person here. the four view [1:19:22] went forth with the 555 property. So I [1:19:26] mean you know I've heard rumblings but [1:19:28] yet now it's here and I don't know [1:19:30] whether or not at this point where where [1:19:34] we're going with this. So we gave the [1:19:38] com So when we purchased the 555 [1:19:40] property and we started doing the [1:19:41] meetings [1:19:43] um the community there was a great [1:19:46] interest from the community for if we [1:19:49] ever had the opportunity to purchase [1:19:51] this property that we purchase it to [1:19:53] give the city the full 10 acres. I [1:19:56] believe it's right at 10 acres all of [1:19:57] it. And um we had a meeting where we [1:20:01] gave the city manager's office the [1:20:03] authorization to pursue purchasing the [1:20:06] property. And so what he's done is he's [1:20:10] gone out and negotiated a contract. and [1:20:13] he has to bring that contract to us to [1:20:16] approve it so that he can do the next [1:20:18] steps which is to get the appraisals, do [1:20:22] the um due diligence on the [1:20:24] environmental testing and then it would [1:20:26] come back to us with all of that [1:20:28] information. I think what Mike is saying [1:20:30] is that we received the contract today [1:20:32] at like 6:20 signed and so the meeting [1:20:35] had already started. he did not have the [1:20:38] opportunity to share the contract with [1:20:40] everyone so that everyone here could [1:20:42] read the contract and see what it says [1:20:45] and the purchase price and all of that. [1:20:47] That's what he was giving the [1:20:49] information on. Um, as far as the [1:20:52] purchasing of it, four of us did give [1:20:55] authorization to move forward. Um, but I [1:20:58] any questions that you have about the [1:21:00] property, whether it's the the what [1:21:03] we've already purchased or this, we can [1:21:06] talk about that today in a meeting or [1:21:08] you could ask Mike anything [1:21:11] um as far as that goes. But we have I [1:21:14] can tell you with certainty that many [1:21:17] residents have voiced their opinion on [1:21:19] wanting the city to acquire that. It's [1:21:21] the entrance to the city and it would [1:21:23] give the city full control of the [1:21:26] entrance to the city and how it looks. [1:21:28] >> Thank you. I mean, I'm not opposed to [1:21:30] » Thank you. I mean, I'm not opposed to [1:21:30] it, but I'm like I'm trying to come in [1:21:32] after the game's already been played. [1:21:34] >> No, I understand. [1:21:35] » No, I understand. [1:21:35] >> So, and and so understanding it uh and [1:21:38] » So, and and so understanding it uh and [1:21:38] and I mean, you know, Mike and I have [1:21:40] had many, many conversations, the two of [1:21:42] us coming in new and he's newer than me, [1:21:45] but yet um inundating with things. So [1:21:50] yes, you know, and and and once again, [1:21:53] he wasn't really even privy to 555, so [1:21:58] he didn't know any more than I did, you [1:22:00] know. So, and and I mean, you know, I'm [1:22:01] not opposed to it, but it's just like, [1:22:04] you know, oh, here it is. [1:22:07] >> Eddie or M Commissioner McGee. [1:22:09] » Eddie or M Commissioner McGee. [1:22:10] >> Yeah, definitely. I think that adding [1:22:11] » Yeah, definitely. I think that adding [1:22:11] this property would be idea. We've [1:22:14] already talked about adding this [1:22:15] property. The only thing that I would [1:22:17] like to talk further is is the soil [1:22:20] contamination. [1:22:21] Um, and basically we can talk about it [1:22:25] here. We can talk about it oneon-one. I [1:22:28] believe the residents, as the mayor [1:22:30] said, are in agreement with this [1:22:32] property. That way we have it the whole [1:22:34] thing. Um, I just don't know much about [1:22:38] when you brought up the soil [1:22:39] contamination. Mhm. [clears throat] Um [1:22:43] the state of Florida uh D FD uh Florida [1:22:47] Department of of U environmental [1:22:49] protection, they had a program to remove [1:22:52] underground storage tanks. This this [1:22:54] site had a 2,000galon underground [1:22:57] storage tank and part of the state [1:23:00] wanting to come in and aband and wanted [1:23:02] those abandoned tanks to be removed. So [1:23:05] the state um paid for the removal of the [1:23:10] 2,000galon underground storage tank and [1:23:12] then they also paid for a an assessment [1:23:17] afterwards to see what type of [1:23:20] contamination was left behind. Part of [1:23:23] that was to take soil samples and also [1:23:26] take groundwater samples of that area. [1:23:28] So there's probably and I I counted them [1:23:30] up but I can't remember. I think there's [1:23:32] five environmental um monitoring wells [1:23:35] out there and over the years they've [1:23:38] been sampling those and they do not have [1:23:40] any contamination. However, when they [1:23:42] did the removal of the tank, there was [1:23:44] some leftover um soil contamination. [1:23:49] It wasn't to the point, it wasn't in a [1:23:51] an amount that the state says, okay, [1:23:53] this is an environmental hazard. It's [1:23:55] just that there's traces of petroleum in [1:23:59] the soil. Um, the only time that that [1:24:03] would be of hazard is if we were to tear [1:24:05] the building down, pull up the the [1:24:08] foundation, uh, and start to try to [1:24:10] build something on that. this program [1:24:13] that the state has uh if we do go that [1:24:17] route ter you know to to remove the [1:24:20] building and the foundations the state [1:24:24] would come in and for their at their [1:24:27] cost remove the top 2 feet of soil um so [1:24:31] that's the program that that site is [1:24:33] under and it gets transferred over to [1:24:35] the city so I see it as a very small [1:24:38] risk of that contamination again we have [1:24:42] to do our due diligence on the envir [1:24:44] environmental site assessment phase one. [1:24:47] That phase one will then direct us if we [1:24:51] need to do a uh a phase two. [1:24:57] » Mike, do we know how much they would be [1:24:59] asking for this property at this stage [1:25:01] of the game? [1:25:02] >> The property uh we offer uh our offer is [1:25:06] » The property uh we offer uh our offer is [1:25:06] at 3.5 million. [1:25:11] To me that's a lot of money. [1:25:13] Um I can understand make the properties [1:25:16] contiguous and enjoy a whole you know [1:25:20] giant nice piece of property. Um, I [1:25:24] think the little bit of an upland that [1:25:26] they have [1:25:29] doesn't justify the the cost and also [1:25:32] there's a lot of obviously wetlands and [1:25:35] and the bay and all that water really [1:25:39] there is generally stagnant because it [1:25:41] has no other place to go. So, it kind of [1:25:44] goes bacterious. But that's another item [1:25:48] for another day. Um, [1:25:51] you know, I don't know what the board [1:25:53] thinks, but I I'm not going to support [1:25:56] this. [1:25:57] >> Mayor, if I if I could without sounding [1:25:59] » Mayor, if I if I could without sounding [1:25:59] too much like I'm getting up on a soap [1:26:01] box, but we're on the precipice of [1:26:03] making a historical [1:26:06] uh change and for the better in Madira [1:26:08] Beach. I I think we should wait and have [1:26:11] the opportunity to look at the contract. [1:26:13] Absolutely. I think we should discuss [1:26:15] it. I don't know how much time we have [1:26:16] since it's been uh signed before we can [1:26:19] get mov forward. But all the first step [1:26:22] is to get that testing done to phase [1:26:24] one. [1:26:25] >> We can't do that. We cannot do that. So [1:26:28] » We can't do that. We cannot do that. So [1:26:28] the way it works is we need to have we [1:26:31] need to all review the contract, have a [1:26:33] meeting, approve the contract, and once [1:26:35] we approve the contract, then the [1:26:38] testing can be done. [1:26:40] >> I guess that's what I meant. That's what [1:26:41] » I guess that's what I meant. That's what [1:26:41] I meant. I just I Yes, there's going to [1:26:43] be a lot of details. It's a lot of money [1:26:45] and it's a lot of land. [1:26:48] But if we were to do this, this would [1:26:52] this would be a gamecher for our city. [1:26:54] And and I think it would be a positive [1:26:56] game changer. The fact that we could use [1:26:59] the entire three sides for for for [1:27:02] revenue, for for docks, for income, for [1:27:06] whatever we want, and the fact that we [1:27:07] couldn't if we didn't own it. Uh all of [1:27:10] that. So I not only in favor I'm [1:27:13] strongly in favor of moving forward but [1:27:15] after we look at that contract [1:27:18] >> could um maybe could or rec department [1:27:21] » could um maybe could or rec department [1:27:21] do an assessment as far as how much [1:27:23] money we can bring maybe in the next 10 [1:27:26] years would that be possible too [1:27:28] >> I feel like I've already seen some of [1:27:30] » I feel like I've already seen some of [1:27:30] those numbers just with two sides of it [1:27:32] >> right [1:27:33] » right [1:27:33] >> that was presented at one of our [1:27:35] » that was presented at one of our [1:27:35] workshops and uh just by the way I meant [1:27:37] to say earlier at I went to all of the [1:27:39] workshops we had with and there were [1:27:41] there were no push back right from any [1:27:43] residents, right? They were all [1:27:45] positive. Yes. Let's get this done. [1:27:46] >> The community as a whole was very [1:27:48] » The community as a whole was very [1:27:48] positive in the purchase of the of the [1:27:51] 555 property and were very supportive of [1:27:54] the city pursuing this purchase. Um so I [1:27:57] think the conversation is when can we [1:27:59] have a meeting and um [1:28:05] is everybody available on the 24th of [1:28:07] August? [1:28:10] I'm not [1:28:11] >> uh depending on the time I'm either free [1:28:14] » uh depending on the time I'm either free [1:28:14] in the morning or I'm free after 300 [1:28:16] p.m. [1:28:21] » And there's and it's burger week. [1:28:24] >> Well, we can all leave here and go get a [1:28:25] » Well, we can all leave here and go get a [1:28:25] burger. [1:28:28] >> Can we order in a burger? [1:28:30] » Can we order in a burger? [1:28:30] >> I'm good. [1:28:31] » I'm good. [1:28:31] >> I'm good. The 24th all day. [1:28:35] » I'm good. The 24th all day. [1:28:35] >> Commissioner McGee go. [1:28:37] » Commissioner McGee go. [1:28:37] >> I'm good. [1:28:37] » I'm good. [1:28:37] >> You good? [1:28:38] » You good? [1:28:38] >> Yeah. So [1:28:41] » Yeah. So [1:28:41] >> funny [1:28:42] » funny [1:28:42] >> he they said good you said after 3:00 [1:28:45] » he they said good you said after 3:00 [1:28:45] >> either after 3 or before noon [1:28:47] » either after 3 or before noon [1:28:47] >> tr cannot be here for it could some [1:28:50] » tr cannot be here for it could some [1:28:50] >> I would remind you also you have code [1:28:51] » I would remind you also you have code [1:28:51] enforcement special master hearing [1:28:53] starting at noon and there is at least [1:28:55] 23 cases that are I think 23 close to it [1:29:00] cases are going to be heard I don't know [1:29:01] how long that meeting is going to go um [1:29:03] so we do those in this chamber so it it [1:29:08] should not be early in the afternoon and [1:29:10] I'm double booked on the 24th [1:29:13] and I'm not sure if I can get a lawyer [1:29:15] here because my backup is covering [1:29:17] another meeting that I'm double booked [1:29:18] on. [1:29:22] Um, [1:29:25] we are all here on the 21st. [1:29:28] I don't know if that would work for [1:29:30] strategic planning until 4 o'clock [1:29:33] >> after that. [1:29:38] » Well, that would work except I think [1:29:40] we're serving burgers that night. [1:29:42] >> No, we're serving No, [1:29:44] » No, we're serving No, [1:29:44] >> we're serving burgers on the 26th at [1:29:47] » we're serving burgers on the 26th at [1:29:47] noon. [1:29:48] >> Okay. Sorry. [1:29:50] » Okay. Sorry. [1:29:50] So it is so the 21st is the kickoff to [1:29:54] um burger week. [1:29:58] » So burgers and after the strategic [1:30:01] planning [1:30:02] >> strategic planning then then a special [1:30:05] » strategic planning then then a special [1:30:05] meeting and then village Friday. [1:30:09] I I don't know. I'm just I'm asking I'm [1:30:11] verbalizing it. [1:30:12] >> I'm I'm fine with that. It'll be a long [1:30:14] » I'm I'm fine with that. It'll be a long [1:30:14] day, but we'll all be here [1:30:17] >> on the 21st. [1:30:19] » on the 21st. [1:30:19] >> So, we're thinking the 21st at what? [1:30:22] » So, we're thinking the 21st at what? [1:30:22] Five o'clock. That's a Friday. [1:30:25] >> Or or when we're done. [1:30:27] » Or or when we're done. [1:30:27] >> Yeah. Right after that. [1:30:28] » Yeah. Right after that. [1:30:28] >> No, you have We've got a sketch. We have [1:30:30] » No, you have We've got a sketch. We have [1:30:30] to advertise it. So, [1:30:31] >> Okay. What about Thursday the 20th where [1:30:35] » Okay. What about Thursday the 20th where [1:30:35] you don't have another commitment? [1:30:38] >> Um, [1:30:40] » Um, [1:30:40] >> I'm free in the afternoon. [1:30:44] I'm good. [1:30:45] >> So, I can do in the afternoon. [1:30:50] » Who's [snorts] on vacation? [1:30:50] >> Sounds like our AV guy may be on [1:30:52] » Sounds like our AV guy may be on [1:30:52] vacation. [1:30:53] >> That's fine. We'll we'll work that out. [1:30:55] » That's fine. We'll we'll work that out. [1:30:55] >> So, 5:00 on the 20 [1:30:58] » So, 5:00 on the 20 [1:30:58] >> 20th [1:31:00] » 20th [1:31:00] >> 20th. [1:31:00] » 20th. [1:31:00] >> Yep. [1:31:01] » Yep. [1:31:01] >> That works for me. [1:31:01] » That works for me. [1:31:01] >> 5:00 on the 20th. Commissioners. [1:31:04] » 5:00 on the 20th. Commissioners. [1:31:04] >> Yes, that's [1:31:06] » Yes, that's [1:31:06] >> city attorney. [1:31:08] » city attorney. [1:31:08] >> Okay. [1:31:17] Okay. [1:31:21] Then next on the agenda is agenda [1:31:23] setting. And uh Commissioner McGee, you [1:31:26] have something you'd like to [1:31:28] >> Yeah. I would just like to add I've had [1:31:29] » Yeah. I would just like to add I've had [1:31:29] some residents reach out to me on 144th [1:31:33] and 145th. And as you know, Marcy, [1:31:36] you've taken drives around that that [1:31:38] horseshoe. um [clears throat] 145th, you [1:31:41] know, uh I believe there's three or four [1:31:45] pools that have not been kept up and uh [1:31:49] they've reached out to me and a lot of [1:31:51] they have children on 144th and they [1:31:54] they don't want them to play outside [1:31:56] because of the mosquitoes that are just [1:31:58] breeding rampantly over there. So maybe [1:32:00] we can add that we can uh get together [1:32:02] and uh see if we can do something about [1:32:04] that. [1:32:08] anything additional that anyone else [1:32:10] would like to see on the agenda? [1:32:12] >> Madame Mayor, um [1:32:14] » Madame Mayor, um [1:32:14] I have the um plaque, the uh the key to [1:32:19] the city plaque [1:32:22] and um which we're going to discuss in a [1:32:25] few minutes. So, if we're trying to set [1:32:27] an agenda, then we probably need to let [1:32:30] the recipients [1:32:32] uh be present. [1:32:36] Um, so the next meeting that we have [1:32:38] that we're setting an agenda for will be [1:32:39] a workshop. [1:32:41] Do you want to present them at a [1:32:43] workshop or in a regular meeting? Yeah, [1:32:44] regular meeting. Yeah, [1:32:47] >> I agree. For the next [1:32:49] » I agree. For the next [1:32:49] >> regular meeting. [1:32:50] » regular meeting. [1:32:50] >> Regular meeting. [1:32:56] » Do we have any public comment? [1:33:00] Then next on the agenda is reports and [1:33:02] correspondence. Board of Commissioners [1:33:04] reports and correspondence and I think [1:33:06] commissioner is going to present. You [1:33:08] want to present this to the commission? [1:33:10] >> Um yes, I would love to have the [1:33:13] » Um yes, I would love to have the [1:33:13] commission take a look at this uh plaque [1:33:16] for the key to the city. [1:33:19] >> Um [1:33:21] » Um [1:33:21] >> and it'll have it would have this here [1:33:24] » and it'll have it would have this here [1:33:24] >> with Poppy on it. [1:33:26] » with Poppy on it. [1:33:26] >> And I would like to get some advice as [1:33:28] » And I would like to get some advice as [1:33:28] far as you know the notation that goes [1:33:31] on that plaque. Oh, [1:33:33] >> nice. Very good. [1:33:36] » nice. Very good. [1:33:36] >> I'd like to if you're asking for help, I [1:33:38] » I'd like to if you're asking for help, I [1:33:38] I'd give it some thought and send it to [1:33:39] you. [1:33:40] >> Would you? [1:33:40] » Would you? [1:33:40] >> Yeah, sure. [1:33:42] » Yeah, sure. [1:33:42] >> So, we could have that on our workshop. [1:33:44] » So, we could have that on our workshop. [1:33:44] >> And is So, just to be clear, is this a [1:33:46] » And is So, just to be clear, is this a [1:33:46] plaque that goes to the entity and stays [1:33:50] with them? Or is that a plaque that has [1:33:53] a list of people that get it from year [1:33:55] to year? [1:33:56] >> Goes to them and stay. [1:33:57] » Goes to them and stay. [1:33:57] >> So, the next time we give a key to the [1:33:59] » So, the next time we give a key to the [1:33:59] city, it'll be another plaque just like [1:34:01] this. We'll have two plaques because [1:34:03] we're going to give two keys to two [1:34:06] folks that we have discussed previously. [1:34:08] >> Okay. Yeah. But from the same entity. [1:34:10] » Okay. Yeah. But from the same entity. [1:34:10] >> Yes. [1:34:11] » Yes. [1:34:11] >> Yeah. So I'm just asking because it'll [1:34:13] » Yeah. So I'm just asking because it'll [1:34:13] make a difference on the wording should [1:34:14] say. So this is specific to that entity [1:34:17] and those people. So when we approved [1:34:20] this plaque, so when this came to us, um [1:34:23] we gave it to the commissioner go to go [1:34:25] out and work with the city clerk's [1:34:27] office to come up with a a plaque and a [1:34:30] key in the presentation way. This will [1:34:32] now be the way we present any key to the [1:34:34] city that we give moving forward. [1:34:36] >> Yes. [1:34:37] » Yes. [1:34:37] >> So this will be will this would [1:34:40] » So this will be will this would [1:34:40] >> nice. Yeah, [1:34:41] » nice. Yeah, [1:34:41] >> it looks nice. [1:34:43] » it looks nice. [1:34:43] >> Very nice. [1:34:44] » Very nice. [1:34:44] >> Thank you. Thanks for that work, [1:34:45] » Thank you. Thanks for that work, [1:34:45] Commissioner. Are we going to have [1:34:47] anything here that shows who we gave [1:34:50] keys to? [1:34:52] >> I mean, you know, [1:34:53] » I mean, you know, [1:34:53] >> so the city has been giving keys for [1:34:56] » so the city has been giving keys for [1:34:56] many years and that's never been done. [1:34:59] I'm sure that we could put something up [1:35:01] that said who got them, but there have [1:35:03] been a lot of keys over the years given. [1:35:06] >> It'd be nice. That's a good idea to [1:35:08] » It'd be nice. That's a good idea to [1:35:08] create history. [1:35:09] >> Yeah. I mean, because like they're [1:35:11] » Yeah. I mean, because like they're [1:35:11] taking this. So, and then and then did [1:35:14] we decide is it a year or how often are [1:35:17] we giving away the keys? [1:35:21] So, a commissioner gets to nominate [1:35:23] someone that they believe deserves the [1:35:26] key to the city. And we had quite a bit [1:35:28] of what I would call robust conversation [1:35:31] in um not just giving the key to anyone. [1:35:34] So I think in the past that I've learned [1:35:38] there were keys given [1:35:40] not particular they were given for lots [1:35:42] of different reasons and this commission [1:35:46] tended to lean towards giving a key to [1:35:48] someone that was exceptionally doing [1:35:51] something right. Not just handing a key [1:35:53] to everybody but it being [1:35:56] >> but so like this is one of the two keys [1:35:59] » but so like this is one of the two keys [1:35:59] or two keys that we're giving out for [1:36:01] 2026. [1:36:03] This is the highest honor that [1:36:04] >> right I mean but like is and and I'm [1:36:07] » right I mean but like is and and I'm [1:36:07] trying not to [1:36:09] >> degrade it you know so like you're just [1:36:12] » degrade it you know so like you're just [1:36:12] giving keys away keys away so we'll be [1:36:15] so like this is the two keys for 2026 [1:36:18] are given away [1:36:20] >> so I I that commissioner um Dylan [1:36:24] » so I I that commissioner um Dylan [1:36:24] bringing that up I think that because [1:36:26] currently there are only four items on [1:36:28] our agenda coming up for the workshop I [1:36:31] think it would be mindful to have a [1:36:33] discussion about the ordinances that we [1:36:35] have in place currently for keys, coins, [1:36:39] awards, those sorts of things. And that [1:36:41] will help us that will propel us also [1:36:44] into [1:36:46] um the anniversary of the city because [1:36:50] we're going to be doing awards for that, [1:36:51] too. So, if we could add that, then we [1:36:53] could have a really good conversation [1:36:54] about that. And because this is a [1:36:57] different commission um and we've [1:36:59] learned other ordinances that existed [1:37:01] that we weren't necessarily aware of. So [1:37:04] we can do that. I think that would make [1:37:05] for a great conversation. [1:37:08] >> If I may, um as we all know, August is a [1:37:12] » If I may, um as we all know, August is a [1:37:12] Purple Heart month [1:37:14] and um obviously right now it's kind of [1:37:17] late, but maybe we should set this up [1:37:19] from next year on to recognize Purple [1:37:22] Heart [1:37:23] >> with the American Legion right now. [1:37:25] » with the American Legion right now. [1:37:25] Yes. But [1:37:26] >> yeah, Eddie Eddie took the lead on [1:37:27] » yeah, Eddie Eddie took the lead on [1:37:28] working on Purple Heart. [1:37:29] >> Yes. No, I understand that. But as far [1:37:31] » Yes. No, I understand that. But as far [1:37:31] as like some sort of proclamation here [1:37:33] that we recognize this month as a Purple [1:37:36] Heart heart month. [1:37:38] >> Yeah. [1:37:38] » Yeah. [1:37:38] >> It would be just nice to [1:37:41] » It would be just nice to [1:37:41] >> Well, we can do that coincide that with [1:37:43] » Well, we can do that coincide that with [1:37:43] the resident of Madira Beach that [1:37:46] receives the recognition for the Purple [1:37:49] Heart. [1:37:49] >> Okay. [1:37:50] » Okay. [1:37:50] >> So, Commissioner, if you wanted to, we [1:37:53] » So, Commissioner, if you wanted to, we [1:37:53] can do that. We could do a proclamation [1:37:55] at our BOC workshop on the 26th. It [1:37:59] would be the end of the month, but we [1:38:00] could still do that if you want to. [1:38:01] >> Okay. I think that would be lovely if we [1:38:03] » Okay. I think that would be lovely if we [1:38:03] could do that. [1:38:04] >> I think the city clerk can prepare that. [1:38:07] » I think the city clerk can prepare that. [1:38:07] >> Yes. [1:38:08] » Yes. [1:38:08] >> I get send me all the information on it. [1:38:10] » I get send me all the information on it. [1:38:10] I can put something together. [1:38:12] One other item I wanted to bring up and [1:38:15] and I was talking to our city clerk as [1:38:18] far as um [1:38:20] um [1:38:24] as far as getting a raise and I I don't [1:38:27] think we have given her a raise since uh [1:38:30] her last evaluation. U am I correct? Um, [1:38:34] I've got the 3% over to board of the [1:38:37] same and we were supposed to get a [1:38:39] valuation every October and of course [1:38:42] it's late coming and we have another one [1:38:44] this coming October and it the [1:38:46] commission approved in the budget which [1:38:49] I was included for the up to 3% [1:38:51] depending on the numbers and [1:38:55] >> but but but my point right now is you [1:38:57] » but but but my point right now is you [1:38:57] you did not get a raise from last [1:38:59] October, right? So, it's [1:39:02] >> not the mayor, not the um the merit as [1:39:07] » not the mayor, not the um the merit as [1:39:07] the same as the other employees. [1:39:09] >> So, [1:39:10] » So, [1:39:10] >> she got the cola raise, not the merit [1:39:11] » she got the cola raise, not the merit [1:39:11] raise. [1:39:12] >> Right. [1:39:13] » Right. [1:39:13] >> Right. [1:39:15] » Right. [1:39:15] Anyhow, just wanted to bring that up. [1:39:16] >> Okay. [1:39:17] » Okay. [1:39:17] >> Yes, definitely. And that was in the [1:39:18] » Yes, definitely. And that was in the [1:39:18] budget, too, was it? [1:39:19] >> Yes. [1:39:21] » Yes. [1:39:21] >> And it was due October 2025. [1:39:26] » Anything additional? [1:39:29] Next on the agenda is the 2026 meeting [1:39:31] report. And I think that's just our [1:39:34] regular report that Clara provides for [1:39:36] us. [1:39:38] Any questions or comments on that? [1:39:42] Next on the agenda is city attorney. [1:39:45] >> Thank you, mayor. I don't really have [1:39:46] » Thank you, mayor. I don't really have [1:39:46] anything to add. I'd be happy to answer [1:39:48] any questions if anybody has any. [1:39:50] >> Any questions for the city attorney? [1:39:53] » Any questions for the city attorney? [1:39:54] >> Thank you. [1:39:54] » Thank you. [1:39:54] >> We feel secure having you here, Tom. [1:39:56] » We feel secure having you here, Tom. [1:39:56] >> Appreciate that. [1:39:58] » Appreciate that. [1:39:58] And next on the agenda is the city [1:40:00] clerk. [1:40:03] >> Um we've been doing a the city clerk's [1:40:06] » Um we've been doing a the city clerk's [1:40:06] office has been doing a complete scan [1:40:09] project and so we'll soon not have any [1:40:13] uh records stored at off-site storage [1:40:16] trying to get everything in the laser [1:40:18] fish. And the more we can get in there [1:40:21] the better for the community. and it's [1:40:24] like looking on your computer, you know, [1:40:26] your phone for information. So, we're [1:40:28] hoping that our public portal will turn [1:40:30] into that one day. And um we're also [1:40:34] getting ready to do a ready scan and u [1:40:37] the company is waiting on access to all [1:40:40] the share drives and stuff and it's [1:40:42] going to tell us what documents we have [1:40:45] and that's not in laser fish and [1:40:47] everything over the board. Um what our [1:40:51] final one is and all. So we can capture [1:40:54] all our documents that's somewhere [1:40:56] whether in email or um in these shared [1:40:59] drives and all we can get those the [1:41:01] final of those documents inside laser [1:41:04] fish for the public portal and which is [1:41:07] to the commission as well to look. So I [1:41:09] I'm really looking forward to that. Uh [1:41:12] the last piece to that ready scan is the [1:41:15] city manager and it given the um [1:41:21] the access to those share drives and [1:41:23] everything and they're ready to move [1:41:25] forward. And so we that should be done [1:41:28] this within probably a week and then we [1:41:31] get started from there. And so we're [1:41:34] really excited about it. [1:41:37] >> That's nice. Yeah. [1:41:39] » That's nice. Yeah. [1:41:39] >> Thank you, Clara. [1:41:40] » Thank you, Clara. [1:41:40] >> You're welcome. clear up a lot of space. [1:41:42] » You're welcome. clear up a lot of space. [1:41:42] >> Next on the agenda is the city manager. [1:41:45] » Next on the agenda is the city manager. [1:41:45] >> Uh I'd like to have Max come up and give [1:41:48] » Uh I'd like to have Max come up and give [1:41:48] you an update on the burger week and uh [1:41:52] I think a progress report on the seafood [1:41:56] fest and then I've got a few other items [1:41:57] I'd like to to catch you up on. [1:42:08] All right, mayor, board of [1:42:10] commissioners, I'm going to update you [1:42:10] kind of on everything that's going on [1:42:12] down at the recreation center um along [1:42:15] with special events. So, for athletics [1:42:17] over the summer, just so you are aware, [1:42:19] um we did run a specialty summer uh [1:42:22] basketball and volleyball specialty camp [1:42:24] um in conjunction with OciOla High [1:42:26] School, we utilize their indoor gym with [1:42:28] our joint use agreement. We had over 100 [1:42:30] kids participate in that uh that [1:42:32] specialty camp program. It's the first [1:42:33] year we've done this. So, um we're [1:42:35] really looking at expanding our athletic [1:42:37] programming uh in that aspect. So, um [1:42:40] right now we have fall youth soccer. Uh [1:42:43] registration is open. Um and then we're [1:42:47] also planning and looking forward at our [1:42:49] our winter programming. Um last year we [1:42:51] instituted the the volleyball the indoor [1:42:54] volleyball uh co-ed uh big big big hit. [1:42:57] So, we're looking to expand that even [1:42:59] more uh this coming uh winter spring [1:43:03] season. Um senior programming. So, our [1:43:05] Madira Beach Social Club is still on its [1:43:07] summer break. Um staff, we are [1:43:09] finalizing the schedule and programming [1:43:11] for the upcoming season. Um which our [1:43:14] first uh get together for the season [1:43:16] takes place September 14th. [1:43:19] Uh child care, we just recently wrapped [1:43:21] up another successful summer camp [1:43:22] serving approximately 70 children each [1:43:25] day. Um that program included daily [1:43:27] field trips and larger weekly trips uh [1:43:30] to places like the zoo, the aquarium, [1:43:32] educational outings. Um our after school [1:43:35] program uh is full for this season. So [1:43:37] we are operating on a wait list. That [1:43:38] program um it's limited by uh the space [1:43:42] of our facility. We can only legally [1:43:44] have so many children um in the rec [1:43:47] center uh for after school care. So we [1:43:49] are full. We have a wait list. Uh we are [1:43:51] accepting uh for that. Um, special [1:43:54] events. So, we are in the final planning [1:43:56] stages for the 3rd annual Madiraa Beach [1:43:58] Burger Week. Uh, that's taking place [1:44:00] August 21st through the 30th, as you all [1:44:02] know. Uh, 18 restaurants participating. [1:44:06] Um, [1:44:08] we have the burger bus taking place [1:44:09] August 22nd. So, tickets are on sale for [1:44:12] the burger bus if you are interested. We [1:44:14] are going to three different [1:44:14] restaurants. [1:44:16] um on the bus is a tour of all different [1:44:20] burger love and community fun. So, uh [1:44:24] that should be a really good time. Um [1:44:26] and then [1:44:29] to back up even more, Village Friday is [1:44:31] our burger week kickoff party as you all [1:44:32] know. Um that'll start at 6:00 down at [1:44:35] John's Pass featuring live music from [1:44:36] the Crowns. Um we'll be down there [1:44:38] handing out Burger Week passports. We [1:44:40] have some Burger Week giveaway promo [1:44:41] items. Um, we also have some Burger Week [1:44:44] merchandise that is for sale in the city [1:44:46] store. We will also have it down there [1:44:48] at Village Friday for sale as well. And [1:44:51] then we do also have Burger with the [1:44:53] Board on August 26th at the Cambria [1:44:55] Hotel. That's taking place from 12 to 2. [1:44:58] That's where you guys are going to serve [1:45:00] your burgers. And it's kind of a [1:45:02] spin-off of Conversations with the [1:45:03] mayor, but we're going to have a burger [1:45:05] with the board. So, really excited about [1:45:07] that. Um, [1:45:10] next big event we have coming up for [1:45:11] recreation wise is uh the 45th annual [1:45:14] John Best Seafood Festival. Um, so we're [1:45:18] we're in crunch time for that planning. [1:45:21] Uh, that's going to be the 23rd, 24th, [1:45:24] and 25th. Uh, vendor applications are [1:45:26] still open through the end of August. [1:45:29] Um, those can be found on johnspass [1:45:31] seafoodfest.net. [1:45:33] Um we are currently in the process of uh [1:45:35] booking entertainment for the three [1:45:36] stages. Um and we're also working on um [1:45:41] any sponsors and securing those last [1:45:43] minute partnerships. Um we have been [1:45:45] working on a partnership with iHeart [1:45:47] Media and JJ Taylor for the marketing of [1:45:49] the festival. So hopefully that pans out [1:45:51] well. Um, overall recreation is coming [1:45:54] off of a very busy summer and looking [1:45:56] forward to a strong uh fall event and [1:45:58] programming schedule and we're excited [1:46:00] about the upcoming events and the [1:46:02] opportunities to provide our residents, [1:46:04] visitors, and local businesses here in [1:46:05] Madera Beach. [1:46:07] >> Thank you, Max. That's awesome. [1:46:09] » Thank you, Max. That's awesome. [1:46:09] >> Any questions? We're good. [1:46:10] » Any questions? We're good. [1:46:10] >> Do we have any vegetarian burgers? [1:46:13] » Do we have any vegetarian burgers? [1:46:13] >> I have uh I have a shrimp burger. [1:46:16] » I have uh I have a shrimp burger. [1:46:16] >> Close. [1:46:17] » Close. [1:46:17] >> It's close. [1:46:18] » It's close. [1:46:18] >> Pescatarian. [1:46:19] » Pescatarian. [1:46:19] >> Pescatarian. Okay. [1:46:22] » Pescatarian. Okay. [1:46:22] I will uh I'll work on that though. All [1:46:23] right. Thank you. [1:46:27] » City manager, [1:46:30] » uh just a reminder, strategic planning [1:46:34] uh is August 21st, which is next Friday. [1:46:38] Um John's Pass dredging project has been [1:46:41] completed. Um and we are in contact with [1:46:46] uh Florida Department of Transportation [1:46:48] to figure out if they are completed with [1:46:50] their removal of debris. Um it does not [1:46:54] look like it is, but they may be [1:46:56] completed. So we may have to go back [1:46:58] into conversations with them on removing [1:47:01] more. The sand is already coming back as [1:47:04] you know. Um the snack shack [1:47:06] restoration. Um right now we're working [1:47:10] on the historic um des um designation. [1:47:15] Uh we're going to try to do a few things [1:47:18] in parallel to get the design the white [1:47:23] uh the white box design uh completed as [1:47:26] we're going through the historic [1:47:29] designation. [1:47:30] Um, [1:47:33] area three, uh, drainage improvement. I [1:47:36] believe Megan's going to come up and [1:47:39] talk about that real quick. Thank you [1:47:42] [snorts] [1:47:47] » and Kitty Park. [1:47:49] >> Good evening again, mayor and [1:47:51] » Good evening again, mayor and [1:47:51] commission. Um, area 3, they've finished [1:47:53] the milling today. So, all of the roads [1:47:56] have been mil. Um we will be doing our [1:47:58] walkthrough tomorrow to create the final [1:48:01] punch list um for items that need to [1:48:03] still be completed. So um but the [1:48:06] asphalt is down and it looks fantastic. [1:48:10] And Tom and Kitty Stewart Park, we are [1:48:12] working on finalizing the foundation [1:48:14] plan for the restroom. The restroom is [1:48:17] still in design. Not in design, I'm [1:48:19] sorry. Production drawings have been [1:48:21] approved. They're waiting for state [1:48:22] stamp approval. I believe Mercy was the [1:48:25] conversation we had last week. [1:48:27] >> I believe that's correct. [1:48:28] » I believe that's correct. [1:48:28] >> Yes. So, it's it's it's in progress, but [1:48:31] » Yes. So, it's it's it's in progress, but [1:48:31] because it's coming from another state, [1:48:32] it does have to make sure that the [1:48:34] Florida state approval it's stamped and [1:48:36] receives the FEMA approval and on all of [1:48:39] our regulations. Um, so that is still in [1:48:41] the works. We do, and you all have [1:48:43] already approved the not to exceed with [1:48:45] Keystone for the um not to exceed [1:48:48] $500,000 for the park restoration. So we [1:48:52] have been in talks with them about the [1:48:54] foundation plan and they are we don't [1:48:56] have the site plan finalized yet. So we [1:48:59] haven't been able to receive a proposal [1:49:02] from them but we have been actively [1:49:04] working with them so they are aware. Um [1:49:06] I am working on the landscaping plan [1:49:09] that you all asked to receive. I have [1:49:12] been a out of town um traveling a little [1:49:15] bit these days and I'm still working on [1:49:17] that. So I will have that for you for [1:49:18] the workshop meeting. [1:49:22] And then just an update on the paving. [1:49:25] Um you all received a not so great news [1:49:28] email from me yesterday regarding John's [1:49:31] Pass Village. [1:49:33] Um that is a unfortunate but the [1:49:37] contractor is aware and they are going [1:49:39] to fix um tomorrow we will be visiting [1:49:41] every single one of the shops. Has it [1:49:44] have has everyone received the email [1:49:46] from me? Okay. So the issue is is the [1:49:48] striping was incorrect. Um the only way [1:49:51] for us to actually receive what we paid [1:49:53] for is to mill and to repave those [1:49:56] places or otherwise it would just be [1:49:58] subpar and I'm not going to accept [1:50:00] subpar. So um it will be we will mill [1:50:04] Sunday night um one side of the road [1:50:07] pave Monday morning and then the the [1:50:09] next Monday night we will mill the other [1:50:12] side pave Tuesday morning and we will [1:50:15] stripe it. And the issue was is the [1:50:17] angled parking. The striper [1:50:20] did not double check his work. So it did [1:50:24] not meet the minimum standards and we [1:50:25] cannot accept that. And then Baypoint [1:50:28] has been completed as well. So that has [1:50:30] all been mil overlaid. So projects are [1:50:34] moving right along. [1:50:36] >> Thank you, Megan. Megan, I I have one [1:50:38] » Thank you, Megan. Megan, I I have one [1:50:38] question. Um the at Kitty Park the we [1:50:42] call it a seaw wall, right? Even though [1:50:45] >> a sand wall, seaw wall. [1:50:46] » a sand wall, seaw wall. [1:50:46] >> Yeah. So the cap is is that wood? [1:50:49] » Yeah. So the cap is is that wood? [1:50:49] >> It's recycled [clears throat] plastic. [1:50:51] » It's recycled [clears throat] plastic. [1:50:51] Yes. [1:50:51] >> So it is going to survive the moisture [1:50:55] » So it is going to survive the moisture [1:50:55] and Yes, sir. heat and everything. [1:50:57] >> That is what is on all of the docks that [1:50:59] » That is what is on all of the docks that [1:50:59] we have. That is also the stairs that [1:51:01] are at Archbald bathrooms. That is what [1:51:04] all of that is made out of. [1:51:06] >> I see. Okay. Thank you. [1:51:08] » I see. Okay. Thank you. [1:51:08] >> You're welcome. [1:51:09] » You're welcome. [1:51:09] I'd make a statement that well of course [1:51:11] I was just out there the other day [1:51:14] but what you have in that first island [1:51:17] as you come in is gorgeous. I mean it is [1:51:20] all drought resistant. [1:51:21] >> I would love to take that but that was [1:51:23] » I would love to take that but that was [1:51:23] not us. Catties actually planted that. [1:51:26] Um so we with your we can leave that in. [1:51:30] Um those are not typical plants that I [1:51:33] would plant. the grasses um get a little [1:51:35] bit too tall. So, they are over that 36 [1:51:38] in. So, they're over in the sight [1:51:40] triangle. Plus, those grasses get they [1:51:44] are pretty at first, but they are kind [1:51:45] of a bear to maintain and they collect a [1:51:48] lot of garbage. And then whenever you [1:51:49] have to trim them down, I don't know if [1:51:51] anybody's seen, but you have to cut them [1:51:53] almost like a buzz cut. And in my [1:51:57] professional opinion, they are not very [1:51:59] pretty. Well, like I say, I I what [1:52:02] you've done with the rest of the city is [1:52:04] perfect. Very well done, and I'm I'm [1:52:07] looking forward to what your [1:52:09] recommendation is. [1:52:11] >> Thank you. [1:52:11] » Thank you. [1:52:12] >> That's easiest to maintain and take care [1:52:14] » That's easiest to maintain and take care [1:52:14] of and drought resistant. [1:52:16] >> We love that. [1:52:18] » We love that. [1:52:18] >> Thank you. [1:52:19] » Thank you. [1:52:19] >> Thank you, Megan. [clears throat] [1:52:22] » Thank you, Megan. [clears throat] [1:52:22] Um this week we started our interview [1:52:25] process for the uh for the new RC [1:52:28] department head. Uh we are hoping to [1:52:32] have that selection by Friday or early [1:52:35] next week and then start the [1:52:38] negotiations to have that uh person come [1:52:41] on in within a couple of weeks. [1:52:46] >> Okay. [1:52:47] » Okay. [1:52:47] >> Awesome. [1:52:47] » Awesome. [1:52:47] >> That's all. [1:52:48] » That's all. [1:52:48] >> Thank you very much. Next on the agenda [1:52:51] » Thank you very much. Next on the agenda [1:52:51] is respond to public comment. We only [1:52:53] had one public comment and it was a [1:52:55] thank you. So, thank you Mr. Bellows for [1:52:58] coming and giving a compliment to staff. [1:53:00] They surely do deserve it. [1:53:03] And it is 7:52. [1:53:06] We are adjourned.
