[0:00] okay yeah okay uh it's 6 30 I think we've got [0:04] everybody here so let's go ahead and get started [0:12] all right looks like we do have a quorum everyone's present tonight [0:17] uh we need to uh review the agenda and see if there need to be any changes [0:24] it's nice to see a short one [0:31] yeah we've forgotten yeah [0:34] did anyone see any need to change the agenda [0:37] okay can I have a motion to approve the agenda [0:42] moved and seconded all in favor say aye aye any opposed [0:47] thank you all right we need to take a quick look at the minutes from October [0:52] 19th make any changes or [0:56] revisions in those [1:14] foreign [1:29] see any need to make a correction on those [1:37] uh if not can I have a motion to approve the minutes [1:42] moved any second moved and seconded all in favor say aye aye any opposed [1:50] thank you [1:53] all right uh the public hearing we have one case tonight as always [1:59] we will read through the case get response from legan for any questions [2:05] the applicant will have an opportunity to speak to the Planning Commission and [2:12] there will be time for public comment after that [2:17] case number su-01-23-1 [Music] [2:22] rooted Land Company LLC Mr Zachary Whitman has applied for a special use [2:28] permit to operate six short-term rental units on two adjoining Parcels which he [2:34] owns the two Parcels combined contain roughly [2:37] 257 acres and are identified on Madison County's tax maps as [2:44] 37-7c and 37-11 the 100 Acre parcel [2:50] 37-7c is zoned A1 Agriculture and in this zoning District more than one [2:57] short-term rental on a single parcel requires a special use permit [3:02] currently this parcel contains one by right three bedroom short-term rental [3:08] unit and an additional three bedroom short-term rental unit is proposed [3:14] the adjoining 157 acre parcel 37-11 is split Zone C1 conservation and [3:22] A1 Agriculture and a special use permit is required for more than one short-term [3:27] rental unit on a single parcel currently this parcel is undeveloped but [3:33] four short-terminal units are proposed the four short-term rental units would [3:38] be a three bedroom unit and three one bedroom units [3:42] the subject Parcels are located on graves Mill Road route 662. [3:47] the existing dwelling located on parcel 37-7c contains a postal address of 2410 [3:55] Graves Mill Road Madison Virginia all right leaving anything to add on [4:00] that no I'll um so [4:04] there is an existing one can I go to [4:09] um [4:11] can I get control of this right here [4:17] I was just going to go to [4:42] there you go [4:45] so if if you look at a little hatch line [4:49] so this Graves milled to the left that's where the existing dwelling that that [4:53] that's the one you know you see like with the candy cane that's with existing [4:59] and then it would the three bedroom at the very North the very top you see the [5:04] green line the red that would be roughly where and that's [5:07] where our Park site is that's with a three bedroom unit so that [5:10] parcel would have two units got an existing one and a [5:15] second one that's what 100 Acre parcel and then if you go to the net and if you [5:20] go to the next page if you come down keep scrolling down [5:26] you can actually go back up you can go back up [5:29] so if you look right keep going up on the next parcel itself [5:34] you see those keep can go back down right there so that's the 157 acre [5:40] parcel that's to the South joins [5:44] it'd be a the first one red you know Red Dot would be a three bedroom [5:50] and those three clustered together would be [5:54] three one bedrooms now they all have he has all the perk [6:00] sites and everything for each one um [6:04] it's really it's really requesting for short-term rental we say six I don't see [6:09] any problem with advertising for six but one would be right by right on each [6:14] parcel but we still we just sort of said we just said six not that's anything [6:19] wrong with that but um three [6:24] of the of the short-term units that are [6:28] proposed I'm saying that they would be [6:31] manufactured [6:34] what they call part Park Model Park Park Model RV is that right three of them so [6:40] it's three clustered right together and you got a visual [6:43] and those would be on a septic all be hooked into a septic they'd be within [6:47] close proximity to each other nothing you know there's nothing wrong [6:51] with as far as a building official we talked to Jamie [6:53] about that that's fine that's what Madison bonds has just FYI they have a [6:58] park model but I mean like Park like you're parking it it's not really [7:02] something that is you move around a lot and it can be put on a permanent [7:06] foundation you can bring electric to it the only thing it's just not meant for [7:11] full-time living as long as it's you know a short-term rental or a [7:16] non-full-time use they're quite nice and again [7:21] Madison bond has some units like this so you know my feeling is I mean we've been [7:28] to a lot of short-term rentals hearings lately is [7:33] this is obviously it's got one active one now on the [7:37] combined it actually owns 300 acres a little over 300 there's another parcel [7:41] that's not part of this request that he owns but [7:45] I think the scale is um kind of more [7:49] uh what we maybe are comfortable with a little easier so this is you know six of [7:56] that 200 some Acres um [7:58] VDOT doesn't really have a lot of comments [8:02] um there's a couple access points in in there on graves Mill there's a couple [8:09] different access points um [8:12] I'll let Zachary can you have any questions for [8:14] him you can ask him but other than that um [8:18] a few things that tie together before this would be [8:21] January 4th hearings we got another month [8:25] um and that'll that's it any questions for [8:29] me about this one or like what are those uh other white [8:34] blocks that you've got up there [8:40] yeah I think those are identifying textbooks those little white yeah okay [8:44] yeah so this um [8:48] so the access points the one that's down there off of uh Berry Mountain Road I [8:54] guess is there a uh an easement there's one a Roadies [8:59] meant one to that one right there because it looks like it's going through [9:02] two pieces of other pieces of property [9:08] the first the first easement I mean the first access right [9:17] yes [9:28] so yeah [9:33] behind bird Mountain Road or I'm sandwiching between Barry and Drake's [9:38] Mills if you're coming down Drake's Miller's Hollow back to the left the [9:41] first step down below uh to the right there if there's an old bridge shouldn't [9:46] be back on it before I did okay Ben Jim's hated for seven years that's it's [9:51] that parcel right down right next to Estes is my neighbor oh okay yeah I [9:56] don't know where it is the other question maybe what are we [10:00] seeing those three Parcels that are together right there what's that piece [10:04] of land grown [10:09] now we'll pull up [10:15] I did not like this handy yeah I got it [10:21] God I can't stand this so [10:25] that parcel is right here the the cabins are right in here it's a [10:30] it's a1c1 [10:33] the green right there [10:40] yeah right is that right is that right in here [11:00] three Park mobile homes and then the other two [11:05] would be the state built three bedroom [11:09] one guy would that require three Anchor Street [11:13] yeah but he's got it yes right that's what that's what [11:26] we're all of them together [11:31] it's a lot set back that's what I was asking [11:33] yeah I mean uh the uh you don't have to put on a separate parcel I mean the [11:40] setbacks we don't require that they have to be that just have to be out the [11:44] property line you know 125 feet from sides 50 from the rear [11:50] um as far as their cluster I mean the building thistle just [11:54] requires they be so many feet apart for fire protection but I don't see [11:59] doing this as any kind of issue with the zoning ordinance [12:04] um so all three of them can be on three [12:07] acres or one acre or whatever yeah yeah I mean I unless you have some concern [12:12] about it there's nothing in a code to me that [12:15] you know they're yeah I mean I I'm not aware of anything [12:19] I mean um unless you see something that would [12:23] be like I said the building Fisher wants a certain amount of Separation but I [12:27] mean they'll probably be what 20 30 feet apart [12:30] I mean at minimum [12:42] three legal reasons [12:46] the main road right there the mouse is serving over that's one of [12:50] these 24K [13:01] they'll all be installed so you're basically looking at a single entrance [13:05] off of Grace Mill Road then and then branching off yeah okay yep you [13:11] actually have he has two entrances but one will be the primary entrance [13:16] uh [13:22] yeah but these are the ones that are intended to service the short-term [13:26] rentals the ones that are shown here yeah [13:30] yes um [13:33] I think I know but I'll explain your rationale for [13:38] clustering the three units septic power [13:43] um [13:47] and just remember where all the Italians are [13:50] one those are one bedrooms so they only have one car as well [13:54] so everything could be compacted right there in one location so each each one [13:59] of the tiny homes will not have multiple Vehicles [14:03] so in one bathroom but it's mainly clustering to [14:11] limit the septic system to one serving three right and Road [14:20] Lincoln since we're obviously going with the Africa now I want you to give you [14:25] the mic so yeah [14:33] any other questions for the applicant yes well this is probably for League can [14:38] one septic field uh serve three of these yeah I mean we have to have three [14:43] bedroom septic if it's but yeah they could do that people people do that [14:48] same thing that's right [14:57] these all three look like they're right along the tree line where the [15:02] slope starts going up along that River Valley there correct I assume that's the [15:06] Rapidan there right uh if the rapid in there's also a smaller Creek negative as [15:11] well well we can't see that on this and it'll it'll be on great of course and [15:15] we'll go in and do dirt work to each one of the sides but [15:26] any other question [15:30] on your your three single bedroom [15:34] I guess I'll call them manufactured homes because I noticed that we don't [15:38] actually have a mobile home definition in our ordinance [15:43] are those going to be placed on permanent foundation correct yes sir yes [15:47] okay [15:50] look at how much land is being disturbed for this project [15:56] well you already have a road it goes back to that one [15:59] the it already pretty much is a road there's an existing farmer that goes to [16:03] each side right we're gonna we're gonna gravel it and probably put in a couple [16:07] of small culverts and then it would just be the footprint for each one of the [16:11] yeah so Maybe if it's all done at once [16:16] you might have each separate part maybe 10 you know it [16:21] might be a little less than an acre total not even I would even say it even [16:24] acre [16:32] and this doesn't actually have anything to do with it but knowing that stretch [16:37] of the river up there in that terrain uh it looks like your entrance does cross [16:42] the river right correct it does yeah I assume you have a large Bridge of some [16:47] kind where we're in the process of installing a new VDOT 100 000 pound [16:51] Bridge foreign [16:59] [Music] any other question for the applicant [17:07] pretty straightforward I got one so just for for the applicant [17:15] so you know we recently changed uh the way I see this map [17:21] um all six units are going to be serviced by a portion of the the [17:27] driveway off of uh Graves Mill Road correct so we passed not too long ago uh [17:34] you can have six units on a private Drive which this equals six except for [17:40] the fact that the park model RVs obviously could be removed [17:47] with some ease if you ever wanted down the line to to switch it out and build [17:55] regular family homes in there but they would have to go yes sir okay yeah and [18:02] that's part of the logic as well in case gotcha something doesn't work all right [18:05] I think it's incumbent upon all of us to let applicants know what they're getting [18:12] into sometimes okay that's all I got mm-hmm [18:18] any other questions for the applicant [18:23] be public comment [18:31] great but I'll address these comments [18:38] commission not to Mr Whitman but Mr Whitman uh not in my backyard crew will [18:43] be old yeah Mike would you come up to the Mike [18:51] foreign [18:58] I mean so have you talked to your neighbors have you I mean anybody [19:04] there'll be a hundred people in here I don't know about 100 but there's a bunch [19:07] of people in here and they will influence [19:11] not only the Planning Commission they will try to influence the board of [19:15] supervisor uh I I think that you should uh [19:19] especially when you're running through easements [19:23] you know you you probably need to really make sure that you can do what you want [19:27] to do through somebody else's problem uh [19:31] when does the sign go up Mr Webb um I'll wait till probably [19:36] middle of December uh sometime just because it won't be till January 4th [19:42] so sometimes and you you want that [Music] [19:49] they want this they need to come to the meeting on January 4th [19:53] understood and have you talked to anybody from the Piedmont environmental [19:59] Council no I don't know I would advise you to do that just to be they're aware [20:04] at least they're aware that you're going to do this and cross a string [20:10] thank you thank you [20:13] any other public comment [20:26] all right if not thank you for your application uh are there any additional [20:31] items uh from the Planning Commission or from the public [20:42] if not can I have a motion for adjournment [20:46] a second moved and seconded all in favor say uh okay [20:53] [Laughter] tip [20:59] go home and have dinner with your wife [21:03] yeah yes Dan [21:08] why you're early [21:12] oh okay you don't need one for being early okay yeah [21:17] made any all in favor say aye aye any opposed [21:22] there you go it was a a valid point [21:27] thank you
