that's a hundred percent [19:13] but that's definitely something you're [19:15] gonna have to look into because if [19:16] you're operating the road in a different [19:18] way if you look at the map talking about [19:30] potentially doing a design at Joe car [19:32] and Marvin we were ineligible to do so [19:34] in the past because we couldn't use [19:37] carpo money on that section of road now [19:39] we can [19:40] you're going to want to make sure that [19:43] any of your actions are not going to [19:44] result in those sections of roads being [19:46] taken off of the Federal Aid System or anything in the [35:20] Geo Bond but I know as we start the [35:23] publication education efforts we're [35:24] going to have a lot of questions on what [35:26] about me if I'm a private road owner are [35:28] you going to pave my road the roads [35:30] estimated for private roads were about [35:32] eight or nine hundred thousand dollars [35:34] in the past we've had I know at least [35:37] one subdivision possibly to come to us [35:40] and ask for an assessment which [35:43] basically allows for us to pave those [35:46] roads and do tax assessments on their [35:47] property over a course of however many [35:49] years we decide to do it [35:52] um essentially it's us running the money [35:53] and then charging back the property [35:54] owners in their tax bill we would still [35:57] have the same authority to foreclose on [35:59] property if that wasn't paid so the [36:01] recouping of the money is still very [36:03] high and it goes with the land so if [36:07] someone [36:08] is on a road today that's private and [36:11] they're planning on selling their house [36:12] in a couple of years they can still have [36:14] that road resurfaced and have the [36:15] subsequent homeowners pay for it if they [36:17] do the assessment it's a legal process [36:20] in the state of North Carolina I think [36:21] it goes up to eight to ten years so we [36:24] could essentially project out that cost [36:26] from eight to ten years and it's all [36:28] based on linear footage linear Road [36:30] footage footage [36:31] and 50 percent of those homeowners are [36:34] 50 of the linear footage owners would [36:36] have to agree [36:38] to that assessment [36:40] so Robinwood for example if they wanted [36:43] to come in and get their roads paved [36:45] they would have to Rally amongst their [36:47] neighborhood to get over 50 percent of [36:50] linear footage owners to say yes they [36:52] provide that petition to us we go out [36:55] and have an engineered study drawn of [36:57] how much it's going to cost then we [36:58] charge that back to them they they will [37:00] have to sign more additional paperwork [37:02] but we would charge that [37:03] assessment back to them and their tax [37:05] bill over the course of however long [37:06] y'all decided to do it [37:12] yes yeah yeah it would be an individual [37:15] assessment [37:16] so at Firethorne let's say the line so you would want to [46:20] include 14.9 million dollars for example [46:23] you could use up to that 14.9 but if all [46:27] the private roads don't come to fruition [46:28] then [46:29] you can repurpose that authorization you [46:32] can just let it lapse but even though [46:34] you're getting repaid back you still [46:35] need to have that max amount authorized [46:37] to issue the debt up front but you would [46:39] borrow but you the money that you would [46:41] use in the first tranche you would have [46:42] it paid back by the time the second [46:44] tranche is pulled so therefore you [46:45] wouldn't have as much as you've [46:47] estimated in the first or the second you [46:49] and I can talk about that offline from [46:51] the modeling standpoint it shouldn't it [46:54] shouldn't affect the bottom line [46:58] we'll talk about that the only other [47:00] thing I want to mention to you is the [47:02] potential for a traffic mitigation fund [47:04] this would impact the model [47:06] um over the course of five years that [47:09] I've been here we've constantly had [47:10] people come in and ask for Speed tables [47:13] stop signs that kind of stuff in their [47:15] subdivisions crosswalks [47:18] um pedestrian refuges like we've had a [47:21] lot of those requests we've offered to [47:24] do cost share with HOAs like when the [47:26] unfortunate case on Joe Carr where the [47:29] pedestrian [47:30] um [47:31] fatality we had about three [47:35] subdivisions over there that want to do [47:36] a pedestrian Refuge last crosswalk we [47:39] offered a call share with them none of [47:42] them were willing to do it at that point [47:43] in time so we we just want to know [47:45] do you all want to put some type of [47:47] money that reoccurs to help some of [47:51] these minor projects that come up [47:53] when they come up for these requests [48:09] like Marvin school or Joe Carr right [48:36] so [48:39] Marvin Creek had to Pony up their money [48:41] too for theirs right so let's just keep [48:43] it the same from that perspective but [48:45] then I agree if there's issues [48:51] right there [48:57] so what we can do and it's hard for us [48:59] to really say how much to put in there [49:00] because if you're talking about just a [49:02] crosswalk with lights and that kind of [49:04] stuff it's fairly cheap I say we [59:40] started this morning [59:42] and that that is beginning a near fiscal [59:45] 2026 assuming that we issue half the [59:48] bonds in fiscal year 2025. and then [59:51] three years later we're assuming we take [59:52] the second half and issue that and that [59:55] would be an additional [59:57] 2.75 cents [59:59] which would take us up to seven and a [1:00:00] half cents now again this includes an [1:00:03] above Market interest rate assumption so [1:00:06] obviously when the time comes for us to [1:00:08] issue the debt we'll have current market [1:00:10] interest rates at that time and we can [1:00:12] refresh the model to suggest for that [1:00:15] particular budget year what the property [1:00:17] tax rate would need to be but for [1:00:18] planning purposes we want to be a little [1:00:19] bit on the high side just so that we're [1:00:21] not missing the mark and cavity come [1:00:23] back to the public later with a property [1:00:25] tax increase above what we stated what [1:00:28] was the 2.5 [1:00:29] uh to 2.75 would be in fiscal year 2029. [1:00:36] at the max it would be seven and a half [1:00:38] cents um but as the principal and [1:00:41] interests on the bonds start to pay down [1:00:43] as presumably your value of a penny [1:00:45] [1:04:31] a presentation of Union County 2023 [1:04:34] critical intersection and Analysis and [1:04:37] consider adoption of resolution [1:04:38] supporting the Union County 2023 [1:04:40] critical intersection analysis [1:04:46] yeah [1:04:48] so this is [1:04:52] a really productive eight months [1:04:56] and [1:04:59] so we started in January we had a [1:05:02] stakeholders Committee comprising of [1:05:04] staff from each of the communities dot [1:05:07] carpo Union County and we met until [1:05:11] August our September meetings actually [1:05:13] supposed to be tomorrow but we cancel it [1:05:14] because we didn't necessarily need it [1:05:16] and [1:05:18] went through the schedule you see here [1:05:21] so we identified intersections based on [1:05:24] local knowledge [1:05:26] we confirmed our ranking across us [1:05:29] started collecting data on traffic [1:05:32] counts crashes [1:05:34] the configurations of the intersection [1:05:36] constructability concerns we went out [1:05:38] for public Outreach which was remarkably [1:05:41] successful we then analyzed all that [1:05:44] information and confirmed our scores for [1:05:46] the projects and then came up with our [1:05:49] top 15 that 15 is not a magic number [1:05:51] it's just what we in what we started [1:05:53] with seven years ago when we started [1:05:55] this process and we've [1:05:57] keep kept that same number as we have [1:05:59] done updates over the years and so now [1:06:01] in July and August into September [1:06:04] presentations and adoptions so we've [1:06:07] presented to most of the municipalities [1:06:09] that are impacted we actually have eight [1:06:11] that have locations which is good means [1:06:14] that there's a geographic dispersion to [1:06:17] the locations and we'll go to the Board [1:06:19] of Commissioners in mid-september for [1:06:23] adoption [1:06:24] so in terms of the public Outreach the [1:06:27] western part of the county was well [1:06:29] represented we had nearly 3 000 people [1:06:31] County Wide [1:06:33] um black or I'm sorry Marvin had over a [1:06:36] hundred respondents which was consistent [1:06:40] with half of the municipalities in the [1:06:41] county we had really good Outreach [1:06:43] priorities were safety and congestion [1:06:46] I'll note that I I didn't word the [1:06:48] question very well about safety and [1:06:50] congestion because I asked them [1:06:51] independently and when asked [1:06:53] independently people said that's the [1:06:54] number one priority which is obviously [1:06:56] impossible so I needed to have it in the [1:06:58] same question for the future but they [1:07:00] are both important and they're both [1:07:02] considered in the evaluation process [1:07:04] truck traffic it's a consideration it [1:07:06] wasn't a particularly strong one though [1:07:08] Geographic [1:07:10] dispersion not so much people wanted to [1:07:14] prioritize growing areas [1:07:16] bike ped it's a consideration it [1:07:19] shouldn't be the only reason why we [1:07:20] choose a location and congestion safety [1:07:23] comments were made throughout the county [1:07:25] on Transportation needs in general so we [1:07:28] heard a lot about a lot of [1:07:30] issues that weren't necessarily at a [1:07:33] specific intersection we also received [1:07:34] them for Indian land and and Charlotte [1:07:37] as as things that they just wanted to [1:07:40] get it off their chest [1:07:42] so the scoring process we used the [1:07:45] previous cycle used a a nice round [1:07:48] number of 100 it's now 115 because the [1:07:51] two rows at the bottom multimodal [1:07:53] considerations and constructability were [1:07:55] added it says that a project score or a [1:07:59] location scores better if there's a [1:08:01] readily identified pedestrian or bicycle [1:08:04] deficiency at that location or by [1:08:06] improving that intersection you're going [1:08:08] to help connect the network and then [1:08:09] constructability is let's let's [1:08:12] prioritize locations that are easier to [1:08:14] build than just hoping for the best and [1:08:17] so that was a consideration as well to [1:08:19] know how much [1:08:21] high power [1:08:23] electricity lines water sewer historic [1:08:27] buildings [1:08:28] other types of considerations that are [1:08:31] going to make a pro a project more [1:08:32] complicated [1:08:34] and the public Outreach process was very [1:08:37] useful we identified multiple [1:08:39] intersections that made it into the list [1:08:41] as a result of what the public asked to [1:08:43] say doesn't mean it doesn't mean it was [1:08:45] Mob Rules it just meant that they [1:08:47] identified issues that we then looked at [1:08:50] and said for most of them yes this is [1:08:53] the location that actually scores really [1:08:55] well and we should include it and one of [1:08:57] which is not necessarily in Marvin but a [1:08:59] lot of Marvin resonance would use which [1:09:01] is Ray Road and Marvin School [1:09:03] some locations didn't make it in [1:09:08] they're also not necessarily in this [1:09:10] part of the county more towards the [1:09:13] Indian Trail stylings Monroe area where [1:09:15] there are intersections that have [1:09:18] objectively bad congestion and safety [1:09:21] scores the problem is they've already [1:09:22] been essentially built out and so the [1:09:25] solution is not necessarily improving [1:09:27] that intersection it's improving the [1:09:28] corridor which is beyond our capability [1:09:32] of what we're considering through this [1:09:33] process [1:09:34] also the carpo [1:09:37] prioritization process for their [1:09:39] long-range plan historically is only [1:09:41] looked at Corridor widenings or New [1:09:42] Roads your Monroe expressways your [1:09:45] Providence roads of the world not [1:09:46] necessarily intersection improvements [1:09:48] but we successfully argued over the last [1:09:51] couple years that one there just isn't [1:09:53] enough money to do everything you've [1:09:55] talked about in the past and secondly [1:09:57] you can get a lot of [1:09:58] cost-effective improvements by focusing [1:10:01] at larger intersection particularly the [1:10:03] ones that are too expensive for the [1:10:04] locals to consider on their own a [1:10:06] perfect example is 75 and Potter which [1:10:09] is in downtown Mineral Springs if you're [1:10:11] driving towards Monroe on 75 it's a bad [1:10:15] intersection you have a lot right on the [1:10:17] intersection and a part of the reason [1:10:18] why the intersection is complicated to [1:10:20] improve because you have the railroad [1:10:21] tracks not even 100 yards to the north [1:10:23] why should a town be responsible for [1:10:26] improving an intersection and on an NC [1:10:29] Highway and a class one Freight Railroad [1:10:33] as opposed to the dot so that's why we [1:10:36] were able to successfully argue that in [1:10:38] situations like that they should be able [1:10:40] to be evaluated through carpo's [1:10:41] long-range plan meaning they make it [1:10:43] into the step and they get implemented [1:10:45] by the dot without local match and and [1:10:47] that impacts three intersections all of [1:10:50] which are actually going to be evaluated [1:10:52] in this step cycle uh 74 and 601 is one [1:10:55] of the highest Freight bottlenecks in [1:10:58] the entire region [1:10:59] Rocky River and Old Charlotte Highway [1:11:01] that is where the railroad the CSX [1:11:04] railroad going to Charlotte crosses at a [1:11:06] diagonal you actually have two railroad [1:11:07] crossings within 100 yards of that [1:11:09] intersection is horrible we actually [1:11:12] submitted that as a railroad project so [1:11:14] it might get funded not as a highway [1:11:15] Improvement project but as a railroad [1:11:18] Improvement project which is a different [1:11:19] pot of funds and then one in hemby [1:11:23] Bridge which are two intersections right [1:11:24] there in their downtown which have a [1:11:26] huge amount of flood Plains very [1:11:28] congested and is in need of improvement [1:11:31] it's going to be very expensive and [1:11:33] there's no way that hemby bridge could [1:11:35] come up with the local match on its own [1:11:36] that's actually being submitted as a [1:11:39] step project as well so we've we've [1:11:42] grown and matured and been able to take [1:11:44] advantage of different flexibility and [1:11:46] pots of funds to implement these [1:11:48] recommendations [1:11:51] so what people care about the most is [1:11:54] did my intersection make the list so [1:11:55] here's here's the list there's 15 uh [1:11:58] there is a score associated with them I [1:12:00] will not say that the highest scoring [1:12:02] one is the number one priority because [1:12:05] we partner all the time we obviously [1:12:08] have partnered with the village we've [1:12:10] partnered with the dot with [1:12:11] municipalities and [1:12:14] whoever wants to submit a project and [1:12:16] partner with us becomes our priority [1:12:18] this just helped us determine what [1:12:20] should make it into the list for example [1:12:23] were [1:12:24] committing seventy five thousand dollars [1:12:27] in partnership with Wesley Chapel for [1:12:29] the fourth intersection Newtown and [1:12:31] Cuthbertson we the dot said we think a [1:12:34] roundabout is the right thing to put [1:12:36] here [1:12:37] we don't have all the money we'd like to [1:12:39] go to carpo for some we need some local [1:12:40] match [1:12:41] Wesley Chapel and Union County would you [1:12:44] come up with the money [1:12:46] Wesley Chapel is already committed to it [1:12:48] Board of Commissioners are going to [1:12:50] consider that at their meeting on [1:12:52] Tuesday fairly confident that that's [1:12:54] going to get approved so that's an [1:12:57] example of partnership and how we're [1:12:59] moving these ahead [1:13:00] so I'll stop here for a sec do you have Road was on the Federal [1:13:43] Aid System The Dot may own 80 000 miles [1:13:47] of roads but only a subset of that the [1:13:50] most important roads actually are on the [1:13:52] Federal Aid System where they can use [1:13:53] federal dollars to make the Capital [1:13:55] Improvements that may be needed we were [1:13:58] able to between [1:14:00] City of Charlotte Union County and [1:14:03] Marvin we were able to successfully [1:14:04] argue that this road serves that caliber [1:14:07] of traffic and should be added it's [1:14:09] since been added so now it's an option [1:14:11] if the village in cooperation with the [1:14:15] county wanted to submit that [1:14:17] intersection to get designed and cost [1:14:20] estimates developed to help with future [1:14:22] Grant applications you also have the [1:14:24] option of Stacy Howie and wax on Marvin [1:14:26] I'll note that Union County [1:14:29] is willing to go into a 50 50 share on [1:14:33] the local match the estimated cost per [1:14:35] location is uh forty thousand dollars [1:14:38] that's the budget so twenty percent of [1:14:41] that's eight thousand dollars [1:14:42] we assume that if it's inside of [1:14:44] municipality we'll split at 50 50. so [1:14:46] your share is four thousand dollars [1:14:48] however we only have twenty thousand [1:14:50] dollars to work with so which means [1:14:51] we're talking five intersections five [1:14:53] intersections and we've had interest for [1:14:55] more than five so what [1:14:58] um we determined internally is a way to [1:15:00] be fair is to say okay with all the [1:15:04] municipalities that have two or more [1:15:07] locations you could consider we'll go 50 [1:15:09] 50 with you on the first one [1:15:11] but [1:15:13] for the subsequent one if you're willing [1:15:15] to put in all the match we could include [1:15:16] that in our list but otherwise you've [1:15:20] got to choose a location like if you [1:15:22] only want to go in on the 50 50 [1:15:23] Arrangement you'd have to choose which [1:15:25] one of these two locations you want to [1:15:27] have [1:15:28] um submitted as part of this design [1:15:30] Grant which is due to carpo at the end [1:15:32] of October so we have about two months [1:15:34] to figure this out and if you were [1:15:37] sitting in our chair how would you [1:15:38] prioritize that from if we had to choose [1:15:41] Joe car and Marvin [1:15:46] Beyond where where is uh where do we [1:15:49] stand with [1:15:51] uh [1:15:54] Waxhaw Marvin and bonds Grove Church we [1:15:58] executed the interlocal last week and we [1:16:02] are [1:16:03] we kind of run into a we'll work through [1:16:05] it but we're working we're we're working [1:16:07] through a little bit of Finance [1:16:09] contractual issues with the D.O.T [1:16:11] because our finance officer because [1:16:13] we're the we're the applicant [1:16:15] essentially and we're Contracting with [1:16:17] the dot the dot is saying well [1:16:21] you need to you need to acknowledge that [1:16:23] if there's overruns you're going to be [1:16:24] responsible for those two which our [1:16:25] finance department says well we don't [1:16:27] know what that number is so we can't [1:16:28] sign for it until we know what that [1:16:30] number is and it's that that [1:16:33] interpretation's actually and if Finance [1:16:36] director share you can confirm or deny [1:16:39] this that there's been recent changes in [1:16:40] like the responsibilities of Finance [1:16:42] departments for local governments that [1:16:45] kind of hits on that accounting [1:16:47] situation so we're trying to figure out [1:16:49] what to do but we'll we'll work on it so [1:16:52] that's the fact that we're in that [1:16:54] Contracting process right now so that [1:16:56] the dot can start the design process [1:16:58] concerning 12 months ago you were being [1:17:00] asked to consider putting grant money on [1:17:02] it is remarkably fast I mean yes Newtown [1:17:06] and Marvin's under construction right [1:17:07] now and that's great but how many years [1:17:09] ago did that process start so we're [1:17:12] pretty pleased that that's where we [1:17:14] actually stand with that right now [1:17:15] because that's got to be priority [1:17:17] especially when you're talking about the [1:17:19] widening of Providence that's we held [1:32:36] the public hearing on August 8th heard [1:32:39] from the residents we closed that public [1:32:41] hearing and tabled the decision so this [1:32:44] is kind of that discussion portion [1:32:45] between the council [1:32:46] I do want to kind of go over uh just to [1:32:49] refresh your memory of the staff report [1:32:51] of the submittal and highlight some kind [1:32:54] of key points so this middle is for the [1:32:57] rezoning of the former Scott Wide [1:33:01] Property crane house property uh from [1:33:04] Marvin residential to the Marvin [1:33:06] Heritage District commercial only [1:33:08] the applicant is zapsa at all at all [1:33:14] um but uh zepsa Capital LLC they are [1:33:18] proposing to renovate the existing home [1:33:20] at a commercial kitchen and the proposal [1:33:24] of two additional commercial mixed use [1:33:26] retail buildings on the site [1:33:30] um [1:33:31] the applicant also uh [1:33:33] the the site from a buffer standpoint [1:33:36] it's a 20-foot no uh undisturbed buffer [1:33:40] on their property to couple with the 30 [1:33:42] feet of The Preserve common open space [1:33:44] for a total of 50 feet that back [1:33:46] building sits 84 feet off their rear [1:33:49] property line it sits 114 feet from the [1:33:52] property line of any Residential [1:33:53] Properties in The Preserve [1:33:56] um [1:33:58] the applicant is proposing [1:34:00] 28.26 percent of landscaping and [1:34:02] buffering about 12 percent of [1:34:04] pedestrian-oriented Hardscape and [1:34:06] outdoor amenities this total is 40 [1:34:08] percent of reserved open space for the [1:34:10] development which is succeeds the [1:34:13] minimum of 30 percent per the ordinance [1:34:16] the applicant is also proposing a [1:34:20] to construct originally [1:34:23] the easement at the front for the Marvin [1:34:26] Loop they were dedicating and he's been [1:34:27] to the Village but they have offered to [1:34:29] construct that eight foot path of their [1:34:32] portion of the Marvin loop it's per the [1:34:35] standards and has to be approved by [1:34:36] ncdot and us so it's going to be built [1:34:38] to the design standards that we're [1:34:40] working on for that Marvin Loop project [1:34:43] they're also proposing that connector [1:34:45] piece at the back of their lot to [1:34:46] connect with The Preserve internal Trail [1:34:50] the vehicle and access and [1:34:52] transportation [1:34:53] the property is being proposed to be [1:34:55] accessed from Newtown Road it will be a [1:34:57] right in right out configuration the [1:35:01] applicant has also agreed to consult [1:35:03] with DOT of any additional Road [1:35:05] improvements for their driveway entrance [1:35:10] and all that will be taken care of [1:35:11] during the preliminary plot and [1:35:13] construction document phase [1:35:15] parking the developer is proposing 53 [1:35:17] regular parking spots and four Ada [1:35:20] accessible parking spots for a total of [1:35:22] 57. as you recall the Marvin Heritage [1:35:25] district form-based code does not have a [1:35:27] minimum parking standard for non-ada [1:35:30] spots but this roughly equates to one [1:35:34] and [1:35:35] 400 square feet of commercial one spot [1:35:38] for every 400 [1:35:40] square feet of commercial retail space [1:35:43] the applicant is also looking to secure [1:35:45] additional shared use parking options on [1:35:46] other adjacent sites that will that's [1:35:49] that's the um that is up to the [1:35:52] applicant developer to secure those in [1:35:54] riding and work those agreements out [1:35:57] with any adjoining property owners as [1:35:58] they so choose [1:36:03] um I do want to hit on [1:36:05] the some of the deviation questions that [1:36:09] kind of came up during the public [1:36:10] comment because the applicant and their [1:36:12] some their current submittal being [1:36:13] considered there's only three requested [1:36:15] deviations there's not eight uh prior to [1:36:18] at their first submittal they submitted [1:36:20] a deviation chart perk that's required [1:36:23] per our ordinance those deviations [1:36:26] um regarding [1:36:28] setback building size all that stuff was [1:36:31] uh not needed because the form-based [1:36:34] code was amended those amendments were [1:36:35] being [1:36:37] addressed by staff and the village [1:36:39] attorney way prior to actually receiving [1:36:41] their application [1:36:43] um that went through planning board [1:36:44] Council approved those so there's their [1:36:47] proposal is compliant the only three [1:36:49] deviations left are the parking spots [1:36:52] being nine by 18 our ordinance requires [1:36:56] 10 [1:37:00] sorry hold on [1:37:03] where's that are the ordinance requires [1:37:05] 10 by 20 staff is okay with 9x18 that's [1:37:08] what we the minimum parking standard for [1:37:10] DOT that is also the minimum parking [1:37:11] size in Marvin Gardens [1:37:14] the applicant's also proposing to do a [1:37:16] crushed concrete parking service [1:37:18] compared to Paving the ordinance does [1:37:20] require that parking lot spaces must be [1:37:22] paved over any spots over 10 parking [1:37:25] spots [1:37:26] staff's okay with this deviation request [1:37:28] as well is because it does promote kind [1:37:30] of that Rural Preservation feel it also [1:37:32] helps with uh less impervious surface [1:37:34] they will they are required to do a [1:37:37] maintenance planning agreement for their [1:37:39] parking service so if if the rezoning is [1:37:41] approved they will submit that [1:37:43] maintenance plan in agreement with their [1:37:46] construction documents [1:37:48] the final deviation that's left is the [1:37:50] no designated loading space the [1:37:53] ordinance requires a 12 by 25 loading [1:37:55] space [1:37:56] they the applicant is proposing two [1:37:58] there's two parallel spots at the top of [1:38:01] the site [1:38:02] sorry I don't have it pulled off [1:38:05] but up here by their trash and I can [1:38:07] pull it up in PB those are going to be [1:38:09] designated [1:38:10] um a designated loading zone During [1:38:12] certain hours but it'd be used for [1:38:14] parking and outside those hours [1:38:16] so those are the only three deviations [1:38:18] being requested as part of the submittal [1:38:22] and the other five [1:38:24] that were I guess brought up [1:38:28] we were changing those deviations [1:38:31] before they even purchased the property [1:38:33] correct [1:38:35] and those and those five deviations were [1:38:38] based on [1:38:40] other municipalities and being coming up [1:38:43] to other Municipal other municipalities [1:38:47] standards correct earlier this year with [1:38:50] meeting with certain Property Owners [1:38:51] within the Heritage district and kind of [1:38:54] going through hey how you know working [1:38:55] on submittals they pointed some things [1:38:58] out dealing with inconsistencies and [1:38:59] kind of how it uh really impacts [1:39:03] even getting to the develop like getting [1:39:05] to the point where they can propose [1:39:06] something to us I discussed this with [1:39:08] chaplain chaplain identify him and I [1:39:10] both went through it highlighted [1:39:11] sections that were inconsistent didn't [1:39:13] make sense and those were sections that [1:39:15] were that were addressed [1:39:17] the applicant was following that process [1:39:19] because they submitted their rezoning [1:39:21] after the fact and obviously we're aware [1:39:22] and so when they when it was going [1:39:24] through planning board they catered the [1:39:27] the their side to what planning like the [1:39:29] ordinance that planning board [1:39:31] recommended so that's why it was kind of [1:39:33] following that process but other than [1:39:34] that yeah those those amendments started [1:39:37] prior to the rezoning okay and the three [1:39:40] remaining [1:39:41] deviations would you say that they would [1:39:44] be consistent with other municipalities [1:39:47] uh yes I mean the um parking space like [1:39:51] I said the 9x18 ncdot standard we also [1:39:54] allowed that that's the minimum parking [1:39:56] space requirement for Marvin Gardens the [1:39:58] parking surface most other [1:39:59] municipalities [1:40:01] you know they are the form-based code [1:40:03] says it has to be paid most of their [1:40:05] municipalities have in there where it [1:40:07] says [1:40:07] must be paved or you know some type of [1:40:11] hard surface Crush gravel something like [1:40:13] that and then it always has some turns [1:40:15] in there but it's uh subject to maybe [1:40:17] you know Village engineer or you know [1:40:19] Municipal engineer or planning directors [1:40:21] um discretion uh and same thing with the [1:40:24] loading zone most ordinances do require [1:40:26] a loading zone for any type of [1:40:27] commercial retail establishment [1:40:30] um [1:40:31] and they're still providing that but [1:40:33] it's also it's just how the [1:40:34] functionality of their site that's why [1:40:36] they're requesting this deviation [1:40:37] because it is a lot like a long and [1:40:39] narrow side compared to something that [1:40:40] has a little bit more movability per se [1:40:44] okay because I just want to make sure [1:40:45] that we're that we as a village are [1:40:48] consistent with other municipalities so [1:40:50] someone you know can't come in and say [1:40:53] that the that [1:40:54] were inconsistent right and the changes [1:40:57] that were made to the form-based code [1:40:58] were all when I took um was presenting [1:41:01] it to planning board like I said it was [1:41:02] in planning board for three months it [1:41:04] was April May and June [1:41:06] um [1:41:08] I provided them research of about 10 [1:41:10] different municipalities and what their [1:41:12] ordinances read for kind of similar like [1:41:14] neighborhood commercial [1:41:16] districts and that's how that those [1:41:19] amendments the form-based code were made [1:41:21] or derived were out of looking at [1:41:24] what other municipalities are doing how [1:41:26] it best impacts and best fits Marvin and [1:41:29] um you know to mention too is like I [1:41:30] said it's conditional zoning District so [1:41:33] things can always kind of be greater [1:41:35] than what we uh [1:41:38] can always kind of be amended to be [1:41:40] greater or requested to be greater than [1:41:41] what's in the ordinance okay thank you [1:41:49] so finally [1:41:51] um [1:41:51] after some discussion too with the [1:41:53] applicant and from the public hearing [1:41:55] the applicant has agreed on their site [1:41:57] plan to do a fence on the side property [1:42:00] line between the church and their [1:42:03] property they've also agreed to raise [1:42:05] the height of the fence to seven feet uh [1:42:09] from six to seven so it'll be seven feet [1:42:10] on the side and rear [1:42:16] um [1:42:20] honor I know that we we haven't [1:42:24] um [1:42:27] we're scheduled to have a meeting with [1:42:32] uh Weddington Methodist [1:42:35] so how does that impact any of this [1:42:37] today [1:42:38] if there's an like I said it goes back [1:42:41] to that shared agreement for parking [1:42:44] they are proposing the 57 spots on their [1:42:46] site [1:42:47] the districts intended like I said it's [1:42:50] kind of you know piece Milling like we [1:42:51] have the [1:42:53] no minimum parking standards because [1:42:54] it's supposed to be kind of a you know a [1:42:56] Village Center intertwined type [1:42:57] development throughout this is just the [1:43:00] first application it is one of the [1:43:02] smaller properties so if the applicant [1:43:04] does secure you know some type of shared [1:43:06] parking agreement through the church per [1:43:08] se [1:43:09] um it would not I mean impact this [1:43:12] rezoning it would just it would actually [1:43:13] benefit them it would it could also [1:43:15] potentially benefit the church [1:43:17] okay I just want to because I just want [1:43:19] to be [1:43:22] aware of and have everyone aware of work [1:43:25] that that we're still working through [1:43:28] other [1:43:30] concerns from the church and respectful [1:43:34] of them that that we work through those [1:43:36] concerns continue to work through those [1:43:38] concerns correct yeah yeah the [1:43:41] their site plan has those vehicular [1:43:44] stubbed to adjacent properties there at [1:43:46] the rear like I said that is [1:43:49] set up through the ordinance to have [1:43:51] that interconnectivity between [1:43:52] properties so potentially you know [1:43:55] additional parking could be at the rear [1:43:57] there could be some additional parking [1:43:59] at the front but that just has to be [1:44:01] agreed upon between the property owners [1:44:03] okay [1:44:11] Hunter for for mayor may I speak this is [1:44:13] chaplain Spencer we've also got the [1:44:15] development agreement you previously saw [1:44:18] a draft of the development agreement [1:44:21] in this zoning District [1:44:23] and in accordance with the proposed [1:44:25] ordinance if you do move forward with [1:44:27] approval you approve the development [1:44:29] agreement at the same time which sets [1:44:32] forth supplemental terms and conditions [1:44:35] there have been some minor deviations [1:44:39] and clarifications from the development [1:44:41] agreement that you saw in your agenda [1:44:43] packet [1:44:44] at the the first meeting uh one is in [1:44:48] section 4.3 vested rights [1:44:50] they proposed 10 years that would give [1:44:53] them 10 years to develop uh without any [1:44:56] changes or modifications in our rules [1:44:58] and regulations [1:45:00] I had originally suggested I think three [1:45:03] but hunter said that was um [1:45:05] too tight and he didn't like that I [1:45:08] think Hunter was at Bob the draft [1:45:10] language is for seven years and that's [1:45:12] something that Council can discuss also [1:45:15] in section 4.4 are the uses we added [1:45:19] language [1:45:20] so that each of the three special permit [1:45:24] uses that being the restaurant serving [1:45:28] alcohol the micro Brewery and the vet [1:45:30] clinic each one of those is now limit [1:45:33] limited to one use so there could only [1:45:35] be one restaurant unless they came back [1:45:37] before the board [1:45:39] or for a minor Amendment which they [1:45:41] could certainly do but they would have [1:45:42] to get another permit if there's a [1:45:45] second restaurant or a second [1:45:46] microbrewery [1:45:48] uh and we also addressed uh [1:45:52] the parking [1:45:55] uh and the um [1:45:58] and the sidewalk [1:46:00] um issues and just clarify that a little [1:46:02] bit more [1:46:04] along with regulations on the hours of [1:46:07] um the noise [1:46:13] chaplain where did you say the vested [1:46:15] rights were four section 4.3 [1:46:23] 4.6 [1:46:25] the term is seven the term is 4.3 so the [1:46:29] term of the agreement is kind of their [1:46:30] vested period so it is 70. okay all [1:46:33] right okay thank you [1:46:41] so all the all the terms within this [1:46:43] development agreement have already been [1:46:45] agreed upon by the applicant [1:46:49] um they have been discussed with Council [1:46:51] uh [1:46:53] so all these have been mutually agreed [1:46:55] upon but this is just kind of the the [1:46:57] document that kind of makes it binding [1:46:58] it does get recorded it incorporates the [1:47:01] site plan and all those Provisions uh [1:47:03] the elevations and all that [1:47:14] Hunter is there somewhere in here where [1:47:16] there cannot be a second hand [1:47:21] store remember we talked about that that [1:47:24] is yes that's the way they still have to [1:47:26] go through the special use permit [1:47:27] process [1:47:29] yeah but you said that we couldn't deny [1:47:32] it that way so we were going to put it [1:47:34] in this that and no buildings could they [1:47:36] have a second hand store until we get [1:47:38] that changed on the [1:47:41] use list [1:47:45] I don't know where's the group at City [1:47:50] that's what I'm saying I want that [1:47:54] basically is just to prohibit [1:47:57] um the use of because the way the [1:47:59] language reads it was a concern of [1:48:01] counsel [1:48:02] um [1:48:03] prohibit consignment thrift secondhand [1:48:05] store [1:48:06] as it just said prohibited use [1:48:13] it's [1:48:14] I don't I don't want a good will rolling [1:48:17] up in here and we can't prohibit [1:48:20] specific companies from being here [1:48:22] Goodwill would be second-hand [1:48:24] Consignment and I do not want a Goodwill [1:48:26] in there so I would [1:48:28] prefer that that is not a use that would [1:48:31] be allowed in this until we can get it [1:48:33] off of this list for the entire they would probably have to have in [1:54:22] their own kind of type of lease [1:54:23] agreement [1:54:24] um we can't get into regulating [1:54:30] they're not sure what they're going to [1:54:32] do with that [1:54:33] I think that would they be able to [1:54:35] they'd still have the same opportunity [1:54:39] correct [1:54:44] they would likely do that on the private [1:54:45] end to not have competitive tenants so [1:54:49] they would be long-term tenants I would [1:54:50] assume [1:54:58] oh yeah [1:55:03] yeah they want to put an ice cream store [1:55:05] in it but they the other Marvin [1:56:20] Heritage District small area plan [1:56:22] the Marvin the village of Marvin 2020 [1:56:24] land use plan designates this area as [1:56:26] the Marvin Heritage district and the [1:56:28] Marvin Heritage District a small area [1:56:30] plan further designates the subject [1:56:32] property to the Marvin Heritage District [1:56:34] commercial only [1:56:36] the scale of development is consistent [1:56:38] with the adopted plans furthermore this [1:56:39] development is consistent with the goals [1:56:41] and purpose of the plan by the following [1:56:43] cultivating a sense of community and [1:56:44] creating a gathering place within the [1:56:46] Heritage District maintaining the rural [1:56:48] character and Heritage [1:56:50] providing development adjacent to [1:56:52] existing neighbors that are compatible [1:56:53] in terms of intensity scale and [1:56:55] architecture [1:56:56] providing conservation land or fee and [1:56:58] Liu for future Greenway connections and [1:57:00] additional pedestrian oriented amenities [1:57:01] creating a walkable compact core of a [1:57:04] neighborhood friendly commercial retail [1:57:05] and public use uses and spaces [1:57:08] reuse of existing single-family dwelling [1:57:11] architectural consistent with new and [1:57:13] old development in the area maintaining [1:57:16] rural Aesthetics [1:57:17] proposing and further incorporation of [1:57:19] appropriate traffic calming strategies [1:57:21] and providing shared Parking Solutions [1:57:23] slash options of future vehicular [1:57:24] connectivity within the district [1:57:26] the proposed rezoning of 9908 Newtown [1:57:28] Road from R Marvin to the Marvin [1:57:31] Heritage District commercial only is [1:57:33] reasonable and and is in the public [1:57:35] interest because it promotes the goals [1:57:36] and recommendations of the adopted 2020 [1:57:38] land use plan the Marvin Heritage [1:57:40] District small area plan and any other [1:57:42] officially adopted plans [1:57:56] there's a typo [1:58:03] nope [1:58:06] I know we've we go to it for a vote um [1:58:10] you know I I want to assure that [1:58:15] the audience that this we've looked at [1:58:19] this for numerous years before I was [1:58:22] even elected this has always been talked [1:58:25] about a Heritage district and what could [1:58:27] be in this [1:58:28] District [1:58:30] it required probably a land use change [1:58:34] or plans that we did [1:58:36] it was vetted by planning board members [1:58:41] and I think uh to the concern I and I [1:58:46] I hear the concerns of some of the [1:58:48] residents that that abut to this [1:58:50] property but uh you know I gotta say I'm [1:58:53] I'm not I think the biggest concern I [1:58:55] heard was safety [1:58:57] and I [1:58:59] I can't obviously nobody can promise [1:59:02] anything but if it's related to the [1:59:04] alcohol being served I I I'm trying to [1:59:08] wrap my head by this [2:05:03] um I'm not I don't well I do know that [2:05:07] when I asked her about getting rid of [2:05:10] the moat that would have been part of [2:05:12] the Topo because they didn't actually do [2:05:14] exact Topo so I don't know if the [2:05:16] grading is exactly 100 accurate so it [2:05:20] very well could be I just don't want to [2:05:22] have the expectation that it's going to [2:09:45] can kind of see if it's from the [2:09:47] irrigation which is what we think it is [2:09:49] or if it's groundwater so since they [2:09:52] said it was a leak and they went in to [2:09:54] fix the leak and they broke up all the [2:09:55] concrete and there was no leak uh we [2:09:58] shouldn't have to pay for that and they [2:10:00] need to give us our money back and give [2:10:02] us some money to fix it so we had we've [2:10:04] been fighting them and unfortunately the [2:10:06] leak and the leak person so [2:10:09] Roto-Rooter was called Roto-Rooter came [2:10:11] out they said that they can't identify [2:10:13] where the leak is coming from they [2:10:15] recommended a vendor come out called [2:10:17] leak Squad leak Squad came out they shut [2:10:20] the lines down they ran pressurized [2:10:22] tests they do use this audio device that [2:10:25] they put into the pipes to see where [2:10:27] it's coming from or in the ground they [2:10:28] heard something in the area where they [2:10:31] marked that it was a leak we think that [2:10:34] what they heard was a frog [2:10:36] um [2:10:37] they yes [2:10:40] which one of our experts you have to be [2:10:43] there to get the whole story Joe but yes [2:10:46] yeah so [2:10:52] they they marked it off they came in to [2:10:54] locate the city came or the utilities [2:10:56] came in did a locate on the gas line [2:11:00] um they came out the the crew [2:11:02] Roto-Rooter then came back out they [2:11:04] actually did what the contract said they [2:11:06] were supposed to do excavate find the [2:11:09] location where it was located and then [2:11:10] make the repair so they were out here [2:11:12] for probably I don't know three hours [2:11:14] Excavating isolating the line getting [2:11:18] ready to do the repair so per the [2:11:19] contract they really have done [2:11:21] everything they said they were going to [2:11:22] do except for the repair section we have [2:11:26] asked them to deduct that from the bill [2:11:27] which they have done I'm also still [2:11:30] trying to fight with the leaked person [2:11:31] to say basically that you came out here [2:11:33] and identified a leak and there was no [2:11:35] leak so until we can fully discover that [2:11:37] there is truly no leak [2:11:40] we're kind of at a standstill right now [2:11:42] we've dug the hole still dug out which [2:11:44] is why we've got it still open because [2:11:46] we want to make sure it's still in fact [2:11:47] not a leak where they said it was [2:11:50] um [2:11:51] it's it's rained every single day since [2:11:54] uh since it's happened the whole dug up [2:11:56] did they go back and do that [2:11:59] audio thing and [2:12:01] because that's where they can determine [2:12:03] where no they haven't yeah okay because [2:12:05] I would recommend wouldn't that make [2:12:07] sense after it stuck up because if it's [2:12:09] saying it's there and they look and it's [2:12:11] it's clearly not there well it wasn't [2:12:13] there when when they were out when they [2:12:15] actually excavated everything and to [2:12:16] isolate where this they said the leak [2:12:18] was [2:12:19] there was no there was nothing coming [2:12:21] out we waited a couple of hours while [2:12:24] they were here and left it open it [2:12:25] nothing happened they went shut off the [2:12:27] water shut it back on nothing changed we [2:12:30] also left it there the entire day it [2:12:32] didn't fill back up it did fill back up [2:12:34] the next day because it rained [2:12:37] um and we were going to keep it filled [2:12:39] up until it dried out we were gonna [2:12:41] we were gonna keep it I'm sorry keep it [2:12:43] open until it dried out completely so we [2:12:45] were able to turn the irrigation back on [2:12:47] to see if it actually filled back up [2:12:50] but unfortunately it's rained every day [2:12:52] since then [2:12:53] um what we third thing I want to add [2:12:55] just for clarification for Joe [2:12:58] one of the tests that they did was they [2:13:00] turned off the main valve in Christina's [2:13:03] office for a 24-hour period and looked [2:13:06] at the at the meter there was no change [2:13:08] in the meter so there's no way there [2:13:13] could be a leak between that it's not on [2:13:16] any of our main lines so it's not [2:13:18] underground and we did it again we did [2:13:21] it we did that twice they did it twice [2:13:23] result there's no water escaping [2:13:25] anywhere so therefore I feel very [2:13:28] confident in the fact that there's no [2:13:30] leak between the building and the meter [2:13:33] at the road with the fact that we've had [2:13:35] rain and with what we just discussed [2:13:38] is it drainage [2:13:40] is it the foundation it works [2:13:44] I feel like and and this is why we're [2:13:46] back at the irrigation because what [2:13:49] we've found is the irrigation box stays [2:13:51] full of water the valve box that's by [2:13:53] beside the side and it's off of a well [2:13:55] correct it's off the well yes but it [2:13:58] comes around but right where I'm getting [2:14:00] at it is is there were several [2:14:02] underground uh passages under the [2:14:04] sidewalk and such for the irrigation [2:14:06] that would have the water if it's [2:14:09] leaking in that valve box and filling [2:14:11] that valve box there's opportunity for [2:14:13] it to run underground and and come to [2:14:17] that point so the reason [2:14:20] we feel like it is the valve box has is [2:14:24] is leaking water in there as the other [2:14:25] valve boxes on the property are dry [2:14:27] that's the only one that seems to be [2:14:29] consistently full of water so [2:14:33] I'm not seeing 100 percent there could [2:14:37] be some other source but we want to rule [2:14:39] that out because that's the next most [2:14:42] likely Source if that is not in in fact [2:14:44] the source of water then there is [2:14:48] something that [2:14:50] is either groundwater like a [2:14:54] spring under here somewhere or something [2:14:57] that was missed in the soils [2:15:02] preparation which they did a lot of [2:15:05] undercut and replacement of soil on this [2:15:09] property before this building was built [2:15:10] because of the if you remember I'm not [2:15:12] sure if y'all remember this but there [2:15:13] was a whale that was on the property [2:15:15] that [2:15:17] they had closed that they had identified [2:15:19] in construction from my understanding it [2:15:21] was closed off everything was done like [2:15:23] it was supposed to [2:15:25] um so I don't know it's well it's [2:15:28] actually not even on our property the [2:15:30] well that was identified was is on [2:15:32] Robbie's property it's that little box [2:15:34] over there then subsequently we found [2:15:37] another well [2:15:38] which is way up by the road when they [2:15:41] cleared that has been capped so there [2:15:46] those are the two Well locations that we [2:15:48] are aware of now I do know that prior to [2:15:53] construction when we walked this area [2:15:55] there was a lot of water that sat in [2:15:58] this area here that we assumed was [2:16:02] coming from the drainage from the ditch [2:16:05] now I'm not going to rule this out [2:16:08] that [2:16:10] it could possibly even be underground [2:16:13] from that and if we do our this this [2:16:17] re-grading for the drainage and all that [2:16:19] stuff [2:16:20] address that may address it as well so [2:16:22] there's there's [2:16:24] a couple of things I'd like to see and [2:16:27] I'd like to at least [2:16:30] make sure that it's not the irrigation [2:16:33] 100 before we just look into others the [2:16:36] next steps that we have to address it [2:16:37] are to one get a couple good hot warm [2:16:40] days where it's not going to rain [2:16:42] keep the irrigation on as we have it now [2:16:44] see if it fills back up if it does we'll [2:16:47] shut it off see if it goes away and if [2:16:49] it does that tells us it's irrigation if [2:16:51] it doesn't [2:16:53] then we got another problem that we've [2:16:55] resources that we have in Marvin and I [2:49:18] know there's a lot and I brought the wax [2:49:20] off Sports magazine because I guarantee [2:49:22] that you know there's a lot of people [2:49:25] [2:56:31] nothing out there so they literally have [2:56:32] to run the line from the road all the [2:56:34] way down to the barn they charge an [2:56:36] install fee for for spectrum but and I [2:56:39] think that's where the bulk of the [2:56:40] charge is coming from is running that [2:56:42] line down there yeah I mean because [2:56:44] spectrum is run on coax that stuff is [2:56:47] cheap and easy to lay people get run way [2:56:50] off the road to their homes too I don't [2:56:53] they typically don't charge crazy [2:56:55] amounts of money [2:56:57] it doesn't have the linear with some of the changes that were done [3:26:30] in this I would encourage [3:26:32] that [3:26:34] Council read this [3:26:36] bill [3:26:38] through and be familiar with some of the [3:26:40] changes [3:26:43] and this is already passed yes this has [3:26:47] been passed it was passed just recently [3:26:49] a couple weeks ago so there's there are [3:26:52] some changes one of the one of the [3:26:55] changes of note that I'm looking at here [3:26:57] is to amend the residential code to [3:27:00] include three and four family dwellings [3:27:02] and basically this is kind of a [3:27:07] safety issue [3:27:11] they're not requiring greater than a two [3:27:14] hour fire resistance and or or automatic [3:27:17] sprinkler systems which is previously [3:27:19] been required for three and four [3:27:21] dwelling or three three and four [3:27:25] uh [3:27:26] family dwellings for safety reasons so [3:27:30] I'm assuming this was something that was [3:27:32] pushed through by the uh [3:27:34] the Builders Association to save cost [3:27:37] um there are a couple of things that [3:27:39] refer to driveway paving and different [3:27:42] things like that [3:27:43] changing of the uh [3:27:46] minimums for [3:27:48] um having to get a permit for [3:27:51] upgrading properties and such so [3:27:54] um [3:27:55] can you repeat that house [3:27:57] it's the house bill 488 [3:28:00] session law [3:28:02] 2023-108 yeah [3:28:04] say that again session law 2023-108 [3:28:09] about what 32 Pages or something like [3:28:11] that something like that [3:28:13] um [3:28:16] [3:29:07] they're just changing some things like [3:29:09] this [3:29:10] we may just want to pass this along to [3:29:12] chaplain and see what his interpretation [3:29:13] is for the implications yeah [3:29:16] okay I mean I think we should do that [3:29:18] obviously we need to reach out to our [3:29:19] reps and find out like what's going on [3:29:21] yeah I would just say some of this stuff [3:29:23] so I mean there are a couple things that [3:29:25] do make sense but like that that thing [3:29:27] to me from [3:29:30] and this was also raised at the Wilma [3:29:32] meeting is the safety issue when you [3:29:34] have multiple family [3:29:37] buildings and you start rescinding some [3:29:40] of these safety requirements that's [3:29:42] that's a red flag to me I don't think [3:29:45] that that we should be getting less safe [3:29:47] I think we should be more safe if [3:29:50] anything so [3:29:55] multiple multiple family dwelling [3:29:58] multiple family dwellings right yes so [3:30:01] these are these are triplexes and quad [3:30:03] plexes they don't necessarily apply to [3:30:06] Marvin at this stage because we don't [3:30:08] have these but it's the premise I mean [3:30:11] it's like it's they're relaxing some [3:30:13] safety standards in the in the building [3:30:15] codes which [3:30:17] is troublesome that's just one example [3:30:19] there are several wanted to bring it up to you all if [3:32:25] you thought that we should entertain [3:32:27] looking at [3:32:28] acquiring two more of those [3:32:31] signs and placing them out there on [3:32:33] those two thoroughfares [3:32:35] um I would be [3:32:37] open to that because we know those are [3:32:39] two thoroughfares that are also over [3:32:42] this high [3:32:43] speeding but [3:32:45] I've since then you know traveling [3:32:48] around I've seen different signs [3:32:51] um I don't know [3:32:53] just curious I don't know if the one on [3:32:56] Marvin Road [3:32:57] is so effective it's slowing down I mean [3:33:00] it look as people I the one that always [3:33:04] got my attention was the one on Johnston [3:33:06] Road as you're going into and towards [3:33:08] Carmel [3:33:10] but I've also seen the one that is if [3:33:14] anybody has seen it going down [3:33:15] independence from Matthews [3:33:18] going down going towards Charlotte [3:33:21] they have one that absolutely from a [3:33:24] distance looks like blue lights from the [3:33:26] top of a [3:33:28] police car [3:33:29] and when you're riding it's just I mean [3:33:33] it's like oh my gosh and the first thing [3:33:35] hits you is somebody's been pulled over [3:33:37] and then the lights get your attention [3:33:39] then it has you know what your speed is [3:33:42] so I don't I would be open to maybe a [3:33:45] different sign depends on the cost of [3:33:47] course but [3:33:49] um that's my [3:33:52] you know opinion about it there there [3:33:54] was also a suggestion and it may or may [3:33:57] not be [3:33:58] correct but Ed had also mentioned that [3:34:01] he thought that those signs were capable [3:34:04] of reading speeds in both directions but [3:34:07] only displaying the one that you can see [3:34:10] for Diagnostic purposes for law [3:34:12] enforcement to be able to enforce [3:34:14] I'd like to look into that as well if [3:34:18] our signs are capable of that and if not [3:34:20] the ones that we may purchase in the [3:34:23] future if they may be if we can make [3:34:26] sure that they're they're capable of [3:34:27] doing that because there's really [3:34:30] nothing better than having that data for [3:34:33] our law enforcement to be able to do [3:34:35] their job it helps them traumatically so [3:34:38] um you're talking about [3:34:40] you're talking about the mobile one [3:34:42] right no the the permanent ones that are [3:34:44] oh you're talking about the permanent [3:34:45] ones and the the speeds if I mean if you [3:34:48] if you compare those speeds [3:34:52] um maximum speeds and and the amount of [3:34:55] speeding from when we first installed [3:34:58] those to what we're getting now [3:35:00] the maximum speeds have dropped by 20 [3:35:02] miles per hour [3:35:04] because we were seeing 109 100 and [3:35:07] whatever now we're down to 85 for Max [3:35:09] speeds so they are I think they're [3:35:12] walking I think they're like [3:35:15] because they've been consistently going [3:35:17] down so I I could tell you that [3:35:19] listening to constituents that [3:35:23] speed trap that they set up on Newtown [3:35:26] Road [3:35:27] uh two weeks ago three weeks ago that [3:35:30] had all the deputies out there got [3:35:33] everybody's attention everybody thought [3:35:35] what the heck and I I heard from a lot [3:35:39] of people like you know obviously Union [3:35:40] counties wanted to pad their their uh [3:35:43] sheriff department wants to pad their [3:35:45] pockets and all this kind of stuff what [3:35:47] kind of Sting was this but it got [3:35:48] everybody's attention yeah I heard a lot [3:35:51] of animals think I don't know if it's [3:35:52] substitute [3:35:54] you know also I don't mind us being a [3:35:56] speed trap [3:35:58] I'd rather see something instead of [3:36:00] something permanent you know we have [3:36:02] enough sign pollution as there is I'll [3:36:04] call it sign pollution especially in a [3:36:06] rural area [3:36:11] um so I would rather get something that [3:36:13] if we start to see problems we drag out [3:36:17] a mobile sign and park it and it stays [3:36:20] at the E for Park and we have one well [3:36:25] then if we have one [3:36:29] it gets moved around but one the thing [3:36:32] about it is it's not it's not there all [3:36:34] the time and my point is is that the [3:36:36] ones that are permanent are actually [3:36:38] making an impact because people's [3:36:40] they're they're recording it that's what [3:36:42] is in your packet every month when they [3:36:44] do the deputies report and the the [3:36:46] speeds have come down [3:36:47] the max speeds have come down the [3:36:50] average speeds have come down so it [3:36:52] seems to me that they're making an [3:36:54] impact and especially Joe Carr Road and [3:36:57] if you talk to our deputies they write [3:36:59] more tickets on Joe Carter Road than [3:37:00] anywhere else in the village [3:37:02] so I think that [3:37:06] um you know I think it's worth [3:37:08] considering I think uh you know [3:37:13] I'm not sure how much we spent on those [3:37:16] and I'm not sure how much they are now [3:37:19] but they do seem to be making an impact [3:37:22] so we can add it to the agenda I think [3:37:26] and for actual discussion but uh in the [3:37:29] purpose of time I information on [3:43:18] my [3:43:26] but I think it was good conversation [3:43:29] um [3:43:30] probably most likely not going to be [3:43:32] happy with what has happened I will say [3:43:35] that one individual who is affected [3:43:38] directly and abuts to the property I had [3:43:41] a phone call with and [3:43:43] he was aware of what was potentially [3:43:45] going to happen here and [3:43:48] expecting it [3:43:50] this quickly so um but he was aware [3:43:53] which I think when you as you know Kim [3:43:56] in real estate it's buyer beware you got [3:43:59] to know where you're night that that has questions about what [3:45:31] were those changes you know certainly [3:45:32] reach out to either uh the mayor or [3:45:35] myself and I've told them then I said [3:45:38] you've good [3:54:46] eye on these components because it's you [3:54:49] know so we're not getting down into the [3:54:50] weeds of every single little detail and [3:54:52] every little event we're going to hope that we have more than 75 [3:55:09] people show up for this which I'm sure [3:55:11] that's a conservative number that you [3:55:12] want to [3:55:13] do you have a contingency for [3:55:17] if we do have say 200 people show up [3:55:20] for extra time allotment so those types [3:55:24] of things I say I know you said three to [3:55:25] five it's a little early in the [3:55:27] afternoon but I understand with the [3:55:30] cooking and all that stuff are as their [3:55:32] Provisions for it to run longer if [3:55:35] there's big attendance that kind of [3:55:37] thing so basically it's got to be less [3:55:39] than three hours [3:55:41] um because of [3:55:43] serving food and not having them [3:55:46] actually have a sanitation grade and the [3:55:49] environmental health this is based on [3:55:50] their form that I had to fill out so [3:55:51] it's got to be less than three hours if [3:55:53] we're not going to have them actually [3:55:54] sell plates of food or them come out and [3:55:58] check everybody and make sure they have [3:56:00] all the sanitation grade and all that so [3:56:03] but [3:56:06] well can we if it's three hours can we [3:56:09] just extend it to six [3:56:10] like from three to six yeah I think that [3:56:13] would be is it just because I I mean I [3:56:15] know it's going to be getting dark [3:56:16] earlier so I know that's why we didn't made or a [4:13:59] statement statement has been made about [4:14:01] bribes and payoffs and the only thing I [4:14:04] can say to that if if someone truly [4:14:07] believes that before you make a [4:14:08] statement like that just know that [4:14:10] you're you're really you're really [4:14:12] spitting in someone's face from an [4:14:14] Integrity standpoint I don't appreciate [4:14:16] it and if you think that I'm taking a [4:14:18] bribe where I'm taking a kickback or I'm [4:14:20] getting a payoff please come to me and [4:14:24] or or any of us or come to the come to [4:14:26] the town The Village manager and address [4:14:29] that in a way that that has context and [4:14:33] content around it and if you want to [4:14:35] audit me please feel free to do it [4:14:38] you're gonna you're gonna pay for it but [4:14:40] please understand on the back side of [4:14:42] that there's going to be a significant [4:14:44] penalty for you for making that claim [4:14:47] now I don't
