I think they have an indivisible look at it and they just scroll. [0:18] Good evening, and welcome. [0:22] Today on the agenda, we will have a primary reason for all of you to get ahead of these. It's to address this public hearing attack. [0:35] a five legislative line of news hearing, you know, the council to discuss and decide [0:41] of course, of actions. But before we move into that, any amendments to the agenda of the [0:47] seat? Can we do that, Courtney? No. Okay. And then we are going to move right into the [0:57] click hearing. And then I want to go through the public hearing. We'll close out with the [1:04] extended announcement concerns to comments, public comments, and then with adjournment. So with that, [1:12] this is a time and place for a public hearing for ordinance number 593-226. And the ordinance [1:21] some kind of the Dundee public vote prohibits [1:23] driving hearing uses of the community commercial zone [1:28] commercial zoning district and clarified provisions [1:31] in the development code related to drive through [1:34] uses in the city of Dundee. [1:35] This is a type five procedure [1:38] and the hearing is now called okay. [1:43] The public hearing will be conducted as follows. [1:47] Staff will be there report and answered [1:50] are getting questions from the council following the staff report or will open the hearing for public testimony. [1:59] First, I will take testimony in support for both amendments. [2:04] Then the testimony offered to those in opposition and finally will pick testimony for those who are neutral on the proposed amendments after the opportunity for public testimony. [2:15] The council may have additional questions for staff. [2:17] I will then close the public hearing and the counsel discussing consider the matter. [2:23] So when you do test it, whether it's on the station name and your address or the record. [2:32] And please, the testimony can size and roll it to the issue before us this evening. [2:37] All testimony shall be directed towards council and not the other members of the audience [2:43] for the deliberations esteem in the ticker book criteria for founding section 17.405.403.12. [2:53] I've done the development code. These criteria are listed and discussed in the sample form, [2:59] including the apostles of gender tactics. [3:03] Dean, some artists like to vary the city council must you make this decision. [3:07] value to raise an issue with sufficient specificity to afford the City Council on all parties [3:13] that opportunity to respond to an issue, make for clue to the appeal to the landings [3:17] for the appeal that's on that issue and may include any action to serve it for it. [3:23] Now, at this time, I ask any members to sit counsel to disclose any complex of interest [3:29] that the member may have pertaining to ordinance number 5 into 3-20 of sales. [3:34] basically a nation-extended conflict at any interest, [3:39] and they can whether you intend to participate in or stay [3:41] from the hearing. [3:43] So I'm going to just start now, line, [3:46] and start with a security. [3:49] Yeah, I have no time to stop. [3:51] That's it. [3:52] That's all this. [3:53] No, no, no. [3:54] I'm going to work in a year. [3:56] So does any member of the audience list [4:01] the challenge you have built in a consort of hearing this matter? [4:05] During none, I would now turn to the staff report in several numbers on the staff board, [4:11] and in the study of how many of those items are included in the record. [4:19] So, thank you, Mr. Mayor. [4:22] And also my name is Brad Chulby. [4:24] And we've been invited by the governor for Heart Rock, PS4, [4:28] Gales 2-0 by southeast of Kansas Street, [4:31] Fort LaGuardia 97-202, [4:33] and this is a contract not very much better. [4:37] The corporate policy for you involves two good. [4:43] It involves changes to the long-to-code balance of everything. [4:48] And in the municipal code and four different ways, [4:52] it prohibits driving to establish [4:54] from the sanitary and commercial law. [4:56] So, already break it into a central business series, so this would essentially prohibit [5:02] drivers throughout the community. [5:05] Here we go. [5:06] Drive for design standards. [5:08] Go to the bottom here. [5:09] So you can get that for the design standards. [5:11] Or you're essentially shadowed and passed for drive-throughs along Pacific Highway. [5:18] In a third eye of the definition of drive, you're declared by the full service gap most. [5:22] And if anybody want to pay cash, we're not considered right to be useless. [5:27] And he's entitled by my user review that was initiated by the State Council on April 7, [5:34] 2026 by majority. [5:36] And so for that reason, because you initiated as the council, [5:41] you didn't have to go to the final commission for a game, [5:43] because they would make a recommendation to you, [5:46] then that recommendation was simply state. [5:48] They didn't even recommend approval already, you know, that you have already made your [5:52] case for wanting this legislation, so that's why it's probably for you. [6:02] So that's the end. [6:04] We submitted another issue, the awarding department linked to a consideration of the development, [6:09] 35 days prior to the first experience, and that was what we said, in 2026, and now I'm [6:16] making it. [6:17] yet we now notice to everybody on this map that is commercial use. So everybody that [6:29] will be enacted by this proposed amendment or these proposed amendments will receive [6:34] another proposed amendments. Excellent, please. [6:40] So the proposal to the development of your [6:42] or rural criteria, really, there are four in that session. [6:47] But the only one is applicable to public government. [6:51] And it must apply under the applicable, [6:54] composite plan goals and policies, [6:57] statewide plan goals, and ordinary military rules. [7:00] And that's in your stat before we went through [7:02] the applicable goals that we felt were relevant to this. [7:07] And I'll go ahead and make those for the purpose [7:09] of the audience. The goals policies that we found were relevant to this. These amendments [7:16] would be assured that commercial and industrial developments preserve a hands-in-said character [7:21] and mobility identity that the city should preserve. I create the business as long 99 W by supporting [7:28] highway agreements that will lead a traffic congestion by requiring velocity parking to be [7:34] by repriving high design standards in the developments, [7:37] and the city will promote alternative transportation [7:40] most fragile auto use, including carpool and pedestrian traffic [7:43] and bicycle. [7:45] Well, you recognize this change modified business model [7:48] is traditionally permitted in its own drive-through uses. [7:51] The council believes that the restriction cost [7:53] for the more cohesive and walkable environment [7:55] toward the court over that prioritizes longer visits [7:59] over kidney and cascading thefts. [8:03] And you already know the emphasis of this request was primarily the drug due that was proposed [8:10] associated with McDonald's. [8:12] This, these amendments would not prohibit for preclude the dogs locating and then be, [8:19] but they would have to do it as a drug in restaurant as opposed to a drug through restaurant, [8:24] which some people say, well, that's not that they do. [8:28] I'm going to argue that if you're going to like us, we go right down. [8:30] Chick-fil-A just opened up a sit-down restaurant. [8:33] It's a drive in, it's their first in Maryland. [8:37] I'm not sure they do anywhere else in the country, but that was one of the first restaurants that they've done. [8:42] So there's the restaurants for it, and I will say that you have a downtown business organization [8:49] that wants to make money in that situation. [8:52] You now have a finance. [8:53] So you have not changed the potential about what you want to see that you become over the years. [9:00] And so that particular application had 185 comments that were received. [9:09] And I did some quick math and that's five percent of your population. [9:13] I think in that there was only one comment in favor of the writers. [9:19] through the nursing network opposed to it. [9:22] And there's some form letters, but they were also outside [9:24] of that, some letters specifically to you [9:27] in order to find the information requesting it. [9:29] You guys look at drive-through uses, [9:31] and so your community certainly haven't [9:33] interested in not going to prevent drive-through uses. [9:38] It's important to me that you're clear and understand [9:40] that by including any drive-through users, [9:44] let me drive your best. [9:45] I'll help you be allowed in the area. [9:46] and I try to copy PEOs, won't be allowed, it won't be a drive-in or drive-up, you know. [9:52] So the idea is that people come in and don't part and then they'll find something more [9:56] interesting to check out in the downtown border as it can develop. [10:02] Now, next slide, please. [10:05] Oh, I didn't work with that's it. [10:06] I wanted to talk about a public notice, the LCG noticed and published, [10:09] April 22nd. Notice was published in the Newark Graphic and on May 14th, and then the effective [10:18] property on the quarter notified on May 5th. That's that map I should be earlier. [10:26] Yeah, before I get to that, I have a meeting on May 19th. There were 18 vote comments were received [10:33] by staff. One comment on my position to the proposed amendment and 17 in support of the amendment. [10:38] that all received anonymous primary points [10:40] are included in the packet, and exit the team. [10:47] We've proposed the ordinance in here, [10:50] and we are recommending the fact that we know [10:55] that the applicant, the result of the applicant [10:58] is updating their application to resummit [11:02] that this will cost to anyone to see [11:05] If you were to pass an answer tonight, [11:08] we'd become effective. [11:09] If you don't, maybe we've come back for a second reading. [11:13] And presumably after that reading, [11:16] you have a cold, not period in for about, I think, [11:19] it's 30 days. [11:20] So the legislation will realize her effect for 30 days. [11:23] So you may have a condition for her driving you within that 30 days [11:26] would have to be subject to rules that aren't, [11:28] if you haven't said it today. [11:35] I'm going to talk about there were probably [11:39] I've been putting more work on these within that community [11:41] commercial zone on now that they saw it earlier. [11:45] And I would just again, by saying that [11:49] established the baseline prior conversations [11:53] and our analysis of this legislation [11:55] to recommend through what the application [11:58] or the maintenance that you guys kind of had as prepared. [12:04] And available for any questions you may have. [12:07] Well, thank you very much, everybody. [12:08] But I wouldn't know that in your packet, there is, what's the additional, all the comments [12:12] that was sent to me, and I think to my particular administrator earlier, I guess, like [12:20] this afternoon, from the owners of Red Hill, so that's in your packet, sitting there, [12:26] supporting for pretty many drive-throughs, assuming that that's the record. [12:31] And that will be included in the record as well. [12:33] So, not only do you have any questions that the staff have, or council have, if the [12:42] committee is not reporting, but the reporting, or the answer. [12:47] So, I think, of course. So, there's a button in there, there's no one, but there is a solution [12:52] I would say. I know you already mentioned, but really pretty good. Right, through some of the [12:59] of this one, from the start of the party, [13:01] and say, it's caught your attention in the future. [13:03] How is one of that future of the UVG group? [13:07] Let me give you a moment to see if it is. [13:09] Great question. [13:11] You guys have been prohibited today. [13:13] It doesn't mean that you would have to all be prohibited. [13:16] You might mind if there's a reason [13:18] to have a drive-throughs along the way [13:20] in the rear-registered area. [13:23] And start looking at maybe a separate commercial zone [13:27] or any other labor you would someday prepare for these. [13:32] So at this point, every agreement will affect the existence [13:35] simply on anything beyond the within control [13:39] of the machine. [13:40] That's right. [13:42] That's all right. [13:43] It's a different console, [13:47] and different editions of curing the roles [13:49] can be changed at that time for sure. [13:56] So zoning regulations, I don't know if they could do that 10. [14:01] So underneath there they describe all of the zones in there. [14:04] They are talking about the community commercial zone, which is a zone, and I'll read it out [14:10] here because I can read it out. [14:12] I don't think it has it. [14:13] Let's see some provides a wide range of info-serving businesses including retail, office, and services. [14:20] use. This CSO is intended to encourage commercial and big-shoot development that is convenient [14:26] and accessible by all modes and to create an commercial area that is attractive and functional [14:31] for customers, business, and community of large. Then to complete this, by escaping as a key [14:38] component of the site design of the CSO and to provide lottery to adjacent residents, [14:43] allied industrial uses, and create an attractive street schedule for buy and buy, you know, [14:48] benefits. With these changes to a fluid drive-through, do we need to also make sure we're changing [14:55] in this purpose for the Z-Sone, C-Sone. [15:00] To make sure that we are, are, are, are removing this convenient to all, like, and accessible, by all modes. [15:10] Um, no, because, I mean, you still have to drive up to the right end or the right, if you said it's still accessible. [15:17] Um, I think it's a purpose to, so it's not a criteria yet. Right. Um, it, it's entirely up to you as a council. [15:25] in what you've currently envisioned for that [15:28] in the commercial zone. [15:29] Okay. [15:30] But I would say like when this goes [15:33] in front of the planning commission, [15:35] again, we're going to send this [15:36] to the planning commission [15:37] and let them have their, [15:39] yeah, when sending this to the planning commission, right? [15:41] That's what we discussed. [15:42] Is we're going to, yes, when we have that, [15:45] this is the last meeting. [15:46] We said we'll make a short-term emergency fix, [15:49] but it will go in front of the planning commission [15:51] to allow them to look at this. [15:53] Is that still in the case? [15:56] I think we were discussing if we wanted larger changes or other sheetless, but- [16:02] Well, is this change the drive to change? [16:05] And so my state last time was I would sign off on a short-term change in emergency [16:12] phase as long as it went to the planning mission. [16:16] So we got all of the residence inputs on it and allowed them to look at it and to determine [16:21] whether or not they want the purpose, for example, or any other things they want to change. [16:27] So, and we're still planning on doing that. [16:29] Right. I mean, you can certainly record the planning [16:31] missions to stay wherever you want. Like I said, [16:33] there might be a reason to fill out some rest of your team, [16:36] but you choose not to do it on island in the United. [16:39] Maybe you have a overlay where you wouldn't prevent them. [16:42] And that would be something that you have to plan [16:44] missions to stay more in debt. [16:46] Okay. So when will we send you this plan? [16:54] So what do you [16:58] want the planning commission to do? [17:06] So, again, when I, when you're asked that, [17:09] you'd ever meet about this, about trying to do an emergency fix. [17:13] My opinion was this really should go to the planning commission. [17:17] All of the letters that are many of the letters that we have been seeing [17:20] were sent to the planning commission. [17:22] I think the idea that these own changes are done to the planning commission is whether or not it is legal or required. [17:29] It is a common, I think they come into sense because this is the rewink and so on and you change it. [17:34] That's what the planning uses for. [17:36] So, but I was out of the opinion that we're going to do a short-term emergency checks. [17:41] And then we are going to send this to the planning commission to have them redo it. [17:45] I don't get to just want to stamp and say, yeah, that looks great or if they want to do. [17:49] but allow them to put some of their insight into the game. [17:55] And so, is that what we're planning on doing? [17:58] So, city council's the decision maker. [18:01] So, I'm not exactly sure what would be accomplished [18:05] in a city council making a decision, [18:07] and then I think they're going to make a decision with it. [18:09] I think my understanding from what we talked about [18:11] is that if you wanted to look more globally at the development code [18:16] and see if there were any visitors that they recommend, [18:19] but I'm not sure would be prudent for countless [18:23] or negative decisions, which is, you know, finding [18:25] and then send out acts of recognition. [18:28] Well, if this is part of the larger discussion, [18:31] that's fine, and so that's great. [18:34] If we want to send to the planning commission [18:36] something like here, look at this thing, [18:38] or look at that thing, which would include [18:40] the insurgent changes, I'm finding that. [18:43] But as long as it is going in front of the planning [18:46] condition. Yes, that's okay. Okay, so this year, so I'm here. Yes. Yes, that's [18:54] long. And would you look at where you're right now? That's on the page 16 and I will [19:00] find it. Oh, is it? Yeah, it's up 17.202.010. It's the purpose that not be [19:13] So other questions I have. So I thank you for clarifying that we will be sending this in front of finding commission to allow them to have their input on this and any of the things that we're addressing. [19:25] Your definition here in spoons full service gas stations right they would no longer be allowed in town. [19:31] Now, what it says is that a full service gas pump is not constituted right to reviews. [19:41] So the question, it came up in the testimony from the copyunters there, that on the property [19:49] where the column was proposed to go, they asked, well, does this make the AMP, the constant [19:58] the full service is this making non-informative. [20:01] Well, to the extent that you can, [20:02] when you write legislation, [20:04] you don't want to create non-conformatives, [20:05] unless it's intentional. [20:07] And I don't think that that's the intention here. [20:10] So that's why drive or like when you go through, [20:15] the definition of driving was very specific [20:17] and that you don't have to be out of your car. [20:20] And the idea was that if you're going there, [20:23] you don't necessarily have to be out of your car, [20:25] it's full service. [20:26] You see the guy in your credit card. [20:28] Right. [20:29] And so it's a drive-to service includes drive-up ATMs service for full service gas stations. [20:37] Right. [20:38] So an ATM or a full service gas station is considered a drive-to service. [20:44] So that's about reading out of the definition. [20:48] Excuse me. [20:48] I didn't find you. [20:49] There you are. [20:50] Yeah. We were already doing that. [20:53] Last day, that's 17.501. It is the definitions. [20:57] And I'm sorry, I didn't turn it into that. [20:59] So I don't have to say, oh, it's 37.37. [21:02] Well, this one of the reasons, [21:04] and that's what I can't say. [21:05] It's 37.37. [21:06] Yeah, this probably wouldn't be an additional problem. [21:10] Wow. [21:11] I'll try to get some aspects. [21:23] Yeah, I mean, that is the way it's written. [21:26] the aid, but I think the proposed amendments, [21:35] no, you're working on the correct definition of the aid, it's all on yellow, right? [21:43] Yeah, it's going to set a new code of the old code. [21:46] That's only the code. [21:47] That's all good. [21:48] Yeah, I'm sorry, really, that there's seven of these two. [21:52] There's an age range to two on a pattern of that. [21:55] I don't think that, I don't think it might as well be this. [22:03] It includes dry and horrible service agent which should be, say, dry to your service precludes, [22:10] dry out the data and start responsible service application. [22:13] So that's actually, I should have caught that again. [22:15] So I'm sorry, but it's the word precludes? [22:20] So it would precludes the supposed to exclude. [22:24] So it would precludes the supposed to exclude? [22:28] Excellent to set it includes. [22:30] I would. Okay. So is this a change that you're suggesting we made? [22:33] Yes. [22:34] Excluded. Okay. Thank you. [22:39] So this would go, this would prohibit, for example, and remember the [22:45] old A and W's we so that that would no longer be allowed. But you could throw up a sat in your car [22:51] and conduct your business unless you were an ATM or full service gas station. You would be, [22:57] It would be her boat. [23:00] That's a great question because I think of a drive-in like Mike's drive-in, but I also think that my son would be somewhere in the same way or the W. [23:10] Yeah. [23:10] He'd drive in a drive-out. [23:12] Oh, you sit in your car, you ordered and they'd bring it out, but that's kind of a question, pretty old, I guess. [23:22] Yes. [23:23] So that sort of space assumption is that people are dining and they're correct, right? [23:31] But again, they're able to do all of their transaction inside and without leaving the vehicle, [23:37] because that's the problem with this definition. [23:40] But again, this is something that seems to be sort of a fanness type of thing, when the [23:46] planning committee gets this, they can address those larger sorts of issues, as long as we [23:51] change that word includes to exclusives, the point of allowing the ATMs and full service [23:57] gas stations, the ARCO would not be out of scope for that. [24:02] Yes, not for me. [24:03] And I totally agree with you. [24:05] That's definitely, that's an interpretation, right, that you would want to have me. [24:10] I mean, if your intention is to have you meet your other car and spend more time in downtown [24:19] I would say that that would be a sonic version of my death, and it would just be something [24:26] that you might clarify with my condition, but if that's more in herbivation tonight, [24:34] that's how it's expected, which is to say that if any of your sonic comes in, we can say [24:40] that all of this was actually discussed in the council, and the idea is that it was looking [24:44] improve the moving a lot of these right now. It would be a good and we'll have to [24:52] explain patiently studying this. [24:56] And on the gap stage here, so there's also a definition for automobile service [25:02] station means that building design primarily for the supply of motor fuel oil [25:07] deprecation and accessories to motor vehicles, but excluding major repair and [25:11] overall, and then in the development code, that isn't allowed or used in a community [25:17] partial tone. [25:18] So it's a different use, they asked, it's not. [25:23] So I do have an issue, does not have any definitions about commercial or retail or anything [25:30] like that, right? [25:31] It is. [25:32] I think you're right. [25:33] I mean, like, you don't want to focus on payments in a thousand, or if you're excluding [25:38] there, it's sad that it is excluded right through the business. Most certain stations are [25:44] important to be made right to you, and arguably you don't have, but in the whole reason [25:49] you don't have the full service, because you do have a gas station account that provides [25:54] full service. But there's an expectation that people have to stop and get gas, and not [26:01] everybody can pump it on gas, because what we have meant for years and years is not allowed [26:12] So, just a clarity of questioning online and related to the ORCO, that is a pre-existing [26:19] use and if we change code, that wouldn't affect them anyway, would it? [26:24] We're making them non-conforming if you consider the full service items, because they don't [26:31] to get out of their car. They can stay entirely in their car. [26:35] I mean, it was just making that [26:38] those islands market forked. [26:40] And say our goat can and they want to [26:44] band the use. It counts as [26:47] another decision to make how they handle non-performing nieces. [26:51] And I have a study in code so I don't know [26:53] if there are amortization [26:55] clauses meaning that over time you want to [26:58] to phase out lung conforming uses, [27:00] or if you'd want to allow certain expansions. [27:02] I mean, I see a different ways [27:04] of different jurisdictions that I work in. [27:06] So I think that my individual role [27:10] that has that land use matter [27:11] is to not create situations where you're creating [27:13] a lot of non-gear formalities [27:15] when you do them in the company. [27:17] Yeah, that makes sense. [27:18] And I think that's, again, [27:19] the lower reason you have the fun [27:20] with those other stuff. [27:22] So I think it gave us a little more insight. [27:25] But I think it's for tonight's activity. [27:28] I think we get a certain global way of trying machine computer based on feedback from [27:32] it. [27:33] But any other question you can, all of my thoughts? [27:36] It's curious why we're excluding the drive up, I guess it would be in drive up or drive [27:42] through ATM. [27:44] Then drive up, different than in drive through, we can drive up, you're getting out, right? [27:50] Drive through, you're not. [27:51] So, why do we have to exclude driver explicitly? [27:56] I guess you don't have to. [28:02] That was... [28:03] So, this is what I understand. [28:05] This is a definition of what we have in our current code. [28:08] Yeah. [28:08] So, we exclude all of them. [28:13] I mean, we prohibit the driver from telling that we include ATM. [28:18] So for us to leave the gas pumps, NADM services, [28:23] a bay level high price of in-times would have to change [28:27] if it's possible. [28:28] But this is the question which you would be nice and bring it [28:32] to have plenty of vision to go for all the details [28:34] and actually figure out like there's a car wash [28:40] would be considered as a dry food or dry food service. [28:45] There's a, you know, a quick boil change is considered as a drive-through, as a full-serve [28:50] and so on. [28:51] If there is, like, prohibiting it in general, you can create a lot of actual play-through [28:58] one space. [28:59] We don't address it in the nearest future. [29:03] So Daniel made us out of an obligated lake of to-do by thinking in the lake of the places. [29:09] And he said, well, I see. [29:10] We don't have any right or right through ATMs in town, my knowledge. [29:15] Great. [29:16] We used to have an ATM together at the town, and Columbia, or was it Columbia back? [29:22] Oh, but it wasn't get out of the car, wasn't it? [29:25] Yeah. [29:28] That would be to ask underneath the convenient version of it. [29:32] Yeah. [29:33] So it's possible. [29:35] It's possible to take it out of a language by ATMs, that's an option. [29:40] I [29:45] don't see why we would keep it, unless it doesn't make sense to me, but I guess that's [29:55] So if that's the case, I mean, my file as we take it out. [30:00] I'm going to have a fine commission to deal with it and really be armed up to here. It's to protect the. Article would so it's not informing that's fully the objective right now. So, rather than add. Working closely complexity, that it's at the moment, we'll look at the planning commission back to us with the recommendations. This other. Services, as well. So he's suggesting you say that last sentence would be driving service, the excludes, full service, gas. [30:29] stations are running. That's it. And then, leading the bolster, gas stations, is that allowed? [30:37] Execoded, put one in. [30:45] At this point, if they need all the requirements, we're talking about the handful of properties here. [30:51] There's not like a new lot of space when you look at the map of where these are going to go, [30:55] but so I guess the rate is possible. [31:06] Okay, do you have any other functions? [31:13] So that means that we can make finalized breaks. [31:19] So now we're going to open another testimony. [31:24] Just nine rules received by the testimony, the points of the application first, [31:29] the points of the application that speaks back in the notes that are made from. [31:33] We'll speak third. [31:36] So is there anyone here that is wishing to speak in favor of the applicant that's forgotten? [32:01] It played a lot of things. [32:03] Thank you. [32:06] Thank you. [32:07] Thank you. [32:07] Welcome. [32:08] It's Victor and Andrew Storke. [32:10] Brian McKay, 8670, Northeast Wardenville Road. [32:14] Thank you. [32:15] Thank you, Brian. [32:21] I just wanted to kind of point out that kind of the key thing that I had highlighted, which was, you know, the county and the state funded somewhere along the lines of $350 million to build a live pass to basically improve the traffic situation in town to make it more walkable to make it a destiny. [32:45] And should I have heard you get echo all that? [32:46] And I just wanted to kind of reinforce that, right? [32:49] We were bestowed a huge investment. [32:52] I mean, a third of a billion dollars, right? [32:55] That's very, very significant. [32:57] And I think it's on us to make sure that we are good students [33:01] of that investment. [33:03] That's it. [33:05] Thank you. [33:06] And give him, thank you. [33:08] You know, we're still working to finish the other face [33:11] of the White House as well, right? [33:12] So yeah, maybe even probably maybe work right or come on. [33:17] Yeah, I'm going to be cordial to be awesome. [33:20] Thank you. [33:22] All right. [33:22] Well, thank you. [33:26] So Lauren. [33:28] Lauren here. [33:29] Lauren. [33:30] Thank you. [33:31] Welcome. [33:33] My name's Lauren Thompson. [33:36] I'm kind of coming here with just a general question. [33:38] more than anything. I used to be the manager for SIP City, which was a coffee shop in Newberg, [33:44] that just recently closed. And we are in the process of seeking out a new space to go. [33:53] And so we actually have considered Dundee as a space that we wanted to enter because of its [33:57] love of small business and how much this community thrives on supporting small businesses. [34:02] And it's been a woman owned business for over 30 years in the Newberg area. And we have a lot [34:08] customers who are from here. So my question is, is like, based off of everything I'm hearing, [34:14] which I understand all of it, are efforts in vain to keep continuing to look at them? [34:22] Do you have the space that we might be able to put our new building or be a part of, or should we [34:28] hold that search? Does that make sense? So I appreciate you coming. We're not in a position to [34:36] answer that question. Come here. Okay. We're happy to have a conversation with you [34:39] out of the lines. Yeah. Yeah. Okay. We're happy to get engaged as well. I think I'm [34:45] so happy for sure. Okay. Okay. Thank you. I've learned more about what we were [34:49] interested in doing. Yeah. Yeah. Okay. That'd be lovely. Thank you so much. [34:54] Thank you for coming. We have one more. Just going to try area. Area. [35:01] at the year, just to add to that. So after tonight, if this council drive through uses would [35:09] not be allowed in the senior year in the commercial discharge, so just some of you will care on it. [35:19] My name is Ariane and I'm in my there, 1, 7, 6, kind of on the street and then deep. And that's kind of, [35:25] I have a small business owner, I have a entrepreneur, I've been to law and pretenders, [35:30] Now, our business and when I was in Bradenburg for not having drive-through because of franchises, [35:39] things like Donald's kind of large things to take away from our small businesses. [35:44] And I guess that is kind of, I mean, maybe you guys have discussed this, [35:49] but what about small businesses? What about non-franchises? [35:53] If we were able to just change, I mean, I don't know, if I'm not immune to this stuff, [35:57] It sounds like you're just like, hey, let's change this vocabulary. [36:01] Why can't we work towards still being open to? [36:04] I had no idea if City was going to be here, but I had a narrative story and I know [36:11] the small businesses that have aren't now able to open up a coffee shops or other small [36:17] business. [36:17] If I was a entrepreneur in town, why it seems like it shuts down branches of businesses [36:26] that want to grow in this wonderful place. So is that still a possibility to discuss? [36:33] Are you asking about the drive-through? Yeah, so in the drive-through, why can't we be [36:37] more specific on like a lot of franchise businesses versus small-town events? [36:45] You can, I guess, experiment against business just because of their name. [36:51] So that's real quick. [36:52] But who the planning commission created code that says, for example, how many cards are in it? [37:00] The number of things that they could go about. [37:05] And like I had mentioned, you could go get, where does it make sense to try to reduce it? [37:11] Where is like other business streets that are on? [37:13] I remember that you will be okay with that and you drive through this zone and then you look at that and then that's what you talk about. [37:21] Maybe there's an overlay or a summary you want from any questions. [37:27] And I was saying also that the other side of the coin is that you can also look at it. [37:34] We're promoting lock up and sit down distances. [37:37] That's the other side of the coin is that we're trying to really encourage that. [37:41] I do that. And walking up makes sense. I'm thinking of the small, long lifetops, like [37:50] acidity specifically. It's just so interesting that they're exactly what I'm talking about. [37:58] And I get not discriminating specifically, big business names, but just general saying, [38:04] I'm not saying, I'm not a dog, I am saying that, but I'm saying it, yeah, that's all I have to say. [38:12] One thing I would encourage when it goes in front of you, even if I out, so when this comes up in the planning commission, [38:19] you were able to provide your input to allow them, and maybe they'll craft a solution that will allow small businesses to be able to have those sort of things. [38:29] I just feel like there's like another level there that isn't, yeah, I think that it's not [38:35] walking or walking versus the walk of only people are wanting a small business to strive, [38:43] you know, to be strong and that it shouldn't be screaming against a small version of a [39:05] I'm assuming that we have, that's a question as well, it's kind of going up on all this. [39:11] When a business comes in, we still have to do things like traffic studies and stuff, right? [39:16] Okay. [39:18] So I think that's very important. [39:20] That was it. [39:21] Okay, I mean, I love SIP city, but I mean the reason did you see the traffic when just on 99 it was just different lines and it wouldn't differ a little bit [39:31] But you said also the fence ago, I mean you can see when going on the other place off the side of the road [39:36] Well, you have to set the town so you have one in each corner so you don't want to do the process streak or something [39:39] You can see things like that happening as long as there's like a traffic study still being done [39:44] That was it. Yeah, it's loaded and not even on it's it says a state [39:49] it's state so got and got a very [39:54] prescribable room that you can get for [39:56] restricting about what's a [39:58] lot of anger. It's not one of the other [39:59] stuff for bail or not. I have a [40:01] switch. I remember hearing this. It's [40:03] in the planning commission and in [40:04] North Plains. So we're working very [40:06] hard to keep on our streets out by [40:08] the state and not the city for little [40:10] reasons like that. So thank you. [40:12] Thank you very much. Any other [40:14] any other comments? If not, I'll close [40:16] the hearing, and see if there are any other final questions for the members of council [40:28] or staff for any clarification or any further questions or comments. [40:44] So, [40:47] if we are allowing full service gas stations, would a full service gas station be with [40:55] a McDonald's inside, or even like the one with the private brothers, would that business [41:01] inside the business be allowed with this? [41:05] Now, we have tried a bit with the reconstituted separate drive to use. I think that it was [41:11] tied to the S.H. and I think that the idea is that maybe we may be aware that it's [41:16] both sort of complex or both sort of silence or something are what is being assumed from [41:22] the definition. [41:24] Well, it's the drive to window, right, that is, oh, I'm sorry, I think you're thinking because [41:28] As we exclude full-service gas stations, can they likely take the other shell and sound [41:34] that as a guide of the other on the batter side? [41:38] Yeah. [41:39] Basically different views. [41:41] So [41:45] should we have any information really? [41:47] Well, yes. [41:48] I know the reason why the planning commission should look at this. [41:51] But I think for this particular point, and we should get the planning commission to move [41:57] relatively quickly on this dear point, but I think for Adel, I think the objective, I think [42:07] that we hadn't restarted this process was to put in place this ordinance now, and we'll [42:17] go back, there's more things to craft, and we'll have another fighter, too, with the Adel [42:23] and say something, I guess, because we don't have a lot of answers. [42:26] With that, the item of course is ordinance number five, [42:33] none of the three deaths, 20, 26, and ordinance 30, [42:36] and then the initial code of amendments [42:38] for the drive to establish in the community, commercial, [42:42] zone, and we will be driving through signs, standards, [42:45] other GAMC chatters, 17.202, 17.203. [42:52] And so the [42:57] potential ordinance here to be applied to this area and I have faith in us to what it's done. [43:13] So, the ordinance of approving the Dunning Institute of DMC amendment for drive-through establishments of community [43:20] the commercial and the moving drive through [43:22] exhaust speakers. [43:24] The NCE chapter 17.202 and 17.203. [43:30] So I'm seeking emotions to move this, [43:36] do we need to close the public hearing? [43:39] I thought I did. [43:41] I think it's good. [43:43] But by that I close the public hearing just in record. [43:46] What do we have? [43:47] We have somebody online there with a, [43:49] I mean, that's Carrie Wittler, she's a lady's attorney, so she's found one thing. [43:53] And let's raise your hands up. [43:55] Oh, there's good hands up there. [43:59] Thank you. [44:01] Sorry, thank you, Mayor and Council. [44:04] My name is Carrie Richter. [44:06] I am the contract land use attorney who's kind of been helping the city on this. [44:10] And I just wanted to remind the Council, if you're going to make any substantive amendment to [44:17] proposed ordinance which would be your change in the wording of the definition that you were talking [44:23] about. It needs to be read aloud as part of this meeting if that's the direction the council wants [44:31] to go. So I just before you I think you take a motion you get a second and then maybe Brad if you're [44:39] We're prepared to read that amendment just so we're clear that we get that and as part [44:45] of the motion. [44:49] Thank you. [44:49] That makes sense. [44:50] Thank you. [44:51] Okay. [44:52] So we have it first. [44:53] You're in. [44:54] I move to a dashboard in December by 93-16 with these. [45:00] I have amendments that we will discuss with that. So, first, the second, so, Brad, do [45:12] you [45:21] want to [45:37] do service means it is where patrons can enter aside care transactions or receive service [45:43] and exit the site without leaving their vehicles. Drive to your service, [45:47] the excludes and full service caskations. [45:52] And we would, we would wait for you on from that. [45:58] Can we have a second? A little bit. We did have a second, a person's second. Any other questions [46:03] or comments. But now we do actually have to do a roll call by name. And so we'll start this [46:19] council president. I vote yay for changing the community commercial level and adopting ordinance [46:26] is number 593-2026. [46:29] Thank you. [46:30] Frank, Brian Wilde, I spoke to you [46:33] to adopt ordinance number 593-2026. [46:38] Thousand or number so, [46:39] I will be aiming on adopting ordinance number 593-2026. [46:45] David Hitson, I'll vote yes on as amended. [46:49] Constantly round two, but I go to this, [46:52] So I'm going to address number 590-2026 as I mentioned. [46:57] There are four votes. Yes, charge to adjust the emotion as an entity. [47:03] So with that, we have unanimous vote of counsel. [47:08] And so I'm supposed to restate the decision whether or not it's approved. [47:13] It was an emergency and so we're proving this as an emergency and we will make it effective [47:20] and close to this business, maybe. [47:23] So I think you carry the right hand around [47:26] you need to be out of the emergency motion. [47:31] Okay. [47:31] Do you recommend it out there? [47:32] I'm one of them. [47:33] And so we have to do another vote. [47:35] Yes. [47:36] Okay. [47:36] We need four of us on the right hand. [47:39] Yes. [47:40] We're, it is on the first motion for 100 big green. [47:45] Yeah. [47:46] Letting. [47:47] Okay. [47:47] So, the following motion is read by the council. [47:53] This is the motion, the emergency motion moved that the rules be suspended and the ordinance [47:59] number five, nine, three, dash, twenty, eight, eight, six, three, red, a second time by [48:04] all of them declared emergency in place and be placed on final passage. [48:10] So I need a motion. [48:18] I knew the rules would be suspended, and the ordinance number 5.3-2.026 be read a set of [48:25] time, that's not only, but they're in emergency and place enough final tests. [48:30] So that's it. [48:32] We have three seconds, it's hang, exactly, and so then any other questions or comments on [48:39] that? [48:39] How's everything around, but not all called for by name, [48:45] its councilmember, I'm also, sort of, by gov-a-d. [48:49] Not by me, but I'll say, very well, it'll gov-a-d. [48:51] Councilor Grusso, okay. [48:54] If it is any a-d, that's not the case, but it's eight. [48:58] Okay, so that passes. [49:00] Now, I move to, where I're. [49:03] Maybe is someone getting your vote? [49:05] Oh yeah. [49:05] I will give you a technical feedback. [49:13] So many of them are in this motion. [49:17] It's an explosion. [49:18] There's a chunk of people you've already added that motion. [49:21] So I just kind of give it that first. [49:23] I think it's fine. [49:25] I think that the first reading by title. [49:30] We've had the second reading by title and it was unanimous both times. [49:34] So, I think you are concluded on this question, and I believe that the ordinance is effective. [49:42] Okay. Thank you. Thank you for your guidance. Thank you for the staff. [49:46] What did you do on this? I know this has been a, you know, it's an interesting piece of work, [49:54] And I think also I'd like to thank Mel, so I work on some of that and I've done looking at this in more detail. [50:06] And for your recommendation to move this to, it's fine admission for further discussion because we haven't been forward to doing it. [50:15] It's on our code for sure. [50:18] And now we'll move to any other questions. [50:24] Council of concerns or comments before we update the public. [50:31] Sorry. I was several 100 long length or defend by the public for the input to resolution. [50:38] I'm actually being present and we would like to see more often. [50:41] We can't do much in it and we'll try to make it more accessible for the material that [50:48] is on impact. [50:50] So to try to get familiar with all the Jones we have and what areas are actually enacted [50:56] by the resolutions and ordinances we make. [51:00] So that will give the public a better understanding why you know how it is done. [51:05] But overall, thank you very much for being part of this amazing meeting. [51:10] Thank you, Councilor. [51:15] What he said. [51:16] Thank you. [51:16] It looks seriously. [51:17] Thanks. [51:19] So, yes. [51:20] I would like to also thank everyone here for being here. [51:24] Public involvement is an important process. [51:26] It helps us be informed and to make better decisions on your behalf. [51:30] So thank you for your engagement and for your time. [51:35] The other thing I just wanted to say a little quickly. [51:38] For those that have seen the yellow for the orange flags that are hanging [51:42] of the walkways. Those are intended for that. It came out of a program of volunteers here, [51:51] downtown D.A.J. and the industry program. And it was an idea that came through just some public [52:00] dialogue with people getting together to say, what could we do to make the city more walkable, [52:05] more accessible, even safer. And so one of the volunteers did that, and so I'm getting some [52:10] a lot of credit for this, he took this on and let it and was persistent in getting it. [52:18] Pass it on one of those little flags for you, pull out one end and use it to walk across the street [52:24] to give people's attention to 90% to be pretty busy for those walk across it. So I just want to acknowledge [52:31] that. So anything on your own? Pretty? Okay. If not any other public comments this evening, [52:41] Very not. [52:42] What's your opinion? [52:43] Thank you. [52:45] Is [52:46] it [52:46] important? [52:48] Okay. [52:49] So that was [52:49] stables. [52:50] All right.
