[15:51] So in terms of plan land uses in the area, you will see that there has been a pretty significant shift that Belmont here has become industrial. [15:59] There's quite a bit of heavy and light industrial. What we're proposing today is entirely consistent with that change. Next. [16:07] We are also in addition to the changes that you see along our western. [16:13] The western side of our property, we do have a significant sand and gravel operation that is on the eastern portion. [16:18] So this land is kind of sandwiched between the two, which is why we really think light industrial uses makes a whole lot of sense. Next if you would. [16:27] Again, very consistent with what this board is already approved out for the Belmont 1080. [16:33] Next. And then what I really want to touch on is this is a case where frankly supervisor Lesco in this board challenged us when we came here with the comprehensive plan amendment to do a lot of work with the community. [16:46] We had been doing that. We've had really good conversations with folks. Next slide if you would and I want to just highlight some of the things we were able to work out. [16:56] We were able to assure them that the primary access here will be 339 avenue. [17:01] If you look at where that purple star is, that's where the majority of folks kind of live out there. [17:06] So we're not cutting through their area, their way of life. Next slide if you would. [17:13] We also spend a great deal of time negotiating buffer zones. So we created a 22 acre area where we have limited the permitted uses. [17:22] We've got enhanced design standards where we have ensured them that the preservation of desert landscaping really given them significant restrictions in terms of what actually happens directly behind our home. [17:34] So next slide if you would. That first buffer zone, there's no structures, there's no parking, there's no storage, it's just circulation vehicle and pedestrian circulation access and native landscaping. Next slide. [17:49] Buffers zone number two. We've limited permitted uses, there's no outdoor storage, it's less on the other side of building. We've limited the maximum height. Again, we talked to them about specific design standards. [18:02] Next slide. We also restricted the uses that could go in that buffer zone. Next slide. [18:10] And then we also created a separate solar exclusion zone, that was a real concern if they wanted to have, they did not want to have solar behind their homes. [18:18] So we created an area where that would be specifically prohibited within 500 feet when generation is prohibited across the entire site. [18:26] So we're sort of very carefully negotiated with the community. This is to give you an idea of what those enhanced design standards would look like for those buildings. [18:36] And then what I will say in my form and it's here just to summarize is we were very grateful that the most impacted neighbors adjacent to this site, we were actually able to get letters of support. [20:53] The proposed project would drive biological and life cycle alterations, habitat loss and fragmentation for various wild species. [21:00] Many that are supposed to be protected by the Endangered Species Act and Migratory Bird Treaty Act. [21:05] Species that personally recorded nesting on the site's under discussion. [21:10] It would create noise, polite, electromagnetic and air pollution that will threaten the peace, health, and overall well-being of nearby residents, [21:18] which is something the planning and zoning committee pretended to care so much about in the previous meeting regarding other agenda items in which the applicants. [21:29] We're not billionaire developers requests by the common men to use their land for purposes of business or entertainment all denied on the basis that these endeavors would disrupt the peace of the area and the quality of life of nearby residents. [21:44] On that basis alone why has this request not also been denied? [21:48] This would be more consequential than just in noise nuisance to the community. [21:52] And don't point to the economic growth and need of infrastructure as being justification for approval. [21:58] The guaranteed negative impact supersede any possible positive and will be more permanent. [22:04] The short-term payout you might expect will become an even greater cost and not just in terms of money. [22:10] Contrary to what the applicant says in terms of compatible land use, the only nearby operating industry is a couple hundred acre gravel line that doesn't even see from the properties. [22:21] And should we really be pointing to the Bellmont City concept which has seen zero developments since it was first touted almost a decade ago, by the way, as justifications for further development. [22:32] Accessing out of the water supply for this proposed Bellmont City would be challenging enough without a massive 1.5 gigawatt data center, which could also which could alone demand 10 million gallons of water per day. [22:45] Even if air coin technology is used versus the water cooling the impact to the electrical grid is a legitimate concern, particularly when you consider this new study that suggests vast data centers are creating their own heat islands. [22:58] Warming the land around them up by up to 16 degrees Fahrenheit. It already reaches 110 to 120 degrees, multiple days throughout the summer in this region, allowing this development to move forward would be inhumane. [23:12] And that would precipitate transformation of our desert home into an uninhabitable wasteland. [23:17] General urban development on its own, which you are all calling infrastructure improvements, will already exacerbate the heat island effect. [31:27] This is the sunrise over my actual property. It is not Photoshop. [31:31] It is my little slice of heaven for the first five minutes of every day. [31:36] After that, the day can kind of do. Next slide, please. [31:42] So, we are Gamble Field because of the large number of Gamble Clale on the property. Next slide. [31:50] We do currently host dog events, next slide, and you can thumb through to the slides pretty quickly. [31:56] So, the dog events are held by AKC, UKC, and ABA, and other nationally recognized entities and organizations. [32:05] They rent the field because the field is safe, secure for their dogs, allows security from traffic, [32:12] and allows for the dogs to do what dogs do, run, play, interact. [32:20] The problem we have, even having been passed the planning and zoning commission, [32:27] is that several of the conditions that are attached to this proposal are unduly burdensome and an abroneous application of the law [32:35] and bordering on unconstitutional. Next slide, please. [32:40] So, we do have a huge amount of support for our proposal. Next slide. [32:46] Keep going. [32:48] So, what we are asking for is 40 days a year, or that is what we have compromised to is 40 days a year [32:54] between October and April, using Friday Saturday's Sundays and Major Holidays only. [33:02] We are primarily a daytime operation. There are a few times when we will operate in the evening, [33:07] and most of the conditions that are proposed are not a problem at all, and we agree with those. [33:13] The problems that we have are the dedication of the road, as there is no essential nexus, [33:19] between that land dedication requirement, and our proposal, and it is not proportional to our use. [33:26] The problem additionally arises that when you have a required dedication that changes the size of the property, [33:33] and then you add in the Prop 207 waiver that says no changes of the made to the value of the property, [33:38] they cannot both stand at the same time. [33:42] So, one or the other has to go. [33:45] There is no essential nexus. This road has been functioning as a road illegally, [33:50] but functioning as a road says at least 2002. [33:55] The county built the road through 21 private properties, without first acquiring any right of way or land rights. [34:01] It was an eight foot telephone easement that the county came through and turned into a 30 foot wide road. [34:09] The records request that we have submitted supposedly the records only go back to 2018. [34:14] I do not believe that is true because they also did not provide any destruction of records certification for the records that supposedly no longer exist, [34:24] and those records should have been covered in my records request. [34:27] Additionally, I have not received any of the emails that I have requested amongst the various departments as to how they came about these determinations. [34:34] The assertion that has been made by the Department of Transportation is that the number of occupants or [34:40] number of people that can participate in our events must be kept low as well. [34:44] In part because the road currently has 92 average daily trips according to an email I received on March 11 after planning and zoning. [34:52] That is not true by Department of Transportation's most recent traffic count. [34:59] And I have those for you if you'd like to see them. [35:02] We are already at the 100 mark. [35:05] My limited traffic does not change the level of service on that road and would not require any additional improvements. [35:11] There are no changes that are needed. [37:20] So what that gives them the right to do it. [37:22] Currently for land use would be rural uses as well as residential uses. [37:26] Which is the property is currently being used for. [37:29] In the past couple of years there have been three requests for temporary use permits to allow temporary events on the site. [37:35] That's been occurring. [37:36] Each of those temporary use events has incrementally increased in its intensity. [37:41] With the last temporary use permit it went to the Board of Adjustment. [37:45] The Board of Adjustment indicated that with this level of intensity it was becoming more of a permanent use. [37:51] So the applicant has requested the special use permit for a permanent entitlement. [37:55] The original request was for up to 400 attendees at 60 days a year. [38:02] At that level of intensity and this became a permanent type of event venue. [38:07] It also would be considered a commercial type of venue under our codes. [38:13] With that come requirements for certain infrastructure improvements. [38:18] The request that came forward did not provide the adequate level of detail to show that those infrastructure improvements would be provided. [38:27] Some of those would include water service wastewater service. [38:32] The gradient and drainage for the parking area and ADA access. [38:37] As we proceeded through through the through the evaluation analysis of the request. [38:42] It became apparent that what what the applicant is proposing would be to have a permanent entitlement to what could be considered more of an interment use. [38:50] As you see on on the slide that she showed it's a very beautiful pristine location. [38:55] The intent is that my understanding and our discussions with the applicant the intent would be that after each of these events it returns to that pristine location. [39:04] So with that in mind as we as departments got together to look at those codes and what those requirements would be. [39:11] What are the thresholds where things would would be considered more of a temporary or interim type use. [39:16] As we looked at those codes the conditions of approval that were advanced through the commission are those ones that we came up with. [39:22] or the ones that would would allow for the use of portable portable toilets the ability to utilize the site. [39:30] As you can see in the for the for those smaller types of events that's where we came up with with the lesser intensive use of the 49 49 epic our 49 attendees. [39:41] Primarily as it relates to the questions that were brought up by the applicant today with regards to the prop 2 of 7 waiver or that section of the Arizona statute regarding. [39:51] waiver of liability that is a something that is asked of every applicant it's an acknowledgement that states that they are asking for for this decision. [40:00] And they're waving that this legislative act waving that ability to come back and seek. [40:07] Redress through that through that statute. [40:11] It's a common procedure it's something that goes through without that. [40:16] To proceed forward puts the county at that liability. [40:20] The other request is Mr. Gutierrez here's the speak to that is on the conditions of approval related to the infrastructure related to the transportation. [40:30] Chair before we move on to Mr. Gutierrez I just want to understand the first the first request was to have up to 400 attendees. [40:40] But there were certain in order to do that there had to be infrastructure improvements correct that is correct. [40:46] And then it is that you're understanding the applicant and want to do those infrastructure improvements for 400. [40:52] So you guys talked together I assume and then moved it down to 49 attendees. [41:00] So that there would be less infrastructure needs is that your understanding. [42:03] The next slide you could clearly see there's a well defined road. [42:07] Well before this is 1986 now. [42:11] Three thirty first. [42:13] From lower buck I you could see the lower buck I writing on the area all the way [42:17] Vamburen on the north on the top of the slide. [42:20] There's a well defined road. [42:21] Yes there are other roadways scattered throughout but you could see [42:25] Three thirty first is a well defined roadway existing all the way back. [42:30] I'll start from 1976 this is 86. [42:33] And it serves multiple properties multiple neighbors. [42:36] As the area develops there was more. [42:39] The roadway was more defined. [42:41] So moving to the next slide. [42:43] Circa 1996 you can see the existing roadway. [42:47] There's a roadway there that serves a property. [42:49] The the arrow red arrow points to the property in question. [42:54] And it's a well defined road. [42:56] Again yes there are other adjacent roadways to properties and two deserts. [43:00] But this roadways well defined many years before. [43:04] But the claim the claim from the applicant was that we created the road in 2004. [43:11] The road has been there for over 50 years. [43:14] So the next slide. [43:17] Again is is a little more defined. [43:20] That's the current condition of the roadway. [43:23] We've met with the applicant obviously and had numerous discussions to try to. [43:29] Work through the SUP and I'll I'll talk more about that in a second. [43:34] But this is the the most current slide. [43:36] So in those next slide. [43:39] That's all right. [44:17] So the existing roadway serves obviously a multitude of properties. [44:21] To points north and south of the applicants property. [44:25] It was taken into the county system by the board in 1994. [44:30] We discussed the need for the dedication. [44:33] Which is a standard practice for for the increase zoning entitlement to the county zoning zoning ordinance. [44:39] In the fact that this is a section line alignment and requires. [44:43] The house re-dedication. [44:45] Very clear. [44:47] Very straightforward. [44:49] The requirement for traffic impact study was waived. [44:53] The requirement for reservation of a 55 foot right away was waived and reduced. [45:00] To 40 feet, the half-street improvements that would typically be required from a business putting in the infrastructure have been waived. [45:10] Staff work to provide all the requested information. I know that one of the questions or one of the points made by the applicant that they didn't receive, the information we provided over 600 documents, four different directors have worked on this. [45:30] Personally, work with them directly to provide the answers to provide the support and any guidance that we could to try to make this work. [45:42] I know that one of the claims is that we didn't provide the documentation required, but that fact that we provided over 600 documents. [45:54] Director of Data Governance herself came to make not look through over 5,000 files herself to provide the information to the applicant. [46:05] When it comes to this move to the next slide? [46:09] This point of clarification, all those items that were waived, are they in relationship? Thank you for this project and relationship to this project. [46:19] Directly related to this project. [46:21] So when we look at this slide, it talks to the other points. [46:27] All those areas in blue along that alignment are state land. [46:32] We have a tremendous relationship with state land, and those right-of-way dedications that we would need for the roadway are granted through state land. [46:41] So the claim that we're going through properties without permission is to this slide, I'll speak to it. [46:52] Either going to be granted to us by state land or we can vote ARS 37931, which all the guarantees is that everything in blue there, the state land and property, that will have a right away for the roadway. [47:09] So those are not in question. It's kind of difficult to see, but then you'll see some yellow lines along 33. [47:17] Those are previous dedications from either subdivisions or private properties. [47:22] So what we're left with is two red arrows pointing to two properties. [47:27] Those are the only two dedications needed. [47:30] So the point that we don't have permission to be there and don't have the right away throughout the entire stretch is erroneous. [47:41] So we do have permission to be on the right away. [47:44] When we talk about those other areas that we do not have specific dedicated right away, because we've established that the road has been there for at least 50 years. [47:57] We have what's called prescriptive rights, prescriptive easements, the right. [48:02] And as I say, I'm speaking of the general public, all the neighbors, all the residents along the alignment are using that roadway for access to their properties and have been conspicuously using that for over 10 years. [48:16] Those are some of the tests to the prescriptive rights case law. [48:20] And the fact that they are using this on a daily basis as well as the applicant is using other people's property for access to their property is really speaks to prescriptive easement rights. [48:38] The fact that we can be there and all we are doing from the department transportation is maintaining that existing roadway for the residents providing a safe passage for that. [48:49] And to finalize my comments, the dedication allows us to finally get those last portions of right away so that we can continue and improve the the roadway for the business that's coming in and for the residents to continue to make the next level of improvement right now to dirt road. [49:13] Once we reach a level of traffic beyond under a hundred, which is what we're at right now, average daily traffic was re-measured. [49:24] I spoke to the applicant, I let her know that the numbers we're using were several years old and the number was about 75. [49:37] The applicant told me those are probably wrong so I asked for an expedited done in about two weeks, which normally takes two months, we got it done in two weeks got the numbers back and the numbers came back in the 90s. [49:54] So it didn't help the case that any more traffic along that route is going to trigger the need for make dot to start making more improvements for does mitigation for controlling the access in terms of making it a safer passageway. [50:12] All those points really are the nexus of the requirement and it is directly tied to this development. [50:20] So the fact that we are essentially asking for this dedication is strictly tied to the development and is clearly justified through our standard practices and policies and zoning ordinance and the fact that we're only trying to provide a safe passage for the residents on a roadway that's existed for over 50 years. [50:41] What's your thank you I have a couple questions and I think you already answered it but I want to make sure it's clear this isn't any unusual condition on this particular applicant correct this is before you would ask this of any applicant correct. [51:01] Madam chair, Madam vice chair absolutely. [51:06] The the roadway dedication is part of our zoning ordinance. [51:11] I think you know I even saw in the slides from the previous agenda item that was listed on there the requirement so and that they're inviting by and so absolutely this is standard practice it would not. I never got a letter, information saying they were taking property from me for any reason, legally or not. [1:00:28] The county has a lot of problems out there that they're refusing to address. They need to get their crap together as homeowners and treat us properly with respect. [1:00:38] If there was no easement, it was a power line utility, which has not allowed for public traffic as I understand it may be on-roll. [1:00:46] Correct me if I'm wrong. Allowing neighbors to use it out of kindness turns into they take it without any due process. [1:00:58] I do not believe that's fair. And that has happened to wherever your map is. And no one has taught to me or asked me anything. [1:02:40] And I'm the very first part of that road coming off of lower by going north. [1:02:51] So I would like to have this get resolved. I have no issues with gamble field. I'm all for everything that they do. [1:03:05] But this road is becoming a problem. And it needs to be fixed. Thank you. What I would like the board to do is to approve this application with the removal of the road dedication requirement and an alteration of the number of people requirement. [1:03:38] I am extremely upset with the way Mr. Guterres has been misrepresenting and playing fast and hard with the truth. [1:03:48] The road already has a road count of over 100, which requires EPA stabilization, which they had last year. [1:03:57] So for them to have previously done the road stabilization at a cost of 300,000 taxpayer dollars. [1:04:04] Yeah, we pulled those records. Oh, and as a side note, yeah, he did give us a data dump of some 600 documents 500, which were for other roads we didn't request information on. [1:04:14] But don't act like the big volume of information they gave us was relevant. He still refuses to provide the documents we requested claiming they no longer have them, even though the law requires they being maintained in perpetuity. [1:04:27] There are some serious shenanigans going on with that. Also the 49 person thing is tied back to whether the road is stabilized. [1:04:38] The 49 people EPA is going to require that the road be stabilized. They already did stabilize it last year. [1:04:46] 20 20 had over 100 car count, which required the stabilization, which they did in January of 2025. Again, 300,000 taxpayer dollars. [1:04:56] We talked up through our count 21 privately owned properties and they had not the Board of Supervisors said in 94. [1:05:04] Go build the road, but get the access to it, get the acquire it. [1:05:11] They built it without acquiring it. That constitutes an illegal taking under both federal law and state law. [1:05:42] Now, we're not opposed to being a road there, even though I'm paying taxes on it, but the idea that we do a permanent dedication in exchange for a temporary permit. [1:05:53] Because even though it's a special use permit, it's got a time limit on it. At the end of our permit, do we get our road back? Because if we don't get our road back, then the property has been diminished in value. [1:06:03] So, all we want to do is let dogs play in the field. What we propose is that the road issue be separated and dealt with as a separate issue, which is going to have to be anyway at some point in the future. Hundreds of dogs have in fun. [1:07:03] And so happens in Arizona that the Quail Hunting season is October through March, I believe. [1:07:10] So, in that regard, the only reason I'm kind of looking at it is it goes from 49 people to 400 people. [1:07:17] And the gentleman did note on here, and I will repeat what he stated on one of these 471 pages. [1:07:26] This is overall natural unimproved outdoor space, where people and dogs can participate in the vast openness without concrete traffic or other city characteristics. [1:07:35] But there are guns involved, because Quail Hunting involves guns and then you have dogs all over the place chasing them. [1:07:43] This is what I'm understanding from what's going on in here. It is Gamble's a Quail and she did mention that there's Quails all over the place. [1:07:51] So I'm wondering if there is a safety factor regarding a lot of guns in one area where you jump from 400 people down to 49. [1:07:59] And I also read it that said that they wanted a 30 year SUV and you brought it down to a 10 year SUV. [1:08:08] Is that a concern regarding the Quail Hunting, the noise, I don't know what else might be, it's just I'm throwing it out for thought, but it is in those 471s and I'll give the rest of my time for you to answer those questions. [1:09:23] But that's almost a regardless to the dedication requirement in the zoning ordinance, the zoning ordinance requires that we get a half street dedication on these section lines. [1:09:33] Those are two separate things. On top of that dedication, we are looking at the added traffic, the added volumes that push us, whether it's 102 to 120, 150, whatever the vehicle count is that we take the next step to improve the roadway to make it safe to reduce the dust and the problems that we have. [1:10:00] So those items are interconnected but the way they're being described is not exactly accurate. [1:10:10] So it's a very straightforward methodology that we use. We follow the ordinance. We follow the processes and the zoning ordinance is very direct requirement for the half street dedication. [1:10:25] Nothing to do with the actual weather we spent and we were actually told by the applicants that we did a great job of maintaining this roadway for since the board took it in in 1994 we've done everything we could as a DOT to make it a safe roadway. [1:10:44] So we have done we have expanded those bodies and we shared that information. We provided that information in full transparency. [1:10:51] We have provided everything we have because the initial request was very general and very large so I think the information shared depicted the fact that we do request this from other applicants not just you and that's why it was shared. [1:11:11] There's relevant to the request so a lot of those things are not exactly accurate and I'm not saying they're intentionally inaccurate by the applicant I'm just saying they're just inaccurate. [1:11:24] So hopefully that answers the average daily traffic the requirement for the half street dedication which is what we require everybody. [1:11:33] And the fact that we have because the board of supervisors took this roadway into the roadway system we therefore maintain it since 1994's part of the road file doing our due diligence and doing the best we can so along with that any any further questions. [1:29:34] So this work of drug enforcement and cartel investigation is now falling under Homeland Security Task Force. [1:29:46] And they work through the DEA on this. [1:29:49] We basically resurrected the same mission just through a different part of the government. [1:29:56] So our team... [1:30:00] Because cartel activity continues to encroach deeper and deeper into our county, it makes sense for our deputies to work with the DEA and with their federal funding, we're able to buy equipment, investigative tools, pay for analysts, things like that. [1:30:20] The original agreement sent to us from the DEA was just an MOU. We worked with the county attorney and split that into not only an MOU that dictates how our deputies work with the DEA. [1:30:35] We also then did a cost reimbursement agreement, which outlines the kinds of equipment and services that we can use their money for. [1:30:47] And that's what we have here today is both of these agreements now need to be approved so that we can continue our work. [1:30:55] This round of the contracts is down a federal fiscal year, so technically it started back in last October, but it took a long time for the DEA and the Homeland Security sort out which projects they wanted to continue and not continue. [1:40:10] This is a public improvement district, a paving improvement district. [1:40:15] And essentially the neighborhood, the property owners themselves came together, requested that the county design, bid, build and operate this roadway on their behalf. [1:40:32] They are funding it in its entirety. [1:40:36] The transparency comes through numerous steps, which this particular item and the next one are steps six and seven of the entire process. [1:40:45] We've gone through steps one through five before the board. [1:40:49] Everything from the postings to the acceptance of the design, the assessment map, what each homeowner is going to pay. [1:40:59] The cost estimates from the contractor, essentially through every step, each homeowner has been notified directly and in person about their contribution, their expected contribution. [1:41:14] And in the final contribution, they've been kept up the speed on the progress of the project through the last four years, it's been a long process five years now. [1:41:23] And essentially there are no gaps in the communication or the transparency. [1:41:29] Every single homeowner is fully aware and voted on the project and anything related to it specifically. [1:41:38] Giving that background, I know there are several specific questions. [1:41:43] I'll ask Lana, our superintendent of the streets to talk to those specific points. [1:41:49] Yes, Madam Chair, members of the board. [1:41:52] To first, just these touch space on the public notifications, but as per statute, we followed the notifications required each step of the forming the district and all the resolutions that have been previously approved. [1:42:07] The assessment of the questions was a assessment amount. [1:42:10] I've started off, we collected $259,000 and $40 and $222,000 in cash payments from property owners, which resulted in $189,000, $320 in a penny that are going to go to bond. [1:42:26] The total bond plus interest that this will result in is $280,000 and $265, sorry, I'm curious to that, $286,000, $565 and $31,000 that's bond plus interest over the next 10 years. [1:42:45] There are 14 properties that will have assessment amounts that will be collected. [1:42:53] The county is not paying as Jesse has stated the county is not paying for any of this is all funded by the property owners and the road is accepted into the county and we will be maintaining it going forward. [1:53:31] Current rule 43 zoning supports responsible growth in an area with low density desert equestrian living. [1:53:37] There are quest shifts to a high density zoning, including small lots and multi-family housing and it is not a transition. [1:53:44] As a complete change of land use, place into the middle of a rural desert community. [1:53:49] Third, this is not just a local issue, it has regional impacts. [1:53:53] The road emergency services and infrastructure in this area are shared across multiple surrounding communities. [1:53:58] Increase density here will directly impact traffic, response items and public safety while beyond the boundaries of this project. [1:54:05] The community is strongly opposed to these rezoning requests. [1:54:09] We ask that these concerns and the voices of 1,000 residents be taken seriously as is moved forward. [1:54:14] And we respectfully ask that you take the time to meet with representatives of the community before making any final decisions. [1:55:17] We Google something every day, our GPS, etc. [1:55:22] We need responsible building of data centers and that's exactly what project Bacara is doing. [1:55:28] They are providing their own energy source. [1:55:31] They're selling back power to APS on the wholesale market. [1:55:38] So it's going to provide power to the citizens of the West Valley, which we need with all of the growth that we're experiencing. [1:55:46] This project will also use reclaimed water, which is critical because as everyone in this room will tell you water is a concern. [1:55:55] So using the reclaimed water, kind of disperses their reasons for being against this project. [1:56:02] People will come in with the sky as falling scenarios, telling you there's chemicals, there's noise, there's all of these things. [1:56:11] But the reality is this, data centers are here to say, stay. [1:56:15] They are very popular right now to it's popular to be against them. [1:56:20] But the people who are against them are not digging into the facts. [1:56:24] And the fact is a data center in the West Valley is going to be needed mainly for the power. [1:59:27] I, like many of my loved ones, have voted by male because my job, like many others, do not allow the day off so that we can go to our polling locations to place our vote. [1:59:38] When I have gone in the past, the lines were so long, it would just take hours of my time. [1:59:43] So voting by male gave me essential time to do the research on the candidates and ballot measures so that I could make an informed decision well before election day and doing all this in the comfort of my own home. But looking at the survey released by the Center for the Future of Arizona on January 15, 26, it shows our core value for accuracy with 96% saying every vote counted and each are essential. With 69% saying votes should be easier and convenient for citizens to vote early by mail and election day. [2:00:27] Arizona doesn't need people like Justin heap or Mac influences. Who would limit the number of polling locations making it disproportionately harder for communities like my own and other marginalized groups to make and to make our voices heard because let's be real they do not want to hear what we have to say. [2:00:47] Our elections are secure, accurate and trusted by our residents. We deserve a system that reflects the needs of our communities where voting is accessible. [2:01:39] It has been a reliable and trusted way for me to participate in our democracy. It gives me the time to research candidates and make informed decisions without feeling rushed. [2:01:49] That's why it's so concerned to see a system that has worked for decades now being questioned and disrupted. [2:01:57] Arizona's elections are secure, trusted and already working for voters like me, but recorded just in heat is undermining that trust. [2:02:05] He's creating confusion, delanded decisions and making people question the system that works. [2:02:12] We need the polling locations map finalize, delays like this don't protect voters, they discourage participation and it makes it harder for people to do their civic duty. [2:08:47] I should never be present at polling locations and their presence is unnecessary and would have a chilling effect upon voters and serve to intimidate eligible voters from exercise in their constitutional right to them. [2:10:32] Instead, we're stuck waiting for everyone to agree on a spreadsheet, creating an unprofessional time crunch that makes it almost logistically impossible for us to activate, educate and organize our community. [2:10:41] But before we get too far, we're going to need a detailed explanation on the math and the criteria that the reporter heap and you all as the supervisors are using to select the vote centers. [2:10:50] We need to explain the justification for his current proposal. [2:10:53] If I heard correctly on Monday, heap is planning for seven far east of early vote centers to be open for 28 days before the election versus one west side of the voting location center in Levine to be open for only 12 days. [2:11:09] Make that make sense. [2:11:10] Is he planning based on some historical voting patterns that we all know about? [2:11:14] Or is he planning for the voters he wants to show up for his maga Republican candidates? [2:11:21] As I end, please do not let technical disputes disenfranchise us. [2:11:53] Voting in America is one of the most important duties we have as citizens, but it was not always an equal right for everyone. [2:11:58] Let's not repeat history and go backwards. [2:12:00] I'm here today because of the injustices going on in our country and in our state that are not being addressed. [2:12:05] People shouldn't have to fight just to have their voices heard. [2:12:08] Our elections have already been trustworthy in the past years, but just in heap and his maga agenda are deliberately sabotaging the system that makes our democracy. [2:12:17] Arizona is a face for the consequences of the fabricated chaos, and yet the board has yet to come through for us. [2:12:23] If you allow just and heap to dismant our elections, the voters like me will suffer the consequences. [2:12:28] My neighbors will suffer the consequences, black, brown, indigenous, and marginalized communities will be left with even less resources to have a say in a system that is already not built for them. [2:12:38] Is that what you want? [2:12:39] Why do we not have a finalized polling location in the map yet when other counties are ready to do? [2:12:44] Everyone in our great state deserves it right through a fair election. [2:12:47] We deserve a board that will choose our democracy over Trump's agenda. [2:12:50] My mother, my father, my neighbors, they all deserve a voice. [2:12:54] I'm standing before you to ask for a prompt polling locations map, a saying who governs our state and for everyone to feel a power that comes with the yielding their ballot. [2:13:35] You as the board do not have the ability individually or collectively to supervise the elements that you moved or the previous board moved, which you have sanctioned to stay in place. [2:13:49] You do not have the ability to supervise and provide transparency, accountability, and integrity collectively unless each of you all five are present for every meeting. [2:14:03] Every training, every oversight, every directed that is given to the election department, unless you are collectively there. [2:14:13] It becomes a partisan issue for each of you then to, while I trust the fellow board members for their conclusions. [2:14:22] That is not transparency board. [2:14:26] Transparency is to give the Recorder his duty that he was due the elected to do and hold him accountable. [2:14:34] That is the vote that is what everybody is expressing. [2:14:39] Everybody wants their vote to be accounted for the way that they submitted it. [2:14:45] And that is what you do. You hold the individual accountable. Collectively, you cannot do that. [2:14:53] You cannot collectively vote to approve. [2:15:00] Your actions without it creating a cloud that is not transparency for the voters of Maricopa County. [2:18:13] Sometimes with seconds within seconds, I myself was interrupted by the chair three times in the last meeting that I was at. [2:18:21] Within the first 25 seconds of my public comment, you didn't even acknowledge what I was going to say. [2:18:28] That's called viewpoint discrimination and guess what? [2:18:31] That's unconstitutional. [2:18:33] Same thing you just did. [2:18:35] That is an infraction against my free speech in my first amendment, right? [2:18:40] In case you didn't know, first amendment is free speech. [2:18:43] This is my free speech time. [2:18:45] I was thrown out and for an unconstitutional restriction of my first amendment for those of you who are reminder that is my free speech. [2:18:53] However, board members, particularly during budget discussions recently, have expanded the time to go off topic without similar interruption. [2:19:00] From a public standpoint, this appears to be unequal application of rules. [2:19:05] Because of my pushback, I was ejected from the room. [2:19:08] And when asked where I was removed, the response from Mr. Galvin was profanity. [2:19:13] I did not say anything profane to cause myself to be ejected. [2:19:18] And that was completely untrue. [2:19:20] And we might just call that what it is, it's called a lie. [2:19:23] So if we can't expect the truth from you, Mr. Galvin and the board, why should we believe anything that you say? [2:19:29] Chair McGee, you allowed that violation to happen and shame on you as well. [2:20:02] Sometimes they're upset and angry. [2:20:05] I know that you guys catch a lot of flack. [2:20:09] I'm also on the other side of that because this is only my fourth meeting. [2:20:14] And as a retired realtor, I find the fraud that's involved in the foreclosure. [2:20:22] The auction sales is atrocious. [2:20:25] I also handed these out. [2:20:27] So I don't know if you have this form you've seen it before. [2:20:32] And it's kind of odd when you really look at it. [2:20:35] There's, you know, 22 homes on it. [2:20:37] There's only one where in the column where it says, you know, [2:20:42] the balance in that account is zero. [2:20:46] And that means that that homeowner, after their foreclosure, [2:20:50] and their equity was stolen from the home. [2:20:54] By the banks, they got that money back. [2:20:57] So that's less than 5% of the people are getting their money back. [2:21:02] And the only reason that they, it's so low is that they've never, [2:21:07] it's never been disclosed to them about this. [2:21:10] So I would really like to reach out with two of you [2:21:14] and see if we could set up a meeting and talk about this. [2:21:18] This has been going on for probably 25 years. [2:21:23] I've been a realtor for 44 years and never heard the term, [2:21:28] excess funds, excess proceeds, or overages. [2:21:32] I've worked for banks, I've foreclosed on homes. [2:21:35] So this is a tremendous amount of money, [2:21:39] and they're taking it from the most vulnerable people. [2:21:43] You get thrown out on the street after foreclosure. [2:22:20] Arizona has procedures for post-election audits and tabulation, [2:22:24] but the public still needs clear visibility [2:22:27] into how ballots move through the system. [2:22:31] Can the public easily access documentation that shows [2:22:35] where ballots are at each stage custody? [2:22:42] Be who is responsible for them? [2:22:46] Custody. [2:22:48] And see how they are secured and transferred? [2:22:52] That's custody also. [2:22:55] Chain of custody is one of the most critical parts of election integrity. [2:22:59] If the public cannot clearly follow that process, [2:23:02] confidence will continue to decline. [2:23:05] Transparency in handling ballots is just as important as counting them. [2:26:07] And then you won the race. [2:26:09] You got elected. [2:26:10] You probably thought, these people are pretty wise. [2:26:13] They elected me. [2:26:14] These are smart people. [2:26:16] I would have hoped that the first meeting you guys got together [2:26:20] and would have had focused on how do we glean from our people's wisdom. [2:26:27] In Proverbs, chapter 11, 16 and 24, [2:26:31] it is stated over and over about how good outcomes are obtained by the wisdom [2:26:37] and the counsel of many. [2:26:39] If you want the wisdom of your people, like you said, [2:26:43] here's a starting place. [2:26:45] First, make it convenient for your people. [2:26:49] The Bureau of Labor Statistics shows 87% of the working men and women [2:26:56] are stuck at their jobs between eight and five, [2:26:59] Monday through Friday. [2:27:00] So, once you hold this public meeting on Saturday or in the evenings, [2:27:06] too, once you prove the webinar access to all, [2:27:09] not just the board or the elite view. [2:27:13] Three, once you stop restricting public dialogue [2:27:16] on nearly 80% of the agenda items. [2:27:20] Instead, once you ask the people if they want to speak on any [2:27:24] or all the agenda items for, [2:27:26] once you schedule the public comment time at the beginning of the meeting. [2:27:31] Sometimes we wait here for three hours to speak for two minutes. [2:27:35] People these two are going to speak on those two. [2:27:38] That would have been a total of six for driving for three hours. [2:27:41] Once you schedule the dog presentation after the public comment, [2:27:45] your dogs come before your people. [2:27:47] How about people before dogs? [2:27:49] Once you budget some funds to advertise to the people [2:27:52] that you are eager to hear from the people at these. [2:30:36] Florida and Mississippi are among four Republican controlled states, along with South Dakota and Utah, that have enacted proof of citizenship measures this year. [2:30:46] These measures reflect election integrity reforms demanded by President Donald J. Trump. [2:30:52] Donald J. Trump, such as requiring a birth certificate, naturalization certificate or passport. [2:31:00] President Trump has also issued an executive order to reform mail-in ballot voting, which is facing obstruction [2:31:08] from Democrat lawmakers left-wing extremist and liberal judges. [2:31:14] Are they worried about losing their votes from illegal aliens? [2:31:20] Just question. If these four states can pass this legislation on requiring voter ID, Arizona can too. [2:31:28] Each of us need to write to our senator, whether it's Kelly or Gallego, [2:31:34] and ask, did you vote to pass the Save America Act? [2:31:38] If no, please explain what part of it is not in the best interest of putting America first. [2:31:46] We need to remind them that they are elected by us, hopefully, to carry out our will. [2:31:56] Our will is to place America first, this having the same America Act passed. [2:32:04] Board members, if you are in agreement with the Save America Act, when you go out to your group meetings and meet with large number of people, [2:32:13] please talk about this, you can reach more people than we can as individuals. [2:32:19] And Mr. Gallardo, last meeting when I asked the board members, if they had stood in the state of the Union address, you said no. [2:34:31] You know, we have folks on the other side here that I don't necessarily agree by totally respect their viewpoints on some of the issues until they start calling as names. [2:36:27] It gives parents the tools that they need to help their kids get through a tough time in their life. [2:36:33] We know that mental health is an issue with our teens right now. And so I encourage you to go to not my kid.org and learn more about that and maybe you can get involved. [2:36:41] It's an incredible organization. [2:36:43] I also want to thank Vice Chair Lesco. She held a, she organized a meeting at the state capital for us to meet with our legislators from both sides of the aisle to talk about local independence, right? [2:36:56] Local control and how important it is for the government closest to our community to be able to support their community and work with them. [2:37:02] And not so basically let us see what we do, they do what they do, and it was a great meeting. So thank you for that supervisor. [2:37:12] Attendant the Gilbert State of the town, where that town is booming, attended that with Mayor Anderson and Council. [2:37:19] But I think the great thing about that is the community members that come out to take part in that. [2:37:23] They're doing great things in Gilbert. [2:37:26] We attended the grand opening. And I was thank you Madam Chair for allowing me to speak at the new Maricopa County Department of Public Health. [2:37:34] The staff there is incredible. We had a ribbon cutting. [2:37:38] And this location will bring together multiple services like WIC, vital record, vital records, immunizations, health screening, testing treatment service, all in a consolidated location. [2:37:50] We like to talk about meeting the customer, where they are, and this particular location of Mesa just does that. And it's a state of the art place. [2:37:58] And then I had the fortunate time to spend with Mayor Cori Woods last week. [2:38:04] And we had a nice lunch and downtown. [2:38:06] It's happy they've done some great things on Mill Avenue. [2:38:08] But tempies and good hands with Mayor Woods and Council. [2:38:11] And thank you very much, Chair, for the time. [2:39:28] And they help with road control, traffic, that type of thing. [2:39:32] But they also check in on people that are gone on vacation to make sure that their house is okay. [2:39:39] And there's not a flood in that type of thing. [2:39:42] And as supervisor Stewart said, I host a legislative luncheon down at the state capital. [2:39:50] And I was honored to have our chair Mrs. Brophy McGee there. [2:39:56] And also Mr. Stewart joined in also a number of legislators. [2:40:00] And we talked about all kinds of issues. [2:40:03] But as these two can attest, I just kept telling our state legislators don't mess with the county. [2:40:10] And which is interesting because I used to be in the state legislature. [2:40:16] And I used to mess with the county in the city. [2:40:18] And now I'm in this different building. [2:40:20] I'm like hands off at the county. [2:40:23] Anyway, and then yesterday I got to go to Glencroft a center for modern aging. [2:40:30] It's an assisted living center for senior citizens. [2:40:57] And two of the members of that group that meets every Friday. [2:41:03] I think my colleagues from the legislature would recognize Frank Cantonore from Cochise County. [2:41:10] Sunny Borelli from Mojave County. [2:41:13] And if I had a nickel for every time they said, I wish I had known this in the legislature. [2:41:22] I picked on county so much and they're really mad because we're getting picked on. [2:41:30] So the light eventually goes on. [2:41:34] But even for even for the. [2:41:38] But I won't call them eerie deemables. [2:41:40] But that's what they called me. [2:41:43] Now we're good friends. [2:41:45] I wanted to thank Scott Jarrett and his team. [2:41:49] I got to participate in a mock election. [2:41:52] But the election volunteers. [2:41:55] It was really fun. [2:41:57] I got to role play a voter who showed up with my early ballot wanting to vote it. [2:42:02] But I didn't bring my ID. [2:42:05] And I couldn't bully my way through. [2:42:08] Guy was so nice. [2:42:10] I said I can't be grumpy. [2:42:12] He's too nice. [2:42:13] But they were role playing all these different situations for what can happen. [2:42:18] And it had a polling place. [2:42:20] And I was very, very impressed. [2:42:23] I Helen Purcell was there. [2:42:25] So that's always fun. [2:42:27] To I was very impressed. [2:42:29] I was very happy to be a part of that. [2:42:32] When I was on the school board I used to walk into a school. [2:42:37] And the energy was always unique. [2:42:40] And then depending on the classroom you went into the energy was unique. [2:42:46] Because things were happening. [2:42:47] I remember one classroom I went in and it was nothing was happening. [2:42:50] I was very sad. [2:42:51] But most of the time there's a pop. [2:42:53] Things are happening. [2:42:54] So walking into that elections room and the energy just popped. [2:43:03] People were excited to be there. [2:43:06] They were excited to participate. [2:43:10] They were very dedicated to ensuring that people got to vote. [2:43:15] And everybody, you know, were able to present their ballot. [2:43:21] And it was led by Mr. Jarrett, who also despite his auditor background had some real energy. [2:43:29] Going, this is his passion. [2:43:31] This is what he loves to do. [2:43:33] And it was really an honor and a privilege. [2:43:37] So I also wanted to thank, we had some new participants today. [2:43:42] And I wanted to thank the new participants. [2:43:46] We had some regular participants. [2:43:49] A couple of whom recognized different views, different perspectives. [2:43:53] Thank you for coming. [2:43:55] Thank you for presenting those views. [2:43:57] Thank you for presenting those perspectives. [2:44:00] And I have a microphone. [2:44:04] I'm a politician.
