[1:40] going to want to call this meeting to order at 6 o'clock. Madam Clerk, could you please [1:45] call the Roll Commissioner Ms? Here, commissioner comments here, Vice chair night in there [1:55] and cherry holler here. can you please silence that? Whoever's on the phone okay. [2:12] All right. I'm gonna ask you all tries for the Pledge of Allegiance. Enter new assistant [2:15] city manager with awful is going to lead us in that Mr. Commissioner, if we could, all [2:20] police can put our Sandra on the right. And I will begin with the [2:26] Pledge of Allegiance ready? I pledge allegiance to the flag of the United States of [2:34] America. And so the Republic for which it stands, one nation under God, and the visible [2:39] region and justice for all. Thank you, sir. Thank you. Ok, before we move on, just [2:49] as a reminder to everyone, if you have, if you have phones, if you could, please put them [2:56] on vibrate and obviously not talking phones during the meeting, that would be most [3:04] appreciated. Okay. There are no presentations this evening. [3:09] Are there any modifications to the agenda? No modifications tonight. Thank you. You can ask [3:16] the Planning Commission for an all in favor to approve the agenda. I I I I motion carries [3:25] with none opposed. Madam Clerk, are there any requests to speak on non agenda [3:32] items? Not tonight. Thank you. Okay. We'll move on to approval of the minutes. There's one set [3:45] of minutes for the Planning Commission's approval. Those planning commission have any [3:51] modifications. All right, seeing none. Can I ask for an all in favor to [3:58] approve the minutes from August? 26 2026 I I I I. None opposed the minutes are [4:06] approved. On the consent calendar. There are no consent calendar [4:12] items. And now on to public hearing items before we begin the [4:19] public hearing. I just like to briefly go over the procedures for that [4:26] following staff's presentation and any questions that the commission may have of staff. [4:32] The applicant will then be given an opportunity to speak. That will be followed by [4:38] members of the audience who wish to address the commission. Each speaker will be given up [4:46] to 3 uninterrupted time to provide their comments. And there's a countdown timer that [4:51] you'll see. Please note that the commission does not respond directly. [4:56] 2 comments from the public, however, we may raise questions of staff that are that are [5:05] directly related to the comments that you make. And that would be after the [5:12] hearing is closed to before we proceed commissioner night and has a statement that he [5:16] would like to make the city. Thanks sure. Out of an abundance of caution and [5:23] percent to advice from counsel. I'll be recusing myself from this item to to a common law [5:29] conflict of interest and leave the room until the matter is completed. [5:35] Thank you, Commissioner night. Okay. This is item 9.1 Boulder's project, Mr. A [5:52] community development director. Could you please introduce this item thinks share members of [6:02] the public. The item will be presented by a penny, a manager, Ryan Fowler. I [6:09] but maybe this is probably one of them has projects that are actually going to be percent [6:13] into the Pentagon, which may be second to last. Some rain will be doing the presentation. [6:20] Good evening, chair and commission members of the public. This is a boulders to [6:26] residential project includes 3 and entitlement cases that the general [6:31] plan amendment peel and 24 Dash 0, 2, 5, 3, a change of zone killing. 24 Dash, 0, 2, 5, 2, [6:37] and a plot plan peel. And 24 Dash 0, 2, 5, 1, The project site is located [6:44] north of Newport Road and west of Marietta Road along its southerly boundary is Spirit [6:52] Park. And the project site is located northeast of the terminus. The cul-de-sac there [6:58] of Normandy Road east of the railroad and it's adjacent to the boulders. One project, this [7:06] boulders to project is the same applicant and owner has that Boulder is one project and we [7:10] will talk about a little bit of background on on that in future site. Here. So the general plan [7:19] amendment, I it is to go from 5 to 8 join units per acre Residential land use [7:24] designation to a 20 to 24 a droll units per acre residential land use [7:29] designation. Just important note on this. Back in December of 2021, there was a different [7:38] zoning. The 5 to 8. It was economic development corridor, new part Road that designation [7:43] would have allowed for a mix of uses, including commercial and residential. It would have [7:51] allowed for up to a residential density of 24 dwelling units per acre. In addition to [7:57] commercial uses. So this is kind of going back to that sort of density [8:06] the zoning designation is now currently the low medium density residential. That's to [8:10] align with the 5 to 8. Do you per acre and they are proposing a high-density HDR [8:18] classification. Again, the zoning for the site was the economic development corridor, [8:21] Newport Road that would have allowed for the 24 dwelling units per acre back in 2021. [8:28] Before it was changed. So little bit of a background. These are images of the [8:32] boulders. One project here. You're looking at the from the intersection of Brea Normandy [8:39] to the Northeast at the medical building there at the on the top image and then behind it [8:46] in the background are the residential units. But there's also a podium parking [8:52] facilities see on the upper image and then in the lower image you see of the day care [8:57] center that's there now as well as the boundary between the boulders, one existing site and [9:03] the proposed Boulder's to site. So as far as the timeline that was November [9:10] 2021. That the planning commission approved this boulders, one project and then [9:16] in December 2022, they came back, made some modifications, some tweaks, and it was proved [9:21] by planning Commission for those modifications. Then the next year in 2023, they begin [9:28] construction. And in 2025, is when the boulders one started receiving some of their [9:30] certificates of occupancy to open up and start business. It included the boulders [9:42] included 3 medical, a 3 story medical office building which you see there, it had 234 units [9:48] of apartments and that is very similar to what we have before us tonight. And boulders to [9:55] there was a 9 three-story residential buildings, a day care and the putting parking, [9:59] as I mentioned. So as I mentioned, there was this ATC zoning and land use [10:04] designation on the site prior to 2021, you see it there. This is an image showing the [10:12] land use prior to that to 2021 change. So it says a whole swath. The project site [10:18] outlined in red as well as the boulders one project, which is immediately to the West and the [10:22] champion Self storage site. All is the ATC. Really? I think the reason why that was [10:29] originally ATC as because in Newport, Rhode was essentially Normandy road [10:33] that they were mapped to connect and then at some point, the Newport Road was directed [10:41] down to the south and then there's topography there that could have prevented any sort [10:46] of street frontage on the south side of the project site. So seeing that there was no [10:52] street frontage in really make sense to have the requirement of the EDC, which would have [10:57] required a mix of uses with commercial and residential. That's when that was the site [11:03] was changed to a more residential only designation and it was put in this category [11:10] in between the 24 and the existing residential to the to the north and to the east. [11:15] Now we have like us. We have a slightly different scenario and that we have a built [11:21] project immediately adjacent to the site, which wasn't the case back in 2021. We have the [11:28] boulders, one project as well. As you know, we have numbers and this this site would help [11:33] in terms of meeting the city's moderate and above moderate unit requirements for Reno, [11:39] which is a state requirement for housing units, location. It is not just important note. [11:47] This is not low or very low income, but it is meeting more than moderate and above [11:52] moderate. So now for boulders to switching gears to the project [11:57] before you tonight, its 240 unit multifamily. So similar to the [12:03] unit count of Boulders. One, it's on 10.1 for acres. You see it in the blue, a transparent [12:11] coloring, the five-four story, buildings. They were intentionally shifted down and [12:17] away from the residents to the north and to the to the east. So that way they were give a [12:25] much larger setback. You can see in the image on the left hand side. It's great out, but [12:28] you can see the outline of the existing boulders, one project and you can see that the the [12:35] boulders to blue buildings are set back almost double what the boulders. One buildings are set [12:40] back from the residents to to the north. Then along the perimeter on the north and to [12:47] the east, you'll see those yellow tripe Lexus. Those are 2 story. [12:54] So they will mimic car or kind of a line with the the residential to story buildings, [13:00] homes to the north and to the East. There's also a wrecked [13:06] building. That's 5,025 square feet that's shown in the green. And then there's a much smaller [13:13] maintenance building up in the northwest portion of the site was 795 square feet. [13:20] In terms of access. The me the primary access will be right in right [13:27] out off of Newport Road. And there is another access that is a [13:33] full driveway off of Bray a road. You see it's shown it goes through the boulders one [13:39] site and then connects to Boulder's too. She wanted to emphasize in this presentation [13:45] that there is no access through or on Harts Berg. That was an [13:49] intentional originally when the project came in because that road was stabbed out to [13:56] connect. It was really the originally shown in the site plan to connect, but then Spurs [14:01] staff's recommendation that is now closed off. There's a plan or it can't be connected and [14:05] instead we're connecting to Newport, with a write-in right out. [14:10] There are some improvements for traffic that the applicant is conditions to provide. [14:16] So one is a new traffic signal at Berea and Normandy. Just that the northwest corner of [14:21] Speer park there. They will also be required to install a northbound left turn [14:29] lane pocket at that intersection or just want to note, too, that [14:35] they have an alternative scenario and their conditions where they can provide as an [14:39] alternative, a roundabout which would keep traffic flowing at that intersection in terms of [14:47] parking. They're required per our code to provide 374 spaces and they're providing a surplus [14:55] of 4 above that number to 3.78 And in terms of their landscaping and screening. [15:04] So they're going to provide 1.7 acres or 16% of the site will be landscaped throughout [15:10] the site there upsizing the trees to be 36 inch. And 45 48 inch box trees. So kind of [15:19] starting off with a larger specimens. So that way has more of a media impact and then [15:24] along the northern and eastern perimeters of the site, they will be putting in evergreen [15:31] trees and show Brisbane box trees currently, which are rapid growing, have a high of [15:34] about 30 to 50 feet, depending on the environment. And those will be of size to be [15:41] the 36 inch box right off the bat. So that way they scream or immediately. [15:47] There is a landscape setback of the 20 feet on both the north and the east. And then in [15:53] addition, you have on the north side of 40 foot Channel Flood Control Channel that further [15:56] separates them from the residents to the North. Catch a quick question. Can go back [16:04] to that on the eastern boundary between this specific family residences. And that reflects [16:07] is we got the road trees, but is there going to be a cinder block wall, a wall? There is an [16:12] existing law existing will help. Also 6 foot 6. And they will be providing [16:21] recreational amenities can spread throughout the the project site in the northwest [16:27] corner as the the is the sites can slopes up. There is a clubhouse with gentleman's pool [16:36] and spa and in spread throughout the rest of the site. There is a tot lot, 2 [16:42] different court yards with picnic tables and shade structures and grilling [16:47] equipment. And then in the northern portion of the site, there is a pickleball court [16:52] and dog Park. There is an open space requirement in the proposed [17:01] zoning designation of HDR that requires 20% open space there providing 21 through a mixture [17:08] of private open space com and open space, recreational area and passive. [17:15] The architecture for the site of the blooms was designed to blend but be distinct from the [17:22] Boulder's one project. So they're using the modern style architecture. Again, they're [17:29] using in the larger buildings, the horizontal lap siding metal awnings really means brick [17:36] stone veneer and then there's us recessing the windows, 2 inches to give it a more a [17:42] higher and look. For the 2 story along the north and the [17:49] east perimeter. They're going to be providing a little bit more warmth in and to more of a [17:53] residential feel, but still tying in some of those modern elements and utilizing garage [17:59] windows. Brick veneer board and batten lap siding, concrete flat tile, roofing and the [18:04] accidents and would pot shelves. One of the ACC's aspects of the [18:09] projects going to mention was that that access on Newport Road. So it does need to go [18:17] through a spirit park. So it will impact 0.1 0 acres of Spirit Park and shift it all [18:24] the way to the east side of the project site to can shorten the length that it has to [18:29] connects to Newport Road and also to avoid the active fields and courts that are in Spirit [18:37] Park right here where this new part road, the extension or connection occurs. It's a [18:42] natural passive turf area. And then and sáááá areas to offset the impacts of this loss [18:50] of Spirit Park. They're proposing to upgrade the parks to install some dog park [19:00] fenced areas with the infrastructure for that as well. Benches and and fountains [19:05] with that. Last week we did take the projects to the parks, Rec's [19:10] and Trails Commission that was on September. 3rd. To discuss, they're quick to [19:16] calculation, essentially for the public. The part that is the fee that can up that goes [19:24] to park acquisition. And at that meeting we received feedback from Prt. See, we will [19:33] need to go back after this project 2, because that was continued. That discussion [19:38] to solidify and finalize the Queen bee calculation discussion. That is pretty [19:45] standard. all projects after they're entitled go to the Rtc to iron out the details of [19:52] credits and how much she could be the responsible for. And the reason [19:57] why this one was brought before the planning Commission occurred was because of COVID, [20:03] the unique aspect of having Newport, Rhode go through the the Spirit Park. [20:11] Initial study for Sequin for California Environmental Quality Act to initial study, a [20:14] mitigated negative declaration was prepared, determined that the project will not have a [20:19] significant effect on the environment. And the public comment period [20:25] ran from July 29th to August 18th. We did receive comments from the from [20:33] the Department of Toxic Control, Substance or talks. It substances control. [20:38] And those comments were satisfied. Nothing further was required from them. And then we [20:47] did receive a couple 2 different correspondents. We email. You have all the [20:52] correspondence from the residence and then we did just receive one today that was [20:56] forwarded to you in part of your package. So this time staff is [21:02] recommending to adopt a resolution. I'm recommending adoption of a [21:11] mitigated negative declaration, incorporated and staff are in [21:13] the initial study in the conclusion that Boulder's to project look at approximately [21:20] 600 feet east of railroad northeast of the eastern terminus of nor any road will [21:22] not have a significant effect on the environment. And to adopt a resolution [21:28] recommending City council approved the general Plan Amendment zone change the plot [21:35] plan for both the boulders to project. Just to make a quick note on that first bullet [21:37] should be recommending adoption. And then also you have for [21:45] exhibits in your blue folder. 3 of those are essentially enlargements are a print outs [21:52] for of Bell, make it a little bit more readable review of the exhibits that were in the [22:00] exhibit packet. You'll note that and on the on the one exhibit we struck out [22:05] language that said that only part. The part of the project site was in a very high fire [22:10] zone. Just want to make that correction for the record that it is the entire site that is [22:15] within that high fire zone. And then in addition, there is an exhibit showing the the [22:24] odd. There were some minor discrepancies between the version that is in your packet [22:27] and what they're currently processing with our fire fire department. So we provided that [22:37] as well. And then also, exhibit showing the the deployment areas and the the ladder [22:45] deployment from the fire trucks. So this concludes staff presentation were here to [22:50] answer questions. Thank you, Ryan. My colleagues have any questions for staff, [22:54] Chris. These are private streets right? There are private streets. Okay? Yes, he [23:01] approaches street. Who's responsible case for the rhino. The tribe, the tribe [23:15] is going to is the tribe, the tribal area where the rocks and all that is, you know, is [23:18] that currently deeded to families are going to be deeded to them. It is going to be [23:24] needed to them. And so will the trial be responsible for? Clean debris trash weeds all [23:32] about who's our world? Well, the ICA homeowners to say so CA should have an easement and [23:34] have to do who's going to be responsible for cleaning that that area. [23:42] So the applicant will need to have some access for 4 to that area for maintenance, including [23:50] for odd. So they know they have to be worked out in the easement [23:53] between Pechanga in the the applicant. So you say the applicant. Does it [24:00] mean the H.O.A. once it's built around that H.O.A. is responsible for maintaining [24:05] that entire area or just certain fuel like so many feet in. [24:12] Just a point of clarification. Did the the project is safe or rental a product? Therefore, [24:20] I'm sure there's going to be a choice if they don't. That probably happened or that [24:22] company management company and they should be the property owner correctly on. But they [24:28] will legally be responsible for maintenance worker at a pay. [24:36] And just to confirm. Part one of the conditions of approval as that. [24:41] The project to install a traffic signal at Normandy in Berea right? Is that correct? [24:47] Yes. Okay. Or they have an option of the roundabout roundabout and me [24:55] if they do the roundabout. There will be no dig at extension of the left turn [25:00] pocket. That's correct me. But the way it is, that's correct. Okay. And is it one [25:03] of those two-lane roundabouts or a single lane roundabout? That's something that's going [25:07] to be decided in final engineering. He's going to be will says [25:14] Signalized and going to be a very bitter option. 10 traffic signals for for that location. [25:19] It doesn't quite have the discussion points later. Thank you, Ryan. That was very [25:28] thorough I just I have a question why are we [25:35] considering the very height and says density instead like medium density? [25:41] part of it was to make it a continuation of the boulders. One project there was serious [25:50] thought about how to better buffer, the boulders to projects how we can do better [25:55] than even boulders. One. So shifting all the density more to the southwest away from [26:01] the residence. But putting the residential buildings that are the same [26:05] height. This is the 2 story along the boundaries. In addition, the the higher [26:12] designation does help to us with reaching our moderate numbers for arena. Moderate [26:19] income numbers. Thank you. And with regard to the access road. [26:27] Because it's in a high severity. Fire zone. [26:35] Another access is required whether or not it's. At a low density medium [26:41] density. Things like that, right? That's so the access of Newport [26:48] Road would be required, whether it's this project or another project on this project site. [26:52] It's really just a necessity of developing this project site. And my question. [27:07] There with me and so with regard to the tribal property that is protected. And that's [27:14] not a part of the 20% open space. Correct? No, that's that's not part of that. [27:18] Collation. I I have some questions also for for staff. So I want to [27:29] start with. With fire. So when I reviewed the agenda report in the agenda packet. [27:37] The materials in the packet indicated that this site was partially yes, please, Madam [27:46] Fire Marshal was partially in a very high fire hazard severity zone and that the rest of it, [27:51] the say the westerly two-thirds ish. Was in a moderate fire hazard [27:58] severity zone. And I don't believe that's correct. And I think we established that that [28:02] was looking at that is state responsibility, area maps, not LRA maps and the LRA maps, the [28:08] local responsibility area. Does indicate that this is in the very high fire hazard [28:13] severity zone in its entirety. Is that correct? Madam Chairman Chair? That's correct. Thank [28:21] you. And so I that they gave me concern because that changes the [28:26] requirements for help projects going to ground. And part of that has to do with [28:33] 0 zone. Landscaping requirements and where you can't have any sort [28:38] of combustible materials in the euro zone. And I didn't know on this handout that there is [28:45] strikeout language. Houston was too correct. Yes. I do know their language but [28:53] rain. Could you go back to those slides? I think it was. Maybe the landscape plan. [29:05] That one that one. So here's my concern. There are different requirements and well, I see [29:12] that this one has been revised. The symbolic G that I see on this exhibit still indicates [29:19] landscape material in the 0 zone with the color green. And so here's my concern. [29:26] I think this is resolve bubble, but my concern is. It's difficult to do that. Right [29:34] now. So I want to put that out there and and ask staff before we [29:43] get into public testimony. How would you propose to resolve those issues? Because [29:49] they directly relate to findings that we have to make. So that's that's my question [29:53] for you is a fair question. Jennifer Marshall, they may want to turn to you at some [30:01] point. It's light. Ask you just a hang on for you in relation to that. Just to clarify where [30:04] she speaks, if I look at this. Like I'm looking at the buildings in the center. [30:10] Here's Kareen. In some sense, it looks like there's a gray area. Is that satisfied the [30:15] zeros on doors? Do they have to get rid of all that green? So I don't. [30:19] We're looking at we're looking screenings of it. So it's hard for me to determine. I I don't [30:27] know. So that's I get. So the question is, does this? I just one of us satisfy the [30:34] 0 Africa just explains. So you do see that Grayson, biology, that it might not be shown in [30:39] the legend here on the other exhibits of the landscape packet. That is indicate that [30:42] that is the 0 to 5 zone. So there is no combustibles allowed in there and it does [30:49] indicate that that will be more gravel czar are clearly not things like that. But non non [30:55] combustibles. So here you see in the image there is about a 5 foot strip everywhere where [31:04] the building touches at the something other than concrete. It's it's that 5 foot gravel [31:08] strip. Okay, that that's helpful to hear. So the only place in the [31:16] hack it were it described because I also saw Barca mulch and other things listed here. [31:21] The only place in the packet where that was describe because like it's hard to read the text [31:28] in the packet. It's actually hard for me to read this text on the sheet like, but I can't. [31:35] This is the only place in the packet that needed this strikeout. And you're certain. [31:44] So we did. Yes. So the note that says that it's only partially within the high fire, [31:47] if that's what you're referring to. Yes, that was only place that that needed that. So then [31:52] I have a I have a follow-up question. You can leave that exhibit up on the screen. [31:59] Sony, thank you, sir. Yes, shorter than men for money that is perfectly fine with me. [32:06] So the exhibit that I'm looking at here is this buffer exhibit A of use. This is in the [32:12] packet. Also, he received the is the storm that is a few modification. [32:17] Yes, so I can I can bring it to you. If you'd like okay, okay. So here's my question. [32:23] Also in the very high fire hazard severity zone. If the 100 foot. But for that is one [32:30] of the zones. Yes. So I see 100 foot buffer, but it does go into an open space area. [32:39] Is some modification to that required threw an AM and m that would show up in the [32:44] alternative. Methods and materials. I think. Is that with that, that's they get that [32:51] acronym or you didn't get their rights and their events. You shows up in the F P p I'm [32:53] sorry for all these acronyms, folks. The fire protection plan, alternative methods and [32:58] materials to satisfy requirements in a fire protection plan. That's what [33:03] I'm asking. So, yes, it is that it could get my articulated [33:07] that correctly, because what I see here doesn't appear to meet that. So there's going to be [33:13] 3 beyond his own 0, 1, 2, 3, And then that would be the 0 to 5, 5, to 30, the 30 to 100 [33:21] right or up into the property line. And so those measures might be up into the property [33:24] line is what you're seeing. The fire protection report will study additional measures to [33:32] those who it was other additional. I wouldn't call it among them because they're [33:36] not doing something that's not prescriptive. But it might be that based on the technology [33:41] from behavior, Fire report, whatever program that they used might indicate that the fire [33:47] links are the flame Heights are. I'll be drastic. But like 12 [33:53] feet in height or something that might say with that. And with the scientific [33:57] knowledge of and amber casting and those type of things in combination might require that [34:08] offense might some type of the block fans to start seeing you all are tempered glass on top [34:12] of the wall so that that report would come out in addition to if it deemed that those [34:18] patterns occurred in that area, that the report did those scientific testing. So that [34:23] might my question, my question to you I do understand that. So yet this evening, I have [34:30] to make finding certain findings related to safety issues. And I don't have that [34:37] data. So how how help me out her? Okay. How do you get me pass that where we don't have [34:43] of spp that's approved so they can submit in the preliminary for protection report, which we [34:47] have reviewed within that preliminary review that we've done so currently [34:52] there's nothing significant. They would change the project in its infrastructure [34:58] and its roadways in the way that they presented in the Fire Protection report and [35:07] approved fire protection report gives them up into a building permit release too. and a [35:14] final. When he pulled a building permit. You still have to come [35:17] compliant with what the code is today. So if the pulled it in 2 years are they pulled it [35:25] in 6 months? It is what today's requirement is, which is all the zones to [35:32] 0, 1, 2, 3 feel modification requirement and all the requirements that are put forth [35:34] in the California will be code and so they would have to come compliant. The should they [35:39] choose to put today. Should they choose it to pull in 2 years? Those requirements [35:46] when change and what we've seen today. Nothing drastic is changing. [35:55] So we're deferring that until building permit issuance, which still leaves me with the [35:58] challenge of how do I make a finding today? So now I'm going to turn back [36:07] over here to staff and our city attorney for some guidance because and I'm I'm still I [36:12] still have some. Level of unease with us. And so I'm hoping you you can walk me [36:20] through this. So I believe one of the condition they're standard [36:24] conditions is to require prior to pulling any building permits to confer with and receive [36:30] approval from the fire marshal. If I'm not mistaken as such at anytime, right, whether it's [36:39] 2 or 10 years from now. I think the language that says the project will be condition to [36:44] meet all political Code Section Santas and ordinances at the federal state and local levels. [36:48] Maybe we can add something that says in particular in regard to, you know, very high fire, [36:56] severity or something like that. That specifically speaks to your concern regarding the [37:01] high fire hazard. The might get just might get me there. Helped get me there. [37:07] I I just. I just want to reiterate that. So I have to make findings and [37:13] I'm not quite there yet. But that may provide an option to be able to do that. For [37:20] example, on the buffer. I'm I'm a little bit on the customers. Even if BP delayed [37:26] and not Don a little earlier, but that may be the city's process. But but whether that's [37:31] through the use of a CMU wall and tempered glass or some combination thereof that serves [37:37] to to mitigate for the lack of a full 100 foot. But for into open space area that might do [37:46] it. So I. Maybe I'll ask you to think about it and we can go through [37:50] the hearing and I I can come back to this. So this is just to me asking questions right [37:56] now. Well, just might I just to answer some of your concerns regarding the conditions or [38:02] whether would meet those conditions are to meet the public health, safety and [38:07] welfare of the community. Several conditions under the office of the Fire marshal [38:11] include 206, very high fire area. This project is now in a very high fire area proposed [38:16] buildings. The shall meet the requirements of construction. Cbc CFC chapter. 49 and to [38:23] comply with title 14 requirements of the Board of Fire Forestry and Fire [38:28] Protection regulations. So again, at the time of building permit, it would have to meet [38:32] all those requirements section excuse me, condition to a 7, 5 protection plan. Fire [38:35] protection plan for this project must be submitted and approved prior to any [38:40] landscaping being approved. Please ensure that all information on the landscape [38:44] plan, some middle matches what is proposed and approved in the spp. I defer to the middle [38:48] for the fire protection plan must be made to them in a few office of the fire marshal [38:51] prior to a building plants, the middle again, notwithstanding the the excuse [39:00] me, the exhibits. Wet weather. It says there is no escaping for 5 fever, 10 [39:07] feet if in 2 years the state says that our local area needs to have 20 feet as you're [39:12] escaping. That's what will be required at the time. The building permit. It's being [39:17] pulled under the fire protection plan and finally condition to 8 feel [39:22] modification. Few modifications and landscaping. Details show it here to the film adaptation [39:27] that excuse me feel modification plan. The first the middle for the fire [39:31] modification plan must be made to the minute the office of the Fire marshal prior to building [39:34] plants. The middle. So each of these conditions remind us that the exhibit may see something [39:42] today which has been updated by staff. And I think your point is very clear. However. [39:50] When a project moves forward for building and landscaping, et cetera, it will have to meet [39:57] the most stringent. Most current requirements under state and local policies and [40:01] laws. And that will include whatever additional standards might be required for purposes [40:05] of health, safety and welfare of the public. Thank you. Thank you. [40:10] Ok, my my other comments, I'm going to. I think on this is we. Because through the rest [40:19] of the meeting, other comments or questions were about traffic. And I don't know where [40:24] that might be the most appropriate for elder, though, or the [40:27] traffic consultant is here. How do you want to handle that? I don't think Trump consultants [40:31] here today. You said they're not. They're not okay. Well, then I guess you get my [40:41] So can can you can you walk me through the the splits, the the percentage [40:51] of of trips and the PM Peak trips that are coming out, the going [40:56] in and out this the call it the secondary access as opposed to the primary access. You want [41:01] Ryan to some exhibits and that's for sure. That's one. Regular stamina. And what I'm [41:12] And with that, an exhibit. Okay. Yeah, I can. I can explain so in going into psycho [41:32] going out of the site during the Am Peak hour and during the am, you have 5% coming out. [41:39] The Brea and heading north. You have 60%. This is at this driveway. 3 location that you [41:50] see on the screen. And then and you see the 3 and a detailed on the top 3rd one [41:59] over so 5% goes up. Brea 60% goes down. Brea. And then if you go to driveway 6, that's [42:07] the new part Road Connection with Project Drive way and going out in the [42:13] Am. You have 35% because it's right in right out going right on Newport Road. And then in [42:21] the PM, the changes slightly. You have 45% off Berea going in. [42:30] And then 55% from Newport, Rhode going into the project that's in the PM. [42:36] So dare I also have the numbers, for example, on to thrive. We? Going into the [42:42] project. For the AM. We have 12 troops and for the PM have to do to be keeps that's going [42:52] inbound. It's bone. We have. 25 Toups and the AM. And to be on the driveway and [42:58] have for the other streets. If you are, you know the numbers too. [43:05] But I do recall reading in the in the agenda packet that in I know that you [43:13] you've already indicated that improvements to the signal that Normandy Embree are required. [43:19] Whether that's actual signal improvements or construction around about I did [43:21] read that. Was it below us? Which I know isn't a sequel issue, but it is a general plan [43:29] issue. Those the mitigation would resolve that. None of the other intersections met [43:37] thresholds for similar type improvements. Is that correct? That's correct. Okay. [43:46] And again, just to the size of tube. In more on that on the traffic seago, you do for [43:52] traffic signals in there. You know, it would cause problem with the flow. [43:55] Grossman, this red light. The car has to stop. And when these 2 roundabouts and the [43:59] floor is just constantly going. Will serve better. The project. Ok? Thank you. [44:08] That's all I have to. You all have any other questions. You do? Yeah, I have couple [44:14] additional questions. So can we pull up that presentation real quick again, that same slide [44:20] you had. Ok? So at number 3 on the east, though, Western. [44:32] The Western exit of the project where Brea comes up and they can turn right into the project [44:36] or someone lives tour of all they can go up. Is there going to be a stop sign or anything [44:42] or is it just a continuous flow? And the people coming out of the project have to [44:46] yield to traffic com Berea. Not for enormity north of that. If you look on this on this [44:56] where the number 3 is the Western exit of the project behind Boulders. One. Where [45:04] it's the. What is that the some the U.S. Western northwestern corner [45:10] of boulders. One where the car is going to be coming out from the project. [45:15] They're obviously they'll stop at the exit there, but is it will bring you have any kind [45:21] of stop sign. 2. Mitigate for the number of cars leaving or is it going to be [45:24] just treated like a driveway? Just a driveway? Okay. You know, if I agree with that, [45:34] but OK, we'll time you can talk about that. Next question is. In this letter that was in our [45:43] packet. There's a couple issues if we could just asked some questions about it. First on [45:48] the very front of the first page, this was this was submitted by Aaron Givens he [45:53] brings up a couple issues. Number one. On the northbound Berea where [46:00] it enters the existing single family residence. Apparently there's a lip of some kind [46:06] that's that's causing problems that should be addressed in the conditions may be a smooth [46:09] transition or something. I don't know. So are you aware of that issue at all? [46:18] We received the letter and that was something that we can discuss the findings near where [46:22] there is something that we can do on our maintenance of the road [46:30] they also said that there's a curb in front of the fire hydrants Umbria that's not [46:34] painted red and locked. You know anything about that? You know what? All the curbs. [46:41] The sweet painted red. But if there's a fire hydrant, there should be a red zone. [46:46] Right? It can be painted red and all of them use. Not only one on this. Beep at ABC had a [46:51] comment. Yes, actually passed by the site prior to coming here and there were trucks [46:58] blocking the fire. Yeah. So basically it's like a horse meat issue of snow and should [47:02] be parked within 15 feet of a fire hydrant. Yes, okay. So pop possibly could be paying [47:06] a red, OK? I just want to ask if you know of these issues that some the next one was. [47:13] And it has to do with they did upgrade the trees on the boundaries here. Like you said [47:15] to the 36 inch and evergreens and things in the letter they talk about there's a landscape [47:23] buffer of 24 trees or deciduous and I don't quite understand in a letter where they're saying [47:27] those are. Do you have the letter in front of you? It says didn't say exactly [47:35] where but it, but I'm assuming it's up against the the along the [47:38] flood control Channel Channel. Yeah. Okay. So I believe there is multiple [47:44] rows of trees that will Rosa to. So are they all just sit I'm sorry. I don't know off the [47:53] top of my head. with that they all are okay. Last question is on Newport Road where we turn [48:04] into the new the new having ear and Ingress to the project. Are they going to be installing [48:14] a a new deceleration lane? And is that going to cut into the park property that which [48:19] which I'm fine with it just cups in a little bit. I mean, where's that? New deceleration [48:21] lane. Deceleration in going to come from. They're going to dedicate that [48:25] period. So this will become a decidir nation. They need there and that's gonna help you with [48:31] the involved and also slow down the traffic death coming into report. So it's going to have [48:39] its own 10 foot or what is it? What is a deceleration is a foot 10 foot. What is the with [48:45] the one of those? I think it's about the town besides that. That is also the the bike lane. [48:49] That's also continues all the way across. And there. So it's going to be. [48:54] Regular lanes lane bike lane. And then deceleration lane. Offer Chair Commissioner Thomas [49:01] Nick Filler Public Works director. The project will construct a new right turned to [49:05] celebration lane for westbound Newport as a into the entry. The entry will be right in [49:11] right out the right turn. Deceleration lane will help the cars slow down as they're [49:16] entering into the driveway. It will be about a 10 foot wide. That's typical for right [49:21] turn. And so so rushed to get that you're going to cut into the [49:26] move to curb and into the park to get that right. Correct. Okay. We might have a little [49:32] bit of that might not be it for quite a full 10 feet. We'll get through that and [49:36] final injury. When we look at there's currently a bike lane in by about for lane. So we [49:41] might be able to absorb some of that debt out of the bike lane. But for lane through [49:46] there. But that will be something we determine final engineering. So just from me. [49:51] I know engineering is determined based on numbers. But if there is a choice, I'm [49:56] okay was eating up some of the part. I'd rather have a safe Even if we have some of that [50:00] there. But will there be an acceleration lane? But on the right out from there, no, there [50:06] won't be there and just be the right turn. Deceleration land. So it the right turn. [50:10] Deceleration lane allows for the people that are exiting to see that if the car is [50:16] actually entering into the driveway or if there's an open spot in the number 3 lane for [50:22] the westbound traffic check on traffic. So that will help provide that distinction [50:25] between the people that are turning right. And the people are going through so that they [50:30] can find that gap in traffic. And is there any line of sight issues if you are to be pulling [50:37] out you on the year in the project, your point you're going to turn right on Newport. [50:39] You're going to look a laugh to see. You know, the 50 mile an hour, 89 or car coming at [50:47] you. Is there is there a line of sight study at that point? They do it by pulling that [50:54] right. Turn lane back obviously helps the line of sight unless of a larger vehicles coming [51:00] into that right turn lane, then they can determine whether or not they have a clear [51:06] visibility. Okay. One of the issues we might want to bring up is whatever we. [51:10] Change that little cut out. That's going to be there because we're going to top it [51:14] off in the park. Is the the corner there? Retains line of sight. So it's [51:20] definitely yes, we will definitely do that. Ok? Thank Okay. And just a couple more [51:33] questions. Regarding. Cash for got. Here we go. [51:43] I list right here and I just wanted to clarify the eyes and and the [51:49] for boaters to states that Roland is the school districts. And can we clarify that and [51:56] make? Yeah. So it is. So does the parish Union High School District and the minute the [51:58] Union School district. So we can make that strikeout in the [52:04] final version of the I-70 that gets finalized. Okay. Great. Now as I was looking at the [52:11] maps. And ice in Boulder's one folders one rich, more [52:17] elementary school is the home school. And then we have West. We have the other projects over [52:26] there. But the duplexes and then we have the KB Homes. And I'm thinking to myself, [52:35] all those. All those projects are are the homeschool for rich. More. Have we talked to [52:42] the District 10 communicated with them in terms of the impact to that particular [52:47] school. Is so a couple things on that one is that we always transmits [52:53] to the school district's when we have a new project so that there aware early on they could [52:58] begin the planning process early on. We also coordinate with them on a yearly basis [53:04] explaining what projects are in process where they are in the process. They're also part of [53:11] the sequel review. So they were notified and sent the I S M and T to to comment on. If they [53:18] if they felt. In addition to that, we also staff's perspective, we have quarterly [53:23] meetings. We there, director of facilities where we have to do in all of the projects and let [53:27] him know what's on the pipeline for them to prepare for the additional units. [53:33] Great because I think the principal would be very happy. I'm pleased to. Receiving [53:40] enrollment but also to prep para for the additional traffic and have that. Lead time for [53:48] prep. I know this isn't far into the future, but they need that [53:54] prep time. And and then with regard to the heart. Weird. Cutting out 4,356 feet of the [54:04] park. And I watched the parks and rec meeting and there's that [54:10] they stated that they were. Behind in their part, cool. So. [54:18] How is this moving forward? The cull or what is the plan to move forward to going to [54:23] achieve? The 5 acres per resident. Well, I was the that's a very [54:34] loaded question, right? The the general plan does have a significant or a specific [54:41] requirements as far as what the goal is for us to provide high open space in park for the [54:49] CD, right? Every party that comes scene. We we see the opportunity to require or ask [54:56] the to provide some park space over open space, too. Isis doesn't with meeting that goal [55:03] right? The end of the day they have to go through a process aimed through the calculation [55:10] of the creamy agreement, impact fees and those impact fees says the CDC in acquiring property [55:17] in and building new parks as well. So in regards to this specific project [55:26] this is unique because it's probably one of the few projects that actually has and [55:33] the impact on existing park or it actually taken away open space. [55:40] So the app pic and we've had discussions with you have to kind of sets you see on the [55:46] proposal they try to upgrade the existing parking, create more amenities. They are [55:52] willing to continue to have conversations but staff with community service [55:59] as well and eventually meet Parks Commission as well and make sure [56:05] that to the not only comply with the Queen Bee requirement, but also I either upgrade or or [56:13] or provide some type of public benefit, but it's going to ups of set [56:20] square footage as a result of the driveway. Thank you. Okay. I don't have anything [56:30] else for staff at this point in time. So I'm going to open the public hearing at 6. 55. [56:39] Madam Clerk, can you confirm that this item was legally noticed and if any [56:44] correspondence has been received, it was in any correspondence is and you put [56:49] fielders. Thank you. Now I'd like to invite the applicants to the podium to [56:56] speak. And as you're coming forward, if you please introduce [57:01] yourself when you're at the podium. But as you're coming forward, if I also asked, do [57:06] you agree with the conditions of approval as they currently exist? My name is Rich Wilson, [57:14] myself and John Cho are partners in this fifty-fifty and I the managing partner. [57:18] And yes, we do agree to conditions of approval. Thank you. [57:26] I want to thank all the commissioners and the staff. I think that their power point [57:29] presentation was extremely strong. And so I'm gonna if you could pull a page [57:33] 4. It in our package, if you could, it could bring up the [57:39] applicants are point. You go to Page 4. I'm going to give a little [57:49] history of the First entertained to the bowlers. We call the bull is one, which [57:53] is a 10 acre parcel of the bowlers to which is to 5 acre parcels. And we look to [57:59] purchase the 20 acres the first thing was access. And if you can see the [58:04] green lines up there, the to act, this is where offer Berea. But we are asked and it's tough [58:09] to see. Can you magnify those at all? Even more if you can't just [58:19] keep going? All right. Let's look at Normandy and those are the Purple Line's. So you see a [58:23] street come enough nor money going to. Into boulders one and then you [58:31] see another street that was supposed to go to the bowlers, too. And we were told that both [58:36] of those who were not could not be achieved because of of tribal. [58:47] Features in the area. When we first looked at the project, we wanted to bring for those 2 [58:51] roads going bring. It will call to be in the. South Road would come all the [58:58] way through. Go through Braille, boulders, one in debris bullish too. And then it [59:03] would actually attached to harbor. And that's what we thought we were going to [59:08] originally do. And then the most, the Street, which is parallel a canal, would come [59:13] down through. Bull is one boulders to and then turn and connect to would have a loop. [59:16] That's what we thought we were going to have. We purchase boulders, one at [59:23] that time. Bull is one in boulders to which the brine. Clearly he thought it was part [59:31] of the EDC Newport Road and then we had to have a was to add 24 units per acre. We have [59:38] had had to have a commercial and a business, a portion of the project. So that's why we [59:45] put the medical center building in there, which is a three-story medical center. [59:50] And we also build a daycare center, which is the 9,000 Square foot, [59:56] a day care to enhance the project. We felt both the medical center and the daycare [59:59] but help enhance the community. During that construction phase of boulders. [1:00:09] The boulders to the developer told us that there was going to he was working with the city to [1:00:12] turn. It turned into single family housing had a density of the 8, which with ADA, he could [1:00:23] make it 160 units. And then he talked to us until said he could not make a pencil and [1:00:26] that was going to go to the market again at that time we met with the city and we asked [1:00:32] if we if we could go back to do 24 and that was the verb each at the time was that with [1:00:38] Reena, which is the new State procedure to increase residency units in a city that they felt [1:00:46] that was possible. And we want to head and purchased. The goal is to think, you know, we're [1:00:53] going to put 240 units just like we did in Boulder's one because of pencils for us. [1:01:02] And then in 2025, we were told by the city that he harbored a entry into the project would [1:01:09] not be allowed for 2 reasons. One day received complaints from the neighbors, concerns [1:01:17] from the neighbors of higher traffic. But the real reason are a strong reason was the [1:01:23] fire marshal did not want to have access with fire equipment coming down through a [1:01:27] residential neighborhood and what you have to meander through to get to the project. [1:01:32] And at that time they told us we would not be able to use harder to be closed off. [1:01:37] And you can see there's a white line through there. And then that time they also suggested [1:01:44] that they felt that we be allowed to go through Spirit Park and what they call the [1:01:49] new Port Road cut through. So we thought that was the pretty logical idea. And that [1:01:56] allowed the staff to access is one access from Berea Road North and the other coming [1:02:04] in from new port. So that meant that we we felt we had a green light to continue to develop [1:02:08] the property and that approximately a month ago, we were told that on Spirit Park [1:02:14] in lieu of having to cut through that. If we would put a dog to [1:02:19] dog parks, a large dog park and a small dog park and some improvements to the year. [1:02:24] And we agreed to that. And that has been finalized. But you can see the yellow. There's 2 [1:02:29] circles there and that yellow areas of the dog parks, a small dog park and then a large dog [1:02:36] park for the size. The dogs also canopies there for shade. Seeding tricking found trick in [1:02:41] town for the dogs and also for for the folks. If you look, we also a one-time [1:02:47] one of the dog parks was going to be on the. West side of the cut through. But the thing they [1:02:56] want the project to be in the most passive areas, which we put them both on the on the [1:03:02] east side. If you can see the Spirit Park, which is phenomenal park. But just to [1:03:07] the basketball courts, tennis courts, the play areas, the rec area, the shaded area, the [1:03:13] barbecue areas and the parking lot. The mayor is all to the to the West and that the past most [1:03:18] passive area is where the cut through is. And that's what we have today. [1:03:27] I don't think it would behoove us to go through the our Power Point [1:03:31] presentation because it was so well covered by by staff. I just want to give a little [1:03:39] history of the access because the access was Spence been a challenge and we've we've we [1:03:44] think we've worked through it. Do I do? I entertain questions to do is sit down. Let me [1:03:51] check. Okay. My colleagues have any have any questions. Yeah, I'm just interested. Is the [1:03:59] medical center, the stout and the apartments leased out. What's the the medical center? [1:04:02] The 3rd floor? The first of all. We have a dermatology in the [1:04:08] first floor that's been there for about 3 months out. Maybe 4, the 3rd floor is a sign [1:04:14] contracts were in construction. We have a building permit. And that is going to a company [1:04:20] called respite, which does health care. Its kind in county by county [1:04:27] state agency and then on the first floor, we have the Golden Gate Golden Gate to [1:04:39] medical, which is a pediatric doctors. And you regulars, doctors and they and their [1:04:44] project. We're in permitting with that. We have a contract over permitting that. [1:04:49] So basically the 3rd floor in the first floor full and the second floor. We have been 23, [1:04:56] people that are entertaining it and we have not signed contracts that any of those 3 [1:05:01] want to miss the dentist want. And then the other one is AM. Rehabilitation center. [1:05:10] Okay. And they do that. By the way, then you react to the population. The day care of [1:05:16] that will hold 120 right has a 80 80 plus students. So they're profitable now and they're [1:05:20] running. I think it's a very high caliber daycare. I'm very, very happy. But the folks that [1:05:25] have that and then we're right now at 199 occupants in the 234. So we're about 80 89 just [1:05:36] about not quite 90%. We get between for 5 to 6 people week that move in. So we're [1:05:42] expecting some time late this year that before it fully occupied and are you [1:05:47] obviously is can the city will make the final decision? But are you leaning towards a [1:05:52] traffic signal or a roundabout way around about would keep better flow. We've talked to. [1:05:58] Would you like are engineered to speak on that? I just wonder which way you're leaning, but [1:06:03] we're going to go whatever the site. But we think that the roundabout has better [1:06:07] circulation. Thank you for that. Good questions. [1:06:14] Thank you for being here tonight. The pathways or maybe this [1:06:22] point I'm not. I'll ask the question. You let me know the pathways that go through. [1:06:31] That connects the 2 dog parks. I see too. Pathway to rip what routes [1:06:39] ripped prop that rip rap. That's there. Now it's a drainage facility. We're asked [1:06:43] to put one on one side and another one on the other. But those are not by staff. [1:06:48] Are they connecting pathways? So there is a path that goes East West on the North side and [1:06:53] then the Ripper app that you see splits the 2. But the pathway will continue through [1:07:01] the road through the road and there will be the markers there and lights when you push him. [1:07:07] But last year's come up and then cars will stopping you walk walk through. That was my [1:07:11] closest walk area. Also in that area, we're going to enhance it. And, you know, we're going [1:07:16] to put a drinking fountain and there will be a little too. You get is evil type, said the [1:07:26] passive area. Yes, thank you for clarifying that because the times that I've been at [1:07:32] Spirit Park people use those pathways was walking path. Yes, I want to make sure that [1:07:37] it's well lit. And when cars are turning and coming out, they have clear visibility of [1:07:46] the pedestrians and and we live in the life. We live currently with the e-bikes. [1:07:50] So all the papers that go through that area as well. Thank you. And I may have a [1:08:01] question for you later, but we can ask you to return to the point that they do need to [1:08:04] speak to any of our consultants at this time. I don't think so. Ok? Well, thank you. Thank you. [1:08:08] Thank you. Thank you. Thank you. Okay. Madam Clerk. Are there any requests to speak [1:08:16] on this item? Yes, there are. Tom Bureau 5 followed by Carla I've been in residence in 1992. [1:08:35] I mean, if it was just a little hole in the ground that can I ask you to introduce you saw [1:08:40] Tom Burroughs. Thank you. This gentleman talks so far that's been a lot of places of [1:08:46] deserted and department. I just talked to a neighbor leadoff or 2 months free rent, [1:08:49] if you would read up a spot this month. So the key faithful, I'm confused about [1:08:55] new part because if you seen it goes up when they make Newport, they raised it up. Behind the [1:09:03] houses. So you have to go just courtesy. If you go up, I don't know how you gonna handle that [1:09:10] and you just turn right on Newport because you've seen Oprah Dimon says 92 Newport's [1:09:16] probably got 10,000 work hard to Newport. Now that had to new tunnel. [1:09:21] And my question is area is very congested. How's that going to affect traffic? [1:09:25] When the come true, like you said to go 60, 70 miles an hour. I live on DORVAL court [1:09:31] the ago down from my street about 45 50 miles an hour. And because he used to be a [1:09:37] residential street is now a commercial street because of all the apartment complex [1:09:41] coming down our street. So I was done runs on time, clarified the new Porter so [1:09:49] you can turn left on new party to the complex that with what the plant that that's what they [1:09:52] want to do. Is that correct? That's well, I'm not sure understand your question, but [1:10:00] it's certainly going to see on going west on Newport. And sergeant. We generally [1:10:05] don't take questions from from the public. But if you if you just ask your question, one of [1:10:11] us may in turn, you want to ask staff for their village of used to because it's a nice [1:10:18] climb. If you build more, they're talking about putting the road. It's a nice little [1:10:22] climb up to Newport. here's another concerned that one of the gentleman who has [1:10:27] behind a brick wall where they're going to put the duplexes. He's he's lost. [1:10:33] The case does speak to skews me to seek lining. It's to Kane and you just wonder gifts [1:10:38] they're going to worry about the wall when they start digging the trenches and all [1:10:42] that stuff for the pipes. And another one of which is crazy. It's not a question is [1:10:47] the police report? Ever since they put this apartment in when neighbors had tied with 6 [1:10:51] police officers at his house. And he's complained about the noise and disturbance. He even [1:10:57] had a neighbor come by the other day and asked for water because the kid got pepper [1:10:59] sprayed and the apartments. So it's the concern about to put in the public will fare. [1:11:10] Because and fun. 25 26 is a been a lot of police reports go into those apartments. [1:11:15] And the question is why do they want to put 4 stories? It's going to ruin our view and [1:11:21] a lot of people are concerned that our property value to done on the homes because they are [1:11:27] view of the mountains and vegetation and Mother Nature is going to be gone. To compensate [1:11:32] for that. And that's just about it. I think I'm just kind of [1:11:40] disappointed. And I would like to think that Menifee in the city council there was a time [1:11:43] is up so thank you. Thank you. Carla followed by Irene. I'm so sorry. I cannot [1:11:55] pronounce less safe. Good evening. Thank you for giving us teppert anything due [1:12:00] to tap. My name is got a lot more to get in my house. It's yes. And how was wrote [1:12:06] and actually, as I'm looking at the map, the Nets mention my will. My backyard would have to [1:12:14] pull that. Get to see. It's going to go out on Thursday. Parks for the docks. I don't [1:12:20] have any good Ine. That's Dan, OK, this project send a prop plane. We not offend beautiful [1:12:27] beach are in power point, but I-70 it evening there for the pass 10 years. The beginning of [1:12:35] this contruction. What horrible leaving to 365 days. 24 hours is there. That construction [1:12:44] was horrible and a lot. Then the high was Roe was not approve to be enter because [1:12:52] the first week of that building, what the fire next to the will of my house. [1:12:56] And who are able to put the fire Tao. My adult kits. Thank God that I have that [1:13:04] because of the fire department was unable to make him quick bit. So I'm glad that is not [1:13:12] that now the nightmare as of right now with this first Eunice of the traffic as a [1:13:18] brand right now. I don't understand why that then Inc the park in the streets. [1:13:25] We're not able to look of vehicles when we want to turn we're at and going to meal [1:13:31] pork. We are not able to see it if Bishop in the weekends and it's a rainy she'd a single [1:13:38] it is horrible. Another thing is. Building that way. Then the [1:13:48] project star, we have to get it new, a C because of the aisle that all that the fumes [1:13:55] and everything was in the humble properly. We have too many times to complain and ask [1:14:00] more water after the dirt. We are not against that buildings but more water [1:14:05] because all of this vast come into our home. Our pool got dominant. My AC got that. [1:14:11] Who's going to pay us back? And I have to prove all of that. And guests eat this [1:14:18] protest coming. I hope then this is not a proof or fife. I move from your CD with my [1:14:26] House west with one building that then Florida in another building. And I moved here at [1:14:31] them in a few area. When I thought I'm going to happen, a beautiful area. But now that [1:14:38] I see. It's up to the street again. And that's a senior and a tire. The county employee. [1:14:44] And it could mean the Senate. That's not going to happen. So I hope did. It is not. [1:14:54] I mean, it get more to fight this and the way that doesn't affect asked that [1:15:00] residents that that previous resident has misrepresented that where the time is up. [1:15:04] Thank you very much. Thank you. Irene followed by Patrick Murphy. [1:15:13] Good evening, everyone. Thank you for your time. My name is Irene. Younger Vick. I also [1:15:17] I'm a resident on Hearts Brook Road. I echo the sentiments of [1:15:23] previous resident currently We do live in the same household. So wouldn't have 3 minutes is [1:15:27] not long enough. So that's why I'm here too. We've had lots of issues. It's been nothing [1:15:32] short of a nightmare since Boulder Boulders, one has started and unfortunately, we [1:15:37] weren't able to provide comments at that time. We were in communications with the [1:15:43] project, you know, PR person went up to the site phone number work constantly [1:15:49] in communication because of the dust. And unfortunately, since the boulders, one project [1:15:57] has started, our backyard area has not been habitable. In addition to having replaced [1:16:04] having to replace our AC unit, we our pool. Unfortunately, I know first what problem but has [1:16:11] been on some level. in addition to that project and just all of the movement around [1:16:16] there has been even though we were sure there are water tankers there that are just [1:16:21] making sure that the ground continues to stay wet. That did not happen. There's not a day [1:16:29] that goes by that the dust is accumulating outside in our backyard and within our home. [1:16:33] So that's an issue. Second, another issue is the parking on the and exiting door [1:16:41] about court making a left onto Berea. There's so many parked cars there is. It's completely [1:16:50] packed and there's and I'm not sure what what you have, what the if there has to be a [1:16:57] sidewalk painted red. But unfortunately, everybody is packed right there and it's [1:17:00] hard to see. And especially during the boulders, one construction, a lot of the [1:17:04] construction workers did not really care for the traffic signs for the traffic for the [1:17:11] stop signs. And I almost I had 3 near misses because we have construction workers that [1:17:19] we're just running the a C stop signs because it was at like 6, 6.30, the morning. I live in [1:17:23] Riverside. So thankfully she's my work in Riverside. So thankfully a lot of the traffic [1:17:27] I miss. But at the Times that I do have to leave a little bit later, the traffic to go right [1:17:33] on to pour out of Normandy is pretty heavy. So I'm glad that those are going to be [1:17:39] mitigated. But then on and also the driveway on Hershberger Road. But then going into [1:17:44] boulders to I don't know where these residents are currently parking or where they're going [1:17:47] to park because it's going to get worse. And it's probably going to continue on to do [1:17:50] about quarter and affect all of those residents. Residents there and I have to drive on to [1:17:57] talk about court entre to exit onto Newport Road. So the traffic is just going crease. [1:18:02] I hope that the communication between the developer and the residents continues to it [1:18:10] continues to improve because there was a big lack of communication. And there was a [1:18:14] lot of arguing back and forth to try and get the issues paid for. That we had gone through [1:18:20] savings. Time is up. Thank you. Thank you. Mayor Fee followed by Holly brokenness. [1:18:30] Good evening. I'm Patrick Murphy. High been a resident Amanda Feet since 2018. [1:18:37] My wife and I and our 2 dogs frequently use Spirit Park. I'm opposed to this project. [1:18:44] For 2 reasons. First of all. If you go West Harbor area on Normandy. [1:18:55] That goes to an area with hundreds of Audi Murphy homes. The only other street that [1:19:01] those people can get out to Newport on. Is gets road. That's the only 2 ways those [1:19:10] hundreds of homes can get to Newport. The traffic coming down or [1:19:16] Monday at rush hour. And then the evening. Backs up almost to Salt Creek. [1:19:27] That rat scares me. The traffic on Newport wanting to turn right on to Berea. [1:19:35] Backs up on the new port at times for that intersection of Berea and Norman Tree. [1:19:40] The impact of that intersection. Literally with this project [1:19:46] be doubled. The density is too high. I don't know anywhere else in [1:19:53] Menefee where they have such a density of of of homes and cars. The 2 ladies before May's [1:20:00] spoke about the parking on Berea that narrows bread down very significantly because the [1:20:05] cars are thick on both sides. The second reason I'm opposed to this project. [1:20:13] Is that access across the park. They talked limiting of the park area. The number they gave [1:20:25] didn't include that. The celebration lane that came up with your questions. That's [1:20:30] going to cut into the park even more. The 2 dog parks. They're going [1:20:37] to be too small to be useful. There's a nice dog park over on Marietta. [1:20:46] If the city wants to do another dog park. The park over on Bradley. [1:20:54] It's got a lot of area that can be used because it's inundated with gopher holes. [1:21:00] Thank you for your time. Thank you. Hawley Rocha's followed by [1:21:08] David Faust. I am wholly. So the reason you're hearing from so many [1:21:14] residents is because we don't have an H.O.A. we love not having an H.O.A., but also it [1:21:21] means that we don't have a specific spokesperson. I've been a resident there [1:21:29] since 2013. We're the people who pay taxes and we're now we're seeing a bunch of renters [1:21:36] can in and destroy our roads. Take over all these parking spots. I don't feel safe [1:21:38] walking at night anymore because of all the police activity. I take my dog for [1:21:44] a walk. She has to be walked. She is high energy dog and I can't do it anymore. So my [1:21:51] husband has to do it because she needs to go to 3 to 4 miles every night. And I want to be [1:21:56] more. It's too hot to do it during the day. It's small kids. And I won't let them ride [1:22:03] their bikes around the block anymore because the traffic now is too high and Orville. [1:22:08] So if we add more cars because we're adding more residents and it's only going to get [1:22:13] worse because they do cut through from Marietta to go through Doraville. I'm a [1:22:21] resident on gifts for and so I'm street removed. But I still I can't let them go [1:22:26] up any further because there's a car. Every time. So I took notes for the dog park as well. [1:22:36] The place where you put it, there's no parking for that. So you'd have to go. Crossover [1:22:43] somewhere. So that doesn't make sense. Also have the infrastructure that you guys [1:22:47] are proposing. I mean, the grocery store is. Crazy. Can't go past 4 o'clock [1:22:52] because now you have there's a dunce from the new construction. You're speaking [1:23:00] about. You have the construction that's going on everywhere. And then you now [1:23:02] have these residents and now you want to add 300 more residents because you have to [1:23:08] think it's not just the departments that one person per apartment. It's going to [1:23:13] be couples. It's going to be roommate. It's going to be, however, many other people. [1:23:19] So it's not one person you're adding. It's not a single unit that you're adding. You're [1:23:25] adding. 600 more people. Because whos just to people sometimes stop. Not the way [1:23:31] the prices are the states like, let's be honest about how people can afford. Thanks so. [1:23:37] Those are the things that I think about when I'm looking at it and I'm thinking about my [1:23:43] kids and raising my kids in this area. I'm looking at the school districts. I'm looking [1:23:47] at, OK, great. The school's know what's happening. But our is 3 years going to be [1:23:53] enough to provide infrastructure. Kids are already at 32 to 36 [1:23:59] kids, a class. So re really going to add more to that. So those are the things that I [1:24:05] concerned about. So please don't add more to it. And also spirit Parks best. So why are [1:24:09] we taking more away from it? Thank you. David 1000 followed by. She can [1:24:20] us are. Good evening. Commissioners David Faust, chair of them in a [1:24:31] few parks, Recreation Trails Commission. As you know, that your [1:24:38] commission deferred this project to hear from the Parks Commission first, which we met [1:24:44] this last Thursday. Last week. really shocked at [1:24:54] the proposal, not not so much the apartment complex because I think the the city needs more [1:24:59] affordable housing for a lot. A lot of young families. Singles and couples. But the [1:25:04] fact that the proposal to take the park take and put a road through Spirit Park is [1:25:10] unprecedented. Her in the city that section of of Spare Park is a passive park. It's it's a [1:25:19] very popular place to to walk. There's a beautiful walking path through there on the [1:25:24] boulders and the the pine trees. I was just there on Monday with my grandson. [1:25:32] And I just we we were unanimous in our in our decision first not to to prove a quid. The [1:25:36] assessment for the project at this time because what? And so we kind of hit the ball back to [1:25:43] the planning Commission on this project. And as well as we wanted to hear more from the [1:25:50] public and and even suggested to some type of public public hearing [1:26:00] specifically regarding the the the effect it'll have on on on Spirit part, putting a road [1:26:04] through Spirit Park by setting that one acre section of the park concerned for the safety [1:26:10] of our residents on the bike trails on The Walking path up on the sidewalk. With that [1:26:19] right turn in for from westbound. Only right. Turn out to going westbound. [1:26:23] I'm thankful that there was no signal propose there, but to it's just not. [1:26:32] It's not a great plan. I'm not opposed to the project itself, but the access to this project [1:26:36] has severe restrictions. I know the neighbors don't want to access to harsh. Harsh Berg. [1:26:44] Is it to the streets and there's a limited access to the on the connector to [1:26:49] the existing, even with the contractor proposing to give us the dog parks, which frankly [1:26:57] are undersized for the for the both small and large stocks and that that's one acre [1:27:06] sections already by second through the director of the storm drain. And there's a [1:27:08] little bridge on the Walking path. It sets at lower grade level. [1:27:12] The Newport. I just think that this proposal to put up a 2 by SEC, the park and put a road [1:27:19] through the park is is is conceived and that is that's just what I wanted to share [1:27:23] with you today. Thank you. Thank you. She can us are. [1:27:43] Hello. I'm in a chic and thus are I am a former employee of the month. The school district. [1:27:49] I now work for the state of California and I work from home. So I live on the record [1:27:55] in the apartments directly affect me as far as working from home, I hear constant [1:28:01] screaming domestic violence issues and that in turn affects my mental health as well as my [1:28:09] and within our property. And we've had occupants come to our door to ask for [1:28:15] surveillance. Do the fight in front of our property because birria is already filled. [1:28:20] They park on our street corridor full court. So people have parked their they left [1:28:25] chest bear. There's increased drug use which is not proper for kids because there's a day [1:28:35] care for one. There's a park. There's 2 we would eventually that's less than a mile and [1:28:39] half away. So it's like not beneficial. They have also reached out to [1:28:47] our other neighbors in regards to camera footage and we should not be going to be put in the [1:28:49] position of becoming the security system for new development. [1:28:55] If this does get approved, I have also requesting from the city of residential parking [1:28:59] permit parking permit program for surrounding homeowners. The additional residents of [1:29:06] vehicles from this development recreate will create additional demand for street parking and [1:29:09] existing homeowners should not lose access to the parking that we rely on. [1:29:16] Another major concern is privacy. We were promised privacy. But in as you [1:29:20] mentioned before, they did not. Provide any privacy at all. Therein properly spaced. [1:29:29] So. They don't. I don't. They providing coverage to it from the [1:29:34] balconies to into our backyards. The leaves dewfall year-round. So. [1:29:41] Again, do not provide part privacy. As far as the part. I do feel [1:29:48] like that's essential to our children here in Menifee because [1:29:54] there is not much for the children who are already complaining about the e-bikes [1:29:56] are complaining planning about this. Every time I go by that park, the park is full. It's [1:30:02] very essential. Says committee. As far as summer parks and Recs. They're always there and [1:30:07] that pours into the chilling. It's not much to do. We don't have will be the 8 ERs. We [1:30:11] don't have things for them to do. We do have a law so I think that's the last thing actually [1:30:18] done. Thank you. There are no more public comments. [1:30:26] Okay. Is there anyone else any? And it's that would like to speak on this item. Because I'm [1:30:29] going to close the public public hearing here in a second. [1:30:34] Please come up and then afterwards, would you fill out a speaker slip in the back [1:30:39] after to and just state your nephew? I'm Corey Rochus. I live on get 4 in court as [1:30:45] well and just wanted to state that the sediment that everyone spoke about today [1:30:52] is truthful. There's constant crime going on in the apartment complexes that didn't exist. [1:30:56] I've part of Menifee since 2013 as well and moved here from [1:31:03] Riverside County. And the crime is has gone up since those departments have [1:31:09] gone. And I take my dog for walks consistently down dorval court cars are flying down that [1:31:15] street. I know. See squad cars flying down the street to go to the apartment complexes [1:31:19] consistently the parking situation is atrocious. It's starting to overflow onto [1:31:26] Dorval it's not safe for any kids riding bikes up and down the [1:31:30] street anymore like it used to be. Where is just regular residential? Very low volume of [1:31:36] traffic. Now it's high volume of traffic with everyone coming through and it's only going to [1:31:39] get worse with approval of this. This complex. I would propose that you build [1:31:48] on spirit part, give more land to the kids, give more land too. The residents give more [1:31:54] land to beautiful landscapes instead of just high-rise buildings. That's what I would [1:31:58] love to see for my community. If you go over to the sports park, I was at the sports Park [1:32:03] Lake Elsinore Sports Park last night. It was completely packed full of kids packed proxies [1:32:09] like football practicing soccer. We literally had to park on the street because [1:32:12] there's no more parking field in the park like we need more parks and to take away parks [1:32:17] and a takeaway, recreational activities for high rises that. Just are going to impact the [1:32:23] traffic in our community impact the crime statistics in our community [1:32:29] and just take away from what our community needs and take away from Parks and rec. [1:32:33] I don't think is there a correct answer here? I would like to see a more [1:32:40] space for for a communal. You sound like to see more space for children. I would [1:32:44] like to see more space for schools like to see more space for. [1:32:49] Just having open space in looking at the beauty of nature and enjoying time outdoors. [1:32:54] By adding high rises. It takes that away from us. It just over populates our small community [1:33:00] that we have off adorable. And I forgive floored. it's just really crowding us. [1:33:06] And it's taking away from our property values. And its all of us here are living in that same [1:33:11] complex where just under duress of the whole time with all this new construction going on. [1:33:17] And it's it's not fun. So seeing no one else. I'm going to close the did you want to [1:33:27] say something, sir? Okay. I'll ask you to do the same thing after year. [1:33:31] Complete speaking at the podium. And sir, could you remember to fill out a speaker [1:33:35] slip? I'm doing my name is Brandon. I feel that these should not [1:33:44] be built a few like voting once in the urban do his will because [1:33:50] as homeowners, we pay a lot of money and I feel like we're living in a fishbowl. [1:33:56] Those 3 story buildings, people are on the top that this is looking down on us like this. [1:34:01] Mike. The football game or sent The guy that came to our house quit asking for the videos. [1:34:10] He saying that he got in a fight with his daddy Jessa for video from our cameras that we [1:34:15] see anything. He told me that he's speaking to our dogs every morning. He's on the 3rd floor [1:34:19] like. We hope you have a whole new you want privacy. That's the [1:34:26] reason you move into. We don't have that. We're finding drugs industry just the other day. [1:34:34] A car parked in front of our House dumped popcorn right there from their house. Did [1:34:38] not clean it. And that's not the first time that happened. I walk around the neighborhood [1:34:44] every day. I'm seeing Louis bike gangs building up in the apartment. There's no security [1:34:49] in there and that this happened. I'm starting to see tagging on walks. So this extra [1:34:58] doing is going to bring games to these community. I come from LA. I've seen [1:35:04] kids mountain about the park's doing things. They're not supposed to do [1:35:08] there's no police action over there. Nobody's patrolling the streets for parking people, [1:35:13] parking on the corner. Just today we were walking and the there's a group of kids in the [1:35:22] car smoking marijuana sitting around the corner, looking like they're up [1:35:24] to no good. That's not the first time I seen that now. Music. [1:35:32] Fights waking up to hearing to beware the Q you 06:07AM, in the morning. And the weekends [1:35:44] or atrocious, like everybody There's nowhere to park people are arguing with homeowners. [1:35:52] You know, you're parking in front of their house being disrespectful to music. The [1:35:58] alcohol, your drugs. And, you know, it's just a constant battle and I feel like [1:36:04] I'm this project should not go through and for the safety of the kids for the safety of [1:36:11] homeowners, for this community. If you want to keep it how it is tell you that this does not [1:36:17] need that because this is going to bring the negativity and more problems. So thank you. [1:36:24] Thank you. I don't think there's anyone else. going to close the public [1:36:32] hearing, it's 7.34 Does my colleagues have any further discussions? Questions, [1:36:41] comments? I know. I do assume you will do that 15. I'm going to defer to Tammy first and [1:36:47] then I'll come back to you, OK? And with regard to heard kid the city or the applicant [1:36:58] address. How? And they planned to in a guy us. And prevent damage to [1:37:05] surrounding neighborhood and surrounding homes. To me, can you be a little bit [1:37:16] more specific use of? Which which concern us seeing safety? It would be about [1:37:23] mitigation of us. Destin damage to Okay. Now I know why the kind of person. He was handing [1:37:30] the speaker, Kurt he was stunned. Who in staff's can answer them. It all There are [1:37:42] specific conditions of approval that requires the applicant to comply with the no 8 Q and [1:37:47] the requirements and Dustin during construction hours of operation [1:37:51] hours of construction as well. So there are very specific requirements. [1:37:58] Obviously, you know, the applicant here, obviously and maybe they can elaborate in [1:38:03] terms of what measures into Quinn boulders. One was constructed in and, you know, [1:38:08] there's any room for improvements in terms of making sure the [1:38:14] impacts that are being generator are minimized to the extent possible. [1:38:23] Might want to stand up to. You're gonna have a few questions. [1:38:32] Kaye on and and U.S. control. We can do a better job of controlling to us. The project [1:38:37] was completed to approximately year ago. So when a comment said that, [1:38:41] you know, my pulls dirtier. You know, the Destin a that the we did have a dozen open there [1:38:50] and we did have water control. But there was just a time soon. We also cleaned quite a few [1:38:58] pools and clean the. Solar panels for folks. And we did have dust and that's [1:39:04] something that we'll we'll do. The best job we possibly can to mitigate that. And then the [1:39:10] deaths, some comments that were made, if I can, there is no graffiti and buildings. We have [1:39:18] the police control funding police. We have our own security system. [1:39:24] There are evil ickes from our project. It's one of our biggest concerns they come in [1:39:28] in groups of 5, 6, 7, and they come in and they go through our landscaping. It. They just kind [1:39:34] of come through and take over the so we have big concerned about that will be talked to [1:39:40] the city about and also in the city is a given us access to a drone and they followed them [1:39:45] home with that with some of their families and some of that, let them know that there [1:39:49] kids are being destructive on on the property. So you have great on the security [1:39:56] said their security. Do you have just cameras should you haven't actually have on-site [1:40:01] security. We have 12 hours a day. We have full-time security staff staff. Yeah. [1:40:11] What know these are security folks is we have a private company called and asked for [1:40:18] Tuesday and for and then we have to patrol officers that are in uniform and we pay for. [1:40:25] And they're they're from what? Like 95 or something where the dollars. [1:40:32] 06:00PM and 9 to 7 in the morning. And during the day we have [1:40:37] staff there, but they're not law enforcement. You know what? So just to [1:40:48] follow up and maybe more directed to staff. I mean, I I would be interested to know [1:40:51] that I've heard several speakers to speak about all college of criminal [1:40:57] activity involving drug dealing. Do you have information on on? [1:41:07] Call volume for that particular area? That would. You know, kind of bear that [1:41:15] out or what information I do. I know we have a police back. I don't want to put him on the [1:41:19] spot for that cause. That's not fair. He's not ready for But but I'm interested. I'm [1:41:26] interested in that. Unfortunately, we don't have data today to share [1:41:34] with you. It is from my department. We haven't been aware over any specific [1:41:40] concerns in terms of additional crime? I think we would have asked for that information from [1:41:46] PD so we could provide that data to the commission. But we don't have [1:41:54] that information. Obviously the the process, today's for the commission to make a [1:41:59] recommendation to city Council. So what I suggest is that we obtain that data from [1:42:04] the pleas and permitting percent that information as well too. City Council for [1:42:10] further consideration. Okay. All this. The overarching thing for me is we were. [1:42:22] High density. It got changed. The reason was high-density because it was the DC that's [1:42:29] the reason this. Because identity works. If you have. Commercial, that's a bold us [1:42:34] one months. It seems to be okay. So we lowered it to 1, 1, to 5, right? Was it one to [1:42:42] 558-5858. And then now we're asking, go back to the higher density [1:42:48] Nani, DC I whenever I see anyone going to high asking for Dancy, I want to say we're [1:42:53] number one. How are you going to mitigate the effects of that? And number 2, how does it [1:42:57] benefit the city obviously benefits the property owner which I'm for like 8 more [1:43:03] affordable housing, more units. That site is great. But the downside, what does it do [1:43:11] city and what is that? What's the benefit? So that's the overarching I have here. [1:43:19] So number one is. To just are some easy questions. Why are they parking [1:43:27] on Duval in Berea? If there was sufficient parking in the parking study for [1:43:31] Boulder's one. So they do meet the need for Boulder's one, the code [1:43:42] requirements for parking glitch. We did reach out to the applicant and and [1:43:47] kind of pose that question a few months back. What we understand is there are some [1:43:53] units that are just closer. So just proximity to the number. And so they will park [1:43:59] and then they have a shorter trip to they can and go to their apartment and so that's [1:44:06] that's one of the primary reasons. Okay. So it's there's there's [1:44:12] what I understand, maybe them kicker correctly on this. But they they do have [1:44:19] their allocated a certain space, but believe me, they don't want to pay for the [1:44:24] additional parking space. It's 4 overs all mean person. Get to get that they get a [1:44:30] parking spot with their units on the townhouses, but they have a second car. [1:44:39] So. And ask a series of questions. I didn't mean to interrupt [1:44:45] them. Sorry, not no prom. that's fine. It sounds like there's an issue [1:44:53] that with even though it's legal to park in Berea, it sounds like there's an issue [1:44:59] with parking on Berea for all residents of the north coming down various to Normandy into [1:45:05] the 5th to Newport. There's it's getting packed as being dangerous for kids. [1:45:10] Would there be any benefit to putting no Berea along the frontage of this? [1:45:21] With the vote of ozone that no parking sign and some red curves for help with the fees [1:45:25] up to the people coming in and out and breathe. Now I'm not a parking engineer. I just [1:45:33] sometimes there's the unintended consequences of doing these things. But I just [1:45:36] want to throw it out there that. One resident brought up. [1:45:43] What are your thoughts on? Permitted parking like in Duval in that area? Have you ever use [1:45:47] that mechanism? What I guess my question is how do you stop overflow parking from the [1:45:54] boulders? One from flowing into the single family residence to have any suggestions. [1:46:04] Well, I think I think number one, obviously, as rain indicated, we think we think [1:46:08] that the people that are probably some of the people that are parking is because of [1:46:11] their the unit happens to be about to close against recounted. I think we need to [1:46:17] work with the applicant see how they're managing the parking and how we can best [1:46:24] take advantage of what we know for you. How it's being offered to the to the rest of [1:46:28] it right? Obviously that they are parking requirements and in [1:46:35] that parking that require per code needs to be available to the residence. Obviously [1:46:42] residents may have more than one card to cars to cars. And I think at that point [1:46:44] there's that there's needs to be a, you know, some type of Lehman. Would we be? [1:46:52] Applicant and the Rays hitting terms as to how they're going to manage that right? [1:46:57] and I understand the wise. I appreciate that. Has. Is there any other [1:47:04] mechanisms besides? Relying on the property owner to manage the parking. Is there [1:47:08] any other mechanisms the city is used to control parking overflow into residential [1:47:19] areas? I don't recall if we've we've done any permits in the seeding terms for [1:47:24] residential neighborhoods. Taipei, seen that in other cities where [1:47:29] there's mean impacts either due to the proximity to a school, either adjacent to commercial [1:47:36] and there's overflow parking and there's been cases where there you see the parking [1:47:46] permit to program that can tip them into to assist with that. I'm not sure they can. We've [1:47:49] done that here in the city. I'm not saying that. That's the answer. But I'm just asking [1:47:54] if there's other mechanisms. So that's just stick that on the shelf right now will keep [1:47:58] that in your mind. Okay. A judge just to confirm you do have a on site to [1:48:06] security officers. First to honor. You have to security officers [1:48:12] walking the fold and I'm asking is in Boulder, one because it will finally has different [1:48:16] wonder, too, that we pull from 6 o'clock at night till I think 7 in the morning. It's a great [1:48:27] have an office. We have an officer not to have one have one or 2. They split shifts. [1:48:30] And then during the day you just have the management. We have a team that we have [1:48:37] staff of 3. We have a and maintenance staff. And Porter and actually to [1:48:43] Porter's. And then we have. A security person. That's that's a female. She says she's [1:48:53] not work in security, but she's in charge of it, OK? And the then we have this sales folks. [1:48:59] Okay. Thank you for clarifying that next question. [1:49:08] Can we pull up the slide that showed their plan of the blue lines, the green lines, the [1:49:12] original, you know, access and then what we had to go to. That was on the applicants [1:49:20] presentation. It paid for 8 for Atkins. Commissioner comments be asked [1:49:28] What is the function of the security when there's a domestic disturbance the [1:49:37] I'm not an expert on it are we have patrol officers there that they carry a weapon. [1:49:40] We pay extra for that. They have to be trained. If there's they call the police department [1:49:46] immediately. But there are there are trained professional police officers. [1:49:53] Not know what the city, but they are certain charm, security arm security. And we [1:49:55] hope that we pay extra to have them more. And we did that because of the bike folks. [1:50:03] They came in and just to basically overpower you with 5, 6, kids age 12 to what have [1:50:07] you actually met with the school, the principal at the school because it was a pretty [1:50:11] big issue that still is that they do wrong. Excuse me. I can tell you from personal [1:50:19] experience in dealing with armed security previous my life is it's very expensive. I would [1:50:25] imagine spirit we do with when they weren't on the shoes and the kids didn't [1:50:30] seem to respect him as my dad. And yeah, we have videos where they delayed their bikes down [1:50:34] around a patrol car and have a what are you calling in? You know, they talk to the [1:50:42] police officer. And so we upgraded to a higher security level which they don't [1:50:48] intimidate those that so my next question or proposal is. Part of me. [1:50:55] If we didn't have to cut through the park like see access off of Newport because [1:50:59] that. Pulse people out of the project and it doesn't let them go in. [1:51:05] The downside is it's cutting the park off and we heard from that and I'd rather not do [1:51:11] that. So my question is the blue line there that goes from the end of Normandy into the [1:51:16] put potential blue line into the new boulders to that's running through Indian [1:51:23] property. Karin de N I is it because they found cultural resources or just because the [1:51:27] tribe owns it. There are good because she clear on that just that we own the property. [1:51:32] Yeah. It is going to we've agreed with the tribes to make it a [1:51:36] concerted conservation easement. Yeah, we will still own. And if I'm wrong, I'm [1:51:43] wrong and we will maintain it for fire for cleanliness for graffiti. We have to maintain [1:51:51] the area and that we are truly are the owners okay? Think that out. We asked to go through [1:51:56] there. Yeah, no, we were told no. We said matter of fact, you're [1:52:00] going to have to make this a conservation easement. So I want my question wants to [1:52:07] address that. A lot of problems will be solved here if we could do that. Is there any way we [1:52:11] can negotiate with the tribe to mitigate a purchase mitigated land for this? [1:52:19] So in our conversations through the consultation with the 2 tribes sub Olympic Chong, the [1:52:24] and based on the cultural port. There is multiple cultural resources in this area so that [1:52:33] it I think it would be a ask of the tribes to to kind of go back on that. Okay. There is [1:52:39] a large and the truth or they call it but rack but crack rock which is cooking area, goes [1:52:48] back to the thousands of years and they've document and that is in right in that vicinity. [1:52:56] Yeah. And that's the biggest area. Also like talk a little bit of a kind change subjects a [1:53:00] little bit. Just your chair could. This was a huge drug area. We did not realize that [1:53:05] we purchased the property the as yet, but crack rock. There are people [1:53:10] living up there in mattresses and covered areas. And when we first went in there started [1:53:16] cleaning it up. They started destroying our equipment because we and we actually push [1:53:21] the drug traffic's out of there. Eventually we we have that role cars. That's that was [1:53:28] a big drug area. And we didn't know before we started. We think we've actually help clean [1:53:33] the area. That's that's our that's good. That's good. So so basically it's off the [1:53:39] table to negotiate with the tribe that there's also one other reason. You know, we've [1:53:42] heard from fire that that does toe come to one confluence point number and Normandy. [1:53:51] So having to pay them. So that's off it. What wears David Faust. David, [1:54:03] can you come up? They see allowed to speak since he's on the commission and about its [1:54:07] findings. Can we ask you some technical questions? The Parks Commission. [1:54:15] No Heat. Are you talking about whether you can ask him questions as to [1:54:17] what happened at the Parks Commission? About about ideas from the [1:54:27] Parks Commission. Yes, no, because he's here for public comment. He is not representing [1:54:29] staff for the entirety of the Parks Commission. Okay. Thank you so while asked city staff, [1:54:36] what is the likelihood of moving the dog park to the Bradley Park? [1:54:46] Well, a CNA. I was going to ask for a community services director to come in and assist [1:54:49] with that. Maybe some of the our questions. Good Evening Commission. [1:54:55] Marianna Mitchell Committee services director. I want to clarify which park exactly is [1:55:02] so so. So one of the proposals was in the area. They're going to chop off because of the new [1:55:06] Port Access Road. We have a presentation at the 2 proposed little dog parks [1:55:11] in the little corner that we were going to lose. It's insufficient size. So as [1:55:18] an offset, could those dog parks the funded at the Bradley Park is that something that? [1:55:26] Parks and community services would support it. So we're we're always open to [1:55:32] conversations about what would offset or increase park amenities through [1:55:39] development of this nature and 14, not completely clear what park off Bradley referring to. [1:55:44] I don't believe we have a city-owned park. A mention moving to the Bradley Park. [1:55:48] So I guess let me ask about it all. Is there another park that if this developer could find [1:55:55] a park site, a dog park at another location since this would not probably function [1:55:59] well, as we're absolutely open to discuss that with a developer develop. And my [1:56:05] question, thank you. I talked about possibly no Berea. What about the wall between on [1:56:16] the will, the eastern wall between the tri plexus and the existing homes? I heard a [1:56:22] comment that that was degrading. Is that true? And [1:56:28] what's to like the of the of adding a condition of approval to rebuild that wall and [1:56:32] possibly even raise it. As part of the final engineering. If we find that [1:56:40] that wall is not in good shape than we could require that to be reconstructed are placed. [1:56:47] Just to make a note of this. Next question is. If the Newport Road access the [1:57:08] road, the cutoff thing, can we pull it up? Yeah. So where the interests to it. If if this [1:57:15] gets approved. I would want to see because right now like there's a fight [1:57:21] believe is their offense along Newport, that this is fence, assert certain that has a full [1:57:25] circumference of the of the park or just like along Newport and various other is split rail [1:57:30] on Newport, always but route, OK? My thought would be there [1:57:36] should be either a rod iron fans or some kind of maybe 3 foot fence, something on the [1:57:42] park's decide. On the. They do whatever it takes. We doing. It should be a fence here here [1:57:50] that would force traffic if you go up to 8 lead a March Frost. And kids and dogs and stuff. [1:57:56] So that's that's my concern there. You can make a note of that. [1:58:05] You see to do a better exhibit that we can use instead of this one may be in the staff [1:58:09] presentation. If you want to bring up the staff's presentation, I think [1:58:15] this one does show the entirety a little bit better. But I'm okay with it. Also mentions you [1:58:20] need more aerial. I'm okay with the one that was there and Super Bowl is this pool and [1:58:34] clubhouse proposed private or public. It's private is private. [1:58:41] Okay. So those are my I mean, once again, I'm not sold on. [1:58:52] The 4 stories in the higher density. I don't see the benefit to the city. I don't [1:58:57] see him being mitigated. My last one, which may help a lot of these. [1:59:05] Is my suggestion that period to become condos, not apartments. And this [1:59:12] is why I live next to it than a single family residence right next to the little that could [1:59:16] throw a rock at him. apartments and then condos next to it. The lots are the same [1:59:22] size. They basically look the same. But one is apartment units which is renters. One [1:59:31] is ownership. It goes renters condos. And then the existing single family residence. [1:59:36] It is a great buffer. I mean, I like to say this publicly, but ownership drives. [1:59:42] Let's public safety problems. Less. Of noise, those kind of things. So in my opinion. [1:59:53] This really should be an ownership product, not a rental product. I don't have a problem [1:59:58] with the units as much if it's ownership. So I want to throw that out there to the [2:00:01] commission and see what your thoughts are on that. Also. Hi, I'm with the Parks [2:00:08] Commission in. It first 5 to if we can't going off of Normandy because of the [2:00:15] tribal land and because of the confluence of concentration of fireworks and we have to go [2:00:18] off in Newport. I'm not in love with chopping the park. But there's something that this [2:00:24] project has to bring to the community to offset the loss of that park. And I don't see what [2:00:30] that is yet. I don't see and I'm open to contra. Got open to ideas that this could be [2:00:36] a win-win, a property right sky. You have property you should be able to develop it. [2:00:40] I hate to say this, but when everyone, but I've been here since 1997. And there was open [2:00:46] fields at my house had fields around. It is now surrounded by track lumps. I didn't like [2:00:51] that. But whoever on that land has a right to develop it. And when the city's owns it a [2:00:56] certain way, they have a right to develop it. And we we want that. That has to be mitigated [2:01:02] by what it does to the surrounding community and twos to the city as [2:01:07] a whole. I don't see that game to the city on this project yet. Work with staff proposed [2:01:13] what you can bring to the city that would benefit either the surrounding neighbors will [2:01:17] first. We're going to have to mitigate some things. And number 2, what why should the [2:01:23] city loses basically chopping off the corner? That park is we're losing it basically. [2:01:28] What can you bring to the table to offset that? Those are my thoughts to the commission. [2:01:30] Love to hear what you to think. I have a question if we entertain condos. Are [2:01:45] there. Does that affect of and are there other places where the moderates, income [2:01:54] level Arena? Units go. Our with condos. The moderate income level. [2:02:02] Well, the project before you today, it's for end product. It's one parcel under [2:02:11] one ownership he ordered to entertain a condo project. Obviously he would have to one, [2:02:15] you know, kind of go bag to the processing beyond analyzes he for sell product with the [2:02:21] additional abdication of stuck on the map. Again. 4 story building. Can that be [2:02:35] set up as a kind of perhaps? But you should be that type Lindy sign a to [2:02:44] 4 a for apartments in for rent product. The Tripe Lakes could be. Maybe be a product [2:02:52] that could the perhaps that condo map. But today the request from the [2:03:00] applicant has to do 84 and product with these 2 types of. Building building types. [2:03:10] to answer a couple of your questions, Commissioner Thomas the the [2:03:18] project has to go back to the Parks Commission. To get the Queen Bee Agreement [2:03:28] approve. It's part of the process. They they they need to work with staff and [2:03:31] work with the Parks Commission to make sure that we get something that it's acceptable [2:03:38] to the city into the purse commission. So in terms of the exchange, what are we getting [2:03:43] out of it again, the asking nation wants to do this and that the person Commission, the [2:03:51] not support that. So we're kind of back to square one in terms of figuring that out again. [2:04:01] I'm the end of the day, the A C D and the parks Commission. We we we have the last say on [2:04:05] it in terms holes, whatever the offer, a tempting that what we're losing in terms [2:04:14] that's dry weight around property that would those be. But again, there has to be [2:04:19] there has to be that process that needs to be complete. And at [2:04:24] this point, the applicant understands and they're willing to work with us and and the [2:04:30] Parks Commission to propose something that. That hopefully is going to be acceptable to [2:04:36] both. Okay. So I'll just put out there that. [2:04:42] I don't see no matter what goes in this parcel. It's not gonna work in this. We have that new [2:04:48] port connection is just not going to. So the Newport Connection has to happen in [2:04:54] my mind. Which means something needs to be mitigated offset for the [2:05:02] Lost Ark. So and and also I don't see how this project could work in this. It's an [2:05:05] ownership product personally. So my suggestion would be to continue it and work out the [2:05:10] details on this. That would be my suggestion. Commissioner Thomas, I've been [2:05:18] grappling with that whole trade off. As well. In terms of I mean, [2:05:26] we've heard from the Parks Commission are representative from the Parks Commission. [2:05:30] I did see the meeting and they were very adamant about this isn't. What we want in the [2:05:39] community. So I would be agreeable to to what you're proposing. So so [2:05:46] I did not watch that. But would you say when you said the words, this is not good for [2:05:49] the committee? Was that the the infill project or just that they were OK with the [2:06:02] the residential product that they are not okay with ICE acting the part that part and [2:06:07] also they were not okay with the dog park. The from what I recall. And [2:06:17] they said that passive. Open space is part of an official to the community [2:06:21] because the dog park on the caters to a certain type of resident. [2:06:25] So if I could jump back into about holidays for taking bath. City staff. [2:06:34] Is there any viable alternative to the Newport Connection? We've talked about the travel [2:06:39] and that's not gonna work. We've talked about. Fire access, funneling [2:06:47] everything down. Debris in Normandy fire doesn't like that because it's a one point [2:06:52] access. So is there any other viable opportunities for this infill project other than that [2:06:58] Newport, One and I I would love to get with a new for just tell me. Is there any other viable [2:07:03] options? You know, that this was actually the staff's recommendation to the applicant [2:07:10] because of time we were concerned with the neighborhood to the east. So we want to [2:07:16] impact that. So we obviously understood that we're going to be patients with the cultural [2:07:20] resources. So this wasn't even proposed by the applicant. And we [2:07:26] actually have Brad to forward to the app and say, you know what, let's look at this [2:07:30] because this seems to be I love all the scenarios. The least. Harmful to that to [2:07:42] the neighborhood right as Maybe a lot of weight on a couple more other issues in terms of [2:07:47] your comments about making for ownership project you know. Everything that we process or [2:07:56] 18, 80% of what we process in Cannes before the planning commission is for ownership, [2:08:01] whether it's single-family residential where there is a medium density or even higher [2:08:06] density in terms of of condos, right there. He's a need over a makes [2:08:14] both types of units. These. Project for one-bedroom apartments, two-bedroom [2:08:24] apartment, which we don't have a lot of options in the city. So I'm [2:08:31] that makes a challenge in trying to provide the type of product we constantly to get [2:08:39] comments from. Residents. Then, you know, they're they're college kids. [2:08:43] You know, they can come back because they that they don't have a place to go. You [2:08:51] the residential single-family home price in the even though. It's more economical and in the [2:09:00] side of of the county and still expensive for a segment of the population. So this helps us [2:09:07] meet that need as well. In terms of your statistics for a crime. We've had other [2:09:17] multifamily projects because strength in other parts of the city. We haven't seen that [2:09:22] increase or at least the house and the chair with that. So I'm not sure if this is [2:09:27] unique to this area where there are affecting that as well. So I [2:09:34] don't think there's a correlation between multi-family in crime. They [2:09:39] may be some but not not to the extent that that we're talking today. [2:09:47] So on to pay back money just said the project I'm referring to near me. It is a gated [2:09:51] community. So that is something staff with that effect crime levels and behavior on the [2:10:02] site. Would you think? Kind of along those lines? I've heard a number of things [2:10:17] this evening from neighbors, the comments that most concern me that I've heard [2:10:25] really revolved around. For lack of a better phrase. Also criminal activities around [2:10:32] the site that that concerns me that concerns me because if if I live adjacent to that, [2:10:39] I would not feel at peace at home and that's really important so that that one [2:10:44] resonates parking issues, off-site parking issues that spill over [2:10:49] out of the project. I think that's another very legitimate concern. [2:10:56] I I want to get to safety in just a second, but I want to see if I could. I'd like to say [2:11:01] a couple of things. The access off of Newport doesn't particularly concerned me. [2:11:05] I think that there's a way to potentially mitigate the impacts of that. I think what [2:11:11] you ask for some additional mitigation is appropriate. I don't know what that is yet, [2:11:14] but I think there's a way to do that. That seems to be the least impactful, a remote [2:11:22] location and without secondary egress, even the 5 to 8 density. Would not be possible [2:11:31] to build on this site. Secondary means of egress that remote like that is absolute. [2:11:36] Otherwise you create additional problems for the city that I would particularly. Now. [2:11:41] But but that's just we have to have that. I do like the way that could [2:11:49] you flip to the ran one of the site plan may be that landscape plan. Whatever most clearly [2:11:54] shows the drive aisles. Through the project. I do. I do think there is a but [2:12:04] and that's OK about the colored up 1, one that had colored rivals result easier to see [2:12:09] the driver. Lawyer. Well, you're looking for that. [2:12:17] I do think that that. You want to slice. I do think that that I like the [2:12:25] way that the forest right buildings were pulled back. Which is not the case with the [2:12:32] boulders. One project I I I think that's responsive to some of the concerns that I've heard [2:12:39] with the 2 stories located closer to the existing single family homes that can be one [2:12:44] or 2, one or 2 stories. I think that's appropriate the site does feel very, very tight to [2:12:51] me. The circulation through the sate is a little concerning having to zigzag through that. [2:13:01] That last could you use the cursor grand the bottom block of for story buildings, [2:13:05] the one closest to Newport. You, which ones I'm talking about. Yeah, that block. [2:13:15] Could that block seems like that block could be mirrored. So the drive I would come [2:13:20] straight down and you have a pedestrian. Corridor through the center [2:13:27] of the site leading to the recreation center. To me that works a little better. It [2:13:31] doesn't. I don't think you lose any units. It separates making. It said all along, make it a [2:13:39] square. No, just mere mean with that. If it looked around this way and friend so the drive [2:13:45] out would be on the right side and the pedestrian path would be through the. [2:13:49] Through the middle to run, then vertical. That's just that's just one of my thoughts. [2:13:51] I think that would help the internal site. Having said all that. [2:14:00] I think I still have some concerns over the very high fire hazard [2:14:08] severity zone. Air is in making sure that we're cleaning that up properly. I think with the [2:14:12] other concerns that I've heard this evening I would also support a continuance for maybe [2:14:19] slightly different reasons. But I would like to ask the applicant to continue to work [2:14:28] with staff. I think the site plan is close. But I would like to have the applicant [2:14:36] continue to work with staff and maybe refine that and work on some of the some of the [2:14:41] other things that I've heard. One of the things that I think they could avail themselves [2:14:46] of damage done so already would be meet with PD. And let's let's have them go through a [2:14:54] separate head review so that so that we can understand if there's crime prevention for [2:14:58] amount of environmental design started to slip back into acronyms. Sometimes. [2:15:05] To go through that process to review to see if there's ways to improve on site security [2:15:10] for the boulders to project, which is what we're talking about here. Some of that might [2:15:17] have application for Boulder's want. So for those reasons, I think I would also support a [2:15:23] continuance. So my my question, if the commission decides to do that, what would be an [2:15:28] appropriate time frame, Mr. Director. I do understand we you know, [2:15:36] the city wants to, you know, get this thing moving along. So I don't want to unreasonably [2:15:40] delay further consideration. But I think there's enough loosens that. [2:15:45] It merits this, especially given that this is not a arena site. And this is a fairly [2:15:48] substantial general plan amendment. In the back on that. What is [2:15:53] the feasibility of making it? And that's it would it would have to be analyzed [2:16:07] by engineering to make sure that the stacking works, that that. [2:16:11] And there's sufficient turn around and hand. It's something that we can. Consider as we. [2:16:20] Continue to analyze the project. To do that. In and suggested [2:16:30] time front. I think in order for in order to give us some time to. You know, work some [2:16:35] of that. Issues in common is that were raised today probably to continue the project to the [2:16:44] first meeting in October. I would I would support that is or which one? [2:16:53] I'm okay with continuing that item. Sure. Sure. All. The first [2:17:04] meeting in October. That was up Tobar 14th, October 14th. Ok, thank you so. [2:17:11] Just to be you do what you need to touch that. We propose that we continue. [2:17:20] It may be before we see a continuance, if we can make an know that the property owner [2:17:26] should work with staff on the following issues to resolve them. Number one would be the [2:17:33] increased. Just measures to do a better job than you Boulders. One [2:17:40] number 2, meet with police. Get the call volume to see what the actual [2:17:45] crime level is at this level. This one as well as possible additional on saint measures to [2:17:50] improve it. I would specifically like to to explore that ceppt to process to see if [2:17:56] there's measures ship Sept Ed. That's number 2. Number 3 would be. [2:18:04] Talk about the parking issue on Berea possibly making free a no parking zone for the frontage [2:18:11] of the property or working with and working with management on parking enforcement. Or [2:18:16] whatever measures we could do. That's that's the next the 3rd issue, the 4th issue would be [2:18:23] to confirm about the degraded walls on of West's on the east side between that resonate in [2:18:26] residential and that reflects is the 4th issue. The 5th would be [2:18:34] to go to the Parks Commission and as well as staff. To think appropriate mitigation [2:18:42] matter for the last of the park. What when could we have for everybody there? [2:18:50] Also to discuss? And ownership project ownership possibility tainted tonight. [2:19:00] We won it. So the ownership I do understand your your point. I get a little nervous about [2:19:04] that. Distinction between making a distinction between rental and [2:19:08] owner. Properties and Mike in the capacity I'm sitting here. [2:19:16] She said last night it is your problem. The way I worded it know. So I don't think there's [2:19:21] any way to implement what you're describing in the time frame because that they have [2:19:24] come back and do it. He tm for condo purposes. That's going to take a lot longer than that. [2:19:29] I don't expect him to have a map. They could discuss ownerships. The property owners [2:19:37] willingness and feasibility. You're interested in a conceptual kind of sexual [2:19:41] conversation. And and likelihood. So we don't have to have a [2:19:47] drafted him. You don't have to. There's no patients and things. Yeah, yeah. There's no way to [2:19:51] get that done. And that amount of time is that this is that workable, a concert. You know [2:19:55] the conversation from a concept standpoint. And again, I'm I'm I'm nervous about a distinction [2:20:00] between the 2. So the so anything else you to want to add as far as what [2:20:04] needs to be discussed. Prior to suggesting continuance? Ok, then I'll propose a [2:20:09] continuance on the project. Is it to date certain what he said to him, October 14th. [2:20:15] Yes. Is that your motion? That's my motion. Madam City clerk. As you get all that I [2:20:24] did OK? And and OK, we're going to take a vote that I have just one [2:20:32] thing. And do we? It's still stuck on waiting. Do you want us to do a switch to voicer? [2:20:39] Here we go. Okay. Chris. Okay. We have a motion and a second. Please vote. [2:21:00] Operator. The motion passes with all 3 commissioners voting for the [2:21:09] continuance. make this comment after this photo that I would encourage the property owner to [2:21:13] work with staff, see what we can do to mitigate it so your project can get done for the [2:21:20] project, just how it's done. So let's see if we can have a win-win year. [2:21:27] Okay. That concludes that item. There are no discussion items for [2:21:31] this evening. Director Hernandez to have any updates or comments and then today [2:21:36] think of anything came. If we could just wait for vice Right on time. [2:21:52] Those the commission. Commissioner night and have anything to report and [2:21:58] community activities. Well, in 2 hours. Going to court. And to me. On August, 18th. [2:22:11] I went to the Rotary Clock dedication ceremony that was pretty cold. Linda. Jennifer [2:22:20] Jean passed away recently. On the 31st, wants the district for a town hall. That was well [2:22:30] attended what information over there that Dean was. That's teen's [2:22:37] final one. By 9, 1, I went over to the interfaith meeting over Cross a fire station 7. That [2:22:44] the largest meeting of scene there ever. With all the community members [2:22:50] and they're talking about upcoming. Fall. Activities. On the 8th. [2:23:05] says yesterday I went to the SEC introduction of Dr Dotson that was hosted by the NFL is [2:23:10] Chamber of Commerce. And then after that, what was my family over the Quail Valley Moose [2:23:17] Lodge for the district, 2 candidate for. That's all you. Thank you. Thank you. [2:23:24] Commission the commission like to request any future agenda items. [2:23:29] Seeing none. I adjourn this meeting at 8.21, thank you all for coming.
