Yes. Taylor. Yes. Yes. Thank you. Dara. Okay. Next is [15:40] public participation for items not on the agenda. I do not believe we have anyone from the [15:46] public. So I will skip that. And next item is a resolution. It's a resolution adopting the [15:56] 2025 stormwater management element as an amendment to the montgomery township master plan. [16:02] do I have a motion to approve? So move. Do I have a second? Second roll call, please? Dara [16:13] khan yes. Yes. Roberts. Yes yes yes yes yes okay. Next is an extension request. This is case [16:26] pb oh 323. The applicant is harlingen associates llc. It is for block 6001. Lots 3334 34.01, [16:38] 35, 35.01 and 36 route 206 montgomery township. It's an extension of preliminary and [16:45] final major subdivision site plan approval to january 8th, 2027, and for the applicant, [16:54] richard johnson, attorney. Good evening. Good evening. Here to get an extension of vested [17:00] rights under njsa 40, column 55 d hyphen 52. We got preliminary and final site plan, [17:09] subdivision and bulk variances, design waivers, exceptions on. January, the resolution was [17:24] adopted on january 8th, 2024. So our time is up for vested rights as of january 8th of [17:31] this year. Was approved by the planning board in november of 2023. This is the application [17:39] for two story, two story, affordable market rate mix housing apartment buildings [17:46] with 18 apartments, 11 of which are affordable. As your third round obligation on the mount [17:54] laurel. Seven of market rate at 36 three bedroom townhouses. You recall that this is one [18:02] where we're doing extra work for the township, for sanitary sewer, to bring the sewer line [18:12] across down the rutland road to the manhole, and then the township then will decide to [18:20] connect to the properties in harlingen village, which have failing septic systems, which [18:28] have been failing since I came to town about 50 years ago. So it's it's a real boon to the [18:36] town. Beside being your third round obligation. So what have we? What have we been doing in [18:42] the last two years? We got somerset planning board approval on august 9th, 2025. [18:51] we got somerset union conservation district approval on site on june 4th, 2025, we [18:59] got new jersey dep approval for the stormwater discharge general permit on site approved [19:05] on january 26th, 2021. We have somerset union soil conservation district for the [19:11] all on site soil, sediment sediment control certification on june 30th, 2025. That's for [19:19] the sewer line we got doing dnr canal commission approved certificate of approval [19:26] received on october 15th, 2025 fret freshwater wetlands statewide general permit number [19:34] two for force for the force main crossing, the fox brook gp. General permit number six for [19:41] filling up the swale and a gp ten a for a driveway crossing and a transition area waiver [19:49] averaging. It was submitted by our environmental consultant, environmental sciences on [19:55] 862024. I've been advised that it should be approved within a month. We got approved njd p [20:05] approval for the flood hazard area verification method six on september 16th, 2025 we got [20:15] njdep approval for freshwater wetlands. A letter of interpretation approved on [20:22] january 7th, 20222020. The nj permit for flood hazard area verification was approved on [20:32] august 29th, 2022. Let's see what else. We've done. Various easements and other things in [20:43] order to. Get our plans approved, which are being reviewed by mr. Darcy's office. [20:53] revised plans. We've had comments and so did mark herman, your engineer. And let's see [21:01] for that. We got the cross easement approved on the november on october. Sorry, [21:17] november 11th, 2025. We got the municipal services agreement approved on on december 15th, [21:28] 2025. We got the drainage easement for the open space lot approved on october 29th, 2025. [21:37] we got the driveway easement because if you recall on this one there, the driveways [21:45] crossed into the common area, and that was a condition of the resolution drawn by miss casey [21:50] that was approved on july 9th, 2025 open space dedication. There's open space lands. We [21:58] submitted our environmental audit was approved by miss wasikowski. We have to clean up [22:07] some garbage, which we agreed to do. We completed the construction sequence agreement, [22:12] the affordable housing agreement. The deed restriction for affordable housing was done [22:18] today. Was approved today. I did a contract for a temporary construction access easement [22:28] for your public works. That's the offsite sewer that's being reviewed by mr. Herman and miss. [22:37] mrs. Quiroga. A temporary construction access agreement between montgomery and the ems, [22:44] the first aid squad, which is finally signed. Let's see what else we have. And we sent in [22:57] our homeowners association papers last week through mark herman wanted a certain [23:07] restriction on the stormwater. Stormwater facilities. We said that in he's reviewing that and [23:19] that's about it on this one here. The long pause was because for the off site [23:26] easement that we had to get from richard meier for the sewer took for a long time, [23:33] because you had to get an appraisal and you went back and forth and back and forth with [23:38] mr. Myers attorney. And that was only done on may. The easement was dated on may 25th [23:46] at 2025, and that prevented us from going on to his property and doing soil testing, in [23:53] which delay the sewer, which we now have. We do have the sewer. Bids in approved by mr. Herman, [24:04] your engineer. I drew a contract for that. I had to draw another contract for that. [24:11] he's. He and miss quiroga is are doing for your public works access. Because we have to put [24:19] the sewer line on that and the also the agreement for sewer capacity for the. Pipe plant. [24:34] so that's what we've done. We need a little bit more time, probably within a year to [24:39] complete everything. Again, the big hold up on this one was getting mr. Meyer to agree to [24:47] the easement finally, by the township committee. And and you're you're comfortable that [24:54] a year is you're comfortable with the year extension. You feel you feel comfortable with [24:59] that. That should do it. Okay. Okay. As you can see we did a lot of work on this one. Oh [25:07] yeah. Look this is a this is a this is a pretty this is an involved. The offsite sewer. [25:14] yeah. Across the fox brook go under the fox brook. And you know it took a long time. Yep. [25:22] okay. Given that we do not have public comment, we'll go right to board, question discussions. [25:28] any questions? Yeah, I have a question. Mr. Saltzman, can you divulge what was involved in [25:38] the agreement with ems? I'm sorry, what was involved in the agreement with ems? You made [25:48] reference to an agreement with ems. Oh, we're we're not giving them a line, but we're giving [25:57] them a lateral up to the foundation so that the only thing they have to do is get a [26:03] plumber to hook up to the lateral so they can get rid of their septic system. Okay. [26:10] thank you. And then what we're doing is we're originally going to only do a lateral a line, [26:18] put a sewer line. And they were going to put a lateral in but they cried poverty. And so [26:25] we're putting the lateral into the foundation. So all they have to do is get a plumber to [26:30] hook it up and to whatever facility they want to hook it up to. Thank you. Any other [26:39] questions? No. Okay then. Oops. Sorry. Then let's do I have a motion to approve the the [26:50] extension request. Do I have a second? Second? Roll call please. Dara. Sorry. Yes, yes, [27:01] yes. Khan. Money. Yes. Roberts. We lost. Roberts. Schuldiner. Yes. Thing. Yes. Yes. Loffler. [27:15] yes. Sharma. Yes. Yes. Okay. Thank you. You're all set. Okay. Next item is approval of the [27:27] minutes of the december 8th, 2025 regular meeting. Do I have a motion to approve? Do I have [27:33] a second, please? Second. Roll call please. Dara. The first I didn't hear. Sorry about that. [27:42] okay. Yes. Yes, honey? Yes. Singh. Yes. Taylor. Todd. Yes. And khan. Yes. Okay. Future [27:52] agenda items. This is a this is a addition this year that we're going to have. Yes. At least [27:59] once a month where we're going to put on the agenda what we believe future agenda items are [28:05] going to be. So if anyone from the public does come, they will hear things that are coming up. [28:12] so it's again, just another way of letting the public know about potential things coming [28:17] in front of us. So we have two future agenda items. One is the 23 orchard road redevelopment [28:25] plan, and the other is the amended affordable housing plan element. Before I go to future [28:33] meetings, I just would like to welcome our newest board member, mr. Sharma. Welcome, welcome. [28:39] yes. Thank you and should be as much fun as we had last year. So I think we welcome mr. You [28:50] know I just I'm I'm you think marvin. Yeah I mean I've been looking at I've been looking at [28:55] marvin on boards for you know 15 years. So marvin schuldiner welcome back. It was like I [29:00] hadn't even left because this last application was part of it. I handled it at the beginning. [29:07] so yeah, it's, you know, like nothing. It's still going on for years and and. Exactly [29:13] right. So, marvin, are you good with it? Yeah. Okay. Yeah. Sorry about that. Yes. Welcome [29:20] back. Thank you. Okay. Future meetings january 26th will be a planning board meeting. If we [29:26] have items, as far as we know, we don't know yet. And then february 3rd is the site plan [29:33] subdivision committee meeting at 8:30 a.m. Via zoom. February 9th is a planning board meeting. [29:39] and february 23rd, our scheduled planning board meetings as well. Do I have a [29:45] motion to adjourn? So moved. Do you have a second? Second? All in favor? Aye, aye. All right. [29:55] thanks, everybody.
