He has faced a number of challenges including [9:34] a sudden death of a very close family friend, [9:37] and his father's illness. At this [9:41] time his dad is actually under hospice care [9:46] . As we all can imagine, his physical and [9:47] mental health has suffered a little [9:48] bit from this. The mayor has decided to take [9:50] a medical [9:51] leave of absence to address his current health issues. [9:56] he is committed to his public service role, [10:00] but [10:01] realized his health and well-being [10:02] of his family must come first right now. [10:08] chris is getting help from the support [10:09] of the healthcare team so [10:10] he may return as soon as he is able to. [10:16] we, as the board, wish him a speedy [10:17] recovery and ask that you respect [10:18] his privacy during these challenging times. Thank you. [25:53] we have any members of our crews that [25:55] were invited into night in the audience? I'm going to [26:01] ask them to come up and join me up front. [26:35] >> it is my pleasure to be recognizing [26:36] the [26:39] group of individuals who [26:41] serve tirelessly every day. I don't know [26:43] if you always realize, oftentimes what happens in [26:47] the town, the great services that [26:48] are provided happen and nobody pays [26:50] attention until they are not happening [26:51] or until a problem comes up and then you [26:57] notice that something is not going right. [26:59] this is a representative [27:00] group of a larger group of individuals [27:01] and I'm going to ask that the names [27:02] be shown as I'm talking through this. [27:08] an employee spotlight every month would [27:10] like to focus on either an individual or [27:11] team of people that are just doing [27:13] incredible work for the community. [27:16] during the recent hurricane and again, it is [27:18] through the grace of god that we did [27:19] not suffer more damage than we did, [27:21] you know, we are [27:23] still praying every day and sending [27:24] all the help we can to the western part of the [27:26] state, but there were challenges that [27:30] were being faced right here in mooresville and [27:33] it was through the incredible efforts [27:34] of these individuals, these gentlemen [27:35] and others on their team [27:36] that really made sure we all stayed [27:37] safe and that the town kept moving forward [27:47] and that you [27:48] did not have any more interruptions [27:49] to your daily lives then you had to when [27:50] the storm came in so there were multiple [27:51] departments we want to [27:53] recognize tonight and again you will see the names [28:06] and the names of the departments flushing [28:07] up on screens but I would like to [28:08] point out [28:09] a few of these groups and individuals in [28:10] the teams. Throughout public works [28:11] we got a lot of people doing a lot [28:12] of different things but [28:13] people don't always realize for example, [28:14] parks and recreation does amazing [28:15] work, and some of the work they did [28:16] during this [28:17] time is remove the fallen trees, the [28:18] debris and limbs from across the town [28:22] in our parks, our cemeteries that we [28:23] had issue with another town facilities [28:24] and then we had [28:25] our sanitation crews that were out [28:35] along [28:36] with our streets and the stormwater [28:37] crews and these teams are responsible [28:38] for addressing all the flood -related street [28:39] closures in the cleanup of multiple [28:40] trees that [28:41] had gone down on the roads and across citizens' [28:44] properties. I hope if you were on [28:45] social media that you had a look at [28:46] some of the images we shared because [28:47] we really wanted [28:50] to share with you [28:52] , almost in real time you could see the [28:53] work being done and for those of you [28:54] who have these issues in the community [29:06] you know they came very quickly. Almost all [29:07] the work across the town was completed [29:08] within three business days which I [29:09] think is a pretty remarkable turnaround time [29:10] given all the challenges we were facing [29:12] taking care of our community and helping other [29:12] parts of the state. Art [29:18] traffic and transportation team worked [29:19] to take care of all of our intersections. [29:20] we lost signals and [29:21] had one major traffic accident that had [29:22] to be cleared and serviced and again [29:23] they made sure they got out there [29:28] and made sure all of our traffic is [29:29] flowing safely because there is [29:30] nothing worse than coming to an intersection [29:31] and you have flights that are not [29:32] working in lines that are down so [29:33] again they worked both during and [29:35] after the storm to really ensure that we all stayed [29:38] as safe as possible [29:40] and that our lives were impacted as [29:41] little as possible during the storm. [29:45] they are really a shining example, I [29:47] believe, of the excellence [30:01] that all of our town departments deliver [30:02] every day but again, these people are [30:03] oftentimes unsung heroes because as [30:04] I said, they take care of things we [30:05] don't really pay attention to unless [30:06] they're not working so I would ask [30:07] you now to join me in [30:08] a round of applause to thank them [30:09] and just so you know, [30:21] we have a token of gratitude for all of [30:22] you that we are going to be distributing [30:23] because our group is large. We have [30:24] about 46 [30:25] individuals total so I will be going [30:26] to departments individually but I [30:27] really appreciate you being here tonight. [30:28] I appreciate all that you do. [31:38] we would like to thank you for hosting us [31:41] tonight and having these [31:53] younger students to present to. They [31:54] are very excited and we are tremendously [31:55] proud of them for all the work they [31:56] have done and all the work they aspire to [31:57] do. Tonight we are excited to share [31:58] with [31:59] your up-and-coming volunteer opportunities [32:00] and the project we hope to construct, [32:01] build and promote the school year. [32:04] I will have the students join me. They [32:05] are very excited and is or [32:08] --eager to present to you their hard work. [32:29] >> hello. My name is will [32:32] roos. I'm the president of [32:36] mooresville youth council. I want [32:37] to begin by saying thank you to you [32:38] all for letting us speak. [32:41] I also want [32:42] to thank everybody else in the room [32:44] for supporting us and everything that we do. [32:45] so, [32:49] what is the mooresville youth council? We are [32:52] a youth volunteer program that aims to [32:59] help the mooresville community in every [33:00] endeavor. We [33:02] aim to assist youth that want to make [33:03] a [33:05] difference in the community and want [33:06] to [33:09] improve our community and [33:14] we aim to let youth participate in local [33:15] initiatives, to provide an [33:16] understanding of the town's functions. [33:20] I also would like to introduce the executive [33:21] team of the mooresville youth [33:24] council, our vice president [33:26] hannah, our social media and marketing [33:31] coordinator, our secretary, our assistant vice president [33:37] --she could not make it today --our [33:39] assistant social media marketing coordinator and our [33:41] assistant secretary who could also not make it. [33:53] I would like to say thank you to carly, nick, [33:54] and jane, advisers, for giving us [33:55] so much [33:56] of their time to make sure we are successful [33:57] and a big thank you to commissioner [33:58] deweese [33:59] for supporting us significantly, as well. [34:07] >> hi. I am the secretary of the mooresville [34:08] youth council and a little bit about [34:09] my job is that [34:10] I make the calendars for the meeting so that [34:12] we stay on track and [34:13] know what we want to discuss. I also [34:15] take minutes during the meeting [34:19] so we know what we have planned and how we [34:20] are going to execute in the future, and [34:24] I also put outposts [34:26] for meetings so we know when we are [34:27] meeting, what we are doing for the [34:28] meetings and we [34:29] know who is coming to the meetings [34:30] and regarding meetings, we have two per month. [34:33] one [34:34] is that the one mooresville center where [34:35] we plan our volunteer opportunities [34:37] and also discuss our projects and then another meeting [34:41] is at one of the town departments where [34:42] we are [34:45] able to take tours and allow all [34:46] of our members to explore these facilities. [35:04] >> hello, everyone. On the screen [35:05] here you can see our t-shirt design [35:06] for this year. This is actually [35:07] the first project we do as a group [35:08] every year and so it starts at our [35:09] very first meeting where we do [35:10] a team building activity and prepare [35:11] a list of words to present to the mooresville [35:17] youth council. You can see or local [35:18] just redesigned last year and our motto [35:21] . [35:30] >> one of our big things is our legacy project [35:31] every [35:32] year. This year we plan to create [35:34] free little libraries. We've been applying for [35:39] the state award mini [35:40] grant for the past month in order [35:42] to get a $500 grant [35:43] in order to do this project. Our goal [35:45] is to construct four free [35:48] little libraries [35:50] around mooresville to boost literacy rates [35:51] and bring awareness to [35:53] s.t.e.m. Education and its importance. [35:59] we had to give every child in person [36:00] and mooresville on equal opportunity [36:03] and a good education. [36:04] I a very big math guy. I love math ever [36:06] since I was little and would [36:08] love nothing more than to provide [36:11] children with knowledge on stem in mathematics. [36:15] we also plan to [36:16] have a collection event in november and december 2 [36:28] collect books to be placed into the little [36:29] libraries. Once the little libraries are [36:30] constructed we will distribute them [36:31] widely to many different [36:33] parts of mooresville. Some potential locations that we [36:40] brainstormed our mega park, liberty park, [36:41] bellingham, hope park. We are always [36:43] open to more ideas. Working with commissioner [36:43] deweese on this [36:44] project was definitely a big help. [36:45] he helped us [36:46] tremendously with the main idea and [36:48] we managed to build several new ideas with his help. [36:57] we also have many ideas for opening [36:58] events of [37:00] the little libraries. We plan to have several stem demonstrations [37:03] at the openings. We will have a lot [37:04] of [37:06] social media awareness to [37:10] ring this to the community and we also [37:11] plan to create educational signs and [37:12] things that just explained [37:14] the purpose of the little libraries and [37:15] what they stand for. [37:22] youth council has also attended several [37:23] state youth council conferences in the past. [37:27] the state council leadership conference [37:34] was on september 10th and we learned how [37:35] other councils functioned in how our [37:36] leadership skills could be [37:38] improved. We plan to go to the state youth council [37:48] conferences in november, february [37:49] and april. The upcoming conference [37:50] in [37:51] april will be about the mini grant [37:52] for a legacy project and we are very [37:53] excited about going there. [38:03] >> every holiday season we show [38:04] our support for the town by being involved [38:05] in classic christmas and by posting your own [38:18] project. This year we plan [38:19] to center our holiday project around [38:20] our legacy project and we intend to [38:21] host a book collection aspect project [38:22] to support our legacy project but [38:23] for [38:24] classic christmas last year we helped [38:25] children build holiday [38:27] crafts and [38:30] take pictures with the zippy and hosted [38:33] the donation drive. For [38:44] creek week, we had a booth set up [38:45] with snail races and tattoos for young [38:46] kids alongside an educational booth [38:47] about [38:48] the storm water department. At this [38:49] event we were able to raise interest [38:51] from parents and teens about the youth council. [38:54] earth day was another opportunity [38:55] for us to connect with the youth of [38:56] mooresville and share information [38:57] with them about recycling and maintaining [39:01] a healthy environment. [39:04] we had an awesome time. [39:21] >> all right, this is my favorite part, [39:22] the dog mayor. Every year we host [39:23] our annual dog mayor elections and [39:24] they are held via our youth council [39:25] instagram. Last year, we hope the [39:26] election [39:28] nominations which is basically [39:34] a form for anyone [39:35] wanting to run for dog mayor will [39:36] fill out a form with their information. [39:37] that was from may 1st to may 15th [39:38] and we had elections [39:40] from may 19 to 25th which is [39:43] basically count of her likes on [39:44] each candidate's post. Last year we [39:46] had six total participants in the winter was real [39:49] --reya, [39:52] a [39:55] 12-year-old pimple and she [40:01] won with 219 votes. [40:02] >> [40:03] we have a meeting tomorrow at public ups [40:04] were we will be taking a tour and [40:05] allowing our members to [40:09] experience these different areas that they [40:10] otherwise probably would never be [40:11] able to [40:12] experience, which is such a great [40:13] part about the council and [40:23] our second meeting, or our next meeting will [40:24] be at the one mooresville center for we [40:25] will continue to discuss our future [40:26] projects and volunteer [40:27] opportunities such as well was talking [40:28] about, the legacy project and [40:32] more about our volunteer opportunities. [40:33] we actually have one coming up this [40:34] saturday we will be [40:36] helping clean up the eastern heights community. Thank you. [40:50] >> I just want to talk about how the mooresville [40:51] youth council has influenced me as [40:52] a member. It's help me get out there [40:53] in the community [40:54] and take initiative. I have my own [40:56] programs with the library and it's helped me learn [40:57] what I want to do in my future and [40:58] helping me build [40:59] these public speaking skills and helping me [41:01] shape my skills as a leader. [41:06] >> the youth council helped me make [41:07] more friends and be more friendly [41:10] and [41:12] accepting to other people and going and [41:13] talking to other people. [41:24] >> youth council really just inspires [41:25] me to be my best self in any [41:28] way that I can, [41:29] and it inspires me to just be a leader [41:31] whenever I possibly can. [41:34] and I've just been [41:36] a big fan of the youth council for as [41:37] long as I've been here. [41:43] >> the mooresville youth council inspires [41:46] me by really showing how [41:57] the collaboration of teens from freshman [41:58] through senior can come together to [41:59] make [42:00] a huge impact on our town, especially [42:01] in the position that I am. I am able [42:02] to see how, with the [42:03] improvement of our communication , [42:04] team building skills, how that has [42:05] an impact on the success of our projects [42:06] and [42:07] events and I hope [42:09] that I can see this passion in teenagers continue [42:10] for years to come. [42:21] >> so, the mooresville youth counselor [42:22] has inspired me to have [42:23] a greater impact on the community [42:24] as a whole so being able to see all [42:25] of our ideas and new members [42:27] come together to create different [42:28] opportunities and different offenses just [42:29] amazing and seeing them [42:31] come to reality. The mooresville youth council inspires [43:03] me because it allows me to understand [43:04] and really immerse myself in the experiences [43:05] of our community, which [43:06] I think really brings us together [43:07] in a way beyond words and I would've [43:08] never gotten this close to the mooresville [43:09] community if it were not [43:10] for the mooresville youth council [43:11] and as a senior, I have done youth council [43:12] for all four years and I can say that [43:13] it has just shaped [43:14] me as a person, as everyone has mentioned. [43:15] volunteering, giving back to the community [43:16] and general leadership skills so as [43:17] a cornerstone of my high school experience [43:18] I hope to continue to inspire youth [43:19] to make mooresville a better place. [47:21] >> whereas breast cancer awareness month [47:22] is an international health campaign [47:23] in october, whereas there are more [47:24] than 4 million breast [47:26] cancer survivors in america [47:30] , that is a big number, and this year [47:31] alone, hundreds of thousands more [47:32] will be diagnosed and whereas all [47:33] scientists [47:34] have made significant breakthroughs [47:41] to prevent, detect and treat breast [47:42] cancer, the diagnosis is frightening [47:43] and overwhelming. Patients and families [47:45] are often flooded with complex medical information [47:50] . [47:52] they're forced to advocate for themselves, often [47:53] to receive the basic care, whereas [47:54] although breast cancer is more common in women [48:04] , it does affect men, as well, now [48:05] therefore be it resolved that the mayor, [48:06] board of commissioners do hereby proclaim october [48:07] 2024 as breast cancer awareness month [48:09] and encourage participation [48:10] and activities to support education, [48:11] support programs and the funding of research programs to [48:14] find a cure for breast [48:15] cancer this 21st day of october, 2024. A big push has been [59:32] made by our public safety department [59:35] , both mooresville fire rescue and [59:36] mooresville police department have spent [59:40] multiple days. [59:41] we have sent 21 different firemen [59:56] up to 14 days over there. We have [59:57] also sent three different teams of [59:58] mooresville pd to provide some security [59:59] for the supplies that have been [1:00:00] given and donated over there in western [1:00:01] north carolina and I know the photos there [1:00:03] give another small glimpse of the [1:00:04] catastrophic damage that occurred [1:00:05] over in western north carolina [1:00:06] and as details continue to float forward [1:00:13] about how these heroic individuals from [1:00:14] mooresville supported those over in [1:00:16] western north carolina we will be sure to share. [1:00:19] public education events . [1:00:22] literally last week [1:00:25] we had an event [1:00:29] literally every day. The one that [1:00:30] you see there, you will see three [1:00:31] different photos of the first baptist church. [1:00:35] both mooresville fire rescue and the [1:00:36] police department were there to speak with [1:00:42] preschool students, form relationships, [1:00:43] and let them know about what each [1:00:44] agency does and how they work together [1:00:46] to keep them safe. [1:00:54] I am always surprised at the number as [1:00:55] it continues to grow for our drug [1:00:56] takeback [1:00:58] event. Our next event [1:01:09] as you can see there on the left side [1:01:10] is this saturday from 10:00 to 2:00 [1:01:11] p.m. At cannon pharmacy. If you don't know [1:01:12] what that is that, it's in front of [1:01:13] the food lion on 150. The other thing [1:01:14] I wanted to make sure [1:01:16] I plugged on this [1:01:19] slide is that if you are not able [1:01:20] to make the cannon pharmacy, [1:01:21] the new police department does have [1:01:22] a dropbox and its lobby that can be [1:01:23] used by our community, and since 2012, [1:01:30] this is a number that continues to for [1:01:31] me, over 6 tons of prescription drugs [1:01:32] have been taken [1:01:34] back at these events, so what is service to our community [1:01:39] . Just ask an employee to take back those [1:01:40] unneeded prescription drugs if you [1:01:41] have [1:01:42] the chance this weekend. Next two slides [1:01:49] are going to talk about [1:01:50] some of the details of our trick-or-treat [1:01:51] downtown. Walker, [1:02:50] this week we are going to see milling [1:02:51] on institute, clover, underhill, cassie [1:02:52] elaine and jake's ridgeline's and [1:02:53] you'll see those workers from life [1:02:54] construction around town [1:02:56] and we are just thankful the board has supported us [1:03:01] in having such a robust overlay [1:03:02] project for this year. I just wanted [1:03:20] to take this time [1:03:23] as an opportunity to talk [1:03:24] about the scope of municipal authority. [1:03:25] this came up at the last board meeting [1:03:33] and the town gets a lot of questions [1:03:34] about the scope of municipal authority [1:03:35] and north carolina. I just want [1:03:36] to talk about that for a few minutes. Basically [1:03:43] north carolina is different from other [1:03:44] states [1:03:45] and it is important to understand [1:03:46] that north carolina cities and towns [1:03:47] are limited in what they can or can't [1:03:48] do based on regulations that are [1:03:50] adopted at the state level. [1:03:57] you hear terms put out, such as home [1:03:58] rule states in dylan's role states [1:03:59] and north carolina is somewhat of [1:04:01] a hybrid from that. Meaning that north carolina [1:04:03] municipalities are only granted authority [1:04:05] from the state legislature either through statute or [1:04:08] delectable rules. What [1:04:11] that means is that [1:04:18] what the town can or cannot do, that [1:04:19] is outlined by the state, so for instance, [1:04:20] impact fees. We [1:04:23] have no authority to [1:04:25] require developers to pay impact fees [1:04:26] and that comes from the state legislature [1:04:27] so I [1:04:29] just wanted to mention that [1:04:33] for the public. I think that is an [1:04:34] important piece for folks to understand, and [1:04:35] the services that we [1:04:36] provide is a town are granted by the state [1:04:40] , so counties have certain services that they provide [1:04:46] . Cities and towns have certain services [1:04:47] they provided there is overlap between [1:04:48] cities and counties, but I just wanted to [1:04:58] point that out for the public. [1:05:44] we [1:05:46] have item number 7a is a public hearing [1:05:52] , and I guess if you guys remember, [1:05:53] this is a request [1:05:56] for [1:05:59] the [1:06:01] approval of an ordinance for a conditional rezoning [1:06:02] request on the property located off [1:06:05] 165 [1:06:08] clodfelter road, 154 [1:06:11] clodfelter road, and [1:06:14] 816 shearers road. [1:06:22] there is actually no public comment. This [1:06:23] was the item that was continued, but [1:06:24] we do have something [1:06:25] from the applicant so at this time [1:06:26] of going to open the public hearing and [1:06:28] mr. Cole, could you start us off with [1:06:29] that, [1:06:32] please? [1:06:33] >> thank you, [1:06:34] mr. Mayor pro tem. The applicant is here [1:06:35] to speak a little bit more to the [1:06:36] topic [1:06:38] that was continued last meeting. [1:06:50] >> if you will all [1:06:51] bear with me I'm sorry, it's been [1:06:52] in and out for a few days. I will [1:06:53] try to speak as clearly and loudly [1:06:54] as possible [1:06:56] for as long as [1:06:58] possible. My name is sarah beeson, [1:07:00] 119 barber loop, mooresville north carolina. I hear [1:07:02] representing [1:07:08] magnetic homes [1:07:24] . To give a quick overview of what we [1:07:25] spoke about at the last meeting, the [1:07:26] project that is being proposed as [1:07:27] a conditional rezoning and [1:07:28] annexation is 180 family single-family [1:07:29] residences, that gives a density of [1:07:31] 2.87 dwelling units per acre. Which is far below [1:07:34] what could be in a traditional neighborhood of eight [1:07:35] units per acre and we have over [1:07:36] 16 acres of open space entry space [1:07:50] . One of the other commitments that [1:07:51] has [1:07:52] been made as part of this project [1:07:53] that would not be included with the [1:07:55] bayreuth project is the 20-foot greenway easement [1:07:56] in the 10-foot paved path being constructed [1:07:56] from [1:07:57] ridge avenue all the way along the [1:07:58] western property line. The request [1:07:59] at the end of the last hearing was [1:08:00] to go back and look at enhanced [1:08:01] buffering for the site with the [1:08:02] existing [1:08:05] residences off of shearers [1:08:08] road, in particular. [1:08:11] [ inaudible ] home reached out to [1:08:12] many of [1:08:14] those residents either bite [1:08:20] email, [1:08:21] phone call or in person. This is the [1:08:22] original site from the eight-foot [1:08:23] perimeter buffer shown. There is also [1:08:24] fencing [1:08:26] at the northern inference [1:08:29] --entrance off of shearers road. What [1:08:30] is being [1:08:32] proposed tonight is that [1:08:38] the fencing is [1:08:39] not only at the northern entrance but follows [1:08:40] the entirety of the eastern property [1:08:42] line across 22 parcels, and that would be within [1:08:42] the eight-foot buffer [1:08:44] and six-foot vinyl fence [1:08:47] , and that is a condition in [1:08:49] the revised plan, just to give a little bit more [1:08:55] quantitative ability to look at that [1:08:57] math and that separation. This provides anywhere from [1:09:05] 24 to 70 feet. This is between the building [1:09:06] lots where the homes [1:09:07] are actually going to be constructed [1:09:08] on, versus the existing residence [1:09:18] . That orange area, [1:09:19] and this is just a kind of make it [1:09:20] pop on the plan, that is all common [1:09:21] open space or treed area. None of that [1:09:22] is [1:09:24] proposed to be dwelling unit. [1:09:31] and so the requesting to be not only [1:09:32] visual separation but also physical [1:09:33] separation to address some of those [1:09:34] concerns as [1:09:35] far as ability for the residents of [1:09:36] the proposed community to come across [1:09:37] into the back of those residences [1:09:38] off of shearers and [1:09:39] clodfelter road. The 6 foot [1:09:42] fence seemed to best address [1:09:45] both of those concerns. [1:09:49] as part of that six-foot fencing condition, [1:09:52] we are noting that it would run temporarily [1:10:02] through the stub. There is a stub [1:10:03] proposed to the rear, one of the eastern [1:10:04] property lines [1:10:05] at 707 shearers, I believe, and so for [1:10:13] the duration until that connection if [1:10:14] ever needs to be made to any adjacent [1:10:15] development on that site, the [1:10:16] fencing would go through that stub just [1:10:17] to preserve the continuity of that buffer. [1:10:20] the other condition that was requested is regarding [1:10:29] clodfelter road itself. We initially noted [1:10:30] emergency access only after the udo. [1:10:31] the request was [1:10:33] to make that [1:10:38] no vehicular, no pedestrian connection [1:10:39] at all, and so the concept plan [1:10:40] has been revised to remove that connection to [1:10:42] clodfelter road and [1:10:45] expand the open active space area so no additional [1:10:54] lots were converted using that space. [1:10:55] the number of homes and lots remain [1:10:56] the same and there is an expressed condition [1:10:57] in the proposed packet that there [1:10:58] is [1:10:59] no vehicular pedestrian connection [1:11:00] allowed to [1:11:10] clodfelter. To summarize again, 187 [1:11:12] single-family detached homes. 2.87 density [1:11:16] , a 20-foot greenway easement that [1:11:18] would not otherwise be provided [1:11:26] , the significant savings of open space [1:11:27] entry space [1:11:28] around the entire perimeter of the property [1:11:30] provides a buffer to existing homes and residences. [1:11:30] staff [1:11:33] is recommended to approve [1:11:36] and [1:11:37] we have made those updates with the six-foot [1:11:38] vinyl fence along the eastern property [1:11:39] line [1:11:42] on the closing off of clodfelter [1:11:47] as requested so respectfully request [1:11:48] that with these additional [1:11:49] conditions the board approved this [1:11:51] project as presented. Right now [1:12:21] is the property stands , and what [1:12:23] the current zoning is, if it was not rezoned, [1:12:30] referencing my notes here, [1:12:42] the allowance would be like 131 houses. [1:12:45] >> [1:12:46] okay, so if we didn't do anything [1:12:47] they could build 131 houses, [1:12:48] they could have water and inactive plan [1:12:49] or whatever, there could be 131 [1:12:50] houses there. The builder would deal [1:12:51] with the [1:12:55] [ inaudible ] as they normally were [1:12:57] whether we were doing anything [1:12:59] or not. And they would not be required [1:13:00] to do any of this [1:13:03] additional screening, buffering [1:13:06] , nothing. [1:13:15] >> that is correct. >> thank you. This is jared whelan's who [1:13:54] did the one-on-one contact with the [1:13:55] phone [1:13:57] calls and in-person meetings and door knocks. So between [1:13:57] ji [1:14:00] s with public information , [1:14:03] we also because the town sends out the colors for [1:14:21] anyone within half a mile for [1:14:22] hearing notices, we listed townhomes. [1:14:23] they give us phone numbers for anyone [1:14:24] we didn't have that information from [1:14:25] the community meeting report. We had [1:14:26] a number [1:14:27] of phone numbers and email addresses [1:14:28] but by far we did not have everybody, [1:14:29] so between using the public records, [1:14:30] calling erika [1:14:31] and stefan her helping [1:14:39] us get more phone calls, mainly jerry put [1:14:40] in some phone calls to all those residents [1:14:41] in trying to set up either speaking [1:14:42] with them over the phone or meeting [1:14:43] physically on the property with the house, [1:14:53] howard can go into additional details. [1:14:54] >> good evening. I think there were [1:14:55] about 19 [1:14:56] or 20 different residents we reached [1:14:57] out to in totality and I think we [1:14:58] got to about 14 or so of those. There [1:14:59] were several that [1:15:00] did not return any of the phone calls [1:15:04] . I think there were three [1:15:05] or four of those so I think we got [1:15:07] to the majority of the ones that corresponded with us. [1:15:08] some ask for phone conversations and sharing [1:15:21] of our plan for the buffer on the [1:15:22] fencing [1:15:23] and what type was it, so it was a [1:15:24] pretty thorough conversation over the phone, [1:15:25] so then I finished it up with what time [1:15:26] would you like to [1:15:27] meet out there and I can walk your property [1:15:28] because one of the things I wanted [1:15:29] to make sure that they knew [1:15:30] is that orange perimeter that was [1:15:31] shown on the map [1:15:35] that they knew there was distance [1:15:36] between their property and that there was [1:15:37] hoa-maintained common open [1:15:40] space that would remain [1:15:41] and that where the fence wood et cetera, [1:15:43] just walk it with them. [1:15:50] probably half of those accepted an [1:15:51] invitation to meet at their house, [1:15:52] so I guess that somewhere [1:15:53] around six or seven of those I met with and [1:15:57] we did the walk it in the tape measure [1:15:58] type program [1:16:01] and walked through [1:16:08] and spoke of what her plans were, [1:16:09] when that would happen, the sequencing. It's [1:16:10] a couple years now [1:16:11] before the fence would even show up [1:16:13] but overwhelmingly, the concern was the visual block [1:16:16] , the not having [1:16:19] kids walk through blocking off [1:16:22] clodfelter and just having [1:16:23] that separation and privacy really [1:16:24] was a concern and felt like the fence was [1:16:28] our best offer. Likewise looking back from the original to this one, [1:16:46] there was [1:16:49] a six-foot privacy fence [1:16:52] and the initial one [1:16:54] to begin with so I'm not sure I understand [1:17:05] when we said go use the additional [1:17:06] money to enhance the buffering I was [1:17:07] thinking maybe shrubs or something [1:17:08] or [1:17:09] trees on the other side of that fence. [1:17:14] or a berm, or something, so not really [1:17:15] --I'm a little confused since the [1:17:16] fence was already in existence, you [1:17:19] added how many feet [1:17:27] is what I'm hearing. How many feet [1:17:28] did you add to that? [1:17:29] >> I think we have [1:17:30] an image [1:17:31] we can show you before and after. [1:17:32] that when that is up there right now [1:17:33] would be the before. That is just the entrance [1:17:35] there at the northern part. [1:29:26] it is also located in a critical watershed [1:29:30] which caps the site [1:29:35] and impervious areas so tonight the [1:29:36] applicant is requesting conditional mixed-use [1:29:37] zoning [1:29:38] so just for context conditional zoning [1:29:39] is required because they are proposing [1:29:40] a [1:29:42] drive-through on the site. [1:29:47] this is in front of the food lion [1:29:48] which is part of the watermark shopping [1:29:49] center so [1:29:50] it is adjacent to a bank, a gas station [1:29:51] and an arby's restaurant. [1:29:56] here's the proposal. It is for a 2500 [1:29:57] ft.? Drive-through restaurant and [1:30:14] it would, because it constitutes development [1:30:15] of an existing out parcel, it was [1:30:16] sure the existing shopping center [1:30:17] access, which is located here along [1:30:18] bridgewater lane, just for reference [1:30:19] also, this is williamson road, which [1:30:20] runs north to south. [1:30:21] the development would orient the building [1:30:22] to bridgewater lane with a drive-through [1:30:23] stacking area plan. The development [1:30:24] would also [1:30:27] provide the frontage upgrades [1:30:29] as required by the udo including a shared use [1:30:33] paths along williamson road. [1:30:40] so here just to orient you all it [1:30:41] is a starbucks that is proposed here [1:30:42] currently adjacent to the abc store [1:30:44] over across bridgewater lane and some retail uses. [1:31:02] so, the conditions associated with [1:31:03] the site currently there are four. That [1:31:04] would be adherence to the [1:31:05] concept plan you see here, a series [1:31:06] of use restrictions which would narrow [1:31:07] uses to the drive-through restaurant [1:31:08] and potentially compatible uses should [1:31:09] the user change [1:31:10] in the future, medications if required [1:31:12] for the change of use and also a density averaging [1:31:12] certificate which is a little unique and [1:31:13] I'm happy to explain it further. [1:31:18] these are the uses that are currently allowed [1:31:19] on the site [1:31:20] in the bayreuth cm district so this [1:31:21] is a pretty broad retail commercial district. [1:31:24] these [1:31:27] would all be use restrictions so [1:31:32] should this request past tonight there [1:31:33] would only be a few that would be allowed, [1:31:34] drive-through restaurant of course [1:31:36] being one of them. [1:31:38] with density averaging, the site is here [1:31:42] , this gold star [1:31:45] . Currently the [1:31:47] site is proposing 70% impervious area which is above [1:32:00] the cap of 50% in the critical watershed so [1:32:01] the applicant, one of [1:32:02] the four conditions is that before they [1:32:04] can develop the site, they are required [1:32:04] to seek a density-averaging certificate [1:32:05] from the board of [1:32:06] adjustment that would allow [1:32:09] transfer of [1:32:10] that additional 20% impervious area [1:32:11] from one of the sites across williamson [1:32:12] road to the subject property. That is [1:32:13] something that is a process [1:32:14] allowed by the state and should the [1:32:16] request be approved tonight, [1:32:17] they would be required to have that issue. [1:32:23] because this is a conditional request [1:32:25] there was a [1:32:26] neighborhood meeting required held [1:32:30] that was a virtual meeting and advertise to [1:32:34] adjacent [1:32:37] property owners. [1:32:43] we would consider this [1:32:51] consistent with our standards. There [1:32:52] is only one small inconsistency with [1:32:53] one [1:32:54] mooresville. One mooresville considers [1:32:56] this area mixed-use corridor and commercial character. [1:33:21] however, it is worth noting there [1:33:22] are other drive-through uses adjacent [1:33:23] to the site [1:33:24] already. We do recommend approval of the request. A lot of landscaping along [1:35:44] the front, too as well as pedestrian way.
