Um, [7:21] they they have to use essentially what the way the levy is it or the ballot is [7:26] written, um, they have to essentially continue with the core of the Lisbon [7:31] Monclova EMS. Um, however, if restructuring needs to [7:34] occur to better manage, um, that is an option that the trustees and our board [7:38] can work through. Um, [7:40] but the the trustees will kind of have oversight on how that's operated um and [7:45] tied to the tax funding. >> If nobody has written in or fewer than [7:49] three people have written in, then they'll be appointed. See [34:41] if it See if the the [34:43] the legislature would come up with something state wide. Obviously nothing [34:47] happened to that so that's why we're having this discussion again. So I've had a [35:24] couple of experiences with this. I'm not an e-bike owner. I think they're really [35:28] cool. Um but on more than one occasion, I'm an [35:32] avid walker in my neighborhood and also with the various trails that we have, [35:37] which I usually refer to as walking trails. Though I do understand that [35:41] they're available for bikes and such. But on more than one occasion, [35:47] partly due to the very quiet nature of e-bikes and also [35:53] amazing speed that at times I was just surprised that [35:57] oh, they're allowed to go that fast and in what is considered in my mind more of [36:04] a public walking area. Fortunately, there was [36:08] the last time that I remember and was it was on a tri- [36:13] on a trail and it just came out of the blue. I [36:17] mean, I was I typically don't have earbuds in. I [36:21] mean, I'm aware of what's around me and it came so fast [36:26] and I I I barely knew that he was behind me. [36:31] There was no accident, but had I stepped, you know, to the right just a [36:36] little bit, or if I had just stumbled over something, [36:40] it could have been a serious accident. [36:44] And um after he had passed, I thought, well, [36:50] wouldn't it be kind of common courtesy that maybe they would ring a bell or [36:54] something. I don't know what that is. I got a bike myself, so I don't know. [36:58] But um I felt like yelling at him, but I [37:00] thought, well, that was no point, cuz he was already down the road, so why [37:04] bother? So, I just bring that example up. [37:08] Um I think e-bikes are really cool. They're really popular. I would like to [37:12] point out the two times that I had an experience like this, I'm not pointing [37:17] to teenagers. Both times, these were adult [37:21] males that should have known better, that should have been thinking, "Oh, [37:25] there's that woman up there. Looks like she's got gray hair. Maybe I should honk [37:29] my horn." But um it concerned me, and I just it [37:33] did make me wonder, aren't there some rules about that out [37:36] there? If you're walking on a public sidewalk, if you're on a trail, [37:40] how much Well, [37:44] how much guidance do e-bike owners maybe need so they're being safe with [37:48] pedestrians? Thank you very much. [37:51] » Thank you. Thank you. Thank you. Thank you. [37:53] » Cindy >> First of all, I am an e-bike [37:57] and avid e-bike rider owner. Uh have been for several years. And to [38:03] your point, um we [38:07] the the biking community in general, not just e-bikes, [38:11] but there's a uh [38:14] on the trails, there are [38:19] not laws or ordinances guiding us. So, [38:25] there's a sort of [38:29] pattern that we use, that we learn, that's common among the community. And [38:34] as we see newer riders of both normal bikes, e-bikes, [38:40] the scooters are becoming very popular on the trails. [38:46] Walkers with earbuds can be a problem because even when the biker is [38:52] doing everything they can, [38:56] you know, if if I were out walking with my earbuds [39:01] in, I may not hear somebody coming because of the way I like my music. But [39:07] So, typically as a rider comes from the rear, [39:12] the rider is expected to announce their approach in some way. [39:18] Generally, because we pass on the on the left side, because the rider's riding on [39:25] the right side, we would say on your left. [39:29] Loud enough and a far enough distance to to let the the walker or the biker know. [39:35] Some people do use bells. You know, the old bicycle bells. [39:41] Those aren't as common. It's much easier just to announce yourself in a friendly [39:46] manner. And and that generally works. I also [39:50] just recently had the opportunity to do [39:55] eight days in Europe riding bikes, which included both trails and city streets. [40:01] And I will tell you that the bike culture in Europe is much better than [40:05] the bike culture in the US. Because here we also have motorists who [40:11] have no real concern. They don't think that [40:16] bicyclists have equal uh [40:20] to the to the spaces. But by law we do and that those laws [40:26] have been in place for years. So when I saw this on the agenda I was [40:31] extremely pleased because currently [40:38] there are young people that are riding these with [40:43] reckless abandon. I probably would have been one of those [40:48] at 12, 13 years old but we can educate. So part of this is also [40:55] going to need to be educated. Ironically I was just talking to one of the parking [41:00] lot board members [41:04] last week that perhaps it's time to go back to our trails [41:10] plan and look at okay which streets were designated to be trails and is it time [41:17] to look at painting bike lanes. [41:24] On the Lisbon Road as you ride into Lisbon there's a sign share the road [41:30] with a bicycle. So I think this is a very timely discussion. [41:35] I'd also like to say that after reading through the [41:41] sample. Thank you Chris for this because I was struggling with [41:46] what is out there and it's nice to see one. [41:50] What a lot of people don't realize is there are [41:55] different levels of e-bikes and I think it's important [42:00] that we understand those. So a level one e-bike is a bike that you can turn on [42:07] the power is on but it doesn't [42:10] have any power to the pedals unless you [42:18] click a button to make it say, "Okay, I want extra power." It's called pedal [42:23] assist. So, without that, you're just riding a [42:27] regular bike. With pedal assist, it allows you to pedal, [42:32] helps uh old people like me ride a bike, which maybe we couldn't do as off or as [42:38] uh long as we had wanted to. Um the restriction on a level one bike, [42:45] which is the pedal assist, or one with an a throttle, so it does pedal a bit [42:51] assist, or you can use a throttle. I like the throttle in the cases where I'm [42:57] trying to cross one of the streets in Marion, [43:01] and make sure I get out of the way as quickly as possible. Um [43:06] but a a level one bike is maximum 20 mph [43:13] with a throttle. Now, if you're going downhill not using your throttle, [43:17] obviously you can get faster than that. Um [43:21] but that would be a level one. A level two, [43:25] the power can take you up to 28 mph. A level three, in my view, [43:32] becomes an electric motorcycle and can be powered over 28 mph. [43:40] And it is only limited by the size of motor, power, etc. that goes into that. [43:47] One of the things as I looked at the uh sample ordinance is that the ordinance [43:53] doesn't discuss the different levels at all, and [43:58] I think that's an important thing. Because as a rider out on the trail, uh [44:05] many people have the e-bikes because they want to extend their ability to [44:10] ride. They may have knee problems, issues like that, where they couldn't [44:15] ride a bicycle without the pedal assist. Um and then [44:21] you have those people that have it because it's fast. [44:25] And they don't have to pedal. Um and those are the people that we need [44:30] to, you know, work with. >> Well, my experience is just FYI, I rode [44:35] two fast dudes. >> Mhm. [44:38] » That [clears throat] was my experience. >> So, [44:42] that's just from a user's expe- uh experience as well as an observer, [44:48] uh Second Avenue North tends to be a very interesting place [44:54] afternoons with kids uh coming and going from the pool. [44:58] » My knowledge has been a topic of discussion at the Public Works [45:01] Department. Um as you guys all know, we're around town [45:03] all over the place. Um more specifically, the younger generation, um [45:10] I guess I'll start with uh [45:13] » [clears throat] >> we've all witnessed [45:15] younger kids on these uh e-scooters and e-bikes. Um [45:18] they come to an intersection and they just blow through the stop sign. Um [45:23] they're hard to see uh and they're young kids. [45:28] More importantly, we found them running around on the ball diamonds quite a bit. [45:33] Which is a real pain in the butt for us, but um [45:36] » And multiple riders. >> Yes. [45:38] » On scooters and bikes. >> Uh since this is a dis- discussion, um [45:44] keep it very brief. I am for [45:47] moving forward and having an ordinance written up that would be specific to [45:52] Mount Vernon. The Bellevue example is great. I love [45:56] the the class you have to take in here if [46:00] you're under the age of 14 with the learner's permit, and so on. [46:04] Enforcement will be a drag. >> Mhm. [46:06] » I mean, I understand that. >> And sometimes it's symbolic enforcement, [46:10] [clears throat] but [46:12] uh having an ordinance is a start. [46:15] » Yes. Who would do this, by the way, Chris? As far as it or as it relates to bike [46:45] trails, there's we have to be careful [46:49] um [46:51] on any ordinance that would restrict these on those. There's Supreme Court [46:57] cases that relates to accessibility um and use of the trail system, so that [47:03] goes back to motorized wheelchairs and all of that, so [47:07] um yeah, we would likely turn this one over [47:10] to the attorney just just because there have been court cases on all of this. [47:16] Um one of the challenges that we have um [47:20] or one of the things that I like about the building ordinances that um [47:24] they do restrict in certain sections of the community [47:29] um and certain streets. So, the the challenge with probably 80% or 90% of [47:35] the Malvern roads is that they're two-lane streets with a dedicated bike [47:39] lane. >> Mhm. [47:40] » Um they typically come with no parking on [47:44] one side or the other, so the the reality is is [47:49] I think looking at potentially restricting certain streets or certain [47:53] sec- sections of the community might be um [47:57] I'm not compliment, but really this being added to the discussion I think [48:01] was just before we engage and spend money with the attorney is I wanted to [48:05] make sure that there was opportunity to counsel to [48:08] at least consider and potentially go through the process. [48:11] » Yes. >> I I similar to [48:15] a couple of statements that it was apropos that this came up because [48:20] early last last week Monday Tuesday whatever it was [48:23] um I'm leaving to go to work at [48:26] 9:00 9:30 in the morning and I'm on um I'm on the main road and there's a kid [48:31] who's maybe eight I don't know in front of us on an e-bike and there's [48:38] six or eight of us I mean there was a a virtual traffic jam on Main Street and [48:44] and he's right in the middle of the road just turning up town as it you know you [48:47] get past the PMP there and I and he was this high off the ground and and and at [48:53] least he had a helmet on and you know I mean there is doing something's right [48:55] but it just um [48:57] we're getting some control over them who's riding where they're riding and [49:01] how they're equipped what their visibility is like and the education and [49:05] the helmets and the flags just it isn't just you can ride here or there [49:11] other parts of this that I really appreciate so [49:13] » Are we aiming to like any are we thinking about along the lines of the [49:18] same streets that are off limits to golf carts? [49:22] » Expanding on that >> I think that I mean that's what I'm [49:25] saying >> It you could for ease but [49:29] that will ultimately be up to you. We'll we will give you a base [49:33] with recommendations and then the council can decide from there if they [49:37] want to expand or contract um from the base. [49:40] » And certainly before it comes to us um however long it takes [49:45] to have everyone over this side of the table [49:48] weigh in >> Absolutely. I was working in [51:06] Independence today and I had two young boys that were on e-scooters [51:12] and they had looked both ways. They were just crossing this really busy [51:17] street not in a crosswalk and they had looked both ways but they [51:21] didn't look to see a car was coming towards them me and we easily could have [51:27] collided into each other cuz they were just full on going straight like oh no [51:31] one's coming this way and they just came at me. [51:33] And and then I come home and start reading [51:37] the notes I'm like I'm so glad we're discussing this because [laughter] I [51:40] almost hit two young boys today but they didn't even think to look ahead [51:46] of them. They were only concerned about the cars coming out either side. This is to [54:20] you know, what does economic development look for us look like for us versus [54:23] Cedar Rapids and Iowa and so on. So, [54:27] hopefully you can come for that meeting on Wednesday night [54:30] 5:00 at Ely. And the third thing is the next meeting [54:34] of money kind of heads-up right now. At this point, the next meeting with [54:38] regular meeting with the I would [54:40] I would be a team that's going to be hopefully here to talk to or see if [54:44] there are any comments from the 100 uh homeowners who are [54:49] bordering Highway 1 through town for this uh [54:52] DOT project that we're doing next couple summers. Um [56:44] the city only notified people who had 7th Street addresses and not all the [56:50] people who had land along there, and there were very few people [56:55] that got notified, but it affected a lot of people, and um [57:00] and a lot of people who just live like one house up [57:04] from 7th Street. And so, um it took a lot of us by surprise that it [57:09] was all happening because so few people got notified. And so, I just want to [57:14] avoid a repeat of that. I think a lot of the town is aware that Highway 1 is just [57:19] going to happen, but I just hope that like [57:24] all the people who have land along Highway 1 will be let [57:29] know, because my water got turned off so many times during that. But technically, [57:33] I don't have a 7th Street address, but I was affected so many times during [57:38] that construction. >> I think this is where some of the [57:42] crossover will be. Um [57:46] Being a DOT driven project, you will be subject to what it is they [57:52] plan to do. That does not mean that the city, once [57:56] we We haven't sent anything out because we [57:58] don't have a definitive Right. If it comes the 17th, and we have something [58:02] that we could send out. That doesn't prevent the city [58:06] from sending out notifications, cuz you are correct. [58:09] Those that have driveway access to Highway 1 are not likely going to be [58:13] accessing their driveway during the construction process. So, [58:16] uh it will affect the side streets with parking and things like that. So, um it [58:21] won't prevent us from doing something similar. [58:24] Um I'm thankful, obviously, that they're [58:27] coming in August. They're not bidding the project in November. So, we we're [58:31] probably a full 8 to 9 months away from them [58:36] starting construction. Uh so, we have time to do that. [58:41] » Right. And And with 7th Street, the 8 months before, they were only talking to [58:46] those few people on 7th Street. And then, when it was [58:51] like 1 month out, then word finally got to the rest of us. [58:56] » No, I can assure you the DOT is only going to notify [59:00] those that it generally affects. Okay.
