And 2, 3, 8, age. [3:34] 35 south and this e 3 [3:38] commercial district. Colton [3:41] the floor, Thank you, MISTER [3:41] Chair and Good evening. [3:42] Commissioners School to Barker [3:43] with the brothels neighborhood [3:46] community planning. [3:47] >> The first item this evening [3:48] is an appeal to the city's [3:50] building design standards, [3:50] particularly as they relate to [3:52] or is on office and [3:54] articulation for proposed [3:55] dealership redevelopment [3:59] along. I-35. This is the first [3:59] appeal of this type to come [4:00] before the planning commission [4:02] since the 2021 zoning Code [4:02] amendments signed this review [4:07] authority. Salute also mean a [4:11] little the subject property [4:13] this evening is just under 5 [4:15] acres France. The ice. 35 [4:16] access road as well as McCain [4:20] Mcqueeney Road to the East. [4:21] >> The property is located [4:23] within Lucy, 3 commercial [4:25] district adjacent properties [4:26] on the Southside of 35 are [4:26] also see 3 in commercially [4:30] developed. No zoning changes [4:31] or land use modifications are [4:35] associated with this request. [4:36] These photos show the current [4:38] site conditions. The applicant [4:40] intends to demolish the vacant [4:41] dealership building and [4:42] redevelop the property with a [4:43] new dealership and continue [4:46] its established use. The [4:48] request before you is limited [4:50] to a single building design [4:51] element and does not affect [4:51] any other site development [4:52] standards that the development [4:54] is required. As a few more [5:01] slides here. Of the property. [5:02] Under the city's [5:03] non-residential design [5:04] standards, large commercial [5:05] buildings must include among [5:06] other elements, horizontal [5:09] facade, articulation These are [5:10] perpendicular offsets intended [5:12] to reduce long, flat exterior [5:13] walls and introduce a visual [5:16] interest in building design. [5:17] The ordinance establishes 3 [5:17] main requirements when it [5:18] comes to horizontally. [5:21] Articulation. There's a [5:22] maximum distance, a walk and [5:23] run before an offset is [5:25] required. Each offset must be [5:26] at least a certain death based [5:29] on the building's height. Off [5:30] said let's run a minimum [5:31] length along the facade based [5:34] on the total facade length. [5:35] These requirements are adopted [5:36] by the city to help prevent [5:38] overly monolithic commercial [5:40] structures and to reinforce [5:40] appealing building designed [5:46] for the community. This [5:46] elevation provided by the [5:48] applicant shows the codes [5:49] required offset depth at the [5:49] top and the proposed depth at [5:53] the bottom. The building needs [5:54] the spacing in length [5:54] standards, but the offset [5:58] depth is less than required. [6:00] It's like math on this one. [6:02] But the slide summarizes how [6:04] the proposed showroom facade [6:04] compares to the articulation [6:05] standards listed in the [6:08] ordinance. Both the maximum [6:09] distance between offsets and [6:10] the minimum offset length, [6:14] comply with the code. The [6:15] applicant provides offsets at [6:15] the appropriate intervals and [6:16] each off said is long enough [6:17] to meet the required [6:19] percentage. The only standard [6:20] that does not comply as the [6:23] minimum offset depth. The [6:24] ordinance requires an offset [6:25] death based on 15% of the [6:27] buildings. Average height. [6:28] Well, the proposed design [6:31] provides a shallower depth. [6:33] This appeal solely focuses on [6:35] the difference in that death [6:36] and all of the year to [6:37] collection requirements are [6:42] meeting their standards. Staff [6:42] is recommending approval of [6:44] the appeal to allow an offset [6:45] depth of one foot, 6 inches in [6:46] place of the required 3 foot, [6:48] 3 inches. The project appears [6:52] to me all other articulation [6:52] standards and the reduced [6:53] still supports the ordinance [6:54] is a 10 intend and the [6:58] dealerships brand design. In [7:00] the context of I-35 the [7:00] shallower offset does not [7:01] appear to affect the [7:04] building's visual character. [7:05] The request concerns only [7:06] offset death and appears to [7:06] have little to no impacts on [7:09] the adjacent properties. I'm [7:10] happy to answer any questions [7:12] you MAY have for staff and I [7:13] believe MR. Started in his [7:14] design team are here. If you [7:15] have any questions for them as [7:15] well. Any questions [7:20] commission? [7:21] >> I'm just curious with the [7:25] in-depth. Co that you all have [7:26] the ordinance right now is or [7:29] reason why they all have that [7:30] particular deaths. [7:31] >> I believe that peace was [7:33] adopted back some of the [7:34] bigger box stores were coming [7:35] into town. And so that was [7:36] adopted by the city council at [7:40] that time to kind of offset. [7:41] MAY have come in as a big, [7:45] flat building just as an [7:46] attempt to mix it up a little [7:47] bit and have some visual [7:50] variance and use those big [7:50] buildings. [7:51] >> With this request with the [7:52] variants are having all [7:57] consider re. Looking at that [7:57] again? [7:58] >> Yes, ma'am. Yeah. Believe [7:59] we're looking at that as a [8:01] part of the lbo project there. [8:01] We're incorporating those [8:03] building design elements into [8:05] those to be a little bit more [8:05] flexible with business [8:06] partners. Okay. Thank you. [8:09] It's me. [8:12] >> In this kind of situation, [8:14] does deviation does it [8:15] attached to the project [8:17] attached to the property. [8:22] There's a good question. It's [8:22] the building just to build [8:23] Jose living. So if this got [8:27] sold next week, this deviation [8:28] is applied. And correct. Okay, [8:29] Yeah, it would be just for [8:30] what's being requested on this [8:31] particular building for this [8:31] particular project. Okay. [8:37] Thank you, sir. If you In [8:41] other words, it. [8:41] >> Would still apply if they [8:43] keep the building when it sold [8:45] and if they tore down the back [8:51] to the original correct. [8:52] >> And just to clarify, this [8:53] is not a zoning change in any [8:54] way. That's correct. [9:01] >> It's been. Thank you [9:01] >> applicant is here would [9:10] like to speak. They do your [9:13] name and weather is in West [9:14] entered resident representing [9:17] Kaylee going prizes Bluebonnet [9:18] swing we agree with the [9:20] staff's position. Thank you. [9:24] On this picture. What [9:26] Volkswagen is requiring is [9:27] what they call the white [9:27] frame. That is around the [9:29] entrance. One of them says [9:30] Bluebonnet on at the other [9:32] one. You see a Volkswagen [9:36] insignia and they pre [9:37] fabricate these. So this isn't [9:38] our design. It's the design of [9:39] Volkswagen nationwide saying [9:40] here's what we want the front [9:43] white frame to be behind the [9:45] white frame is glass. So it [9:46] has that depth perception [9:47] because you're going to see [9:48] right through into the [9:51] building. So even though it's [9:53] one feet, 9 inches instead the [9:55] required 3 feet, 3 inches. [9:56] It's going to feel like it's a [9:57] lot deeper because it's all [9:59] glass behind it. And so we're [10:00] just advocating for that. The [10:02] rest of the building, which is [10:04] to my left up there, the gray [10:05] portion has articulation. [10:07] That's the shop. We really [10:09] don't want to tear down our [10:11] existing Jeep story. We think [10:12] it's beautiful but full so I [10:14] can will not let issues that I [10:14] say. If you want the franchise [10:15] in New Braunfels, you have to [10:18] build this white frame. Look, [10:19] and we're going to provide [10:20] with you. It's not our [10:22] architect to design. Did its [10:23] pulse wagon. They're [10:24] corporation saying this is [10:25] what it has to be. So that's [10:27] when we come to this space. Be [10:30] happy to answer any questions. [10:34] Commissioners, any questions? [10:34] >> What's the timeline on this [10:40] project? [10:41] >> Well, we're just waiting [10:42] for see permitting right we're [10:44] all so it ready for us to go [10:46] and they take We're ready to [10:50] go. Okay. Yeah. [10:53] >> Just as the comment seems [10:54] like like you pointing out [10:55] that the glass next [10:57] articulation. The reason for [11:00] that articulation kind of [11:01] knowledge void because you've [11:05] got plenty of. Break up in [11:06] Last night and the design [11:20] itself. [11:25] Yet not to buy to be [11:28] the top on. I don't know, [11:29] Sean, if he's the architect so [11:30] he can tell you that my [11:36] expectation is it's that Good [11:36] evening. My name shall well as [11:38] with backing architecture, I [11:40] do resident Braunfels. [11:43] >> What you see the top [11:44] elevation there. The shop [11:45] side. The great piece with the [11:46] couple bought about that's [11:49] what that will be. But then [11:50] the showroom piece on the [11:51] bottom with the green will be [11:52] is what we're proposing for [11:53] the show. So it kind of going [11:57] to be competition. Both that [11:57] makes. [11:58] >> So no articulation on the [12:00] gray Raj portion saying I'm [12:05] sorry. Which recommending is [12:09] that long. Gray area does not [12:09] have articulation. [12:11] >> No, we are going to add [12:11] articulation to the long gray [12:13] area as a shoal in the top. O [12:19] ur. We yes. You want to [12:24] clarify what? [12:24] >> Yeah. As I'm hearing it [12:25] sounds like when we made this [12:29] exhibit to articulate does. [12:31] Horizontal articulation, [12:31] perhaps they got a little [12:32] mixed in these 2 exhibits. But [12:34] what I'm hearing is that the [12:37] gray portion of top reflects [12:37] accurately and the white [12:38] portion on the bottom reflects [12:49] accurately. That's great. [12:51] >> He that this is a public [12:52] hearing. Anyone late to come [12:58] forward and speak for anyone [12:59] like to come forward and [13:03] speaking in says? Seeing none. [13:03] We'll close the public airing [13:05] commissioners. Any discussion [13:10] or [13:10] >> I make a motion to approve [13:15] second. Motion and second. [13:16] >> All in favor. Aye. All [13:28] opposed. Motion carries. [13:31] >> It's up to 6 dash, 2, 5, 6, [13:32] Public hearing and [13:36] recommendation to City Council [13:36] requested by communities are [13:39] operating limited partnership. [13:41] On behalf of sons, Silver Star [13:45] llc. The be a son retreats, [13:49] Texas Hill country to rezone [13:52] approximately 11.4, 4 acres. From c 3 commercial [14:03] district, 2 c 3 commercial [14:06] district special use overlay [14:08] to allow manufactured homes [14:10] currently utterance that one [14:15] for one Mary the [14:17] >> Good evening, chair and [14:17] commissioners, Mary level with [14:20] neighborhood in community [14:21] planning the subject. Property [14:24] consists of approximately 11.4 [14:25] 4 acres located along the east [14:29] side of Wrigley Road, roughly [14:29] one quarter mile from the [14:36] interstate. Surrounding zoning [14:38] districts include apd him to a [14:42] mu bc 3 c one bn are too. And [14:43] that's a mixture of commercial [14:46] industrial and agricultural [14:47] development. And it also has a [14:48] mixture of residential [14:50] commercial and undeveloped [14:52] parcels for the land uses that [14:54] are surrounding it. The [14:55] current use of the property is [14:57] an rv park manufactured homes [15:02] were. Previously allowed with [15:07] nbc 3 district and until 2012 [15:09] when an amendment code [15:10] amendment removed. [15:11] >> The allowance of [15:14] manufactured homes from to see [15:16] 3 district earlier this year [15:16] when the applicant was in the [15:19] process of permitting and [15:21] locating the 10, 10 new mobile [15:22] homes. Excuse me, manufactured [15:26] homes on the lot. City staff [15:27] notified the applicant that [15:28] the men you've actually homes [15:33] were not allowed anymore. And [15:34] they have lost their non [15:37] conformed legal nonconforming [15:38] use because the previous units [15:41] were removed. And it had been [15:46] longer than 12 months. To [15:47] retain the units and proceed [15:48] with permitting. The applicant [15:51] is now seeking a rezoning to [15:56] see 3 s up with a special use [15:57] overlay to allow manufactured [15:58] homes on the property which [15:59] would maintain the uses [16:00] currently allowed under the [16:05] Sea. 3 zoning and also at that [16:06] one use of manufactured homes [16:10] as an additional approved use. [16:13] Approval of this rezoning [16:14] request would legalize the [16:15] manufactured homes that have [16:18] been recently placed on the [16:19] property and allow their [16:22] continued permitting. A denial [16:23] of the request would require [16:23] the removal of the [16:28] manufactured homes. The [16:29] request would not be [16:31] consistent with following [16:35] actions of Envision New [16:36] Braunfels Action. 1.5, which [16:38] is promote economic centers by [16:41] ensuring adequate parking for [16:44] people visiting businesses, [16:46] restaurants and shops action. [16:47] 1.8 is to concentrate future [16:49] investment in industry and [16:53] employment centers along the [16:54] I-35 corridor and action. 1.1 [16:58] 1, which is you know, update [16:59] our policy in codes to achieve [17:01] development patterns of this [17:05] plant. Goal of plan and also [17:06] balance commercial centers [17:10] with stable neighborhoods. On [17:11] the other hand, the request [17:12] would be consistent with many [17:16] of the housing supportive [17:17] actions in Envision New [17:18] Braunfels. And I've listen up. [17:26] You here on this on the slide. [17:30] Staff recommends denial [17:31] envision New Braunfels [17:33] emphasize the emphasizes [17:34] preserving commercial uses [17:35] within the c 3 zoning District [17:37] and commission commercial [17:39] corridors. If the commission [17:40] is inclined to approve the [17:43] rezoning staff does recommend [17:44] a few conditions that are in [17:46] the staff report. Couldn't [17:49] read them here. A maximum of [17:50] 10 manufactured homes allowed [17:52] on the property, a screening [17:53] would be required along any [17:57] street frontage. And all homes [17:58] must comply with Appendix b, [17:59] which it are some code [18:00] regulations and development [18:02] standards for I'm a veteran [18:07] home communities. Public note [18:09] of notification included [18:11] mailing notices to 19 property [18:12] owners and staff received 3 [18:15] responses and paper which [18:16] comprised 58% of the [18:17] notification area. And there [18:21] were of these response carts, [18:24] it back in opposition. A super [18:26] majority vote is not required [18:28] for approval. A petition was [18:29] email to staff after the [18:32] agenda was posted that did not [18:35] have any property owners [18:36] addresses. Therefore, it was [18:36] unclear if any of those [18:38] individual signing or [18:40] digitally signing that [18:42] petition. We're within this [18:42] 200 that notification buffer [18:46] area. Thus in staff's [18:47] presentation. And I'm here to [18:49] answer any questions you MAY [18:50] have for staff and the [18:51] applicant is here, too. Make a [18:55] presentation. I got a quick [18:55] question. [18:59] >> When your notification that [19:01] you see 2 of 5, they were they [19:02] were in favor of this tomb, [19:04] those property. It is the [19:05] applicant's, the owner of the [19:10] property. Thank you. [19:12] >> What was the notification [19:13] that you received without the [19:17] addresses and names of people? [19:18] >> It was e-mailed to the [19:19] planning commissioners. And I [19:23] have a copy of it here. It's [19:25] it's a Something called a jot [19:27] for and maybe something that [19:28] gets sent out to various email [19:28] addresses. And then if [19:31] somebody wants to. Acknowledge [19:35] there, you know, decision they [19:38] respond and it just has names [19:39] and emails. [19:41] >> With that sent and he was [19:46] sent to Yes, in email. But it [19:48] wasn't written from anybody It [19:54] has p a it has names on it. I [19:57] think I counted about 101 or 2 [19:57] names in opposition of it in [20:01] opposition. [20:02] >> So I think you names and [20:04] emails on there. But he said [20:05] there was no physical address. [20:07] We can verify that they within [20:08] the notification area. That is [20:10] correct. Commissioner about [20:15] But So if was a neighborhood [20:16] behind the properties time [20:16] Dolly and Douglas Fir came [20:17] from there. But they recite a [20:19] notation to correct. [20:21] >> Some of them were there are [20:22] some properties that receive [20:23] notification cards in the [20:24] mail. But none of those were [20:29] returned. [20:31] >> There's obviously not 100 [20:32] people in the notification [20:33] area. So it stands to reason [20:37] they can consider that. [20:39] Weather situation purposes [20:40] that they're not in nation, [20:41] right? For the most part. I [20:42] just can't confirm that. It's [20:43] the neighborhoods that are [20:46] shown on this map. [20:48] >> I haven't really, but we [20:49] didn't use a but we do need to [20:50] consider. We do need to [20:51] consider could possibly come [20:54] from the neighborhood behind [20:54] absent that we have to respect [20:56] that. So 2 things, one, if you [20:58] read at the very last page of [20:59] that petition that was sent, [21:00] there are comments from the [21:02] signers on there. A lot of [21:03] them reference the name of the [21:05] neighborhood that they are [21:06] from every day. And that's [21:08] yes, that immediate area. So [21:09] some of them, at least in [21:11] their comments does at least [21:13] see it. It's Highland Group [21:14] anecdotally say that they're [21:16] from there. But very if you [21:17] could, could you just 4 maybe [21:18] even just me personally, he [21:20] back up and kind of just maybe [21:21] try to best of your knowledge. [21:24] Explain why city removed the [21:25] manufactured homes from c 3. [21:27] And what was the purpose for [21:27] that? [21:28] >> That occurred in 2 2020 12. [21:31] And I don't know if anybody [21:32] here might have [21:36] >> exactly. That's [21:37] >> I don't think any of us [21:40] were here at that My [21:41] assumption one just or I guess [21:44] would be that and c 3 is a [21:47] commercial district. It was [21:49] expected that commercial use [21:50] was was the preferred [21:51] development height in that in [21:55] that district? [21:56] >> It MAY have coincided with [21:58] a new district that only [21:59] allowed manufactured homes as [22:02] well. So maybe they were. The [22:05] intent was to remove it from [22:05] other zoning districts in just [22:10] allow them in a certain. [22:11] >> There MAY have been some [22:15] changes in state law time. And [22:18] eventually brings the [22:21] >> Yeah, I apologize. I I [22:25] isn't this a It is an rv park. [22:27] It's just an park. It's not a [22:31] jelly resort. I will let the [22:32] applicant MAY be till the [22:35] history of what type of uses. [22:40] >> They've had in the past. [22:41] Any other questions? I So how [22:43] many current manufactured [22:43] homes are on the property [22:47] right now There's 10. [22:48] >> There's And how much land [22:49] is that incorporate in their [22:53] property? You know? [22:54] >> I would say that's almost [22:59] 12 acres. Less than an acre. [23:04] >> Were they put on without? [23:06] Where they put on recently, [23:08] assuming that could use Yes, [23:09] it was been there for a while. [23:12] Those all were removed. [23:14] >> So I think there was a [23:15] disconnect in it was difficult [23:17] for the applicant to [23:17] understand when their legal [23:19] nonconforming use was going. [23:24] >> going to end and when they [23:26] purchase these units to [23:28] replace it took about a period [23:29] of time and all that the [23:30] applicant speak to that that [23:34] MAY have been. But they're as [23:34] a player nonconforming. They [23:37] weren't place there. [23:39] >> With approval of the city. [23:43] There are some that. Through [23:44] the permitting process that's [23:49] very hard find out the date of [23:50] illegal not come for me [23:51] because we would have had to [23:52] have that information when [23:54] they were removed. And so when [23:59] the applicant. A pursuit [24:01] permitting, there were a [24:02] couple, maybe 2 or 3 that were [24:07] permitted at a later date, [24:10] staff was notified that these [24:11] were removed in. They lost [24:13] their legal non-conforming [24:16] status. So we had to kind of [24:18] backtrack you know, notify the [24:21] applicant in writing that the [24:22] previous permits that were [24:23] issued were issued [24:26] incorrectly. And that's how we [24:28] are here today. [24:29] >> Thanks to the permits were [24:33] issued. There permits issued. [24:34] >> There were permits issued, [24:35] but there's a revocation from [24:39] the building official. [24:40] >> That once it came to light [24:41] that they lost their legal [24:43] non-conforming status. [24:47] >> Permits for sot initiated. [24:48] Prior to these being placed up [24:51] there. [24:51] >> I don't know the timing of [24:56] the locating that. [24:59] >> Is manufactured housing [25:00] allowed under any zoning right [25:01] now in our city of aside from [25:04] as up obviously. [25:07] >> believe it's allowed in the [25:07] b zones. [25:08] >> Yes, it's it's a lot of [25:10] multiple districts. I don't no [25:11] those off of you know, they [25:18] alone. [25:18] >> Manufactured homes on the [25:19] property right now. Yes, there [25:23] is. There's 10 Okay. [25:23] >> And are you are where's the [25:25] city aware of any new laws [25:26] coming from that you might [25:29] later that would. Us to deny [25:32] this. Or prohibit us from [25:35] denying manufactured. I just [25:44] want make sure. Happens. [25:47] >> To that all 10 permanent. [25:50] >> There were only 3 that I [25:50] believe were issued permits [25:53] that were later revoked by the [25:54] building building official. [25:55] They would have to move all [26:00] 10. They don't have a pathway [26:01] to have been permitted as [26:14] today. I guess maybe. [26:14] >> I mean, it obviously has [26:15] any questions. But here in the [26:17] applicants. Nothing would be [26:20] helpful, too. [26:21] >> Yes, I'll go ahead and call [26:29] them right now. [26:30] >> You state your name and [26:34] with your risen are non [26:35] >> My name is Jamie. And here [26:37] I am not a resident of New [26:38] Braunfels and this has been [26:39] currently with me. She is also [26:40] not a resident New Braunfels [26:43] representatives of the [26:44] community. I do live in San [26:44] Antonio, some at least semi [26:48] close by Good Evening Chair [26:48] Council, thank you for your [26:52] time this evening. We want to [26:52] discuss our plan to replace [26:53] manufactured homes. It's under [26:57] trees. Texas Hill Country. Our [26:57] intent for the parcel is not [26:58] to change anything in the [27:01] approximate 11 acre parcel, [27:01] rather, just replace [27:02] manufactured homes that were [27:04] previously on the property. At [27:05] this time, we have no plans to [27:06] add any new development that [27:08] was not previously [27:09] established. Our goal is just [27:10] to restore previous used the [27:14] sites. As a real estate [27:14] investment trust. We will [27:15] maintain ownership of the land [27:16] regardless of the individual [27:18] homes located on the property. [27:19] Our preferred approach is to [27:21] enter these homes into our [27:22] home rental program that [27:23] provides a quality and [27:25] affordable living space while [27:25] maintaining consistent [27:27] ownership and management of [27:28] the property are home. Rental [27:30] program includes a formal [27:31] application and screening [27:33] process for prospective [27:34] occupants. This allows us to [27:35] evaluate applicants ensure [27:38] that the homes are occupied by [27:38] qualified individuals meters. [27:42] That was rental requirements. [27:43] We also performed annual [27:45] inspections to ensure units [27:46] are maintained and all [27:47] property standards are met. [27:48] Ultimately, our goal is to [27:49] responsibly maintain the [27:50] property, preserve its [27:50] character, replace homes [27:52] without introducing a new or [27:52] substantial different used to [27:56] the parcel. So I guess like [27:58] part of the what I would say, [27:59] part of the misconception [28:00] about this is that we want to [28:01] change the entire 11 acre [28:04] parcel. We do not. If you look [28:05] at the photo that we have, [28:08] this is an old photo and its [28:09] right off the second street [28:10] there. There's like 10 sites [28:11] right there to the right of [28:14] the Second Street. The mh [28:15] homes were there in the past. [28:16] We just want to we're put. We [28:17] put them back, right? It just [28:19] took a little bit longer than [28:21] right there. Thank you for [28:22] ever We took a little bit [28:24] longer than we originally had [28:25] planned or that we knew about [28:28] a year not conforming use. So [28:30] we're not trying to take [28:32] everything out and turn the rv [28:33] park into a manufactured [28:35] housing community. We just [28:36] want to provide a different [28:36] rental option for our guests [28:43] to come. Enjoy our resort. So [28:46] Sun is a company, I think is a [28:47] good. It's important to talk [28:47] about his U.S. As a company. [28:50] We been around since 1975, you [28:51] know, went New York Stock [28:55] Exchange public in 1993. If [28:56] 450 best-in-class properties, [28:57] we pride ourselves on being [28:58] the nation's premier owner and [28:58] operator of manufactured [29:01] housing, an rv and rv resorts. [29:05] You know, we have 16 in Texas, [29:07] 12 rv Resorts 12 rv resort [29:08] sudden 16 manufactured housing [29:09] communities with to a New [29:11] Braunfels. So we do have a [29:12] effective housing community. [29:12] That's about 2 miles north of [29:15] the subject. Property come [29:17] out, farms and we bought [29:18] Senator East country of [29:20] mentioned Jellystone. It was [29:20] jellystone in the past and [29:23] sons Silver Star to a point [29:24] we've gone through some [29:25] changes corporate management [29:26] re-branding. So that's what [29:28] all the da's un names come [29:29] from. But we purchased it in [29:34] FEBRUARY 2016 285 sites and 52 [29:35] vacation rentals. The family [29:37] focus property with indoor [29:38] outdoor pools, volleyball [29:39] courts, extensive events and [29:41] activities that we want to, [29:41] you know, should provide a [29:44] good time for our guests. [29:45] We're also committed to local [29:46] outreach and giving back. So [29:49] we host annual event with Camp [29:51] Quality usa can't quality [29:53] provides outdoor hospitality [29:55] camping for, you know, [29:56] families that are impacted by [29:57] children with cancer. So we [29:58] provide once it once a year on [30:01] Thanksgiving. We have a [30:03] weekend unity with our son [30:04] Unity program which is are [30:05] giving back program that we [30:07] invite these families to come [30:09] enjoy are camped out for free [30:11] in it sits next weekend. It's [30:11] really good for the soul of [30:15] been to a couple of them. So [30:16] we want to go through our [30:17] timeline a little bit. You [30:18] know, I know that was [30:18] something that was just [30:22] brought up. In DECEMBER. 25 we [30:24] had a meeting with city [30:25] representatives presented our [30:26] plan to replace the [30:26] manufactured housing, [30:27] manufactured homes are removed [30:30] from the property. We did not [30:31] order the homes until after we [30:34] had that meeting. Right? So we [30:35] thought there were no concerns [30:39] raised in that meeting we were [30:40] ok to order them because we're [30:43] replacing right. There was I [30:44] think some representatives [30:46] from net was at the and the [30:47] you in New Braunfels utilities [30:49] on the call. It was a team's [30:54] call. Sorry, New Braunfels How [30:55] General contractor who is in [30:57] New Braunfels resident Adam [30:59] Hatch and then his form and [31:00] one couple representatives [31:01] from signed the manager [31:04] Michelle Guajardo Huzzah New [31:05] Braunfels resident and The [31:08] couple people from the city. I [31:09] don't know the last name [31:12] summer. Amanda were on the [31:13] call and we were we were told [31:14] that meeting that as long as [31:16] we're replacing units, it was [31:17] ok. So that was why we went [31:19] ahead and ordered In APRIL. [31:23] The homes began to arrive. We [31:25] got our first permits and I [31:26] think as mentioned, we got 3 [31:27] permits. One on MAY 28th one [31:28] on JUNE 4th and one on JUNE [31:31] 24th and then on JULY, the [31:32] permits revoked while we had [31:36] the other 7 in for review. [31:37] Right? So we were we were not [31:38] doing anything with the other [31:38] 3 were waiting for the permits [31:41] to come in. We also had 4 [31:44] applications on these already. [31:45] So we had to guess that we [31:46] were just waiting for the [31:47] final construction to be [31:48] completed, but we are ready to [31:48] move into these homes before [31:51] we got the revocation. We 4 [31:52] locations to are denied to are [31:56] approved. So that we feel this [31:57] was due to a timing [31:58] technicality and not a [31:58] substantial violation. We [32:00] would have been within one [32:01] year, we would have been fine. [32:02] We would still had a [32:02] non-conforming use for one. We [32:07] remove them. This is the site [32:08] plan. So this these time that [32:10] we have here on the site's up [32:14] in the front of the park. You [32:15] know, that's the far end of [32:15] the park away from the [32:17] neighboring community in the [32:19] back. It's right off the road. [32:20] I think you said roughly sort [32:21] of sat around 100 times today, [32:23] but Rocky Road right off the [32:24] front there. And then this is [32:26] the floor plan and all this [32:27] was presented at that meeting [32:31] in DECEMBER. So very clearly [32:32] it's a manufacturer House size [32:36] in apartment size. We have [32:37] some pictures. Obviously we've [32:37] got some work to do. We [32:38] stopped working as to when we [32:41] got the revocation for her. [32:42] The letter we stop that we've [32:43] got landscaping work that will [32:44] go in there and then finishing [32:46] touch up. He says to to these [32:50] homes. So there fantastic [32:52] looking one of the things that [32:53] we love about these homes [32:54] compared to our views as we [32:55] have control over the look at [32:56] right? Like we maintain the [32:57] standards, we maintain the [32:59] curb appeal the guest pulls in [33:00] with an rv. It could look 10 [33:05] times worse than this. In [33:07] conclusion like our thought [33:08] process here is is really we [33:08] just want to replace what we [33:11] have these 10. We're not [33:11] looking to change our [33:12] business. We're not looking to [33:14] change the entire parcel. We [33:15] just want to be able to [33:17] replace the time that we have [33:18] and keep you and utilize that [33:19] and that we have already put [33:20] in. Thank you guys for your [33:25] time. Have a question. [33:26] >> So you have the rv's which [33:29] are short-term rentals, people [33:31] who come in to enjoy the [33:32] resort. [33:32] >> Yeah, I mean, it's of x, [33:33] right? We have people that [33:34] like we have winter Texans to [33:37] come down and stay long term. [33:38] We have people that are [33:40] short-term campers weekend [33:41] week. It's a full max, but [33:43] it's not long-term permanent [33:45] rentals, not long-term [33:45] permanent rentals. I'd say we [33:46] don't have any long-term [33:47] permanent rentals and then. [33:51] >> Next to that, are these. [33:52] Manufactured homes which are [33:55] long-term meant to be [33:56] long-term permanent rentals? [33:59] Well, I think the way that we [34:00] would address that is say we [34:00] are a thought process is that [34:04] their monthly? [34:04] >> Right in their monthly [34:05] rentals, right? You could rent [34:06] it for a month. You could rent [34:08] defer to our preference would [34:10] be that are out housing. [34:14] People move into Technically, [34:14] yes, okay. And then on the [34:15] other side of that. [34:19] >> Is the actual resort. In [34:20] the rv's, correct between the [34:24] rv's in the resort. Perez, you [34:25] are jealous. Know. A lot of [34:27] jelly stone longer sunrun [34:29] treats is our summer and a [34:32] cable says Joe Yeah. We like [34:34] be often used. Yeah, that's [34:35] that's kind of what I was [34:36] trying to say. This property [34:37] has been I mean, we bought it [34:38] in 2016. I think that it had [34:39] to owners prior to that and it [34:42] was a jellystone at one point. [34:44] And so we've rebranded it to [34:45] arson retreats model, which is [34:48] a more of like the community [34:50] rv park that we want to, you [34:51] know, bring people together to [34:51] enjoy the outdoor space, least [34:56] owns the name of the Yeah. [34:58] just led yes because it was at [35:00] one time a But it is a route [35:04] resort area on far side of [35:04] the. [35:05] >> So we've got rv's in these [35:06] manufactured homes and then at [35:09] a resort area and you have [35:11] cabins on that resort redo. [35:11] There are 52. And this is the [35:15] way that the park. [35:15] >> Did present itself and [35:16] operate for many years. Again, [35:17] there were manufactured homes [35:20] there. This is not new. [35:20] >> And in our in our industry, [35:24] we have several communities [35:25] that we own that are hybrid. [35:26] That's what we consider [35:27] hybrids that work in the rv [35:32] and mh space. It's not [35:33] uncommon that are re used to [35:36] have. And short like weekend [35:36] cabins. [35:37] >> Yeah. For the most part, I [35:37] would say that we have some [35:38] people. It's a week to 10 [35:40] days, ok, what their vacation [35:45] is, what plans? Meant to be a [35:46] vacation And I could clarify. [35:47] Commissioner, quick, do you [35:48] have yearlong residents live [35:52] in these? And these cabins [35:53] where manufactured homes [35:54] you're talking about, is there [35:56] anybody that lives there? [35:58] >> For 12 months for talk [35:59] continues month. We don't have [36:01] anybody in the manufactured [36:02] homes. Now there. Yeah. We [36:05] want talk about the future [36:06] leasing releasing for long. If [36:06] I want to come there, lived [36:09] there for 12 months. [36:10] >> Yeah, I mean, I think that [36:12] was are give me a year That [36:14] was our original plan, right? [36:15] Where we're at the point right [36:16] now where we're want to defer [36:17] to you guys a little bit and [36:20] and have have like a a [36:22] discussion about our plan [36:23] originally was to put them in [36:25] what we call it a home rental [36:27] program where they are [36:31] essentially on we call because [36:32] placement agreement because it [36:33] they pay monthly unpaid [36:37] electric bill. [36:39] >> What is purpose? And those [36:42] homes cause? Right now you are [36:48] running a resort. Business [36:49] model. Yeah. I mean, it sounds [36:51] like you're kind of. Wanting [36:52] to switch into getting into [36:57] the residential. [36:58] >> I wouldn't say that we're [36:59] trying to switch and get into [37:00] a residential development. I [37:01] think for us it's about [37:05] providing. Options for our [37:06] guests, We have guessed that [37:07] want to stay for a week. We [37:08] have guessed that love this [37:09] area and they want to live [37:10] here and be here all the time. [37:11] And we want to be able to [37:12] provide both of those options [37:18] to our guests. It's a it's [37:19] big, many said it's a hybrid. [37:20] This kind of hybrid property, [37:22] right leg. Understood. Yeah. [37:23] No [37:26] >> Yeah. I mean, that's that's [37:26] that's for us. It's it's about [37:27] creating options and keeping, [37:28] you know, business options [37:28] open as well as what's the [37:31] best thing for. [37:32] >> What we feel, the guests [37:32] for the for the area and for [37:35] for business as well. [37:36] >> So how long have the 10 [37:39] manufactured homes been on [37:39] there? [37:41] >> I think that it was they [37:41] started getting delivered in [37:42] APRIL. And the last one I [37:43] think was delivered in [37:47] Mid-JUNE before that as far as [37:48] they were on their before. We [37:51] bought the property in 2016. [37:52] >> So there's been 10 minute [37:54] fractured homes on the [37:54] property. [37:59] >> well, know how they They [38:00] were removed, right? And like [38:00] that's what this whole issue [38:02] comes down to an r and as we [38:03] are without with would not [38:04] within that one year. [38:05] Nonconforming space. [38:06] >> But they had been there [38:07] since before summer of the [38:10] property in 2016. [38:13] >> So they grandfathered [38:14] grandfathered in. [38:15] >> That is our understanding. [38:16] Yes, essentially nonconforming [38:18] among 4 news. [38:19] >> So do you all know how long [38:20] they've been all know how long [38:23] they've been on this property. [38:25] >> We don't have that [38:26] information. Looked at aerials [38:27] and I think they were as far [38:30] back as we could look in their [38:31] early 2, thousands. So they've [38:33] been on there, at least I [38:34] would say at least 20 years [38:36] when we have paperwork from, [38:36] we bought the property when [38:38] that we have 3 addresses. One, [38:40] 31 one, 41 1.51 and one. 41 [38:43] was called like Silver Star Mh [38:46] Park and one 31 was one. 51 [38:47] were jellystone are Silver [38:50] star or whatever. The middle. [38:50] The middle parcel was an mh [38:54] park at one point. [38:57] >> So just to since they were [38:58] grandfathered and it's because [38:58] they remove them because they [38:59] removed them for longer than [39:01] one year. Yes. And now they [39:05] have to start over. They don't [39:06] have to start over is just [39:09] there and they're not allowed [39:12] use in in zoning banks. And so [39:12] we don't approve this. It all [39:16] just goes back to see 3. It is [39:18] currently see 3 right [39:19] continue. Yes, okay. So if [39:19] it's not approved to react to [39:22] remove the units we have about [39:23] 1.2 million dollar investment [39:27] in them right now. So you have [39:28] 3 that a permanent that you [39:31] brought in 7 more without [39:32] permits. [39:33] >> They were the all the [39:33] permits were submitted at that [39:37] point. In end, it said it's a [39:38] hard balance when you do that [39:40] because we have to order the [39:41] units with the manufacturer. [39:42] They have to produce them. We [39:44] wait for delivery. [39:46] >> You typically we can't [39:47] permit them until they're [39:47] delivered because we don't get [39:49] a vin number are a number at [39:50] all until they're delivered [39:53] property. [39:56] >> So you can't even get them [39:57] from a to b for no. And I [39:57] mean, that's you could have [40:02] done was get this. The [40:02] preconstruction meeting. And [40:03] that's why what we thought was [40:04] ok and that's why we want to [40:06] order. [40:07] >> So you're saying you met [40:10] with the city? Everything's [40:11] fine. What made it? One 2 men [40:13] dollar investment and then but [40:13] they're in there and then you [40:15] get back no, no, never mind. [40:15] They're no longer in [40:20] conformance. [40:21] >> Did you know about the year [40:23] lapse time? We didn't know [40:23] until we met with the city [40:27] after they were revoked. [40:28] >> Do we have an exact date on [40:28] when they were because [40:33] that's really the point right [40:33] is it's not about historical [40:35] use, but in 2012, the right [40:36] for manufactured was removed [40:40] from c 3. And so when [40:40] something's removed its law, [40:43] you have 12 months to do any [40:44] type of stuff keep your [40:47] conforming. So I mean, that's [40:50] that was there beforehand [40:53] before it was purchased. So [40:54] the real is just when were [40:56] they removed? And then that is [40:57] the time frame to understand [40:59] if it was 12 months or not. [41:01] >> I think it was about it was [41:03] within the year that they do [41:04] the pre-development meeting [41:05] and I has to beat it was [41:07] around MARCH. So it they would [41:11] you know, place the units by [41:11] MARCH 2026, but looks like [41:17] they missed it about a month [41:18] or too, got just what it is to [41:19] me from what I gathered and [41:23] then hearing from you all. [41:25] >> y'all ordered the new ones [41:26] within the 12 time period. [41:27] They were. They were ordered [41:28] in JANUARY after the [41:33] preconstruction meeting. [41:34] >> And how many Dion have on [41:38] the property? Now? We have 10. [41:39] So they're all yelton were [41:40] delivered by think like said, [41:41] I think it was mid JUNE or [41:45] early JULY. The last one came [41:45] in. [41:45] >> I'm new to this as well. I [41:46] think it's I just moved to San [41:49] Antonio in JULY. So the role. [41:50] And so this might be a [41:52] question for staff. But in [41:55] this instance where they can [41:56] with the manufactured home. I [41:57] know with park models [41:59] and staff as well used to have [42:00] a vin number. And so you don't [42:00] get that until you get the [42:03] actual delivery of it. [42:04] >> And what I'm hearing is [42:05] that the process is that's [42:05] when you can actually come to [42:06] the city staff and permanent. [42:10] Is there any? What the right [42:13] word of the allowance for the [42:15] fact that given the certain [42:16] model the orders have to [42:17] happen before that. So the [42:19] order placement was in there [42:20] nonconforming use. But then [42:21] the permit falls outside of [42:23] it. Because if that's the [42:24] case, then they would have to [42:27] order it like immediately and [42:27] hope that they get a cause [42:28] that could be completely out [42:30] of their hands. On the [42:31] delivery date. Sony's park [42:33] models get super delayed. And [42:34] if delayed a couple months [42:35] than they might MISS Their [42:36] permit window. So I guess [42:40] that's really that crux of it. [42:41] >> It ultimately up to the [42:45] building official revoke the [42:46] permits and it was decided [42:48] that order for them to [42:49] continue with the use, that [42:50] they would have to go through [42:50] rezoning. [42:55] >> Okay. These 10 that you get [42:55] there are ready. Are you [42:56] planning on putting more out [43:00] there if this passes? We had [43:01] originally planned to replace [43:02] another 10 in a different [43:03] area. But we think at this [43:03] point we're just going to [43:08] stick to the Thank you. [43:12] Clarify Zoning request. If [43:12] it's approved. [43:17] >> approved for all 11 point, [43:18] whatever acres. [43:20] >> a special use permit [43:21] request so there can be [43:21] conditions placed on the [43:23] special use permit request. [43:27] But right now as it stands. [43:30] >> If it were proved they [43:32] could put manufactured homes [43:33] all over almost 12 acres. [43:35] There were no conditions [43:37] placed unless we put a [43:39] condition for a limited to [43:40] what's already now. Well and [43:42] again, I think Jamie and I are [43:42] here to say we heard Mary say [43:45] that at the end of her [43:46] presentation and at this [43:48] point, we want to at least use [43:49] those 10 that were delivered [43:50] because we have a 1.2 million [43:53] dollar investment in those. [43:54] >> We are fine with absolutely [43:55] stopping there looking at [43:57] those conditions that were [43:58] placed were happy with any [43:59] riders that come to So you can [44:00] just stick it and be done with [44:04] it. [44:09] >> For why given the confusion [44:14] >> are recommending denial? [44:16] >> So I would I would say, you [44:22] know, our our recommendation, [44:24] >> It sometimes tough for [44:26] staff to make the to come down [44:27] on one side or another. And [44:28] this is one of those instances [44:31] where it was not a. [44:32] >> You know, is not black or [44:37] white. Circumstance. So and in [44:39] fact, that's why the report [44:42] was crafted. The wind was too [44:42] sort of balance that there [44:47] are. Actions the comprehensive [44:49] plan that that support the [44:56] request. Are reviewing our [45:02] consideration with the These [45:03] residential products being [45:07] removed from the zoning code. [45:09] We felt that that was the [45:10] direction that, you know, the [45:15] city was. In the adoption of [45:16] of those changes to the code [45:19] that that the city was. In [45:25] favor of that. That position. [45:26] >> I think to suggest that we [45:27] open up the public hearing and [45:30] if we need to representatives [45:33] come back, we come back. I [45:36] think public hearing and I [45:36] thank you here for many [45:37] citizens are here to talk [45:40] about it. It will open a [45:41] public hearing for anyone that [45:41] would like to come and speak [45:47] regarding And we couldn't use [45:48] a cell phone. Note here, is [45:52] that okay? [45:53] >> Okay. Curtis yanking I do [45:55] live here and and Braunfels up [45:56] in the Highland Grove area [45:56] with one of those e-mails and [45:57] names on that list. It's a [46:03] real quick. It's a good [46:03] evening. I'm speaking [46:05] regarding special use permit [46:07] for this. And my concern is [46:07] not necessarily the [46:09] manufacturing housing after [46:10] hearing their story. I do feel [46:14] for him a little bit, but I'm [46:16] more worried about the [46:18] cumulative impact of land use [46:19] decisions on this area and the [46:20] surrounding established [46:21] neighborhoods and more than [46:25] just a 200 feet. It is in the [46:26] brothel, specifically calls [46:28] for protecting the character [46:29] intake, integrity and [46:30] stability of neighborhoods and [46:30] balance commercial centers are [46:33] stable neighborhoods. The area [46:34] has already experienced [46:36] significant change, including [46:37] MARCH homeless shelter nearby [46:38] on the other side of the [46:39] interstate. Now the city is [46:41] considering allowing [46:42] manufactured housing [46:43] approximately 11 acres of sea, [46:44] 3 commercial property along [46:48] the I-35 corridor Senate [46:49] stated his current team is [46:51] only 10 manufactured homes, [46:52] but the separate quest covers [46:53] approximately 11 acres. I [46:53] think you just kind of talked [46:54] through there could be [46:57] conditions on that. But that [46:58] still raises an important [46:59] question to the cep is [46:59] approved. What prevents future [47:00] expansion beyond those 10 [47:02] homes? And what is the city's [47:03] intent based on their vision [47:06] plan for this area? Retired [47:07] after 31 years in the U.S. [47:10] Army as a colonel. Chose New [47:11] Braunfels and picked that area [47:11] because of the residential [47:14] rural area and what it looked [47:16] like as I continue to watch it [47:18] grow and watch things grow on [47:19] the side of Mayfair and then [47:21] things down here, it seems [47:24] like this side of New [47:25] Braunfels is getting homeless. [47:26] Shelters manufactured homes [47:28] and things like that. I'm just [47:30] concerned that looking at the [47:30] envision and where the [47:33] future's going for this homes [47:34] that are in Highland Road that [47:36] are half a million dollars MAY [47:36] have land value issues in the [47:53] future. Any questions for e? [47:59] Sorry the mic was off. [47:59] >> Anyone else would like to [48:02] speak. Please forward. If not, [48:03] I will close the public [48:05] hearing. [48:06] >> Commissioners, I'd like to [48:09] suggest. Hearing both sides to [48:15] this. I think with Big. Works [48:17] on both sides. And [48:22] >> and the applicant's side. [48:23] Just like to say that before [48:27] we go any further. It suggests [48:28] that if we were going look at [48:28] any approval that we [48:31] absolutely put Conditions that [48:34] the only these thank you [48:38] factor domes. Presented to [48:41] commissioners, please. [48:43] >> Someone from the city [48:44] confirmed that vin numbers [48:49] required. Required 2. Issue a [48:52] permit [48:56] >> The planning previously [48:58] before it reconfigured in [48:59] split into 2 to division [49:04] departments I personally [49:05] reviewed mobile home. They [49:05] come, you we have all [49:08] terminology mobile home [49:09] permit. And it is true that [49:13] there had to be a picture of [49:15] the id number of that unit. [49:18] And I recall seeing those in [49:20] reviewing and that's before [49:20] they're issued. So you have to [49:26] have that. [49:26] >> I think my biggest concern [49:27] is because I know we lived on [49:32] the east side. B-one got [49:33] rezoned next. Our residential [49:36] and Being in real estate. I [49:38] saw the impact of that. My [49:39] concern is if we have it, [49:43] prove this. Kind of a lead. [49:47] The doorway open. That if they [49:48] were to come back in the [49:52] future. It would be really [49:55] hard to say, no, because [49:57] there's already 10 on there. [49:58] It's kind of like St ours. You [49:58] know, once we open the door to [50:04] that. It could lead to more. [50:05] And seen, you know, given the [50:05] voice of the residents all [50:07] around it. We have to honor [50:11] that. My heart goes out to you [50:14] all. I hate the situation. [50:16] Like how it all happened. I [50:16] wish things could have been [50:21] clear for y'all. I'm concerned [50:22] with the big, you know, the [50:23] future the big picture. And [50:29] the fact that the city has. [50:30] They're recommending denial. I [50:31] think that's something to look [50:35] at as well. For the strategic [50:41] plan. And so. [50:43] >> I think we have the image. [50:43] And since he the letter of the [50:45] law and the spirit of law. [50:50] Being part month or 2 [50:52] difference between when you're [50:54] informant win or not. And for [50:55] months and if a delay in [50:58] delivery appear units and you [50:59] have that the permit of the [51:00] unit there before you get the [51:04] actually issue their vote [51:07] >> yeah, I would hate to see. [51:08] So this is this is a a small [51:12] enough. Give. [51:14] >> An area property that [51:17] already had 10. You didn't. I [51:18] think if we restricted to 10 [51:19] unit says planning staff has [51:21] recommended. I'm not concerned [51:24] about future this mean it. [51:25] Future growth, Mult [51:25] manufactured housing in this [51:29] area. Because because of the [51:32] restrictions of the U.S. Up. [51:38] But do see harm. And this 1.2 [51:39] million dollars harm for any [51:43] business on a technicality of [51:44] a month or 2 of their on of a [51:44] delivery date of unity. You [51:47] have no control over. So I [51:55] die. I'm going to vote [51:56] approval of this with these [51:56] restrictions that staff [52:01] presented. Because of that. I [52:03] think that this place where we [52:07] can show a little grace and [52:08] this instance My concern, [52:10] though, is this is what's the [52:11] future look like? And we've [52:12] got a look down the road, its [52:13] future. What happens when [52:14] Winters making here? [52:18] >> And I thinking about what [52:19] we want. You both look like. [52:22] 25 for 2 years from this, [52:23] Yeah, decisions we make now. [52:24] So PRESIDENT's there's been [52:26] many a times over the years [52:27] where we've done the phase [52:28] will do it in phases phase 2 [52:28] never happens because you've [52:30] got everything you the [52:33] megastar in phase one and [52:34] magically phase 2 goes away. [52:38] My concern is. And I agree [52:39] it's kind of us is biz staff [52:42] food all around and like to. [52:43] Accommodate. But my concern [52:46] is. What happens a year for [52:48] now. They come back and say, [52:49] oh, now we want to do this. [52:51] This and this and they want [52:54] another special use permit. [52:55] And maybe the board's [52:56] different. I don't know that [52:56] the Department of trying to [53:02] make is. I agree it's a bad [53:03] situation, but we've got look [53:04] out for what want New [53:05] Braunfels to be like in the [53:08] future. If zoning says no [53:12] manufactured homes. If we [53:13] approve the tend to stay [53:13] there, there's got to be [53:17] something very. So this is [53:18] nothing else happens here for [53:23] me to support. As a have a [53:25] question for the applicant and [53:26] you really you have to get up [53:28] predict how many, how many [53:29] locations like resort still [53:43] have to say, like in Texas. [53:46] >> We have I mean, to to [53:47] outside Dallas to in Austin [53:48] and, you know, the closest one [53:51] hears off 16. 0, 4, and San [53:52] Antonio, one downtown San [53:53] Antonio than 2 of her by [53:55] Houston. And that's just the 9 [53:56] that we operate, the 9 that [53:58] I'm responsible for. We also [54:00] have 3 more that are like [54:01] operated by a 3rd party that [54:02] we own nose or jelly stones. [54:04] Like you mentioned earlier. [54:05] >> So they're places where [54:07] these thank you. Factor homes [54:09] could be placed if this were [54:16] denied. Potentially. Thank [54:22] right now is. I operate a [54:22] business that deals with [54:28] permits, different cities and [54:28] and it's not it's not [54:29] manufactured home. So I [54:30] understand some of the process [54:32] might be a little different. [54:34] On her la Home building. But I [54:35] know we don't we don't move [54:40] without a permit. We do want [54:40] to get situation. Got her [54:42] house down. But on the flip [54:46] side of that, once we have a [54:48] permit, we rely on that good [54:50] faith that we have a permit [54:52] and we certainly don't know [54:55] that can come back through, [54:55] you know, code books from 10 [54:56] years ago, 15 years ago to [54:58] ensure that the city staff [55:00] issue the permits, correct. So [55:05] my thinking right now. And, [55:06] Ali, I'm not going make a [55:06] motion was more discussion, [55:08] but my motion would probably [55:14] be 2. Honor. The 3 permits. [55:14] And approve it for the 3 that [55:18] were issued. You know, hope [55:19] that the other could be [55:19] relocated repurpose somewhere [55:21] else. That's where my head [55:24] that at the moment. [55:25] >> 3 permits like and 3 [55:26] manufactured homes, the ones, [55:29] the ones that worries you. But [55:34] then I still remove 7 right? [55:40] Of those 12. Have are those [55:41] strictly manufactured-home [55:43] subdivisions? Are they [55:44] hybrids? [55:45] >> So the 16 properties that [55:46] we have there are many fashion [55:47] housing are strictly [55:47] manufactured housing. I would [55:51] say of the. The 12 properties [55:51] that we have that are like [55:55] under rv division. I think 2 [55:55] of them are considered hybrid, [55:59] too. To have the 2, 2, in [56:00] Dallas are considered hybrids [56:07] and and yeah, in a how many [56:08] developments you'll have like [56:11] this resort. [56:12] >> In Texas or general in [56:16] Texas, there be about 10. And [56:20] 9 or 7 of those 10 we operate. [56:21] 3 are operated through a 3rd [56:24] party. Maybe you have more [56:25] manufactured home subdivisions [56:25] and you have resort, correct? [56:28] So. [56:29] >> And I know that be a cost [56:30] to get at a cost to Acosta you [56:31] got to find space if you got [56:36] it. To me. I think that option [56:41] for residents, the neighbors. [56:41] Applicant for the end to [56:44] event, we have? It's a big [56:48] lump sum. Both sides. [56:51] >> But I can see the clear [56:52] business model vision that you [56:53] all have is manufactured [56:54] homes. I think my concern is [56:55] as planning commissioners, we [56:59] kind of have to see through. [56:59] As to where we're heading. [57:04] We're going. You know, act. I [57:05] can see I can see all coming [57:10] back. And saying can we do 10 [57:11] more are can we go ahead and [57:15] just? Can we make this what we [57:18] have the other 12? I mean, [57:20] even I mean, parent would be [57:21] really great. Yeah, I [57:23] understand your concern and [57:25] for us after what we've gone [57:26] through in the situation is is [57:28] not our intent at all. [57:29] >> We're already discussing [57:31] other options for what we can [57:32] do in those sites where we [57:32] would potentially have added [57:35] 10 more right. We're talking [57:36] about making premium the lead [57:40] sites for rv's or Brianne Park [57:41] model. Many you know, parking [57:41] on the Adventure Park model [57:42] homes as rentals like we've [57:44] already started the discussion [57:45] because we realized that we [57:49] were outside of the the zoning [57:50] on this. We didn't know until, [57:51] you know, I came up here and [57:52] talk to Mary in mid-JULY after [57:58] the record revocation. I to [57:59] make a decision on on any [58:00] decision on what MAY happen or [58:03] what could happen when we're [58:04] >> deciding what they're [58:08] asking for. Now be any change [58:09] that they would be in the They [58:11] would have to come in and ask [58:12] again to change the U.S. Up [58:13] from whatever it is. We decide [58:18] to do here. And at that time. [58:19] The commissioners at that Time [58:19] City Council that time could [58:20] vie way. What would be best [58:22] for the community? Then they [58:23] decide that. Yeah, that time [58:24] that we MAY need 100 [58:26] manufactured homes. But they [58:27] have to come in and ask for [58:28] done for a case for that with [58:33] at that time. I think making a [58:35] decision now based on not [58:36] facts, but what ifs. And you [58:37] know what MAY happen in the [58:37] future is a wrong way to [58:41] approach us. [58:44] >> But I've seen this, you [58:45] know, after 4 years and the St [58:47] ours and when we [58:49] >> allow. [58:54] >> a zoning change. We have to [58:55] prepare ourselves for our [59:03] future. So changes? Also think [59:04] we need to deeply consider [59:12] staff's recommendation. [59:13] >> Come down on the side of us [59:17] and isolated situation. Not [59:22] entirely of they're doing. [59:23] That that's the overriding [59:29] principle for me. [59:30] >> to hear a motion of any [59:30] circumstance, you say final [59:33] make a motion. So I'm gonna [59:36] make a motion to. Secondary [59:42] this. To approve the special [59:44] use overlay. On the condition [59:48] that it's for the 3 [59:49] manufactured homes that have [59:54] that were issued permits. [59:58] Every second. Quick question. [59:59] Those 3 permits. Those do have [1:00:02] the numbers are right. [1:00:09] >> Yes, they do. Was that a [1:00:14] second chance? Motion? And [1:00:15] second could got a question [1:00:18] real quick for a vote. So if [1:00:22] this passes mean taking? [1:00:23] >> Come back. And the [1:00:23] manufacturer homes on the [1:00:27] property. Sponsors means they [1:00:38] are pulled the 7 out [1:00:44] >> I mean, what the boss in I [1:00:45] don't know that that's [1:00:47] beneficial to because again, [1:00:48] because we had a specific area [1:00:49] carved out for these 10 units, [1:00:52] you saw it on the sly. [1:00:53] >> So many it looks very on to [1:00:56] have 3 units up there that are [1:00:57] sitting alone. So I don't know [1:00:58] that it's beneficial for us [1:01:01] just to do that. 3. And I do [1:01:01] understand your concern [1:01:04] because the basis of our [1:01:05] business is where [1:01:05] manufacturing housing that is [1:01:06] 100% correct. That's how we [1:01:09] entered the market many years [1:01:11] ago. But we have one into the [1:01:13] rv market and it is very [1:01:14] beneficial for us. It's very [1:01:14] beneficial for us because a [1:01:17] lot of families starting [1:01:19] resorts like the one we have [1:01:20] down here and then they MAY [1:01:22] end up in one of our 55 plus [1:01:23] communities in Florida later [1:01:24] they might tell a family [1:01:24] member about us because we're [1:01:27] a big name in this industry. [1:01:28] Our intent is not to change [1:01:30] this resort into that. We [1:01:32] wouldn't even be standing here [1:01:33] if there were units [1:01:34] manufactured homes there [1:01:36] before we wouldn't be here. [1:01:36] This wouldn't even be a [1:01:37] conversation if they were here [1:01:41] before. Again, we we went to a [1:01:43] meeting in DECEMBER of last [1:01:45] year trying to clarify that it [1:01:46] was ok because we know how are [1:01:48] currently zoned. We didn't [1:01:49] know that the mh units. We do [1:01:51] know that the bump that we ran [1:01:53] into, but that's why we have [1:01:53] that meeting. And again, we [1:01:54] wouldn't be standing here if [1:01:55] we didn't have them in the [1:01:58] past. And that's not that's [1:01:59] not where we're going. I [1:02:00] promise you. We don't have [1:02:03] indoor polls and outdoor pools [1:02:04] and activities programs and [1:02:04] all of that typically for me [1:02:09] communities. [1:02:10] >> We have a motion and we [1:02:12] have a second. [1:02:14] >> One other point before we [1:02:16] go, make sure we keep insight [1:02:19] that is recommending body and [1:02:20] the decision will be made by [1:02:20] city Council for for the [1:02:27] final. Action on this request. [1:02:31] >> So we have a motion is that [1:02:32] thank you for the questions. [1:02:33] Would you take a roll call, [1:02:34] please. [1:02:35] >> Commissioner I Commissioner [1:02:42] Rudy. Commissioner Taylor. [1:02:44] >> Commissioner Mathis. I [1:02:46] Commissioner Alan. [1:02:49] Commissioner Henry. [1:02:52] Commissioner brazen. Vice [1:02:59] chair, also. Chair Sonia. 5 [1:03:03] yes's. [1:03:06] >> The motion carries make [1:03:08] sure you restricted to 3 [1:03:17] manufactured homes. It's up to [1:03:23] 6. Dash, 2, 6, 1, Public [1:03:23] recommendation to City [1:03:29] Council. Requested by. It's a [1:03:31] one. Real on behalf of 8, 3, [1:03:36] 9, voices Street llc to [1:03:38] rezone. Approximately 0.1, 7 [1:03:40] sense of an acre. But it was [1:03:46] are edition. Lot of 5 lot, 9 [1:03:47] from art dash, 2 single family [1:03:54] into family district. To see [1:03:56] It's up commercial office, [1:03:59] strict district with a special [1:04:01] use overly to a lot of [1:04:02] short-term rental residents [1:04:04] currently addressed 8, 3, 9 [1:04:09] oasis Tree. [1:04:10] >> The subject property is [1:04:13] located on the north side of [1:04:14] Oasis Street, approximately [1:04:16] 125 the east of right street [1:04:17] and the Oasis Street [1:04:21] intersection. The law is [1:04:24] approximately 0.1 7 acres and [1:04:26] is developed with [1:04:28] approximately 1002 1200 Square [1:04:31] Foot House with 3 bedrooms and [1:04:34] 2 bathrooms. Abutting land [1:04:35] uses are residential with a [1:04:36] warehouse located at the [1:04:37] southwest corner of Right [1:04:41] Avenue and Oasis Street and an [1:04:42] automotive repair used at the [1:04:42] northeast corner of right [1:04:45] Avenue and Pine Street. The [1:04:46] property is currently zoned r [1:04:50] 2 short-term rentals are not [1:04:51] allowed in a residential [1:04:53] zoning district there for the [1:04:54] property must be rezoned to a [1:04:56] non residential district at [1:04:57] the same time is requesting [1:04:59] the special use overly to [1:05:01] allow a short-term rental use. [1:05:04] Therefore, the applicant is [1:05:05] here requesting to change the [1:05:07] base, owning a property of the [1:05:10] property to commercial office [1:05:11] district along with that [1:05:14] special use over late the [1:05:18] commercial office district at [1:05:20] residential notably a [1:05:22] single-family residence and [1:05:23] also allows office uses at [1:05:24] some light commercial uses by [1:05:29] right? This slide shows the [1:05:31] exterior and some of the [1:05:32] interior of the house under [1:05:34] the city's current as tr [1:05:35] occupancy rules are residents [1:05:39] of this size, a host up to 8 [1:05:40] occupants and is required to [1:05:43] have at least 3 paved [1:05:44] off-street parking spaces, [1:05:45] which it does appear that the [1:05:49] law can accommodate. The [1:05:49] applicant has submitted a site [1:05:52] plan and a floor plan that [1:05:53] depicts the retention of the [1:05:56] residential character of the [1:05:58] structure and staff notes that [1:05:58] any future changes to either [1:06:02] this site plan or the floor [1:06:03] plan would require amendment [1:06:04] to this to the U.S. Up. If it [1:06:09] is approved. The nearest [1:06:10] existing short-term rentals [1:06:12] are located approximately one [1:06:13] block South West, which is [1:06:16] about 700 feet away along [1:06:18] Oasis Street. And it's and the [1:06:22] property that property zoned [1:06:23] industrial. Situated across [1:06:25] from an existing warehouse. So [1:06:31] staff notes that this cons [1:06:32] context differs a lot with the [1:06:36] current subject site which [1:06:36] also sits in the middle of a [1:06:44] residential block. There's no [1:06:46] adjacent commercial or [1:06:47] industrial uses immediately [1:06:51] around the property. Staff [1:06:53] recommends denial. The Co [1:06:55] district is New Braunfels [1:06:55] least intense commercial [1:06:59] zoning district. It's. Mixed [1:07:02] use. Character is intended to [1:07:03] balance opportunities for low [1:07:04] intensity, neighborhood skill [1:07:07] and walkable commercial uses. [1:07:08] While protecting the [1:07:09] residential character of the [1:07:10] surrounding neighborhoods. [1:07:13] However, it because this [1:07:14] subject property is mid-block [1:07:17] in. It does have those [1:07:20] adjacent residential uses. We [1:07:22] staff feels like it would be [1:07:24] dedicated to negatively [1:07:28] impacting those properties. [1:07:28] And a guest of short-term [1:07:32] rental at this location would [1:07:34] be required to drive into an [1:07:34] existing intact residential [1:07:38] neighborhood. The nearby [1:07:39] short-term rentals that are [1:07:43] located nearby. They actually [1:07:47] are zoned industrial. So i [1:07:47] just wanted to emphasize that [1:07:48] and they have an existing [1:07:51] warehouse across the street. [1:07:51] If the commission is inclined [1:07:54] to approve this request, staff [1:07:56] recommends the following [1:07:58] conditions, the residential [1:07:59] character, the property must [1:08:01] be maintained and the property [1:08:02] will remain in compliance with [1:08:05] the approved site floor plan. [1:08:09] At this time me going to these [1:08:11] notifications. Public hearing [1:08:12] notices were sent to owners of [1:08:16] 26 properties within 200 feet [1:08:17] and staff received 4 responses [1:08:19] in opposition. Accounting for [1:08:23] 11% of the notification area. [1:08:27] And one response in support. [1:08:28] Unless the opposition [1:08:29] increases a supermajority vote [1:08:30] of city council would not be [1:08:33] required to approve this [1:08:34] applicants request. If you [1:08:35] have any questions, I'm happy [1:08:36] to answer regarding [1:08:41] application. Commissioners, [1:08:45] any questions for staff? [1:08:46] >> Thank you quick. And is [1:08:54] here to present. [1:08:55] >> your name and whether a [1:08:59] resident New Braunfels. [1:09:00] >> Hi, my name is yet to come. [1:09:00] One my non resident of New [1:09:05] Braunfels. I am a resident of [1:09:07] the como districts. Familiar [1:09:07] with the area, but it's just [1:09:11] outside city limits. Just a [1:09:13] little bit of backstory with [1:09:14] this property we have on this [1:09:16] property since 2008 and its [1:09:17] families throughout all this [1:09:20] time. A couple of years ago, [1:09:23] we decided to do every model [1:09:24] lien on the property which [1:09:26] turn out to be a beautiful [1:09:27] Used to be super small. 2 [1:09:30] bedroom, one bath and we went [1:09:31] through the whole process of [1:09:32] permits and you 19 years all [1:09:35] that stuff to make it. A [1:09:39] really nice property after [1:09:42] remodeling this property. We [1:09:43] had one long-term resident. It [1:09:46] was a business owner here in [1:09:48] New Braunfels. Who leaves the [1:09:49] property for about a year. And [1:09:51] then after that, he bought a [1:09:55] house, its been vacant since [1:09:55] it's been really hard to lease [1:09:59] a property. It's Bacon for [1:10:02] almost a year and a half. And [1:10:04] we still have a mortgage on [1:10:06] the property. So at this [1:10:07] point, we just want like at [1:10:10] least some type of income. So [1:10:15] we're seeing on this property. [1:10:20] Fast forward to this year. My [1:10:22] we are a family, you know, [1:10:27] people forward to these year. [1:10:30] My family and I kind of stay [1:10:30] during the summer and [1:10:33] altercations and we have [1:10:34] always in love with the city [1:10:37] of New Braunfels. I had a [1:10:37] slide show, but I'm sorry. I [1:10:49] think it's too late, too. That [1:10:51] is not business and work. You [1:11:06] can you a k project. [1:11:10] >> So we basically made this [1:11:12] property, the noises that New [1:11:14] Braunfels because it is [1:11:15] located on always history. It [1:11:15] was we thought that he was a [1:11:19] nice nice, though. I think [1:11:20] it's going to be a great [1:11:22] Airbnb because it's really [1:11:26] centrally located in minutes [1:11:29] away from water bar downtown [1:11:29] local shops, the museum [1:11:33] Buc-ee's another. Even I-35 [1:11:35] and basically like I [1:11:36] mentioned, even when we get [1:11:37] people from out of state, we [1:11:38] usually bring them all the way [1:11:39] to New Braunfels because we [1:11:41] know the culture. We know [1:11:47] vive. I always support local, [1:11:49] you coffee shops and we love [1:11:53] the festival. I'm just coming [1:11:54] out of the routine from our, [1:11:58] you every day they to they [1:11:59] work. And then coming here [1:12:02] just to connect with nature. [1:12:03] With this Airbnb, I would like [1:12:08] to help the community a our [1:12:11] local tourism and creating and [1:12:12] supporting more local shops [1:12:13] and restaurants even local, [1:12:16] you know, handyman Sen [1:12:18] cleaning companies. I know one [1:12:19] of the concerns for the [1:12:26] neighborhood. Didn't one of [1:12:31] the concerns is that. They [1:12:31] don't they don't want, you [1:12:35] know, people that are. [1:12:36] Probably light drinking or [1:12:37] partying are being loud [1:12:39] because it is a really quiet [1:12:39] neighborhood. All the [1:12:42] neighbors are amazing. I [1:12:42] wouldn't want to the survey [1:12:46] any of these I have under [1:12:49] their be there's a setting [1:12:51] where you can either in stem [1:12:52] book or you have to approve of [1:12:53] the bookings. And this is what [1:12:56] I'm planning to do. 2 approval [1:12:57] of the book because even [1:13:00] myself, I wouldn't want any [1:13:02] party people or allow people [1:13:03] in my house that might be the [1:13:04] facility to trash the place or [1:13:10] doing our furniture. The first [1:13:11] few weeks that I didn't know [1:13:15] we needed to do a rezoning. We [1:13:17] had a a couple of guests that [1:13:19] everyone was really happy. Not [1:13:21] only with the house, but with [1:13:22] the convenience that they [1:13:24] didn't have to pay to 3 hotel [1:13:27] rooms and they have those [1:13:27] additional resources to [1:13:29] support the local shops in New [1:13:36] Braunfels. Do you have [1:13:40] questions for me? How did you [1:13:45] find out? I got a letter. [1:13:47] Basically we went live for him [1:13:49] and or be. And then after 2 [1:13:54] weeks they receive a letter. [1:13:56] someone complain? No, I think [1:13:59] it's I don't know. It's part [1:13:59] of the [1:14:00] >> of cd to monitor like other [1:14:01] air Bnb. Is that going live on [1:14:05] the city? And of course, know [1:14:08] it's a lot to ask. You know, [1:14:09] like we don't plan to sell [1:14:11] this property, this is [1:14:11] probably going to be one of [1:14:13] those retirement homes because [1:14:14] we really like the community [1:14:16] and we love the city. So [1:14:21] basically. If there's like in [1:14:24] a condition that you allow me [1:14:24] to the rezoning and even any [1:14:28] moment. We decide to sell, [1:14:31] they can cancel that. We don't [1:14:38] want any profit. Basically. [1:14:39] >> When was last time you [1:14:43] tried to lease the property? [1:14:44] Well, it's actually on the [1:14:45] market for long term. But no [1:14:51] luck. Do you know if you are [1:14:57] overpriced? Yes, we are [1:14:58] overpriced compared to other [1:14:58] properties. But to be honest [1:15:01] with you, this is a one unique [1:15:03] property. [1:15:03] >> Most of the properties [1:15:05] around the neighborhood, [1:15:05] there's Their 2 bedroom, one [1:15:10] bath. Between a 10900 square [1:15:12] feet. This is a 3 bedroom, 2 [1:15:14] bath and it's almost 1500 [1:15:16] square feet Icr 2300 a month. [1:15:21] Yeah. That's probably it is so [1:15:23] beautiful. Property is just [1:15:23] and you know, like I said, we [1:15:27] have a mortgage we actually [1:15:27] thought about decreasing the [1:15:31] price. And we did the crease [1:15:34] surprise last It's just it was [1:15:40] expensive. Still. I mean, this [1:15:41] case. I know most of the [1:15:42] families that where our guest [1:15:45] on their bnb up, they were [1:15:46] really grateful. The fact that [1:15:48] like I said, they had more [1:15:50] resources to spend in the [1:15:53] community and that they have a [1:15:54] private inconvenience place to [1:16:03] just travel a lot and events. [1:16:08] This is a public hearing. [1:16:09] >> Anyone think speak in favor [1:16:10] of this are opposed to Please [1:16:13] come forward. Seeing none. [1:16:16] We'll close the public [1:16:17] hearing. Commissioners [1:16:24] questions, comments, motions. [1:16:28] >> My comments, I guess. They [1:16:29] get think sympathize with the [1:16:33] situation financially. I do [1:16:36] think we have to. In my [1:16:40] opinion set that aside. You [1:16:41] know, real estate market as a [1:16:43] whole is not what it was 4 [1:16:43] years ago. [1:16:44] >> I think we have to be [1:16:45] careful using that as a [1:16:46] consideration because we can [1:16:50] see this popping up. [1:16:51] Especially given the current [1:16:52] climate. So my thoughts on [1:16:55] that. [1:16:56] >> And a notification. There [1:16:58] were some people neighbors are [1:16:59] objecting to. Is that correct? [1:17:05] Once on occasion, Mount. We've [1:17:06] had a Cooper live applicants [1:17:09] like this room. They were [1:17:12] looking change it to we've [1:17:13] discussed because it could [1:17:13] also be changed into an [1:17:18] office. Work goes over pretty [1:17:22] extensively in the 2 years. [1:17:23] >> So what's the distance of [1:17:26] the close us str? Mary? 700 [1:17:29] feet. [1:17:31] >> issue is this is big block. [1:17:36] You know, are too [1:17:37] >> That and the other str is [1:17:40] in a different basis. Only in [1:17:42] the light industrial zoning [1:17:42] surrounded by light industrial [1:17:44] commercial zone properties. So [1:17:45] >> and what's the closest [1:17:48] commercial to this? I know [1:17:54] there's industrial. [1:17:54] >> The closest commercial is a [1:17:59] probably. 150 feet on the [1:18:02] corner. And I think it's pine [1:18:03] rise that auto shop there on [1:18:07] the court. I have a question [1:18:10] for the applicant. [1:18:11] >> So what was vision or did [1:18:12] John not know? Y'all just kind [1:18:14] of got excited and started [1:18:16] remodeling or I mean? Did you [1:18:20] see yourself doing this? [1:18:21] >> Well, our vision was to [1:18:22] remodel and Lisa for a couple [1:18:24] of more years until my father [1:18:29] decided to retire. Which he [1:18:30] says he's going to do any [1:18:33] time. Some Bush think it keeps [1:18:34] >> But it's been it's been a [1:18:38] nice experience now that it's [1:18:39] furnance. [1:18:40] >> Like I mentioned, we [1:18:44] usually come to 3 times a [1:18:46] month with the family and we [1:18:47] love to spend time. I mean, [1:18:49] just passed everything, you [1:18:52] know, like the water bar wine. [1:18:53] We have a local coffee shops [1:18:56] and is just the community. Do [1:19:01] not intend to. I am 10 to [1:19:02] continue with the values of [1:19:04] the city of New Braunfels. I [1:19:05] know how with space and that's [1:19:06] one of the reasons why we [1:19:06] don't want to sell this We [1:19:07] don't want to be forced to [1:19:11] sell Because we really like [1:19:14] this So was an intention to [1:19:15] move into the House full-time [1:19:15] government. [1:19:19] >> Yes. [1:19:21] >> And I'm like I mentioned, I [1:19:22] mean, I understand one of the [1:19:26] concerns maybe with the with [1:19:29] the neighbors could be like [1:19:30] loud noises most of the [1:19:32] advertising that I do. It's to [1:19:34] welcome families.
