This is District 3 and 4. 77 00:06:54,630 --> 00:06:59,330 Our Assistant Community Development Director Mr. Ben Sewell is going to make 78 00:06:59,330 --> 00:07:05,110 the presentation for the county. Good evening Mr. Chairman and Board of Commissioners. 79 00:07:05,190 --> 00:07:09,170 Can you gentlemen hear me okay? Yes, I hear you. 80 00:07:09,810 --> 00:07:18,210 As you have referenced this item before you is rezoning petition 24-014 submitted by North Caledon investors 81 00:07:18,210 --> 00:07:20,790 and is referred to as Project Peach. 82 00:07:21,670 --> 00:07:27,430 The subject property is an assemblage of the seven tax parcels that are on the bottom of this slide 83 00:07:28,870 --> 00:07:31,730 totaling approximately 326 acres. 84 00:07:31,730 --> 00:07:34,970 The property is currently zoned rural conservation. 85 00:07:35,710 --> 00:07:42,590 The applicant is requesting to rezone the property to light industrial to develop a data center campus. 86 00:07:46,680 --> 00:07:52,140 The property is located near the intersection of Highway 29 North and Weldon Road. 87 00:07:52,620 --> 00:07:56,720 The western portion of the site spans both sides of Johnston Circle. 88 00:07:56,720 --> 00:08:04,340 As proposed, the development would remove a portion of Johnson Circle whereas currently connects to Highway 29. 89 00:08:06,500 --> 00:08:10,920 Accordingly, the applicant is planning to abandon that section of Johnson Circle. 90 00:08:11,740 --> 00:08:22,400 The proposed plan includes a primary and secondary entrance off of Weldon Road as well as a secondary entrance off of Highway 29. 91 00:08:23,900 --> 00:08:28,720 The site is bound to the southwest by the Palmetto North Industrial Park. 92 00:08:31,270 --> 00:08:38,110 It is bound to the north by the city of Palmetto with primarily undeveloped property and it 93 00:08:38,110 --> 00:08:42,610 is bound to the southeast by large estate lots. 94 00:08:47,300 --> 00:08:52,000 The conceptual site plan submitted with application proposes eight separate data center buildings 95 00:08:52,000 --> 00:08:59,680 with individual building sizes ranging from 150,000 square feet to around 350,000 square feet. 96 00:09:00,100 --> 00:09:05,120 In total, the site would include approximately 2.1 million square feet under roof. 97 00:09:06,420 --> 00:09:11,940 Additionally, the plan indicates a roughly 13-acre pad for an electric substation. 98 00:09:12,640 --> 00:09:19,480 This substation would be located near the current northern entrance of Johnston Circle and the railroad tracks. 99 00:09:19,480 --> 00:09:20,620 These 100 00:09:24,110 --> 00:09:28,470 are photos of the site from that perspective at Johnson Circle looking 101 00:09:28,470 --> 00:09:35,450 across to the Palmetto Baptist Church. The photo to the bottom left is from the 102 00:09:35,450 --> 00:09:39,930 Palmetto Baptist Church looking back into the site and the photo at the top 103 00:09:39,930 --> 00:09:44,150 right is looking north toward the town of Palmetto from that intersection. 104 00:09:47,870 --> 00:09:52,290 This site is internal to the site approximately where the cul-de-sac 105 00:09:52,290 --> 00:09:58,210 for Johnson Circle will be implemented if approved and 106 00:10:02,080 --> 00:10:03,700 this is a photo of the 107 00:10:03,700 --> 00:10:08,660 site from the Weldon Road perspective. Weldon Road is predominantly overstory 108 00:10:08,660 --> 00:10:11,300 forest with exception of this drive cut into the site. 109 00:10:15,580 --> 00:10:16,660 These are proposed 110 00:10:16,660 --> 00:10:21,560 renderings submitted by the applicant of what the development should look 111 00:10:21,560 --> 00:10:22,760 like after construction. 112 00:10:27,460 --> 00:10:29,500 As you know amendments to the zoning map are 113 00:10:29,500 --> 00:10:32,160 reviewed by 14 standards under Article 29. 114 00:10:32,960 --> 00:10:35,600 Staff has chosen to highlight four standards that are most 115 00:10:35,600 --> 00:10:36,940 applicable to this application. 116 00:10:37,760 --> 00:10:40,720 According to the comprehensive plan, the subject property is 117 00:10:40,720 --> 00:10:43,980 located within the priority development character area and 118 00:10:43,980 --> 00:10:47,420 lies within the growth priority tier as shown on the growth 119 00:10:47,420 --> 00:10:48,320 strategy map. 120 00:10:49,300 --> 00:10:51,140 Number two, the priority development character 121 00:10:51,140 --> 00:10:53,520 area indicates that new development should be 122 00:10:53,520 --> 00:10:57,480 designated with multiple entry points to avoid creating 123 00:10:57,480 --> 00:11:02,620 stress on high traffic roads. It is important to ensure that water sewer and 124 00:11:02,620 --> 00:11:06,480 road infrastructure are provided concurrently with the development. Most 125 00:11:06,480 --> 00:11:10,220 of the permitted uses within the light industrial district would not be 126 00:11:10,220 --> 00:11:15,800 supported in these character areas. Number three, the growth priority tier 127 00:11:15,800 --> 00:11:19,360 indicates that existing communities should be protected from adverse 128 00:11:19,360 --> 00:11:24,400 impacts of new development with greater intensity of land use. It 129 00:11:24,400 --> 00:11:28,180 recommends that industrial development should occur in existing industrial 130 00:11:28,180 --> 00:11:33,920 districts where necessary improvements are already in place. Based upon the 131 00:11:33,920 --> 00:11:38,240 above information, the comprehensive plan does not support the industrial 132 00:11:38,240 --> 00:11:42,500 zoning for this area. However, it's important to note that when the 133 00:11:42,500 --> 00:11:46,580 comprehensive plan was adopted in 2021, data centers were only beginning 134 00:11:46,580 --> 00:11:50,660 to emerge as a topic of discussion in the county and were not 135 00:11:50,660 --> 00:11:53,340 significant considerations in land use planning. 136 00:11:57,370 --> 00:11:58,870 Should this board choose to 137 00:11:58,870 --> 00:12:03,990 approve the rezoning request, community development submits the following 21 138 00:12:03,990 --> 00:12:08,910 conditions for consideration. I'm going to try to read these as quick as 139 00:12:08,910 --> 00:12:13,650 possible and you gentlemen feel free to stop me if you have any questions as 140 00:12:13,650 --> 00:12:17,870 we go along and I'm going to see if I can minimize Commissioner Smith so that 141 00:12:19,310 --> 00:12:21,830 I can read the conditions in verbatim. 142 00:12:22,870 --> 00:12:26,570 Number one, the subject property shall be conditionally zoned for a data center operation. 143 00:12:27,050 --> 00:12:33,090 Number two, all Calvary to County Code of Ordinances shall be adhered to unless a variance is granted through the normal review process. 144 00:12:33,810 --> 00:12:46,650 Number three, the developer shall donate right of way from PID 1177065005 to allow for the relocation of Palmatta Tyrone Road at its intersection with Weldon Road 145 00:12:46,650 --> 00:12:50,730 from its current location to a 0.220 feet east of the existing intersection. 146 00:12:51,650 --> 00:12:56,670 The developer shall also contribute $1 million to the county to be used for the design and 147 00:12:56,670 --> 00:13:01,070 construction of the intersection relocation and intersection improvement project. 148 00:13:01,950 --> 00:13:07,250 Number four, intersection and stopping site distance that meets AASHTO requirements 149 00:13:07,250 --> 00:13:13,610 must be provided for proposed driveway A. Number five, the developer shall contribute 151 00:13:19,510 --> 00:13:24,450 $25,000 towards the cost of signal timing modifications at the intersection of Collins 152 00:13:24,450 --> 00:13:30,230 Worth Road and Tingle Lane. Number six, construction traffic to and from the development 153 00:13:30,230 --> 00:13:34,930 or associated with the development shall not utilize Johnson Circle to travel to or from 154 00:13:34,930 --> 00:13:35,830 the development tract. 155 00:13:48,700 --> 00:13:52,960 Excuse me. Number seven, if traffic issues arise during construction 156 00:13:52,960 --> 00:13:57,540 of the project due to construction traffic. The developer shall design and construct left 157 00:13:57,540 --> 00:14:04,440 and right turn lanes at Site Driveway B along Weldon Road. Site Driveway B shall remain gated 158 00:14:04,440 --> 00:14:10,760 after construction. Number eight, the proposed rejection lane at Site Driveway A shall be 159 00:14:10,760 --> 00:14:17,180 constructed as a one-way drive to accommodate outbound traffic only. Number nine, the developer 160 00:14:17,180 --> 00:14:22,240 shall design and construct a cul-de-sac at the intersection of Johnston Circle and 161 00:14:22,240 --> 00:14:23,540 In the existing property line, 162 00:14:25,620 --> 00:14:28,280 the portion of Johnson Circle within the property shall 163 00:14:28,280 --> 00:14:29,440 be abandoned by the county. 164 00:14:30,220 --> 00:14:33,480 The developer shall donate right-of-way for future maintenance of the cul-de-sac. 165 00:14:34,060 --> 00:14:37,200 The proposed emergency access to Johnson Circle shall be gated. 166 00:14:38,080 --> 00:14:44,420 Number 10, the applicant shall coordinate with public works and provide all required 167 00:14:44,420 --> 00:14:48,940 documentation for the portion of right-of-way abandonment along Johnson Circle to be 168 00:14:48,940 --> 00:14:50,720 approved by the Board of Commissioners. 169 00:14:51,460 --> 00:14:57,120 11. Sewell at this time 213 00:19:14,080 --> 00:19:25,560 does the applicant wish to speak okay come forward would you please and give to 214 00:19:25,560 --> 00:19:32,960 the unless you need the computer there okay give give us your name and your 215 00:19:32,960 --> 00:19:42,240 address or if you are in a particular district if you know that but if you 216 00:19:42,240 --> 00:19:47,540 don't want to give you a personal address but that's Mr. Chairman members 217 00:19:47,540 --> 00:19:52,640 of the Commission Commissioner Smith out there in zoom land good to be with all 218 00:19:52,640 --> 00:19:57,460 of y'all tonight my name is Arthur Edge I'm here on behalf of the 219 00:19:57,460 --> 00:20:02,020 applicants here this evening North Cali to investors and they're partnering 220 00:20:02,020 --> 00:20:10,480 with Cyrus I. I live at 118 Pickens Drive, noon in Georgia, 30263. Mr. Sewell did a very 221 00:20:10,480 --> 00:20:16,860 good job of sort of giving you the highlights of our application. I did want to note just 222 00:20:16,860 --> 00:20:21,520 for the record before I start that obviously our application is part of the record. I also 223 00:20:21,520 --> 00:20:25,640 submitted a constitutional letter last week that should be part of the record as well. 224 00:20:26,960 --> 00:20:32,740 As Mr. Sewell said, this is an application to locate a data center campus on approximately 225 00:20:32,740 --> 00:20:37,140 326 acres on a site in unincorporated Cavity County. 226 00:20:37,820 --> 00:20:42,860 The property is adjacent to State Route 29 and Weldon Road, and we are requesting rezoning 227 00:20:43,310 --> 00:20:47,920 from RC Rural Conservation to LM Light Industrial. 228 00:20:49,020 --> 00:20:54,380 As noted by Mr. Sewell, upon completion of this project, it will consist of eight 229 00:20:54,380 --> 00:21:00,000 buildings of approximately 2.1 million square feet. There will be eight data center buildings 230 00:21:00,000 --> 00:21:06,720 there. I think it's also important for the board to note that this will be a phase construction 231 00:21:08,100 --> 00:21:13,100 through 2036 as our anticipation. So this will not all be happening at one time, but 232 00:21:13,100 --> 00:21:19,040 it will of course depend on demand for the data center. The construction value 233 00:21:19,040 --> 00:21:23,480 you once it is fully built out will be approximately $1 billion. 234 00:21:24,660 --> 00:21:29,960 That does not include the server equipment that will be housed there but simply the construction 235 00:21:29,960 --> 00:21:30,720 of the buildings. 236 00:21:32,030 --> 00:21:38,500 The employee count, we estimate probably about 500 construction jobs being necessary 237 00:21:38,500 --> 00:21:44,960 for the completion of the data center campus and we've anticipated upon full buildout 238 00:21:44,960 --> 00:21:49,140 We'll have about 50 full-time jobs in project completion. 239 00:21:49,740 --> 00:21:53,600 The electrical load will be about 700 megawatts. 240 00:21:54,340 --> 00:22:00,440 We have already been in discussions and have as much assurance as we can at this point 241 00:22:00,440 --> 00:22:03,600 from Georgia Power that they will be serving the load. 242 00:22:03,880 --> 00:22:10,040 Their policy is, as the board may know, not to do anything finalized until the 243 00:22:10,040 --> 00:22:11,600 rezoning has been approved. 244 00:22:11,600 --> 00:22:18,460 But we are confident that that will take place and we will be able to secure a letter from 245 00:22:18,460 --> 00:22:22,840 Georgia Power, verifying they will serve the data center campus. 246 00:22:23,860 --> 00:22:30,180 The access it was touched upon by Mr. Sewell, primarily off Weldon Road, there will be four 247 00:22:30,180 --> 00:22:36,240 driveways that will be utilized, some of which for emergency if necessary. 248 00:22:37,960 --> 00:22:40,360 Utilities I mentioned, the power on the water. 249 00:22:40,360 --> 00:22:46,920 The water and wastewater will be handled by the Caledon Water and Sewage Authority. 250 00:22:47,640 --> 00:22:52,800 We'll be looking at building a 2.6 mile line extension to handle this. 251 00:22:53,600 --> 00:23:00,520 We anticipate that full build out will be talking somewhere between 80 to 100,000 gallons a day of water. 252 00:23:01,260 --> 00:23:06,480 I also want to state for the board that I think it's very, very important for you to understand 253 00:23:06,480 --> 00:23:11,720 that this data center campus these buildings will be air-cooled not water 254 00:23:11,720 --> 00:23:16,160 cooled and so we will not be using the the level of water you often hear 255 00:23:16,160 --> 00:23:19,800 sometimes referenced in other data center projects and we will not be 256 00:23:19,800 --> 00:23:26,260 releasing any water into the water supply that has been used to treat these 257 00:23:26,260 --> 00:23:32,220 these servers and the other equipment in the data centers. 258 00:23:34,480 --> 00:23:35,400 From a waste 259 00:23:35,400 --> 00:23:39,980 standpoint, there'll be no hazardous waste generated at the site at full 260 00:23:39,980 --> 00:23:46,000 build out again through 2036. We anticipated generating about 400 tons 261 00:23:46,000 --> 00:23:54,320 of waste annually. Now recycling Cyrus one's experience with this last 262 00:23:54,320 --> 00:23:58,860 year at their other sites, other data center sites, they accomplished a 46 263 00:23:58,860 --> 00:24:03,520 percent recycling rate and they hope to improve upon that. But so far, 264 00:24:03,520 --> 00:24:04,500 or that's what they've accomplished. 265 00:24:05,220 --> 00:24:09,140 That would leave approximately a little over 200 tons annually 266 00:24:09,140 --> 00:24:12,340 to go to the landfill in 2036. 267 00:24:13,080 --> 00:24:15,780 And as mentioned, an on-site electrical substation 268 00:24:15,780 --> 00:24:17,320 is planned as well. 269 00:24:18,180 --> 00:24:20,900 We have successfully completed the DRI process. 270 00:24:21,940 --> 00:24:24,740 The conditions that were noted by Mr. Sewell 271 00:24:24,740 --> 00:24:26,620 are acceptable to the applicants. 272 00:24:27,440 --> 00:24:30,420 And we fully intend to comply with each and every one of them. 273 00:24:30,420 --> 00:24:31,960 and we find them reasonable. 274 00:24:33,800 --> 00:24:35,000 That's a brief overview. 275 00:24:35,660 --> 00:24:38,200 You're going to hear from some other members very briefly 276 00:24:38,620 --> 00:24:40,620 from each of our other team members. 277 00:24:41,160 --> 00:24:43,160 They're going to touch upon the economic impact 278 00:24:43,800 --> 00:24:47,140 of this project, the taxes that we 279 00:24:47,140 --> 00:24:49,200 expect to be generated from the project. 280 00:24:49,960 --> 00:24:51,860 They'll talk about the site plan a little bit, 281 00:24:51,980 --> 00:24:54,340 the building construction, the materials, and so forth, 282 00:24:54,860 --> 00:24:58,000 the traffic, and the noise that will be generated. 283 00:24:58,000 --> 00:25:01,500 and also talk about the cooling that I mentioned previously. 284 00:25:03,560 --> 00:25:08,720 Just to sum up, we feel like this project fits the general character of the area. 285 00:25:09,400 --> 00:25:15,040 As was noted, there was an industrial park to the west of the site. 286 00:25:15,040 --> 00:25:19,880 Again, I'm going to warn you, we don't need any outburst. 287 00:25:20,920 --> 00:25:25,700 You might think something's funny, you might think something is not funny. 288 00:25:26,700 --> 00:25:33,720 but keep your comments to yourself as I will instruct folks when you get up to 289 00:25:33,720 --> 00:25:38,660 speak to also he is speaking to the Commission and I'm asking you very 290 00:25:39,940 --> 00:25:45,920 politely and as courteous as I can let's be respectful I'm sorry miss. No 291 00:25:45,920 --> 00:25:52,340 thank you Mr. Chairman there will not be a huge drain on the water resources of the 292 00:25:52,340 --> 00:25:57,800 county. As a result of this project, we think it will be of immense benefit to the county 293 00:25:57,800 --> 00:26:03,340 from a job standpoint, a tax standpoint, and really the great thing about a project like 294 00:26:03,340 --> 00:26:08,400 this, they do generate a lot of jobs and taxes, but they do not require a lot of services 295 00:26:08,950 --> 00:26:14,080 as a subdivision or some other development might require. So for all these reasons 296 00:26:14,080 --> 00:26:19,580 we're asking that you grant our application for rezoning, and I'm going to turn, I'll 297 00:26:19,580 --> 00:26:26,020 Retain the balance of my time and I'll turn it over to some of our team members to talk about these items that I mentioned unless they're questions 298 00:26:27,720 --> 00:26:29,540 They're gonna they're gonna speak 299 00:26:31,120 --> 00:26:36,140 We have yes have any that has signed it. Yes, Mr. Chairman. We signed them up. Yes, sir 300 00:26:37,660 --> 00:26:39,460 Questions, would you call you first? 301 00:26:40,900 --> 00:26:43,060 Yes, sir. Mr. Chairman of Brad health 302 00:26:48,150 --> 00:26:51,630 again your name and address or if you 303 00:26:53,370 --> 00:26:53,930 Brad. 304 00:26:54,390 --> 00:26:58,770 Brad Hout with Cyrus One, 2850 North Harwood Street, Dallas, Texas. 305 00:26:59,590 --> 00:27:00,830 Thank you, Chairman. 306 00:27:01,090 --> 00:27:01,890 Thank you, commissioners. 307 00:27:01,910 --> 00:27:06,210 Appreciate the time tonight to provide some background on the proposed project here in 308 00:27:06,210 --> 00:27:06,810 Coyita County. 309 00:27:07,750 --> 00:27:12,230 So as a matter of introduction, Cyrus One, we're a global data center owner, operator 310 00:27:12,230 --> 00:27:13,970 and developer based in Dallas, Texas. 311 00:27:14,510 --> 00:27:16,770 We have 50 locations across the globe. 312 00:27:16,770 --> 00:27:22,870 We employ over 1,000 people who are tasked with operating, maintaining, and securing these 313 00:27:22,870 --> 00:27:26,670 data center campuses and the critical information that they store. 314 00:27:27,770 --> 00:27:34,050 This site we've identified as part of our overall expansion strategy and they've worked to 315 00:27:34,050 --> 00:27:36,910 develop a campus that we're presenting to you tonight. 316 00:27:38,170 --> 00:27:39,670 Steve, if you move on to the next slide. 317 00:27:40,390 --> 00:27:43,790 Our company has a commitment to be carbon neutral by 2030. 318 00:27:43,790 --> 00:27:46,110 We have full details of that on our website. 319 00:27:47,500 --> 00:27:54,810 The report is available highlighting all of the different facets that we take to maintain 320 00:27:54,810 --> 00:27:57,490 sustainability, and again, that's on our website. 321 00:27:59,010 --> 00:28:02,450 Just the economic headline skin and touch on a lot of these. 322 00:28:03,650 --> 00:28:09,990 Campuses developed over seven to ten years, $1.1 billion in investment, 49 permanent 323 00:28:09,990 --> 00:28:16,470 These are jobs that are utilizing people from a variety of backgrounds and skills and expertise in trades. 324 00:28:17,250 --> 00:28:25,130 500 construction jobs are sustained there over the life cycle of the development, producing $100 million in new tax revenue for the county. 325 00:28:25,890 --> 00:28:31,170 So diving into the tax revenue for the county, I have a couple additional slides here to highlight the economic impact. 326 00:28:31,610 --> 00:28:32,270 Steve, if you would. 327 00:28:32,930 --> 00:28:34,310 on the construction side. 328 00:28:34,510 --> 00:28:36,490 So non-exempt construction material purchases. 329 00:28:36,730 --> 00:28:38,530 These are purchases that are not covered 330 00:28:38,530 --> 00:28:40,730 or not exempted by the state's data center 331 00:28:40,730 --> 00:28:42,030 and sales use tax exemption. 332 00:28:43,330 --> 00:28:45,750 Targeting a $500 million material spend, 333 00:28:45,890 --> 00:28:47,770 there's $15 million in sales taxes there. 334 00:28:48,350 --> 00:28:50,130 The power that we use is gonna be subject 335 00:28:50,130 --> 00:28:53,230 to the county's tax rate, utility tax rate. 336 00:28:53,870 --> 00:28:56,310 And that's estimated at $34 million over 10 years. 337 00:28:56,950 --> 00:28:59,010 And then the real personal property taxes 338 00:28:59,010 --> 00:29:01,830 were the first 10 years targeted at $57.2 million. 339 00:29:02,570 --> 00:29:03,930 And so in that graph to the bottom, 340 00:29:04,030 --> 00:29:06,950 you see the ramp up of the tax dollars over time 341 00:29:06,950 --> 00:29:08,210 as we developed this campus. 342 00:29:08,690 --> 00:29:09,870 Once the campus is in place, 343 00:29:10,030 --> 00:29:11,330 those tax dollars are sustained 344 00:29:11,780 --> 00:29:12,870 for the life of the campus. 345 00:29:13,610 --> 00:29:16,390 And so the economic impact that we create, 346 00:29:16,550 --> 00:29:18,110 again, has sustained over multiple years. 347 00:29:18,990 --> 00:29:20,630 Taking further into the property taxes, 348 00:29:20,970 --> 00:29:23,870 I did split up the impact of the property taxes 349 00:29:23,870 --> 00:29:24,810 to the county and the school. 350 00:29:24,970 --> 00:29:26,010 Steve, if you would go to the next one. 351 00:29:26,770 --> 00:29:31,530 On the left side are all the taxes that I mentioned, and we stabilized at $10.8 million 352 00:29:31,530 --> 00:29:33,330 in taxes when we're stabilized. 353 00:29:33,930 --> 00:29:40,670 Of that amount, $2.2 million annually goes to the county, $7.23 annually goes to the schools. 354 00:29:41,350 --> 00:29:46,450 Over 10 years, that's $38 million to the schools and $11 million to the county. 355 00:29:47,630 --> 00:29:49,770 And finally, I have one last slide. 356 00:29:49,890 --> 00:29:51,930 I did want to just mention the non-financial impact. 357 00:29:51,930 --> 00:29:54,770 And so, we've been in business for 25 years. 358 00:29:55,250 --> 00:29:58,050 We're good citizens and good neighbors in the communities that we locate in. 359 00:29:59,390 --> 00:29:59,830 We... 360 00:30:00,000 --> 00:30:03,480 We have the ability to make a real impact here, not just from our workforce, but our contributions 361 00:30:03,480 --> 00:30:08,080 to community events and community initiatives. So thank you for your time. I appreciate it. 362 00:30:08,100 --> 00:30:08,240 Thank you. 363 00:30:10,370 --> 00:30:12,210 Next, Mr. Chairman, Zach Randolph. 364 00:30:18,280 --> 00:30:23,700 Ladies and gentlemen, Zach Randolph with Kimley Horan, I'm a civil engineer. So what I wanted 365 00:30:23,700 --> 00:30:28,120 to do is talk you through the site plan today. As mentioned before, we have eight buildings 366 00:30:28,120 --> 00:30:32,860 and one substation proposed for this campus. Our primary access point is in the southwest 367 00:30:32,860 --> 00:30:37,920 less corner along Weldon Road, and then our secondary access point is shown in the southeast 368 00:30:37,920 --> 00:30:39,620 corner along Weldon Road as well. 369 00:30:40,340 --> 00:30:47,580 We do have two, I'll say, emergency maintenance access points on US 29, and then where Johnson 370 00:30:47,580 --> 00:30:49,560 Circle does a cul-de-sac we've put at the end there. 371 00:30:51,220 --> 00:30:55,140 One thing that I did want to note, as mentioned by Mr. Sewell, is that our intent is to 372 00:30:55,140 --> 00:30:57,800 abandon a portion of 29 as part of this project. 373 00:30:58,680 --> 00:31:02,080 Looking at the site layout, we have really tried to focus on pushing the buildings 374 00:31:02,080 --> 00:31:05,720 towards the center of the site and south of the existing power line that is out there 375 00:31:05,720 --> 00:31:10,460 today working within the existing stream branches that fall within the site. 376 00:31:10,940 --> 00:31:13,180 You can see the buffers called out with the dash lines to the middle. 377 00:31:14,700 --> 00:31:18,040 And then the second thing would be that we're working with the existing topography that's 378 00:31:18,040 --> 00:31:21,940 present on the site to try to work to shield the buildings and work within the natural 379 00:31:21,940 --> 00:31:22,680 topography there. 380 00:31:24,540 --> 00:31:27,600 This is just a landscape rendering of what we think the project will look like. 381 00:31:27,660 --> 00:31:31,100 I want to highlight that the intent is to place trees throughout the development 382 00:31:31,100 --> 00:31:35,280 along the roads at the stormwater ponds and then along the front and kind of 383 00:31:35,280 --> 00:31:40,980 the perimeter of the site. And then these are five sight lines that we've 384 00:31:40,980 --> 00:31:44,880 cut around the development so looking kind of clockwise starting along Weldon 385 00:31:44,880 --> 00:31:48,640 Road in the southeast corner is the top one and what I want to highlight here is 386 00:31:48,640 --> 00:31:52,840 our building which is identified as building eight is actually lower in 387 00:31:52,840 --> 00:31:55,620 elevation than the adjacent adjacent parcel so what we're doing is putting 388 00:31:55,620 --> 00:31:59,380 that building low utilizing the existing hundred foot buffer and the 389 00:31:59,380 --> 00:32:02,300 existing trees off-site to screen the building from the adjacent uses. 390 00:32:02,900 --> 00:32:07,720 The next two, if we work kind of down those sight lines, are focused on the views from 391 00:32:07,720 --> 00:32:09,700 across Weldon Road to the development. 392 00:32:10,200 --> 00:32:16,080 Want to highlight here that we are proposing to include berms and buffers as a way to build 393 00:32:16,080 --> 00:32:20,820 up the topography in front of these buildings and screen them from the view corridor from 394 00:32:20,820 --> 00:32:21,300 Weldon Road. 395 00:32:21,700 --> 00:32:26,320 The fourth one from the top is the view line that does run into the site right at 396 00:32:26,320 --> 00:32:27,280 the front entrance point. 397 00:32:27,280 --> 00:32:31,260 So I do want to highlight there that aligns with the condition around a break in the berm 398 00:32:31,260 --> 00:32:33,760 and buffer for that actual driveway right there. 399 00:32:34,040 --> 00:32:40,260 And then the fifth one on the bottom is for the sight line from 29 towards the substation. 400 00:32:40,560 --> 00:32:45,260 What you can see there as well, we're trying to utilize a berm and buffer with some plantings 401 00:32:45,260 --> 00:32:48,960 to screen the view from the public right of way on the far side of the railroad 402 00:32:48,960 --> 00:32:49,260 track. 403 00:32:49,800 --> 00:32:50,700 That's all I have today. 404 00:32:50,800 --> 00:32:51,020 Thank you. 405 00:32:51,440 --> 00:32:51,880 Thanks. 406 00:32:52,000 --> 00:32:52,400 Thanks. 407 00:32:53,300 --> 00:32:54,140 Thanks, Mr. Chairman. 408 00:32:54,340 --> 00:32:54,780 John Walker. 409 00:32:59,880 --> 00:33:04,460 Hello, John Walker, traffic engineer with the firm Kimley Horn and Associates. 410 00:33:04,640 --> 00:33:07,940 We're located at 11-720 Amber Park Drive, Alpharetta. 411 00:33:08,640 --> 00:33:12,600 So due to the size of the development, the square footage, it does fall into the development 412 00:33:12,600 --> 00:33:13,980 of regional impact, DRI. 413 00:33:14,240 --> 00:33:18,580 So we did go through the DRI process with the Three Rivers Regional Commission, Greta, 414 00:33:19,100 --> 00:33:20,960 Georgia DOT, and Coweta County staff. 415 00:33:21,140 --> 00:33:25,680 One thing I want to point out is the ITE trip generation manual. 416 00:33:25,680 --> 00:33:29,760 That's a manual that we use across the entire country, tells us that a data center of this 417 00:33:29,760 --> 00:33:32,220 size would generate 2,080 trips per day. 418 00:33:32,580 --> 00:33:35,500 That's roughly 1,000 trips in, 1,000 trips out, over 24 hours. 419 00:33:36,060 --> 00:33:39,280 We have our own internal client here that's Cyrus one. 420 00:33:40,340 --> 00:33:43,020 It's roughly about 822 daily trips. 421 00:33:43,540 --> 00:33:48,400 About 60% less traffic than what ITE manual suggests, so I just want to let you know 422 00:33:48,400 --> 00:33:52,420 that this site will probably generate 60% less than what our traffic study documented, 423 00:33:52,420 --> 00:33:59,060 but nevertheless we used the higher trip rate per Greta and what was mentioned earlier Mr. 424 00:33:59,160 --> 00:34:04,040 Sewell talked about the Greta Notice of Decision Attachment A which is a number of improvements 425 00:34:04,040 --> 00:34:09,860 mentioned and then the staff got that and provided some additional detail to the conditions 426 00:34:09,860 --> 00:34:15,040 and in summary we are going to create turn lanes at both our site driveways 427 00:34:15,040 --> 00:34:21,440 on Weldon Road and also we're going to make a monetary contribution for some of the off-site 428 00:34:21,440 --> 00:34:25,660 improvements. The first one relocation of Palmetto Tyrone Road at Weldon Road 429 00:34:25,660 --> 00:34:30,200 one million dollar monetary contribution that's per the staff report. We've 430 00:34:30,200 --> 00:34:35,140 accepted that. The next one signal timing modifications $25,000 again per 431 00:34:35,140 --> 00:34:38,560 staff report. We've agreed with that that's in the condition. This last one 432 00:34:38,560 --> 00:34:42,720 I'll bring your attention to it. Turn lane extensions along Highway 29 and 433 00:34:42,720 --> 00:34:47,740 also at the I-85 exit ramp. Lengthen those turn lanes. There is no 434 00:34:47,740 --> 00:34:51,980 monetary dollar amount in the staff report. So we're on behalf of the applicant going 435 00:34:51,980 --> 00:34:57,100 to say up to $500,000 for those off-site improvements since the first two had a dollar 436 00:34:57,100 --> 00:35:01,720 amount assigned. I felt like we should probably put a dollar amount for that one. Again, up 437 00:35:01,720 --> 00:35:07,360 to $500,000 for that one as well. One slide for me. That's it. Thank you. 438 00:35:09,670 --> 00:35:12,570 Thank you. Next, Ms. Chairman, Laurel Cottrell. 439 00:35:20,150 --> 00:35:24,670 Laurel Cottrell, Director of Environmental Compliance with Cyrus I, 2850 North Hardwood 440 00:35:24,670 --> 00:35:25,970 Street, Dallas, Texas. 441 00:35:28,830 --> 00:35:34,710 So environmental noise is what I'm speaking about and to dig right in, first I want to 442 00:35:34,710 --> 00:35:38,350 talk about our objectives with respect to environmental noise with Project Peach and 443 00:35:38,350 --> 00:35:39,610 really it's two simple things. 444 00:35:39,810 --> 00:35:44,030 One make sure we're compliant with noise code requirements and two make sure we're 445 00:35:44,030 --> 00:35:44,670 a good neighbor. 446 00:35:45,150 --> 00:35:49,650 These are our objectives wherever we develop across the country and really across the 447 00:35:50,510 --> 00:36:03,010 And to talk through how we achieve those objectives, I'm going to go through quickly three questions that we commonly receive from community members and people like you all when we go into a new community. 448 00:36:03,750 --> 00:36:07,890 So with that first question, what will the noise sources even be? 449 00:36:08,310 --> 00:36:10,330 For us, we're not a heavy industrial source. 450 00:36:10,790 --> 00:36:14,490 We have very simple buildings with very simple noise sources. 451 00:36:14,490 --> 00:36:19,670 And those noise sources include one, cooling equipment, and two, emergency generators. 452 00:36:20,230 --> 00:36:23,370 Our cooling equipment, again, is air-cooled chillers. 453 00:36:24,030 --> 00:36:27,890 Those chillers have fans and compressors that do generate some noise. 454 00:36:28,490 --> 00:36:32,330 Our generators are backup emergency generators. 455 00:36:32,870 --> 00:36:35,610 They run intermittently over the course of the year. 456 00:36:35,710 --> 00:36:40,030 If there's no power outage, we might expect them to run a total of 10 to 15 hours 457 00:36:40,030 --> 00:36:41,970 each over the entire year. 458 00:36:41,970 --> 00:36:46,090 So these two-noise sources are very simple. They're very well constrained. 459 00:36:46,530 --> 00:36:53,730 Because they are simple and well constrained, it makes it easy for us to evaluate and mitigate ahead of time like we're doing now. 460 00:36:55,030 --> 00:37:00,050 Next question, how quiet will the data center be? Sometimes this question comes in as how loud will it be, 461 00:37:00,150 --> 00:37:02,530 but I like to rephrase it as how quiet it will be. 462 00:37:02,530 --> 00:37:11,650 I like to use this table which correlates objective decibel limits to subjective how 463 00:37:11,650 --> 00:37:13,970 loud is that type descriptions. 464 00:37:14,930 --> 00:37:21,230 So the short answer to how quiet it will be, it will be quiet or very quiet depending on 465 00:37:21,230 --> 00:37:22,830 how far you are from our facility. 466 00:37:23,530 --> 00:37:27,930 So each of our facilities, if you look at the bracket at the bottom of the table there 467 00:37:27,930 --> 00:37:33,430 where it tends to land in that 60 decibel or less range in the community surrounding 468 00:37:33,430 --> 00:37:39,750 our facilities, and obviously that decreases as you increase distance from the facility. 469 00:37:40,210 --> 00:37:43,770 That's based on worst case modeling, max cooling capacity, et cetera. 470 00:37:43,810 --> 00:37:46,370 It's a very conservative planning approach that we use. 471 00:37:47,250 --> 00:37:54,770 The 50 to 60 decibel range at the top of that tends to be where community decibel 472 00:37:54,770 --> 00:37:57,870 limits live for different jurisdictions around the country. 473 00:37:58,250 --> 00:38:02,870 So in terms of trying to meet our good neighbor objectives and code objectives, you know, falling 474 00:38:02,870 --> 00:38:06,390 within this bracket really achieves both of those objectives. 475 00:38:08,270 --> 00:38:12,990 And then to tie it together, how we use that information to make sure we're meeting those 476 00:38:12,990 --> 00:38:17,330 objectives for Project Peat specifically, basically we're doing detailed acoustic 477 00:38:17,330 --> 00:38:21,550 studies and making sure we're feeding those acoustic studies back into design, 478 00:38:21,550 --> 00:38:26,330 make sure we're checking the box with being good neighbor and being compliant with code requirements. 479 00:38:30,460 --> 00:38:34,840 Thank you. Next, Mr. Chairman, Matt Fortier. 480 00:38:37,680 --> 00:38:39,320 Good evening, commissioners. Matt Fortier 481 00:38:39,320 --> 00:38:46,520 with Cyrus 1, 2850 North Harwood Street. I wanted to highlight one of the most important aspects 482 00:38:46,520 --> 00:38:52,020 of data center sustainability. Traditionally, data centers consume millions of gallons of 483 00:38:52,020 --> 00:38:56,840 water annually just for their cooling. This can provide a significant impact on the community 484 00:38:56,840 --> 00:39:03,560 and water resources. Our approach at Cirrus One is different and purposely so. At Cirrus One we've 485 00:39:03,560 --> 00:39:08,980 developed a fully closed air loop system that we've deployed across 50 locations within our 486 00:39:08,980 --> 00:39:10,260 portfolio to date. 487 00:39:12,500 --> 00:39:16,120 This dramatically reduces the environmental impact when it comes to water. 488 00:39:17,060 --> 00:39:22,660 Once our systems are charged we use zero gallons of water annually. That means no makeup 489 00:39:22,660 --> 00:39:32,320 up water, no evaporative cooling, and no secretive draw on the public system. 490 00:39:34,940 --> 00:39:39,680 Because it's a close-up system, we're not using chemical treatment to use on the water 491 00:39:39,680 --> 00:39:41,500 or putting that back into the wastewater. 492 00:39:42,500 --> 00:39:47,900 The only water we do use at our facilities is for basic occupancy needs such as flushing 493 00:39:47,900 --> 00:39:56,420 toilets, sinks, minor humidification, and for our fire sprinkler protection system in 494 00:39:56,420 --> 00:39:57,380 the event of emergency. 495 00:39:59,120 --> 00:40:04,540 These are minimal systems that are standard through commercial and industrial buildings. 496 00:40:06,020 --> 00:40:09,660 We've met with the Water and Sewer Authority to coordinate on these minimal efforts as 497 00:40:09,660 --> 00:40:12,780 well to ensure they're not burdening the current system. 498 00:40:13,540 --> 00:40:17,080 We know that water is one of the most vital resources a community manages. 499 00:40:18,100 --> 00:40:20,240 We take that seriously at Cyrus 1. 500 00:40:20,960 --> 00:40:23,680 This is a commitment for us more than just a design principle. 501 00:40:25,080 --> 00:40:29,480 We're proud of this design and the minimal impact it has on the surrounding community. 502 00:40:30,140 --> 00:40:36,260 And we hope that it demonstrates in our presentation also the kind of partner we intend to be. 503 00:40:36,880 --> 00:40:37,540 Thank you for John. 504 00:40:38,960 --> 00:40:39,660 Thank you. 505 00:40:40,400 --> 00:40:43,960 Mr. Chairman, that concludes those signed up in support. 506 00:40:45,100 --> 00:40:45,940 Let's start with opposition. 507 00:40:46,620 --> 00:40:47,000 Absolutely. 508 00:40:47,780 --> 00:40:52,560 Just a reminder, according to your meeting rules, there is 20 minutes for and against. 509 00:40:53,160 --> 00:40:57,840 We have quite a few signed up in opposition, so just to remind those that have signed up, 510 00:40:57,980 --> 00:41:01,120 we will get to where we may exhaust the 20 minutes and I'll let you know. 511 00:41:01,720 --> 00:41:02,140 Okay. 512 00:41:02,760 --> 00:41:04,220 First we have Laurie Newsom. 513 00:41:19,780 --> 00:41:21,180 My name is Laurie Newsom. 514 00:41:21,180 --> 00:41:25,300 I live at 185 Craigwood Way, Sharpsburg. 515 00:41:26,380 --> 00:41:28,040 Just want to go over a few things. 516 00:41:28,180 --> 00:41:34,660 You started the meeting with no volume, but then you got angry when the crowd has, the 517 00:41:34,660 --> 00:41:39,500 only way they have of telling you that they can't hear you is to express it out loud. 518 00:41:39,800 --> 00:41:41,200 But you got angry about that. 519 00:41:41,260 --> 00:41:45,760 Then you turned on your speaker, but we still, a lot of us still couldn't hear you. 520 00:41:46,180 --> 00:41:49,760 And so they're still telling you that they cannot hear you. 521 00:41:49,760 --> 00:41:55,260 And then this lady, I would like to know before I leave here today who she is, 522 00:41:55,400 --> 00:41:57,580 what's her job duty and what's her name. 523 00:41:58,600 --> 00:42:03,260 But she said that if we didn't straighten up, she wanted to start throwing people out. 524 00:42:03,660 --> 00:42:08,580 I would like one time in my life to come here to a commission meeting and 525 00:42:08,580 --> 00:42:11,040 see taxpayers treated with respect. 526 00:42:11,040 --> 00:42:12,060 Ma 527 00:42:14,240 --> 00:42:22,840 'am, I have tried very much, and I apologize to you that I did not have my microphone on. 528 00:42:23,000 --> 00:42:27,980 They're usually off, and I usually try to check, and I do apologize for that. 529 00:42:28,460 --> 00:42:29,080 And that worked. 530 00:42:29,420 --> 00:42:34,720 But then when you turned it on, we still couldn't hear you, and we had to tell you what to 531 00:42:34,720 --> 00:42:35,280 tell you. 532 00:42:35,680 --> 00:42:42,480 Me being in charge of sound in many churches that I've served in, I understand that, 533 00:42:42,480 --> 00:42:49,260 but a lot of times people expect the correction instantaneously but if you 534 00:42:49,260 --> 00:42:53,860 would give me just a second I would have asked our sound folks back there to 535 00:42:53,860 --> 00:42:59,360 adjust it but that's okay let's let's get past that and I apologize for you 536 00:42:59,360 --> 00:43:04,680 feeling like you were being mistreated and I don't intend players were 537 00:43:04,680 --> 00:43:09,360 because everybody that's here is here because they're home and their 538 00:43:09,360 --> 00:43:14,120 community. And we understand that. And we're thinking, oh, I took off, I did a lot of different 539 00:43:14,120 --> 00:43:20,240 things to be here. Now I'm not going to be able to hear. I felt the same way. Okay. Okay. So 540 00:43:20,240 --> 00:43:25,200 you ran off Dell Web. Dell Web would have. Hang on, hang on just a second. I'm going to ask the 541 00:43:25,200 --> 00:43:32,460 clerk if she will reset your three minutes. Okay. Okay. Now you don't have to clap for me. I 542 00:43:32,460 --> 00:43:37,200 just want to do the right thing. Okay. Let's just, let's move on. I want to hear what she 543 00:43:37,200 --> 00:43:44,080 has to say. Okay. Y'all ran off Dell Web. Dell Web would have brought many wonderful things 544 00:43:44,080 --> 00:43:50,880 to our county and even more tax monies, which is something that y'all really seem to like. 545 00:43:51,480 --> 00:43:55,960 You ran off Trinity Christian School. That would have been a wonderful addition to that 546 00:43:55,960 --> 00:44:02,240 area, but no, they're gone now, too. And now you want to bring this crap, I'm just 547 00:44:02,240 --> 00:44:04,640 just going to call it into our community. 548 00:44:05,580 --> 00:44:07,540 Why are you commissioners? 549 00:44:07,960 --> 00:44:14,200 I mean, honestly, I have to ask myself, why would people sit here and oversee this kind 550 00:44:14,200 --> 00:44:14,820 of stuff? 551 00:44:15,560 --> 00:44:22,040 They could go one or two more counties out west and there's plenty of room where they're 552 00:44:22,040 --> 00:44:23,760 not going to upset anybody. 553 00:44:24,360 --> 00:44:27,160 But where they are is right down the street from Holmes. 554 00:44:27,160 --> 00:44:32,940 and the daylight, I have seen the data centers in Fayetteville, they're 555 00:44:32,940 --> 00:44:41,200 surrounded by 24-7 daylight. Why? But if they are, that will hit where I live. So 556 00:44:41,200 --> 00:44:46,760 these are things and the water and the utilities they say go up because it's 557 00:44:46,760 --> 00:44:51,960 like never-ending need. So in trying to keep up with the need, the 558 00:44:51,960 --> 00:44:59,720 the utilities go up in prices to build more infrastructure to be able to meet these needs. 559 00:45:00,000 --> 00:45:06,880 But these are all things that will mess up our communities. The increase in utility rates, 560 00:45:07,020 --> 00:45:15,100 the 24-7 daylight around the centers, all of these kind of things that would just really 561 00:45:15,100 --> 00:45:21,020 be bad. The data centers in Fayetteville are not a good thing because we have sat there 562 00:45:21,020 --> 00:45:27,180 and watched them and we have seen that when those people got to this meeting, it was 563 00:45:27,180 --> 00:45:36,280 already done deal. I pray that it's not the case here. Thank you. Thank you. 564 00:45:39,020 --> 00:45:44,680 Before we call the next, would you like to respond to the era that was 565 00:45:44,680 --> 00:45:52,280 mentioned about the Dale Webb and also as to the Trinity Christian School and 566 00:45:52,280 --> 00:45:57,920 there withdrawal just to correct the. Sure so in terms of Dale Webb that 567 00:45:57,920 --> 00:46:02,480 development was approved by this body so they're under development review at this 568 00:46:02,480 --> 00:46:06,840 time so they they should be moving to construction very soon. Okay. So that that 569 00:46:06,840 --> 00:46:12,680 was approved. In terms of Trinity that conditional use permit was acted on by 570 00:46:12,680 --> 00:46:16,980 the board of zoning appeals it was a recommended denial but the night of the 571 00:46:16,980 --> 00:46:19,960 board commission meeting that application was withdrawn so this body 572 00:46:19,960 --> 00:46:21,160 did not take action on it. 573 00:46:21,400 --> 00:46:21,700 All right. 574 00:46:21,940 --> 00:46:22,160 Thank you. 575 00:46:22,600 --> 00:46:22,740 Yes, sir. 576 00:46:22,980 --> 00:46:24,220 Call your next speaker, please. 577 00:46:24,700 --> 00:46:25,200 Yes, sir. 578 00:46:26,040 --> 00:46:26,960 Teresa Thomas-Smith. 579 00:46:36,460 --> 00:46:37,740 Warm greetings, commissioners. 580 00:46:38,440 --> 00:46:41,140 My name is Teresa Thomas-Smith. 581 00:46:41,940 --> 00:46:47,020 My residence is 221 Forest Run, Palmetto, Georgia. 582 00:46:48,280 --> 00:46:55,380 Tonight, I speak to you as a 21-year resident of Palmetto, Georgia, in Coweeda County. 583 00:46:56,340 --> 00:46:59,600 And with this voice, I speak for four people that reside in my home. 584 00:47:00,640 --> 00:47:07,000 But my name and title is Teresa Thomas Smith, Mayor of the Great City of Palmetto. 585 00:47:07,520 --> 00:47:14,100 And with this voice, I speak for the 5300 plus people that voted for me to serve them 586 00:47:14,100 --> 00:47:19,180 and those outside of the voting district that did not vote for me but also choose to 587 00:47:19,180 --> 00:47:20,160 call Palmetto home. 588 00:47:20,780 --> 00:47:22,240 Many of them are in the room right now. 589 00:47:22,240 --> 00:47:29,920 town. For more than 25 years, our small town is finally seeing signs of renewal and a sense 590 00:47:29,920 --> 00:47:35,320 of community pride. We're ready to develop. We are ready to grow. We are ready to do some 591 00:47:35,320 --> 00:47:41,500 amazing things for our community. This decision would fundamentally offer the character, alter 592 00:47:41,500 --> 00:47:47,720 the character of our community. We have no desire to see a massive industrial facility 593 00:47:47,720 --> 00:47:50,960 less than one mile from our historic downtown. 594 00:47:53,210 --> 00:48:00,810 As we have heard, data centers bring very few jobs, massive water and energy use, while 595 00:48:00,810 --> 00:48:05,350 they say it's not noise, it still is, and heavy infrastructure demands. 596 00:48:06,590 --> 00:48:14,710 It does not belong in such proximity to our downtown area and our residential neighborhoods. 597 00:48:15,850 --> 00:48:23,330 The conditions that they offered were 21 and not a single one included the name Palmetto 598 00:48:23,330 --> 00:48:24,130 Georgia in it. 599 00:48:24,510 --> 00:48:28,890 That means that we're not being good neighbors and I heard them say good neighbor multiple 600 00:48:28,890 --> 00:48:33,390 times but when you can't even say the neighbor's name I don't know how good of a neighbor 601 00:48:33,390 --> 00:48:34,090 that that is. 602 00:48:35,110 --> 00:48:40,930 Board members on behalf of all of Palmetto ask that you please consider the long term 603 00:48:40,930 --> 00:48:49,150 costs to our quality of life, our environment and our residents, the heart of our community. 604 00:48:50,250 --> 00:48:57,030 The second commandment is love that neighbor. Romans 13 and 10 says, love does no wrong 605 00:48:57,030 --> 00:49:04,130 to a neighbor. Therefore, love is the fulfilling of the law. While I would love to pull everyone 606 00:49:04,130 --> 00:49:08,790 sitting over here pushing for this development to see which one has one of these in their 607 00:49:08,790 --> 00:49:14,310 neighborhood. I know I don't have time to do that. So what I will do is say that 608 00:49:14,310 --> 00:49:19,430 the people of Palmetto. I'm excuse me, Mayor. Yes, sir. I'm going to remind you 609 00:49:19,430 --> 00:49:26,290 again outbursts are not allowed. I'm going to ask the deputies just to sort 610 00:49:26,290 --> 00:49:32,190 of see who's doing it. But I'm not asking anybody to leave. I want you to 611 00:49:32,190 --> 00:49:37,570 hear I want to be a part of the meeting. But folks outbursts because I 612 00:49:37,570 --> 00:49:40,310 I want to hear what the mayor has to say, okay? 613 00:49:41,510 --> 00:49:44,670 And in anybody else who walks up there, 614 00:49:45,090 --> 00:49:47,470 I don't want to lose my concentration 615 00:49:48,130 --> 00:49:51,150 and be thinking of something that's going on in the room 616 00:49:51,150 --> 00:49:53,930 other than the business of the county. 617 00:49:54,470 --> 00:49:56,010 And mayor, I'm gonna let you finish. 618 00:49:56,250 --> 00:49:57,030 You should give you a like. 619 00:49:57,470 --> 00:49:59,890 With the balance of my time, I would like to say, 620 00:49:59,930 --> 00:50:00,910 well, I can't pull them 621 00:50:00,910 --> 00:50:02,510 and I know that I can't pull you either. 622 00:50:03,070 --> 00:50:04,930 I would say that you do no harm 623 00:50:05,290 --> 00:50:06,510 to your neighbors to the north. 624 00:50:06,510 --> 00:50:10,730 love us as you love yourselves. I wish you peace and blessings. Thank you for your 625 00:50:10,730 --> 00:50:12,690 time, and I yield my time back. Thank you. 626 00:50:14,800 --> 00:50:16,720 Next, Ms. Chairman, Shalandra Henry. 627 00:50:21,820 --> 00:50:22,300 Good 628 00:50:22,300 --> 00:50:26,660 evening, Councilman. Thank you for the opportunity to speak before you. I am 629 00:50:26,660 --> 00:50:33,380 Shalandra Henry at 212 Williams Street, Palmetto, Georgia, 30268 Coweta County. 630 00:50:34,020 --> 00:50:37,980 I'm a fifth-generation Palmetto, and I'm both my father and my mother's side. 631 00:50:37,980 --> 00:50:45,260 I'm the great-granddaughter of John Will Thurman, a business man and builder who owned land in Palmetto, 632 00:50:46,560 --> 00:50:54,840 Palmetto, Caleta, and Fulton. Our blood, sweat, tears, celebrations, family unions, faith, 633 00:50:55,320 --> 00:51:03,280 is literally in the Georgia clay of 30268. 212 William Street is my property, is a small house 634 00:51:03,280 --> 00:51:09,960 that I love, that will be my 12 year old daughter's home property once she's of age. 635 00:51:10,780 --> 00:51:14,720 In the initial announcement it was said that the area was undeveloped. 636 00:51:15,320 --> 00:51:18,540 My house and others are directly adjacent to this property. 637 00:51:19,260 --> 00:51:24,440 I can see my neighbors, it's not huge lots, so it is a developed area. 638 00:51:24,960 --> 00:51:29,460 I can see through the trees where this property is going to be, where this development 639 00:51:29,460 --> 00:51:30,080 is going to be. 640 00:51:30,780 --> 00:51:34,520 The photos shown don't show the full picture of the community and the area. 641 00:51:35,020 --> 00:51:38,840 This project site, as I said, is directly through the trees. 642 00:51:39,620 --> 00:51:43,820 The exact property, if you have not driven through, is a beautiful property. 643 00:51:44,400 --> 00:51:49,800 I go over there as often as I can. There's a sweet pond, rolling grassy hills. 644 00:51:50,760 --> 00:51:56,880 Why would we want to give that up for concrete that will serve as a health and financial burden for our citizens? 645 00:51:56,880 --> 00:52:03,400 As you can tell, this is exceptionally personal to me because this is an attack on John Wiltherman's 646 00:52:03,400 --> 00:52:09,100 legacy and the future of his descendants, many of whom are in this room tonight. 647 00:52:09,740 --> 00:52:15,940 This project seems to be the epitome of not in my backyard, but it is literally my backyard. 648 00:52:16,680 --> 00:52:23,960 I implore you to vote no on this project, therefore supporting the financial and physical 649 00:52:23,960 --> 00:52:28,580 health and well-being of my daughter, my cousins, and the entire community. I'm 650 00:52:28,580 --> 00:52:33,900 asking you all to vote no, but I want to speak directly to Councilman Blackburn 651 00:52:33,900 --> 00:52:38,940 and Ridelbach. Please vote with the interest and conscious of your 652 00:52:38,940 --> 00:52:44,700 constituents. Please vote no. We may not be multi-millionaires, but our welfare 653 00:52:44,700 --> 00:52:48,720 should count for something. Unlike the advocates of this project, we the 654 00:52:48,720 --> 00:52:54,120 community do not find the items acceptable. It has been proven that jobs 655 00:52:54,120 --> 00:53:00,500 last only for a short term and property values decrease, representing short term 656 00:53:00,500 --> 00:53:05,120 gains for long term negative impacts. And finally, I'm excited to know that the 657 00:53:05,120 --> 00:53:11,020 media with at least WSB TV news is here and interested in this in this issue. 658 00:53:11,360 --> 00:53:16,200 Thank you. Thank you. It is nothing but green trees green grass, and it's amazing. There is development back there 669 00:54:12,620 --> 00:54:14,000 There's a house or two back there 670 00:54:14,000 --> 00:54:21,040 It's just fun to go and look at God's creation on certain days, and I do it just like she said she does it 671 00:54:21,040 --> 00:54:22,540 It's just a peaceful place 672 00:54:23,680 --> 00:54:30,660 What will not be peaceful is leaving church on Sunday morning and see the monstrosity of a power substation. 673 00:54:31,600 --> 00:54:39,640 If you want to see what it looks like and you don't know right after Johnson Road where Palmetto has already been inundated with it at the data center there. 674 00:54:41,460 --> 00:54:46,200 To the north of us we have on hand probably 12 warehouses. 675 00:54:47,200 --> 00:54:53,100 I don't know what's happening to here, but when you leave Atlanta and you drive all the 676 00:54:53,100 --> 00:54:58,840 way down through Troop County, Calwita County, the South Fulton County, all you see is warehouses. 677 00:54:59,840 --> 00:55:03,620 It has to be, I'm just trying to figure out where, who's paying who. 678 00:55:04,580 --> 00:55:08,800 It's everywhere, and you're going to landlock us in by nothing but industrial. 679 00:55:09,620 --> 00:55:14,380 I know Calwita like the back of my hand like you do, and I know that there's four 680 00:55:14,380 --> 00:55:18,520 other industrial areas, one that's out on 16, that's a massive undertaking. 681 00:55:19,080 --> 00:55:25,260 Why don't these people go and buy industrial zoned land instead of trying to take and continue 682 00:55:25,260 --> 00:55:26,440 to take our rural residential? 683 00:55:27,460 --> 00:55:31,440 We have got to stand up at some point and say no. 684 00:55:32,160 --> 00:55:36,300 Just like Palmetto has done, I am Mayor Pro Tem this year and I am a council member 685 00:55:36,300 --> 00:55:37,260 for the past 10 years. 686 00:55:37,860 --> 00:55:40,100 So I know what it's like to sit on your side as well. 687 00:55:40,500 --> 00:55:42,140 And you're probably tired of hearing it by now. 688 00:55:42,140 --> 00:55:47,640 But if nothing else tonight, please listen to the people who have shown up. 689 00:55:47,940 --> 00:55:50,620 I will ask this because not everybody can talk. 690 00:55:51,180 --> 00:55:58,000 So as my final outgoing, I extremely oppose the building. 691 00:55:58,920 --> 00:56:04,000 And I would like for anybody who is against this to stand up in their seat tonight. 692 00:56:04,740 --> 00:56:06,420 Please do not stand up. 693 00:56:07,940 --> 00:56:10,220 Please do not stand up. I'm sorry. 694 00:56:11,980 --> 00:56:14,680 We need to move on. We're not taking a vote. 695 00:56:15,060 --> 00:56:17,800 Right here. Mr. 696 00:56:19,360 --> 00:56:22,160 Bowes. Yes, sir. Speaker, please. Robert Arnold. 697 00:56:34,510 --> 00:56:38,090 Good evening, Mr. Robert Arnold. 205 Taylor Circle Palmetto, Georgia. 698 00:56:38,830 --> 00:56:42,250 I, too, am a multi-generation Palmetton 699 00:56:42,250 --> 00:56:46,030 and Coyote County resident. Well, I'm not a Coyote County resident, but my roots run deep 700 00:56:46,030 --> 00:56:51,650 in Calcutta County. For over 100 years, my family has owned property along a time of 701 00:56:51,650 --> 00:56:56,590 lead cook road. And now many of my residents, many of my family members still live on that 702 00:56:56,590 --> 00:57:00,970 land and property in Calcutta County home, as well as many of my church members still 703 00:57:00,970 --> 00:57:06,370 call Calcutta County home. And we are going to threaten their way of life. And there 704 00:57:06,370 --> 00:57:12,030 are a couple reasons why I'm asking that you oppose this data center. One is that 705 00:57:12,030 --> 00:57:15,150 there are going to be potential increases in the air pollution. I know we've heard 706 00:57:15,150 --> 00:57:19,430 some data that says otherwise, but I'm asking that you would consider the data 707 00:57:19,430 --> 00:57:24,570 pollution, the air, the dust from the construction site. As a council member, I've 708 00:57:24,570 --> 00:57:28,270 been on this Palm Island City Council now for five years and I know that when 709 00:57:28,270 --> 00:57:31,610 developments come in, they don't always follow the boundaries, they don't 710 00:57:31,610 --> 00:57:37,030 always follow the setbacks and we've seen that we've, as Nate just said, we've 711 00:57:37,030 --> 00:57:40,390 he's been on council ten years, I know he's seen his share of it and he's 712 00:57:40,390 --> 00:57:45,890 seen his share of emails about it as well. And so I'm asking that you oppose it for that reason. 713 00:57:46,170 --> 00:57:51,970 Also, there's already additional truck traffic that we're seeing on Highway 29 on Weldon roads 714 00:57:51,970 --> 00:57:56,590 and also our secondary screeching power metal overruns with trucks now. So we're asking that 715 00:57:56,590 --> 00:58:02,050 you oppose it for that reason. Also, we don't want to see our night skyline disrupted by 716 00:58:02,050 --> 00:58:06,790 artificial lights. We're also concerned about the noise pollution. We're also concerned 717 00:58:06,790 --> 00:58:10,390 about the sleep patterns as well being disrupted because of the artificial light 718 00:58:10,390 --> 00:58:15,750 and the noise equipment. Also we've got seniors who've called out of home for 719 00:58:15,750 --> 00:58:20,610 some of them 70, 80, 90 years and now so we're asking that you not disturb their 720 00:58:20,610 --> 00:58:25,170 way of life. So we have legacy families in this area who are going to be 721 00:58:25,170 --> 00:58:29,490 impacted. People like the Williams of Thurman's just to name a few. So we're 722 00:58:29,490 --> 00:58:32,630 asking that you not disturb their way of life. And also we're just 723 00:58:32,630 --> 00:58:37,470 concerned about the decline of property taxes as well and also we're 724 00:58:37,470 --> 00:58:42,350 concerned about the loss of natural habitat so as it was said earlier it's 725 00:58:42,350 --> 00:58:45,970 a beautiful place to go and so we're asking that if you must consider 726 00:58:45,970 --> 00:58:49,110 rezoning this if you would please consider rezoning it for something that 727 00:58:49,110 --> 00:58:53,130 can be useful for the community as a whole consider using it for education 728 00:58:53,130 --> 00:58:57,110 consider using it for a single-family housing consider it for use as 729 00:58:57,110 --> 00:59:01,510 recreational facilities consider it for dining consider for medical use some 730 00:59:01,510 --> 00:59:04,990 other use other than a data center. I yield back. Thank you. 731 00:59:07,320 --> 00:59:08,620 Next, Mr. Chairman, Jess 732 00:59:08,620 --> 00:59:09,180 Wilbanks. 733 00:59:11,500 --> 00:59:15,740 Good evening, commissioners. On behalf of Palmetto neighbors and 734 00:59:15,740 --> 00:59:20,900 leadership, we would ask you to vote no or to table the rezoning of our rural 735 00:59:20,900 --> 00:59:26,600 conservation land just outside Palmetto along Highway 29. We just don't want to 736 00:59:26,600 --> 00:59:32,700 be walled in. We'd appreciate being part of future conversations. We're 737 00:59:32,700 --> 00:59:38,300 concerned that part of our city limits may actually be impacted. The area 738 00:59:38,300 --> 00:59:42,700 surrounding this data center is mostly rural residential and it is not best 739 00:59:42,700 --> 00:59:48,200 suited for industrial. There's only one corner of businesses there. Project 740 00:59:48,200 --> 00:59:52,700 Peach proposal is 0.8 miles from downtown. It will be in the backyard of 741 00:59:52,700 --> 00:59:59,020 many of our legacy families. The constant hum from generators and 13 742 00:59:59,020 --> 00:59:59,880 18 acres of power. 743 01:00:03,520 --> 01:00:10,100 Our air quality concerns, light pollution, it will decimate our night sky. Our quality of 744 01:00:10,100 --> 01:00:14,820 life of our residents will certainly be diminished. The neighborhoods, churches, current industries 745 01:00:14,820 --> 01:00:20,080 and entire community would suffer from a decade of construction. Palmetto residents are trying 746 01:00:20,080 --> 01:00:24,880 to preserve our heritage and cultivate our future. We've had enough of the wrong kind 747 01:00:24,880 --> 01:00:31,180 of development. We're asking for Palmetto to be a place of peace and purpose. Please help 748 01:00:31,180 --> 01:00:37,220 us preserve our way of life. Could I get your address again, please? 217 Cobb Street, Palmetto, 749 01:00:37,260 --> 01:00:38,140 Georgia. Thank you. 750 01:00:40,380 --> 01:00:41,980 Next, Mr. Chairman, Barbara Nott. 751 01:01:04,880 --> 01:01:07,540 Hey. My name is Barbara Nott, and I live 752 01:01:07,540 --> 01:01:12,780 in Palmetto with my husband Charles and son Jonathan in a historical house on eight 753 01:01:12,780 --> 01:01:20,220 acres where ancient trees and a pond dominate a landscape alive with the coming and going 754 01:01:20,220 --> 01:01:26,680 of birds and frogs, squirrels and rabbits and sometimes deer, often seen wandering in 755 01:01:26,680 --> 01:01:28,840 from the backwoods to drink from the pond. 756 01:01:29,860 --> 01:01:34,780 Together my family has published 25 issues of an online literary art journal called 757 01:01:34,780 --> 01:01:41,160 The Grapevine Art and Soul Salon, where we focus on the cultural and soulful values 758 01:01:41,160 --> 01:01:45,940 so important to our health and happiness and satisfaction as human beings. 759 01:01:46,920 --> 01:01:52,140 My thoughts in opposition to the development of a data center so close to downtown Palmetto 760 01:01:52,140 --> 01:01:58,100 have a lot to do with hazards that include the loss of animals and healthy landscaping 761 01:01:58,100 --> 01:02:04,760 as well as dangers to our own health with irritating lights and sights and noises and poisonous air. 762 01:02:04,760 --> 01:02:10,820 Under the influence of our Mayor Theresa Thomas Smith, the City of Palmetto presently is making 763 01:02:10,820 --> 01:02:16,460 major efforts to cultivate cultural changes and additions that will enhance the health, 764 01:02:16,700 --> 01:02:22,600 harmony and satisfaction of our citizens' lives through greater access to art and culture 765 01:02:23,040 --> 01:02:29,240 and environmental development that will beautify our homes and city spaces and outlying 766 01:02:29,240 --> 01:02:36,240 areas filled with trees and landscaping that support our intention to be a blooming community. 767 01:02:36,960 --> 01:02:42,180 It seems ironic that so much of Kawita County, particularly in the Newnen area, has devoted 768 01:02:42,180 --> 01:02:49,700 decades to paying impressive attention to environmental values and artful building and landscaping, 769 01:02:50,180 --> 01:02:53,300 enough in Newnen to name it the city of homes. 770 01:02:53,300 --> 01:02:59,220 I wondered how they could possibly support the negative effects of a data center that 771 01:02:59,220 --> 01:03:01,900 had been spelled out so clearly in so many ways. 772 01:03:02,440 --> 01:03:10,180 Then I saw a Facebook post on April 11th from the Newnan Times Herald with 57 comments 773 01:03:10,780 --> 01:03:15,720 from Newnan and Calvita folks showing that they do not support the project and wish 774 01:03:15,720 --> 01:03:20,580 very much that the Calvita County commissioners would pay attention to the resistance and 775 01:03:20,580 --> 01:03:21,980 complaints from Palmetto. 776 01:03:21,980 --> 01:03:28,540 So, so do I wish that as a retired psychotherapist I can tell you that data centers and the space 777 01:03:28,540 --> 01:03:33,720 they take up and the mechanical forces they use and the traffic congestion created by 778 01:03:33,720 --> 01:03:39,300 trucking are factors that lead to emotional depression which is one way to describe the 779 01:03:39,300 --> 01:03:41,100 loss of soulful living. 780 01:03:42,260 --> 01:03:45,700 We so desperately need in our troubled times. 781 01:03:45,700 --> 01:03:52,320 We need art in abundance, cultural and spiritual centers and events, places to 782 01:03:52,320 --> 01:03:56,980 wander alone or with a partner and absorb sunlight and moonlight and enjoy 783 01:03:56,980 --> 01:04:02,380 trees and rivers and animal life. In Palmetto we need the freedom to pursue 784 01:04:02,380 --> 01:04:07,720 our goals of creating a blooming community where all our people can 785 01:04:07,720 --> 01:04:13,240 become quick which might be called alert and evergreen in the environment 786 01:04:13,240 --> 01:04:18,140 of their choice. Our hope is that you and Calvita County will join us as neighbors 787 01:04:18,140 --> 01:04:24,080 and friends to live a more abundant life, not a less abundant one. Thank you. 788 01:04:24,940 --> 01:04:26,740 Next, Mr. Chairman, Charles Nott. 789 01:04:40,780 --> 01:04:47,520 My name is Charles Nott. I live in Palmetto on Cobb Street, 227 Cobb Street, 790 01:04:47,920 --> 01:04:55,320 a house my father bought in 1963. My parents willed the house to me when they died in 1990s. 791 01:04:55,320 --> 01:05:01,180 The house was built in the 1850s, and it sits on eight acres of land. 792 01:05:01,960 --> 01:05:05,740 The land has a pond, many ancient trees, and lots of animal life. 793 01:05:06,380 --> 01:05:08,940 To put it bluntly, the land is sacred. 794 01:05:10,360 --> 01:05:17,520 Perhaps I can speak for all the elders when I say that I do not want to spend my final 795 01:05:17,520 --> 01:05:25,040 years breathing construction dust, listening to the perpetual hum of high-voltage electricity 796 01:05:25,040 --> 01:05:34,700 seeing the night sky up, lit up by artificial lights from a data center, listening to the 797 01:05:34,700 --> 01:05:42,140 perpetual hum of high-voltage electronics invading my consciousness, etc. I hope that I can be 798 01:05:42,140 --> 01:05:46,980 allowed to speak for our elders and also for a much neglected group that cannot speak 799 01:05:46,980 --> 01:05:53,200 for itself, namely the young people. I would not wish the environment I just described 800 01:05:53,200 --> 01:05:58,900 to be imposed upon a newborn, nor would I wish it to be imposed upon a developing child 801 01:05:59,320 --> 01:06:05,440 who needs space to play and space to grow. Somewhere along the way, a lot of people with 802 01:06:05,440 --> 01:06:10,900 a lot of money forgot that the land is sacred. The land is not something to be broken up 803 01:06:10,900 --> 01:06:16,580 and reassembled for monetary purposes. The eight acres my parents left behind are 804 01:06:16,580 --> 01:06:21,780 a microcosm of the earth. We must protect the lives of the deer and foxes and rabbits 805 01:06:21,780 --> 01:06:27,100 bits and squirrels and raccoons, to say nothing of the bullfrogs and butterflies and children, 806 01:06:28,440 --> 01:06:32,400 both unborn and recently born and those yet to be conceived. 807 01:06:33,540 --> 01:06:35,340 And then, too, there are the birds. 808 01:06:36,360 --> 01:06:41,120 Every time I cut the lawn, grass seed is spread, and the birds come in to have a feast. 809 01:06:41,840 --> 01:06:43,300 Who would take that away from them? 810 01:06:44,180 --> 01:06:49,980 If the data center is built, a lot of nature and a lot of lives, human and animal, 811 01:06:49,980 --> 01:06:58,320 will be severely damaged. Please vote no. Thank you, sir. Next, Mr. Chairman, Dennis Miller. 812 01:06:59,860 --> 01:07:00,340 Good 813 01:07:08,470 --> 01:07:15,370 evening, Mr. Chairman, commissioners. My name is Dennis Miller, 519 10th Street, 814 01:07:15,830 --> 01:07:22,110 Palmetto, Georgia. So fortunately, oh, sorry, fortunately, you've already heard a lot of what 815 01:07:22,110 --> 01:07:26,170 I had to say from previous speakers. So I'd like to address something that I don't think has 816 01:07:26,170 --> 01:07:32,630 been touched on yet. Let's talk about zoning and how zoning affects everyone's 817 01:07:32,630 --> 01:07:38,310 responsibility to determine a sense of place. That's why people live in 818 01:07:38,310 --> 01:07:43,110 municipalities and counties and not in unincorporated areas where they can do 819 01:07:43,110 --> 01:07:49,830 whatever they want. They want to follow a set of rules so that we can all say 820 01:07:49,830 --> 01:07:55,450 this is a place I can be proud to call home. And I'd like to think the 821 01:07:55,450 --> 01:08:03,230 commissioners when they're considering their sense of place and their responsibility as 822 01:08:03,230 --> 01:08:12,390 it comes to zoning to consider your northern border and what that sense of place and your 823 01:08:12,390 --> 01:08:22,030 vision for rural conservation might as well be paved industrial and its effects on your 824 01:08:22,030 --> 01:08:29,030 neighbors. And our ability to determine our sense of place. And I'll leave you with one 825 01:08:29,030 --> 01:08:37,370 final thought. Hopefully it's a little emotional. I'd like you to consider if, because as a 826 01:08:37,370 --> 01:08:43,170 current citizen of Palmetto, I am a previous citizen of Noonan. I love it. It's a beautiful 827 01:08:43,170 --> 01:08:47,490 area. It's a beautiful county. When I moved from Chicago, I thought I could never love 828 01:08:47,490 --> 01:08:52,010 anywhere rural absolutely most part of the country don't plan to move until the 829 01:08:52,010 --> 01:08:58,370 corner takes me away in a black man but I want you to consider that if people a 830 01:08:58,370 --> 01:09:04,890 generation ago sitting in your seats decided that a gigantic facility would 831 01:09:04,890 --> 01:09:12,870 be a great thing to put point eight miles away from this building do you 832 01:09:12,870 --> 01:09:17,310 think maybe noon and wouldn't be known as the city of homes probably not 833 01:09:17,310 --> 01:09:23,950 maybe the city of data centers or whatever they were building in 1950 so 834 01:09:23,950 --> 01:09:28,650 please have some forward vision when you consider what you think your sense of 835 01:09:28,650 --> 01:09:34,710 place and your role is because it affects this county and your neighbors and the 836 01:09:34,710 --> 01:09:40,250 citizens that live there. I appreciate your time. Thank you. Mr. Chairman that's 837 01:09:40,250 --> 01:09:43,370 exhausted there 20 minutes. Okay I 838 01:09:45,900 --> 01:09:48,320 will say I'm sorry to all of you who 839 01:09:48,320 --> 01:09:58,060 wanted to speak the meeting rules call for 20 minutes on both sides either pro 840 01:09:58,060 --> 01:10:05,560 or con but I think we've heard your message that you have from from both 841 01:10:05,560 --> 01:10:13,300 sides and at this time Mr. Chairman the applicant does have about four minutes 842 01:10:13,300 --> 01:10:16,700 Yes, that's what I was going to say. I was going back here to read my notes here. 843 01:10:19,100 --> 01:10:22,140 How much time does the applicant have? 844 01:10:22,260 --> 01:10:23,860 According to our time, four minutes. 845 01:10:24,100 --> 01:10:26,040 Four minutes, yes. Mr. Age? 846 01:10:28,790 --> 01:10:33,610 Mr. Chairman, I don't have anything else to say, but I'll be glad to stand for questions if there are any from the board. 847 01:10:35,690 --> 01:10:37,070 Any questions from the board? 848 01:10:38,690 --> 01:10:39,990 I have a question. 849 01:10:40,530 --> 01:10:40,830 Okay. 850 01:10:41,010 --> 01:10:41,330 Yes, sir. 851 01:10:42,690 --> 01:10:51,010 I noticed that the 50 jobs that were mentioned did not give an amount of what the salary would 852 01:10:51,010 --> 01:10:51,270 be. 853 01:10:52,690 --> 01:11:01,210 And the second question is, what is the use of 80 to 100,000 gallons of water a day for? 854 01:11:04,220 --> 01:11:07,440 Chairman, Commissioner Smith, let me answer the second one first. 855 01:11:08,120 --> 01:11:13,300 We think that that amount that we're giving you on the water is very much probably on 856 01:11:13,300 --> 01:11:17,300 the high end, but we're trying to be conservative here. But as one of our 857 01:11:17,300 --> 01:11:22,520 previous presenters stated, basically the water is used for what you would 858 01:11:22,520 --> 01:11:27,140 normally use in an office building or an industrial building. It's just for the 859 01:11:27,140 --> 01:11:31,860 toilets, for the kitchens, that type of thing. There's nothing being used to 860 01:11:31,860 --> 01:11:35,800 cool any of the data, center equipment, anything of that nature. So it's just 861 01:11:35,800 --> 01:11:39,560 just normal regular usage. So if anything I think we've aired on the 862 01:11:39,560 --> 01:11:44,320 high side of the amount of water, frankly, but we want to be cautious on that and make 863 01:11:44,320 --> 01:11:45,760 sure we weren't understating that. 864 01:11:46,360 --> 01:11:49,140 Now on the question about the salaries, you can give me one moment. 865 01:11:58,380 --> 01:12:05,080 I'm told that the salaries average over 125% over the county's average medium wage. 866 01:12:05,440 --> 01:12:09,560 That's been our experience in other jurisdictions, and we expect that to be the case here. 867 01:12:10,300 --> 01:12:11,460 So is that a number? 868 01:12:15,210 --> 01:12:17,770 I think the market is going to determine that. 869 01:12:17,770 --> 01:12:22,950 When they go to hire folks here, Commissioner, then they'll be looking at what is the medium 870 01:12:22,950 --> 01:12:28,350 wage, how they hire the best people they can hire, they're going to pay a premium to do 871 01:12:28,350 --> 01:12:28,570 that. 872 01:12:30,920 --> 01:12:35,360 Mr. Vice, do you know what the medium wage is for Cady County? 873 01:12:37,180 --> 01:12:40,980 I believe I'd have to check with our economic development president, but I want to say 874 01:12:40,980 --> 01:12:44,620 the last time we spoke it was nearly 50,000, so like 49,000. 875 01:12:44,620 --> 01:12:49,620 Okay. So 120% would take you to about $57,000 a year estimate. 876 01:12:50,520 --> 01:12:53,100 Did that answer your question, Commissioner Smith? 877 01:12:53,840 --> 01:12:57,420 Yes, it does and I really appreciate Mr. Edge addressing that. 878 01:12:57,820 --> 01:12:58,760 Yes. Thank you, Commissioner. 879 01:13:02,430 --> 01:13:07,910 I have a question. I don't need to know the name, but are you in contract with a hyperscaler? 880 01:13:09,070 --> 01:13:10,490 No, Commissioner, we're not. 881 01:13:10,670 --> 01:13:11,270 Not at this time? 882 01:13:11,650 --> 01:13:12,390 Not at this time. 883 01:13:14,630 --> 01:13:20,490 I can say that based on our experience and other jurisdictions, we expect that to happen 884 01:13:20,490 --> 01:13:24,310 fairly quickly if this is approved. 885 01:13:25,130 --> 01:13:30,630 I'd also note that my research indicates that the data centers that are up and operating 886 01:13:30,630 --> 01:13:35,910 in the Metro Atlanta area, I think they have a vacancy rate of about 3.7 percent, 887 01:13:35,910 --> 01:13:37,410 so they fill up pretty quickly. 888 01:13:37,930 --> 01:13:38,470 Thank you. 889 01:13:42,000 --> 01:13:48,840 So what you're saying is, do you know who will actually own the building? 890 01:13:49,880 --> 01:13:53,760 Well, we would own the building. We don't know who the tenants are going to be, so to speak. 891 01:13:53,960 --> 01:13:59,100 Okay, so you're going to basically lease or rent it out to whoever your tenant is? 892 01:13:59,240 --> 01:13:59,540 Yes, sir. 893 01:14:00,320 --> 01:14:02,580 But you don't know who the tenant is at this point? 894 01:14:02,780 --> 01:14:03,120 No, sir. 895 01:14:03,340 --> 01:14:03,520 Okay. 896 01:14:03,860 --> 01:14:08,940 We'll be marketing that, and it could be one large tenant, it could be several smaller ones. 897 01:14:08,940 --> 01:14:09,740 Anyone 898 01:14:14,340 --> 01:14:15,480 else have any questions? 899 01:14:16,120 --> 01:14:18,260 I have questions after you close the public hearing. 900 01:14:18,460 --> 01:14:18,900 All right. 901 01:14:20,960 --> 01:14:21,440 Second. 902 01:14:22,480 --> 01:14:22,980 All right. 903 01:14:24,000 --> 01:14:24,660 Is that a motion? 904 01:14:24,820 --> 01:14:26,040 I'll make a motion to close the public hearing. 905 01:14:26,240 --> 01:14:26,520 Second. 906 01:14:26,820 --> 01:14:27,140 Okay. 907 01:14:27,360 --> 01:14:33,200 I heard Mr. Smith second before John said it, but that's okay. 908 01:14:34,380 --> 01:14:36,880 I have a motion to close the public hearing. 909 01:14:36,960 --> 01:14:38,420 Is there any further discussion? 910 01:14:41,360 --> 01:14:42,800 All in favor say aye. 911 01:14:42,800 --> 01:14:43,940 All right, all right. 912 01:14:44,500 --> 01:14:48,280 All of those carers sounds like unanimously. 913 01:14:49,700 --> 01:14:50,200 All right? 914 01:14:54,900 --> 01:14:55,980 You want to? 915 01:14:57,420 --> 01:14:59,000 I have some questions. 916 01:14:59,760 --> 01:14:59,840 All right. 917 01:14:59,840 --> 01:14:59,980 You 918 01:15:01,200 --> 01:15:12,520 So, you know, some of the issues that we have to deal with as commissioners is people say put this in industrial areas. 919 01:15:14,000 --> 01:15:22,410 Well, to the south of that proposed plan, there's 61 acres of industrial. To the north of that plan, there's... 920 01:15:24,530 --> 01:15:30,970 To the south of that, let me go back and restate, a lot of talk about, and the Christians have 921 01:15:30,970 --> 01:15:35,590 a difficult time making these decisions, but you talk about placing these things in industrial 922 01:15:35,590 --> 01:15:36,090 areas. 923 01:15:36,950 --> 01:15:41,050 So to the south of that proposed development, there are 61 acres of industrial. 924 01:15:41,770 --> 01:15:47,990 To the north, there's about 30 acres of non-use, what do you call it, power right 925 01:15:47,990 --> 01:15:48,270 of way. 926 01:15:48,410 --> 01:15:49,190 You can't build on that. 927 01:15:49,730 --> 01:15:56,130 to the east of that project is nothing but zoned industrial it's industrial all 928 01:15:56,130 --> 01:15:59,850 around there except for that one area so it's a difficult thing that we have to 929 01:15:59,850 --> 01:16:03,810 deal with it and I as a you know I've lived here for 35 years and I don't know 930 01:16:03,810 --> 01:16:08,310 that I would build a house out there given where it's at right now so the 931 01:16:08,310 --> 01:16:15,630 other questions I have am I correct in saying what I said mr. Sewell yes it 932 01:16:15,630 --> 01:16:19,110 It wasn't too long ago, I believe maybe six, seven years ago, 933 01:16:19,970 --> 01:16:26,450 where Palmetto annexed property to put a 1 million square foot 934 01:16:26,450 --> 01:16:30,390 industrial cross-stock warehouse from Cavite County. 935 01:16:31,910 --> 01:16:33,270 Again, industrial. 936 01:16:38,190 --> 01:16:40,410 I mean, that's the difficulty we have 937 01:16:40,410 --> 01:16:46,030 is dealing with this, is that in my eyes, 938 01:16:46,070 --> 01:16:47,270 this would be an industrial area. 939 01:16:47,390 --> 01:16:48,170 That's just my opinion. 940 01:16:48,170 --> 01:16:52,410 it's an industrial area because of everything that surrounds the current 941 01:16:52,410 --> 01:16:56,570 developments that are there right now. So that's that's all I have Mr. Chairman. 942 01:16:57,470 --> 01:16:57,590 Okay. 943 01:17:00,150 --> 01:17:07,150 Is there any other questions commissioners? Can I make a comment? 944 01:17:07,610 --> 01:17:15,450 Yes Mr. Smith. By my count I had six people for the developer that spoke in 945 01:17:15,450 --> 01:17:22,710 favor of the project. And I don't know if any of them lived in this area except Mr. Edge. 946 01:17:24,310 --> 01:17:33,230 And contrary to that, there were 10 residents that spoke against it and not one spoke in 947 01:17:33,230 --> 01:17:39,330 favor of it. And that tells me something about the relationship between the developer 948 01:17:39,330 --> 01:17:42,650 and the community is a gap there. 949 01:17:42,910 --> 01:17:45,830 And I would think that at least some residents 950 01:17:46,450 --> 01:17:51,410 would see the value of it, but I did not see that tonight. 951 01:17:51,790 --> 01:17:55,810 So that's weighs heavily on my decision-making. 952 01:17:56,630 --> 01:17:57,570 And thank you for that. 953 01:17:58,210 --> 01:17:58,650 All right. 954 01:18:02,060 --> 01:18:04,240 Are we ready for the motion? 955 01:18:06,820 --> 01:18:10,060 I wanna just say something before we go in there too 956 01:18:10,060 --> 01:18:11,060 as I look at this. 957 01:18:11,840 --> 01:18:18,500 I'll speak for myself on this, because somebody mentioned it earlier, and you're listened to. 958 01:18:18,940 --> 01:18:24,680 There is no decision that is made up here that I don't put myself, and I'm certain they 959 01:18:24,680 --> 01:18:29,060 probably do the same thing, that I don't put this structure in my backyard too. 960 01:18:29,980 --> 01:18:31,420 In fact, I would take it. 961 01:18:32,260 --> 01:18:39,120 So I look at this to commission a Ritalbox comments for industrial, and I have an 962 01:18:39,120 --> 01:18:43,200 opinion too, just like you did. And I gave you the floor to be able to speak and I didn't 963 01:18:43,200 --> 01:18:49,300 laugh at you. So I look at this as far as industrial. But there's another piece to this 964 01:18:49,300 --> 01:18:55,240 I look at too. We called other jurisdictions in Loudoun County and other areas to see what 965 01:18:55,240 --> 01:19:02,140 they went through. What they did in people's backyards. And every development is fought. 966 01:19:02,480 --> 01:19:08,320 Every protracted development, per protracted development is fought. You voted, the public 967 01:19:08,320 --> 01:19:17,800 voted on HB 581. We had to cut over $10 million. That budget, that void is still there. You 968 01:19:17,800 --> 01:19:23,640 were tasked us to help us run a county. This is what we're trying to do. We're bringing 969 01:19:23,640 --> 01:19:27,940 in elements like this to be able to offset that for Cuita County. There's other counties 970 01:19:27,940 --> 01:19:33,620 in Georgia that's doing the same thing. You can adjust your ordinances in here 971 01:19:33,620 --> 01:19:35,740 when the revenue stream is also there. 972 01:19:36,640 --> 01:19:40,900 You don't want an additional 4 million people coming into the state of Georgia, do you? 973 01:19:41,640 --> 01:19:44,700 This is part of that mechanism in which to do that. 974 01:19:45,200 --> 01:19:47,040 These revenue streams are real. 975 01:19:47,600 --> 01:19:52,680 And I thank you for the numbers that you provided me for the four campuses, because 976 01:19:52,680 --> 01:19:58,060 the jurisdictions that have housed these in Loudoun County, Virginia and Sterling 977 01:19:58,060 --> 01:20:00,520 Virginia, they have verified that. 978 01:20:01,040 --> 01:20:06,960 There are other campuses for these data centers much larger than the ones that 979 01:20:06,960 --> 01:20:12,080 have been described here today that will provide this also. You want parks, you 980 01:20:12,080 --> 01:20:16,000 want trails, you want some of this other stuff. This is the mechanism in which to 981 01:20:16,000 --> 01:20:19,400 pay for that and there are other avenues that we can break off for tax 982 01:20:19,400 --> 01:20:24,220 purposes and this is where I'm at and I wanted to explain myself before the 983 01:20:24,220 --> 01:20:24,980 vote took place. 984 01:20:27,840 --> 01:20:31,500 And then, Mr. Chairman, I also have some other, I mean, I, I 985 01:20:31,500 --> 01:20:35,280 appreciate, you know, the conditions that Mr. Sewell and community development put 986 01:20:35,280 --> 01:20:35,440 up. 987 01:20:38,710 --> 01:20:46,910 Please do not do an outburst. This is not the time. It's not the way to, to 988 01:20:46,910 --> 01:20:48,610 handle business. I look at the downward lighting from the industrial 1041 01:25:52,980 --> 01:25:57,660 areas that are already out there. So there is light out there already. They will be 1042 01:25:57,660 --> 01:26:03,300 required to use the downward LED lighting as well if they were to get approved. So 1043 01:26:04,840 --> 01:26:10,280 I mean, that's my comments on the additional conditions. I don't know if I have any 1044 01:26:10,280 --> 01:26:13,000 of the commissioners that want to speak to anything so 1045 01:26:17,510 --> 01:26:19,430 Mr. Chairman I'm gonna make 1046 01:26:19,430 --> 01:26:24,650 a motion to prove on the conditions okay you the additional conditions with the 1047 01:26:24,650 --> 01:26:30,490 21 standing effect the motion did you add you do you want to add those yes I 1048 01:26:30,490 --> 01:26:35,310 just went through them okay the additional 25 DB at the property lines 1049 01:26:35,310 --> 01:26:38,490 the served letter from the power and a purchase agreement from the power 1050 01:26:38,490 --> 01:26:43,230 company within six months waste mitigation plan with reporting company 1051 01:26:43,230 --> 01:26:47,650 community development once a year annually it shows the recyclable waste 1052 01:26:47,650 --> 01:26:52,950 versus the landfill waste all buildings must be data centers and they're 1053 01:26:52,950 --> 01:26:59,010 swapping the substations with building one and then all visible buildings will 1054 01:26:59,010 --> 01:27:05,470 be burned and buffered. I was on an 1065 01:42:04,630 --> 01:42:10,370 associate Nicole Blackwell is going to make presentation. Good evening. I'll be 1066 01:42:10,370 --> 01:42:16,770 presenting petition variance 2502. The applicant Page Dockweiler is requesting a 1067 01:42:16,770 --> 01:42:23,090 barn setback reduction variance under article 7 section 72 item 4a for 1068 01:42:23,090 --> 01:42:28,850 property located at 9210 East Highway 16 in Senoi. The property is 1069 01:42:28,850 --> 01:42:36,690 approximately 12.81 acres in a zoned RC Rural Conservation. The applicant purchased the property 1070 01:42:36,690 --> 01:42:44,870 in 2018 and established an agricultural farm known as Duck Brown Farm and Distillers. Duck 1071 01:42:44,870 --> 01:42:49,870 Brown Farm and Distillers is a seed-to-still farm. As part of the farming operation, 1072 01:42:50,110 --> 01:42:56,350 the applicant constructed a 40-foot by 50-foot pole barn to store farming equipment. Unfortunately, 1073 01:42:56,350 --> 01:43:01,770 The applicant did not obtain any building permits prior to construction of the pole 1074 01:43:01,770 --> 01:43:06,170 barn and the structure does not meet the required setbacks for a barn. 1075 01:43:07,450 --> 01:43:08,170 According 1076 01:43:11,370 --> 01:43:17,710 to Article 7, Section 72, Item 4A, all related accessory buildings used for 1077 01:43:17,710 --> 01:43:23,670 the storing of equipment shall be located 100 feet from all property lines and at 1078 01:43:23,670 --> 01:43:27,190 least 200 feet from any existing off-site dwelling. 1079 01:43:27,190 --> 01:43:37,700 As you can see from the site plan, submitted with the application, the pole barn is positioned 1080 01:43:37,700 --> 01:43:40,660 in this narrow area right here of the property. 1081 01:43:42,740 --> 01:43:48,560 It's between the applicant's property boundaries and their personal residents. 1082 01:43:48,980 --> 01:43:52,180 They have a personal residence right here on this next parcel. 1083 01:43:52,180 --> 01:43:52,320 parcel. 1084 01:43:54,520 --> 01:44:01,580 The barn is situated approximately 40 feet from the northern property line and 1085 01:44:01,580 --> 01:44:08,000 approximately 150 feet from the applicant's residential dwelling on the next parcel. 1086 01:44:08,860 --> 01:44:13,260 Therefore, the applicant is requesting the variance for a reduction in the required 1087 01:44:13,260 --> 01:44:17,420 setbacks to allow the barn to remain at its current location. 1088 01:44:20,720 --> 01:44:22,060 Here is an aerial view 1089 01:44:22,060 --> 01:44:25,920 of the property you can see the barn right here and 1090 01:44:28,160 --> 01:44:29,340 the applicant's home on 1091 01:44:29,340 --> 01:44:35,800 this parcel to the north. Again the barn is approximately 40 feet to their 1092 01:44:35,800 --> 01:44:40,860 property line and 150 feet to the personal residence. 1093 01:44:45,590 --> 01:44:46,890 Here are photos staff 1094 01:44:46,890 --> 01:44:52,110 took of the barn. You can see the barn in question on the left and on the 1095 01:44:52,110 --> 01:44:57,190 right you can see another angle of that same barn looking towards the 1096 01:44:57,190 --> 01:44:58,430 applicant's home. 1097 01:45:01,010 --> 01:45:05,570 Consideration for a variance request must be reviewed by the seven factors under article 1098 01:45:05,570 --> 01:45:12,230 28 of the Cahuilla County Zoning and Development Ordinance. Some highlighted factors are barns 1099 01:45:12,230 --> 01:45:18,130 are common sites within the RC Rural Conservation Zoning District and complement the rural nature 1100 01:45:18,130 --> 01:45:25,690 of the area and are essential for the upkeep of a farming operation. The Board should consider 1101 01:45:25,690 --> 01:45:28,170 if this request is justified by a hardship. 1102 01:45:33,200 --> 01:45:35,400 Should the Board choose to approve this request, 1103 01:45:35,620 --> 01:45:39,860 the Community Development Department submits the following four conditions for consideration. 1104 01:45:40,700 --> 01:45:46,580 One, the pole barn shall not encroach any closer to the Northern Property Line or to 1105 01:45:46,580 --> 01:45:52,500 the off-site residential dwelling than it currently exists today. Two, the applicant 1106 01:45:52,500 --> 01:45:57,200 shall meet all the requirements of the Building Department. Three, the applicant 1107 01:45:57,200 --> 01:46:03,200 will obtain all appropriate building permits and inspections for the pole barn and for if 1108 01:46:03,200 --> 01:46:08,680 the barn cannot meet all requirements for building permit inspections and approvals then 1109 01:46:08,680 --> 01:46:14,280 the applicant shall demo the barn after obtaining the appropriate demo permits from the community 1110 01:46:14,280 --> 01:46:15,860 development building department. 1111 01:46:18,330 --> 01:46:22,570 Here's that site plan again and I'd like to point out that the community development 1112 01:46:22,570 --> 01:46:29,090 department received an audience participation form from Tommy and Shirley Davis at 9288 1113 01:46:29,090 --> 01:46:35,850 Highway 16, Sonoy. The Davises are the most effective property owners to the south. They 1114 01:46:35,850 --> 01:46:41,550 live right here on this property. And they support the variance request for the barn 1115 01:46:41,550 --> 01:46:44,250 setback. Any questions for staff? 1116 01:46:46,330 --> 01:46:50,250 So the surrounding property owners are okay with the barns as well? 1117 01:46:55,480 --> 01:47:00,500 Does not hear any more from up here. Does the applicant wish to speak? 1118 01:47:01,580 --> 01:47:03,800 I have a question before you, David, could you please? 1119 01:47:03,940 --> 01:47:04,340 Oh, I'm sorry. 1120 01:47:04,940 --> 01:47:10,940 Is the barn on the property of the owners, I saw the drawing, but it doesn't look like 1121 01:47:10,940 --> 01:47:14,160 it's on the same property as the home of the owners. 1122 01:47:15,820 --> 01:47:18,420 It's on a separate parcel. 1123 01:47:20,300 --> 01:47:21,280 They own both. 1124 01:47:21,500 --> 01:47:22,320 They own both. 1125 01:47:22,980 --> 01:47:27,200 She owns both parcels, but it is on a separate parcel. 1126 01:47:27,200 --> 01:47:34,640 And that's why it does not meet the requirement of the off-site dwelling must be 200 feet. 1127 01:47:36,500 --> 01:47:41,100 Had the properties been combined, that wouldn't be an issue. 1128 01:47:43,240 --> 01:47:44,160 Okay, thank you. 1129 01:47:44,620 --> 01:47:44,780 Sure. 1130 01:47:46,910 --> 01:47:48,290 Any other comments? 1131 01:47:49,670 --> 01:47:51,410 Does the applicant wish to speak? 1132 01:47:53,550 --> 01:47:53,830 Okay. 1133 01:47:55,870 --> 01:48:03,030 Okay. Are there any comments in support of or in opposition other than the one that we 1134 01:48:03,030 --> 01:48:03,290 heard? 1135 01:48:03,770 --> 01:48:06,590 Mr. Chairman, no one signed up to speak in support of our opposition. 1136 01:48:07,970 --> 01:48:08,690 All right. 1137 01:48:13,430 --> 01:48:16,910 Any other questions for the staff? 1138 01:48:17,210 --> 01:48:19,310 I just have one question there. I was going to do it after me. 1139 01:48:20,310 --> 01:48:30,930 So that you guys go out and inspect everything, make sure they're compliant with the building requirements and all that stuff, and then give them the permit with those variances, correct? 1140 01:48:31,490 --> 01:48:31,850 Yes. 1141 01:48:32,130 --> 01:48:33,410 Okay. Thank you. 1142 01:48:35,100 --> 01:48:36,880 Is there a motion to close up here? 1143 01:48:37,600 --> 01:48:38,600 Can I ask another question? 1144 01:48:38,720 --> 01:48:43,300 Oh, I'm sorry. It's sort of hard to hear you, but go ahead. 1145 01:48:43,300 --> 01:48:50,440 I'm not there but does anybody know if the way that the barn is built now if it 1146 01:48:50,440 --> 01:48:52,220 will pass inspection? I 1147 01:48:54,330 --> 01:48:58,430 have to. I'm assuming that's if we can defer to the 1148 01:48:58,430 --> 01:49:02,250 building official. Sure yeah they haven't permitted it yet so it hasn't been 1149 01:49:02,250 --> 01:49:06,530 evaluated that last condition is intended to make sure that we have the 1150 01:49:06,530 --> 01:49:10,790 time to do that and if it is not meet code they'll have to modify it to meet 1151 01:49:10,790 --> 01:49:19,570 code or take it down. Okay. Did you hear him, Mr Smith? I did. Okay. Thank you. All right. 1152 01:49:20,550 --> 01:49:28,950 Do it. Get a motion to close. Motion to close a second. Second. All right. Any further 1153 01:49:30,190 --> 01:49:38,410 call for the motion? All in favor say aye. Aye. Aye. Aye. All opposed. And the motion 1154 01:49:38,410 --> 01:49:45,350 carries unanimously. All right, is there a motion regarding the proposed variance? 1155 01:49:47,630 --> 01:49:57,840 There is a with the conditions. All right, we have a motion and a second. Any further discussion? 1156 01:49:58,400 --> 01:50:07,720 Yes, I would like to ask a question about the fees that would have been paid and since they weren't, 1157 01:50:07,720 --> 01:50:16,080 It wasn't done by the cold. The subject property is approximately 30.63 acres. 1324 02:05:30,350 --> 02:05:31,670 The 1325 02:05:37,880 --> 02:05:40,880 applicant intends to construct a home on the property. 1326 02:05:41,080 --> 02:05:54,940 However, a stop work order was issued in October of 2022 after a site plan review revealed that two structures had been built without the necessary permits and without meeting ordinance requirements. 1327 02:05:58,910 --> 02:06:05,730 The two structures are this log cabin and this metal barn. 1328 02:06:07,010 --> 02:06:10,850 The metal barn is actually two separate accessory buildings. 1329 02:06:11,290 --> 02:06:20,190 Construction of the proposed new home right here remains on hold until these issues are resolved. 1330 02:06:24,020 --> 02:06:26,580 Here are some pictures stuff took of the property. 1331 02:06:27,160 --> 02:06:34,660 Again, applicant is applying for variances so that he and his family can build their home on their property. 1332 02:06:41,180 --> 02:06:43,140 First, let's take a look at the log cabin. 1333 02:06:45,200 --> 02:06:51,740 The applicant is seeking relief from the 25-foot state water buffer and the county's stream 1334 02:06:51,740 --> 02:06:54,380 corridor protection buffer and setback requirements. 1335 02:06:55,280 --> 02:07:00,700 This cabin was originally a pole barn and was later converted into a cabin after the 1336 02:07:00,700 --> 02:07:02,180 applicant purchased the property. 1337 02:07:03,260 --> 02:07:05,800 No building or septic permits were obtained. 1338 02:07:06,440 --> 02:07:10,620 The log cabin does not meet the minimum square footage requirement for a primary 1339 02:07:10,620 --> 02:07:17,480 residential dwelling. If considered an accessory structure, the parcel lacks a 1340 02:07:17,480 --> 02:07:23,060 primary structure and it encroaches on the 25-foot state water buffer in the 1341 02:07:23,060 --> 02:07:27,760 county stream corridor protection buffers and setback requirements. The 1342 02:07:27,760 --> 02:07:32,980 applicant has proposed the following mitigation measures. The installation of 1343 02:07:32,980 --> 02:07:37,280 gutters with rain barrel collection systems to capture runoff and the 1344 02:07:37,280 --> 02:07:38,820 removal of the septic system. 1345 02:07:43,760 --> 02:07:48,020 Then we have the metal barn, Variance 2501. The 1346 02:07:48,020 --> 02:07:51,640 applicant seeks relief from the county's stream corridor protection buffer and 1347 02:07:51,640 --> 02:07:55,800 setback requirements. The metal barn consists of two accessory structures 1348 02:07:55,800 --> 02:08:00,700 built after the applicant purchased the property. While labeled a metal barn 1349 02:08:00,700 --> 02:08:05,140 on the site plan, the structures are currently being used as storage for 1350 02:08:05,140 --> 02:08:09,740 items unrelated to farming, including windows and doors for the proposed 1351 02:08:09,740 --> 02:08:15,580 future home. If the structures are considered barns they do not meet the 1352 02:08:15,580 --> 02:08:21,680 100-foot barn setback requirement. No building permits were obtained. The two 1353 02:08:21,680 --> 02:08:26,100 accessory structures are less than 10 feet apart violating setback 1354 02:08:26,100 --> 02:08:30,620 requirements and the structure on the right encroaches on the county's 1355 02:08:30,620 --> 02:08:32,380 stream corridor protection buffers. 1356 02:08:35,580 --> 02:08:37,360 Consideration for a variance request 1357 02:08:37,360 --> 02:08:42,280 The request must be reviewed by the seven factors under Article 28 of the Cahuilla County 1358 02:08:42,280 --> 02:08:44,360 Zoning and Development Ordinance. 1359 02:08:45,140 --> 02:08:51,180 Highlighted factors are the intent of the ordinance is to provide protection to state 1360 02:08:51,180 --> 02:08:58,140 waters and removal of the structures may adversely impact the stream more so than 1361 02:08:58,140 --> 02:08:59,140 allowing it to remain. 1362 02:09:04,200 --> 02:09:08,860 Should the Board approve this request, the Community Development Department is 1363 02:09:08,860 --> 02:09:14,740 submitting the following conditions for consideration for Variance 2420, the log cabin. 1364 02:09:15,720 --> 02:09:21,340 1. Applicants shall provide to the county all necessary building and engineering plans, 1365 02:09:21,700 --> 02:09:26,620 inspections and certifications for building officials approval and certificate of occupancy 1366 02:09:26,620 --> 02:09:33,000 and completion issuances. If the building official deems it an impossibility, then the applicant 1367 02:09:33,000 --> 02:09:38,120 Applicant shall obtain a demolition permit and remove the structures and re-stabilize 1368 02:09:38,120 --> 02:09:40,460 all disturbance with permanent vegetation. 1369 02:09:41,220 --> 02:09:41,300 2. 1370 02:09:41,760 --> 02:09:46,660 Applicant shall provide approved stormwater runoff mitigation for encroachments into 1371 02:09:46,660 --> 02:09:54,760 the buffers as approved by the county development review staff and inspected by the county 1372 02:09:54,760 --> 02:09:55,700 development inspector. 1373 02:09:56,540 --> 02:09:57,400 3. 1374 02:09:57,400 --> 02:10:03,600 3. If the log cabin is allowed to remain as per condition number 1, then the applicant 1375 02:10:03,600 --> 02:10:09,700 shall provide a deed restriction for the log cabin to be used as a guest house under 1376 02:10:09,700 --> 02:10:15,520 the guest house provisions of the Caledic County Code of Ordinances. If not allowed 1377 02:10:15,520 --> 02:10:20,980 as a guest house, the applicant shall amend or demo the structure as directed by the 1378 02:10:20,980 --> 02:10:21,320 4. 1379 02:10:23,580 --> 02:10:27,540 The structure shall not encroach any further into the state and county stream 1380 02:10:27,540 --> 02:10:29,460 water protection buffers or setbacks. 1381 02:10:33,090 --> 02:10:35,870 The existing unpermitted septic 1382 02:10:35,870 --> 02:10:41,970 absorption field shall be removed. 6. If it is determined that no new septic 1383 02:10:41,970 --> 02:10:46,730 system can be permitted for the cabin, water service must be disconnected from 1384 02:10:46,730 --> 02:10:51,110 the log cabin. All plumbing fixtures shall be removed and the structure 1385 02:10:51,110 --> 02:10:55,790 shall be documented as a non-dwelling unit through a deed restriction. 1386 02:10:56,630 --> 02:11:04,030 7. All buildings shall be reviewed by a state licensed engineer to confirm conformance with the adopted building codes 1387 02:11:04,030 --> 02:11:08,570 and shall be documented and submitted to the building official for review and approval. 1388 02:11:09,310 --> 02:11:18,550 8. Applicants shall provide these above conditions prior to the release of the in-place stop work order for the residential house. 1389 02:11:18,550 --> 02:11:25,490 9. The applicant shall apply for any additional variances as may be determined at a later 1390 02:11:25,490 --> 02:11:25,870 date. 1391 02:11:29,600 --> 02:11:37,780 As for the metal barns, should the Board approve this request, the Community Development 1392 02:11:37,780 --> 02:11:44,140 Department is submitting the following conditions for consideration for variance 2501, the 1393 02:11:44,140 --> 02:11:50,600 metal barn. 1. Applicant shall provide to the county all necessary building and engineering 1394 02:11:50,600 --> 02:11:56,120 plans, inspections and certifications for building officials approval and certificate 1395 02:11:56,120 --> 02:12:02,060 of occupancy and completion issuances. If the building official deems it is an impossibility, 1396 02:12:02,540 --> 02:12:07,860 then the applicant shall obtain a demolition permit and remove the structure and restabilize 1397 02:12:07,860 --> 02:12:14,540 all disturbance with permanent vegetation too. Applicant shall provide approved stormwater 1398 02:12:14,540 --> 02:12:20,040 runoff mitigation for encroachments into the buffers as approved by the county 1399 02:12:20,040 --> 02:12:24,720 county development review staff and inspected by the county development inspector. 1400 02:12:25,560 --> 02:12:32,120 Three, if the metal barn is allowed to remain as per condition number one, then the applicant 1401 02:12:32,120 --> 02:12:37,000 shall provide an acknowledgement of intent letter and deed restriction to the county 1402 02:12:37,000 --> 02:12:43,240 building permits and inspection staff that the structure is not used as an agricultural 1403 02:12:43,240 --> 02:12:48,160 use barn unless a setback variance is approved by the Board of Commissioners. 1404 02:12:48,680 --> 02:12:55,460 4. The structure shall not encroach any further into the county's stream water 1405 02:12:55,460 --> 02:12:57,040 protection buffers or setbacks. 1406 02:12:59,580 --> 02:13:03,180 5. The two accessory structures that make up the 1407 02:13:03,180 --> 02:13:07,740 metal barn shall be connected into one unified accessory structure unless a 1408 02:13:07,740 --> 02:13:12,680 variance is applied for and approved by the Board. 6. The utilization of 1409 02:13:12,680 --> 02:13:18,040 rain barrels. Collecting water from gutter runoff shall be required or some other form 1410 02:13:18,040 --> 02:13:24,540 of approved stormwater runoff mitigation. 7. All buildings shall be reviewed by a state 1411 02:13:24,540 --> 02:13:29,160 licensed engineer to confirm conformance with the adopted building codes and shall 1412 02:13:29,160 --> 02:13:34,940 be documented and submitted to the building official for review and approval. 8. Applicants 1413 02:13:34,940 --> 02:13:40,260 shall provide these above conditions prior to the release of the in-place stop-work 1414 02:13:40,260 --> 02:13:45,680 order for the residential house nine the applicant shall apply for any additional 1415 02:13:45,680 --> 02:13:50,060 variances as it may be determined at a later date and 1416 02:13:53,740 --> 02:13:54,680 there's a site plan any 1417 02:13:54,680 --> 02:13:55,620 questions for staff 1418 02:14:04,420 --> 02:14:08,260 so the cabin has plumbing and 1419 02:14:10,310 --> 02:14:12,250 an unpermitted septic 1420 02:14:12,250 --> 02:14:19,410 sitting next to a stream is that is that what I heard yes and 1421 02:14:23,090 --> 02:14:24,450 and they so 1422 02:14:24,450 --> 02:14:27,730 So when did they, they came to you first in October of 2022? 1423 02:14:28,510 --> 02:14:29,970 That's when you made them aware of this? 1424 02:14:31,570 --> 02:14:37,350 I believe that, was it the building department became aware of this when they submitted plans, 1425 02:14:37,730 --> 02:14:41,370 site plans for their home that they would like to build. 1426 02:14:44,050 --> 02:14:46,490 So almost two years ago, that's what you're saying. 1427 02:14:50,260 --> 02:14:51,460 How old is the cabin? 1428 02:14:51,740 --> 02:14:52,420 Where was it built? 1429 02:14:52,420 --> 02:14:59,500 Originally it was a pole barn. They purchased the property in... 1430 02:15:02,220 --> 02:15:11,280 Commissioner, if I may. According to what I found on Google Earth imagery, upon the poe barn, 1431 02:15:12,800 --> 02:15:21,940 which was later converted into the log cabin, was built between 2012 and 2015. The applicants 1432 02:15:22,680 --> 02:15:29,120 didn't purchase the property until 2017. So the poe barn was already there before they 1433 02:15:29,120 --> 02:15:34,560 purchased the property. But it's my understanding that they continued with 1434 02:15:34,560 --> 02:15:40,700 improvements on the what we're calling the log cabin. And this is going to be a 1435 02:15:40,700 --> 02:15:45,860 primary residence or just a getaway place? No sir, they want to build their 1436 02:15:45,860 --> 02:15:53,760 primary residence. This was simply a log cabin that they had built. They 1437 02:15:53,760 --> 02:15:57,680 want to permit it as a guest house. Well that's kind of what staff was 1438 02:15:57,680 --> 02:16:02,920 thinking that you guys were okay with them leaving it, you know that we needed 1439 02:16:02,920 --> 02:16:10,800 some way to handle it, it being a separate dwelling, but it's kind of hard 1440 02:16:10,800 --> 02:16:17,460 as this was a hard one. Does it have power? Yes sir. So you made a comment too 1441 02:16:17,460 --> 02:16:26,000 that I guess by removing it or letting it stay, you know there, in other words if 1442 02:16:26,000 --> 02:16:28,720 you're moving may cause more damage and if you just let it stay can you 1443 02:16:28,720 --> 02:16:36,480 expand on that? Yes, sir. I can. Well, I, you know, just demolishing it would cause land 1444 02:16:36,480 --> 02:16:40,220 disturbance within the buffer. You know, it's there. Everything's stable. 1445 02:16:40,680 --> 02:16:47,820 Everything's stable now, but they move it or have to tear it down. You know, it's 1446 02:16:47,820 --> 02:16:51,920 going to cause some land disturbance that, you know, could impact the state 1447 02:16:51,920 --> 02:16:58,700 water. But the septic could already be doing that. Could be. Yeah. Do we 1448 02:16:58,700 --> 02:17:01,720 We know what kind of flooring this log Kevin has it. 1449 02:17:02,340 --> 02:17:03,640 I don't know, sir. 1450 02:17:03,940 --> 02:17:05,200 I mean, is it a concrete floor? 1451 02:17:05,900 --> 02:17:07,680 I guess we can ask him. 1452 02:17:08,020 --> 02:17:08,120 Yes. 1453 02:17:08,660 --> 02:17:08,920 OK. 1454 02:17:10,920 --> 02:17:11,780 I have a question. 1455 02:17:12,660 --> 02:17:13,000 Yes, sir. 1456 02:17:13,900 --> 02:17:17,260 I thought that I heard if you tear the barn down, 1457 02:17:17,980 --> 02:17:21,280 it could cause more damage than it could solve. 1458 02:17:23,200 --> 02:17:25,220 Now, maybe it was the cabin. 1459 02:17:25,880 --> 02:17:28,100 But I thought they said if you tear the barn down, 1460 02:17:28,100 --> 02:17:29,780 it would also be a detriment. 1461 02:17:32,990 --> 02:17:33,330 Well it could. 1462 02:17:33,530 --> 02:17:33,730 Nicole? 1463 02:17:34,250 --> 02:17:34,650 Yes sir. 1464 02:17:35,250 --> 02:17:35,730 Yes sir. 1465 02:17:35,870 --> 02:17:43,010 I think either one that encroaches the buffer, the idea of the buffer is to remain undisturbed. 1466 02:17:43,330 --> 02:17:51,090 But you know honestly I think staff has given you guys an opportunity to go either way depending on how you feel about it. 1467 02:17:51,090 --> 02:17:56,970 But again the septic could be encroaching on the water and the stream buffer right now as we speak. 1468 02:17:56,970 --> 02:18:02,790 But either way, will the septic have to come out, the septic has to come out either way? 1469 02:18:02,910 --> 02:18:04,530 I would think so, yes sir. 1470 02:18:05,450 --> 02:18:08,630 On the log, there's no septic for the... 1471 02:18:08,630 --> 02:18:10,870 Not that I'm aware of. That's right. 1472 02:18:11,230 --> 02:18:16,710 So if they can't perk, according to the septic permit they can't perk, then you can't put plumbing in there. 1473 02:18:17,010 --> 02:18:17,310 Correct. 1474 02:18:17,690 --> 02:18:17,950 Okay. 1475 02:18:20,630 --> 02:18:24,950 But the problem here is it's too close to the lake to leave the septic intact. 1476 02:18:25,370 --> 02:18:25,490 Yeah. 1477 02:18:27,190 --> 02:18:33,470 They, I'm not sure exactly where the septic is located, but the log cabin encroaches both 1478 02:18:33,470 --> 02:18:37,190 the county and it encroaches the state water buffer just a little bit, too. 1479 02:18:37,750 --> 02:18:44,130 If you look around Catter County, there'd be a thousand grandfather cabins that have 1480 02:18:44,130 --> 02:18:44,490 something. 1481 02:18:45,130 --> 02:18:47,950 I mean, that world didn't come into the 80s, maybe? 1482 02:18:49,750 --> 02:18:50,910 75, I believe. 1483 02:18:51,350 --> 02:18:51,750 75. 1484 02:18:52,690 --> 02:18:56,810 I think the problem with this Commissioner Lightburn is it was a 1485 02:18:56,810 --> 02:19:02,210 bull barn and sometime after that they've continued to add on to make it a 1486 02:19:02,210 --> 02:19:06,870 dwelling that does not meet the ordinance. One of my concerns also is as I 1487 02:19:06,870 --> 02:19:10,010 understand there's no assigned address to the property because it's not a 1488 02:19:10,010 --> 02:19:13,670 permitted dwelling. So from a public safety standpoint we we wouldn't know 1489 02:19:13,670 --> 02:19:17,950 how to respond to this address today. So we're looking for some direction on 1490 02:19:17,950 --> 02:19:20,030 how to deal with it, but that's another consideration. 1491 02:19:21,930 --> 02:19:25,050 Now, you're talking about the address having the number on it. 1492 02:19:25,190 --> 02:19:28,410 Will that go for the house, or does that go for the log cabin? 1493 02:19:29,330 --> 02:19:30,090 Well, will it be separate? 1494 02:19:30,510 --> 02:19:31,970 Currently, there's no address, I believe. 1495 02:19:32,330 --> 02:19:32,710 That's correct. 1496 02:19:32,930 --> 02:19:34,850 I mean, if we were to. 1497 02:19:35,810 --> 02:19:37,230 If you guys were to approve it, that 1498 02:19:37,230 --> 02:19:39,350 would give staff the latitude to sign an address 1499 02:19:39,850 --> 02:19:40,810 if it was a guest home. 1500 02:19:41,290 --> 02:19:41,870 Oh, OK. 1501 02:19:42,130 --> 02:19:43,050 If it's a guest home. 1502 02:19:43,130 --> 02:19:43,310 Correct. 1503 02:19:43,730 --> 02:19:45,550 Today, it's not registered as anything 1504 02:19:45,550 --> 02:19:46,950 as an unpermitted structure. 1505 02:19:46,950 --> 02:19:55,130 sure. Okay. So do I understand it correctly that the home is occupied now? No. No, the 1506 02:19:55,130 --> 02:20:00,530 applicants do not live in that cabin. Do we have a time frame of when the primary structure 1507 02:20:00,530 --> 02:20:06,090 is to be started under construction? I'm not sure. I think they're just waiting tonight 1508 02:20:06,090 --> 02:20:11,810 to find out what happens to see if they can, because they originally back in 2022 submitted 1509 02:20:11,810 --> 02:20:13,810 plans for 1510 02:20:16,400 --> 02:20:22,560 the house but and that's why it was stopped so I'm sure they would like 1511 02:20:22,560 --> 02:20:27,960 to be whatever way you got whatever you decide they would like to build their 1512 02:20:27,960 --> 02:20:34,360 house I guess my next question would be for the applicant or the property 1513 02:20:34,360 --> 02:20:45,180 the owner. And that's Seth Lee Tarplin. Can I ask a question first? Yes. It sounds like 1514 02:20:45,180 --> 02:20:52,320 it sounds to me like the cabin and the barn are hazardous to the environment. 1515 02:20:54,820 --> 02:20:56,860 Am I hearing 1516 02:20:56,860 --> 02:21:02,100 that? Anybody else hearing that? It sounds like both of them need to be gotten rid of, 1517 02:21:02,100 --> 02:21:08,900 but they're so close to the lake in the stream bed that it's hazardous to leave it there 1518 02:21:08,900 --> 02:21:10,500 and it's hazardous to take it down. 1519 02:21:14,910 --> 02:21:16,190 I think that's a fair statement. 1520 02:21:18,900 --> 02:21:20,740 Have they done any 1521 02:21:20,740 --> 02:21:30,740 environmentals to see if there's any contamination from this? I think we've spent the last couple 1522 02:21:30,740 --> 02:21:35,620 of years trying to, you know, they've hired an attorney to try to help them and they've hired 1523 02:21:35,620 --> 02:21:42,820 an engineer to try to help them and we've tried to reach out to the EPD for some guidance 1524 02:21:42,820 --> 02:21:50,080 or some corrective action and it's just been kind of, I don't think the EPD wants to be 1525 02:21:50,080 --> 02:21:54,100 involved in somebody's backyard like this without a complaint. 1526 02:21:56,300 --> 02:21:58,940 We typically have a complaint policy. 1527 02:21:59,220 --> 02:22:04,960 We don't have a complaint on this issue and this is something that staff has been 1528 02:22:04,960 --> 02:22:11,700 and trying to work with the tarplies to try to come up with a solution, the building official 1529 02:22:12,420 --> 02:22:21,000 says that it's likely going to be very difficult for them to bring the log cabin into compliance 1530 02:22:21,000 --> 02:22:31,980 with today's regulations, but he doesn't know because, you know, he hasn't really 1531 02:22:31,980 --> 02:22:37,860 investigated it yet or inspected it yet so there's some there's some doubt 1532 02:22:37,860 --> 02:22:42,500 there but and that's why the condition was worded we tried to staff tried to 1533 02:22:42,500 --> 02:22:49,600 word the condition to you know to provide some some I guess an option so if 1534 02:22:49,600 --> 02:22:55,240 they could get it in compliance then okay maybe it's okay but you know but 1535 02:22:55,240 --> 02:23:00,960 But that's, you know, that's irrespective of the, of the septic system issue. 1536 02:23:01,620 --> 02:23:08,640 Well, I mean, I would, I would suggest, I mean, I get, I get the point, but if, you know, 1537 02:23:08,720 --> 02:23:13,560 you can, you can do all the inspections, but you can stop, stop the plumbing now. 1538 02:23:14,180 --> 02:23:14,440 Sure. 1539 02:23:14,540 --> 02:23:15,040 You know what I'm saying? 1540 02:23:15,240 --> 02:23:20,780 So it doesn't, the septic, and then if you find a liable, you know, per part of 1541 02:23:20,780 --> 02:23:25,500 property when you put a leak field on me like that, then you've kind of solved some of your 1542 02:23:25,500 --> 02:23:34,620 issues right there. But to me, the plumbing in my opinion should stop now because we don't 1543 02:23:34,620 --> 02:23:36,480 know if it's contaminating the groundwater. 1544 02:23:38,730 --> 02:23:40,970 So it should be used for that purpose right 1545 02:23:40,970 --> 02:23:41,230 now. 1546 02:23:42,330 --> 02:23:42,750 I understand. 1547 02:23:44,900 --> 02:23:49,120 And that would still give them the ability to go out and see if they can perk the 1548 02:23:49,120 --> 02:23:54,120 plan and put in a correct septic system and be able to convert it over. 1549 02:23:54,500 --> 02:23:55,240 So without 1550 02:23:58,920 --> 02:24:03,460 tearing it down yet, and then you go in there and do your inspections and stuff. 1551 02:24:03,680 --> 02:24:05,680 I mean, that's what that's what I'm thinking. 1552 02:24:09,480 --> 02:24:12,860 Uh, yo, got any further for all the Africa? 1553 02:24:14,810 --> 02:24:17,870 I guess what I'm saying is that you guys see this as an option. 1554 02:24:18,150 --> 02:24:18,270 I guess. 1555 02:24:18,550 --> 02:24:18,590 Absolutely. 1556 02:24:18,850 --> 02:24:19,930 Would you see that option? 1557 02:24:20,230 --> 02:24:24,910 vibrant to where you just basically stop the flowing now that the right okay 1558 02:24:24,910 --> 02:24:34,070 alright that's fair okay mr. Tarkley would you come up and let us ask you 1559 02:24:34,070 --> 02:24:38,450 some questions or you tell us what you want us to hear whoever's gonna speak 1560 02:24:38,450 --> 02:24:47,110 for you or okay I was gonna say I received a phone call and and they 1561 02:24:47,110 --> 02:24:52,470 were really bragging on they would love to have y'all as neighbors and how nice 1562 02:24:52,470 --> 02:24:58,250 you are and I don't know that much about Seth but I think I've had a little 1563 02:24:58,250 --> 02:25:05,210 contact with you and if you're the part of the top top please that I'm aware 1564 02:25:05,210 --> 02:25:13,810 of but you you're welcome tonight and speak on behalf of y'all's property 1565 02:25:13,810 --> 02:25:14,730 Thank you. 1566 02:25:16,550 --> 02:25:23,850 Hey everyone, my name is Shelby Tarpley. I'm here with my husband Seth and our son Rip. Sorry for the toddler outburst tonight. 1567 02:25:23,870 --> 02:25:25,990 Could you give us your address, please? 1568 02:25:26,290 --> 02:25:30,210 We are currently living with my parents in 15 Chinman Place, Sharpsburg. 1569 02:25:30,410 --> 02:25:30,630 Okay. 1570 02:25:30,750 --> 02:25:36,370 But the addressing question that, when we bought it, it was considered 1127, Kalwita heard. 1571 02:25:36,510 --> 02:25:42,510 I'm not sure if that's going to be the address or not, but I just want to say I was a homicide detective for 10 years 1572 02:25:42,510 --> 02:25:49,230 and not once was I worried about court testimony, but if I'm a little flabbergasted, I'm sorry. 1573 02:25:51,030 --> 02:25:55,870 But I just want to say, I just want to say thank you for your consideration and kind 1574 02:25:55,870 --> 02:25:58,910 of give you a rundown of what we've been going through the past three years. 1575 02:25:59,370 --> 02:26:02,370 So we bought the property back in 2017. 1576 02:26:03,150 --> 02:26:06,810 My husband proposed to me on the property in 2019. 1577 02:26:06,810 --> 02:26:12,990 we got married on our property in 2020 and it's exactly where we want to build our 1578 02:26:12,990 --> 02:26:19,110 house. Little backstory, before we got married my father-in-law decided to 1579 02:26:19,110 --> 02:26:25,630 build this cabin on our property and at the time it was just a pole barn and when 1580 02:26:25,630 --> 02:26:31,950 we purchased this property we did not know about the water restrictions. We 1581 02:26:31,950 --> 02:26:35,130 just had no idea. You know we were looking at a beautiful piece of property 1582 02:26:35,130 --> 02:26:40,070 where we could come camp come hunt and fish. We'd like to do all the outdoor 1583 02:26:40,070 --> 02:26:48,730 activities so it was just very exciting. He enclosed the cabin and honestly it we 1584 02:26:48,730 --> 02:26:53,090 were just wanting to use it as a spot to do Thanksgiving Christmas just come and 1585 02:26:53,090 --> 02:26:57,770 camp. I mean it was never going to be a guest house or anything of that 1586 02:26:57,770 --> 02:27:01,510 nature. We always wanted to build our home. It was just a place to come 1587 02:27:01,510 --> 02:27:06,990 hang out instead of having to bring campers. And when we went to apply for our build permit 1588 02:27:06,990 --> 02:27:11,870 for our home, you know, we came across all these obstacles and I'll be the first to admit 1589 02:27:11,870 --> 02:27:16,950 I'm the one when I left policing, I cashed out my retirement and I said, I'm going 1590 02:27:16,950 --> 02:27:20,110 to contribute before I'm going to stay at home mom, I'm going to pay for our building 1591 02:27:20,110 --> 02:27:24,310 in our shop. And through recommendations, we had a couple of friends recommend out 1592 02:27:24,310 --> 02:27:30,690 of state company, which is who I hired. And I don't want to say that I really 1593 02:27:30,690 --> 02:27:35,630 didn't look into it further, but I was under the assumption that when you pay this company 1594 02:27:35,630 --> 02:27:43,170 $50,000 that they handle all of the aspects. So I apologize to you. That is my wrongdoing. 1595 02:27:44,310 --> 02:27:50,490 We have suffered for it for the past three years. Sorry. But I would just like to apologize. 1596 02:27:50,750 --> 02:27:54,650 Like I said, we're not trying to be malicious. We're just trying to build our home. 1597 02:27:55,330 --> 02:27:59,250 We've been living between family members for the past three years. 1598 02:27:59,910 --> 02:28:05,990 We started this when my son was one month old. He turns four in June. Sorry. 1599 02:28:07,470 --> 02:28:15,350 We had already paid our builder their builder fee of $30,000. We have already started our home loan. 1600 02:28:15,930 --> 02:28:19,850 We lost our home loan back in December because our concrete was not poured. 1601 02:28:20,470 --> 02:28:27,610 I brought some documents that I can show you where I had to call and write ten page letters to the banks, 1602 02:28:27,610 --> 02:28:31,810 you know giving them the rundown of what we were trying to do. We hired Melissa 1603 02:28:31,810 --> 02:28:36,910 Griffiths and we worked with her and Dan Davis who's an engineer for three 1604 02:28:36,910 --> 02:28:43,210 years. We no longer work with her. I just feel like the last 36,000 dollars 1605 02:28:43,210 --> 02:28:48,290 they got from us it just let us know where. We were doing soil tests, we were 1606 02:28:48,290 --> 02:28:54,310 doing mapping, we had our surveyor at our house every other week. We just 1607 02:28:54,850 --> 02:28:59,170 we felt like we were doing everything that the two of them asked us to do and 1608 02:28:59,170 --> 02:29:04,750 three years later we're still in the same spot so my husband and I went to Mr. 1609 02:29:04,870 --> 02:29:10,150 John and said we're coming to you directly what what can we do we will do 1610 02:29:10,150 --> 02:29:16,710 whatever we need to I just asked that you have some compassion like I said 1611 02:29:16,710 --> 02:29:21,210 we're not trying to be malicious we were just looking for a place to start 1612 02:29:21,210 --> 02:29:26,330 our family. I know that the shop is being called a barn. We don't have livestock or 1613 02:29:26,330 --> 02:29:31,310 anything in there. Right now I have all of my bedroom furniture. We have his jeep, our 1614 02:29:31,310 --> 02:29:36,370 camper boat. We have all of the doors and windows that we already purchased for our home. 1615 02:29:37,230 --> 02:29:42,450 We're currently paying $96,000 back on a home loan that was canceled because we 1616 02:29:42,450 --> 02:29:47,130 already had our grading done. We already ordered materials for our house and they're 1617 02:29:47,130 --> 02:29:49,730 sitting in between the shop and the cabin. 1618 02:29:50,990 --> 02:29:54,610 So I would just, I'm open to answer any questions you have. 1619 02:29:55,430 --> 02:29:58,830 I just ask that you please, you know, look at us is. 1620 02:30:00,460 --> 02:30:06,120 Compassionate humans and just please accept my apology and know that we're not rule breakers. 1621 02:30:06,220 --> 02:30:12,220 Like I said, I was a police officer for 10 years. But at this point, we're going to do what we need to do. 1622 02:30:12,340 --> 02:30:14,920 We just want to build our home and continue growing our family. 1623 02:30:16,660 --> 02:30:20,500 Do you have any questions, commissioners? No. No. 1624 02:30:22,220 --> 02:30:23,680 Thank you. All right. Thank you, guys. 1625 02:30:25,260 --> 02:30:31,160 Mr. Fass, do we have any in support or opposition to this proposed variance? 1626 02:30:31,920 --> 02:30:32,320 No, sir. 1627 02:30:32,420 --> 02:30:34,560 Mr. Chairman, no one signed it to speak on this public hearing. 1628 02:30:37,520 --> 02:30:38,980 Motion to close the public hearing. 1629 02:30:39,800 --> 02:30:40,280 Second. 1630 02:30:40,960 --> 02:30:43,040 There is a motion and a second to close the public hearing. 1631 02:30:43,140 --> 02:30:44,040 Any further discussion? 1632 02:30:44,860 --> 02:30:46,220 All in favor say aye. 1633 02:30:46,320 --> 02:30:46,660 Aye. 1634 02:30:47,020 --> 02:30:47,220 Aye. 1635 02:30:48,000 --> 02:30:48,740 Those opposed? 1636 02:30:49,880 --> 02:30:50,980 Not hearing any. 1637 02:30:51,620 --> 02:30:53,220 It carries unanimously. 1638 02:30:56,860 --> 02:30:57,800 do we, 1639 02:31:01,610 --> 02:31:07,490 this is in my district and I'm going to, I'm going to muddle through this because 1640 02:31:07,490 --> 02:31:12,550 we're talking about three different things. Let's take the log cap and 1641 02:31:20,810 --> 02:31:23,770 I hear John, you 1642 02:31:23,770 --> 02:31:29,730 and Nicole and others say that it may be more detriment to tear down the existing 1643 02:31:29,730 --> 02:31:36,130 structure than it is to leave it. So this would be my suggestion is to leave the structure 1644 02:31:36,130 --> 02:31:48,570 But take out septic tank. It has not been approved. We don't know if it's leaching into the streams or anything about it. 1645 02:31:48,710 --> 02:31:55,950 Plus I would like for them to get that approved. 1646 02:31:56,350 --> 02:31:57,370 Can I make a comment to that? 1647 02:31:57,370 --> 02:31:57,530 Yes. 1648 02:31:57,530 --> 02:32:04,810 Mr. Chairman, so I would agree with you, but I think removing the septic leaks field would 1649 02:32:04,810 --> 02:32:06,430 be a detriment because you have a land. 1650 02:32:06,770 --> 02:32:07,730 You're disturbing the land. 1651 02:32:07,830 --> 02:32:08,610 Am I right, Mr. Ramison? 1652 02:32:08,770 --> 02:32:13,270 When you pull out the leak field and the septic, so if you let it there, just stop 1653 02:32:13,270 --> 02:32:20,050 it, quit, stop the plumbing from the structure, it would eventually dry itself out and go 1654 02:32:20,050 --> 02:32:20,250 away. 1655 02:32:20,370 --> 02:32:21,430 I mean, so it wouldn't be an impact. 1656 02:32:21,690 --> 02:32:22,730 You wouldn't have disturbed land. 1657 02:32:23,070 --> 02:32:24,370 It would become a dead field. 1658 02:32:24,690 --> 02:32:25,690 Am I correct, Mr. Ramison? 1659 02:32:26,430 --> 02:32:26,970 Yes, sir. 1660 02:32:26,970 --> 02:32:34,690 If I could add, could we involve the Environmental Health Department in doing this, since that's their line of business? 1661 02:32:35,950 --> 02:32:37,970 That's who they'd have to get the permit from, right? 1662 02:32:38,030 --> 02:32:38,350 Yes, sir. 1663 02:32:38,890 --> 02:32:53,640 So, I don't know exactly how to pose that if the environmental folks come back and say it can't be done, but without taking it out. 1664 02:32:53,640 --> 02:33:00,200 but my son-in-law is going through this right now that's why I know they're 1665 02:33:00,200 --> 02:33:05,520 leaving the existing leak field there to die and they put in a new one and that's 1666 02:33:05,520 --> 02:33:09,740 how the EPD did it they just let it go what about the sifted tank itself it 1667 02:33:09,740 --> 02:33:14,200 basically drains itself and it's just it becomes so it's just a empty you need 1668 02:33:14,200 --> 02:33:19,820 to fill it and then cap it fill it with their sand yeah mr. chairman 1669 02:33:21,280 --> 02:33:26,160 The recommended conditions were those nine conditions and so far the ones you're 1670 02:33:26,160 --> 02:33:31,160 mentioning are already listed the one item number five I believe it is 1671 02:33:31,160 --> 02:33:34,820 condition five the existing unpermitted septic absorption field shall be 1672 02:33:34,820 --> 02:33:38,900 removed so you could simply change that to as directed by environmental health 1673 02:33:38,900 --> 02:33:48,580 and let them handle it if that's the board's pleasure right that down is 1674 02:33:52,040 --> 02:33:59,100 Is there water service? They said that there was electricity. I didn't ask about the water 1675 02:33:59,100 --> 02:34:00,800 service. Is there well or is it? 1676 02:34:00,940 --> 02:34:01,160 Well. 1677 02:34:01,640 --> 02:34:02,500 I serve city water. 1678 02:34:03,160 --> 02:34:03,940 City water? 1679 02:34:04,080 --> 02:34:04,640 County water. 1680 02:34:04,820 --> 02:34:05,240 County water. 1681 02:34:05,500 --> 02:34:06,040 County water. 1682 02:34:07,440 --> 02:34:07,960 Wow. 1683 02:34:08,880 --> 02:34:09,920 That's interesting. 1684 02:34:15,320 --> 02:34:22,760 Well, my question is still, are they trying to save the cabin? Because I'm going to 1685 02:34:22,760 --> 02:34:29,520 One of them at a time and I want to find out what we're going to do with their log cabin if if anything if this at this point 1686 02:34:29,520 --> 02:34:33,340 I think it would be consensus from what I can gather that the cabin remain 1687 02:34:34,100 --> 02:34:38,580 Yeah, my question later. They want to try to turn it into a guest house, which 1688 02:34:39,400 --> 02:34:41,380 Sure, we're not sure if the 1689 02:34:41,900 --> 02:34:46,040 Well, they have to make sure they have to get septic perk and all that stuff. Yeah 1690 02:34:46,680 --> 02:34:48,360 One of the conditions 1691 02:34:49,440 --> 02:34:51,040 Since they're in the stream buffer 1692 02:34:51,040 --> 02:34:56,520 they also know not to expand upon the structure in the future as well is that 1693 02:34:56,520 --> 02:35:02,000 in there it's I don't believe that's a condition but we could add that do you 1694 02:35:02,000 --> 02:35:06,620 not agree with it yeah no you're right you're right because I mean if they can 1695 02:35:06,620 --> 02:35:10,300 mitigate yes I'm saying they'd mitigate I'm okay with it okay 1696 02:35:12,170 --> 02:35:18,010 that's about you okay with it yes are you recommending staffs recommended nine 1697 02:35:18,010 --> 02:35:26,130 conditions. Change number five. Correct. And just no further expansion. And I don't 1698 02:35:26,130 --> 02:35:29,570 I don't know if number six if it says if it's determined that no septic 1699 02:35:29,570 --> 02:35:32,950 system can be permitted your water service must I mean we're gonna wait 1700 02:35:32,950 --> 02:35:36,890 for that to be done before you discontinue water service or what. Yes 1701 02:35:36,890 --> 02:35:40,290 I'd be determined if the structure cannot be permitted then obviously we 1702 02:35:40,290 --> 02:35:47,310 would move to that next step. Is that something that we need to add? I believe 1703 02:35:47,310 --> 02:35:48,150 I believe it's covered. 1704 02:35:48,870 --> 02:35:50,010 I believe it's covered. 1705 02:35:50,890 --> 02:35:53,130 I think you've got to have, if it's a dwelling, 1706 02:35:53,370 --> 02:35:54,330 you have to have running water. 1707 02:35:55,510 --> 02:35:56,910 So it can't be a dwelling. 1708 02:35:57,470 --> 02:35:58,030 Okay. 1709 02:36:01,540 --> 02:36:03,460 Add the 10th condition of your expansion. 1710 02:36:03,940 --> 02:36:04,500 Yeah. 1711 02:36:05,140 --> 02:36:05,440 Right. 1712 02:36:08,080 --> 02:36:11,740 So that looks like, so we modified 5 and added number 10. 1713 02:36:12,660 --> 02:36:13,380 All right. 1714 02:36:14,480 --> 02:36:16,120 You want to vote on those independently? 1715 02:36:16,580 --> 02:36:20,240 Well, I think we probably need to do so. 1716 02:36:20,240 --> 02:36:32,060 we're going to vote on the log cabin first. So I'd make a motion that we allow 1717 02:36:32,060 --> 02:36:39,520 the log cabin with the conditions that are given there are 10 with the where 1718 02:36:39,520 --> 02:36:43,080 nine I think and then we expanded and went to 10. 1719 02:36:45,120 --> 02:36:49,680 So that's my motion on the 1720 02:36:49,680 --> 02:36:55,500 allowed cabinet. I'll second. I have a motion to second. Is there any further discussion? 1721 02:36:56,080 --> 02:37:05,660 So was number 10 resolved that the septic field would be allowed to die in the septic 1722 02:37:05,660 --> 02:37:12,560 tank field with sand or dirt? Is that what that's what we're talking? That's modification 1723 02:37:12,560 --> 02:37:17,800 for number five, number 10, is they can't expand on the current dwelling. Okay. All 1724 02:37:17,800 --> 02:37:17,940 Alright. 1725 02:37:20,430 --> 02:37:21,370 Thank you, Chairman. 1726 02:37:21,750 --> 02:37:26,290 Okay. Anything further? Ready for the question? 1727 02:37:26,810 --> 02:37:28,130 All in favor say aye. 1728 02:37:28,290 --> 02:37:29,710 Aye. All opposed? 1729 02:37:31,630 --> 02:37:33,550 Okay. Carries unanimously. 1730 02:37:35,290 --> 02:37:41,330 On the VAR 2501, which is the metal barn. 1731 02:37:47,960 --> 02:37:51,020 My heart goes out to you when you talk about 1732 02:37:51,660 --> 02:37:59,340 hiring people to and you know you're new to building and that kind of stuff. If my 1733 02:37:59,340 --> 02:38:05,240 heart goes out to you to understand how you can you can be took you know and 1734 02:38:05,240 --> 02:38:07,120 thinking everything is fine. 1735 02:38:13,120 --> 02:38:16,660 Commissions what do y'all how do you feel? I 1736 02:38:16,660 --> 02:38:25,180 really don't have a problem with the metal bond or the two metal buildings 1737 02:38:25,180 --> 02:38:29,980 from whatever they are. I think the only two things that I like it if they 1738 02:38:29,980 --> 02:38:33,500 mitigate just the staff. Yeah that's what I'm saying mitigated for staff 1739 02:38:33,500 --> 02:38:40,420 requests staff conditions that's what I would suggest to you. So I'm assuming 1740 02:38:40,420 --> 02:38:48,220 then is there any other discussion for why make a motion on it? Yes sir I 1741 02:38:48,220 --> 02:38:51,620 would I would like for them to be able to keep the barn because they have 1742 02:38:51,620 --> 02:38:55,920 of building materials and she says they have a bedroom 1743 02:38:55,920 --> 02:38:57,180 suited and stuff like that. 1744 02:38:57,660 --> 02:38:57,780 Yeah. 1745 02:38:59,680 --> 02:39:03,440 But it's so difficult because if you tear it down, 1746 02:39:03,780 --> 02:39:05,700 it's gonna affect the string buffer. 1747 02:39:06,440 --> 02:39:08,680 And if you leave it up, it's gonna affect the string buffer. 1748 02:39:08,760 --> 02:39:11,220 But I think it needs to be demolished, 1749 02:39:11,320 --> 02:39:14,000 but only after she's finished using it for storage. 1750 02:39:16,220 --> 02:39:18,480 I agree with you. 1751 02:39:18,480 --> 02:39:25,380 And I believe that my colleagues are in line with what you were saying. 1752 02:39:26,400 --> 02:39:28,220 So can I ask questions further? 1753 02:39:29,520 --> 02:39:38,560 So, Mr. Emerson, based on what Mr. Smith was saying, is if we leave it there until they're, 1754 02:39:38,680 --> 02:39:40,580 I guess, they build their house and you tear it down. 1755 02:39:40,920 --> 02:39:45,560 But I thought he says there, if you tear it down, it can cause more problems than what it's... 1756 02:39:45,560 --> 02:39:46,720 And that's what Mr. Smith said. 1757 02:39:46,720 --> 02:39:59,700 It could. I think staff's recommendation would be to for them to provide mitigation and let it stay there, do some things to do some things environmentally to try to, you know, that's what I saw. 1758 02:39:59,840 --> 02:40:02,600 Okay, so we're just going to mitigate it. 1759 02:40:02,680 --> 02:40:02,960 Okay. 1760 02:40:02,960 --> 02:40:15,860 Okay. Any further? My motion is to approve this request with the conditions as stated 1761 02:40:15,860 --> 02:40:23,800 and that staff will help mitigate this with the owners. That's my motion. 1762 02:40:23,940 --> 02:40:24,940 I'll second through motion. 1763 02:40:25,260 --> 02:40:28,440 All right. Motion is second. The first is Vicki Hunter. 1873 02:46:42,300 --> 02:46:44,300 I'm sorry miss Hunter I like to try to 1874 02:46:44,300 --> 02:46:45,220 Good 1875 02:46:48,200 --> 02:46:57,400 evening. Thank you for letting me talk to you about something that's very close to my heart, my neighborhood, Lake Hills subdivision. 1876 02:46:57,980 --> 02:47:06,020 When my parents moved there in 1964, I thought I had truly moved to Paradise. It's a wonderful place to grow up. 1877 02:47:06,720 --> 02:47:11,900 I've lived in Lake Hills for 55 years and five generations of my family have lived there. 1878 02:47:11,900 --> 02:47:17,480 Later, as an adult, I was able to buy an acre and build a cottage and teach school in Coweta 1879 02:47:17,480 --> 02:47:20,000 County for 35 out of my 40 years. 1880 02:47:20,580 --> 02:47:22,800 What a wonderful place to raise a child. 1881 02:47:23,340 --> 02:47:26,140 And the mortgage is almost paid off after 37 years. 1882 02:47:26,620 --> 02:47:31,840 It's a lovely neighborhood, and I have never wanted to live anywhere else, but in Lake 1883 02:47:31,840 --> 02:47:35,240 Hills, Coweta County, it's safe and peaceful. 1884 02:47:35,980 --> 02:47:42,600 A change has been proposed to the houses just down the hill for me. 1885 02:47:43,860 --> 02:47:48,700 It may not seem like much, but I think it will forever change my world. 1886 02:47:49,820 --> 02:47:53,760 At least 30 houses may go up behind these seven acres. 1887 02:47:54,760 --> 02:47:59,660 Multi-density, two terrifying words in modern vernacular. 1888 02:47:59,660 --> 02:48:05,120 And I don't know what the answer is because these two neighborhoods are so different. 1889 02:48:05,420 --> 02:48:07,640 Acre lots, multi-density. 1890 02:48:09,440 --> 02:48:11,600 These two-story houses looming over. 1891 02:48:13,120 --> 02:48:16,160 I know the new neighborhood will have strong covenants. 1892 02:48:16,460 --> 02:48:20,940 They'll keep the appearance of their neighborhood pristine, grass shrubs pruned. 1893 02:48:20,940 --> 02:48:29,020 And the only problem is that most homeowner associations do not patrol the back of a property. 1894 02:48:29,910 --> 02:48:36,060 So these 30 houses that my neighbors and I will see, I'm just concerned about the grills, 1895 02:48:36,360 --> 02:48:40,960 the overflow stuff, campers, boats, you know, all just the outdoor paraphernalia people 1896 02:48:40,960 --> 02:48:42,040 put behind their houses. 1897 02:48:42,640 --> 02:48:49,440 And of course the trash cans won't be stored in the front or on the sides but probably 1898 02:48:49,440 --> 02:49:00,380 and back in plain view. Also, dogs outside, fencing issues, the list just goes on and 1899 02:49:00,380 --> 02:49:05,820 on and hopefully there are none of them are rentals because that's a whole other issue 1900 02:49:05,820 --> 02:49:12,480 there. But the intensity of this is quite overwhelming to those in Lake Hills who have an acre lot. 1901 02:49:13,240 --> 02:49:18,520 We're not special, we just live in Coweta County and we have septic tanks because 1902 02:49:18,520 --> 02:49:25,120 of the codes of our time. I took a lovely walk today and as I topped the hill, I thought wow, 1903 02:49:25,580 --> 02:49:37,300 I will see roof, roof, roof, more than 30 of them. So please, if you can, vote no to the amendment 1904 02:49:37,880 --> 02:49:43,620 for Lake Hills and Camelia Circle. I have cherished my neighborhood of 55 years and 1905 02:49:43,620 --> 02:49:48,600 almost paid for house with an acre lot and a septic tank. Thank you for my 1906 02:49:48,600 --> 02:49:53,680 wonderful half-century of living in beautiful Calvita County. Thank you. 1907 02:49:55,100 --> 02:49:56,940 Next Ms. Chairman Ruth Stark. 1908 02:50:04,700 --> 02:50:07,720 Ruth Stark, 30 Club Court. 1909 02:50:12,270 --> 02:50:14,910 Before I address the 1910 02:50:14,910 --> 02:50:18,790 annexation that is currently being proposed I want to go back and revisit 1911 02:50:18,790 --> 02:50:25,790 the annexation that was previously approved on Green Top Road. 1912 02:50:27,150 --> 02:50:33,310 The county did a great job going to bat forest with that as best they could 1913 02:50:34,090 --> 02:50:39,970 because of the laws that are in place City 1 to annex that. 1914 02:50:41,090 --> 02:50:44,710 The concerns I have is the things that I'm looking at already 1915 02:50:44,710 --> 02:50:57,730 with this development that is already in place. The annexation, the residents of my neighborhood 1916 02:50:57,730 --> 02:51:01,850 were concerned that once the city got their foot in the door, they'd fling the door wide 1917 02:51:01,850 --> 02:51:07,850 open and it has happened. They are asking for more and more and more. They want to 1918 02:51:07,850 --> 02:51:14,110 variance to go with the 400 unit allowance, which would be about 25% more of an increase. 1919 02:51:15,270 --> 02:51:22,410 My observation of the current things that are going on green top road are, I thought 1920 02:51:22,410 --> 02:51:30,570 there was supposed to be a 50 foot planted buffer with a 25 foot planted perimeter buffer 1921 02:51:30,570 --> 02:51:38,990 is one tree considered 25 feet? Where are they measuring? Are they measuring the 1922 02:51:38,990 --> 02:51:43,890 trunk or are they measuring the canopy? Because that's all that is on Green Top 1923 02:51:43,890 --> 02:51:50,450 Road right now is one tree standing along the road. We are concerned about the 1924 02:51:50,450 --> 02:51:57,250 impacts, traffic, and I know that's not something that we learn that can be 1925 02:51:57,250 --> 02:52:03,850 really address, but it needs to be. The infrastructure is not there. Northside Elementary 1926 02:52:03,850 --> 02:52:10,630 School is already at capacity and they haven't even completed this other development. 1927 02:52:12,990 --> 02:52:13,750 The 1928 02:52:14,190 --> 02:52:23,770 developer of this proposed annexation has indicated there is an N.A. for an impact 1929 02:52:23,770 --> 02:52:31,230 study. Why? Why was that impact study not applicable? Apparently the earlier impact study should 1930 02:52:31,230 --> 02:52:31,770 be obsolete. 1931 02:52:38,270 --> 02:52:46,790 It's only a quarter of a mile of highway, of road. Due to the realignment 1932 02:52:46,790 --> 02:52:54,690 of Green Top, my neighborhood is now isolated. I live in Country Club Manor in the backside 1933 02:52:54,690 --> 02:53:01,070 side of Heritage Hills. And to be able to get out on the traffic has already increased 1934 02:53:01,070 --> 02:53:07,230 without any of the development, any of those developments already in place. I feel that 1935 02:53:07,790 --> 02:53:11,070 it's going to be even worse. Is the county going to be? 1936 02:53:14,960 --> 02:53:15,960 Don't sell our tools. 1937 02:53:15,960 --> 02:53:17,960 Thank you. 1938 02:53:21,100 --> 02:53:24,980 We have a few more to sign off the agenda later, Mr. Chairman. 1939 02:53:25,560 --> 02:53:27,060 Off the agenda? 1940 02:53:28,480 --> 02:53:30,840 We'll get to those here shortly. 1941 02:53:33,660 --> 02:53:45,540 Item number eight, recommendation regarding petition number AN02-25 filed by Charles 1942 02:53:45,540 --> 02:53:54,940 Charles Connolly, representative of NCTILLC, proposing to annex property located off of 1943 02:53:54,940 --> 02:54:02,220 Green Top Road into the city of Nenon, District 3, and Ms. Blackwell, you have the floor. 1944 02:54:02,760 --> 02:54:03,700 Thank you. 1945 02:54:04,460 --> 02:54:12,560 We have applicant Charles S. So where are we at in the 45-day threshold? Your next meeting would 2000 02:58:41,800 --> 02:58:49,940 exceed the 45 days. So I would I would move and suggest that we object to the 2001 02:58:53,140 --> 02:58:56,320 Is that based upon the information in the staff report, Commissioner? 2002 02:58:57,460 --> 02:59:03,300 It is based on the metric that Nicole presented and what Michael just illustrated. 2003 02:59:04,620 --> 02:59:04,960 Okay. 2004 02:59:05,740 --> 02:59:06,560 I'll second it. 2005 02:59:06,940 --> 02:59:08,160 I have a motion to second. 2006 02:59:08,480 --> 02:59:09,380 Any further discussion? 2007 02:59:11,400 --> 02:59:20,240 I would add, if I could, I'm sorry, Mr. Chairman, would the Board consider, if we do notify DCA, placing a stay in that arbitration process 2008 02:59:20,240 --> 02:59:24,320 us to try to get a an agreement before this goes to arbitration like we're 2009 02:59:24,320 --> 02:59:32,900 doing for Sydney Pope is that I mean I'm sorry to add that now no no if you 2010 02:59:32,900 --> 02:59:35,660 guys would consider making that part of your motion I think that would help to 2011 02:59:35,660 --> 02:59:42,760 clarify I would make that part of it the original motion all right correct 2012 02:59:42,760 --> 02:59:42,920 Great. 2013 02:59:43,660 --> 02:59:45,540 And second, you okay with that? 2014 02:59:45,800 --> 02:59:46,300 All right. 2015 02:59:46,720 --> 02:59:47,740 Any further discussion? 2016 02:59:48,940 --> 02:59:50,440 All in favor say aye. 2017 02:59:50,540 --> 02:59:50,880 Aye. 2018 02:59:51,300 --> 02:59:51,540 Aye. 2019 02:59:52,680 --> 02:59:55,000 And it is opposed. 2020 02:59:55,880 --> 02:59:59,200 So, carries, but it is. 2021 03:00:00,000 --> 03:00:14,220 All right, number nine, request approval, execution of an amendment to chapter 14, the building and 2022 03:00:14,220 --> 03:00:21,460 building regulations associated with permit fees. It carries unanimous. 2115 03:15:45,510 --> 03:15:51,630 Number 13, request approval execution of fiscal year 2025, Georgia Department of Human 2116 03:15:51,630 --> 03:15:58,270 Human Services Subrecipient Agreement with Three Rivers Regional Commission associated 2117 03:15:58,270 --> 03:15:59,730 with CalEDA Transit. 2118 03:16:00,430 --> 03:16:02,390 And I think, Ms. Kelly, are you? 2119 03:16:02,990 --> 03:16:08,890 Mr. Chairman, Commissioners, staff is in receipt of the 2025 Agreement with Three Rivers Regional 2120 03:16:08,890 --> 03:16:13,250 Commission, which outlines the Department of Human Services funding process and 2121 03:16:13,250 --> 03:16:15,930 requirements for the County's 5311 Transit Program. 2122 03:16:17,010 --> 03:16:22,890 This is essentially funding that we receive through the Department of Human Services, 2123 03:16:23,390 --> 03:16:27,890 and we're a sub-recipient of the Three Rivers Regional Commission, so the money funnels through 2124 03:16:27,890 --> 03:16:28,210 them. 2125 03:16:28,590 --> 03:16:36,250 And it's for eligible individuals, and instead of them paying the $3 per one-way trip, like 2126 03:16:36,250 --> 03:16:42,610 a public trip, these trips are booked ahead of time through the DHS database, and we 2127 03:16:42,610 --> 03:16:43,550 are reimbursed. 2128 03:16:43,550 --> 03:16:52,590 I believe it's around $19 per trip so this is again it's a significant percentage of 2129 03:16:52,590 --> 03:16:58,350 the trips provided by our transit service are these DHS trips and again it's for 2130 03:16:58,350 --> 03:17:02,630 eligible individuals now going to eligible centers such as the Relidge Center 2131 03:17:02,630 --> 03:17:05,610 and the Coway to Senior Center. Will we ever have a direct with them and sit 2132 03:17:05,610 --> 03:17:10,510 out here with the three river sensor do our own transportation? That's a great 2133 03:17:10,510 --> 03:17:17,170 question we have been discussing trying to become a direct recipient for some 2134 03:17:17,170 --> 03:17:23,910 other FTA funding I'm sorry though I'm not sure this is not FTA I'm sorry we 2135 03:17:23,910 --> 03:17:30,630 could look into that it's just curious it's always worked this way when we've 2136 03:17:30,630 --> 03:17:36,670 asked questions I'm not sure we've gotten great answers but it I we can 2137 03:17:36,670 --> 03:17:44,730 certainly continue to know it's a great question. I have a motion. Second. All 2138 03:17:44,730 --> 03:17:53,370 right. Any further discussion? All in favor say aye. Aye. Aye. And it carries 2139 03:17:53,370 --> 03:17:53,930 unanimously. 2140 03:17:57,350 --> 03:18:03,850 Number 14, a request approval of courtroom audio video 2141 03:18:03,850 --> 03:18:09,610 technology upgrades and we do approve thank you there's a motion is there a 2142 03:18:09,610 --> 03:18:16,790 second second motion in a second any further discussion not hearing any all 2143 03:18:16,790 --> 03:18:24,430 in favor say aye all opposed by the same it carries unanimously number 15 bid 2144 03:18:24,430 --> 03:18:29,730 award associated with enforcement of ordinance regulating rank plant growth 2145 03:18:29,730 --> 03:18:36,830 and trash accumulation for property located at 25 Ridgedale court noon and 2146 03:18:36,830 --> 03:18:42,830 district 4 make a motion to approve all right there's a motion and we have a 2147 03:18:42,830 --> 03:18:51,530 second any discussion all in favor say aye and it carries unanimously our 2148 03:18:51,530 --> 03:18:57,570 additional action items number 16 request approval to submit a juvenile 2149 03:18:57,570 --> 03:19:05,950 justice incentive grant application. I'll make that motion. I'm sorry. I'll make that motion. Okay, 2150 03:19:06,110 --> 03:19:14,010 he was motion. Motion second. Any discussion? All in favor say aye. Aye. Aye. And it carries 2151 03:19:14,010 --> 03:19:19,790 unanimously. Number 17 request approval execution of a local maintenance improvement grant 2152 03:19:19,790 --> 03:19:27,830 supplemental application for 2025. It says district 2 but I think it's everybody. 2153 03:19:28,330 --> 03:19:32,850 Motion to approve. You got a motion to approve? Can I just kind of give us a 2154 03:19:32,850 --> 03:19:38,170 quick summary on the Elmizer? So I guess the amended budget from the 2155 03:19:38,170 --> 03:19:43,170 state, they allowed for some additional funding to go out to local 2156 03:19:43,170 --> 03:19:48,350 governments for local road projects. In this particular case, the county's 2157 03:19:48,350 --> 03:19:53,170 eligible for 2.2 million dollars in additional funding used towards road 2158 03:19:53,170 --> 03:19:56,810 transportation projects so the reason it says district 2 is what we're 2159 03:19:56,810 --> 03:20:01,250 proposing to do is use this to fund a portion of the Southwest Connector 2160 03:20:01,250 --> 03:20:06,190 Project so the SPOS fund and then we had budgeted for that. The Southwest 2161 03:20:06,190 --> 03:20:10,510 Connector Project is basically building the new road into the fair. That's 2162 03:20:10,510 --> 03:20:16,250 correct. So that's why it says district 2. Thank you. Motion. I have a motion. 2163 03:20:16,250 --> 03:20:29,330 Second. I'll second it. All right. Any further? All in favor say aye. All opposed. Thank you. 2251 03:27:30,870 --> 03:27:31,370 Thank you, sir. 2252 03:27:33,410 --> 03:27:35,890 Next, Mr. Chairman, Ron Bachrath. 2253 03:27:45,040 --> 03:27:48,840 Ron Bachrath, District 2, actually 335 Boone Road. 2254 03:27:49,480 --> 03:27:53,160 The proposed project sale borders my back property. 2255 03:27:55,840 --> 03:28:01,900 I've been sort of following on the internet what has happened in the last, since January 2256 03:28:01,900 --> 03:28:03,160 when this first came out. 2257 03:28:04,040 --> 03:28:07,900 And if you read things and listen to look at things on the internet, there are a lot 2258 03:28:07,900 --> 03:28:08,860 a lot of negatives. 2259 03:28:10,340 --> 03:28:17,060 Places people, municipalities that had approved data centers in the past are having second 2260 03:28:17,060 --> 03:28:17,540 thoughts. 2261 03:28:18,500 --> 03:28:22,320 I hope we are smart enough maybe to avoid those second thoughts and think of them 2262 03:28:22,320 --> 03:28:23,060 in the first place, 2263 03:28:25,380 --> 03:28:29,440 a study has been posted on a YouTube about the effect of data centers 2264 03:28:29,440 --> 03:28:37,180 in Georgia. They say as you have your loss of productive homeowners, like wells have 2265 03:28:37,180 --> 03:28:46,540 been destroyed, excessive dust during construction and noise, and this isn't just for a year 2266 03:28:46,540 --> 03:28:51,320 or two years, this is going on for like ten years. That's a long time to put up 2267 03:28:51,320 --> 03:28:52,140 with a bunch of nonsense. 2268 03:28:54,200 --> 03:28:55,380 Excessive bright lights. 2269 03:28:56,240 --> 03:28:57,400 If you look at some of the videos, 2270 03:28:59,540 --> 03:29:02,800 it's really discouraging to see that kind of bright light 2271 03:29:02,800 --> 03:29:04,020 out in a rural area. 2272 03:29:06,740 --> 03:29:11,220 Wildlife habitats destroyed, the lifestyle 2273 03:29:11,220 --> 03:29:14,500 that we've kind of grown accustomed to and we kind of like. 2274 03:29:15,200 --> 03:29:17,520 I've been out there for like 25 years roughly now. 2275 03:29:18,180 --> 03:29:19,740 Physically built the house we're in. 2276 03:29:23,530 --> 03:29:31,730 Also, it cites the recent veto by Governor Kemp of the suspension of the sales tax that 2277 03:29:31,730 --> 03:29:36,610 these places would have to pay if they had to pay taxes like we had to pay on our property 2278 03:29:36,610 --> 03:29:37,510 and our improvements. 2279 03:29:38,590 --> 03:29:44,190 That doesn't seem really very nice, especially when the legislators approve it and he vetoes 2280 03:29:44,190 --> 03:29:44,370 it. 2281 03:29:44,770 --> 03:29:49,170 It doesn't seem like he has the best interest of what the citizens of Georgia want through 2282 03:29:49,170 --> 03:29:50,910 the newly elected representatives. 2283 03:29:54,010 --> 03:29:59,900 Also, Georgia power has not charged 2284 03:30:00,000 --> 03:30:07,240 Charged industrial companies, the same rates as residential. Residential rates in Georgia 2285 03:30:07,240 --> 03:30:12,420 are slightly above the national average, while industrial rates are significantly below the 2286 03:30:12,420 --> 03:30:13,220 national average. 2287 03:30:15,940 --> 03:30:21,820 A proposal was made that maybe they should make data centers pay for 2288 03:30:21,820 --> 03:30:28,320 the added infrastructure that's needed to build these things. That was left to die on 2289 03:30:28,320 --> 03:30:37,540 committee. That's again another example where I think the duly elected officials were thinking 2290 03:30:37,540 --> 03:30:41,660 one thing, and somebody else would know, I won't just shove that aside in favor industry. 2291 03:30:42,460 --> 03:30:49,180 Industry is being emphasized over individuals. I think Georgia should do a little better 2292 03:30:49,180 --> 03:30:49,660 than that. 2293 03:30:52,090 --> 03:30:57,430 During two weeks, Commissioner Smith is a couple of weeks back, you, I'm sorry, 2294 03:30:57,430 --> 03:30:57,950 Are we out of time? 2295 03:30:58,250 --> 03:30:59,070 You're out of time. 2296 03:30:59,210 --> 03:31:00,070 I didn't mean to do that to you. 2297 03:31:00,090 --> 03:31:00,750 No, you're fine. 2298 03:31:00,830 --> 03:31:01,530 Thank you very much. 2299 03:31:01,630 --> 03:31:02,690 Thank you very much for coming. 2300 03:31:02,830 --> 03:31:04,050 Well, I didn't realize it. 2301 03:31:04,650 --> 03:31:05,230 Thank you. 2302 03:31:05,390 --> 03:31:05,830 Thank you. 2303 03:31:06,490 --> 03:31:08,450 Next, Mr. Chairman, Jill Daniel. 2304 03:31:10,190 --> 03:31:10,590 Daniel. 2305 03:31:16,200 --> 03:31:17,020 That's the left. 2306 03:31:17,380 --> 03:31:17,540 Okay. 2307 03:31:17,740 --> 03:31:19,080 Next, Connie Lytton. 2308 03:31:20,480 --> 03:31:20,880 Connie. 2309 03:31:26,660 --> 03:31:27,840 Good evening, commissioners. 2310 03:31:28,520 --> 03:31:31,780 I am speaking on behalf of Citizens for Rural Cowheed. 2311 03:31:31,840 --> 03:31:33,040 My name is Connie Lytton. 2312 03:31:33,100 --> 03:31:34,420 I might live on District 2. 2313 03:31:34,820 --> 03:31:35,260 Thank you. 2314 03:31:35,760 --> 03:31:40,240 I want to thank all of you all for your time tonight. I know it's a very late night. We're all ready to get to bed 2315 03:31:40,240 --> 03:31:45,440 I want to talk about some of the concerns that I have heard while having conversations with a few of you 2316 03:31:45,440 --> 03:31:47,140 Mr. Rettelbach has 2317 03:31:48,440 --> 03:31:55,180 Has shared with me that he is very concerned about imminent domain and how Kawida County citizens were affected 2318 03:31:55,180 --> 03:31:57,780 I agree imminent domain should be avoided 2319 03:31:57,780 --> 03:32:04,480 However, I also believe that people's homes and lives should not be negatively impacted by any data center being built in 2320 03:32:04,480 --> 03:32:10,040 in Cavite County. Homes in industrial zones are not a good fit for each other. I've heard 2321 03:32:10,040 --> 03:32:14,240 from more than one commissioner that Project Peach is an appropriate location due to the 2322 03:32:14,240 --> 03:32:20,000 industrial area that already flanked the property. I was also told that the location of Project 2323 03:32:20,000 --> 03:32:25,340 Cell is very different than Project Peach. I agree that Project Cell is very different. 2324 03:32:26,000 --> 03:32:30,420 It's definitely a very rural area with no industrial businesses already built there. 2325 03:32:30,420 --> 03:32:37,040 If you vote yes to Project Cell, then not only will the residents be greatly impacted during the building phase, 2326 03:32:37,600 --> 03:32:41,440 that will last many years according to Atlas, but forever after the build. 2327 03:32:41,960 --> 03:32:45,800 During the building phase there will be constant construction, noise dust, dirt, traffic, 2328 03:32:45,980 --> 03:32:48,420 and other negative impacts to the residents in the area. 2329 03:32:48,940 --> 03:32:53,720 A video shared by a resident that lives near QTS but not right next door to it 2330 03:32:54,420 --> 03:32:59,400 showed the intensity of the blast which causes her entire home to rattle 2331 03:32:59,400 --> 03:33:01,640 and now they're concerned about their foundations. 2332 03:33:02,640 --> 03:33:05,280 Wager's Mill is an area with a great deal of rock. 2333 03:33:05,820 --> 03:33:07,140 Have you all considered this? 2334 03:33:07,540 --> 03:33:09,340 And have you asked ATLAS for information 2335 03:33:09,340 --> 03:33:12,500 about the land makeup in the proposed data center? 2336 03:33:13,040 --> 03:33:16,020 Land surveys need to be required to show the amount of rock 2337 03:33:16,020 --> 03:33:18,080 that needs to be blasted and how that would be handled 2338 03:33:18,080 --> 03:33:19,340 if the project is allowed. 2339 03:33:19,780 --> 03:33:21,920 What about possible damages to nearby homes, 2340 03:33:22,060 --> 03:33:24,400 our foundation sheet, rock, windows, seals, et cetera? 2341 03:33:24,940 --> 03:33:25,840 Who pays for this? 2342 03:33:25,840 --> 03:33:30,380 So the citizens have to get a lawyer and sue if this happens to their homes. 2343 03:33:31,240 --> 03:33:35,100 Now for the permanent impact of our lives, the landscape of our area will forever be 2344 03:33:35,100 --> 03:33:40,140 changed for the worse and we will have an 836 acre industrial space sitting in the center 2345 03:33:40,140 --> 03:33:40,860 of our community. 2346 03:33:41,660 --> 03:33:45,920 If the same logic is used for determining the decision about Project Peach that is 2347 03:33:45,920 --> 03:33:50,260 already in a place that's industrial, then as people start to sell their homes 2348 03:33:50,260 --> 03:33:54,880 to escape the negative impacts of the data center, land will be getting rezoned 2349 03:33:54,880 --> 03:33:59,400 as industrial and gradually the entire area would change from the beautiful rural area 2350 03:33:59,400 --> 03:34:01,240 of Calwita to the next industrial park. 2351 03:34:01,920 --> 03:34:06,020 Mr. Rettelbach shared that he would not buy a home in the Project Peach area because of 2352 03:34:06,020 --> 03:34:09,800 the industrial zone and I agree I would not buy in any of those areas either. 2353 03:34:10,260 --> 03:34:14,900 But why will anyone else want to come to our area and buy our homes if the industrial 2354 03:34:14,900 --> 03:34:15,620 is allowed? 2355 03:34:17,100 --> 03:34:21,300 When there are other places that do not have a data center and whatever other 2356 03:34:21,300 --> 03:34:27,160 businesses decide to come to our place as people start to leave. Nobody wants to 2357 03:34:27,160 --> 03:34:30,620 live around these eyesores negative noise and light impacts and all the other 2358 03:34:30,620 --> 03:34:34,760 things that an industrial area has. So as you contemplate your decision for the 2359 03:34:34,760 --> 03:34:40,240 future vote of project sale, please consider that although we will not have 2360 03:34:40,240 --> 03:34:44,080 intimate domain, we will have imminent deal. Thank you. 2361 03:34:44,080 --> 03:34:47,480 Thank you. Next, Mr. Chairman, Robert Lytton. 2362 03:35:00,200 --> 03:35:03,620 Good evening, Robert Lytton. I'm a member 2363 03:35:03,620 --> 03:35:09,280 of Citizens for Rural Caueta and I'm just gonna piggyback and finish the 2364 03:35:09,280 --> 03:35:11,140 comments my wife had earlier. 2365 03:35:14,540 --> 03:35:17,020 Eminent domain will have eminent doom. I think 2366 03:35:17,020 --> 03:35:20,120 that's where she left off and we will be forced to move if we want to 2367 03:35:20,120 --> 03:35:25,080 remain living in a rural area homes rather than data centers and 2368 03:35:25,080 --> 03:35:30,800 businesses as our neighbors with the high likelihood that we will not get what our places would be 2369 03:35:30,800 --> 03:35:36,780 worth the day before the news broke out this data center and the rest of us will be forced to live 2370 03:35:36,780 --> 03:35:45,180 in an area that we no longer love because either no one will buy our homes or we cannot afford the 2371 03:35:45,180 --> 03:35:51,680 financial hit it will take to sell our homes so again we will not be facing eminent domain 2372 03:35:51,680 --> 03:35:58,300 like the citizens near QTS but will be facing imminent doom. I'd also like to 2373 03:35:58,300 --> 03:36:01,880 take this opportunity to thank you all for listening to us throughout this 2374 03:36:01,880 --> 03:36:08,620 process. Thank you. That's all Mr. Chairman. All right. 2375 03:36:12,000 --> 03:36:14,460 Is there any reason for 2376 03:36:14,460 --> 03:36:17,820 executive session? There's not Mr. Chairman. 2377 03:36:21,520 --> 03:36:24,760 We have a motion to adjourn and a 2378 03:36:24,760 --> 03:36:31,820 second. All in favor say aye. Aye. Aye. And it is unanimous. Thank you, folks, for coming 2379 03:36:31,820 --> 03:36:32,300 and staying.
