[2:50] Our [3:04] heavenly father, we call your precious name. Thanking you Lord for life, health [3:07] and strength. We thank you for this day. We thank you, oh Lord, for all the ones [3:11] that that uh came and interested in uh government business and and we just [3:16] pray, Father God, that as we uh go through the agenda and make the [3:20] decisions that that the love of of you would would uh rest in our hearts that [3:24] we make the right decisions that will benefit the citizens of Newton County [3:29] and to glorify your name. It's in Jesus name we pray. Amen. [3:33] » Amen. >> Uh we'll call the meeting to order. Uh [3:36] we do have a quorum. I'd like to acknowledge everybody that's here today. [3:40] Uh Chelsea public, anybody set up to speak? Okay, we'll close the public [3:46] hearing. Go right into the consent agenda. Um minutes from the previous [3:53] meeting. KK's not here. She is Do you know anything about how far caught up [3:58] she is? Okay. [4:04] Do we have any uh deputations or bonds that have come in? [4:12] I don't think we do. So, uh, on the monthly departmental, uh, reports, [4:18] um, we have in the packet here the departmental reports from [4:24] pretty well all the departments for y'all to look over. [4:54] Okay, hold on a chair. [5:00] [laughter] [5:04] » [clears throat] [5:46] » They jumped out at me on the fourth bill jumped out. [5:56] » Yeah. >> Couple of big items on that. [6:00] [clears throat] That's the [6:03] appraisal district budget [6:11] district. [6:14] Yeah, there was some software [6:19] on rent. Hope that's coming back. [6:24] » We received that already and we're just paying it off. [6:28] We receive grants and then we have to from the controller we receive payment [6:32] and we have within 550 to pay it out. >> Okay. [6:35] » So that 167 37 >> that was money yeah money received but [6:40] money's you know just turn right over [6:46] a note on that and put it on we usually do it that doesn't come with commission [6:51] report. We usually do on a different day it just landed on commissioner for day. [6:55] So normally that's just a wash. We just do it. We get painted in. We usually get [7:00] it out and then we get the requisition in this 25 35 days. It does not have to [7:05] come through court. Okay. Because of the fact that it is [7:10] we be having court. >> Well, you could way they're set up now. [7:15] I don't you could have court quick enough with the three business day. [7:18] Three working business day. >> You wouldn't be able to [7:22] » and it's not really a bill anyways, right? No, it's a reimbursement. [7:30] » But it does get your ears pointed when you see it and don't know what it is. [7:33] » I'm sorry. We should have [7:39] » It didn't bother me so much I didn't call. So [7:59] is probably knocked out. >> No. [laughter] [8:09] Probably. >> All right. Does anybody have any [8:11] questions on the monthly department reports? [8:18] Um, how about we don't have any continue education certificates on there for [8:24] » Oh, wait. We do. Mark McCall um [8:29] Mark McCall went to uh Fort Worth and did uh critical courthouse security [8:37] uh emergency planning courtroom and courthouse security. So, and [8:45] um need everybody say a prayer for Mark. He's in the Methodist hospital [8:51] uh having some issues. So, but uh we'll accept Mark certificate of on completion [8:59] of the critical court incidents emergency planning courtroom and [9:04] courthouse security. Um [9:08] I've got one question. We've got JP one and four report, but I didn't see two [9:14] and three in this package. Did I miss it? [9:17] Uh, have they seen it? [9:27] » I think we had discussed last time that most of them may get sent to Miss Ginger [9:32] and maybe I'm just not getting say they didn't do one. I'm just saying. [9:37] » Have you received Ginger? >> Yes. But it's their responsibility to [9:42] get it to the judge. [9:47] Thank you. All right. I make a motion that u [9:54] we accept the monthly departmental reports. [9:59] » Second. Uh [10:03] should uh reward that to accept the consent [10:07] agenda. >> Yeah. [10:10] » I made a motion. Commissioner Hopson second. All in favor? [10:15] All against. All right. [clears throat and snorts] [10:18] We'll deliberate and consider action on the following items. Item number one is [10:22] appoint Wayne Mororrow, Robert Sam, and Tommy Mullen to serve as commissioners [10:28] or ESD number two. That's Trout Creek ESD. That's uh three new commissioners [10:35] on their ESD board. Um, so [10:41] now I make a motion that we appoint Wayne Moral, Robert Samuel, and Tommy [10:46] Mullen to serve as commissioners for ESD number two. [10:54] » I second that motion. They're good to me. [10:56] » All right. Motion laid by me, second by Commissioner Benson. All in favor? [11:02] » All against. All right. Item number. >> Hey, judge, before you leave that item, [11:07] I think it's every January a number of commissioners on each comes [11:12] up. >> Yes. [11:14] » Could I I don't know. Could your office provide us with a list of the ESD [11:19] members that are coming up so we can either reappoint them or ask them if [11:23] they want to continue? I was contacted by one of the ESDs in my precinct [11:26] saying, you know, we'd like to know if they want to continue, who's going to [11:30] reach out to them? and I told him I felt like the judge's office would, but I'd [11:34] bring it up to date. >> Okay. I have spoke to some of the [11:37] members of ESC number one and and they would, you know, consider, you know, [11:44] staying on those. >> This was spec specific to number five, [11:49] ESD number five in the pocket is where the question come. [11:52] » Okay. And I I will we will get that to them. [11:58] And it probably be good if all the commissioners just had a list, you know, [12:01] every year so we we'd know, you know, just kind of who's coming up, who's not. [12:07] » Yes. Every should be have two to three that need [12:14] » and then every year that happens >> to one year, three. [12:19] » Yeah. Thank you. [12:22] » All right. Item number two, approve 2026 violence against women's Special [12:28] prosecutor project resolution which authorizes the district attorney to [12:34] continue applying for grants that supplement the salary of the assistant [12:39] district attorney. >> Have that um grant resolution. This is [12:43] the same resolution that Courtney comes with every year. It's asking for [12:49] authorization to apply for the the follow grant. Um, and this will be for [12:55] um the upcoming great year, which is August 2026 to August 2027. [13:01] Um, and this um I don't exactly know how much money it [13:07] is. Y'all probably do, but it's a it's a certain amount of money that supplements [13:10] the assistant uh prosecutor. Not my salary, but the other assistant DA. [13:17] » Okay. [13:21] » All right. and county and getting that grant since at least [13:29] » 2002. >> That's why [13:31] » when I was VA in 2003 to 2005, it was under that. [13:37] » Yes. >> I make a motion that we approve the 2026 [13:42] violence against women special prosecutor project resolution. [13:48] » Second. >> All right. Motion made by Commissioner [13:51] White. Second by Commissioner Benson. All in favor? All against [13:58] you for a second. [14:12] So shared. [14:15] All right. [14:57] » [clears throat] [15:01] » All right, we'll move to item number three. Item number three is discuss and [15:06] consider changes or amendments to the county policy that allow employees the [15:11] opportunity to transfer vacation hours to other employees if they choose to do [15:17] so. [15:23] So, okay. Um, so I I brought this up uh in a [15:29] previous meeting and and Ginger was going to do some research and met with [15:33] her and uh her recommendation uh is that we not [15:39] go this route. There's the the the big issue there is if if I had vacation [15:44] hours and apprentice made more money than me, those vacation hours would be [15:48] earned by me and if I had 10 hours and get him 10 of my hours, he would get it [15:53] at his pay. So based on our HR guidance, um I recommended we take no action on [16:00] this item, not table. It would just >> take no action. [16:05] » All right. Misty, they looked up this. [16:11] » Yeah, Misty Misty also provided some documentation to support how difficult [16:16] that would be, I guess, is the best way of saying it. [16:19] » It can be done, but it would be. [16:24] » All right. So, >> can be done also. You discussed that [16:28] last. >> Okay. [clears throat and cough] [16:30] » All right. Commissioner Pal made a motion to take no action. Second. [16:35] Commissioner White second. All in favor? >> All against. [16:41] » All right. Uh item number four is discuss and take [16:45] action to recover funds associated with the establishment of ESD6. This line [16:52] item is a followup to previous meetings where the county paid for legal services [16:56] and other items with a motion being preempted by a statement that the money [17:02] would be paid back to the county once the ESD begin collecting sales tax. And [17:07] as Commissioner Pal um now I I do have a couple members of the ESD board here. [17:14] I've got uh Charles Duckworth, he's the president. Uh Alan Collier, he's I don't [17:21] know what office you hold on the board, but you're a board member. [17:25] » Okay. U now uh they received their first check of [17:34] what was that at the end of December and it was for September, October [17:40] and possibly November. Was it September and October? [17:46] Yeah, >> they didn't start collecting until [17:49] October. >> Okay. [clears throat] [17:51] » So, that would be for the month of October [17:54] November. Best of my controller runs about a month behind [17:58] » on the collection part. >> So, the first check uh was received in [18:05] they're under contract with Allegiance. They paid 55. What is a monthly? [18:11] » 58,000 a month. 58 a month to pay for one of the ambulances. And you know [18:18] what, but I was told they don't have a problem, you know, paying back monthly [18:23] notes, but they'd like to see how much money they're they're going to bring in [18:28] with the sales tax before they start uh paying. [18:33] » And and on this agenda item, I was the one that made the motion in the past [18:37] that we collect that money once that money is available. I'm not here today [18:42] to say, you know, we want it right now, but uh certainly just keep this maybe [18:48] maybe keep a line item in here to discussion or track. Maybe not every [18:51] court meeting, but once a month look at what we've spent out originally, you [18:55] know, with lawyer fees and what have you and how we're going to recoup that for [18:58] our taxpayers when >> it doesn't buy. [19:02] » We just need a we need some kind of blaze off of it. Uh [19:08] I talked to Kate about it, our lawyer, the same lawyer that been represented [19:13] since day one. >> Yes. [19:15] » Uh and the way she explained it, the way she thought she understood, interpreted [19:21] it was once ESC6 was formed, once we was formed, then we will be responsible from [19:28] that day forward with fees. I don't have a problem with ESC paying the money back [19:36] because it's benefit the whole county uh as long as we are not struggling to pay [19:41] for our ambulance a month. Uh because we we we have two ambulances we have to pay [19:46] for and it's $58,000 a month. That's without all the other bill. So as long [19:52] as we're making that payment, I'm good with it. Uh and we'll figure out how we [19:56] can get it allotted and paid back to the county. And I'm sure the rest of the [20:00] board won't have a problem with it. Uh we have a meeting on the 20th right here [20:04] in this courtroom uh at 6 pm and uh if the agenda ain't been posted, I'm going [20:09] to go ahead and have it put on the agenda today for our meeting on the 20th [20:14] to discuss it amongst the whole board. And but we need we need some [20:19] documentation from the county from day one because this is what it was on line [20:25] item everything broke down. That way we can look at it and know what we're what [20:31] we're paying for and we want to make sure that we're strictly for this [20:34] election. But as me as president and I'm speaking as me, I don't have a problem [20:41] paying back. I really don't. But we want it broke down. We want to see it line [20:45] for line exactly what it was spent on. >> Fair enough. [20:50] » Yeah, there's no problem with that. You know, basically all it is is legal fees [20:54] from >> Yeah. It's not it's not a great amount [20:57] of money. It's just one of those things to where you know if you guys once you [21:01] get your your feet on the ground and you got a circle of money, what have you, [21:04] just recoup that money back to the taxpayers. [21:07] » No, that's fine. We're fine with that. >> Good. All right. [21:10] » It's just right now we have no idea what money for the year look like. [21:16] » Good. Well, I'll make the motion that we table this agenda item for future [21:20] reference. >> All right. [21:22] » Discussions. Second. >> All right. Motion is made by [21:25] Commissioner Pal, second by Commissioner Hson. All in favor? [21:30] » All against. All right. Item number five, discuss and [21:35] take necessary action concerning VFD radio communications. [21:41] All right. This is uh when we built the new radio tower in South County uh [21:50] basically the going digital that's kept Bergville [21:56] and I think K being fire departments from communicating [22:01] with the sheriff department you know because of the digital channels now the [22:08] frequency you gave them the frequency in October. [22:15] So I think the problem is with money [22:18] associated with programming the radios. So and I'm not sure Joles, could you [22:24] elaborate on >> Joles, can you come over here because we [22:26] got the audio won't take you up over there. There's people watching and it's [22:32] » all right. So go back to the radio start from ground zero. One's the radio. part. [22:40] I talked co about it 100 times. It ain't we switched to digital. Okay. And it [22:46] ain't just Bville and believe me. Anybody that comes north of FM 1414 on [22:52] Highway 87, don't matter if it's Dyville, Trout Creek, Bondware, Newton, [22:57] once you get north of 1414, nobody radio work. Zero. [23:02] Because dry creek had the NC fire, Newton County [23:07] fire that their repeater is in Fleetwood. Once you get to 1414, you [23:11] can't reach that repeater. You have to be able to reach Mayflower repeater. [23:16] Well, that channel is on that ML. So, it will not work north of 1414. Well, that [23:23] means anybody in this county that goes north of 1414 cannot contact who's doing [23:30] that. So that's with the exception of the sheriff's department, [23:34] » right? The digital side would work. >> What about the ambulance service? Will [23:38] they can they communicate? >> Okay. The radio's in the ambulance or [23:42] not P25. So they do not have the digital in them. All they have is their console [23:48] and Josh. So I just looked at the radios this past week. I'm there every other [23:54] day or so checking on the station, checking on everything. But them radios, [23:59] I'm waiting on the answer back from my radio guy. Can he put P25 in them? If he [24:05] cannot put P25 in them, then we're going to have to change radios uh in the [24:09] house. And it's already on my agenda for next week to discuss radios in [24:14] » currently right now. >> But currently right now, they cannot [24:16] talk to the because they're not digital capable in. [24:21] Well, about what was it about 10 it's over 10 years ago the state mandated [24:27] everybody to go digital. That's when they they pulled all the digital or they [24:32] pulled all the VHF channels from TV. Uh the military needed the bandwidth, so [24:37] they mandated everybody go digital. Then it didn't work. You know, the the [24:43] smaller counties like Newton couldn't afford all the equipment. Um, so and it [24:50] was my understanding, you know, we all had to buy dual band radios, but any any [24:54] radio sold now, uh, pretty well was dual band. And now the state mandate and any [25:01] radio you buy now has to well with grant funds has to be triband, [25:07] which has three different bandwidth in it. [25:11] » I have some new radio for Bart. They ain't even been installed because [25:17] about the time we got them with grant money is when we went to digital. So I [25:21] ain't even installed them. But they can have people 25 foot in them. But that [25:25] has nothing to do with the 10 handhelds. The handheld is your live line. If [25:30] you're in this courthouse fighting fire, you're across that street one of the [25:34] county office fighting fire. You can't run back up to that truck, get on that [25:37] radio, and call for help. You need to be able to call for help. [25:39] » Okay. So, in order to replace 10 handhelds from Bville, that's about [25:43] $45,000. And we can't afford that. I get $4,500 a [25:47] year budget for radio. >> Okay. So, the handhelds you got are VHF [25:52] only. >> Yes. They will not swap to digital [25:56] because we ain't updated handhelds in seven or eight years. So, I mean, [26:01] handhelds [clears throat] are null and void. They're paper weights. Now, the [26:06] console radios go to vehicles. I can put B25 in, but [26:11] back to everybody. I mean, I'm just trying to make sure everybody [26:15] understands it ain't just Bville and Toledo. It's anybody in this county that [26:19] goes north of 1414 cannot communicate >> with exception of the sheriff. [26:25] » Correct. And before we did the radio upgrade, we didn't have your law [26:28] enforcement didn't have radio communication throughout [clears throat] [26:30] the whole county. I mean, right here in the courthouse, you could talk wherever. [26:34] you didn't have any radio communication. So that's something that we you know [26:38] have to do. But >> well I think you know so what will fix [26:41] the problem a repeater? >> Well [26:45] I talked me and Colton talked last week down there on the fire. Uh we need an [26:52] answer from the radio guy that put this digital stuff in and ask him can he just [26:57] add a channel because the equipment's there. Well, we ought to be able to just [27:01] add a channel, a different channel and make it like Newton County from one end [27:07] of the county to the other and every fire department will be able to access [27:09] it if he can do that, which I think he can because it's difficult. But that's [27:14] going to come from the radio guy. >> Okay, [27:16] » I'll get with him. >> But that doesn't solve the handheld [27:18] problem. >> That does not solve handheld problem at [27:20] all. I think we need to do whatever we need to do to help him with the [27:24] handheld. I mean, one life is worth it all, you know, whatever it But, you [27:28] know, if we and [clears throat] I'm not asking [27:31] » for 10 new handhelds. I don't need 10 new handhelds. [27:34] » If I had four handhelds, it would work. I'm good. Everybody else can still use [27:39] their old radio, but they can only talk on the same [27:43] one person in eight people at my fire department that talk on that radio [27:47] anyway as far as contacting ESO or anybody else. And that's me. Them girls [27:52] and them other ones, they could care less about being on that radio. So, [27:55] we're not jamming up a channel. So, that's why everybody don't need a [28:01] new hand. What I'm getting at, if I had four hands, that's all I need. I think I [28:07] have one back when Odan was emergency management EPS come through with a grant [28:14] to give one. It's called a Apex 4000 when they first started the digital [28:20] stuff. I don't know if it's too old to put [clears throat] the digital in. I [28:26] think it'll work, but I'm waiting on that answer also. So, that would be one [28:30] of the four. I'd only need three more. And then that would that would put me [28:34] where I needed to be. >> I got a high com. [28:38] [laughter] [28:41] » But that's goes back to we got to figure out the channel situation. [28:46] What it But that's radio guy. I mean, he's got to give that answer. [28:50] » We had this discussion in the past. Mark was here and we had talked about having [28:56] a channel for the commissioners to speak, you know, like during a hurricane [29:01] and what have you. You don't have cell towers and s such as that, different [29:05] things. We could speak one to another. And what I understood him to say is each [29:09] commissioner would have to get their own repeater. [29:11] » Yes. And that's that's it was uh four repeaters, one in Mayfly, [29:17] one around the Burkeville area, one in Lakewood, and then one in on the Dville. [29:25] So four repeaters. U but it wasn't [29:30] it wasn't digital. It was still the analog system. Well, what I what I [29:36] recall the conversation being was the commissioner what we have dead areas [29:41] just like what Mr. Dougworth was talking about. you know, when when we send [29:45] someone off on a maintainer, if they have a health emergency, you know, it [29:50] literally if they don't come back at the end of the day, that's when you'd find [29:52] out, right? Because somebody the rule where I was going with that is there's [29:57] probably going to be some expense that the commissioners want to incur to get [30:00] our get us a radio channel or at least I do and maybe if we package all of this [30:05] up with the repeaters that we want or need. [30:09] » Yes. And then the repeaters that are needed to get that radio commun may it [30:13] may reduce the overall cost just from the standpoint of they're out there [30:18] putting up two repeaters and >> well I think it got a price on a [30:22] countywide fire channel and it was right a little over $50,000 [30:28] and you know uh that way every fire department would [30:34] communicate with one another you know and breaking down the cost [30:39] between, you know, the fire departments. I don't remember it was eight$8 $9,000 [30:46] per fire department. And some of them didn't didn't want to pay for the, you [30:52] know, they're like, we have our own channel, so why why should we pay for [30:56] another one? So, but you take like Bondware, [31:02] um, Burkeville don't get a lot of tax dollars. Clea Ben U Bon gets none. You [31:08] know, they're basically on their own out there. And you got uh Devil's Pocket and [31:15] you have Trout Creek and uh ESD number one that it does pretty good with their [31:20] their tax base. So, uh it's other fire departments that that are at the low end [31:27] of their tax base and struggle to keep the equipment. you know, thinking about [31:34] Bard Bell and the this problem you got, you know, ESD1 where I my precinct, they [31:41] get plenty of money. They got a great system. They got great equipment. They [31:44] do a great job. Uh just like the folks in Burkeville. But the people that live [31:48] in precinct 4, they frequent Burkeville. They got places at the lake, they fish [31:53] at the lake, they hunt in Bville. So, it's not a Bville issue. It's a [31:57] countywide issue. So, how do we figure out what we can do as a county? You [32:02] know, it could go back if if the court says we're not going to pay for this, [32:06] ESD should we can go back and say, "Hey, we'll get it done and then figure out [32:11] how we get paid back over the next 10 years or something like that. If that [32:15] helps the court, we need to get these repeaters up." As I understand it, [32:18] that's the issue is I didn't know about the handhelds, but I understand that [32:23] there needs to be some repeaters installed to be able to get that radio [32:28] communication to you guys. >> Well, and [32:32] it goes back to the digital guy because I don't know what equipment they [32:36] installed. And if that equipment's capable of adding more channels, you [32:40] won't have to have repeaters and stuff. he can just go in there simply build a [32:44] program and come add it to the to the repeaters to every one of them and then [32:49] it'd be up and running if he can do that. But far as I know, you can do that [32:54] in digital. You can just build another software and add it [clears throat] to [32:58] it and then it'll be running. >> Well, judge with with being out, [33:04] » could we nominate either yourself or some member of the court to work with? I [33:09] I will get with the radio people, but I I think we would have to apply for [33:13] another radio license to do that with the digital sign. [33:18] » Well, the I'm not a radio guy for the record. I don't know the nuts and bolts [33:21] that goes into it, but I believe there may have been a spare repeater that come [33:27] off of maybe the south tower and I think they were going to rebuild it and keep [33:31] it as a spare for the county, but it belongs to the county. You know, maybe [33:35] an option or an avenue to look at. I get with Tracy and see if [33:38] » they they did remove >> be compatible to that. [33:42] » We just need somebody to own it and get us to the finish line where we get a [33:46] like you said, you know, one life. What's that worth? You know, some [33:51] » Well, I'll get with the radio people since Mark's out and see what it's going [33:56] to take to get a channel for where everybody can communicate [34:03] and then bring it before court next meeting. And when you do that, judge, if [34:07] you would throw in there, if it helps reduce the cost, you know, the [34:11] commissioners are thinking about doing those things, just throw in all the [34:14] options. And at least for me, I mean, I I need a radio comm I need radio [34:20] communication from vehicle to vehicle in precinct 4 cuz 311, 3112, 3116, [34:28] it's just dead areas and all right. And I've got a spare radio to [34:34] help you. [34:42] » There you go. [laughter] [34:49] » All right. [34:54] So, I'll make a motion that uh on uh I'll take action uh contacting the [35:04] radio providers uh to [35:09] uh basically get a price on what it's going to cost us the uh to provide radio [35:16] communications countywide for the VFDs and commissioners. [35:22] I second the motion, >> I guess. I mean, do we need to make a [35:27] motion on it or you just going to do it? >> Well, I'm see what you do. We make a [35:32] motion or does he just don't [35:35] » Okay. Well, it said >> you're just going to do it. Take action. [35:38] I'm I'm gonna go ahead and do it. I'm gonna get with [35:43] » Okay. Well, we don't need a motion on that. [35:47] All right. Uh, judge. You're welcome. Uh item number six, take action to replace [35:54] the obsolete printer copier in the Newton County Tax Office in Newton and [35:59] Blakewood. >> Now there's two uh obsolete printers, [36:03] one in the Bloodwood office uh tax office and one in the Newton tax office [36:07] that we need to get replaced. Um the the difference on the units will be [36:14] uh well the cost of units will be $461 per month. [36:20] talking to Tracy. They both need to be changed out [36:24] their contract. >> Okay. [36:28] » Contract. [36:31] » They're 46 per >> $461 [36:35] per >> print. [36:37] » Now that that contract, they replace the ink cartridge. [36:41] » They do all the >> Yeah, they like a lot of money, but when [36:44] you consider the the maintenance and the replacement of the cartridges, it's [36:47] really not They just charge us per copy made, [36:52] right? >> Any kind extra. We get so many copies [36:56] and then >> Okay. [37:02] All right. Uh I'll make a motion with approved to [37:07] replace obsolete prayer property in Newton County Tax Office [37:12] uh and in Newton and Blewood. Second. [37:18] All right. Motion made by me, second by Commissioner Benson. All in favor? [37:23] » All against. All right. Item number seven, discussion [37:28] of appropriate approve the purchase of the following patrol vehicles via lease [37:34] agreements for the sheriff's office fleet. One is a 2024 Chevrolet Tahoe. Uh [37:39] purchase price plus outfitting is $66,7942. [37:46] A 2025 Tahoe 4x4 U purchase class plus outfitting is $81,478 [37:55] and 98. >> Morning. Uh so this past year we do all [38:00] our vehicles on lease agreements. This past year we uh we paid off two vehicle [38:04] uh looking to ask y'all's approval for two new Taho. U lease agreement. The [38:10] first payments are not due until 207. higher um monthly note will go up, I'm [38:17] sorry, yearly note will go up approximately $10,000 between the two [38:20] vehicles. Uh if you notice the price on these things are two specialty vehicles. [38:24] One is going to be a Tahoe for our drone uh that we've had great success with. Um [38:30] [clears throat] so several different law enforcement agencies in the area, they [38:33] have a you know there's a TV stand mounted in the back. So in the event [38:37] we're on any situation, we can see everything in live time on a TV screen [38:41] versus a small little screen. uh just used it um used it on the dog fighting [38:47] operation um fire department the other day. So I [38:53] think that'll be a courseier on the second one. Um Friday our new K9 unit [38:59] starts. Um, we have bought a 4-year-old German Shepherd from Jasper County along [39:04] with its handlers coming over. Um, K9 rhino with his handler Chad Answorth. [39:09] He's u, you know, already made criminal apprehension. He's uh, nationally [39:14] certified for narcotics, narcotic detection, handler protection, criminal [39:19] uh, tracking and apprehension. So, looking forward to that. That's going to [39:22] be a force multiplier for public safety in the county. And with the uh you know [39:27] the Tahoe, it's going to have to be fully rigged for a K9 unit, things like [39:31] that. That's why the price is substantially higher. [39:34] » I think Chad's going to be a great addition to you. [39:37] » Yeah. >> Been handling a dog since 1996. [39:41] And uh that's one of my things. If you're going to do it, do it right. And [39:45] like I said, the dog's got a track record. You know, he brought it by the [39:49] office the other day and all the employees were impressed about how good [39:51] it listened and his, you know, his abilities, things like that. So [39:56] having him on board, >> one thing to not telling y'all, he hired [39:59] him away from over in [laughter] [40:07] the drone. You know, I seen something on Facebook the other day. I think you guys [40:11] use that river bike, right? Yes, sir. That's to me that's pretty impressive. [40:16] You know, you don't put somebody in a boat. You you got the ability to go down [40:19] the river and get places that you would present. I mean, right now, if you go [40:22] down the river, you better have a tunnel hole because you can't going to drag [40:26] bottom. So, I'm pretty impressed with that drone. [40:28] » You know, another thing, last uh Friday or couple weeks ago, a guy calls me. He [40:33] says, "I've got a horse missile." He said, "I see y'all have a drone [40:37] department. The drone, can you all bring it out here?" You know, and and that's, [40:40] you know, training for for Captain Smith and and the drone, you know, anytime [40:45] you're you're flying it, you familiarize yourself, become more familiar with it. [40:48] Anyway, long story short, we located this horse. So small things, but it's a [40:52] way for us to give back to community, you know, [40:56] as >> So the money [clears throat] you're [40:58] you're not going to pay this money or start paying until 2027. Is that right? [41:02] » Yes. [41:05] » Oh, >> per,000. [41:14] So you're saying 20,000 more? >> 20,000 more between the two. [41:19] » Really? >> Yes. [41:24] 125 I believe >> 125 is what we were paying. One of them [41:28] is going to go up to like 15,000. Another one can go up to about 19. [41:39] » What is the light on a dog? >> Uh so he just retired his other dog at [41:45] 10 years nine almost 10 years old. So he would have another [41:51] five years hopefully four to five and every thing obviously depends on [41:55] injuries or you know I mean but a perfect one would be four to five more [42:00] years [clears throat] just curious [42:04] what we pay what you pay for that $3200 >> you to make that back the first drug [42:11] » that's got money >> but like I said the dogs got a track [42:16] record he if y'all seen a couple of weeks ago know there was some bad guys [42:19] on vehicle chase or something ended up in [42:23] Jasper County. He was able to apprehend one of those. So [42:26] » he actually come out with a dog, right? >> Yes. [42:30] » Dad brings a local one >> in Jasper County. [42:35] » So So he lives in Evade. >> He does. [42:37] » You know that's that's a win for the Newton County because my precinct is [42:42] almost in Evade. That G old champion precinct, it's right there. you know, [42:46] he's literally 10 minutes from that precinct, whereas [42:51] you're 60 minutes from it here and you're 25 minutes from the annex built. [42:56] So, that's a win. Well, I'm going to go ahead and make the [43:01] motion that we approve the purchase of the patrol vehicles listed [43:07] um in this this commissioner's court for the lease agreement. [43:13] And uh then we're going to go through Investor that was formerly first [43:17] national bank that we passed. So it's approved. [43:20] » I'm not going to read the entire line there, but I'm going to make I'm going [43:23] to make a motion that we approve line item seven as it's listed. [43:31] » Y. [43:38] » All right. Motion made by Commissioner Pal. I'll second. [43:42] » Second by Commissioner Hopson. All in favor? [43:45] » All against. All right. Open up on item number eight. [43:50] Discuss and if appropriate, approve Newton County Sheriff's Office to [43:54] establish a credit account with Fuel Man for purchasing fleet fuel. Fuel fuel man [44:00] does not require a contract to be signed. Uh the fuelman public sector [44:05] cards will be invoice monthly. So currently we have a KICO uh fleet. [44:11] You can only get gas at Kico and you know it's not bad if you're working up [44:16] here because they've got D's one stop there in Trout Creek and we have a Dober [44:20] account as well. But for the guys down south, they've got to travel into Orange [44:25] County to buy fuel and uh don't like that, you know, stay in their zone where [44:31] they're assigned and uh lot of gas several of the gas stations down there [44:36] fuel man, you know, to do the fuel man. So, we'd like to transition away from [44:40] the Kico and go to fuel man. Um, we've had deputies that are going to schools [44:45] and going here and there and even patrolling the county that have to pay [44:49] out of their own pocket to put gas in their patrol vehicle because you can [44:53] only go to a conco and that pump may be messed up or it may not take the part at [44:58] midnight or whatever the case may be. So I would like think it'd be more [45:00] efficient user friendly for us to go with a fuel man rather than strictly [45:06] kind of code >> right now like page last week about [45:10] transporting some inmates. >> Yes. [45:13] » Yeah. Yeah. Same thing on inmate transport. If you go to South Texas or [45:17] West Texas or North Texas, wherever it may be, we have to find a conico and [45:21] sometimes you're not able to find a conico or it may be a 100 miles away or [45:25] out of your way. We ran into that. They've had to go 20 or 30 miles out of [45:29] their way just to go to Kico to get fuel. [45:33] » Do we have a contract with Kico or >> um we have a contract? [45:40] » Yeah, I don't know that we do. >> We're just going to add another contract [45:44] to fuel. >> We don't need them. [45:46] » We don't need them. >> Yeah, we don't. [45:48] » Oh, don't need it. Okay. >> I would like to get away from [45:53] » I'd like to get away from cars leaving Newton County. get fuel, [45:57] » right? But the SD6 would too. >> Yeah. Sales tax. [46:02] » Well, I don't think I don't think there's any sales tax. [46:06] You got state tax and the federal tax, but I don't think there's no local on [46:11] people. >> And another thing based on the gallons [46:13] that we have used in the past, I think we get an 8% eight 8 cent discount per [46:19] gallon. So, and also um captain's been handling it, [46:25] but they come with a roadside service as one of the deputies are on a [46:30] transport out in the middle of nowhere. They would call roadside service [46:32] throughout the system. [46:36] [clears throat] I'll make a motion with approve county insurance office [46:41] manual. Second. All right. Motion made by [46:46] Commissioner Hopton, second by Commissioner White. Uh [46:50] all in favor all against [46:54] all right item number nine discuss and of appropriate approve an interlocal [46:59] cooperation agreement between Newton County Sheriff's Office and Jasper [47:03] County Sheriff's Office concerning the incarceration of Jasper County inmates [47:08] in Newton County Jail. That's a new one. >> Yeah. [laughter] Yeah. So back uh back [47:14] in February, March, we ran into an issue that I was over how capacity on males [47:20] here in the county. Jasper uh couldn't take them because they were they needed [47:25] a place for three females to go and and if we could find housing for the three [47:29] females, they can open up another wing and take our males. Um long story short, [47:34] we brought the three females over here, realized we needed a contract, uh but [47:40] you know, approved commissioner's court and we're not going to house any [47:43] prisoners for them. don't have the space but you know instances like that they [47:48] can take our males we take their females and you know if they need to open up [47:52] another wing or whatever for that recently they arrested their one of [47:57] their correct officers family members was arrested so they asked to house him [48:02] over here uh due to the conflict and obviously they we charge them the same [48:07] thing so it's a wash on our price per day um on that like I said we don't have [48:13] the room to house a lot, but on the case by case scenario that we do, we want to [48:17] have a contract, make sure we're covered. [48:20] » All right. Well, I make that motion that we approve [48:24] the inter corporation agreement between Newton [48:28] County Sheriff and the Jasper County Sheriff's Office [48:33] Corporation of J County inmates and the New County Jail. [48:38] I second. >> All right. Motion made by Commissioner [48:41] White, second by Commissioner Benson. All in favor? [48:45] » All against. All right. Item number 10, uh, authorize [48:53] the execution of letter of agreement between Newton County and Newton County [48:56] Emergency Services District number six. Now, this letter is uh county is able to [49:05] apply for a $350,000 grant to purchase SNAM. That's all we can do with it is [49:10] purchase an ambulance and donate it to a qualified EMS provider. So, as far as [49:16] the letter of execution, the letter states that, you know, Newton [49:21] County will donate the ambulance to ESD number six. [49:25] They can't uh sell it, give it away. They can't do anything [49:31] with it long as it's useful life and it can only be used for benefit of Newton [49:38] County Emergency Services. Oh, and the letter is in the in our packet. U [49:44] [clears throat] if anybody wants to read it, [49:51] we find it out before the court. [49:58] Yeah, [50:02] you got that letter. You're better at looking through [50:06] paperwork today. All right. All right. This is a letter of agreement and we did [50:12] send it to Misty and she has agreed with it. Uh letter of agreement between [50:18] Newton County, Texas and Newton County Emergency Services District number six. [50:24] This letter of agreement is entered into between Newton County, Texas and Newton [50:29] County Emergency Services District number six for the purpose of [50:33] establishing terms and conditions for the purpose transfer and use of one [50:39] ambulance funded through grant assistance. Uh purpose Newton County [50:43] will use grant funds to purchase one ambulance to support emergency medical [50:48] services within Newton County. Upon purchase, the county will transfer the [50:52] ambulance to SD6 for operational use serving the residents of Newton County. [50:58] Upon acquisition, Newton County shall transfer the ambulance to SD6 at no [51:03] cost. ESD6 agrees to accept the ambulance [51:07] subject to the conditions outlined in this agreement. Use of the ambulance. [51:12] The ambulance shall not shall be used exclusively for emergency medical [51:16] services that benefit Newton County and its residents. PSD six agrees that the [51:22] ambulance will not be used for any purposes that does not directly support [51:27] Newton County emergency response and public safety operations. Restrictions [51:33] on sale of transfer. The ambulance [clears throat] may not be sold, [51:36] donated, or otherwise transferred to any other entity without prior written [51:41] consent of New County. However, ESC6 may trade the ambulance toward purchase of a [51:47] newer replacement unit once the ambulance reaches the end of its useful [51:52] service life or becomes operationally obsolete provided that the replacement [51:58] ambulance will be continued to use serve Newton County and the trade in [52:03] replacement supports continue to medical services for Newton County residents and [52:08] it goes to useful life. Um they ESC6 agrees to maintain and operate the [52:15] ambulance in accordance with all applicable laws, regulations [52:20] uh maintenance and liability. ESC6 shall responsible for all costs associated [52:25] with operation, maintenance, insurance and repair of the ambulances and they [52:29] assume all liability for use, operates and maintenance upon transfer from [52:34] Newton County. Uh compliance with grant requirements. [52:38] Both parties agree that the ambulance shall be used in compliance with all [52:41] applicable grant requirements and funding conditions under which the [52:45] ambulance was purchased. Uh terms of agreement, this agreement shall remain [52:51] in effect for the duration of duration of the ambulance useful life including [52:56] any replacement unit obtained through trade of the original ambulance. um and [53:02] entire agreement. This agreement represents the entire understanding [53:05] between Newton County and ESD6 concerning the ambulance and supersedes [53:11] any prior discussions or agreements related to this matter and it's got uh [53:17] signature for myself and emergency service district number six. [53:24] So basically that protects ESC6 and the [53:28] county once the ambulance is purchased and delivered to them. [53:34] So anybody have any questions or concern [53:41] with the letter or the agreement? [53:49] I move that we authorize execution of the resolation resolution between Newton [53:53] County and Texas Department of Transportation. That's the wrong one. I [53:59] move that we authorize the execution of letter of agreement between Newton [54:02] County and Newton County Emergency Service District number six. [54:06] » All right. Second. Motion made by Commissioner Pal, second by [54:09] Commissioner. All in favor? >> All against. [54:14] All right. >> All right. All right, we're skipping [54:18] number 11. [54:21] All right, item number four. >> Yeah. [54:25] » Yeah. So, applying for a grant, um I don't think [54:30] we're going to be able to get it. Maybe since the 2020 not complete, so many [54:35] table that table. [54:38] » Let me know when you're ready to bring back. Let me know when you're ready to [54:42] bring it back. >> Yes. Yes, I Thank you. We'll bring it [54:45] back as soon as the 2023 audit is completed. [54:49] » Do we need to go ahead and table it? >> Yeah. If it'll come back. [54:54] » Yeah. Then somebody take action. [54:58] » Yeah. I'm going to Yes. Um I move that we table [55:04] the authorization of execution between New County, Texas [55:10] Transportation. Second. [55:13] » All right. Motion made by Mish Foul, second by Commissioner White. All in [55:17] favor? All against. [55:21] All right. Uh item number 12 is approve contract between Newton County and Clear [55:27] Gov or budgeting software. This is a new budget software. U we actually tabled it [55:36] three or four months ago. Wanted to make sure that it was compatible with uh net [55:41] data. uh uh demonstrations and stuff they they have shown that it works with [55:48] that data and I would like to proceed uh and go ahead and get the software. [55:58] » Just want to let the court know that I have not been um demonstrated so that I [56:03] I mean I have no I don't know it's going to work. I did reach out to Orange [56:07] County that they do use it and they said that it has not worked for them and [56:12] they're actually not using it's just been a waste of money. So that's all I [56:16] know is that I did reach out their but I have not been any demonstration [56:24] that [56:28] they have demonstrated that it did work with that data and I feel confident [56:32] it'll work. I think it'll work. They demonstrated [56:38] here judge with our system. Yes. Uh they did well not not in with [56:46] our system but they demonstrated with other systems [56:50] connected in net data. [57:01] Make a motion to approve contract for new car budget. [57:08] All right. Motion made by Hopson. How much is it? Good. [57:22] And then included in this, they come in with a team and train everybody on how [57:30] to use it. [57:36] So it's 13,000 annually. Is there any link? There's a one also a [57:43] one time service set up B4,250. >> That's where they come in and integrate [57:48] it with the Newton County software and has a [57:56] team come in to train how to use them. >> This is going to help with the budget [58:03] time. >> Yes. [58:07] basically what it what it is. We'll be able to send each individual department [58:12] their budget. All right? And it's filled out online and sent back, you know, and [58:18] then uh each individual employee is listed in [58:22] there. Uh when say you want to give a raise, uh you put in percentage raise, [58:30] it automatically calculates, you know, or you can even do it for the [58:34] whole county. It automatically calculates their raise and their [58:40] benefits uh without having to sit there and go each individual line item and do [58:46] it. [58:53] And there's no 20-year contract. It's >> No, it's it's like a yearly. It's a [58:59] yearly. Now it says the customer on an annual basis but residing evidence [59:07] is at least 60 days. So you're not lost on it. It also says that within the [59:14] first 30 days of service you'll have an option to terminate the service and get [59:20] a full refund. >> Don't sound like we can go wrong. I I [59:24] hear the auditor's concerns down there and I respect them, but sounds like [59:28] you're going to get 30 days to to approve it here. So, I'll second [59:32] Commissioner Hopson's motion. Approve the [59:35] » All right. >> Purchase and lease agreement. [59:37] » Motion made by Commissioner Hopson, second by Commissioner Pal. All in [59:41] favor? >> All against. [59:45] All right. Uh item number 13 is receive presentation from Newton County Tax [59:52] Assessor Collector's Office. It's got my name on it, but [laughter] [59:59] good morning. I have printed off last three months. I know you have [1:00:05] December in your packet, but this from October to present. [1:00:11] I was contacted by Commissioner Pal and the uh DA's office and auto office to [1:00:17] kind of go over what has been um collected and taken care of during the [1:00:24] decided appointment. Um [1:00:30] October quite a challenge I won't make of that but we got it taken care [1:00:37] of. Start off by reading the tax collections for October. [1:00:42] The total county collections 101,416.34 [1:00:50] portion of that went to Newton County was $74,415.76. [1:00:56] The amount of refunds that were due and paid out during October was $2,23953. [1:01:06] Now, we had a change in our procedures during this time how we come did our [1:01:13] refunds um in the past. They all came out of one [1:01:19] entity. So, now we do send a refund application to each entity taxpayer that [1:01:26] is getting that refund or the mortgage company. the entities are receiving a [1:01:32] refund application to approve so that it all just come out of GO1Ds [1:01:39] receive theirs receives theirs [1:01:43] um and it's saying that I do have contact information [1:01:50] had great communications withd I am still in need of ESD1 [1:01:59] preceding for I need a contact to get their approval on some funds. [1:02:06] um in November our tax collection. >> Hey, before you go on. [1:02:10] » Yes. >> Just so you're telling the court that in [1:02:13] the past all of the refunds come out of the general fund. [1:02:19] » So that means that the entities weren't [1:02:24] paying their part of refunds to individuals in this county. [1:02:29] uh from my understanding and when I go back and I pull those refunds [1:02:34] um under previous [1:02:38] leadership uh those were all [1:02:42] unmarked in [1:02:47] so like I said when we started now that is October's as well I did research and [1:02:53] look into the refunds there it does look like it started in October [1:02:58] that we started reaching out to each entity [1:03:01] » when it was addressed whenever that was [1:03:06] » and I've worked with Sherry um to make sure each one of these have been [1:03:14] corrected and they are done >> moving forward [1:03:19] on the past have not been >> um from [1:03:24] September backward I can't really tell you the total I [clears throat] know [1:03:29] from just my doing my job that go was the one that was [1:03:35] paying out all [1:03:39] from what I've seen it goes and I just went back to 2013 [1:03:47] 2013 and that's as far as I went back. It all [1:03:52] depends on how the overage is credited if that makes any [1:04:00] I understand what I we discovered it was all being credited [1:04:05] whenever it was paid it was being paid through all the interest when it was [1:04:10] paid back it was only being paid out now if it's a supplemental refund it was [1:04:17] done correctly because we don't go in and we don't alter any of So that is not [1:04:22] what the appraisal is talking. So that's another thing. [1:04:30] » I don't offer anything. >> So this is something that the attorney's [1:04:34] office looking into. We'll get more information on it. [1:04:38] » Thank you. November tax collections total [1:04:42] collections was $634,93158. [1:04:48] The new county portion 527,993.94 [1:04:55] refunds in November were $39,428. Now that amount is down due to the [1:05:03] amount of supplements that were left behind for me to catch up. Um, I had [1:05:10] over 20 supplements that I needed to process and [1:05:17] so there were no refunds processed during that time except for [1:05:25] which was the next overpayment. And then you have any questions before I [1:05:30] read our December [1:05:44] I'm trying. So for December 2025, [1:05:51] our total county collections is $2,55,529.13. [1:05:59] This does not include our ESD. that goes to the treasur. [1:06:04] Miss Ginger takes the money and distributes them accordingly [1:06:10] um into the general fund road. I will start at the top. It says grand [1:06:17] total of curs and delinquent m taxes including all attorney fees was [1:06:22] 2,66,253. [1:06:29] And like I said, total count total count collections, it's $2,5529. [1:06:37] We did get cottonwood in >> and I know there I'm hoping it would [1:06:42] come out at December distributions, but unfortunately that [1:06:47] will come out, [1:06:53] » which is fine. I mean, it's all going to the same place just a little bit later [1:06:57] getting there. So that that check from Cockwood, how much of that $6 million [1:07:01] check belongs to the county? [1:07:06] » That' be in next month's report. [1:07:11] » Do know that it was a little higher than last year. Last year I believe they paid [1:07:15] in 5 million. This year was six million. [1:07:25] » Thank you very much. And yeah, that was it. [1:07:33] All right. Item number 14, budget amendments. Do we have any budget shar? [1:07:39] » All right. We'll skip that and go to item number 15, which is payment of the [1:07:43] bill. [1:07:48] plan 467,22.36 [1:07:53] district county state fund $454 $4548 [1:07:58] Roenbridge general $39 Roenbridge precinct one $4939 [1:08:05] Roenbridge precinct 2 $722.15 Roenbridge precinct 3 $440.92 [1:08:14] Roenbridge precinct 4 $769 $943 the AW grant $78 commission special [1:08:22] precinct one $34520 mission special precinct 26 $65 and [1:08:28] $81742 [1:08:31] commission special precinct 3 $5,2835 [1:08:36] commission special precinct 4 $64580 recordation $287.72 [1:08:46] solid laces $4,696.98 [1:08:51] voter registration $87.84 lawn library $219 [1:08:58] county and library $5,664.91 [1:09:02] historical operating $46.81 81 grants $167,3176 [1:09:12] technology fund $263.36 our total all funds $661,874.38 [1:09:24] » like we talked about at the beginning of the meeting that 167 for grants is [1:09:27] really not a bill it's reimbursement >> and then we've had their appraisal [1:09:34] school district's first order [1:09:38] » and also on the general fund I wanted to also address that out of year 2025 we [1:09:44] paid 170,720 $2569 [1:09:50] and out of 2026 funds $296,5167 [1:09:57] where the $446,242 [1:10:01] came from that separated 25s and 26 [1:10:11] » you know u what the roll over >> I don't because we have got remaining [1:10:16] bills from >> uh in road bridge [1:10:21] » u I think I gave that to you the other day it was like 300 something thousand I [1:10:25] think I gave that to you as long as there's no more pills that come out and [1:10:29] throw the bridge down >> you you did quote that that figure but [1:10:33] it It's been about a week or two ago. So I didn't know [1:10:37] there was $39 that came out of that here the bill page. So like I said the other [1:10:43] I don't know until we get right now there's 228,274 [1:10:49] out of just the general fund but I don't know if there bills outstanding in 25 [1:10:53] that we have received. That's what the purchasing [1:10:58] system. >> Yes, that's that would help with that. [1:11:01] Yeah, I noticed you get to the end of the year, you see the commissioner quit [1:11:04] spending money trying to at least for me trying to figure out where I'm gonna end [1:11:09] up, you know, that PO system help. >> Okay. [1:11:13] » So that 300,000 that figure, could you send that figure when it's finalized to [1:11:17] make roll back around for uh for budget next [1:11:22] year? Definitely. [1:11:26] » First we pay an announcement report. Anyway, we're [1:11:31] all second. >> All right. We got a motion to pay the [1:11:35] bills from Commissioner Benson. Second by Commissioner Hopson.
