Um, you [clears throat] have [2:27] the information in your packet um in front of you. Uh, we are basically [2:32] coming up well, we are coming up to the end of the fiscal year. Uh so once we go [2:37] into uh our next fiscal year which uh the current year ends September 30th, [2:42] the new year begins fiscal year begins October one, you'll still see um uh some [2:49] data from the last fiscal year because our data trends a bit behind. Um [2:54] everything is trending normally. The the one item though I will will call out um [2:59] something we've discussed about or discussed in the past is you can see um [3:04] uh under um [clears throat] uh uh your expenses um professional [3:11] services we are coming up on the limit of that um we are going to have some uh [3:16] we may have another invoice or two um for the end of the fiscal year um and [3:22] depending I don't expect it to be a significant amount account. Um, but it [3:27] may require me to transfer um between line items within the budget uh to cover [3:32] it. But if it if if it does require um uh um a few extra or a few additional [3:39] dollars, I don't expect it to be a significant amount of activity dollars [3:43] based on the activities at the moment. So, [4:39] we'll move on to agenda item six, which is review and discuss the Oakpoint [4:45] Income Development Corporation business plan goals and strategies. [4:50] » Sure. When we last talked about this, um, uh, you all had some questions about [4:55] sort of how we were keeping tabs or measuring certain items. So, McKenzie um [5:02] has gone back and um added the wheel into that. We h we will um call out or [5:09] go through some highlights of some specific items. Happy to answer [5:12] questions on any of the items. Um I know that this is an important uh topic for [5:17] you for the EDC. We will continue to provide updates. We're going to start. [5:22] I'll let McKenzie kind of share some of the work that she's done, the [5:26] conversations that she's had, and then we'll happily answer questions. [5:31] » Sorry. >> No worries. [5:33] » Good evening everybody. Um, so basically our goals are going to start [5:39] on page 24 of the business plan packet. I know it's kind of large. Um, and so we [5:44] have a lot of things that are currently in process with a lot of the commercial [5:47] development that's happening within the city right now. So, we've gone in and [5:50] revised um some of essentially what we're looking at on the metric KPI side. [5:56] And so, we've made sure that we're including a lot more um in progress [6:00] aspects of that within those measures. Some of the other measures um that [6:05] Councilman Wiler or I guess director Wiler in this aspect and I spoke about [6:10] um are pertaining to goal two with those really specific u metrics as a number of [6:16] developer agreements per month as well as number of conferences attended per [6:21] year um number of site selector events attended per year. And so really what [6:25] we're going to do um is work um as city staff to look at if those metrics are [6:30] going to be really reasonable for us to report on. Um we know that we are having [6:35] conversations with developers. However, how many times those are happening per [6:39] month or versus how many times those happening per quarter? What is kind of [6:43] the difference? And is that metric expansion going to be more feasible for [6:47] us in the long term when we're continuing to have all of these [6:50] developments happen? Um, some of the other goals that Councilman Director [6:55] Wiler and I talked about specifically pertain to the EDC bylaws. That's going [7:00] to be kind of a larger project that we're undertaking with the business plan [7:03] just because they haven't been revised since about 2014. Um, so it's going to [7:07] be a lot of revision, a lot of combing through happening with that here at city [7:11] hall. Um, with some staff members. I will be emailing you guys later on [7:15] tomorrow kind of a copy of the EDC bylaws for you guys to go through. Feel [7:20] free to make comments on them. and shoot them back over to me with any kind of [7:23] edits that you guys have. I definitely want you guys to have as much input and [7:27] say into the modernization of that as possible. On our end, what I'm going to [7:31] be doing is looking at a couple of other EDC corporations in the area and kind of [7:36] the bylaws that they've adopted. Our limit time frame wise is going to be [7:40] probably within the past five years on that, even probably going to three years [7:44] if I can find any um to really see kind of what other EDCs are focusing on in [7:49] the area. And then we're also going to be looking at some other cities that are [7:53] similar to Oak Point and what we can offer and provide. Um, so that is going [7:57] to be kind of our next largest step. Um, out of all of these, I do think it's [8:01] probably the largest project that we're going to be undertaking. And then [8:05] another one that we can discuss now or do you want to discuss later? Um, so [8:10] another kind of aspect of the business plan is these EDC binders that would be [8:15] available to you guys to have here and possibly um use just kind of personally [8:20] to categorize things, organize things, make sure things are put together. I did [8:24] want to get some input on you guys. Um, and that can be something I include in [8:28] that email sending out with the EDC bylaws on what you think you would want [8:32] as an EDC director member to be included in that. Along with that, I'm also going [8:37] to be doing some of the same exact research that I talked about before and [8:40] looking at other EDC's, what they want included. Um, right now, kind of our [8:46] basis of what we're going to be putting in there is that we have some material [8:50] related to like commercial development. Um, it's a little bit dated. It's from [8:54] 2026 of this I mean January 2026. Um, and so we are looking at seeing if we [9:00] can work with anybody to modernize that, update that a little bit before we start [9:04] including that. Um, other than that, we have our code of conduct that we updated [9:09] recently that we're going to be including in that. We also have all of [9:12] our boards and commissions handbook stuff that we're going to be including [9:15] in that as well. Um, other than that, I don't think we really [9:20] have anything else. So, if you guys have any kind of ideas or any kind of inputs [9:25] that you want included in that, um, feel free to let me know. Obviously, we're [9:29] going to be including some agendas in there. That way, you guys can just kind [9:32] of have it all in one place. we have a lot of um goals and metrics around [9:37] marketing materials and brand development. So when we start kind of [9:40] dipping our toes in the water into that, you'll find that material available [9:44] within the binder as well. [10:12] » Keeping trend I mean is a five minute conversation the same as a 30 minute [10:17] discussion? >> Yes. And so there's where quantifying [10:21] those things get to be tough. >> Exactly. And I think that's another [10:24] deeper discussion that Noah and I need to have because he's really the one [10:27] that's having those conversations. I'm not calling me up and like, "Hey, [10:30] Mackenzie, I want to talk to you. Put mark in this." [10:33] » Yeah. Um, and so that's another discussion that we do have to have [10:36] together as staff and like what we really want to consider a conversation. [10:41] Um, another thing that Dragon did talk about is kind of expanding the [10:46] conferences and kind of like combing the internet on some conferences for EDC [10:50] stuff that would be available to you guys. I think are great. And we do [10:54] qualify for some scholarships through TML, which is the Texas Mun School [10:57] League if you're unfamiliar with that. That would provide for um members to be [11:02] able to get those paid for by TML. So, I'm going to be looking into some of [11:06] those and some other conferences. Um so that way we can just expand out our [11:10] education as much as possible. >> And just going back to to the [11:14] developers, right? I mean, you know, I think part of that conversation is do [11:20] you care that I had three conversations or 23 conversations or do you care that [11:24] I'm having conversations, >> right? Right. [12:54] » And I think my staff can attest um amount of time I spend on the phone with [12:58] how much they're trying to get me for other things. He also walks [laughter] [13:00] around while he does it. So, it's just like a game of where's Noah? [13:04] » You need a tracker. You haven't put an Apple tracker on yet. [13:07] » I haven't convinced him of it yet. >> Right. I know. I try to get us to do [13:13] like a city staff like walking thing for one month and I was like, no one would [13:18] blow us out of the water. [laughter] >> Okay. Thank you. So somewhere in the past we have talked [13:27] several times the EDC in in some of these joint meetings that we've had [13:33] we've talked about uh sorry turn my hearing aids off. [13:42] um about how we're going to set ourselves [13:47] apart from looking like 380 and Little M with all the different [13:56] building architectural elements if there's any way we can try to bring that [14:02] into some consistency. And now that I see item five coming up [14:10] um on the uh development report, [14:18] you know what I what I would like to see [14:24] um is some kind of architectural consistency because I I know one of our [14:30] consultants brought out color palettes and kind of building material. samples [14:36] and tried to in institute that into the overlay district, you know, if we [14:41] possibly could. But if if we have any leverage [14:47] on any of these developers to help us create some uniformity in [14:54] architectural elements so that when people drive down 720 they get the feel [15:01] that they're driving through a downtown area of some sort. They're some [15:06] consistency with buildings. So >> I saw that, you know, it it seems like [15:12] that should be somewhere in these in these goals and it may be, but I didn't [15:17] see a jump. >> Yeah, there are significant limitations [15:19] on that. Um uh the state several years ago um through legislation removed a [15:24] city's ability to sort of dictate, you know, building materials, how much, you [15:29] know, masonry, glass, metal, um etc. you can use. Um and so um without that [15:36] there's not a lot you know localities can do. We do have a 720 overlay um [15:41] that's been put in place and recently it was updated um uh as we dealt with the [15:47] commercial projects on the west side of 720. Um but um you know we aren't in a [15:53] position um you know to say you know we like these colors, we like these [15:58] materials. um you know we do have conversations with developers when they [16:02] submit or they talk about projects and we try to encourage um features and [16:08] charact uh and other traits to differentiate that product. Um, but one [16:14] of the big drivers of that is typically in exchange for doing some of those [16:19] things, the locality is putting in something, right? Maybe um, uh, it's a, [16:25] you know, reduced price on land or, you know, some sort of incentive. And those [16:30] are things that are really hard for us to do because we don't really have land [16:34] and we don't have deep pockets. And, um, so, you know, there's not a lot that you [16:40] can do. Now, um Brian, uh works um very hard and uh in his conversations with [16:47] developers and the the items that he takes forward to planning and zoning to, [16:52] you know, look at you know, different things for bu building articulation. Um, [16:57] you know, we've got a commercial project, um, that you referenced number [17:01] five coming up where, you know, I think, um, they probably thought I was a broken [17:06] record where I said you've got to have like, you know, an incredible amount of [17:09] landscaping. um you know but at the end of the day the thing the other piece [17:14] that makes that difficult is um you know developers are [17:22] not always willing or wanting to spend a whole lot of extra money and you know [17:26] it's also what the market will dictate because if they're spending a lot more [17:30] money creating something that's very different um and different typically [17:35] costs more money um then they've got to charge higher prices or higher rents um [17:40] which makes it harder for them to you know lease up or lease out those spaces. [17:44] Um you know we we do everything we can as a staff with the tools and resources [17:49] that we have. Um but you know we are again unique in terms of our limitations [17:54] on what we can offer. Um as well as you know how we can kind of make things uh [17:59] marketable and competitive within the marketplace that we find ourselves in. [18:03] as you mentioned, you know, we're sort of sandwiched between 380 and Little [18:07] Elm. And um you know, if you have things that cost a whole lot more [18:14] money for um businesses and developers, they may say, "Well, we're going to pass [18:18] an Oak Point and go somewhere else where we don't do that." Um you know, there's [18:23] not a lot of land. um you know the I guess it's the east side of 720 is a [18:29] fairly you know in the shopping center world a fairly small track of of land um [18:35] you know so there's not a lot of options and how you can maximize that as you [18:39] heard consultants share with you how do you maximize um uh you know sales tax [18:45] per square foot you know when you've got to factor in all the other things um on [18:50] a on a on a small person um but our best tool is the 720 overlay and I think [18:55] planning and zoning has been great um in amending that um uh with some uh [19:01] additional items particularly what was it May April that we went before them [19:09] » recently um so [laughter] um you know and so we as staff if we come across [19:15] things that we think we can add to um to improve upon that um we are not shy [19:21] about coming forward to PNZ and saying Hey, there's another thing we want to [19:25] add to the overlay. And again, um the commercial properties that are that are [19:31] yet to be developed on the west side of 720 that Chapperel area, I mean, most of [19:37] that was not actually included in the original 720 overlay because it came [19:42] before all of that. And so, um, the most recent, um, 380 agreement that we put [19:48] forward that's been approved, um, one of the great pieces about that, I mean, [19:52] they were all great pieces, but, um, one of the highlights for us was that the [19:56] developers of that agreed to come under or fall under the 720 overlay. So, they [20:02] now have to, um, meet a higher standard than what was originally, but that a [20:08] higher standard from what they were originally um, allowed to do. And so, [20:12] um, you know, while there's nothing yet to show for that, I think that's a [20:15] fairly significant, um, accomplishment, um, you know, does it go all the way? [20:21] Uh, no. But I think, you know, also you referenced, you know, that the color [20:24] palette and some of the concepts. Um I think a lot of those things were you [20:29] know are great ideas and important ideas but you know at the end they were kind [20:33] of concepts that were somewhat discussed you know [20:38] you know in a context or just in a box without kind of considering all of the [20:41] other things and you know we are again limited in what we can control and how [20:46] we can control those things. Well, I wish we would at least have a [20:51] visual or a rendering that, you know, when somebody comes in and approaches [20:57] Brian, Brian could say, "Hey, would you give this any consideration if we could [21:04] follow this path of architectural elements? You know, [21:10] hell, it it it could be a tree on the corner of or a tower on the edge of each [21:16] building. Or maybe it could be the monument sign that I was going to say. [21:20] » Everybody, you know, everybody has some uniformity that they have to comply [21:25] with. >> Yeah. [21:26] » Rather than, you know, most of the time I'm sure they're just coming in with a [21:29] preliminary drawing of what they want to do. I wish we could get out in front of [21:34] that and say, "Hey, we think we should identify Oak Point [21:40] different than everybody else. Pierce's suggestion. Can you get on board with [21:44] it?" >> Yeah. So the 720 overlay does have what [21:46] you're saying. It has uh specifically certain colors in it that it likes to [21:51] see. Um but again like Noah was saying some the applicability of the 720 [21:56] overlay is kind of a patchwork right now. Um additionally like you said you [22:00] know there's always the ability for NPDS to have this language and then also to [22:05] kind of show them hey here's you know if you need a zoning change for your [22:09] property here is what PNC and council like to see. So those standards are [22:13] there. um in a patchwork across the city's small commercial area. And then [22:18] also we still point people who aren't in the 720 overlay. We say, "Hey, here is [22:22] the standard that everyone else is at. If you have to request any variance, [22:27] this is what we're going to hold you to if you want to get that." So the [22:30] standards there in the 720. It's just a matter of getting it to really clamp [22:34] down on all the remaining properties that it doesn't apply to. Since [22:39] nothing's really other than the one corner, nothing's really got signage or [22:43] anything on either side from Mtop to McCormick, could could there be some [22:48] sort of standardized monument sign because that's you know if [22:53] » potentially but a lot of cities they have um or not cities a lot of [22:56] developers and brands they have you know their brands you know for like [23:00] McDonald's for their sign that's what they want you know so they all you know [23:05] you might see small variations like Sedona Arizona um but For the most part, [23:08] they're going to do whatever fills that space and starts the rent checks coming [23:12] in. You know, like said, the city has very little ability. Yeah. [23:18] » Okay. Is there like as far as uh parking lot lighting and so forth? Is there some [23:24] uniformity? >> There is. Yeah. So, we are dark. [23:28] [laughter and clears throat] >> We got to work on this. [23:30] » Yeah. The person coming up goes up top. [laughter] [23:36] » Uh no. So, we have dark sky certification um or certified. We um [23:42] have the dark sky standards in our lighting ordinance which regulates the [23:45] temperature of the light. You know, whether it's the really harsh white or [23:49] the really old school yellow, you know, the warmth and the coldness of it. Um [23:54] and then there's also like the light height and then also the bleed or the um [23:58] trespass of the light, how far how intense it can be at the property line. [24:03] As far as fixturing >> um stop signs and signs within the [24:10] development or the physical pole and the head of the light, we have no [24:15] consistency there. >> No. [24:18] » Like if the maximum height is 75 ft, can we make them all 75 feet or do they have [24:24] » the maximum height I think is something like 25? [24:29] » 35. Yeah, it's 25 after the base and the [24:33] base can only be two and a half feet tall, [24:36] » but it doesn't regulate what the base is made of. It'll like concrete cylinder [24:40] or, you know, concrete with this kind of rock on the edge, you know. [24:45] » So, they could look different development to development. [24:47] » They could. Yeah. Um, >> so it's too late to include something [24:51] like that in there. >> And I just don't know that that's, you [24:53] know, >> the continuity. [24:56] » I just don't know that that's worth it. You know, [24:59] all the great places I've been to, I can't recall what the light posts look [25:02] like. You know, no one's going to go, "Oh, Oak Point." You know, I really like [25:05] your light. >> You know, it's kind of like residential. [25:09] You know, usually they establish >> a certain type of uh [25:14] » Yeah. Whatever. >> That kind of toes the line of the what [25:18] started that materials bill is cities were regulating what style and color and [25:23] brand of brick you had to buy. And that's what got the govern the Texas [25:29] government to say, "No, can't do any of that." So, we would like to not be the [25:32] next uh case study for the Texas legislature. And I will say just to add [25:37] to the the legislative part of that, you know, we're coming upon the next [25:41] session, um we do expect um several pieces of legislation to um further [25:48] erode our ability to regulate um commercial and residential development [25:54] um as well as how we use incentives uh for development. um they're um fairly [26:01] high priority items um for folks who are looking to [26:06] restrict city's ability to dictate or make maintenance. [26:11] » So what I'm hearing is really we have really no set plan that can help us [26:17] distinguish ourselves from the neighboring [26:21] » we have the 720 overlay. >> Yeah. Okay. [26:26] Right. >> It's not that we didn't have the ideas. [26:28] We're restricted from doing some of the things that we have. [26:31] » Well, it's a combination of that and but >> we're behind the curve and we don't [26:35] control the the development. >> Correct. [26:38] » You know, if we had 50 acres that was city owned and we said we're going to in [26:44] exchange for the 50 acres, James, you get to develop it, but we want you to [26:48] develop it with, you know, 75 foot tall light post. um you know and all the [26:54] other things you know water feature and this and you know trees and whatever um [27:00] you know we just were not in that position. don't have that. And you know, [27:04] if you want to incentivize that, you may be able to uh entice a developer to do [27:10] something more. Um but you're going to be pledging future dollars um you know, [27:15] now uh to do that. And as you know, we're not um a deep pocketed. I [27:23] understand that. How do you think, as silly as it is, how do you think Little [27:28] Elm gets everybody to put those silly lights on their building? [27:34] » I don't know what they have LED lights on. [27:37] » I know that, you know, LED lights and change color. [27:41] » They incentivize it. >> Okay. [27:43] » They truly do incentivize it. And a lot of whenever they go up, you know, it's [27:47] projects that the EDC is already working with them on. So they incentivize it and [27:51] it's usually either a part of uh the requirements of their incentive or it [27:57] goes under their qualified expenditures. [28:02] » Well and and one of you I don't remember which one of you a few minutes ago kind [28:06] of muted that you relate to the game. I mean that's you know some of these [28:11] things we wish you know we had the right step team in place you know a few years [28:16] ago so we could kind of get ahead of some of these things and we're really [28:20] we're trying to catch up with what little we have left [28:28] question here and um correct me if I'm wrong but I was thinking if that u [28:34] development area wanted to be having some some sort of like a sign of [28:40] the city. Do we have anything like this monument being built or being displayed [28:45] at the beginning the entrance of the development that the that area because [28:50] we know from this point the old point starts like that's a limit and this this [28:57] spot let alone starts. So, we know like through driving, but not necessarily [29:03] when we're driving to see. Okay, now we have [29:07] » we have an Oak Point monument sign that's at the corner of 720 and [29:11] McCormack um at the moment. That's where it it is, [29:15] but nothing that sort of delineates your coming in or, you know, leaving. [29:19] » Um >> well, there's one there's one on Naylor. I [32:28] mean just does it make sense to sort of you know duplicate that effort I think [32:32] at some point in the future um as we have more uh commercial opportunities [32:38] uh existing commercial opportunities within the community and maybe spaces [32:42] start to change hands in the future you know we'll be playing a much larger role [32:47] in um the recruitment of things but right now most of you know most of the [32:52] calls that I get are from the commercial brokers not specific entities is looking [32:57] to locate because they've already had those calls. [32:59] » Yeah. And they're calling because they've already done the research and [33:02] their demographics and I I understand all that. I just wanted us to have [33:06] something if in fact we you know we're in a restaurant and it's [33:12] like hey this is this could work in Oak Point. [33:16] I'd like to have something to hand them. And I have I have the [33:20] » right >> you know two or three page marketing [33:22] brochure. Um, but I I think the other piece to that, you know, because I have [33:27] um one council member who hands out his cards everywhere he goes, so I have a [33:31] stack of like I know where he's eaten this week. Um, and [laughter] um, I [33:35] mean, and my family jokes because I keep a stack of my cards in the car. So, [33:39] every time we go someplace, I'm like, "Hey, I do the same thing." The thing [33:42] that I find the most that um, hinders those conversations [33:48] um is, "Oh, I may be interested in a point. you know, where where would you [33:52] put me? And right now, I don't have any spot to put them. And so, I would say [33:58] for all of the places that I've gone to or that I've followed up from the [34:02] council people's cards of where they've gone to, that is a single that is the [34:06] thing that kills the conversation. I I don't have a spot, a pad, a vacancy. [34:11] Nobody wants to build a building or, you know, typically in that that genre of of [34:16] folks. I I need the commercial folks to come in, build their things. So I have a [34:21] place to say, "Oh, you know, there's blah blah blah square feet of retail on [34:26] the east side and, you know, this many sites on the west side." We don't have [34:31] any of that right now. >> Okay. We should have some ammunition to [34:36] at least say, "Hey, call Scott at Whitesman because he's working on he's [34:42] working on something. Call or call so and so. he's working with. [34:47] » So that's what I do do is I do pass that information on to those folks. So if you [34:53] you know um because there's several different brokers, I would say the best [34:57] and easiest thing is if you have those conversations, if you connect me to [35:00] those people, I will make those connections. That way you have it readily available and that way if you have those [35:12] conversations, then that's just something that you can see right there. [35:15] for sure. So that's going [39:27] to be another restriction. And that's going to be something that I can outline [39:31] in the email itself just to keep in the back of your mind while you're looking [39:34] at all of them. And we'll definitely cross check all those references to make [39:37] sure that they meet that. on saying that I was thinking to run it with the [39:40] artificial intelligence to see which one is the closest one which is you know [39:44] that's >> Yeah. So there are actually different [39:46] options that you can manually do that in word instead of running it through AI. I [39:50] personally am not a super big fan of doing that in AI especially with [39:54] anything that's like a legally binding document. I definitely think that AI has [39:58] its uses and it's definitely going to be able to catch things that I'm not able [40:02] to catch after looking at the same 35 pages multiple times kind of thing.
