[0:05] >> Good evening. [0:06] The record meeting of the Oakley Planning Commission is called [0:10] to order at 6:30 p.m. [0:13] Clerk, will you please say the roll? [0:19] >> Commissioner Goudie. [0:20] >> Here. [0:22] >> Commissioner Ireland. [0:23] >> Here. [0:25] >> Vice Chair Harvey. [0:26] >> Here. [0:27] >> Chair Price. [0:28] >> Here. [0:29] Would you please stand and join me in the Pledge of Allegiance [0:34] to the flag? [0:37] >> Pledge allegiance to the flag of the United States of America. [0:40] And to the Republic for which it stands one nation under God [0:46] indivisible with liberty and justice for all. [0:57] >> We will now move to the consent calendar. [1:02] For items not listed on the agenda, [1:06] I have not received any speaker cards to speak. [1:09] Clerk, are there any remote attendees out there [1:13] raising their hands? [1:15] >> There are no hands raised, Chair. [1:21] >> We will now move to the consent calendar. [1:25] >> I wanted to pull 3.1 because there was a point I wanted to -- [1:31] >> Okay. [1:32] >> So for 3.1, I did notice one item on there on the minutes [1:36] for item 4.4. [1:38] In the motion, the wrong municipal code is referenced, [1:42] I believe. [1:44] It should be 9.1.406. [1:46] It is referencing 1.5.061 b3. [1:49] It's just a typo. [1:52] But since it's for the record, I think it needs to be updated. [1:55] I'd like to make a motion to approve [1:56] the minutes with that change. [2:00] The correct Oakley municipal code is in the title of 4.4. [2:06] It is just in the motion in the minutes it has the other one. [2:12] >> Thank you, Commissioner . [2:17] >> We can have staff confirm that. [2:19] >> Is the motion to change the -- [2:25] in the motion and the minutes to match the section in the title? [2:28] >> Correct. [2:29] Sorry. [2:30] I apologize. [2:31] I noticed too late to send it in before the meeting. [2:35] >> With that change, would you like to make a motion. [2:39] >> Yeah, I'll make a motion. [2:41] >> Second. [2:44] >> Clerk, please do a roll call vote please. [2:49] >> Commissioner Goudie. [2:50] >> Aye. [2:51] >> Commissioner Ireland. [2:53] >> Aye. [2:55] >> Vice Chair Harvey. [2:55] >> Yes. [2:57] >> Chair Price. [2:58] >> Here. [2:58] >> Motion carries 4-0. [3:03] >> We now move to the public hearing. [3:06] Mr. Ortiz. [3:10] 4.1 [3:11] >> Thank you. [3:43] Thank you, commissioners. [3:46] Tonight the next item on tonight's agenda [3:49] is the Hacienda Estates tentative map. [3:53] Here is a project location map. [3:56] It gives you an idea of where it is located [3:58] around Sellers and Delta Road. [4:01] More closely Delta road at 5321 Sellers Avenue. [4:10] This brings us in closer, gives us a better [4:14] idea of where we are located. [4:15] We are at 5321 Sellers Avenue, with others to the east [4:23] and a city property line to the East. [4:26] Chris Moore Drive is to the west with a property in between. [4:33] Undeveloped county lands across Sellers to the east [4:36] are also near the property. [4:40] And the property is also primarily surrounded [4:43] by scattered rural residences and undeveloped land. [4:47] A little background, the properties [4:51] designated rural residential or RR within the General plan. [4:57] It is zoned r40, which is single family residential. [5:01] The property is about 5.4 acres and will [5:06] be subdivided into five separate parcels that will remain [5:10] undeveloped for the time being. [5:12] Each parcel will be about 0.95 acres in size. [5:16] All of them will be about similar size. [5:22] Here we have the tentative map. [5:26] As I mentioned, there is no development proposed [5:29] as part of this application. [5:31] Future residences would require a design review. [5:37] And as you see here, each parcel is about 41 and 1/2 thousand [5:48] Square feet, so close to that .95 acres. [5:53] There are proposed private streets or roads that would [5:58] be developed in the future. [6:07] And would be required to be installed when [6:09] the properties are developed. [6:10] The map complies with the development standards [6:13] of the R40 zoning district. [6:17] And all other development standards. [6:20] And environmental, this project did [6:26] go through a unique environmental process. [6:29] They had to go through what is called a 15183 checklist, which [6:36] states that if a project complies [6:38] with the general plan and zoning designations, [6:43] you don't have to go through the full environmental review [6:49] that a different project may require [6:52] or a project that doesn't necessarily [6:54] comply with the underlying general Plan designation. [6:58] What that means is the checklist goes and refers to the General [7:06] plan and any newer environmental studies and states [7:11] that any potential impacts that this subdivision may have [7:18] or previously analyzed as part of the Oakley [7:25] general plans, EIR, and the subsequent focused General plan [7:30] update environmental documents. [7:32] But with that being said, the modified initial study [7:38] or the 15183 checklist did do studies [7:43] and found that the potential impacts were previously [7:45] analyzed and accounted for. [7:51] With that being said, staff recommends [7:55] that the Planning Commission approve [7:56] a resolution recommending the City Council approve [7:58] a tentative map for the project titled Hacienda Estates. [8:03] That's TM 2025-002. [8:05] And find that the modified initial study/15183 checklist [8:12] identifies the general plan policies or actions that [8:14] apply to the development of the project [8:16] have been determined in the General Plan EIR [8:20] to substantially mitigate environmental effects [8:23] as conditioned. [8:24] Thank you. [8:27] >> Thank you. [8:31] >> Thank you. [8:34] Commissioners, have any questions? [8:39] >> I have one questions. [8:41] This may be a little pedantic. [8:42] But on the notice, I believe there [8:44] may be an issue with the address, the zip code. [8:47] I believe it has a typo in it. [8:49] The parcel number looks correct, but the zip code [8:51] on the notice for location looks like it is not in zip code. [8:57] I'm curious if that is an issue with noticing [8:59] that could be a problem later. [9:01] The parcel number looks correct. [9:12] >> You're talking about Oakley, California, [9:14] the typo in the zip code. [9:17] That would not change any notices that went out. [9:19] We use a physical click on the map and choose the parcel. [9:22] >> That's the only question I have. [9:24] >> Thank you for pointing that out. [9:25] Will correct that. [9:26] >> No further questions. [9:27] Thank you. [9:29] >> I have one question. [9:31] Looking at the map they had, is there a sediment [9:34] pond set aside there for that site? [9:39] >> I'm sorry. [9:40] Are you saying if the project has a detention basin? [9:45] No, the project -- let me see here. [9:56] There is not a larger subdivision [10:02] that require a detention basin. [10:05] I don't think we have one in this situation [10:07] or it would require or trigger that. [10:13] >> I can help address that. [10:15] I've had some more experience with stormwater control [10:20] in a past life. [10:23] The stormwater detention basins are typically [10:26] required when there's a project being developed. [10:30] In this case we only have the subdivision. [10:32] So the parcel is being split up into five lots. [10:38] In the future, if these lots were [10:40] to be developed with single family residential, [10:44] even then the chances that a detention basin or pond [10:47] would be required really depends on how much impervious surface [10:50] is built and whether there is enough impervious [10:53] surface to handle what is called a self retention. [10:56] So if there's enough of it there to absorb the runoff and flows [11:01] and percolate into the ground, there [11:03] would not have to be any special stormwater. [11:05] But that is really a question that [11:07] would be answered when development comes forth [11:09] on the property. [11:10] That is not happening at this time. [11:13] >> Thank you. [11:15] I will now open the hearing for public hearing item. [11:21] With the applicant would like to provide [11:24] any information at this time? [11:26] Or is the applicant here? [11:29] >> I believe a representative from the applicant is here. [11:32] But I don't think they had a formal presentation prepared. [11:35] Did you want to go? [11:49] >> My name is Roberto Ruiz. [11:55] I guess exactly what they mentioned, that is [11:58] what we plan to do. [12:02] I can't think of any other information that I could share. [12:10] However, the whole plans was to divide it [12:17] into five separate parcels. [12:24] There is five of us that own the property. [12:27] So that is why we divided it into five parcels. [12:31] If you guys have any other questions in regard [12:35] to our intentions, I am more than happy to answer. [12:40] >> Do you own the property as a single entity or >> [12:48] It's a single entity property. [12:49] However, once we-- there is an entity. [12:56] However, that is going to be developed later in the future [13:02] as we decide what we are going to do with the property [13:09] and how we're going to do it. [13:13] >> Thank you very much. [13:15] >> Thank you. [13:21] >> Any other questions? [13:23] >> I think that's it. [13:24] Thank you very much. [13:27] >> Clerk, are there any attendees online that have [13:30] a question? [13:31] >> There are no hands raised online. [13:35] >> I will now close the public hearing and bring the matter [13:38] back to the Commission for deliberation. [13:41] Commissioners, would like to adopt the resolution [13:45] or have any comments at this time? [13:52] >> One moment. [13:56] >> So we are just approving the tentative map. [13:59] Later on we come through and decide like fire truck [14:02] access and stuff like that? [14:05] >> So yeah, right now we are just looking at the subdivision, [14:09] the line lines as you would say. [14:12] They're not proposing any development [14:15] as Ken mentioned previously. [14:21] Typically -- or it depends on how they come back and propose [14:26] their project. [14:26] If they're just going to do one lot at a time, [14:29] typically we will do a staff review of the house. [14:34] But that is typically what we do for single houses. [14:39] But again, it just depends on what they [14:41] propose to do in the future. [14:43] The conditions of approval do typically govern, hey, [14:49] if you're going to do development, [14:51] here is everything you would have [14:52] to do to do your development. [14:55] So all that is covered. [14:57] But for now, it is just the subdivision itself. [15:05] >> Any other comments? [15:07] >> The only comment I have, I'll make a motion to approve with [15:10] one minor modification. [15:11] I think just the wrong template got loaded in. [15:14] It references city council instead of planning commission [15:16] on the signature page. [15:17] So just to update that to Planning Commission, [15:19] and then I'll go ahead and approve or make [15:21] a motion to approve it. [15:25] And that is on the very last page of the resolution. [15:38] >> Second for this? [15:40] >> I will second it. [15:41] >> Clerk, would you please say roll call? [15:46] >> Commissioner Goudie. [15:47] >> Aye. [15:49] >> Commissioner Ireland. [15:51] >> Aye. [15:52] >> Vice Chair Harvey. [15:52] >> Yes. [15:54] >> Chair Price. [15:55] >> Aye. [15:56] >> Motion carries 4-0. [16:02] >> Thank you very much for coming. [16:03] We will now move to item 5.1, adopt a resolution appointing [16:08] a planning commissioner alternate [16:10] to transplant committee to fill a vacancy for our two year term [16:14] ending. [16:14] To the commissioners have any questions for staff? [16:19] >> Is there any item on here on the staff report that needs [16:23] to be presented? [16:24] >> I can give a really quick staff report. [16:26] First of all good evening, Chair, vice mayor members [16:31] of the Planning Commission. [16:32] I'll read the summary and background. [16:34] This is a really straightforward item. [16:35] The transplant committee coordinates [16:37] the regional transportation interests of each East Coaster [16:41] County community including the cities of Antioch, Oakley, [16:44] Pittsburg, and Contra Costa County. [16:47] And unincorporated communities of Bethel Island, Byron, [16:50] discovery Bay, and Knightsen. [16:52] Elected officials and planning commissioners [16:53] sit on the planning committee. [16:55] On May 6th 2025, the Planning Commission adopted resolution [16:59] 5-25 appointing commissioners Harvey and Oliveros [17:02] as the representative and alternate respectively. [17:06] Those appointments were for a two year term. [17:09] On July 7th, 2026, Commissioner Oliveros announced that [17:13] a resignation from the Planning Commission. [17:17] Since Commissioner Oliveros served as the alternate [17:19] representative for the Planning Commission, [17:21] the Planning Commission may appoint a new alternate [17:23] to complete the two year term, which will end on May 5th, 2027. [17:27] So staff recommends that the Planning Commission [17:32] nominate an alternate, second to that, and take a vote. [17:36] And there is a resolution that would be [17:38] signed to make that official. [17:40] Once that is done, staff will notify transplant staff [17:45] of the update and provide them the updated planning [17:48] commissioners information. [17:53] >> So I can go ahead and volunteer to complete that term. [17:57] >> I think we have to vote on it. [18:00] So do you want to nominate him. [18:05] >> I will nominate Mr. Ireland. [18:07] >> I'll second it. [18:08] >> Clerk, will you take a roll call please? [18:13] >> Commissioner Goudie. [18:14] >> Aye. [18:16] >> Commissioner Ireland. [18:17] >> Aye. [18:19] >> Vice Chair Harvey. [18:19] >> Yes. [18:21] >> Chair Price. [18:22] >> Aye. [18:23] >> Motion carries 4-0. [18:27] >> Now moving to staff reports. [18:30] Any reports from staff? [18:33] >> Yes, sir, I have three quick staff reports from staff [18:37] to the Planning Commission and public. [18:39] As you know we have the vacancy to fill for Commissioner [18:43] Oliveros resignation. [18:45] I'm happy to report that we did receive [18:51] a few applications for the new Planning Commissioner. [18:54] We are tentatively scheduling that to go [18:57] in front of the City Council at one of the September meetings. [19:01] Will be finalizing that soon what the agenda is posted. [19:04] They will hold interviews and hopefully appoint [19:07] one of those members who would then [19:09] be able to start as soon as possible. [19:11] Also as you remember on July 21st, [19:14] there was a joint planning commission and City Council [19:17] meeting to discuss data centers as a general term for a multiple [19:22] of uses. [19:23] At that meeting staff was directed [19:25] to come back with a focused second work session. [19:31] We have prepared the materials for that. [19:32] That is now scheduled for September 15th at 6:30 p.m. [19:37] Right here in the City Council Chambers at Civic [19:41] Center and City Hall. [19:43] Lastly, I would like to announce that the regularly scheduled [19:48] meeting for October 6th Planning Commission meeting will not be [19:52] held. [19:52] We will have at least one of our Planning Commissioners out. [20:00] I will be out. [20:01] Another one of our planners will be out. [20:02] Will instead be moving that meeting to the third Tuesday [20:05] of October or October 20th, same time, 6:30 p.m. [20:10] Right here in the Council chambers. [20:12] Those are all my reports. [20:13] Thank you. >> Thank you. [20:17] Are there any reports from the commissioners? [20:20] >> I would like to share a few things. [20:24] August 18, I was unable to attend, [20:28] but I notified the city the next day. [20:31] On August the 6th, I was able to participate in water tours [20:39] for Oakley and understand more about our water infrastructure [20:43] within Oakley. [20:44] It was very fascinating and informative. [20:47] I gained a lot of confidence in our water system. [20:50] Our employees are amazing with a beautiful staff. [20:53] Very caring. [20:54] It was a great experience. [20:57] On the 13th of August I was able to attend right here in City [21:01] Hall when Josh Gardner for district nine did a meet [21:05] and greet and spoke to a great number of people about funding [21:09] and a lot of things that are going on right now [21:11] in California, especially for fixed income people. [21:15] And I was able to ask him specifically [21:18] about the constant attacks on our Delta water [21:20] and how to fight it. [21:22] And he is very specific about HR1311 [21:27] and how to fight them taking our Delta water. [21:32] Please support that. [21:33] Thank you very much. [21:35] >> Thank you. [21:35] Any other commissioners? [21:38] >> One thing, when we came on the Planning commission, [21:42] we went through and did a walkthrough with the water that [21:49] that showed what went on. [21:50] That was pretty interesting. [21:51] I don't know if any of the commissioners have any chance [21:53] or been invited to do that, but it was very enlightening [21:56] and what goes on in the water service in our city here. [21:59] >> Thank you for that note. [22:01] I'll look into that. [22:02] Thank you. [22:03] >> It's called the Contra Costa Value Water tour. [22:06] I did it in 2024. [22:07] It's an excellent tour. [22:09] I highly recommend it. [22:17] >> There being no further business this meeting is [22:19] adjourned.
