[0:48] I got to do that all over again. >> Okay, first one is datab bank phase 2 uh [0:54] PV25-2. Uh I believe AKRF has some information [0:59] for us. [1:02] » Okay, sure. Um, so the applicant submitted their draft scope and we [1:09] submitted a red line and clean version back to the board. Um, a lot of it was [1:14] clarifications on certain aspects and kind of just some typical secret [1:19] language that we added in. Um, at this time tonight, because it is still just a [1:24] draft, we are asking that the board refer it out to the involved and [1:28] interested agencies. that way they can come back and comments on the scope as [1:33] well. And then we would also like to hear any uh questions or comments from [1:38] the board on the scope. And uh this isn't the end of it as well. We're going [1:43] to let me pull up the schedule real quick. [1:49] Um the game plan is to also set um the public hearing [2:01] for September 9th and then we'll also be accepting written comments until [2:06] September 14th. Um, so the board can we can discuss any comments that you all [2:11] have now, but it's not too late. If you need to email us, we can discuss things [2:16] further and keep editing. We have some time. The goal is to adopt the final on [2:23] 9:23. Thank you. Um [2:28] this is just a scoping session for the board. There will be no public comment [2:32] on this. This is basically for us to agree and to vote on circulating all the [2:38] comments to the public. So there will be no public input on this at this time. [2:42] Okay. Any questions or comments on this? [2:48] » Okay. Mike, questions or comments? >> Nothing at this time. [2:52] » Okay. Thank you. Any questions or comments? [2:56] » Uh, no, not right now. >> Okay. Questions or comments? [3:00] » Gross. Questions or comments? >> Okay. Um, can I have a vote from the [3:05] board to circulate this for public scoping session? [3:11] » Motion to distribute the draft scoping document to interested agencies. [3:21] » Okay. Do I have a second? All in favor? [3:25] » Any opposed? >> None. Okay. So be it. Thank you. [3:31] » And then the second part would be I'm not sure if you all want a motion to um [3:36] set the public hearing for September 9th. I think isn't that up for the [3:42] building department to set the meeting >> between [3:52] » Okay. Do I have a motion to set the meeting for what was the date? [3:55] » September 9th. >> September. [3:57] » September 9th for datab bank. >> Motion to set public hearing for the [4:01] scoping document for September 9th, 2026. Okay. Do I have a second? I'll [4:07] second that. All in favor? Any opposed? >> Okay, you have that. Okay, next item. If [4:15] I can find this mess. Hold on just a second. [4:36] » Oh, I It's just a list. Okay. [4:41] I think the next one is [4:47] a consultation for um >> No, no, [4:50] » no, >> not that next page. [4:52] » Huh? >> It should be a third page. [4:54] » I don't have third page. >> Oh god. [5:06] » Here. I got it here. That was that event. Okay. The next is uh Beerus 7th [5:12] Day Adventist Church uh village of Nyak planning board site [5:16] review. It's a general uh municipal law referral. [5:22] Is there any discussion on that? Um they're looking for I think local [5:29] » local amendment. >> Any discussion Andy? [5:34] » I have nothing. Mike, >> nothing. [5:39] Oh, okay. Thank you very much. Nothing. Nothing. Nothing. [5:45] » So, we want to refer this for local uh motion to refer um [5:56] the Sarah 7th Day Adventist Church [clears throat] [5:58] back to the village of Nyak. Uh local determination. [6:02] » Do I have a second? >> Second. All in favor? [6:06] » Any opposed? None. Okay. The next is Gray resident site plan amendment again [6:11] from the Gro planning board. Uh general municipal law referral. [6:17] Any discussion on that? >> I have nothing. [6:19] » Mike, >> no comment. [6:21] » Dave, Matt Gross, nothing. Okay. Can I have a [6:25] motion for local referral? Motion to refer the GRA resident site plan as [6:31] amended back to the village of uh NYAK a local determination. [6:36] » Thank you. Okay. Next is >> second. [6:39] » Second. >> Okay. Do I have a second? [6:41] » Second. >> All in favor? [6:43] » Oppos? None. Okay. Next is one vert place seaw wall rehabilitation and stair [6:49] access again the village of Nyak planning board. [6:54] » Discussion. Andy. >> No. [6:56] » Mike. No back. No. Okay. Again. [7:01] » Okay. Motion to refer one leva place seaw wall rehabilitation stair access [7:07] back to the village of Nyak planning board for local determination. Okay. Do [7:11] I have a second? >> Second. [7:13] » All in favor? >> Opposed? None. Okay. Done. Okay. [7:18] » Now we get down to business. Thank you ladies and gentlemen. [7:22] Okay. The first one if I can find it. What's in this mess? [7:27] » Yeah. Is it >> Coing 30 Corporate Drive LLC site plan [7:32] review PB 2622. [7:48] » Glenn McCrad, engineer for the applicant. [7:51] G L E N MCC C R E D Y [8:02] » Okay, Mr. Brder. >> Yes. [8:04] » What can I do you for, sir? >> We are here for pre approval of an [8:10] expansion of an existing building in corporate park. [8:18] We are here for the expansion of an existing building in Corporate Park. [8:23] » Okay. Thank you, sir. Um, let me go through the consultants report. Orangetown drainage consultant Kier [9:07] Engineering uh dated August 2nd, 2026 with four comments. [9:13] » It's been it's been Excuse me. >> There was a second letter from uh [9:19] » the consultant. >> I have another one coming. Okay. I have [9:22] another letter from Orangetown Drainage Consultant Cier dated August 11th. [9:28] Uh which says not approved. 12 comments. I have a letter from Rockland County [9:33] Department of Planning dated August 11th. 12 comments. I have an email from [9:39] Orange and Rockland Alpha Gaddy dated August 1st. conflict. I have a referral [9:46] sheet from Rockland County Department of Planning dated July 13, 2026. Comments [9:52] attached. I have a consent lead agent letter from Rocklin County Planning [9:58] dated July 23rd. The consent. I have a short EAF form [10:04] uh by the owner dated uh April 6, 2025. And I have project narrative provided by [10:12] Mr. Brener at the Did you read the August 20th letter from [10:17] the consultant? I sure can. [10:28] Okay, this is um August 20th from K August [10:33] 20th, 2026 Ker engineering. The above comments represented by our [10:40] professional opinion and judgment but may not necessarily in all cases reflect [10:45] the opinion of the planning board. Overall, the proposed storm water [10:49] management plan meets the intent of the regulations and therefore we recommend [10:54] that the coning 30 corporate LLC site plan be approved for drainage sub to the [10:59] above project comments of which there are four. [11:02] » Okay. Thank you, sir. [11:06] Any questions or comments? >> Yeah, I'm looking at [11:12] looking at your landscape plan. Um, down towards towards the end of the [11:20] driveway, it looks like you're going to put some [11:23] trees in around that turnaround and down towards the back. [11:29] » What kind of trees are there? I believe we have sele [11:35] comments for that. >> Are they green giant after biting? [11:38] » Yeah, the giant ones that supposed to be de resistant. [11:44] » Depends on how hungry they are. >> I know. [11:49] Um >> All right. So, and then you have in the [11:54] um the back corner on the left hand side of the uh of the plan uh existing trees [12:00] to remain all those other trees are going to come out. [12:03] » Yes, there be impacted by construction. Yes. [12:08] Some of which are right. I'm sorry I hit my microphone. Oh, here [12:13] it is. >> What about the trees like down um down [12:17] on the um on the property line there? >> Uh there are a few that would be [12:22] impacted that we're going to be replanting in the same zone [12:26] » uh just due to grading conflicts, [12:30] » but you're not you should be showing that on your on the [12:33] » They're exed out. The ones that are being taken out. [12:35] » The ones that are taken out. But are you going to replace any [12:40] in the back there? Um at this time we don't have anything proposed directly [12:45] behind the building. Uh most of those that are within the building envelope [12:49] are being removed but the ones that are outside the envelope are being [12:51] protected. >> Okay. [12:56] » I don't have any further right now. >> Questions comments. [13:01] » Thank you Mr. Chairman. Um the deme's uh comments of August 20th [13:08] 1st of 2026. Uh the first comment it talks about the [13:13] difference between the underground storage system and the above ground [13:16] storage system and it was uh Bruce Peters suggested that all proposed storm [13:22] water management facilities shall be uh the above ground system. What is the [13:27] rationale that you're putting it underground? [13:30] » So there's there's I don't know if you can hear me. Um so there's a few [13:33] different rationale for um deciding on the above ground or below ground [13:39] infrastructure. Uh the number one component would be how much disturbance [13:43] is required to do the above ground uh which is one detriment uh for this [13:47] project considering the constraints to the property line where the buildings [13:51] are located existing buildings are located. Um [13:56] there's also other considerations about um the the maintenance and the [14:00] landscaping that are imposed as a because of the above ground [14:04] infrastructure. The ease for the underground infrastructure is that it's [14:08] protected from the elements. Um it's easy it's relatively easy to maintain uh [14:13] and it is allowable per the New York State DEEC manual. So um although it is [14:18] costly to install the future benefits usually outweigh the benefits of the [14:23] above ground facilities. However above ground facilities do have their merits. [14:28] Uh but in this instance because of the constraints to the property line it's [14:31] one thing that we took into consideration. [14:34] » Sure. [14:46] Secondbody [14:52] to speak on project. [15:02] » Motion to close public portion. Second. Second, please. [15:05] » Second. >> All in favor? Any opposed? None. Okay. [15:10] » Motion for lead agent. Motion for lead agency. [15:13] » Do I have a second? >> Second. [15:16] » All in favor? >> I none. Okay. Motion for neg. [15:20] » Motion for Nick Deck. >> Second. [15:23] » Second. All favor. >> I. [15:26] » Any opposed? None. >> I think the biggest thing is is the um [15:31] the underground. And I think that you worked it out, right? Um a motion for [15:34] final with conditions. >> Yes, Mr. Burn. [15:38] » I don't think so. I think we have to go to zoning board. [15:43] » I think we have to go to zoning board. So if you give us final subject to [15:46] zoning board. >> Okay. Motion for final uh subject to [15:52] final approval from zoning board. >> Motion. Are [15:55] » we all right with that? >> Okay. [16:00] » Thank you. Thank you. >> Motion. Motion for final subject to [16:04] conditions and zoning board. >> Zoning board's approval. [16:09] Uh, let me go through the conditions. Um, Orangetown ZBA, August 11th, 15 [16:17] comments. Orangetown DME, Bruce Peters, August 21st, 17 comments. Orangetown [16:24] Fire, uh, July 31st, no comments. Orangetown Planning Consultant, Paul [16:31] Gazki, August 2nd, three comments. Orangetown drainage consultant Ker [16:36] engineering first of two letters August 2nd approved [16:42] four comments. Um, Orangetown James Consulting College Engineering. Uh, [16:48] August 11th, not approved. 12 comments. Rocker County August 20th. What the [16:56] second? >> Okay, I think it back was August 20th. [16:58] The first one, the uh, Orangetown Drainage Consultant, Ker Engineering, [17:03] » the approval letter was on August 20th. Can't be before the ground. Okay, fine. [17:08] Thank you. Uh, Rockham County Department of Planning, August 11th. comments [17:15] and that's it. [17:23] » I don't see any any problems. [17:28] I think I think we're good. >> Okay. Do I have a second? [17:31] » Second. >> All in favor? [17:33] » Opposed? >> Thank you. Thank you. [17:41] » I don't know. You guys are being too good tonight. What's going on? [17:46] [laughter] [18:02] It's all yours. >> Thank you, sir. [18:05] » I'll be back. >> Peter Stay, SK AE, uh 15 Corporate [18:12] Drive, Orangeburg. [18:16] » Yes. [18:30] So, I apologize for the site plan mixup last time, but I'm back. [18:41] » We're all set. [18:49] August [18:54] 21st comy 30th no comments. [19:24] I'm sorry, 2026. [19:34] » I have nothing right now. >> Thank you. [19:37] » Thank you, Mr. Chairman. Mr. public. The short environmental assessment form [19:43] dated uh May 20th to 26 states new rooftop HVAC units and chillers. Your [19:51] plan page one submitted for the meeting shows two new chillers on the ground [19:55] level southeast side of the building. Uh where are the chillers going to be on [20:00] the roof or on the >> No, the chillers are on the side. [20:02] There's a rooftop unit just on top of the loading dock. A small [20:05] » message rooftop unit. >> It's added then. It's it's it's being [20:09] added and it's it's actually shown on all the mechanical plans. [20:12] » Okay. All right. But this is the conflict in the state. All right. So [20:16] there's two on the ground and one above. >> Correct. [20:19] » Okay. [20:29] » Okay. That's the only question I have now. Thank you. [20:42] Motion open public portion. >> Do I have a second? [20:44] » Second. >> All in favor? [20:46] » I >> I [20:47] » opposed. Okay. Anybody from the public wish to speak on his project? [20:51] One more time. Anybody from the public wish to speak on his project? Hearing [20:54] none. Motion to close. >> Motion to close. Public motion. [20:57] » Second. >> Second. [20:59] » All in favor? I opposed. Okay. Um, >> got to read [21:03] » motion for lead agent. >> Did we do that already? [21:07] » Did we do lead? I don't know if we did. >> All right. Okay. [21:11] » Motion for motion for lead agency. >> Second. [21:14] » Second. >> All in favor? [21:15] » I >> oppose. [21:18] Um, motion for neg. >> Motion for neg. [21:22] » Second. >> Second. [21:24] » All in favor? >> Any oppose? None. [clears throat] Motion [21:27] for final conditions. Do we have [21:32] » Okay. Does he still have to go to Aapore or [21:36] » I don't think this is the one. >> Huh? [21:38] » The Greek churches. >> No, no. There's a [21:41] » Do they have to go to Aore? >> No. No. There's a comment, I think. [21:46] » Yeah. Uh, building department number two, aorean review and approval may be [21:51] necessary. So, we can >> we can we can wave it. [21:58] We can wave it. >> Okay. Motion to wave. [22:09] » Uh I went to the IC for performance already. That was already approved. Uh [22:13] it's been approved for two or three months. I don't know what [22:18] what setbacks. I'm I'm not violating any that I have anything that I need. [22:25] » They're actually They're actually further than the existing mechanical [22:29] equipment outside. But that's >> would the the new generator be a [22:33] sideyard problem? [22:37] » Rick, go at the top where the generator is there. What's that? I think it looks [22:41] like 46 ft. >> 46. [22:43] » I think you're required 50, isn't it? Required 50. [22:49] » Can we make that? >> I don't know. Can we make that a [22:52] condition? >> Well, I can't. And I'm not going to I'm [22:56] going to have to go to if needed to go to zoning then for variance. [22:59] » No, no, no. I'm just saying I'm trying to avoid you coming back. [23:05] » Is there a total sideyard? >> There may be a total sideyard besides [23:08] the >> If there's a total sideyard, I don't [23:11] think >> Well, the generator is the only one [23:13] that's encroaching. That's a 46 ft. Everything else there is fine. [23:18] » What's your total sideyard on the other side? Is is it going to need a variance [23:22] » for total also? total side yard. He go back down again, Rick. [23:27] » Right here. He's got >> uh 132 ft [23:32] » or close to it. >> Right there. 132 ft. But that it goes [23:36] in. But he's got only 46 here. And that's the problem. [23:40] » Yeah. But what I'm saying is total sideyard both sides. [23:43] » Yeah. Both sides of the building >> is it, you know, like [23:46] » But I think on the other side I think he's he's fine because it's got to got [23:51] to existing. They got to be added >> when you add them. [23:57] If it's a total sideyard of like let's say 200 feet [24:02] » and he's got 150 on one side he's got or 46 it make whatever makes up 200 feet [24:09] should >> total side 200 feet [24:13] and so you have >> I don't know is that is that is that [24:17] what the zoning is 100 he's got 102 there [24:20] » 30 the rear setback is 100 ft so you have 103 to the building and the [24:26] chillers If you got variances for the other [24:30] chillers, you still have to get a variance for this. [24:32] » So that's that's what it is. And what they're saying is they're going to give [24:35] you final and let you go with the condition that you get the zoning [24:38] approval, which will save you a big step. [24:40] » Sure. And I'm happy to do it. I guess you know I rely on engineers and when [24:44] when the engineers gave me they how they said it to me was the setback is to the [24:48] building, not to actually outdoor equipment that supports the building. [24:51] But that's obviously incorrect. So, [24:56] so setbacks are actually any piece of equipment that goes on a on a piece of [25:00] That's interesting. [25:06] » I know. Me, too. I don't want to see if you don't have to come back. I don't [25:11] want to see you come back. >> It's It's up to Department right now. [25:18] » I know we don't like doing it because we're kind of almost setting a [25:21] precedent. But we're talking [25:36] » So can I understand? [25:41] » Can I can I ask a question? I just I really genuinely want to learn. So the [25:45] generator we're saying has to be 50 feet from the property line. It's only 46. [25:48] Right. >> The chillers have to be 100 ft. Why [25:52] wouldn't they play the same that they only had to be 50 feet? [25:55] » And what I don't understand, Rick, can you go down to the bottom where the [25:57] chillers are? [26:01] Slide it over a little bit. [26:05] Okay. These are the new two new chillers. [26:09] » Yes. >> These are inside of what's here. This is [26:12] existing. [26:15] So why does he need a varian those two chills. I think the only thing he needs [26:20] variance for is to generate. So the way the laws [26:25] increase [26:33] no I understand I just the rationality being that these two are inside of what [26:38] he already what's existing [26:43] » well can I I just want to understand that so the setback for a generator is [26:46] only 50 ft but the chiller is 100 ft why is the chiller different than the [26:50] generator I would commercial [26:58] » but I'm trying to understand if you're talking about outdoor you know equipment [27:01] that goes outside to support the building is it does it vary by the type [27:05] of equipment [27:09] » and a chiller is not an appliance. >> Okay. [27:19] What's the distance on the other side? >> 46 [27:32] technically [27:39] it's commercial all the way both sides of property. [27:42] residential, which is understandable. [28:10] » The only that we can do to possibly move this along to ask [28:19] for those two right so you don't have to go [28:23] back on a calendar that's what I'm trying to do I was trying to avoid that [28:26] if possible [28:36] » but now does he have preliminary does he have to go on the [28:41] calendar rotation versus contin [28:53] » I'm >> all right. [28:54] » I'm I'm I'm determined to get this finished no matter how long it takes. [28:58] » The board's trying to help you. The board's trying to help you. [29:01] » Yeah, I get it. No, I get it. >> You know [29:07] that we can do ask to [29:11] » yeah I would ask is there any reason [29:15] » wouldn't give him final just with the condition he gets the variance so he [29:18] doesn't have to come back >> no this is what we're trying [29:20] » yeah I would say let's let's go forward with that [29:22] » but again I had made the comment are we setting precedent because we discussed [29:27] this other applications where you know should we and then we're [29:33] worried about setting precedent >> well usually we look at the degree of [29:36] variance I mean these are fairly minor varianes I I don't think you'll have any [29:39] trouble getting and and that's why we we do this. I think it's a good precedent [29:42] for that for that matter. But there are other things where there are larger [29:46] variances and you know then we have them come back. [29:50] » All right. I'd like to have a motion for final with [29:55] a condition that the applicant gets from ZBA. [30:00] » Okay. >> Mr. Chairman, I would just say subject [30:04] to the ZBA approval because um Phrasing it as a condition is [30:10] um technically not right. I would say subject to ZBA approval with all the [30:14] other conditions that you're going to talk about. [30:16] » The rest of the conditions, but it's subject to ZBA's approval. [30:19] » Yes. >> No question about it. Okay. You want to [30:22] include and [30:25] Okay. Uh first thing is a motion to waiver um a [30:30] » motion to wave Aore. >> Okay. Second. [30:33] » Second. >> All favor. [30:35] » Any opposed? None. Okay. Motion for final with condition which include that [30:39] the applicant gets a final from ZBA for the two variances that are required [30:47] » along with other conditions >> subject to [30:52] » subject to ZBA approval. Any other conditions are Orangetown DBA Rick [30:58] Oliver August 5th nine comments. Orangetown DME Bruce Peters August 21st [31:05] one comment. Orangetown Fire July 31st zero comments. I have a letter from Orangetown [31:49] ZBME. Yeah. Rick Oliver, August 5th, nine [31:53] comments. Uh Orangetown DME Bruce August 21st, one comment. Orangetown drainage consultant, Kier Engineering, [32:12] approval, one comment. Okay. Do I have a second? [32:15] » Second. >> All in favor? [32:18] » Oppos? [32:24] Okay. Uh Opposition 541. Okay, [32:32] you have a half an approval. >> Closer. I'm getting there. [32:37] » We'll just keep trying. So, thank you. I really appreciate it. [32:39] » All right. Thank you very much. >> Yep. [32:42] » Okay. Next one is [32:47] Greek Orthodox Church. [33:04] tell us all your names, please. >> Sure. [33:08] » Hi, Justin Ferzano. College engineering on behalf of the applicant. So, um, we were here before the board about a month ago. Mhm. [33:49] » Um we were received a drainage memo right before the hearing. We have since [33:54] addressed that. We appreciate uh Audrey's help on expediting that for us. [33:58] But on uh the 12th of August, we received that approval. So um what we [34:05] wanted to do, what we hope to do tonight is give a brief uh uh explanation of the [34:11] building by our architects and then we're hoping to move forward with [34:15] approvals if the board sees fit. Yes, sir. [34:20] » Excuse me. [clears throat] Good evening. Um, I just briefly want to run through [34:23] the uh expansion of the building. It's an expansion to an existing Greek or [34:28] Greek Orthodox church for the youth and education community center. Uh, the main [34:33] level, which is the uh street grade. Uh the the expansion includes a parish [34:38] priest's office, administrative office, parish council room, a conference room, [34:43] and an event space with warming kitchen for parish events such as lectures or or [34:47] large meetings. Uh the lower level will be used to house the Sunday catechism [34:53] classrooms. There'll be four of those. A youth multi-purpose room, two nursery [34:58] rooms, and the uh supported uh toilets and uh facilities for such events. [35:05] Uh the overall intent is to the addition to match the existing architectural [35:10] features. It's a modern Greek Orthodox church design. Very simple white ephus [35:15] and stucco um cladded building with some blue coping accents at the roof line and [35:22] a quarry stone water table which is the base around the perimeter of the [35:26] building. Um and there'll be arched windows that are kind of replicated [35:30] throughout the facility. Um I do have a colored elevation Yeah. [35:35] » Can we Sorry. Can we share the architecture while he's talking? This is [35:38] a civil site plans. He's explaining the architecture. Just want to make sure [35:42] that's up on the board. >> Yeah. Do we have that? [35:46] » They don't have to I don't believe they have the colored. They have the floor [35:48] plans, but I have a I have a new colored elevation. [35:50] » Do you mind if you do you mind if he shows what he's explaining? Thanks. [35:54] » So, I kind of just kind of just ran through the plan and then started [35:58] talking about the exterior design. So you can see here on this uh drawing, [36:04] we're going to call it D7. The far left side of the plan is the [36:10] existing church. Um you can see with the existing arches, [36:15] the white ephus/ stucco finish and some blue coping. Um to area to the right, [36:21] the lower lower building, that's the expansion. And so again, we've we've [36:25] mimicked the architectural features uh to be consistent throughout the project [36:29] and we've put in a stone base on the new exhibition, but adding we're adding that [36:35] to the existing facility as well. So now you've got one big cohesive um facility [36:40] that kind of blends seamlessly with each other. [36:51] Do you want to see the Do you want the floor plan up to kind of walk through it [36:53] or Okay. >> Kind of interested in the outside. [36:57] » Mhm. >> I think we had an issue on the last [37:01] meeting where I think the attorney was here was [37:06] looking to wack but at that time we couldn't because we didn't have [37:12] that's what we're looking for. >> Okay. [37:14] » So, yeah. gave us an idea what's going on. [37:18] » Correct. So, last time we wanted all the approvals and and the waiver and we were [37:23] deficient of that one drainage memo which we're now complete and [37:27] » hopefully >> let me go through the consultant report. [37:32] » Absolutely. >> Okay. I have a letter from um Orangetown [37:37] OP OPZ uh Rick Oliver August 5th 16 comments [37:44] DME Bruce August 21st 20 comments [37:50] drainage consultant Samson dated uh August 21st it's approved with four [37:55] comments I have a short referred by uh Jesse Copler [38:03] July 29th and I have a response letter prepared by [38:06] Kier Engineering July 30th. Okay. Any questions or comments? [38:15] here. There was a question about the site to [38:20] uh the Palisad Parkway and I noticed that I think on one of the plants you [38:25] you put a note up there you're putting up a fence in that back area to uh [38:33] » there's an existing fence and I believe we decided to install privacy slats to [38:38] make it completely solid. >> Okay. to block any um [38:41] » along the along the >> along the new parking spaces. Yeah, [38:44] that's that's that label right there that you could see up privacy slats. So [38:48] that that gets installed onto the chain link onto the onto the fence and that [38:52] prevents any uh headlights from shining through. [38:55] » And that's going to how long is that going to be? [38:58] » The entire run of the new parking spaces where those where [39:01] » just where the parking >> where the where the two arrows Yeah. [39:04] where the two arrows are pointing. That's the start and finish [39:08] » along along the palisades. >> Right here, the headlights, [39:13] » right? Yeah. >> Okay. [39:14] » So, on the rendering, >> on the rendering that you had of the [39:18] front of the building, where is the second story on here? [39:23] » It looks like all one story, correct? Yeah. So, so the second the upper level, [39:28] if you will, is is at grade. So from if you're standing on the main street [39:32] looking towards the building, you're looking at the upper level. The [39:36] classrooms are it drops down because the property drops off to the back. So the [39:40] the lower level is really a kind of a walk out if you want to describe it. [39:44] » Okay. All right. I have nothing further right now. [39:47] » My question is >> Yes. Do you have a rendering of the rear [39:51] of the building? >> We have the We do not have a colored [39:56] rendering. We have the elevations that were previously [39:59] » you have a drawing of the rear of the building. [40:01] » Yeah. [40:36] Okay. Sorry. Yeah. So, elevation uh sheet D6 on the original sub. [40:40] » All right. Now, what's the is the architecture on the outside similar to [40:46] the front? >> Continuous around all all sides of the [40:48] building. And you're going to have the uh brick along the bottom in the back as [40:51] as well as the front. >> Correct. You have Y. [40:53] » Okay. Um now when it goes out to uh the fence, you're putting in slats, right? [41:01] » What what's the color of the slats? >> I said green, but I don't know. [41:10] » I think I think we discuss we discussed green, but if there's a preference, I [41:16] think they have multitude of options. >> Would you? Okay. Does that mean we're [41:22] voting on the um on the architecture and the the landscaping as in in lie of [41:30] sending it to Akabore. Uh that's why we've had renderings. Now [41:35] on the landscape plan, I was looking at that [clears throat] and [41:41] uh one of the questions I'm look looking at the landscaping plan [41:47] is what plantings are we putting in wall? All we doing is putting the slab [41:52] plant are we planting anything back there in addition? [41:57] » I don't think so. [42:01] » No, we didn't want to cover the the stone. Um we're probably gonna have um [42:05] less >> he's asking by the by the privacy [42:08] » slats the fence along. >> No I think I think it was contemplated [42:13] to try and block it with vegetation but then we ultimately decided that the [42:16] privacy slats are the most efficient way to block the light because if you do all [42:22] if you do shrubs and hedges you can you can do that but some light might spill [42:27] through. This is going to this is going to completely block the headlights. [42:30] » Okay. along the front. Uh >> there's there is landscaping proposed um [42:36] along the along the front facade there, >> right? Are you talking about um most of [42:41] it's going to be the >> shrubs shrubs, ground cover and one [42:45] ornamental tree? >> Okay. The um variegated lily turf. Is [42:50] that the one that's going to be going? >> The lily turf is ground cover. That's [42:54] that's ground cover. And then there's some evergreen shrubs. And then there's [43:00] a one there's one uh Japanese maple tree >> that ground cover that's going all the [43:05] way along the front on the street line along the front by the of the building [43:09] by the parking. >> Yeah. [43:11] » So it's it's annotated as a >> Lim. [43:17] » Yeah. >> And you could see it's called out right [43:20] kind of right in the front of the >> Right. You have you have it along the [43:23] street line. You have it along the uh the parking areas. They have it along [43:28] the back fence also. That's what I'm looking at. There's 67 [43:32] of them. Okay. [43:37] Okay. [43:45] Lighting plan. You're not proposing any new lighting? [43:49] » No. >> Okay. So, the current lighting is [43:51] sufficient. >> We we upgraded like three years ago. Our [43:55] our parking lot. So it's sufficient. Yes. [43:59] All right. Now, um [44:10] the ADA parking uh on the reply from uh Kalas, it says [44:18] uh discuss deter uh discuss and determine the [44:23] location of the ADA uh required spots for the zoning officer. [44:30] No, that's that's that's for us because that's not a zoning issue. That's a [44:37] thing. I think the the concern was that you have one, two, three, four. You have [44:44] five spots, but it's on the other side of the driveway. [44:47] » Mhm. >> Am I correct? [44:49] » Yeah. So the the ADA parking spaces have to by law be the most accessible [44:55] uh close to the means of >> but it's a dangerous situation. They got [45:00] to cross the uh the roadway there. Uh now originally in your previous plans [45:07] right next to the porch you had two ADA spots there. [45:12] You also had uh [45:16] I see around the others these two >> right here. Those were ADA spots in the [45:20] in the old building. Was there a reason why they were changed and no longer ADA [45:24] compliant spots? >> Jesse said that he you know he was a [45:30] striping thing that we could just stripe it that way and he would he would [45:34] comply. [45:37] » We stripe those as ADA. No issue striping what um what was [45:41] requested. >> We can make those ADA if that's a [45:43] concern. Yeah. >> Okay. So those would now become ADA [45:47] spots. >> Yeah. Um it would become one ADA spot in [45:51] a in a drop off striping. >> Okay. [45:55] » You need eight feet for each 8 foot for the space, 8 foot for the drop. Now, um [46:01] because the uh looking at where you have the ADA parking, those spots are not too [46:07] they're not large enough. >> I see that. [46:09] » What I'm um suggesting was just looking at it, you have another ADA spot as you [46:16] go by the electrical box. >> Mhm. I see that. [46:19] » Now, we have one spot there. Uh there's no sidewalk there. [46:24] » There is there appears to be next to the drop off. You're talking about the ADA [46:29] spot that's by itself with the striping next to it. [46:32] » Um, not by the p the porch. No, not the por. [46:36] Oh, yeah. I'm talking about that spot there. [46:38] » What about this one? Right. >> Yeah. [46:39] » So, this this looks like a sidewalk right here. [46:41] » Sidewalk. This starts right at the spot there. [46:43] » So, you drop off, you get out in the striped area, and you have direct access [46:47] to the sidewalk that brings you around. Um [46:51] was wouldn't it be well it's a recommendation to uh move the ADA spots [46:57] over to this location and put in a a sidewalk there so they could comply [47:03] without going out to the street. >> This is this is sidewalk here. [47:06] » Yeah. No, no talking right next to next to the one that they have [47:12] there. So >> thank you. [47:15] Other words, right now you have one ADA spot here, right? [47:20] » Would it be possible to extend the sidewalk out and put all your ADA spots [47:26] here? >> This way, nobody has to cross the [47:28] street. >> These spots could become regular spots. [47:31] » It depends. That looks a little steep there. [47:36] » You see topography, but >> Yeah, they're most likely they're [47:39] located where they are because that's a nice flat area of the parking. [47:42] » Yeah, but it's >> right there. But it's it doesn't uh [47:47] it's not as safe as it should be. There's no sidewalk there [47:51] » on the bottom on the bottom by the uh the loop um closer to the palisafes. Um [47:56] this is where most of um our elderly park [48:00] » back here >> back. Yeah. Well, those are those are [48:02] new spots, but do you see the three little spots um opposite them [48:07] » towards the new building to the right? >> To the right. [48:09] » The back of the building. >> There's a circle. [48:11] » Come over towards the right. Yeah, those >> those um because we have the elevator, [48:14] most come in through that um through that those entrances actually right [48:19] there and it's it's very lightly trafficked anyway. [48:23] » So, >> is there is there a sideway access right [48:25] there that we can stripe the middle and make that two ADA spaces? [48:29] » They could share the stripe in the middle. [48:32] » Yeah. >> Yeah. [48:33] » Like that idea. >> That's a nice flat area. We could do [48:36] that. I think that's a better solution. And that way you'll give that way we'll [48:39] have access to the park. [48:44] That way if someone makes their way down there by accident, [48:48] they still have an opportunity to have accessible entry. [48:51] » They said become two ADAs there. >> Yeah. [48:54] » What was the uh I forget the requirement. Was it six or eight spots? [48:58] » I believe six. >> So one [49:05] » that's four. You just need two more spots. [49:13] » You put them next to that one that's by itself and just extend the uh sidewalk. [49:19] » Yeah. They're saying though, that's where [49:23] » Well, >> well, I'm sorry. Here. I think I think I [49:25] have a solution. If if you >> Yeah. Oh, go back. Okay. [49:29] So if I was if I was making this ADA compliant, what I would do, [49:35] sorry, is I would stripe this. >> Yes. [49:38] » One, two. >> This stays three. And then I would [49:42] stripe this one and this one. I have four, five, six. [49:46] » Well, no. If you use those other two spots next to the porch. [49:50] » Well, yeah. Or or Yeah. Or or we could also put [49:53] » one there. >> Have seven. We could do seven then. [49:59] If you put two up there, what about putting two in here? You still have the [50:03] uh >> No, I I don't think there's a [50:06] » I don't know. >> There's a there's a little [50:07] » You'd have to walk around. That would be on the right. On the right, they could [50:12] access it relatively easy. >> Walk all the way up here then to get all [50:15] the way. >> You see those stairs there? [50:17] » All the way to the right um is a relatively easy access, especially with [50:21] the new building that's going to be fixed up um along the road. um will be [50:27] you know much more accessible but we didn't have that planned as ADA but it [50:32] could be >> what you talking about that lowest that [50:35] lower level down there >> so let's do this here let's do this [50:38] we'll do stripe this and stripe this one that gives us one two three we have four [50:45] » right >> we'll do one here with a stripe and then [50:49] we'll do six >> you could do two up there in that spot [50:53] at the back >> we can but we don't need to we need six [50:55] All right. So, we're going to do one, two, three, four, five. [50:58] » That have to cross the street to >> Well, one less one less here. [51:01] » Yeah. So, you have two up there. >> Okay. One we have there. [51:05] » Three. >> You have one there. That's four. So, you [51:07] need two there. >> Yeah, I think that works. [51:22] » I just mark it up for you. [51:28] I'll leave it here. >> Yeah. Yeah, absolutely. [51:31] » Okay. >> Yeah. If I can add as a legal adviser as [51:33] well, I mean, if you're going to grant final, you need to see it and approve as [51:39] modified. So, >> before they vote, mark up something [51:43] reflecting everything that was just said. Absolutely. Because I think the [51:46] people taking notes here, you're saying there, there there's [51:50] taking notes. I know. >> I I'll mark it up and then he can [51:54] » Let's have something marked up and you vote on what's marked up. [51:57] » Okay. So the the two in the back, there's three spots there now. That [52:02] would be made two spots. Correct. >> Correct. [52:05] » Then the next one would be you still leave the one where it was. The one next [52:09] to the porch would become one spot. >> Correct. [52:12] » Correct. >> Two by itself would become one. [52:15] » Right. So that's four spots. And then you'd put two on the other where you [52:19] have the five spots. Now you make 2 ADA. [52:33] That will give us six. [52:52] » Today is >> Let's just make sure. Let me add middle [52:54] laser just for a second. >> Of course. [52:58] » So, what we're talking about is this is going to become two [53:01] » striping. This is going to become one with striping, right? [53:06] » This is going to become one. That'll stay. That'll stay the way it is. [53:09] » This is going to become two striping, >> right? [53:19] » Just signed it. >> One, one, two, two. [53:22] » That's it. >> Okay. Okay. It sounds good. [53:24] » Love it. Pass it on down. [53:36] Um, thank you. That's all the questions I have at this time. [53:39] » Thank you, sir. >> Questions? [53:41] » Can I see the uh the rendering? I was just looking at the current [53:46] picture of the structure right now. So, it's the it's currently white and has [53:51] blue, I guess, accents. The facade. >> You said something about stone. [53:57] » Okay. All right. So the the facade what it is currently now the new structure is [54:01] going to have the same coloring. It's going to look like it's all inclusive [54:04] all same color same build. It's going to wrap around all the way. [54:07] » Yep. The only thing that the existing building tower [54:15] off [54:24] » and it'll be consistent on all four. >> All right. Thank you. [54:28] M. >> Yeah. And so you mentioned the coping [54:32] would be in blue. >> Yeah. So at the at the top of the roof, [54:35] the metal coping that's one that's kind of a kind of Greek blue, if you will. [54:40] » Like a real blue. >> Yeah. Blue. [54:41] » Yeah. And uh the doors are going to match existing. What do you [54:47] » Yeah, these are these are would be >> Yeah, we we already have the blue coping [54:52] on the current building, so it's to match. And the doors are wood doors with [54:56] like insets like this. It doesn't show it there, but they're they're like this. [55:00] » They'll be raised panel >> raised panel to match existing. And then [55:04] the the window trim, the mullions are >> there'll be a clear anodiz which is kind [55:08] of a matte silver. >> Okay. [55:11] » We currently have it on um and it's just going to m and the [55:16] sides of the church it'll just match those. [55:18] » And on the rear elevations, the same >> we same. You're gonna continue the same [55:23] the same treatment on all sides. It's not like [55:26] » not just the back is you know plywood or what? [55:30] » Yeah. No, I just think because if we're waving aore if we are potentially waving [55:34] a we might as well ask theore question. >> That's a great question. [55:38] » And then the landscape I understand the you're going to keep it a spare [55:42] landscaping just to >> allow the stone and the [55:47] » building >> stucco to sing. Um and so there's Not [55:52] really a landscape plan above and beyond what you were suggesting. [55:56] » Just a few shrubs. Yes. And keeping was there. [55:59] » Correct. >> This this was always like planned, [56:02] remember from like the building of the original structure. Yeah. [56:05] » So that's why it kind of was even the lighting that we originally installed [56:09] with that parking was in mind with this eventually coming. [56:13] » So that's that's why. Well, it's a little bit it's about half the size we [56:16] planned, but >> And then the fence, you're not you're [56:20] not expanding the fence. It's just the existing fence that we're just getting [56:23] the green slats >> slats in the slats. Yeah, correct. [56:26] » Yeah, I mean I think it looks great. Um, so I don't have any other question. [56:31] » Thank you. >> Yeah, [56:36] one of our founders [56:40] motion public >> motion to open public portion. [56:45] » Second. >> Second. [56:46] » All in favor? I. >> Anybody from the public wish to speak on [56:50] this? One more time. Anybody from the public [56:53] wish to speak on this? Hearing none. A motion to close. [56:56] » Motion to close. >> Second. [56:59] » All in favor? >> Okay. Um, [57:06] a motion to um [57:13] » I don't know the words to not let them go to aore motion to uh [57:18] » wave >> wave [57:19] » wave aore you have to ask for it. Do me a favor. We would like to wave back or [57:23] request a waiver from Aabore. >> Motion to wave Abor [57:26] » because we have reviewed the plans. >> And approve the plans as given. Okay. Do [57:33] I have a second on that? >> Second. [57:35] » Okay. All favor. >> I. [57:37] » Any opposed? >> Okay. [57:40] » Motion to wave lighting plan. >> You probably should do SRA first. [57:45] » Add that. >> Do Sra first. [57:46] » Okay. >> We'll add that in. This is a condition [57:49] that they put in the new parking as corrected. [57:52] » Oh, no. The sufficient >> they're not adding any [57:57] » the change >> lighting. I'm talking about lighting. [58:00] » Oh, the lighting. That's Yeah. >> Okay. [58:03] » Did we do lead agency last time? >> Okay. [58:08] » Okay. Motion for lead agency. >> Second. [58:12] » All in favor? I. >> Motion for neg. [58:14] » Motion for neg. >> Second. [58:16] » Second. >> All in favor? I opposed none. Motion for [58:20] final with commissions. [58:25] » Okay. Uh we back so that's not an issue. Okay. The other concerns are okay. Town [58:32] of um building department Rick Oliver August 5th has 16 comments. [58:37] Town DMD Bruce Peters August 21st has 20 comments. [58:42] Orange Town Drainage Consultant Weston Samson [58:46] uh dated August 12th. It's approved with four comments [58:52] and that's it. Okay, >> Mr. Chairman, I would also note that ADA [58:57] parking as reflected on the markedup plan that was submitted at the meeting. [59:02] » Okay. The applicant has agreed to change the ADA parking as to the plan that he [59:11] drew up and submitted to building department as of this date. [59:17] » Okay. Any other there be a motion to accept the plan for the change in the [59:24] ADA parking as uh approved by the uh >> applicant and signed. [59:32] I don't know if we need that. But >> yeah, I made the motion. [59:35] » Okay. All [59:38] » favor. [59:44] » Right. >> Yeah. [59:46] » Okay. Motion to wave a lighting plan. The current lighting is sufficient to uh [59:52] light the uh area. >> Not being modified. [59:55] » Not being modified. Second. >> All in favor? [59:58] » I none. Anything else? >> Okay. Do we have to make some statements [1:00:04] on the um what we're approving as far as the architectural details? [1:00:09] » So, [1:00:21] Okay. >> Yeah. As presented. [1:00:23] » Okay. Motion to accept the architectural details and landscaping as uh presented [1:00:29] by the applicant. >> Second. [1:00:32] » Second. >> All in favor? [1:00:33] » I think we're done. Are we done? [1:00:38] » Anything else? >> So, Bruce Bruce motion final. [1:00:41] » I don't think any I don't think you second or voted on it. [1:00:44] Andy >> somebody. [1:00:49] » No, you jumped. >> Second. [1:00:51] » Do I have a second for? >> Okay. All favor? I. Any opposed? None. [1:00:56] » Okay, >> now we're good. [1:00:57] » Now we're done. >> Thank you. Thank you. [1:00:59] » Thank you very much. >> Thank you very much. God bless you. [1:01:01] » Have a good night. >> Thank you. [1:01:03] » Good luck. [1:01:08] » Okay. [1:01:13] Next one is 228 South Boulevard site plant. Mr. [1:01:19] Brener, fancy meeting you here. >> He had his yeses. He doesn't get any [1:01:24] more now. [1:01:41] Mike Khesi, engineer for the applicant. [1:01:52] » The expansion of the commercial building subject getting the tools zoning board. [1:02:00] Um, do I need a resolution waving packable? [1:02:07] All he's doing is just putting the same with the same material. [1:02:13] » We do [1:02:16] that. [1:02:30] » Yeah. No, not 15 court. 30 the one I was there. [1:02:37] » Well, I'm asking for it now because I thought basically when you get the final [1:02:41] it was like automatic, but I saw that they asked for a special resolution. So, [1:02:46] I am requesting that resolution. [1:02:58] It's It's same building, same box. At the back of it is the Orangetown SL [1:03:05] treatment entirely. >> Well, I just want to make sure legally [1:03:09] we're okay. [1:03:12] » If the board wants I I don't know what the board wants to do, but I'm just [1:03:15] saying [1:03:25] No, there's actually no public comments. [1:03:30] » And he did state the trees that you wanted if you remember correctly. [1:03:34] » So, we should go ahead and ask he's going to ask for a wave. We should [1:03:39] granted or not granted >> or reopen. [1:03:42] » Motion to reopen 30 corporate drive. >> Second. [1:03:47] » All in favor? I done uh a motion to Oh, Mr. P, you have to ask what you asking [1:03:55] to do. >> Requesting a motion that we wave [1:03:57] appearance before Rakavore. >> What reason, sir? [1:04:01] » Reason is that it's the same building, same material. It's going to be on it's [1:04:05] a warehouse. We talked about the trees around the building [1:04:09] when the M Mr. uh I'm in great shape. Was it not Mr. [1:04:16] Mandel? Mr. Andy. Okay. And Andy requested that um [1:04:22] certain trees be planted, the Carnic tree be planted, and the back of the uh [1:04:27] is the sewage treatment plant town of Orangetown. [1:04:35] Applicant is asking for a waiver going back to [1:04:41] Did you get all those notes? >> Good. [1:04:47] Motion to wave Abora >> for 30 [1:04:52] 30 corporate drive. Do I have a second? >> Second. [1:04:56] » All in favor? >> Okay. So, [1:04:59] » okay. Now, which one are we taking? >> 228. [1:05:12] » Too many papers over here. [1:05:26] Yes. [1:05:57] Are you waiting for me? >> Yes, sir. [1:05:58] » Oh, sorry. >> I don't know what you want. [1:06:02] » One final. >> We We We appeared before a [1:06:06] » Well, you got to talk to me. >> We appeared We we appeared before your [1:06:10] boy. We got preliminary. Then we went to Akabore. We appear before Aabore for all [1:06:15] four of the items we've taken. This one got approval from Akabore [1:06:21] from the Aabore board and now we're here for final. [1:06:24] » Okay, let me go through the consultant reports and we'll see what we can do for [1:06:29] you. Let me get through some of this paperwork. [1:06:36] Okay. I have a letter from building department [1:06:41] Rick Oliver dated August 6th with 12 comments. [1:06:46] I have a letter from Orangetown BME Peters dated August 21st nine comments. [1:06:53] I have a letter from Warstown Fire dated July 31st. One comment. I have a letter [1:07:00] from Warstown plan review Paul Gansky dated August [1:07:05] second. with three comments. I have a letter from town drainage consultant [1:07:10] Weston and Samson dated August 6th which says approved with two comments. I have [1:07:17] a short EAF sign Aaron Sass dated May 28th 26 project narrative from Mr. Ber [1:07:26] at the time of the application. [1:07:30] » Oh no I screwed up. I'm sorry. [1:07:36] Yeah, [1:07:39] » we'll do I'm gonna screw everybody up. 214 I read it all in [1:07:47] Mr. Bren [1:07:52] first. What's the difference? [1:07:58] » Okay, questions or comments? [1:08:10] So refresh my memory. Why is Mr. Brener [1:08:15] back? >> Because he didn't give me finals. [1:08:20] » Okay. I have nothing right now. [1:08:24] » Okay. >> Any questions? [1:08:27] » Yeah, several questions. Um going back to the preliminary uh [1:08:32] decision that we gave you on April 15 to 26 on page 8 to 16. Number two, height [1:08:39] of retaining walls. This is variable on the plan still. Number three, air [1:08:45] plantings on ement area on the south side not shown on the plans. Is there a [1:08:51] reason for that? >> We uh we put a separate on sheet 208 [1:08:56] with a separate retaining wall. like we've discussed. [1:09:04] » It gives you the height of the walls. >> You just have to subract. [1:09:07] » No, no, it says you got to height of the walls. [1:09:11] » Okay. [1:09:16] » We did do a separate plan as requested. We did put the spot elevations, not the [1:09:20] heights. The heights also are subject to change based on [1:09:24] » I know it's variable, but we did ask for the heights. [1:09:28] the top and bottom sufficient but we can add that to that detail that's not [1:09:39] » okay and the plantings uh number three we said they're plantings to the [1:09:45] easement >> sorry [1:09:50] the conservation easement what plans we looking at the ones from 415 still or [1:09:56] the We did call out the plans for the plant [1:10:00] within the conservation the species type in [1:10:05] the bottom planting schedule. We also were hoping to be able to put in [1:10:13] the field [1:10:17] location because we didn't want to potentially have a problem with anybody. [1:10:24] because it uh that's what we asked for and that was how the condition was [1:10:28] written to put it show with it in the conservation ement. We added we added it [1:10:33] to the planting schedule at the bottom trees for conservation [1:10:39] types of we have which page this I'm sorry this is page [1:10:45] five [1:10:52] you show I see the planting schedule up there uh [1:10:57] something [1:11:01] If you read note number four, proposed tree location within conservation [1:11:05] located within with town representatives to determine the best location trees [1:11:11] with regards to the tree health and the neighboring property. [1:11:16] That's number five in the planting. >> Is that something that the town does go [1:11:20] out and help them plant? >> Well, this is kind of unique. This [1:11:25] project is unique. thought it's the wise thing to do [1:11:29] because of what we inherited [1:11:35] » to have a comment from the building department. [1:11:37] » I would say it's very unusual but uh if the building department is willing to uh [1:11:43] go along with that >> so I mean you're calling for someone [1:11:47] from the building department to go out with you and pick the locations [1:11:49] » but we will st it I'm assuming they would just simply st the tree locations [1:11:54] prior to them being installed if they appropriate. We just didn't we're not [1:11:58] located everybody's house, everybody's deck, anything that they have on the [1:12:02] adjacent property. We just didn't want to put them in a spot on the plans that [1:12:07] we would have one of the neighbors. >> So, if you want, I can put them on the [1:12:11] plans. That's not a problem. But once again I can't say that they would be in [1:12:14] the best location suited suited as per you know as per not only the the [1:12:20] conditions of this conservation ement but the condition the the view sheds of [1:12:25] the neighbors but that would be the function of an arborist [1:12:31] landscape architect. >> Yeah [1:12:33] » I don't think we have any landscape architects in the building department [1:12:36] that I know. Nope. >> We can show them on the plan. [1:12:45] » It's just that there were conditions from the last meeting that we asked to [1:12:49] be done. >> We were just concerned about the [1:12:51] neighbors. >> That's fine, but it's you should have a [1:12:54] landscape architect. Now the and the other thing is that it goes for 214. and [1:13:00] also goes for 220 228 [1:13:04] is DEM's number one plan still depicts the road widening easement along South [1:13:09] Boulevard. However, the town cannot accept the road widening easement. The [1:13:14] widening must be dedicated. The road widening shall be correctly labeled and [1:13:19] all drawings in detail with full mets and balance of the widening shall be [1:13:23] added to the drawings. Lastly, a formal road widening deed shall be submitted to [1:13:28] this department. any attorney's office for review and approval [1:13:31] » that that we will agree to. We usually give easements or dedication. We don't [1:13:38] have a problem. We can make the dedication. [1:13:40] » Well, the the thing is these roading easements, it'll also affect now your [1:13:45] front yard setback. So, these lots were predetermined by the village of South N. [1:13:51] They took them as ements, I believe, not to get rid of their front yards, [1:13:57] right? Because right now, you 214. [1:14:00] The front yard to the porch is 20.8 ft from the property line. But if you take [1:14:05] the ement of 11 ft, now you're going to have 9 ft. And these easements have [1:14:10] already been filed and recorded as part of the original subdivision and [1:14:17] not anything that we've done. So to abolish the ement, make it a [1:14:23] dedication. Now you're going to have a 9 foot front yard. [1:14:28] the front porch plus approximately 9. [1:14:36] Now we we have other properties even in Orangetown which have the same [1:14:40] situation. We goes way back when we have Cam Shanks [1:14:45] when they dedicated certain areas. We have the White Street and Independence [1:14:49] Avenue where it comes up to around 10 ft from the house. So I think what's being [1:14:56] said Basically, we're dedicating the easement and we're keeping the easement [1:15:03] so that we can keep that where the living South K wants the [1:15:07] building to be. We didn't create the situation. We [1:15:11] inherited the situation. I think that's the best way of handling it because um [1:15:16] and it has it's a precedent has been done before. You go right up independent [1:15:21] s. >> It was well before my time. Well, I know [1:15:24] you know was before mine, too. But I I did research it. [1:15:30] » So, I'm sorry, Mr. Mando. Is that uh Mr. Dean's letter saying that? [1:15:35] » Well, that's uh um Bruce's [1:15:40] » and and what does Bruce say? What does Mr. Peter say? [1:15:44] » He's saying uh how he reads I'll read it back. Quote, "The plan still depicts a [1:15:49] road widening east middle along South Boulevard. However, the town cannot [1:15:53] accept the road widening easement. The widening must be dedicated. The road [1:15:57] widening shall be correctly labeled on all drawings and the detail with fulls [1:16:03] and bounds of the widening shall be added to the drawings. Lastly, a formal [1:16:08] road widening deed shall be submitted to this department and town attorney's [1:16:12] office for review and approval. >> That's on two lots. [1:16:16] » Did m Did Mr. Dean have any comment? I mean that really is his purview. [1:16:22] » No. >> Okay. I think the issue though is um [1:16:26] again that's highway's purview, not so much dee. [1:16:30] But Mr. Peters is probably right. It's not going to be a public road ever [1:16:34] unless that's accomplished. >> Are they on a main state? It's a public [1:16:40] road right now. >> Oh, it is listed as a public road. [1:16:44] » This is South Boulevard. >> Okay. [1:16:46] » And and the problem is where these I don't know what they planned in the [1:16:49] future when they did the original subdivision, but they're, let's say, [1:16:53] they're basically landlocked. You have separate ownership on both sides. So, [1:16:57] you would need either a taking by the town or additional easements to do any [1:17:01] improvements to South Boulevard. So, the these these were filed. The [1:17:06] meets and bounds from the file map is shown on the plot plan for a lot. So, [1:17:11] the these easements were already accepted once by South Nyak. Yeah, I [1:17:16] think this is one of those problems where South NY with the way they handled [1:17:20] the subdivision, we're kind of locked into um having things the way they are. [1:17:25] » A burden on us now. What do we do with it? [1:17:30] » I mean um >> it is a registered street. It is a if [1:17:34] you look at the the state map is a registered street called South Nike reg. [1:17:41] So the town is not being penalized in any way. It is a registered street. [1:17:46] Well, we told we would do it times where we had to finish it off. I think not all [1:17:51] of them were finished off. >> No, no, that's that's the other roads [1:17:53] that you have will. [1:17:58] But this here on south is an existing road. It always been an has been an [1:18:03] existing road. These easements at the time of the original subdivision were [1:18:09] were accepted by the village of South N. I I don't know what you could do with [1:18:15] it. I don't know what it what a how a dedication of it would even benefit the [1:18:19] town. You have the easement now for road widening purposes. That was the purpose [1:18:23] of the easement >> and this is on the state register as [1:18:27] being state being an accepted road. >> Yeah, I would say um it's up to this [1:18:36] board. Um you don't have to make Bruce Peters that one comment by Mr. Peter's a [1:18:43] condition you know and I would say given the history of this and the fact that [1:18:48] the subdivision was approved as it is it is a public road the easement was [1:18:53] required and it was filed >> because normally we don't as you know we [1:18:58] take our consultants we don't you know override them that's why we're [1:19:03] looking at help from you >> right [1:19:06] » want to do the right things >> and again the only um condition that you [1:19:11] ever have to override ride. That's a technical term is the county planning [1:19:15] your own Orangetown people. You don't override. You have perfect authority to [1:19:21] accept or not accept any of their proposed conditions. [1:19:24] » Is what I'm trying to say. So what the applicant is coming up with and what [1:19:30] what Peters is saying is kind of two [1:19:34] different things. >> Mr. Brener, if I can ask you, is there a [1:19:37] reason you can't um offer the dedication? Is there reason [1:19:42] » if we like it was explained if we dedicate [1:19:46] then that moves the line so that the front yard is going to be what's [1:19:52] approximately 9 ft 9 ft and that cont's [1:20:09] discretion what you I think is appropriate. [1:20:13] I mean, I if Mr. Dean wanted a dedication and wanted to widen the road, [1:20:19] I would say that would be one reason we would it would make sense to ask for a [1:20:22] dedication, but Mr. Dean apparently is not asking for that and is not going to [1:20:27] widen it. So, >> since I've been on the board, the [1:20:31] highway department has really never given us any direction. [1:20:35] Well, I guess part of the problem is this is a site plan approval and that [1:20:39] would have been done. You know, Jim would have made those Mr. Dean would [1:20:42] have made those requirements as part of the subdivision and he would not have [1:20:46] asked for a easement. He would have asked for the dedication [1:20:53] and this has been done. This is has been done on in situations like this because [1:20:59] this is a listed road in the states. That road right there [1:21:05] It's there. It's an existing road that South had to maintain and take care of [1:21:14] » the road now. >> When when they finish it, kind of kind [1:21:20] of Orange County has to take care of the road [1:21:24] » right now. They have to take care of the road right now. [1:21:31] » An existing road. What do you think? [1:21:38] What do they want to do? [1:21:46] » Are they taking care of the road all the way down to this house or this proposed [1:21:52] house? >> It's a major road. It's a major road. We [1:21:55] have the building really has nothing to do with this. I mean, if it's a major [1:21:59] road and there hasn't been any problems, I don't see why we couldn't override [1:22:06] Bruce's comment. I mean, they're stuck between a rock and a hard place, and [1:22:13] unfortunately, it was dumped on us, but what are we going to do? [1:22:18] I, you know, put the road, [1:22:23] » right? Yeah. >> And by the way, we have done [1:22:28] this border started. Know that subdivision uh on South Main Street that [1:22:33] goes back down on that private road [1:22:40] the rightway comes 9 ft from the guy's house from the steps 9 ft. [1:22:46] Is there is there some way you can move the house [1:22:51] back? We have to get to maintain the proper [1:22:55] setback between the deck and the house. You have a couple feet. [1:23:00] You have a 30 foot rear yard. We may be able to move the back two, [1:23:06] three feet, but that would make going from 9t to 10, 11 or 12 feet on the [1:23:12] porch. You're not really picking up any real appreciable gain by moving the [1:23:17] house back. [1:23:30] It's a 32t rear yard like the front yard. This was a cluster development. [1:23:36] You have a 32 rear yard. Right now we have 33t. [1:23:49] Yeah, I agree with Mr. Andrews. I don't see a problem there. It's a problem that [1:23:52] we inherited >> because we had to take South Nyak. [1:23:56] So, I have no problem with that because that nine yard 9 foot front yard is [1:24:01] ridiculous, >> especially on that road. [1:24:04] » Would be a It would be a danger to the people. [1:24:08] That's my comment. >> Dave, [1:24:13] I'm looking at the aerial shot right now and I see 214 is one available lot. [1:24:17] Looks like there's another one that's south of that. But everything has [1:24:20] developed in the area. Looks like this has been a parcel of land that's been [1:24:23] sitting dormant for a while. And I don't see the point of pushing it back [1:24:27] farther. It seems like everything else is pretty much set in place from the [1:24:30] same distance from the road. It seems like a a problem we did inherit. I don't [1:24:36] I don't see the issue with with the house as is. [1:24:43] I think that the it would be too burdensome on the [1:24:49] property owner. While I understand the desire to have a [1:24:53] wider road, it it's just existing and if you want to do [1:24:57] the least harm, it would just be to not make them lose those 9 ft. [1:25:04] They just don't have it. [1:25:18] Just don't >> just don't put it in. [1:25:21] » Just don't put the comment out. [1:25:24] » Right. [1:25:31] » Rick, does does it make sense to just be very clear why we're ignoring this [1:25:37] comment? Not not ignoring the comment but considering it but [1:25:40] » technically again for overriding and explaining your justification that's [1:25:45] only required for Rocklin plan planning board for this I think the discussion is [1:25:51] sufficient that you had and when you read the conditions in when you vote on [1:25:55] it you would just leave out number one of Mr. Peters's letter. [1:26:00] » I think you do want to hear from the public if anyone here wants to [1:26:04] » Well, we're just uh just trying to get the board [1:26:07] Can you just do me a favor in layman's terms? Can you explain what the [1:26:10] stipulation was made by the how department just so I understand how this [1:26:14] comment was there in the first place? >> Okay. Um just historically this [1:26:18] subdivision was approved decades ago by South Nyak and because uh South Nyak is [1:26:24] no longer in existence by law. We the town of Orangetown has taken over [1:26:30] everything that was South Nyak including its prior subdivisions. [1:26:35] And this these houses had to come back for site plan approval and this is [1:26:40] coming back for site plan approval. Uh Mr. Dean did not submit any letter of [1:26:45] comment on this. Um if he had wanted to widen the road and wanted a dedication [1:26:50] presumably he would have said so and perhaps the board would behave [1:26:54] differently since he has no comment. Uh presumably uh he's okay with keeping [1:27:01] things as they are. As Mr. Brener has said, "We're not accepting the road [1:27:06] widening easement. The easement has been filed decades ago." Is that right, Mr. [1:27:11] » So, we're not accepting anything. We're not making them file an easement that [1:27:15] was done with the subdivision. So, that's, you know, we're kind we're kind [1:27:20] of locked into what South Nyak did with the subdivision, [1:27:25] which is why we're here. So, you had asked about what Highway had said. [1:27:29] Again, our highway depo department has not commented at all about this. [1:27:33] Presumably, the highway department back 20, 30 years ago in the subdivision had [1:27:39] said all they wanted was a easement and that was provided. [1:27:45] Does that answer the question? >> That was well said. I I completely [1:27:49] understand. >> Thank you. [1:27:52] » We still not understand, but we understand. [1:27:57] » Okay. Uh, [1:28:03] make a motion to open to the public. >> Motion to open public portion. [1:28:07] » Second. >> Second. [1:28:08] » All in favor? >> Any opposed? None. Okay. Anybody from [1:28:11] the public wish to speak on this project? [1:28:14] Okay. One more time. Anybody wish to speak on this project? Hearing none. A [1:28:17] motion to close. >> Close. Public portion. Second. [1:28:20] » Second. >> All in favor? I. [1:28:22] » Any opposed? None. Uh, reaffirm. Motion to reaffirm secret. [1:28:27] » Second. >> Second. [1:28:28] » All in favor? >> I. [1:28:30] » U. Motion for final with conditions. Huh? [1:28:33] » Okay. Motion. >> Motion for final. [1:28:35] » Motion for final with conditions. >> Okay. Um, town of Orangetown, Rick [1:28:40] Oliver, dated August 6. He has 12 comments. Town Orangetown DME, Bruce [1:28:47] Peters, August 21st. He has eight comments. for leaving out number one [1:28:53] comment of his August 21st letter [1:28:57] » which leaves how many? >> Huh? [1:29:01] » Okay. So, we leave eight comments. >> Yeah. [1:35:07] Um, so I just wanted to go on record to um maintain that I I feel as if too [1:35:13] large of a house is going on too small of a property. feels a little [1:35:17] shoehorned. I I realize that you [1:35:26] have a lot of um experts that maintain the other direction, which is just fine. Um, I live across the street from where the developer will be [1:36:47] building the house. And we do have a view of the river and the bridge and I [1:36:51] was just wondering if maybe you could clarify how high the peak will be. I [1:36:56] know it's going to be about 33 feet or 30 feet. Um, I know it's all set in [1:37:01] stone, but just a slight request if it could possibly build be built not too [1:37:07] much higher than our view allows. I'm not sure if that could be asked now or [1:37:13] » you have any idea what the height of the >> building [1:37:21] look [1:37:25] really at this point it's it's hard to sight. I have a short EAF prepared to Aaron Sassin uh owner May [1:40:17] 28th, 2026 and a project narrative. Don Brener [1:40:23] Andy question. >> Yes, sir. Yes. I want to go back to Mr. [1:40:28] Majansky's letter. Okay. We want you want to talk about that. We [1:40:35] had a problem in that area on Saturday night [1:40:42] and a tree came down across the road. [1:40:49] couldn't get in touch with anybody. I personally with the owner's permission [1:40:55] got a contractor out there and remove the tree showing that we want to get it [1:41:00] done. And what we did is we're going to we have pictures for you to show you [1:41:05] this road has been paved for years and years and years and the fire department [1:41:11] comes down that road every year and checks it out. So the road is that size. [1:41:17] The fire department has used it and runs ex [1:41:23] every year. >> The owner of directly [1:41:28] road [1:41:34] because I know in front of them they were out there. [1:41:41] But I'm just saying this is back years or so ago. I know they were out there [1:41:45] paying the road. [1:41:48] » No, but I know Mr. Manski was worried about certain things. He was worried [1:41:52] about the fire truck. He was worried, can it get through? And the fire [1:41:55] department's been the only thing in South Na has been checking it out every [1:42:00] year. They run their equipment across the road and the road is open and paved. [1:42:07] » Who paved the road? >> Was paved [1:42:11] » by the owner of the property? >> The owner in that house. They didn't [1:42:15] verify it, but the the lady across the >> road [1:42:21] also she's looking for the town to take over the road because it's not listed as [1:42:25] a private road. Her deeds do not extend to the center line. It does not have a [1:42:29] separate tax. So she's quite anxious to get the town [1:42:35] over the responsibility. >> What's the role? [1:42:40] » It varies, you know, like I said, part is about what [1:42:46] » I'm going to say the surveyor is going to go out there just to locate it [1:42:49] because the uh we were asked to do so at the PRC [1:42:52] » right >> just as a quick pacing measurement I got [1:42:55] about 16 18 ft >> it's required to be 20 [1:42:59] » 20 [1:43:05] we have we have roads in the town that are 16 18 ft they are roads [1:43:11] these are existing roads this road is paved from [1:43:16] to Chase. It is a paved road. It was our [1:43:22] understanding at the PRC that as long as it wasn't a dead end road where a fire [1:43:27] truck would have to back up. This would be [1:43:32] somewhat deemed acceptable because it's not a a dead end. [1:43:43] the principal >> different from helping you too much. [1:43:47] » I believe that discussion was had at uh PRC. Was that right? Yeah. I was sitting [1:43:51] next to Mr. Majeski when that discussion happened. [1:43:55] » I would say more or less that's an accurate description of the discussion [1:44:00] that Mr. Majeski would work with them. But I don't know that there's any need [1:44:05] to not follow his conditions. you know, [1:44:10] » goes all the way the road goes all the way down to Bracken. I mean, the slope [1:44:16] of the road is unbelievable, but it does go all the way down. [1:44:19] » Right. So, again, I believe it's accurate to the degree that Mr. Majeski [1:44:25] will work with the applicant and it perhaps may be adequate as things are, [1:44:31] but I don't think that there's any need to cut out any of his his conditions. [1:44:37] Is the applicant asking for a modification of [1:44:40] » No, we we will work with him, but we just wanted to to show that this has [1:44:44] been used, paved, and fire trucks go through it. [1:44:48] » It says if required, Mr. Burner, the last two words on number two, if [1:44:52] required. [1:44:57] » Question. I appreciate the provided, but I just [1:45:02] happened to say this is not a dead end, but I was on the same picture. You said [1:45:06] that. What's the sign right here? It says dead end. [1:45:09] » You can't go by the signage because they put up private road, no parking, one [1:45:14] way. [clears throat] You can't tell by they block the road. [1:45:19] » If you Well, first off, it's not an official sign. It's not an official [1:45:22] height. It's not official size. just [1:45:26] falling down. >> Just trying to drive that road to take [1:45:29] the tree down. >> Somebody put up saw horses across the [1:45:33] road. So, you had to move these obstructions just to get to the road. I [1:45:37] don't know who did it, >> but I can just tell you they exist. Even [1:45:40] at the intersection further down on Barin [1:45:44] » and it just appears that people like parking on the road, so they don't want [1:45:48] to they don't want to make these roads more public, shall we say. [1:45:54] Well, yeah. Even if you go down to the culdeac on Bar and you'll find trailers, [1:45:58] you'll find campers, you'll find everything parked up along through the [1:46:01] the culdeac of barrage and they're not owned by the applicant. [1:46:08] We we did we did say we spoke to highway superintendent, we once this is [1:46:15] approved, we're going to go through and get the rest of the subdivision done and [1:46:19] one application and we will put up private [1:46:24] to try to get these people off the property. [1:46:33] » Oh, they're going to love that. [1:46:53] I said last meeting that uh that the measurements for the roadway was [1:46:58] supposed to be taken and put it put on the uh site plan. So we knew if it was [1:47:04] 18 or 20 or 19 or whatever that the attorney can come to that turn. [1:47:13] Yeah, but how many years that firm been there? And how many times has the fire [1:47:17] truck going up and down without a problem? [1:47:21] » That's uh I mean it was paid by the woman who lives there because the the uh [1:47:27] the hill above her is every time it rained. [1:47:29] » Yeah. >> She wound up with uh the dirt and [1:47:32] everything blocking her driveway. So, she had it paved. [1:47:36] » She's also the one who told me that fire department does she said their biggest [1:47:41] truck around [1:47:45] the fire hydrants on the road. >> There's a fire hydrant that I know of at [1:47:49] the intersection of and and college right on the I'll [1:47:54] [clears throat] call it the southwest corner going up the hill. I believe [1:47:58] there's one closer to Chase. >> Where is it? Where is Where is it in [1:48:04] reference to the property? We have one right here. [1:48:08] » So, it's closer to the property. Oh, >> yeah. Yes. [1:48:12] Fire checkers must go up there and check the fire hydrants. [1:48:17] » No, that's under the control water. >> Pardon me. [1:48:23] » Water provides the water. [1:48:28] » That's not over because it's not water. >> Yeah. But doesn't a fire department go [1:48:34] up and check the hydrants? Yes. Okay. So, that's what I'm saying. [1:48:38] » I assume that's why they run the truck up there. [1:48:41] And how is there any part of that road that's as narrow [1:48:46] as where you are? >> You say 16. [1:48:52] It appears to be a little narrow. Like I said, just rough measurements. [1:48:56] The surveyor was going to go out and just locally [1:49:08] [clears throat] this this portion of the road up here [1:49:10] because according to the res. She has issues with stuff like that [1:49:18] because they won't go down because >> the hills like that. [1:49:22] » No, she's saying it's not even it's not even a pitch of the hill. [1:49:27] the condition of the road. [1:49:35] And part of the thing is she has trash out [1:50:02] concern moving forward. I know that [1:50:12] is address [1:50:21] and now we have [1:50:29] problem [1:50:33] forward. >> Well, I think what we're talking about [1:50:37] now is not a public road. Correct. This is a private road. [1:50:40] » No, I as far as we can tell, it's not a private road. [1:50:44] » This is a public road as well. >> Well, if you look at Willow, right? [1:50:48] Right now, Willow has a tax number, right? Willow would be under private [1:50:53] ownership. >> Well, m Mr. I mean, if it's a if it's a [1:50:58] public road, it's listed with the state and it's on Mr. Dean's list. [1:51:02] » What was said here is that when he acquired the property, he made a [1:51:07] statement to the town and Mr. [1:51:13] that was missing in the road. The utilities are in, the drain is in, the [1:51:17] sewer is in, the curves, everything's in. He said he would cap the road to the [1:51:22] town specific. And that's really what we're trying to do. We're trying to get [1:51:26] going. >> So, Mr. Brener, is it your understanding [1:51:30] that this is a town road or it's not a town road yet? [1:51:34] » I don't know what it is. The one area that needs to be capped yet [1:51:38] that area I don't think that's turned over to the town because it won't be [1:51:42] until it's >> it was dedicated by deed and subdivision [1:51:47] plant to the village of South [1:51:53] » all these areas were dedicated >> because how how can that be man stick [1:51:57] out an edge? How could the town plow it? town does not plow [1:52:03] » and and South KN did not plow it. In other words, the people that live there [1:52:07] plow it. >> Okay. One thing to keep in mind is even [1:52:11] though it's been offered for dedication does not make it a town road. It has to [1:52:16] be there needs a town board resolution or South Nyak resolution saying we [1:52:21] » could not find South. We know the town did not accept it. Okay. And the reason [1:52:28] we made when he started the project is that the build he will cap the road to [1:52:34] meet the requirements of the town specification [1:52:37] that he committed himself. >> The only thing I know a deed has been [1:52:41] filed dedicating the road to South KN South KN signed off on the deed. To me [1:52:47] that's an acceptance of the road once it's completed fully. [1:52:53] » Now you're saying that the owner has agreed to cap the road. [1:52:57] » Yes. He agreed to cap that term. [1:53:00] » This is already This is all Brandon. >> No, no, no. I understand. Is this part [1:53:04] of what he agreed to cap? >> He agreed to cap the road in accordance [1:53:07] with >> any road that I believe required. If [1:53:10] required will if that road is not capped, he's agreed to cap that road. [1:53:16] » Okay. So, if he's willing to cap it, why doesn't he add two feet to it to make it [1:53:22] more make it comp? >> Well, because you can add a foot either [1:53:26] side. principal part of it's tough because you have a stone retaining wall [1:53:30] that runs along this east edge and the thing [1:53:33] » not that I'm talking about. >> Yeah, you see that you can see the wall [1:53:36] right there on the one side. >> We're talking about this turn [1:53:40] » this turn right here. He wouldn't even have to do two feet. [1:53:44] If you want him to I don't believe he'd have a problem widening the road. [1:53:48] » That's the only thing we're concerned of is that turn right there. [1:53:53] That turn is not the rest of the road. We can't do anything about it. [1:53:58] We know that this is the only thing that we're concerned [1:54:01] » with this [1:54:05] area we discussed at the project review. [1:54:19] That's what I was I was going to suggest that we're making a condition that they [1:54:23] work it out once once you get the approval one way or the other and the [1:54:26] applicant agrees to we have to work it out. [1:54:29] » Yeah. However, when we when it was discussed at project review, it said [1:54:35] that there were measurements should be taken to determine exactly [1:54:38] » should >> that should have been done that way. [1:54:41] Would it do we have to have a discussion or we don't have to have a discussion? [1:54:45] That was the whole principle behind getting it measured. We showed the [1:54:48] measurements at the property. The measurements that were being looked for [1:54:52] going up towards Chase, which are not on the property. [1:54:56] » Well, we were looking at the project review was looking specifically, [1:55:01] my recollection at the turn there in front of the property. That's what they [1:55:05] were looking for. >> Three dimensions listed right at the [1:55:07] turn >> and they're short. [1:55:09] » They're short, but that's why we went to Is it a dead end? Because it was a [1:55:14] belief that from this point up it was gravel. So, we went, we took the picture [1:55:18] to show that the roads were actually paved, that it's not gravel, that it has [1:55:23] a traversible surface, and then there's a surveyor [1:55:28] that will go out and get the measurements for Dave to give him the [1:55:32] widths, and we'll try to find the spot of the [1:55:35] » We're only concerned with this turn. That's where your property is. That's [1:55:38] where our concern is. >> At the turn, we should we show hard [1:55:41] measurements that were done by the right now. We have 19 more. But it was the [1:55:46] believe that this was a dead end road and that the truck would have to back up [1:55:50] for the length of the road because the footage of the road at 71 ft 24 so 124 [1:55:58] were greater than allowable according to the fire. [1:56:02] So that's why he but that was under the belief that this was a nontraversible [1:56:06] portion of road going away from us but it is travers [1:56:13] and as for extending the road 9/10 of a foot 10 in to a foot in this portion [1:56:19] over here I don't believe the applicant would have a problem extending the road [1:56:23] » I think that's that's our concern we're concerned with the door [1:56:27] » well then that that would be something you would discuss with Dave Yes. [1:56:32] Well, we have to work it out with Dave. The only way we can get past Dave, we'd [1:56:36] have to go to Albany. >> Not even not even do it, [1:56:39] » right? >> Because you had said you had that [1:56:43] concern with it. >> Yes, I did. [1:56:45] » Okay. So, you're going to work it out with him. So, we're going to leave it as [1:56:47] it is and you're going to work it out with them. [1:56:50] » I I mean, I was discussing it because I just wanted to tell you, [1:56:55] » right? >> We have to work it out with Dave. If we [1:56:56] can't work it out with Dave, we have to go to Albany. We really don't want to go [1:57:00] to >> Well, it'd be nice to have on on a piece [1:57:02] of paper stating to us that it's the 20 ft. It had been worked out originally. [1:57:08] » Well, we we [1:57:12] work it out with him. If if you if you come up with 19 ft, it's not that much. [1:57:15] I don't think it's going to be that much. [1:57:16] » Well, he's going by the code. The code is [1:57:18] » by the code. We understand that. >> Um I mean, we've used that road for I [1:57:23] don't know how many years and never had an issue. So, if we can move everything [1:57:28] the code because we're getting stuff that's not within code. So we make [1:57:32] everything the code down the road everybody else [1:57:37] the code so we don't have a problem. >> Is it on his property that he can do [1:57:41] this or it's not? Whose property is it on? [1:57:43] » It does appear that he should be able to go on to his property extend. It's about [1:57:48] a one foot about a 10 in 10 in 10 inch extension of the road. Looking at the [1:57:53] measurements that were taken 19.1 >> if he can It's his property. He can do [1:57:59] it. And we're we are going to do it. If it's not his property, we can't talk to [1:58:04] somebody else's property. >> Technically, it's in the rightway. [1:58:08] » They have a tenant extension into the rightway. It wouldn't be on property. [1:58:12] There would be no easement, anything like that. [1:58:14] » Okay. [1:58:19] » So, I think you did. I think I finished all [1:58:26] » join the club. [2:06:38] » Was this a conspiracy? [2:06:43] » Is anybody here from 182? >> Yes, sir. Okay. [2:06:47] » Soon as we get rid of these guys, come on up. We'll abuse you a little bit. [2:07:02] What the heck happened? [2:07:15] I'm not getting involved. Don't get involved. [2:07:20] Be here all night. [2:07:24] Okay. [2:07:30] » Yes, sir. [2:07:34] » State your name and address for the record and sign it, please. [2:07:37] » Sure. >> Samson. [2:07:42] » S. Last name. S I M O I [2:07:52] S O. [2:08:11] » All right. So, I was here about two weeks ago. the PRC. I believe there were [2:08:16] a few things that were addressed and I took care of a few things that some of [2:08:20] the questions they were concerned about some of the addresses [2:08:24] and whatnot. So, [2:08:30] I wanted to um the property is pretty small. The the lot size [2:08:38] the way I'm not sure if you guys have the plans of what I was proposing on [2:08:41] doing privacy trees for my uh equipment. Oh, there you go. [2:08:47] » I don't have I got it. [2:08:55] So, as far as you guys are concerned, do you prefer that there are trees? Can [2:09:02] I have a fence in on the on the North Middletown Road? [2:09:08] If so, is there a setback? Because looks like the property line I'm not sure if [2:09:13] there's a if there's an easement there. Based on the survey that I was giving, [2:09:16] which is very old, doesn't show any easement. It shows the property is right [2:09:20] on the on the street. So, has anything changed ever since? [2:09:26] Does does it change any ruling as far as a setback versus if I put a fence versus [2:09:31] trees? [2:09:37] » Okay. [2:09:52] Um, so on on the street there, is that the [2:09:57] front or the back of the house? >> It's a good question. The property has [2:10:01] two addresses. So [2:10:04] » they're both front yards. >> Yeah, I guess. [2:10:07] » So you're only allowed uh four and a half ft on those roads, [2:10:12] » the height, correct? >> Yeah. Are you on a corner, an outside [2:10:14] corner? >> No, there's no other street there, [2:10:17] right? >> No, I mean there there are two adjacent [2:10:19] properties. I know it's it's not it's not [2:10:21] » so yeah four and a half ft >> height. [2:10:24] » Yeah. [2:10:27] » No, a fence can be right on the property line. [2:10:28] » It could be. >> Uh yeah, right on your property. [2:10:30] » Trees as well. >> Trees. Yeah. [2:10:40] You brought up a project review that you you were talking about a fence, but you [2:10:45] wanted to possibly, as you show there, put plantings around, move the fence a [2:10:50] little back for your sight distances. [2:10:54] » Correct. I mean, the way I envision this is that first of all, if I'm going to [2:10:58] put plans there, I wouldn't put them on the property line because they're going [2:11:02] to get killed with it when they plow the road, [2:11:04] » right? >> So, it would have to have a setback [2:11:06] regardless. Now, if I put a fence, that might change the conversation a little [2:11:10] bit. >> But I'm not sure if you guys going to be [2:11:12] satisfied with the look because if I put the fence so close to the street, I'm [2:11:16] not going to have any room for for any planting. [2:11:19] » Well, [2:11:25] that close. >> Well, you would probably if I put a [2:11:28] fence, I would probably put like three feet in, but if I'm putting trees, [2:11:31] probably like seven 10 feet in, I would assume. [2:11:35] » There was no sidewalk on that side of the street. [2:11:37] » Correct. [2:11:41] » They didn't do anything. >> It ends right there. So, that's exactly [2:11:45] why I was asking about the the setback if there's any any easement. [2:11:53] Okay. The the other thing is coming out of the property. [2:12:03] » Correct. [2:12:15] » So, so that's a great question you brought up. The last time I was here at [2:12:18] PRC, um the fire chief had mentioned that he he had trouble accessing. Now, [2:12:24] the the neighbor next door, he had shrubs coming all the way up, and I [2:12:28] asked him if he would let me cut, and he did. So, since then, I've planted 48 [2:12:33] trees on the side, 48 green johns, which has the best the fastest growing trees [2:12:38] on the market, you know, today because I wanted to let them grow at least to to [2:12:42] let the roots establish for next spring. They're just going to take off. I [2:12:45] haven't done anything in the front obviously because I want to you know I [2:12:48] want to get some answers here or some ideas. Um so that I solved that problem. [2:12:54] However, there is an electrical pole that's [2:12:58] really what's causing the the view to make it difficult to to go in and out. [2:13:08] So I may have to I know it's not shown there. I did a poor job there. I I would [2:13:12] probably have to call OR to solve that problem and and then to end this point [2:13:18] um I haven't updated it but I didn't want [2:13:23] to bring everything the last minute where it does show where the there is [2:13:28] enough space that you can pull up and you have a clear view to get you know to [2:13:32] get out of the parking lot without causing an accident. [2:13:35] » Well, at least that's the goal. >> Yeah. That's why you wouldn't go with [2:13:38] the abroades in the front on Middletown Road. That would block your site totally [2:13:44] if you use that. >> So the way I'm in the way I had my [2:13:47] renderings as of this afternoon that I was working on. This is something that I [2:13:51] did. So it's nothing professional. This is not an art. [2:13:53] » Yeah. Well, it's got the plan when you do come before the board. Sure. is to [2:13:58] they'll give you sheets that'll tell you how to do it, but you have to have a [2:14:01] professionally drawn up >> of course [2:14:03] » plans and everything that would show it, show your landscaping and everything [2:14:07] like that. But you did mention at uh project review if you worried about the [2:14:12] site distance there too. So if you did plant along Middletown Road, have that [2:14:16] be something that would be lower. >> So the green giants [2:14:21] » they grow and you're never sight. >> I understand everybody thinks that. [2:14:25] However, we, you know, we're in landscape business, so we maintain them. [2:14:28] We can, we can bring as many pictures as we need to. Something we maintain for [2:14:31] year for our >> You may want to bring it back [2:14:33] » and we can also keep it at 12 14 ft high. Still too high. But if you sit in [2:14:38] your truck, you better be able to see out. [2:14:40] » No, no, no. Meaning for privacy. So, it's not going to look like this giant [2:14:43] thing. Has nothing to do. Yeah. >> What I'm talking about is the side is [2:14:46] fine. It's It's on Middletown Road. If you're playing Queen Giant, everybody's [2:14:51] there. you you won't have any sight distance unless they're set back from [2:14:55] the road. >> Correct. At least six feet. [2:14:57] » Yeah. This way you can pull up and you can see either way. [2:15:00] » Correct. >> But you had brought that up which was an [2:15:02] excellent idea, I think. And it would give a good look to the uh to the [2:15:06] property on the Middletown roadside. >> So that's what I'm trying to accomplish. [2:15:11] So, it's private enough, but it also doesn't look like because I realize it's [2:15:16] I believe it's an residential zoning there, even though there's a bunch of [2:15:20] commercial to keep that look. Isn't that Is that something you guys would prefer [2:15:24] versus just a plain fence? >> Well, [2:15:31] well, if you put the fence back six feet and you put vegetation in front of it, [2:15:35] something low growing to sort of make it look better [2:15:40] for a second. [2:15:44] Is there a sidewalk on the other side of the street? [2:15:48] » They ran out of money, so they only went to like King basically. [2:15:52] » No, no, even they come really next door to me. Like literally stops the building [2:15:55] next door to me. >> Right. [2:16:00] » On my latest rendering, which I didn't bring because I didn't want to bring the [2:16:03] last minute that I that I worked on this afternoon. It actually I just left it [2:16:06] alone for now. grass >> when that were to happen they can just [2:16:11] basically just remove the grass without damaging the trees [2:16:14] » right >> so what you're seeing there those are [2:16:17] the uh if you can go down whoever is using it yeah [2:16:22] » so either maybe put the fence behind the arboritis and then just push the [2:16:26] arboritis further back so have a strip of grass at least five or six feet that [2:16:32] if if and whenever they do the sidewalk >> right [2:16:35] » we're not back to square one to planting that would make more sense and it still [2:16:38] give you uh it give you the sight distance that you need. [2:16:43] It's it looks fairly good except I think pushing it back would make it especially [2:16:47] if there's going to be a sidewalk eventually. [2:16:50] Who knows in our lifetime but maybe there'll be a sidewalk but if not you [2:16:55] leave the grass there this way with snow and everything you're not losing [2:16:58] » correct >> your trees or anything and it's not [2:17:00] going to kill anything. >> And any plants that would be in front of [2:17:02] those arbors would be all perennials that we can cut back in winter. Yeah, [2:17:06] » it still gives it, you know, it's like a very fresh look, but it can get get back [2:17:11] cut back in winter. >> It's a [2:17:15] You're not going to do anything on the other side of the house. [2:17:18] » You mean in the frunk? No, it's currently residential. It's [2:17:21] » okay. So, that'll stay residential. >> Correct. And and and other than that, [2:17:25] there's a gate where the proposed garage is on the right side that gives access. [2:17:31] I would assume that you guys going to want me to shut that off so we don't [2:17:35] have we don't have our trucks going into the the residential area. Correct. [2:17:40] » I don't think they can have Can they have two? [2:17:45] » It's two different purposes. The the front of the building is commercial. [2:17:49] » Back of the building is residential. Okay. [2:17:52] » Are both of those addresses listed in the 911 system? [2:17:55] » So, great qu. So, I I made a call as soon as I left that day. 911 recognizes [2:18:03] 182 which is interesting because 182 was added after 33 Mariana which is in the [2:18:09] front. So they said which I actually in fact we have a tenant moving in the [2:18:13] residential. I've I put a note that in case an emergency let them know it's 182 [2:18:18] North Middletown but post office has two addresses. [2:18:25] So in other words, I had a mailbox in the in this side the other people have [2:18:28] in the front that will be moving in, you know, in the next few weeks or month. [2:18:33] And the mail is completely separate. It's just a 911 in case there's an [2:18:38] emergency. It's recognized as 182 North Middletown Road. [2:18:44] » Are they two separate lots? >> It is one lot. [2:18:48] » It's also one building. It was just split at some point. It's a split level [2:18:52] house. One side of the house is on one road. [2:18:56] The back of the house is on Middletown Road. [2:18:58] » No, I understand that. >> So, but they have two driveways. [2:19:02] » One coming out on Middletown, one going out on [2:19:05] » 911. [clears throat] What address are they going to look at? [2:19:09] » That's the problem. >> 182 [2:19:13] » 182 Middletown. >> Yeah. [2:19:14] » I call Rockland County. I'm not I forgot what it's called the department but they [2:19:18] will give you that you [clears throat] know they they tag take the the map lot [2:19:22] the tax map whatever it's called right >> and they'll tell you how they recognize [2:19:25] it. >> Yeah. [2:19:28] » Is there a way to change it? I'm not sure. I I haven't asked that question. [2:19:35] » Yes, it is separate addresses. >> Correct. [2:19:48] Did you get a copy of the consult reports [2:19:51] » from uh yesterday? >> Okay. [2:19:53] » Yes, I did. Well, this will just go I've also consulted with an engineer that I'm [2:19:58] supposed to be meeting the near the next few days. [2:20:01] » Yeah. Let me just uh I got three three things here. Let me read them to record. [2:20:06] So, they're in the record. I have a letter from Orangetown Building [2:20:11] Department, Rick Oliver, August 7th, he has seven comments. [2:20:16] Orangetown DME Peters, August 21st has seven comments. And Orangetown Fire, [2:20:23] July 30th, we have two comments. [2:20:36] I think the biggest you were looking for respect to [2:20:41] this gate to push the fence back or so. >> Yes. [2:20:47] » And then behind the fence this way too if they do come through the sidewalk [2:20:53] » without having to destroy anything other than the grass. Correct. [2:21:02] » Yeah. They may or may not. [2:21:15] » Yeah, that's nice. [2:21:30] » Has it been done where you can actually make that change on their end. [2:21:36] » I don't know. We have another same thing has two addresses. So, we haven't [2:21:42] approached that yet. [2:21:54] That's >> understand. [2:22:00] But it looks like a good project. >> Yeah, [2:22:04] » it's going to change the uh the look of the area, which is good. [2:22:09] » Can't hurt. >> And uh just with the paving that, you [2:22:14] got to look at the deme's comments because you're probably going to need a [2:22:20] oil water separator because you you're parking the trucks there. [2:22:23] » I actually printed something. I didn't I I thought he was going to be here. I [2:22:26] wasn't sure that if that's what he was referring to, [2:22:28] » probably. Yeah, you can give him a call on that. [2:22:31] » Oh, can I? Okay. To Bruce, right? >> Right. Yes. Okay. Ask him, you know, [2:22:35] what he specifically meant by that. And then you got to get some, you know, [2:22:40] survey or whatever to draw up your plans, separate plans for your uh [2:22:46] landscaping. Separate plans. And the buildings department give you it's a [2:22:50] check. It's a check off list, isn't it? Uh Audrey. [2:22:56] » Okay. [2:23:04] And if you comply with all those things, that makes the the process a much [2:23:08] speedier process once you come before the board, [2:23:10] » which is why I'm here because I'm trying to get as much information as I can so I [2:23:13] can pass it on to the engineer to anybody that needs it. that [2:23:16] » well that's a checkation and you give them the uh comments which you have so [2:23:21] far but the EM's ones if you get a lot of those knocked off that uh that'll [2:23:26] speed up the project but once you have most of the stuff done your plans and [2:23:30] everything done you go to the check off list then you can come to the planning [2:23:34] board to the builder's department to you know to put in for the permit and for [2:23:39] appearance before the board and I don't know if you need I don't think you need [2:23:44] any variances So that would to cut out the CBA. [2:23:49] So >> I'm not sure if that's a building [2:23:52] department question, but is there will the fence be required or is that just if [2:23:58] something I want to do? In other words, you see the gate that's there. Is that [2:24:03] something you guys would prefer with the building department or is that just [2:24:06] totally optional? >> Well, the gate would have to be you'd [2:24:09] have to lock. >> Yeah, but if you're going to lock it, [2:24:12] you'd have the fire department would need a key or something. something like [2:24:15] that. >> I was I thought the fence was just [2:24:18] something you want. It's not something that's required by us, [2:24:20] » right? >> Yeah. But if [2:24:22] » I think for safety issue, you might want to do it. Just keep people out of it. [2:24:26] Although they can jump the fence if they want to. So, [2:24:29] » but you can put a a lock >> Well, not in forever. That's why. [2:24:33] » But you could put a lock box there where you where the fire department has access [2:24:36] to and then they can unlock the gate. Yeah. You could lock it in here [2:24:40] » because the way we would operate is it would be open all day long just shut at [2:24:44] the end of the >> and you would you be locked at night [2:24:47] time. >> Correct. Yeah. [2:24:48] » So there's your box that you can put there that the fire department has [2:24:51] access to that they can unlock and get in that way. [2:24:54] » Got it. In case an emergency, >> right? But it's something too that you [2:24:57] could talk to the fire department once you get approval and whatever that they [2:25:01] know there's a back entrance or something that makes it easier for them [2:25:05] when they uh respond to it. >> They have to. [2:25:07] » What kind of equipment you require? So, we have a small landscape company. It's [2:25:11] going to be pickup trucks, maybe mason dumps, [2:25:14] trailers. [2:25:19] » It's all small equipment, right? >> It's all small. Correct. Yeah. [2:25:22] » Because in the past, I thought it was like a limo. [2:25:25] » So, it was a limo and then it's plumbing. Was it plumbing business [2:25:31] operating out of there? It's currently still. That's how it is still. [2:25:37] Correct. Yeah. [2:25:50] No, you have nonable [2:25:58] gravel. [2:26:10] » You said it's 75%. I got it. So that is the reason the [2:26:16] proposed it says gravel. I thought only after that includes the front and the [2:26:22] back. >> Sure. Of course. Yeah. Yeah. Right. But [2:26:26] if some of those um sidewalks or driveways can be converted to permeable [2:26:31] pavers that will help >> the permeable pa which is a different [2:26:38] » no the because we've installed them which is with gravel base so the water [2:26:42] perks right through it and it's it's basically becomes a dry well. So the [2:26:47] they have like 316 gap we don't use sand. [2:26:51] » You would have to provide calculations. >> Okay. [2:26:57] » Sure. An engineer. So it's 75%. Got it. Okay. [2:27:10] » Yeah. Because I'm the grass, right? Correct. Yeah. That by default the [2:27:14] landscaping as well, right? [2:27:22] It's a good project that you know you might as well hope start off and [2:27:26] » thank you. >> Run with it, [2:27:33] » right? It's one whole lot. Okay. [2:27:44] Right. >> Okay. I think [2:27:48] » All right. >> Thank you for coming. [2:27:50] » Any questions department happy to help you as much as they can. [2:27:55] » Okay. Appreciate it. >> Okay. [2:27:58] » Thank you. >> Thank you. [2:28:04] » Do we have anything? >> What? What? [2:28:07] » July 22nd. >> Motion to approve July 22nd minutes as [2:28:12] approved. is corrected. >> Motion to approve July 22nd minutes as [2:28:17] amended. >> Second. [2:28:19] » Second. >> All in favor? [2:28:21] » I oppos. Anything else? >> Motion to adjurnn. [2:28:26] » Motion to adjurnn. Second. >> Second. [2:28:28] » All in favor? I >> oppos [2:28:36] 26.
