[0:03] uh this of the the municipal election board will [0:06] not come to uh order council uh can you call the role please [0:11] yes mr mayor colleen stratton president joel bennett [0:29] before you give the decision in case so you voted on this last [0:36] uh hearing uh all that's to be done to this to sign [0:40] the decision in the uh open public and then we will tender a copy to the uh [0:46] to the uh objector into the end so if i can ask all the electoral board [0:56] members [1:01] you're gonna be good with individual you're gonna circulate them off all [1:07] right so you give me years thank you sir [1:14] [Applause] [1:38] um [Applause] [1:45] you want this one i just signed it [2:02] um maybe you can give me a hand so [2:13] to the objector and to the candidate it is this date of january 30 [2:26] and as the board ruled on the first hearing on monday that the [2:32] candidates competitions are held and shall not be [2:36] on the ballot that being the case uh a motion to adjourn second [2:44] seconded uh to adjourn those in the favor suit by levi [2:48] i [2:52] thank you thank you [3:16] yes [3:45] good uh [3:59] [Music] [4:08] good morning [4:13] i would call this uh hearing uh before the payless hills [4:16] uh municipal election board to order uh call the roll please [4:20] pauline stratton gerald bennett president rudy mulderlink is here [4:25] mark brockman here and again [4:33] there is a quorum mr mayor at the last hearing [4:39] we took this case uh our advisement transition today [4:43] and to allow us to do some re research on the nobody issue [4:48] uh you heard the evidence on monday that the notary signed your commission uh [4:56] printed on the notary signature which was a printed signature [5:04] we did research on this matter and the both the secretary of state and [5:10] case law is very clear as we stated in the [5:14] decision that the notary has to sign the no [5:19] affidavits the notary trot as she or he has signed her notary [5:25] commission that was not done in this case and as we [5:30] stated the law that has come from the secretary of [5:33] state as well as the case law that's come from [5:36] the appellate court the decision is is clear [5:42] that the objection has to be granted as to the notary [5:49] invalidating the statement of candidacy and the petition sheets [5:54] and granting the objection that would be my recommendation if you [6:00] agree the motion would be to uh [6:05] uh interject at this point because when we left this hearing we were asking [6:10] both the objector and the uh defendant i want to call that [6:18] the petitioner to bring us information about the status of whether or not we [6:23] these people were registered voters do you remember that yes yeah i got the [6:30] website uh everyone on this petition [6:35] all 16 of them are registered voters so that validates the fact that they all [6:41] are registered but you got the same problem [6:44] there that you have with your notary they didn't sign the petition either [6:48] they printed their names and that was me yeah so i'm just [6:52] interjecting that to let you know the information the [6:57] record okay thank you the fact that the notary [7:02] uh validates the the petitions so i think the uh the proper motion if [7:09] you agree with that and i gave you the law [7:11] ahead of time and the board uh individually receive the uh [7:16] the memorandum from uh my office as to the law [7:20] uh i think the proper motion at this point would be to [7:24] grant the objection as to the notary and to invalidate the petition [7:30] second moved and seconded all those in favor will signify by a [7:36] vote of i i and i and the motion carries [7:40] mr mayor i prepared a decision and if the board can sign the decision [7:46] at this meeting he contended the decision to both parties [7:58] uh and for the record uh both the objector is here [8:02] the candidate who did not appear at the first [8:06] hearing uh not adhering either is here to have her as as being present [8:15] on behalf of the candidate [8:38] uh [8:52] so [9:21] and the notary who's roughing the candidate here [9:24] uh are being tendered to the signed copy of the decision [9:29] uh there being no other matters mr mayor i'll make a motion that we adjourn this [9:35] hearing second move or clerk um [9:42] we'll vote no photos and i in the uh adjourned thank [9:48] you thank you thank you award ward 3.
