[0:20] costly. [0:28] » But like [0:31] Yeah, it ruined our secondary water system. [0:45] » Yeah. [0:50] [clears throat] [1:02] Okay. [1:12] » Beautiful. [1:15] [laughter] [1:24] So, it is 5:31 and since we don't have a mayor, we need to elect a mayor proamp. [1:31] Kelly, are you ready for us to be okay? I'd like to nominate [1:37] uh David Burton for mayor promp. >> Better him than me. I second it. [1:43] » All in favor? I I >> I [2:23] Whoa, whoa, whoa, whoa. >> Call the Carin City Council meeting to [2:30] order. It is now. >> Can you turn on your microphone or put [2:34] it to your face? >> What is that? your microphone. [2:38] » Nobody can hear me. >> Okay, it's August. Do I need to start [2:43] over? >> No. [2:44] » Okay, it's August 27th and it is 5:33 [2:49] p.m. [2:53] Okay. Do we have some opening ceremonies, [2:57] » Michelle? >> Okay. Our opening ceremonies will be [3:00] given by Council Member Toppam. Our [3:18] father in heaven, we bow our heads before thee this day to ask a special [3:21] blessing as we come together as a city council and a community. Please bless [3:27] that we may be able to go through these agenda items with respect to one [3:32] another, hear everyone out and make the decisions that are best for our city. We [3:38] are also so very thank thankful for all of the moisture that we have received [3:43] and pray that we can continue to receive [3:49] what you think that we need. And we are so very thankful for this beautiful [3:53] community that we live in. And I say these things in the name of Jesus [3:56] Christ. Amen. >> And amen. [3:58] » Please stand. [4:02] » I pledge alce to the flag of the United States of America and to the [4:10] stands one indivisible. [4:21] » Thank you, Council Member Toppam. [4:27] Are [clears throat] there any conflicts with anyone on the council tonight with [4:32] anything on the agenda? >> No. [4:35] » No. >> Thank you. Hearing none, we will now [4:41] proceed with public comments. Is there anyone that would like to give [4:47] a comment on something that they have in concern with the city that isn't on the [4:53] agenda that they'd like to bring forth at this time? [5:02] Well, seeing none, we will move to the consent agenda. This [5:08] is regular items that are approved by the council regularly. Items six and [5:14] seven. Six is the M minutes from the special work meeting August 13th [5:20] and the city council meeting on August 13th of 2026 and the warrant register [5:26] for August 27th, 2026. >> Mayor, I move to approve consent agenda [5:34] items six and seven. I'll second it. [5:38] » Okay, it's been moved and seconded. Approve the consent agenda. All in [5:42] favor? >> I [5:43] » I any Excuse me. Any opposed? Okay, the consent agenda passes. [5:52] We'll now move to the action agenda number eight, [5:57] which involves a temporary alcohol event permit for September 19th, 2026 for [6:05] Sweet Pea Farm and Orchard DA Olrich, owner. I propose that we uh grant the [6:13] temporary alcohol event permit for September 19th, 2026 for Sweet Pea Farm [6:18] and Orchard uh Daich owner. [6:24] » I'll second it. >> It's been moved and seconded that we [6:28] approve the temporary alcohol event permit for Sweet Pea Farms for September [6:32] 19th, 2026 for Dao Ultridge Oldrich, excuse me. All in favor? I [6:40] » I >> I [6:41] » Any opposed? Motion passes to approve the alcohol [6:46] event permit. >> Uh item number nine, consider proposed [6:52] zone change for parcel A-0026-000027-0000 [7:01] from A1 to R2. Dan, do you have a presentation on that? [7:08] Um I don't we did discuss it last um last time in the work agenda um in [7:14] detail. So I don't have anything planned to presentwise but I can certainly [7:18] answer any questions. The uh the uh um property is in front of you um [7:26] for the zone change request. [7:31] So is there any discussion? [7:38] Is there someone to answer questions? >> Okay. [clears throat] [7:44] Um, listening to a lot of uh citizens uh [7:49] both in the green area and the the little squares on the top of the page on [7:56] the left. Um, do you know where I don't know if this proper to ask or [8:03] not, but they've been asking I don't know. Um, do you know where the first [8:09] street would go through to exit that property? [8:13] So, [clears throat] there's going to be, excuse me, going to be the roadway on [8:18] the north north end the 100 north would be the first roadway to go in and it [8:23] also connect to the two roadways to the north as well. So there'd be three [8:26] points of access >> like right off the bat. [8:31] » Right off the bat, you can see the phase line in the middle [clears throat] right [8:34] at the north end of the first one. [8:40] » So 100 North and their their plan [clears throat] is [8:45] to connect it to the existing roadway on 100 North, [8:52] » but that road's not built yet. No, it's it ends just in front of that property [8:58] over in the Aspen Cove subdivision. >> Yeah, [9:01] » there's a a little line right there where the asphalt ends. You can see that [9:05] kind of a dotted line. It would continue to that point. [9:09] » So, it' exit there and roll down to 775 west [9:14] » and then 660 north. >> Okay. [9:16] » So, that's one access point. Then the other two roadways going northward would [9:20] be the other two access points. So the two at the top of the page. Okay. [9:30] » Is that property secured that's off from what is that on 100 north through that [9:38] Aspen Cove subdivision right there where it joins. There's a little strip that's [9:43] not owned by them, but they've been talking to the owner and she's and [9:48] they've been agreeable to part ways with it and allow the roadway [9:52] to pass through. >> They're agreeable in what way? [9:57] » To allow the purchase to happen and let the the roadway pass through. And [10:02] nothing's happened. The zone change has to happen first before they finalize [10:06] agreements and see if everything will work out. [10:12] So the two exits, the concern that citizens have and also [10:19] myself is the two exits going to going north [clears throat] with our new 42 [10:27] well 60 foot rideway and 42 foot asphalt and actually rolls into those streets. [10:35] Do you know how wide those streets are? The asphalt part [10:40] Uh right there at the top it would be 42 feet wide. [10:47] » Well, I mean >> asking on the on [10:49] » going into that property. Oh, to the north. [10:52] » How how wide those streets are? >> I don't I I can't tell you. I know it's [10:56] it's built for what was standard when when it was built. Their concern is [11:02] they're substandard roads um with no curbon gutter um and they're [11:07] approximately 28 feet of asphalt. My last measurements. Yeah. So that's [11:14] those are the my concerns. [11:23] Well, and my concern is that that property hadn't been secured yet for [11:27] that other access. It's just a tenative agreement. [11:33] » We're not considering the subdivision though. We're considering a zone change. [11:37] » So, [clears throat] they can develop it as it sits as an R1 with a few less [11:41] houses or lots. The question is is whether R2 or not. [11:47] » Okay. [11:54] » Well, I'll make a motion for discussion that we leave it at an R1. [11:58] It is an R1. >> It's an A1 right now. [12:00] » A A1. >> Yeah, [12:03] » that was an R1 when they bought it, right? Correct. [12:06] » So, we were here a few city councils ago when it was going for R3. And at that [12:11] time, it was recommended by the city council to make go to R2, which is why [12:15] we're back here requesting the R2. [12:24] So, to answer your question, Lyall, it's it's currently zoned as an R as an A1, [12:31] » but if they want to do a subdivision with the current zoning, it will it will [12:38] treat it like an R1. Does that make sense? They don't have to reszone in [12:42] order to subdivide >> an R1. [12:46] » It will be treated like an R1. >> Yeah. So, an R1 and A1 are basically the [12:50] same >> when it comes to development. Yeah. [12:52] » Okay. And they were trying to get the R3, [12:56] which is the same, if I'm not mistaken, it's the same as the neighboring [13:00] subdivision. They're trying to go for the same zoning. So now we're doing [13:04] something a little less dense than what's neighboring. It's it's a [13:09] development. [13:12] » I just think the citizens around their main concern is like the density [13:17] of it and putting all of that traffic through. [13:21] And this is not your fault. like their substandard roads, you know, putting all [13:24] of those homes and everything through their [13:28] through their subdivisions. >> That's I think that's the main thing. [13:35] Correct me if I'm wrong you guys, but like the phone calls that I've come that [13:39] I have fielded is like they would like not to see as dense as it is around. [13:48] Uh, I'd like to ask Dan a question about density. What's the difference in your [13:54] calculation of density from A1 to R2? Um, the difference is [clears throat] in [14:02] the lot size for single family residences. [14:08] Um, [14:11] if if there's R2, so their proposed subdivision is single family residences. [14:15] Obviously, they could change it and do do something else with twin homes or [14:20] something. From a single family resident standpoint, if these parcels were were [14:27] at the minimum of 7,500 square ft, um it would be one thing. The the reality is [14:34] is the parcels average probably somewhere in the neighborhood of 82 [14:39] 8,300. There's parcels that are close to R1. They're almost 10,000 square feet. [14:45] There's a bunch of parcels that are larger than 8,000. There's a few parcels [14:50] that are smaller, just smaller than 8,000. 78 78 78. And um these [14:57] [clears throat] are the smallest ones on this right side. [15:00] Um these parcels, there used to be four here. Now there's three. So, um, [15:05] anyways, my point is is they they're getting 35 [15:10] parcels in the subdivision laid out. They could go smaller, but [15:15] that's the way they've laid it out with parcels about that large. So, if they if [15:19] they if we don't approve the zone change and it stays A1, they're basically going [15:24] to have to force them to do 10,000 square foot lots instead of like 80, [15:30] whatever the average is of all those. I ran the math figuring that see if it [15:34] averages about 8,200 it basically means um a couple less lots [15:40] like in the neighborhood of I don't know four or five lots less but effectively [15:46] it's going to look pretty similar um if you just if you add up the acreage [15:54] divided by 35 then divide it back out by 10,000 um it instead of 35, it's [16:02] probably, I don't know, 28, 29. I don't know. I'm not not laying out their [16:07] subdivision. I'm just trying to do raw math. So, you may squeeze a little bit [16:11] of density out of there, but it's already not as dense as it could be [16:14] under R2. That's my point. >> But that's under their [clears throat] [16:19] proposal now. But it could be denser. I mean, there is the possibility of that. [16:25] So, if they were to come back with a with twin homes, twin homes uh require [16:30] 10,000 square feet for both homes to sit on, giving you effective density of [16:37] 5,000 square feet per lot is the maximum. Um, obviously that's more homes [16:42] in there than this. Um, so yeah, theoretically it could come back with a [16:48] different thing and be 5,000 square foot per residential unit. [16:53] Okay, we have a motion to leave it at A1 with no zone change, but we I don't [17:00] believe we had a second. >> I second it. [17:04] » Okay, we have a motion in a second to leave it as without zone change is A1. [17:11] Is there any more discussion? [17:16] And all those in favor of the motion on the table, please say I. [17:23] » I. >> I. [17:24] » I. >> Any opposed? [17:28] » I. >> No. I'm I. [17:33] » Excuse. What was your vote, Council Member? [17:35] » It was a no vote. No. >> Okay. So, three to one. So, [17:40] » no. I voted with the rest of you. >> Oh, you vote I. [17:43] » I voted I. I just >> that's why I asked for clarification. [17:47] I'm sorry. So >> the vote was unanimous. So there will be [17:52] no zone change. It'll remain A1. >> Okay. [17:58] » Thank you. >> Thank you. [18:04] Uh the next item for business is item number 10. Consider cooperative land [18:12] realignment, road dedication and property exchange agreement with Lance [18:17] Shotwell relating to parcels A-491- [18:23] 0491-00002 [18:26] and a-492-000014-0000. [18:33] Okay. [clears throat] Is there any presentation on this? [18:39] » Yeah. So, we did have a conversation about it. Gave a pretty good [18:42] presentation last time just moving forward to work. I mean to action, but [18:48] I'm wondering if anybody had I I did show the [18:52] the diagram last time, did I not? >> Yeah, you did. [18:55] » Um and and and explained it. I just wondering if the council has any um [19:02] has any questions um on this before we start down the path of all of the steps [19:08] to do this. At the end, of course, the council will have the option whether or [19:11] not to trade the property. We've just got to do a lot of work to massage it [19:16] and abandon roads and and define new roads and redraw property boundaries in [19:22] order to make it happen. And we just need to have an agreement as we start on [19:25] that process. So, You're not agreeing to trade the [19:29] property yet. That's the last step. >> Yeah. [19:33] » I'll just say I talked to Dan about this a couple of times because I was [19:37] concerned and I support this. I I I looked at all the different situations [19:44] and all and the the reasoning and and what would the city would gain and [19:50] versus and what would be resolved. And so I I support this exchange. [20:06] Well, I'll move to approve the cooperative land realignment road [20:10] dedication and property exchange agreement with Lance Shockwell relating [20:14] to the parcels that were stated. >> I'll second it. [20:19] It's been moved and seconded that we consider cooperative land realignment [20:24] road dedication and proper exchange agreement with Lance Shotwell relating [20:29] to the parcels as stated. All those in favor [20:33] » I >> I [20:34] » I >> I [20:35] » any opposed it vote is unanimous. So, [20:41] » Kelly, I'm going to send it back to you. >> It is approved to consider this land [20:46] exchange to proceed anyway. Okay. Uh we will now go to the work [20:53] agenda which involves I guess we go right to [20:58] reports. So, I don't know. Council member Topham, [21:04] do you want to start? >> I would love to start. All right. I I [21:08] attended a theater board meeting. They talked about um all of the people who [21:12] are booking the theater. It seems like we've got a pretty good list of um [21:18] events and things that are happening in the theater with like a homeschool [21:22] academy and Beacon Academy and such. Um one thing that I do want to put out to [21:26] the public is that we're having a really hard time finding people that want to [21:30] direct plays in Peruan. Um, and so as of right now, we don't have another play [21:36] that is scheduled for this year that's put on by the community theater board. [21:42] So if you are somebody who would like to direct a play or anything, get with me, [21:48] get with Jet Smith, get with Jennifer Terry. Um, we'll get you on the [21:53] uh theater agenda and we will talk about it. There are a few for the following [21:58] year, like for 2027 and even in 2028 that we're going to do, but there's [22:02] nothing for the remainder of this year. So, um, that's sad. So, I just want to [22:09] shout that out there. So, >> hopefully we can get some people. [22:13] » So, that could change if they >> It could change if somebody [22:16] » just didn't realize that they could do that. Maybe. Um, I know Shelley Porter [22:22] has reached out to all of her contacts and and such and she's coming up dry, so [22:28] we need some good people who want to direct some plays. [22:32] » Okay. >> Anything else? [22:35] » Um, no. >> Okay. Thank you, Council Member Barton. [22:41] » Uh, yeah, just an update. We were able to attend the UMS. Uh Ronnie rode up [22:47] with me for a couple of days and Dan and Jeremy were there and couple of [22:52] takeaways. We are short short of power and short of transmission lines moving [22:58] forward into the next years and there's a lot of good ideas to solve a lot of [23:04] those problems. But it's going to take a lot of work and it's going to be an [23:08] uphill battle. But the thing I was amazed about was how well received Dan [23:13] and Jeremy are. They're very wellliked and and respected [23:18] through those channels. So, I think we got a we got great people in there. [23:22] » Were you more surprised that I was wellliked or Jeremy? [23:25] » Well, Jere I was Jeremy. I was like everybody knows him, hugging on him and [23:28] like respect. I mean, not that I was surprised, but it was just [23:32] » it was just neat to see. [clears throat] >> There's a lot that Jeremy does on the [23:37] various boards of the various projects and he's a he's a chairman of of a of a [23:43] UMP's board. That's really important. It takes a lot of administrative stuff to [23:48] be involved in Uamps and Jeremy carries the lion share of it. He he really does. [23:55] A lot of cities, they will pay a former mayor or former city manager or somebody [24:01] that was involved for years just to keep current with everything going on with [24:06] you Amps. And we're fortunate to have Jeremy do that. He does a great I agree. [24:11] I will say that we need to protect him because everybody up there wants him [24:14] back or wants to get him. So anyway, >> I I can veto his retirement or his being [24:22] poached. I I tell him that all the time. Okay. Thank you. [24:27] » Anything else? >> That's it for me. [24:30] » Council member Dean. >> Uh planning and zoning was cancelled. So [24:34] I had it pretty easy for the last two weeks. [24:38] » That's it. I don't have anything. I think Dan's [24:42] going to cover what I, you know, as far as the water. So, [24:47] » yeah, I've got a few things. Um, first thing I'm going to start with, um, [24:52] hopefully good news. Uh, next Thursday, um, we will be we're on the agenda for [24:57] CIB to go up and ask and make our presentation for um, hopefully grant [25:03] funds for the library. Um, hopefully they'll give us grant money. we may have [25:08] to take a loan or a partial loan, partial grant. [25:13] They are they sent a letter out to a bunch of cities and said, "Please [25:18] reconsider even applying. We don't have enough money to to loan grant out." Um, [25:25] probably better for you to stay home. And luckily, we didn't get one of those [25:29] letters, but Marcus, our our you guys met Marcus when we appointed our [25:33] municipal adviser, he says he's never seen an agenda this big with requests [25:37] from CIB. Um, and we are number 25 of 27 people [25:43] that will go in front of that board to ask for funding. So, we've been game [25:49] planning that and getting ready. Uh, Marcus feels good about it. Um, [25:53] hopefully it it goes well. I will not be in attendance. I could not believe that [25:59] it when we got the agenda that it's the exact same day of my knee surgery and [26:03] I've been waiting for like eight months. So, I can't reschedule. So, Molly's [26:08] going and Molly is the secret weapon when it comes to [26:10] » She really is >> getting getting people to commit stuff [26:13] to the city. >> It's true. [26:14] » And Corey's going and um we we might have Jerry there. Um if but they only [26:20] give us two to three minutes. And I mean I love Molly. This is not a diss on [26:23] Molly. If you think Molly can keep it to under three minutes when she talked [26:26] about passionately about Perwin City and the community center, I don't know. [26:30] » Said no one ever. >> So, um, and Marcus will be there, of [26:34] course, to steer us. Right. So, that's happening next week. Um, hopefully, [26:38] fingers crossed that goes well. [clears throat] Um, that was positive [26:41] fun. Hopefully, the next one is the bridge. I am just really extremely [26:47] frustrated. um Inbridge the gas company in case anybody doesn't know keep track [26:52] of what they've changed their name to this week. They have decided that they [26:57] have to get update the um um stream alteration permit even though [27:03] there's a stream alteration permit to cover the prog process that originally [27:07] they were going to bore the new gas line under the the road that it is just too [27:14] many boulders and stuff which is smart. I didn't know how they were going to [27:17] ever bore it. I figured they were going to get midbore and have to trench it. [27:21] Well, they've now determined after doing their potholeing and stuff that they are [27:24] going to have to trench it. Unfortunately, federal money, UD do [27:28] process, they now have to modify the stream alteration permit, which they [27:33] probably won't get that done until October. [27:37] » I'm just beyond frustrated. Um, we're going to get a bridge, but I can't [27:42] honestly say exactly when. So, what does that do with like all of our funding and [27:45] stuff that we've >> funding is good. U DOT's already expand [27:48] extended it. We luckily had a a large buffer because our we got such good [27:54] bids, but I'm guessing I mean I who knows what'll happen if if we didn't [28:00] have that buffer. I would really be sweating bullets. [28:03] We're going to get a bridge and I and and and it should get done under what [28:07] the funding that we have. It's just we want this thing done yesterday and we're [28:12] just sick of it being delayed. But that's what we're looking at. Just found [28:16] out that today. I knew that they were questioning the stream alteration [28:19] permit, but I just saw today that that they are for sure going to have to [28:23] reapply. And so and the state takes 30 days on an accelerated time frame to get [28:30] that modified. Um the diversion, uh we did have a a a [28:35] scare with the diversion. Actually had part of the project flood. um in recent [28:40] floods and um there was there was a little bit of [28:46] friction afterwards trying to figure things out between our engineer and the [28:50] and the soils um engineer and the the uh contractor and ourselves, but I think [28:58] we're back on track. um that they had to uh go down and remove a bunch of [29:04] material and put material back on. Specifically, the the bedding that this [29:09] the the the filter material that that keeps um any any dirt from getting into [29:16] the the drain line because you the drain line needs to take water out from under [29:21] the structure, but we don't want any any sort of dirt to go through because it'll [29:24] eventually erode. So, they had to make sure that the the fabric and there's a [29:28] specific type of sand and everything that filters all that out. They had to [29:32] make sure that was okay. They had to clean out the the lines and and and they [29:36] had to take out a bunch of material that had been installed just on the dirt burm [29:40] or the dirt portion of the dam. So, um they're back on track. That was going to [29:44] probably delay them a little bit. Um and but but but JP was just eager to get [29:50] going. In fact, some of the frustration was they wanted to immediately get [29:54] building and we needed the engineers to make sure we figured out and which we [29:59] needed them to press pause and figure out to do it right. We don't want to [30:02] have a dam that's leaking or is is somehow um [30:08] um not built to the standard it's supposed to be. So, um we're we're back [30:13] on track there. Um, the last thing that I have to share is that the reservoir [30:18] company turned the Yankee out um, today, which means we should get water [30:24] tomorrow. Um, is 20 turns a full turnout? [30:28] » It's It's hitting the weird right now. >> Just barely got a text just now that the [30:32] weird is a five. >> So, the water is has got here this [30:36] evening. >> So, I think that and obviously there's [30:41] only a certain amount of water. It only gained about 3 feet in elevation during [30:44] the time it was off. >> Yeah. [30:46] » Um I I'm guessing the farmers are making a big push to to get a last big cutting [30:52] out of it. Aldo and I talked, do we go back to a two-day a week watering [30:57] because we'll probably maybe have the water and I what I told Aldo is I said [31:01] I'll prepare all the communications and if we see that it actually starts [31:06] overflowing and we're at that point we may as well be using the water that [31:10] point maybe we'll go back. from a red to a yellow status. But probably my guess [31:14] only for a few weeks, three weeks. >> I think with the rains and whatever and [31:18] just leave it the way it is for now. I think it's going to be shortlived. And I [31:22] really think as far as a the farmer standpoint, we we're going to try to get [31:28] across with one good watering and then shut it off for the season would be my [31:33] guess. Just just to hedge our bet for another dry winter. [31:37] » If if we don't and that's fine. We cannot do that. People are going to [31:41] complain that water's pouring over the overflow and we're on one day a week, [31:45] but that's the tricky thing. It's moving fast back and forth and the confusion. [31:51] We we don't want to move between the numbers very often. But that's the [31:55] that's the conundrum. So, for the time being, [31:58] » well, that being said, I think you could probably open it back up to two. I think [32:01] you I think we'll be two weeks cuz we'll have Robinson Reservoir and then we'll [32:06] be able to call for Brian Head Pond which is not much but it it adds some [32:10] water. >> Does it? [32:11] » So I think we'll have good water for for two weeks at least [32:16] » if let's see it's the end of August. If we get another we stretch it two two [32:20] three weeks. >> Yeah. [32:22] » About when it gets shut >> about when we shut it off anyways. [32:24] » Yeah. >> So so that's the last of my updates. [32:30] » Okay. Thank you. How about Calie? Do you have anything? [32:34] » How about you, Scott? [32:48] » Okay. Thank Thank you. >> Is that your report? [32:56] » Okay. Thank you. [clears throat] >> Now we're on the record. Scott's being [32:59] serious. >> Okay. Um, do we have a close session? [33:04] » We do. We need to go into close. >> Oh, well. [clears throat] Okay. Well, I [33:09] thought we were going to hit a record here. So, [33:12] » we we we couldn't hit a record without Molly here. [33:15] » Okay. Okay. >> Throwing a monkey wrench. [33:18] » Anyway. Okay. Uh, I'll entertain a motion to go into close session. [33:24] » Can I ask? need to discuss strategy sessions to discuss pending or imminent [33:28] litigation. >> I'll make a motion to go into close [33:31] session as Dan has stated. >> I second it. [33:37] » Okay, it's been moved and seconded that we go into close session to discuss the [33:41] items that Dan has listed. I guess roll call vote. [33:47] » Rochelle Top and I. David Burton I Bart I [33:51] » John D I >> Okay, thank you for coming everyone. I'm [33:56] sorry I didn't invite everyone and welcome everybody at the beginning like [34:00] Molly does, but we're glad you
