[0:00] 6:00. Uh this is the B city council [0:02] meeting. Uh we'll uh open this meeting. [0:06] Uh Council Roelly will open it with [0:09] prayer for us. [0:13] Our dear kind loving father in heaven. [0:15] Father, as we pause in prayer at the [0:18] start of this city meeting, we are so [0:20] grateful for this beautiful area in [0:21] which we live. We are thankful for the [0:24] precipitation thou has blessed us with [0:26] in the last few weeks, and we humbly ask [0:28] for more. Father, we're grateful to live [0:31] in this great nation. We're thankful for [0:33] religious freedoms and personal [0:34] freedoms. That's why we're gathered here [0:36] tonight. We pray that we may make wise [0:38] decisions concerning the future of PAC. [0:41] We pray for this city and all of its [0:43] residents that we may have prosperity [0:45] and safety and a good plan moving [0:48] forward. Father, we pray thy spirit be [0:50] with us. Do so in the sacred name of [0:52] Jesus Christ. Amen. [0:54] >> Amen. Thank you, Ryan. Uh we'll have uh [0:57] Rick Johnson if he would approach the [0:59] pulpit and lead us in the pledge. [1:14] » I pledge algiance to the flag of the [1:17] United States of America and to the [1:20] republic for which it stands. One nation [1:24] under God, indivisible, with liberty and [1:27] justice for all. [1:29] >> Thank you, Rick. [1:32] >> Ladies and gentlemen, I'd like to excuse [1:33] Council Hulet, Brian Huelet. He's uh [1:36] gone to a conference, Main Street, [1:38] National Main Street Conference, [1:40] >> Mayor, I'm online. [1:42] >> Oh. Oh, good. Thank you. Didn't know you [1:45] were going to do that. Great. Wonderful. [1:47] I'm not sure about Bob Provoscard, but [1:50] I'm sure he'll join us momentarily. [1:54] Okay, moving on to uh the consent [1:57] agenda. [1:59] Uh [2:01] C. Uh number one, approval of the April [2:03] 1st, 2026 count city council meeting [2:07] minutes. Number two, confirmation of the [2:09] monthly financial information. [2:12] Number three, annual fraud risk [2:14] assessment. Number four, resolution city [2:17] of fund carnival carnival incorporated [2:20] agreement. Uh res number five resolution [2:23] arrowhead ranch adidum to master [2:26] development agreement. [2:29] Uh it's number six resolution approving [2:31] the municipal law enforcement services [2:33] agreement with Mountain View Hospital. [2:36] And number seven, uh, resolution [2:38] identification of PAC city fire and [2:40] rescue as the city's EMS service [2:43] provider and relicensure of ambulance [2:47] licenses. Council, unless there's any [2:49] discussion uh on these items, I'm ready [2:52] for a motion. [2:54] >> Mayor, I have one question. [2:56] >> Okay. [2:57] >> Um, just on the Carnival, do we always [2:59] do a five-year contract with them? And [3:01] is there any way an out if we decide to [3:05] change that in the five years? [3:09] >> We have done a fiveyear [3:11] far as I can remember. We could make it [3:13] a less term. [3:15] >> I don't know that there's any I don't [3:16] know there's been any problems with [3:18] them. I've been very satisfied all my [3:20] career here that uh that we've [3:23] interacted with them. [3:24] >> Oh yeah. My whole life it's been that. [3:26] And every time I go there I have a I [3:27] have a city of fun. [3:30] >> Yeah. I was just curious about the term [3:32] and if there's if something happens we [3:34] decide to you know if we want it out is [3:37] there is there an out clause in it? [3:39] >> Yes, there is a termination clause. [3:41] >> Okay. Okay. Thank you. [3:43] >> Good. Thank you, Brian. [3:45] >> Um I I had two questions. The one was [3:49] kind of about the city of fund. I read [3:52] through the agreement and I was just [3:54] curious [3:56] have they have in that discussion like I [3:58] know it's their choice but I think the [4:01] number one thing I hear from residents [4:02] every year is that the ticket prices are [4:05] just getting outrageously unaffordable [4:08] and so I just didn't know if like that's [4:11] the only place that we look at and then [4:15] making sure that they do abide by their [4:17] agreement because I feel like there are [4:18] a few things in it that you see them [4:20] doing that like smoking in non areas or [4:26] you know different things like that. So [4:28] >> and that's something that police chief [4:30] could address for us is as it becomes [4:32] necessary. Right. [4:33] >> I was just I think the ticket prices I [4:35] just hear all the time that it's just [4:37] unaffordable for families these days and [4:39] so that's just a concern. But then my [4:41] other question on the Arrowhead Ranch [4:43] addendum the 2.26 26 acres. I read the [4:48] previous one. Is it just open land and [4:51] trails? [4:55] Bowl of questions. [4:56] >> It is open land and we're part of that [4:59] agreement is we're paying the portion to [5:01] landscape of trees [5:04] uh picnic table. We didn't want to do a [5:06] lot of landscaping because our hope is [5:09] that as the other properties around it [5:10] develop that we will add that make it a [5:12] bigger park. [5:13] >> Okay. That was [5:14] >> but that was this portion. We we asked [5:15] them to put it down toward the [5:18] >> and a pavilion I think I read. Maybe [5:20] something like that. [5:21] >> Yeah. Okay. We're eventually want to [5:23] have more of a regional park with the [5:25] other properties that develop. [5:26] >> Okay. That was just I just wanted to [5:27] know what the plan was. Okay. [5:29] >> And Lacy and maybe a little bit more on [5:32] your on your point with the carnival. [5:35] They do have a half price night. That [5:36] Monday night is always a half price [5:38] night. So [5:39] >> Friday night I believe is the [5:41] >> Yes, Friday night. It's the It's the [5:42] first. Yes, [5:43] >> we'll just make sure to push that more [5:44] maybe for people that are upset about [5:46] the prices. So, they have price. [5:48] >> I've I've been I've been impressed with [5:49] City of Fun, especially as I've compared [5:51] them to other carnivals in other cities. [5:53] I think they do a pretty good job. [5:55] >> Yep. [5:56] >> Okay. Any other questions? [5:57] >> I do want to make a statement. I just [5:59] want to thank our our recorder for how [6:01] well she does with the minutes as I [6:03] review those. Those have been looking [6:04] really nice. So, thank you so much for [6:06] the detail and uh and how concise those [6:08] minutes are. [6:10] >> Okay. Wonderful. Anything else? Okay, [6:13] I'm ready for a motion. [6:15] >> Mayor, I motion that we approve the [6:17] consent agenda. [6:18] >> I'll second that. [6:19] >> Okay, we have a motion been seconded. [6:21] Roll call vote starting with council [6:23] Moss. [6:23] >> Yes. [6:24] >> Council Roelly, [6:25] >> yes. [6:25] >> Council Smith, [6:26] >> yes. [6:26] >> And council Helet. [6:28] >> Yes. [6:29] >> Thank you. Motion carries. Uh D. [6:32] Petitions PAC and Sanquin Chamber [6:35] Quarterly Report and Awards. Jim, I saw [6:37] you here. [6:46] and Lacy, Friday night, much smaller [6:48] crowds. Great night to go to the [6:50] festival for sure. [6:53] I am Jim Roland, the president of the [6:57] PAC and Santa Quinn Chamber of Commerce. [6:59] Hello, mayor, city council, and members [7:02] of the community. Light crowd tonight. [7:04] No, nothing to fight about tonight. [7:09] fight. [7:11] >> All right. Yeah. Well, I won't add to [7:13] anything to fight about either. So, um [7:17] it's uh my pleasure to um provide a [7:21] quarterly update on what's been going on [7:23] with the chamber um to help support and [7:26] grow our local businesses. This first [7:28] quarter of the year is the slowest time [7:31] of the year for chamber events. Um [7:35] though I don't feel like I've had any [7:38] more time on my plate to do other [7:41] things. Um but it is a slower month. We [7:44] enjoyed our um another great successful [7:48] annual awards gayla at Moments on Maine [7:51] in February. The theme this year was [7:53] Garage to Great Powering America 250. um [7:57] where we celebrate the incredible [7:59] success stories of our local business [8:01] owners and nonprofits that are really [8:04] the engine to to our community. [8:07] We were honored to have Major General [8:09] Jefferson Burton as our special guest [8:12] speaker and I'm proud to share that our [8:15] $10 balloon pop um raised $1,190 for our [8:20] high school scholarship program. [8:24] And we are working diligently this week, [8:27] right Ann to choose uh some our first [8:31] award winners that we'll announce next [8:33] week or on May 4th at their banquet. So [8:37] we're excited to uh to present that [8:39] scholarship [8:41] to a high school graduate. [8:44] The community guide magazine came out [8:47] about a week or so ago. I dropped off a [8:49] couple more copies. I put some more out [8:52] on the front uh table if anybody wants [8:54] to grab one. [8:56] >> Hey Jim, I did the wonderful wonderful [8:58] magazine. I love it. Thank you. I did [9:00] want to ask the population for Pacin and [9:03] Sanquin. It's exactly the same. I'm [9:05] curious. Is that a typo or really the [9:07] exact same? [9:08] >> You know, we can only find what we can [9:10] find. [9:11] >> Right. So that's what you found. must be [9:12] the numbers that [9:13] >> interesting. Okay. [9:15] >> So, [9:16] >> and I think that is a little bit high by [9:18] comparison some of the figures that I've [9:20] seen too, but we're between 24 and [9:22] 25,000. [9:23] >> Right. Okay. [9:23] >> Yeah. I know a couple years ago we were [9:26] definitely three or 4,000 ahead. [9:29] >> Right. [9:29] >> So, [9:30] >> there's been a lot of growth in South [9:31] Santa. So, that was interesting to me. [9:33] Thank you. [9:33] >> According to Robert over here, it's very [9:36] close. [9:37] >> Really? Wow. [9:39] >> What are we going to do about that? [9:43] sell more houses in case [9:49] » um anyway the magazine is really fun. [9:51] It's got um a calendar of events for the [9:53] entire year. So it's not just PAC [9:57] events. It's all the the whole Wasuch [10:00] community. [10:02] Um a lot of it celebrating America 250. [10:05] Um so there's tons of events throughout [10:08] the valley. Um, and uh, it's got a lot [10:11] of uh, advertisements from our local [10:13] businesses. So, I ask that you support [10:15] those businesses and um, and enjoy the [10:19] magazine. [10:21] Uh, we celebrated some uh, ribbon [10:24] cutings this quarter um, welcoming some [10:27] new growth to the community. um included [10:30] uh great local additions like pre-loved, [10:34] the pace invention innovation center and [10:38] studio 22 salon suites and a reopening [10:41] celebration of the Wayfair Theater. [10:44] The there are two more businesses that I [10:47] know of that are on the brink of [10:48] opening. Uh the first one is Beehive [10:51] Bandit Burgers which is located next to [10:54] Caesar's Little Caesars up by the high [10:56] school. Um they I get a feeling it's any [11:00] day now they will be serving some [11:02] burgers up there. So be sure to check [11:04] them out. And another great new addition [11:07] to our community is Western Timber Frame [11:10] who is moving into the old bowling [11:13] alley. Um they build magnificent wooden [11:17] structures for commercial buildings and [11:20] uh they're going to be a great um [11:22] employer in our community. Uh we have a [11:25] few issues to resolve at the building [11:27] that hopefully will get resolved quickly [11:30] and uh we will have a big ribbon cutting [11:32] and celebration there soon as well. [11:34] >> I just Jim I might mentioned too they're [11:37] they have won some accreditation from [11:39] the small businesses. [11:41] >> They did. That's right. They won [11:43] >> lets them go on to further competition. [11:46] >> Yep. It gives them uh some some power to grow even even bigger than what they [11:51] are. So, I don't know how much land [11:53] comes with that building, if they have [11:54] room for growth, but um they uh they [11:57] have quite a cool operation. So, I'm [11:59] excited to get over there and check them [12:01] out. Um we are in the middle of planning [12:05] our next hometown market season in Santa [12:08] Quinn. Uh we'll get many of the vendors [12:11] at that market will come from our PAC [12:13] businesses. um including on July 13th [12:16] our young entrepreneur night um which [12:19] brings out a lot of incredible youth in [12:21] our community um that do some amazing [12:24] things. I met uh Alexa Ellis from the [12:28] PAC Treehouse um here on Pac Main [12:31] Street. I don't know if any of you have [12:34] met her yet. Um I don't The treehouse is [12:38] right above Remax Furniture where there [12:41] was a yoga studio or something up above [12:43] there. Um, so she's got a cool little [12:45] business there and she's been um [12:48] diligently meeting with all the downtown [12:50] businesses and is very anxious to pull [12:53] off a hometown market on Main Street and [12:56] other activities and she feels that [12:59] there's a lot of support from the other [13:01] business owners on Main Street. So, I [13:04] will be working closely with her and Ty [13:08] um Jones to see what we can develop and [13:11] maybe we can have a PAC hometown market [13:13] here later this year or next year. Um, [13:17] unfortunately, we had to cancel our [13:19] upcoming garage to gray workshop that [13:21] was scheduled for next Friday. Um, but [13:24] we do have another one planned for [13:25] October and are looking forward to that. [13:27] Um, that is my report. Thank you for [13:30] allowing me time to share. Is there any [13:33] questions or [13:35] anything the chamber can do to help [13:37] support our local businesses? [13:38] >> I just want to say thank you so much as [13:40] the city council representative for the [13:42] chamber of commerce. You guys work [13:43] really really hard and you are [13:47] constantly texting each other and [13:49] planning things and and you're there for [13:51] the businesses and there for Pacin City [13:54] and and and its residents and I don't [13:57] think we could do a lot of what happens [13:59] without you guys. So, thank you so much. [14:02] >> Thank you. [14:04] >> All right. [14:04] >> Thank you. [14:04] very much. [14:05] >> Thanks, Jim. [14:09] » The next item on the [14:12] petitions is the I-15 interchange [14:14] update. I don't see Eric here. [14:17] >> We're skipping it. [14:18] Okay, we'll go ahead [14:19] and move to the next one. Number three, [14:23] proclamation municipal clerk's week. [14:26] Any information now or just uh [14:30] I think it's [14:32] >> me do it. [14:35] >> Come on, Emily. [14:39] » Yeah, it's a week for me. [14:43] >> Yeah. So, [14:46] >> turn it off. Oh, jeez. You guys see? Um, [14:49] it's the first week in May. I know I'm [14:52] already like um and it just recognizes [14:55] municipal clerks and their role in the [14:57] city that is support that supports all [14:59] departments and council and and yeah so [15:03] that's what that is. [15:04] >> Okay. [15:05] >> And you're awesome. [15:06] >> Thank you. [15:06] >> Did a great job. [15:07] >> Thank you. [15:10] >> Okay. Moving on. Uh we'll open a public [15:13] forum. Anyone can speak. Uh please be [15:16] cognizant of your time. Try to hit [15:18] around three minutes. uh less if you [15:21] don't need to take more. So, uh just let [15:24] us know who you are and what what you'd [15:26] like to tell us. [15:30] Come on up. [15:37] Hello. Thank you. My name is Sarah [15:38] Ogden. Um I have been a resident of PAC [15:41] city for six years and I understand that [15:44] the topic I'm about to bring up has [15:46] already been addressed before. Um, I [15:49] think our city should allow two to three [15:51] goats on lots smaller than half an acre. [15:55] Uh, the concerns that ultimately led to [15:57] shutting down this idea 5 years ago can [16:00] be mitigated with proper infrastructure [16:01] and well-managed care. [16:04] Some advantages to owning goats are to [16:06] help patient citizens to be producers [16:08] instead of just consumers. [16:11] Goats um provide companionship much like [16:14] cats and dogs along with milk, meat, [16:17] fiber, and fertilizer. Their milk is in [16:20] high demand. It's nutritious, easier to [16:22] digest than cow milk, and thus great for [16:24] many with sensitivities to cow milk. Its [16:27] high butter fat content makes it [16:28] excellent for gourmet cooking to make [16:30] nourishing foods like yogurt and cheese, [16:32] as well as skin care, such as lotion and [16:34] soap. [16:35] >> The meat is also nutrientdense. [16:38] >> You can use fiber for spinning into [16:39] yarn. [16:41] Like rabbit manure, goat manure is cold [16:43] and can be applied to gardens without [16:44] burning the plants from too much [16:45] nitrogen. Both weeds and feed are [16:49] processed into a rich soil amendment [16:51] that increases soil's water retention, [16:53] which is a wonderful thing in this [16:54] drought. Um, it also allowing goats [17:00] will allow for sustainable [17:02] self-sufficiency. [17:03] Goats don't actually require as much [17:05] room as you might imagine to be happy [17:07] and healthy. In just a 20 by 10 foot [17:09] pen, a couple of miniature goats could [17:12] produce between half [17:14] >> to one gallon of milk per day. [17:18] >> I recognize that noise, smells, [17:22] property damage, and animals at large [17:25] are all valid concerns that deserve [17:26] attention and consideration. Um, in my [17:30] opinion, [17:32] I don't see goats ever becoming a bigger [17:35] noise issue than dogs if their needs are [17:37] being met. [17:39] Also, for smells, I don't see their [17:42] manure, if properly managed, ever [17:44] smelling worse than dog poo or cat poo. [17:48] Um, certainly for property damage and [17:51] animals getting out, we want to make [17:52] sure that pens are secure and we would [17:54] have the same kind of rules in place [17:57] that we have for dogs. [17:59] So, I propose that we move toward [18:01] drafting an ordinance to allow two to [18:03] three miniature goats on lots less than [18:05] half an acre. We can in include [18:08] provisions regarding adequate space, [18:09] shelter, fencing, care, and maintenance. [18:12] Uh, 5 years ago, when this issue was [18:14] brought before the city council, a [18:15] petition had been signed by over 350 [18:18] individuals in favor of allowing goats [18:20] on smaller lots in PAC. So, I'm [18:23] wondering if maybe we can put this on a [18:25] ballot to vote, have the people vote on [18:27] it, or perhaps implement a pilot [18:30] program. I hope one day soon to see PAC [18:33] embrace the great homesteading spirit [18:35] that made our country what it is. To [18:38] empower our citizens to take care of [18:39] themselves and each other, to embrace [18:42] the principles of freedom and industry, [18:44] to make preserving that small town feel [18:47] not just some superficial catchphrase, [18:49] but actually an ideal that we live and [18:51] work toward. Thank you. [18:53] >> Thank you. [18:54] >> Thanks, Sarah. [18:57] >> Okay. Anyone else like to address this? [19:02] >> No. Jim, you've already done it. [19:07] I'm speaking as a resident now. [19:11] I I don't really have much prepared, but [19:15] I was just thinking about the uh path on [19:19] um Dry Creek Path, I think it's called, [19:22] right from 1400 up to almost Main [19:24] Street. [19:26] There are some pretty big motorcycles [19:28] that ride on that path, and it's very [19:31] scary when you come across them [19:33] unknowingly. Um, I have not been caught [19:37] in the tunnel under under the road with [19:40] a motorcycle burling around that corner [19:44] yet. Um, but I can picture [19:47] the fear of my wife and my dogs while [19:51] inside that tunnel. I I'm not coming [19:54] with a solution, but I would sure like [19:56] to just voice our concern [19:59] as as a walking path to be fighting [20:03] against um these motorcycles. A lot of [20:07] electric bikes as well are on that path [20:11] and and if I had an electric bike, I [20:14] couldn't think of a better path to be [20:15] riding on myself. [20:17] So, I'm stuck with what do I do as a [20:21] parent with my kids on their bikes and [20:24] stuff? Where do I send them? I certainly [20:26] don't want them out on the highway in [20:28] the roads. Um, but I sure would like to [20:30] see a way to ban them from that walking [20:35] trail, if it indeed is a walking trail. [20:38] And I'm I'm not going to spill the [20:39] beans, but we are we are working on a [20:41] solution right now. Uh the for the for [20:44] the police to have to give them the [20:46] ability to to watch over that and patrol [20:48] that. And so hopefully that will [20:50] curtail. Hopefully a few a few warnings [20:52] will scare these individuals straight [20:54] because because right now they're not [20:55] supposed to do it. [20:56] >> It's against already for [20:58] >> it's against city ordinance. [21:00] >> Yeah. becomes an enforcement issue and [21:03] you know can't be there 24 hours a day [21:05] and [21:05] >> but you may see some different bikes [21:07] there that could offer some enforcement. [21:10] >> Yeah. And I know there's a difference [21:12] between [21:13] >> they'll be loud. [21:14] >> An electric bike and a motorbike and [21:17] sometimes that's a very fine line and [21:19] those electric bikes have gotten big and [21:20] heavy and these are little kids that [21:22] drive these things that have no more [21:24] control over it than I might. Um that [21:27] it's just a it's just a dangerous thing [21:29] for a beautiful pet. Well, and it's been [21:31] an ongoing um issue for the Maples HOA [21:34] over there, too. We uh when I was on [21:38] that board, we tried to put signs up. [21:39] They'd get stolen [21:42] um or ignored. [21:43] >> And the signs I I showed the mayor one [21:46] sign there and it's it's like 20 ft off [21:48] the path and and apparently it didn't [21:52] >> have any. [21:52] >> It wasn't one of our signs. It was an [21:54] sign. Yeah. Yeah. [21:55] >> So, I have not seen any sign about not [21:57] being, [21:58] >> but it is something we're we're aware of [21:59] and cognizant of and something we're [22:00] actually actively working on on taking [22:03] care of. [22:03] >> Great. Well, if you need a deputy on the [22:05] path, let me know. I can help you out. [22:08] >> You have more time, too. [22:09] >> On your hands. [22:11] >> A man's got to walk, you know. [22:12] >> That's true. [22:13] >> I got to get my 7,000 steps in. [22:15] >> Yeah. Should we give you a dirt bike to [22:16] patrol it? [22:18] >> Probably wouldn't be a good image. Thank [22:21] you. Thanks. [22:22] >> Thanks, Jim. Anyone [22:25] else? [22:28] Not seeing anyone here. Uh, anybody [22:31] online, Emily? [22:34] Okay, thank you. We'll go ahead and [22:36] close the public forum and move on to [22:38] staff reports. [22:49] » I doubt that. Um, I just want to thank [22:53] Jim for bringing that up. We do have a [22:54] solution in the works. Um, our resource [22:57] officers in the when they get out of [22:59] school, they're going to be uh signed to [23:01] trails. So, we're going to have a big [23:03] enforcement. Uh, the legislature changed [23:05] a few rules. Those bikes that you see, [23:07] those fast ones, those are actually [23:09] considered motorcycles and need to be [23:11] licensed. So, we've got a a campaign [23:13] we're coming up with right now. You'll [23:15] start seeing it on social media here in [23:16] the next probably couple weeks. and [23:18] we're going to get out there and and [23:20] really make a dent in that. Um they're a little they evade pretty easy, [23:25] so sometimes it's hard, but we we'll [23:28] we're we'll be working on it shortly. We [23:31] just once our high school or our uh [23:33] SRO's get out of the schools, we're [23:35] going to move them to trail and and [23:37] street enforcement for the summer. So, [23:39] it's a it'll be a good solution and [23:40] hopefully that carries on through the [23:42] whole year where we don't have them year [23:44] round, but at least we'll get good three [23:45] months of good enforcement and some [23:47] education out there. So, [23:49] >> hey Chief, can I just interject and [23:52] clarify for me because we see a lot more [23:53] of these electric bikes running around [23:55] even following traffic patterns. At what [23:58] point does that cross the line and [23:59] become illegal? I mean, are they ever so [24:01] >> It depends on the on the bike. Okay. So, [24:04] the ones that like the Saron bikes, [24:06] those are illegal all the time. They are [24:08] considered motorbikes. [24:10] So they're they're capable of going 20 [24:12] miles an hour or higher. They're going [24:13] to be considered a motorcycle. [24:15] >> Okay. [24:17] >> Scott, we got to make sure. [24:20] >> Well, we're not going to let Scott ride [24:22] a bike anymore just for obvious reasons, [24:24] but [24:26] >> that scar on his head may tell you a [24:28] tale of that, but um no, it's it's a [24:31] huge problem. It's a huge problem in [24:33] every I mean I live on I live on canal [24:35] by canal road in Salem and we have a [24:37] trail along there and I I see [24:39] 12-year-old kids riding a wheelie at 60 [24:41] miles an hour past my house almost daily [24:44] >> and that's why the law was changed a [24:46] little bit. It didn't change a lot, but [24:47] there is there is a campaign that's [24:49] coming out that uh we did lobby [24:51] legislature for some education money [24:53] that's going to be coming through uh [24:55] either DD DNR or highway safety office. [24:58] Um just aformational campaign. There is [25:01] some rules and regulations. Um we did [25:04] make it easier for us to hold on to the [25:06] bike till we can get a parent to come [25:07] get it. Um if it is a if it is in the [25:10] motorcycle category, we can actually [25:11] impound it. Uh we're not we're not [25:13] trying to take everybody's stuff. So, [25:15] we're going to try and ease into it and be a good neighbor about it. But, uh [25:19] I mean, you've seen the news. We've had [25:21] probably 10 or 12 uh young young adults [25:24] or young children, not young, but you [25:26] know, between 10 and 16 years old that [25:29] have died on them this year. And that's where the bill originated was out [25:32] of Centerville. So, um I know Southern [25:34] Utah's had a a rash of of serious [25:37] injuries or even deaths on those. So, [25:40] um, it's just not super responsible to, [25:43] you know, give a 60 mph, you know, [25:46] motorcycle to a 12-year-old kid, right? [25:48] There there's [25:49] >> there's a lot. [25:49] >> See it all the time. [25:50] >> Council Moss called me. Councilwoman [25:52] Moss called me the other night and by [25:54] the time I got down there, they were I [25:55] could not find spent 30 minutes looking [25:57] for them and they just [25:59] >> saw you coming. [26:00] >> Well, it's funny. I don't think they see [26:02] me coming, but I was suspicious enough [26:03] that they they got out of there. So, but [26:06] from there, there's trails all over. [26:07] They can go anywhere in town. That's the bad the the other issue we're [26:10] working on that's kind of part of that [26:12] is the graffiti. I mean last last [26:16] May, June and July, we got hit really [26:18] hard with graffiti in our pocket parks. [26:20] Um and that's another aspect that we're trying to curtail as well as [26:24] far as that that enforcement effort goes [26:26] through. So we've got a multiaceted [26:29] situation that we've got to get a handle [26:31] on somehow. You know, the pocket parks, [26:33] they're they're hidden. They're dark. [26:35] You know, we were going to put some [26:37] cameras up. We don't have any internet [26:38] service. We don't have any any power at [26:40] some of them. So, we're, you know, [26:41] looking at some other options, but [26:43] that's kind of where we're at on that. [26:45] >> Thanks, Chief. [26:56] » Chief number two, [26:57] >> right? Uh, kind of tag team and Brad. I [27:02] we do have on on the parks and trails [27:04] end I have all of Provos who have really [27:07] delved into this especially with the uh [27:10] the ebikes uh I think the most dangerous [27:12] thing we find is they're silent. [27:15] >> So, you know, you can have a mom or dad [27:18] with a stroller just walking along and [27:20] so so we do have all that and I' I've [27:22] talked with Brad and we'll continue to [27:24] work together to get signage up there. [27:26] Uh so, but that's not why I'm here [27:29] tonight. Although I was really gonna [27:31] embarrass Scott, but Brad kind of stole my thunder, so I won't do that. [27:35] But uh we we are we did we did offer uh [27:39] a new parks position to a gentleman and [27:43] we're hiring another position that that [27:45] left. So we'll have two new employees. [27:48] Soon as we get everything buttoned up, [27:49] we'll bring them in here and introduce [27:50] you. So we're excited about that on the [27:52] parks end. Uh and then I really wanted [27:55] to report on 930 West Park down there. [27:58] Uh what we uh Councilwoman Moss has been [28:03] gracious enough to send me some [28:04] pictures. We've been trying to talk to [28:06] everyone about uh the look. Uh kind of [28:09] what we landed on is me and Wes ended up [28:11] at the Pacin Temple uh meeting with [28:14] their grounds crew going kind of over [28:17] their whole exterior plan uh choosing [28:21] some stuff. We thought if we could kind [28:22] of bring that look outside the temple [28:25] down 9:30. So, that's kind of where [28:28] we're going with that. Um, so just with [28:30] the types of trees and and the type of [28:32] look that that's in the temple, we [28:35] thought that would work best since they [28:36] did all the research to know what grows [28:39] best and and everything in that area. [28:41] Uh, but on that, we've just been waiting [28:44] for the water to be energized and you'll [28:47] start seeing trees saw, different things [28:49] go in. The benches have been ordered. [28:51] You probably seen some pads down there [28:53] that we've poured. They're selling those [28:55] this weekend. So anyway, that's just a [28:58] report on that. I just I know people [29:00] drive past it and see it sitting there. [29:02] It's only because we've been waiting for [29:04] water. That's it. Soon as we have full [29:06] water, then we'll start planting and do [29:08] everything. So [29:09] >> So Tracy, I'm going to ask the question [29:10] that you're tired of getting asked, but [29:12] what is the deal with that bridge that's [29:13] just chilling there on the side of the [29:15] road? [29:15] >> That is a development question. Uh so [29:18] that that honestly is the development [29:20] that's just east, [29:22] >> right? It's just been [29:22] >> and and originally that that trail's [29:24] supposed to go to that bridge, cut [29:26] across, go go go through that way, but [29:28] we honestly got sick of waiting for [29:30] them. [29:31] >> And so we're we're turning the trail [29:33] across 9:30 to capture it. Yeah. [29:37] >> And we're going to have to put up [29:38] something temporary but permanent enough [29:41] that people walking, you know, will have [29:43] to transition there because you want to [29:46] go straight and there's it's going into [29:48] no man's land. [29:49] >> Yeah. So, it's frustrating, but that's [29:51] that development that [29:53] >> Okay. [29:53] >> That's in charge of putting that in. So, [29:56] >> before he put in [29:57] >> Oh, the bridge has been there a long [29:59] time. [30:00] >> We've been dealing with that for eight [30:01] years. [30:02] >> Yeah. Yeah. So, that's why we've finally [30:04] just pivoted and said we're going to [30:06] turn it and we're going to [30:07] >> get this done. So, [30:09] >> it is. Now, can you give us a quick [30:11] update on the short course, how that's [30:13] >> Sure. Yeah. I I I had a gentleman in [30:15] from North Carolina last two days who's [30:16] helping with putting putting everything [30:19] into into the mapping, you know, part of [30:22] it. So, not necessarily design, but [30:25] safety features, different things like [30:26] that. So, uh Kent's guys have been great [30:30] or Travis's uh coming up and helping. [30:33] We're getting to the point now that [30:34] we'll get all these uh maps back that we [30:39] can really settle into costs of [30:42] everything. [30:44] >> So, uh I should within two week probably [30:46] by next council meeting really have a [30:48] feel for not necessarily the layout, but [30:50] you know how we're going to do this. [30:52] >> Awesome. [30:52] >> We're having a blast. I had Dave and [30:54] Robert up there. Uh yeah, and anytime [30:57] you guys want to come walk through it, [30:58] I'd love to give anyone a tour and take [31:01] any ideas like on retention and diff [31:03] just different looks and but I I can't [31:06] say I'm like you do. I'll take your I'll [31:08] listen to you, but we'll do whatever we [31:10] want. [31:10] >> Yeah, [31:12] >> I'll just I should we'll strike that [31:14] from the record. [31:15] >> We'll we'll tell Eric that. [31:17] >> So, thank you. Thanks, Tracy. [31:20] >> I know. [31:29] Well, you're wearing a nice shirt, [31:30] Janine. [31:34] » Mayor and Council, I just want to do a [31:36] shout out of a couple events we have [31:38] coming up. Um, Arbor Day is the 23rd [31:43] and it'll be at Memorial Park and we've [31:45] invited Park View Elementary, third [31:48] grade. So Wes will talk to the third [31:50] grade about Arbor Day and about trees [31:52] and about planting trees and then we'll [31:55] split [31:56] >> that is this month. Yep. [32:00] And then we'll split into groups and u [32:02] we've had a couple of trees that we've [32:04] had to take out at Memorial Park. So [32:06] we'll replace those during that day. So [32:09] and that's at 100 p.m. And you're all [32:11] invited [32:12] >> on the 23rd. [32:13] >> 23rd. Correct. Yeah. And then Miss Pacin [32:17] will also join us and she'll hand out [32:19] cookies and punch to the kids. So it's [32:22] fun. Um May 5th is Cinco de Mayo. That's [32:26] a Tuesday and that's at the amphitheater [32:29] at the Petite Meat and that's from 5 to [32:31] 9 and you're all invited to that too. [32:34] Last year we got rained out so we were [32:37] all up on the stage so it was a we were [32:40] all it was fun actually. It was we were [32:43] a part of the presentation so it was [32:45] exciting. So we're hoping for better [32:47] weather this year. So okay, thank you. [32:50] >> Thanks Janine. [32:51] >> Janine, what was the the times on Cinco [32:54] de Mayo? [32:54] >> 5 to 9. [32:57] >> Thank you. [33:13] Hello, Mayor and Council. I do have a [33:15] Taria and it is not for sale [33:19] despite my wife's wishes. [33:23] She is trying to sell it while I was in [33:24] the ER. [33:28] Um, just to give you let you know a few [33:31] things. We've got open burning going on [33:32] right now, which is always a challenge. [33:34] Everybody wants to burn everything in [33:35] their their yard and then some. Um, but [33:38] not everything's allowed to be burned. [33:39] So, trying to regulate that and have [33:41] people do it properly. Um, but we've had [33:45] a few challenges with some of the [33:46] residents or people with their lovely [33:49] cell phones see smoke and they call it [33:51] in just because like burning prunings or [33:53] something like that in the orchards, [33:54] they don't like to see smoke or flames [33:57] so they call it in even though people [33:58] are following the rules. Um, [34:01] also to make you aware, we're working on [34:03] our wildlands reertification. We have to [34:05] do that with pack test. Um, carrying 45 [34:08] pounds in three miles in 45 minutes or [34:11] less. So, it's an arduous um test to [34:14] make sure our people can do that so we [34:17] can go on federal fires um for extended [34:19] times. Um, so we're working on that this [34:22] month. And uh the they opened the gates [34:24] today up to the ski lift. Um, so for [34:27] those who don't know where the ski lift [34:29] is, past the grotto to the parking lot [34:31] up above. Um, so those are open to that [34:34] point now. [34:35] >> Okay. And the question I've been here my [34:37] whole life, heard that phrase my whole [34:39] life. Was there ever actually a ski lift [34:40] up? [34:41] >> There was. Yes. [34:42] >> Yes. [34:42] >> Yep. You can still see some of the [34:44] concrete up in the trees just east or [34:46] west of the parking lot. Yeah. [34:48] >> It went up that hill up towards Pete [34:50] Winward. Yeah, [34:52] >> that was in her sc that was in her [34:53] scavenger hunt last year for adventure [34:56] day. [34:57] >> Okay. Okay, cool. Thank you. [34:59] >> I I skied there all the time. That's how [35:01] old I am. [35:02] >> Did you really? [35:03] >> No. [35:06] >> I know the gray hair is kind of [35:07] misleading, isn't it? [35:09] >> I got out of the ER. [35:11] >> Exactly. In my own mind, I was. [35:15] Um the last thing is um Station 92 is [35:18] coming along really good. We're trying [35:20] to do the final little tweaks and stuff [35:21] on the site plan. Um, and what they call [35:25] the vibe of the the color schemes and [35:27] stuff inside the station. That's always [35:30] fun. But it's come along trying to get [35:32] all the last details and stuff. So [35:34] hopefully within the next month to two [35:37] months, we'll have all the design done [35:38] and and get going here shortly. So [35:40] things are going really well. So thank [35:42] you [35:58] Got any other staff? I thought you were [35:59] going to get up here, Dave, for a [36:01] second. [36:05] » Okay. Okay. If there's no other staff, [36:08] we'll move to uh council reports. Uh, [36:11] I'll I'll start with Brian Hullet [36:13] because I might forget you if I don't do [36:15] it right now. Go ahead, Brian. [36:17] >> Yeah, I just have one quick thing is um [36:20] we uh the downtown organization got a [36:23] grant from the state to be able to um [36:26] contract with somebody. So, they [36:28] contract with Rhonda Hair to be the uh [36:32] director for downtown. So, I think she [36:34] contracted to do about 20 hours a week. [36:39] >> Okay. Thank you. We'll go ahead and [36:41] start here with uh Lacy. Would you like [36:45] to [36:47] >> um I only have a a thank you to the [36:52] beautiful bright red curb all along the [36:55] baseball fields and all 14 signs, but [36:58] one already did get taken out, just so [37:00] you know. [37:00] >> Yes. Right on the corner. [37:02] >> Right on the corner. [37:03] >> We didn't see it happen, but we know who [37:05] did it. [37:05] >> Okay. Anyway, but it looks beautiful. [37:07] And I will tell you since it's been [37:09] down, I haven't seen one person parked [37:11] there. And I do drive that road a lot. [37:14] Um, and then I just wanted to say this [37:17] to Sarah because I noticed we all talked [37:19] after Jim spoke, but I heard what you [37:22] said and although I have no way of [37:25] knowing how it all works, if anything, [37:27] I'm more than happy to talk to whoever [37:29] because I have a few ideas because I [37:31] know that there are there is an [37:33] ordinance with a certain land that if [37:35] your neighbors agree to the animals, [37:40] you're allowed to have certain animals [37:42] on certain sized land. It is bigger, not [37:45] a halfacre, but so I'm happy to talk to [37:47] whoever, but I heard you. So, I just [37:48] wanted to make sure you know. That's [37:50] all. [37:52] >> Ryan, [37:53] >> thank you, Mayor. I just have one little [37:55] thing. Um, the parking lot for pre-loved [37:58] and fat cats and whatever else. They're leasing that, correct, from a [38:04] different owner. Um, as as I notice on [38:07] the east side, they they had they now have the parking lot fully [38:12] fenced in. Um, but on the east side [38:14] there's no access for pedestrians. So, [38:16] you can only go out where the cars get [38:17] in, which is on the south side. And [38:19] that's real tempting for kids and people [38:21] just to hurry and dart across the road [38:23] right there. And it's really busy blind [38:25] corner. And so, I think we need to talk [38:28] to that landowner about adding um uh [38:31] access in that fence line on the east [38:33] side to allow them to to eject the [38:36] pedestrians right next to the crosswalk [38:39] on the corner. Uh just on the way down [38:41] here just right just 20 minutes ago a [38:45] sweet little family was darting across [38:46] the road right out from the chain link [38:48] from that parking lot and there's no [38:50] crosswalk there. It's really dangerous. [38:52] That road's getting too busy to do stuff [38:53] like that. So we need to we need to make [38:56] sure it's easier and more convenient for [38:58] people to use the crosswalk right there [38:59] if those businesses are in fact going to [39:01] try to make that their parking lot [39:03] that's across the street. [39:04] >> Right. And I've got his phone number [39:05] swiped. [39:05] >> A raised hand from a very good student. [39:09] I didn't hear where you said that was [39:10] at. [39:11] >> Oh, pre-loved. So, right across the [39:12] street from uh Fat Jacks to the [39:16] >> You the old Christmas tree lot. Yes. [39:18] Yep. [39:19] >> Yep. [39:21] >> I' I've got I've got his phone number, [39:23] so I'll be glad to contact. [39:25] >> Excellent. [39:26] >> Just Just a little bit of history there, [39:28] too. they approached me about that and [39:30] uh and so what I I did is I had Jonathan [39:34] from our our staff uh show what a you [39:39] know a parking lot should look like and [39:40] they could not access access that from [39:43] the highway. It had to come off of Utah [39:45] Avenue, but that that's just for cars. [39:47] So [39:47] >> yeah, right. We need to Yeah, the they [39:49] need to make access on Main Street for [39:52] pedestrians. I'll be glad. I I need to [39:54] talk to you about some other issues with [39:56] you. [39:57] >> And that's all I have. [40:00] >> Okay. [40:01] I don't have much either. I just [40:02] want to thank our staff. They're always [40:04] so willing to answer my phone calls and [40:06] answer my questions. And you guys are so [40:08] wonderful to work with and um kind [40:12] knowledgeable and professional and um so [40:15] thank you so much. And I echo what Lacy [40:18] said about the goats and um what Sarah [40:22] said. So I I'm willing to look into that [40:25] as well. So thanks so much. That's all [40:29] I've got. [40:30] >> Okay. Thank you. We'll go ahead and move [40:32] on to e action items. Public hearing [40:35] amendments to the fiscal year 2025 2026 [40:39] budget. Kathy. [40:44] » Yeah, she's right there. Yep. [40:50] » Did I surprise you? [40:54] >> Okay. [40:57] >> Try and get it up before I see myself on [40:59] the screen. [41:02] Let's see if I can get it up here. There [41:04] we go. [41:06] Okay. I put together a quick p quick [41:09] PowerPoint will come up. Um, [41:18] it's not to [41:24] Sorry. I apologize. You're fine. We'll [41:26] get there. Okay. Some of these concepts [41:29] are just a little bit thick. So, I [41:30] thought it'd be easier to to talk [41:32] through them a little bit. [41:36] So, this is the budget adjustments, the [41:38] expenditure side that we're proposing. [41:41] Um just I'm not going to hit every one [41:43] of them. Some of them are [41:44] self-explanatory, but these are kind of [41:46] some of the unusual ones. So in item [41:49] three, initially we thought that the [41:51] fire truck was a qualifiable expense [41:54] under the uh public safety impact fees. [41:56] We found out that the only portion that [41:58] we can pay out of park or public safety [42:01] impact fees is the commercial portion. [42:04] So, what we're going to do because we [42:06] expect an audit on impact fees this [42:08] year, we're going to transfer funds from [42:11] the revolving loan fund back to the park [42:13] or the public safety impact fees and [42:16] then over time we're going to pay that [42:18] back to the revolving loan fund through [42:19] an internal loan from the fire [42:21] department. [42:22] >> So, so residential impact fees cannot [42:25] help pay for a firetruck. [42:27] >> No, just the commercial. [42:28] >> That is that is [42:30] >> that is silliness. Oh, that's [42:31] >> that doesn't make any sense. Yeah, [42:33] >> right. [42:33] >> Who decided that? The legislature. [42:36] >> Yep. [42:37] >> They don't have any houses. [42:38] >> Sometimes they don't make any sense. [42:40] >> That's something needs to be looked at. [42:41] >> Wow. So, item four, this is an agreement [42:44] with Arowopath Ranch to pay for park [42:46] improvements. This is coming from the [42:48] park impact fees. [42:50] >> Um, so in the enterprise funds, as you [42:54] know, enterprise funds are like [42:55] self-supporting businesses. So, when we [42:58] did the downtown main street, we did a [43:00] lot of infrastructure. we did sewer [43:03] improvements, water improvements, all [43:05] that. So, this um adjustment is to allow [43:09] us to um transfer those funds back to [43:12] the enterprise fund so they can [43:14] recognize the assets in the enterprise [43:16] funds. [43:19] Um items 9 through 10, as you know, um [43:23] cities are limited to 35% of fund [43:26] balance. And in the budget this year for [43:28] 26, we actually budgeted out of the uh [43:34] the sales tax off the energy tax is fund [43:37] 24. Um that fund does not have [43:40] sufficient funds to transfer excess fund [43:42] balance over to the capital fund. So I'm [43:45] proposing we move that budget adjustment [43:47] back to the general fund. And it I tried [43:49] to illustrate it at the bottom net [43:52] effect. So as I said the initial fund [43:55] was budgeted out of the fund 24 but the [43:58] net effect of adding the two use of fund [44:02] reserves will be the same. So it's it's [44:04] a net zero. It's just from department to [44:06] department. [44:10] The fire station funding um last year as [44:12] you know we increased property taxes to [44:15] allow for the debt service on half the [44:18] cost of the fire station. Um, we haven't [44:21] bonded yet. So, we have those funds [44:23] sitting in the general fund. I'd like to [44:25] move them over to the capital fund, hold [44:27] them in a reserve account until we have [44:28] that debt service come come through. [44:32] >> And Kathy, I want to make a mention on [44:33] this uh item 11. And just reiterate to [44:36] the residents. Here's here's the proof. [44:39] The the property tax increase that we [44:42] approved, that's the money right there [44:44] going straight to the fire station just [44:46] like we promised. It's not being spent [44:47] in other areas. It is. We sold it as as furnishing the debt for the fire [44:53] station and that's exactly what that [44:55] money is earmarked and what it's doing. [44:57] Nothing else. [44:57] >> Yep. [44:59] >> Glad you pointed that out. [45:01] >> So item 12 um this is all the general [45:05] fund um departments. They're in separate [45:08] funds, but at the end of the year we [45:10] roll them up into the general fund. So [45:12] the fund balance of all these little [45:14] funds is essentially the fund balance of [45:16] the general fund. As you know, in the uh [45:20] petite neat, we budgeted for the [45:22] bathroom remodel and did not expend all [45:24] those funds. Um Carl thought it would [45:27] pro be prudent to use those funds to [45:29] epoxy the floor of the pool. Some of the [45:32] reasons are that we're kind of competing [45:34] with Spanish Fort. We'd like to keep the [45:36] facility up and keep it nice. This is [45:39] only the current year budget. It doesn't [45:42] affect any future projects in the petite [45:44] need or anything else. And there's no [45:46] other um planned projects in the petite [45:49] neat. So this is just to allow Carl to [45:51] use those funds for that purpose [45:55] in this budget year. Yeah, we have more [45:57] projects budgeted next year for the [45:59] petite meat. Um and just to let you [46:01] know, we are planning one more open [46:03] budget in June and that's going to true [46:05] up all the funds so that we're in [46:07] compliance with state audit and all that [46:10] kind of good stuff. So, and we may have [46:13] to depending on if all the projects that [46:16] we have budgeted this year get done or [46:18] not, might have to transfer more fund [46:20] balance over to this capital fund. [46:23] That allows the council with the [46:25] guidance of Robert and Dave to um [46:28] allocate on new projects and allows us [46:30] to do new capital projects so it doesn't [46:32] go to waste. [46:34] And that's all I've got. [46:36] >> Okay. Council, any questions? [46:39] >> Thanks. [46:40] >> Okay. We'll go ahead uh and if we need [46:43] if it's for some more questions, we can [46:45] do that, too. But I'll accept a motion [46:46] to open the public hearing. [46:48] >> I motion that we open the public [46:50] hearing. [46:51] >> Is there a second? [46:52] >> I second that. [46:53] >> Second. Okay. Roll call vote. [46:56] >> Starting with council Helet? [46:58] >> Yes. [47:00] >> Council Moss, [47:00] >> yes. [47:01] >> Council, [47:02] >> yes. [47:02] >> Council Smith, [47:03] >> yes. [47:04] >> Okay, [47:04] >> motion carries and uh we'll open up a [47:07] public hearing. Step to the mic, please. [47:08] State your name and address and speak [47:10] clearly. [47:12] Let me your comments if you can to about [47:14] 3 minutes. Uh let me your comments to [47:16] whether you agree or disagree with we've [47:18] just heard from from Kathy our financial [47:22] director. So we'll go ahead and open it [47:24] up. [47:27] Okay. Not seeing anyone here that is [47:30] going to address this. Is there anybody [47:31] online? Okay. I'll accept a motion to [47:35] close the public hearing. [47:36] >> Hey. A motion to close the public [47:37] hearing. I'll second. [47:39] >> Okay. [47:41] Uh, I'll go ahead and just just All in [47:43] favor say I. [47:44] >> I. [47:45] >> Yes. [47:45] >> Any opposed? [47:52] » Ex mayor call on me. [47:55] >> He must oppose. [47:58] >> Yeah, that's enable. Okay, moving on. [48:02] We'll go ahead and close the public [48:03] hearing. Um, any other discussion? just [48:07] thank you for for keeping track of the [48:09] finances. That's the most important part [48:11] of of our city of of handling the the [48:13] funds of the residents and and again, [48:15] I'm just so excited to see the the [48:17] specifically earmarked money that we promised that would go to the [48:21] fire station is is there being held and [48:23] going to work for us in the future once [48:25] we bond for that. [48:28] And I'm excited to see some something [48:30] come in under budget and use those funds [48:32] uh somewhere else like at the pool as [48:34] well. [48:36] That's wonderful. That's awesome. [48:38] >> Yeah, those those improvements at [48:40] Petitney were very badly needed and [48:43] they're they're very nice. [48:44] >> Yeah. [48:46] >> Okay. [48:48] Then I'm ready for a motion on this [48:49] item. [48:51] >> Mayor, I motion that we approve the [48:54] amendments to the fiscal year 2025 2026 [48:57] budget that has been just been presented [48:59] to us. [49:00] >> I'll second. [49:01] >> Yeah, I have a motion and seconded. The [49:03] roll call vote starting with council [49:04] Smith. Yes. [49:05] >> Council Roelly. [49:06] >> Yes. Council [49:07] >> Moss. [49:07] >> Yes. [49:08] >> Council Hullet. [49:09] >> Yes. [49:10] >> Thank you. Motion carries. [49:13] Moving on to number two. Resolution. [49:15] Economic Development Board appointments. [49:19] That's up to you, Robert. [49:24] Council member Hillet, would you like to [49:25] introduce these people or do you want me [49:27] to do it? [49:28] >> Go ahead, Robert. [49:29] >> Okay. Great. [49:31] We are so grateful to have um three new [49:34] members uh to be recommended to the [49:37] economic development board. Uh first of [49:40] all, uh Lindseay Hughes. Uh she will be [49:43] representing Neibo School District. Uh [49:45] we're so excited to have a [49:47] representative from the school district [49:48] join us. Again, their input is very [49:51] important. Uh Joseph Hansen is a [49:54] resident of PAC and has been involved in [49:57] many different things and we're excited [49:58] to have him. And then Sean Pickup uh is [50:01] a business owner in PAC Pacado. And uh [50:06] Sean has served uh for quite some time [50:09] on the business retention committee. Uh [50:11] been really helpful and don't think [50:13] you're going anywhere from that [50:15] committee. So we're going to keep him on [50:17] there. But we're so excited for these uh [50:20] people and grateful for their [50:22] willingness to serve and just recommend [50:23] them to you as the council to be on the [50:25] board. [50:26] >> Okay. Um Sean, you want to stand up? [50:29] You're the only one here, I think. [50:32] >> And then um yeah, we have them ready to [50:35] accept that. [50:36] >> Okay, [50:37] >> we'll need to approve before we [50:40] >> Yeah, that's we we need to make them [50:41] take action. [50:42] >> Okay, any council discussion? Okay. Uh [50:47] >> thank you everyone for willing us to [50:49] serve on these committees and boards. [50:51] >> So I'll accept a motion on this item. [50:57] I was going to see if Brian wanted to do [50:59] this one, but uh Brian, you want to make [51:02] the motion? [51:03] >> Okay, I'll make a motion that we approve [51:04] the three that we just talked about to [51:07] the economic development board. [51:10] >> I'll second. [51:11] >> Okay, we have got a motion been [51:12] seconded. The roll call vote started [51:14] with Council Helet. [51:17] >> Yes. [51:18] >> Council Moss, [51:19] >> yes. [51:19] >> Councelor Early, [51:20] >> yes. [51:20] >> Council Smith, [51:21] >> yes. [51:21] >> Good motion carries. Are you ready, [51:24] Emily? [51:58] Done. Congratulations. [52:07] Okay, moving on to number three. A [52:09] resolution board of adjustment [52:11] appointment and the oath of office. Uh [52:15] council make a recommendation of Rick [52:18] Johnson to be part of the board of uh [52:22] adjustments. Any discussion on that [52:25] action? [52:28] Okay, [52:29] then I'm ready for a motion on on this [52:31] item. [52:33] Mayor, I motion that we approve the [52:35] board of adjustment appointment of Rick [52:37] Johnson. [52:39] >> A second. [52:39] >> Okay. Have a motion seconded. Roll call [52:41] vote starting with council Smith. [52:43] >> Yes. [52:44] >> Council Roelly. [52:45] >> Yes. [52:45] >> Council Moss. [52:46] >> Yes. [52:46] >> Council Heer. [52:47] >> Yes. [52:48] >> Wonderful. Motion carries. Are you [52:50] ready, Rick? Come on up. [53:08] Congratulations. [53:36] Okay, moving on to number four. Another [53:38] resolution, the planning commission [53:40] appointments and oath of office. Uh, [53:43] I'll go ahead and take this one. Uh, [53:46] ladies and gentlemen, we we we had I [53:48] can't can't remember how many we had. [53:50] How many do we have? About five or six, [53:51] maybe more than that. [53:54] >> Six or seven applications to be part of [53:58] the planning commission. We had some [54:00] great great uh uh people that that [54:03] wanted to be part of the planning [54:05] commission. The end result uh is that we [54:09] decided that it would be well for us to [54:12] maintain the the two that uh were up for [54:16] renewal and so Ryan Frisbee and Perry [54:18] Adams is the those uh that two that have [54:22] been nominated to be again part of the [54:24] planning commission. [54:26] council have any uh discussion about [54:28] this particular item? [54:30] >> I'm I'm happy to see that these two fine [54:32] gentlemen decide to to stay on and [54:34] reapply. I think we're in an important [54:36] space on the planning commission and in [54:38] city at the city as we change. So, thank [54:40] you both for your willingness to to keep [54:42] serving in this capacity. It's such an [54:44] important commission [54:47] >> that ditto. [54:49] So, uh I'll ask for a motion. [54:54] Mayor, I motion that we approve the [54:56] planning commission appointments of Ryan [54:58] Frisbee and Perry Adams. [55:00] >> Okay. Is there a second? [55:02] >> I'll second. [55:02] >> Okay. Motion been made and seconded. Uh [55:06] roll co starting with council Helet. [55:09] >> Council Moss. [55:10] >> Yes. [55:10] >> Council Rowley. [55:11] >> Yes. [55:12] >> Council Smith. [55:13] >> Yes. [55:13] >> Wonderful. The motion carries. [55:17] And we'll go ahead and have Emily do her [55:20] thing. Come on up, man. Gentlemen, [55:25] again, appreciate you being willing to be part of planning commission. [55:29] You're doing a great job. [55:43] Swear that I will support [55:44] >> obey and defend the United States [55:53] » state of Utah. [56:07] » Congratulations. Thank you. [56:26] Okay, moving on to number five. [56:27] Resolution intend to submit an opinion [56:31] question to face and residents regarding [56:33] the PRC tax park tax and notice to Utah [56:39] County. I don't see Carl here, but [56:41] Brandon, are you going to address us on [56:43] it? [56:43] >> I can take it. Okay, [56:49] » because the rumor was Carl was going to [56:51] have this presentation with all the [56:53] beautiful things that the park tax had [56:56] purchased and gone towards in the past [56:57] and I was like that that would be great [57:00] but looks like he's not here. Um, so the resolutions that are in the packet [57:06] are um to renew uh the park tax. every [57:11] 10 years it expires and we have to renew [57:13] it and resubmit it to the voters. So the [57:16] first step in that is determining [57:18] whether the city can actually place the [57:19] question on the ballot. So we have to [57:20] send a notice of intent to Utah County [57:23] and once it goes through the Utah County [57:26] Commission saying that they're not going [57:27] to pass a countywide park tax then they [57:30] give us the okay to put it on the [57:32] ballot. And then the second resolution [57:34] in there is the um question that would [57:37] go on the ballot. Shall Pacin City enact [57:39] a a tax of onetenth of uh a cent on [57:43] sales to go towards the the park tax? So [57:45] the park [57:47] uh parks, arts, recreation, and [57:51] can't remember C, but also known as the [57:53] zap tax, zoo arts and parks. Um uh I [57:57] think it's one of the most um visual [57:59] representations of where a tax money [58:01] goes that we can see it in the [58:02] community. Um, so with your vote on [58:05] those uh on these items tonight, we [58:08] would send uh the resolution to Utah [58:10] County to get their go ahead and then [58:13] get their approval for the ballot [58:14] language. So, uh it's actually due June [58:17] 30th. We're just getting ahead of the [58:18] curve here in April to be ready in time [58:20] for it. [58:21] >> Yeah, I might mention that as you say, [58:22] it's the one of the most visual uh tax [58:25] results that we can we can find. We've [58:28] and then some of the things that uh [58:30] we've done connect the walking trails [58:34] that go underneath the the highway going [58:36] to Spring Lake cover for playground [58:40] equipment or pickup courts [58:42] >> courts [58:43] >> music for the uh pace and band uh for [58:47] the concert concert and on Sundays u so [58:52] there's there's a lot of things that [58:54] it's a very beneficial use of the [58:58] I I'm a [58:59] >> we've collected over [59:00] >> Go ahead. [59:00] >> We've collected over $3 million since [59:03] that been in place for that goes back to [59:06] our community. [59:07] And nice thing is too is that anybody [59:10] that shops at Walmart, whether they live [59:12] in Pac or not, that goes into our [59:14] community. [59:17] » With this with the the opinion question, [59:20] I anticipate that'll be some sort of [59:22] survey we send out to the to the [59:24] residents. Is that what that is? [59:26] >> It would go on the ballot for them to [59:28] vote on the election in November. [59:30] >> Okay. Are we going to send any survey? [59:32] Have we talked about that at all? I just [59:34] I really want to make sure we educate [59:35] the residents on this park tax because [59:37] it's a wonderful thing. It's not a new [59:39] tax. It's just a portion of the sales [59:42] tax and we we desperately need it to [59:44] continue to help quality of life and [59:46] parks and everything else in our city. [59:47] >> Yep. Great great question. Um, we can't [59:50] necessarily have an opinion on whether [59:51] people should do that or not, but Carl [59:54] has prepared a really, really great [59:56] video that goes through and demonstrates [59:59] all of the projects that we've been able [1:00:01] to do be uh in part because of these [1:00:04] funds. And I think that will be very [1:00:05] helpful. Uh, if people want to, you [1:00:08] know, get together and and [1:00:11] campaign for it, we can provide a lot of [1:00:13] information about what has been done [1:00:15] with that money. We just can't as a as a [1:00:18] city influence a vote. Okay. [1:00:21] >> Right. Okay. [1:00:22] >> I can't put that video. Sorry. [1:00:23] >> No, go ahead. [1:00:24] >> Oh, we'll put the video on our web page, [1:00:26] right? And on our Facebook page and [1:00:28] stuff because it's actually just [1:00:30] detailing all of the the information and [1:00:33] how that money has been expended in our [1:00:35] community. We totally can do that. [1:00:38] >> And I'll echo what Ryan said. It's not a [1:00:40] new tax. It's just the usage of that [1:00:42] money that's there. And I that's part of [1:00:45] the checklist is there is a part of that [1:00:48] the the code uh the state code allows us [1:00:50] to do is an education [1:00:53] >> campaign get the word out there what it's for what it's been used for. [1:00:57] Yeah. So that that that is a component [1:00:59] of the overall process. [1:01:00] >> Correct me if I'm wrong. We've used some [1:01:01] of those uh uh uh the monies from gener [1:01:05] generated from there to improve the the [1:01:07] park trails, the [1:01:08] >> the trails, the benches, [1:01:11] >> remove the asphalt and real nice uh [1:01:13] cement trails. [1:01:15] >> Okay. [1:01:16] >> So, when we did this before when we [1:01:17] first put it on the ballot, uh we had a group of citizens that got together [1:01:23] and met once in a while and and really [1:01:26] pushed it as group of citizens. So, I [1:01:28] think we could do that again. [1:01:30] Let's Let's do that'd be excellent. [1:01:36] » Okay. Got anything else for us, Brendon? [1:01:38] >> No. [1:01:38] >> Okay. Any any further discussion, [1:01:41] council? [1:01:42] >> Okay. I'm ready for a motion. [1:01:44] >> I'll make a motion that we approve the [1:01:47] putting the um on the ballot the um the [1:01:51] park tax opinion and also send it to the [1:01:54] county, get their approval that we can [1:01:56] do that. [1:01:58] >> I'll second. I'll second. [1:02:00] >> We have a motion been seconded. Uh roll [1:02:02] coal starting with council Hullet. [1:02:05] >> Yes. [1:02:06] >> Council Moss. [1:02:07] >> Yes. [1:02:07] >> Council Roelly. [1:02:09] >> Yes. [1:02:09] >> And council Smith. [1:02:10] >> Yes. [1:02:10] >> Wonderful. Motion carries. Thank you. [1:02:13] We'll move on to number six. Ordinance [1:02:15] code amendments to various sections of [1:02:17] the title 12 subdivision regulations of [1:02:21] the pace and city code regarding [1:02:22] residential density. Michael. [1:02:27] >> Thank you. Mayor and council. Um, this [1:02:29] presentation is really short because the [1:02:31] bulk of it is the text and the things [1:02:33] that you see in your packets. It's going [1:02:35] to be a presentation for all five of [1:02:37] these upcoming agenda items. They are [1:02:39] separate agenda items to vote on, but I [1:02:42] would also uh caution you that if you're [1:02:44] voting on one, you should consider them [1:02:46] as a whole because they all affect each [1:02:48] other. But let me let me pull that up [1:02:50] really quickly. [1:02:54] Um, if if you want to read them all, [1:02:56] that's fine. there. I'll sh I'll share [1:02:57] them in the presentation too. So, tonight we have title 12 subdivision [1:03:17] regulations, title 13 zoning, the [1:03:21] general plan, the Spring Creek area [1:03:23] specific plan, and the South Meadows [1:03:26] area specific plan. And all of these are [1:03:30] um related to density and how that's [1:03:33] defined, how it's uh identified on our [1:03:36] maps, and our plans in our documents. [1:03:39] Uh city council's role tonight would be [1:03:41] to make a decision on this whether or [1:03:43] not to approve it, deny it, table it, uh [1:03:46] approve it with modifications. We're [1:03:48] open to all of those. Um it did have a [1:03:51] public hearing at planning commission. [1:03:53] It was voted unanimously for a positive [1:03:55] recommendation of approval. I noticed [1:03:58] when I was putting this presentation [1:03:59] together, I did not put the planning [1:04:01] commission minutes in the packet, but [1:04:03] the minutes consist of that last [1:04:05] paragraph right there on this item. So, [1:04:08] it's uh some brief comments that the [1:04:11] commissioners had about this and then [1:04:13] they voted uh unanimously to approve it. [1:04:16] and Michael, thank you for including the [1:04:18] planning commission's uh conversation [1:04:20] and vote right here in the in the [1:04:23] PowerPoint. Thank you. [1:04:24] >> Sure. [1:04:27] » Um I talked about this a little bit. Um [1:04:30] each of these requests are all related [1:04:32] to density and how it's defined and [1:04:34] identified and viewed in these [1:04:37] documents. [1:04:38] um [1:04:40] units per acre, for example, the word [1:04:43] density, gross density, net density, all [1:04:45] of that staff looked at to try to create [1:04:48] a cohesive, clear understanding of how [1:04:51] these would be interpreted in all of [1:04:52] these documents. [1:04:55] So, with that, if this council wants to [1:04:58] look at any particular documents, I can [1:05:00] close this presentation and pull those [1:05:02] up. Um I it's kind of up to you how how [1:05:05] you want to proceed at this point. [1:05:09] Can I ask um [1:05:13] this may be a really dumb question [1:05:15] maybe, but [1:05:17] from the planning and development, [1:05:22] do you see this as a good thing because [1:05:24] it helps clarify [1:05:27] or what is like the idea behind so many [1:05:32] changes? Um, like for me it was there [1:05:34] were certain things that I myself was [1:05:38] I felt like it could have been [1:05:41] understood [1:05:42] differently by other people like the way [1:05:44] that I kept reading it over and over [1:05:46] again and there was just some things [1:05:47] that so that's I'm just curious from [1:05:50] like your guys's if if that's allowed or [1:05:53] >> we have often u conversation with [1:05:56] property owners, prospective builders, [1:05:58] developers, that sort of a thing. most [1:06:01] of the time they want to look at gross [1:06:04] density, meaning all of the entirety of [1:06:07] the property over what's buildable and [1:06:10] excluding roads, things like that. And [1:06:12] so we want to clearly define that [1:06:14] throughout all of these documents. Um, [1:06:17] we had our consultant that's working on [1:06:19] our uh zoning code amendments for us and [1:06:23] our our revisions of our zoning code [1:06:25] look at titles 12 and 13 and and provide [1:06:28] feedback. um in your packets. Um [1:06:32] there is all of her her edits and [1:06:34] suggested changes I believe are in [1:06:36] purple and then staff looked at it again [1:06:40] um with our attorney and we kind of [1:06:43] changed a few minor things here and [1:06:45] there. But um hopefully that answers [1:06:47] your question. But the idea is to to [1:06:49] bring clarity to uh council to uh [1:06:52] planning commission to staff and to [1:06:54] prospective developers. [1:06:56] And I think the main goal here of of [1:06:58] specifically the code rewrite, but just [1:07:00] specifically these codes too, is is to [1:07:03] remove any subjectivity of of [1:07:06] assumptions or or loopholes or there's no more surprises. It's cleancut [1:07:11] of what the density means, what's there, [1:07:14] and that way there's no surprises for [1:07:16] the developer or more importantly for [1:07:17] the city. And that that's what I saw as [1:07:20] I read through that. And Michael, can [1:07:21] you uh can you confirm are we are we [1:07:25] removing all mentions of or or ideas of [1:07:29] gross density and moving to net density [1:07:31] or what did you what you guys [1:07:33] >> what we're doing is there's she [1:07:35] recommended striking both gross and net [1:07:38] density out and creating a definition [1:07:40] titled density. And so that's that new [1:07:42] language that's in there. And then how [1:07:44] we are going to calculate density is [1:07:46] that definition not using the others. [1:07:49] There is also um a definition specific [1:07:53] in the RMF zone, the multif family zone [1:07:56] talking about how density is going to be [1:07:58] addressed for multif family development. [1:08:00] >> Okay, for a simple mind such as myself, [1:08:03] how are we identifying density now with [1:08:05] the code changes proposed? So [1:08:07] essentially anything that's not [1:08:08] buildable, we want to exclude, but we [1:08:11] want to reward developers if they're [1:08:13] having open space and park space, such [1:08:16] like that, but we we don't want them to [1:08:18] have credit for unbuildable space. We [1:08:20] don't want them to have credit for their [1:08:22] roads, that sort of a thing. And so [1:08:24] that's that's the intent of what we want [1:08:25] to do. We we want to see that open space [1:08:28] and and dedicated parks. And so we want [1:08:30] to let them have density for that even [1:08:32] if they're not building on those [1:08:34] properties. like no credit for wetlands [1:08:37] that are [1:08:37] >> correct [1:08:38] >> just going to be mosquito wetlands. [1:08:40] >> Yeah, correct. [1:08:41] >> Which which I'm I'm all for uh giving [1:08:43] them some credit like you said for the [1:08:45] green space and the parks and stuff, but [1:08:47] yeah, giving having them the ability to [1:08:50] call wet space and then skew the whole [1:08:53] lot sizes and and homes. That was a [1:08:55] heartburn for me. So, I'm glad that [1:08:56] we're relieving that. And and for [1:08:59] clarification of the public, council has [1:09:02] all of this, but we're we're trying to [1:09:04] move from a a units per acre on our maps [1:09:06] and in our plans to the most appropriate [1:09:10] zone we feel that plan is trying to [1:09:13] achieve. And so we try to put a zoning [1:09:16] designation in our from our zoning code [1:09:19] in each of those plans where it makes [1:09:21] sense. [1:09:23] >> Okay? Okay. And so when a developer [1:09:24] comes before us and let's just say they ask for a zone change. Okay. Um [1:09:31] with with the current code, we can point [1:09:33] to units per acre uh and and use that as a backs stopper of going one way or [1:09:40] another. If we have specific zones for [1:09:43] specific areas, [1:09:45] how how can we use that as ammunition to [1:09:47] either protect or incentivize uh [1:09:49] residents or builders? [1:09:52] Well, I think the intent of the the plan [1:09:54] with these changes would be that that [1:09:57] would be the understanding that that [1:09:58] zone would be assigned when a zone [1:10:02] change were to happen. There's still the [1:10:05] plan is just that it's a plan. It's a [1:10:07] guiding document. You can still make a [1:10:09] different decision, but the idea is it's [1:10:12] trying to meet what we originally had in [1:10:14] there of say four units to the acre. [1:10:16] We're interpreting that generally as R [1:10:20] 110, so the 10,000 square foot lots. [1:10:24] >> And so [1:10:25] >> we just want it to be clear in that [1:10:27] regard. Uh it gets harder with [1:10:29] multifamily because how how do you do [1:10:32] that? They don't actually have a lot and [1:10:35] so that we still have to have that [1:10:37] definition of how we're going to define [1:10:39] density there. [1:10:40] >> Okay. Very good. Thank Is that why on [1:10:42] the Spring Creek the residential units [1:10:45] went to to be determined because prior [1:10:49] it had [1:10:51] >> amounts? So I guess like that when I saw [1:10:54] that that was my only like hesitation of [1:10:56] like well how many lots now how many [1:10:58] homes are going to be in there you know [1:10:59] and so that was [1:11:00] >> so who determines it. [1:11:02] >> Yeah I didn't like that's where it comes back to the zone [1:11:06] that is assigned. [1:11:08] >> Okay. So, if it's zoned R110, then every [1:11:11] single lot has to be 10,000 square feet unless [1:11:15] >> there's some development agreement that [1:11:16] changes that or a master plan or [1:11:18] something that that they can do [1:11:19] something different. [1:11:20] >> So, it could technically be less than [1:11:22] what was proposed before because now [1:11:23] non-usable land would be removed. [1:11:26] >> it could be. [1:11:29] >> The Spring Creek plan was very good at [1:11:33] identifying developable land and so I [1:11:36] think it's pretty accurate. We just [1:11:38] wanted to streamline through all of the [1:11:40] plans and the ordinances the same kind [1:11:43] of language. And so the Spring Creek [1:11:45] didn't have much to actually put into [1:11:47] it. [1:11:49] >> And so Michael, so we're we're changing [1:11:51] the general plan and then [1:11:52] subsequentially we're we're changing all [1:11:54] the specific area plans that it needed [1:11:57] to be changed with the language. [1:11:58] Correct. [1:11:59] >> Okay. [1:11:59] >> There is um I want to say it's in the [1:12:03] South Meadows plan. There's a section [1:12:04] toward the I think it's the very last [1:12:07] page in your packet on that South [1:12:09] Meadows talking about the executive [1:12:12] style homes and the density such there. [1:12:15] I don't think anything needs to change [1:12:16] there. I just was calling it out to you [1:12:19] because it does say units per acre, but [1:12:21] then they also talk about a lot size [1:12:23] there. So, we probably don't need to [1:12:25] change anything there. I just wanted to [1:12:26] bring it up so that you can see that [1:12:28] there and if you felt there was a need, [1:12:30] we could do that there. [1:12:34] looked like a lot of work. [1:12:35] >> It was fun through that. So, thank you. [1:12:37] This is so important we do this though [1:12:38] and and and remove any assumptions from [1:12:41] either side. No surprises. [1:12:44] >> Okay. Any other discussions? [1:12:47] They're all interconnected. So, uh [1:12:49] >> you need a separate motion for each. [1:12:51] >> Yep. So, we'll just go through them and [1:12:52] then we'll [1:12:54] >> take turn. [1:12:57] >> Okay. I'm ready for unless there's any [1:12:59] further discussion. I'm ready for a [1:13:01] motion on this particular item. [1:13:03] >> Take the first one. [1:13:04] >> Okay. [1:13:05] >> Turn your mic on and [1:13:06] >> that we approve the [1:13:08] >> mic. Mic just turn it on. [1:13:11] >> Sorry. There we go. [1:13:12] >> I always remember except for just [1:13:15] >> um Okay, I'll start over. Mayor, I I [1:13:17] motion that we approve um the code [1:13:20] amendments to various sections of title [1:13:22] 12 subdivision regulations of the PAC [1:13:23] and city code regarding residential [1:13:26] density. I'll second. [1:13:28] >> Do we have a motion been seconded? Roll [1:13:30] call vote starting with Lacy. [1:13:32] >> Yes. [1:13:33] >> Brian, [1:13:34] >> yes. And [1:13:35] >> yes. [1:13:36] >> And [1:13:38] >> yes. [1:13:38] >> Brian. [1:13:40] >> The guy online. [1:13:41] >> Yeah. Brian, did you say yes? [1:13:43] >> Yes, I did. [1:13:44] >> Okay. Motion carries. Thank you. [1:13:46] >> Mayor, I make a motion that we approve [1:13:48] the code amendments to various sections [1:13:49] of title 13 zoning of the PAC city code [1:13:52] regarding residential density. [1:13:55] >> I'll second that one. [1:13:56] >> Okay. We have a motion been seconded. [1:13:58] Roll call vote starting with Brian. [1:14:00] >> Yes. [1:14:02] >> And [1:14:02] >> yes. [1:14:03] >> Brian. [1:14:04] >> Yes. [1:14:05] >> Wonderful. Motion carries. Going on [1:14:07] number eight. [1:14:09] >> Mayor, I motion that we approve the [1:14:10] general plan amendment to various [1:14:12] sections sections of the general plan [1:14:14] regarding residential density. [1:14:17] >> I'll second. [1:14:18] >> Okay. Motion and a second. Roll call [1:14:21] vote starting with council Smith. [1:14:23] >> Yes. [1:14:24] >> Council Roelly. Yes. [1:14:25] >> Council Moss. [1:14:26] >> Yes. [1:14:26] >> Council Heer. [1:14:27] >> Yes. [1:14:29] >> Wonderful. Motion carries. Moving on to [1:14:32] number nine. [1:14:34] >> I'll take this one. [1:14:35] >> Okay. [1:14:36] >> Mayor, I motion that we approve the [1:14:37] general plan amendment to the Spring [1:14:39] Creek area specific plan for various [1:14:41] sections regarding density. [1:14:44] >> I second. [1:14:46] >> Okay. We have a motion been seconded. [1:14:48] Roll call vote starting with council. [1:14:52] >> Yes. [1:14:54] What was that? [1:14:55] >> Yes. [1:14:57] >> Council Moss. [1:14:57] >> Yes. [1:14:58] >> Council Rowling. [1:14:58] >> Yes. [1:14:59] >> Council Smith. [1:15:00] >> Yes. [1:15:00] >> Motion carries. Thank you. Number 10. [1:15:02] >> I'll motion that we approve the general [1:15:05] plan amendment to the South Meadows area [1:15:07] specific plan for various sections [1:15:10] regarding density. [1:15:11] >> I'll second. [1:15:12] >> Okay. I have a motion been seconded. [1:15:14] Roll call vote. Starting with Council [1:15:17] Smith. [1:15:17] >> Yes. [1:15:18] >> Council Roelly. [1:15:19] >> Yes. [1:15:19] >> Council Moss. [1:15:20] >> Yes. Council Helet. [1:15:22] >> Yeah. [1:15:23] >> Okay. Motion carries. More. Going on to [1:15:26] number 11. Ordinance amending title six [1:15:30] and in acting a new chapter prohibiting [1:15:33] virtual currency machines and providing [1:15:36] for enforcement and penalties. Chief and [1:15:41] Brandon, I think I think this is a this [1:15:44] is a very critical addition that we need [1:15:46] to use. [1:15:56] about [1:15:58] turn your mic on. Chief, [1:16:01] >> join the club. [1:16:02] >> I don't have a guy. [1:16:02] >> Hello. Hello. [1:16:04] >> Um, recently the legislator made some [1:16:07] changes to the the cryptocurrency [1:16:08] machines that we see at our our uh some [1:16:10] of our convenience stores or some of the [1:16:13] other location uh retail uh locations in [1:16:16] town. Um, our crypto machines um here [1:16:21] and other places in the community are used about 98% of the time for scams [1:16:28] uh which technically usually involve our [1:16:31] elderly citizens or some other type [1:16:34] incapacitation. Um so we we're following [1:16:37] suit with some of the other communities. [1:16:39] Leighton passed the first one a couple [1:16:41] of weeks ago. Uh they forward that [1:16:42] information to us. They done a lot of [1:16:44] research on it. um spoke with the [1:16:46] sponsor of the legislature as well as uh [1:16:49] the attorney general's office who who [1:16:51] gave him the thumbs up with with banning [1:16:54] some of these machines and and the main [1:16:55] reason is just fraud. A few years ago, [1:16:57] we went out to all of our locations and [1:17:00] put up signs saying, "Hey, you know, [1:17:02] before you make a transaction, make sure it's not someone [1:17:06] calling you to post bail from your [1:17:08] friend in Guatemala or you know, the [1:17:10] government's after you got to post this [1:17:12] or your computer's broken. um you got to [1:17:15] pay for customer service. There's a [1:17:17] whole bunch of scams. We went back and [1:17:19] just done a real quick search in ours [1:17:20] the last two years. We've had $100,000 [1:17:23] in scams come out of our uh [1:17:25] cryptocurrency. [1:17:26] Um obviously we're a lot less populated [1:17:28] than the the Davis County area, but they had about 11 million in a 5year [1:17:32] period. Um so it is becoming well it is [1:17:36] it has been you know for that there's [1:17:39] not a lot of legitimate purposes to have [1:17:40] the machine anyway. Um the legislators [1:17:43] did dial it down to where you could only [1:17:45] do $2,000 transactions at the most, but [1:17:48] obviously they've had them 30 40 50 [1:17:50] $60,000. Um it's it's it's perpetuating [1:17:55] criminal activity is really what it is. [1:17:57] So we we felt the need to follow suit. [1:17:59] Um other cities such as Worm, West [1:18:01] Jordan, South Jordan are in the in the [1:18:02] process of of you know researching it as [1:18:05] well. I met with Brandon. Brandon had uh [1:18:08] looked over it and uh we feel like we're [1:18:10] in a good spot with it with this [1:18:12] ordinance. So, this ordinance will give [1:18:14] them 60 days to remove the machines. And [1:18:16] in fact, talking to Chief Swanson and [1:18:18] Elon, their business owners, they had [1:18:20] like 16 of them and they all thanked him [1:18:22] for creating this ordinance so they [1:18:23] didn't have to have those machines [1:18:25] anymore. They could get out of their [1:18:26] leasing situation with them. So, [1:18:28] >> I think it's critical that we help [1:18:30] protect people from their own emotions [1:18:33] sometimes. [1:18:35] Yeah, we we've had, you know, we had one [1:18:37] I won't name names, but we had one that [1:18:38] was $30,000. [1:18:40] >> Yeah. [1:18:40] >> How many do we have here? [1:18:41] >> We have six. [1:18:42] >> I didn't even know we had them. [1:18:44] >> Yeah. Well, I thought we had three [1:18:46] >> and and Detective Mark Hartson went out [1:18:48] and and actually physically done a count [1:18:50] for us the other day and and look also [1:18:52] looked at some of the cases and said we [1:18:54] were about $100,000 in the last two [1:18:56] years and then we have six of them. I [1:18:58] thought we had three, but [1:18:59] >> I was I was wrong. Sometimes people are [1:19:02] victims two and three times. [1:19:04] >> Well, yeah. I mean, you get someone that [1:19:06] gets scared into into doing this, you [1:19:09] know, they do it, you know, and and they [1:19:10] stay on the phone with them. They'll [1:19:11] stay on the phone, [1:19:13] >> you know, go to your local store, you [1:19:15] know, they'll they'll search up a crypto [1:19:16] station and go go withdraw $15,000 from [1:19:20] your bank account, take it to the crypto [1:19:22] kiosk, and they give them a a wallet [1:19:25] address is what they call it, and [1:19:27] they'll put their money in the machine. [1:19:28] and they'll dial up a a wallet address, [1:19:30] hit send, kind of like a reverse ATM [1:19:33] machine, and it goes, who knows where it [1:19:35] goes, and it's very hard to get it back. [1:19:37] Our special agent in charge of the FBI [1:19:40] here said that sometimes they're able to [1:19:42] get about 30% of the money back, but [1:19:44] it's it's pretty hard, but it's a [1:19:46] billions and billions of dollars that [1:19:48] goes through a year. So, [1:19:49] >> I'm I'm glad to see us considering a [1:19:51] outright ban on these machines. They do [1:19:53] they they serve no purpose, [1:19:56] >> right? Yeah.
