[0:09] Payson and friends of Payson. [0:12] It's 6:06 p.m. right on the dot. [0:16] Uh [0:17] before we get started, I would accept a [0:19] motion [0:20] to appoint mayor pro tem for this [0:22] evening. [0:23] >> I motion that we [0:25] approve Bob Provost Guard as the mayor [0:27] pro tem for this evening in the absence [0:29] of Mayor Wright. [0:30] >> I'll second. [0:31] >> I have a motion and a second. All in [0:32] favor, Council Lacey. [0:34] >> Yes. [0:35] >> Council Brian. [0:35] >> Yes. [0:36] >> Council Ryan. [0:37] >> Yes. [0:38] >> Council Land. [0:39] >> Yes. [0:40] >> Motion carries. [0:42] All right. [0:43] Um [0:45] I've asked Tracy Zobell if he would give [0:47] us an opening prayer and then Shawn [0:49] Black will lead us in the pledge of [0:50] allegiance. [0:57] » Our dear Father in heaven, we come to [0:59] the [1:00] opening of this council meeting where [1:02] we're grateful that we can meet together [1:04] tonight to discuss the issues of Payson [1:06] City. [1:07] We ask you to please bless the leaders [1:08] of the city, particularly the council [1:10] tonight that [1:11] they can make the best decisions for the [1:13] citizens and the staff. [1:15] We're thankful for this beautiful place [1:17] we live and for the [1:18] opportunity we have to discuss things. [1:21] We ask a blessing that we may receive [1:23] some moisture and [1:25] rain or any form of moisture that to get [1:27] us through the season and get us to [1:29] winter. [1:30] Again, Father, we're very grateful for [1:33] the people that volunteer and work and [1:36] serve this community to make it better. [1:39] We're thankful for [1:41] all those that are [1:43] out serving our country at this time. [1:46] We ask a blessing on them and pray for [1:49] all those who [1:50] need anything at this time, whether it's [1:52] physical, emotional, or mental. [1:54] Please ask I plead ask you to bless them [1:57] and [1:58] please bless us tonight as we travel. We [1:59] may do so in safety. We say this in the [2:01] name of Jesus Christ. Amen. [2:02] >> Amen. Thank you. [2:05] Uh item C, consent agenda. [2:08] Everybody had the opportunity to review. [2:09] >> We need the pledge. Mr. Mayor, the [2:11] pledge. [2:11] >> Oh, sorry. Sorry, Sean. [2:18] » I pledge allegiance to the flag of the [2:21] United States of America and to the [2:23] republic for which it stands, one nation [2:27] under God, indivisible, with liberty and [2:30] justice for all. [2:36] » All right. Now, item C, consent agenda. [2:39] Council, have you had any opportunity to [2:42] review? [2:43] Any Any changes or suggestions? [2:47] » I motion that we approve the consent [2:49] agenda. [2:49] >> I'll second. [2:51] >> Have a motion and a second. All in [2:53] favor? I. I. [2:55] Consent agenda passes. [2:58] Uh [2:59] petitions, item D. [3:01] >> It doesn't say roll call votes, so [3:03] >> Doesn't say roll call? Okay. [3:05] Then I'll go. Councilwoman [3:07] >> Yes. [3:07] >> Councilman [3:08] >> Yes. [3:09] >> Councilman [3:10] >> Yes. [3:10] >> Councilwoman [3:11] >> Yes. [3:12] >> You get that? [3:14] Sorry. [3:16] Uh [3:17] item D. [3:19] We will uh we have no report from Steve [3:22] today, so we'll table [3:24] uh or not not entertain I-15 update to [3:27] this evening. [3:29] Item number two, youth recognition of [3:31] youth city council seniors, Shelby and [3:33] Ryan. [3:42] » Sorry, I couldn't see over my [3:45] prizes we're handing out here. [3:47] Uh residents and uh city staff, city [3:49] council, mayor pro temp, uh we'd like to [3:51] invite our outgoing youth city council [3:54] members that are leaving us to go on to [3:56] bigger and better things. If we can have [3:57] Ella and Josh and Zeke come stand up [3:59] here with me. [4:07] So, these are our three graduating [4:09] seniors and they were with us from the [4:11] beginning. Just You were a little late, [4:12] but you you you got on board pretty [4:14] quick. But uh but they they came on at [4:17] the beginning of this year when Shelby [4:18] and I actually were able to meet [4:20] organize and restart the youth city [4:22] council. We didn't have a lot to go on. [4:24] Shelby and I talked to Springville city [4:26] to see what they were doing, got a few [4:27] ideas, and then the rest of it uh we [4:29] made up as we went and I think it turned [4:31] out really good. And uh these youth uh [4:34] these three in particular are pivotal. I [4:36] am sad to see them leave. They were [4:37] leaders. They came up with some of the [4:39] best ideas. They were reliable. They [4:41] showed up. And they asked really good [4:43] questions and were extra respectful and [4:45] just fun to be around. And so, on behalf [4:48] of myself, rest of city council, to Josh [4:51] and Ella and Zeke, we are going to miss [4:53] you. And so, uh I'm going to invite [4:55] Shelby to come up and share a few words. [4:57] And then after she's finished, if you'll [4:59] please just share with us uh one thing you liked about youth city [5:02] council and then share with us what [5:04] you're doing [5:05] after now that you're big kids now, [5:07] okay? [5:08] >> Big kids. [5:12] Okay, I wrote a whole thing for you [5:14] guys. [5:15] >> [laughter] [5:16] >> So, this is one of those bittersweet [5:17] moments that comes with being an advisor [5:19] for youth. [5:21] Tonight, we celebrate the [5:22] accomplishments of our seniors and look [5:23] forward to all that lies ahead for them. [5:26] But if I'm being honest, this is also [5:27] the part where we realize some of the [5:28] best leaders are leaving us and we start [5:30] wondering how we're possibly going to [5:32] replace them. [5:33] The truth is, you don't replace people [5:35] like Ella, Ezekiel, and Josh. Every [5:37] youth council member leaves their own [5:38] mark and these three have left a big [5:40] one. [5:41] Ella was one of the very first members [5:43] of the new Payson youth council. When [5:46] you help start something from the [5:48] beginning, you help shape what it [5:50] becomes. [5:51] Ella has been there through the growth, [5:52] the changes, the activities, and all the [5:54] moments in between. [5:56] More than anything, she has always [5:57] brought fun. Every group needs people [6:00] who make service enjoyable and help [6:01] create memories along the way, and Ella [6:04] has done exactly that. [6:05] Youth Council simply would not be the [6:07] same without her energy, sense of humor, [6:09] and willingness to jump into whatever [6:11] idea we had. [6:13] Ezequiel also joined us early on, and [6:15] his first real day as a Youth Council [6:17] member set a pretty high standard. While [6:20] most people ease into new activities, [6:23] Ezequiel's introduction to Youth Council [6:25] was Local Officials Day at the State [6:26] Capitol. [6:28] For those who have participated in that, [6:30] you know that it's one of our favorite [6:32] activities every year, but it can be a [6:35] lot. [6:36] Since then, he has grown into an [6:37] incredible leader and now serves as our [6:39] Youth Assistant Mayor. He has [6:41] represented our group with [6:42] professionalism, dedication, and a [6:44] willingness to serve others. Watching [6:47] him step into leadership roles has been [6:48] a privilege, and our city is better [6:50] because of his involvement. Then there's [6:52] Josh. [6:53] >> [laughter] [6:56] [gasps] [6:56] >> Josh may have joined Youth Council a [6:58] little later than the others, but from [7:00] the moment he got involved, he made a [7:01] tremendous impact, not only on Youth [7:03] Council, but also on our Youth Court. [7:05] Throughout high school, Josh has [7:07] faithfully served in Youth Court, and [7:08] honestly, I don't know what I would have [7:09] done without him when I first took over [7:11] the position. [7:13] When I stepped into that role, Josh knew [7:15] more about Youth Court than I did. He [7:17] patiently helped me figure out what [7:18] Youth Court was, how it worked, and how [7:20] to keep it organized and running. [7:22] There are very few students who leave an [7:23] organization better than they found it, [7:25] and Josh is absolutely one of those [7:26] people. [7:27] As advisers, we hope that students learn [7:29] leadership, service, and responsibility [7:31] through programs like Youth Council. [7:33] But if I'm being honest, sometimes the [7:34] students teach us just as much. These [7:36] three have reminded us that leadership [7:38] isn't always about being the loudest [7:39] person in the room. It's about showing [7:41] up consistently, serving others, making [7:43] people feel included, [7:45] and leaving things better than you found [7:47] them. [7:48] Over time, we've shared meetings, [7:50] activities, service projects, trips, and [7:52] countless memories together. There have [7:54] been early mornings, long events, group [7:56] photos that took probably a little too [7:58] long, and enough food to sustain a small [8:01] army, which that is not an exaggeration. [8:04] >> [laughter] [8:05] >> Through all of it, Ella, Ezekiel, and [8:06] Josh have helped create the community [8:08] that makes Payson Youth Council special. [8:11] To our seniors, thank you. Thank you for [8:13] your time, leadership, service, and [8:15] example you've set for younger members. [8:17] Thank you for making us laugh, for [8:18] stepping up when needed, and for helping [8:20] build a program that future students [8:22] will continue to benefit from. [8:24] While we're excited for all that lies [8:25] ahead for you, know that you leave [8:27] behind a legacy here in Payson Youth [8:29] Council. We are proud of the people you [8:30] have become, and we can't wait to see [8:32] what comes next. [8:39] » You start talking [8:40] >> so sure. [8:44] » Uh one of the things I loved about Youth [8:46] Council was just being able to get [8:49] involved and look behind the scenes and [8:51] see [8:52] everything that the city and local [8:54] government really does for us. [8:57] Um [8:57] after this, I plan on serving a church [8:59] mission, and then studying architecture [9:02] in college. [9:03] >> Have your call? [9:04] >> Not yet. [9:05] Okay. [9:06] Thanks, Zeke. Let's give Zeke a round of [9:07] applause. [9:13] » Um okay, I say this every single time, [9:15] but my favorite thing about um being a [9:17] part of Payson City Youth Council is [9:19] hanging out with Ryan and Shelby. [9:21] And there's it's there's a lot more to [9:22] it than just hanging out with two [9:24] amazing people, but like I think it's so [9:26] cool for the youth to be able to [9:28] be in a setting where they get to see [9:30] like things that you don't really see. [9:31] Like you're like, "Ooh, city council [9:33] meetings are scary, and that's where all [9:35] the adults are." And but it's like it's [9:37] cooler than like it's perceived and so [9:40] it's cool to [9:41] have a thing where the youth can see how [9:44] a city is run and all the little bits [9:46] and pieces that go into it and that [9:49] that's my favorite part of city council [9:51] and all that fun jazz. Anyways, [9:53] um I plan [9:54] I'm going to go and I'm going to serve a [9:56] mission for the Church of Jesus Christ [9:57] of Latter Day Saints and then afterwards [9:59] go to college and all that stuff. Yeah. [10:03] Mhm. [10:09] » I I definitely have to say my favorite [10:11] thing about the [10:13] youth city council is just the [10:14] connection between [10:16] uh everyone there. There's always uh [10:19] good community there. [10:20] Um [10:21] and my plans [10:23] now it's the a church service mission in [10:26] Fort Worth, Texas and uh [10:28] after that hopefully college. [10:35] I am. [10:47] » And thanks to all the parents for [10:48] supporting them as well. [10:58] » I sure am. [11:07] » Thanks. [11:18] » Uh September. [11:26] » That's nice budget nice. We're going to [11:27] turn the decision making over to them. [11:29] We're going to sit and listen now. [11:31] >> Nobody? [11:32] >> Yeah, it's a great idea. [11:39] » Okay, moving on to [11:41] uh open public forum. [11:43] Uh I'd like to I'd like to say one thing [11:45] before we [11:47] go to the public forum. [11:49] Items 11, 12, and [11:52] 13. Am I got that right? [11:56] 12, 13, and 14. [11:58] Items 12, 13, and 14 [12:01] is merely uh this evening force for [12:04] council to either accept or reject [12:08] uh the annexation petition, which will, [12:11] if we accept it, will allow staff [12:14] to go to work and get the information [12:17] that we need to make an educated [12:19] decision on whether we [12:22] would like to bring it in. So, there's [12:23] no official public hearing this evening [12:26] on that, but if you would like to say [12:28] something concerning that this evening, [12:32] we'd like to have maybe two or three of [12:34] those that may be here that would like [12:36] to say something, and if they would keep [12:38] their comments to a minimum of 3 [12:40] minutes. [12:42] Thank you. [12:43] I would accept a motion for the public forum. [12:48] » Yeah. [12:48] >> Oh, public forum is open. [12:51] Please come to the mic, state your name, [12:53] your address, [12:54] uh [12:56] and tell us what's on your mind. [13:06] » Lee Orton, Payson. [13:10] We have a couple of concerns that's [13:13] bothered us over the years. Uh [13:17] the festivities are coming. Fireworks. [13:21] They're banned in certain areas. Where [13:23] we live is a lot of [13:26] debris and grass and brush, fire [13:29] problems all the time. [13:31] And [13:33] bottle rockets, illegal fireworks [13:37] in a restricted area. And we have not [13:40] yet seen any patrol [13:43] over the years to [13:45] combat this. [13:47] And it's now no water. [13:51] Pretty dry this winter, so [13:54] grass is still growing. [13:56] Everything's dry, going to burn easily. [13:59] So, our question is, are we going to [14:01] have is the city going to put out any [14:04] extra [14:05] coverage in [14:07] patrolling for illegal fireworks and see [14:09] if we can [14:11] curb some of the fires. [14:14] And some of the problems that's caused [14:16] by the fireworks. [14:18] You know, last year we watched a kid [14:20] come off of 600 East and rode right down [14:22] into the Hollow Park on his motorcycle [14:25] and started lighting off bottle rockets. [14:28] 10, 15 minutes later, there he goes. [14:31] You know, it's just [14:33] one of these days it's going to take off [14:34] and burn. [14:37] My second question is is on Gary's [14:39] Meats. [14:41] It's been [14:43] over 20 years now. [14:45] Is he hooked up to the sewer line? [14:53] » His home still [14:54] >> The home is is the business hooked up to [14:56] the sewer line? [14:59] How long does it take to do that? [15:02] These are These are your ordinances. You [15:05] people sit up here and put it in the [15:08] ordinance, city law. [15:10] And [15:12] it's been over 20 years. [15:14] The holding pen is supposed to be [15:16] enclosed, soundproof, smell proof. [15:21] No change. [15:22] Parts of it's built with a [15:24] extension ladder. Part of it's built [15:27] with a guardrail. [15:28] It's not the code by no means. [15:31] I had to build the code, but evidently [15:35] the slaughterhouse didn't have to build [15:36] the code. And still avoids [15:40] ordinances and issues. [15:43] And it's been a while and we still haven't [15:47] seen anything other than things get [15:49] worse. [15:51] The yard looks like a [15:55] wholesale wrecking yard. Vehicles for [15:58] sale, pallets stacking up. It's [16:02] I don't think any of that's supposed to [16:04] be allowed on that property, but yet the [16:07] city turns a blind eye to it from my [16:10] side of the fence. What we see, nothing [16:13] happens to these people. He's still in [16:15] business [16:17] and he's not held to account. [16:20] >> Lee, thank you. You're out of time, but [16:22] I will tell you from my point of [16:24] perspective [16:26] is we have a beautification committee in [16:28] place right now that is just hitting the [16:30] ground. [16:31] And we have a wonderful letter that has [16:33] been approved by the council that is [16:35] going out [16:36] to those specific businesses and [16:38] residences to address that. [16:41] As far as the fireworks go [16:43] I know our police department can't be [16:45] everywhere. [16:46] Uh you're looking at one who was a [16:48] result of a bottle rocket that started a [16:50] fire in my yard about 8 years ago. [16:53] Um I sympathize with you there. [16:57] But I do know our police force is out [16:59] and about. They can't be everywhere when [17:01] every bottle rocket does go off, but I [17:03] know that they are citing [17:05] and they are are following up with with [17:08] reports of fire illegal fireworks. [17:12] >> And you might get with our chief of [17:13] police and give him your address so they [17:15] know where you are. [17:17] >> And I will add to that not only police [17:19] department, but on on nights where [17:20] fireworks are allowed, the actual fire [17:22] department does patrol around, [17:24] especially in those higher danger, [17:25] higher restricted areas, and they [17:27] they've been pretty good about enforcing [17:28] those. So, we are mindful of that, and [17:30] it is extra dry, like you said, and so [17:32] that is top of mind for the fire [17:33] department. I have spoke to the fire [17:35] chief about that. [17:39] » That's cuz you're not starting any [17:41] fires, so thank you. [17:43] >> Lee, thank you for your comments. [17:45] Very appreciated. Anybody else from the [17:47] public that would like to [17:55] » Thank you, city council members, for [17:57] giving me a chance to share some [17:58] thoughts, and I I have a a little State [18:01] your name, please. [18:02] >> Uh my name is Taylor Ellis. [18:04] Um [18:05] I'm a a home and property owner on uh [18:09] 400 East. My [18:10] property shares the western boundary [18:13] with the Haskell addition parcel. [18:16] Um so, I wanted to speak a little bit [18:18] concerning that. Um would it be [18:20] appropriate to hand these out now before [18:22] I say [18:23] >> Yes. [18:23] >> Okay. [18:40] » That's a [18:47] » Um anyway, yeah, thank you for the the [18:49] opportunity. Um I I wanted to say that [18:52] I'm not against this annexation and the [18:55] development of these parcels. Um I'm I'm [18:58] extremely fond of of Mark and Marjorie [19:01] Haskell. [19:02] Um would like for them to get the value [19:04] for their land and and be able to set up [19:06] again somewhere to do what what they [19:08] like to do and live the way they want to [19:09] live. [19:10] Um for me, the question is not whether [19:12] the annexation should happen at some [19:14] point. Uh, rather I'd like to make sure [19:16] that it's carried out well and and [19:19] aligns with the the city's Eastside [19:21] Comprehensive Plan. [19:23] Um, which Grow Development has stated [19:26] that they're in alignment with. And, uh, [19:29] as a reminder Grow Development's the the [19:31] sponsor of this annexation petition. [19:34] Um, [19:36] and and also in alignment with uh, the [19:38] most recent master plan which [19:40] specifically defers to the area plan for [19:43] implementing specifics. [19:46] So, um, [19:47] on the published materials of this [19:49] application I noticed that the score the [19:51] city's own scorecard for determining [19:53] whether the city's resources should um, [19:56] entertain a study to move forward with [19:59] uh, [20:00] this annexation [20:01] um, gives them a a point five out of [20:04] one. [20:05] Um, their application met 50% of the [20:08] criteria [20:09] um, for moving forward. [20:12] The city's calling this incomplete or [20:14] half-baked. The two most heavily [20:17] weighted items, utility infrastructure [20:19] and community benefits, were both [20:21] substantially unmet. [20:22] The applicant has acknowledged they [20:24] intend to address those gaps after [20:26] annexation is approved. [20:29] Um, [20:31] anyway, I personally I I would like to [20:33] see a a a bigger effort and and due [20:37] diligence on the part of the developer [20:39] um, [20:41] to [20:42] uh, acknowledge known conditions in in [20:45] their concept plans. Uh, known uh, [20:48] challenges uh, before [20:51] resources are allocated to carry forward [20:53] and and I hope that uh, those [20:56] um, concepts can actually reflect [20:59] support of of that that plan. [21:02] >> Mayor, thank you. You're you're out of [21:03] time. [21:04] >> Okay, out of time? All right. [21:06] >> You I I I read a letter from you. [21:08] >> You did. Yeah. [21:08] >> Submitted to the city. [21:09] >> Yep. [21:10] >> Um thank you. We We all have that. [21:12] >> Mhm. [21:13] >> We all take very seriously what we're [21:16] looking at here. [21:18] Uh but there again, I merely state that [21:20] all that we're considering denied is [21:22] if we want staff to give us a report on [21:25] where roads I mean, you've probably seen [21:28] I think you alluded to a cul-de-sac and [21:30] some things, but staff ultimately will [21:33] be the one that looks at it and tells us [21:35] where our infrastructure should be [21:37] and what have you. And so [21:39] um we might be a little premature on [21:42] deciding what a subdivision is going to [21:44] look like. [21:44] >> I know I acknowledge that. And I What I would [21:48] love is is for them to to give a little [21:51] uh a little more good faith and due [21:54] diligence in their application. [21:56] And I I would hope that you you guys [21:59] would hold them to that before making [22:00] that determination to move forward with [22:02] the study. [22:03] >> Okay. [22:04] >> Thank you. [22:04] >> Taylor, thank you. [22:05] Appreciate your comments. [22:07] Anyone else? [22:12] » Am I able to present [22:14] our point? [22:15] >> At a public forum, I don't believe so. [22:17] No. [22:18] >> Okay. [22:21] Yeah, I could email it later. All right, [22:22] my name is Jeremy Smith. I'm neighbors [22:24] with Taylor. Um [22:27] My address is 633 South 1400 East. [22:30] Um I also [22:32] my west boundary of my property borders [22:35] with the Haskell annexation. [22:38] Um my main concern is with [22:41] the zoning on the application for that [22:43] piece of of property. It's On the [22:45] application, it's a R19 zoning request. [22:49] And I feel that that does not line up [22:52] with the um Eastside Comprehensive Plan. [22:56] Where this is in the area of a township. [22:59] Um the plan gives [23:01] a a lot size for traditional lots, which [23:04] would be quarter to third-acre lots. And [23:07] then from there, it just says larger or [23:09] estate. And so the township is [23:12] considered a larger lot than the the [23:15] traditional. Um which [23:18] an R19 allows for a small lot as a 9,000 [23:22] square foot lot, which would be 0.21. So [23:24] under a quarter. [23:26] Um [23:27] So my request would be that to not set [23:29] precedence by approving this application [23:32] with a R19 request, [23:34] but to require them to [23:36] um adhere to the comprehensive plan [23:40] and have at least a R1 uh 15, which [23:44] would be just about a a third of an acre [23:47] um as minimum lot size. [23:50] So that that's uh my request. Thank you. [23:53] >> Hey, thank you. [23:58] Anyone else like to address the council? [24:02] Staff? [24:15] Yes. [24:22] » Mayor pro tem and city [clears throat] [24:24] council, I just want to take a second [24:26] and talk about the adventure day. For [24:28] those of you who are not able to attend, [24:30] um I want to thank Ryan Rowley. He was a [24:33] huge part of that. He was busy all day [24:35] long. So, and Brian, of course, he was a [24:38] part of um putting that event together. [24:41] Um I also want to thank Dave and Robert. [24:44] They were there all day long, too, and I [24:46] want to thank them for their support. [24:49] Um it was a very busy day, so our police [24:53] officers were everywhere, also. It [24:56] started with the Orchids Triathlon early [24:59] in the morning at the swimming pool. [25:01] And Jackie had her event. Police were [25:04] involved with all that. [25:06] And then we went with the Gran Fondo at [25:09] 7:00 a.m. So, things started very early. [25:12] Um and so that was a quite a success. We [25:15] have a lot more people this year signed [25:18] up for the Gran Fondo and I think they [25:19] were really happy [25:21] with that. [25:22] And then at the park itself, uh [25:25] it was from 10:00 a.m. to 3:00 p.m. [25:30] And it was just so much going on in such [25:33] a short amount of time that it's like [25:36] three huge events into one in five five [25:39] or six or seven hours. So, it was it was [25:42] pretty amazing. Um during the Adventure Day, we had um [25:49] vendors, we had food vendors, we had [25:51] inflatables, we had a a boat regatta, [25:55] but we had a cornhole competition, a [25:57] pickleball tournament, bingo, a 250-year [26:02] that we were celebrating year 250, the [26:04] puzzle, gymnastics, we had plein air [26:07] going on at the museum, guided mountain [26:10] bikes, fly tying, photo contest. [26:13] Um at the information booth, if the [26:16] people who came uh we had a little map [26:19] for them if they went around all the [26:20] vendors, which is good because we want [26:23] our vendors to actually be able to talk [26:25] to everybody. So, as they would go [26:27] around and check off their little vendor [26:29] list, they'd come back to the [26:30] information booth and spin a wheel. And [26:33] then they were able to receive free [26:35] swag. And that's what this event is [26:38] about, too, is to keep reminding our um [26:42] our community at our new Adventure Day [26:45] um logo and theme. So, hopefully we'll [26:48] see a lot more swag around town cuz [26:50] there was a few hundred people who [26:52] received free swag at Bay. So, I want to [26:55] thank all the volunteers. It took so [26:57] many volunteers from [26:59] um Shelby's team. They were there. Uh [27:03] the Rec Department. Everyone was on [27:05] board with them. Um it took city [27:08] employees to help run everything. I had [27:12] Robert out in the heat all day. I mean, [27:15] it was it was a lot going on. Yes, he [27:18] was I looked over there and he was all [27:20] red. I'm like, he needs a hat. It's the least I could do. Anyway, so [27:25] thank you cuz this event [27:27] um just wouldn't happen with [27:30] without the hundreds of volunteers. So, [27:32] our next event is not this weekend, but [27:35] next weekend. It's June 26th and 27th. [27:39] It's the Here Comes the Sun Rock [27:41] Festival. [27:42] Um this has been going on now for a few [27:44] years. Um if you love rock and roll, you [27:47] got to come. It's just super fun. So, [27:50] Friday it starts at 3:30. We'll have [27:53] vendors, food trucks, and of course rock [27:55] and roll. We have a few built yeah food [27:58] booths. It's a tent No, photo booth. [28:01] It's a tent, but it's more like set up [28:03] like a photo so people can pretend [28:06] they're on stage and um we'll have [28:08] things for them and to wear so it'll be [28:09] like a photo booth. It'll be really fun. [28:12] Um we have some professional artists [28:15] coming to do some chalk art. So, that [28:17] will be fun while the concert's going [28:19] on. [28:20] And then Saturday it starts at 3:30. So, [28:23] we hope you all can come. Thank you. [28:27] >> Janine, thank you. Payson City and the [28:30] citizens are so lucky to have you [28:34] for all your effort. [28:36] Chief, [28:38] I was going to follow up on Mr. It looks [28:40] like he's left. Mr. Johnson's comments. [28:42] We we worked with Gary's to get him to [28:44] come in compliance with nuisance. So, [28:46] we'll revisit that and make sure they're [28:49] still in that. I I think we spent quite [28:50] a deal of time with them last year or [28:52] the year before, so we'll we'll revisit [28:54] that and make sure the cars are whatever [28:56] he's to I'll go look at it and make sure [28:58] we're [28:59] as far as the other stuff, we'll [29:01] follow that as well, so. [29:03] >> Thank you. [29:04] >> Thanks, Chief. [29:06] >> Any other staff? [29:09] Then we'll go to Robert, David, either [29:12] of you? You good? [29:14] Then we'll go to Lacy. [29:18] » Um [29:21] I don't have anything really other than [29:24] uh I did attend a Four Bay [29:27] event last night and um [29:30] thankful to the previous council and [29:35] ones that are currently on it, too, that [29:36] helped protect it. [29:38] And I know Orion has like really [29:41] put a lot into it, especially um [29:44] and Carl and [29:46] um I say it time and time again, I love [29:49] Payson Canyon. [29:51] I think it's our biggest asset, [29:52] honestly. [29:53] Um it's a hidden gem and I love to tell [29:56] people about it, but I don't want to [29:57] tell people about it because it's so [29:59] amazing. [30:00] And um [30:02] just going up there, it was incredibly [30:04] peaceful. Um it was beautiful. [30:07] Um [30:10] it made you realize also [30:12] uh [30:13] mother nature and we spoke about the [30:16] fire of 2018 [30:18] and uh [30:19] that's a huge huge concern for me this [30:22] year, especially cuz I live so close. [30:25] And I would hate to see that canyon ever [30:27] burn again. Um and so [30:31] um just [30:33] I just hope that everyone that utilizes [30:36] it really pays attention to that and how [30:38] dry it really is and [30:42] I know that you can't stop people, but I [30:44] guess I'm that person that fireworks are [30:46] my favorite thing. I have a birthday in [30:48] July and I say the fireworks are for me, [30:49] but [30:51] this year alone, I'd be I'd [30:53] I would 100% be done with fireworks for [30:56] the year. It's [30:58] so dangerous right now, but that's just [31:01] my thing, but [31:02] thanks for inviting me to the four-bay, [31:04] but other than that, I don't have [31:05] anything. [31:08] » Councilman Youel. [31:09] >> I just got a couple things here. Um one [31:11] is we had a downtown event Friday that [31:14] tied into Adventure Day and just like to [31:17] thank Ronda Herron all the staff in the [31:19] city that helped with that. Um it was a [31:22] good event. [31:23] Also, um uh for Adventure Day, just uh [31:26] thank Carl and Janine and April and all [31:29] the volunteers and staff that helped [31:31] with that. It's it's a good event. It [31:33] really ties into our branding, helps us [31:34] with our branding. [31:36] Um and also [31:38] uh thank Rob. He's over He's the one [31:41] that started the Grand Fondo here in in [31:43] Payson, so we're really grateful for him [31:45] to bringing that. He does a lot of work for that and he did [31:49] give me a jersey. He said, "We have Tour [31:51] Utah jersey up there, so we need to put [31:54] his jersey up there." So, we'll have to [31:57] look at doing that. So, um anyway, [32:00] grateful to him. [32:01] And then just um just sorry I missed the [32:03] four-bay thing. I was out of town, so [32:06] that would that's just a great asset for [32:08] the city. [32:11] >> Councilman Youel. [32:12] >> Yeah, I think they've covered everything [32:14] I was going to say. The only I'm just [32:15] going to make the obvious comment. [32:17] Whenever I see that jersey, I think who [32:18] could fit into that? Who wore that? But [32:21] yeah, I don't I don't have anything to [32:22] report. Thank you everybody for being [32:23] here tonight. [32:26] >> Ann. [32:27] >> Um I echo everything that everyone else [32:29] said. I'm sorry couldn't be at Adventure [32:31] Days. I was out of town, as well, but I [32:33] was at the four-bay thing and every time [32:35] I go up there, I'm just so glad that we [32:37] made the decision we did. It was the [32:38] right thing to do and [32:40] um I hope we can keep it safe [32:42] and everyone enjoy it. We saw deer and [32:45] birds and [32:46] um the views are always spectacular and [32:49] so it is it is a valuable [32:52] um asset for Payson. [32:55] Um don't tell anybody about it. [32:57] >> [laughter] [32:58] >> I grew up going to Zion and now that's [33:01] and we would have the whole hike to [33:02] ourselves and that's long past now. [33:05] Um [33:07] and just thanks as usual to everybody [33:09] that that we work with. We're really [33:11] lucky here. Thanks. [33:12] >> Thank you. [33:13] I I'm just thankful for staff [33:16] and for council members that [33:19] uh as thin as stretched as we are making [33:22] it to the ribbon cuttings, to the [33:23] groundbreakings, [33:25] to the four bays, to everything that we [33:28] have going on right now, to have [33:30] representation from the council. I [33:32] talked to three people that were there [33:33] last night and they said [33:35] council members were there. It was [33:37] awesome. It was just So, thank you thank [33:39] you guys for being [33:41] council members and representing Payson. [33:46] Moving on, [33:47] uh action item number E. [33:50] Uh I believe [33:51] Kathy and Melanie, if we could do items [33:54] 1 2 3 Oh, Robert, go ahead. [33:56] >> Actually, um can we just announce that [33:59] item 15 is going to be tabled? [34:01] >> Yes. Thank you. I [34:03] Item number 15, if any of you are here, [34:08] » That's the the Payson Gateway plan. That [34:11] is correct. [34:13] >> And we've we've been asked to table that [34:15] until the first council meeting in July. [34:18] So, if anybody's here for that, [34:21] we're we're grateful that you'll stay, [34:22] but if not, uh [34:25] we'll we'll table that until till the [34:27] first council meeting in July. [34:30] All right, back to item E. Melanie and Cathy, if we could present items 1 2 [34:35] 3 and 4 [34:37] and then council will [34:40] uh entertain uh public hearings on each of those items. [34:45] >> Okay. So, I'm going to start with the [34:47] certified tax. I'm going to review the [34:49] budget with you. I'll turn the time over [34:52] to Melanie to review the compensation [34:54] portion and then let you go into the [34:55] public hearings. [34:57] Um you probably know I go kind of fast, [34:59] so if you have any questions, just stop [35:01] me. [35:02] So, [35:04] for this year's uh certified tax rate, [35:07] it's kind of what we predicted It's 0.001277. [35:13] Um if we look on a scale, it's a little [35:15] bit less than last year. So, you can see [35:18] it's kind of gone down a little bit. Um [35:21] here's kind of an impact to the [35:22] taxpayers based on home valuation. You [35:25] can kind of see what where you rank. [35:27] Again, this is Payson only. This is not [35:30] your total certified tax. [35:33] Um [35:35] now the the whole assessment, I don't [35:38] know if it was posted right or not, but [35:40] it's showing that Nebo School District [35:42] went down a little bit. So, that might [35:43] change. I'm not sure. And I heard that [35:45] Central Utah Water Conservancy might go [35:48] up. If it stays like this, Payson City's [35:51] portion is about 15% of your total [35:54] certified tax. [35:57] So, transfers and indirect costs, we're [35:59] going to have a separate public hearing [36:00] on this one also. And we've presented [36:03] this several times, but um indirect [36:06] services are those services provided by [36:08] the general fund, the vehicle [36:10] maintenance, and the IT department um [36:13] charged to various departments and to [36:15] the enterprise funds, and those funds [36:17] are transferred to support those [36:19] services. [36:21] Transfers are non-reciprocal transfers, [36:25] meaning they're just operational [36:26] transfers directly from [36:28] um [36:29] the enterprise funds to the general fund [36:31] or from the general fund to to various [36:33] programs and and uh enterprise funds. [36:37] Traditionally, the city has transferred [36:38] 9% of enterprise funds to the general [36:41] fund. [36:42] This year we're we're trying to reduce [36:44] that or eliminate operating transfers to [36:46] the general fund, and you can kind of [36:49] see where we've lowered it to this year. [36:51] We hope to make more progress in the [36:53] coming budget years. [36:57] So, for Payson City budget [37:01] um changes to the tentative budget. So, [37:04] first we adjusted planning to uh [37:06] development services wages for a [37:08] part-time hours for a current employee. [37:10] We adjusted the RDA business park road [37:13] overlay for $504,000. [37:17] Um in police, we added um a donation to [37:20] the Children's Justice Center at Utah [37:23] County for $66,000. [37:26] Um we adjusted the Memorial Park [37:28] playground. Um and just to remind you [37:32] that $200,000 of that is a grant, [37:35] 150,000 is an increase in the parks [37:38] department, and 350,000 [37:41] is coming from the park tax budget. Half [37:44] of that was an increase. [37:46] Um adjustments to the sewer department, [37:48] we added the pit station rollover. [37:51] Um the internet to the lift station, the [37:53] streets department sewer project, and [37:55] the sewer master plan. [37:57] Um we added um Communities That Care [38:00] revenue of 35,000, and they also [38:02] received a grant for 18,000. [38:05] Um we rolled over the HVAC system in [38:07] administration and moved the [38:09] installation to the fall. [38:11] That's 700,000 increase for total of [38:14] 950,000. [38:16] Um streets, we added a 3-month sidewalk [38:18] data entry person. That's a one-time [38:20] project cost. [38:23] Um projections and indirect services [38:25] were updated for 98,000. [38:28] And we adjusted 481,000 transfer from [38:31] the general fund to restricted debt [38:33] service in the capital service fund. [38:36] So, here's the reconciliation of those [38:38] amounts. You can kind of see [38:41] how it was [38:43] broken out if you have an interest in [38:44] that. [38:46] Um [38:47] budget highlights uh for fiscal year [38:50] 2027, we're proposing [38:52] a 126 million 573,786 [38:57] dollar budget. [38:59] Um for funded personnel positions, we're [39:01] requesting departments wait to mid-year [39:04] to fill them just so we can monitor the [39:05] economy because of the rumors [39:08] about the economy. [39:10] Um we've added um two increases for [39:13] employees. A two per 2.7% increase will [39:17] be allotted through COLA and the 1.3% [39:20] will be merit at mid-year. [39:23] And this is just a breakdown of the URS [39:26] system, and you can kind of see the [39:27] breakdown. These amounts are added as [39:30] employee benefit paid directly to URS. [39:35] Funded personnel for this year, we're [39:37] proposing the following new positions. A [39:40] new police officer with promotional [39:41] opportunities for two officers. [39:44] Six EMTs for the ambulance department, [39:46] we're offsetting that with part-time [39:48] wages. [39:49] A water employee with some seasonal [39:51] help. Some adjustments for a public [39:53] information officer. A a GIS position. [39:58] And streets has requested again the [40:00] 500-hour employee for data entry of the [40:02] streets condition. [40:06] In the water fund, um we've allowed for [40:10] a four-bay bond amount that's going to [40:11] be transferred from the general fund [40:14] to the water department. The water [40:16] department is charged with federal lead [40:17] and copper lateral replacements that [40:19] have been funded. [40:21] The city is seeking options through [40:23] WIFIA [40:24] um [40:25] funding for capital water, sewer, and [40:28] storm drain projects. We'll be cut [40:30] bringing that forward hopefully pretty [40:32] soon. [40:33] Um [40:35] and then we'll also do a budget [40:36] adjustment when it comes forward if that [40:38] is approved. Um we've added design for [40:41] the Main Street CUP project. [40:44] And this is just a quick overview. Um [40:47] those items that are highlighted in [40:48] color are those items that we funded. [40:51] Those in black were requested but we [40:54] have not funded those this year. [40:57] And the water the water fund has a [41:00] $8,750,277 [41:03] budget. [41:05] And here's the offset to the [41:06] expenditures. [41:09] Impact fees for the water is $1,371,858. [41:15] When you see the audit at the end of the [41:17] year, the impact fees and the enterprise [41:20] fund roll up into one one um [41:22] presentation. [41:25] And the solid waste [41:27] um just a great deal of the budget [41:29] expenses the landfill pertain to main [41:32] maintenance and improvements to the [41:33] landfill. [41:34] Um in addition to the landfill, the [41:36] solid waste department handles garbage [41:38] collection and city snow plowing. [41:40] The landfill is getting additional C&D [41:42] revenue from school demoli- demolitions [41:45] and other projects. And they've [41:47] requested fencing and a 10-wheel dump [41:49] truck. [41:50] And here is the solid waste revenue. [41:52] It's uh $4,417,722. [41:58] And the offsetting expenditures with [41:59] that. [42:01] In the electric power plant um [42:05] they're concerned about large capital [42:07] projects, the transmission line, the [42:10] substation. Those both of those will [42:12] come through impact fees. The power [42:14] plant construction and lighting [42:15] projects. [42:17] 2027 was scheduled as the third of a [42:19] four-year rate increase plan. [42:22] Um we're not going to follow up on that [42:24] this year. We don't have any straight [42:27] utility increases. There's a couple [42:28] increases we're suggesting, but those [42:30] are user fees, not utility fees [42:33] necessarily. [42:34] The electric plant payments made through [42:37] UAMPS operational billing, um you'll see [42:40] that in the operation. So [42:41] we will not own the plant until it's [42:44] paid off. So we don't have any debt [42:45] service associated with that. [42:49] A transfer from the general fund will [42:50] cover the cost of the Utopia payments. [42:54] And again, um there's a lot of projects [42:56] going on in electric fund. The colored [42:58] items are those that are funded. Um the [43:01] color the item in black is uh WIFIA [43:04] project. Again, we haven't budgeted for [43:06] that yet. [43:08] The electric power plant has a [43:09] $23,698,501 [43:13] budget. [43:14] And here's the offset to that. [43:16] And then we also have impact fees [43:18] through the power for $4,613,000. [43:24] And the sewer plant. [43:27] Um the sewer plant continues with the [43:29] construction of the sewer plant. Um the [43:31] sewer department is in a unique position [43:34] cuz approximately 64% of operational [43:36] revenue goes to debt service. So it's [43:38] really that is due to the big sewer [43:41] plant. [43:43] We will have issued by tomorrow $5 [43:46] million bonds to complete the sewer [43:47] project. [43:49] And just a reminder that the city must [43:51] maintain 1.25% bond cov- coverage. [43:55] In coming years, particularly with the [43:56] WIFIA funding, the city will be [43:58] obligated to raise user rates if they [44:00] cannot meet the 1.25% bond coverage. [44:04] That won't be this year. We're not [44:06] raising rates, sir. [44:07] Um the sewer [44:08] fund is $27,242,181. [44:14] And the offsetting expenditures. [44:17] And then they have impact fee projects [44:18] for $966,200. [44:22] And again, this is um [44:25] it's hard to see up there. At the bottom [44:27] two are the ones that were not funded, [44:29] one from WIFIA, and one we're building [44:32] up revenue to get them a camera van. [44:37] The ambulance department. [44:40] And the ambulance is almost at capacity [44:42] of what they can provide the city due to [44:44] available personnel. The city is looking [44:46] at future equipment, employees, and fire [44:48] station in order to more fully meet the [44:51] needs of the city. [44:52] In that vein, we funded six full-time [44:54] positions. [44:56] Um an ambulance was ordered last year [44:59] and should be received. [45:01] It was ordered last year. It should be [45:02] received in this coming budget year, we [45:04] hope. [45:05] A fire and ambulance impact fee study is [45:08] being updated. And here's what we've um [45:11] proposed. They asked for 14 full-time um [45:14] EMTs, but we just didn't think we could [45:16] squeeze that out of that fund this year. [45:20] The ambulance has a $2,164,830 [45:25] uh budget. [45:28] And the golf fund. [45:30] The golf course is currently in [45:32] construction for a par-3 golf course. [45:35] Um this is expected to bring additional [45:37] revenues and expand opportunities at [45:39] Gladstan. [45:40] The RV pack park pack park is reserved [45:44] out early in the year and has become [45:45] quite an asset to the city. [45:47] So, the two big items in the golf fund [45:49] is a par-3 and a real grinder. And Tracy [45:53] let me know that because of some of the [45:55] watering issues and such that we might [45:57] have to do an open budget coming up to [46:00] help with [46:02] um turf [46:03] at the at the golf course. [46:06] So, the golf um fund has is a budget of [46:08] $4,166,361. [46:13] And the offsetting expenditures. [46:16] The storm drain. [46:20] The primary purpose of the storm drain [46:22] fund is to help enforce EPA regulations [46:24] regarding storm water illicit discharge [46:26] detect detection and elimination. [46:30] The city has allocated $250,000 this [46:32] year for curb and gutter projects and [46:34] that's from a CDBG grant. [46:37] And here's the expenditures. Again, they [46:39] asked for WIFIA funding. We have not [46:41] budgeted for that. [46:43] The storm drain has a $2,398,787 [46:49] budget and the offsetting expenditures [46:50] for that. [46:52] Internal service funds. [46:54] Um these are the [46:56] um vehicle maintenance requested and [46:58] funded items. [47:01] And IT requested items. [47:05] The internals uh the vehicle maintenance [47:07] fund is $677,285 [47:10] and the IT budget is $978,026. [47:16] The revolving loan fund. [47:20] The city has a revolving loan fund to [47:21] finance new equipment and vehicles. The [47:24] cost of the equipment is expensed in the [47:26] revolving loan fund. Amortized loan [47:29] amounts are assessed to the departments [47:30] to reimburse the revolving loan fund and [47:33] build up funds for future allocation. [47:35] Most loans are amortized over 3 years at [47:37] this point. [47:38] Vehicle replacement is based on the [47:40] assessment of the vehicle maintenance [47:41] director. [47:43] And here are the items that we're [47:45] rolling over this year and the ones that [47:47] were not funded. And just the ones I [47:49] want to point out is uh the downtown [47:52] repayment to MAG. We're going to sell a [47:53] building downtown, [47:55] turn the funds over to MAG, and then as [47:58] soon as we sell the building, we're [47:59] going to reimburse this fund. [48:03] Um the revolving loan fund is [48:04] $2,446,400. [48:09] The park tax fund [48:11] um [48:13] the total is $585,300. [48:15] Again, this is the with the increase in [48:18] the Memorial Park playground. So, that's [48:20] a little bit of a change of what they [48:22] requested. [48:24] So, there's $595,300. [48:26] We added $10,000 for advertising for the [48:30] park tax election that's coming up. [48:34] In the general fund [48:37] sales tax is steady right now. Building [48:39] permit revenue is down and I understand [48:41] that's pretty consistent with other [48:43] cities right now. [48:45] In previous years, we've transferred [48:47] excess fund balance from the utility [48:48] fund to the capital fund. This year, if [48:51] we have excess um fund reserves, we're [48:53] going to concentrate on transferring [48:55] that directly from the general fund. [48:58] The effect of that is that [49:02] if I can get to it, it looks like we're [49:04] expending more fund reserves out of the [49:06] general fund. But, actually a good [49:08] portion of that is the transfer of [49:10] excess fund reserves. So, it's not an [49:12] expenditure, it's a movement of fund [49:14] balance. [49:17] That also, and I just want to point out, [49:18] gives the council opportunity to do [49:20] capital projects. It's benefited the [49:22] city because we've been able to do the [49:24] downtown, we're funding half of the fire [49:26] station [49:28] and excess funds will be available for [49:30] the council to allocate. [49:36] And my thing stopped. I apologize. [49:40] There we go. [49:42] So, the general fund is comprised of the [49:44] following individual funds that you'll [49:46] see in the audit. Again, these all roll [49:48] up into the general fund and when we [49:49] talk about fund balance, it's a [49:52] combination of all these funds. B&C [49:54] revenue again is restricted funds. It's [49:58] not available for use for any other [49:59] purpose. [50:00] So, the funded and requested for the B&C [50:02] fund, [50:05] the building maintenance fund. Oh, I [50:07] want to point out, too, that there is [50:08] one B&C project that will not be [50:10] complete by June 30. We will have to [50:12] bring that forward for a budget [50:14] adjustment so they can complete that [50:15] budget. We didn't have it in time to get [50:17] in this [50:19] um budget [50:20] uh proposal. [50:22] Building maintenance, engineering, [50:26] parks, [50:28] fire, [50:30] a library, [50:31] and the police station. [50:34] Recreation, [50:35] streets, [50:37] pool, [50:38] seniors, [50:40] cemetery, [50:41] petite meat. [50:43] Here is the overall budget. If you look [50:45] at the bottom, you'll see those little [50:47] funds that roll up into the general [50:49] fund, beginning with B&C road funds. The [50:52] total budget of the general fund is [50:54] $34,013,391. [50:58] And here's various we have [51:01] various and broad um departments that [51:04] participate in the city through the [51:06] general fund. [51:08] The RDAs, there will be a separate [51:10] hearing on the RDAs, and we can come [51:12] back to this if you have questions. [51:14] The town redevelopment is primarily the [51:17] uh the Walgreens economic development [51:19] agreement, and that extends to October [51:21] 2028. [51:23] And then we have the redevelopment [51:25] business park, and that's primarily the [51:27] innovation center. [51:31] And I [51:31] And here's the requested and the funded [51:34] for the RDAs. [51:36] I'm going to turn the time over to [51:37] Melanie and let her go through the [51:39] compensation portion. [52:01] » Okay, thank you. Um as Kathy indicated [52:04] in the budget, [52:06] um we are proposing [52:09] um an increase for executives, um but [52:12] starting in 2024, um there was a [52:14] requirement that we have to hold a [52:16] separate public hearing. So, even though [52:19] Kathy's already highlighted and covered [52:20] that, we're going to have um just take a [52:23] minute and there'll be time for the [52:24] hearing to highlight um on the executive [52:26] positions. [52:29] Yeah, it's not [52:32] Let's see. [52:33] I'll let you drive it. [52:37] Please hold. [53:05] Okay. [53:08] So, um let me just go here. Um again, [53:11] it's a statutory requirement to hold the [53:13] public hearing. Um so, it's This is [53:16] based on Utah Code 10-3-18, [53:19] um that we cities are required to hold a [53:21] public hearing on increases proposed in [53:23] the budget uh for executive and [53:25] statutory officers. [53:29] Um these are just some of the [53:30] definition. Um compensation means [53:33] salary, a budgeted bonus, or budgeted um [53:36] incentive pay, a vehicle allowance, and [53:38] deferred salary. [53:40] And then compensation increase um as [53:42] mentioned in the definition above. [53:45] Um an executive municipal officer is [53:48] defined as the chief administrative [53:50] officer, assistant city attorney, um an [53:53] individual is the head or chief of a of [53:55] a department. [53:57] Um so this is um the positions that um [54:01] Payson City um [54:03] has uh for our executive officers. [54:06] Um and so it's proposed that um [54:10] these individuals would receive um a 2.7 [54:14] um [54:15] 2.7 uh percent increase and um up to a [54:20] 1.3. Um that's not a guarantee. Um we [54:23] have a merit uh program based on [54:26] performance evaluations. So um the total [54:29] proposed increase for our executives [54:31] would be um 4% and this is the same um [54:35] percent that as Cabbie has indicated is [54:38] for all employees as well. [54:43] Are there any questions? [54:50] » Okay. [54:52] Uh [54:54] at this point I would entertain [54:56] a motion to open a public hearing [54:59] on the fiscal year 2026-2027 [55:03] certified tax rate. [55:05] >> So moved. [55:07] >> Second. [55:09] >> Motion and seconded. [55:11] Emily, did you get those? [55:13] Okay. [55:14] All right. [55:15] Uh the the public [55:17] hearing is open concerning the public [55:19] tax rate. We need to uh [55:21] Oh, wait. [55:22] >> [clears throat] [55:23] >> Vote. [55:23] >> Solidify vote. [55:24] >> That's right. [55:24] >> Yep. [55:25] >> Thank you. [55:25] >> Open the public hearing. [55:26] >> Yep. [55:27] Uh I would enter or since we've got a [55:29] motion and a second, Lacy. [55:31] >> Yes. [55:32] >> Brian. [55:32] >> Yes. [55:33] >> Brian. [55:34] >> Yes. [55:35] >> And [55:35] >> Yes. [55:37] >> Okay, now the public hearing is open. [55:39] Uh anybody that would like to come up [55:41] and make comment concerning the [55:43] certified tax rate. There's four [55:46] different public hearings that we need [55:47] to have here as we move through the [55:49] budget season. [55:51] Uh and the first one will be the [55:53] certified tax rate. [55:58] » Sorry, I thought I had this saved. [56:01] >> Emily, is there anybody online? [56:03] Not noting that anybody [56:05] >> I know. I'm kidding. [56:07] I can't. Sorry. [56:09] I'm not as fluent in this. [56:11] >> Okay. Not seeing anybody online or any [56:14] public comment, I would accept a motion [56:16] to close the public hearing. [56:18] >> So moved. [56:19] >> Second. [56:20] >> Motion and second. Councilman Ann? [56:22] >> Yes. [56:23] >> Councilperson Ann? [56:24] >> Yes. [56:26] >> Councilman [56:28] Ryan? [laughter] [56:29] >> Yes. [56:29] >> Councilmember Ryan? [56:31] >> Yes. [56:31] >> Councilmember Lacy? [56:32] >> Yes. [56:33] >> All right. Public hearing's closed. [56:35] Council dis- discussion. [56:37] >> Uh could you go to the next slide? [56:39] >> You bet. [56:41] Right here? [56:43] >> Yes, thank you. Um [56:45] you know, property taxes are the most [56:47] stable source of income for a city. Uh [56:50] however, they're I believe they're the [56:51] most sacred as well. And we try to keep [56:54] these as low as we can. And last year we [56:56] did impose a property tax increase and [56:59] 100% of that money uh we are setting [57:02] aside for a fire station. And we've [57:04] already made those transfers. And so we [57:06] do not make uh tax increases lightly or [57:08] willy-nilly to to fund uh frivolous or [57:11] silly things. And uh and this year after [57:14] much discussion and much deliberation uh [57:16] Payson City is not raising uh their [57:18] portion of property taxes, which I'm [57:19] very proud to see. So luckily there's [57:22] not much to discuss here. [57:23] >> Right. [57:26] We all concur pretty much. [57:27] >> Okay. [57:28] >> Yes. [57:28] >> Then I would entertain a motion. [57:31] >> I move that we approve the certified tax [57:34] rate for fiscal year 2026-2027. [57:37] >> I'll second. [57:38] >> I have a motion and a second. Council [57:40] member Lacey. [57:41] >> Yes. [57:42] >> Council member Brian. [57:43] >> Yes. [57:43] >> Council member Ryan. [57:44] >> Yes. [57:45] >> Council member Ann. [57:46] >> Yes. [57:48] >> Motion passes. [57:51] Item number two, public hearing for [57:54] fiscal year 2026-2027 [57:57] executive municipal officers [57:59] compensation. [58:01] I would accept a motion to open a public [58:03] hearing. [58:03] >> So moved. [58:04] >> Second. [58:05] >> Motion and a second. [58:07] Uh roll call vote. Council member Ann. [58:10] >> Yes. [58:11] >> Council member Ryan. [58:11] >> Yes. [58:12] >> Council member Brian. [58:13] >> Yes. [58:14] >> And Lacey. [58:14] >> Yes. [58:16] >> Okay, public hearing is open. If anyone [58:19] would like to come forward and have [58:22] public comment on the executive [58:24] municipal officers compensation [58:27] that Melanie just presented to us. [58:34] Emily, I'll ask you again, is anyone [58:36] online? [58:37] Not noting that anyone is online and no [58:39] public comment, I would entertain a [58:41] motion to close the public hearing. [58:44] Have a motion, second? [58:46] by Lacey. [58:48] Uh Council member Ann. [58:50] Council member Ryan. [58:51] >> Yes. [58:52] >> Council member Brian. [58:53] >> Yes. [58:53] >> Council member Lacey. [58:55] >> Yes. [58:56] >> Motion is closed. The public hearing is [58:58] closed now. I would accept uh comments [59:00] from the council. [59:02] >> Uh this is a 1% less uh raise than we did last [59:08] year. And not only this is the rate for [59:09] the the executive team, but this is also [59:12] the rate that we're we're increasing all [59:13] their wages across the board for Payson [59:15] City. [59:16] And uh 4% is is what we're looking at. [59:23] » So it's not even I have a question. So [59:25] it's not even solidified. You guys [59:27] haven't gone through the merit process [59:29] yet, have you? [59:30] Okay. [59:31] >> We're giving the parameter up to [59:33] >> up to. [59:33] >> Yep, up to that percentage. Is that [59:35] correct? [59:36] >> Cost of living portion would be given. [59:37] >> The cost of living, but the merit would [59:39] be based on department head [59:42] evaluation. [59:43] Okay. [59:44] >> And then to ask um Melanie, maybe. [59:48] The [59:50] >> [clears throat] [59:50] >> Yeah, hello. [59:52] Um and I it might have been talked about [59:54] before. The cola, the cost of living. [59:58] Where do we receive that rate from [1:00:00] again? I'm just curious because looking [1:00:03] at other cities, ours is different. [1:00:06] CPI is what [1:00:09] I understand that [1:00:09] >> I mean, the CPI came in at 3.8%, [1:00:11] correct? [1:00:12] >> higher, right. [1:00:13] >> Yeah. [1:00:16] » Right. [1:00:17] >> We do the we do the average for the [1:00:18] calendar year, so what we put in there [1:00:20] was from [1:00:25] » Can we go to that screen just [1:00:28] >> Yeah. So, the CPI for May was 4.2. [1:00:32] Um [1:00:33] I'll see if I can get to it. I'm sorry. [1:00:35] >> That's okay. [1:00:40] » Yeah. [1:00:42] >> This is really fast. [1:00:45] See if I can see it here. [1:00:48] Right there. [1:00:50] The 2.7 increase will be allotted [1:00:51] through a jet um through cola and the [1:00:54] 1.3 will be merit at mid-year. [1:00:58] Is that what you wanted to see? Is there [1:00:59] something else you wanted? [1:01:01] >> It was the executive [1:01:03] >> Oh, Melanie. [1:01:03] >> the executive one. The executive one. [1:01:05] >> Yeah, it was on the other slideshow. [1:01:07] >> Oh, and it was from Melanie. [1:01:09] >> We generally get the CPI from the [1:01:11] >> It is it's the same exact department [1:01:13] right here. [1:01:14] >> Uh commerce uh commerce, I think. [1:01:17] >> All the department heads. [1:01:18] >> Yeah. [1:01:18] >> Yep. [1:01:19] >> Yeah, and then we also do a survey of [1:01:21] other cities to try and stay [1:01:23] competitive. So, those are [1:01:26] >> Yeah, so as I looked around some are [1:01:27] doing more. [1:01:28] Uh a lot are doing less than than the 4% [1:01:31] uh Payson City was behind for a very [1:01:33] long time in what we paid our employees. [1:01:36] And uh years ago they they made pretty [1:01:38] aggressive steps to get it up to snuff. [1:01:41] And uh I do think it's important we stay on the conservative consistent side [1:01:46] of of paying our employees. That way we [1:01:48] don't have to do these huge jumps. And [1:01:50] for me personally, I don't think the 4% [1:01:52] is outrageous and I'm I'm feeling okay [1:01:54] about it. I think uh on the whole the [1:01:57] culture of Payson City employees has [1:01:59] improved in the last few years. And I [1:02:01] think we have really good department [1:02:03] heads right now as well that are that [1:02:05] are continuing to elevate our culture. I [1:02:06] want to attract the best people to [1:02:08] Payson. It makes the residents' lives [1:02:10] more stable and more reliable. And also [1:02:12] the all all of the workers, a lot of [1:02:14] them that are none of them are here [1:02:16] tonight. They're the first line of [1:02:17] defense and the first ones to interact [1:02:19] with our residents. And it's important [1:02:21] that they feel loved and respected and [1:02:23] treated and treated and paid well. I [1:02:25] don't want Payson to turn into a [1:02:26] training ground uh for other cities. Uh [1:02:29] but we're also not just going to [1:02:30] endlessly throw money at them either. [1:02:32] And so, I think this 4% is is pretty [1:02:34] dang fair as as far as that's where I [1:02:37] feel about it. [1:02:38] >> I want to echo what he said. I want to [1:02:41] keep it conservative. We don't want to [1:02:43] be exorbitant. We're still a small town. [1:02:45] And um [1:02:48] so judge accordingly in the merit-based [1:02:51] stuff. [1:02:52] And [1:02:54] I [1:02:55] as long as it's up to and not everyone [1:02:57] is guaranteed that. [1:02:59] And we keep it conservative. [1:03:02] But I also want to say our department [1:03:04] heads are awesome. So, if we could, I'd [1:03:06] give everyone a lot more, but [1:03:09] >> Also, [1:03:10] >> we have to be careful. [1:03:11] >> Um [1:03:12] I want to This is um my [1:03:18] I just want to express my thoughts on [1:03:20] it. [1:03:21] Um [1:03:22] I do [1:03:23] everything that they say. I [1:03:26] uh have enjoyed working along with [1:03:28] especially the department heads. They've [1:03:30] been more than helpful for me. [1:03:32] Um [1:03:33] They've already heard what I have to [1:03:35] say, but I want to say it publicly. And [1:03:37] that is um [1:03:40] My answer will not always be yes on [1:03:42] this. [1:03:43] And that is because right now in this [1:03:44] community, many families in our [1:03:46] community have not seen an income [1:03:49] consistent increase every year, [1:03:51] especially even for our cost of living. [1:03:53] Um [1:03:55] Right now, many Payson residents are [1:03:56] struggling with rising cost of living, [1:03:58] increased utility rates, higher taxes, [1:04:01] not from us this year, but [1:04:04] the school district, a lot of our [1:04:06] community, they don't have kids in the [1:04:08] school district, and it's hard that that [1:04:10] is the majority, and they might have [1:04:12] utilized it in the past. [1:04:14] Um [1:04:16] But also, [1:04:17] um [1:04:18] everyday expenses continue to climb. [1:04:20] And so, I'm just it's it's not a [1:04:23] disrespecting. It's not a I don't [1:04:26] appreciate everyone. It is just a [1:04:30] I've I've lost sleep about this budget. [1:04:33] I will be 100% honest about making sure [1:04:36] that I as a council person am putting [1:04:39] forth [1:04:40] what I feel is best for the residents [1:04:43] that um trust me. [1:04:45] And so, [1:04:46] um I just want to put it out there that [1:04:48] I hope that in the future [1:04:50] um we can look at other ways if we [1:04:52] continue to need to give the increase. [1:04:55] To and again, I know that the budget's [1:04:57] less this year, and I know this isn't a [1:04:58] budget talk yet, but [1:05:00] it kind of all works together. And so, [1:05:03] um that's just my feelings right now [1:05:05] that [1:05:06] I just hope that [1:05:08] it's not a thing that I have noticed I I [1:05:11] did a ton of research and it just seems [1:05:13] like it's a constant nope they get it and it's it's every [1:05:17] city it's every government agency [1:05:19] almost. And so that's just my honest [1:05:21] feelings. I'm fine with it this year [1:05:23] because of everything like other things [1:05:25] but I'll be 100% honest that my answer [1:05:27] will probably not be yes every single [1:05:30] year. So. [1:05:31] >> Well said Lacy thank you and and I do [1:05:33] want to make comment last year we we did [1:05:36] cut it back [1:05:37] a full percent from what it was [1:05:39] requested and then just make sure the [1:05:41] residents know too that we are not [1:05:42] raising any utilities this year as well [1:05:44] which is a great thing. [1:05:45] >> I I get that. I just you know it's it's [1:05:49] just everything and it's month after [1:05:51] month and it's it's hard. [1:05:53] We all know that everyone in this room. [1:05:55] So. [1:05:57] >> Any other comments from the council? [1:06:00] Then I would entertain a motion. [1:06:02] >> I'll make a motion that we approve the [1:06:04] fiscal year 26-27 executive municipal [1:06:07] officers compensation. [1:06:09] >> Have a motion. [1:06:10] >> I'll second. [1:06:11] >> Seconded by council member Ryan. [1:06:14] Start with council member Lacy. [1:06:17] >> Yes. [1:06:18] >> Council member Brian. [1:06:18] >> Yes. [1:06:19] >> Council member Ryan. [1:06:20] >> Yes. [1:06:21] >> Council member Ann. [1:06:22] >> Yes. [1:06:23] >> Motion carries. [1:06:25] Okay moving on to item number three [1:06:27] public hearing [1:06:29] of fiscal year 2026-2027 [1:06:32] enterprise [1:06:34] fund transfers. [1:06:35] I would accept the motion to open a [1:06:37] public hearing. [1:06:38] >> So moved. [1:06:40] >> Motion and a second council member Moss. [1:06:43] >> Yes. [1:06:43] >> Council member Ryan. [1:06:44] >> Yes. [1:06:45] >> Council member Brian. [1:06:46] >> Yes. [1:06:47] >> Council member Ann. Or council member [1:06:48] Lacy. [1:06:50] >> Yes. [1:06:51] >> This is hard. [1:06:52] >> [laughter] [1:06:53] >> Good job Bob. [1:06:53] >> The nightmare doesn't come. [1:06:57] Okay public hearing is open once again. [1:07:00] Citizens and staff [1:07:02] have the opportunity to come forward and [1:07:04] uh [1:07:06] give us some public input on the [1:07:07] enterprise enterprise fund transfers [1:07:10] as presented to us. [1:07:12] And just so you know, we seem to be [1:07:14] moving quickly. [1:07:16] We've been working on this budget since [1:07:18] Lacy and I took office in January. [1:07:21] We've had work sessions. We've had [1:07:23] continual feedback and discussions. And [1:07:26] we're to the point now that we think [1:07:28] we've got [1:07:30] our budget where we can face the [1:07:31] citizens of Payson. [1:07:33] Uh [1:07:35] we're mindful of [1:07:37] salaries. We're mindful of increasing [1:07:39] costs of [1:07:41] everything from fuel to food. [1:07:43] But we're also mindful of the increasing [1:07:45] costs that are passed on to the cities [1:07:48] from [1:07:49] the entities that we do business with to [1:07:51] make the city function. [1:07:53] Taking all that in the washing machine [1:07:55] and what comes out of that is we chose [1:07:58] not to raise any fees this year, [1:08:01] any taxes. [1:08:03] Uh at some point [1:08:05] we're going to have to bite the bullet [1:08:07] and do that, but it's not this year. [1:08:09] We felt like that we needed a [1:08:12] an opportunity to catch our breath and [1:08:14] take a a good hard look at where else we [1:08:16] can cut. We went to our department heads [1:08:20] uh at the beginning of the budget [1:08:21] process and asked them to to cut 5% out [1:08:25] of their budgets. [1:08:26] And I think the department heads done [1:08:29] wonderful [1:08:30] uh to to bring this to where we are [1:08:33] tonight. [1:08:34] So that's a little bit of history of [1:08:35] where we're at in this budget process. [1:08:38] So if anybody would like to come [1:08:40] forward, [1:08:41] uh [1:08:42] now's the time. [1:08:45] Emily, anybody online? [1:08:47] Not seeing Wait. [1:08:51] Would you like to come forward and [1:08:53] >> Is this about the enterprise fund [1:08:54] transfers? [1:08:55] >> Yeah. [1:08:55] >> Yep, this is the enterprise fund. [1:08:57] >> Enterprise fund. [1:08:58] >> The next one The next one will be the [1:09:00] budget. Yep. [1:09:02] Which one would you like to speak on? [1:09:04] >> I'm [1:09:05] standing in knowing if [1:09:07] the [1:09:08] sewage [1:09:10] is covering only Kayson or if it's [1:09:13] covering [1:09:14] surrounding towns. [1:09:16] >> Okay, let us finish this one and then we'll be [1:09:19] on that one very next. [1:09:22] All right, not seeing anyone else online [1:09:25] or in public. [1:09:26] I would entertain a motion to close the [1:09:28] public hearing. [1:09:28] >> So moved. [1:09:29] Second. [1:09:30] >> Second by Brian. I have a motion and a [1:09:33] second. Council member Lacey. [1:09:35] >> Yes. [1:09:35] >> Council member Brian. [1:09:36] >> Yes. [1:09:37] >> Council member Ryan. [1:09:38] >> Yes. [1:09:38] >> And council member Ann. [1:09:40] >> Yes. [1:09:40] >> Motion passes [1:09:42] to close the public hearing. Is there [1:09:44] any other input from council? [1:09:46] >> I I have one question. Cath- Cathy, [1:09:48] where'd you where'd you go? Oh, there [1:09:50] she is. Okay, very good. Um and I don't [1:09:53] know if this is uh regarding this, but [1:09:55] uh for the approved budget of 20 uh I was I was curious about the park [1:10:03] impact fee and why that took such a [1:10:05] dramatic uh dramatic change, a change of uh it went from 700,000 up to 1.2. [1:10:12] >> Cuz I we're using fund reserves. [1:10:15] >> Think we added the 500,000 for the [1:10:17] >> Oh, the expenditure side of it. I [1:10:19] apologize. [1:10:20] Um [1:10:21] >> Was that the 500,000 for the [1:10:22] >> No, I don't think so. This is for park [1:10:25] impact. [1:10:26] >> Let me look. I'm I apologize. I'm going [1:10:28] to have to I'm more of a visual [1:10:30] >> And like I said, this this is on the [1:10:31] previous year's budget. So if this is a [1:10:33] conversation had for a different time, [1:10:34] that's fine, too. [1:10:36] >> Okay. [1:10:37] >> I'm looking at the combined funds [1:10:40] uh for the approved budget 6 30 2026. [1:10:46] » I'm trying to I'm trying to think. [1:10:48] Go back. [1:10:49] >> You're in the enterprise fund, right? [1:10:52] >> We're in the general fund right now. [1:10:55] It's in [1:10:56] Okay. [1:10:58] Yeah, that [1:10:59] That's park tax. Were you calling park [1:11:01] tax or park impact? [1:11:03] >> Impact. [1:11:03] >> Park impact. [1:11:13] This current budget. [1:11:15] Maybe Carl can answer that question. [1:11:17] Thank you. [1:11:18] I just saw the change just from [1:11:19] >> We had it a couple of things last year. [1:11:21] We added the um additional funds to the [1:11:24] high school for additional tennis [1:11:25] courts. [1:11:26] >> Okay. [1:11:27] >> 350 and we also added the Wilson school [1:11:30] payment. [1:11:31] >> Okay, very good. That answers that [1:11:32] question. Thank you. [1:11:34] >> Apologize about that. [1:11:36] >> Thanks, Carl. [1:11:37] >> that. Thank you. [1:11:38] >> Stick around. [1:11:41] >> [laughter] [1:11:41] >> We're not done with you. [1:11:43] No, you're good for right now. [1:11:46] Are there any other discussion from the [1:11:47] council? [1:11:48] >> Um I just want to say I appreciate the [1:11:51] lowering of what you normally um do. [1:11:56] My goal down the road, I would love it [1:11:58] even more cuz I would love to be able to [1:11:59] use [1:12:01] the money that we're moving it from [1:12:04] for the for some other things, too, but [1:12:05] I think it's awesome. I think it's [1:12:07] great. And so I just wanted to just [1:12:09] state that that [1:12:11] >> Right. And and that's our goal coming [1:12:13] up. We will still have the indirect [1:12:15] services because the enterprise funds [1:12:18] are supposed to pay for their own [1:12:19] services and that that's the allocation [1:12:22] there, but yeah. [1:12:25] » On the enterprise fund transfers, do we [1:12:28] have any kind of uh [1:12:30] plan or or goal set up to ever use uh [1:12:33] some of these transfers, some of the uh [1:12:35] extra funds? I know they could be used [1:12:37] in a million different ways, but but to [1:12:39] start attacking some of Payson City's [1:12:41] debt a little more aggressively. Is that [1:12:43] ever something that we that we discuss? [1:12:46] >> Most of the debt we well, we have two [1:12:48] primary sources of debt. We have the [1:12:49] pool bond that's going to expire [1:12:52] 2027 27. And then we have the enterprise [1:12:56] fund debt. So, [1:12:58] we really once it's transferred it's [1:13:00] transferred to another fund, but we can [1:13:03] use whatever's revenue whatever revenue [1:13:05] is in the enterprise funds itself [1:13:07] because they sort self-contained [1:13:08] businesses. [1:13:10] Did that answer your question at all? [1:13:13] >> Yeah, I just I just think moving forward [1:13:15] if you know, I know it's a drop in the [1:13:17] bucket, but just just attacking that [1:13:19] adding a little bit of extra to those to [1:13:21] those debt service I think is is wise [1:13:23] and prudent with the residents funds and [1:13:25] to try to try to get us our head above [1:13:27] water as fast as we can to to be out of [1:13:30] the bondage of interest. [1:13:31] >> Right. Right. And I agree. One of the [1:13:33] things we are concerned about though is [1:13:35] that we have sufficient fund reserves in [1:13:37] the enterprise fund. So, if there is [1:13:40] a crisis or [1:13:42] you know, a a natural disaster or [1:13:44] something that that these funds can act [1:13:46] to on behalf of the citizens to provide [1:13:48] services still. So, we don't want to [1:13:50] eliminate all that. [1:13:52] >> Right. [1:13:53] Thank you. [1:13:55] >> Any other discussion council? [1:13:58] Then I would entertain a motion. [1:14:00] >> I motion that we approve the fiscal year [1:14:03] 2026-2027 [1:14:05] enterprise fund transfers. [1:14:07] >> I'll second. [1:14:08] >> I have a motion and a second. Council [1:14:10] member N? [1:14:10] >> Yes. [1:14:11] >> Council member Ryan? [1:14:12] >> Yes. [1:14:12] >> Council member Brian? [1:14:13] >> Yes. [1:14:14] >> And Council member Lacy? [1:14:15] >> Yes. [1:14:17] >> Motion carries. [1:14:18] I'm going to be all night long counting [1:14:20] these. [1:14:22] Okay, item number four. I guess one does being mayor pro tem negate his [1:14:27] ability to vote as a council member? Can [1:14:30] I vote? [1:14:31] >> Oh, okay. [1:14:32] >> Cuz it hasn't affected any votes right [1:14:33] now. We're okay, but [1:14:34] >> But I yeah, you still vote, Bob. [1:14:36] >> Oh. [1:14:36] >> Yeah. [1:14:37] >> Then all minor yes. [1:14:39] >> Okay. [1:14:40] >> So far. [1:14:43] Council member? [1:14:47] » I I think it'd be good to, you know, [1:14:49] especially on budget [1:14:49] >> have Bob's input and vote on this, too. [1:14:51] So. [1:14:52] >> I would like to. [1:14:53] >> Okay. All right. [1:14:54] Now, the big one. Item number four, [1:14:56] public hearing [1:14:58] uh on the adoption of fiscal year [1:15:00] 2026-2027 [1:15:02] budget. I would entertain a motion to [1:15:04] open a public hearing. [1:15:05] >> So moved. [1:15:06] >> Second. [1:15:07] >> Motion and a second. Council member [1:15:09] Lacey? [1:15:10] >> Yes. [1:15:10] >> Council member Brian? [1:15:11] >> Yes. [1:15:11] >> Council member Ryan? [1:15:12] >> Yes. [1:15:13] >> Council member Ann? [1:15:14] >> Yes. [1:15:15] >> Public and Council member Bob? [1:15:16] >> Yes. [1:15:19] » Public hearing is open. Anybody that [1:15:21] would like to make comment concerning [1:15:24] the entire fiscal year budget may now [1:15:27] come forward. [1:15:29] This would be a great time for your [1:15:31] question. [1:15:39] No, you're fine right there. [1:15:41] We [1:15:42] Okay, you need to come to the [1:15:43] microphone. Sorry. [1:15:44] >> Can I take the mic? Can I take the mic? [1:15:46] >> We're not sure if somebody's online and [1:15:47] they can't hear you. [1:15:49] >> You can bring it over here. You're free [1:15:50] to sit down if you'd like. [1:15:58] » My name's Heidi Perry and [1:16:01] I've I've lived here for two or three [1:16:04] years and the [1:16:07] sewer cost shocks us every time we look [1:16:11] at it. [1:16:13] Um we came from Battle Mountain, Utah [1:16:16] and they charged like 30, 45 dollars for [1:16:19] six months. [1:16:21] So, when we look at the cost here, it we [1:16:25] just about faint. [1:16:27] Um [1:16:28] I understand that we're having to build [1:16:31] a new [1:16:32] facility. [1:16:34] Um that we're required to do for federal [1:16:37] reasons or something. [1:16:39] But, I'm wondering [1:16:41] does will it include service for towns [1:16:45] around us [1:16:47] and are they helping to pay for any of [1:16:51] it if so? [1:16:54] >> I can answer a lot of that for you. [1:16:56] Uh [1:16:58] So we were mandated to update the sewer [1:17:01] plant uh by the EPA. [1:17:04] And we took uh [1:17:07] costing bids. [1:17:08] We came in [1:17:09] and I'll preface this by saying [1:17:12] I was on the council prior to this time [1:17:15] and I spent a lot of time in Logan. [1:17:17] I spent a lot of time in Provo and I [1:17:20] spent time with Spanish Fork [1:17:22] on what they were having to do cuz they [1:17:23] was they was 2 years ahead of us. [1:17:26] We we got told that there was going to [1:17:28] be some changes and so we held off [1:17:32] and COVID hit [1:17:34] and it just drove everything out of the [1:17:36] bucket. [1:17:38] Then the Biden administration put a time [1:17:41] period that we had to meet on and so we [1:17:44] had to move. [1:17:46] We went through the process and I must [1:17:49] say [1:17:49] for what we did so Logan originally [1:17:52] budgeted $86 million. They come in at [1:17:55] 119. [1:17:57] Uh I can't remember Provo's. It was it [1:17:59] was even more staggering. Spanish Fork [1:18:01] was about the same percentage. They were [1:18:03] about 38% higher than what the original [1:18:07] council budgeted cost was. [1:18:10] Payson City budgeted $70 million [1:18:13] for our sewer upgrade and one thing that [1:18:16] gave us the leg up is immediately we [1:18:19] started purchasing [1:18:21] the long-range products that we were [1:18:23] going to need to complete the project [1:18:26] and paid for them at that point of the [1:18:28] project early on. [1:18:30] So we beat the cost increases. We beat [1:18:33] everything. Last council meeting we [1:18:36] approved the final $5 million of [1:18:40] $70 million. We came in right at budget. [1:18:44] So, we don't have any cost overruns. [1:18:47] We're we're right where we need to be [1:18:49] and we that's been a lot Hats off to our [1:18:51] contractor that's down there. Hats off [1:18:54] to our staff and hats off to our [1:18:56] administration for staying on top of [1:18:58] that like a hawk. [1:19:00] Uh [1:19:01] in answer to your to your do we share [1:19:04] sewer [1:19:05] we have interlocal agreements [1:19:07] uh with certain cities. [1:19:09] We do supply sewer for for Elkridge City [1:19:12] right now. [1:19:14] But, we also have uh interlocal [1:19:16] agreements with them on water. [1:19:19] That we we connect to some of their [1:19:21] water systems. [1:19:23] Do they uh [1:19:25] do they pay their fair share? [1:19:26] Absolutely. [1:19:28] Yep, they do. [1:19:29] We we are not a council that is in [1:19:32] business to [1:19:34] be the big brother anymore. [1:19:36] Uh Payson City is Payson City and the [1:19:39] other cities are cities that need to pay [1:19:40] their own way. And so, we treat it as a [1:19:43] business. [1:19:44] And they have to pay their fair share. [1:19:47] >> Okay. Um I'm going to say I [1:19:51] Here's the bad Lacy. [1:19:52] I disagree with that. I've asked since [1:19:55] January that we do a study to see if [1:19:57] they are paying paying their fair share. [1:20:00] Based on the papers, I don't think so, [1:20:03] but that's just me. I was told that they [1:20:05] were given the chance to help [1:20:08] like buy into the sewer upgrade or [1:20:10] system [1:20:12] and they did not want to. [1:20:15] And so, for me I see it as again an [1:20:18] incoming resident who also pays a large [1:20:21] sewer bill. [1:20:22] And um [1:20:25] I I first asked the question in January [1:20:27] though, but I see it as [1:20:29] they're They're a great smoking deal and [1:20:32] we're the ones paying the bond back, and [1:20:35] I also know that that city then up [1:20:37] charges [1:20:38] their residents because they maintain [1:20:41] the lines in their city. [1:20:43] Um it would cost them a lot more if they [1:20:45] even could build their own, and so [1:20:49] I will keep pushing for the study to be [1:20:51] done. I know it takes time. I know what [1:20:53] Travis said it could take 6 months or [1:20:55] so, but we have the money for that. [1:20:58] Um [1:20:59] and so [1:21:01] me personally, I want the same answer, [1:21:03] and I haven't been able to get it yet, [1:21:05] but I hope in the next within the next [1:21:07] year we have that answer, and then we [1:21:10] can figure it out, but [1:21:13] that's just my opinion. [1:21:14] >> I I can answer that a little bit if I [1:21:16] may. [1:21:17] The original agreement with Elkridge [1:21:19] City is that we were to give them 1,500 [1:21:23] Was it 1,500 even? [1:21:27] At at a set price with cost increases [1:21:30] that we would incur, we would pass on to [1:21:33] their bill also. [1:21:35] >> Okay. [1:21:35] >> We're nearing that connection total. I [1:21:38] think we're about 1,300 right now. [1:21:40] So, in the next year or two, maybe 3 [1:21:43] years, [1:21:44] there will need to be either a new [1:21:46] agreement or Elkridge City will have to [1:21:49] entertain the thought of going with [1:21:50] Salem [1:21:52] or doing their own sewer system. [1:21:54] >> Okay. [1:21:55] >> Uh I I I'm very sensitive to what Lacy [1:21:59] said, cuz I was part of that. Uh that [1:22:02] was years ago when Elkridge City first [1:22:05] came to us. [1:22:06] Uh [1:22:07] and we felt like at the time [1:22:10] a lot of these agreements are aged, [1:22:12] right? [1:22:13] And so what looks like a good deal [1:22:15] today, [1:22:17] it probably is a better deal than them [1:22:19] having their own sewer system, but [1:22:21] that's the agreement that we've had to [1:22:22] live with. [1:22:23] They also have to uh, with their [1:22:26] agreements they made two connections to [1:22:28] us for water. [1:22:30] And so, we feel like we're getting a [1:22:32] pretty good deal there, also. [1:22:34] >> Okay. [1:22:35] >> If Does that answer it? I mean, Lacey's [1:22:38] correct. Uh, are they paying their total [1:22:40] fair share? No, but we're bound by an [1:22:43] agreement [1:22:44] >> Okay. [1:22:44] >> that was signed several, several, years ago. [1:22:47] >> Okay. And is that the only one that [1:22:51] >> Woodland Hills. [1:22:53] Yep. And And [1:22:54] >> And it is time we we evaluate those [1:22:56] agreements and and get them improved to help benefit uh, our city that's taking on the bulk of the [1:23:03] responsibility and charge of that. We [1:23:04] want to be good neighbors. Uh, we don't [1:23:06] want to uh, take advantage of our [1:23:08] neighboring cities, but we can't let the Payson residents subsidize it, [1:23:11] either. So, it is time we reevaluate. [1:23:13] >> Okay. [1:23:14] And one other question. [1:23:15] >> with that completely. [1:23:17] >> I have one other question. [1:23:18] >> Mhm. [1:23:19] >> Um, we were told that we may have [1:23:22] lead in our water. [1:23:24] When does that process take place of [1:23:28] whether we're going to have that [1:23:30] [clears throat] fixed? [1:23:31] >> Travis, can you We we do [1:23:34] We we monitor for lead often, and so, [1:23:36] Travis can answer those questions. [1:23:39] >> Travis is our utilities [1:23:41] guru. [1:23:42] >> the EPA said we had to go and identify [1:23:46] any lead or copper that was in our water [1:23:48] system and let the residents that are [1:23:50] that have that in their lateral or or a [1:23:52] main line know that. [1:23:54] As far as I know, we don't have any [1:23:55] lead, but we have galvanized and copper. [1:23:58] So, we've notified everyone that has [1:24:00] that, and we're actively replacing our [1:24:03] side of it, but the homeowner is [1:24:05] required from the meter to their house [1:24:07] to replace it if they have any [1:24:08] galvanized lines like they're old. [1:24:13] So, as far as I know, we don't have any [1:24:15] actual lead, but there are galvanized [1:24:18] lines and and copper that the EPA [1:24:20] doesn't like. So, we are doing our part, [1:24:23] but we have to let the residents know [1:24:25] until they replace theirs that every [1:24:27] year we have to notify them that they [1:24:29] have that risk. [1:24:31] So. [1:24:31] >> So, [1:24:33] the first part of my house was built, I [1:24:36] think, in 1884. [1:24:38] And the the last part in 2013, [1:24:41] and something in the middle. [1:24:44] So, we're finding all kinds of surprises [1:24:48] with what we bought. [1:24:50] And we're just kind of trying to figure [1:24:52] out [1:24:54] when we can get sidewalks, and [1:24:57] do we get clean water? [1:24:59] We have very little water pressure. How [1:25:02] does that Does that affect there? So, [1:25:05] um if you could talk to me more about [1:25:07] that, I'd appreciate it. [1:25:09] >> Yeah, if you want to get a hold of me, [1:25:10] like, we can go through anything. I I [1:25:12] don't know if we want to go through all [1:25:13] that tonight, but [1:25:14] >> Okay. [1:25:15] >> But yeah, I you know, we try to do our [1:25:17] best, like, you know, water, it could be [1:25:20] an issue in your house, like, cuz we [1:25:22] have hard water in Payson. So, you get [1:25:24] that that calcium deposit, that can [1:25:26] build up in your lines. Like, I just [1:25:29] replaced the PRV in my house, which is a [1:25:30] pressure pressure-reducing valve, and my [1:25:32] pressure went way up. [1:25:34] >> Okay. [1:25:34] >> Cuz I had had I've lived there for 23 [1:25:37] years, and mine had gone down, so I did [1:25:39] that in my own house to fix it. That's [1:25:41] not the city's responsibility, that's [1:25:43] the homeowner, so we can definitely [1:25:45] check your area, and see if there's any [1:25:47] issues with anything on our side, but it [1:25:50] also could be on your side, too, so. [1:25:51] >> Okay. I appreciate that. And what was [1:25:53] your name? [1:25:53] >> Travis. [1:25:54] >> I'm the public works director, so. [1:25:56] >> Travis Yokoman. [1:25:57] >> Travis Yo [1:25:58] >> Jocumsen. [1:25:59] >> Jo Jocumsen. [1:25:59] >> Okay. [1:26:00] >> [laughter] [1:26:01] >> All right, thank you. [1:26:02] >> You say Prols Guard, I say Prols Guard. [1:26:05] >> Thank you. [1:26:06] >> [laughter] [1:26:06] >> You're Prols Guard. [1:26:07] >> Thanks, Travis. [1:26:08] >> Thanks. Thank you for your comments. [1:26:11] Are there any other comments? [1:26:15] Anyone online, Emily? [1:26:17] Not seeing anyone online. [1:26:19] Uh I would accept a motion to close the [1:26:21] public hearing. [1:26:22] >> So moved. [1:26:22] >> Second. [1:26:23] >> Have a motion and a second. Council [1:26:25] member Ann. [1:26:26] >> Yes. [1:26:26] >> Council member Ryan. [1:26:28] >> Yes. [1:26:28] >> Council member Brian. [1:26:29] >> Yes. [1:26:30] >> Council member Lacey. [1:26:31] >> Yes. [1:26:32] >> All right, Council. [1:26:33] >> Are we talking about the budget? [1:26:34] >> We are on the budget. [1:26:35] >> Okay. [1:26:35] >> Public hearing is closed. Oh, Council [1:26:37] member Bob. Yes. [1:26:40] >> Thank you. Okay. Um I I have a few [1:26:42] questions and and uh want to float a few [1:26:45] things before the Council, too. Um [1:26:48] uh [1:26:49] the the current budget is is 2% less [1:26:52] than the budget we had last year, which [1:26:54] I applaud uh all of the department heads [1:26:56] all the departments for cutting budgets. [1:26:58] Thank you. Thank you for doing well with the funds that you have and even [1:27:01] trying to reduce that. Thank you so [1:27:02] much. Really, this is a this is a good [1:27:04] conservative budget. I appreciate that. [1:27:07] There are a few items I do see I wonder [1:27:09] about cutting and I want to get the [1:27:10] Council's uh input on. [1:27:13] Um uh the the first is is one that I had [1:27:16] thought about and now I'm wondering [1:27:17] about is is the the business park uh [1:27:20] road overlay. [1:27:21] Uh one one concern I have about that is [1:27:24] uh they're going to be a bunch more [1:27:25] connections that we'll have to make and [1:27:28] tear that up anyway. That road's not in [1:27:29] terrible shape now. Uh I do wonder if if [1:27:32] that's something we postpone for a few [1:27:33] more years or if you guys feel it truly [1:27:35] is is needed right now. [1:27:37] >> As we talked about that, [1:27:40] you and I, [1:27:41] uh the answer is we've stubbed all of [1:27:44] our sewer and water and utilities [1:27:47] foreseeable into the lots [1:27:50] down there. Now, that doesn't mean that [1:27:52] uh [1:27:53] something new could come in and demand [1:27:56] more, Ryan. That would require [1:27:58] >> Mhm. [1:27:58] >> additional [1:28:00] out in the street. [1:28:01] Uh I think the the concern is we were [1:28:05] originally going to chip and seal it, [1:28:07] >> Mhm. [clears throat] [1:28:07] >> but we've started if you've driven down [1:28:10] there, we've started collecting a lot of [1:28:13] uh what I call spider webs [1:28:16] that we've [1:28:17] uh [1:28:20] damaged the the surface below. The the [1:28:22] road base and what have you is is no [1:28:25] longer holding and so it needs to be [1:28:27] resealed. [1:28:28] And we felt like rather than spending [1:28:31] a couple hundred thousand dollars on [1:28:35] the chip and seal that we would be [1:28:37] better to rotomill it and and re-overlay [1:28:40] it. [1:28:41] >> So, I got a few comments on this. One is [1:28:43] I was the one that brought this up [1:28:44] because this is RDA money. It's not in [1:28:47] our general budget. It's RDA money and [1:28:50] we have RDA funds that were [1:28:53] came from property taxes in that area [1:28:56] and it has to be spent in that area. We [1:28:58] have millions of dollars, so it needs to [1:28:59] be go back in the area, but that's the [1:29:02] thing to look at if it makes sense now [1:29:03] or not, but it makes sense to use the [1:29:05] RDA funds. It's not funds that come from [1:29:08] the general population. [1:29:09] >> Is there a timeline on when we have to [1:29:11] use those RDA funds, Brian? [1:29:12] >> I don't think [1:29:13] >> No, I don't think so. [1:29:14] >> And Okay. Uh Travis and and is that [1:29:17] accurate? Do we do we have stuff stubbed [1:29:19] into the individual lots? [1:29:21] >> Um yes and no. There are a lot of stubs, [1:29:23] but obviously if they subdivide [1:29:25] differently and add a lot, you know, or [1:29:27] do something then that may or may not [1:29:29] work out, but yeah, there are a lot of [1:29:32] lines, so hopefully we could avoid [1:29:34] cutting it, but I've learned no matter [1:29:36] what you do, somebody will come along 5 [1:29:38] minutes after you just finished [1:29:40] >> They're wanting to cut it. [1:29:41] >> We do have a moratorium where we don't allow them to for a certain [1:29:46] number of years, but you know, like I [1:29:48] said, any new development, it's hard to [1:29:50] say for sure that you're not going to [1:29:51] have to go back in, but there are quite [1:29:53] a few there. [1:29:54] >> So, you're saying if we if we totally [1:29:56] replace this road, we have a moratorium [1:29:57] and when will let someone dig in and and tie in? [1:30:01] >> So, if we obviously we can definitely [1:30:03] look at that where they all are [1:30:05] and do our best to, you know, estimate if that's going to work before [1:30:10] we obviously redo the road. And if we [1:30:11] need to add one here or there, we could [1:30:14] that would be cheaper to do it then than [1:30:15] obviously after we just paved it, but I just looked yeah, we have quite a [1:30:19] few that are stubbed out on those empty [1:30:21] lots a lot there, so [1:30:25] >> Any comment on that with the sewers out [1:30:27] of it? [1:30:27] >> Yes. [1:30:37] Yeah. [1:30:39] but then and is that fine metric? [1:30:41] I don't want to wait forever for it [1:30:42] develop to to repave it, but I drove it today. I just don't know if [1:30:45] it's needed now or not, so [1:30:47] >> That's That's why I was looking at just [1:30:49] a slurry seal just for the cracks are [1:30:51] and just do that and get the slurry done, so [1:30:55] >> Yeah, so there's the cost of the slurry, [1:30:57] there's the cost of the [1:30:59] >> How much would the cost of the slurry [1:31:00] be? [1:31:01] >> The cost of the slurry is about 124,000 [1:31:03] and to redo the road is is 504 and I [1:31:06] know Bob met with Kent and talked about [1:31:09] that and obviously slurry is just a [1:31:11] band-aid. [1:31:11] >> Yeah, there might be some areas where [1:31:12] you have to do a more intensive [1:31:15] treatment cuz slurry is basically just [1:31:17] what it is. It's just a thin coat. If [1:31:19] you have cracks in that, it'll seal [1:31:21] them, but it's not going to stop them. [1:31:23] >> Mhm. [1:31:23] >> Whereas if you have some bad areas, we [1:31:25] might need to dig those up, actually [1:31:27] beef that section of the road up, but [1:31:29] you know, we could look at a combination [1:31:30] of doing [1:31:32] the the more intensive repairs and then [1:31:33] doing the slurry over once we get that [1:31:35] without doing everything, but that's [1:31:37] something we'll have to look at the [1:31:38] condition. [1:31:39] >> So one thing I was just thinking of and [1:31:40] I'm not an expert on roads at all, but [1:31:42] where the cracks are, it's just go in [1:31:44] fill, you know, do the cracks and that [1:31:46] wouldn't be the 123,000 and just be and [1:31:49] that's more in the middle than than the [1:31:51] middle part of the road. [1:31:52] >> width and depth of the crack matters cuz [1:31:54] if it gets too wide, just trying to [1:31:56] crack seal it doesn't work very well cuz [1:31:58] it gets too big, so sometimes you got to [1:32:00] cut like a 5-ft section out, re-compact [1:32:03] base in that, and then pave it, but [1:32:05] that's definitely something we can look [1:32:07] at and some go somewhere in between [1:32:09] those two costs basically. [1:32:10] >> Yeah, I just didn't want it fall to [1:32:12] pieces while we have money that we can [1:32:13] fix it. So, let's keep it up up to snuff [1:32:16] and whether we need to do the whole [1:32:18] thing or not, it doesn't matter to me as [1:32:19] long as we keep on top of it. [1:32:21] >> Yeah, I think we could do a combination [1:32:22] of it. [1:32:23] >> I would How would the council feel it if we if we approve them a certain [1:32:27] amount to to go after that road and and [1:32:30] preserve it, but maybe not totally redo [1:32:32] it. [1:32:32] >> big comment as well, Dave. [1:32:34] >> Um we are expecting and anticipating a [1:32:37] pretty significant development [1:32:39] >> Yep. [1:32:39] >> uh to occur. Uh it might be prudent to pause and see what that specific [1:32:46] development needs to do. Uh you know, if [1:32:48] there's money in the budget to to [1:32:51] come in after that one is done uh with [1:32:53] whatever tie-ins may or may not be [1:32:55] necessary, that might be a little bit [1:32:57] more prudent in this situation. [1:32:59] >> I like that idea. [1:33:00] >> And sorry, are we not talking about [1:33:02] We're We're this That's a budget [1:33:04] >> It's the RDA It's the RDA budget which [1:33:06] is Okay. [1:33:07] >> So, I'll bring that up next time then. [1:33:09] Uh but you know what I'm going to bring [1:33:10] up now. My My other My other question um [1:33:14] is the [1:33:15] uh the HVAC system uh for the building. [1:33:19] Um the the 700,000. [1:33:22] How many times have we rolled that over? [1:33:23] Do you know, Kathy? [1:33:24] >> I think this is It might be the third. [1:33:28] >> What did you say? [1:33:29] >> Third. [1:33:30] year? Okay, do do we have any [1:33:31] information of why that keeps getting [1:33:33] rolled over? [1:33:34] >> Yeah, why isn't it getting Why isn't it [1:33:36] getting done? [1:33:37] >> I know this year we went out for a [1:33:38] formal bid. We hadn't done that [1:33:40] previously. We got a contractor now [1:33:42] online, but they don't want to do that [1:33:45] project until May when it's cooler so [1:33:47] that we have air conditioning. [1:33:48] >> I thought you had said it was the fall. [1:33:51] >> Well, oh, sorry. Did I say [1:33:52] >> So, yeah, but I like I was going to [1:33:56] bring this exact thing up um because I [1:33:59] feel like this is baby sewer plant and [1:34:03] we'll just keep kicking it and HVAC [1:34:05] systems just keep getting more and more [1:34:06] and if we get a bid now [1:34:08] I don't feel like it's going to be [1:34:11] suffi- like it's not going to be bids [1:34:13] are only good for so long and so [1:34:15] >> 3 seconds is [1:34:15] >> Yeah, exactly. And so and if you even [1:34:18] purchase the stuff now, it may not be [1:34:20] compliant in a year. But it's [1:34:24] Sorry to take your time, Ryan. But so [1:34:26] when I was sitting in your office and [1:34:28] I'm going to I'm going to preach it. [1:34:31] I think everyone knows that I am a [1:34:33] lead by example and as we were sitting [1:34:36] in your office, number one I made the [1:34:37] example. If you go to Chief Bishop's [1:34:39] office, you're in Florida with the fruit [1:34:41] flies. [1:34:42] And then you go to your office and you [1:34:45] have a inefficient [1:34:47] window AC unit blaring all day. [1:34:51] And here we are [1:34:53] trying to get our residents to be more [1:34:55] efficient. And all that HVAC system is [1:34:58] going to do is help be efficient in this [1:35:00] building and even if one day this isn't [1:35:02] our city building, it's an improvement [1:35:05] to the building. And so for me [1:35:08] personally, I don't want to keep kicking [1:35:10] it, but that's just my thing, but [1:35:13] >> I still want to know why why it took 3 [1:35:15] years to [1:35:17] put out for a bid. [1:35:19] Why didn't we do this the first year? [1:35:22] >> I can't remember. Do you remember, Dave? [1:35:25] Do you remember? [1:35:27] >> I didn't pull that. [1:35:29] last [1:35:32] I need to find out. [1:35:33] >> Yeah, we'll find out for you. [1:35:35] >> Okay. [1:35:35] >> So I guess I guess for me personally, I [1:35:37] yeah I feel uh a little different than Lacy. I wonder about just cutting that if we're going to keep [1:35:42] rolling it over and and really judge if that's the best use of the funds to put in this building right now or [1:35:48] not. So that's something I'm [1:35:49] considering. [1:35:50] >> If if to do it, let's do it. If we're [1:35:51] not, then [1:35:52] >> Yes. [1:35:53] >> Take it off. Totally agree. [1:35:54] >> Cuz I don't I don't see anything in the [1:35:55] near future that we're going to get a [1:35:57] new building. [1:35:58] >> No. [1:35:59] >> And I and I hear both of you. [1:36:02] But I know that our employees are [1:36:03] suffering, too. They're They're dying in [1:36:06] all the seasons. [1:36:06] >> I I just I fear and I don't know. I just [1:36:08] wonder if if if we haven't done it [1:36:10] because we don't know for sure if it'll [1:36:12] fix the problem. The HVAC. [1:36:13] >> That's a good question. [1:36:14] >> That's not been the reason. [1:36:16] >> I I don't believe it is. And I'm going [1:36:18] to verify that it has been 3 It might be [1:36:20] 2. It was 6 [1:36:21] >> I think the first year we budgeted, it [1:36:23] was [1:36:24] and he did get some bids. It was not [1:36:27] enough money in the budget. It was a lot [1:36:28] more expensive than what we had [1:36:30] anticipated. [1:36:30] >> And that's why we carried the 200,000 [1:36:32] >> over and added more to it. [1:36:34] >> Yep, and added more to it to make it [1:36:36] work. [1:36:37] >> It was totally cost. [1:36:39] >> Will it be the entire building or will [1:36:41] it just be the office the offices on [1:36:43] this side or will it be the offices over [1:36:45] there or will it be [1:36:46] >> My understanding is the air handler for [1:36:48] this side of the building. [1:36:49] >> That's my understanding. [1:36:49] >> Yep. Yeah. [1:36:50] >> So, just one side. [1:36:52] >> But yeah, just just saying 700 grand, [1:36:54] it's [1:36:55] I I know Steve [1:36:56] >> I I don't want to [1:36:57] >> I'd buy a lot of dirt somewhere. [1:36:58] >> I don't want to go to [1:37:00] That's the amount we're rolling over. [1:37:01] It's the additional 250,000, so it's [1:37:03] 950,000. [1:37:05] >> Right, but that's I'm just discussing [1:37:06] the roll over. Yeah. Yep. So, thank you. [1:37:09] Okay, those are my two things I I Well, [1:37:11] I guess my one thing I want to bring up [1:37:13] um to see if it's worth putting that 700 into this [1:37:18] budget or not. [1:37:19] >> I know that you brought up in the work [1:37:20] session the carpet replacement. Did we [1:37:23] ever talk about that? [1:37:25] >> in the [1:37:26] uh what the banquet hall and Steve has [1:37:28] told me this is this is going to happen. [1:37:30] >> So, this is going to happen. Okay, cuz I [1:37:31] know you had brought up like And I do [1:37:33] want new carpet in here. That's my [1:37:34] favorite stain right there. [1:37:36] Well, you had brought it up that we I [1:37:37] think we thought it was just for the [1:37:38] seniors cuz that's what it says on the [1:37:41] budget. [1:37:42] So, I just wanted to confirm that. [1:37:44] >> We'll have to. Thank you. [1:37:45] Thank Yeah. [1:37:48] >> Um I have a question about the motocross [1:37:51] study. Is that in this one or is that in [1:37:53] the amendment amended one? [1:37:55] >> It is in this budget 2027. [1:37:58] >> I would like to, um, [1:38:01] not spend $80,000 on a motocross study [1:38:04] and before we get more information. We [1:38:07] need more information on how the [1:38:08] residents out there feel, if it's, um, [1:38:12] going to be [snorts] [1:38:14] a big fight, [1:38:15] if it's even needed, if it's important, [1:38:19] all of that stuff. So, I would like to [1:38:21] save $80,000 and not do the study for [1:38:24] that because I don't think it's it's not [1:38:27] necessary right now. [1:38:29] I think it's just That's That's a lot of [1:38:31] money. [1:38:31] >> And one suggestion, you don't have to [1:38:33] take my suggestion. If you keep it in [1:38:35] the budget and you want to do your your, um, investigation this year, you [1:38:40] don't use it, it rolls to fund balance. [1:38:42] If it's used, it's used. [1:38:44] But, that's just a suggestion. You can [1:38:45] take it out if you'd rather take it out [1:38:47] completely, too. [1:38:48] >> Okay, I don't know how the rest of the [1:38:49] council feels about that, but [1:38:51] >> I know that we we don't have the grant [1:38:53] money for this one. So, my feeling was [1:38:56] to take it out if the grant money that [1:38:57] we received is not going to cuz I feel [1:39:00] like we're doing a lot of studies right [1:39:02] now. We're not going to be able to do [1:39:03] all of them, [1:39:05] but that's just my feelings on it. [1:39:07] >> Yeah. [1:39:08] >> I could add a little bit about [1:39:09] motocross. We've been working on this [1:39:10] for 20 years plus. So, it's not [1:39:13] something that's new and then Rocky [1:39:15] Mountain ATV has a promise to bring in a [1:39:18] national event if this happens. So, [1:39:20] there's a lot more to it than just doing [1:39:22] the study, but I I didn't even know that [1:39:24] was in there for the 80,000, but it's [1:39:27] something that we really need to keep [1:39:29] pursuing because something we worked on [1:39:31] for a long time. There is a lot of [1:39:32] interest in it, but [1:39:34] >> And is Rocky Mountain going to help us pay for that or [1:39:38] >> I don't know if specifically on this. I [1:39:40] know they've talked about helping with [1:39:42] this and then I know another individual [1:39:44] that's building a 400,000 square foot [1:39:46] building in Payson that's very [1:39:47] interested in our motocross, too, and and we're [1:39:51] >> this is all information I want to know [1:39:52] before we spend [1:39:55] $80,000 on a study. [1:39:57] >> The 80,000 was just a a hypothetical [1:39:59] number. We don't have an actual [1:40:00] consultant [1:40:02] that we've contacted. We just said a [1:40:05] You've just set a budget number. [1:40:08] >> And another thing with this, and and the [1:40:09] reason this probably in here and I [1:40:11] didn't know exactly on it, but um [1:40:14] the BLM [1:40:16] says they don't have money to keep this moving along. And so, it's [1:40:20] just kind of sitting there, and they [1:40:21] said, "Well, if you come up with the [1:40:23] money, then you can do this." And it it [1:40:25] really shouldn't be our responsibility, [1:40:27] but to keep this moving along at all is that's probably why that's in there, [1:40:32] but I agree that we could we could leave [1:40:34] it in the budget, but let's look at it a [1:40:36] little bit deeper and see if we can get [1:40:37] some help from some other individuals to [1:40:40] help compensate for part of this, too. [1:40:43] >> I I'm just not confident that it'll [1:40:46] be welcomed out there after the gun [1:40:49] range [1:40:50] um [1:40:53] opinions came out. [1:40:55] >> Mayor Mayor Council, we could if on all [1:40:58] these, the 80,000, the HVAC, if you want [1:41:01] to pull those out of the budget, that [1:41:02] would go into fund balance, and then [1:41:03] once you get information, we could [1:41:05] always do a budget amendment later in [1:41:06] the year. [1:41:08] I mean, we we can do it either way. We [1:41:09] can leave it in until and [1:41:12] just put a hold on it till you guys [1:41:14] >> Personally, I absolutely do not want to [1:41:16] pull the HVAC out. We've kicked that can [1:41:19] down the road too long. [1:41:20] >> Yeah, I'm just I'm just saying [1:41:21] >> Prices are just going to keep going [1:41:22] through the [1:41:22] >> We could always do a budget amendment [1:41:24] once you're comfortable with things [1:41:26] at a later time. [1:41:27] >> I I think we need more information on both those items, and we'll get a bid. [1:41:35] And then we can [1:41:36] do a budget [1:41:37] amendment. [1:41:38] >> I think we've got a bid on the HVAC. [1:41:40] >> Do you? [1:41:40] >> Yeah. [1:41:41] >> Okay. I don't want to I don't want to [1:41:43] keep the HVAC in. [1:41:49] » These are my least favorite city council [1:41:50] meetings, by the way. [1:41:52] I'm starting to learn that. [1:41:54] Um [1:41:54] >> [clears throat] [1:41:55] >> I didn't just going to say this and then [1:41:58] I'm done my personal opinion will then [1:42:00] talking about it. Um [1:42:03] I'm going to first say [1:42:05] uh this opened my eyes a lot. [1:42:07] Um [1:42:08] I will be the first one to admit like I [1:42:11] have said the exact words shame on me [1:42:14] for not asking as many questions as now [1:42:16] I suddenly have. [1:42:18] Um especially as last week I reached out [1:42:21] to you and I said [1:42:23] what is other professional services [1:42:26] entail? What does this entail? What does [1:42:29] this entail? [1:42:30] And as I started getting the answers, [1:42:33] that's when I saw things and I said I'm [1:42:35] not okay with that. And then I started [1:42:37] thinking of my [1:42:40] real my full-time job and I thought I [1:42:43] asked these questions in there and [1:42:44] that's how I find this this and this. So [1:42:46] I asked you, you know, multiple [1:42:48] questions about like subscriptions and [1:42:49] do you know, how do we make sure that [1:42:51] we're not paying for the same [1:42:52] subscription somewhere, you know, um [1:42:55] different things that little by little [1:42:57] like my exact notes are like many think [1:43:00] that like little expenditures, you know, [1:43:03] or little tiny increases may not be a [1:43:05] lot, but it adds up and that's why all [1:43:07] of a sudden we were at 122, [1:43:09] 123 and now we're at 126.5. [1:43:12] Um [1:43:14] again like my biggest thing that I would [1:43:16] like those little tiny things [1:43:18] I would love for all this stuff that we [1:43:21] cut the things that aren't right this [1:43:24] minute needed and I can't do that [1:43:26] because I now didn't give my time to [1:43:28] really like dig into it. Um but I really [1:43:31] after talking to you, I would really [1:43:33] love to look at it more [1:43:36] um [1:43:37] and put more into the like the capital [1:43:40] because I really think that that's how [1:43:42] like [1:43:43] we need to fund a police station soon [1:43:46] and I really that is like I would I [1:43:49] don't want to increase taxes on it and [1:43:50] so for me the more and more we started [1:43:52] looking at numbers like I know $80,000 [1:43:55] isn't an overall ton of money [1:43:58] but it might pay you know in my eyes I'm [1:44:00] like well that pays for someone's salary [1:44:02] you know that pays for this and so me [1:44:04] personally I will be the first to admit [1:44:06] shame on me. Um, that's all I have to [1:44:09] say on it but that will help um [1:44:12] just let people understand where I'm at [1:44:14] right now. So. [1:44:18] This is on. Is it on now? [1:44:19] >> If any of you have questions feel free. [1:44:21] >> Feel free to ask, stop by. [1:44:24] I'm a spreadsheet person so I drive [1:44:26] people nuts but I'm happy to give any [1:44:28] level of detail you want. [1:44:30] >> It was a learning experience that's why [1:44:31] I said like this first year [1:44:33] they don't teach you this in that [1:44:35] three-hour course you take. I can tell [1:44:37] you that right now. The only thing they [1:44:39] teach you is stuff that hasn't been [1:44:41] relevant at all. So [1:44:43] that's all I want to say. [1:44:44] >> And Kathy you you've been more than [1:44:46] accessible. [1:44:47] >> Thank you. [1:44:47] >> You really know you you know your [1:44:49] numbers, you know your spreadsheets, you [1:44:51] know all the funds. So thank you so much [1:44:53] for being willing to answer all our [1:44:54] questions and talk to us at any time. [1:44:57] >> So um [1:44:59] Dave and Robert um so there's there's [1:45:01] two avenues here we could remove [1:45:03] uh said items if it were to pass from [1:45:06] the budget or is there a way to attach [1:45:09] something to these particular items that [1:45:10] it couldn't be spent until it got [1:45:13] reapproved by the council? [1:45:15] Or is it just easier to just take it out [1:45:16] and then do a budget amendment? [1:45:18] >> part of your motion and we'll [1:45:19] >> Okay. [1:45:20] >> Yeah. [1:45:21] >> Could you guys feel comfortable if we [1:45:22] kept these things in the budget but I I [1:45:25] be but attached something to these two [1:45:26] line items that uh require further [1:45:28] approval before we spend the money. [1:45:31] >> So it doesn't disappear [1:45:32] >> Yep. [1:45:33] >> over time like [1:45:34] >> Right. [1:45:34] >> nickel and dime away. [1:45:36] >> And then if And then if we decide to to [1:45:38] change the amount or it's not spent, [1:45:40] then what happens to that that money on [1:45:42] paper? [1:45:44] >> Yep. [1:45:44] >> Okay. [1:45:45] >> It'll be [1:45:53] » Okay. [1:45:57] >> Or like you were saying earlier, to pay [1:45:58] a bill. [1:45:59] >> Yeah. [1:46:00] >> Yep. [1:46:02] >> Any further discussion, Council? [1:46:05] It's kind of long and lengthy, but I [1:46:06] think we've got a got kind of an idea of where [1:46:10] we want to go with this. [1:46:11] >> Mhm. [1:46:11] >> It's important stuff. [1:46:13] >> Yep, it is. I would entertain a motion [1:46:15] for the adoption of the fiscal year [1:46:17] 2026-2027 [1:46:19] budget [1:46:20] as proposed. [1:46:23] >> Can I [1:46:25] change your motion? [1:46:26] Can we Can we change the motion in such [1:46:29] that uh [1:46:30] the uh the 80,000 for the uh dirt bike [1:46:33] >> Bob made a motion. [1:46:34] >> What Brandon what [1:46:35] >> I didn't I didn't make a motion. [1:46:38] >> Okay. [1:46:38] >> I just said I would entertain a motion. [1:46:40] >> Oh, okay. Okay. [1:46:41] >> I would entertain a motion. [1:46:42] >> Sorry, yes. Sorry about that. [1:46:44] >> Yeah, no. I I would entertain a motion. [1:46:46] >> Okay, well, I make a motion that we adopt the fiscal [1:46:50] year 2026-2027 [1:46:52] year budget uh with with the uh [1:46:56] the changes that the HVAC uh for the [1:46:58] amount of 700,000 for the city center, [1:47:01] and also that a 80,000 dollar um [1:47:05] >> motorcross track uh [1:47:08] >> study uh that those two line items have [1:47:11] attached to them that the money cannot [1:47:13] be spent until further review and [1:47:15] approval by staff and city council. [1:47:18] >> I'll second. [1:47:20] >> I have a motion Any other comment? [1:47:24] Start with council member Lacy. [1:47:28] Oh, you want me to [1:47:28] >> No, it's okay. No, it's okay. Um [1:47:33] Uh [1:47:34] I just cannot in good faith say I fully [1:47:36] approve it. So, mine is a no right now. [1:47:38] >> Okay. [1:47:38] >> That's all. [1:47:39] >> Council member Hewlett. [1:47:40] >> Yes. [1:47:40] >> Council member Rowley. [1:47:41] >> Yes. [1:47:42] >> Council member Proscard. Yes. [1:47:44] Council member Moss. [1:47:45] >> Yes. [1:47:46] >> Motion carries. [1:47:49] All right. [1:47:52] Uh [1:47:54] Cathy, our next on the budget amendment [1:47:56] fiscal year 2026 or 2025 2026 budget [1:48:01] amendments. [1:48:02] >> Okay. We have a few suggested budget [1:48:05] amendments. The first one is an [1:48:07] additional allocation [1:48:08] for transfer to the capital fund. Again, [1:48:10] we're not expending funds, we're moving [1:48:13] them from the utility fund to the [1:48:16] capital fund. Be um allocated by the [1:48:20] council at a future time. [1:48:23] Um and of course it won't move for me. [1:48:26] Darn it. [1:48:28] Let's see if I can get it to move. There [1:48:29] we go. Communities that care, they've [1:48:31] had additional projects. I don't think [1:48:33] we adequately um [1:48:35] counted on the youth council and some [1:48:37] other expenses. So, we're suggesting we [1:48:39] bring in $25,000 to [1:48:41] balance out that budget. [1:48:46] Well, it's going to be an interesting [1:48:48] night. Sorry. [1:48:50] Crum. [1:48:51] Okay. Well, [laughter] [1:48:54] I don't know where we are anymore. [1:48:56] Okay. [1:48:57] >> There you are. [1:48:57] >> Scottish Festival. They um have been [1:49:00] bringing in additional revenue. So, [1:49:02] we're suggesting that we increase their [1:49:04] revenue and their expenditure side to [1:49:06] allow them to spend revenue because they [1:49:08] just they straddled the fiscal year [1:49:10] there. [1:49:12] And then, there the next three are just [1:49:15] cushions. These departments have not [1:49:18] gone out over budget. It's just that [1:49:21] when we do budget projections, it's [1:49:23] getting so small a margin that if they [1:49:26] have an unexpected expense or something [1:49:28] else, we would like to have just a [1:49:30] cushion for them so that they do not go [1:49:32] over budget. [1:49:33] Um and I I want to point out that most [1:49:36] of the general fund expenditures are [1:49:38] being offset by the building maintenance [1:49:40] budget, so it's not coming out of fund [1:49:41] balance. It's just a shifting of [1:49:42] budgets. [1:49:45] >> I um [1:49:47] li- line item I guess we need to Oh, [1:49:49] never mind. I'm going to wait. Yep. [1:49:51] Okay. [1:49:52] I would accept a motion to open the [1:49:54] public hearing. [1:49:55] >> I [1:49:57] give Oh, I'm like now I've lost. [1:49:59] Uh [1:50:00] so moved. Someone else Sorry. [laughter] [1:50:03] >> I'll second it. [1:50:04] >> Okay. Brian Brian made the motion. Lacey [1:50:07] seconded. [1:50:09] Start with Councilmember Roll- or [1:50:10] Councilmember Moss. [1:50:12] >> Yes. [1:50:13] >> Councilmember Roley. [1:50:14] >> Yes. [1:50:14] >> Councilmember Hewlett. [1:50:15] >> Yes. [1:50:16] >> Councilmember [1:50:16] >> Yes. [1:50:17] >> Ann and Councilmember Bob, yes. [1:50:19] >> You mean Lacey. [1:50:20] >> Okay. [1:50:20] >> Lacey. [1:50:22] What did I say? [1:50:23] >> Ann. [1:50:25] I don't get to vote. [1:50:26] >> Lacey is a yes. [1:50:27] >> Okay. Public hearing is open concerning [1:50:30] the 2026-27 [1:50:33] enterprise fund transfers. [1:50:39] » It's a budget adjustment. [1:50:41] >> Oh, budget amendment. Sorry. Budget [1:50:44] amendment. [1:50:44] >> Yes. [1:50:45] >> I'm so sorry. [1:50:46] >> That's okay. [1:50:47] >> check that one off yet. [1:50:48] >> You're doing great. It's a big agenda. [1:50:50] >> add really quick that by state law we're [1:50:52] not supposed to get over expend any of [1:50:54] our budgets. So this just lets us land [1:50:57] the plane without going over budget. [1:50:59] >> Imagine that. Cities have to balance [1:51:01] their budget and others don't. [1:51:03] >> [laughter] [1:51:03] >> Okay. [1:51:05] So these [1:51:07] To me it's just in case fund that will [1:51:09] be approved [1:51:10] uh in case. [1:51:12] Um [1:51:15] Is that a good concise way of saying it? [1:51:16] >> That is. Yes. The only one that we [1:51:18] probably need to [1:51:20] that is not is the Communities That [1:51:22] Care. They have expended their budget. [1:51:24] >> Okay. [1:51:26] Any public comment? [1:51:29] >> Yes. [1:51:30] >> It's open. [1:51:30] >> I would say. [1:51:31] >> Yeah, it's open. [1:51:32] >> That's what we vote about. [1:51:33] >> Yeah. [1:51:34] >> Emily, anybody online? [1:51:36] Not seeing anyone online or no public [1:51:38] input. [1:51:39] I would accept a motion to close the [1:51:41] public hearing. [1:51:41] >> So moved. [1:51:42] >> Second. [1:51:43] >> I have a motion and a second. Council [1:51:45] member Lacey. [1:51:46] >> Yes. [1:51:46] >> Council member Brian. [1:51:47] >> Yes. [1:51:48] >> Council member Ryan. [1:51:49] >> Yes. [1:51:49] >> Council member Bob. Yes. Council member [1:51:52] Ann. [1:51:53] >> Yes. [1:51:54] >> Okay. [1:51:55] Discussion. [1:51:56] >> When do when does the city council [1:51:58] usually [1:52:00] discuss what to do with the capital [1:52:03] funds that we're allowed to Like is that [1:52:06] Do we have any meetings during the year? [1:52:08] When do we [1:52:09] Okay. [1:52:10] >> We can do it at a work session, a budget [1:52:11] meeting, anything you would like. Right [1:52:13] now we have the two major project [1:52:15] projects. We're wrapping up the downtown [1:52:17] Main Street project. We're reserving [1:52:19] funds for the fire station. [1:52:23] For that debt service and to pay half [1:52:24] the cost of the fire station. Those are [1:52:27] the projects that we have right now. [1:52:29] >> Normally as we start the budget process [1:52:30] in January, we'll propose some projects, [1:52:33] but anytime the council has something [1:52:35] they would like to use those capital [1:52:36] funds, we're happy to listen to it. [1:52:39] >> And Kathy said we can save them, like [1:52:41] build it up for something big coming up. [1:52:44] >> To to a certain amount. Such as the [1:52:46] ladder truck Lacey we talked about [1:52:50] >> a new [1:52:51] >> Putting some money away for the fire [1:52:52] truck. [1:52:53] The new ladder truck that we're going to [1:52:55] order. [1:52:56] So that we can [1:52:58] >> down the road, yeah. [1:52:59] >> Down the road. [1:53:00] >> Yeah. I mean I would love to [1:53:02] >> That's what I mean is [1:53:02] >> Yeah, I would love to even break down [1:53:04] percentages, like [1:53:07] if we're going to do a ladder truck [1:53:08] then, if we're going to do a police [1:53:09] station there, if we're going to do, you [1:53:11] know, whatever is [1:53:13] ranked of what we need the most, I think [1:53:15] that this is a great way to do it. And [1:53:17] again, it helps cuz it comes from the [1:53:19] utility funds. [1:53:21] And again then, if we spend less and we [1:53:23] get the revenue, [1:53:25] more money that we can go in there and save others from [1:53:30] spending. [1:53:31] >> And this money comes from Oh, sorry. [1:53:33] It's on. You're on. [1:53:36] This money actually comes [1:53:39] Oh, well, that is [1:53:40] >> Wasn't it a utility fund transferred to [1:53:42] the capital? [1:53:44] Or did I misunderstand? [1:53:46] >> Okay. The utility fund is uh sales tax. [1:53:49] We used to use a utility fund. It's [1:53:51] called utility fund. It's sales tax [1:53:53] that's generated off [1:53:55] uh the the power. But it is a sales tax, [1:53:59] but we're trying to close out that fund [1:54:01] and just use the general fund. [1:54:03] >> But if the general fund goes the [1:54:05] expenditures go down, then we have more [1:54:07] left over to [1:54:09] Perfect. Okay. [1:54:12] >> Any further discussion, Council? [1:54:14] >> the public hearing. [1:54:15] >> We did? Okay. Um [1:54:17] I I do I do wonder about line item [1:54:19] number two, the Communities That Care. [1:54:21] Uh you know, that that's [1:54:23] and that's about 30% of their budget. [1:54:26] What's the big need for that much of an [1:54:28] emergency fund? Do you know where the [1:54:29] extra expenditures came from, Carl? [1:54:31] Or Kathy, whoever wants to answer. [1:54:33] >> Oh, I'm I'm sorry. I'll just say that is not an emergency fund. That is [1:54:38] they actually went over budget this [1:54:40] year. And I think [1:54:42] I don't believe we budget for the youth [1:54:44] council, but we did have the youth court [1:54:47] in there. So, I think and I I mean [1:54:50] I'm not sure of all the expenditures, [1:54:52] but that's the majority of it. Is that [1:54:55] correct, Carl? [1:54:56] >> I would say the youth council addition [1:54:57] is some extra hours that shall be set to [1:54:59] work. [1:55:00] Multiply other things. [1:55:02] >> Mhm. [1:55:03] Okay. Thank you. I was just curious. [1:55:04] Yep. [1:55:11] By the way, the Scottish Festival is on [1:55:13] deck. [1:55:15] >> Yeah, I'm up soon. [1:55:16] >> Getting excited. [1:55:18] Put my kilt on. [1:55:22] Any further discussion, Council? [1:55:24] All right, then I would accept a motion [1:55:27] for [1:55:28] adoption of budget amendments fiscal [1:55:30] year 2025. [1:55:32] How come it says 2025? [1:55:34] >> It's 25 through 26. [1:55:35] >> It's the one It's the one we're [1:55:37] currently tidying up last year's budget. [1:55:38] >> Okay. [1:55:39] >> Yeah. [1:55:39] >> 2025 to 2026 budget. [1:55:42] Thank you. [1:55:44] >> I move that we approve the [1:55:47] 2025-2026 [1:55:49] fiscal year budget amendments as [1:55:50] presented. [1:55:52] >> A motion and a second. Council member [1:55:54] Moss. [1:55:55] >> Yes. [1:55:55] >> Council member Rowley. [1:55:56] >> Yes. [1:55:57] >> Council member Hulen. [1:55:58] >> Yes. [1:56:00] >> Council member Smith. [1:56:00] >> Yes. [1:56:01] >> And Council member Bob. [1:56:02] >> Yes. [1:56:04] >> How am I doing, Dave? [1:56:05] >> You're doing awesome. [1:56:06] >> I know. [1:56:07] And that is tongue-tied as they can be. [1:56:09] Moving on. [1:56:14] Item number six, public hearing or staff [1:56:17] presentation, Cathy. [1:56:18] >> Okay, fee schedule changes. We had three [1:56:22] um proposed fee schedule changes in the [1:56:24] solid waste. The first one is a startup [1:56:27] fee for garbage collections, and that is [1:56:29] because the cost of cans increased $23, [1:56:32] so that's a pass-through. [1:56:34] The cost of recycling contracts [1:56:36] increased 31 cents, so we're proposing [1:56:39] that um we increase recycling that much, [1:56:42] and people can opt out of that program. [1:56:44] That's That's not a necessary program if [1:56:46] they don't want it. And finally, there [1:56:48] was a a legislative action back in 2025 [1:56:52] that said that if there are fines on [1:56:55] unsecured loans, $5 of that has to go [1:56:58] back to the Environmental Protection [1:57:00] Agency so that they can collect the [1:57:02] litter off the highways, as I understand [1:57:04] it. So, we would propose that we raise [1:57:07] um unsecured loans to five to $10 to [1:57:10] cover that uh penalty that we have to [1:57:12] pass on. [1:57:15] » The recycling is passed on just directly [1:57:17] to the the citizens that are using [1:57:20] >> Right. [1:57:20] >> that service and [1:57:22] that is not passed on to the entire [1:57:23] city. [1:57:24] >> No. [1:57:24] >> Right. [1:57:25] >> And and people cannot talk out of that. [1:57:26] >> and we got that from Republic Services. [1:57:28] >> And am I right in saying the these fees [1:57:30] were actually incurred from Public [1:57:32] Services? These This is not Payson City [1:57:34] raising uh the recycling rates. This is [1:57:36] however the third-party uh provider, [1:57:38] which is Republic Services, raising [1:57:40] their rates and uh we didn't feel Payson [1:57:42] City should subsidize recycling for [1:57:44] everyone that's not doing it, so we're [1:57:46] just passing that down onto the actual [1:57:48] person that recycles. [1:57:50] >> Yeah, all of these are from another [1:57:52] entity. [1:57:53] >> And I was going to go after uh the the [1:57:55] unsecured load of of increasing it that [1:57:57] much, but I see it's actually a a house [1:58:00] bill, so [1:58:01] >> [laughter] [1:58:02] >> I can't. [1:58:02] >> it for you. [1:58:03] >> Yep. [1:58:04] >> All right, so I would entertain a motion [1:58:06] uh [1:58:07] for [1:58:08] >> I have one quick one quick question. [1:58:09] >> We've got to have a public hearing. [1:58:11] >> So, the unsecured loads, I thought we [1:58:14] were already higher than that if [1:58:15] somebody didn't cover their loads than [1:58:17] $10. [1:58:17] >> Well, if they don't right now the [1:58:19] penalty is $5, so we're going to add $5 [1:58:22] that we have to pass on to the the [1:58:24] Environmental Protection Agency. [1:58:27] >> Yeah. [1:58:29] I think it might have been higher than [1:58:30] that if [1:58:31] >> All right, I would entertain a motion [1:58:32] for a public hearing on the uh [1:58:34] resolution fee schedule update. [1:58:37] >> So motion. [1:58:38] >> I have a motion. [1:58:39] >> Second. [1:58:39] >> Seconded Councilmember Moss. [1:58:42] Uh start with [1:58:43] Councilmember Smith. [1:58:44] >> Yes. [1:58:45] >> Councilmember Hill. [1:58:45] >> Yes. [1:58:46] >> Councilmember Rowley. [1:58:47] >> Yes. [1:58:47] >> Councilmember Probstgaard. [1:58:49] >> Yes. [1:58:49] >> Councilmember Moss. [1:58:50] >> Yes. [1:58:51] >> The public hearing is open concerning [1:58:54] the [1:58:56] fee up schedule update. [1:59:02] Yes, Ross. [1:59:04] >> You guys are going faster than my minute [1:59:06] sure mine. [1:59:07] >> [laughter] [1:59:08] >> I have a whole five questions. [1:59:10] When they first started this recycling [1:59:14] I was under [1:59:16] the impression that [1:59:17] they was dumping the recycling stuff in our landfill. [1:59:22] Is that still the case or is it actually [1:59:25] getting recycled? I pay what? [1:59:28] Seven, eight bucks a month. [1:59:29] >> Yes. [1:59:29] >> Now [1:59:30] recycling [1:59:31] >> I can [1:59:32] Yeah, Kathy. [1:59:33] >> I I used [1:59:35] >> There's some spoils [1:59:36] >> Yeah. [1:59:37] >> that are within the recycling that that [1:59:39] aren't accepted. That ends up uh they [1:59:42] separate it. [1:59:44] And some of it does end up in a [1:59:46] landfill. [1:59:47] I won't specifically say it comes in [1:59:49] ours. Uh [1:59:50] there's also the landfill out out to the [1:59:52] west [1:59:53] of us. Um but yeah, there are some [1:59:56] spoils that citizens put [1:59:58] the wrong garbage in. [2:00:00] Uh [2:00:00] And so it's separated, but if you've [2:00:03] been over there, they recycle a lot of [2:00:05] stuff [2:00:06] that that come through. So yes, that's a [2:00:08] good good question. [2:00:10] Dave [2:00:10] >> Yeah, just to answer that, we we over [2:00:12] periodically we get complaints about [2:00:14] that. [2:00:14] >> [clears throat] [2:00:15] >> And I know [2:00:16] we had [2:00:17] um [2:00:19] Republic does our recycling, but they do [2:00:22] garbage for other communities that go to [2:00:23] the landfill. So they saw that color [2:00:25] truck and say, you know, they're just [2:00:26] dumping it the landfill, they're not [2:00:28] recycling it, but that was a different [2:00:30] truck and we followed that. We've had [2:00:32] them track it so that we can [2:00:34] answer those questions or the those [2:00:36] complaints that come, but pretty we're [2:00:37] confident that it it does recycle, but [2:00:40] you're right, some of it does become [2:00:42] spoiled. [2:00:43] I don't think it comes back to our [2:00:44] landfill because they take it to a [2:00:46] different facility. And if it's spoiled [2:00:48] they take it to the closest landfill. [2:00:49] >> Yeah. [2:00:51] So I'm Yeah, I don't think much of it's [2:00:53] coming to our landfill, but if it did [2:00:55] we'd charge them for it. [2:00:57] >> Mhm. [2:00:58] >> So. [clears throat] [2:00:59] Yeah. [2:01:00] All right. [2:01:02] We still in the public [2:01:04] >> Oh, yeah, we need to close it. [2:01:06] I move that we close the public hearing [2:01:08] on the fee schedule update. [2:01:09] >> I have a motion. [2:01:10] >> Second. [2:01:10] by Council member Rowley. [2:01:12] Council member Smith. [2:01:13] >> Yes. [2:01:14] >> Council member Hewlett. [2:01:15] >> Yes. [2:01:16] >> Council member Rowley. [2:01:17] >> Yes. [2:01:17] >> Council member Proscard. Yes. Council [2:01:19] member Moss. [2:01:20] >> Yes. [2:01:21] >> Public hearing is closed. Any further [2:01:23] discussion Council? [2:01:24] >> No. [2:01:25] >> Then I would entertain a motion. [2:01:28] >> I move that we approve the fee schedule [2:01:30] update as presented. [2:01:32] >> I second. [2:01:33] >> Motion and a second. Any further [2:01:35] discussion? [2:01:36] Council member Moss. [2:01:38] Council member Proscard. Yes. Council [2:01:40] member Rowley. [2:01:41] >> Yes. [2:01:42] >> Council member Hewlett. [2:01:43] >> Yes. [2:01:44] >> And Council member Smith. [2:01:45] >> Yes. [2:01:45] >> Motion carries. [2:01:47] Item number seven. [2:01:50] Melanie, [2:01:51] you're up. [2:01:55] Resolution of employer pick up of public [2:01:57] safety and firefighter employee [2:02:00] retirement contributions with Utah State [2:02:02] Retirement. [2:02:03] >> Yes, thank you. Um this is basically [2:02:06] just a administrative action. Um we just [2:02:09] approved in the budget this pick up was [2:02:11] included in the budget and so this [2:02:14] resolution um Utah Retirement Assistant [2:02:16] just requires us to send a copy of the [2:02:19] resolution and the signed form by the [2:02:21] city authorizing the city to be able to [2:02:23] continue to pick up and this is um for [2:02:25] public safety and um as indicated we've [2:02:27] been doing this since 2020. Um and it's [2:02:31] I think it's a viable um [2:02:34] program for our officers um and it [2:02:36] really does help with um retention and [2:02:38] recruitment um especially [2:02:41] these um officers that are on the tier [2:02:42] two plans, so. [2:02:45] Are there any other questions? [2:02:46] >> No. [2:02:49] » I agree with you. It's very important [2:02:50] for our fire and police. [2:02:53] >> Yeah. [2:02:53] >> This was something that I agreed with [2:02:55] for sure, so. [2:02:57] >> Then I would entertain a motion. [2:02:59] >> I make a motion that we approve the [2:03:00] employer pick up of the public safety [2:03:02] and firefighter employee retirement [2:03:04] contributions with the Utah State [2:03:06] Retirement System. [2:03:07] >> I'll second. [2:03:08] >> Motion and a second. Council member [2:03:09] Smith? [2:03:10] >> Yes. [2:03:11] >> Council member Hughley? [2:03:12] >> Yes. [2:03:12] >> Council member Rowley? [2:03:13] >> Yes. [2:03:14] >> Council member Probst Guard? Yes. [2:03:16] Council member Moss? [2:03:17] >> Yes. [2:03:18] >> Motion carries. [2:03:20] Hey, now we can go on to some fun stuff. [2:03:23] Item number eight. [2:03:24] Resolution [2:03:25] >> already? [2:03:26] >> Yeah. [2:03:27] Authorizing the city to enter into a [2:03:29] real estate purchase contract for the [2:03:31] acquisition of property located at [2:03:34] approximately 1350 North Arrowhead [2:03:36] Trail. [2:03:37] Brandon? [2:03:38] >> Yes. Thank you, Mayor Pro Tem and [2:03:40] Council. [2:03:42] This resolution is asking the Council to [2:03:44] authorize the Mayor to sign a real [2:03:45] estate purchase agreement contract for [2:03:48] property that's located at address for [2:03:52] potential installation of a future power [2:03:54] substation. [2:03:56] The way the real estate purchase [2:03:57] contract is written is there has to be [2:03:59] some contingencies that are fulfilled [2:04:01] first. [2:04:02] One of the biggest ones is that [2:04:05] the seller [2:04:07] obtain the land and be annexed into the [2:04:09] city. [2:04:11] That purchaser has a [2:04:13] uh [2:04:14] an application in right now. [2:04:16] We've been going back and forth quite a [2:04:18] while on there. Um and believe it's [2:04:21] going to come up on Planning Commission [2:04:24] real soon. However, they have not [2:04:27] adhered to many of the comments [2:04:29] from staff, so I believe it's going to [2:04:31] go to [2:04:33] Planning Commission with a negative [2:04:34] recommendation. And so I don't know [2:04:38] that contingency will be fulfilled, but [2:04:40] we wanted to negotiate in good faith [2:04:42] that um [2:04:44] we are we we want we are interested in [2:04:46] purchasing that land. [2:04:48] Um but there's a contingency that's [2:04:52] partly in their control. [2:04:53] >> Isn't there a contingency on another one [2:04:56] being annexed also? [2:04:59] The [2:05:01] >> So, the overall [2:05:02] um [2:05:03] the overall [2:05:05] >> project [2:05:06] >> wants to be annexed is what the the [2:05:08] >> So, the so the Minneola Creek is this [2:05:12] and then there's there's another one, [2:05:13] right? [2:05:14] >> piece of property is actually in the [2:05:16] city already. [2:05:17] >> Yeah, okay. [2:05:17] >> There's a contingency that another [2:05:19] >> That's what I'm saying. Like it's [2:05:21] separate. [2:05:22] >> the contingent [2:05:23] >> So, yeah. Um [2:05:24] >> on us annexing them into the city. [2:05:26] >> that's [2:05:27] >> Did they did they draft up the purchase [2:05:29] contract and the addendum or did we? [2:05:31] >> We both did. Uh we both contributed to [2:05:34] it. [2:05:35] >> So, there's the that off-ramp and then [2:05:37] there's a off-ramp for if it doesn't [2:05:40] um if it doesn't settle by August 22nd, [2:05:44] I believe was the date, then it expires [2:05:46] as well. [2:05:47] >> I think another concern was the [2:05:49] >> Oh, yeah. And if there's a there's a [2:05:50] study if there's wetlands and it's not [2:05:52] usable, we're not interested. [2:05:54] >> So, my concern was [2:05:56] um I had I don't know if Dave and Robert [2:05:58] you got my email on Friday, but I'd sent [2:06:01] an email asking if we had any idea of [2:06:03] what that study was going to cost. And [2:06:06] then I would questioned if the [2:06:08] annexation was different land. [2:06:11] Um [2:06:13] but my other question is [2:06:14] and maybe this is super normal for [2:06:17] cities because [2:06:19] I get we're not going out for a loan. [2:06:21] Is it normal that it wasn't contingent [2:06:23] for the land to appraise for the [2:06:25] purchase price? [2:06:28] I believe it was not contingent on [2:06:30] appraisal. [2:06:32] >> Checked. Uh and the other question, [2:06:33] Brandon, are we okay to discuss this or [2:06:35] we need to do have a closed session [2:06:37] after meeting discuss the details of the [2:06:39] web C? [2:06:41] >> Um I [2:06:43] >> It has to be approved in the public [2:06:44] meeting. [2:06:44] >> Yeah. [2:06:45] >> Okay. [2:06:46] So, I just didn't know if that was [2:06:48] normal cuz I know it was [2:06:50] contingent on due diligence. [2:06:52] And it was [2:06:54] it didn't the funding, but then um I'm [2:06:58] 90% sure it said it was not contingent [2:07:01] on it appraising. [2:07:02] >> Right. Yep, light them up. 8.2 is not [2:07:05] contingent. [2:07:06] >> my thing is I would never want to buy [2:07:09] something that the value's not there, [2:07:12] but that's just So, I didn't know if [2:07:14] that was normal for cities. [2:07:16] >> I I'm putting a lot of trust in Shawn. [2:07:18] He's one negotiating land deals. [2:07:20] >> Shawn's just [2:07:22] >> over there bouncing off the wall. [2:07:23] >> Constantly knowing what they're [2:07:25] going for. [2:07:26] >> we're putting together the contract. So, [2:07:28] that's I I guess like also this. [2:07:31] >> yeah, we both are. [2:07:31] >> Okay. I [2:07:33] >> So, the way I look at that is if we're comfortable with the purchase [2:07:37] price, it doesn't really matter what the [2:07:38] appraisal is if we're comfortable with [2:07:40] the purchase price. [2:07:41] >> That's the important [2:07:42] >> Well, and and what we're using with the [2:07:43] property would detrimentally devalue an [2:07:47] appraisal because it's going to be for a [2:07:49] substation. [2:07:50] >> Yep. [2:07:50] >> So. [2:07:51] >> Well, I feel like the land also if it [2:07:53] comes back like [2:07:55] unusable for the developer would also [2:07:57] then for the landowner Yes. So, I guess [2:08:00] that would be my [2:08:00] >> And and it does sound like the the [2:08:02] wetlands is is part of one of our [2:08:03] off-ramps, right? [2:08:05] >> Do we know how much that study is [2:08:06] though? I'm just curious. [2:08:09] >> Are we doing it? [2:08:10] >> They're the ones that are doing [2:08:11] >> Oh, I thought it said that the buyer [2:08:14] >> Or maybe we we would do it. [2:08:16] >> Yeah. We do that. [2:08:18] >> Minimal. [2:08:19] >> That's minimal because it's through the [2:08:21] Corps of Engineers. [2:08:22] >> Okay. [2:08:23] >> That would [2:08:23] >> But that's just stuff that like for me, [2:08:26] I [2:08:27] >> Good question. [2:08:28] >> I would like to know cuz when you get to [2:08:30] environmental stuff [2:08:31] >> Yeah, I just went and looked for it. I'm sorry [2:08:34] I didn't respond. [2:08:34] >> you guys were off. I get it, but [2:08:37] >> [laughter] [2:08:37] >> it's okay. That's why I'm asking now, [2:08:39] but [2:08:40] um [2:08:42] I personally don't feel okay with the [2:08:44] annexation clause. Um [2:08:46] but that's I think that they should be [2:08:48] able they should have to [2:08:49] go through what everyone else goes [2:08:51] through, so. [2:08:52] >> Totally agree. [2:08:53] >> They will. [2:08:58] » If we say no, then they're going to like [2:09:00] well, we don't [2:09:02] Yeah. [2:09:02] >> Yeah, that's protecting us cuz Because [2:09:04] they have to. [2:09:05] Uh we don't want to buy it if they [2:09:07] aren't they can't get it to us and [2:09:09] they're annexed. [2:09:11] >> No, this is separate land. [2:09:13] >> Right, but still if they aren't if they [2:09:14] don't annex that other property, they [2:09:16] >> Yeah, but they're still under contract [2:09:18] for this land, right? They don't [2:09:19] technically own this land. It's under [2:09:21] contract. [2:09:22] It's a They're writing a contract for [2:09:24] land that they are under contract on. [2:09:26] >> That's correct. [2:09:27] >> So, if they [2:09:29] That's what I'm saying. Like they don't [2:09:30] even know if they're going to buy it [2:09:31] yet. It's there's [2:09:32] >> There again, I think the good word is [2:09:34] we're doing this in good faith. [2:09:36] >> Okay. Well, [2:09:38] >> what transpires? [2:09:39] >> I've vo- I've vocalized mine. [2:09:41] >> And that's why Personally, I think it's [2:09:42] DOA. [2:09:43] >> That that's Yeah, the [2:09:44] >> But we're doing our due diligence in [2:09:46] >> council meeting in May when I was saying [2:09:48] I'm not optimistic about it happening. [2:09:49] >> not optimistic about it happening. [2:09:51] >> Right. [2:09:54] » Yeah, and and you know, this this this [2:09:56] deal is a little bit unique. I did I [2:09:58] talked to Shawn about this one [2:10:00] in depth. And yeah, yeah, this it's [2:10:03] unique. We want to get our foot in the [2:10:04] door, show our interest, but I do see [2:10:06] too. I think [2:10:08] we need we need to be real careful about [2:10:10] what what contingencies we place on the [2:10:11] addendums. I don't want there to ever be [2:10:13] any quid pro quo of saying we will do [2:10:15] this if you will do this, especially [2:10:17] regarding annexation. And so I I just [2:10:20] think that could be dangerous dangerous [2:10:22] language for both parties. We don't want [2:10:24] to string each other along and and say [2:10:26] we'll do this if you do that. So, that's [2:10:28] just something I think we should watch [2:10:29] in the future. [2:10:30] >> And I'm supportive of us getting a new [2:10:32] substation. I am. [2:10:34] I just I don't [2:10:36] not going to sell my soul to the [2:10:40] Yeah. [2:10:41] >> Yep. [2:10:42] I I I think I think we're just trying [2:10:45] we're we're if if we meet with the staff [2:10:48] with the applicant and they meet some of the things we feel [2:10:53] like, you know, part of that is putting [2:10:55] a sewer plant to get some of our [2:10:57] or a lift [2:10:58] Yeah, lift station so that we get [2:11:00] some of our customers back from Salem. [2:11:03] That's a good thing. I think that's what [2:11:04] the council wants. [2:11:05] But [2:11:07] we're we're trying to make it work. If it works, then [2:11:10] we'll need that substation sooner than [2:11:12] later. If it doesn't work, [2:11:14] then there's an off-ramp for us to not [2:11:16] need to purchase it [2:11:18] or them to sell it to us. And they like Lacy said, they're under contract. [2:11:22] And if if if they don't get annexed, [2:11:24] then they probably won't purchase that [2:11:26] property. [2:11:27] And then we still need to look for some [2:11:29] property out there [2:11:30] eventually for a for a substation, but the [2:11:35] it it it's not as critical time-wise. [2:11:38] But we're we're doing what we can to [2:11:41] bring something to the council that [2:11:43] could work for our community and and [2:11:45] help with a lift station in that whole [2:11:47] area out there. So, I mean, we're [2:11:49] hopeful that things can happen, but [2:11:51] those contingencies that are something [2:11:53] they wanted in there and frankly, we [2:11:55] wanted in there. And if it doesn't get annexed, then [2:12:00] we may not need to buy that property. [2:12:01] That's right. [2:12:02] >> I guess go [2:12:04] >> Going along with what Ryan said, just so [2:12:05] everybody knows that we aren't going to [2:12:07] approve their annexation so we can get [2:12:09] this property. [2:12:11] >> That's the bottom line is we're not [2:12:12] going to be held over over a barrel. [2:12:15] >> I just me to me the wording made it seem [2:12:18] like [2:12:21] and maybe maybe I don't understand the [2:12:23] wording I guess, but to me the wording [2:12:25] 100% made it seem like [2:12:28] it's contingent [2:12:30] on [2:12:31] >> us approving [2:12:32] >> on us approving that. So in a sense, [2:12:34] that is saying you want this land, well [2:12:36] I've got something that I want too and [2:12:39] that's all it's just [2:12:40] >> I should have explained that better. [2:12:41] Yeah, because that Minne Creek [2:12:43] annexation [2:12:45] I'm not optimistic about it. [2:12:47] >> I just [2:12:48] >> happening and so I saw it as an [2:12:50] guaranteed off ramp for the city not to [2:12:52] have to [2:12:54] purchase it if it if it doesn't go through and it [2:12:58] looks like it's not. [2:12:58] >> If they want to take that out. [2:13:00] >> I would just also caution to say that's [2:13:02] a separate application that will be [2:13:04] reviewed according to the [2:13:06] >> I don't even know what you're talking [2:13:07] about. [2:13:08] Thank you. [2:13:08] >> I wouldn't comment about whether or not [2:13:10] it's going to happen. [2:13:11] >> on that. Yep. [2:13:12] >> No. [2:13:13] >> Okay. Any further discussion? I guess if [2:13:15] you wanted to add if we wanted to add [2:13:17] something to that and go back and give a [2:13:19] addendum to this as saying that this has [2:13:21] nothing to do with the annexation and [2:13:24] approval from the city or something like [2:13:26] that. [2:13:27] >> Here's another thing. [2:13:28] >> We can do that. [2:13:29] >> What about [2:13:31] I think in the budget we have up to [2:13:32] $300,000 [2:13:35] for land. [2:13:36] Is that accurate Sean? [2:13:40] I think so. [2:13:41] I mean again like there's always the [2:13:44] thing of [2:13:46] instead of that, if it's really the only [2:13:48] land out there [2:13:51] I mean I'd be more [2:13:53] if that ever happened like that's just [2:13:54] another idea if that had to happen I [2:13:56] guess or [2:13:57] if there's other land, but you're the [2:13:59] one that's shopping. [2:14:00] Not me. [2:14:03] Okay. [2:14:08] » All right council, any further [2:14:09] discussion? [2:14:11] Then I would entertain a motion. [2:14:12] >> I make a motion that we authorize the [2:14:14] city to enter into a real estate [2:14:15] purchase contract for the acquisition of [2:14:17] the property located at approximately [2:14:19] 1350 North Arrowhead Trail, Payson, [2:14:22] Utah. [2:14:23] >> I'll second. [2:14:25] >> I got a motion and a second. Council [2:14:27] member Moss. [2:14:28] >> Yes. [2:14:28] >> Council member Probst guard. Yes. [2:14:31] Council member Rowley. [2:14:32] >> Yes. [2:14:33] >> Council member Hewlett. [2:14:34] >> Yes. [2:14:34] >> Council member Smith. [2:14:36] >> No. [2:14:38] >> Okay, motion carries. Item number nine. [2:14:41] Resolution approving an agreement for [2:14:43] the purchase uh and and sell of power [2:14:47] between Payson City and the Strawberry [2:14:49] Water Users Association and authorizing [2:14:52] the mayor to execute the agreement. [2:14:55] Brandon or Shawn or whoever. [2:14:58] >> We're tag teaming. [2:14:59] >> Okay, tag team us. [2:15:00] >> Here's the expert right here, but Mayor [2:15:02] Council, we um [2:15:05] Strawberry Water Users Association um [2:15:09] owns or through the federal government, [2:15:11] they have the hydro generating plant in [2:15:13] Spanish Fork Canyon [2:15:15] and the one in Payson Canyon. [2:15:17] And they've been under contract uh [2:15:21] with another entity to purchase all that [2:15:23] uh [2:15:25] that power that comes from there. [2:15:27] Uh that contract ends July 1st. We've [2:15:29] been working with them for quite some [2:15:31] time. They They put out [2:15:34] um [2:15:35] bids or or letters of interest and and [2:15:38] we we are interested. [2:15:40] Uh it's another [2:15:42] type of power for our portfolio. Uh you know Shawn by now. We We've come to [2:15:47] you with solar and wind and [2:15:50] different things like that, but this is [2:15:51] part of our our portfolio. [2:15:54] And uh [2:15:56] through the due diligence process with [2:15:57] Strawberry, they they wanted to work [2:16:00] with us. [2:16:01] Uh we prepared this contract. It's been [2:16:03] through a [2:16:04] through Brandon and their attorney and a [2:16:06] lot of iterations, there was we wanted a [2:16:08] 10-year [2:16:10] um [2:16:11] contract [2:16:13] and uh there was a little hitch there [2:16:15] because Strawberry's in the middle of negotiating with Central Utah Water [2:16:20] to become a Bonneville unit [2:16:22] and there was some [2:16:23] there's some uncertainty that if they become a Bonneville unit in year [2:16:27] two, [2:16:29] you know, what would that do to the [2:16:30] contract? And you know, we talked to [2:16:32] Central Utah, they they want to give us [2:16:35] whatever [2:16:36] good [2:16:37] fuzzy feeling that they can give us that [2:16:39] they would keep working with us, but so [2:16:41] we we dropped it to a 5-year [2:16:43] we we we cut down the price we were [2:16:45] willing to pay for it because it's five [2:16:46] instead of 10. [2:16:48] And but hopefully we can continue to [2:16:49] work with that and uh [2:16:52] and I can turn it over to Shawn for more [2:16:53] of the details if you have questions, [2:16:54] but that that's kind of what we're [2:16:57] asking the the council to approve is is [2:16:59] this contract for 5 years to to purchase [2:17:02] that power, the hydropower from [2:17:04] Strawberry Water Users. [2:17:07] >> Shawn, anything you want to add? [2:17:09] >> Um not not too much. Uh [2:17:14] the Strawberry water power has been used [2:17:17] a long time by themselves and then [2:17:20] with um another um entity that as they [2:17:24] broke away, they always kind of stayed [2:17:25] together and so they put it out to bid [2:17:28] like they was saying. I think there was [2:17:29] a lot of bidders [2:17:31] and we got it. I did some research. Um [2:17:34] the transmission is is treated [2:17:36] differently because it's within the [2:17:38] SUVPS system [2:17:40] and so I was able to bid a little higher [2:17:43] than someone that was from outside of [2:17:46] that system because you'd have to pay [2:17:48] about $11 more per megawatt hour. [2:17:50] And so that that helped us um [2:17:54] attain it. It's a uh a little bit this [2:17:56] year's kind of bad, but it looks like [2:17:58] it'll be about 8% of our power under [2:18:00] good years [2:18:01] um overall and it would come mostly in [2:18:03] the spring and early summer into the [2:18:07] summer. [2:18:08] Um [2:18:09] And [2:18:11] I like it. It's just another [2:18:12] diversification tool. It's just [2:18:14] something else that fits in our [2:18:15] portfolio. And anytime that we can buy [2:18:19] something renewable that comes under our [2:18:22] wholesale price, [2:18:23] I just want to pull the trigger because [2:18:26] we don't know what the political climate [2:18:28] will be like in a few years. So, we did [2:18:30] a lot of this where I used to work. Um [2:18:34] Uh you know, when you'd get these 8-year [2:18:36] stints of certain presidents, and then [2:18:38] all of a sudden all the rules would [2:18:39] change. And so, we divested of coal [2:18:42] where I used to work pretty early, [2:18:44] like 2010, where a lot of people tried [2:18:46] to hold on and, you know, switch to [2:18:47] natural gas mostly. So, it became like [2:18:50] the bridge [2:18:51] to prop possibly nuclear in the future, [2:18:53] but um [2:18:55] it you usually there's energy credits [2:18:57] that trade. There is energy I mean, each [2:19:00] kind of um energy has its own value, and [2:19:04] you can trade and sell those credits as [2:19:06] well. So, um just looked attractive to [2:19:08] me. Um I've always I really like hydro. [2:19:11] We had four of them in the last town I [2:19:13] worked in. And And the crisp is falling [2:19:16] off bad as well, which is the Colorado [2:19:18] River Storage Project. You all hear [2:19:20] about Lake Powell and Flaming Gorge and [2:19:22] all that. That's been a bummer cuz a lot [2:19:24] of the cities along the Wasatch Front [2:19:26] get big portions of that power. So, it's [2:19:29] very much hurt um our local towns around [2:19:33] here that had allocations. So, anytime [2:19:35] though we can get hydro, um all in. [2:19:39] It's fuel-free, inflation-free. [2:19:43] >> So, Sean, do we get all the power that [2:19:45] comes from there? [2:19:46] We don't split it with anybody else. We [2:19:48] We'll We'll get all the power, right? [2:19:49] >> From Strawberry? Yeah, currently, but as [2:19:51] Dave pointed out, um [2:19:53] if the Bureau takes it over, it could [2:19:56] get allocated through WAPA and it [2:19:59] changes everything Western Area Power [2:20:00] Authority and it might have to get [2:20:02] shared after that point, but might take [2:20:04] a long time to the paperwork and stuff, [2:20:06] so we're not sure. But, we didn't know [2:20:08] how to gauge it cuz what they may do [2:20:10] might only be 2 years, so we just went [2:20:12] with 5 years. We would like to have done [2:20:14] 10. [2:20:15] Um, lock it up as long as we can, but [2:20:17] all the rules could change on us in a [2:20:18] few years. [2:20:20] And so, [2:20:21] >> Sean, do we have any other hydro in our [2:20:22] portfolio as of now? [2:20:24] >> Uh, Colorado River storage project a [2:20:25] little bit. [2:20:26] >> Okay. [2:20:26] >> Like about like 2.5. [2:20:28] >> Yeah, it's about megawatt right now. Um, [2:20:31] and it's usually bigger. It's probably [2:20:33] about a third of what it's traditionally [2:20:35] been and it might shut off [2:20:37] some point, so. [2:20:38] >> Need more snow. [2:20:40] >> In the water. [2:20:41] >> Yeah. Yeah. [2:20:42] >> [laughter] [2:20:44] >> Any other questions, Council? [2:20:46] I'd entertain a motion. [2:20:48] >> I'll make the motion that we approve the [2:20:50] um, purchase uh, for the sale of power [2:20:53] between Payson City and Strawberry Water [2:20:55] User Association authorizing the mayor [2:20:57] to execute the agreement. [2:20:59] >> Second. [2:21:00] >> I have a motion and a second. [2:21:02] Council member Smith. [2:21:04] >> Yes. [2:21:05] Council member Youatt. [2:21:07] >> Yes. [2:21:07] >> Council member Rolley. [2:21:08] >> Yes. [2:21:09] >> Council member Probst Guard, yes. [2:21:11] Council member Moss. [2:21:12] >> Yes. [2:21:13] >> Motion passes. [2:21:14] >> Thank you. [2:21:17] >> [snorts] [2:21:18] >> Item number 10, amendment to Payson City [2:21:20] Code section 4.08.180, [2:21:24] cross connection control and black [2:21:27] backflow prevention. [2:21:29] Brandon and Travis. [2:21:31] >> Yeah, I'll take this one. [2:21:32] >> Okay. [2:21:32] >> So, um, a couple of our employees just [2:21:35] went to a some state training on [2:21:37] backflow prevention and cross [2:21:38] connections, so they had the state [2:21:41] review our ordinance and the state [2:21:42] recommended the wording change that you [2:21:44] see in the packet, so that's that's what [2:21:46] it kind of pushed this forward to hurry [2:21:49] and do it so so we could just be in [2:21:50] compliance with what [2:21:52] the state's doing and what we have to do [2:21:54] with it cuz this is basically if anyone [2:21:56] wants to connect, you know, like they're [2:21:58] trying to water outside with a, you [2:22:00] know, [2:22:01] culinary water. So, like we have up [2:22:02] above the canal in Patterson and stuff [2:22:05] like that. [2:22:06] We have to do yearly inspections and [2:22:08] that kind of stuff. So, that's just kind [2:22:09] of a little Somebody might live up there [2:22:11] that we know, But, yeah, that's what this is about. [2:22:14] So, it was just get to tighten up our [2:22:16] ordinance better with what the state [2:22:17] wanted. So, [2:22:22] » Pretty straightforward. Uh any any [2:22:25] further discussion, Council? [2:22:26] >> I make a motion that we approve [2:22:29] the amendment to the Payson City Code [2:22:30] section 4.08.180 [2:22:33] cross connection control and backflow [2:22:35] prevention. [2:22:36] >> I will second. [2:22:38] >> I have a motion and a second. Council [2:22:39] member Moss. [2:22:40] >> Yes. [2:22:41] >> Council member Probst guard. Yes. [2:22:42] Council member Rowley. [2:22:44] >> Yes. [2:22:45] >> Council member Schuler. [2:22:46] >> Yes. [2:22:46] >> Council member Smith. [2:22:47] >> Yes. [2:22:49] >> Motion carries. [2:22:52] Item number 11. [2:22:54] Ordinance adopting the IO Infill Overlay [2:22:56] Zone designation for property located at [2:22:59] 353 North [2:23:01] 300 East Utah County parcel [2:23:05] 08-048-0029. [2:23:08] Michael. [2:23:12] » So, I don't have a presentation, just a [2:23:13] couple of images to show you at that [2:23:15] proximity, the area, the neighborhood. [2:23:17] So, I'll just pull that up really quick. [2:23:27] So, [2:23:28] where the little red dot there is, [2:23:30] that's where the home is. The proposal [2:23:32] is to subdivide the home, so it's of the [2:23:36] same lot sizes as you can see [2:23:38] nearby, very similar. Um this was done [2:23:42] many years ago and it was approved, but [2:23:45] then it never got recorded, never went [2:23:48] forward. And so the property owner wants [2:23:50] to come back and and do such. So, that's [2:23:54] um the neighborhood um and then [2:23:57] the lots would just look [2:24:00] um very similar again to adjacent lots. [2:24:03] Uh and so the overlay is needed because [2:24:06] these lots are just slightly smaller [2:24:07] than the minimum lot size for that zone. [2:24:10] And that's that's what's being asked for [2:24:12] today is the the lots are just a little [2:24:14] over 7,000 square feet and the frontage [2:24:16] is just a little under the I think it's [2:24:19] like 60 something. I can't see it on [2:24:22] there, but um [2:24:24] 59 [2:24:27] » 5943 [2:24:29] >> No, it's it's more. Yeah, so you 7050 [2:24:32] 7052 Yeah, it's got a point of beginning [2:24:34] right there that adds another [2:24:36] So, the yeah, it's about 5 ft under the [2:24:39] minimum frontage, very similar to like I [2:24:42] said to other homes in the neighborhood [2:24:44] there. So, that's that's the request. [2:24:46] Um it went to planning commission about [2:24:49] 3 or 4 weeks ago and they had a positive [2:24:51] recommendation for approval on this. [2:24:53] >> And lot one is where the existing home [2:24:55] is, correct? [2:24:55] >> Correct. [2:24:57] >> Michael, I had a question. If you go [2:24:59] back to the [2:25:00] If when I drove by there, it looks like [2:25:02] the building is right on property line. [2:25:05] Where you would divide the property [2:25:07] line. [2:25:07] >> That shed structure, is that kind of [2:25:09] what you're pointing at? [2:25:10] >> That would make it non-conforming. [2:25:12] >> Yeah, it looks [2:25:13] >> Whoops, is the setbacks wouldn't be [2:25:15] correct. [2:25:15] >> Correct. [2:25:20] » Mhm. [2:25:21] Well, but it's it's attached. [2:25:25] >> Well, [2:25:26] I can't say it's attached to the home. [2:25:28] >> No, it's not. And [2:25:33] No, I don't know if we have the size of [2:25:34] that [2:25:36] building. [2:25:40] » I I think if we were to make a motion [2:25:42] that we would just make a motion that it [2:25:43] met [2:25:44] the setback requirements of dividing [2:25:47] that line. [2:25:49] What would make me comfortable. [2:25:52] >> And you could make a modified motion for [2:25:54] that if you wanted to. Allowing for [2:25:56] less setback or requiring that they have [2:25:58] the proper [2:25:59] >> meet that setback. [2:26:00] >> So they may have to move that uh [2:26:03] that shed too potentially or moving the [2:26:05] shed either way, moving the boundary of [2:26:07] lot two or [2:26:09] all that. So [2:26:11] one remedy could be just [2:26:14] adjusting the property line to allow for [2:26:16] >> saying adjust the property line cuz you [2:26:18] can't go any smaller than 7,000 ft. [2:26:21] >> Well, you can. [2:26:22] >> We could. [2:26:22] >> The overlay allows you [2:26:23] >> we can. [2:26:24] >> Yeah. I just I just don't know if it's necessary for us to make him [2:26:27] tear down that shed if if it's [2:26:30] >> I just don't want to make it [2:26:31] non-conforming. [2:26:32] >> Just move the property [2:26:33] >> This is already going to this is an [2:26:34] overlay so it's going to change. It's [2:26:35] going to be non-conforming. [2:26:37] >> Well, and you can see there it says 5-ft [2:26:39] PUE ends at the existing garage. So [2:26:42] there would be that 5 ft behind it. [2:26:46] Would be would be that property line. [2:26:48] >> No, it's not. Then the 5-ft setbacks [2:26:50] exists. Okay. [2:26:52] >> Yep. [2:26:52] >> Any further discussion? [2:26:53] >> Yeah, I have one question for you. How [2:26:55] long does the overlay zones last if if [2:26:58] we approve them, if they don't record [2:27:00] them, do they last 1 year, 2 years, 3 [2:27:02] years? [2:27:02] >> the biggest problem with this is the the [2:27:04] plat never recorded. [2:27:05] >> Right, but how long [2:27:07] >> it's 1 year. [2:27:08] >> 1 year, okay. [2:27:09] >> Yeah. [2:27:10] >> And they're going to record it this [2:27:11] time, we hope. [2:27:12] >> That's the plan. [2:27:13] >> Okay. [2:27:15] >> I make a motion that [2:27:17] we approve adopting the inlay the infill [2:27:20] overlay zoning designation for the [2:27:22] property located at 353 North 300 East, [2:27:26] Utah County parcel 08 0480029. [2:27:33] » I second. [2:27:34] >> Motion and a second. Council member [2:27:35] Moss. [2:27:36] >> Yes. [2:27:37] >> Council member Probstgaard? Yes. [2:27:39] Council member Rowley? [2:27:40] >> Yes. [2:27:41] >> Council member Hewlett? [2:27:42] >> Yes. [2:27:43] >> Council member [2:27:44] >> Yes. [2:27:47] » All right. [2:27:49] Item number 12. [2:27:50] >> It looks like your microphone's not on. [2:27:52] So. [2:27:53] >> Sorry. [2:27:55] >> Motion carried. Items number 12, 13, and [2:27:58] 14. [2:27:59] Can you give us a presentation on all [2:28:01] three? [2:28:01] >> Yes, I'll give you a brief presentation [2:28:03] on all three, but they are separate [2:28:05] agenda items, so [2:28:06] >> We'll make a motion on each one. [2:28:08] >> Make them separately, yes. [2:28:09] >> Yep. [2:28:29] » Oh, it looks like it's at the very end. [2:28:30] Okay. So, there's three the three agenda [2:28:33] items there, the Haskell, the [2:28:35] Braithwaite, the Ludine, Mark, and [2:28:36] Marjorie Haskell annexation requests. [2:28:41] So, we'll just go through them in order [2:28:42] as they're on the agenda there. [2:28:44] Um the first one, you can see it zooming [2:28:47] in here. This is [2:28:48] um the Haskell addition. [2:28:51] Those are the two parcels, and then [2:28:53] there's a remnant parcel at the top of [2:28:55] that's road that would be part of this. [2:29:01] Um [2:29:02] so, to give you a little bit of [2:29:03] orientation, I put on there 1200 East [2:29:06] and Salem Canal Road. Uh this is the [2:29:08] concept layout that the applicant shared [2:29:10] with us on the left-hand side there. [2:29:13] Um staff have some concerns with this [2:29:16] concept layout, and I I just put a few [2:29:18] bullet points there. The street needs to [2:29:20] be stubbed to the edge of the property. [2:29:22] That helps for future developments, and [2:29:25] helps hopefully to address some of those [2:29:27] concerns we have with um annexing very [2:29:30] small pieces of property that we want to [2:29:32] plan for the future of of adjacent [2:29:34] properties. [2:29:36] Um that flag lot's a concern to us. [2:29:40] That that's not ideal. Um and then last [2:29:43] of all, we need to confirm that uh [2:29:45] utilities will work in that area and [2:29:48] that would be something that we would [2:29:49] work with the applicant on if accepted. [2:29:52] Uh zoning here would match um the most [2:29:55] recent annexation to the west, the [2:29:57] Staley annexation. And it would be [2:30:00] minimum lot sizes of 20,000 square feet [2:30:03] is the intent for these. So, 20 That [2:30:06] would be the R120, but the lots would be [2:30:08] anywhere from 20,000 to greater in [2:30:10] square footage. [2:30:13] >> And I wonder if we should talk about [2:30:15] each of these individually just cuz they [2:30:16] all have uh individual needs and [2:30:18] concerns. [2:30:19] >> Probably we should. Probably we should. [2:30:20] >> I I really don't like lot number six. [2:30:23] Um [2:30:25] Mhm. [2:30:26] >> Is that the flag one? [2:30:27] >> Yeah. [2:30:27] and then uh also the [2:30:30] uh the uh the terrain, and I'm trying to [2:30:32] remember uh isn't this one quite steep? [2:30:35] >> It starts elevating. I think it's it's [2:30:38] fairly flat here, but it starts [2:30:39] elevating towards the I believe the back [2:30:41] of those buildings on I guess the first [2:30:44] lot on the left-hand side there. [2:30:46] >> Okay. [2:30:47] >> Yeah, so it does start elevating. [2:30:48] >> I I do like the size of the lots. Uh I I [2:30:51] think I think that's a a bonus to have [2:30:54] some more bigger lots in Pace, and [2:30:55] that's what we've always been wanting. Um [2:30:58] uh obviously the your bullet item about [2:31:01] the utilities, yeah, we want to make [2:31:02] sure that [2:31:03] uh utilities can flow. Um I'm not a big [2:31:06] fan. I've talked with Travis, too, and he's helped me understand a few [2:31:10] things. Not a big fan of all these [2:31:12] little tiny uh lift stations running [2:31:15] these little subdivisions. And so, that would be a huge concern for me to [2:31:19] see if in fact we could tie in the [2:31:20] utilities and do it in such a way that [2:31:22] it's not a burden on the rest of the [2:31:23] residents. And then uh obviously it's it's a small annexation, uh but the [2:31:29] risk that comes with big annexations of hundreds of acres is they're always [2:31:34] begging for super dense. Right? And so, [2:31:37] that's one way to keep uh bigger lots is [2:31:39] to have these smaller annexations. So, [2:31:41] that's something to consider, too. [2:31:44] » Uh my my question is we're considering [2:31:48] an annexation, not a subdivision. [2:31:51] >> Yes, this is just a concept they shared [2:31:53] with us. [2:31:54] >> I I'm I'm not in favor approving that. I [2:31:57] am interested in talking about the [2:31:59] annexation, but the concept plan to me [2:32:02] should be just off the table. I [2:32:04] appreciate them taking a moment in doing [2:32:06] that, [2:32:07] but I'm more concerned about the [2:32:09] annexation and letting staff [2:32:11] really fine-tooth this and tell us what [2:32:14] >> Well, the the concept wouldn't be part [2:32:16] of your decision tonight. That would be [2:32:20] ultimately what would go into an [2:32:21] annexation agreement if it was adopted. [2:32:24] >> I agree. [2:32:25] >> But I think for for myself to make a [2:32:27] decision on annexation this small, the [2:32:29] concept map is important to see what [2:32:30] their their plans are and to see how [2:32:32] much they would change if they would [2:32:34] further go down the road. [2:32:35] >> Well, and I think if staff spends a few [2:32:37] more minutes with it, [2:32:39] particularly utilities and that, we [2:32:41] might find that [2:32:43] there might be some suggestions there, [2:32:44] also. [2:32:45] >> So, the way I look at this, this is just [2:32:47] a go-to review. So, this concept plan is [2:32:49] just their ideas, and it's it's not [2:32:52] I mean, it could totally change because [2:32:55] it's going to be what staff looks at, [2:32:57] what they agree to, and then it'll come [2:32:58] back to council once the staff's and [2:33:01] planning zoning are comfortable with it. [2:33:03] Then it'll come back to us and see if we want to annex after that time. But I So, I'm going to leave it up to [2:33:09] the staff to look at this and and make [2:33:12] sure it's what we really want and how [2:33:14] it's going to work for Payson. [2:33:18] » Any other comment, Council? [2:33:20] Then I would consider a motion [2:33:23] specifically for the Haskell addition [2:33:26] annexation petition for consideration [2:33:29] of further review located at 1200 East [2:33:33] Salem Canal Road consisting of 6.21 [2:33:36] acres. [2:33:36] >> I'm going to say so moved so I don't [2:33:38] have to repeat it all. [2:33:42] » I need to pause and ask one more [2:33:43] question before I can make a decision, [2:33:45] Michael. Um if this were to get approved [2:33:47] and we we allow for staff to continue to [2:33:49] review this annexation [2:33:51] uh at that point, what what avenues or [2:33:54] off-ramps do we have if we don't like what comes to us with [2:33:59] the the full annexation? [2:34:01] >> Well, that's the beauty of an annexation [2:34:03] is it's entirely legislative. [2:34:05] >> Okay. [2:34:05] >> And so you can say no for just about any [2:34:07] reason. [2:34:08] >> We we can say um [2:34:10] we can bring it in [2:34:12] as as a holding zone, right? [2:34:14] We don't have to bring it in as an [2:34:16] annexation. We can bring it in as as a [2:34:17] holding zone. So that gives us a whole [2:34:20] bunch of legislation right there. [2:34:22] >> Really really all you have the decision [2:34:24] before you tonight is [2:34:27] do you want us to review this for [2:34:29] annexation or do you not want us to [2:34:31] review this for annexation? And then you [2:34:34] have a arsenal of things. [2:34:36] >> I'd like to know what the sewer is going [2:34:38] to be costing. [2:34:39] >> I [2:34:40] forgot to ask. Um sorry. [2:34:43] When when a annexation review comes to [2:34:46] staff, is it normally [2:34:49] the total weighted score? [2:34:51] Like do people normally not enter the [2:34:54] utilities are currently? [2:34:56] >> So for instance, with the last [2:34:59] annexation that we had um that was [2:35:01] actually denied, that weighted score was [2:35:04] like 25% when the applicant brought it [2:35:07] to us, but we still had uh city council [2:35:10] still accepted it for further review, [2:35:12] and we went through the whole process [2:35:13] only to come to the conclusion that [2:35:16] council decided not to annex that. So, [2:35:18] it's really just a guiding tool for us [2:35:21] and for you to understand [2:35:23] how we're we're kind of rating these, [2:35:26] how how ready are they to potentially [2:35:29] develop, but it's by no means uh like a [2:35:35] something you you're going to hold your [2:35:36] hat on for it. [2:35:38] >> What would you say how many based on [2:35:40] just this one? [2:35:42] Rough guess, [2:35:44] how many more staff hours would you [2:35:46] consider this one would need [2:35:49] to [2:35:50] like if they would have done a little [2:35:52] bit more work or you know, something [2:35:53] like [2:35:54] >> If I can. [2:35:56] Sorry, Lacy. We've got a motion on the [2:35:57] floor. [2:35:58] >> Oh, sorry. [2:35:58] >> Uh [2:35:59] >> Go ahead. [2:36:00] >> I I think procedure-wise, we need to [2:36:02] follow through. [2:36:02] >> Okay. Yeah, sorry. Go ahead. [2:36:04] >> I have a motion on the floor to approve [2:36:06] the further review. Do I have a second? [2:36:08] >> I'll second. [2:36:09] >> I have a second. Any further discussion? [2:36:12] Lacy. [2:36:15] So, [2:36:16] >> this [2:36:16] >> to answer her question if if that's [2:36:19] >> Yes. [2:36:19] >> Okay. [2:36:20] >> Um [2:36:22] this is very common for annexation [2:36:24] proposals. Applicants, developers, [2:36:26] whoever they are, they don't want to [2:36:28] spend money until they have some [2:36:29] assurance that they're at least going to [2:36:31] be considered. So, they're going to do [2:36:34] additional engineering, civil planning, [2:36:37] those sort of things to go into this. [2:36:39] There's going to be back and forth with [2:36:41] staff, but this being as small as it is, [2:36:43] it's not going to be a lot of man hours [2:36:45] for staff. [2:36:46] >> Thank you. And I and I do want to thank [2:36:48] all of the residents that have both sent [2:36:50] emails and come tonight. We we we hear [2:36:52] you loud and clear. We appreciate how [2:36:54] thoughtful uh [2:36:56] how much thought went into this. And uh [2:36:59] annexation and land use is a very [2:37:01] important and very important thing. And [2:37:03] I do want to remind all of us that this [2:37:05] East side is so very important and that [2:37:08] we need to develop it wisely. I don't [2:37:09] want to be coming down SR 198 in the [2:37:12] future and say, "Oh, look how nice Salem [2:37:14] is." And then, "Oh, look there's [2:37:15] Payson." And so, we'll we'll be very [2:37:17] conscious and careful about how we [2:37:19] develop this area. [2:37:22] >> And and just one last thing, there [2:37:24] it will come to a public hearing. [2:37:26] >> Yes. [2:37:27] >> public will have a chance to come and [2:37:29] voice their [2:37:31] concerns and look at the [2:37:33] appreciate [2:37:33] >> the letters that we've gotten so far in [2:37:35] May. [2:37:36] >> Yeah. [2:37:36] >> Yep, they've been very helpful. [2:37:37] >> And as staff reviews this, they're going [2:37:39] to be looking at these type [2:37:41] comprehensive plan and making sure it [2:37:42] fits. [2:37:43] >> the plan, if it meets the ordinance, [2:37:44] there's a lot of things that we will [2:37:45] give to you so you can make a decision. [2:37:48] >> All of this is why I'm okay to re- [2:37:49] to pass on to review. [2:37:51] >> Okay, I have a motion and a second. [2:37:53] Council member [2:37:54] Moss. [2:37:55] >> Yes. [2:37:55] >> Council member Pulsipher. Yes. Council [2:37:58] member Rowley. [2:37:58] >> Yes. [2:37:59] >> Council member Hewlett. [2:38:00] >> Yes. [2:38:01] >> And Council member Smith. [2:38:02] >> For this, yes. [2:38:04] To review, yes. [2:38:06] >> Motion carries to review. [2:38:08] Item number 13. [2:38:11] Breathwaite Addition Annexation Petition [2:38:14] for consideration of further review [2:38:16] located at approximately 10457 South [2:38:20] 2340 West consisting of 5.25 acres. [2:38:24] Michael. [2:38:27] » Zooming in on this one here. [2:38:29] >> Make sure your [2:38:30] microphone turned on. [2:38:32] >> Zooming in here, this is immediately [2:38:34] north of the Quail Mountain subdivision. [2:38:36] That's that [2:38:38] area that um [2:38:41] that area that's the square box that's [2:38:43] in the city limits in yellow. So, that's [2:38:45] the area here. [2:38:47] Um [2:38:49] showing you the concept they have here. [2:38:51] We're we're not necessarily in love with [2:38:53] this concept, either. Um [2:38:56] it's a rough concept that they shared [2:38:58] for for these purposes and to consider [2:39:01] ultimately how many lots they could [2:39:02] potentially get on the property. [2:39:05] Um [2:39:07] same question staff have on this is just [2:39:09] confirming that utilities will work for [2:39:11] the area. This would include uh storm [2:39:14] drain. This would include sewer and how [2:39:16] that works. [2:39:18] Um [2:39:19] the applicant is proposing uh R110, [2:39:21] which is uh [2:39:23] the same as what's immediately adjacent [2:39:25] to it. So, [2:39:26] any questions on this one? [2:39:29] >> Uh I guess not questions, just a few [2:39:31] comments. Um [2:39:34] it would almost be a one-way dead end in [2:39:37] and out situation with this uh [2:39:40] particular one the way it's laid out. [2:39:41] And then uh if I'm not mistaken, this [2:39:43] one would require a sewer lift station [2:39:47] uh to to make it work. And uh that that [2:39:50] for me incurs enough of a cost. And I [2:39:53] think this one I mean it's it's it's the [2:39:56] smallest one uh to and [2:39:59] I guess I'm not a huge fan of this one. [2:40:06] » I'm I'm fine with just doing a review. [2:40:08] So, this that's what this is for is so [2:40:10] staff can look at and do a review and [2:40:12] see what it comes back like. [2:40:15] >> Yeah, I I don't like the concept of it [2:40:17] at all. [2:40:18] >> Okay, any further discussion? [2:40:22] Uh [2:40:23] I'd entertain a motion [2:40:24] for resolution number 13. Do I need to [2:40:27] read it all again? [2:40:33] » I move that we approve [2:40:35] uh the resolution for the Braithwaite [2:40:36] addition and annexation petition for [2:40:38] consideration and further review located [2:40:40] at approximately [2:40:42] 10,457 [2:40:43] South 2340 West consisting of 5.25 [2:40:47] acres. [2:40:48] >> I'll second. [2:40:49] it. [2:40:50] >> Motion in the second. Council member [2:40:53] Smith. [2:40:53] >> No. [2:40:54] >> Council member Hewlett. [2:40:55] >> Yes. [2:40:56] >> Council member Rowley. [2:40:57] >> No. [2:40:58] >> Council member Probstgaard. [2:40:59] >> Yes. [2:41:00] >> Council member Moss. [2:41:03] >> Yes, only because it's going to review. [2:41:05] >> Motion passed for review. [2:41:09] Motion [2:41:10] >> Nope, it shut off. [2:41:12] It's It's tired. [2:41:14] >> [laughter] [2:41:14] >> Uh motion passed for review. [2:41:17] Um I think you're you're more than open. [2:41:21] It's been a public forum or public [2:41:22] meeting tonight to let them know that [2:41:25] council does not like the concept at [2:41:27] all. [2:41:29] Um [2:41:30] we're not going to be specific with [2:41:31] that, but we just don't like it. [2:41:34] They can go from there. [2:41:36] Thank you. Item number 14. [2:41:39] Resolution for Ludene, Mark, and [2:41:41] Marjorie Haskell addition annexation [2:41:43] petition for consideration of further [2:41:45] review located at approximately [2:41:48] 10755 South 2100 West consisting of 6.57 [2:41:54] acres. [2:41:55] Michael. [2:42:07] » So, these are the properties here. Why [2:42:09] does it keep going forward? Um [2:42:13] we'll just continue on to the next one. [2:42:15] So, uh these are the properties. You can [2:42:18] see the homes that are existing on the [2:42:21] east side of 1500 East and then [2:42:24] a conceptual [2:42:25] uh lot layout there. [2:42:27] Um [2:42:29] the staff met with them a couple times [2:42:31] on this one. This is the latest [2:42:33] consideration of a lot layout they gave [2:42:35] us. We're not in love with it. I know [2:42:38] that uh I met with [2:42:41] Joe Jamison on our staff and he was [2:42:43] telling me how um a vactor truck [2:42:46] couldn't even get through this area [2:42:48] right here where they're proposing for [2:42:50] sewer to continue through. So, that's [2:42:53] obviously an issue that sit the city has [2:42:55] that would need to be addressed in any [2:42:57] kind of development layout. Um [2:43:01] this one also has um [2:43:03] some concern with the 1500 East because [2:43:06] 1500 East is proposed to be a future [2:43:09] arterial road that will go all the way [2:43:11] to the freeway. And so there's a lot of [2:43:15] right of way here that that potentially [2:43:17] needs to be preserved. This is [2:43:20] potentially a good um strategy for the [2:43:23] city to ensure it if the city were to [2:43:25] annex it for example is it only annex it [2:43:28] on condition that that right of way is [2:43:30] dedicated. [2:43:31] >> Correct. [2:43:32] >> Um however [2:43:34] um you can see uh [2:43:38] the right of way is the hashed area that [2:43:41] they're showing here. [2:43:42] And that's getting really close to some [2:43:44] of those homes there. [2:43:46] So [2:43:47] there's several concerns with this. Uh [2:43:49] this one by far has had the most public [2:43:52] comment that's been submitted to us thus [2:43:54] far. Um the biggest public comments are [2:43:57] concerned with drainage and concerned [2:43:59] with lot sizes. Uh the citizens in this [2:44:02] area feel as if the lots should be [2:44:04] similar in size to those most [2:44:06] immediately adjacent to the left. And [2:44:10] staff [2:44:11] believes that that's a fair assessment. [2:44:13] That's why they're asking the [2:44:15] applicant's asking in their request for [2:44:17] the R19 and staff would recommend either [2:44:19] R110 or R115 at a minimum for for these [2:44:23] areas. Any questions on this one? [2:44:25] >> I I think it's safe to say too we have [2:44:27] no idea when that road is is is going to [2:44:30] happen. Um and it would be wise for the [2:44:32] city to to get that road dedication. How wide it would we require to [2:44:37] dedicate? [2:44:39] >> Travis, what is it? 105? 108? [2:44:41] >> 108 back-to-back. [2:44:43] >> 118 ft [2:44:45] >> toe back-to-back. [2:44:46] >> Wow. [2:44:46] >> From from back of sidewalk to back of [2:44:48] sidewalk. [2:44:49] >> Yeah. So so So this this uh you know [2:44:51] this annexation is particularly when [2:44:53] they're they're shrinking a lot sizes [2:44:54] because they're dedicating so much [2:44:57] to to the city. Um but uh but yeah, this [2:45:00] one's in in such a tender spot too and and uh [2:45:05] the lot sizes, the shape of everything, [2:45:07] it's this one might need to be part of a [2:45:09] bigger one in the future. [2:45:18] » I just worry on this one that we're [2:45:19] going to use too much [2:45:21] staff, right? Like resources right now [2:45:24] until it's a little closer to [2:45:28] being ready, but [2:45:28] >> We we don't want to lead anybody along, [2:45:30] including the applicant and the [2:45:31] landowner. We don't want to waste staff [2:45:32] time. And yeah, so it's a delicate [2:45:34] balance of [2:45:36] what to have you guys focus on. [2:45:39] >> Do we want to review it? [2:45:41] Um [2:45:42] and and let them tell them I mean [2:45:45] obviously every one of us are not in [2:45:46] favor of R19 zone. [2:45:48] Not in that area. [2:45:50] Uh particularly if you look to the left, [2:45:54] um [2:45:55] those are all larger lots. [2:45:58] >> Yes, and then like I said before, it's [2:46:00] that double-edged sword cuz if we wait [2:46:01] until a a 2 300-acre annexation in this [2:46:05] property, uh it's going to come with a cost of more density. [2:46:09] >> Yeah. [2:46:09] >> And so that is it is that that fine [2:46:11] line. [2:46:12] Um and yeah, the the only way to control [2:46:14] our neighbor's property is to buy it. [2:46:17] Right? And so it's it's a hard thing. Um [2:46:19] but this one may not be timely yet. [2:46:22] >> Uh if I may interject, the applicant is [2:46:25] here if you want to ask them any [2:46:26] specific questions. So [2:46:30] >> Yeah, I just have a couple things on [2:46:31] this. This is going to be a challenging [2:46:33] piece and yes, it I think that the [2:46:35] density needs to be less, [2:46:37] but I still don't have a problem with [2:46:39] reviewing it, but just knowing that the [2:46:42] applicant knows that this could be a [2:46:44] real challenge. [2:46:48] » I agree. [2:46:49] Um [2:46:51] not a public hearing, so staff any other [2:46:53] or council any other [2:46:56] comments or questions? [2:46:58] I would entertain a motion. [2:47:00] >> Make a motion that we approve the Lou [2:47:02] Dean Mark and Marjorie Haskell addition [2:47:04] annexation petition for consideration of [2:47:07] further review located approximately [2:47:09] 1755 [2:47:11] South 2100 West consisting of 6.57 [2:47:14] acres. [2:47:16] >> I have a motion. [2:47:17] >> It's 10,000 not 1,000. [2:47:20] Thank you. [2:47:23] » Motion, do I have a second? [2:47:25] >> Second. [2:47:25] >> I have a motion and a second. [2:47:27] Start with council member Moss. [2:47:34] » I'm going either way. [2:47:37] It's out for review, I'll say yes. [2:47:40] >> Um council member Probstgaard, yes. [2:47:43] Council member Rowley. [2:47:44] >> No. [2:47:45] >> Council member Hulet. [2:47:46] >> Yes. [2:47:47] >> Council member Smith. [2:47:48] >> No. [2:47:50] >> Motion passes [2:47:51] for review. [2:47:53] Item number 15 has been tabled. [2:47:59] Okay, I would consider a motion to table [2:48:02] item number 15. [2:48:03] >> So moved. [2:48:04] >> Second. [2:48:06] >> Council member Moss. [2:48:07] >> Yes. [2:48:07] >> Council member Probstgaard, yes. Council [2:48:09] member Rowley. [2:48:11] >> Yes. [2:48:12] >> You know what you're voting on? [2:48:13] >> Mhm. [2:48:15] >> Council member Hulet. [2:48:16] >> Yes. [2:48:16] >> Council member Smith. [2:48:17] >> Yes. [2:48:20] >> Brian. [2:48:23] Uh council or item number F, I would [2:48:26] accept a motion to adjourn to the [2:48:28] redevelopment agency. [2:48:29] >> So moved. [2:48:30] >> Second. [2:48:31] >> Have a motion and a second. Council [2:48:33] member Smith. [2:48:34] >> Yes. [2:48:35] >> Council member Hulet. [2:48:36] >> Yes. [2:48:36] >> Council member Rowley. [2:48:37] >> Yes. [2:48:38] >> Council member Probstgaard, yes. Council [2:48:40] member Moss. [2:48:41] >> Yes. [2:48:42] >> We are now as [2:48:44] directors and we are in the a [2:48:46] redevelopment agency setting. [2:48:54] » May I [2:48:55] We reviewed this once already as I said [2:48:57] the redevelopment for the town is a [2:48:59] Walgreens economic development [2:49:01] agreement. And the redevelopment [2:49:04] business park is innovation center with [2:49:06] the addition of the road. [2:49:09] Do you have any questions on it I can [2:49:11] help you with? [2:49:17] » Oh, this is this is what I brought up [2:49:19] earlier, right? Um [2:49:21] I guess one idea I have I wonder if if [2:49:24] instead of replacing the entirety of American way because of fear that I [2:49:30] have of rapid growth in that area which [2:49:32] I'm hopeful for and then tearing it back [2:49:34] up to to tie in everybody's utilities. I [2:49:36] wonder if [2:49:37] instead of approving the 504 [2:49:41] we just I wonder if we should just [2:49:42] approve up to $200,000 [2:49:45] to to slurry and crack seal and to do a [2:49:48] few other hot button items that will [2:49:50] help preserve it into the future rather [2:49:52] than totally repaving it. [2:49:56] I'm open for any other ideas or [2:49:58] discussion on that too. [2:49:58] >> Yeah, I I think I would rather approve [2:50:01] prove it [2:50:02] and then see what the connections are [2:50:05] going to be. [2:50:06] My concern is is that we're going to [2:50:08] lose the integrity of the the sub structure of the asphalt and [2:50:12] it'll cost us a double. [2:50:14] That that's my concern if we go through [2:50:16] another winter. [2:50:18] Maybe we could limp through this winter [2:50:20] but my concern is I don't want to have [2:50:22] to pay it double. [2:50:24] Uh [2:50:25] hopefully whatever's coming [2:50:28] we'll dig out into that road and get it [2:50:31] done [2:50:33] in a timely manner. [2:50:34] I I I think that would be the best say. [2:50:37] >> Yeah, I'd like to leave the way it is, [2:50:38] but let Travis and Kent do a little more [2:50:41] study on and see what they think would [2:50:43] be the best to [2:50:45] make sure we preserve it but in a timely [2:50:47] manner and cost-effective manner. [2:50:50] >> But before we move forward, I would I [2:50:53] would like Ryan, if that's okay, [2:50:55] to come back to council and approve [2:50:57] that. [2:50:57] >> You want to do the same stipulation you [2:50:59] did on [2:50:59] >> Yeah, the same stipulation that we don't [2:51:01] spend this money until [2:51:03] council has one more opportunity to [2:51:04] review it. [2:51:05] >> Yeah, at the very least. Yep. [2:51:07] >> Cuz not knowing what the WICP is going [2:51:10] to do, it might be good for us to wait [2:51:12] till then anyway. [2:51:12] >> That's right. [2:51:13] >> It'll be spring time. [2:51:15] >> Yeah, and yep. Yeah, I Yeah. [2:51:17] >> But we would definitely come back to you [2:51:19] if you wanted to do it that way. [2:51:20] >> And we got to see what Rocky Mountain [2:51:21] ATV is going to do in Patterson. So [2:51:23] those are the big big three right there. [2:51:26] If we knew what those three were doing, [2:51:27] that pretty well covers most of what's [2:51:29] left. [2:51:30] >> This will cover it cover till the end of [2:51:32] June of next year. [2:51:33] >> Right. [2:51:34] >> So [2:51:36] Does that that make sense? [2:51:38] Okay. [2:51:39] Any further discussion? [2:51:41] Then I would entertain a motion [2:51:43] >> hearing first. [2:51:44] >> Or [2:51:44] Excuse me? [2:51:45] >> You need to have a public hearing first. [2:51:47] >> Oh. [2:51:48] Keep waiting for Ross to get up. [2:51:51] Motion to open a public hearing as a [2:51:53] re-de- redevelopment agency [2:51:56] uh concerning [2:51:58] uh the RDA development money. [2:52:01] >> So moved. [2:52:01] >> Second. [2:52:03] >> Council member Moss. [2:52:05] Director. Director Moss. Director [2:52:07] Probstgaard. Yes. Director Rowley. [2:52:09] >> Yes. [2:52:10] >> Director Hewlett. [2:52:11] >> Yes. [2:52:11] >> And Director Smith. [2:52:12] >> Yes. [2:52:13] >> Public hearing is open. [2:52:16] You can see the numbers that are before [2:52:17] us [2:52:18] uh with what's proposing. [2:52:21] Uh the the one [2:52:23] critical one is [2:52:25] American Way [2:52:26] uh is needing to to have some [2:52:28] maintenance done on it and [2:52:30] uh we're we're discussing back and forth [2:52:32] how we want to [2:52:34] protect those monies and not just pour [2:52:36] it down a hole. [2:52:41] » And that's obviously in the [2:52:42] improvements. [2:52:43] Yes. [2:52:43] >> also some landscaping for $100,000 [2:52:47] that was requested in that budget. So, [2:52:49] those are the two items that [2:52:50] >> It's also landscaping for what? [2:52:52] >> The uh, RDA itself. [2:52:54] >> Okay. [2:52:56] It's the entrance way. [2:52:57] >> ways. [2:52:58] >> Yeah. [2:52:59] >> with signs. [2:52:59] >> I think well, is it the signs? [2:53:01] >> Signage. [2:53:02] >> we've been work- we've been working with [2:53:03] Central Utah like for a conservation [2:53:06] garden with the different types of [2:53:08] uh, landscaping. [2:53:09] >> On both ends of American Way with [2:53:10] signage. [2:53:11] >> That is [2:53:12] >> I think it's just the landscape. I don't [2:53:13] think the signage is in this. [2:53:16] >> But I [2:53:16] >> Just just the landscape? [2:53:17] >> Yeah, I think we do need to come back [2:53:19] with signage so at some point. [2:53:21] >> I was hoping to see some sweet uh, [2:53:23] signage in in uh, [2:53:25] in that, but uh, landscaping uh, [2:53:29] Okay. Yeah, I just wonder if we have a [2:53:31] lot of lawn there Don already. We going [2:53:32] to get rid of some of that and do [2:53:33] something different or what was the [2:53:35] Okay. [2:53:36] >> Yeah, we were going to have like a [2:53:37] conservation garden in conjunction with [2:53:39] uh, Central Utah Water so that we could [2:53:41] people could see what conservation could [2:53:44] do, what types of plants they could [2:53:45] >> that are [2:53:46] >> grow and [2:53:47] >> tolerant for our climate and and drought [2:53:49] situation. [2:53:50] >> types. [2:53:50] >> Mhm. [2:53:51] >> Okay. [2:53:52] They they helped us design it. We just [2:53:53] needed to get some funding to hopefully [2:53:55] finish it. [2:53:56] >> And also some improvements to the the [2:53:58] detention basin. [2:53:59] >> Yeah, that detention [2:54:00] >> make it look nicer. [2:54:01] >> Not seeing anyone from the public uh, [2:54:04] any online Emily? [2:54:06] Okay, I would have I'd entertain a [2:54:08] motion to close the public hearing. [2:54:10] >> So moved. [2:54:10] >> Second. [2:54:11] >> Have a motion and a second. Director [2:54:14] Smith. [2:54:14] >> Yes. [2:54:15] >> Director [2:54:16] >> Yes. [2:54:17] >> Voting. [2:54:17] >> Yes. [2:54:18] >> Close the public hearing. Director [2:54:20] >> Moss. [2:54:21] >> Yes. [2:54:22] >> Any further discussion council or [2:54:25] directors? [2:54:28] I can [2:54:29] >> I make a motion that uh [2:54:32] we approve the resolution of the RDA [2:54:35] fiscal year [2:54:36] 2026-2027 [2:54:38] budget with the amendment that the 500 [2:54:42] plus thousand that was designated for [2:54:44] the overlay of American Way come back [2:54:45] before the directors before funds are [2:54:48] approved. [2:54:50] >> Have a motion. Have a second. [2:54:53] >> Um [2:54:53] >> Who'd you get, Emily? [2:54:55] >> Brian. [2:54:55] okay. [2:54:57] Council member Smith. [2:54:58] >> Yes. [2:54:59] >> Council member Hewlett. [2:54:59] >> Yes. [2:55:01] >> Director Smith. [2:55:03] >> Yes. [2:55:03] >> Director Hewlett. Yes. Director Rowley. [2:55:05] >> Yes. [2:55:06] >> Director Prostgaard. Yes. Director [2:55:09] Moss. [2:55:09] >> Yes. [2:55:10] >> Motion carries. [2:55:12] I would entertain a motion to adjourn [2:55:15] from the redevelopment agency.
