[13:47] And welcome to the extra planning board meeting of Thursday. [13:50] August 27th, 26th. [13:52] At 6:30 PM for a few minutes late. [13:56] Apologize for that. [13:57] I won't have candy and popcorn next time. [14:01] In the Noack room and town office building located at 10 front street, actually [14:05] New Hampshire. [14:06] To consider the following. [14:07] Before we do that, though, we will introduce the board and I have each [14:11] board member. [14:12] Introduced himself. [14:13] So I'm lying plumber. [14:15] And I'm chair of the extra board into my left. [14:18] Gwen English, regular member. [14:20] Nancy Valant luck for representative. [14:23] Sam McLeod alternate. [14:25] And Jen Martel, [14:27] Marty Kennedy. [14:28] Ryan Kelly alternate. [14:30] Okay now let's see. [14:33] We supposed to have John on. [14:35] Screen this evening and [14:38] Alan. [14:42] So let's see what's happening here. [14:45] Well, you can check the participants. [14:49] Elaine might not be, cuz she. [14:51] Just left. [14:51] Yeah, that's true. [14:53] So, [14:54] no one's online right now. [14:55] Okay. [14:56] All right. [14:57] So [15:00] we're having our second, we're starting this evening's meeting. [15:03] With the second public hearing public hearing. [15:06] On the 27th, 23 capital improvement program. [15:09] C I P [15:10] projects as presented by the town departments. [15:13] Copies of the proposed documents will be available in the planning department office. [15:17] Prior to the meeting. [15:20] And we, so this is the second. [15:23] Hearing for the capital improvement plan. [15:26] We haven't read it. [15:27] It'll put your sleep quickly, but it's very interesting material. [15:32] In that it projects capital improvements over the next. [15:35] Five years. [15:37] And that happens every year. [15:38] So we always. [15:40] Move ahead. [15:41] To try to help balance expenditures. [15:44] And allow it really is the beginning of the, of the bed, meaning pro [15:47] making process. [15:48] Each year. [15:49] So August is that beginning month and Exeter. [15:52] So Dave, do you. [15:55] Want to [15:57] sure. [15:57] Thank you. [15:59] Yes.At the last meeting you had all the department heads. [16:01] Yes. [16:01] Present all their proposals and you have the draft capital improvement program. [16:07] Mm-hmm in front of you. [16:09] And you had a chance to ask questions, the department heads and so forth [16:14] Tonight's meeting is for an opportunity. [16:17] For the public to weigh in on any of that, historically you've had, you [16:20] know, the two meetings you have the department head meetings where they present everything [16:24] and then you hold the public hearing. [16:25] At the subsequent meeting or this meeting tonight. [16:31] And tonight is to hear from the public. [16:34] And then if you so choose, take action on. [16:38] The capital improvement program, because you are the board that adopts it. [16:41] Mm-hmm you do not fund it. [16:43] You, that is for others to fund. [16:45] Yeah, you're just saying. [16:46] Okay, this is what we believe the capital improvement program for the next six [16:49] years should, should be. [16:52] And you usually write a transmittal letter. [16:54] And that's usually the chair, but if you, I, I always recommend if you [16:57] have an op, if you want to highlight something in the plan, if you [17:00] have something specific that you, you know, if you feel. [17:02] Is a priority or multiple priorities. [17:04] This is your chance tonight. [17:07] To add that to the transmittal letter, because when once adopted. [17:11] We send it off to the budget review committee that reviews it and the [17:13] select board. [17:15] And, and then ultimately the voters and that's who decides what, you know, the [17:19] funding on it. [17:20] So. [17:21] If you have anything to add to the transmittal letter, if not, we just [17:24] do the, kind of the generic transmittal letter to say, you know, on, on [17:27] this meeting, we reviewed it. [17:28] We agree with. [17:30] You know, support the capital improvement plan as presented. [17:34] That being the case. [17:35] Are there any. [17:37] Particular items. [17:39] That has caught your attention, [17:41] Gwen, one really quick question. [17:44] In the minutes there was. [17:46] A comment about the Clemson pond. [17:49] Tide gates and Mr. Cronan was going. [17:52] To maybe update us on. [17:54] In the minutes. [17:56] I don't know. [17:58] You said noted, there will be an inspection tomorrow when he would have more [18:01] information. [18:02] I just wondered if there were any follow ups to that. [18:05] I don't know, it's not a big deal. [18:08] We don't have that information today. [18:10] That's fine. [18:10] So we can come back with it if needed. [18:12] Yeah, that's fine. [18:13] Okay. [18:13] I just was curious. [18:21] Anybody else? [18:38] Quiet crowd here, anybody from the public wish to. [18:41] Question. [18:41] If I had comments regarding this plan, sir. [18:44] Please introduce yourself. [18:45] So [18:46] we know who's speaking and our viewers at home. [18:51] Good evening, [18:52] mark Furlong. [18:53] 24th street. [18:55] I wanted to make a couple comments about. [18:58] The capital improvement program. [18:59] First of all, it's, it's a lot of work that goes into that. [19:02] I appreciate the work by. [19:04] The department heads and town manager's office and other staff. [19:08] I know it's required by state statute. [19:11] Glad happy to see that exit. [19:12] It takes it seriously. [19:14] Not every town does that. [19:16] And then the second thing is I, I was one person that spoke up [19:20] after last election. [19:22] At a select board meeting about. [19:24] The rapid increase in property taxes. [19:27] Taxes. And one thing I suggested was to. [19:30] Pump the brakes a little bit on some items in the, in the C [19:32] I P and I, I think there is some evidence of that and I [19:35] I appreciate that. [19:37] I wasn't here at your last meeting, but I did watch it. [19:39] Mm-hmm and I did pick up a copy and I've reviewed it. [19:43] And I think it's a, it's a good document. [19:46] But the main reason I came tonight. [19:48] Is for an item that's not in the C I P. [19:52] And I didn't really expect it to be, I guess, this year. [19:55] Some of you may be aware. [19:57] That we've [19:58] formed a [20:00] community group, a neighborhood group in the. [20:02] Park street, Oak street, neighborhood to advocate for the park street bridge. [20:07] Where for the status and condition. [20:10] And we're happy to see the, that. [20:13] It is starting to get some attention. [20:15] We've been doing a lot of research around the bridge. [20:18] And one part of that research, I found that. [20:21] The [20:22] replacement of the park street bridge appeared in the. [20:26] 2007. [20:29] 10 year, New Hampshire, D O T. [20:31] T highway improvement. [20:34] Plan [20:35] and it appeared in the next four cycles. [20:38] Cycles and my question, and I'm not sure. [20:41] This probably predates just about everybody that's involved at this point, [20:45] but I. [20:46] I'm wondering, [20:47] it seemed like, would make sense that the bridge would've been put into the [20:51] C I P. [20:52] And once it was identified for potential funding. [20:57] From [20:58] D O T back in. [21:00] From between 2007 and. [21:02] I think it was 2015. [21:04] So [21:06] I may be incorrect, but I think the bridge belongs to the railroad. [21:11] As the crossings are their responsibility. [21:13] That that is up for debate at the moment. [21:15] Okay. [21:16] They are claiming ownership and that's being research. [21:18] Researched by the town. [21:19] Yeah. [21:21] But [21:22] there, there was an agreement for the town to take over the bridge back [21:26] in the early two thousands, which was apparently never. [21:29] Completed, [21:30] but somewhere along the line, somebody got the idea that the state. [21:34] Was gonna work with the town and replace it and put it in the [21:37] 10 year plan. [21:39] Then it, and then it disappeared. [21:41] So, [21:42] I don't know if anybody has any history about that. [21:44] So, [21:46] no. [21:47] Okay. [21:47] Thank you. [21:49] Keep asking your questions. [21:51] . [21:52] And thank you for coming this evening. [21:57] Anybody else? [22:00] All right. [22:00] Well, [22:03] I think perhaps we're ready to. [22:06] Accept and forward the plan. [22:10] So now [22:11] we need a motion for that. [22:12] Yeah, you can move to adopt the 20, 27 to 2032 capital improvement program. [22:19] As presented or with the following revisions, however, you'd like, yep. [22:27] Well, let's see. [22:27] Now I got a point some alternates here. [22:31] Sammy you're acting and [22:32] you're acting around it. [22:34] Afternoon, you're acting as well. [22:35] Brian. [22:36] So 1, 2, 3, 4, 5, 6, 7, 7. [22:38] You've got seven. [22:39] So everyone's acting magic seven. [22:41] Okay. [22:45] So Sam, you look like you're ready to make a motion. [22:47] yes, sir. [22:48] I was just. [22:51] Mr chairman, I'd like to make a motion. [22:54] That we approve the [22:56] C I P for 2027 through 2032. [23:00] As presented to the planning board. [23:04] Thank you. [23:05] Is there a second? [23:07] Not all one second. [23:08] Okay. [23:09] . [23:11] Any discussion on that? [23:16] We need a hand vote or voice vote or. [23:18] Let's do a hand, vote those in favor, please raise your right hand. [23:22] Hold supposed [23:24] abstentions. [23:25] That would be me as select board member. [23:27] I have to vote on this later on down the way, so, okay. [23:30] Can't you can't stack your deck. [23:31] Okay, good. [23:32] Thank you. [23:32] Thank. [23:32] You [23:33] so be it. [23:35] And thank you again as. [23:37] You have banked all the department heads. [23:40] The time and effort and the, and they're good folks. [23:43] To put this together. [23:44] So. [23:45] That's good. [23:45] Thanks. [23:46] All right. [23:50] Hey, we're adjourned until seven. [23:52] Yeah, that's right. [23:53] We can't. [23:54] We got another 10 minutes to talk to each other, get a cup of [23:56] water. [23:57] . [23:59] Oh, good. [23:59] I can get organized. [24:01] Okay. [24:02] Okay now. [24:04] I just realized [24:06] the eye grabbed. [24:08] I don't think I've ever been this close to the chair. [24:10] Oh, , [24:12] that's why I'm feeling so warmed. [24:13] I'm getting a little nervous. [24:15] You get too close. [24:16] You're gonna. [24:16] Get elected. [24:19] You may be looking for a new cook. [24:20] Yes, [24:21] it's not. [24:22] Let's not get me ideas. [24:24] How long? [24:25] Oh, dear. [24:27] I'm glad I didn't. [24:34] You're gonna wait. [24:39] I can see you got it or not. [24:41] You [24:42] there's problem. [24:43] Since I can really use it. [24:48] Okay. [24:49] How was the family? [24:51] You're good. [24:51] I emailed, I emailed him a minute. [24:54] Not yet. [36:33] The last line. [36:35] Huh I'm seeing in the oh. [36:38] Oh, I'm sorry. [36:38] That's the third. [36:40] I was looking at the mid, we didn't review the minutes from the seven [36:43] seven, [36:45] so we just have to do that one still. [36:46] So that's right. [36:47] Okay. [36:48] Save that one. [36:48] Okay. [36:49] yeah. [36:51] Okay. [36:52] I need a motion, please. [36:54] I move to accept the. [36:56] Draft the meeting minutes from August 13th, 2026 as amended. [37:09] Okay. [37:13] All righty now let's see. [37:18] Continuation of public hearing for the application of. [37:22] Jake Hasley associates for the site plan review. [37:25] Of the proposed demolition of existing dry cleaning building. [37:28] And proposed development of a four-story building 22. [37:32] Room hotel. [37:34] No, no. That's [37:36] that's outta sync with the new proposal. [37:39] Consists of 12 unit residential building with commercial uses on the first floor. [37:43] It's back to the original one. [37:45] Yes. [37:45] Okay. [37:45] I'm just reading what's here. [37:47] I understand that. [37:47] Okay. [37:49] So, and that's pine board. [37:52] Well, let's see projects in the C2 highway commercial zoning district. [37:56] Excuse me [37:57] and identified as tax map. [38:00] 65 dash 1 25. [38:02] And is planning our favorite buying board case number 26 dash three. [38:07] Do you have anything to start us off, Dave? [38:09] Because you said you were gonna do some more. [38:11] Reviewing. [38:12] Yes, I am good that this was reviewed by the planning board [38:17] for a while and like, well, similar proposal. [38:20] Under a month, but then mixed use the state law zoning changes. [38:23] And now they're coming in not under a month. [38:25] So those provisions, most of those provisions. [38:28] No. Well, they, the MUN provisions do not apply. Mm-hmm [38:31] they are going under the zoning under a mixed use. [38:33] So they're back. [38:34] So it's this. [38:35] Similar proposal, they did they'll address it, but they did, [38:39] you know, [38:40] make some revisions. [38:42] In response to the eight, 13 planning board. [38:46] And I'll let them [38:49] describe what those changes are. [38:51] I did, you know, in the event the board gets there. [38:53] I do have suggested conditions of approval. [38:55] Should the board decide to take action in that way? [38:58] This evening? [38:59] Okay, thank you. [39:00] Okay. [39:01] Great good evening. [39:05] So we're back after a couple of months [39:07] to accommodate the summer schedule. [39:10] And the time [39:12] we amended our application. [39:15] Based on [39:16] feedback from the board and also from. [39:19] A couple of the abutters that have been. [39:21] Here throughout this entire process. [39:24] In that time, there was a. [39:26] Change in the state law regarding how. [39:29] Commercial zones interacts with residential uses. [39:33] Uses and I believe we've now, [39:36] we're now. [39:37] Proposing the least intrusive use possible. [39:40] On this property while complying with. [39:43] The underlying CT zone. [39:45] All that Christian go through. [39:48] The specifics [39:48] not much has changed on the plan set mm-hmm that you saw last [39:52] time. [39:53] We had spoken in theory about. [39:57] Modifying an [39:59] aisle in the back a mulch bed, we were calling it. [40:02] We had at the last hearing, talked about not doing that. [40:05] This plan shows that the amended plan shows that so. [40:08] That's the only substantive change on the exterior, really. [40:11] And again, electrician go through that. [40:13] Before I do. [40:15] I have a letter here from. [40:18] Chris Hilton at, from DTC on behalf of Ariel. [40:23] The margaritas lot owners. [40:25] It was emailed to me and also to the planning department at five 13 [40:29] today. [40:31] To paraphrase and I'll, I'll read it into the record if that's okay. [40:34] Sure. [40:34] But to paraphrase [40:35] essentially. [40:37] The folks over our [40:39] yep. [40:40] The folks at R E L have withdrawn. [40:43] All of their objections to this application. [40:46] And they also now are voicing [40:48] support for the application. [40:50] So [40:51] I think that's good news for the applicant and the city. [40:55] If I could read this into the record, I think that might be the [40:57] quickest way to please do it, do this. [40:58] And again, it is in metal. [41:00] Save my birth in, in Dawn's email. [41:02] okay. [41:03] So dear chair plumber, as you'll recall, this office represents [41:07] WJP development, LLC, which serves as manager of 75 Portsmouth Ave. [41:11] Exter in New Hampshire on behalf of its ownership team throughout the deliberations on this [41:15] application and a prior similar application, this office on behalf of the owners of [41:20] 75 Portsmouth Ave expressed certain concerns relative to the application. [41:24] Of course, the application has changed over time, including principally the parking demands of [41:28] The proposed development, my clients understand the parking will be confined to the subject [41:32] property under the current iteration of the application and supporting plans. [41:36] Plans against that backdrop. [41:36] My client's respectfully submit this letter to inform the board that their concerns regarding [41:40] the proposed development have been reasonably met by the applicant. [41:44] And as such their various objections are respectfully withdrawn. [41:47] In light of the amendments to the application and the proposed uses and configurations [41:50] reflected in the plan set with the latest revision date of August 8th, 2026. [41:55] My. [41:55] Client's cast their support of the relief sought in this application. [41:59] As always, if you have any questions or concerns regarding the foregoing, please feel [42:02] free to contact me at our Exeter office. [42:06] Very truly yours, Christopher.Hi. [42:07] Hilson. [42:08] So [42:09] with that.I'll let Christian [42:10] talk through the plan. [42:12] Okay. [42:13] Traffic good evening, Mr. Chairman members of the board [42:16] for the record. [42:17] My name is Kristen Smith engineer with Beals associates. [42:20] Associates representing the applicant on this project. [42:23] And [42:23] Josh is, is quite correct. [42:25] There was very little change to the exterior. [42:29] Aside from making all the plans. [42:31] Plans depict the correct. [42:34] And non disturbing. [42:36] Back travel ways [42:38] to that. [42:39] Landscape island, [42:40] which is largely. [42:42] On the, on the Needham bank property. [42:46] We have gone through this revision with the, [42:49] the fire inspector. [42:51] He is, he is very happy with it. [42:53] What this change in use we feel does is addresses the issues that were [42:58] brought up. [42:59] By some of the abutters [43:01] specific to the transient nature of hotel use. [43:04] The intention at this time is for these apartments to be sold. [43:10] And in that you will have. [43:13] Residents very similar to residents at the Manor. [43:16] The bottom floor will have two. [43:19] Different roughly 1200 square foot. [43:23] Commercial spaces. [43:25] We do not know who those users are gonna be. [43:27] Who's going to occupy those commercial spaces, but. [43:30] Very likely, you know, it will be office or retail or something along those [43:34] lines. [43:35] We, we did our parking calculations. [43:38] Based on professional office and a retail. [43:42] For roughly half of each [43:44] and. [43:46] We still now another point that I wanted to add. [43:49] Is, [43:50] I don't believe this the new state law requires you to have. [43:55] Visitor spaces, quote unquote, but we accounted for those in our parking calculations simply [43:59] because the exit ordinance discusses that. [44:02] And does require that. [44:03] And even with that and the commercial space. [44:06] We now have a surplus of three spaces, which. [44:10] Would not be needed to be used per se. [44:13] So I think we've, we've gone a step in. [44:16] Curing everybody's concern that this proposal would. [44:20] Eliminate their ability to use the cross easement that goes over all four of [44:23] these properties as well. [44:26] And just to, just to remind folks. [44:30] If we get that far tonight, which we're certainly hopeful, we do. [44:34] There is still a, a Shoreland protection conditional use permit that is required for [44:38] this. [44:39] Months ago you did receive correspondence from the conservation commission and they're in favor [44:45] of the project. [44:47] Very little else has changed with regard to the site plans. [44:52] We still propose the pervious walkways. [44:54] We still propose the per. [44:55] Pervious pavement in the back stalls, which we assume will be probably the lightest [45:00] used. [45:02] And everything else. [45:04] Pretty much remains as it was in the former proposal. [45:08] This amendment just changes that from a, a micro hotel. [45:13] To 12 residential units and two commercial spaces on the first floor. [45:17] With that I'll entertain any comments or questions from the board? [45:21] You spoke about selling those eventually we sold. [45:24] And does that mean you're gonna end up with a condominium? [45:27] Association. [45:28] Very likely. [45:29] Yes. [45:29] So. [45:32] And are they going to end up owning the whole building? [45:34] And being the well, if it, if it's sells out, that would be per [45:38] be my presumption. [45:38] Oh, they, or they would become members of that cor yeah, they, they would [45:41] all be. [45:42] Part of the association. [45:43] Yep. [45:45] Questions. [45:46] Thank you for the changes. [45:48] Changes looks. We finally came to an answer. [45:49] It took a little while to get there, but . [45:53] Yes. [45:54] Question question in your face. [45:55] A lot of questions, but I just [45:57] in the, on the back back part of the lot. [46:01] I can't remember. [46:02] Was there, was there ever any issue about. [46:05] Putting you've got that area designated as a snow storage. [46:10] Where it's not allowed on the forest pavement, but is there an issue with [46:14] snow being pushed beyond that? [46:16] Because it that's, the slope goes down well, there's, there's vegetation. [46:20] That's gonna, that, that is planted. [46:22] That can't be cut. [46:23] That is actually on the town. [46:25] Side of that [46:25] property line. [46:26] Okay. [46:26] Alright. [46:27] And so the thought process being [46:30] it's, it's not gonna go there and if, if, I mean, that's not. [46:33] Gonna hold a great deal of snow Gwen. [46:34] And as you know, we've spoken about this before. [46:37] In the event that it starts backing into the stalls. [46:42] Stalls they've gotta come in, scoop it and truck it up. [46:44] So at this point, really the only snow storage you have is right up [46:48] in the back of the building. [46:49] And up, up front, front, front by the yes, by the road. [46:52] Which, [46:53] and I, a little, yeah, because at the board's request we did remove. [46:57] Those notes between us and the Manor property. [47:00] Okay. [47:01] I'm a little concerned about how the plantings are gonna do. [47:06] On the road. [47:08] Snow storage side, but [47:12] well, our landscape architect told us that those are they're gonna be, I don't [47:16] know about salt tolerant, but salt resistant. [47:18] Okay. [47:19] Planting. [47:19] So flour resistant. [47:20] Well, right. [47:21] If they, if they shove their plow across the grass, that [47:24] could be a problem. [47:26] Okay. [47:30] May I just G go ahead. [47:31] Just remember we, we do have that condition that yeah. [47:33] Any dead or dying vegetation shall be. [47:35] Yeah. [47:35] Please replaced the next growing. [47:37] Season. [47:37] So yeah. [47:38] You know, we do have that as a backup, if it, yeah. [47:41] Got it. [47:45] So [47:47] all right. [47:48] I, I I'm a little. [47:50] Concerned about the traffic pattern in the parking area, in back of the building [47:56] So people [47:58] unless, unless I've on one plan, it looks like. [48:02] The middle section of that parking area has 1, 2, 3, 4, 5. [48:06] Spots mm-hmm but on another it looks like it only has four. [48:09] So do you see a circular. [48:12] Pat a circular driving pattern in that parking lot. [48:15] Are people gonna go in. [48:18] Back out. [48:18] No, I think they would go in back into the aisle, that front aisle [48:21] between the first set of stalls and the middle stalls. [48:25] Stalls is if I'm not mistaken, 35 feet. [48:28] So there's plenty of room for vehicles to back out. [48:30] Okay. [48:30] And turn around in that location. [48:36] Okay. [48:39] No ADA parking in the front. [48:41] It's all in the back. [48:42] Just those two currently. [48:43] Yes. [48:43] That's how currently that's closed. [48:44] Tell you, you have it. [48:46] I guess you, I guess. [48:50] Hmm. [48:51] And we went through that in one of the prior iterations. [48:53] It might have even been the M U N D, [48:56] but that existing parking lot up front is. [48:59] Actually too steep to propose. [49:00] I, I remember that spell ADA stalls. [49:02] It's hotel. [49:04] Yeah, I remember that. [49:05] I just. [49:07] Just seems if you're gonna have a. [49:09] Commercial, some kind of commercial enterprise office space, whatever downstairs. [49:14] Downstairs. [49:16] It just seems like the front of the building is gonna be the. [49:20] The most [49:22] used parking space, but. [49:25] You have ADA parking in the back. [49:27] So I guess that's all right. [49:29] Mm-hmm . [49:33] Where do you? [49:34] You've got the, the mailboxes are in the back inside, but in the back [49:38] down. [49:39] Downstairs of the door. [49:39] There will be a kiosk just inside that door. [49:41] I believe on the left. [49:42] When you're walking. [49:44] So I know previously [49:47] we talked about a loading spot. [49:50] Are you presuming that there's always gonna be a place for the male person [49:54] I presume they'll drive just all. [49:55] We have three extra stalls. [49:57] Stalls if based on the town's ordinances, every single space. [50:02] Designated for use would be in use. [50:04] We have three extra stalls. [50:06] And in addition to that, [50:08] hopefully this works. [50:11] There we go. [50:13] With the reorganization of this, there's a lot of. [50:16] Dead pavement right there. [50:17] Mm-hmm . [50:18] Definitely a male truck had come in there. [50:21] Parked right next to that [50:23] handicap space. [50:24] Handicapped space and get into that side of the building, do an access, the [50:27] kiosk. [50:28] Kiosk. [50:29] Okay. [50:32] Hmm. [50:36] And you don't [50:37] don't you already said you don't know. [50:39] Yet where, [50:40] what is going in the commercial spaces? [50:43] So correct. [50:44] Okay. [50:46] Do you have EV conduits? [50:48] Yes. [50:49] Yes. [50:49] EV conduits are in the back as well in the back as well. [50:53] And then I know Jen brought up bike storage. [50:57] Has that [50:58] have you [51:00] we didn't specifically. [51:02] Designate any, but my assumption is. [51:05] They would likely put [51:08] for the summer months, just a. [51:10] Movable bike rack on that grass area left of the, well, I guess it [51:15] would be south of the walkway into that building. [51:20] Mm-hmm [51:23] Hmm. [51:24] All right. [51:24] And then it could just be moved into storage for the winter months. [51:32] Shift point to work. [51:33] Can you point to me where that. [51:35] Is [51:36] just the location of that. [51:37] Yeah. [51:37] The bike belt. [51:38] Yep. [51:39] So here is the walkway into the building Uhhuh and this grass strip [51:43] right here. [51:44] Got it. [51:44] Thank you. [51:45] Mm-hmm . [51:50] Mm-hmm [51:54] I'm gonna stop for now. [51:56] Okay. [51:57] Someone else has questions. [51:59] Questions. [51:59] I have probably a couple questions. [52:02] Let's see are the, the residential units. [52:04] They. [52:05] Single bedroom, two bedroom, [52:08] two, two bedroom. [52:13] The [52:15] the parking up front. [52:17] The those spaces, Todd, to tell there, this space. [52:20] These end spaces here. [52:23] What is the distance between the setbacks so that a vehicle can back out [52:27] and turn and head back out in that direction. [52:30] How close is that space to the, to leave. [52:32] Those are 24 feet. [52:33] Marty. [52:33] Let me. [52:34] No, no, no. The, what I'm looking for is the, the distance. [52:39] Is your PA end of the parking space. [52:42] And appear is the end of the parking little offset space. [52:45] Yeah, it's approximately five feet. [52:47] Okay. [52:50] Is that [52:51] on the [52:54] I think this is the old. [52:56] Planting plan [52:57] cuz the circulation that that is correct. [52:59] We, we are still waiting for the current one, but. [53:02] Realistically, I believe the only thing [53:05] materially that's gonna change. [53:07] Is there was in the former iteration. [53:10] A little island right there, but that was where the. [53:13] Landscape. [53:14] I was being [53:15] effective and in talking to Lee's. [53:18] Lee's essentially these plantings that were going. [53:21] In that little island. [53:24] Will just be relocated to this new island, which is, which is gonna be [53:29] Our side of what's left of, of that landscape. [53:33] Okay.I, I, everything else was gonna remain the same. [53:35] The concern I have with the, the, the previous plan. [53:39] Had [53:40] trees out here in this area. [53:42] At the end of those Isles. [53:43] Yep. [53:44] And again, I'm just, you know, I'm concerned that this vehicle's in lost space [53:48] we'll be able to back out. [53:51] Back into that area without [53:53] hitting the tree. [53:54] Without hitting a snow bank, whatever's gonna be there. [53:56] It's it's just very tight. [54:01] But it is the standard, [54:03] the standard. [54:05] Aisle width. [54:05] So it's a. [54:07] But so the setbacks, at least five feet, [54:09] as you're saying [54:11] that five foot kind of over pavement from the end of the stalls. [54:15] Stalls.Yes. [54:16] Yes. [54:16] I, what I'm talking about is the. [54:19] The end of the parking space. [54:20] Yep. [54:20] When you back out, you've got at least five feet before. [54:24] On those parking lot end zone on those installs? [54:25] Correct. [54:26] Okay. [54:26] Yep. [54:29] And I know you said. [54:31] You don't know what's gonna be in the commercial space. [54:35] I I'll just say, you know, the issues I had before with respect to [54:40] traffic and pedestrian. [54:42] Activity in that front area. [54:44] Was primarily related to [54:47] if it was gonna be a high turnover coffee shop. [54:51] If you have office space or other type of retail in there, it's not [54:54] as a much of a concern. [54:57] But if it's a coffee shop, I would've the same concerns. [55:00] So I don't know. [55:01] What I can do about that. [55:02] If you can't tell me what it's gonna be. [55:04] . [55:07] It makes it challenging. [55:14] I had a question. [55:14] Go ahead. [55:15] A few questions. [55:17] Off of Gwen's question about the EV. [55:23] Ports, you said they'll be in the back, correct? [55:26] Does that conflict? [55:27] So it's on the back of the building. [55:28] So would that impact. [55:30] The placement of the ADA spaces. [55:32] Well that that's currently where we have it proposed. [55:35] I mean that, those conduits, if you guys feel they're better located somewhere else [55:40] Can go. [55:40] Absolutely. [55:41] Anything.Yeah.I mean, is there any issue with putting them in the front? [55:46] Because, especially if they, I mean, aside from, you know, you're gonna have pedestals [55:49] at the end of the day, which are not got attractive, but. [55:54] I mean, we could, we could run them out to the middle. [55:57] The middle of a parking. [55:59] But then again, that's gonna monkey with. [56:05] I just noticing [56:07] yeah. [56:09] With [56:10] two [56:11] accessible spots that you have. [56:14] There that would only [56:16] that would either be inaccessible or a handicap spot. [56:19] That's charging an EV [56:21] and then you have one remaining potential, like not handicapped plate. [56:25] It's a lot back there. [56:29] So, [56:30] I mean, if it's the board's preference that, that you guys want them. [56:34] Both directed to [56:35] non HC compliance stalls. [56:38] That's that's not an issue. [56:40] Those conduits can be run anywhere. [56:41] Okay. [56:42] That makes sense. [56:43] It does. [56:43] I think that makes sense. [56:44] I would worry about. [56:46] Occupying a car occupying an EV. [56:49] Site when there's a need for a handicap. [56:51] Yeah. [56:53] Yeah, parking spot. [56:54] I mean, can they go, can they go on the back? [56:57] Line in the pervious pavement. [57:04] Yeah, that that's a valid point. [57:06] Yeah. [57:06] What, what the client's saying, Glen. [57:08] Is that we would probably prefer to leave one at the ADA, just in [57:11] case. [57:12] There was an ADA car that needed to park there. [57:15] That is an electric vehicle. [57:18] And we could certainly run another one out to one of those rear stalls [57:23] Stalls.Yeah. [57:23] Yeah. [57:24] As long as there's a sign or something that says. [57:27] Only [57:28] handicap parking, ADA parking there. [57:30] So you, you wouldn't want someone taking, oh, of course. [57:33] A spot, of course. [57:33] And, and they will have. [57:35] Nancy, the typical signage. [57:38] The paint on the pavement depicting that that is a, so if, if somebody [57:42] without. [57:44] Handicapped credentials parked there. [57:46] The police could be called. [57:47] They could get ticketed, you know, [57:50] okay, thank you. [57:51] It, it, it, they will be enforceable. [57:55] Another question I had, and I know this is a. [57:57] Older planting plan, [58:00] but on the. [58:02] Plantable space, adjacent ports with Ave. [58:04] Are, is that still going to be Juniper brush or is, can that be [58:10] Trees because that part of forest would have [58:12] gets a lot of sun. [58:12] Doesn't have a lot of shade. [58:14] And that would be good for people parking there as well as people using [58:16] the sidewalk. [58:17] Yeah. [58:17] I thought she had a couple of trees proposed if trees proposed. [58:21] Can you put up there? [58:22] I dunno if you can go to the planting plant. [58:24] Yep. [58:25] Even though it's old. [58:27] Page eight. [58:36] Yeah. [58:37] So there's those trees. [58:39] Just one sec. [58:42] There we go. [58:44] Now we can see it better, [58:45] not as much. [58:49] So there's those three, which is great. [58:51] And then I'm thinking about. [58:52] The, [58:54] I guess it's [58:55] it's spot next to port Ave. [58:59] Is there a possibility of trees being there in here? [59:01] Yeah. [59:02] In there. [59:03] From both the shade of those parking. [59:06] And [59:08] adding shade to the sidewalk. [59:13] Yeah, the well [59:15] this, this area right here. [59:19] That, that sign we had gone through with the neighbor who has a commercial [59:23] unit in the Manor facility. [59:25] Okay. [59:27] And have basically that that's where the sign for this building will go as [59:30] well. [59:32] And have committed to him that it will not be taller or will actually [59:35] be lower. [59:35] I believe is what the agreement was. [59:38] Right to his size, his sign right up the street. [59:40] Mm-hmm so that wouldn't work out in that location. [59:43] I mean, [59:45] one tree could probably go in here, [59:47] Ryan, but. [59:48] I don't know that multiples would, would work well simply because in the winter [59:52] months they, that will. [59:55] You know, Therase storage area for some yeah. [59:57] And. [59:58] The visibility that's I, I could, but as she works through this for final [1:00:02] Which which again, [1:00:04] you know, the, the only real substantive change proposes in the back, relocating those [1:00:08] small shrubs mm-hmm but. [1:00:10] I could see being able to put one tree kind of in the middle [1:00:13] mm-hmm and then the canopy would, I would assume cover at least a [1:00:17] couple of the spaces. [1:00:18] Maybe [1:00:19] the one in the middle and half of each of the other one or [1:00:22] whatever, but yeah, it would provide some shade. [1:00:24] Yeah. [1:00:24] I think anyone that's parked in those lots knows it. [1:00:27] It's [1:00:27] oh, it gets hot. [1:00:28] Yes. [1:00:29] And then the other question I had was. [1:00:33] I guess you can see it here below the proposed parking. [1:00:35] If you want to please pointer to assist me. [1:00:38] Below here to the right. [1:00:40] Yep. [1:00:41] To, to the right more down. [1:00:43] Mower down, down on the map. [1:00:45] Oh, I'm sorry. [1:00:45] Yeah. [1:00:45] So that. [1:00:47] Has crosshatch part, [1:00:49] is that just. [1:00:50] Lines for that is painted lines. [1:00:52] So it's not curd. [1:00:53] It's just lines, correct. [1:00:54] Okay. [1:00:54] Yeah. [1:00:56] Alright, that answers the questions. [1:00:58] Questions.Oh, I guess the question is this might be up to the. [1:01:02] Condo association or how that's formed. [1:01:04] Is it assigned parking? [1:01:07] In the lots in the back for residence and partially in the front, or [1:01:09] is that just gonna be something that gets sorted out as time goes on [1:01:12] sorted out? [1:01:14] Yeah. For the, for the records sorted out as okay. [1:01:16] Things come together. [1:01:17] Yeah. [1:01:18] Those are my questions. [1:01:19] Thank you. [1:01:20] You're very welcome. [1:01:22] Should I go back to the presentation plan, Mr. Chairman. [1:01:24] Sure. [1:01:25] I will. [1:01:25] I think while you're on this one, I have a question. [1:01:27] Oh, who're on this one. [1:01:28] Wait a minute. [1:01:29] Okay. [1:01:31] Kristen. [1:01:31] Just wait a minute. [1:01:32] Yeah, I'm just sliding the view over so we can see the entire property [1:01:39] Ah, good. [1:01:43] The whole shot enchilada. [1:01:44] Very good. [1:01:50] Okay. [1:01:51] So I think at the risk of sort of repeating what other people have [1:01:53] said, I'm also a little. [1:01:55] Bit concerned about the parking circulation. [1:01:58] In the front [1:01:59] where it's. [1:02:02] This, this isn't the updated one, but basically those two. [1:02:06] Like right now, this one that we're seeing goes in hasn't changed. [1:02:11] This, this is different than your, some than your proposal, though. [1:02:15] I chose one way. [1:02:16] This shows one way circuit circulation with an aisle you're Absolut. [1:02:19] Absolutely right. [1:02:19] Yep. [1:02:19] Yeah. [1:02:19] Yep. [1:02:20] Which this, [1:02:22] this kind of makes sense. [1:02:25] To me as a driver. [1:02:28] Because you can [1:02:30] you know, if you go in and then, oh, there's no spots or whatever [1:02:32] you can just loop around. [1:02:34] And then also just anyone who's parking on those, like Northern four. [1:02:38] Spots. [1:02:39] I feel like are going to be hitting your trees. [1:02:43] Constantly. [1:02:44] If you don't like. [1:02:45] Put a fence there or something, then they're gonna be hitting the fence. [1:02:49] I don't know. [1:02:50] I just, I feel like it's like very tight, like backing out of one [1:02:52] of those spots on like the. [1:02:55] The four spots on the north, it just doesn't seem like there's enough room [1:02:59] To maneuver. [1:03:01] Well, I mean, we do show the, the vehicle and I think we used [1:03:05] a St like a. [1:03:07] Ford [1:03:08] Explorer type of a vehicle. [1:03:09] Did what sheet is that on? [1:03:11] Cause I wasn't seeing that parking plan, I believe. [1:03:14] The parking, which I can get. [1:03:17] Yeah. [1:03:17] If you could pull that up, that'd be great. [1:03:18] Cause I was not seeing that. [1:03:22] Shoot four. [1:03:28] Yeah, parking [1:03:30] yeah, right down there on the lower left. [1:03:33] There we go. [1:03:34] Yeah. [1:03:35] Oh, okay. [1:03:35] I didn't see that. [1:03:36] It's not there. [1:03:36] It's clear on this screen, but. [1:03:40] Which sheet number is that? [1:03:45] Four Marty, I think four. [1:03:46] Oh, I see it. [1:03:46] Yeah. [1:03:47] On the. [1:03:48] Someone with the blue arrows. [1:03:50] Arrows [1:03:55] is that gonna have a curb? [1:03:57] Is there a curb on that Northern edge? [1:03:58] On, on the Manor side? [1:04:00] Yes. [1:04:00] Yeah. [1:04:01] Okay. [1:04:02] Yeah, that'll help. [1:04:12] But that, that question. [1:04:14] Jen is precisely why [1:04:17] took a look at this stall, which is. [1:04:20] Yeah, that's this stall. [1:04:21] Yeah. [1:04:21] I appreciate seeing that. [1:04:22] Just to see that missed that little insert back out, make their turn and [1:04:25] not get off the paper. [1:04:26] Mm-hmm . [1:04:28] Yeah, crank into other vehicles. [1:04:28] And I think having that curb there that at least their tires would hit [1:04:31] the curb. [1:04:31] Yeah. [1:04:32] It, it gives you a, a six inch veal for a wheel stop. [1:04:35] Yep. [1:04:55] Hello [1:04:56] questions. [1:04:56] Thoughts. [1:05:13] Anybody from the [1:05:16] public would like to speak. [1:05:18] Please come up, [1:05:20] step up to the microphone and. [1:05:23] Introduce yourself, please. [1:05:24] A couple quick questions. [1:05:26] Questions. [1:05:32] My name is Michael Siegel. [1:05:33] I'm from, I. [1:05:34] Representative Manor. [1:05:37] We weren't [1:05:38] at the first couple of meetings and I, one thing I, I didn't see [1:05:41] the plans, but. [1:05:43] How large are the residential units? [1:05:44] That's. [1:05:46] That's [1:05:48] around 700 square feet, 700 square feet. [1:05:50] Okay. [1:05:51] And how many parking spaces are there? [1:05:54] 26 26. [1:05:55] Okay. [1:05:56] That's all I wanted to know. [1:05:57] Thank you. [1:05:59] Yes, sir. [1:06:10] Good evening, Todd FAHE from the law firm of Upton and Hatfield representing Needham [1:06:15] bank, which is in a butter as. [1:06:17] You recall just a quick procedural question to be sure that I'm fully clear [1:06:22] So the there's been several matters. [1:06:25] Introduced they have, and the records were combined. [1:06:28] And this is simply an amendment. [1:06:30] On the combined. [1:06:31] Is that what the board's understanding is? [1:06:34] It's it, this is an amendment. [1:06:37] To what was a previous, the last application, which was then combined with the [1:06:41] prior proceeding. [1:06:44] Yeah. [1:06:44] Yep. [1:06:45] It wasn't. [1:06:46] What do you mean by the prior? [1:06:48] Well, there were two records. [1:06:49] There were two records. [1:06:51] And then I think there was a motion and you combine them. [1:06:54] The reason I'm asking is that I just. [1:06:56] I, I don't have to resubmit everything again, but, but if you're, if you're [1:07:00] to tell me that this is a new. [1:07:02] Matter then I would want to just redate and resubmit documents that you've seen [1:07:07] from me ad nauseum. [1:07:08] So was a as a active. [1:07:10] Of mercy. [1:07:11] I'm asking the question. [1:07:12] So I need to give you more documents. [1:07:15] Documents.I can, I can answer that. [1:07:15] We, we continued the meeting to give them time. [1:07:18] To [1:07:21] hopefully work out that then. [1:07:24] Hotel plan. [1:07:26] So this is [1:07:28] basically the same plan. [1:07:30] With modifications, because this is the best way they could work out the traffic [1:07:34] flow. [1:07:34] Right. [1:07:35] But we're still dealing with the same. [1:07:37] It's an, it's an amended. [1:07:38] Plan and the, and the certified record that we attached to this is still [1:07:42] attached to it. [1:07:42] Perfect. [1:07:43] You don't need to give us any more paperwork. [1:07:45] All right. [1:07:45] Exactly. [1:07:46] I won't. [1:07:47] If you'd like don't weren't needed. [1:07:49] Todd. [1:07:49] All right. [1:07:50] No problem. [1:07:51] Okay. [1:07:52] So not being said. [1:07:54] This is, [1:07:54] I think the. [1:07:56] The issue we still have because I don't, we don't really, I, I don't [1:08:00] have authority tonight, not understanding what the use is gonna be in the commercial [1:08:04] Use and what the traffic flow is, it's the same issue. [1:08:06] So I know there was some reference and I understand that developer wants flexibility [1:08:12] Appreciate the, the issue addressing the parking. [1:08:16] But without knowing what the use would be. [1:08:19] You know, we can't can't consent to this and we need to object for [1:08:22] the same reasons we previously have submitted to the board. [1:08:26] Save for the, for those that are relevant. [1:08:27] I mean, it's not a hotel anymore. [1:08:29] But the most important piece is that you still have discretion [1:08:33] under your site plan, review regulations to, to approve this in a way that [1:08:38] Makes sense under your regulations? [1:08:39] Yeah. [1:08:40] So for the reasons I previously said before, [1:08:43] we renew those requests. [1:08:45] We renew our objections. [1:08:47] Only insofar [1:08:48] as [1:08:49] just don't really [1:08:50] don't really understand how this is gonna work. [1:08:52] And even with the trap, [1:08:54] the traffic flow. [1:08:55] Two little points. [1:08:56] I appreciate the shaving off of the, the area that was affected in the [1:09:00] island in the back. [1:09:01] And, and perhaps the applicant could speak to this. [1:09:03] I saw it seemed to be a new. [1:09:06] A new sewer easement, maybe an eight inch pipe. [1:09:09] And I'm, I don't know if that was some wh where that came from [1:09:12] but I think I saw that on the utility. [1:09:14] Plan. [1:09:15] And with that, I'll just end my comments, Mr. Chairman. [1:09:18] Okay, thank you. [1:09:21] Yep. [1:09:21] And I can address that Mr. Chairman, that is just a replacement of the [1:09:26] Pipe that is currently there for the dry cleaner. [1:09:30] So that is the D P w just wanted that. [1:09:33] D P w was new pipe? [1:09:34] Yeah. [1:09:35] Okay. [1:09:38] Anyone else? [1:09:43] Don't come in, then I will close the public portion of the meeting. [1:09:46] Bring it back to the [1:09:47] board. [1:09:48] And now you spoke about. [1:09:52] And then you're gonna need your help. [1:09:54] Conditional. [1:09:55] Conditional use paramedic use permit. [1:09:58] Use permit. [1:09:58] And we do have two waivers that are still pending. [1:10:02] I will remind you one of those is for the. [1:10:06] Work within five feet of a budding property line. [1:10:08] Yes. [1:10:10] The entire building is within five feet of both property lines. [1:10:12] We couldn't. [1:10:14] Couldn't get this done without, without that. [1:10:18] And [1:10:21] then [1:10:27] oh, the, the. [1:10:29] The light trespass onto a budding. [1:10:33] Properties. [1:10:33] Yeah. [1:10:34] You took care of that though. [1:10:35] You took, yeah, we, we did. [1:10:37] So, [1:10:37] I mean, I'll, I'll let you guys [1:10:40] any direction. [1:10:41] I'll let you guys [1:10:43] opine. [1:10:45] There we are as to whether or not that is. [1:10:48] Still gonna be necessary. [1:10:51] And again, if you see a. [1:10:53] Couple of hundreds. [1:10:56] Hundreds just over the property line. [1:10:57] That is gonna be absolutely washed by the existing high pressure sodium. [1:11:01] Lights that are all around us. [1:11:06] But they did get the entire. [1:11:09] Cones of illumination [1:11:11] down to, I believe it is. [1:11:14] Half a foot candle, [1:11:15] maybe even a 10th of a foot candle. [1:11:17] All on property. [1:11:20] All within those property. [1:11:22] Okay. [1:11:22] Can I just ask a call a yes. [1:11:25] Floor. [1:11:25] It was taken care of and you didn't need that anymore. [1:11:28] So that's now you needed to. [1:11:31] You you need the waiver again? [1:11:32] No, the lights have not changed since. [1:11:34] Okay. [1:11:34] Since prior iteration. [1:11:35] Okay, so you don't need a wave? [1:11:37] Well, we, we never got there. [1:11:39] So you guys never said, no, you don't well, because you modified it [1:11:43] Yes. [1:11:43] And you changed it. [1:11:44] So it wasn't necessary. [1:11:45] We sent it back to our lighting consultant. [1:11:47] Okay. [1:11:47] Correct. [1:11:48] Okay. [1:11:48] And that has not changed. [1:11:49] Wanna make sure that wasn't another change that has not changed, changed. [1:11:52] Nancy's not changed. [1:11:52] Thank the proposed lights have not. [1:11:54] Okay. [1:11:55] Been edited. [1:11:59] Okay. [1:12:00] Yes. [1:12:00] And then Mr. Chairman, the final piece would be the conditional use permit. [1:12:04] Because a portion of this property is in. [1:12:08] Protected Shoreland. [1:12:09] Yep. [1:12:09] Believe it's that line. [1:12:10] There is the one 50 and that line, there is 300. [1:12:16] That was where the previous packet. [1:12:17] Wasn't it. [1:12:19] Well, let's go with a. [1:12:22] That permit first. [1:12:24] Yeah. And the disturbance doesn't change because nothing else exterior really changed. [1:12:29] And we, we are reducing the. [1:12:33] Existing impervious area. [1:12:35] In this proposed condition. [1:12:37] Or we continue to propose that. [1:12:39] Yes.Yeah.Yeah. [1:12:45] Henry conditions you need to respond? [1:12:48] Well, there are, there are. [1:12:50] Mm-hmm [1:12:52] eight points. [1:12:52] I think. [1:12:54] Which I can [1:12:56] okay. [1:12:57] Nope. [1:12:57] Five points. [1:12:58] Which are part of 9.3 0.4 G two. [1:13:02] Conditional uses. [1:13:04] Uses the proposed development will not detrimentally affect surface water quality. [1:13:08] To the waterworks pond or result in unhelpful conditions due to the proposed stormwater [1:13:12] management. [1:13:14] That meets a town of Exeter requirements that is proposed for the property. [1:13:18] And in addition, no [1:13:20] snow will be stored within the. [1:13:23] The Shoreland district in the. [1:13:28] In the, in the direction of the water. [1:13:31] Pond. [1:13:32] I, I would suppose. [1:13:34] The project will solely discharge domestic wastewater through the municipal sewer system. [1:13:39] There will be no onsite discharge or storage of. [1:13:44] Excuse me or disposal of hazardous or toxic wastes on the property. [1:13:49] Letter C the proposed development will not result in any damage to spawning grounds [1:13:54] or other habitat. [1:13:56] All storm water from the development area that is directed towards the waterworks pond [1:13:59] will be infiltrated into the ground. [1:14:02] Post-treatment and the layout has been designed to minimize. [1:14:07] Disturbance within the S P D and complies with the use regulations. [1:14:12] Identified an article 9.3 0.4, with the exception of the following, which is part [1:14:17] of this conditional use permit request. [1:14:19] Minimum lot coverage. [1:14:20] The maximum impervious lot coverage is limited to 10%. [1:14:25] Where we are requesting an impervious lot coverage of 78%. [1:14:30] Which as a reduction from the existing site at 79% in pervious within the [1:14:35] Shoreland protection district. [1:14:37] And finally point E article 9 30, 1 of the Exodus Shoreland protection district ordinance. [1:14:43] Authority and purpose the protection, maintenance and enhancement of the waterworks pond is achieved [1:14:49] Achieved through the drainage design proposed. [1:14:51] The existing site, direct stormwater. [1:14:53] To the water. [1:14:55] The current site directs water towards the waterworks pond without treatment. [1:15:00] The proposal provides porous pavement with a sand filter treatment that infiltrates all storm [1:15:05] water. [1:15:06] Up to and including the 50 year storm event. [1:15:11] Okay. [1:15:13] Any questions about that? [1:15:17] I'd like to make a motion. [1:15:23] That we prove the [1:15:29] requirement here. [1:15:31] The suggestive language. [1:15:32] It's a little tough. [1:15:33] Ah, [1:15:35] right. [1:15:36] So this is the shore warrant. [1:15:37] Shoreland. [1:15:39] Protection district. [1:15:42] I don't have [1:15:44] we don't have any like, suggested. [1:15:47] Like motion. [1:15:53] On the, [1:15:54] it's not included in the memo. [1:15:57] Okay. [1:15:58] If I can get you one oh, right here. [1:16:01] Oh, okay. [1:16:01] Yeah, I have one. [1:16:02] Do, do you. [1:16:04] I could read it to you if you could read it and then I'll [1:16:06] move it. [1:16:06] How's that? [1:16:07] Yeah. [1:16:07] And it's the Shoreland one, right? [1:16:09] Yes. [1:16:10] Yeah.Yeah. [1:16:10] After reviewing the criteria. [1:16:12] For a Shoreland conditional use permit. [1:16:14] I move that the request of. [1:16:17] Which one is this one? [1:16:18] Jeff Kaley. [1:16:20] 26 dash 3 26 dash three. [1:16:26] For our conditional use permit, be [1:16:28] approved. [1:16:29] Approved with fallen conditions, table or denied. [1:16:32] I would recommend. [1:16:33] Two conditions that were recommended by the conservation commission. [1:16:36] Wasn't that one? [1:16:37] Yeah. [1:16:38] These were the ones, the conservation commission recommended that the soils located around and [1:16:42] under the existing building a tested for contamination after building removal and shown to [1:16:46] be. [1:16:46] In the in line with state requirements and to the monitoring. [1:16:49] Well, located onsite is decommissioned and. [1:16:53] Re removed until after cons. [1:16:55] Until after construction and recommissioned. [1:17:00] All set. [1:17:01] Okay. [1:17:01] So if you move, I'll try this one. [1:17:03] And Mr. Chairman, I'm sorry to interrupt you, Nancy. [1:17:05] I believe both of those. [1:17:07] Notes are on the plans. [1:17:09] Plans. [1:17:09] Okay. [1:17:10] My apologies. [1:17:10] No, no need. [1:17:11] And it's good to just put 'em here for, you know yeah, it does [1:17:14] for visibility sake. [1:17:15] Cutting. [1:17:15] Nice pressing teeth. [1:17:16] So. [1:17:17] I will move. [1:17:21] The conditional use permit. [1:17:23] As as described by our town planner. [1:17:27] And including the conditions stated be approved. [1:17:32] I kind of John the glove, but that's the best I could do. [1:17:34] Sorry. [1:17:34] I'll second. [1:17:35] Thank you second. [1:17:36] Okay. [1:17:36] Any [1:17:37] questions? [1:17:37] Discussion. [1:17:40] We can do hand votes on this captain. [1:17:42] So [1:17:43] those in favor, please raise your right hand. [1:17:46] Mm-hmm opposed. [1:17:48] Senses the eyes. [1:17:49] Have it. [1:17:50] Okay now. [1:17:52] Can I ask a one question? [1:17:54] Sure. [1:17:54] If that's all. [1:17:56] Right. [1:17:56] We have not talked about the architectural features of this, but I, I did [1:18:00] wanna ask. [1:18:02] On the [1:18:05] I guess it would be the third floor. [1:18:06] It almost looked well. [1:18:08] It would have railing if it was a balcony, but is that. [1:18:12] I'm looking at this picture. [1:18:13] Oh, let me get that up for you. [1:18:15] Go on. [1:18:27] It's yeah. [1:18:43] Yeah, that one, that wouldn't work. [1:18:55] Here we go. [1:19:02] Okay. [1:19:03] So it's probably just the pers the perspective, but almost it almost looks like [1:19:07] there's a. [1:19:09] A platform at the, at the base of the. [1:19:13] White area of that building. [1:19:15] And I'm assuming it's just. [1:19:17] The way [1:19:18] crown, because you'd have to have something around it, but yeah, you, you can [1:19:22] see up on the top. [1:19:24] I see those are balcony. [1:19:26] Balconies, but yes, this is, [1:19:28] I would suspect probably. [1:19:30] A foot wide at the most. [1:19:31] Okay. [1:19:34] And I guess just from a personal. [1:19:37] I just, I will say this. [1:19:38] It. [1:19:39] No bearing really on the approval of it, but I I'm just really disappointed [1:19:43] that this doesn't sort of give a nod to the historical features. [1:19:48] Features of the rest of our community. [1:19:49] It just feels. [1:19:50] Very modern and, and I'm not opposed to modern, but I, it, it just [1:19:56] is. [1:19:58] It's very boxy and [1:20:01] it just doesn't have [1:20:03] . [1:20:04] Well, we have my opinion. [1:20:04] It doesn't fight not, we, it doesn't, the architect had a foot, had a [1:20:08] footprint to work with and I realize that I think it's gonna be a [1:20:11] very at. [1:20:12] Attractive building at the end of the day. [1:20:13] What do. [1:20:14] Well, here's my comment. [1:20:16] How do you think blue ribbon cleaners look when it was built? [1:20:19] Well, it's smaller for one thing, [1:20:21] but it's fifties. [1:20:22] It's shorter. [1:20:23] Now, but it's, so this is the two thousands. [1:20:24] Okay. [1:20:25] I mean, that's what I agree. [1:20:26] Well, as, as I said, it's the first don't agree opinion. [1:20:28] It's not, it's just my thought on the building. [1:20:31] And no, I know I'm just [1:20:33] for what it's worth. [1:20:34] And I. [1:20:35] And I think the other thing that bothers me and. [1:20:39] Is that there really isn't anything. [1:20:41] Around it. [1:20:42] That's that's. [1:20:45] And I hate to compare it to another building that's in this general vicinity [1:20:49] but it's a fairly, there's another building. [1:20:52] In a neighboring lot that doesn't have. [1:20:55] It's the road and the side of the building. [1:20:57] It's, it's very abrupt. [1:21:00] And it doesn't have any, doesn't have flower pots. [1:21:03] It doesn't have any green of any kind. [1:21:06] And it just it's unappealing. [1:21:07] And I just feel like this is. [1:21:10] Kind of does the same thing. [1:21:11] It just, yeah, it's fine. [1:21:16] It's the side of the building and right down to the pavement, there aren'tany. [1:21:17] There aren't any [1:21:19] flower boxes. [1:21:20] There's nothing to. [1:21:22] Kind of make it look more inviting and I, I don't know if that's [1:21:25] something that can be done. [1:21:28] At some point, even after this gets approved. [1:21:31] Oh, they, they may choose to put some [1:21:33] like planting barrels down there, which would have to come. [1:21:36] Inside during winter months, if they're using. [1:21:38] It looks like you have one on the side. [1:21:41] Of where the door goes. [1:21:42] Yeah. [1:21:42] And then obviously one in the front against. [1:21:46] Portsmouth avenue, [1:21:47] which is, which is a wider green space with the plantings. [1:21:50] Yeah. [1:21:50] Oh, that's right up next to the road, but not the next building. [1:21:53] Yeah, no, not next to the. [1:21:54] Building Gwen, because that's what I know it is where we use the pervious [1:21:57] papers, right. [1:21:58] To collect the stormwater. [1:21:59] Right, right. [1:21:59] And provide stormwater treatment for the property. [1:22:01] It's just, again, [1:22:02] it's just a comment [1:22:04] and being. [1:22:06] Just felt a need to. [1:22:09] And I've heard other people express concerns about it, not on the board, but [1:22:09] Explain. [1:22:13] other people who have seen the plan, but. [1:22:16] Yeah, that's it. [1:22:20] I think we should look at the. [1:22:23] Waiver request. [1:22:25] Is this set back. [1:22:27] Yep. [1:22:27] Thank you, Mr. Chairman, [1:22:28] we respectfully. [1:22:30] Request a waiver to the town site plan, review and subdivision regulations. [1:22:34] Section 9.3 0.6 0.4, which restricts grading within five feet of any exterior property [1:22:40] line. [1:22:41] We feel the waiver is justified. [1:22:44] As the proposed design provides adequate space to work between the proposed disturbance and [1:22:49] the property line. [1:22:50] Therefore granting of the waiver will not, detriment will not be detrimental. [1:22:55] To public safety, health, or welfare. [1:22:57] Nor could it be deemed injurious to other property? [1:23:01] The conditions upon which this request is made. [1:23:04] Are expressly due to the fact that the proposed building being proposed. [1:23:09] In the same location as the existing. [1:23:11] Which is closer than five feet to the, to the property line. [1:23:15] The existing building driveway. [1:23:17] Et cetera are all within five feet of existing parcel boundaries. [1:23:21] And this is unique to the parcel. [1:23:24] And the proposal does not generally, which is not generally applicable to other properties [1:23:30] Due to the location of the existing features as referenced above, it would be [1:23:34] impossible to improve this site without such encroachment. [1:23:38] This would result in the hardship. [1:23:40] If the strict letter of the regulations is carried out, as it would be [1:23:43] illogical to implement this rule on the current layout. [1:23:47] Of this parcel, [1:23:48] given the current layout of this parcel, excuse me, care will be taken to [1:23:51] ensure no disturbance. [1:23:53] On the abutting pars parcels, unless. [1:23:56] Authorized by the abutting parcel owners. [1:23:58] The waiver would not be contrary to spirit and 10 of the regulations. [1:24:02] As the proposed development will result in adequate width for construction to take place [1:24:07] Without causing harm to a buddy property. [1:24:10] And finally the proposed waiver [1:24:12] does not propose to vary the provisions of the zoning ordinance or master plan [1:24:17] This is demo. [1:24:18] Demonstrated by the facts cited above as well as the fact that no structures [1:24:22] are to be located within five feet of the property line. [1:24:25] No news structures. [1:24:26] Excuse me. [1:24:30] Okay. [1:24:37] Mr Sharples. [1:24:37] Do you have any like suggested conditions? [1:24:40] We're good right on the waivers? [1:24:41] No. Yep. Just wanted to make sure, cuz we don't have that here. [1:24:44] Either. [1:24:45] I'm going to try to make a question. [1:24:46] Oh, okay. [1:24:47] Now the waiver motions either. [1:24:49] No. [1:24:52] Yeah, that I did get that. [1:24:54] Okay. [1:24:54] So I moved. [1:24:56] Moved [1:24:57] to waive. [1:24:58] The setback per [1:25:00] 9.3 0.6 0.4. [1:25:04] For planning board case number 26 dash three. [1:25:07] Be approved. [1:25:09] I'll second. [1:25:11] Moved and seconded. [1:25:13] So we'll do a hand vote again. [1:25:16] Those in favor, please indicate by raising your right hand. [1:25:19] Those opposed. [1:25:21] Pensions the aye. [1:25:22] Have it. [1:25:23] That's all set. [1:25:28] Now [1:25:29] was another [1:25:34] was another waiver that request you had? [1:25:36] I don't think so. [1:25:38] No. We've we've. [1:25:39] Come to the determination that after our lighting crew went through, or our lighting [1:25:42] engineers went through and corrected that it is no longer required. [1:25:46] Required.Alright. [1:25:46] And we didn't need one for. [1:25:49] Loading zone. [1:25:51] That's what we did talk about that at the last meeting, but [1:25:56] I don't know, was it the hotel? [1:25:58] Yeah. [1:25:59] Yes, it was. [1:26:00] Okay. [1:26:00] Thank you for changing this. [1:26:01] Yeah, that was the hotel. [1:26:02] Yeah. [1:26:02] Yeah. [1:26:02] Just making sure. [1:26:10] So Dave, have you got your. [1:26:12] Conditions. [1:26:13] You're usually [1:26:15] yeah, you ready? [1:26:17] Can we have, I have like a couple, we got a couple other questions [1:26:20] discussion items. [1:26:21] Go ahead. [1:26:21] I can bring it back to the board. [1:26:22] Just potential conditions. [1:26:24] So actually, [1:26:25] one is just more of a question for Mr. Sharples. [1:26:27] If I can ask that. [1:26:28] So. [1:26:29] The, the commercial is being listed as professional and. [1:26:34] Retail. [1:26:35] So does that mean, like, it can't be a restaurant. [1:26:41] Or [1:26:42] coffee shop. [1:26:43] Yeah, I'll, I'll defer the Alan, but you know, if you put a restaurant [1:26:47] in there, you know, you're probably gonna bump up against the part. [1:26:50] Part you're not gonna have enough parking, right? [1:26:51] So this is this approval. [1:26:53] Like with this amount of parking is only the amount of parking for. [1:26:57] Whatever is allowed under the zoning that doesn't trigger additional. [1:27:00] Per, you know, like anything that's I would say anything's allowed under the zoning [1:27:03] ordinance. [1:27:04] Yeah. [1:27:05] That they don't exceed anything. [1:27:06] Would. [1:27:08] Would go, could go in there. [1:27:09] Yeah. [1:27:09] But if so, so could I just follow up on your question if. [1:27:13] If we determined that the. [1:27:16] Pedestrian and traffic. [1:27:18] Interaction was a problematic in that front lot. [1:27:21] If [1:27:22] a high turnover [1:27:24] coffee shop goes in there. [1:27:25] Mm-hmm . [1:27:27] Can we [1:27:28] set as a condition that a high turnover coffee shop cannot go in. [1:27:33] Well, I [1:27:35] I wouldn't really suggest that if you were saying something like that, I would [1:27:38] suggest, you know, [1:27:39] you know, something you return to the board for, you know, like, I don't [1:27:42] know, but like what, what, gimme a scenario. [1:27:45] Work that out though. [1:27:45] I'd like a little more discussion on that because like, what is unsafe about [1:27:49] the parking lot? [1:27:50] Because, okay. [1:27:51] Say you, you know, a car comes in and. [1:27:54] You know, every 15 minutes or a car comes in every hour. [1:27:57] What's the difference? [1:27:58] What is the concern here? [1:28:00] You know, what are the specifics? [1:28:01] I I'd want the, if you want, I could go through it. [1:28:03] I mean, I, no, no. I think that's what you would. [1:28:05] Want to, you would want to justify that in a conversation before you made [1:28:09] a condition of approval with that, like outline your concern. [1:28:12] That's what I would suggest. [1:28:13] Okay. [1:28:14] And see if the applicant can, maybe the applicant could do something on a [1:28:17] remedy. [1:28:18] It, so. [1:28:19] Okay. [1:28:19] I mean, I think whether I know this is a, a change use, but [1:28:22] we had this discussion. [1:28:24] At one of the prior meetings. [1:28:25] So [1:28:26] I can, I could go through it again if you want. [1:28:28] Yeah. [1:28:28] I, I wasn't here during those. [1:28:29] Yeah. [1:28:30] So, so, but, but also, you know, you asked me. [1:28:33] A question and maybe, and I know you closed the public hearing. [1:28:36] You might want to reopen it so the applicant could speak or anyone could [1:28:40] speak on those limited issues that we're discussing. [1:28:42] Yep. [1:28:43] So, I guess before we do that though, like, so. [1:28:46] Just cause I don't have like the zoning. [1:28:48] Chart in front of me. [1:28:49] So. [1:28:50] Parking requirements for [1:28:53] retail versus isn't there like a specific parking requirement for like, [1:28:58] a a food establishment, like it's by seats. [1:29:01] Yeah. [1:29:01] Versus [1:29:02] by square footage. [1:29:03] Yeah. [1:29:04] Retail's like one space for every 300. [1:29:06] So if it became. [1:29:07] Like a coffee shop. [1:29:07] We'd have to go buy like number of seats, correct. [1:29:10] Okay. [1:29:10] Yeah. [1:29:11] You'd have to go buy the parking and then if it exceeds, exceeds the [1:29:13] 24, if the. [1:29:15] Use goes in there, you limit the use by limiting the parking. [1:29:18] So yeah. [1:29:19] You know, if, if I guess that was my question, that was kind of [1:29:21] the answer to my question. [1:29:22] At least if you wanna. [1:29:23] Open up them, but, but, but the problem, well, the problem, the issue here [1:29:27] is they have parking. [1:29:29] They have an easement, they can pocket it park next door. [1:29:31] They can. [1:29:32] Park at the bank. [1:29:32] So the parking. [1:29:34] It's the we'll work itself out [1:29:35] that won't stop the zoning they have, they can, they can park at banks [1:29:39] parking lot. [1:29:40] That's the issue. [1:29:40] Could I address that? [1:29:41] Mr. Chair? [1:29:42] Yes. [1:29:42] Just quickly. [1:29:42] Yes. [1:29:43] Hold on. [1:29:43] I'd suggest you reopen, you're reopen that for your comments specifically to the stop [1:29:48] I guess. [1:29:48] Thank you. [1:29:49] And, and just so I'd reopen. [1:29:50] It to anybody who wants to speak on those issues. [1:29:52] Sure. [1:29:53] Great. [1:29:53] Thank you to address it. [1:29:55] So. [1:29:56] The parking is limited. [1:29:58] In the ordinance already. [1:30:01] By each use, right? [1:30:02] So we're suggesting a commercial use. [1:30:05] On the ground floor [1:30:06] who don't know what tenant. [1:30:09] May or may not be interested in that space right now. [1:30:12] If it were to switch to a restaurant. [1:30:14] I think it's [1:30:16] not, it's a misnomer, the parking for the lot. [1:30:20] Has to be calculated on the lot. [1:30:22] It's not being calculated offsite. [1:30:25] We've established that. [1:30:26] So [1:30:28] if there was a change in use. [1:30:30] The applicant and there was a parking implication to that. [1:30:32] Your ordinance already. [1:30:34] Provides the rubric that we would need to work under. [1:30:38] So, [1:30:39] and there's, we don't have a definition of a high. [1:30:42] Intensity [1:30:43] use coffee shop. [1:30:44] So. [1:30:45] There is restaurant, [1:30:46] right? [1:30:47] And there's a parking calculation provided for that. [1:30:51] So [1:30:52] we're calculating the parking. [1:30:54] With under the zoning ordinance. [1:30:56] If there's a chance of use the applicant or an owner would be compelled [1:30:59] to come back here. [1:31:00] To try to address that use. [1:31:02] And in this scenario, unless something drastically changes in the zoning ordinance. [1:31:08] There's they're simply not going to be able to permit. [1:31:11] That use [1:31:12] right. [1:31:14] We, we went through that kind of rigmarole before here. [1:31:18] So we're just asking that we permit. [1:31:21] The commercial, we have commercial space on the first floor [1:31:23] we're complying with. [1:31:25] The parking as defined by the ordinance and the state RSA. [1:31:29] So if there's a change, the applicant has to come. [1:31:32] I always laugh when there's that condition of, well, you must comply with, with [1:31:34] the Ben zoning ordinance, because that is a given. [1:31:37] The applicant would've to come back. [1:31:40] So [1:31:41] it's well defined in this ordinance. [1:31:42] I, I don't think it's necessary in any way to further define it. [1:31:47] Given what the ordinance provides and that's the, that would be the normative way [1:31:51] to address. [1:31:53] This exact issue, the ordinance provides that there's no need to have a further [1:31:57] condition. [1:31:58] That would be. [1:31:59] Pretty arduous [1:32:00] and somewhat inequitable. [1:32:03] In a situation like this, the ordinances, the definition. [1:32:06] And here [1:32:07] it would be highly. [1:32:09] Unlikely based on those calculations. [1:32:11] That that the particular use in question would be. [1:32:15] Permanent here. [1:32:17] So the, the op an applicant would've to come back for that. [1:32:21] And it's unlikely that that would actually work here given the size and spacing [1:32:25] on the slot. [1:32:28] And to give you an example, it would be a 12 seat restaurant. [1:32:31] yeah, that that's all that would be allowed. [1:32:34] So. [1:32:35] In in the entire bottom floor, the, the, restaurant's not my concern. [1:32:39] It's a, it's a high turn of a coffee shop. [1:32:42] Come in, [1:32:43] grab your coffee. [1:32:44] And, you know, a bagel and head out that's how you can traffic. [1:32:49] That's that it's a completely different, let's see situation than any other. [1:32:52] Type of use that would go in there, but it's not defined within the [1:32:55] ordinance. [1:32:56] So we'd be making up a use and then making up a definition. [1:33:00] Absent, either a warrant article, or an amendment to the ordinance by this board [1:33:06] Which is illegal. [1:33:10] I, I hate to be that guy, but I am the lawyer sitting in [1:33:12] the room. [1:33:12] Right. [1:33:12] So Todd's here and he can fight with me about this. [1:33:15] I know it's an unsatisfactory. [1:33:16] Unsatisfactory answer, but there is a rote process. [1:33:20] For that kind of change, especially to a definition. [1:33:23] And or a calculation or some formula that's in the ordinance. [1:33:27] We can't just ad hoc. [1:33:29] Hoc make them up. [1:33:31] Even though you are an expert in this field. [1:33:33] You're not sitting here as an expert tonight. [1:33:35] So we can't just make that up and then ratify it somehow tonight with [1:33:38] a condition. [1:33:40] It's not how it works. [1:33:42] Respectfully [1:33:46] I [1:33:47] Todd Fay again, Needham bank. [1:33:50] I think the sport has every right to have sufficient. [1:33:53] Information to understand what's gonna happen on this site to apply your subdivision. [1:33:59] Your site plan approvals. [1:34:01] Approvals to what happens here. [1:34:02] And so the, the, the challenge I'm having is. [1:34:07] You don't want to be in a situation of approving something that unwittingly will [1:34:11] be contrary if implemented to your, to. [1:34:14] Your to your own. [1:34:16] Regulatory scheme. [1:34:17] Right. [1:34:18] It's really important. [1:34:19] And you've worked really hard. [1:34:20] We spent a lot of hours on this. [1:34:22] So respectfully to my colleague. [1:34:26] You do have a right to understand what's gonna happen. [1:34:29] So. [1:34:30] This can't just be an open-ended situation. [1:34:32] And then we don't really know what's gonna happen. [1:34:35] And [1:34:36] I, I just think. [1:34:37] There needs to be a little bit of clarity. [1:34:39] And if there were a little more clarity, I think maybe we could all [1:34:42] be in a different spot here, but there's not. [1:34:44] And, and respectfully, I. [1:34:45] Know, these folks have worked hard to get this project permitted. [1:34:50] I still think they're trying to do a lot on a small lot, [1:34:53] obviously. [1:34:54] But, you know, the it's gone through a lot of iterations. [1:34:58] But I do think we need to those issues of traffic flow and pedestrian [1:35:02] safety. [1:35:03] Are are just, are writ large in your ordinance and nothing. [1:35:07] Deprives you [1:35:08] or prevents you. [1:35:09] From from issuing an approval. [1:35:11] If that'd be your per your decision tonight. [1:35:14] To to ensure that those, that there's gonna be some fidelity to those provisions [1:35:17] right. [1:35:18] That's what this town needs and wants. [1:35:20] And that's your obligation. [1:35:21] That's. [1:35:22] That's my comment. [1:35:22] Thank you. [1:35:23] Thank you. [1:35:25] Can I rebut that as the applicant? [1:35:26] Mm-hmm please. [1:35:29] So I'm looking at section 5.6 0.6. [1:35:33] In the zoning ordinance. [1:35:35] Restaurants bars nightclubs. [1:35:38] Nightclubs of Wich golf shop would fall into. [1:35:40] And it's one for each three seats, and then there's an employee component to [1:35:44] that. [1:35:45] So I, I agree with Todd, we have every right to have as much [1:35:48] info. [1:35:48] We we're providing all of the information that we're compelled to you. [1:35:51] Plus more, we are trying to comply. [1:35:54] And we have been trying to comply with the parking ordinance. [1:35:56] It would be highly unlikely. [1:35:59] That a 12 seat coffee shop would go into the entire first floor of [1:36:02] that building. [1:36:04] And if it did, it would need to comply with the parameters in the [1:36:08] ordinance. [1:36:08] So I, I'm not arguing about. [1:36:11] Trying to provide as much information or that you have the right to ask [1:36:13] us any question that you want really. [1:36:16] And we're happy to answer. [1:36:18] 'em. [1:36:20] For what I'm arguing against is creating an ad hoc regulation with a condition [1:36:24] that is irrelevant. [1:36:26] Irrelevant because a change of use. [1:36:28] Would require an applicant to come back before this board. [1:36:32] And to comply with the ordinance. [1:36:34] In that moment as it's drafted. [1:36:37] And I think that that's, [1:36:38] again, the rote way that this should operate. [1:36:42] Or does operate in my experience in the state. [1:36:44] So [1:36:46] we're proposing or we did the parking calculations. [1:36:49] Using professional office and retail. [1:36:51] Those are the most likely uses here [1:36:53] for changes. [1:36:55] Changes [1:36:55] Mr. Kelly or another owner would have to come back before this board. [1:37:00] And comply with the calculation, but writing a new calculation for a use. [1:37:03] That's not in the ordinance. [1:37:05] Is not something that I think would be a great idea in this moment [1:37:10] So that's all I have. [1:37:13] Can I ask? [1:37:14] Oh, [1:37:15] can I add just, just on the follow-up that like is, you know, [1:37:18] I don't disagree with anyone in theory what people say, but if, if you're [1:37:21] saying like, I need to know. [1:37:23] What's going in there. [1:37:24] Mm-hmm then you've never done that as a board, since I've been here [1:37:28] you've approved. [1:37:29] Multiple commercial spaces. [1:37:32] That you did not know the use and the guardrails, if you will, are [1:37:35] the zoning ordinance. [1:37:37] So, I mean, there's numerous ones. [1:37:39] I mean the, the, the one in front of gateway, the one in front [1:37:42] of McKay, I mean, list goes odd. [1:37:44] There's there's numerous ones. [1:37:45] Ones on Portsmouth Ave and [1:37:47] the one you just did next to thirsty moose had commercial space, but the [1:37:51] uses in identified. [1:37:52] But the use uses are identified in the zoning that's that's, what's allowed. [1:37:58] So that would be, if you start going down that road, it's something that [1:38:01] you, you know, I, I, I have not seen you. [1:38:04] Mm-hmm sorry, you know, requiring what what's going in there. [1:38:07] You've never done that before. [1:38:08] No. [1:38:12] Okay, let me next thing that what makes. [1:38:15] Let me bring it back to the board again. [1:38:16] I'm sorry. [1:38:17] I'm sorry. [1:38:17] Oh, go ahead, Jack. [1:38:18] Go ahead. [1:38:19] Chris, [1:38:22] and I shouldn't put words into your mouth, but I'm thinking what makes you [1:38:26] nervous? [1:38:26] What makes me nervous? [1:38:28] Is just the, whether [1:38:30] a person is walking from. [1:38:32] The new eye eyesight place through. [1:38:36] The Plaza to this building or. [1:38:39] Whether they're driving and parking and it's the pedestrian, it's the pedestrian crossings of [1:38:45] these roads that makes. [1:38:47] Me nervous and that will happen. [1:38:50] Potentially with whatever goes in and there's nothing we can when we can't regulate [1:38:56] The number of people going in and out of that building, that's not. [1:39:00] Something we can do. [1:39:00] It's not something, you know, in advance, but I think the pedestrian safety. [1:39:06] Continues to be [1:39:07] a big concern. [1:39:09] For me and I don't. [1:39:11] Don't, I don't know how to address that. [1:39:14] I mean, just in, but I may be, I may be misinterpreting partly what [1:39:18] you're saying in my. [1:39:20] Mind [1:39:20] the, the [1:39:22] problem is how tight that. [1:39:25] That those parking spaces are in front. [1:39:27] And a high turnover. [1:39:29] Coffee shop [1:39:30] the volume of traffic that'll be generated. [1:39:33] Will will will mean you have cars coming in, pulling in. [1:39:37] Pulling out every few minutes. [1:39:40] And you're gonna have parking. [1:39:42] That's gonna be happening at the bank. [1:39:44] And I, [1:39:46] I'm not concerned about the parking. [1:39:47] There's plenty of parking spaces out there. [1:39:48] Mm-hmm the fact is though, because they're gonna be parking over there. [1:39:52] Pedestrians are gonna be walking. [1:39:54] Across. [1:39:55] And when in that tight parking area where people will be pulling out and [1:39:58] backing out [1:39:59] that's the issue and any other type of retail. [1:40:03] Use out there. [1:40:05] It wouldn't have it to that extreme. [1:40:06] It's not perfect, but it would be fine. [1:40:08] Mm-hmm but the, in my mind, [1:40:11] the one use that will cause that problem. [1:40:14] Will be [1:40:15] a, a high turnover coffee shop. [1:40:18] And if they could tell us, they're not gonna put that in. [1:40:20] I I'd be fine. [1:40:22] But if, if they can't tell us that. [1:40:25] I still have that concern. [1:40:27] I mean, I think what I was hearing is that. [1:40:29] They, they can't put that in without. [1:40:31] Going back to zoning. [1:40:32] I [1:40:33] I'd like some confirmation on that. [1:40:36] Is that true? [1:40:37] Well, it's a restaurant, so it is allowed in the zone [1:40:40] so that they can put, but it a restaurant. [1:40:43] So you take. [1:40:44] 24 spots you got right. [1:40:46] 26 0 26. [1:40:48] I'm sorry. [1:40:49] So, so you have, so you have [1:40:51] 12 for the units cuz the state law, the new state law says you [1:40:54] need. [1:40:54] One spot for every residential unit mm-hmm . [1:40:56] So that leaves 14. [1:40:58] You need one, you need one parking spot for every three seats. [1:41:02] Seats. [1:41:02] So you'd need, you could get four. [1:41:06] You get four, three seats. [1:41:07] So 12 seat restaurant. [1:41:10] But then that's it. [1:41:10] You couldn't use any of the rest of the space down there, so you [1:41:13] would, I, I, I don't know how it would happen. [1:41:16] My, my concern is not the parking. [1:41:18] Demand based on seats, a high turnover coffee shop. [1:41:22] That was in there could have. [1:41:24] Five seats and it will still generate a lot of traffic because people were [1:41:27] going up to the counter. [1:41:29] Grabbing their bagel, grabbing their coffee and running out. [1:41:32] That's what generates the traffic. [1:41:33] It's not the seats. [1:41:35] Seats. [1:41:35] I understand that, but that's what our zoning says. [1:41:37] We have to go by our zoning. [1:41:38] Okay. [1:41:38] I, I, I mean, I do you like, I, I don't really know what [1:41:42] you're saying here. [1:41:43] Do you. [1:41:44] I guess then [1:41:46] if the con, so Marty, if, if I'm hearing you right, the concern, your [1:41:49] concern is. [1:41:51] Independent of parking. [1:41:52] It's just [1:41:54] turnover of that location. [1:41:56] Is that what I'm hearing? [1:41:56] It's the interaction between traffic. [1:41:58] Coming in coming out quick turnaround and pedestrians walking across the parking water, that [1:42:03] activity on this space on this lot. [1:42:06] Is there some. [1:42:07] Traffic engineering solutions that could be used. [1:42:10] To mitigate that concern or possibly to mitigate that. [1:42:13] Impact or interaction. [1:42:16] I know it's a narrow lot and it's. [1:42:19] It's scope really just to the parking. [1:42:21] In front of it, we don't have any. [1:42:23] Say over the existing. [1:42:25] Private roadways in there, but. [1:42:28] A speed tables. [1:42:30] Tables adjustments to turning the painted islands into curb. [1:42:32] So that there's a. [1:42:34] More [1:42:36] or [1:42:38] friction to the driver going through that area. [1:42:41] When there's potential. [1:42:43] Pedestrian [1:42:44] volume. [1:42:47] So I think that might be, we have lots of high turnover. [1:42:52] Places in town. [1:42:56] And, you know, there's always PO possibly issues, but these problems can be solved [1:43:00] in an engineering way. [1:43:02] Possibly, I don't know how to solve that. [1:43:04] Of course. [1:43:04] But. [1:43:06] It seems like something that could be. [1:43:09] Considered [1:43:11] in lieu of saying in lieu of creating a. [1:43:14] Condition that may not be enforceable in any way. [1:43:20] Problem is that a lot of the mitigation would occur on. [1:43:24] Someone else, someone else's property. [1:43:25] Yeah. [1:43:26] I mean, looking at this, the spot I see is the painted islands turning [1:43:29] into. [1:43:32] Curbed, but I don't know if from a traffic engineering standpoint, if that's enough [1:43:35] to be impactful. [1:43:37] And [1:43:38] resolve any potential issues. [1:43:40] Yeah. [1:43:40] I mean, that is the challenge that this is crossing. [1:43:44] A space that is owned by many people. [1:43:47] And [1:43:48] not in scope for this discussion. [1:43:50] Yeah. [1:43:50] Well, at the same token, [1:43:52] anybody right in the right mind, wants to have a coffee shop to do [1:43:56] that kind of traffic. [1:43:57] And they look at the situation. [1:43:59] That's not gonna work. [1:44:00] They're not gonna have the customers. [1:44:01] They need to pay for the coffee to pay for the rent. [1:44:04] I just, we're trying to rub a crystal ball here and we don't know [1:44:07] what's gonna happen down there. [1:44:08] Maybe they're gonna have. [1:44:10] Hot coffee, right in a hose. [1:44:11] And you drive down and stop and fill your cup and drive on. [1:44:14] Who knows? [1:44:14] I would go there. [1:44:16] Just, I would think we're trying to predict the. [1:44:18] Future here and we're spending too much time on it. [1:44:21] Yeah, really do I think. [1:44:23] Dave gives me the, the confidence that we have the zoning for the, the [1:44:27] right purpose. [1:44:28] And I just don't think I'm going to try to put a coffee shop [1:44:30] there. [1:44:32] Cuz I I've gotta spell, send a spell, sell a lot of donuts and [1:44:36] coffee. [1:44:37] To pay the freight [1:44:38] and if nobody's coming in, because it's so hard to get in and out [1:44:42] Or that we're there once and they backed into somebody. [1:44:44] Like somebody did the other day now at. [1:44:47] Mo's right through the door. [1:44:49] . [1:44:50] It's Holly, they're waiting for the insurance to come through, to fix the door [1:44:54] So at they had all the room of the world there. [1:44:55] They've got back into the door. [1:44:57] So those things happen. [1:44:59] But, you know, I just think that. [1:45:06] The plan speaks for itself in terms of. [1:45:08] Flexibility and what can happen there? [1:45:12] And [1:45:14] there's all kinds of businesses that are certainly, I think could. [1:45:16] Use that kind of space. [1:45:20] Oh, that's where I stand on it anyway. [1:45:22] Yeah, I think I agree. [1:45:23] I think the zoning. [1:45:25] I feel pretty comfortable that the zoning. [1:45:27] Yeah, regulations will limit sort of what can happen there as well as the [1:45:32] just the site constraints. [1:45:33] So I, I personally feel satisfied with. [1:45:36] My original question that I think brought this all up. [1:45:38] . [1:45:43] Okay, can we move on or do you, you guys okay. [1:45:47] I said my piece. [1:45:49] And are we ready for, I, sorry, I had one more. [1:45:52] I had two things. [1:45:52] Oh, that's right. [1:45:53] I have to check with you first. [1:45:54] Two things. [1:45:54] Sorry. [1:45:56] I just wanted to discuss this and I don't wanna take up too much [1:45:59] time. [1:46:00] Again, but [1:46:01] because this is one of the first. [1:46:05] Applications that the BIS bicycle infrastructure would apply to. [1:46:10] And, you know, I had to look up what we. [1:46:13] A section 8.7 0.9, the new. [1:46:16] Bike infrastructure regulation. [1:46:18] It's it's super subjective. [1:46:21] So the applicant, what I heard is the applicant is proposing. [1:46:25] Temporary [1:46:26] bike racks to be placed in grass. [1:46:29] Ass seasonally. [1:46:32] And [1:46:34] in my opinion, [1:46:36] that would not qualify as. [1:46:38] Bicycle friendly design elements. [1:46:41] Elements [1:46:41] because [1:46:43] number one, it's not gonna be their year round. [1:46:45] Number two, it's gonna be on a grass surface. [1:46:48] That is not great for parking a bike on. [1:46:52] And [1:46:53] number three. [1:46:54] There's really nothing. [1:46:56] In this application that's unless we add it as a condition, which I would [1:47:00] recommend that we do. [1:47:02] That that be installed and maintained. [1:47:04] Or that be placed and maintained. [1:47:07] So, I guess my proposal is that we, that we add a condition at [1:47:11] the, at a minimum, at a condition that we. [1:47:14] That the applicant [1:47:17] place [1:47:18] a bike rack seasonally. [1:47:23] But personally, I prefer it be on pavement and. [1:47:27] You know, be secure, be a piece of infrastructure. [1:47:30] Mm-hmm . [1:47:32] Almost doesn't make sense to put it on grass cause it's gonna get. [1:47:35] Torn up. [1:47:36] Yeah. [1:47:36] How are you gonna mow the grass there? [1:47:37] Bikes on it. [1:47:38] Can't mow it. [1:47:40] Very easily. [1:47:41] Christian move the rack. [1:47:43] Did we close [1:47:44] again? [1:47:45] Hmm, no, we okay. [1:47:46] Good. [1:47:50] I agree. [1:47:50] Thank you. [1:47:53] That's a reasonable condition. [1:47:54] Okay. [1:47:58] I think they're just looking at. [1:48:00] Where they might put it. [1:48:01] That's not on graph. [1:48:08] Do you wanna open it back up for public comments so they can, would [1:48:11] you like to speak again? [1:48:12] Thank you, sir. [1:48:13] . [1:48:14] You're open to speak to me. [1:48:15] Well, now I'm gonna have to go back and, and go back to the [1:48:18] site plan, but. [1:48:22] Now in, in speaking with Jeff, actually the area that, or one of the [1:48:27] areas that. [1:48:29] Marty was talking about specific to vehicular movement. [1:48:35] If it pleases the board, we do have this location. [1:48:39] And I think that is probably, I think that front sidewalk is eight feet [1:48:43] wide. [1:48:43] If I'm not mistaken. [1:48:45] There could be a bike rack. [1:48:47] Placed right there. [1:48:48] That is paved. [1:48:49] That is still proposed to be paved. [1:48:51] And if that places the board, we will happily add that as a condition [1:48:56] I still think they're gonna want to take it in the winter because that [1:48:58] Calvin and I still. [1:49:00] While.Good. [1:49:01] It's still gonna rust. [1:49:01] If you leave that out [1:49:03] where they're spreading salt. [1:49:10] I would say, just stay on that. [1:49:12] The. [1:49:13] In town at the Y also downtown there's. [1:49:17] There's steel coated ones that are out all year round. [1:49:19] And they've been out there for they're like embedded in the concrete they've been [1:49:23] in there for. [1:49:24] They probably knows eight years. [1:49:26] Yeah. [1:49:26] Eight years. [1:49:26] I think I put 'em in 2018. [1:49:28] Look good. [1:49:29] So, yeah, there's. [1:49:31] There's bill rust event. [1:49:31] They starting new, but yeah, they'll 20 years. [1:49:33] Yeah, exactly. [1:49:33] So they run, but. [1:49:36] So there are options there for. [1:49:38] Solution, but that's fine. [1:49:39] I mean, if they, you guys want it left out the entire winter, I [1:49:42] don't know. [1:49:42] Who's riding their bike here in the winter, but this guy mm-hmm oh, oh [1:49:45] To this place people. [1:49:45] Yeah. [1:49:46] People. [1:49:47] I see very rarely. [1:49:48] And I drive, I drive 33 a lot. [1:49:51] I do not see a hell of a lot of bikes on that road [1:49:55] But [1:49:55] whatever you guys want, it's fine. [1:49:56] Yeah. [1:49:57] We don't have any issue with that. [1:49:58] Okay. [1:50:00] Think that's good. [1:50:01] Yeah. [1:50:01] And keep in mind in the near future, Portsmouth avenue is gonna be. [1:50:06] Redone mm-hmm it's it's in the CIP P so. [1:50:10] It, it, it, the hope is that it's gonna be, are they putting in [1:50:12] bike lanes? [1:50:14] We haven't gotten there yet. [1:50:15] Oh, okay. [1:50:15] I'm just saying that it's coming so most likely, most likely I don't want [1:50:20] most [1:50:21] anything. [1:50:22] But yeah, that's one of the few places idea is to. [1:50:25] Do things like that. [1:50:25] So, yeah. [1:50:25] Yeah. [1:50:26] No, I think that's great because. [1:50:29] When I end up writing my bike down that road, I am fear for [1:50:32] my life. [1:50:34] Lot of carb cuts to work that one out. [1:50:36] Yep. [1:50:37] Okay close. [1:50:38] Well, I, hold on. [1:50:39] I would just suggest, you know, since you opened it for them, for that [1:50:42] limited purpose of talking about the bike rack, I would suggest just. [1:50:45] Offering it to the public, the rest of the public. [1:50:47] If they want to talk about the bike rack issue, ride your bike, anybody [1:50:51] How long mate, how long we keep it out. [1:50:54] It's stationary like me. [1:50:55] Mm-hmm . [1:50:58] Public question again. [1:51:00] So you, do you have your standard? [1:51:04] Are you ready for him? [1:51:05] I do have some suggested conditions of approval. [1:51:07] I think so. [1:51:09] We pretty much all the standard ones. [1:51:11] Let me get 'em out here for the bike rack would be around and [1:51:14] well, you're gonna have to add the bike rack. [1:51:15] I hadn't put that one in there. [1:51:16] Okay. [1:51:17] Yep. [1:51:18] An electronic as-built with details acceptable to the town shall be provided prior to [1:51:22] the issuance of a certificate of occupancy. [1:51:24] This plan must be in DW. [1:54:00] And usually that does not happen, but we always put that in a condition [1:54:03] saying if I read it, it's like, ah, I gotta. [1:54:05] Kick it to municipal group. [1:54:07] They usually, you know, the, the applicant will fund that escrow counter [1:54:11] complete that review. [1:54:13] Thank you. [1:54:13] And can I [1:54:14] suggest a bicycle rack? [1:54:16] Yes. [1:54:16] Yeah, [1:54:17] a bicycle rack located on the eight foot sidewalk in front of the building [1:54:20] shall be. [1:54:21] Permanently installed on pavement and shall be noted on the final plans. [1:54:25] Plans as year round. [1:54:26] Did you say anything? [1:54:27] I said permanently installed permanently fine. [1:54:29] As long that that's. [1:54:31] That's okay. [1:54:32] And one EV charging station will be moved from its current site to. [1:54:38] Oh, yeah, [1:54:40] a site. [1:54:41] Did you, did you think that in the, on the purpose favors. [1:54:46] Favors somewhere on the pavement. [1:54:48] Yes. [1:54:48] Okay. [1:54:49] That, that would make the most sense. [1:54:50] Are you actually, so our regs require EV charging read. [1:54:54] Readiness. [1:54:54] They don't require charging. [1:54:56] They just write, go. [1:54:57] So you're but you're actually putting in pedestals. [1:55:00] No. Or a conduit. Oh, okay. So the. [1:55:02] Conduit's going there. [1:55:03] I just wanted to be clear the court, the court's comment you did said [1:55:07] I conduit. [1:55:08] I thought they were putting the into, so. [1:55:11] Okay. [1:55:11] And where we going to requested a tree get planted? [1:55:14] Yeah. [1:55:16] Additional tree planted on the. [1:55:20] Northwestern. [1:55:23] Lawn space adjacent to force with a. [1:55:26] Can I add a comment to that, or just a request that we don't [1:55:29] obstruct. [1:55:30] So as not to obstruct neighboring signage mm-hmm . [1:55:32] Yes. [1:55:33] So. [1:55:34] It's not to obstruct [1:55:35] neighboring signage. [1:55:36] Thank you. [1:55:36] Yeah. [1:55:38] And I have a question, Dave. [1:55:41] On on the July 10th, 2 25. [1:55:45] Notes from the conservation commission. [1:55:47] And this probably should have been with the Shoreland. [1:55:51] Well, Shoreland conditional use permit, but they noted that the soils located around and [1:55:57] under the existing buildings. [1:55:59] Buildings are tested for contamination after building removal. [1:56:02] And shown to be in line with state requirements. [1:56:05] I read that. [1:56:06] And the other one in, did you read that? [1:56:07] Yeah, I read it in the record and you approved the conditional use permit [1:56:10] with. [1:56:11] Those two conditions. [1:56:11] Okay. [1:56:11] All right. [1:56:11] Without the other one is in there. [1:56:13] Yep. [1:56:13] You're all set monitoring. [1:56:14] Well, that's in there. [1:56:15] Yep. [1:56:15] Okay. [1:56:16] The monitoring well located on size decommission. [1:56:18] Thank you. [1:56:18] Yep. [1:56:18] You. [1:56:19] Already approved that. [1:56:19] And I already made those conditions must have been napping. [1:56:22] . [1:56:23] Thank you. [1:56:24] Okay. [1:56:26] We all set. [1:56:29] Ready. [1:56:30] For vote for a motion. [1:56:31] Sure. [1:56:32] So I moved at the request of J Kaley associates, planning, board case number [1:56:37] 26 dash three first site plate approval. [1:56:40] B approved with the conditions as stated by our town planner, Mr. Sharples. [1:56:45] Gender from Martel. [1:56:47] Ryan Kelly. [1:56:51] Do you need more than that? [1:56:52] And the conduit Gwen. [1:56:54] Gwen. [1:56:54] Yeah. [1:56:55] Oh, sorry. [1:56:55] I missed end the condo conduit conduit and her Gwen. [1:56:59] Gwen English. [1:56:59] Mm-hmm I think I covered everyone. [1:57:01] I think that's good. [1:57:02] Yeah. [1:57:02] Okay. [1:57:04] I'll second, Jen. [1:57:04] Okay, move just second. [1:57:07] I [1:57:08] okay. [1:57:09] She did this. [1:57:09] She beat you. [1:57:11] Sorry. [1:57:12] It's okay. [1:57:14] She's closer to the chair now. [1:57:15] So she's gotta be [1:57:17] awake and alert. [1:57:20] Okay. [1:57:20] Now hand vote, please. [1:57:21] Those in favor, please raise your right hand. [1:57:26] 2 3, 4. [1:57:28] 2 4, 5. [1:57:29] Okay. [1:57:29] And those opposed. [1:57:32] One [1:57:33] state [1:57:36] okay. [1:57:37] Motion carries. [1:57:38] Thanks very much folks. [1:57:40] Okay, thank you for being patient [1:57:42] for working. [1:57:47] And I told no, [1:57:48] I know, but I have to. [1:57:53] I know. [1:57:54] Okay. [1:57:54] We've got that. [1:57:56] And then one more. [1:57:59] Okay. [1:57:59] So there [1:58:04] thank you. [1:58:04] I feel like it's already 10 30 or something. [1:58:10] Thank you. [1:58:10] Good night. [1:58:11] Bye. [1:58:18] Good night. [1:58:25] Okay. [1:58:42] To cycle. [1:58:45] Do this one, right? [1:58:46] Yeah. [1:58:47] Wasn't there a PPA hearing. [1:58:50] It's a continuance. [1:58:51] No, it's a continuum. [1:58:52] Okay. [1:58:52] But do they need no, we haven't. [1:58:54] Hold on. [1:58:54] Yeah. [1:58:55] Come here for a second. [1:58:56] Yeah. [1:58:57] They need to be continued again. [1:58:59] P. [1:59:00] E a [1:59:01] yeah, until we can figure out they're they're. [1:59:06] The ZBA. [1:59:08] Decision was appealed to the housing board of appeals. [1:59:11] Okay. [1:59:11] So that's going to be tied up for, you know, I don't know, [1:59:15] a while for months. [1:59:18] So [1:59:21] I would [1:59:22] let me, I, I, I gotta talk with them to see what they want [1:59:25] but, you know, they they'd like to continue. [1:59:27] So if you could just continue it until the. [1:59:30] September 10th meeting. [1:59:30] They're not gonna be there then, but at least that'll give me time to [1:59:33] talk with them to see, okay. [1:59:35] When do we table it to a date? [1:59:37] Certain. [1:59:38] Later or what we do about it, because we might have to just. [1:59:40] Pull it off the agenda temporarily and this, and just re-notice when it comes [1:59:44] back. [1:59:44] Yeah. [1:59:44] Yep. [1:59:45] But just give me a little time to talk to them first and just [1:59:48] if you could table it. [1:59:49] Till September 10th, that would be appreciated. [1:59:52] Okay. [1:59:53] I need a motion. [1:59:54] I moved that we table. [1:59:57] Planning board case number. [1:59:59] I almost did this one. [2:00:00] We just did. [2:00:01] Sorry. [2:00:02] Planning board case number. [2:00:03] 26 dash seven. [2:00:06] To our, what, what, September 10th, September 10th, September 10th, 2026. [2:00:12] Meeting here in the Novak room. [2:00:14] Second. [2:00:15] We'll do second those in favor, please. [2:00:17] And kept by saying aye. [2:00:17] Aye. [2:00:18] Aye. [2:00:18] Aye. [2:00:19] Opposed. [2:00:19] Aye. [2:00:20] ABT. [2:00:21] It.Oh, abstentions what? [2:00:22] That's nine, 10 mm-hmm think Sam's upstate. [2:00:24] So. [2:00:26] Oh, Sam's, it's not here a minute. [2:00:28] sorry. [2:00:30] All right. [2:00:30] So [2:00:34] the continuation of public hearing for the application of. [2:00:38] The stone arch [2:00:39] development, LLC, for a lot line adjustment and a minor subdivision and site plan [2:00:44] review for the redevelopment of. [2:00:46] Property located at five Brentwood drive. [2:00:50] The redevelopment will consist of eight residential condominium units in a single family home [2:00:55] of single family homes. [2:00:57] Homes, the project includes new roadway. [2:00:59] Underground utilities and drainage structures. [2:01:02] Structures tax map 62, parcel number one 11. [2:01:06] And planning based planning board case number 26, 11. [2:01:11] Is that ready to be? [2:01:12] No that's continuation. [2:01:13] So we're already going through the first thing. [2:01:15] Yep. [2:01:16] Do you have some things here to start us off with Dave? [2:01:20] Yes. [2:01:20] Thank you. [2:01:21] As you noted, the, this is a. [2:01:24] Return. This was [2:01:25] am. [2:01:26] A while back back in. [2:01:28] July, I think we saw this, but anyway, [2:01:32] the [2:01:33] site walk was July 14th. [2:01:34] If that's helpful. [2:01:36] Yeah. [2:01:36] And I think there was the June 25th meeting or something like that. [2:01:39] Mm-hmm we saw this and then we kinda, you know, there's a break [2:01:42] We have that break. [2:01:43] And then the C I P. [2:01:44] And then [2:01:45] we're back here tonight for the second meeting. [2:01:48] The, this is for a lot line adjustment and open space subdivision for the [2:01:52] redevelopment of property located at five Brentwood road they're drive. [2:01:55] There used to be. [2:01:56] A a greenhouse there and some. [2:01:59] The project includes a new roadway, underground utilities and drainage structures. [2:02:03] The TRC reviewed the plans and materials submitted to the planning office. [2:02:07] Back in may. [2:02:09] And an overview of the proposed prod project was presented. [2:02:13] Items that we discussed with 20 foot versus 24 foot road, et cetera. [2:02:19] It did also go to the, and I'll get to that in a second [2:02:21] but it, it also went to the conservation commission. [2:02:25] And they voted unanimously to recommend approval. [2:02:28] At their July meeting of the conditional use permit. [2:02:31] And I, [2:02:32] there was a, should be a memo. [2:02:35] Included with the packet. [2:02:37] The applicant did submit a new plan set. [2:02:39] I've you know, the Chan, I just got back from vacation. [2:02:42] So I have a. [2:02:43] Chance to review it a little bit. [2:02:45] It addressed a. [2:02:48] Few items. [2:02:48] There's still a few things worth pointing out. [2:02:51] One is the width of the roadway and the requirement for his shoulders. [2:02:55] You have a Underwood engineers review letter that I haven't got to them that [2:02:58] I just got to you earlier. [2:02:59] I haven't gotten a chance to give to them cuz we just got it [2:03:03] That, that lists out a couple, a handful of still outstanding remaining items. [2:03:07] And one is regarding the 24 foot width of the roadway. [2:03:11] Where 20 foot they they're proposing a 20 foot wide road or 24 is [2:03:15] required. [2:03:16] There's no shoulder on one side. [2:03:19] They need to submit waivers for that in writing, according to our regs, we [2:03:22] have not, we don't have any waivers in writing. [2:03:25] I do not believe. [2:03:27] Also only two of the six driveways off the cul-de-sac shown with small turnaround [2:03:31] areas. [2:03:31] So you don't have to back out into a. [2:03:33] Public street. [2:03:34] So if they are proposing it to be public, then it can't back out [2:03:38] If it stays 20 feet and they ask for a waiver, then they can [2:03:41] keep it as a private road. [2:03:42] Then that provision for backing out on the street, doesn't apply. [2:03:45] If it's a private road, it's. [2:03:47] It's only on public roads, [2:03:48] but that's where the, you know, a discussion with them. [2:03:51] There's some other things about some conflicts with landscaping and. [2:03:55] Utilities, but [2:03:57] nothing, they can't be overcome there. [2:03:58] And then there's some discussion about some storm water that, you know, in engineering [2:04:02] details. [2:04:03] Details [2:04:04] and that's, and that's all I have for now. [2:04:07] Okay, thank you. [2:04:07] Thank you. [2:04:08] Well, Christian, you're still here. [2:04:10] Yes. [2:04:11] Unfortunately for you. [2:04:12] I am. [2:04:13] Oh, no. Still Christian Smith with Beales associates. And I'm representing this applicant on this [2:04:18] project as well. [2:04:19] With me tonight, the audience is John O'Neill from stone arch development. [2:04:24] And Michael Green from the greening company. [2:04:26] And [2:04:28] so David kind of went through and I, I think it is. [2:04:33] I think it was an initial tack after [2:04:36] TRC. [2:04:38] That the applicants wanted to go with a, with a public road here. [2:04:42] We have reviewed the configuration with the fire department. [2:04:45] And from a life safety perspective, they have no issue with it. [2:04:49] But I think [2:04:52] the easier course and [2:04:54] the, the one more amenable to the applicants at this time. [2:04:58] Would be to just propose this then as a, as a private drive. [2:05:02] I mean, it's, it's a very small road. [2:05:04] I'm sure. [2:05:05] D P w probably doesn't want to take care of it in any event [2:05:10] But that being said, we did. [2:05:13] Attend a conservation commission. [2:05:15] And planning board combination sidewalk. [2:05:19] At which time we did review the configuration that we have here, which. [2:05:24] Now proposes two of the buildings. [2:05:26] Buildings off McKay. [2:05:29] While there were a couple of co commissioners that were not thrilled about a [2:05:31] second. [2:05:32] Law or a second house coming off of McKay drive. [2:05:36] It seemed that the contingent of planning board members. [2:05:40] Actually preferred that to spread out the houses a little bit. [2:05:43] Added a forwarded us to. [2:05:46] To maintain that 50 foot setback. [2:05:48] Particularly to our, our butter to the east and south, excuse me, west and [2:05:54] south. [2:05:56] We still have the waiver request in for. [2:05:59] The, the setback [2:06:01] adjacent. [2:06:02] To the lot that we are creating, though, that's not apparent. [2:06:05] Parcel boundary. [2:06:06] So I'm not even sure that's required. [2:06:09] Required, but anyway, [2:06:10] moving on. [2:06:11] So we're still proposing. [2:06:14] Eight units. [2:06:15] Six now would be off the cul-de-sac two would come off McKay. [2:06:19] And we have proposed the. [2:06:23] Basically a very, very firm. [2:06:25] Limit of clearing and limit of what would be maintained potentially. [2:06:30] As a lawn space for these folks. [2:06:33] We do have a [2:06:35] collection system because the curbing is proposed on the road now. [2:06:39] That goes through hard pipe. [2:06:42] Into a, for bay and into a, for this project, a fairly large bio [2:06:46] retention pond. [2:06:47] Which is one of the, the better [2:06:51] BMP stormwater treatment facilities. [2:06:54] That meet all of the criteria. [2:06:56] In 9.3, the Exeter stormwater regulations. [2:07:00] I believe we reviewed the, the yield plan at the prior meeting. [2:07:05] And [2:07:07] based on [2:07:09] what we're putting into conservation. [2:07:11] And if you look at the property, you can kind of see the shading [2:07:14] It's a, just a slanted hatch. [2:07:16] But all of this area. [2:07:20] Is proposed to be conserved. [2:07:22] And if you've read the conservation commission's memo from the sidewalk. [2:07:27] They were actually quite amenable to. [2:07:30] Taking that land because I believe it connects to. [2:07:33] Conservation land either here or over here, but. [2:07:36] That the conservation commission would actually take on the stewardship of, of that property [2:07:41] as well. [2:07:44] So that being said, we, you know, with, with the yield plan, [2:07:49] we [2:07:50] result in a 0.7. [2:07:53] Bonus unit. [2:07:54] So we would. [2:07:56] Then round that up to result in the eight units that you are shown [2:07:59] here. [2:08:03] Anything else [2:08:04] of note from the conservation commission? [2:08:07] I don't think so. [2:08:10] Very very minor change. [2:08:12] Aside from the, the one. [2:08:15] Home being relocated to McKay drive. [2:08:18] And [2:08:19] all of the homes to the south and west now meeting the, the 50 [2:08:22] foot setback to the parent parcel. [2:08:25] And with that, I'll entertain questions, comments from the board. [2:08:29] Okay. [2:08:32] Questions comments. [2:08:34] Comments [2:08:36] I'll start really? [2:08:37] I know, come up. [2:08:39] I'm curious as to why there's a driveway going into the. [2:08:42] Neighboring the lot. [2:08:43] That's on existing lot. [2:08:44] That's on Brentwood road. [2:08:47] Simply because that Gwen is part of the, the lot line adjustment with that [2:08:51] parcel. [2:08:51] He is. [2:08:53] The son of the owner of this property. [2:08:56] And he asked if [2:08:58] he would prefer a driveway off of the new road as opposed to Brentwood [2:09:01] road due to vehicles. [2:09:02] So will he eliminate. [2:09:04] The driveway off that I don't know what a plan is. [2:09:07] He's adding a two car garage. [2:09:09] And I'm not sure if he's going to eliminate that if it's gonna be [2:09:12] side load, but certainly he can't have a driveway on both. [2:09:14] So we'll have to figure that out. [2:09:15] Figure that one out. [2:09:16] Okay. [2:09:17] So. [2:09:17] Unknown [2:09:19] and on your houses. [2:09:21] There's a little [2:09:23] narrow. [2:09:24] Outline going around the perimeter of the house itself or is that the storm [2:09:29] drip edge or is that yes, that, so. [2:09:32] All those have drift edges. [2:09:34] Edges [2:09:35] is that correct? [2:09:37] Oh, no, I'm sorry, Gwen. [2:09:39] Those are the Eves. [2:09:40] The, the only one proposed with drip edge at this point in time. [2:09:44] Would be the one number 11, 11. [2:09:47] Why did you, why did you eliminate. [2:09:50] Didn't they have 'em before? [2:09:52] Not, not every one of them did. [2:09:54] I think a couple of, more of them did. [2:09:57] But I believe they were eliminated based on the relocation and removing one of [2:10:02] those units and putting it on McKay. [2:10:04] Now more of the, the house structures drained directly to the, the buyer retention [2:10:09] pond. [2:10:13] Hmm. [2:10:15] Okay. [2:10:17] So this, this again is. [2:10:19] A private road off Brentwood road. [2:10:22] That, that is what [2:10:24] the, the applicant is contemplating and thinking at this point. [2:10:27] No. Yes. And the other two of course are a driveway. So. [2:10:31] Yes, same idea. [2:10:32] Yep. [2:10:32] Yep. [2:10:38] It was the proposed eight foot high vinyl fence. [2:10:42] Was that something that was agreed to by. [2:10:45] The applicant and [2:10:47] a butters or was that [2:10:50] yeah. [2:10:51] That was, yeah, I, I believe John and the, the owner of the house [2:10:55] that's getting a lot line investment, getting a little more land. [2:10:59] Work that out with those that's what they wanted. [2:11:00] Yeah. [2:11:00] And they were all also consulted on the. [2:11:04] Final landscape plan that was proposed. [2:11:06] Okay, [2:11:07] well, something similar to that on the development. [2:11:09] That's off little river road. [2:11:12] Yes, I think we put in a expert vegetated, but yep. [2:11:16] And then hoping that will grow up and maybe. [2:11:19] Eliminate the need for the vinyl fence, but I just was curious how that [2:11:24] Came about [2:11:27] you have 4, 6, 5 decks that are in, within the. [2:11:33] 75 foot building wetland buffer. [2:11:36] Is there any way that, that, that, that those can be. [2:11:42] I think those are actually patios. [2:11:44] Gwen, are they? [2:11:45] Those are, oh, those are decks. [2:11:47] You're right. [2:11:47] Those deck. [2:11:47] Yeah. [2:11:48] Just can't see. [2:11:49] The hatch at the scale [2:11:50] and it's so out of focus on the screen, it's. [2:11:54] It's difficult to tell. [2:11:55] Yeah, kind of is . [2:11:57] That's okay. [2:12:05] Which just like to keep things out of the buffer. [2:12:10] So it's the three on the lower two on the McKay. [2:12:13] I think. [2:12:15] Are both two on McKay and I think one. [2:12:19] And three actually. [2:12:22] And the other section. [2:12:24] Five seven and nine. [2:12:25] Yep. [2:12:26] Five seven and nine. [2:12:29] Yep. [2:12:29] Got it. [2:12:29] Just wondering if you can. [2:12:32] Do something to eliminate that. [2:12:40] Yeah, actually, that's a valid point, Gwen, because. [2:12:43] When we, when we designed this, we were assuming the, the right of way [2:12:46] was the setback. [2:12:48] This goes private. [2:12:49] The, the setback then goes from the edge of pavement. [2:12:53] So actually I believe we can pull those units forward. [2:12:57] And, and accomplish that. [2:12:58] Okay, great. [2:13:01] Okay. [2:13:08] School bus stop, I guess. [2:13:10] I don't know if you've got to that point. [2:13:11] I'm guessing kids would have to come down Brentwood road. [2:13:14] That is our as. [2:13:15] Assumption and [2:13:16] don't know that yet. [2:13:21] The sidewalks on the other side of the road? [2:13:22] Yeah, the sidewalk. [2:13:33] Yeah. [2:13:33] Can I ask on that? [2:13:34] If we're on that, [2:13:35] does that a mid-block crossing you're proposing. [2:13:38] I'm not really sure. [2:13:39] What sun subdivision site plan B at the end of the sidewalk, you show [2:13:42] two dark lines. [2:13:44] Cross, hold on. [2:13:45] If that's the case. [2:13:47] On the site, PL subdivision site plan, look at the subdivision site plan B [2:13:50] Yep. [2:13:51] Mm-hmm . [2:13:56] Oh, that's better. [2:13:57] Yeah. [2:13:58] Oh, yeah. [2:14:13] Next one. [2:14:14] Yep. [2:14:15] Keep going. [2:14:17] Slate. [2:14:21] One more [2:14:22] overall [2:14:23] a [2:14:24] these and extra B next one. [2:14:25] There is. [2:14:25] There you go. [2:14:26] There it is. [2:14:27] What is that down at the end end of the sidewalk going across Brentwood [2:14:32] There's two lines. [2:14:33] I think that is a crosswalk. [2:14:34] That was that. [2:14:36] Came out of TRC, David. [2:14:40] Yeah, I remember discussing it, but I don't remember. [2:14:42] We, someone said put it in. [2:14:45] Cause it looks like this curbing the conflict. [2:14:46] Is it a tip down and. [2:14:49] Well, yeah, the, the [2:14:51] basically where that there's gonna be a handicap accessible landing. [2:14:55] Yeah.At the end of that. [2:14:56] So the curbing would tip down before you get there. [2:14:59] Yeah. [2:14:59] Yeah. [2:15:00] And then yes, just painted lines across. [2:15:03] To the sidewalk on the other side of the road. [2:15:05] Okay. [2:15:06] But in, in the event of. [2:15:10] A private roadway. [2:15:12] I guess internal sidewalks that aren't even required. [2:15:16] Well, it's no, it's a newly created street. [2:15:18] It doesn't matter if it's private or public. [2:15:19] Okay. [2:15:20] But [2:15:21] in that case, you gotta, you get out of a lot. [2:15:23] Of stuff by making it private. [2:15:24] I thought that was D P w what it was actually talking about putting [2:15:28] in that crosswalk. [2:15:29] Yeah, I heard, I remember that, but I don't remember it saying. [2:15:31] Put it in because just, just an issue with you gotta be very careful [2:15:34] with mid-block crossings and where you put 'em and what kind of signage goes [2:15:38] with them? [2:15:38] Is it a rapid rec. [2:15:40] Rectangular rapid flash and beacon. [2:15:41] Do you put up there? [2:15:42] I mean, that's what I would, the speeds. [2:15:43] Yeah, you probably that's right. [2:15:44] That's why I brought it up. [2:15:46] So, so. [2:15:48] I think we need a little more [2:15:49] consideration on that instead of just the two lines without any additional, unless there's [2:15:54] information. [2:15:56] There [2:15:56] more detail than just what I'm seeing. [2:15:59] There's no detail on what that crossing's gonna be as far as approach signage [2:16:04] or. [2:16:05] Flashing beacon or anything like that. [2:16:06] Right. [2:16:08] Yeah, Christian check. [2:16:12] Would it [2:16:16] yeah, no, but that, that is, that is definitively. [2:16:19] Yeah. [2:16:20] And that's just the lighting. [2:16:24] That is definitively gonna want be an addition to. [2:16:29] Yeah. [2:16:29] If, and if, you know, [2:16:32] we'd even that's the appropriate spot for it. [2:16:35] I mean, I, I know there's a sidewalk there, but midblock, crossing's just gotta [2:16:38] you gotta take a lot of consideration. [2:16:39] Oh yeah. [2:16:40] Understood Karen determining if, if they're gonna go there, you know, speeds on that [2:16:44] road and so forth at that. [2:16:45] Well, I think the issue was they wanted the CRO. They wanted the sidewalk [2:16:48] On this road. [2:16:49] Yeah. [2:16:49] And there's no sidewalk on that side of the street. [2:16:52] No understood. [2:16:52] So they wanted us to get them to the actual sidewalk on Brentwood road [2:16:57] So I will, [2:16:58] I will consult a, a traffic consultant. [2:17:01] A traffic engineer [2:17:02] and they, they will give us the appropriate. [2:17:06] Distances down each side of the road, that those are should go. [2:17:08] Yeah. [2:17:08] And whatever. [2:17:10] Infrastructure and to make it safe. [2:17:11] Yep. [2:17:12] Yep. [2:17:12] Regarding, because then I'm assuming we'll, we'll take that over because. [2:17:16] That that's on a town road. [2:17:17] Yes. [2:17:17] So any infrastructure that will be ours it's regarding that infrastructure. [2:17:22] Change there. [2:17:22] You said the flashing beacon. [2:17:23] Also, if that's a bump out, I'm not sure what the spaces would be [2:17:27] needed, but if that could be. [2:17:29] You know, [2:17:30] a smaller version, what we have downtown. [2:17:34] I don't know what it's gonna be. [2:17:35] That's why I'm asking. [2:17:35] Yeah. [2:17:36] They're not proposing any detail at this point. [2:17:38] So yeah, I'm just saying things to keep in mind on that. [2:17:41] Bump out too. [2:17:41] So it's also. [2:17:43] Shortens the crossing distance and is a visual, additional visual indicator to cars that [2:17:47] there's something going on there besides the flashing beacon. [2:17:51] And, and can I [2:17:53] Dave, could I suggest also that it seems to me that [2:17:56] the decision on whether a crosswalk should be long on Brentwood road at that [2:18:00] location. [2:18:01] Is more of a town [2:18:03] decision. [2:18:03] Does it make sense? [2:18:04] Does it, you know, I don't know if that's come from planning or public [2:18:07] works or whatever, but it may. [2:18:09] Make sense for this [2:18:11] project. [2:18:12] But it may not make, there may be other locations that need crosswalks on [2:18:15] Brentwood road. [2:18:17] That the town should really have more. [2:18:20] Say on than us focusing on. [2:18:22] This part, cuz maybe, maybe putting this in will preclude. [2:18:26] Another crosswalk that needs to go. [2:18:29] To a, oh, well, this would be, they would they're being, so they would [2:18:33] fund this. [2:18:34] I understand. [2:18:34] But I'm saying I'm. [2:18:36] I'm they can pay for something and put it in. [2:18:37] Then we can find out that. [2:18:39] Well, gee, you know, [2:18:41] if there was a need for a Crosswork, it might have been. [2:18:44] 300 yards down the road. [2:18:45] I, I don't know that. [2:18:45] I'm just saying. [2:18:47] That it, it should be more of a, you know, is it something that [2:18:51] Planning or the public works or somebody agrees that that makes sense. [2:18:55] Well, that's what I'm saying. [2:18:56] I think the discussion was that that they would like to see it. [2:18:59] Okay. [2:18:59] The public works representatives at the TRC. [2:19:02] Would they like to. [2:19:03] See it, what I was following up on is there's really no detail. [2:19:06] Yeah. [2:19:07] And there needs to be more detail about what this crossing and to make [2:19:10] sure it's safe. [2:19:11] Because with this, I don't really know what, what is being proposed here. [2:19:15] Okay. [2:19:15] So public works has already said, this is the best location they want. [2:19:18] They like it. [2:19:18] Well, that's what they. [2:19:20] Suggested at the TRC. [2:19:21] Now that Christian reminded me, but I was just asking about let's at the [2:19:25] TRC. [2:19:28] We make comments, but then they don't come back.They. [2:19:28] Go to the planning board. [2:19:29] And then we, you know, I, I try to make sure any. [2:19:32] Like that. [2:19:33] That's why I'm like, well, we need more detail on that. [2:19:35] Oh, yep. [2:19:36] So could I just follow up with that? [2:19:37] And just once the more detail is provided will D P w look at [2:19:41] that. [2:19:42] The additional detail. [2:19:43] We usually. [2:19:45] Get plans for them and send them to them. [2:19:46] Yeah. [2:19:46] Oh, just checking. [2:19:47] Yeah. [2:19:48] Yeah. [2:19:48] Thank you. [2:19:51] Anything in there right away, we pay particularly attention to as well. [2:19:53] Yeah, I just. [2:19:55] This is an interior to the people that road. [2:19:57] This is gonna happen on Brentwood on Brentwood road. [2:20:00] They will be included. [2:20:01] Yes. [2:20:02] Yes. [2:20:02] Good for the public to know that it will be looked at again. [2:20:06] It's great that we get people to cross, you know, I I'm all for [2:20:09] crossing, but I just wanna make sure it's a safe situation. [2:20:13] Yeah, other than, [2:20:14] yeah. [2:20:17] Now I have to drive it, look prospects. [2:20:19] Cause I, yeah, I took up a lot of oxygen there and what's that [2:20:22] I said, I just took up a lot of oxygen. [2:20:24] So I'll stop. [2:20:24] No, no, no. It's all important stuff. [2:20:27] I just said, I. [2:20:29] Am trying to visualize what we have for crosswalks on that. [2:20:33] I drive it kind of frequently. [2:20:33] Stretch. [2:20:34] Right? [2:20:35] So 20 there aren't any aren't there's not, it's just at, I understand at [2:20:39] the intersection square where the new. [2:20:41] The whole, yeah. [2:20:42] Yeah. [2:20:42] And then also that's what I was thinking. [2:20:43] The sidewalk ends. [2:20:45] Ends at Washington road. [2:20:46] You scroll down. [2:20:47] Oh, you can't scroll down, but it ends. [2:20:49] Ends right there, right near there. [2:20:50] So this makes sense because. [2:20:52] If it's six units. [2:20:55] There, you know, 12 people. [2:20:58] 12 to 20 people living there. [2:21:00] However many, [2:21:02] the other side of the road is where the crosswalk is. [2:21:04] So like accessibility for that is. [2:21:07] Yeah, I think that what makes sense. [2:21:08] Yeah. [2:21:08] But yeah, apparently road is. [2:21:11] The dodgy. [2:21:13] Yeah, [2:21:15] horrible. [2:21:19] Okay. [2:21:27] Do you have the [2:21:28] confirmation commission law. [2:21:30] Yeah. [2:21:32] I can't find one anywhere. [2:21:34] I've got, I'm working off a three packet here. [2:21:49] Okay, thank you. [2:21:52] I have a question just because it's been a while since we've looked at [2:21:55] this, can we approve the yield plan? [2:21:58] At the last meeting. [2:21:59] I can't remember. [2:22:00] No, we did not. [2:22:01] So should we look at the yield plan? [2:22:04] Uhoh [2:22:05] I don't have any, you should it's we should. [2:22:07] Yeah, because we need to approve that before we can approve the. [2:22:10] Yeah, [2:22:11] you need to, it says accept. [2:22:13] I believe, read to accept it. [2:22:14] Okay. [2:22:15] Accept. [2:22:16] Cause I feel like first time we at have to make a formal. [2:22:19] Lot of the times we'll make a formal vote. [2:22:20] But if you, if you approve the plan, then you've accepted the yield plan [2:22:24] Yeah. [2:22:24] You know, if, if you have any issues, you should discuss it and. [2:22:27] Have that discussion now. [2:22:28] Yeah. [2:22:28] Okay. [2:22:29] Yeah. [2:22:29] I seem to remember that there were some concerns and we were gonna go [2:22:32] look at the site. [2:22:33] And I don't know if we've addressed all the concerns. [2:22:36] I didn't bring one with me. [2:22:40] Yeah, [2:22:42] the old, the yield plan for this project. [2:22:45] I probably have it, but I'm, I'm all over the place tonight. [2:22:48] I can't. [2:22:49] Thank, can you kinda keep that tagged? [2:22:51] I will. [2:22:52] Okay. [2:22:52] What was that meeting date? [2:22:56] Oh boy. [2:22:56] Well, it could have been June 25th. [2:22:59] I mean, yeah, July 9th. [2:23:00] Was it July 9th, the ninth of the 20 June. [2:23:02] It was July 9th. [2:23:03] I think so. [2:23:03] Yeah. [2:23:04] All right. [2:23:04] Okay. [2:23:06] We've been the 23rd was canceled. [2:23:08] So it was July 9th? [2:23:09] Yes. [2:23:09] Yep. [2:23:10] Or. [2:23:11] Where was the 25th? [2:23:12] I've got the 25th. [2:23:13] No, it was the 25th. [2:23:15] June 25th. [2:23:15] Yeah. [2:23:16] I don't think you went on the July 13th. [2:23:19] No, you weren't there. [2:23:20] Oh, okay. [2:23:21] You met all met once in July. [2:23:25] Yeah, let me, let me, I'll find out definitively here in a second. [2:23:33] Some issues though. [2:23:35] I remember there were some issues and I just couldn't. [2:23:37] Couldn't remember if they were resolved? [2:23:38] Yeah. [2:23:39] One of 'em was the. [2:23:41] Her name winter street, Phillips waiver with a neighbor. [2:23:47] So, yeah. [2:23:49] But just for [2:23:51] between meetings. [2:23:53] Meetings people shoot. [2:24:12] That was the 25th. [2:24:13] Yeah. [2:24:17] I sort of feel like there are a lot of things that. [2:24:20] Have been brought up by U EI. [2:24:23] I and [2:24:25] a few things that may come up tonight that will. [2:24:29] Be require them to come back. [2:24:32] So maybe we can [2:24:34] table sort of table that. [2:24:36] Until [2:24:38] they seen it enough to be able to respond to them. [2:24:41] And there's a lot, there, there is a lot. [2:24:43] And. [2:24:45] We can keep going. [2:24:47] This concerns or thoughts we have on this. [2:24:52] Yeah, I am. [2:24:56] Good idea. [2:25:20] And one of the conservation commission notes. [2:25:25] They noted that the wetlands were surveyed on December 22nd. [2:25:28] And there was a question as to whether there'd been follow up inspection. [2:25:32] Inspections by the wetland scientist to confirm the results. [2:25:36] And was the site inspected during times appropriate to identify presence or absence of [2:25:40] Vernal. [2:25:41] Pool's. [2:25:42] And I just wondered if you have. [2:25:46] An answer. [2:25:47] If you can. [2:25:49] Supply us with an answer on that. [2:25:51] Yeah, I, I, I wasn't Jack bag out there [2:25:55] this spring. [2:25:57] And yeah, there, there was, there was no Vernal pools found for certain. [2:26:01] We could certainly get our. [2:26:04] Soil and wetland scientists to. [2:26:08] Put that into his memo, cuz [2:26:09] I, I am not re recalling him actually adding that to his report. [2:26:14] I did. [2:26:15] I didn't see it. [2:26:17] In, but I know he's been back out on site because I believe he [2:26:21] did a couple of adjustments for us. [2:26:24] Still laid up. [2:26:31] Yeah. [2:26:31] And I'm, I'm just not. [2:26:33] Finding that in this particular calendar time. [2:26:38] And we'll need to have. [2:26:41] There were a lot of comments again by U EI. [2:26:44] I on trees that were. [2:26:47] Placed in locations that either were. [2:26:51] Over utilities or there were some. [2:26:54] There were several concerns in the one of the U EI letters. [2:26:59] Well, if that's the one that came in today, I haven't even seen it [2:26:59] Letters. [2:27:01] Yeah. [2:27:02] Okay. [2:27:02] And I don't remember. [2:27:03] I, I did look at that one. [2:27:05] I don't know if the other one, but. [2:27:07] That it, it sounded like there's gonna need to be a lot done to [2:27:10] revise the landscape plan. [2:27:15] And you'll see that when you. [2:27:18] See the letter from U EI. [2:27:21] I, I don't know. [2:27:23] Let me just see [2:27:26] oh, wait a minute. [2:27:30] Three. [2:27:35] Yes, [2:27:36] it is. [2:27:36] It's on page three of the recent U E I. [2:27:40] Letter [2:27:51] I like 1, 2, 3, what was five, five different points. [2:27:56] Of trees that need to be moved. [2:27:58] And I guess, I guess in follow up to that, I would. [2:28:02] Request that [2:28:05] trees that they're seeing need to be removed. [2:28:07] If those could be. [2:28:09] And this this lot has been pretty heavily. [2:28:12] Cleared. [2:28:14] And I would like to [2:28:16] not see trees just removed and forgotten about, I'd like to see them. [2:28:20] Put somewhere else. [2:28:22] And try to re-vegetate this as best we can. [2:28:26] That's tough out back there. [2:28:27] Boy, they put somebody to sit still sitting in the. [2:28:31] Bucket and, you know, they were small trees at one time. [2:28:33] Yeah. [2:28:33] So it's that kind of a mishmash up there? [2:28:35] Yes, there's no. [2:28:37] No order to right. [2:28:38] Yeah. [2:28:55] Anything else we need to be looking at. [2:29:00] I have a question on the conservation. [2:29:02] Commission letter from August 12th. [2:29:05] 12th. [2:29:05] It's the last paragraph. [2:29:08] Thank you. [2:29:09] Are we supposed to be getting more information from the applicant? [2:29:13] On the language of the conservation land. [2:29:19] They voted unanimously that they support in concept. [2:29:22] Yeah. [2:29:24] Right. [2:29:24] They were looking for. [2:29:26] What that language would actually be. [2:29:30] The charm. [2:29:31] So isn't that something eventually comes to you, Dave, that it, well, Kristen. [2:29:37] And [2:29:38] I can't see you. [2:29:39] Yeah. [2:29:41] So that those planning board doesn't have to look at that. [2:29:43] That's something that happens really. [2:29:46] What happens? [2:29:46] Oh, you can. [2:29:47] Yeah. [2:29:47] Okay. [2:29:48] Well, no, but typically it would just. [2:29:51] Well, yeah, because we don't even know what kind, what it is. [2:29:54] It says what type of deed. [2:29:56] Easement terms, conservation boundary, correct? [2:30:00] Yeah. [2:30:00] There's a few questions. [2:30:02] So at some point I would like to know what. [2:30:05] What the crime is for the bonus is if the conservation commission is willing [2:30:10] to accept the land, you can get a bonus. [2:30:13] Mm. [2:30:13] Mm-hmm a density bonus. [2:30:14] Mm-hmm and, and they are willing to accept it in concepts, in concept [2:30:18] move along with showing a units instead of. [2:30:21] Seven one is the density bonus. [2:30:24] But yet at some point we, we need to know what that yeah, because [2:30:28] in constant Pete actually is gonna say yes. [2:30:30] Yeah. [2:30:31] So if we can get that clarified at some point, [2:30:34] yeah. [2:30:35] I mean, typically the. [2:30:37] The concert or excuse me, the. [2:30:39] Easement documents, conservation documents. [2:30:42] Those get done. [2:30:44] Once we're [2:30:45] stopping, moving trees, things of that. [2:30:47] Yep. [2:30:47] Got it. [2:30:48] Just we're we're checking off a list of what we're looking for and that [2:30:52] is. [2:30:52] Something that absolutely they were, they didn't have. [2:30:56] The information when you talked to them, I watched the meeting, right. [2:30:59] Because, and that was one of the things that got worked out at the [2:31:02] sidewalk is because we don't know if they. [2:31:04] Want [2:31:05] and conservation easement and. [2:31:08] Deed restriction, et cetera, et cetera. [2:31:10] Until we work with them and I think we understand what they're gonna be [2:31:14] comfortable with. [2:31:15] And now it's just a matter of John to get his attorneys to. [2:31:19] Draft the appropriate language. [2:31:20] Great. [2:31:20] Yeah. [2:31:22] How about number three commission also noted strong preference to adopt this plan. [2:31:27] As presented, avoiding the development of the second lad off. [2:31:31] Of McKay drive in order to preserve larger contiguous wetland and wetland buffer complex [2:31:35] without encroachments. [2:31:38] To support settlement retention. [2:31:40] And encourage groundwater recharge. [2:31:43] Yeah, that was one of the points of my. [2:31:46] Introduction Mr. Chairman. [2:31:48] And [2:31:50] while there were a couple of commissioners that were not thrilled about that, [2:31:54] the, the contingent of. [2:31:56] Planning board members. [2:31:57] Now I wasn't at the sidewalk. [2:31:58] My, my. [2:32:00] Senior engineer. [2:32:01] We noticed that John Morgan. [2:32:04] Morton. [2:32:04] He was very good by the way. [2:32:06] He said that a number of planning board members, and maybe it was just [2:32:10] a couple planning board members. [2:32:13] I don't even know how many of you were able to make it outthere. [2:32:14] But we're actually very much in favor of that. [2:32:17] Second unit out on McKay drive. [2:32:19] Yeah. [2:32:20] Because, [2:32:21] you know, it's, it is not affecting wetlands itself. [2:32:24] Right. [2:32:25] And the buffers on those two front. [2:32:28] Proposed thousands out there. [2:32:31] You know, they're, they're just, they're not in that great shape because they're right [2:32:35] next to paragraph. [2:32:36] Photograph, but anyway. [2:32:38] Okay. [2:32:38] Yep. [2:32:39] Yep. [2:32:39] We, we understood what the conservation commission's. [2:32:43] Physician was it, it just seemed that this board's. [2:32:46] Board's position or the agents that were there were, were counter to that. [2:32:50] So that's what we ended. [2:32:57] We always request [2:32:59] the marking of trees that are over. [2:33:02] 20 inches in diameter. [2:33:05] To be noted on the existing condition plan. [2:33:08] I know that this site was. [2:33:10] Cleared , but I don't know about the two lots on McKay. [2:33:15] I, I didn't notice. [2:33:16] Yeah. [2:33:16] I, I will check. [2:33:17] Can you check and see if they're in? [2:33:18] Yeah, I'll take a look at that because I, I know that. [2:33:23] That civil works is aware of that requirement. [2:33:26] Yep. [2:33:26] Yeah. [2:33:27] I I was on the sidewalk [2:33:29] could well be Glen that they, they picked him off with the survey. [2:33:33] Points, but didn't process it through text that shows up on the drawing. [2:33:37] I'll double check mm-hmm I'll mark. [2:33:38] That that would be great. [2:33:39] Yeah, you did show three. [2:33:41] Coniferous trees on the [2:33:44] existing conditions plan. [2:33:45] We thought those were them. [2:33:47] But anyway, they, they didn't identify 'em as 20 inches or better, but [2:33:51] OUS trees they're on. [2:33:54] They're on sheet. [2:33:56] Well, they're on multiple sheets. [2:33:57] They're on the lot line adjustment sheet, [2:33:59] existing conditions. [2:34:00] Yeah. [2:34:01] So I thought those I'll have exist to find out well, we'll confirm that [2:34:05] but I thought that's all that exists. [2:34:06] Right? [2:34:07] Which ones meet the 20 inches and which ones do. [2:34:09] Not [2:34:10] because we talked about that at the TRC as well. [2:34:19] Thank you. [2:34:19] Other questions, concerns. [2:34:26] No, just if we can get a response to the letter that was handed [2:34:29] out tonight. [2:34:31] You know, before [2:34:33] with time to review it before our next oh, that was this one here [2:34:35] Yeah. [2:34:36] Okay. [2:34:36] Yes. [2:34:37] We had a handout. [2:34:38] No, I'll put it someplace. [2:34:39] Oh, it's over here. [2:34:40] Yep. [2:34:45] Anybody from the public, let me open it to the public. [2:34:47] Anybody in the public like to speak about this particular project? [2:34:54] Don't all speaker once. [2:35:03] well hearing none, then we're all set with the, at this point, I'll close [2:35:06] Well, I'll leave it open. [2:35:09] So just, I know we'll probably look at the yield plan at the next [2:35:12] meeting, but just to be clear is so the yield plan dated [2:35:16] February 20. [2:35:17] 26. [2:35:18] Is that the one we're using? [2:35:21] Cause I'm only seeing [2:35:23] I'm seeing nine lots on that one. [2:35:25] And then 10 lots on the proposed. [2:35:28] But maybe I miscounting. [2:35:30] This should only be seven. [2:35:33] Well, so I'm including the two lots on the street. [2:35:36] Oh, the lots, the, the lot line adjustment lot. [2:35:38] And then the lots being carved. [2:35:39] Right. [2:35:40] So, yeah. [2:35:41] So. [2:35:41] There should be nine seven. [2:35:43] New lots. [2:35:44] Yeah. [2:35:46] And then there's eight new lots. [2:35:47] Are there eight new lots on your proposed plans? [2:35:49] Eight new buildings. [2:35:50] Yes. [2:35:50] Yes, because we're, we're proposing. [2:35:53] To enact the 10% density bonus. [2:35:57] Based on the fact that we're putting over 50% of the land in the [2:35:59] conservation. [2:36:00] Got it. [2:36:00] Okay. [2:36:01] I think I, and doesn't one of the units exist the bottom, right? [2:36:04] One you're counting as. [2:36:05] A unit in the yield plant. [2:36:06] Yes. [2:36:06] Don't you move that lot line. [2:36:10] That's what I thought. [2:36:11] Yeah, yeah, yeah. [2:36:12] Okay. [2:36:12] Yes. [2:36:13] Just. [2:36:16] So there's already one of those long units. [2:36:19] There. [2:36:19] Okay. [2:36:21] So, you know, when you get to yeah, so you get to nine, but [2:36:24] it's actually eight new ones cuz one of 'em already exists. [2:36:27] Right? [2:36:27] Okay. [2:36:28] So the bonus gets you nine? [2:36:30] No, the bonus gets you the eighth one bonus gets you eight new ones [2:36:34] Eight new ones. [2:36:35] Yeah. [2:36:35] Yeah. [2:36:36] Remaining. [2:36:36] Land [2:36:37] after subdividing off the parcel that used to have all the greenhouses [2:36:42] you could get. [2:36:43] But on top, there's already. [2:36:45] One existing. [2:36:45] So it's a little confusing. [2:36:46] I'm gonna take your work a little bit. [2:36:47] Yeah. [2:36:48] I, I don't know what happened tonight, but yes. [2:36:50] Okay. [2:36:50] Yeah. [2:36:51] I think what you need to, you know, just, just. [2:36:54] Do you like, you know, the, the, the yield plan. [2:36:57] Where the lots and the configured do they meet the zoning mm-hmm and [2:36:59] so forth? [2:37:00] Mm-hmm that's what you determine. [2:37:04] One, one really quick question. [2:37:07] On mm-hmm the lighting plan. [2:37:08] You have a light. [2:37:10] At the end of the road at the intersection? [2:37:12] Yes. [2:37:12] Is that that's not a, like a regular utility pole. [2:37:16] It's the pole Mount. [2:37:18] That you have pictured, correct. [2:37:19] That's looked at is yep. [2:37:20] Okay. [2:37:20] That's what I thought. [2:37:22] Okay. [2:37:24] What's the condominium like [2:37:27] yeah, pretty much. [2:37:31] That's it. [2:37:32] All right. [2:37:43] What's interesting. [2:37:44] Marty is [2:37:45] I talked to John Bell. [2:37:46] I was talking to. [2:37:48] D P w and they have resurfacing. [2:37:51] Brentwood road next year, and we're gonna do it this year, grind it, but [2:37:54] they thought they would tie it into what we're doing. [2:37:56] So at that point it makes a lot of sense to. [2:37:59] Work on that, that crosswalk situation. [2:38:02] Does that mean I have to drive up that bumpy road for the next [2:38:05] year? [2:38:05] Well, he's in the spring. [2:38:06] Oh my gosh. [2:38:07] . [2:38:10] It's only that short piece. [2:38:12] I think they're grinding though. [2:38:13] I did say from the, from the dam all the way up to Crestview [2:38:17] I think, and that's this year, and then they're gonna continue next year, which [2:38:20] will take it up to, so you might be all right then. [2:38:22] Great. [2:38:23] and I just read that the bridge isn't gonna be redone until right [2:38:28] 2032 or something. [2:38:30] It's way. [2:38:31] That's way off. [2:38:33] and that's a moving target as well. [2:38:34] Yeah, that's a moving target. [2:38:36] As well main target. [2:38:36] Yeah. [2:38:36] Oh, well, [2:38:37] . [2:38:39] Just what it is. [2:38:43] Okay. [2:38:44] I think about a point where we. [2:38:47] Need to continue this case. [2:38:50] Your honor. [2:38:52] Do we know where something continue to, to ask more or to what date [2:38:57] To [2:38:58] that you probably wanna talk to the applicant first couple things. [2:39:01] May I? [2:39:01] Yeah. [2:39:03] First you want, it's the, it's been six since, since it's only the second [2:39:06] meeting, but it's been, but it's been six. [2:39:09] It's been a long time. [2:39:10] It's been 60. [2:39:11] Three days. [2:39:11] So the 65 day statutory clock is up in two days. [2:39:14] So you need to ask the, you know, applicant to agree to an extension [2:39:18] which I believe the. [2:39:19] You know, they got plenty to respond to here, so, but I I'll leave [2:39:22] that to them. [2:39:23] Okay. [2:39:23] And I think you make sure you get that on the record, agreeing to [2:39:26] that. [2:39:27] And then. [2:39:28] When would you be [2:39:30] when you'd be able to turn around and get us plans? [2:39:33] Plans, you know, cuz the next, for example, the next meeting is September 10th, but [2:39:37] we need we'd need. [2:39:39] Response to all this stuff by September 3rd. [2:39:41] I mean, can you do that? [2:39:42] And so by next Wednesday, [2:39:45] That's what I'm asking or, or are you table it till September 24th? [2:39:45] yeah. [2:39:48] Yeah, that was the 24th. [2:39:51] Yeah. [2:39:52] September 20. [2:39:52] And do you okay with a, an extension to the 65 day statutory, [2:39:59] give us an extension. [2:40:00] Absolutely. [2:40:01] Thank you. [2:40:02] Okay. [2:40:04] So back show [2:40:06] there. [2:40:09] Okay. [2:40:10] Do you want, is he looking for a motion? [2:40:12] I couldn't hear. [2:40:12] Can't tell. [2:40:13] I, I, I know, I'm sorry. [2:40:14] I couldn't hear. [2:40:15] Okay. [2:40:15] So I move. [2:40:17] That we continue planning board case number. [2:40:20] 26 dash 11. [2:40:24] To [2:40:25] our September 24th. [2:40:28] 2026 meeting [2:40:29] at 7:00 PM in the Nova room. [2:40:34] Second second. [2:40:35] Okay. [2:40:35] We've got a second. [2:40:37] Everybody in favor, please say aye. [2:40:40] Aye. [2:40:40] Aye. [2:40:40] Opposed obsessions the aye heaven. [2:40:43] Thank you. [2:40:43] Thank you, gentlemen. [2:40:44] Thank you. [2:40:45] Folks ladies. [2:40:46] Oh, [2:40:50] well, at least we have the propensity. [2:40:52] Next time won't be taking. [2:40:56] You never know. [2:40:58] Yeah. [2:41:00] I don't even like myself. [2:41:01] . [2:41:05] All right. [2:41:06] Let's see now. [2:41:13] Thank you. [2:41:14] Very much. [2:41:14] Thank you. [2:41:14] Thank you. [2:41:15] Have a good holiday weekend. [2:41:17] Don't forget to vote. [2:41:19] Oh, yeah. [2:41:19] Voting day adapted. [2:41:21] Okay. [2:41:21] Master plan discussion. [2:41:23] Is there anything to discuss about master plan? [2:41:27] Nope. [2:41:27] Okay. [2:41:28] Land use and regulation on just on that beat. [2:41:31] Do we wanna schedule another meeting? [2:41:33] Our next meeting? [2:41:34] I thought you said. [2:41:36] They're going to start being on the planning board meeting day. [2:41:40] I, I, that's what I proposed that we would do that. [2:41:42] I just. [2:41:43] Are we all good with that? [2:41:45] I mean, I'll, I thought everyone was, yeah. [2:41:47] Okay. [2:41:47] Well, we haven't sent any invitations out or anything, so I'll, I'll follow over [2:41:50] here. [2:41:51] With you.Okay. [2:41:51] Now follow up with Don. [2:41:52] Yep. [2:41:53] Okay. [2:41:53] Call a meeting. [2:41:54] Okay. [2:41:55] And hopefully we get [2:41:58] a quorum. [2:41:59] Yeah. [2:41:59] Okay. [2:42:00] That's a good segue to the quorum point. [2:42:03] Is there an avenue? [2:42:06] To expand that have alternates so that corn be met more regularly. [2:42:10] I mean, is there an well. [2:42:13] I don't suggest committees are a quorum of the planning board, cuz then you're [2:42:16] not a committee anymore. [2:42:17] You're the planning board. [2:42:18] Well, I get it. [2:42:19] So as a, as a group of seven, [2:42:21] a quorum is four. [2:42:23] So you want your committees usually less than a quorum? [2:42:27] Not saying you can't do it, but usually it's like, then, then it's a [2:42:30] planning board meeting. [2:42:30] Yeah. [2:42:31] So I guess I would. [2:42:32] Meant more of like having, cause it seems like all alternates you mean? [2:42:34] Yeah. [2:42:34] Yeah. [2:42:35] Alternates. [2:42:35] It seems like the MPO C meetings. [2:42:37] Meetings come and go because of availability. [2:42:39] So if there's an alternate that could be on that. [2:42:42] I'm not sure what the. [2:42:44] Method for that to happen would be, well, it would be an adjustment to [2:42:48] the [2:42:49] rules of procedure, cuz that's where. [2:42:52] Your [2:42:53] right, right. [2:42:54] Yeah. [2:42:54] That's where it lives. [2:42:55] That's where you created the N POC mm-hmm and that's where it lays [2:42:58] forth. [2:42:58] That there's three members and. [2:43:00] No alternates are identified. [2:43:02] So you'd probably want to just, you could change that and add one and [2:43:07] I don't know, chair Mr. Chair, or if anyone knows the, the process for [2:43:10] that, is that something that happens at a meeting tonight right here? [2:43:13] Oh no, you, you gotta notice. [2:43:15] It. [2:43:15] Okay. [2:43:16] You, you, you you'd say what you want and I, I could. [2:43:19] Prepare like, you know, we'd have a dis let's have a discussion and maybe [2:43:23] the next meeting, I'll just throw it on the agenda and you can discuss [2:43:26] it. [2:43:27] Okay. And I'll be ready. [2:43:27] Yeah, that sounds great if that's yeah. [2:43:29] So just to be clear, it's [2:43:31] to, to discuss the next meeting. [2:43:34] Adding alternates to the M P C. [2:43:37] Adding NAL adding NAL the N POC. [2:43:39] I dunno how many. [2:43:40] Yeah, but then the tricky part with that is I, I didn't notice [2:43:44] I'm thinking about it now. [2:43:45] Cuz that just, you know, that first I heard that. [2:43:47] Yeah. [2:43:47] Well, if the alternate shows an all three member shows, then it's a planning [2:43:50] board meeting. [2:43:50] Mm-hmm so one person couldn't, I. [2:43:53] Mean the alternate could step out or just, yeah, just not be part of [2:43:56] the board. [2:43:57] I, I just worry about that. [2:43:58] Cuz then it's a planning, you know, like then the, then you have a [2:44:01] quorum that you. [2:44:02] Know you can, so it is just, you just avoid subcommittees having a quorum [2:44:06] of the main board. [2:44:07] I think we can consult. [2:44:07] I think that can be solved for. [2:44:10] I think it'd be worthwhile getting M POC. [2:44:13] Having a little more regularity in that meeting if the [2:44:16] bill having, having more regularity in that meeting, if an alternate. [2:44:18] Yeah. [2:44:18] I mean, they, in all fairness, they, they, they met regularly. [2:44:21] For a very long time and you know, and it, oh yes. [2:44:24] You know, so, and sometimes so I, I don't think, I think it's fairly [2:44:27] new that, you know, and it was the. [2:44:30] Summer. [2:44:30] Yeah. [2:44:30] And it's been the summer and, and so forth. [2:44:32] And there hasn't been a lot of business, you know, with, with them. [2:44:36] So, and also just thinking ahead too, to like, [2:44:38] future master plans and just making sure that that committee can work as well [2:44:40] as it can. [2:44:41] Well, future master plans is a different, different, whole different issue. [2:44:44] That's a master plan steering committee. [2:44:46] That's not the master plan oversight committee. [2:44:48] Oh, I know, but I'm saying that's okay. [2:44:49] Presuming the master plan oversight committee continues in the future. [2:44:51] If that's structured in a way to give it success by having. [2:44:55] Appropriate. [2:44:57] People on it, appropriate number of people on it. [2:45:00] Yeah. [2:45:00] I mean, I, I, you know, I mean, I'm not trying to, you know [2:45:03] argue like, but I think we've been very successful at the master plan. [2:45:06] The 2018 master plan was great. [2:45:08] We we're actually doing it again because we've either completed or. [2:45:12] Working on every, every task in there. [2:45:15] I don't know what other town ever did that. [2:45:16] So I, well, I, you know, I agree where you go and I, you [2:45:19] know yeah. [2:45:20] But. [2:45:20] Said, I, I think that was very successful, so, and we will continue to [2:45:24] be, yeah, we can talk about that next one. [2:45:25] Yeah. [2:45:26] Can I ask for a question though? [2:45:28] I just, now I'm confused. [2:45:29] Are we looking to add. [2:45:31] An alternate that we already have. [2:45:34] No that they, they ask. [2:45:35] And I gotta look into this cause I don't recommend subcommittees having quorums of [2:45:41] boards. [2:45:41] That's just. [2:45:42] No, I get it just so I'm trying to understand where the extra alternate [2:45:45] or the alternate he was asking alternate to the M P C. [2:45:49] So a three member, M POC, still three members, but an alternate to fill [2:45:54] in when a regular, one of the three regular members can't attend. [2:45:58] I got that part. [2:45:59] I just didn't know where the alternate was coming from. [2:46:01] So it's separately planning, planning, I would imagine. [2:46:03] Well, that's what I'm trying to clarify it. [2:46:05] Would've to Sam. [2:46:06] Could sorry, Sam, I'm not volunteering you, but I'm using you as a example [2:46:12] If Sam wanted to fill that, it would be somebody. [2:46:15] Already on the planning board. [2:46:16] Oh yes. [2:46:17] I forgot to say that's a great point. [2:46:19] Okay.
