the taxing bodies including allegheny
[1:03:39] county and south allegheny were also
notified as well as any judgment holders
[1:03:45] the public hearings were advertised in
the mon valley independent on october 9
[1:03:49] 2021 and all the properties were posted
with notice of the zoom meeting
[1:03:55] our mailing addresses were obtained from
the allegheny county assessment
[1:04:00] website
um i wanted everybody to be aware
[1:04:04] because this meeting is a zoom meeting
um any interested parties are not able
[1:04:09] to participate live um i know a number
of them are
[1:04:14] uh are watching the public hearing or at
least they indicated to me that they
[1:04:19] would be
but anyone who has an issue
[1:04:22] has uh submitted a letter or comments to
me and i will be entering those in the
[1:04:27] record
so we'll start with the first property
[1:04:31] 1425 washington boulevard this is lawton
block 383n007
[1:04:38] uh the record title owner
is the estate of glenn broman and the
[1:04:44] estate of eleanor broman
um i did receive a call
[1:04:49] um from an heir uh to the current donors
both are deceased
[1:04:54] um and there was no objection to the
demolition
[1:04:58] but it did wanted to um do what they
could
[1:05:02] to get uh you know some personal
property out of the house
[1:05:06] i did um
recommend that they do that sooner
[1:05:10] rather than later i indicated that we
would not be able to provide access
[1:05:14] but that um
but that they would have to reach out to
[1:05:18] a homeowner one of the homeowners
to obtain access
[1:05:22] um it's my understanding that mark
lazzaro is at the hearing this evening
[1:05:28] is that correct

job for the borough

can you describe the condition of the
[1:06:02] property uh on the exterior appears to
be completely run down and not
[1:06:07] maintained
other than somebody i don't know who's
[1:06:10] been cutting the grass but they haven't
really taken care of the weeds or the
[1:06:14] brush overgrowth
it has a deck on the rear of the
[1:06:18] property that's uh kind of dilapidated
and falling down
[1:06:22] um
i was able to get some pictures at the
[1:06:26] windows that you could see the interior
of the house
[1:06:29] and it just looks pretty cluttered up i
don't know if kids have been in there or
[1:06:32] not
uh some of the siding is falling off of
[1:06:36] the house off of the dormer
it's
[1:06:39] just all in all it's pretty well run
down and not taken care of
[1:06:43] mr lucero is the property vacant
it appears to be
[1:06:48] uh there is no electric meter in which
means there's no electrical power there
[1:06:53] there's no gas meter on the property so
again there's no gas service for heat
[1:06:59] yeah
the water
[1:07:02] uh based on the fact that there appear
to be no utilities
[1:07:06] um is that property inhabitable
that's correct
[1:07:10] so it is uninhabitable

[1:07:16] does this property create a safety and
health hazard to the community
[1:07:21] it does because of
being open able to get in the property
[1:07:26] it seems like the back door is kind of
like loose in a jar that kids can go in

and it's the safety hazard the fire has

that uh mr craig broman did contact my

objection to the demolition of this

um mr chantos did sign

had previously indicated that he was not
[1:08:39] going to take any action with regard to
the property
[1:08:42] um
i will i have received a communication
[1:08:46] on this property but i'm going to
have mr uh lozaro testify as to the
[1:08:51] current condition
so i'll ask you again mr laurel um mr
[1:08:56] lazaro um and just to confirm uh you are
mark lazzaro and you are the property
[1:09:01] maintenance inspector for the borough
port of view correct
[1:09:04] that's correct
and are you familiar with the property
[1:09:07] at 1801 new york avenue yes i am
can you describe the condition of the
[1:09:12] property
it's in pretty poor rundown condition
[1:09:16] and if i recall correctly i believe it
was two to three years ago i met with mr
[1:09:21] chantos
because
[1:09:23] there was question about demolishing
this year ago
[1:09:26] and he
taken me through the house and i walked
[1:09:29] through the inside of the house and it
was pretty much full of garbage
[1:09:33] and he had a plan that he was going to
rehabilitate he was going to put it back
[1:09:38] together and apparently he didn't follow
through with any of it
[1:09:42] because today it's just about the same
condition as it was three years ago
[1:09:46] whenever i took photographs of it
[1:09:50] and um mr lazaro did you issue an
inspection report with regard to this
[1:09:55] property
[1:09:59] to the burden yes i did okay and and how
did you rate this property in terms of
[1:10:04] priority
i put it as a high priority
[1:10:07] okay and and does the condition of the
property impact homes in the
[1:10:11] neighborhood
yes
[1:10:15] and does the property create
growth on the property
[1:10:20] which is actually kind of consuming the
building at this point
[1:10:24] okay does this property create a safety
and health hazard to the borough port
[1:10:29] view yes it does

[1:10:32] um i i do want to enter into the record
uh copies of mr lazzaro's uh inspection
[1:10:39] report on this property and for all of
the properties i don't think i asked
[1:10:43] about the report on 1425 washington
boulevard but we'll be um adding all of

um also entered into the record at this
[1:10:53] time is a a letter that i received from
a gentleman trevor osgood and i'm going
[1:10:58] to read it into the record and a
physical copy of it will be included

i have recently purchased the property

personal letter from mr chantos that
[1:11:37] might change some light
on his personal circumstances
[1:11:40] surrounding the condition of the
property
[1:11:43] bro understands his outline in the
inspection report provided by mr lazaro
[1:11:47] from allegheny building consultants who
i would like to add that i have also
[1:11:51] made contact with and indicated he is
supportive of rehabilitation of the
[1:11:55] property under my plan
i would know mr chantos no longer is
[1:11:59] involved in any construction planning
and is no longer the title owner again i
[1:12:03] am the new title owner of 1801 new york
avenue and port view
[1:12:09] i will say that when we did our title
search
[1:12:12] uh if mr chantos was still the owner i
met the borough manager melissa mcglory
[1:12:16] that indicated that burroughs eagerness
to find a swift resolution to the
[1:12:20] property because of the blight and the
time frame of two months would be
[1:12:25] wanted slash expected under my plan
concerning the most pressing repairs the
[1:12:29] borough once fixed namely stages one two
and three in my general contractor's
[1:12:34] enclosed plan
i'm emphasizing the main concerns which
[1:12:37] i've observed to be the front porch and
first story roof
[1:12:40] permits will be obtained and work
performed through
[1:12:43] that of my general contractor mitchell
spark through his company new spin
[1:12:48] design builders that is highly capable
of general construction
[1:12:52] and the preservation of historic
properties
[1:12:54] mitchell sparks general contractor
licenses and he gives us the license
[1:12:58] number the entire renovation we plan to
complete within eight months while
[1:13:02] prioritizing the non-compliant issues
most urgently according to the borough's
[1:13:07] deadlines
my intentions for this property are
[1:13:10] quite sincere and i am highly motivated
to comply with the borough
[1:13:14] and make further
renovations to pass an occupancy
[1:13:17] inspection
is i intend to make this property my
[1:13:20] personal residence and have titled the
company in my personal name instead of
[1:13:24] my company name to demonstrate this
for this end i've already made a good
[1:13:29] faith advanced payment of seven thousand
nine hundred fifty dollars to my general
[1:13:34] contractor mitchell sparks whose
services are now retained
[1:13:37] right now we are in the process of
winterizing the property and emphasizing
[1:13:41] any immediate repairs to comply with the
borough i am local and live in glassport
[1:13:46] and my general contractor lives in west
mifflin so we will be actively on scene
[1:13:50] at the property making the necessary
improvements and maintenance
[1:13:54] again please don't hesitate to contact
me during or after this hearing for
[1:13:57] clarity on anything
this plan is malleable should the
[1:14:00] borough have any other timeline
expectations and my general contractor
[1:14:05] has expressed to me that he will work
with the borough's deadlines you have
[1:14:08] our full cooperation on this matter give
us any deadline milestone in this
[1:14:12] project and i promise we shall meet it
to conclude i therefore strongly
[1:14:17] remember recommend the council to not
condemn and demolish my house i fully
[1:14:21] understand and respect the position of
the borough council has been awaiting
[1:14:25] action
on this property from the prior owner
[1:14:27] considerably longer than i've owned it
and i
[1:14:32] seek to rectify this i'll add that the
taxes are current and will remain
[1:14:36] current under my ownership thank you for

had done research on the historical
[1:15:08] importance of the property to this
and should be saved

medical issues and he at this point is
[1:15:18] unable to do it also attached is um
a proposal from the contractor which
[1:15:25] itemizes the work that is to be done
just to summarize the front porch repair
[1:15:31] uh 3 600
general roof 16 000
[1:15:37] um grounds clean up
weed control and clean up twelve hundred
[1:15:41] dollars interior removal furnishings
debris trash ninety five hundred
[1:15:49] um
and he'll be responsible for the
[1:15:52] dumpster
so i i will say that mr osgood has put
[1:15:56] together a a lot of information on this
um
[1:16:00] mark lazzaro apparently has also had a
conversation with him mark can you
[1:16:04] provide any confirmation on that
i have not had a conversation oh you
[1:16:09] have not
no and i we have not to date received
[1:16:13] any um
application for any building permit to
[1:16:16] do any of the repairs
no and and he you know uh frankly i
[1:16:20] advised him not to
move forward with the building permit
[1:16:25] until council made a decision

yeah he has not reached out to me in the
[1:16:31] form of a phone call anything like that
i have no documentation of
[1:16:35] anything going on with this property for
several years

um and it was still the uh mr chantos

he's apparently you know gotten someone
[1:18:01] lined up you know there are a couple of
different options one option
[1:18:05] is to postpone taking action on the
condemnation
[1:18:09] and um
requiring mr osgood to meet with
[1:18:14] mr lazaro in the next i would say 10
days
[1:18:18] and um
and and give him a period of time to
[1:18:24] complete
uh correction of the building code
[1:18:27] violations
and
[1:18:30] so when do we do this when do we give
him permission or what do we do do we
[1:18:34] make a motion
um yeah i mean what we could do
[1:18:38] and we would do it at the public part of
the meeting
[1:18:41] properties that you want to move forward
with the condemnation of are part of one
[1:18:45] motion okay
and in the event that you uh what i
[1:18:49] would just simply do is make a motion to
postpone
[1:18:53] action on the condemnation of any
property that you want to put a hold on

has this process i'm sorry has this
[1:19:42] property under agreement

[1:19:45] and i did forward a copy of
mr lazaro's report to this property
[1:19:52] owner i don't think um i did receive a
a message
[1:19:57] i'm going out of order on this but my
one of the messages is on my phone and
[1:20:02] i'd rather read it into the record

the manager of canary lion llc
[1:20:12] will be purchasing the house located at
1106 monroe avenue in fort view
[1:20:17] i am aware of the repairs required by
the city to bring it up to code
[1:20:22] and i intend to purchase and correct all
the problems with due diligence in a
[1:20:26] timely manner

a lot of junk in the backyard
[1:21:31] building materials junk on the back
porch washers dryers
[1:21:36] you know appliances
building materials

of course the porch roof is collapsing
[1:21:42] on the back of the property
is this property vacant
[1:21:46] it appears to be
with no way to get into the property i
[1:21:50] would have to assume that it's taken
are there utilities to this property the
[1:21:56] electric was not hooked up i mean there
is power to the meter
[1:22:00] um that i saw there like
there is an electric meter in there but
[1:22:05] the power i don't believe is turned on
because it
[1:22:09] shows a bunch of lines on the meter
which usually means that it's
[1:22:13] disconnected
is the property presently inhabitable
[1:22:18] correct
it it is not inhabitable
[1:22:22] it's not habitable at all okay

[1:22:26] does this property create a safety and
health hazard to the community

uh mark is this a property that can be
[1:22:34] rehabilitated since this individual has
indicated that he intends that that

then they're better off being torn down

[1:30:30] roof
is all leaning over
[1:30:33] the backyard is full of debris
construction debris pallets block
[1:30:38] empty barrels
[1:30:43] tarps
and it appears that nobody is living in
[1:30:47] this property either
because again access to the front door
[1:30:51] front porch the back porch
were completely overgrown
[1:30:57] okay is the property vacant to the best
of your knowledge
[1:31:01] from what i can tell yes
and and do you believe it to be
[1:31:05] uninhabitable
correct
[1:31:09] does it create a safety and health
hazard to the community

especially the

from an attorney um

uh this property is uh scheduled for

share of sale the first monday in

uh her name is caitlin donnelly and i
[1:31:43] did speak with her let me read into the
record her communication
[1:31:48] ms mcgrail thanks again for taking my
call earlier as i stated i looked at a
[1:31:53] property inspection from october and it
looks like there was a tree that fell on
[1:31:56] a garage my client removed the tree but
was advised by hud that it could not
[1:32:01] remove the collapsed garage and to file
an insurance claim on it so this was a
[1:32:06] property with a hud mortgage
i have not heard back from them on a
[1:32:10] response from the insurance company
i did misspeak earlier because i saw
[1:32:14] that hud had approved the removal of the
debris but it has not been done yet only
[1:32:19] the tree removal we are recommending our
client go out and remove the exterior
[1:32:23] debris immediately
i am requesting that this hearing be
[1:32:26] adjourned if possible we only just
received notice of the hearing yesterday
[1:32:31] because it got to the owner and then got
to them late
[1:32:34] and do not have an attorney available to
cover we're attempting to line up local
[1:32:38] coverage but are not sure if he'll be
able to assist on such short notice
[1:32:43] we do have a share of sales schedule for
this property in december i am hopeful
[1:32:47] that this may proceed to sheriff's cell
and we can either address the rest of
[1:32:50] the issues with the property once my
client is in legal possession of the
[1:32:54] property or a third party will purchase
and work more closely with the community
[1:32:58] to rehabilitate

and so they're hoping of course that a

the sheriff's sale

the bank will bid in

name
[1:33:35] but there is absolutely no guarantee of
that

they would owe the taxes and they would

my concern is that they would not bid in
