[8:50] and the way we started with the whole problem with the daniel convenience store -- [8:58] first of all, we do appreciate the business. We love that daniel is there as a convenience store for our kids. For alcohol and other [9:08] things, we don't miss. We don't miss that the homeless people that were [9:13] there, feeling that safety is a hazard to our students. I'm vouching for our [9:21] students and staff. We know they are going to go to the convenience store during school hours, which is not appropriate. But, at the same time, we [9:29] want them to go to a safe convenience store and come right back. [9:35] where there's no alcoholic beverages or anything that makes community members stay in a facility there. Because we had a lot of homeless there and once we [9:42] ended up taking it away and them having to go through the whole zoning process and [9:47] everything they had to do, we saw a lot of decline. The students having to feel [9:54] threatened and the safety came back. I'm talking about safety because I am one of the elected officials for the saisd, so I'm elected by [10:03] these students. I talk for the students because they're not age yet [10:08] to vote but they're the ones going through the path, showing that it is unsafe [10:14] for them to have alcoholic beverages there. But we do love that daniel [10:18] reopened. We do. We miss them. We miss the convenience of being a small convenience store. [10:25] we just don't miss all the bad stuff that comes with it. [10:30] and it was a big fight and we would love to keep them there, just without an [10:34] alcohol license. And it's for the safety of our kids that are at jubilee [10:40] and h hopefully soon, coming back to rhodes. Thank you for hearing us [10:46] out. At the end of the day, it's the safety of our kids and the community there. At the end of the day, we can't take our kids away [10:53] from where they're born. Have been a proud member of district 5 for a lifetime, [15:56] which is about 75 years. I am a former zoning commissioner and a former [16:03] planning commissioner for the city of san antonio . And I'm here today on this [16:10] case, which is, for the record, a major site plan amendment. [16:15] and the way that it is stated and structured is that it is a zoning case, [16:21] which has led to a lot of misinformation, misunderstanding, and [16:28] opposition to this case. Now, this is a project that was started in 1923 -- or [16:41] 2023, I beg your pardon. Three years ago. The owner of the property, [16:46] subject property, is mr. Reyes alvarado, who has operated texas truck shop [16:54] for close to 50 years. The business came into existence in 1983. [17:08] now, this is for a conditional major site plan amendment. [17:15] in 2016, city council at that time approved a conditional use for that [17:24] property and a down zone from a c-3 at that time to a c-2 na, which mr. Reyes [17:35] alvarado supported and agreed to. So it was changed from a c-3 [17:44] na to a c-2 na conditional use. In february of 2023 is when [17:50] he applied for a commercial project, which was to improve the current location [18:00] and operation. In october of 2025, I came into the project and since [18:06] then I've been the project manager and liaison. We submitted all the [18:14] paperwork, major site plan amendment, all the different permitting. [18:19] and then in april of 2026, it was discovered that we needed a change in zoning. [18:26] and again, it's a misnomer because it's not a change in zoning. [18:32] it's going to be the same zoning it currently enjoys and it's going to be a major [18:38] site plan amendment. Since then, we have appeared before the zoning commission -- [18:48] >> viagran: mr. -- >> I want to say that staff recommends approval. There have been a number of [21:23] continuances and attempts to compromise and, you know, there is one issue at hand is the need to increase the size of the bays. There's two other major [21:31] things that are happening with this amendment. One would be doubling the number of bays and tripling the footprint of the site from 5,000 square feet to [21:41] 15,000 square feet. This neighborhood, east gate are dealing with two major [21:46] things now. One is the increased industrialization of our community and of our neighborhood. But then just a new feet [21:54] away, right across the east houston street, is the ice detention facility. [21:59] they right now are navigating development that is not favorable for their [22:04] community as well as not going to be conducive for future growth and for the types of amenities they want to see. Today I will be requesting [22:13] denial and standing with the neighbors on this case. I move to deny. [22:18] >> viagran: we have a motion and a second. The request has been amended to include not only the na, [25:15] the alcohol restriction, but also the nr for no external sound machines or outdoor [25:19] live music to protect that. The owner has also agreed to a lighting pole size [25:26] restriction of no more than 20 feet. We have a letter of those [25:30] conditions as well as the amendment, for the record. I'm honored to be here today to represent not only myself and my property but that of almost 30 families that live in this area. [26:34] basically what's happened is there was an unrepresentation or [26:40] misrepresentation by the hoa because the hoa did not do due diligence by knocking on [26:46] all the doors. I'm 73 years old. I have hip replacement but I did do that in 100-degree heat because I care about our neighborhood and I care [26:54] about the preservation of our neighborhood. The mayor and -- my slides, [27:00] please. The mayor and city council decides the shaping of our [27:06] neighborhoods, preservation for our future. You'll see in some of the maps in just a moment that this project, even though it has a 20-foot buffer zone, [27:17] it is going to be abutting the back fences of all of these neighbors. These neighbors are incensed that this project is moving forward. [27:27] the problem is that it's currently zoned c-1, which is light commercial. [27:32] they want to take it to heavy commercial. And it isn't just the fact [27:37] that that's going to happen. If that were not enough, what happens if the [27:46] pickleball and racketball courts go out of business? Now you have opened a [27:51] pandora's box on businesses that can go in there. But almost 30 families, [27:55] their lives, their heart, their soul depend on preserving our neighborhood [28:02] and we are coming before you to beseech the city council and mayor to please take [28:07] note of all of these petitions that you'll see in this slide presentation [28:14] today. Our neighborhood is primarily 99% low density [28:22] residential. My seven acre property is zoned np-10, which is a [28:27] higher level neighborhood preservation district. As is four or five just to the northwest of my property my parents worked hard to get that designation because [28:36] they wanted to preserve the neighborhood. Allowance of a rezoning of a [28:42] proposed project to commercial 2, which is heavy commercial, severely [28:47] disrupts the character of the neighborhood. It would be extremely [28:52] disruptive, not only to the residents because the operating hours proposed are [28:56] 7:00 in the morning until 10:00 p.m. That's 15 hours of traffic. [29:03] and if you have looked at the proposed project, the perimeter is all parking. [29:07] that means people firing up their engines from 7:00 in the morning until 10:00 at [29:13] night and that's a little bit much for somebody's back fence. [29:21] it's also not only extremely disruptive to the residents because of the operating [29:26] hours but also the wildlife and its habitat. Because we have engaged [29:32] species that are living in the area. We also have those four [29:36] acres have a lot of heritage oak trees on them, on that property. And I know it's protected by the city's tree ordinance. However, how will that be [29:45] handled? Will they be bulldozed down for these buildings and then [29:52] pavement everywhere? What about the heat island effect for all of the neighbors? What about the flora and the fauna that we're supposed to [29:59] try to preserve? Very concerned about that. The other thing is that at a [30:08] previous meeting, cosa's zoning staff recommended denial, denial of this [30:13] upgrade to commercial 2. The reason being: inconsistent with low [30:20] density residential and the flooding issues. You're going to see those [30:25] pictures in just a minute. Problems the neighbors have with this c-2 upgrade. [30:31] flooding, because the property is in the floodplain. Operating hours -- 15 hours of noise. The light intrusion at [30:40] night. Right now we have dark skies there. Noise pollution, real estate devaluation, heat island effect, traffic congestion. [30:54] on saturdays the traffic backs up for a mile heath road to grissom. [31:03] there's air pollution and if you plow down the trees, they help purify the air so [31:08] you're going to have more air pollution. Not only from the trees being gone but you're going to have all these engines firing up all the time. [31:16] the tree ordinance are issues because if you get rid of them, you know, what [31:21] does that do for the neighborhood? If you mitigate and plant someplace else, that doesn't do one thing to preserve the integrity of the [31:30] neighborhood. It also is going to disrupt the neighborhood's peace and quiet. But most importantly, of all of the things I just [31:38] mentioned, the most important thing is that it is inconsistent with current [31:48] low-density residential and inconsistent with neighborhood preservation code designations. We either honor the codes or we low them out the window. [31:58] that's what we're looking at here . Flooding impacts the [32:03] neighborhood again. This picture that you see is heath road . [32:07] you can't tell. It looks like a river, doesn't it? Look at that. Heath road is the middle third section that's there. [32:15] all the rest is flooding. This is from july 4, 2026. So heath road is completely [32:25] under water. Oh, by the way, right here -- let's see. [32:30] is this working? All right. It's not working. [32:38] >> entrance to this project is. It's really important. This project is -- okay. [32:46] you see the light pole on the far left? The light pole on the far [32:54] left, about 5 feet beyond that is the driveway going into this project. [32:59] I wonder how many people are going to play racket ball and pickleball with that [33:04] condition. Oh, by the way, it's a little over 4 acres of [33:10] impervious pavement that they want to put there. What kind of sheet runoff are you going to get from all the water that comes through there? [33:19] next slide, please. Flooding on heath road, july 4th, another picture. [33:23] does it make sense to approve a proposed project with 4 acres of impervious [33:32] pavement and impervious rooftops in a floodplain? Why would anybody vote to [33:36] increase the propensity for flooding? Next slide, please. [33:41] this is a map of the area. However, to show it appropriately, we really [33:49] need to look at a bigger, wider view. But the reason I chose this [33:54] one is if you look up where the red is, the proposed project -- I wish this was [34:03] working. Anybody know how to fix this? [34:11] >> viagran: it's not a pointer. He's moving the slides. >> well, it isn't that. It was working earlier. I don't know. [34:31] but anyway, let's see if we can get this one working. Okay. [34:46] that area there, a little bit -- go about an inch more. [34:51] those houses right in there, their houses got flooded. Their backyards were [34:56] completely under water so it does not make sense to put more impervious pavement [35:01] when people are already suffering because of the flooding in the area. [35:08] if you look at -- it's kind of a maroon color, if you look just below it, that's [35:21] the back fence of all of those people. We are requesting to [35:30] preserve our neighborhood. On june 16, a member on june 16. >> viagran: just one more [35:35] comment to wrap up, please. >> he said it would be to allow a c-2 designation [35:43] would be a slap in the face. Even emily -- one how, 26 minutes, 51 seconds into the [35:51] meeting said the project was not consistent with low-density residential but [35:57] planning approved it. Overall, I know there are a [36:52] lot of concerns in the area relating to the flooding issues and leon creek. [36:58] those are issues we're going to have to address with larger projects in the [37:02] public realm to make sure we're mitigating the flooding further up. [37:17] what I appreciate about the conversations that have been had, particularly with the applicant, with emily, is looking at amending this particular site as much as [37:26] possible to address the issues. Whether or not this goes [37:30] through, whatever project goes in here, it's still going to require significant [37:35] work with public works and the stormwater division to address impervious cover [37:39] along with concerns about flooding overall. I'm appreciative of the [37:45] applicant's making sure alcohol will not be present on site and noise restrictions will be there as well, and of course their continued efforts to reach [37:53] out to misty oaks hoa to ensure this project would remain a pickleball court [38:01] even if it were sold in the future. That needs to be negotiated between the applicant and the hoa but it is my understanding the applicant [38:08] will continue to do that work beyond this vote today. Given the issues raised and [38:13] given some of the issues that folks have raised as alternatives, I'm going to [38:19] motion to approve as amended with the current restrictions on site. I encourage the neighbors to continue reaching out to our office as well as the hoa to [38:28] hopefully have a better conversation to make sure this site really works for [38:33] our community. >> is that a motion to approve? >> galvan: motion to approve with conditions. >> is there a supermajority? Neighbors have watched this business grow from [43:02] inflatable castles to now providing mechanical rides for the fourth of july celebration at woodlawn lake. On paper this does not meet [43:09] the typical use intended for this corridor but we believe that the social and economic impact of this business will bring -- continue to be positive for our [43:19] neighborhood. I also would like to recognize the applicant's willingness to work with their immediate neighbors and neighborhood [43:27] associations in addressing concerns. These include limiting the footprint of the business to only house equipment and small trucks. [43:35] removing large rides from the property. Creating an 8-foot screened fence, and improving the entrance of vehicles to prevent traffic buildup on [43:43] zarzamora. My name is zach salazar. [45:38] we ask that the city reconsider our request for a spray booth. We have worked hard to build a business that serves our community with honesty and [45:46] integrity. To show the support we have for those around us, we have gathered signatures from our neighboring residents and surrounding businesses. [45:53] all of whom support our request for a special-use permit. We would like to clarify an important part of our situation. [46:00] code compliance did not discover our business operating without the proper permit. We came to the city because we wanted to make sure we [46:07] were doing everything the right way. When we realized our certificate of occupancy did not allow us to continue operating our collision shop [46:16] as intended, we sought guidance from the city. Our goal has been to operate [46:21] legally, responsibly, and with integrity. We believe our request may have been denied because it appeared we have been caught painting vehicles without a [46:30] permit. That is not what happened. We chose to come forward voluntarily because we believe in following the rules even when it is [46:37] difficult. We could have continued operating and hoped to not be noticed but that's not the kind of business we want to be. [46:43] we chose honesty and compliance because it's the right thing to do. Today our business supports five employees, each who have families that depend on [46:52] this shop and for their livelihoods. A decision to approve this [46:56] permit is about more than just a spray booth, it's about supporting local [47:01] families and allowing a small business that is trying to do the right thing to continue serving this community. We understand that the [47:07] city's responsibility is to protect the surrounding neighborhoods and we fully respect that responsibility. This is why we have asked to take the time to speak with [47:16] our neighbors and nearby businesses who have expressed support for our operations. We have committed to continuing to operate safely [47:22] and responsibly in full compliance with all city requirements. We sincerely hope that you will consider not only our request but the integrity [47:30] with which we have approached this process. We respectfully ask for you [47:34] to reconsider and approve of our special-use permit so we can continue serving our [47:39] community, our customers, and supporting our employees. [49:21] I invited them to our facility freshly spraying a vehicle and asked her to [49:29] step inside. She took a breath and didn't smell anything. [49:36] I think that's what the opposition is for, the smelling of fumes. I have had both of those people come forward and have actually had their vehicles [49:43] repaired at our facility. We have actually tended to that neighborhood on a [49:47] couple of other neighbors as well. If at this point -- I don't know if there's a follow-up letter or notice signed or filled out, but as far as [49:55] I'm concerned, everybody's on board and the two people that were opposed have brought their vehicles in for service. >> mckee-rodriguez: thank [50:11] you.
