Now if [2:12] you'd like to come up please do so. Okay. Not say anyone then I will close that [2:19] item. [2:23] The next item on the agenda's special presentations. We have a [2:27] proclamation declaring September 2026 as united is the wave month and I do have a [2:34] I was wondering, I was wondering, I'll read this, and then you can come up, and I'll take [2:45] a picture, if you're good with that, and you can address the podium, you can say anything [2:50] you would like. [5:07] Council [5:20] the next item when the agenda is a consent agenda and you'll see there's several different items [5:26] If you have any questions about those six seven seven different items [5:32] We can pull them off and discuss them individually [5:36] Otherwise, there's no questions [5:38] We're going to turn emotion [5:44] Mr. Mayor Holanda motion that we approve the consent agenda as presented [5:49] We have a motion by Councilwoman [5:53] We have a second by Councilwoman Tisdale. Any other discussion? All those in favor, please raise your hand. [6:04] Here is unanimously. Thank you. [6:11] The next item of the agenda is item 10 public hearing. [6:14] We actually have two public hearings and we will address them separately. The first one is conduct a public hearing [6:20] We remember requests for a zoning change from agriculture to life industrial of approximately 83.95 acres of land located on County Road 200, approximately 1,853 feet west of I-35. [6:42] This is a piece of property that's right out on the county line. [6:48] So it sits within the city of St. Louis jurisdiction. [6:51] This is what some of you may have heard and was purchased as a value purchase. [6:57] This particular portion does fall within our city limits. [7:01] So they are looking to move forward with an industrial development on this site. [7:04] and this is just it's automatically ag when we take it in so we have to [7:11] rezone it from ag to industrial so that is exactly what this is doing and it [7:16] does make the future okay anyone wishing to come forward to speak either [7:21] four or against this please do so now not [7:30] seeing you want to come forward I will [7:32] We're going to close the public hearing at 7 o' 7. [7:44] Moving forward, agenda item number 11, conduct a public hearing on ordnance number 09-30-26. [7:53] An amendment to ordnance number 10-18-24 exhibit A, redway impact fees and setting a new collection rate will open that public hearing at 7 o' 8. [8:07] Okay, [8:10] this is actually pertaining to our roadway impact fee that we adopted just recently. [8:16] We've had about a year to work through that roadway impact fee. [8:19] It's all based on plating dates. [8:21] So in the beginning, we didn't see any of these new rates because all of the planning was [8:26] done prior to this new study coming in. [8:29] Now we're to a point where we're seeing those new flats come in and those fees have stopped [8:36] a couple of our projects just did in their track. [8:39] When we first presented this, the consultant that came down recommended that we adopt this [8:47] at a 50% fee. [8:50] Planning and zoning also recommended the 50%. [8:53] Council chose to go ahead and adopt that at 100%. [8:57] So when you look at it, we have the residential fee per service unit at 922. [9:03] That doesn't mean that it's $922, that's the fee per service unit. [9:09] So depending on the house and what it's doing, I believe this fees $4,544, $400 about that. [9:17] The same thing with the non-residential fee, depending on the use, one of the recent ones [9:23] that halted in production was $300 and something thousand dollars for the redway impact fee. [9:28] That's about double what they did vegetative for that project, so it halted that project. [9:34] It also halted a fast food project that was really expensive. [9:38] So, we went back to the consultant and talked to them a little bit about it. [9:41] And given the fact that in most cities, we did do a lot of research around us as well. [9:47] Most cities adopt between 40 and 60. [9:49] We did not find one city at 100 percent. [9:53] So we're coming back to you guys to look at maybe amending that fee. [9:56] and the proposed exhibit be would just cut the original fee in half because we're recommending 50%. [10:04] What did you say that the others you said 40 to 60? [10:09] Yeah, we didn't find anybody. [10:11] No. [10:12] Anybody at 100. [10:14] And so like I said, we haven't seen any issues with that up until just recently because we are just now recently seeing those plated properties. [10:22] So we have written the ordinance in a way that it would take care of some of those properties that have not been permitted. [10:29] They may have been platted, but they have not been permitted. [10:31] So the ordinance is written in such a way that those developments that are on hold would steal benefit from this ordinance. [10:37] So the ones that are permitted, can they pull back an argument and ask for a refund? [10:43] No, I don't know if they could pull back and then read. [10:45] but we're in the public hearing so let me let you finish and let anyone and when [10:53] the item comes up we'll address that. Anything else? Okay anyone wishing to come [11:00] up and speak either forward against this item please do so this time. [11:09] Not seeing [11:10] anybody come forward we'll close the public hearing at 7-11. [11:28] All right council [11:28] First of all, move to the next portion of our agenda, which are action items. [11:34] Item number 12, consideration of possible action on ordinance number 09-29-26 request for a zoning change from agriculture to live industrial of approximately 83.95 acres of land located on County Road 200 approximately 1,853 feet west of I-35. [11:58] so this is that side that we talked about in the first public hearing it was [12:02] slated all along to an industrial site that's what they're requesting that it [12:07] be and they're going to build an industrial warehouse that's the intent we did [12:11] send out a public hearing notices we received one in favor did I understand [12:18] right and I know you said this before that anything that comes in automatically [12:23] goes to agriculture. Any time we annex the new property, it's annexed with agricultural [12:31] stuff. [12:35] Any other questions? Council. You just got one response back in favor of nothing. [12:42] Nothing opposed. Nothing opposed on this side. [12:49] Mr. Mayor, I'll make a motion that we approve [12:52] The ordinance number 09-29-26 has presented. [12:57] We have a motion doing your second. [12:59] Second. [13:01] We have a motion by Councilwoman Newton and a second by Councilman Burris. [13:07] Any other discussion? [13:09] All those in favor please raise your hand. [13:12] Here is unanimous. [13:20] I don't remember 13. [13:21] Consideration and Possible Action of ordinance number 09-30-26 [13:26] and amendments who ordnance number 10-18-24 exhibit a roadway impact fees and [13:33] setting a new collection rate. So like we spoke about just a minute ago, we're [13:39] just requesting that we re-adopt that fee at 50% which would take it half of what [13:44] it currently is. And the two businesses that are currently on hold that fee is [13:50] They would move forward with their projects if that weren't the thing. [13:55] May the council to this is a reminder, the CID committee did review me, [14:01] yes. [14:02] Secondarily, at part of the law before the committee. [14:06] Yes, and the CIS committee also recommended approval at 50%. [14:12] So, Mary, I'm just a quick question because I saw something on a fee schedule. [14:16] this is not it. I think it's down at the very bottom, the fee schedule. [14:26] Before we get [14:26] to 20, I just saw one minor discrepancy. We're not there. I corrected myself. The fee, [14:37] I remember fee schedule jumped out. The fee schedule will be adopted, the fee schedule will be [14:41] it meant it to reflect that. [14:43] Currently, the piece is getting reflected [14:45] what current fees all, which is 100%. [14:48] But this is just setting a new collection rate. [14:52] It is. [14:53] And nothing else in the study changed. [14:55] There was no other changes made [14:57] other than that decollection rate. [15:00] Any questions, ma'am? [15:04] I want you to play here. Mr. Mayor, I'll make a motion that we approve [15:09] the action item. Number 13 has presented. We have a motion done here, a second. A second. [15:17] So we have a motion by Councilman Jan and a second by Councilwoman Tisdale. Any other discussion? [15:25] All those in favor, please raise your hand. Here is unanimously. Thank you. [15:34] Item number 14, [15:35] consideration and possible action on resolution number 2026-10, accepting a [15:42] petition to create the triple-T ranch public improvement district within the [15:48] extra territorial jurisdiction of the city of Saint-Eurotaxes, calling a [15:53] public hearing and authorizing the issuance of no disregarding the public [15:58] hearing. So basically what this agenda I was doing is making you aware we [16:04] received a petition for PID and requesting permission to go ahead and post [16:08] public notice and move forward with bringing that to you all at Council. [16:13] So just unclear this is not a proving of that it's a proving staff to move forward [16:18] with everything they need to do in order to bring it to us correct correct that is [16:23] correct and this is the the PID that's out by the lake so you see a little piece of [16:28] that as they stick out there, a lot of that border's core land, so. [16:33] And that is all north at 4.55. [16:36] Yes, sir it is. [16:40] And really, really petty, almost administrative comment that in the exhibits in the packets, [16:50] that is not legible. [16:53] You almost can't see the red, I think it's a red line to picking the action. [16:57] I don't know if that matters for all of prosperity. [17:01] I'm sure you guys have a much cleaner copy. [17:03] I just wanted to say that what was in the packet [17:06] was just really, really hard to read. [17:08] And if sometimes uploading it, [17:09] it will lose some of some kind of resolution. [17:12] You can get it into such a large set. [17:14] Totally fair. [17:15] Just wanted to make sure that whatever, actually. [17:19] And you get it up in the final. [17:20] Part of that touch is, you know, [17:22] part of it also touches 11, 9. [17:23] Thank you. [17:24] Right there. [17:24] Part of it touches what, bring it? [17:29] This is where $11.90 looks all from $4.55 so you have to go to the emergency room and then this is your name. [17:39] Do you know where that ambulance has stopped? [17:41] Yeah. [17:42] It's a little bit further than it is. [17:44] So it's nowhere near McLean. [17:47] No. [17:48] No. [17:48] No. [17:49] This is north side. [17:50] No, it's the other side of the new appeal. [17:52] Yeah. [17:53] Across $35. [17:54] I mean, $4.55 more. [17:55] I was saying, you need no rise to the left side of this. [17:58] Yes. [17:59] Uh-huh. [18:02] You have to go to the morning to get to this. [18:04] And there is nothing on any of that property. [18:07] You just all vacant land. [18:10] Any other questions? [18:14] Mr. Mayor, I'd like to make a motion. [18:16] We approve resolution number 2026-10. [18:20] Do I hear a second? [18:22] A second. [18:24] So we have a motion by Councilwoman Newton [18:28] In a second, I count someone in Tisdale, any other discussion. [18:33] All those in favor, please raise your hand. [18:36] Here is unanimously. [18:38] Thank you. [18:44] I don't remember 15. [18:45] The consideration, possible, action to accept the written request for annexation from [18:50] Triple T Farms LLC for approximately 387 acres of land in the RBB Survey, A-29, [19:03] and the [19:03] 792, generally located east of Union Hill Road, west of Jones Road, north of Farmer Market [19:11] Road, 1190, and south of Lake Threy Roberts Drive, [19:17] and Call of City Council annexation [19:21] public hearing to be held on October 5th, 2026. [19:26] That is correct. [19:26] This is part of that same triple T development. [19:31] What they've done here is they're just simply asking for a public hearing request for annexation and annexation and the PID. [19:39] All of those items would come before you all on October 5th. [19:44] The survey, these are all part of the steps and the processes involved in our PID process. [19:51] And following the local government code, all of these are things that call. [19:56] This one may be a little unusual in the sense that there is an annexation involved. [20:03] Your city, unlike some, we request day one annexation. [20:08] A lot of cities are not doing the day one annexation. [20:11] They're letting the bomb launch the issue, not all of them. [20:14] Several of them are letting the bomb launch the issue and then when the debt is retired in the [20:21] that come in. So, some of those 20-year deal, when they're finally bringing them in, you hear this is the unusual piece [20:29] for beating annexation, and that was part of our request that they agreed to stand next table. [20:35] The first is going to a PID. They'll go to a PID, it will be that PID, those properties will be part of their [20:43] taxable from the creation hit forward rather than waiting for the PID assistance to be paid off [20:50] 30 years from now. As you recall from our work session that's one of the biggest benefits of [20:58] a PID is annexation now that the state has limited our ability to annex them coming in is huge. [21:06] This is a peculiar annexation and PID will also be bringing utilities. [21:09] Yes. They will also be bringing utilities to this site. [21:15] So from where they are, there will be connecting to our utilities back in town. [21:21] That's a huge benefit to the city. [21:25] But this way, so that may not always see an annexation use with your hands. [21:31] I'm sorry, I said except for sewer, this will be septic out here. [21:36] They're going to put in a list station and run sewer line back to the city. [21:45] Mr. Mayor, I'd like to make a motion that we approve of item number 15 is presented. [21:49] We have a motion. Do I hear a second? [21:52] I'll second. [21:54] So we have a motion by Councilwoman Newton, and we have a second by Councilman Gann. [21:59] Any other discussion? [22:02] All those in favor please raise your hand. [22:06] Here is unanimous. [22:07] Thank you. [22:08] Thank you, Councilman. [22:11] Are you going away? [22:12] You've been up here for all time. [22:14] I know I'm going to watch the video on this term. [22:15] All right. I don't know. Number 16 consideration and fiscal action on ordinance zero nine dash twenty five dash twenty six approving the property tax roll. Now I see why you left, Amy. [22:32] Good evening, Mary County. Tonight's the night. You're going to adopt several things to prepare the city for operations, starting our new fiscal year October 1st. [22:42] There are several steps in this and if you will allow me, just thought I would walk through that because they all build on each other. [22:50] The first action is to approve the property tax role that we received it from the appraisal district. [22:58] After that comes the adoption of the budget for the 2627 fiscal year. [23:04] after that setting the property tax rate that supports that budget for 2627 then [23:13] ratifying additional property tax revenues that will come from additional [23:19] properties and additional value on the tax row and then finally amending the [23:24] city's fee schedule. I wanted to point out two of these items when we go to it when [23:30] adopt the budget and the tax rate, they require a record vote or a roll call vote. [23:36] So after there's been a motion and a second, instead of a normal raised hand vote, [23:41] city secretary will hold each council member for their vote on those two items. [23:47] So the first step is approving ordinance 0-925-26 that you're considering. [23:54] property tax code section 26.09E requires that city council prove the tax [24:02] role as submitted by the assessor. And we received this back on July 22nd, [24:10] 2026 and you have a copy of the ordinance and that appraisal with you and staff [24:18] recommends approval of the ordinance. [24:22] Can I ask you a question? [24:24] Yes, sir. [24:25] All right. [24:26] Where did this come in? [24:28] I know that you're usually pretty conservative by nature. [24:31] I mean, is it roughly where you thought it was going to be? [24:35] We were within about 2% for our thought would be. [24:38] Really? [24:40] It actually was about 2% lower than I thought it would be. [24:45] and that is, if you recall, we had a discussion [24:49] on layer of that, the average value slightly decreased [24:53] this year. [24:55] So just to put that in perspective, [24:58] when the staff begins the budget process in January [25:01] and try to finish up in June, and you've got this, [25:04] and what was the date? [25:06] What was the date you got the certificate by the year? [25:08] July 22nd. [25:09] July 22nd, we were still within. [25:12] And so staff does a really good job of being conservative and I think that that is huge [25:18] dividends for us, a nice job once again. [25:23] So what else do you have on for us to consider on that item? [25:28] Anything? [25:29] That is all for the silence. [25:31] Okay. [25:31] And of course there's council, any questions for Clayton on this? [25:37] You've seen the role, if you have any questions on that then please, this is the time to ask. [25:43] Otherwise, these are the certified numbers and I will entertain a motion. [25:49] Mr. Mayor, I'll like a lesson that we approve. [25:51] I'm number 16 as presented. [25:54] We have a motion to hear a second. [25:57] We have a motion by Councilwoman Newton and a second by Councilman Burris and another discussion. [26:04] All those in favor, please raise your hand. [26:10] Here is unanimous thing. [26:16] Can you all not clear me on the right, or just a little slower. [26:18] What? [26:21] All [26:24] right, we'll move on, Clayton. [26:26] All right. [26:27] Item number 17, consideration of possible action on ordnets, 0, 9-26-26, adopting the budget providing [26:35] for the appropriation of funds for operating and capital expenditures for the fiscal year [26:41] beginning October 1, 2026, and ending September 30, 2027, providing for the intra and inter [26:50] department and fund transfers, providing for unexpected revenues such as grants, donations, [26:58] and insurance proceeds providing for an effective day and providing for approval of the investment policy. [27:07] Thank you Mayor. I would give this ordinance does adopt the budget so City can operate from October 1st through September 30th of this coming year. [27:17] Just as a reminder, budget workshops were open to the public during the July 6 and July 20 meetings. [27:26] And the budget was filed with the city secretary and was available on the city's website for public inspection. [27:34] The city published the required notice and the didn't record chronicle posted notice on the city's website of the budget. [27:42] Public hearings to gather information requests from the public were held on August the 10th and August the 17th for the budget. [27:53] and this ordinance, as mayor stated, also presacies investment policy for the coming year [27:59] to require that this be approved annually, there's no changes from the policy as it has been presented, [28:08] and there's been no changes to the budget since the last copy that you were given after we had [28:14] almost property taxes and then knew what would be what effectively. [28:21] This is one of the two items that does require a roll call load and staff recommends approval. [28:29] Council, what questions do you have for Flaith and her staff? [28:33] He's been over thoroughly the last time. [28:37] I have another administrative question. [28:39] What was that? [28:52] I don't care about the budget book, I don't care about the budget book but I just didn't know the ordinance part mattered. [29:03] My apologies for that oversight. [29:07] I just didn't know if it mattered. I'm the one that caused a roughest change in my last name. That's on me. I just didn't want to tell you. [29:14] I'm glad she finally admitted that. [29:17] That's on me. I don't know the matters. It doesn't matter to me. [29:21] It doesn't matter to me. [29:26] Beautiful. [29:27] I [29:29] want some weirdo coming back being like, oh, that's not right. Your old budget's canceled. [29:36] We appreciate that, I'm going to leave that on the phone, I'm just going to leave it on the phone. [29:45] All right, I'll just go ahead and roll it. [29:48] You had a rocious side of that or anything? [29:52] If there's no other questions, what's your pleasure? [29:54] Thank you. [29:56] I would like to make a motion that we approve. [29:59] I would understand. [30:03] What's on the driver's license, if that matters. We have a motion. Do we have a second? And so we have a motion by councilwoman Newton. Sorry. And then a second by councilwoman Tisdale. Now, any other discussion? All right, this is a roll call. Madam Secretary. Yes. Councilmember Nguyen, how do you vote? Yes. [30:34] Yes. Councilmember Bolger, how do you vote? Yes. [30:36] Councilmember Bolger, how do you vote? Yes. [30:38] And Councilmember Tisley, how do you vote? Yes. [30:46] We get. All right. Thank you, Council. [30:51] That for the record passes and amendments. [30:56] Item number 18. Consideration and Moscow action on ordinance 0-9-27-26. [31:03] setting the city's at Belorum tax rate at 0.689747 for $100 of taxable assessed valuation [31:16] for the fiscal year beginning on October 1, 2026 and ending September 30, 2027. [31:25] Mayor, this is the proposed rate that you set a few weeks ago. [31:29] So, this rate is also unchanged from the current 25, 26 year. [31:36] It's also the third year that the rate has remained the same from year to year. [31:42] The breakout between maintenance and operations in debt has switched a little bit, flops a [31:48] little bit of a year based on what the debt rate needs to be, but the overall tax rate is consistent [31:54] and flat with the last several years. [32:00] In accordance with the Texas Property Tax Code, City published the required notices for [32:06] this. [32:06] It's been available on the City's website and public hearings for public input on the proposed [32:13] tax rate where he'll August the 17th of this year. [32:20] So adopting the property tax rate will fund the budget that you just adopted in the previous [32:26] action. And with my apologies again to the City Secretary and Councilman Newton, there [32:32] will only be a name change on this item as well. [32:38] This is the second item that requires [32:40] a roll call vote and staff recommends approval. Council, any questions for Clayton or Sam? [32:48] I don't have questions, but we appreciate the hard work of the City employees to be able [32:53] to keep it three years in a row at the same rate. [33:01] Mr. Rayer, I made that the property tax rate be increased by the adoption of a tax rate of 0.689747 for $100, which is effectively a 0.46% increase in the tax rate. [33:18] We have a motion. Do I hear a second? [33:20] Second. [33:26] I have a motion by Councilwoman Newton and seconded by Councilwoman Tizdale. [33:37] This does require a record vote. [33:41] I'm Secretary. [34:00] Thank you [34:07] very much item number 19 consideration [34:11] operation, hospital action on the ordinance 09-28-26, [34:15] ratifying the property tax increase reflected [34:19] and the fiscal year 2026-2027 budget. [34:24] Mayor Council, this item is required by state law. [34:29] And even though the tax rate is remaining the same, [34:33] even though the average value of homes has decreased, [34:37] so some homeowners may see a lower tax bill this year. [34:41] Because there are additional properties on the tax roll and because some values have risen [34:47] The city will collect more property tax revenue in the next year than we have in the current year and for that reason [34:55] You're required to ratify a property tax increase [35:00] Even though the rate is staying flat [35:04] So proposed rate is unchanged [35:06] Section 102.007C, local government code, requires that if the budget will raise more revenue from property taxes prior year, that separate vote of the city council ratifies the property tax increase. [35:23] calculation of the increased revenues is based on the adjusted tax roles which [35:28] results in a property tax revenue increase of $531,967. Of that additional [35:39] revenue for next year, $487,028 in revenues generated from new properties added [35:48] to the road this year, so almost all of that increase [35:52] is from brand new properties on the tax roll. [35:58] And staff recommends approval. [36:03] Council, any questions for Clayton or staff on this? [36:06] No. [36:07] No, that's a very helpful number [36:11] that I hadn't seen in the past, [36:12] so I appreciate you putting that in here. [36:14] Yes, sir. [36:15] And how you explained it, the phrasing of the same, [36:20] but I was wondering about that. [36:23] I appreciate it as a citizen knowing how it really does work. [36:28] Thank you. [36:30] Any other questions? [36:31] Yes, please. [36:32] So I want to do my annual complaint, [36:35] but I think that's a ridiculous rule [36:36] from the state to make it more complicated than it has to be. [36:40] Yeah, I mean... [36:42] Scares people? [36:43] I mean, it's difficult, [36:46] because we're not misrepresenting what we're doing. [36:48] correct it all it does sound like it's a misrepresentation by the state well it [36:54] doesn't pass the same test when you say it out loud it doesn't pass the [36:57] smell test and so everyone instantly gets suspicious anyways so it's not [37:01] serving the intended purpose that the state started look I got to talk about this [37:05] for forever I appreciate you putting a bullet point saying it was a state [37:08] fault we have to say it this way thank you and just so you know if it was one [37:14] One cent. One cent more. We would be going through this. That is correct. One cent. One cent. One cent. One cent of additional revenue. [37:22] Yep. [37:22] Would make this a requirement. We'd still be sitting here and listening to Councilwoman Nugan. [37:27] All right. Any other questions for Clayton or staff? [37:35] What's your pleasure, Councilor? [37:37] Mr. Mayor, I make a motion that we approve ordinance number 09-2826. [37:41] six. [37:44] We have a motion here. [37:50] So we have a motion by Councilwoman Newton and [37:53] signated by Councilman Burris in the other discussion. All those in favor, please raise your hand. [38:01] As is unanimously. Thank you. [38:05] Item number 20, consideration, [38:07] consideration, hospital action on resolution 2026-11, I'm mending the fee schedule. [38:13] We're in Council several years ago, we moved to updating the fee schedule once a year in conjunction with adopting the budget. [38:21] Before that time, things were just brought to you throughout the year as something needed to be changed or someone had an idea for changing anything. [38:30] We feel this is much more effective and just brings one item to you that classifies all those things. [38:35] So, you have the ordinance with the fee schedule, there's also a schedule of what's changing. [38:43] But just in a review of those, we're updating development services, building construction [38:47] fees that better reflect the time required of staff to perform those duties and adds fees [38:56] for retaining walls and parking lots that are not currently in the fee schedule. [39:00] updating the food service fees to incorporate some recently updated fees established by the Texas Department of Health, [39:09] revising the library's lost and damaged materials fees, updating the parts pavilion fee rentals to move to all day rental options [39:20] for the pavilions, adding a police department fingerprinting fee, updating the public works water service connection fee [39:29] to reflect the increased costs of water meters, [39:33] and finally adopting new sewer and wastewater service rates [39:36] as recommended by Nujin's Strategies and Solutions, [39:39] which is presented to Council back in August of 2025 [39:44] with a five-year schedule. [39:47] And staff recommends approval of resolution. [39:52] And Mary, do you think now that we have the change [39:55] the impact fees because of the current adoption. [40:00] Say that when we're talking about the impact fees, [40:02] we'll have to be corrected on the fee schedule. [40:04] Okay. [40:05] Because of the adoptive rate reduced to not. [40:08] Yes. [40:08] Thank you, sir. [40:09] Can I just ask you a quick question on page one? [40:13] It's under the fees for food service, the very first one. [40:17] I think that's just a typo, but I want to make sure that [40:21] this is not what's going to happen. [40:23] You see where the very first one goes from zero and it says 55 and it says an increase [40:29] of 50. [40:29] I think it's supposed to be 50 instead of 50 by one. [40:33] Are you looking at the schedule changes? [40:36] The schedule proposed changes to the fee schedule. [40:39] Starts out with building a construction and then it goes down to fees for food service, the [40:46] very first one. [40:47] It's a late fee. [40:48] The business-related fees. [40:50] Yeah. [40:51] Unblocked. [40:53] Yes, that is that that is a typo that is the typo [40:59] The proposed fee is 55 and they change would be I will tell you maybe pull my calculator out for all the other ones the rest of them look good [41:11] My apologies [41:23] I mean, it's very, very stupid. [41:26] 55, too. [41:32] All right. [41:38] So is that something that can be administratively changed [41:46] or do we have to say we're going to do that with motion? [41:51] I mean, we do need to say. [41:54] When the schedule is adopted, what will be posted is just the [42:03] Okay, but it's not going to be 50,000 to be 50, right? [42:07] Okay. [42:08] I thought he said 50,000. [42:09] It should be 50,000. [42:11] I made it. [42:12] I made it. [42:13] I made it. [42:13] That is the same terms. [42:15] Well, the other one is 25 dollar increments. [42:18] And that's why I was wondering if that was the type of. [42:21] Okay. [42:22] Well, listen, that's fine. [42:25] I just couldn't put that back. [42:27] And my follow-up is I made a statement a moment ago [42:30] that the requested fee is 50, that the 55, [42:35] that's on the attachment is in there. [42:40] So the change is 50, which is correct in the fee schedule itself [42:47] attached to the order. [42:49] And so I think the city manager clarified this. [42:51] What we're looking at is just for us, [42:53] the official document will be correct. [42:56] Yeah, nobody, yeah, everybody just wants to see what it's going to cost them. [42:59] Not what it used to cost them. [43:00] Okay. [43:01] Perfect. [43:02] Perfect. [43:04] All right. [43:05] Sorry to go down that rabbit hole, but Clayton need to catch your own food. [43:11] Do you have anything else today? [43:12] That's that, sir. [43:13] Okay. [43:13] Council? [43:14] Any other questions for Clayton or staff? [43:21] Is it? [43:26] No good? [43:27] Okay. [43:27] We're side barring. [43:28] Okay. [43:29] Okay, well usually all the side bars over here and there are no other questions for staff. [43:37] What's your pleasure? [43:39] This may or may make a motion to approve resolution 2026, that shall remain as presented. [43:45] We have a motion to hear a second. [43:47] I'll second. [43:49] So we have a motion by Councilman Burris and seconded by Councilman Gain. [43:54] Any other discussion? [43:55] not hearing any. All those in favor please raise your right hand or let's just raise a hand. How's that? [44:05] Carey sheet and animously. Thank you. You know my lefty. Thank you. [44:09] All right. [44:13] Next portion of the agenda is future agenda items. Does council have anything? They'd like to bring up the staff about [44:21] future agenda items. I would like to [44:24] to talk about the sewer treatment, but it's really us watering our lawns more. [44:34] I would like the city or whoever looks into it, maybe seeing what other cities do because [44:41] our electric bills going up but the water, so we're paying for our lawns to be watered [44:50] And we're getting paid a sewer fee on water that's not being treated so I would kind of like to look and see what other places do [45:00] To mitigate a little bit of the summertime water, lawn watering fees. I know that some go from [45:11] in, they take the winter months and stuff, and that's the, what the average or something. [45:19] Just investigate. [45:24] This is pregnancy between the water and your waste water because you're getting charged [45:28] with waste water in order to be there because it's not because it's not treated going in [45:33] your lawn, it never did treat it while you're paying for it. [45:36] Right. [45:36] Definitely. [45:37] Just put a second meter on their irrigation system. [45:40] They're like $5,000. [45:41] You're never going to recoup that. [45:43] Most people only live in their house seven years. [45:45] So what's the ask is it the ask is for us to review our piece of the label or yeah to [45:51] see what others like Denton they take the the winter months like water usage [45:57] or sur usage and they charge you that all summer long because that's what you [46:04] use most of the time throughout the normal but when you start watering in the [46:10] summertime it's not being right so because like an average failing type of [46:20] Yes, what they do is they take, I think they take, I don't want to have it on my phone, January to February, but didn't all didn't, does this? [46:30] They take the winter months, sir, and apply it to the summer. [46:36] Well, all I would ask is that if you don't want to coordinate with staff to make sure they understand exactly what you're after. [46:44] I think I do, but I want to make sure wherever you're asking if you coordinate and then present it to all council. [46:51] Okay. [46:51] All right. [46:54] Any other future agenda out of? [46:58] Well, council, I have one. [47:03] I just, I'm not going to read the letter, but I will tell you that we do have one of our peers. [47:10] councilman Boulder will be leaving the city limits. He did sell his property and has put in [47:21] notice of resignation of his seat of today's date as the effective date. The reason why I'm [47:30] bringing it up now, one, I appreciate you making the effort to serve and I thought we were a better [47:39] council with you here, and I'm going to miss not having you here, but that also triggers [47:45] some other things that needs to happen. So I will ask staff to put together, we have [47:54] to have a replacement. And there's a process. And in the future agenda, is that where we're [48:01] Your steps prepare to take out the patient's for replacement for this proposal. [48:07] We have verified with the city attorney that he will hold over by state law until which [48:16] point someone is appointed to a seat. [48:19] The point will be through the remainder of this year for his first term and then that seat [48:27] will be available as a special election along with your. [48:30] in May of 27. [48:35] We have everything set to take out patients through. [48:42] Whatever period you like, staff would recommend that you consider taking them [48:46] for a couple of weeks to see how many applicants you did. [48:50] And if you give them a bunch of applications, maybe you can leave it open. [48:53] And the future agenda item would be to bring those to you so that you could [48:57] discuss the teaching candidates. [49:01] It would be for a one-year term to fill out. [49:04] It would be to, yeah, fill out the remainder of this term. [49:08] And then they certainly could run that seat when the election comes. [49:15] It's not the remainder of this term. He came in on a two-year. [49:18] It's just until the official election in May. [49:22] So it would fill, say we found someone next month, they would go until May, they could run again, it would be for one year. [49:31] And to get back on the cycle. [49:33] So if they run again, then that's for the remainder of the time. [49:36] Yeah, if they run again, it's their time. [49:38] They're just filling this bond till the election again. [49:41] So you're allowed to point, you could have went up to, you know, you have to have two at the same time. [49:57] I think that's the most fair way to do it we announce it to the city we take applications and then we we discuss those among ourselves. [50:09] I know there's other ways but I believe that is probably the most fair way to do it. [50:15] So, look forward to going forward with that and Councilman Bulger, seriously, I think [50:25] you are a great improvement to this council and I appreciate your willingness to stay [50:31] on until we find someone. [50:33] So, thank you very much. [50:34] Thank you. [50:36] All right. [50:37] Any other future agenda items? [50:41] Council, what you'll see next is all your information items. I don't know if you have any questions [50:48] about those. If not, then we will adjourn at 7.51. Thank you.
