It's my [2:45] first meeting being able to to kind of [2:47] sit up here with you. I'm Morgan Brim, [2:49] so I was uh introduced by Jason in the [2:51] last meeting. Spent uh a decade in in [2:54] Vineyard, um up north, and some time in [2:56] Virginia, and in Idaho. So, been here [2:58] about 2 months and absolutely love [3:00] loving Santaquin, so hopefully I can get [3:02] to to know you all um better and be and [3:04] be a resource as you make some really [3:06] important land planning decisions. So, [3:08] we have the Grey Cliffs master grading [3:10] conditional use permit renewal um that's [3:12] on today or um city engineer, John [3:15] Lundell, will uh present that. Um the [3:18] you recently reviewed the development [3:21] agreement um [3:23] uh request in the last meeting. Um in [3:26] the agenda packet, that was the memo [3:28] that you had received. We do have an [3:30] updated memo that covers specifically [3:32] the conditional use permit master [3:34] grading uh renewal, so I'll pull that [3:35] up. [3:39] » Thank you. [3:39] >> Thanks, yeah. Uh at this [3:44] point, I think best we'll proceed with [3:47] um [3:48] with the review of it and um kind of [3:51] step through the uh the application and the items on that. Then [3:58] we'll we'll proceed with that. So, [4:01] first this is just a bit of an [4:03] introduction. This is [4:05] Masquerading is currently in operation. [4:08] Morgan, could you bring the maps up, [4:10] please? [4:12] Um [4:13] Up here on the the northeast corner of Santaquin, just off of State Road [4:19] 198. It's been in operation now. This is [4:22] the [4:23] approximately [4:25] fourth year. Yeah, this will be the [4:26] fourth year that it's been in their [4:28] operation. It was [4:32] in conjunction with this Masquerading [4:34] permit that was done, a development [4:35] agreement was uh [4:38] coordinated and approved by the [4:41] Santaquin City Council. [4:43] And this Masquerading is related to that [4:45] specific development that development [4:48] agreement. [4:49] A couple of items that I will point out [4:52] before I go through each item on the [4:55] from the code. Um [5:00] The Masquerading is is proceeding [5:06] fairly efficiently. [5:08] They are working through their first the [5:10] first phase. They are [5:12] um in talking with Steve Larson, he's [5:15] indicated they're roughly about to 90 to [5:17] 95% completed on the first phase. [5:20] There is some work that they're doing [5:22] higher up to try to help mitigate any [5:26] dust fugitive dust that may come off the [5:28] site. Um as we start working our way [5:31] into the drier summer months. Once they [5:34] finish that up, they will pivot down [5:36] onto the first phase and begin working [5:39] on that. [5:41] And so, um [5:43] so there are including the [5:46] development agreement that we that was [5:47] reviewed by the planning commission last [5:49] week, there was some uh grading [5:51] adjustments that was anticipated with [5:54] that development agreement. Um [5:55] specifically, [5:57] if you'll go to the next page on that, [6:00] Morgan. [6:02] Um if you'll zoom in kind of middle on [6:04] the pink, [6:06] that pink area. [6:08] So, there is some modification that's [6:11] going to be done to the uh mass grading [6:14] permit. And this is specifically in [6:17] relation to [6:19] um [6:20] future safety of the uh properties, the [6:24] homes that will be built up there once [6:26] they're they're ready to be built. In [6:28] addition to allow for public safety to [6:31] be able to access higher up on the [6:33] mountain, and also to construct a 3.6 [6:37] acre park area that will be located in [6:40] there. If you can kind of see that area [6:42] park, I think it's park E, [6:45] that um [6:47] will be be completed [6:49] um as as a part of mass grading. [6:52] Uh in relationship to that, they will be [6:54] installing a new access road that comes [6:56] from the north, [6:58] and extends [7:01] um [7:02] kind of to the south and kind of meet [7:04] uh works its way up to that park area. [7:08] This is a wider 20-ft access road [7:11] um that does have some methods in there [7:15] to help prevent uh if there's any loose [7:18] rock that makes its way down off of that [7:21] hill, it would be able to capture that. [7:24] Um [7:25] so, it acts as both an access road as [7:27] well as a rock catch to prevent any [7:30] rocks from rolling into the future homes [7:31] there. [7:32] And that basically, it's a berm that [7:35] they'll construct there and put a fence [7:37] along the top of that to be able to [7:39] catch any rocks that may come down [7:41] through there. We kind of mentioned that [7:43] briefly in the last discussion as well. [7:46] Um [7:47] there are just some other minor changes [7:49] in some of the grading um within the [7:52] first phase, which is kind of that [7:53] little pink area down on the bottom of [7:55] the screen. And then the related change [7:59] because of the road alignment as it [8:00] comes off of Cherry Lane. [8:03] So, those are kind of the major [8:05] grading changes that are associated with [8:07] this one. [8:08] Um [8:10] and [8:11] uh in the the maps that were shown, [8:14] they're they are showing their their [8:16] phasing related to that. There's not a [8:19] any real [8:20] too big a change on the phasing that was [8:22] done previously. [8:24] Only really kind of a projected dates on [8:27] there. Again, what's shown on there [8:29] really are projected dates. If you go to [8:32] the second sheet there, Morgan. [8:35] And in the top left corner, [8:38] they say they they do uh [8:41] show projected dates for that. As I [8:43] mentioned before, the first phase is is [8:45] getting pretty close to finishing up on [8:48] there. [8:49] And there is speaking with with Mr. [8:52] Larson, they don't intend to begin [8:56] really working [8:57] fully in phase two until they finish up [9:00] the rest of They are They are again do [9:01] some work in phase two, but they'll [9:04] finish up all phase one before they [9:06] really get going in the second phase. Um [9:41] you say this [9:42] uh conditional use basically it's a [9:46] permitted use that allow that also [9:48] allows us to add some of that extra [9:49] conditions due to the impact that it [9:51] will have. [9:52] So, the first one to mitigate dust, [9:55] noise, and and odors, um [9:58] they are [9:59] uh actively working on [10:02] trying to take care of their dust. As [10:03] you said, with the um they do perform [10:08] uh seeding hydroseeding on the areas [10:11] that they've cut, especially up higher [10:12] on the hill. You can actually see it's [10:14] kind of a tannish color. There's some [10:16] green starting to kind of peek out a [10:17] little bit, but that's to help mitigate [10:20] any fugitive dust or anything dust that [10:21] may go off. [10:23] Um [10:24] again, their [10:26] you know, noise, the applicant um [10:29] does operate during required city hours [10:31] that are associated with the mass [10:32] grading. Um [10:35] and as far as we know, there's been no [10:38] indication of any [10:41] strange odors that have been coming off [10:42] the site. [10:44] Um bonding, they are currently they [10:48] currently have a bond with the city. [10:50] Um they also have bonding related to [10:52] requirements from [10:54] the Division of Oil, Gas, and Mining or DOGM. [10:57] Um they have all their current bonding [10:59] on there and are in the process of [11:01] renewing that bonding as well. [11:03] Um uh they do have to renew that on a [11:06] fairly regular basis. [11:09] Um [11:10] they currently have a business license [11:13] within Santaquin City and Santaquin [11:15] City, as was reported last Planning [11:17] Commission, uh is receiving the sales [11:19] tax off of that point of sales. [11:23] Um [11:24] lot size, setbacks, parking are all in [11:28] line. Um I'm happy to go through [11:31] anything if if you need on there. Um [11:34] fencing and screening, there is [11:37] um fencing along the the property lines. [11:39] They've also constructed berms at at [11:42] locations to help mitigate any storm [11:44] water, as mentioned a little bit further [11:46] down, to capture anything there and also [11:48] to help with any noise control. [11:51] Um [11:54] currently their road access is off of [11:56] State Road 198. [11:58] Um historically, we have had some [12:01] uh [12:04] comments and and concerns expressed [12:06] about the track out that it has happened [12:09] as they are going out on State Road 198. [12:12] Um and to help alleviate that, they have [12:16] gone and and paved the entire stretch [12:19] from the scales down to 198, which has [12:23] helped significantly. There still is a [12:26] little bit of track out that occurs, [12:28] um but they do actively sweep that and [12:31] try to clean it up. Um they've made [12:34] efforts to try to water it down, which [12:37] has caused a little bit more problem [12:39] because ends up a little bit of mud [12:41] sticks to cars and and goes that way. [12:43] So, they are working their best to do [12:45] that. Um [12:47] UDOT does talk with them as well as [12:49] needed to help with that because that is [12:52] a UDOT road. [12:54] Um again, as mentioned before, they've [12:57] got a pros. [12:59] They are [13:01] uh currently meeting the noise [13:02] ordinance. There have been no complaints [13:04] out there. They are not blasting and [13:07] they will they do not have permission to [13:09] blast. [13:11] Um [13:13] then I'll mention a little bit before on [13:16] drainage. Again, there was [13:19] at one point there was some storm water [13:20] that did make it out onto State Road [13:22] 198. Uh since that occurred, again, [13:25] after coordinating with UDOT and [13:28] Also with Mr. Larson, we have that has [13:31] been corrected. And we to my knowledge, [13:34] there hasn't been any other complaints [13:35] for storm water rolling off. So [13:38] Um [13:40] So I kind of roll through those pretty [13:41] quick. Any thoughts? And the areas where they are [19:03] um [19:04] currently [19:06] where they're currently not So, the [19:08] areas that are not developable per the [19:10] code, that basically those are over 30%. [19:35] However, [19:36] that area originally before they started [19:40] any mass grading before development was [19:42] already [19:43] past that slope. [19:45] And so, with the work that they're doing [19:47] and with this mass grading the intention [19:49] is is to go and make that more of a [19:52] uh [19:53] for lack of a better term uh [19:56] a slope that they can catch [19:58] um with with tiers as as they've done. [20:01] There's some slope and then they put a a [20:04] flat area on there. I believe it's 10 ft [20:06] wide um to catch that. [20:08] >> the drawings. They've got some really [20:09] good I saw the engineering's great. I've [20:12] got a friend that's an engineer and [20:14] it looks all good. We're [20:46] past that 30%. But where they're [20:49] proposing develop in these where these [20:51] home lots are, that was still in the [20:53] area that was developable. So, we should [20:55] be safe from any [20:58] >> Right, but by our own code [21:01] the piece that's not developable [21:03] is being developed. [21:06] Because because it's we're having dirt [21:08] moved and we're having mass grading up [21:09] in places that are not going to be [21:11] developed. So, is it going to be opening [21:14] us up to liability or problems because [21:16] of that? [21:17] >> So, previous councils have have [21:19] determined that the fact that everything [21:21] that's steeper than what's allowed is [21:23] conservationism that's not really [21:25] developed. It's really just being [21:26] secured. [21:28] So, you'll notice that anything that [21:29] we've secured the slope with to deal [21:31] with drainage and [21:33] uh you know, all the safety issues. [21:35] Um it's actually undevelopable. It's not [21:38] included as anything that's usable for [21:40] anything other than just open space. In [21:42] fact, if there's a conservationism, it [21:44] says we really can't do anything with [21:45] it. So, that's the view that the [21:47] previous council had with it and uh was [21:50] we were approved under. And the lines [21:52] are are specifically defined of where we [21:55] can and where we can't. And the other [21:57] thing that uh I would make mention of [21:59] for using lot 403, you'll see a heavy [22:02] line where there's a um where you can [22:05] see where it it it is usable, it is [22:07] developable, it can have a house on it. [22:09] And then behind that is where the [22:11] steeper grades are that are designed to [22:13] protect anything below it. Um in [22:15] addition, [22:17] um [22:18] it's dictated that we can't use [22:20] irrigation water up there, either. So, [22:21] there's there's a lot of uh of [22:24] uh restrictions of what we can and can't [22:26] do. But mainly with the slopes that you [22:28] see and the work that we're doing is [22:30] just to secure the safety of all the [22:32] lower stuff and make it so that mountain [22:34] can can be dealt with the proper way. Um that's an image [23:59] of their water truck in operation [24:02] going through and and uh cleaning and [24:05] making sure they're doing their best to [24:06] keep the dust down. [24:08] Again, a little bit higher up. Um this [24:11] is a image that flat So, you got the [24:13] darker soil. That's the top soil they're [24:15] using to reseed the the slope. And then [24:18] the flat area just at the left is [24:20] actually the area where that 3 and 1/2 [24:22] acre uh park's going to be. [24:26] Again, a image of their slope [24:28] stabilization efforts on there and [24:30] they're hydroseeding to help keep that [24:32] there. And that's just a view um looking [24:35] down on the 3 and 1/2 acre park through [24:37] there. So, [24:39] it's [24:41] say that it'll be a a great facility for [24:44] the city once it's completed. [24:48] » John, maybe one more thing just to [24:49] manage expectations. Um [24:53] our main goal is to get that higher [24:55] stuff done to the point where we can [24:57] water it and control the dust keep our [24:59] neighbors all happy. [25:00] So if you look at that previous picture [25:02] we see the water truck. It kind of shows [25:04] you how high we can get with the truck. [25:06] Um [25:07] but we can't go higher than that. [25:09] So we're putting all of our efforts into [25:11] getting that down and our goal is [25:13] probably get that down as to that park [25:15] area. [25:16] Um [25:17] there is a significant bulge in phase one that we [25:20] call the South Mountain. But once we get [25:23] this down to that level we'll shift [25:25] over. Um but between now and then it's [25:28] all about I don't want Chris Wall mad at [25:30] me. And we just want to get it done and [25:32] get mulch on it and get seed down and [25:34] get it so that we can [25:36] access it better with a with a water. So [25:38] it may not be I don't know when that's [25:40] going to happen. We've probably got [25:42] seven more steps to go and the amount of [25:44] time it takes in those steps is based on [25:46] how much rock we encounter. [25:49] So without blasting it's all about [25:50] picking around what presents itself and [25:52] it comes and goes it's different.
