[0:00] I love it. [snorts] [0:13] [music] [0:18] » Love it. [0:19] >> Welcome to the Santa Quinn Planning [0:21] Commission meeting. [0:24] [laughter] [0:26] » We should do that every time. [0:31] Love it. Love it. [0:35] » All righty. We ready to go? [0:38] >> All right. We'd like to welcome [0:39] everybody to our Santa Quinn Planning [0:41] Commission meeting on August 25th, 2026. [0:45] We would like to start with an [0:47] invocation or in inspirational thought. [0:49] Would anybody like to do that for us [0:51] today? [0:58] I have one. [0:59] >> You have one? Okay. [1:04] » Yes, I have one. Just one second. Just [1:07] an inspirational thought. Um, [1:12] unfortunately, Dolly Parton passed away [1:15] today. I don't know if you guys heard [1:17] that. [1:19] >> That's not really, but she's [1:20] inspirational in many ways and she's [1:22] done a lot of development in her life. [1:24] She's built out Dollywood. she's done so [1:27] much and so she's an inspiration to a [1:29] lot of people. But um so I just wanted [1:32] to quote a quote from her [1:35] and I'm trying to pull it up. [1:40] » It's amazing all the charity work that [1:42] she did that she didn't get a lot of [1:45] accolades for. [1:47] >> Yeah. Yeah. [1:50] Um [1:52] sorry I thought it was just right here [1:53] and it's not. Um [1:57] it was something to the effect that um [2:01] life can be hard but don't let it harden [2:03] your heart and I think that can apply to [2:06] all aspects of life that can apply to [2:09] that land development cities codes [2:12] politics especially um but it said let [2:15] the let it strengthen the muscles around [2:18] your heart not harden the heart itself [2:20] so [2:22] >> there's my thought for the night [2:24] >> thank you very Would anyone like to lead [2:26] us in the pledge of allegiance? [2:28] >> I'll do that. [2:32] [clears throat] [2:33] >> I aliance to the flag of the United [2:36] States of America and to the republic [2:39] for which it stands. One nation under [2:42] God, indivisible, with liberty and [2:45] justice for all. [2:54] righty. Our agenda for tonight is uh [2:57] a public forum. Then we'll have a [3:00] discussion and possible action [3:03] um on the following. A public hearing [3:07] and action regarding restricting bulk fuel storage in [3:10] residential zones and then we'll approve [3:12] our meeting minutes for July 28th. [3:16] Do we have anything else that we need to [3:18] add to that agenda or can we [3:23] » Did you have something to add to the [3:25] agenda? [3:26] >> Yeah, everybody's good with the agenda [3:27] the way it is. [3:28] >> Mhm. [3:29] >> Okay. All right. We'll begin with our [3:31] public forum at 7:04. [3:37] Anybody want to say anything? [3:41] Hold the crowds back. [3:44] All right, we will end our public forum [3:47] at 7:04. And now we'd like to start our [3:50] discussion on Oh, I guess we have to [3:52] have the public hearing first. [3:55] We'll start our public hearing for um [3:57] item number one, action regarding [3:59] restricting bulk fuel storage in [4:00] residential zones. [4:03] Anybody want to comment on that? [4:07] >> Great. Thanks so much. If if you'd like, [4:09] I'm happy just to um go through an [4:12] amendment. You probably recognize the um the item we talked about um [4:20] prohibiting the storage of um fuel 150 [4:24] gallons or more residential districts. [4:26] So, this is one of those it's been um [4:28] you know, it went through the planning [4:30] commission under recommendation of [4:32] approval and then um you know, in [4:35] speaking kind of with the the the [4:36] leadership being the city manager um the [4:39] assistant city manager and the city [4:41] attorney um they felt like we needed to [4:43] make um a few more changes. How it was [4:45] written before, it was more of kind of a [4:48] standard where it was restricted under [4:50] the table, no more than 150 gallons. [4:52] what the um city uh attorney um and uh [4:56] and Jason really felt that it should be [4:58] turned more into a use and so we created [5:00] a bulk fuel storage use and so that's [5:04] what was put in uh in the table and [5:06] actually today so u as far as that goes [5:09] there's a definition it's pretty simple [5:11] that that we provided if you look at the [5:13] amendments and then under um each of the [5:16] tables for the residential districts [5:18] it's a use bulk fuel storage and then [5:20] it's a non-permitted use or a prohib I'm [5:23] sorry a non yeah a non-permitted use or [5:26] prohibited use. Um so in talking with um with with with the city manager um he [5:34] felt that um we needed to go a little [5:37] bit further because there are some [5:39] properties that are zoned residential [5:41] but are actually historically used [5:43] agriculturally. And he said how it's [5:45] written right now um potentially it [5:47] could impact those operations. And so [5:51] even though like we feel like how the [5:52] code's written, it it it won't disrupt [5:55] that agricultural use, but he wanted to [5:58] ensure that it was crystal clear in the [6:00] code. And so today, I've been kind of [6:02] going back and forth, city manager and [6:04] our city attorney. Um and so I have a [6:06] few amendments. Um, so if you do [6:09] recommend a positive um [6:13] recommendation to the the city council, [6:16] we'd like it to be with the [6:19] consideration of some some new language. [6:21] And so this is the staff report that you [6:24] received. Um, and the blue is what was [6:29] in the staff report. The red is what was [6:31] added working with the attorney and the [6:33] city manager today. Um, so we have a a [6:37] few spaces where where it was provided [6:39] and so the [6:43] yeah the definition I can pull we pull [6:45] up the definition. So we do uh because [6:47] first let me pull up the definition for [6:50] bulk fuel storage. [6:53] Let's see where do we place that? [6:57] That's under the ordinance. Just one [6:59] second. [7:11] Okay. So this is the definition. So this [7:14] was the or the the definition that was [7:16] provided in your packet. So it's bulk [7:18] fuel storage of gasoline used fuel, [7:20] kerosene or other liquid fuel in one or [7:23] more tanks or containers having a [7:25] combined capacity greater than 150 [7:27] gallons on a single parcel. Bulk fuel [7:29] storage does not include fuel contained [7:31] within the factoryinstalled tank of an [7:34] operable motor vehicle or or equipment. [7:36] And so it's um essentially if you have [7:40] um storage of fuel, it's going to cap it [7:42] on 150 gallons. It's the same um ba [7:47] basic impact that that it had in the [7:49] last code. It just clarifies it and it [7:52] makes it as as a use. So that's the [7:54] definition. [7:56] And then [8:01] this document, [8:03] yeah, this word document, this is the staff report, but then we added in [8:07] the red to really ensure and make it [8:10] crystal clear that it um will not impact [8:14] currently operating agricultural [8:17] businesses that are in residential [8:18] districts. So the first um is the home [8:21] occupation section. So the home [8:23] occupation section just under the the [8:25] prohibited um uses under that code we [8:30] had simply just bulk fuel storage. Now [8:33] we provide a little bit more [8:34] clarification except so it's bulk fuel [8:36] storage except when accessory and [8:38] incidental to a lawfully established [8:40] agricultural operation conducted on [8:42] residentially zoned property. Fuels [8:44] stored under this exception shall be [8:46] used solely to support the agricultural [8:48] operation. It should not be sold or [8:50] dispensed for any unrelated purpose. So [8:54] just making it clear, we're not going to [8:57] have an impact to our agricultural u [8:59] businesses. And then under the use [9:02] table. So this is um the language that [9:06] we'll then put throughout all the [9:08] residential uh tables, but we just had [9:10] time to put it in this as an example in [9:13] the staff report. So if approved, we [9:16] would then duplicate this in the rest of [9:18] those residential um use tables. So the [9:21] first one is the bulk fuel storage. Um [9:24] and so accept agricultural bulk fuel [9:27] storage as provided below. And so that's [9:30] where we have the N. It's a [9:31] non-permitted use for residential. But [9:33] below that is the carve out for [9:36] agricultural uses in residentially zoned [9:39] properties. So bulk fuel storage [9:40] agricultural um bulk fuel storage that [9:43] is accessory and incidental to lawfully [9:46] establish agricultural operation [9:48] conducted on the property. Fuel stored [9:50] under this provision shall be used [9:52] solely to operate vehicles, machinery [9:54] and equipment used in that agricultural [9:55] operation. and it shall not be offered [9:57] for sale distribution for use outside of [10:00] the agricult agricultural operation. All [10:04] storage shall comply with applicable [10:06] fire building and environmental [10:07] standards. So even an agricultural use, [10:11] if there's large amounts of fuel, they [10:13] still have to meet building code for for [10:14] safety and whatnot. But that's the [10:16] provision that would um kind of [10:18] safeguard our agricultural uses. So [10:21] should have the same impact. just makes [10:23] it really crystal clear and uh you know [10:26] should meet kind of what our city [10:28] manager and our um city city attorney [10:31] want in terms of just making sure that [10:33] our agriculture uses are safeguarded [10:35] while still providing kind of the public [10:37] safety feature for our home occupation [10:39] so we're not having large amounts of [10:41] fuel associated with with just a general [10:43] home occupation. [10:45] Um and that is is everything from staff. [10:48] So the red hopefully that's clear the [10:50] red is what was added today. The blue is [10:52] what was in your staff report. [10:55] Happy to entertain any questions. [11:01] » Lots of questions. Anybody else have [11:03] lots of questions? [11:05] >> All right. Do we allow propane tanks for [11:07] houses in the city? [11:09] >> Um, this wouldn't affect anything with propane tanks that are under the [11:14] 150 um gallon, [11:18] >> right? So, [11:19] >> but what if I had a 250gallon tank? [11:22] >> So, if you had one that was already [11:24] established and and approved through the [11:26] building permit process, then this this [11:29] wouldn't affect anything that's already [11:30] established. But, um, [11:33] yeah, this would affect something 150 [11:37] gallons or more. [11:38] >> Okay. What about fuel oil? Like if [11:41] somebody had a wanted to build a hotel [11:43] and run it on a heat it with fuel oil, [11:46] this would affect them also, right? for [11:47] a you say hotel, [11:49] >> right? [11:49] >> Um, so this would only impact [11:51] residential. [11:52] >> Okay. What if it was like an apartment [11:55] building that wanted to run on fuel oil [11:57] and heat for heating the apartment? I [11:59] know that's antiquated stuff. I'm just [12:02] >> bringing up questions that came to my [12:04] mind. [12:04] >> Right. Right. from a commercial [12:06] standpoint. So, if um um this wouldn't [12:08] impact a a a commercial use, this is um [12:12] specifically written um to target just [12:15] residential zones. Um and so any of [12:18] those residential, the R8, I think the [12:20] R10, the R15, it would impact those. So [12:24] the idea is like your tra traditional [12:26] single family um you know having large [12:29] amounts of of uh storage of fuel like [12:33] inside inside the garage that that [12:35] that's where it would it would it would [12:36] have an impact. [12:38] >> Okay. [12:38] >> The fire department already has like a [12:40] permit that you have to go through if [12:42] you wanted [clears throat] so they would [12:45] be involved in a situation like that if [12:46] it came up. [12:47] >> Okay. So a lot of people in this area, [12:50] not everybody, but a lot of people would [12:52] subscribe to the fact that they would [12:54] are trying to u be self-reliant. [12:59] And so to be self-reliant, a lot of [13:01] times they will store some things up and [13:04] that would may include fuel. Wouldn't it [13:07] be better to go through a permitting [13:10] process and a process of safety [13:13] regulation instead of just outright [13:16] banning it? [13:18] Um, so it it it really depends on on on [13:21] what the process was. So when we went [13:22] through um we met with like our public [13:24] works and our our fire official and they [13:28] felt like the 150 galon would still [13:30] provide um folks enough enough storage [13:33] if they had four-wheelers and things of [13:35] that nature on site for a residential [13:37] use. what our concern is and and we we [13:40] had um we have received requests for [13:43] this in the past, but folks that want to [13:46] sell fuel as a home occupation. And so [13:48] that that that that is a use that that we have seen and that um has been [13:53] requested in the past. And so that that is of of concern because it's kind [13:57] of making a potentially like a a a gas [14:01] station in in a residential district, [14:03] but you know, not not official gas [14:05] station, but we we didn't we didn't want [14:07] um to to blur lines like we we felt like [14:10] that was a good use that we wanted to [14:13] take out of the the home occupation [14:14] section. [14:16] So that's that's [14:18] >> I would agree with with that in in [14:20] saying you cannot sell fuel out of a [14:23] household or a [14:24] >> or a domestic dwelling if you want to [14:27] put it that way. But to limit people and [14:31] take away their choice to be able to [14:34] store enough fuel for themselves and [14:35] their family in case of an emergency [14:40] I think is a negative. [14:43] So, and I can see where we'd want to do [14:45] it safely. [14:47] Um, [14:52] I I I don't like the way it's worded [14:54] personally. So, I [14:58] And I [14:58] >> Do Do you feel that um I mean, is there a number of of gallons or a [15:04] circumstance in which you feel like um [15:07] it it it could it could be allowed? [15:10] Well, one, we I think this is being [15:13] driven by safety. [15:15] So, I think we need to come up with a [15:16] way to put some regulation around it [15:19] where it's safe. But, [15:22] you know, uh, having moved here from [15:25] Missouri, there are a lot of, um, towns [15:28] where the outskirts of town, people will [15:30] have a, you know, a 1500 gallon propane tank so that they can make it [15:37] through the entire year if they need to. [15:39] And I would think we'd want to provide [15:40] our citizens the same option here to be [15:43] able to have something like that if if [15:45] they so choose. I'm not saying everybody [15:48] wants that, but taking away someone's [15:51] freedom of choice is something that I [15:53] don't like. Saying, "Hey, [15:56] we want you to be safe in our community, [15:59] I think that's reasonable, but just [16:01] taking the choice away, I I don't agree [16:04] with." And maybe I'm looking at it [16:05] wrong. if anybody, [16:07] you know, I'm just these are all [16:10] thoughts that came to my mind as I was [16:11] reading through the agenda packet for [16:13] tonight. And so, um, [16:17] I I don't want my neighbor to improperly [16:20] store, [16:21] you know, 500 gallons of gasoline right [16:24] next to my property, but I don't want to [16:26] take his right away to be able to do [16:28] that if [16:30] he's being safe about it. [16:33] So, [16:35] it's kind of a catch 22, I guess, is [16:37] what I'm saying. [16:38] >> Yeah. [16:39] >> So, I that that that's all I wanted to [16:41] bring up about it. [16:42] >> I think you're saying it's okay to store [16:44] that much and they're saying they don't [16:46] want people to be distributing it and [16:49] selling it and then it's like how much [16:53] it's kind of they're kind of mixing in a [16:55] way, right? [16:56] >> I And I Yeah, I think I think you're [16:58] right and that and that's that's a [17:00] really good point. I I think what I mean [17:02] if the concern is just generally for [17:04] like the personal use um and that's like [17:07] when we talk to the fire department like that's what we're asking was what [17:11] from from like a a personal use like [17:13] what what tends to be kind of kind of [17:16] like like the upper limit of what [17:18] someone if someone has a lot of ATVs and trucks just for the personal use and [17:23] the the feeling was like 150 gallon is [17:25] would get you u would get mo most people [17:29] what what what they needed. did. Um, but [17:31] going above that, like the the thought [17:34] was like then potentially you're you [17:36] might be getting into more of a [17:38] commercial capacity where someone could, [17:40] you know, be be using that for a [17:42] business or commercial purpose. [17:44] >> Um, one option to look at is instead of [17:48] looking at just the the storage or like [17:51] now it's more of like an umbrella, it's [17:53] like the personal use and it's home [17:55] occupations. Um, we could start by just [17:58] limiting it specifically to a home [18:01] occupation as opposed to just the the general storage. Um, and so if [18:07] that's a route that the planning [18:09] commission feels more comfortable with, [18:10] we we could we could look at that that [18:13] as well. Um, [18:14] >> it's already not allowed as a home [18:16] occupation. If you go to the home [18:18] occupation chapter, right above, it says [18:21] that you can't have um chemicals and [18:25] different things above like household [18:27] quantities [18:29] under the the home occupation section, [18:33] >> right? H it talks about. [18:36] >> So what's driving this change? [18:40] >> Why why are we putting this forward? [18:42] just to make it ve very clear that you you know because we we we do we have [18:46] had requests for um home occupations to sell fuel. [18:52] >> Well, we've also had requests not for [18:54] home occupations too for really large [18:57] quantities that didn't necessarily have [18:59] to do with agricultural purposes. [19:01] >> Yeah. So, do we want to just make this [19:04] clear that in a home occupation that's [19:07] not allowed and then leave the the code [19:10] the same otherwise? I don't know if the [19:12] code already says 150 gallons. I'm I'm [19:15] kind of shocked at that. But um [19:19] >> doesn't currently say the 150 gallons. [19:21] >> It does not currently. [19:22] >> Okay. [19:24] That that's what the definition of. Um [19:26] so it's a new definition bulk fuel [19:28] storage and then it's defined as 150 [19:31] gallons or more. [19:33] >> In the previous planning commission, [19:35] there was a code amendment to talk about [19:37] the 150 gallons and it got a positive [19:39] recommendation. But before it went to [19:41] city council, it's been rewritten as [19:43] what you've seen tonight. [19:44] >> Yeah. [19:48] So I I think that's that's up for your [19:50] deliberation. Um if you like how it's [19:53] written right now, it would impact folks [19:56] that want to store above. Um so we I [19:59] mean like I said before, this was vetted [20:01] through kind of our our fire department [20:03] and and our public works and that we [20:05] they felt like that that was a pretty [20:06] good upper limit of what someone would [20:08] want to store. Yeah, [20:09] >> it does does not impact the the tank [20:11] capacity so of your vehicle. And so that [20:14] would be in addition to um if you feel like that goes too far, you could [20:20] make it very specific to just the home [20:22] occupation use and just you know fuel [20:25] sales, you know, anything that that's [20:28] stored above 150. I mean, we could [20:30] target that. I would think we we would [20:31] want to look at that maybe maybe a a [20:35] little bit more and and and come come [20:36] back to you if if that's if that was the [20:38] consensus of the planning commission. So [20:40] you have you have a lot of options you [20:42] could recommend as proposed tonight. You [20:45] could kick it back to staff with the [20:48] direction that you you want it to be [20:50] more narrowly focused on on home [20:52] occupations as opposed to to storage. [20:55] Um, if if you do [20:58] if if there is a concern, well, I'm [21:01] trying to think too, like if someone [21:02] does for a storage purpose for their own [21:05] personal needs, if they want to store [21:09] like 500 gallons of fuel, we probably [21:12] would want to talk to the the fire [21:13] marshall and see if there's a permit [21:14] process or something like that. [21:16] >> Yeah, totally. [21:17] >> There there there is. Okay. [21:20] >> Under age. Yeah. So says any home [21:23] occupation which entails the use of [21:24] chemicals exceeding typical household [21:27] quantities, pesticides, and flammable [21:29] combustible materials, including any [21:31] other process or business where current [21:33] adopted building fire codes would [21:34] require an operational permit. [21:37] >> So that's a that's a home occupation. [21:39] What if somebody just wanted it for [21:40] their personal use? [21:41] >> I think a home is the operational permit [21:42] the fire permit. Is that the name of the [21:44] fire permit? [21:44] >> The operational permit. They'd also have [21:46] to go through the fire marshall and get [21:47] that approved [21:48] >> if it was for personal use also. Yeah, [21:49] correct. That makes sense. I understand [21:51] that. Anybody else have any thoughts? [21:55] Sorry, I'm [21:57] pestering everybody with this. [21:59] >> Has staff looked at um [clears throat] [22:01] other cities around us the same size out [22:04] of state? Have we done extensive [22:06] research on what other cities our same [22:09] size are doing compared to like um [22:13] Missouri or other places? you know, like [22:16] I just wonder if we have done enough of [22:18] our own due diligence of what other [22:19] cities the same size are doing the same. [22:22] Well, [22:24] >> um, so we we haven't done a I I would [22:27] say like a big dive into what other [22:30] cities are doing. Um, because this um [22:32] really kind of stemmed out of requests [22:34] that we were receiving as staff from people in the community. Um, so we [22:40] could um look at that if if you wanted [22:43] like we we'd be happy to to to look at [22:46] what other Utah cities are doing. I [22:48] mean, if there's something in Missouri, [22:49] too, we could look there, but probably [22:51] from a state code perspective, we'd want [22:53] to look at uh Utah communities. Um, but [22:56] I I would think I from just general, we [23:00] have researched a lot of home occupation [23:02] ordinances and I that's something I've [23:04] personally done a lot throughout my [23:06] career. Typically I you don't see fuel [23:08] sales out out of home occupations. So I [23:10] think we would be pretty in line if we [23:12] just restricted that if if the [23:14] commission felt comfortable at least [23:17] with that approach, you know, making it [23:19] very clear home occupations, you can't [23:21] sell fuel, you can't have large [23:23] quantities of fuel for your your home occupation. I I think that [23:27] puts us in a in a pretty good uh spot, [23:29] at least kind of going with a starting [23:30] point. And then there's the operational [23:32] permit. It sounds like if someone wanted [23:34] to have bulk fuel storage for um their [23:38] per personal use, then they they would [23:40] have to go through an operational [23:41] permit, probably through the fire [23:42] department. [23:44] And we I I we could find out more [23:46] details of what the operational permit [23:47] is, but that that's that that's what my [23:51] best guess is is that it would be [23:52] through the the fire department. [23:56] >> There was a concern that came up last [23:57] time. I think you guys did a really good [23:58] job of getting to the bottom of that one [24:01] and and making that that not a concern [24:03] anymore. But I do like this this new [24:05] direction of of limiting the commercial [24:09] use while also having a permit for [24:11] personal storage. I think that's [24:13] probably a better approach. [24:14] >> Okay. [24:17] » So, if there's can we exclude propane [24:19] tanks if somebody wanted to run their [24:21] house on propane? [24:23] Would we want to add an exclusion in [24:25] there for that? Um, yeah. Um, the plan [24:28] commission can make any recommendation [24:29] you'd like to the city council. What what we could do if you'd like, we [24:32] could do some some research on the [24:34] propane um um aspect specifically and [24:37] then come back with a draft that targets [24:41] just the home occupation and leaves out [24:44] more of the personal storage since the [24:46] operational permit is already written [24:48] into H. But then we can talk with the [24:51] fire department and understand clearly [24:52] what the the the H operational permit [24:55] is. I I think that sounds like the a [24:57] permit they would get through the fire [24:59] department because it's chemical based. [25:00] It's it's flammable fuels. [25:04] >> So, we we could um we we we could do [25:06] that. So, if you if you wanted to pass a [25:08] motion to continue the item to the to [25:11] the next meeting, that'd give us some [25:12] time to to do some research and uh and [25:15] come back to you [25:17] if if that if that's the route. It seems [25:20] like from nodding heads that's kind of [25:22] the direction you want you want to go. [25:23] Any other discussion or [25:26] points to be made? [25:29] All right. We'll be looking for a motion [25:30] on how to go forward with this. [25:35] » I propose that we continue until the [25:38] next meeting and and and look at some [25:39] different language. [25:43] » I'll second. [25:45] >> Okay. [25:46] Um [25:48] we will continue [25:50] that discussion later and look to staff [25:53] to make recommendations that are more in [25:55] line with the discussion we've had [25:56] tonight. [25:58] >> Yeah. And then um you just since you had [26:01] a second, I would just um call for a [26:03] vote. [26:05] >> Call for a vote on that. Yes. [26:07] >> We need to call for a vote on that. [26:10] >> All [laughter] [26:11] those that are in favor? [26:14] >> Yes. [26:15] Yes. [26:16] >> Yes. [26:17] >> Any opposed? [26:19] >> Okay, that's that's unanimous. Yeah. [26:21] Well, we're happy to do that. That's [26:22] great. Great direction. Um and so we'll [26:25] look at the um making it specific to [26:28] home occupations. We'll look at what the [26:30] operational permit does for the storage [26:32] and then we'll look at the specificity [26:34] around um propane tanks and what what [26:36] other community communities do with [26:38] propane tanks. [26:38] >> Okay. [26:39] >> Yeah. [26:40] I would I would add also don't um have [26:44] it include what's in fuel tanks already [26:47] like in trailers or or in vehicles. Were [26:51] you saying that that might be included [26:52] in the [26:52] >> No, it's not. So, under the definition, [26:54] it it calls out it it breaks that out. [26:57] Yeah. If you have a if you have a tank [26:58] as part of your your vehicle, that [27:01] doesn't um it's not part of the [27:04] >> Perfect. I wanted to I thought you said [27:05] it did and I'm like, let's let's take [27:07] that out. I was worried about that, too. [27:09] And I saw that it had a note in there if [27:10] your vehicle has a tank in it, it [27:12] doesn't count that. [27:13] >> Okay, perfect. Or trailer, cuz some [27:16] trailers hold fuel and stuff like that. [27:19] So, [27:19] >> yeah. Okay. Yeah, then we we we could uh [27:22] we'll probably need to expand the [27:24] definition then [27:26] >> for [snorts] [27:27] >> under the TR. Does it have the trailer, [27:29] too? [27:31] >> Well, we I'll I'll look at that and [27:33] we'll we'll make sure it takes that into [27:36] account. And one note in section two [27:38] severability [27:40] uh it says impair of invalidate. I think [27:42] it's supposed to be or [27:45] and and just [27:49] >> I don't know if that's something that [27:50] got maybe I'm reading it wrong and maybe [27:53] it needs to be of but um just in case [27:57] that got repeated through the document [27:59] somehow just so you guys know. [28:08] I apologize. Can Can you point that [28:10] section that that part out? [28:12] >> Yeah. Let's see. [28:17] Uh judgment third third sentence. [28:21] Judgment shall not affect impair of [28:24] invalidate the remainder of this [28:25] ordinance. I think it's supposed to be [28:27] impair or invalidate. Okay. [28:29] >> Just something that I saw when I was [28:31] reading through it tonight. [28:36] Uh [28:39] okay. [28:40] Um next item up is meeting minutes [28:43] approval for July 28, 2026. [28:48] Do we have any corrections? [28:56] » Do we need to make a motion for that? [28:58] >> Yep. A motion second. Would someone like [29:00] to motion the uh make a motion on those [29:03] meeting minutes? [29:05] >> I'll make a motion to approve the [29:06] meeting. [29:09] >> I second. [29:10] >> All righty. All those in favor? [29:13] >> Yes. [29:14] >> Any opposed? [29:17] Okay. [29:20] Um [29:22] staff reports. Do we need to discuss [29:23] anything else? [29:27] Um, we sent uh the planning commission [29:29] um for the fall conference. Just let us [29:31] know if you'd like us to sign you up. Th [29:32] those are um usually pretty [29:34] entertaining. They have everything from [29:36] park designs to transportation to just [29:39] general land use. [29:41] A lot a lot of the issues that we're [29:42] going to deal with u throughout this next year are going to be covered [29:45] in that in that conference. So, let us [29:47] know. We'd love to uh to get you signed [29:49] up. And um you know, in other cities [29:52] like if if commissioners were going, we just carpool. So, if you need a ride, [29:56] we we got you covered. But, um yeah, [29:58] just email I think Gwen sent it. So, [30:00] email Gwen and we'll make sure we get [30:02] those uh [30:03] >> I got the email go check my dates. [30:06] >> Yeah, no problem. [30:07] >> Yeah, thank you. [30:08] >> Yep. [30:09] >> Anything else? [30:10] >> That's it. [30:14] Oh. Um, yeah, if you can I'm h we're [30:17] happy you guys you guys showed up, but [30:19] yeah, if you let us know um as if you if [30:21] you can't show up as soon as possible, [30:24] it it it helps us. I I don't think we've [30:26] ever fallen below a quorum. So, we we've [30:28] been pretty good. I've been in other [30:29] cities where where we did and it's [30:32] especially have applicants showing up. [30:33] So, the sooner we know the the better [30:36] helps us plan. So, just thank you for um [30:38] all all the work you guys do. Appreciate [30:41] it. [30:44] All right. Looking for a motion for the [30:46] next item on our agenda. [30:49] A motion [30:50] you I make a motion to adjurnn at 7:31.
