[2:47] Tonight before we get started, I'm going to ask Steve Sullivan to do our prayer and Chief Urban. If you'll do our pledge for us, you'll stand. [2:59] by your head, please. [3:01] Dear Lord, thank you for today, Lord. [3:02] We ask you to be with these proceedings, [3:05] to be with everything that would be planned here tonight, [3:07] and it would be pleasing your sight. [3:09] Continue to bless this town, bless our community, [3:12] and the folks in our town, [3:14] work with, allow us to work together [3:17] to make the town a son of a better than it was when we got it, Lord. [3:22] We ask that you bless us, [3:24] and use this service to your, [3:26] in Jesus name, amen. [3:31] Congratulations to the five of the United States of America and to the Republic for which it stands. [3:38] One nation under God in the Israel with liberty and justice is all. [3:44] Thank you. Tonight, our first three items are proposed consent agenda items. [3:53] And our first item is approval of the terms of an authorization for the Mayor to execute an agreement with sweeping corporations of America for roadway sweeping through. [4:01] throughout Smurna. [4:06] America has been providing our sweeping services, at least for the last 11 years or since [4:11] I've been here. [4:12] We used to have competitively bidit, now Sweden Corp is on source well, and it's [4:16] we're able to go directly to them. [4:19] Even though gas prices diesel prices have gone up exceedingly, they have maintained their prices [4:26] and with no price increase on this contract from the current contract. [4:31] Do you think the Jefferson Pike route once a month is enough? [4:38] I have met with Ryan Holm's head and SRM about the rock that they've been kind of spilling [4:49] out onto the roadway. [4:51] We do need to go out there. [4:52] I think they spilled some additionally when you go out there and get that sweep that swept up. [4:56] But I can ask them to come out there and do a little bit more on it. [4:59] It seems like it's just our section, Ryan has volunteered to go out and bring their own sweeper [5:04] from time to time clean that up and reach out to him and see if he can handle that. [5:09] Because he did say that any, he knows it's coming from them. [5:12] Well, could we figure out what that section is? [5:14] And maybe ask them to do it once a month on the hat. [5:17] You know what I mean? [5:18] So we unit up getting it twice a month if they were willing to, if they were willing to do that. [5:23] I just know that, and I'm not even sure exactly, but I know, especially, they're around [5:28] Hickory Grove, is pretty bad. [5:31] I don't ask him. [5:32] Perfect. [5:32] I hope that I'll use them for video-pike inspection, jet-back services, and all that, because [5:37] listed in all this country. [5:39] Those are some services that they provide us alternatives. [5:42] And so if we did need that search, then we could ask for that, but it's not included in [5:47] the base bid, but we have never asked them for anything like that. [5:50] So I think just on our major highways, or which insular roads are there on as well. [5:56] So they are, of course, on all of our state routes, also old National Highway, Inansprings, [6:01] Rock Springs Road, Mato College Boulevard, Work Haven Trail, Front Street, Nolan Drive, [6:07] Sand Bay of Stroke, Stonecrest Parkway, Austin Lee, and Blair Road as well. [6:12] Did you choose those routes, or how many of those are those? [6:15] It's pretty much all of our main routes that are curb and gutter. [6:19] What we asked them to, we don't get into all the residential streets things like that. [6:26] Thank you. [6:26] Just me. [6:27] Okay. [6:28] Item 2 is approval of the Terms of an Authorization for the Mayor to execute an agreement [6:31] with Magnet Forensics for Great Key Services. [6:36] Chief, how are you? [6:38] Good. [6:39] Great. [6:39] And Council, this device is used that we're asking for approval. [6:44] detectives use this device to break into cell phones that have been collected as evidence. [6:50] Encrypted devices, so any kind of iPhone or Android smart phone. [6:56] This device is the phones plugged into this device so we can get into the phone if we don't have the pass key. [7:01] And that way we can obtain evidence right into the case we're investigating. [7:06] Questions for chief on this? [7:09] Okay, well, that to our agenda item three is approval of the terms of approval of the terms of an amendment to the police department standard operating procedure 2-41-Hincus. [7:22] I mean, Council, I've been approached multiple times here in the last couple years by patrol supervisors. [7:29] Do you, too? [7:30] Some of the violent encounters we've had during arrest, some of these encounters have involved officers being spit on, kicked multiple times, several injured during these incidents. [7:43] I had any levado or crime analyst run at some statistics for me. Over the last two years, we've had at least 46 of these incidents where officers have been assaulted, M.S. had been assaulted, fire security guards and also nurses. [7:57] 40, one of these incidents involved just officers alone, men assaulted. [8:03] Just this past weekend, Captain Gibson notified me that part of we were trying to take [8:10] into custody, we had to take him to the hospital and during that time he spent the face [8:14] of one of the nurses. [8:15] He also spent on one of our officers assaulted the nurse and due to these incidents multiple [8:23] It's a representative asked me to look into bringing the defect, a mass that can be put on. [8:29] It's a see through the device, our mass that can be put on. [8:34] So it can be put over the person's face, it's got a soft elastic around the neck to keep [8:40] on the face while the party is handcuffed. [8:43] So you can still see the party, make sure there's no safety or medical concerns to keep from [8:49] officers being spent on or any of the personnel [8:52] that's trying to deal with the party. [8:55] Also with this revision on this policy [8:58] would be a leg restraint or a hobble device [9:01] that would be wrapped at the bottom of the ankles [9:04] of the suspect, it goes around the bottom, near the legs, [9:09] it would loop around the bottom of the seat, [9:11] and the part of the nylon stretches outside of the car's door [9:16] and shuts on the not-not-not-not-not-not-not-not. [9:20] We've had multiple incidents during these times where not only the officers have been [9:24] kicked during these arrests, but also they've kicked the frame and bent the frame on some [9:29] of our police vehicles. [9:30] So they've actually bent the frame where you can't shut the door back and it has to be repaired. [9:35] That's minor compared to me, our officers have been assaulted. [9:40] And these devices have approved the council. [9:45] It only protects our officers, but it protects the person that's been arrested from [9:49] injuring themselves or injuring the officers. [9:51] So, it's safe for the arrestee and also for our officers. [9:57] Sergeant Sharon was supposed to come to that. [9:58] I think he's been in trainings. [10:00] I think he's been delayed. [10:02] But I asked him to come to actually kind of demonstrate some of the devices or [10:07] playing how they work and how they're training, but would go, this device would only be used [10:12] if the party was very combative and violent, we could not get that person in control. [10:17] Also, they will only be issued the supervisors that we supervisors will be on the scene [10:22] and actually have two officers there and supply this equipment to the officers making their [10:28] rest. [10:31] Questions for Chief on this? [10:32] So the other person had actual, the physical items to be able to show us what they look like. [10:39] Is that what he was coming to show? [10:41] Yes. [10:42] Okay. [10:42] Because that was going to be my question. [10:43] I would like to see what those items look like and how that would work. [10:48] The actual mass that we have are we've looked at different models. [10:53] There's different ones that you can get from different vendors. [10:55] We haven't decided on which one we want to go with. [10:59] We wanted to wait and see if we actually got the policy approved before we made a decision on that. [11:05] But there we do have a couple of examples. [11:08] The actual me on, I'm sorry. [11:10] Not a lot of device hobble or leg restraint is pretty standard. [11:15] Just strap that goes at the bottom of the legs. [11:17] Could you send us, could you email us those prior to next meeting? [11:23] And you said this was only in the bit someone is having a violent act in violently. [11:31] So how does that affect, so someone is having a mental issue? [11:37] Are you still, is that for that situation as well, if they are out of control? [11:42] And secondly, [11:45] will there be someone from the police department with that type of training [11:51] for someone who is having instability from a mental challenge. Do you have someone that's [12:01] going to be working with this training for these items? [12:07] These devices would be used or be utilized for any one that's attacking our assaulting [12:13] our officers. [12:16] It's in the policy here where there are certain stipulations where you really [12:20] don't want to use those devices unless it's absolutely necessary, but there are instances [12:25] unfortunately where someone is and one of these crosses where they're assaulting our [12:29] officers. We had one in particular, I can remember, where Officer Trong was capable times, [12:35] almost kicked in the face, where for their safety and our officer safety, you're trying to control [12:40] them as best you can, and these devices to me help do that. The second part of that is just here [12:48] recently we did a CIT training, [12:50] Crosis Intervention Training for a group of our officers. [12:53] And most of our officers are trained in that, [12:56] to notice our nurses or our distress in some one, [13:01] and try to de-escalate that and get it to a situation [13:04] where we don't have to, you know, use force [13:07] or use these type of tools on them. [13:10] Okay, cause I know you and I've talked about that before, [13:12] and I think that's really important to have enough officers [13:15] who have that type of training, [13:16] So that if this comes up, that there are people that can be called to try to de-escalate [13:21] the situation before it gets to a situation like this. [13:26] And I will say, I'll command our officers. [13:28] They a lot of times they do not have to use force. [13:31] They're very good at de-escalate situations and talking people down where force doesn't have [13:37] to be used and it doesn't have to get to this level. [13:40] So I'm very proud of how they conduct themselves in a lot of these situations. [13:46] This all is in accordance with Kalea and all that, with what we're putting in place. [13:51] So Sergeant Shone, we've got with Captain Anderson, professional standards that make sure [13:56] they were looking at what other departments do, and also that this fit in Kalea standards [14:01] that we're adapting and just kind of a sad thing. [14:07] When those individuals are assaulting our officers or tearing up, are we putting charges on [14:13] for that as well. Yes. [14:17] And it's one of those things, you know, you don't want to necessarily [14:22] just add charges on especially if someone's in a mental health crisis. You try to take that [14:27] in the account, but sometimes we don't have any choice when the solder or the attack leads to [14:33] some of these situations that we find our officers in. Well, especially when it's not a mental crisis [14:39] and it's just, why don't mean this. [14:42] Okay, other questions for Chief? [14:45] Okay, we'll move on to Item 4, [14:47] which is consideration of an ordinance relative [14:49] to the amendment of an existing PUD located on tax map 28F [14:52] Group A, parcels 29.01 and 47.0 on Valetia Barquet, [14:58] a containing 23F. [15:00] Ecarus the properties requested are located at 729 Rock Springs Road and this is the second reading. Kevin. [15:06] A little Mayor Council. This is a second reading. Nothing has changed too much on this. I do have a few couple updates for you though. But this is for property of 729 Rock Springs Road. It's about four tenths of a mile from the intersection with old national highway. [15:20] land use plan what support medium density residential in this area, [15:25] strengthening zoning is R3 and R6, [15:28] hard sprints and rock springs branch both flow across this property and due to that [15:32] through property is affected by the floodway, 100-year floodplain, [15:35] and 500-year floodplain. [15:37] The existing approved PUD will allow a single-family dwelling, [15:40] which is the existing house on the property. [15:43] A photography studio, a church, agricultural use, [15:46] the events center and the existing barn and an airsoft course. [15:50] The request of the amendment would add bed and breakfast use of the existing house as well [15:54] as construction of a small wedding chapel. [15:56] There is an existing bridge across the harks branch on the property that the proposed wedding [16:00] chapels north of that and within 400 feet of an existing harker located on Rocksbridge Road. [16:07] Emergency access to the bed and breakfast would have to be across the bridge as we talked [16:13] about the bridge was evaluated by an engineer and it is structurally sound, can't support [16:21] the way, but it was deficient as to width, and it has to be at least 12 feet wide, it's [16:27] only 11 feet for inches. [16:29] The cover and size of the bridge would also have it that far to up to cross. [16:35] In the time since the council meeting, I did hear from the developer of the property owner, [16:41] They have, or in the process of making those improvements to the bridge, and that will be evaluated again by that same structural engineer, to confirm everything is this [16:54] Methore requirements for the park code. So that is in progress. It hasn't been done yet. Once we receive that report, I'm sure we'll get that to you as well. [17:03] But the planning commission did recommend approval of this request with the two conditions. [17:09] One that the Airsoft course is removed as an allowed use, and that those bridging [17:13] prohibits necessary to allow for adequate ingress and ingress by emergency vehicles are required to be made. [17:20] Questions for Kevin on this? [17:23] Did I understand you say you all have not received any drawings on the bridge or? [17:28] We received the initial report and what is that he is making the, basically, the using the existing steel structure. [17:38] It's just adding some additional concrete. [17:40] It's always got to do them to get that additional width. [17:44] My understanding for him is that he's making those changes. [17:46] He's also removed the capturing. [17:50] So that takes care of that issue as well as the ability for the truck to cross. [17:55] And so he's making those changes and once he completes that, he's who have that [17:59] engineer, same engineer to come out and do a second evaluation of it to confirm their [18:04] things. [18:05] Just kind of gives me heartburn to think about being into $2 million fire truck going across [18:10] that bridge. [18:12] Unless we know exactly, you know, that it's structured. [18:15] Right. [18:15] There's a lighter, isn't there, a lighter from structural engineer about the white [18:20] capacity. [18:20] Yeah, that the, yeah, that he was, it was structurally [18:24] sound and everything is okay from the way we're standing, we're just really doing the way [18:28] you just, you need to add the width. So again, they'll have to obviously, they'll be [18:33] a different concrete, they'll have to be certain minimum requirements and all that to [18:38] confirm that. So we have not received it again that updated because that's in process. [18:45] So that's what we have now received that, yeah. [18:48] Yeah, I know you guys talked about it quite a bit. The last meeting I was watching on TV, [18:52] But if I understand correctly, the only thing that's coming off is that airsoft, the course, or something. [18:58] That's good. [18:58] Everything else stays there, plus the amended things. [19:05] Other questions? [19:08] We will put that on the agenda and move on to item five, which is consideration of an ordinance relative to the rezoning of tax map 28. [19:16] EM group G, partial 30.00, 31.00 and 33.00 to go from C4 to C2. It's requested by [19:25] Pop-Hospirings Enterprises LLC and J&M Equity LLC. The properties contain 67, 177, 176, 176, 177, [19:35] acre and 1.03 acres respectively and are located at 1 305, 8, 1 307, 6, and 1310, 6, [19:46] Yes, these are all three properties that are all adjacent to one another under the same ownership. [19:54] They're all national highway about 700 feet north-west of the intersection with Eden Springs Road. [20:00] The land use plan for this area is the old national corridor care area, which would support a mix of neighborhood scale retail uses and services. [20:08] So, as well as potentially for multifamily, the surrounding zoning is R2, R3, R6 and C4. [20:18] The Planning Commission did review this request and did recommend approval 640 against. [20:23] And yet nothing has changed on this since you all looked at it on first reading. [20:27] Questions on this? [20:29] Kevin, have you heard any from any of the elders that attached to this property any issues [20:36] from them? [20:36] We have not heard any calls on this one. [20:39] Yes, sir. [20:39] Yeah, the two pieces, if you're looking at that map, the two small pieces to the right, they [20:44] were originally included and they were excluded because of creating its problems. [20:49] The one on the left, the lady that lives at that R2, she was offered, they offered to include [20:57] her and she said that she did not want to be included. [20:59] So we did hear about that in planning. [21:04] And these two from up here you're talking about. [21:06] See, there was a meeting. [21:07] You know, because of the size. [21:09] They didn't meet the minimum lots of people. [21:11] They didn't meet too. [21:12] Yeah, for C2. [21:13] They were going to have to do a PRD. [21:14] And it's great. [21:15] It's a problem. [21:16] So they took them out. [21:18] So when you send out notices, [21:20] did you just send it to the house to the left and the two houses to the right? [21:25] Or how do you? [21:26] It's there. [21:26] All the adjoining property owners as well as across the street. [21:30] Okay, so you send it to, what's that C? [21:34] So your fixed house is over and see the floor? [21:36] The ones that would be, yes, they would have received it. [21:39] Okay. [21:40] The ones. [21:41] Just those ones, not the whole neighborhood, but those, well, yeah. [21:46] So Kevin, we have a similar situation, father down, oh, Nashville, highway towards Sam [21:54] on the corner of that residential subdivision that was across the street from the strip retail. [22:05] Was that, were we looking at doing C2 on that as well, or is that C4? [22:12] That was actually, well, they've come in twice, actually. [22:15] The first time we'll see four, and then it came back with a P&O request. [22:19] in those times. It faces, at both times, I mean, it's the house that faces a new well-wane, [22:27] but it is at the corner of the well-wane and a natural. [22:30] And I'm just trying to get a graph stone. You know, this seems like we're dropping C4 right, right in and that's not enough. [22:39] There's a request, currently C4, C2, I mean, C4, it's C2. [22:47] And I guess our vision down there in that small highway on that side of the street, how do we, do we have a plan for that? [22:59] or are we just going to [23:04] spot it here and there and let it come together? [23:08] Well, I mean, yeah, the old national highway or the old national corridor is kind of what's, [23:14] which kind of has the next thing, certainly C2, C4, the higher density residential town homes, [23:21] which we kind of have mix of all those things on old national highway. [23:27] So, I mean, it really kind of makes sense for a commercial standpoint, just from the standpoint, if you're close enough, I think the units brings intersection there. [23:40] You know, I think you have C2 at the intersection itself. [23:44] As you go away from the intersection, it's currently at least it's all C4. [23:49] basically on both directions, you do have C2 on the off-to-side of Old National Highway at [23:56] Ian Springs that's largely undeveloped commercially as of today, but sure. [24:04] So, I think that's the gray right there across the past pretty big complex, right there? [24:10] Yeah, that was a PCD, it was a proof for our basic office uses on the exterior and then [24:18] have some commercial in the middle, which you have the daycare centers, put in it up being [24:23] and you set up one vacant lot over there that's in that middle area. [24:27] It's only one vacant lot left to do so. [24:29] That's true. [24:30] And so most of all the rest of it though is office buildings pretty much. [24:34] It's all right. [24:35] To the office building, you have the vet, you have the vets, boarding facility and a couple [24:41] two or three buildings in the middle offices. [24:44] Then you have the daycare center in the middle and then you have one attract. [24:46] track, it's next to the daycare center as they can still. [24:49] So it doesn't have constant traffic, heavy traffic, correct? [24:57] Because the type of buildings that are there. [24:58] Yeah, but other than that, as far as near the residential units, [25:01] yeah, you're correct. [25:02] Because it's all office type uses. [25:05] They're generally not there at night, and that's where they are. [25:08] What would those fall under if they were individualized on? [25:14] within the PCD. Well, the exterior units other than the boarding facility, that was something [25:23] Council did amend that PCD several years after it was approved initially to add the [25:27] boarding facility for the veterinary clinic. Certainly the veterinary clinic itself and those medical [25:35] because it was C4 uses the BCA actually had to act on the daycare center because that is a special exception in the C4 district. [25:49] But normally would fall in. [25:51] It certainly would fall by right in C2. [25:53] C2. [25:54] What would fall in C2? [25:57] The daycare would fall by right in the C2, yes. [25:59] Yeah, and C4, it's a busy area view, so that's why I haven't had the one that's on in that PCD went to the BZA. [26:09] And my comfortable level with this is C4, especially since we're next residential there. [26:16] And I get coming from me and spring if we've went from C2 to C4. [26:22] They weren't looking to jump him back up to C2 here. [26:28] Tomorrow, that's where I'm at with it. [26:31] I'm not comfortable with the C2 reason I either. [26:36] I think C4 is a better fit for this area, [26:40] especially with the residential homes around it still. [26:44] And I could see C2 down the road where closer, [26:50] I'm just not, it doesn't give me a comfort level to do it just, as you say, it's [26:57] spot, kind of a spot zoning with the C2 in this particular situation. [27:05] Kevin, do you know if the owners, there's something specific that they're wanting is the [27:08] reason they're wanting to go to C2? [27:10] I do not. [27:11] I don't think they have a specific, I think, that they're marking is on the market as per [27:17] sale. [27:17] I know at one point, their initial plan was they were going to move their business to that area. [27:24] That didn't happen for whatever reason, and so now it's on the market. [27:28] So I don't know if they've had inquiries for uses that are only allowed in C2 and that's rather asking. [27:33] I don't know. [27:35] Okay. [27:36] Any other comments? [27:39] Okay. [27:40] Then we will put that on the agenda. [27:42] We'll move on to item six, which is consideration and ordinance relative to the amendment of the existing [27:47] PRAD as well as the Resonance from R3 to PRAD for properties located on tax map 54, [27:53] parcels 12.01, 13.01, 15.01, 15.03, 15.04, 15.05, 15.06, 15.11, 15.12 and 15.22 as well as tax map 55A group [28:12] B, parcel 1.00. Owned by banks had holdings and requested by David Weekly homes. [28:18] The properties requested are located on Bankside Dive and Kedron Church Road and this is [28:22] a second reading, Kevin. [28:24] This may have counseled. These are all collectively part of the PRD is known as Bankside. [28:33] They are located on Kedron Church Road and Bankside Dive with four other streets, [28:42] which [28:42] to them. The least finalist support, medium-density single-family residential in this area, surrounding [28:48] zoning is the mix of R1, R3, and PRD, which is the Helmsley Place, PRD, and Town, and RM, [28:54] and R3 County. This existing PRD was approved in October of 2019. It's for 249 single-family [29:01] lots on 809.4 acres, about 2.79 houses per acre. If you take out the open space acreage, [29:09] but the density of about 3.84 on the developed area. [29:15] The plan would connect to and be an extension of the existing bankside development. [29:20] The minimum, a lot size of 6500 square feet with an 18-year-old square foot minimum [29:24] house size. The existing PRD approval does require improvements to cater and church road [29:30] to a 24-foot pavement width and a real alignment of the intersection with Rocky [29:34] available road. As a part of this request, the current owner has requested that language [29:40] being included that if the PRD of MIM is approved, but construction hasn't started within [29:44] two years that the existing approval will be reinstated. [29:49] The requested amendment would be [29:51] two hundred and two single-family laws restricted to age 55 plus. The PRD request would also [29:59] That a partial. [30:00] Currently zoned our three to the PRD, which is the location of the steps. Step system, which was used as a part of the bank side development, which has been discontinued. [30:10] The total acreage of the PRD would because that extra parcel would be increased to 100.25 acres for an overall density of 2.02 houses per acre, which in the amount of open space with this PRD is increased pretty substantially to over 52 acres. [30:26] So the density of the developed acreage is even though it's a reduced number, it does give up a little bit to 4.24. [30:34] The proposed memo on lot size is 6650 square feet, and the proposed minimum house size is 1600 square feet on the 50-foot wide lots and 2400 square feet on the 60-foot wide lots. [30:45] In addition, it is proposed that the roads would be private, and gates installed at the main entrance [30:50] off the Kettin Church Road in this emergency gate at the connection of the bankside drive. [30:56] Three other streets that are stuck into the property would have coltisax added. [31:00] We have staff to recommend those coltisax built and dedicated as public streets, even though the internal streets otherwise would be private. [31:09] A traffic study is required. [31:11] We did receive at the traffic study yesterday, last evening, and so we have had it today. [31:22] So we haven't had, that's the amount of time we've had to review the study, but we did [31:24] receive the study. [31:27] Any improvements that are recommended by that study must be completed by the developer. [31:31] I'm also, we'll get that to you all as well for the council packet, if you all haven't [31:36] in the United States. [31:39] Staff, we did call attention to a concern. [31:42] We had it as regarding Keter and Tertro from Michael L. Emerald from the entrance, as well [31:49] as angle the curve at the connection to Keter and Tertro from the development. [31:54] The existing sewer would be required to be up-sized for May 15th and extended to the entire [31:59] site. [32:00] So you would be the water provider for this project and it is staffs understanding that upgrades [32:04] will be required in order to provide actual water supply. [32:08] The developer did request three waivers from the town's PRD requirements, as a part of [32:14] this amendment. [32:14] One, the requirement of the three lot tier sizes of 7 9 and 11 at the required percentages [32:21] is proposed at 168 lots be less than 9,000 with a 6650 square foot minimum. [32:29] 27 lots would be at least 9 and then 7 lots would be 11,000. [32:36] Two, the requirements at Coral Arts have side entry garages from the lower class of [32:40] high street and three of the requirements that no more than 40% of lots have 7.5 [32:44] at side setbacks, all lots are proposed to have the 7.5 foot side setbacks. [32:49] The planning commission did review this request, did recommend approval, 5.41 [32:53] against, with staff comments and waiver requests that are numbered one and three, but without [33:00] waiver requests two, or that the existing PRDB reinstated infrastructure does not start, [33:06] did you not approve those two or recommend those two things to? [33:12] And we did pursue the driver's study, so we will get that to you as well. [33:20] So, Steve, that's about all that I have this time. [33:23] We also received a PowerPoint that you all should have received that had the information in it as well. [33:36] There are also two things on your desk. [33:41] One was an email from Nikki Sasser that had some questions regarding 55 and those were answered. [33:50] and then there was also an email from Bianca, Leith and Bianca, Scarland, and Kevin have you been [34:02] in touch with them? [34:05] I know, we do receive that this afternoon. [34:06] I have no contact with them. [34:07] Okay. [34:08] Can you make sure that you get back to them to answer the questions that they have? [34:15] Okay. [34:16] Questions on this? [34:20] I guess I'll start it. [34:23] Now there's a lot of discussion on this, and I think at the last meeting, Mike concerned [34:30] was, you know, besting periods. [34:34] You know, I think the argument was, if we don't approve this, then we're kind of stuck [34:39] with out in one, which has more density, and obviously this is a better, I think, a better [34:47] land and another one. Mike's concern was about vesting of the old one when, you know, when [34:54] they expired. Done some research, talked to Dave about it and reached out to a couple of [35:02] people and I'm sure we're going to discuss that further in the future about, you know, [35:09] point, the base zone stays and the vesting continues, but the development standards are [35:20] do expire if they don't start some construction pull permits. [35:25] So with that said, I've got a comfort level with this layout, the comfort level I don't [35:33] have is the single ingress egress, and I do know, and I've seen the numbers from the power [35:41] point of submitted, that the 55 plus does have significantly lower trips per day, but we [35:53] are taking all those trips and putting them in one ingress egress versus the previous [36:01] Pud, which had two points of ingress egress, I guess, out on the bank side, then Jericho, [36:09] then to Morton Lane. So I swank, so the son of a half. [36:14] The first one, Kevin, it's mind, understanding that they're willing to do an ingress egress [36:19] in that back entrance, isn't it? [36:20] Well, I already did, I forgot that to me, yes, that they would be willing to make the bank [36:26] I drive entrance similar to the [36:29] Cudrin entrance so he would be open. [36:31] Still a gay contång. [36:32] Still gay dude but not just the [36:34] emergency only access. [36:36] When was that conveying? [36:40] I have not heard that. [36:42] They were coming to know. [36:43] The part of that's part of the, I think that might be [36:45] within the crowd. [36:46] I had called, and told him concerns that [36:51] Council had an estimate he would be willing to [36:53] look at, address and egress and egress or [36:56] I think it's in the power point, I believe that's worth it. [36:59] I believe so, yeah, I believe that's worth it. [37:02] So then the other concern, at what point do we make those improvements to Rocky or the [37:12] Kegren Church Road and Rocky IV Camaville, you know, as far as a timeline, in my mind, [37:22] they should be up front with those improvements prior to issuing CO's. [37:28] Yeah, I think that was. [37:30] I don't know if I can speak to Mr. Lawry and what their plans are, but I think that's certainly as a staff, I think that's we'll agree with you. I think that's part of the, if you're going to extend construction traffic and all those things, those construction with the construction of the first days you start building those those improvements, I think that would be something we would look at. I know that the Farco does require and I think they're phasing plan shows. Before they get over 100 units, they would also have to have the access to banks drive connected as well. [38:00] Okay. And then the, um, let me read my notes here. [38:11] Um, at what point in the process, [38:13] do we get the traffic impact study from the PRD is submitted? And I thought we got it up [38:20] for I, but now we've had one meeting, we've had one workshop, and now we're about to have another [38:28] meeting and have not viewed that. [38:34] Typically, it's a requirement of a PRD. [38:38] If it's if the PRD is significant enough to merit a traffic strike. [38:44] Often, that doesn't necessarily come into the first, [38:47] with the first subdivision flat. [38:50] Again, they have, we did receive it last night, [38:52] so we do have it ahead of time. [38:56] And we can certainly begin the requirement on the front end, most of the time they know exactly [39:05] what they may be making a request, but to get the traffic study done based on a plan that may [39:11] or may not be approved, I think that's been the hesitance from some of the development community, [39:15] but that didn't mean we shouldn't make that change. [39:20] That's typically, I don't know how everyone else feels, but in my mind, that's a big [39:25] big piece of the puzzle, when we're considering pods, you know, [39:31] then we have it. [39:33] We do have it. [39:34] On this one, we do have it. [39:35] We didn't have it up in the very beginning, but we do have it now. [39:37] But then you can send us. [39:39] Well, actually, we'll send it to the members. [39:41] It's been several years of how we had this same kind of discussion, [39:45] because we felt the same way you did. [39:46] Well, we're not seeing the traffic study until after it's approved. [39:51] And good or bad, we kind of fell down on the approval includes that they have to implement whatever the traffic study recommends. [40:01] So, no matter what it says, they have to do that as part of the BRD condition. [40:06] So, I don't think that's automatic in our BRD approvals, but I think it's part of staff comments, but if it's not, that's what we were doing when we couldn't figure out how to get it right. [40:16] Because I understand I want to spend the cost, they don't want to spend the money on the cost of something that's not going to get approved, and I get that, but at the same time we've got to have those protections, so that's where we fail and we're going to kill you. [40:28] And I'm not blamein' it, but I'm just, it'd be, be good up front just so we can consider the whole thing. [40:36] Then the last thing is these, what I'm calling waivers or amendments to our public requirements, [40:46] They're adding significant green space. [40:50] I mean, this is a well laid out pud, I like it, but are we setting a precedence? [41:01] We set those lot sizes in place to have some guidelines, minimum standards, whatever [41:09] you want to call it, four puds. [41:14] So that that's mother concerned. [41:19] I think Rakell said it this last time when she said that it's not a precedent in that we look at each one individually. [41:27] And the fact this one is 55 plus. [41:31] So that is where I have an easier time swallowing it and not do in the exact percentages for those. [41:42] and with 55 plus, not wanting to keep a larger yard. [41:46] And I do think the pluses of this outweigh, outweigh those. [41:53] That was the conversation we had in plain in Jerome. [41:55] Same exact conversation was that we put these [41:58] priorities standards in place, and we're now [42:00] advocating some of those. [42:01] But in this case, that's just like Mayor just said [42:04] that we felt like the current approval that's [42:07] already there has a lot size of 68, 20-year average. [42:11] We're not getting any 11,000 square foot lots. [42:14] We're not getting any, there's a lot more green space. [42:16] We just decided to trade off for a worth and exception in this case. [42:19] And since it's a PRD, every PRD has to stand on its own. [42:23] So it's not a precedent because the next PRD, they could try to make the argument. [42:27] But they've got to, you know, they're going to have to abide by those PRD standards anyway. [42:33] I'm changing the parking paper now. [42:35] This is going to be, to me, that's astronomical. [42:37] That's a big, big part of it. [42:39] Now, this was just such a big improvement of what was there, and I've had some of the same [42:45] conversations about vesting, Kyle, Kyle, I looked at Kyle, Kyle, I'm here. [42:53] Kyle and I have had some discussions about what can we do, right, because there's some [42:57] limits on what the law allows versus what's there, but I think that's a conversation we need [43:02] to keep having and try to figure out a way to either where we change our process or change [43:07] our wording or add some language or something so that we do get some of that because this [43:12] isn't going to be the first time that we've had what I call vesting that is kind of bitter [43:18] rice. And that is what the special called meeting is for before the next council meeting. [43:26] And then the email we got about the what what is their minimum buffer that we're going to require [43:35] on adjacent property. I see in a 20-foot landscape buffer strip there. If that's [43:42] a supplied, we can require a larger 50-foot if we want. [43:47] The 20-foot is the minimum, that is whether they're into their [43:50] or complying with what we require as the minimum in our standards. [43:54] But if being a pie, we require no. [43:57] Yes. [43:58] I mean, again, it is just, you all as a council can modify the plan, right? [44:04] I'd like to advocate for that and then the last question I've got on the original pod, there was [44:14] 20 foot access, easement to these sort of property and I was wondering if I was going to have [44:22] access to that property as well. [44:28] The same of the starts with assets. [44:33] Yeah, no, it's just about now. I think you're talking about, I think you're talking about this [44:44] One right about the triangle. Yeah, that area that area there, which is that right there. Yeah, they'll have to provide access [44:52] I mean, I don't know if it's necessarily so specifically because they haven't even through these properties already [45:00] Okay, that's the original pod, had a 20 foot, not a seat, shown on that. [45:06] Okay, they'll have to provide that to us. [45:07] I saw them out. [45:08] Give a hint, is it all due to provide rights to access through there? [45:13] I mean, it's adjacent to it. [45:15] Well, right now, I believe, we may show on this, but it's completely surrounded by these tracks, [45:23] And I believe the access is from Ketter and Tert Road, [45:29] kind of through those adjacent tracks between that track and Ketter and Tert Road. [45:34] There's an existing draw. [45:37] And so it might be change. [45:41] The location might change, I'll see. [45:44] But it would be, they'll start to provide that access, [45:48] because there's an easements to provide. [45:50] I don't know if it's spelled out in a deed, [45:52] if there's just something that's been there for ever and there's some sort of perspective [45:55] of easement or what that is. But, you know, you know, we have to, [45:59] they'll have to be provided access. [46:01] And I can't lay a lot to them. [46:04] There's a lot of flood, plain land and open land and such as that. I mean, do we know how that will [46:19] kept from becoming a wilderness, I mean, it fall to the H.O.A. or the H.O.A. or the [46:29] H.O.A. or the H.O.A. or the H.O.A. just possibility, it's the developer [46:33] in the initial responsibility of the developer. [46:38] Well, I mean, they got a lot of really nice developed green space inside the [46:42] subdivision, but some of these are, I mean, it's like that piece up to the far right [46:46] there, so I mean, it's sort of remote. [46:48] It's pretty remote and I think it's, you know, it's fairly, I mean it's [46:53] preferably wooded right now I think, you know, because that area, the area to the [47:00] west was where the field, the subject, not the subject field, the step field [47:07] area was for that step system, kind of on this area, [47:14] right here, [47:18] I didn't [47:18] that area this had the hatched area right there where the mouse is. [47:21] But this area right over here was pretty. [47:24] The hatched area was the field ones? [47:26] Well, I mean, it was in this area right here. [47:29] Right there off a bankside drive was where the, [47:33] where the, the, the, [47:35] what are we just saying? [47:36] Just saying something over there. [47:37] Yeah. [47:37] It wouldn't be in the floodplain there then, right? [47:41] Well, I mean, to you. [47:42] Whatever, whatever, whatever, to you that can see you [47:44] to accept it there on that regard. [47:45] But that's all been abandoned now. [47:49] But that hatched area is where a lot of the floodplain is. [47:56] And it takes pretty remote and undeveloped right now. [48:01] So it may, I don't know what they have plants for, [48:04] maybe some walking trails in that area. [48:05] Go play in the woods, huh? [48:07] Yeah, yeah. [48:09] But especially the area to the east there is just a very remote [48:14] from this development, really. [48:15] But it's still their responsibility. [48:17] It's still their responsibility. [48:19] It's all being incorporated into this development. [48:30] Yes. [48:31] Kevin, with this 55 plus, this isn't a government persisted, isn't it? [48:42] It's just, it's just, but there is a, [48:44] it's part of the Federal Fire Housing Law on the 80%. [48:47] They present requirement and they have to document it. [48:51] have to survey every two years and share out documentation if it's requested of them but it is not [49:01] a any type of assistance regarding that. [49:05] I'm kind of with HG on all the open space, you know, 4.55 plus you had to have a strong HOA [49:15] to take care of all these walking trails, the swimming pool, the pickleball courts, and the open space. [49:26] Sounds like we have some questions. The developers here would you like to hear [49:31] to have some of these answered by the developer? Okay. If you will state name and address [49:38] for Miss Amber, so she doesn't come after you. David Lowry, [49:44] 206 Gothic Court. [49:48] So, to just address your last question, Councilman Dempsey, [49:56] we not only have an HOA, we have [49:58] a regional HOA director, we'll engage a local company in HOA, and we also have an onsite [50:05] lifestyle director that will be office in the amenity. [50:10] It's far as the common areas and the floodplain, probably a better description of this [50:19] buyer is active adult and they are very active. [50:23] And so we're going to put walking trails along the stream there, we'll maintain that, [50:30] or some areas of that wherely would be better off left natural. [50:34] But the things we need to maintain will maintain in the natural area may be best just to [50:39] believe it like that. [50:45] The issue with you had asked about the 80-20, we typically, that was [50:54] a great question last time and we typically do not have 20 percent that are under 55. [51:01] As a matter of fact, we save those that 20 percent for maybe some special cases. For example, [51:08] If, if a married couple comes in and, and, and, in the past, the way and she's younger that would be one of those that would go towards that 20% but we do not, we have the ability with this kind of designation to not sell and for that reason and so we would, we prefer for all of our homeowners be over 55. [51:35] The other issue regarding traffic, [51:40] there is a reason why we waited to do the traffic study. [51:44] It's very important to get an accurate count to make sure school is in. [51:48] And so we waited until school was in to get the traffic study as a lot of developers and builders do. [51:56] So you kind of a backlog there too. [51:58] But that's what we waited. [51:59] We've had them without school traffic. [52:03] I know you don't like that. [52:05] So we appreciate that. [52:07] And so we want to make sure that in our community that our roadway system functions correctly, [52:15] especially with 55 plus. [52:17] Yes, sir. [52:18] Yes, sir. [52:19] And so as far as when those upgrades will be done, we would prefer to do those kind of things [52:26] on the front end. [52:27] So... [52:30] And I haven't really, we haven't really thought through this or I haven't thought through this. But I think there's some kind of time frame in there that we could say we'll have it by is very important for this buyer to see what's there. So we'll do the amenity on the front end. We'll do this, you know, as much as we come in front end because they, this is not the first house they've bought. And so they have certain expectations. And many of them have bought from in communities where developers haven't done what they said they're going to do. So they won't see that on the front. [52:58] Yes, on the front end. Yeah, so that would be that would be our goal there to do that. [53:07] Were there any other questions? [53:10] Thanks for coming tonight. In your, in your power points on Prej, but essentially talking about the busher. [53:18] Can we put power points H8? I was going to say that. [53:21] Are we new? Yeah. I made sure that they. [53:25] Specifically talking about the buffer to the adjacent homeowners. [53:30] So that, that picture right there is kind of hard to see, but there's essentially [53:35] Three lot three pieces of property there that you're butting and you've got on your map a 20-foot buffer shown [53:41] But in almost, it was exception of a couple of small points on this map almost all of it is way more than 20 feet [53:49] Because of the way you've got it laid out my question was going to be before our next meeting could you give us? [53:55] maybe this map updated with the actual depth of buffer you're playing. [54:00] We can do that. [54:01] And we're looking at, I know one of the issues with was with Bianca and Leaves property there. [54:07] We met with him after the last meeting. [54:10] And so that is 20 foot right there right on that corner. [54:13] So we're going to look at a way to do something to either we need to restrict or something [54:17] to have a little bit of a water buffer right there. [54:21] And I would say as far as open space goes, I know one of the issues is how the tiered [54:28] lot sizes. [54:29] If you look behind each lot, they don't back up to each other. [54:33] And so you have an effect, a lot that's going to live bigger than it actually is. [54:37] We put open space behind every lot, we've got pocket parks. [54:41] They are going to be activated because this buyer is very active. [54:46] So, it will function like a bigger lot, even though, I mean, they don't want a bigger [54:53] lot, and that's really, that's really why we designed it the way we did. [54:59] Yeah, I just want to make sure that [55:06] we're hearing the request of the existing ones. [55:09] It looks like, I think it's the Hemsley place, so division up at the top where the loop is, [55:14] that's already developed, and they've got a significant buffer on their side. [55:17] So even with your 20 foot there, it's really going to end up being closer to 80 or 100 [55:22] feet. Which is, which is plenty. It's really, I think, the scarthlands are really the only ones [55:28] that really get within that 20 feet or get to that 20 feet in that one spot. So if we can figure [55:33] out a way to reconcile that, everybody else really kind of has significant more buffer already, [55:39] even though it's not drawn on the map as it's such. We can, we can have that for the next meeting. [55:44] Yeah. [55:45] Heather question. [55:46] If someone owns a problem, if someone owns property and they sell it, how do you control [55:56] its 50-batter-over, is that come through you guys as well? [56:00] Do you know the second sales or is it just automatically? [56:04] So the part of this is in our restricted covenants, it requires monitoring of that basically. [56:15] And so they'll ask like the HOA for a valuation or something to say, hey, this is where they are in the process. [56:27] I will say, and I don't know exactly how that would work, but we can get back with you on that. [56:32] I will say that very few people under 55 want to live in one of our communities, because it just is not designed for families. [56:42] What about one of their communities? [56:47] So, what I'm saying is buyers that are under 55, [56:52] we rarely have people under 55 that want to buy [56:55] and an age-restricted community. [56:58] Matter of fact, we even restrict who can use the poll. [57:02] And so we have before the initial buyer buys their house, [57:06] they'll get rules and we do not allow children at the poll. [57:09] So they can't they won't benefit off of that either if you're under 55. So we have pretty pretty good standards in place for that and procedures in place and feel like we can monitor that effectively. [57:21] What about additional family members moving in later or somebody else moving in later? [57:29] I know that one has to be over 55. I'm not sure I can answer that question, but I can get an answer for you. [57:39] Yes, sir. [57:40] One last thing. [57:41] Just say you're billed out all the lots or so, you know, 55 plus and, like they said, [57:50] once you want to sell your house, that's basically the HOA's, basically, I guess, self-governed [57:57] by the residents there. [57:59] Or would, well, there continue to be an oversight program manager to ensure that HOA restrictive [58:09] of covenants are adhered to it. [58:12] Yeah, there is a point at which it will be self-managed. [58:18] How can I say this? [58:21] This buyer profile likes to manage things like that. [58:25] And there are a lot more restrictive than the other people would be. [58:29] And so I don't think we've ever had a concern with that. [58:34] They seem to be able to take care of themselves. [58:36] I don't know how to experience that in their place, yeah. [58:41] A lot of that whole more than Karen. [58:45] So there's a great line on there. [58:48] And it's, it's like right there where we were talking about the field lines being. [58:54] And it encircles that undeveloped area, it goes all the way down to you. [58:59] Is it a walking trail? Is that what it is? That's nice. [59:05] Yeah, we will have that as activated open space where we've been chosen as things like that along the way that it'll be done very well. [59:17] One last question about the case with Jason property owners and this is just because of our previous experiences we've had. [59:23] Yes, the existing foliage and trees that are there is your plan to leave that is there a certain amount of space that you're going to leave or you plan on tearing it down and planning on new what's the plan for that buffer area along those homeowners. [59:43] So, [59:46] in every place we can maintain that we will, sometimes in the development process, especially [59:51] when you're dealing with storm water. [59:56] I don't remember what I said. [1:00:00] Now, we will do, we will do our best in the process to maintain tree lines and things like that. There are times, though, especially when you're doing drainage ditches and things like that, you get into the root system. And they're going to die and fall one way or the other. At that point, it becomes a safety issue. But we value trees. And we really want that to be maintained as much as we can. [1:00:30] Um, [1:00:35] are you changing the inference way to Kedron Church? [1:00:41] Um, it's about what Kedron Church meets, uh, all of the road, or are you talking about? [1:00:45] No, no, no, no, from from, from, uh, off a Kedron Church road. [1:00:51] We'll have to make improvements to Kedron Church. [1:00:54] And then where we enter, um, is close to the Church, we've talked to the Church. [1:01:00] I haven't met with them yet, but we will do that before the next meeting. [1:01:05] But [1:01:09] I'm not sure, are you saying we'll make improvement? [1:01:12] I guess I don't understand your question. [1:01:13] Well, I think he changed the approach to it. [1:01:15] Do you not? [1:01:17] What page was that? [1:01:18] Where is it? [1:01:19] I don't know. [1:01:20] This is C2TN. [1:01:23] Is that page number? [1:01:25] Is that one ball not? [1:01:27] We're not moving the road. [1:01:29] Oh, that's our board packet. [1:01:32] Yeah. [1:01:32] I think there was discussion about realignment of that road, so that the angle to rocket [1:01:40] forcam a bill road is acceptable, maybe that's what you were asked to make sure. [1:01:48] We're not changing the way the road currently, where the location of the road currently is. [1:01:57] I just thought that it moved. [1:02:00] I could be wrong, because I saw somewhere, I mean, that one really doesn't look like it, [1:02:14] but I'll do my research and get back to the second Tuesday in October. [1:02:20] That sounds great. [1:02:21] Other questions? [1:02:24] Okay. [1:02:25] We appreciate you hearing concerns and trying to work with us on getting a good product for there. [1:02:33] If you will make sure before the next meeting, or as soon as you have it, if you can get it to Kevin and Kevin, [1:02:38] can get it to us in regards to the buffer that we talked about. [1:02:44] And I guess that's it. [1:02:45] Okay. [1:02:46] Thank you. [1:02:47] Thank you for being willing to talk to the neighbors and work with them directly. [1:02:53] And the only, I think the only other thing in the Scarland's email that we really did talk about is the whale. [1:03:00] If you can just get with them on that, there's specific T-deck requirements that obviously they'll have to follow. [1:03:05] So make sure that they're aware of those, and if there's something that we need to be concerned about before the next meeting, let us know. [1:03:13] Okay. [1:03:14] I don't know if I may, I don't know if there's a Mr. Cole may, before you may have seen the movement of that road. [1:03:22] I think on the existing approved PRD, which I think it might be in that packet. [1:03:28] You know that might be wrong. [1:03:29] And I think they had proposed, actually, the portion of [1:03:34] cadrin church road that would be north of the entrance would kind of be abandoned. [1:03:41] And then, kind of, some of that area donated to the church itself, was that church, everyone [1:03:46] here knows, that church sits very close to the road. [1:03:50] And then they were looking to add another access to the church, a little further to the [1:03:59] That way is in the existing PRD, I believe, because that may be where you saw that. [1:04:06] Okay. [1:04:07] Then we'll move on to item seven, which is consideration. [1:04:10] Kevin, did you have anything else? [1:04:11] Sorry, I just kind of cut you off, sorry. [1:04:13] Item seven is consideration authorization of a list of items to be auctioned through the [1:04:17] online surplus sale with guv deals. [1:04:23] Good evening, Mary and Council. [1:04:24] We have a list of items that we would like to have declared as surplus. [1:04:28] The list primarily includes vehicles and office equipment. [1:04:31] The option will be advertised in Merppsboro Post and on the Towns Web site as well as on Channel 3, [1:04:36] the option will run from October 20th to the 27th. [1:04:41] Questions on items? [1:04:43] One question. [1:04:45] The 2017 freight line of rust truck, we are putting out the top option off. [1:04:52] It has last miles on them. [1:04:55] Use rust trucks, we ball from Rollins. [1:04:58] So, can someone explain that? [1:05:01] Yeah, I... [1:05:02] Councilmember Dempsey, I did question that. [1:05:05] And I got confirmation from our fleet manager that the chassis is rusted out to the point where it's not... [1:05:13] We should not hold on to it. [1:05:17] Other questions? [1:05:18] I was going to suggest that the... [1:05:20] 17, 185 glass globes and base light fixtures be advertised as vintage. [1:05:29] We may look at repurposing at 6.50, that's on there. I'm not sure if we're going to take [1:05:35] that off yet, but we are trying to find a different home for that within another department. [1:05:41] So we may not have that on the final list. [1:05:43] Where was that? [1:05:44] That was a lot more than that. [1:05:45] Yeah. [1:05:48] I'm going here. [1:05:49] If council is in agreement, I'd like to add that list to the consent agenda as well for the voting [1:05:54] meeting. [1:05:55] Okay, I'm good with that unless my needs to go down it separately. [1:06:01] Great, perfect. [1:06:02] And if we make that change, I'll just email you so that you're aware of prior to the [1:06:05] consent. [1:06:07] Okay. [1:06:08] Item eight is appointment of one member to the Sona Charity Assistance Fund Board to [1:06:14] serve an unexpired term ending in 2027. [1:06:18] we had a resignation from Chris Ruth and so we will get that posted and did we [1:06:28] have any additional do remember if we had any additional ones? I'm sorry we [1:06:33] have one application that has come in since we put out the packet so it's [1:06:38] not included in your packet tonight it will be included for your [1:06:41] consideration for the voting meeting in your regular packet. Did we have any [1:06:45] that applaud last time that weren't appointed or appointed to another board that we [1:06:52] may need to reach out to. I can look at that. I'll see if there's any from last year that [1:06:56] we're not appointed. That may want to be considered again. So if you know someone that might [1:07:01] want to serve on the Smurna Charity Assistance Fund Board, which is, that's a really tough job, [1:07:08] but it's very rewarding. Okay, we will put that on the agenda and public comment. The [1:07:14] Comvette Concerto Member Kim Grace in the House, [1:07:15] Public Comvette Peeridge, shall we reserve for those citizens that have signed up [1:07:18] to address the Town Council or the Board or Committee, at least 24 hours in advance of the meeting. [1:07:23] Per ardent to the Town's Public Comvette Policy, speakers are limited to three minutes. [1:07:26] In additional comments, maybe seven minute and writing, Amber anything tonight. [1:07:30] Senator, then what was submitted and writing for that one agenda item? [1:07:36] Okay, um, Christie, James, Carl, see you. [1:07:51] I just want to share some good news that we received. This [1:07:55] was in the weekly report, but I do want to share here that we received notice that our 2025 audit report [1:08:01] has been awarded GFOA Certificate of Achievement for Excellence in Reporting. This is the highest [1:08:07] form of recognition for governmental accounting and it is our 38th year we're [1:08:12] receiving this award. It's very prestigious and we are excited about it. I [1:08:17] think sometimes we forget to be super excited because we've gotten it for so many [1:08:22] years but agree it is a huge honor and one that you all do a really a really really [1:08:28] great job in making sure that we receive so thank you. [1:08:38] I did put this in the weekly report, but we did write number two on the priority ranking list for SRA for the [1:08:47] Stewart's Creek Surland. There is several hurdles that still have to be jumped through and processes such as financial review, [1:08:56] environmental, public notice, all these things process will take somewhere in neighborhood of four to six months. [1:09:02] We do expect to be funded and I spoke with Emily about the interest rate and she said she would [1:09:10] find out from SRF but somewhere around 3% would be the interest rate. [1:09:15] Great. [1:09:15] That's always good news. [1:09:17] Yeah. [1:09:17] Right. [1:09:17] There's very green money in Bob and that's. [1:09:20] We don't get green money because our ability to pay is too high. [1:09:25] Question other questions, Brian? [1:09:26] Glad to see you get on your Texas stuff. [1:09:29] Kevin? [1:09:32] We just want to reiterate how the Council will wear this, but on Monday we will be holding [1:09:40] some three different focus groups regarding our comprehensive plan update. [1:09:46] We have had this item social media and we have had several citizens sign up, but we'll [1:09:52] do want to reiterate those tonight. [1:09:53] There's one at 1030. [1:09:55] These are all an hour and a half long. [1:09:56] There's one at 1030. [1:09:57] We're going to economic development and housing from 11 to 1230. [1:10:02] neighborhoods, live a building, and how integration. [1:10:06] And then at one o'clock there's a mobility and infrastructure. [1:10:09] These are focus groups. [1:10:10] These are going to be pretty interactive and groups. [1:10:14] So we are keeping the size of the groups to 15 to 20 people because we don't want to [1:10:20] do overload with the activities that they will be doing. [1:10:23] But we do star space available certainly. [1:10:25] So we want to invite everyone who would like to be involved to be involved [1:10:28] the RAT event center so they can go about signing up. We have that on social media. It was just a QR code just to say and you can't see find that just certainly email me. Let me know. I'll be happy to sign you up. [1:10:48] It's a little difficult to do all three just because there is an overlap of the first two [1:10:53] as far as the time, but you can certainly easily do two. [1:10:59] And then also, obviously if you just have time for one, it's still during the day and [1:11:03] or less, not everybody can take on old day off work or whatever, necessarily. [1:11:08] So we're going to be a volunteer. [1:11:10] It's a wonderful honor. [1:11:13] And that is the one we've had the most responses to, but there are still a few spaces available [1:11:18] in that one. [1:11:19] People are interested in that one. [1:11:22] Other questions? [1:11:23] We're given? [1:11:26] Okay. [1:11:27] Jeff Gregg. [1:11:33] Sure, just a couple of things to give you a heads up on. [1:11:36] We are sent out our workplace experience surveyed all employees last week and so that got a couple [1:11:41] of weeks to get that filled out. [1:11:42] That's a great opportunity for them to tell us how we're doing as a town. [1:11:45] So looking forward to getting that feedback from them here in the next couple of weeks. [1:11:50] Also, it's a performance appraisal time here. [1:11:51] So all of our supervisors are knee-deep in performance appraisals for their employees. [1:11:55] That's a good time for supervisors to get feedback to our employees about how they're doing. [1:12:00] And then the last thing I want to mention is last Thursday, the town is recognized as one of the top campaigns for United Way [1:12:07] across South Central Tennessee. [1:12:08] In fact, we were the third best campaign in all South Central Tennessee, so that's a pretty [1:12:14] cool recognition. [1:12:16] Along with that, I'm a big part of the reason we are in the top threes because our [1:12:20] Smurna charity golf scramble, and that's coming up here at the end of October, and currently [1:12:24] we have close to $105,000 in sponsorships for that event, so it's been very successful. [1:12:30] So far, we'll be posting something in social media in the next couple of weeks to open [1:12:34] it up to anybody that wants to play in that, we'll have some limited spots, but we'll be [1:12:38] open to the public to plan it, hopefully you guys could play as well. [1:12:41] It's all I got. [1:12:44] Tom. [1:12:51] I just want to mention a few road construction projects we have going on. [1:12:55] Starting tonight, and through this weekend, TDOT, and TDOT's contractors will be doing [1:13:01] some intermittent lane closures and ramp closures along I-24. [1:13:06] They're going to be working on some of the concrete areas along those off ramps and on ramps. [1:13:11] going to be each weekend. Well, the ramp construction work will be this weekend and we'll be next [1:13:18] weekend. Work is going to start at 8 p.m. tonight and those ramps will be open up again at 5 a.m. Friday [1:13:26] morning. Then they're going to close in at 8 p.m. on Friday and the opening, I'm sorry, they'll close [1:13:31] at 8 p.m. on Friday and open at 5 a.m. on Sunday morning. And just like, you know, for this weekend [1:13:39] coming up starting tonight and then of course the 25th and 26th as well is Friday and Saturday. [1:13:46] Exit 70, on for road, there will be a full closure of the Westbound All-Framp and Westbound [1:13:52] On-Ramp. Also, the Eastbound All-Framp will be a Lane Shift at the Exit 70, Exit 66, [1:14:01] Samutty Parkway will be a Westbound All-Ramp Lane Shift and then the following week in, [1:14:07] We're gonna be, T dot, starting October 1st, 2nd and 3rd. [1:14:12] They're gonna be closing exit 66A and 66B. [1:14:16] Just samored the eastbound off ramp. [1:14:19] There'll be a full closure of those. [1:14:21] Also, at the exit 66, the westbound off ramp [1:14:24] will be a lane shift, along with exit 70, [1:14:27] Alvaro, the eastbound off ramp lane shift as well. [1:14:32] Obviously, you don't have to memorize all that. [1:14:33] We have some maps up there that [1:14:35] and sent that to Heather, she's gonna be posting [1:14:37] or has posted that on our social media page pages, then the weekends of October 9 to [1:14:45] the 10th and 16th through the 17th, it's just going to be nightly lane closures along [1:14:51] I-24 in both directions near exit 66 and near exit 70 to do some joint replacement operations. [1:15:00] Any questions about it? That's all teed off work that they're going to be doing with our contractor. I'm going to be questions on that. [1:15:09] If not, just want to mention some of our million resurfacing pricing going along for the going around for the last couple of months. [1:15:15] We've got about 12 lane miles of roadway that we've completed so far, milled resurfaced and striped. [1:15:22] Currently, we're working on AMOVAL ROAD, the section behind publics, we're working on that, [1:15:30] milling, finishing the milling up on it, then tomorrow and Monday they're going to be [1:15:34] paving it out and doing the striping at the same time to get that open to them. [1:15:41] From Lee Victory to Hazelwood? Yes, old Nashville. There's a couple spots that had done [1:15:52] had where some turnlings have been improved in the past [1:15:55] so we're gonna skip about two spots in the middle [1:15:57] but it'll be the rest of that. [1:15:59] You know that road, over the years we've talked about [1:16:03] curbing it and where do we stand with that one? [1:16:10] So that's probably changed considerably, right? [1:16:14] You know that's a road that really kind of stays steady [1:16:17] around 11,000 cars per year. [1:16:19] If you look at the history of it it's staying right [1:16:21] that's a daily amount. It is something that we're going to look at at in [1:16:26] curving gutter and sidewalk in the future just because there's you know much [1:16:31] more denser residential in that area and then allow people to get to the [1:16:36] commercial areas but that is a project that we're looking at doing. [1:16:41] Just one [1:16:42] mentioned as well a couple of other roads rock springs road we're gonna be [1:16:45] starting milling it tomorrow we're gonna start after school starts and then we're [1:16:49] be wrapping that up before school, let's out in the afternoon, that's going to be from hearts [1:16:56] branch bridge going to Mason Tucker. And again, that's going to be intermittent. There's some [1:17:01] places that have been upgraded by the developer last few years. We're going to be skipping some [1:17:05] sections, but we're going to be milling and then ultimately resurfacing that. And then we're going [1:17:09] to be next week when we start milling on Imperial Drive as well. Much needed. [1:17:17] set that list fitter fiscal year budget, how do we get up date on that? [1:17:26] Where we're at with their fiscal budget versus our street. [1:17:32] Once we get through this list, we need to take a pause because the index has increased dramatically [1:17:37] with the fuel increases. [1:17:40] So we're a little concerned about our ability to complete the entire list that we had provided [1:17:45] at the several, several months ago, I did provide you all with an update of where we are so [1:17:49] far. [1:17:50] But we're going to need to take a pause to see if there are some of those lower priority roads [1:17:54] that we may not be able to hit this year. [1:17:58] That is the case. [1:17:59] We'll come back to you all and let you know if that's something you want to look at. [1:18:02] Continuing, we'd have to do a budget amendment on. [1:18:05] But the index, the bytuminous index has increased dramatically as high as it has ever been. [1:18:13] One of the things we did talk about in budget was coming back to look at where we are and [1:18:19] so can we make sure that we give Sierra plenty of time to get that prepared and maybe after [1:18:26] the first of the year come in to do that for the overall budget. [1:18:31] And you know, if we kind of get two seasons on the million resurfacing, so feel like we're [1:18:36] probably going to be at a point where we'll have to just pause as the temperature is dropping [1:18:41] and reevaluate for anything additional that we may have [1:18:45] the financial capacity to do in the spring. [1:18:48] But when we do the update, I don't want it to just be on roads. [1:18:52] I'd like for it to look at all departments about what we were looking at and where we were. [1:18:59] Any other things for Tom? [1:19:01] Thank you. [1:19:03] Todd, Jason, [1:19:07] Mike. [1:19:14] Your council is just going to update a couple of things this week. [1:19:17] First of all, Monday over at the Smurna Golf Course Special Olympics of Tennessee was there. [1:19:23] They had a big crowd, and Scott tells me they had about 60 or 70 players, plus another probably 40, 50 volunteers, [1:19:30] and had lunch and for a hundred set up over there. [1:19:32] So that's kind of one of those things that might be out of the, [1:19:35] kind of off the beaten path that they do over there, which is good. [1:19:39] Also, as you well know, the Deepo District car show is Friday night, [1:19:44] and it's from 6.830 and you have to have the cars in at 5.45 and we'll fill up that park [1:19:51] in a lot. We are going to set up a little bit of an overflow park in area for any cars that might [1:19:56] be a little bit late up in the live and truth park in a lot wherever everybody parks. [1:20:02] Also depot days is 10 to 4 on Saturday road to be shutting down about 7 o'clock [1:20:07] for vendors to come in and then probably open up about 5 that afternoon. So they got a lot of [1:20:13] others coming in and doing a good job down there. [1:20:17] That's it. [1:20:17] Thank you. [1:20:20] Chief. [1:20:23] Amber. [1:20:24] I'm a couple of things. [1:20:26] We have not been together since we had our top gun night run. [1:20:30] So that was a fantastic event. [1:20:32] I know I keep for the past few years coming in and saying it was the biggest yet. [1:20:37] But it surely was again this year. [1:20:40] in registration and in sponsorship and then also because we like a challenge we decided to do [1:20:47] two full events in one so we had the 911 ceremony I think most of you were out there [1:20:53] and able to partake and enjoy in that night the rain held up all for us so it ended up being [1:20:59] a fantastic event so that's become a community favorite and definitely one of my favorites so [1:21:06] don't know how long we can keep sustaining here every year, getting bigger and bigger but we're [1:21:10] going to keep drawing. Since then we have kind of turned our focus to some training for town employees, [1:21:19] whether it's with our professional organizations or we've actually had the opportunity to partner with [1:21:24] imp tasks and they have come in and done a couple of training. Well, one training session so far and then they [1:21:31] another one scheduled next week. So Stephanie and Jeff's department has helped me kind of organize that [1:21:37] and determine the people that need to be in each of those sessions. This past Monday at the [1:21:41] event center, MCAS came in and conducted a two hour customer service training. We had 37 [1:21:48] in attendance for that training session. Most of our front facing admin, utilities, treasury, [1:21:55] those employees that are front facing to the citizens. [1:22:00] Next week, on Monday, we have a leadership session for [1:22:04] supervisors, directors, or even some of those new and upcoming [1:22:08] employees that may at some point look to move into a [1:22:12] supervisor role. So we actually have more attendees for that [1:22:16] when we have over 40 scheduled for that one and it'll take place [1:22:20] Also at the Events Center, news of three hour session, I am straight out of the car from Jackson, Tennessee today. [1:22:28] I finished the local... [1:22:30] Leadership Program, Mountain Jackson. So, we'll rest well tonight and thank you day for nominating and allowing me to go partake in that. It's always good to meet people from other municipalities and I was telling day of earlier. I do have to brag because you hear a lot of the municipalities that have the same kind of hot button topics or issues that we're having or may have. [1:22:54] and then also you hear how much more advanced that we are in some ways than other [1:23:01] municipalities. [1:23:02] So I'd tribute that to you guys for always looking out for us and today for allowing us [1:23:07] those opportunities. [1:23:09] So, let's all have. [1:23:11] Thanks, Dave. [1:23:11] Thank you just a couple of things. [1:23:13] One we had our very first principles roundtable this morning. [1:23:18] We had about 15 local schools represented either the principal or an assistant principal [1:23:24] We're also very fortunate to have the superintendent attend this this first one [1:23:30] It was very very well received and they were extremely appreciative of the attempt to collaborate with with them [1:23:39] Being the first one kind of allowed us the opportunity for our staff and I want to thank the staff who were in attendance [1:23:46] for that event [1:23:47] to provide them with various programs and resources that we have available in the town that could benefit both the schools and the students. [1:23:57] In the future we'll look to do this again. [1:23:58] We're going to follow it up with a survey to those who are in attendance. [1:24:04] And we'll ask for their feedback of how we can make it better next time. [1:24:09] And so that was a great initiative. [1:24:11] I think that we have started and looking forward to that moving forward. [1:24:16] One announced that the library did close today for some maintenance and repairs. [1:24:23] Their social media posts only indicated that they would be closed today. [1:24:27] However, in speaking with the interim director who was, he's been very communicating with [1:24:35] us really great, he mentioned that they may be close tomorrow, but the social media didn't [1:24:41] align with that. [1:24:42] So as soon as we get an update from him, we'll make sure that if they are close to [1:24:46] more that we get that out as well, but just want to make you aware of that. [1:24:53] Additionally, just want to mention as well, Mike, Mike, Mike Moss had mentioned to me [1:24:58] that our Cedar Stone Phase I bid is out on the streets and as of right now, we've got [1:25:03] about nine interested potential bidders on that project, so that is moving forward as well. [1:25:09] And that's all I have today. [1:25:14] Stan, we just want to say how sorry we were about tomorrow. [1:25:17] Yes. [1:25:18] Appreciate it. [1:25:18] Very much. [1:25:19] Thank you, guys. [1:25:20] Been thinking about you for Daddy, but. [1:25:23] Thank you. [1:25:24] Drum? [1:25:25] Just want to thank everyone. [1:25:27] Came out of the rowery club. [1:25:28] Fish fry, Saturday. [1:25:30] Had a great event. [1:25:32] It was super hot. [1:25:33] But we are in for sponsors. [1:25:36] Don't need it money to get back to the community. [1:25:39] and if Patrick's listening and the control room of it, several people say that the volume might be somewhat off there, [1:25:48] but they can't hear at home. So maybe you can check into that. That's all I have. [1:25:56] Anything to see? [1:25:57] Eight sheep? [1:25:59] No, we were eating what Mike talked about with depotes, the car shared the morning night, [1:26:06] and depot days itself on Saturday. [1:26:10] It's at event which began years ago, [1:26:14] through the Smart Endup Endup Merchant Association [1:26:18] and we've been encouraging people to buy a local [1:26:22] for a very long time and we'll do that again this weekend. [1:26:28] And I think, Steve, you bring in your money [1:26:32] car all around tomorrow night? [1:26:34] Do you want to break yours? [1:26:36] Yeah. [1:26:36] First time it's been seen in years. [1:26:40] A little while. [1:26:41] You get all that rust. [1:26:42] I got all that rust out of it. [1:26:44] That's right. [1:26:44] You're bringing yours too, right? [1:26:45] I will. [1:26:49] Might get us three spots at my side so they can see how much [1:26:52] pretty your man is the man's. [1:26:54] You don't be there. [1:26:56] Okay. [1:26:56] You don't look too close to his though. [1:26:58] That's not mine. [1:26:59] That's the first thing you've been in. [1:27:02] Seriously? [1:27:03] I don't have anything. Are you going to model for us tonight? No, no, no. No, okay. [1:27:09] Do you agree with where to head your back? We are. If they can only see what I could see. [1:27:15] It's kind of like Zoom used to be, right? [1:27:19] I don't have anything. [1:27:22] Just a couple of items, condolences to the Jones family, Truman Jones, who was sheriff for quite a few years. [1:27:31] gave British first job and with the Sheriff's Department passed away and just want to keep them in our thoughts and prayers. [1:27:41] Cudos to everybody who was a part of the top gun night run and the 9-11 tribute. [1:27:47] I don't think we realized we were doing two totally separate events all on one night. [1:27:53] but I know, I know, so HG, Jerry, and Jerome, great job on Wings of Freedom, Fischfra. [1:28:03] It was a really nice event. [1:28:07] And thank you to Cedar Grove School, Thurmond Francis, Arts Academy, and Poplar Hill for [1:28:13] inviting me to come read. [1:28:14] Rockhill, I think you read somewhere, was it Cedar Grove, Cedar Grove? [1:28:19] Um, we always enjoy getting back into the classroom and thank you for [1:28:24] Rutherford County Schools reaching out for branches of government to, um, [1:28:29] do some, uh, video work on what happens with, uh, local government. [1:28:35] So I enjoy getting to speak with them. [1:28:38] So anything else? [1:28:40] Nothing else, we're adjourned.
