[7:19] Good. Afternoon. Today is October What is today's date? [7:26] Today is October 15th and it is 6:02 p.m. and I call this meeting to order. [7:31] This is an eight member board appointed by the city of South Fton's mayor and [7:35] city council to hold public hearings to make recommendations on resoning, use [7:39] permits, concurrent variance applications, comp uh comp land use [7:43] plans, maps, and amendments to the zoning resolution. The applicants or [7:46] proponents of each case will be allowed a total of 10 minutes to present their [7:50] case. Since the burden of proof is upon the applicants to convince the board [7:53] that the application should be approved, they may choose to reserve some of their [7:56] time for a rebuttal. Following the proponent's presentation, any [8:00] individuals in opposition will have a total of 10 minutes to present their [8:03] position. If multiple people will speak in opposition, you should organize [8:06] yourselves as to allow everyone to speak in the 10-minute time frame. Opposition [8:10] is not permitted rebuttal time. If you wish to address the commission on the [8:14] case, you must fill out a comment card and indicate whether you are a proponent [8:18] or an opponent of a case. If you are not sure whether you are not uh if you are [8:22] not sure whether you are whether you are not whether you are a proponent or an [8:27] opponent, you must fill out an opponent comment card. The commission will take [8:31] two votes on each application. The first vote is on the findings of fact as [8:35] presented by staff. The second vote is for approval, denial, or deferral of the [8:38] application. It is the second vote that determines the board's recommendation to [8:42] city council. These same matters will be heard by city council at a public [8:46] hearing. Um there are a couple of council meetings coming up. So we'll [8:50] just address those as they come up for each case and then they will be voted on [8:54] at that actual council meeting. Please refrain from any verbal outbursts during [8:58] the public hearing and please only address the commission during the [9:00] designated public comment time. We will proceed with the agenda. Staff, can you [9:04] please call the role? [9:14] Commissioner Perry, >> present. [9:16] » Commissioner Remond Jones, >> present. [9:18] » Commissioner Jefferson, >> present. [9:20] » Commissioner Williams, >> present. [9:22] » Commissioner Devon, Commissioner Price, [9:25] » present. >> Commissioner McGeeham. [9:27] » Commissioner Smith Vickers, >> present. [9:30] » We have quum. >> Thank you so much. [9:33] Commissioners, you've had a chance to review tonight's agenda. Can I get a [9:36] motion to approve the agenda as presented? [9:39] » I make a motion that we approve the agenda as presented. [9:45] » It's been properly moved and seconded. Can you please call the role? [9:48] » Commissioner Perry, >> I. [9:50] » Commissioner Rean Jones, >> I. [9:52] » Commissioner Jefferson, >> I. [9:53] » Commissioner Williams, >> I. Commissioner Price, I [9:56] » have it. >> Thank you. So, the agenda is approved. [9:59] Next, we'll move on to the minutes from the last planning commission meeting. [10:01] Commissioners, are there any corrections or edits to the minutes? [10:15] hearing. >> Hearing none. Can I get a motion to [10:20] approve the minutes? >> So moved. [10:24] » Second. >> It's been properly moved and seconded. [10:27] Can you please call the role? >> Commissioner Perry. [10:29] » I. >> Commissioner Rean Jones. [10:30] » I. >> Commissioner Jefferson. [10:32] » I. >> Commissioner Williams. [10:33] » I. Commissioner Price. >> I th have it. [10:37] » Thank you so much. Those minutes are approved. Now, we're going to move on to [10:41] our cases for the night. We have uh [10:46] technically two cases that we're going to be really speaking about tonight. Um [10:50] we can go ahead and start with U25-01 since that's already on the agenda. Um [10:54] I'll have staff speak on that. That case was withdrawn um last night at the [10:59] council meeting. >> Yes. This case U25-011, [11:04] the address was 5540 or National Highway. They were seeking a special use [11:07] permit to extend the existing daycare hours for an existing daycare. City [11:11] council did vote at their meeting last night to withdraw that case. So there [11:14] will be no action needed for this item. >> Thank you so much staff. [11:20] So ne next we have C25-024 [11:26] U25-007 as well as CDP25-009 [11:31] and the applicant is also requesting a withdrawal. Um staff, can you go ahead [11:36] and speak about that as well? >> Yes. Case Z25-024 [11:40] along with a special use permit U25007 along with a comprehensive development [11:44] plan amendment 25-009. The address was zero stone wall tail. [11:49] The applicant was seeking a resoning from AG1 to C2 to operate a gasoline [11:54] station with a dining and retail complex along with a future lang use amendment [11:58] from rural neighborhood to community live work on 4.89 acres. We did receive [12:02] an email from the applicant stating that they wish to withdraw this case. [12:06] Therefore, we uh recommend that uh you all vote for a deferral and then it will [12:10] be voted on for withdrawal at the city council meeting on November 12th. [12:15] Thank you so much, Matthew. Um, so, commissioners, with that being said, for [12:19] these three cases, um, I recommend we go ahead and, um, [12:24] Matthew, do we need to We don't need to do stats find the facts, right? Because [12:27] we're just doing a deferral. Okay, cool. Um, so I recommend that we go ahead and [12:32] um, proceed forward with that motion for a deferral since it's going to be [12:36] withdrawn anyways. No need to open up a public hearing tonight. Um, is there a [12:39] motion to uh defer this uh to defer these three cases to the it'll be either [12:46] the October 28th or November 12th Maring Council meeting. They're not exactly [12:50] sure yet. [12:53] I move that Z2524 U25. [12:59] » Thank you. >> CP2009. [13:07] » Um, his microphone is not working. >> Oh, got it. Perfect. Okay, sweet. [13:12] » Point of clarification. I'm sorry. So, you technically can't defer it to a city [13:16] council meeting. you have to defer to your next planning commission meeting [13:18] with the understanding that city council will take this item up at the November [13:22] 12th meeting for withdrawal. >> Okay. I move that Z25-024 [13:27] U25-00007 CDP25-009 [13:32] be deferred to the next planning commission meeting on November [13:37] 19th. >> Is there a second? [13:39] » Second. >> It's been properly moved and seconded. [13:42] Can you please call the role? >> Commissioner Perry. Commissioner Rean [13:46] Jones. >> Hi, [13:47] » Commissioner Jefferson. >> Hi, [13:49] » Commissioner Price. >> I, [13:51] » Commissioner Williams, >> I. The eyes have it. [13:54] » Thank you so much. And now we'll move on to our new business, which is U25-012 [14:00] 4285 Roosevelt Highway. Staff, can you please present the staff report? [14:08] » Yes. KCU2500012. The address is 4285 Roosevelt Highway. [14:14] The applicant is requesting a special use permit to operate a um for a [14:18] gasoline station with a convenience store to expand the existing facility [14:21] for an additional retail space and two new restrooms. The current zoning is C2 [14:26] and M2 um at again 4285 Roosevelt Highway. Staff is recommending approval. [14:31] And just uh some clarification, this is a parcel that contains two zoning [14:36] districts uh M2 and C2. Um I don't believe we have a but in your st in the [14:43] staff request it should be a zoning map that shows the two ca the two zonings on [14:46] the one parcel. Um we believe that we have a policy that whichever zoning [14:54] takes up the majority of the parcel is what that zoning is. So we consider this [14:58] a M2 zoning and that gas stations aren't allowed in M2 zoning. So that's why they [15:02] need a special use permit to operate and to expand. [15:09] Happy birthday. [15:20] » Thank you so much. Is the applicant here? [15:24] » I am. >> Okay, cool. Can you come up to the [15:25] podium? [15:29] » Good evening. Good evening. Um, okay. Can you go ahead and um say your [15:36] first and last name and address for the record? [15:37] » My name is Quinn Bennett and I'm the architect of record on behalf of the [15:41] owner. >> Okay. Thank you so much. You can go [15:44] ahead, sir. >> Yes. It's a simple um expansion 20 plus [15:49] feet um to add additional restrooms and um to clean up the store to enhance the [15:54] experience. >> My apologies, sir. I forgot to say I was [15:57] opening up the public hearing. Just wanted to say that for the record. So, [16:00] the public hearing is now open. So there's, you know, it's basically a [16:05] comprehensive remodel. The building will be completely gutted out and, you know, [16:10] the total doover um to enhance the experience for all I you know, all the [16:15] foot travel that comes into the store because it does get quite a bit of foot [16:19] travel. And you know, customers, they they like the space, they like the food [16:24] there, but um it they do complain about it being dirty. So, it was time for the [16:29] owner to kind of upgrade everything. So, we have an ADA um sink that we're [16:36] adding and bringing everything up to code. Um it it's pretty straightforward. [16:45] » This is his lot. >> So, that's the new store and we're [16:48] expanding expanding roughly 24 ft to the right of the existing um exit door at [16:55] the rear of the building. So, new counter, um, a a better kitchen [17:05] if you go to the right. [17:11] So, you also have a new game room. So, it it's more of the same thing. You [17:16] know, the space is very cramped, cluttered. You know, not everything fit [17:20] fitted on the shelf. and and they you know they're offering [17:25] a more enhanced experience. [17:34] I open the floor for any questions. >> Thank you so much. Sure. You can take a [17:40] seat for now. Do we have any cards? [17:46] » It looks like we only had one speaker card and that was for the applicant. No [17:51] one in opposition. >> Thank you so much. So, at this time, [17:56] I'll close the public hearing. Um, Commissioner, do you have any questions [17:59] for the applicant? Okay. >> Commissioner Perry, I recognize you. [18:04] » I just I just want to offer a clarifying question. [18:08] » Yes, sir. >> Your the establishment is already a gas [18:12] station. It's already a gas station >> and what you're asking to do is [18:16] basically clean up the gas station that's already there and add the [18:20] restrooms. >> Correct. [18:22] » Okay. I I say that because I I think y'all are for another case [18:28] and the case that was already that's being withdrawn. So this this case is [18:33] just to add bathrooms and clean up the existing convenience store gas station. [18:37] » That is correct. [18:45] Commissioner Williams, I recognize you. >> Um, yes, I have a question for you. [18:50] » Yes, ma'am. >> You said enhance the [18:54] customer experience. >> Correct. [18:57] » Okay. So, we're looking at new restrooms, [19:01] » correct? >> Right. Um, you said the counter. [19:06] » Yes. >> Right. [19:08] Can you tell me more about this game room? [19:10] » So, the game room is a result of the fact that the store is very much [19:15] unorganized. It has game machines all over the space and and I thought it [19:21] would be a good idea to actually clean that up so everybody can move through [19:25] the aisle cuz that's kind of a life safety issue in the event of a fire. I [19:29] don't need anybody tripping to get out of the space. So, um, you had where the [19:35] aisles are, where the merchandise is, you had game machines. And to me, that's [19:39] a code violation. >> So, I kind of separated the two and and [19:44] added a game room for the gamers. So, for to move their already existing [19:49] machines into one central location. Is the owner open to maybe some other um [19:57] enhancements? Maybe something that is beneficial to [20:03] um more of a and and and I know I don't [20:07] want to sound judgmental, but more of a um [20:12] options that are not just games. And and when I say games, because these [20:20] are the the the the slot machines, right? [20:23] » That's correct. >> Right. So, is the owner open to [20:27] providing some other enhancements that speak to maybe healthier food [20:32] options or maybe get rid of some of the packaged goods and and bring some other [20:38] enhancements in? >> That is something I think he would be [20:42] open to. [20:45] » Has he talked to the community and the residents that that actually come in to [20:49] his store? has he talked to the customers? [20:52] » Well, based on the community meeting I held, which didn't have a they had a [20:57] poor turnout, by the way, um the folks I did speak with um they were pretty much [21:03] there for the food that was already being served. [21:06] » Okay. >> And they seem to be happy with that. [21:09] » I mean, it's always it's it's always good to ask though because you never [21:12] know, right? >> We did have that conversation. [21:14] » Okay. So, >> good to know. Good to know. [21:18] » Thank you. >> Yes, ma'am. [21:22] Commissioners, are there any other questions for the applicant? No. [21:28] Okay. So, hearing that, we'll go ahead and [21:31] close this public hearing and we will move on to status finance effect. So, [21:36] I'll need a motion for that to approve or deny staff findings effect. [21:40] » I make a motion to approve staff's finding of facts. [21:43] » A second. >> It's been properly moved and seconded. [21:46] Can you please call the role? >> Commissioner Perry. [21:48] » I. Commissioner Re Jones. >> I, [21:51] » Commissioner Jefferson, >> I. [21:52] » Commissioner Williams, >> I. [21:54] » Commissioner Price, >> I. [21:56] » Eyes have it. >> Thank you so much. And the next vote is [22:00] going to be is going to be to approve, deny, or defer um U25-02. Is there a [22:05] motion? >> I'll move to approve U25-012. [22:13] Um, I move to approve that. >> Second. [22:19] It's been properly moved and seconded. Can you please call the role? [22:21] » Commissioner Perry, >> I. [22:23] » Commissioner Reven, I. >> Commissioner Jefferson, [22:26] » I. >> Commissioner Williams, I. [22:27] » Commissioner Price, >> I. [22:29] » The eyes have it. >> Thank you so much. And Matthew, what [22:33] meeting would this go to for the council? [22:36] » The November 12th council meeting. >> Okay. So, this will be heard at the [22:40] November 12th council meeting. And this concludes our cases for the night. Can I [22:44] get a motion? Oh, >> I move that we adjourn. Yes. Thank you [22:49] so much. Yes. Can I get a second? >> Second. [22:52] » Second. >> Okay. [22:54] » Okay. Well, this meeting is adjourned at 6:17 p.m. You all have a good night. [22:59] » I tried to push it out.
