[6:07] With our department, chief [6:11] flannery has served as [6:12] paramedic firefighter, ba tan [6:20] I -- battalion fire chief. [6:22] Chief flannery has invested [6:22] in [6:24] his own education, he was [6:24] able [6:26] to obtain his undergarage [6:27] walt [6:29] degree from san francisco [6:30] state, a doctoral degree f [6:31] the university of southern [6:32] california in education so, [6:33] he [6:34] brings a unique skill set and [6:37] a lot of capabilities to our [6:37] department. [8:13] christina has been in the [8:14] city [8:15] manager's office for six [8:15] years [8:16] and during that time, she's [8:19] worked on a number of [8:19] projects [8:21] including many grant [8:22] applications, many grant [8:23] reports, legislative niche [8:23] yat [8:26] I fevers such as minimum [8:26] wage, [8:28] styrofoam reach codes and [8:30] could back koe which we'll [8:32] hear about and emergency [8:32] response. [8:34] She has also been our [8:35] sustainability officer and [8:36] has [8:37] served as staff liaison with [8:37] a [8:40] null of outside agencies such [8:42] as wet sxa, the harbor [8:44] district, one of christina's [8:45] major projects has been to [8:48] establish a a community [8:49] district which is progress [8:51] thanks to her effort and is [8:51] we [8:52] hope it will be successful. [8:53] I think there's a special [8:54] bond [8:56] among the staff who served [8:58] during covid and christina [8:58] was [9:00] really instrumental in [9:02] organizing -- I'm getting [9:04] choked up -- covid was a [9:08] trying time, she was [9:10] instrumental in organizing [9:10] vaccination clinic, food [9:11] distributions, maintaining [9:11] the [9:12] continuity of operations as [9:14] well as staff morale and we [9:16] owe her a lot of appreciation. [14:47] I had the distinct honor to [14:50] work with project sentinel [14:51] where we helped numerous [14:51] south [14:54] san francisco residents with [14:55] tenant/landlord issues ask [14:56] fair housing issues. [14:59] You know, you would be [15:00] surprised at the fact of the [15:03] number of residents who will [15:05] get denied for rental units [15:05] or [15:08] for housing based upon their [15:11] gender or their age or the [15:15] fact they had children and it [15:17] was organization like project [15:19] sentinel who went above and [15:22] beyond to make sure all our [15:23] residents had accessible to [15:24] fair housing so I'm honored [15:25] to [15:26] recognize APRIL as fair [15:28] housing month and to read a [15:30] proclamation where it says [15:32] whereas housing is a basic [15:34] right of all people and where [15:36] this year we celebrate the [15:37] 57th anniversary of the [15:39] federal fair housing act of [15:41] 1968 which states that [15:42] discrimination t sale and [15:45] rental of housing is illegal [15:48] and based on race, national [15:49] origin, whereas the fair [15:51] housing amendment act extend [15:56] fair housing rights on [15:57] familial status to people [15:58] with [16:00] children, and whereas [16:02] california statutes protect [16:04] its citizens on the basis of [16:05] age, sexual orientation, [16:07] gender identity and source of [16:09] income and california [16:10] celebrates the 66th [16:11] anniversary of the fair [16:12] employment and housing act [16:12] and [16:14] whereas the city of south san [16:15] francisco supports fair [16:17] housing efforts to eliminate [16:18] discrimination in housing and [16:19] recognizes the benefits of [16:22] project sentinel to educate [16:23] home seekers, apartment [16:23] owners [16:25] on federal and state housing [16:27] laws and investigate [16:28] complaints of illegal housing [16:29] discrimination in south san [16:31] francisco, whereas the [16:32] heightened public awareness, [16:33] the city of south san [16:35] francisco wishes to focus [16:37] public attention of APRIL as [16:38] fair housing mother, now [16:40] therefore be it resolved the [16:42] city council of the city of [16:45] south san francisco does [16:47] recognize APRIL as fair [16:48] housing month and encouraging [16:49] all residents and community [16:49] organizations to celebrate [16:50] the [16:53] value of harm nows and diverse [16:54] [Inaudible] With neighbor and [16:56] is this is signed by the [16:57] entire city council and I'm [17:00] going to ask jacob to accept [17:04] this proclamation, jacob? [18:06] Cities like south city [18:07] provide [18:08] a lot for us and it [18:09] solidifies [18:10] the relationship that we have [18:14] with the cities that we work [18:14] with. [18:44] >> good evening, mayor, vice [18:46] MAY yo, councilmembers, billy [18:47] gross with the planning [18:48] commission and I have the [18:50] pleasure of presenting the [18:51] next speaker. [18:53] As you all know, the adu [18:55] resource center of san mateo [19:00] county opened in 2024. [19:02] It's intended as a one stop [19:03] shop for adu resources. [19:04] We thought it would be the [19:06] director had offered to come [19:08] and speak so we thought it [19:09] would be good as we were [19:10] going [19:12] to be in front of you talk [19:16] about the general plan and [19:17] housing project, so I would [19:25] like to introduce anna [19:26] alekseyeva, she'll go through [19:27] the program. [19:28] >> thank you for giving me an [19:30] opportunity to present the [19:30] adu [19:31] resource center. [19:32] I want to give you a sense of [19:35] what the center is all about [19:37] sdp&services it provides to [19:38] home owners in member [19:39] justices [19:39] teases including south city. [19:40] Before I do that, I wanted to [19:42] set the stage a little bit [19:44] about adu's in the state and [19:45] more locally which you will [19:48] probably be familiar with. [19:50] Adu's are really popular [19:52] housing typology, ever since [19:55] the state started [19:56] liberalizing [19:57] adu statute across [19:57] california, [20:00] the number of adu's that are [20:02] built every single year has [20:04] grown something like 15 [20:07] thousand percent, so hugely, [20:10] hugely popular housing type. [20:11] Most recent data suggesters [20:14] that one in five new units in [20:15] california housing units is [20:15] an [20:17] adu, if you look at lower [20:19] income or very low income, [20:20] housing units, that [20:21] percentage [20:23] is high e more than one third [20:24] of housing units are adu's, [20:25] so [20:26] of course it's not the only [20:28] housing type but it is an [20:29] important one across the [20:30] state [20:31] and more locally in sn mateo [20:33] and in south city. [20:35] And I think billy aluded to [20:37] the housing element and [20:38] progress the city has made [20:40] around the most recent rhna [20:42] cycle but south city has a [20:44] goal of producing almost 400 [20:47] adu's in the current 8 year [20:48] rhna cycle of which the [20:50] majority are projected to be [20:52] at the low icome or very low [20:53] income levels. [20:56] So we like adu's for a lot of [20:56] reasons. [20:58] One, because it's a housing [21:03] type and more housing is GOD [21:05] but they're also a housing [21:07] type, they allow for [21:08] multigenerational living, [21:09] they [21:12] have a wealth building tool, [21:14] they are smaller so they have [21:14] environmental and [21:15] sustainability benefit and is [21:17] we know older adults like [21:18] them [21:20] because they allow them to [21:20] age [21:21] in place without having to [21:22] leave their community. [21:24] Is wah is adu resource [21:24] center, [21:27] it was launched in SEPTEMBER [21:31] of 2024, so we just had our [21:33] six month birthday, not -- [21:34] still baby hood when it comes [21:36] to being an organization, but [21:37] wanted to share some of the [21:40] services we have live already. [21:41] Working with jurisdictions [21:42] and [21:43] with home owners. [21:45] It is a non-profit [21:46] organization, the funding [21:48] primarily comes from local [21:49] jurisdictions like south city [21:50] f city. [21:52] The goal is t drive housing [21:53] production by being a one [21:54] stop [21:56] shop to help get adu's built. [21:59] We do that through two [22:00] different mechanisms, one is [22:02] working with jurisdictions to [22:04] meet their adu policy goals [22:06] and the second is working [22:07] with [22:08] home owners directly [22:09] providing [22:10] resources and direct [22:10] technical [22:11] assistance so I wanted to [22:11] give [22:13] you a flavor of each of these [22:16] areas so you know what's [22:19] offered to residents and sto [22:20] -- to staff, the center [22:22] provides a raping of support [22:24] around housing element [22:25] implementation related to adu [22:27] policy goals, it elapses [22:28] jurisdictions stay in [22:30] compliance with hcd [22:31] expectations and understand [22:33] what the latest adu statutes, [22:36] rules and standards are. [22:37] And helps jurisdictions stay [22:40] up to date about the latest [22:42] adu best practices and what's [22:44] going on at the state level. [22:47] As you all probably know very [22:49] well, state housing law [22:51] changes rapidly, every sickle [22:53] year, that is the same for [22:53] adu [22:54] laws, so every single year, [22:56] there's a slate of new adu [22:57] bills that are passed and go [22:59] into effect and it can be [22:59] hard [23:01] to keep up with any o them. [23:02] And so one of the roles of [23:03] the [23:05] center is to make sure that [23:07] staff understand what the [23:08] latest rules and statutes [23:09] are, [23:11] going to go through a lecture [23:11] of the adu standards because [23:14] that would be an a hour [23:15] lecture, as you can see on [23:15] the [23:17] right hand side of the slide, [23:19] I noted a few laws that went [23:21] into effect this year, all of [23:23] them in some way, shape or [23:24] form encouraging adu's are [23:26] making it easier to build [23:27] adu's. [23:28] One law I want to call to [23:28] your [23:30] attention in particular is [23:32] legalization of unpermitted [23:34] units, so the state as of [23:37] JANUARY of this year has made [23:39] it easier the legalize [23:44] unpermitted adu's, we no in [23:47] some place, the ratio is one [23:48] to three depending on the [23:49] jurisdiction, this has a [23:51] potential to have pretty [23:52] substantial long term effects [23:54] down the road in terms of [23:55] bringing unpermitted units on [23:56] to the market. [23:57] Something else that the [23:57] center [24:04] is working on is it's working [24:07] on affordable adu program, [24:08] these programs have been [24:08] tried [24:09] in different place ins [24:10] california and adrsz [24:11] f cross [24:11] the knotty [24:12] f ri. [24:15] What they do is provide some [24:16] financial incentive for home [24:18] own teaser build an adu and [24:19] those home owners are [24:19] required [24:22] to rent their adu's at [24:24] affordable rates so it's [24:25] below [24:26] market rate housing program [24:28] that subsidizes home owners [24:28] directly. [24:29] There's interesting pilots [24:31] that have been tried in [24:32] different places that we're [24:34] exploring and the goal is to [24:36] have a program model that any [24:37] jurisdiction in the county [24:37] can [24:39] participate in with the goal [24:40] of launching next year, so [24:43] very excited about that and [24:44] innovating in that space. [24:46] And in terms of the services [24:48] to hope own oers, you can [24:48] find [24:53] a lot of information on the [24:54] website, smadu.Org, this is [24:55] just some of the resources we [24:59] have op the website, a very [25:00] comprehensive guide book [25:01] around the different stages [25:02] of [25:04] building an adu specific to [25:06] with local information, we [25:09] have local rules for every [25:10] jurisdiction including south [25:12] city, we have stories of [25:13] residents who have built [25:14] adu's [25:16] in different use case, we [25:16] have [25:18] a proprietary tol that [25:18] allows [25:21] people to put in some details [25:22] about a prospective project [25:25] and get an estimate of the [25:26] projected project cost and is [25:28] the return on investment [25:28] which [25:30] they can expect which is [25:30] based [25:32] on hyperlocal construction [25:32] data. [25:35] and w also do and [25:36] increasingly are rolling ot [25:38] service that is are direct [25:39] technical assistance to home [25:40] owners which we're excited [25:42] about, so starting next [25:43] month, [25:44] residents o member [25:45] jurisdictions, including [25:46] residents of city are going [25:48] the have ak says to a free [25:49] feasibility consult s [25:49] frs [25:51] where they can talk with an [25:53] adu expert for an hour, get a [25:55] sense of what is possible on [25:56] their property talk through [25:59] their goals and get a free [26:01] customized report on [26:01] recommendations. [28:28] >> absolutely, and there's a [28:28] - [28:31] new state law that's [28:32] referenced here, canonization [28:36] that is an optional law that [28:38] allows jurisdiction tos enact [28:40] an ordinance to sell the adu [28:41] separately. [28:48] >> yes, san jose enacted, [28:50] it's the first jurisdiction [28:51] statewide that enacted it and [28:52] san francisco is apparently [28:53] in [28:53] discussions. [31:43] I know staff was there, I'm [31:45] going plug them for our [31:46] westborough residents, make [31:48] sure you pay your water bill [31:48] on time. [32:09] And then last week I had a [32:11] town hall with about 50 [32:14] residents and we had a lot of [32:16] great questions from the [32:18] audience specifically about [32:20] traffic, about public safety [32:23] and we had the police chief, [32:25] the fire chief, public works [32:26] and we had a great [32:27] presentation about what's [32:29] coming in terms of our new [32:32] child care center up in [32:33] westborough and a lot of [32:34] great [32:36] feedback from residents, I [32:38] know we're following up for w [32:39] a lot of residents in term [32:40] ofs [32:40] their questions, I've been [32:43] doing it for the lst 7 years [32:44] now, to see all those [32:46] residents come out and ask [32:47] questions and engaging [32:48] witching staff because I know [32:49] this is how w can continue [32:49] to [32:51] engage with our residents and [32:54] a lot of things we're able to [32:58] accomplish in terms of stop [33:00] signs and curbs came from [33:01] these town halls, people were [33:02] interested how do I get a [33:02] stop [33:03] sign in my neighborhood and [33:06] there's a process for that. [34:09] The next day I found myself [34:12] and again the mayor was at [34:13] the [34:14] skyline college PRESIDENT's [34:15] breakfast and that's 7:30 the [34:17] morning, as many of you know, [34:20] I'm a little older than the [34:22] average colleague up here and [34:27] I don't do 7:30 willingly [34:27] very [34:28] often, he convinced he I [34:31] needed to be tere, it was my [34:34] first time building 12 at [34:36] skyline college, it looks out [34:38] into the pacific ocean and [34:40] it's inspirational, it's an [34:41] amazing venue for an event, [34:45] they had well over 240 people [34:48] there and they had a dj, mc, [34:52] and the music was gj quality, [34:54] the early hour and the dj [34:56] music, I found a table way in [34:57] the corner and it worked okay [34:59] for me. [35:02] The previous saturday on [35:02] MARCH [35:03] 15, I spent a lot hof time [35:09] with the mayor lately, he put [35:10] together cafecito, this was a [35:16] second one, this was on the [35:22] star bucks on mclellan drive, [35:23] I met new people in the [35:25] district and to see them get [35:27] involved and care about their [35:28] community and one of them is [35:30] in the audience tonight, [35:32] hello, anne trres, thank you [35:33] for joining us. [35:35] She's been a a resident of [35:37] south san francisco since the [35:39] 70's and to see hr [35:40] willingness to get involved [35:43] and play a role is truly [35:44] remarkable, so it was all [35:45] worthwhile. [36:19] This is a a great segway, [36:19] I've [36:20] mentioned we are looking for [36:22] people that might want to [36:24] travel to japan with the [36:25] sister city's committee, we [36:26] are not quite maxed out of [36:27] the [36:28] trip, there still might be a [36:29] a [36:31] couple of openings but I [36:32] understand that COUNCILWOMAN [36:33] Nicolas and her husband might [36:35] be joining us so there's even [36:36] less space. [36:40] Anyway, on SEPTEMBER 12th, we [36:41] fly to japan and we don't [36:43] return until the 27th but [36:44] we're going there to be part [36:47] of the sister city [36:48] international committee which [36:51] is being hosted in diernl not [36:53] going to get the name right, [36:55] in the small city daly city [36:57] is [36:58] twined with, we'll spend some [37:02] time in osaka, there's an [37:03] international expo that goes [37:05] for a number of months, we'll [37:07] be in osaka for a little bit [37:09] and find our way to tokyo [37:11] where we'll all be [37:11] overwhelmed [37:12] by the energy there and fly [37:14] home, so there are still [37:15] opportunities if you're [37:15] interested. [42:59] There's still many [42:59] individuals [43:00] that say, you live right [43:02] there, I liver right there, [43:04] you work right there, I'm a [43:05] history buff as the vice [43:06] mayor [43:09] knows and hearing about the [43:11] old macy's warehouses before [43:13] the costco years here in [43:13] south [43:14] city is a great time so I [43:15] appreciate that and we do it [43:16] in different ways. [43:18] We engage with our community [43:19] in different ways. [43:22] I was also happy to join [43:23] councilmember nagales at his [43:24] community meeting as well [43:25] websinger ear out there and [43:26] connecting and sharing the [43:27] information so I appreciate [43:30] all of you, everyone is [43:30] welcome, stay tuned because [43:31] we [43:32] have many more coming during [43:34] the course of this year. [43:49] We hosted and met our new [43:52] assembly member and the state [43:52] legislature, catherine [43:54] stephanie who represents [43:55] assembly dstrict 19, we [43:57] hosted her last week at south [44:00] city at our city hall and [44:01] discussed many important [44:03] policy issues, many assembly [44:04] bills but also things that [44:04] are [44:06] really important to south san [44:08] francisco and this is a great [44:10] opportunity to really say [44:10] this [44:12] has been something that has [44:14] ben filets our community and [44:16] we need additional support on [44:18] this, she was extremely open, [44:20] extremely welcoming and [44:21] extremely willing to work, [44:21] her [44:22] and her team, I want to [44:24] acknowledge and recognize we [44:25] have a strong -- another [44:28] representative in the state [44:28] legislature. [44:29] We're very lucky here in [44:30] south [44:31] san francisco, we have two [44:33] state senators covering, we [44:35] have two assembly members, we [44:37] have two also members of the [44:38] san mateo county board of [44:40] supervisors, we have two san [44:42] mateo county board of [44:44] education trustees, so we're [44:45] -- we're well represented and [44:50] again it's about advocacy, [44:52] it's about ensuring that our [44:54] policy priorities that we [44:54] will [44:56] discuss later are well spoken [44:59] for as well. [45:00] I did want to talk about [45:02] upcoming and you'll start [45:05] seeing some of the promotions [45:07] websinger are on APRIL 5 and [45:08] I [45:09] believe the 19th, we're [45:10] moving [45:12] forward with south san [45:13] francisco neighborhood [45:13] cleanup. [45:15] In particular, kick it off in [45:18] some of the areas most [45:19] affected, downtown, old town [45:21] where we see a lot of illegal [45:21] dumping. [45:27] We kicked tis off last year, [45:28] it was extremely successful. [45:28] Thank tos the support of our [45:29] staff, we couldn't do it, [45:30] also [45:30] our volunteer, people that [45:32] came out early on saturday [45:32] and [45:34] we held it it on sunday, this [45:36] year is both on saturdays, [45:40] this is part of an initiative [45:42] I'm so thrilled about, clean [45:44] ssf, part of that we envision [45:46] providing you with some [45:48] shovels, sme picks and some [45:50] garbage bag and is lending [45:50] you [45:53] some gloves and come out and [45:55] build community, cleaning up [45:56] our neighborhoods, you'll see [45:57] that on social media, you'll [45:59] see that in my newsletter [46:01] coming up so I want to [46:02] welcome [46:04] all residents, even visitors [46:06] of south san francisco to [46:08] partake and join me and staff [46:13] and let's clean up south san [46:13] francisco. [46:15] With that in mind, I'm excite [46:16] ted share with our city [46:18] manager that south san [46:20] francisco should be pursuing [46:21] the [Inaudible] Designation, [46:23] that is the clean california [46:23] designation. [46:24] I would like the share that, [46:27] this is a special initiative [46:30] designation put on by the [46:31] governor's office and managed [46:33] by cal trans and it really [46:35] honors communities that are [46:37] dedicated to doing something [46:38] about it, not just saying, [46:40] well, we got to blame so and [46:42] so or that agency has to come [46:44] up and step up for us, so it [46:47] really brings a sense of [46:48] community, it's improving the [46:50] health, it's improving our e [46:51] economy and it's really aso [46:58] as part of this designation, [46:58] it's allowing south city to [47:00] apply for money torx apply [47:00] for [47:01] grants that potentially could [47:04] support us in continuing to [47:07] clean up south city and all [47:08] locations in every area that [47:13] you can imagine, so, the [47:13] first [47:15] hundred designated [47:16] communities [47:16] will continue to receive this [47:17] resource. [47:18] There are already cities, [47:19] bakersfield, fresno, irvine, [47:21] la, can dewing that are part [47:22] of this initiative and I want [47:23] to se our city be [47:23] represented [47:24] as well. [47:26] Now just turning a little [47:28] different lens, I did want to [47:30] ask our city manager if we [47:31] could look into two items [47:32] that [47:34] I've been monitoring as I'm [47:36] driving around connecting [47:36] with [47:37] neighborhoods and different [47:39] shopping centers, there are [47:40] certain donation insets in [47:41] various parking lotuses and [47:43] shopping centers, one in [47:46] particular is the parking lot [47:48] right behind five guys [47:48] burgers [47:49] in westborough square, as I [47:55] was there this weekend, it [47:58] wasn't a nice sited to look [48:00] at, I would like to see if we [48:02] could work with the donation [48:04] vendor, how often they clean [48:06] up and that sort of thing. [48:07] The oher thing I started [48:10] noticing is on weekends, many [48:13] amazon trucks are parking for [48:15] more than whatever it is, [48:18] saturdays and sundays, taking [48:19] up perhaps a parking lot that [48:21] could be for residents so I [48:23] want to look at are there [48:26] amazon parking lots that are [48:27] designated, in particular in [48:28] district 5, I'm seeing in [48:29] many [48:31] of our surface city parking [48:34] lotuses, there's a lot of [48:35] amazon distribution delivery [48:36] trucks on there, so I would [48:37] like to follow up and discuss [48:39] a little bit on that. [50:02] The most recent e-mail to [50:05] attendees of magnolia teglia [50:08] center is they will be [50:13] relocated to the bola center [50:14] for months, and mingling [50:14] adult [50:16] widths daycare center where [50:18] mayor edie said it was a [50:21] concern having adults with [50:23] young kids. [53:37] What exactly is the city [53:38] council's outlook for south [53:39] san francisco? [53:40] Do they see south san [53:45] francisco as a mini me to san [53:46] francisco? [53:47] Additional apartments are not [53:48] the answer to those that have [53:50] been residents of south san [53:51] francisco for decades. [1:11:54] The housing element is one of [1:11:55] the 7 state mandated elements [1:11:58] of the general plan. [1:11:59] Although unlike the other [1:12:01] elements of a general plan, [1:12:04] the housing element must be [1:12:04] updated by deadlines set by [1:12:06] the state. [1:12:09] The t city adopted a new [1:12:12] housing element in JANUARY of [1:12:12] 2023 and the department of [1:12:13] housing and community [1:12:15] development or hcd certified [1:12:16] our housing element in [1:12:18] NOVEMBER 2023. [1:12:20] And this new housing element [1:12:21] covers a planning cycle [1:12:26] running from JANUARY 31, 2023 [1:12:28] through JANUARY 31, 2031, so [1:12:30] an 8 year period. [1:12:32] And again the housing element [1:12:34] is essentially the blueprint [1:12:35] for future housing [1:12:36] development [1:12:38] within the city ad it [1:12:39] includes goals, policies and [1:12:41] programs that will direct [1:12:45] residential decision-making. [1:12:48] The housing element -- sorry. [1:12:49] The housing element process [1:12:52] begins with the state setting [1:12:53] a regions regional housing [1:12:55] needs allocation or rhna [1:12:56] which [1:12:57] is the estimated number of [1:12:59] housing units that will be [1:13:01] needed over the 8 year [1:13:04] planning cycle to assist with [1:13:05] regional growth and trends. [1:13:10] The 8 year cycle for rhna [1:13:10] does [1:13:13] differ slightly by about 6 [1:13:15] months t rhna cycle run from [1:13:18] JUNE 30, 2022 through [1:13:18] DECEMBER [1:13:19] 15, 2030. [1:13:21] It's important to note with [1:13:22] rhna that these units don't [1:13:25] need to be constructed during [1:13:27] the time period, but the city [1:13:29] is required to ensure that it [1:13:31] is possible to build these [1:13:33] units trough appropriate [1:13:34] zoning. [1:13:35] New units are counted towards [1:13:38] rhna at the time of building [1:13:39] permit issuance and this [1:13:42] applies for all new [1:13:44] residential unit tpes, [1:13:44] single [1:13:47] family dwellings, accessory [1:13:48] dwelling units, duplexes, [1:13:52] duplexes and our larger [1:13:54] multifamily buildings. [1:13:58] The current rhna cycle sixth, [1:14:01] we were -- sorry, we were [1:14:04] tasked with our [1:14:05] responsibility [1:14:10] of 3956 units over the 8 year [1:14:12] period. [1:14:14] The rhna allocation is [1:14:15] further [1:14:18] divided into income levels. [1:14:20] There are four category, very [1:14:22] low, low, mod wrath rat and [1:14:23] above moderate. [1:14:24] These income categories are [1:14:27] based on the area median [1:14:29] income that is set by hcd for [1:14:33] each county. [1:14:36] The 2024ami for san mateo [1:14:39] county is 186 thousand 600 [1:14:40] dollars. [1:14:44] Very low category is [1:14:48] 30-50%ami, low is between [1:14:52] 50-80%ami, moderate falls [1:14:54] between 80-120%ami and above [1:14:56] moderate is more tan 100% [1:14:59] ami, so you can see the [1:15:02] allotment for the total rhna [1:15:04] numbers of 3956, the majority [1:15:07] of which are uder the above [1:15:14] moderate category. [1:15:15] For 2024, the city is [1:15:16] reporting building permit [1:15:20] issuance for a total of 62 [1:15:20] new [1:15:21] residential units. [1:15:24] This includes 6 sing m family [1:15:26] homes, 6 small multifamily [1:15:29] units which are units located [1:15:32] within 2-4 unit structures, [1:15:33] and 50adu's. [1:15:36] Again, new units that receive [1:15:37] building permit issuance [1:15:40] during the reported year are [1:15:42] what is counted towards the [1:15:44] current rhna allocation. [1:15:47] In addition to the new units [1:15:50] issued, a tet of 255 new [1:15:51] residential units were [1:15:52] finagled or received a [1:15:55] certificate of occupancy in [1:15:59] the 2024 reporting year. [1:16:01] The city also approved [1:16:02] planning entitlements for [1:16:02] five [1:16:03] new residential units during [1:16:04] the reporting year. [1:16:08] And the detailers for the [1:16:11] building permit issuance and [1:16:12] entitlements approved and [1:16:15] certificate of compliance [1:16:16] completion are found in [1:16:18] attachment 3 and 4 of the [1:16:25] staff report under table a-2. [1:16:26] So, this is the second year [1:16:27] of [1:16:32] the rhna cycle 6 eighty year [1:16:33] reporting cycle, [1:16:33] cumulatively, [1:16:34] the city is dewed building [1:16:37] perms for a total of 4.5% of [1:16:38] the expected housing units so [1:16:41] that's a total of 177 units [1:16:46] out of the 3956 units that [1:16:50] were allocated through rhna. [1:16:53] This is broken down into the [1:16:55] four income categories. [1:16:57] The city for above moderate [1:16:59] housing category, the city [1:17:01] issued building permits for [1:17:01] 36 [1:17:04] units or 1.9% of the rhna [1:17:05] allocation. [1:17:06] Moderate housing category, [1:17:06] the [1:17:08] city's issued building [1:17:08] permits [1:17:11] for 46 units or 6.4% of the [1:17:12] allocation. [1:17:13] For the low housing category, [1:17:15] the city has issued a [1:17:16] building [1:17:20] permit for 68 units or 13.5% [1:17:22] of the rhna allocation, the [1:17:24] very low housing category t [1:17:25] city has issued a building [1:17:28] permit for 27 units or 3.1% [1:17:28] of [1:17:33] the rhna allocation. [1:17:35] Thsz for the 2023 reporting [1:17:38] year ad then the 2024 [1:17:42] reporting year, cumulatively. [1:17:43] In addition to reporting [1:17:45] housing production to date [1:17:49] during the reporting year, we [1:17:51] also provide information on [1:17:53] our program implementation [1:17:54] status, as mentioned, a large [1:17:56] component of the city's [1:17:59] housing element are goals, [1:18:01] policies and products that [1:18:01] direct decision making, most [1:18:03] of these programs are [1:18:05] implemented and monitored on [1:18:06] an ongoing basis, however [1:18:07] some [1:18:08] programs have deliverable [1:18:09] dates throughout the housing [1:18:14] element cycle. [1:18:16] For the 2024 reporting year, [1:18:18] 7 [1:18:20] programs were completed. [1:18:20] These were all completed [1:18:22] through the adoption of a [1:18:24] zoning text amendment that [1:18:24] the [1:18:26] council approved and adopted [1:18:28] last JUNE. [1:18:30] The zoning text amendment [1:18:31] included amended definitions [1:18:34] of certain uses such as [1:18:35] emergency shelter, addition [1:18:36] of [1:18:38] some new use classifications [1:18:39] including low barrier [1:18:41] navigation center and [1:18:42] permanent supportive housing [1:18:46] as well as updates to the [1:18:47] development uses allowed [1:18:48] within different zoning [1:18:53] districts per state mandate. [1:19:27] So, if we do a good faith [1:19:29] effort in trying to reach our [1:19:32] rhna goals and we don't hit [1:19:35] those numbers, what are the [1:19:37] ramifications of us not doing [1:19:38] that? [1:19:40] >> great question. [1:19:43] So, technically there is no [1:19:45] penalty for not meeting the [1:19:48] rhna numbers but there are [1:19:51] certain provisions sb35 that [1:19:52] MAY take effect. [1:19:54] If a certain percentage of [1:19:54] our [1:19:58] rhna allocation is not met, [1:20:00] midway through the reporting [1:20:02] or the rhna cycle. [1:20:04] And those would include -- [1:20:04] and [1:20:07] I MAY call up tony rozzi for [1:20:07] help here. [1:20:11] But I believe they include [1:20:15] changing the process of [1:20:17] residential development [1:20:17] review [1:20:19] from discretionary to [1:20:21] ministerial if a certain [1:20:23] amount of affordable units [1:20:23] are [1:20:25] included in the overall [1:20:26] proposed residential [1:20:27] development. [1:20:28] >> so, in other words, if we [1:20:30] don't hit our numbers, a [1:20:32] developer can come in and [1:20:34] pretty much submit a project [1:20:37] and we would have to approve [1:20:38] it administrative, tony, do [1:20:40] you want to -- I really want [1:20:43] to be able to -- we [1:20:43] understand [1:20:44] these terms but I want to [1:20:45] make [1:20:47] sure the audience understands [1:20:48] this. [1:21:02] And sb35 is not new, it [1:21:03] applied to us in the last [1:21:04] cycle. [1:21:06] At the end of year four, [1:21:07] midway through the rhna [1:21:08] cycle, [1:21:10] that 8 year period, they want [1:21:13] to know that you're on track [1:21:13] -- [1:21:14] >> hang on, she can't hear [1:21:17] you. [1:21:25] >> sb35 applies and really [1:21:26] holds cities accountable for [1:21:29] how they're doing as far as [1:21:31] progress on their rhna cycle. [1:21:34] After year 4, w report back, [1:21:37] you know, have you met 50% of [1:21:39] your expected above moderate [1:21:39] units. [1:21:41] So, in this case, we have a [1:21:44] lot of above moderate units [1:21:46] assigned, almost over 1800, [1:21:47] so [1:21:51] we would want to see at least [1:21:54] 900 units permitted by the [1:21:56] fifth year in our rhna cycle. [1:21:57] Separately, they want to know [1:21:58] how are you doing with your [1:22:00] low and very low units, so [1:22:02] that will be our very low and [1:22:04] our low, that's almost 1400 [1:22:07] units so half of that would [1:22:08] be [1:22:09] 700 units half way through [1:22:09] the [1:22:11] rhna cycle. [1:22:13] If you are on track and [1:22:13] you've [1:22:16] met both of those numbers, [1:22:19] sb35 doesn't apply. [1:22:21] It is not out of the question [1:22:23] that we might have a stronger [1:22:25] next cuple of years but it [1:22:28] really depends on the market, [1:22:30] tariffs, interest rates, all [1:22:32] of those things affect [1:22:32] whether [1:22:33] a developer pulls a permit or [1:22:35] not but that culd be a [1:22:37] trigger for sb35, like [1:22:38] stephanie said, allows a [1:22:42] project to be proposed that [1:22:44] has no discretionary review, [1:22:46] no ceqa, they do have to use [1:22:47] prevailing wage and they do [1:22:49] have to provide affordable [1:22:54] units, so it's not a free -- [1:22:56] freebie for a developer but [1:22:57] it [1:22:58] limits a developer's [1:22:59] discretionary review. [1:23:00] Does that make sense? [1:23:02] >> yeah, that makes sense to [1:23:03] me. [1:23:05] So, let me dig a little [1:23:05] deeper [1:23:06] here. [1:23:15] So, when you say city report [1:23:16] building permits, you say [1:23:17] city [1:23:17] reported building permit and [1:23:21] is then you say planning [1:23:23] entitlements and I don't [1:23:24] think [1:23:28] the audience understands that [1:23:28] here. [1:23:30] For 62 residential units, [1:23:31] those are the numbers that [1:23:31] are [1:23:33] counted towards our rhna [1:23:33] numbers. [1:23:35] But when you say planning [1:23:37] entitlements, those numbers [1:23:39] are different. [1:23:41] Can yu briefly explain the [1:23:42] difference between those two. [1:23:46] >> yeah, I can and they can [1:23:46] -- [1:23:49] in the life cycle o a [1:23:50] project, entitlements are [1:23:51] your [1:23:52] first stage, you go through [1:23:53] the planning commission, [1:23:55] perhaps city council and you [1:23:56] get entitled for the ability [1:23:59] to now build those units and [1:24:01] you've met your ceqa [1:24:02] obligations, you've met our [1:24:04] design standards and we have [1:24:05] a [1:24:06] very streamlined process for [1:24:10] these projects. [1:24:11] That's entitlement, now you [1:24:13] take those pretty [1:24:13] architectural drawings and [1:24:14] you [1:24:15] turn them into construction [1:24:17] drawings and that could take [1:24:21] as quick as 3-6 months, 18 [1:24:22] months, you have up to three [1:24:24] years from your entitlement [1:24:24] to [1:24:26] get submitted for a building [1:24:26] permit. [1:24:28] Then you submit for a [1:24:28] building [1:24:29] permit, you go back and forth [1:24:31] with our plan check review, [1:24:32] with fire review, with [1:24:34] planning review. [1:24:37] When we issue that building [1:24:39] permit n that whatever year [1:24:42] that is which might be three [1:24:44] years after they're entitled, [1:24:46] we finally get credit in rhna. [1:24:47] Now the state wants us to [1:24:49] report, how did you do on [1:24:51] entitlements, do we we no if [1:24:53] you have stuff on the [1:24:55] pipeline, how are you doing [1:24:56] with issuing permits and now [1:24:58] can you tell us if you have [1:25:00] finagled those projects, are [1:25:01] they now down and people [1:25:04] living in them so that's the [1:25:04] reporting. [1:25:06] >> thank you for that [1:25:06] overview. [1:25:08] Here's what I'm looking at [1:25:10] these numbers, and tony, I [1:25:12] appreciate like the midway [1:25:13] report. [1:25:44] >> I'm looking behind me as [1:25:45] the puc projects that would [1:25:47] ramp up our numbers, right. [1:25:47] >> right. [1:25:48] Er [1:25:51] >> so, let me dig deeper, [1:25:51] when [1:25:53] I was looking at the [1:25:54] spreadsheet here, there were [1:25:56] some akronbacker ron anymore [1:25:58] which is lu, which means land [1:26:02] use, and it says 3.9 in terms [1:26:05] of the spreadsheet, that felt [1:26:06] with crating affordable and [1:26:07] workforce housing, I went [1:26:09] through all the data points [1:26:10] here. [1:26:12] They were talking about [1:26:14] working with the -- [1:26:15] potentially working with the [1:26:17] school district about [1:26:18] building [1:26:19] affordable housing sites and [1:26:19] I [1:26:20] know the school district's [1:26:21] been looking at this and I [1:26:25] know we do have the city [1:26:26] council's sdaol district [1:26:28] liaison committee and I know [1:26:30] it's o one of the priorities [1:26:31] in turnover the school [1:26:33] district but they do have [1:26:36] sites in terms of fox ridge [1:26:37] and sarah vista that [1:26:39] potentially could be housing [1:26:41] sites, so I'm looking at my [1:26:43] colleagues who serve on tat [1:26:44] subcommittee to really see [1:26:46] what the school district's [1:26:47] plan on that is and I know [1:26:49] again one of the things they [1:26:51] mentioned and they have to [1:26:52] look at it but honestly [1:26:53] they've been saying they [1:26:54] support some sort of [1:26:56] development there but they're [1:26:58] dragging their feet. [1:27:00] And if we're going to build [1:27:01] affordable housing and [1:27:02] workforce housing, I want to [1:27:03] see a partnership with the [1:27:04] school district so I'm [1:27:05] looking [1:27:06] at my colleagues over there [1:27:06] in [1:27:07] termser of moving that [1:27:08] forward [1:27:10] and I think jefferson high [1:27:11] school district is a perfect [1:27:13] example of how you build [1:27:13] those [1:27:16] unit, it's such a successful [1:27:17] model that other school [1:27:18] districts ares following that [1:27:20] model, it's a nationally [1:27:21] recognized program in terms [1:27:22] of [1:27:23] what they're doing so I want [1:27:24] to lesh from them in terms of [1:27:26] what we can do forward. [1:27:27] Okay. [1:27:29] There was another one here, [1:27:30] it [1:27:33] says land use 2.1 which is [1:27:35] prioritized development near [1:27:35] transit. [1:27:37] And we during our housing [1:27:39] element cnversation, we did [1:27:40] talk about development aong [1:27:42] the el camino corridor [1:27:42] because [1:27:44] we have seen the development [1:27:46] on the caltrain corridor, but [1:27:48] this is kind of the next kind [1:27:49] of section where we have to [1:27:50] look at in terms of [1:27:52] development because when you [1:27:54] build along transit, you get [1:27:56] people who start using [1:27:56] transit [1:27:58] and I know other cities are [1:28:00] looking along the el camino [1:28:02] corridor in termer of [1:28:03] development so as we mover [1:28:05] forward in terms of [1:28:06] development, these are going [1:28:07] to be the sections we're [1:28:07] going [1:28:09] to be seeing and you can see [1:28:11] it now in terms of where [1:28:15] across from the san bruno [1:28:15] bart [1:28:16] station, tere's already [1:28:19] development and the century [1:28:21] plaza, that's going to be [1:28:23] housing, that's along the [1:28:23] bart [1:28:25] corridor along the samtrans [1:28:26] core dhao,'s something we're [1:28:27] going to be looking at in [1:28:28] terms of development. [1:28:31] And there was another thing [1:28:33] that says crt which I don't [1:28:36] know what crt stood fr. [1:28:38] >> creation. [1:28:41] >> okay, it said 3.1, review [1:28:42] of cmmercial and housing [1:28:44] linkage fees. [1:28:46] So, that was supposed to be [1:28:47] helping us in terms of [1:28:49] building development but for [1:28:50] me, the pipeline is starting [1:28:52] to slow down and there was a [1:28:53] initial conversation at or [1:28:54] housing subcommittee the see [1:28:55] what with [1:28:56] f we can do in [1:28:57] terms of speeding up the [1:28:59] process and I know waun one [1:28:59] of [1:29:02] the things, we did hire a [1:29:03] strategic economic consultant [1:29:06] to look at that in terms of [1:29:06] housing and commercial [1:29:07] linkage [1:29:07] fees. [1:29:10] I look forward to have that [1:29:11] conversation in terms of what [1:29:14] we want to d with that [1:29:15] particular fee. [1:30:49] >> nell selander, economic [1:30:50] and [1:30:50] community development [1:30:52] director, what we're hearing [1:30:56] right now from some of the [1:30:57] larger developmental [1:30:58] directors [1:30:59] who are pulling their [1:31:00] building [1:31:02] permit and is sites now but [1:31:04] not yet pulled a building [1:31:05] permit for vertical [1:31:07] construction, it's not [1:31:10] interest rates, it's the [1:31:14] expected tariff wars and in [1:31:16] particular wood from canada, [1:31:18] so we even hve a project [1:31:19] that's not about to pull a [1:31:21] building permit but is doipg [1:31:21] a [1:31:23] lot of cost estimating and [1:31:26] that was contemplated as two [1:31:28] floors of concrete, so two [1:31:30] podium floors with four to [1:31:31] five stories of wood frame [1:31:33] construction above it and [1:31:33] they're now considering [1:31:37] pricing the whole building in [1:31:38] concrete because -- which [1:31:41] would be unheard of, three or [1:31:42] four or five years ago, [1:31:46] because of the volatility in [1:31:48] the timber markets because so [1:31:50] much of it comes from canada [1:31:52] and also because of fire [1:31:54] insurance and fire risk, [1:31:56] concrete buildings are less [1:31:57] risky in a a fire. [1:32:00] So, we MAY end up with [1:32:00] totally [1:32:01] different types of buildings [1:32:04] getting built in this sort of [1:32:06] economic cycle with the way [1:32:08] tariffs are and fire risk. [1:32:18] >> there's one bright spot in [1:32:20] this, this table a, the [1:32:22] housing development [1:32:23] application submitted, [1:32:23] there's [1:32:24] four different projects and [1:32:26] what I noticed was that in a [1:32:30] couple of them are mid size, [1:32:33] one is 64 units, one is 70, [1:32:36] and those are all to be owner [1:32:38] occupied, is that correct? [1:32:40] So that would be 500 [1:32:40] railroad, [1:32:41] the gateway project? [1:32:44] >> yes, the railroad [1:32:46] townhomes, and there's [1:32:47] another [1:32:50] project, 170, 180 south [1:32:54] spruce, approximately 64, 65 [1:32:54] row houses. [1:32:55] >> I understand that's [1:32:57] happening in the south bay [1:32:59] where some developers are [1:33:00] looking at previously [1:33:02] approved [1:33:03] entitlements for multifamily [1:33:04] with greater height but it [1:33:08] looks like there might be [1:33:08] some [1:33:10] financial advantages maybe to [1:33:11] townhouses and it would be [1:33:13] wonderful if we had something [1:33:14] available for sale where [1:33:17] people could come into south [1:33:17] san francisco, iv [1:33:20] ets, -- [1:33:21] invest, have a stake in the [1:33:22] action and stay here for a a [1:33:23] period of time. [1:33:25] One of the great [1:33:26] disappointments I had with [1:33:27] the [1:33:28] housing rental market, when I [1:33:29] hear the turn over rate can [1:33:30] be [1:33:32] as high as 30% annually, so [1:33:33] you have people that come and [1:33:34] visit us for a couple of [1:33:35] years [1:33:36] and then they go some place [1:33:37] else. [1:33:38] That's not a healthy [1:33:38] situation [1:33:40] for a community, so if this [1:33:41] becomes a trend, I think [1:33:43] there's some potential really [1:33:45] great news here where we have [1:33:48] properties for sale. [1:33:49] >> great. [1:33:52] So, this is why rhna's [1:33:53] important, so every city has [1:33:56] to do rhna, is that right? [1:33:57] Someone? [1:34:49] >> I will say that in cases [1:34:50] of [1:34:51] jurisdictions that are sort [1:34:52] of [1:34:53] blatantly bad actor, they [1:34:53] have [1:34:55] gotten letters from the state [1:34:56] attorney letting them know [1:34:59] that they are at risk of [1:35:01] losing funding for roads, [1:35:02] funding for things that are [1:35:04] not housing related that a [1:35:04] lot [1:35:08] of cities rely on. [1:35:10] We have not always met our [1:35:12] income levels in rhna but we [1:35:14] have often met the lump [1:35:15] number [1:35:16] and we did in the last cycle. [1:35:20] It's just very, very hard to [1:35:23] get and fund the level of [1:35:24] affordable, very low and low [1:35:26] income unit that is are [1:35:28] projected on most cities and [1:35:30] that's where sb35 sort of [1:35:31] creates a carrot for [1:35:33] developers and frankly a [1:35:35] carrot for cities to be a [1:35:36] good [1:35:37] actor and streamline. [1:35:38] >> great. [1:35:39] And as mayor and I know that [1:35:42] my colleagues share this as [1:35:44] well, this is important. [1:35:46] This iss what we get elected [1:35:46] o [1:35:46] do. [1:35:47] When I hear individuals say [1:35:49] you all are hiding behind [1:35:50] your [1:35:53] rhna numbers or using that as [1:35:54] a justification to build, [1:35:54] this [1:35:57] is happening all across [1:35:58] california and in cities that [1:36:00] perhaps don't even have space [1:36:01] to build, right. [1:36:02] They still have a a rhna [1:36:04] number to meet and areap na [1:36:05] allocation. [1:36:09] Tony, can you describe what [1:36:11] the builders' remedy is? [1:36:15] >> the builders' remedy is a [1:36:16] trigger lw that goes into [1:36:21] effect if you do not have a [1:36:23] compliant and certified [1:36:24] housing element, so, you can [1:36:25] adopt a housing element but [1:36:26] it [1:36:30] can be grossly failed to meet [1:36:32] the standards that hcd is [1:36:33] looking at. [1:36:35] Hcd has to certify your [1:36:36] housing element, until they [1:36:36] do [1:36:38] and once the housing element [1:36:40] cycle has started and this is [1:36:42] affected a lot of [1:36:43] jurisdictions including us, [1:36:44] there's a window where [1:36:45] someone [1:36:48] can come in on essentially [1:36:49] any [1:36:49] parcel anywhere. [1:36:50] Er [1:36:51] >> any neighborhood. [1:36:53] >> and propose whatever they [1:36:55] want with streamlining and a [1:36:56] lot of clearance. [1:36:59] It doesn't happen often but [1:36:59] it [1:37:00] is certainly -- there are [1:37:03] examples in berkeley, santa [1:37:04] monica, southern california [1:37:05] where these projects have [1:37:05] been [1:37:05] pro [1:37:06] ep proposed and once you [1:37:08] propose it, you then have a [1:37:10] right to that project in [1:37:11] perpetuity. [1:37:13] That cn be frightening for a [1:37:13] community. [1:37:15] >> great. [1:37:18] This has been as a result of [1:37:18] additional housing, right, a [1:37:20] lot of folks say we're in a [1:37:22] housing crisis. [1:37:52] Housing I important, we [1:37:53] could [1:37:56] certainly make it so that [1:37:57] there is affordablability in [1:37:59] south san francisco but these [1:38:01] are new implementations that [1:38:02] are like I said not just in [1:38:05] south san francisco but [1:38:10] anywhere you go I the state. Mayor, iped to [1:38:16] remind the audience, we just [1:38:17] recently passed an ordinance [1:38:18] that codified that if you [1:38:19] live [1:38:20] and work in south san [1:38:22] francisco that you would have [1:38:23] preferences, so I want to [1:38:25] remind folks, and also that [1:38:27] 3800 number in terms of [1:38:29] residents, number of units, [1:38:31] they did an audit on that and [1:38:33] we apparently -- everyone [1:38:35] according to what their audit [1:38:36] said was understood counted, [1:38:37] so our numbers could have [1:38:38] been [1:38:40] a lot higher than that than [1:38:42] what we have and I serve on [1:38:44] abag which is the association [1:38:45] of bay aea governments and [1:38:46] we [1:38:48] are talking about the [1:38:48] numbers, [1:38:51] the rhna numbers, so I will [1:38:53] have a big part in terms of [1:38:53] what those numbers are going [1:38:56] to be for the region and so [1:38:58] the more we can do now t [1:39:00] better it is for us in terms [1:39:01] of what our rhna numbers ae [1:39:03] going to be for the next [1:39:03] cycle. [1:44:35] It responds directly to the [1:44:37] economic and visual [1:44:38] challenges [1:44:39] created by persistent vacant [1:44:41] store fronts in our [1:44:41] commercial [1:44:42] corridors. [1:44:44] Launch local supports first [1:44:46] time brick and mortar [1:44:48] businesses through leases and [1:44:49] a tenant allowance up to 10 [1:44:51] thousand dollars and targeted [1:44:51] outreach. [1:44:53] The intent is to lower [1:44:55] barriers to entry and pilot [1:44:56] retail concept that is have [1:45:01] long term potential. [1:45:02] Council provided thoughtful [1:45:03] and clear direction in [1:45:05] FEBRUARY which shaped the [1:45:06] final program before you [1:45:07] tonight. [1:45:08] You voiced support for [1:45:09] activation goals and [1:45:11] emphasized the importance of [1:45:12] prioritizing south san [1:45:13] francisco residents. [1:45:15] There was particular interest [1:45:17] in reactivating the former [1:45:18] barbershop space and concern [1:45:20] was raised about limiting [1:45:21] participation to a one year [1:45:23] lease term. [1:45:24] You also encouraged us to [1:45:26] create a model that private [1:45:27] property owners could adopt. [1:45:29] That input is reflected in [1:45:33] tonight's proposal. [1:45:35] I would also like to raise a [1:45:37] related item for council [1:45:38] discussion tonight. [1:45:40] Since the FEBRUARY 12 study [1:45:42] session, the city has [1:45:42] received [1:45:43] multiple inquiry from [1:45:44] existing [1:45:46] businesses, both local and [1:45:47] from neighboring cities, [1:45:48] interested in leasing the [1:45:50] grand avenue spaces at market [1:45:51] rate rent outside of the [1:45:54] launch local program. [1:45:55] One formal lease proposal has [1:45:57] already been submit and had [1:45:57] we [1:45:59] anticipate receiving another [1:45:59] soon. [1:46:01] Notably one of the interested [1:46:03] parties is an existing south [1:46:04] san francisco business [1:46:04] looking [1:46:06] to open a second location and [1:46:08] lease both of the city owned [1:46:09] storefronts on grand avenue [1:46:11] include lg the former [1:46:13] barbershop space. [1:46:15] Given this interest, staff is [1:46:16] requesting council's [1:46:16] direction [1:46:18] on whether to continue [1:46:19] reserving these spaces for [1:46:21] launch local or to consider [1:46:23] market rate lease proposals [1:46:24] separately? [1:46:26] Your input will help [1:46:26] determine [1:46:29] how we -- your input wll [1:46:29] help [1:46:30] determine how we proceed with [1:46:32] these spaces while we [1:46:33] continue [1:46:36] rolling out the broader [1:46:36] program. [1:46:37] The name launch local was [1:46:40] selected through a survey of [1:46:41] key stakeholders including [1:46:42] city staff, elected officials [1:46:44] and staff pr the renaissance [1:46:46] entrepreneurship center at [1:46:46] the [1:46:48] economic advancement center. [1:46:49] It reflects both the [1:46:50] program's [1:46:51] focus on local [1:46:52] entrepreneurship x the [1:46:54] opportunity for participants [1:46:55] to launch their first [1:46:57] physical [1:46:57] location. [1:46:59] It's memorable, energetic and [1:47:01] rooted in place. [1:47:02] Branding icluding a logo is [1:47:07] currently in development. [1:47:09] The program has four key [1:47:12] object tiers, first activate [1:47:13] underutilized retail spaces [1:47:14] in [1:47:16] south san francisco, 2, [1:47:19] support emerging for profit [1:47:22] businesses, particularly those [1:47:23] without a prior brick and [1:47:23] mortar presence, 3, encourage [1:47:25] unique and experiential [1:47:26] retail [1:47:29] or service concepts, and 4, [1:47:30] prioritize local [1:47:31] entrepreneurs [1:47:34] especially gaduates of the [1:47:35] renaissance entrepreneurship [1:47:36] center programs at the [1:47:40] economic advancement center. [1:47:41] Under this pilot, the city [1:47:43] will lease out ipsbacker its [1:47:44] own vacant retail spaces on [1:47:47] grand avenue and el camino [1:47:50] real at a discounted rate at [1:47:57] $1 per square foot. [1:47:58] The standard lease term is [1:47:59] one [1:48:00] year with performance based [1:48:05] options for renewal. [1:48:08] The rfi will open on APRIL 1 [1:48:10] and close on APRIL 30. [1:48:12] All proposals must be [1:48:13] submitted electronically [1:48:15] through procure now. [1:48:16] We'll promote the opportunity [1:48:19] broadly through the city's [1:48:21] channels, the chamber of [1:48:22] commerce and the eac. [1:48:23] Materials will be available [1:48:23] in [1:48:24] english and spanish with [1:48:25] other [1:48:30] translations upon request. [1:48:32] eligible applicants must be [1:48:33] for profit businesses seeking [1:48:35] their first south san [1:48:37] francisco location, offering [1:48:38] a [1:48:39] retail or experiential s [1:48:41] frs [1:48:41] concept. [1:48:42] Demonstrating readiness and [1:48:45] capacity to operate including [1:48:46] financial sustainability, [1:48:48] priority will be given to [1:48:49] renaissance program graduates [1:48:52] aligning with their goal to [1:48:55] uplift local entrepreneurs. [1:48:57] The lease will be 12 months [1:48:57] in [1:49:00] duration with monthly sales [1:49:01] evaluations, structured as [1:49:03] triple net meaning tenants [1:49:03] are [1:49:04] responsible for property [1:49:06] taxes, insurance and [1:49:07] utilities [1:49:09] and tenant improvement costs [1:49:11] are reimbursed as a rent [1:49:11] credit, performance and [1:49:13] consistency will be evaluated [1:49:14] monthly and successful [1:49:15] tenants [1:49:19] MAY be invited to extend. [1:49:21] Tenants will pay a security [1:49:23] deposit of $2 per square [1:49:24] foot, [1:49:25] operate at least 7 hours a [1:49:28] day, five days a week, cover [1:49:29] costs for insurance, [1:49:31] utilities, garbage and [1:49:32] maintain shared spaces and [1:49:34] hold a valid city of south [1:49:34] san [1:49:38] francisco business license. [1:53:44] As far as the tenant [1:53:45] participation, it is -- a [1:53:46] dollar a square foot is a [1:53:48] great deal but all those [1:53:48] other [1:53:50] things add up rapidly too, so [1:53:52] it's quite a commitment for [1:53:54] someone coming out of a home [1:53:56] business or just a concept, [1:53:56] so [1:53:57] anyway, but generally I like [1:54:00] the idea and you were [1:54:01] wonderful in kpix. [1:54:16] I think I kind of share the [1:54:18] concerns in terms of like el [1:54:20] camino real versus grand [1:54:20] avenue. [1:54:23] You know, one of the things I [1:54:24] was thinking about, you know, [1:54:27] if we place this business on [1:54:29] grand avenue, they do well, [1:54:30] eventually they have to [1:54:31] rotate [1:54:34] out or we could maybe extend [1:54:36] the lease as well, is that [1:54:37] another option? [1:54:40] The idea is to rotate to have [1:54:44] a -- not a rediscovering [1:54:48] involver -- revolving door, [1:54:49] but a pop up business, you [1:54:51] would help the tenant either [1:54:53] locate somewhere else, I [1:54:53] that [1:54:54] correct, or -- [1:54:55] >> yes, we could do that. [1:54:58] >> okay, but at that point, [1:54:59] they're paying potentially [1:55:00] full market value? [1:55:01] >> correct. [1:55:03] >> and that potentially [1:55:04] could [1:55:05] be a problem as well because [1:55:07] they were paying a pretty [1:55:08] good [1:55:10] rate and hopefully they were [1:55:11] start in terms of saving [1:55:11] their [1:55:13] money and doing the right [1:55:15] business model so they're [1:55:16] reminded, hey, this is only [1:55:18] temporary, you're going to be [1:55:19] here, we want to establish [1:55:22] your business and then [1:55:24] potentially rotate out into [1:55:25] another location, so I think [1:55:27] that's going to be on you and [1:55:29] staff to say, okay, you could [1:55:31] have a good business model in [1:55:32] the sense, you have to get [1:55:34] ready for the full market, [1:55:34] you [1:55:36] know, so I kind of want -- a [1:55:39] long way of singing on what [1:55:42] are you asking them to help [1:55:43] them relocate, I know it's [1:55:45] early but I want you to be [1:55:47] thinking about that. [1:55:49] >> yeah, we haven't gotten [1:55:51] that far in that planning [1:55:52] process, but that's part of [1:55:55] the reason why we want to [1:55:56] prioritize renaissance [1:55:56] graduates because they've [1:55:58] gone [1:56:02] through an extensive business [1:56:03] class and, you know, city [1:56:04] staff will be available to [1:56:06] help them and renaissance [1:56:09] staff will be available to [1:56:10] help them, so, they learn [1:56:12] these skills of like if [1:56:13] they're even capable to be [1:56:16] running a brick and mortar [1:56:17] business ad hopefully [1:56:20] scavenging aving -- saving [1:56:21] some money e even if they [1:56:23] can't hit that market rate [1:56:27] rent, maybe it if it's 75% [1:56:28] market rate, so that's all [1:56:29] things we'll have to play out [1:56:34] when we see those numbers. [2:06:25] Tonight my presentation [2:06:27] involves an overview of the [2:06:29] city's rotational tow [2:06:31] program [2:06:33] and a request to update those [2:06:36] fees ask the industry [2:06:37] standard [2:06:38] for city ins san mateo county. [2:06:41] The police department have [2:07:00] vehicles removed from the [2:07:01] [Inaudible] Insurance [2:07:02] requirements, alcohol and [2:07:02] drug [2:07:04] testing loosing kaix of where [2:07:06] those storage lots are, [2:07:08] response times, safeguarding [2:07:09] vehicles and following the [2:07:10] maximum rates that tow [2:07:12] companies can charge for [2:07:13] police generated tows are [2:07:13] some [2:07:15] of those regulations. [2:07:19] Those regulations ensure that [2:07:21] tow companies provide safe [2:07:21] quality service to our [2:07:22] community and their vehicles [2:07:23] are accessible and within [2:07:24] secured storage facilities if [2:07:27] south san francisco. [2:07:28] A police generated tow [2:07:28] request [2:07:33] can happen for a variety of [2:07:33] reasons. [2:07:35] And those could include a [2:07:36] vehicle that's blocking a [2:07:39] roadway and cannot be safely [2:07:41] moved, certain violations of [2:07:43] the vehicle code like [2:07:43] blocking [2:07:44] someone's driveway and we're [2:07:46] unable to get a hold of that [2:07:47] owner, parking in a a posted [2:07:48] construction zone, a marked [2:07:50] tow away zone and we can't [2:07:50] get [2:07:53] a hold of those owners and [2:07:55] also when certain cases when [2:07:56] a [2:07:57] driver's arrested, the [2:07:57] vehicle [2:07:58] can't safely remain parked at [2:07:59] the scene. [2:08:03] We do make attempts to locate [2:08:05] the owner and have the [2:08:06] vehicle [2:08:08] moved prior to it being towed [2:08:10] in the crcumstances where we [2:08:12] have that ability to make [2:08:14] that [2:08:15] decision. [2:08:16] Our mximum allowable tow [2:08:18] rates have been unchanged [2:08:20] since 2016 resulting in our [2:08:22] rates being the lowest of the [2:08:23] 8 jurisdictions in northern [2:08:25] san mateo county. [2:08:29] Tow companies like other [2:08:31] businesses have expressed [2:08:34] experiences with increased [2:08:35] operational costs like rent, [2:08:37] equipment, fuel, insurance [2:08:37] and [2:08:40] labor costs, per our [2:08:41] municipal [2:08:43] code, those police maximum [2:08:47] allowable tow fees can be [2:08:49] adjusted after a review from [2:08:50] the police department and [2:08:51] after speaking to a [2:08:51] designated [2:08:54] representative of those tow [2:08:54] companies. [2:08:55] And conducting a survey of [2:08:58] what the other rotational tow [2:09:00] companies in northern san [2:09:03] mateo county cities charge. [2:09:05] The current fee in south san [2:09:08] francisco for a basic tow fee [2:09:09] is $225. [2:09:10] After meeting with the [2:09:11] representative of the tow [2:09:14] companies, we conducted a [2:09:19] survey, as you can se on the [2:09:20] chart, san francisco fees are [2:09:23] the lowest of those 8 cities [2:09:27] in northern san mateo county. [2:09:29] The srvey that we conducted [2:09:31] taking south san francisco [2:09:32] out [2:09:35] showed an average of $323 per [2:09:36] tow as being the average [2:09:37] levering south san francisco [2:09:40] in as one of the 8 -- the [2:09:44] average would be $311 per tow. [2:09:45] The tow companies in addition [2:09:46] to the survey, the tow [2:09:48] companies have proposed we [2:09:49] increase the basic tow [2:09:50] service [2:09:52] fee to $325 so they remain [2:09:54] comparable to other [2:09:55] jurisdictions in northern san [2:09:56] mateo cunty. [2:10:00] On our next slide, you will [2:10:03] see what those proposed rates [2:10:06] would be and the additional [2:10:07] services that are involved in [2:10:09] towing vehicles. [2:10:11] It's important to note that [2:10:12] most vehicles only require a [2:10:15] basic tow and a basic storage [2:10:16] fee. [2:10:16] On some occassions, [2:10:17] specialized equipment lke a [2:10:21] flat bed a dolly, or a more [2:10:22] heavy duty medium sized heavy [2:10:24] duty or super duty truck are [2:10:27] needed to safely remover a [2:10:29] vehicle, a bus, a larger [2:10:31] vehicle from the safe -- [2:10:35] safely from the road. [2:10:38] On our next slide, if the [2:10:40] proposed fees were accepted [2:10:42] and approved, this would show [2:10:44] where south san francisco [2:10:47] would be with those adjusted [2:10:48] rates, it's not at the very [2:10:49] top, it's in the middle, [2:10:53] comparable with the other [2:10:55] agencies. [2:10:57] In speaking with a couple [2:10:58] other agencies in northern [2:10:59] san [2:11:00] mateo county, I learned that [2:11:01] there are other cities on [2:11:02] this [2:11:05] list that are looking to also [2:11:06] evaluate and adjust their [2:11:09] rates to keep them current [2:11:11] with the industry standard. [2:11:14] As noted in the staff report, [2:11:15] but worth mentioning tonight, [2:11:17] all all of the proposed fees [2:11:18] we're talking about do not [2:11:19] get [2:11:20] paid to the city, these are [2:11:22] paid to the tow truck [2:11:24] companies and for their [2:11:26] services in towing these [2:11:28] vehicles dependent upon the [2:11:29] circumstances. [2:11:31] So, in conclusion, the [2:11:33] rotational tow program [2:11:34] establishes a standard level [2:11:36] of service that tow companies [2:11:38] must provide, it's regulated, [2:11:40] when performing their police [2:11:42] generated tows, the maximum [2:11:44] allowable tow fees have been [2:11:46] unchanged since 2016 and [2:11:47] currently don't accurately [2:11:49] reflect the industry standard [2:11:51] for northern san mateo county. [2:11:52] It's recommended that city [2:11:54] council review and adopt the [2:11:55] proposed rate adjustments for [2:11:57] the maximum allowable fees [2:11:59] associated with police [2:11:59] generated tow services. [2:13:08] >> yes, that is a south city [2:13:09] of south san francisco fee [2:13:11] that's in our master fee [2:13:14] schedule for the processing [2:13:15] of [2:13:16] paperwork, the mailing of [2:13:18] notices when a vehicle gets [2:13:22] towed to the registered [2:13:23] owner, that's the [2:13:25] administrative costs that are [2:13:27] paid to the police department [2:13:28] when there's a police [2:13:31] generated tow. [2:13:33] >> so I want to get that [2:13:34] process correct, when [2:13:36] someone's car gets towed, not [2:13:39] only are they paying [2:13:40] potentially a $325 towing [2:13:41] fee, [2:13:43] but now they're paying this [2:13:43] administrative fee as well? [2:13:44] >> yes, that's correct. [2:13:47] And that's a vehicle release [2:13:47] fee. [2:13:49] >> which is $160 now. [2:13:49] Er [2:13:52] >> yes, it is. [2:13:54] >> okay, has there been a [2:13:54] time [2:13:56] when an individual has come [2:13:56] to [2:13:58] the towing company and sy I [2:14:00] can't pay for these fees, [2:14:00] it's [2:14:01] too high. [2:14:02] Is there like a payment plan [2:14:05] that a person can do in terms [2:14:06] of trying to release the [2:14:09] vehicle? [2:14:10] >> in speaking to at least [2:14:10] one [2:14:13] of the companies, they did [2:14:15] express an option case by [2:14:15] case [2:14:16] based on the circumstances [2:14:19] where a payment plan might be [2:14:23] an option but it's also [2:14:25] somewhat o a risky option if [2:14:27] the vhicle is being released [2:14:28] and there's an agreement that [2:14:30] doesn't get fulfilled. [2:14:34] >> now, the person's already [2:14:34] being penalized already, and [2:14:36] for those who are potentially [2:14:37] low income and having a [2:14:39] difficult time paying for [2:14:40] these fees, a lot of the [2:14:41] folks [2:14:42] rely on their vehicle to get [2:14:45] to work or to get to point a [2:14:48] to point b, so I'm just [2:14:49] trying [2:14:50] to understand what the [2:14:50] process [2:14:52] is in terms of if someone is [2:14:53] having a difficult time [2:14:54] paying [2:14:54] for it. [2:14:56] If the person can't pay for [2:14:58] it, the car is going to be in [2:15:00] storage and now they can't [2:15:03] travel, you know or I guess [2:15:04] they have to take public [2:15:05] transportation in this case z. [2:15:09] >> from speak toing the tow [2:15:11] companies, the tow fee and [2:15:11] any [2:15:13] associated storage fees [2:15:16] usually isn't the hurdle that [2:15:18] needs to get over in order to [2:15:21] get the car out. [2:15:24] Oftentimes, there is [2:15:24] associated expired [2:15:26] registration fee that is are [2:15:28] owed to dmv that ae required [2:15:30] to be paid in current prior [2:15:31] to [2:15:32] getting thing vehicle [2:15:32] released [2:15:34] and back to them. [2:15:39] Also if there are other [2:15:40] circumstances, a driver's [2:15:41] license if the registered [2:15:43] owner has a a dmv issue that [2:15:45] needs to be corrected, there [2:15:46] might be something that needs [2:15:49] to be handled at dmv prior to [2:15:51] going to the tow to address [2:15:52] the basic fee and storage. [2:15:55] >> thank you for answering [2:15:56] that, I wonder if this is a a [2:15:57] hindrance in trying to [2:15:58] release [2:16:00] the vehicle, but it sound [2:16:00] like [2:16:02] that's not the main issue. [2:17:17] >> if a vehicle is recovered [2:17:19] stolen vehicle, if the [2:17:19] registered owner is the [2:17:20] victim [2:17:21] of a crime and it's towed as [2:17:21] a [2:17:24] result of that crime, our fee [2:17:27] at the police department can [2:17:32] be wavered by us vered -- [2:17:33] wavered by us under those [2:17:33] circumstances. [2:17:35] The other fee that is are [2:17:36] assessed by the tow [2:17:37] companies, [2:17:38] if there's isurance [2:17:38] involved, [2:17:41] whether it's triple a or some [2:17:43] other type of insurance that [2:17:44] has coverage on whatever [2:17:45] other [2:17:45] circumstances happened, I [2:17:46] know [2:17:48] that that is an option for [2:17:51] what was described to me as a [2:17:51] reimbursement from those [2:17:53] companies, maybe an upfront [2:17:54] charge with the insurance [2:17:56] reimbursing at a later time, [2:17:58] but more specifically I might [2:17:59] need to refer to one of the [2:18:02] tow companies for how the [2:18:07] processing of the transaction [2:18:08] would be. [2:18:25] So, probably 95% of the tows [2:18:27] that we are doing are [2:18:27] normally [2:18:29] not the situation you're [2:18:30] describing, they're only [2:18:30] about [2:18:32] 5% of the tows we're doing. [2:18:33] The majority of the tows [2:18:33] we're [2:18:35] doing are people that have [2:18:37] violated laws, have not paid [2:18:39] their registrations, are [2:18:40] driving without driver's [2:18:42] licenses and in some cases [2:18:44] many of the cases the cars [2:18:46] we're towing, probably 50% of [2:18:47] the cases we're doing in [2:18:48] south [2:18:50] san francisco is abandoned [2:18:50] vehicles. [2:18:52] So, it MAY seem like a lot of [2:18:53] money to you guys as you're [2:18:54] processing this, what you [2:18:55] need [2:18:56] to understand is that more [2:18:58] than 50% of these vehicles, [2:19:00] probably more like 65 or 70 [2:19:02] percent of these vehicles are [2:19:03] never being picked up. [2:19:05] You guys have done a [2:19:05] wonderful [2:19:06] job in south san francisco [2:19:07] and [2:19:08] being here tonight, this is [2:19:09] amazing and beautiful and [2:19:11] we're doing our part to help [2:19:13] keep your streets clean. [2:19:15] So, what we're asking for is [2:19:15] a [2:19:16] rate increase because of the [2:19:18] fact that our businesses, [2:19:19] you've heard it from your [2:19:21] planning department and [2:19:22] everybody else, things have [2:19:24] gone through the roof. [2:37:10] Good evening, councilmembers, [2:37:11] christina fernandez, your [2:37:12] deputy city manager, I'm here [2:37:14] tonight to provide an update [2:37:17] and seek your approval for [2:37:18] our [2:37:19] flavored tobacco regulations [2:37:20] such that they cmply with [2:37:23] recent changes to state law. [2:37:26] With me tonight, I have our [2:37:29] team, lieutenant sair wyatt, [2:37:32] shawn occur, from the [2:37:35] tobacco's county education [2:37:37] team, myra daoe yez ramirez [2:37:41] and director of public works, [2:37:42] bob, so I want to thank them [2:37:44] for their efforts during this [2:37:45] process. [2:37:46] So again we're seking [2:37:49] council's approval to amend [2:37:49] the tobacco retailer permit [2:37:51] and adopt the county's [2:37:52] ordinance by reference. [2:37:55] I'm also going to update you [2:37:57] on our retailer outreach and [2:37:58] education efforts and then [2:38:00] provide you with next steps [2:38:01] on [2:38:03] tobacco education and [2:38:03] engagement efforts. [2:38:05] So, one of the primary [2:38:05] reasons [2:38:07] for the city's efforts around [2:38:09] tobacco is due to the rise of [2:38:13] vaping by mouther, there's 15 [2:38:15] thousand flavors online, 93% [2:38:17] of youth who started vaping [2:38:21] start witched a flavored [2:38:22] product, 96% of high school [2:38:23] students who vape use flavor [2:38:27] and is 9% of san mateo [2:38:29] high-schoolers vape. [2:38:29] Vaping requires nicotine salt [2:38:31] which is highly concentrated [2:38:33] and bad for developing [2:38:33] brains, [2:38:36] it can cause anxiety and many [2:38:39] other detrimental health [2:38:40] effects. [2:38:42] So just a little background [2:38:42] on [2:38:45] past actions, back in 2008, [2:38:48] the city adopted the county's [2:38:49] tobacco retailer permit [2:38:51] ordinance by reference and [2:38:53] that essentially said that we [2:38:55] were requiring all tobacco [2:38:58] retailers to maintain a valid [2:39:00] tobacco retailer permit and [2:39:02] that we would have the [2:39:03] county's environmental health [2:39:05] division enforce those [2:39:05] permits. [2:39:08] In 2012, we then passed an [2:39:10] ordinance prohibiting new [2:39:12] significant tobacco retailers [2:39:14] and a significant retailer [2:39:14] has [2:39:17] 20% or more of their floor [2:39:19] area space and/or 50% or more [2:39:21] of their completed sales [2:39:23] transactions including [2:39:24] tobacco [2:39:27] products or paraphernalia, [2:39:30] back in no. 2019 when I came [2:39:30] on board, there was an [2:39:33] interest on behalf of council [2:39:36] to pursue a flavored tobacco [2:39:37] banser we pursued that, it [2:39:40] bans the sale of flavored [2:39:42] tobacco in all businesses [2:39:43] except for all adult retail [2:39:45] and he iser they only allow [2:39:45] 21 [2:39:47] and over on their premises [2:39:47] and [2:39:49] that was effect tier JANUARY [2:39:52] 1, 2020. [2:39:54] So, there have been some [2:39:56] recent changes to state law [2:39:58] which would necessitate these [2:40:01] updates to our ordinance. [2:40:04] In 2022, voters upheld senate [2:40:07] bill 793 which prohibited e [2:40:09] cigarette and is apes and [2:40:13] other tobacco items listed on [2:40:16] the screen, methane [2:40:18] cigarettes, flavored blunt [2:40:20] wraps, loose leaf roll your [2:40:22] own tobacco, rolling papers, [2:40:25] flavored, and tobacco product [2:40:27] flavor enhances, it did [2:40:28] exempt [2:40:29] flavored premium sig gars [2:40:30] with [2:40:31] the wolesale price of $12 or [2:40:34] more and it also exempted [2:40:37] flavored loose leaf, pipe [2:40:40] tobacco and flavored sheik ka [2:40:42] hookah tobacco which MAY only [2:40:46] be sold in adult only [2:40:49] retailers. [2:40:53] Another couple recent bill, [2:40:56] ab3218 and sb1230, ab3218 [2:40:58] creates an unflavored tobacco [2:41:01] list and that list is [2:41:01] supposed [2:41:03] to be released by the [2:41:03] attorney [2:41:05] general by the the end of the [2:41:06] this year, products not on [2:41:07] this list would be considered [2:41:10] a flavored product. [2:41:14] Sb1230 or the stop act [2:41:15] complements 3218 such that it [2:41:19] allows the state to seize [2:41:20] flavored tobacco products not [2:41:22] on that list and it imposes [2:41:24] civil penalties on retailers [2:41:28] and wholesalers. [2:41:30] So, in 2023, the city receive [2:41:33] add a let frer the county [2:41:35] saying, listen, thankers for [2:41:37] adopting the 2019 flavored [2:41:39] tobacco ban because our [2:41:40] ordinance was modeled on [2:41:41] that, [2:41:43] however, we did make [2:41:43] exceptionbacker exemptions [2:41:44] such that all the other [2:41:45] cities [2:41:48] throughout the county also [2:41:49] made exemptions so there's a [2:41:50] patch work of ordinances out [2:41:51] there. [2:41:54] In order to reduce logistical [2:41:56] challenges with enforcing [2:41:58] various city ordinances [2:41:58] around [2:42:00] tobacco, the county said [2:42:00] we're [2:42:03] going adopt a new tobacco [2:42:04] retailer ordinance and have [2:42:06] stronger enforcement, have [2:42:06] retail restriction and is [2:42:08] there will be proximity [2:42:11] restrictions for new retail [2:42:12] businesses and they really [2:42:13] encouraged cities to adopt [2:42:15] this so there's a more [2:42:17] streamlined approach to [2:42:17] enforcement and [2:42:18] administration [2:42:21] of the retailer program. [2:42:25] So, the new county tobacco [2:42:26] ordinance requirements, it [2:42:28] does clean up some of the [2:42:30] language such tat it aligns [2:42:32] with sate law, so tobacco [2:42:34] prugt is then defined to [2:42:35] include synthetic nicotine [2:42:37] which in the past it did not [2:42:39] and it also expands the [2:42:40] definition of electronic [2:42:42] smoking device to include [2:42:45] non-nicotine products. [2:42:47] It also has issues around [2:42:48] proximity of where new [2:42:50] retailers could be located [2:42:53] such that it prohibits new [2:42:55] tobacco permit for any [2:42:56] location within a thousand [2:42:58] feet of the youth populated [2:43:02] area that could include [2:43:05] schools, public rec centers, [2:43:07] libraries, child care [2:43:08] facilities, preschools, those [2:43:10] are all considered youth [2:43:11] populated areas. [2:43:13] It also prohibits the issue [2:43:13] of [2:43:16] new permits with locations [2:43:22] within 500 feet within an [2:43:23] existing tobacco retailer, [2:43:24] posting of retailers unless [2:43:26] they have a permit and it [2:43:27] updates such that it [2:43:29] streamlines with new state [2:43:31] laws by increasing the age of [2:43:35] 21 years to purchase tobacco [2:43:36] products. [2:43:37] So what does this mean for [2:43:40] existing retailers? [2:43:42] Upon discussions with county [2:43:45] staff, we understand that if [2:43:47] retailers meet one of these [2:43:48] three requirements, they will [2:43:49] be designated as a [2:43:50] preexisting [2:43:53] business and not subject to [2:43:54] new proximity requirements. [2:43:56] So, if a retailer previously [2:43:59] held a a tobacco permit under [2:44:01] the county's environmental [2:44:02] health services, if they're [2:44:03] register witched the state's [2:44:05] department of tax and fee [2:44:07] administration as a tobacco [2:44:09] retailer or if they hold a [2:44:10] south city business license [2:44:12] and is listed aa tobacco [2:44:14] retailer, then they would be [2:44:15] considered a preexisting [2:44:16] business and not have to get [2:44:16] a [2:44:19] new permit and be subject to [2:44:21] the thousand feet and the 500 [2:44:26] feet requirements. [2:44:28] So, the new county ordinance [2:44:31] also mandates fines for any [2:44:32] violations, it increases the [2:44:34] fines up to $500 for the [2:44:34] first [2:44:36] violation and up a to [2:44:36] a [2:44:38] thousand for all subsequent [2:44:39] violation, it requires permit [2:44:40] suspension if a a business is [2:44:43] found to have sold to someone [2:44:45] under 21 and it requires [2:44:47] on-site inspections by the [2:44:48] county's environmental health [2:44:49] services department at least [2:44:52] twice a year. [2:44:54] So, some retailer and [2:44:55] community engagement, I [2:44:55] really [2:44:58] want to thank pd for their [2:44:59] assistance here. [2:45:00] We mailed out business [2:45:01] letters [2:45:03] to approximately 100 [2:45:04] businesses who we thought [2:45:05] might be affected. [2:45:09] We also did three information [2:45:10] sessions, two in person and [2:45:14] one virtual and we also did [2:45:15] an [2:45:16] online tobacco retailer [2:45:18] survey, we targeted that with [2:45:19] the ecd distribution list we [2:45:22] have online and we also did [2:45:23] some social media posts [2:45:24] around [2:45:25] the survey encouraging folks [2:45:27] to take it. [2:45:30] And we also did in person [2:45:31] retailer visits such that we [2:45:33] visited about half of the [2:45:34] retailers that we have on [2:45:35] file [2:45:38] and we went and we spoke with [2:45:40] businesses and informed them [2:45:43] of the upcoming changes and [2:45:44] let them know how this could [2:45:46] potentially affect their [2:45:47] business and answered any [2:45:49] questions they MAY have, [2:45:50] overall most of the [2:45:50] businesses [2:45:54] said we haven't sold flavored [2:45:56] tobacco in four or five years. [2:45:57] There were questions around [2:45:59] sofm the other products such [2:46:02] as like flavored cigars, I [2:46:03] guess folks had questions [2:46:04] about that. [2:46:06] And so, yeah, overall, folks [2:46:07] didn't seem to really have [2:46:09] questions and they all seemed [2:46:10] to indicate they were [2:46:14] compliant with existing state [2:46:14] law. [2:46:17] So, for the next steps, you [2:46:21] know, currently chapter 20 of [2:46:23] our money code [Inaudible] [2:46:26] Chapter 20 is referenced in [2:46:27] chapter 6.47 which will be [2:46:28] repealed if this is approved [2:46:30] tonight, just to ensure [2:46:32] consistency the throughout [2:46:32] our [2:46:35] municipal code, staff will be [2:46:37] bringing chapter 4.20 to the [2:46:38] planning tuition for their [2:46:39] review and back the city [2:46:40] council for their review and [2:46:41] approval. [2:46:42] That being said, separate and [2:46:44] apart from that, I this [2:46:45] ordinance is approved [2:46:46] tonight, [2:46:47] we would go for a second [2:46:49] reading on APRIL 9 and this [2:46:50] would then be effective 30 [2:46:52] days from that reading so [2:46:52] we'd [2:46:55] think about MAY 7. [2:48:22] >> that was kind of the [2:48:22] conversation that the [2:48:23] previous [2:48:24] council had in terms of [2:48:26] making [2:48:27] sure that we are not damage [2:48:29] thing or hurting their [2:48:30] business in a sense because [2:48:33] that was a big topic amongst [2:48:33] us. [2:48:36] And so I kind of wanted [2:48:37] clarification on there's like [2:48:39] signage sometimes I see that [2:48:42] sells -- that says flavored [2:48:42] tobacco being sold. [2:48:45] Is that now being restricted [2:48:50] in terms of advertisement? [2:48:51] I'm trying to understand how [2:48:51] that -- [2:48:52] >> yeah, so, as I understand [2:48:54] the new county ordinance, [2:48:57] unless you have a valid [2:48:58] tobacco retailer permit, you [2:49:00] would not be able to [2:49:00] advertise [2:49:02] tobacco products. [2:49:04] >> so, if you had a valid [2:49:07] license to sell flavored [2:49:09] tobacco, you are able to have [2:49:10] that signage? [2:50:40] >> good ever wantoning, yes, [2:50:42] the department of justice [2:50:44] tobacco grant we received, [2:50:45] our [2:50:49] primary goal is to provide [2:50:51] education since the [2:50:52] implementation of the grant, [2:50:53] we have gone out to the [2:50:54] businesses, provided [2:50:54] pamphlets [2:50:57] and information on our [2:50:57] current [2:50:59] muni code on tobacco [2:51:00] products, [2:51:02] checked t see that they were [2:51:05] in guidelines with our muni [2:51:08] code, so should we adopt the [2:51:10] new muni code, we would go [2:51:10] out [2:51:13] and implement the new muni [2:51:14] code, povide eucation, we [2:51:16] would not be enforcing it at [2:51:17] this time and just ensure [2:51:18] that [2:51:19] all the businesses understand [2:51:22] that the muni code, so our [2:51:25] primary action is education [2:51:26] before enforcement. [2:51:27] >> now I've seen the [2:51:28] education [2:51:30] process when we implemented [2:51:30] this. [2:51:32] I started seeing the flavored [2:51:34] tobacco getting taken away [2:51:36] like for like the wall fronds [2:51:42] or the 7th [Hr-e/]-elevens [2:51:42] where they were primarily [2:51:43] being sold, I was seeing [2:51:43] those [2:51:44] taken out. [2:51:46] The last question is the [2:51:48] hookah tobacco, the ordinance [2:51:50] says if that's still [2:51:50] permitted [2:51:55] if a business that's I guess [2:51:58] allowed 21 -- 21 or older on [2:51:59] the premise, if you're a [2:52:02] business that has that, you [2:52:05] can still continue as long as [2:52:07] an adult -- I don't want to [2:52:09] use your terminology in terms [2:52:10] of 21 and ogler. [3:00:21] In addition, since it is [3:00:23] agendized as a letter of [3:00:24] support, colleagues, some of [3:00:27] you might be hearing or [3:00:27] seeing [3:00:30] our second state senator [3:00:31] scott [3:00:35] wiener is supporting a [3:00:35] regional transportation [3:00:37] measure that potentially [3:00:37] could [3:00:38] support and bring in support [3:00:42] for san mateo county to [3:00:44] support caltrain as well as [3:00:45] to [3:00:47] support bart. [3:00:50] at this level, I wouldn't be [3:00:53] able to, sky, bring in [3:00:53] support [3:00:55] because one of our [3:00:55] councilmembers is connected [3:00:56] to [3:00:57] that, is that correct, if I [3:00:57] wanted to -- [3:00:59] >> he would just rcuse [3:01:00] himself. [3:01:01] >> okay, well, we're looking [3:01:03] for and when I was talking to [3:01:05] the city manager, many of [3:01:07] these agencies are looking to [3:01:10] not be part of this regional [3:01:11] transportation measure and [3:01:12] only three counties instead [3:01:13] of [3:01:14] four counties, however, the [3:01:18] bill has now been designed [3:01:18] for [3:01:20] counties or cities to be able [3:01:22] to opt in. [3:01:24] If san mateo county wants to [3:01:26] opt in to b able to [3:01:26] participate. [3:01:28] I think as a city that [3:01:29] heavily [3:01:31] is supported by caltrain as [3:01:33] well as -- or has the [3:01:34] influence of caltrain and [3:01:34] bart. [3:01:36] This is important for us. [3:01:38] This is a measure that [3:01:40] potentially would be able to [3:01:44] support a path to potentially [3:01:46] relieve the debt that [3:01:47] caltrain [3:01:48] currently has and bart [3:01:51] currently has. [3:01:52] There's mixed opportunities [3:01:52] right now. [3:01:55] I think where we stand is I [3:01:57] believe samtrans board will [3:01:57] be [3:01:59] taking a position of I, a [3:02:01] position on this ballot [3:02:04] measure or potential ballot [3:02:05] measure, a senate bill right [3:02:07] now next week and I wanted to [3:02:09] see if there's interest so [3:02:11] that our city manager could [3:02:13] express not a position [3:02:14] particular but just to say, [3:02:19] hey, tink about thens -- [3:02:23] city ins north county, daly [3:02:24] city, south san francisco [3:02:24] that [3:02:25] we have caltrain and bart, we [3:02:27] have to be at the table, we [3:02:28] can't completely be excluded [3:02:30] aout of a potential funding [3:02:32] mechanism that will support [3:02:34] contra costa, al la immediate [3:02:35] da and san francisco and not [3:02:38] be at the table when these [3:02:39] discussions are potentially [3:02:41] funding support would come [3:02:42] through. [3:02:45] That is potentially what this [3:02:45] regional transportation [3:02:49] measure would look like right [3:02:49] now. [3:02:57] >> so, I believe we have -- [3:02:58] there's no language for ab650 [3:03:01] that we should have a more in [3:03:02] depth discussion on ab650 [3:03:05] because I know that it can go [3:03:07] in various directions. [3:03:09] For sb63, I think it's [3:03:11] important we continue to [3:03:13] collaborate with our regional [3:03:16] partners for some sort of [3:03:16] deal [3:03:18] that makes sense for san [3:03:18] mateo [3:03:19] county but ensures we are [3:03:20] getting funding and [3:03:24] contributing to the funding [3:03:26] that would save caltrain and [3:03:29] bart from the fiscal cliff [3:03:31] that they are facing because [3:03:34] we are potentially going to [3:03:38] see massive, massive cuts o [3:03:43] the entire system of bart and [3:03:47] I think it needs to be known [3:03:49] that 43% of transit riders [3:03:49] who [3:03:51] start in san mateo county end [3:03:56] up outside of san mateo [3:03:56] county. [3:03:57] That is a fakts. [3:03:58] We can't just have -- and I [3:04:00] know this is a great council [3:04:04] and we understand this but [3:04:05] with the county as an [3:04:06] audience, we have to [3:04:09] understand that public [3:04:09] transit [3:04:11] does not start and stop in [3:04:11] san [3:04:12] mateo, it is regional. [3:04:16] We need to be part of the [3:04:18] solution that saves public [3:04:19] transit in the region but [3:04:20] also [3:04:21] ensures that it is the most [3:04:23] seamless experience possible. [3:04:27] There are some south in the [3:04:30] county who believe that only [3:04:31] caltrain is worth saving. [3:04:33] There are twice as many [3:04:33] riders [3:04:35] on bart than there are [3:04:37] caltrain in san mateo county. [3:04:39] And there are many people who [3:04:41] take caltrain and then [3:04:41] connect [3:04:43] to bart to get to their place [3:04:47] of work or connect to other [3:04:49] areas and so we need to [3:04:52] strongly express that we want [3:04:54] to continue san mateo [3:04:55] county's [3:04:56] collaboration in this transit [3:04:56] measure. [3:05:00] I think right now we are at a [3:05:01] cross roads where we could be [3:05:02] included or we could not be [3:05:07] include -- included and the [3:05:09] recent involvement that some [3:05:11] of our county's leaders have [3:05:14] had with mtc and with bart [3:05:14] has [3:05:15] been very antagonistic that [3:05:17] has led us to where we are [3:05:19] today and it's a shame but [3:05:22] right now it is a time for [3:05:22] leadership and collaboration [3:05:24] and we have to work on a deal [3:05:25] that makes sense that ensure [3:05:27] that is our public transit [3:05:28] agencies are well funded for [3:05:31] the people of san mateo [3:05:33] county. [3:06:23] Am I pretty much -- and we [3:06:24] experienced wat happened and [3:06:26] I had a conversation with [3:06:29] nick [3:06:33] nicolo, our lobbyist up in [3:06:34] sacramento, and he was [3:06:38] interested in what happened, [3:06:39] I [3:06:41] requested to the city manager [3:06:42] to do a letter on what [3:06:43] happened that night, there's [3:06:45] an interest in doing this, I [3:06:47] would like to see us doing [3:06:49] that moving forward, not [3:06:50] taking a position about it [3:06:50] but [3:06:51] explaining to the author, [3:06:51] this [3:06:53] is what we experienced when [3:06:54] we [3:06:55] allow for public comment [3:06:56] happening on vao [3:06:57] m where we [3:06:58] really couldn't control it.
