Tonight, I wanted to talk about the difference between ownership, possession and access. Sergeant Jones's police cruiser will be helpful to this analogy. Uh, we may colloquially, colloquially refer to the patrol car that Sergeant Jones uses as Sergeant Jones car. The city may allow him exclusive use of the car to drive between his home and workplace and perform police duties while in Southgate, but he's not likely permitted to take the vehicle on family vacation. Access to the vehicle may be restricted at any time, and what we refer to as Sergeant John's vehicle today could be reassigned, reassigned to another officer the moment that Sergeant John's employment ends with Southgate Police Department, ownership of the vehicle becomes clear. Sergeant John's patrol car was never Sergeant John's patrol car. He only had access to it. The city of Southgate owns the car. When considering what's collected by FLoC, the contract states that the agency or the Southgate Police Department owns the data. You might be surprised that Facebook also claims that their users own their own data. Ownership of anything digital becomes a bit convoluted, because the duplication and subsequent possession of duplicates does not revoke possession of by the originator. FLoC owns cameras that produce the data that they allow paid subscribers to access. Just like canceling Netflix. As soon as you end your contract with FLoC, you lose access to the platform data. They claim that you own. You can download the data ahead of time, of course, but FLoC retains the data in perpetuity under the facade of training, as stated in your contract. So while the data collected by FLoC can be accessed and possessed as a digital duplicate by their customers, ownership implies control. Once the data is collected by FLoC, there is little to no control that the South Gate Police Department, with a total annual budget of 1.5 million, is going to exercise over an $8 billion company domiciled outside of Kentucky, with over 500 million in annual revenue and access to the best lawyers in the country. Nor can South Gate exercise control over any other agency in possession of the duplicated data collected from Fox platform. The claim of ownership is of anything is predicated upon a tested, legal and established regulatory framework, which simply does not exist in regard to Flock's platform data, which is collected. But the reality of flock cameras and any similar technology being sold by axon, Motorola, and Verkada is completely different. These cameras are not just Alpers, and to portray them as such is completely false. That's like saying my iPhone is just a phone. The technological capabilities of these cameras go far beyond snapping photos of license plates. The fact that hundreds of cities across the US have now installed over 140,000 of these cameras means that flock has effectively created an interconnected system of mass surveillance, owned by a private company who has no interest in protecting the liberties of the American people on whom it spies. An article released earlier today by 404 Media and Wired shows that software running on the flock cameras explicitly detects people recording where they appear in an image, and how confident the software is in its detection. This article also states that flock cameras do collect video data in the form of MP4 files. This information is in direct contrast to previous conversations that we had at our own safety committee meeting on Monday night. If flock is lying about, or at the very least misrepresenting their technology and its capabilities, what else are they lying about and why? Um, you know, one of the things was discussed about the hackers and I know Miss Rice sent me that, that And there was a story on a some investigative journalist did about how the system was hacked. Well, flat out says in here, first of all, it's a felony to cut down and steal a camera. That's another story. They manipulated the system. Well, certainly if you manipulate the system. I mean, if you broke into the police department right now, you're going to get guns, you're going to get all kinds of good stuff. So you're going to break into a flat camera and manipulate the system. You could get some data. You're not going to get names and date of birth. So because they're not in that system, in that camera. And the one thing they talked about getting photos of, of people, and it talked about that in this in this article. Well, those were on motorcycles. So I would argue that that is maybe one of the problems with it. It's going to get. However, it's also getting the back of that motorcycle rider. If they have a helmet on, you're not seeing who it is anyway. Um, If Richmond is standing alongside the road and a car goes by right next to that, of course it's going to get him in the photo as well. So whoever if you're standing. However, I do want to state the facts versus misnomers based on what I, I know and have seen regarding the cameras in weeks and even some misnomers relating for Southgate and you all know what those are, and I appreciate the information that's here and the information that we received is pretty much overall what we're hearing is those are good, those are good. Those are good responses. I've researched the fly cameras concern many times over. I think you all know that. I sat with our police department one afternoon to get a better understanding of the flock system here in Southgate. I've spoken with mayors and city administrators from other cities who have had or are working with flock cameras that have them installed or have taken them out, or both. As many of you know, I attended the Judiciary Committee meeting in Frankfurt of the House, joint House and Senate Judiciary Committees on Thursday, September 3rd. I've also done a pretty good share of spending time and listening to all sides, both pro and con, of the topic. There's no doubt that the cameras have assisted many agencies and have been used as a tool in solving felonious crimes throughout our country. However, we know the system operates. How is how the system operates. We understand the concerns of our residents and the public, one of which is who is driving the system for for flock and where on the cloud driver is located. It's in Virginia that we're we're told in by the company that Mark had mentioned. The police chief in Elizabethtown testified to the joint committee, along with the representative from flock and representative from the Retail Association of Kentucky in Frankfort. They spoke in positive fashion, but within an open mind to adjusting requirements for all alpr, including flock by by the state, which would affect cities and counties for whatever they came across with any statutes or policies, they testified, as well as representatives from the state and national ACLU and organizations. Those organizations listed procedure and policy differences. However, they seem willing to work with the legislature to find common ground. Questions were asked of flock in the representative from Ian, the police chief from the committee members. Throughout that session. Both were open to discussing options for retention and use, which will no doubt be presented in the next session early next year. The chief quoted a recent resolution to a stolen vehicle ring in Lexington, where vehicles were found in Radcliff and E-Town. Due to the lock system, I came away with the feeling that the the judiciary committees from both the House and the Senate would create a bill or bills together to retain or seize the Alps with modifications to procedures if retained, and policies for use with such with such Alps in the future. No doubt this will resurface in the early 2027 legislative session when they return in 2027. I believe we will see a bill or bills for reestablishing the use with procedure and policy guidelines. I'll tell you the outcomes I gained from the meeting in Frankfort. Meeting with our police department regarding the cameras and understanding our internal procedures, and listening to you all in our residence at the last Council meeting in before who voiced their opinion, as well as the activity by surrounding cities in in our in Hamilton County over in Cincinnati since our last council meeting. Our police chief and the police chief of Elizabethtown, as well as to the other presenters in Frankfort, and the questions and the. Were in answers that were received by the Judiciary Committee. Um, having seen and listened to all gave me an even better understanding and feeling of this topic. I came away with these takeaways. One to keep the cameras, to suspend the use until more defined policies and procedures are put in place with the legislature in three cc, the operation of all LAPRS entirely. As you know, I gave this to the safety committee at the last council meeting, and they were charged with with coming back with a recommendation. I think I just mentioned the three that are out here. Uh, Mark did a good job in putting that together with Paul and also with John as well. So understand that the South Gate Police Department is fully complied with all current and I stress the word. Current state and federal laws and mandates relating to flock cameras and alpr, even to the point of reducing our storage retention from the 30 day time limit, which we now have as a mandatory now down to seven days. Internally, the South Gate Police Department has helped our city be ranked as the second safest city in Kentucky by Safewise in 2425. I can also I can also assure our citizens of South Gate that the South Gate Police Department conducts themselves accordingly to their internal six page policy procedure and use this tool in a very professional manner, acting responsibly when it comes to taking action while using the flock system. So as a as a member of the board and a past president of the Kentucky League of Cities, I intend to bring this matter to our Board of Directors next week. When we meet on Tuesday, we have an 80 member board that Encompassing the entire state of Kentucky from all over the state. We will meet in Covington in our annual conference starting next Tuesday.
