[0:11] Good afternoon everyone. We'll go ahead and get the Springdale Airport [0:15] Commission meeting called to order. Roll call vote, please. [0:21] A roll call, please. >> Greg Collier [0:24] » here. >> Joe Gardner [0:26] » here. >> Cameron McCarron [0:28] » here. Micah Thomasson, >> Steve Smith, [0:32] » I'm here. >> Mike Goff [0:34] » here. >> Jimmer [0:36] » here. >> All right. Thank you. Has everyone had [0:40] an opportunity to review the minutes from the January 15th meeting? [0:46] Any questions, comments? [0:51] » I make a motion we approve the meetings as written. [0:54] » I'll second it. >> A motion and a second. All in favor say [0:58] I. >> I. [1:00] » All oppose. Same sign. >> All right. Any comments from the [1:05] audience today? If so, you've got uh three minutes to address the commission. [1:11] Please state your name and tell us why you're here. [1:14] » Hi, my name is Don Cop. I've flown out of Springfield airport since 1991. [1:19] I have a plane base there. I filled out an application for board member uh [1:24] membership. I didn't get any official response. So, one, I wanted to know if I [1:28] need to do anything else. And then also, I was reading the requirements. Uh, do [1:32] you need to be a resident of the city of Springdale to be a member of the board? [1:37] I was a little bit unclear on that. >> I don't believe so, Ernest. That that's [1:41] no longer, is it? [1:52] I think you just had to be a qualified elector of the state. [1:59] » Okay. Well, that's good. I I didn't know for sure. I saw something in writing [2:02] that seemed to imply you had to be a Springdale resident, but um [2:05] » I can verify that. >> Okay. Good. [2:07] » One way or the other, we'll get whether it's through the mayor's office, but [2:10] we'll reach out to you. >> Okay, good. Uh, is there anything else I [2:15] need to do besides submitting the uh application? [2:18] » No, we don't have a vacancy on the airport commission currently, but uh if [2:23] you've submitted that then that did you submit that to the mayor's office? [2:26] » Uh, yeah, I did it online. So, I think it went to the mayor's office. Yes. [2:30] » Okay. Then I'm sure he has a copy of that and uh when the next availability [2:36] comes up then he can address that. >> Okay. Thank you. [2:39] » Thank you for coming in. [2:47] Okay, moving to number five on the agenda, discussion of hangar 501 [2:52] assignment. So, just to catch you up, uh this was brought to the [2:59] commission's attention in October. Um [3:06] we had Mr. Dodson come in. He had uh purchased an aircraft over a year ago [3:15] and wanted to keep the hanger. And I read to him and explained to him [3:25] in the lease agreement under number 11, subleting, [3:30] ley may not sublet the premises in whole or in part of assign or transfer this [3:36] lease or any interest therein without the prior written consent of the leor. [3:42] Any such assignment without the leor's consent shall be void and shall at the [3:47] option of less terminate this lease. And so I ruled uh after he had let us know [3:52] that he bought it over a year ago that that voided the lease agreement. Uh it [3:57] came to my attention that that needed to go to a vote and so we're here today to [4:03] readress this and take it to a vote. >> Can I Mr. Chairman may I add a little [4:08] more context? >> Sure. [4:10] » Uh what you stated is correct. Uh [4:15] the hanger the lease was to Dr. Makavoy prior prior to that was Mr. Storm. It [4:21] was transferred to Mr. Makavoy who then sold the plane to Mr. Dodson. It's my [4:26] understanding that the transaction of the sale of the plane is currently in [4:30] litigation and there is a possibility that the sale [4:34] of that plane uh that transaction could be voided. Uh [4:40] Mr. Dodson has indicated to me, I can't speak for him, he's here, but he has [4:44] indicated to me that he understands that he is responsible [4:48] uh if it the lawsuit does not turn out in his favor. Um that he will be subject [4:55] to the vote of this commission, but in the meantime, he does he does understand [5:00] and acknowledge that he's responsible for any rent due actually started from [5:04] October 22nd. Um, so I just wanted to bring that to [5:08] the commission's attention that there is pending [5:11] litigation involving the plane that's in this hanger. It it's not really apples [5:16] to apples, but it's similar to when sometimes we have a reasonzoning request [5:20] that might come to planning commission that there's a lawsuit over the property [5:24] and we're hesitant to take any action on the property while there's litigation [5:28] pending. So that's why I bring it to the commission's attention that there is a [5:33] possibility. I don't I don't know all the intricacies of the case, but but [5:37] there is a possibility that the sale could be voided and the plane would be [5:42] returned to Mr. Makavoy. Uh and then it would be up to the [5:46] commission whether to let him stay in the hanger or if Mr. Dodson prevails in [5:50] his lawsuit whether you let let it be assigned. But Mr. Dodson has indicated [5:54] to me that he would be willing to pay the rent that is due for the hanger in [5:58] the during the pendency of the litigation. [6:02] I think from conversation he's responsible for that rent [6:07] regardless. >> That's true. But we don't know how I [6:10] mean if you take a vote today versus we don't know how long the [6:14] litigation is going to go. Mr. Dodson has indicated to me that however long [6:18] the litigation may take whether it's a month or eight months. Court dockets are [6:22] slow sometimes, sometimes they're fast, that he's willing, whatever that time [6:25] period is, he understands that he's responsible for that rent in the [6:28] meantime. >> Okay. that that really doesn't to me [6:32] that doesn't really address why we're here and why we're meeting on this. The [6:37] and the reason for this coming back up is because a vote was not taken on this [6:44] back in October. I ruled on it as the chairman because president had been set [6:48] on these in the past um and it needed to go to a vote. So that's why we're here [6:54] to discuss that again. Mr. Mr. Dawson, do you have anything different from what [6:58] you presented in October today? [7:07] » Thank you. My name is Ray Dodson. I live at 3900 Shorts Lane, Springdale, [7:12] Arkansas. Just [7:15] briefly, this commission has voted [7:20] the last issue with summit hangers, head hangers. you've you've went ahead and [7:26] issued people that was not on the waiting list a hanger. So, I just want [7:31] to let you all be aware of that stipulation. [7:35] Like I told the city attorney, I'm not asking for any special favors. [7:40] I'm just simple asking you for consideration, [7:45] equal protection, none of the law. You gave it to one group, one guy, two of [7:51] the guys. And why not me? So, it's pretty simple. [8:01] You've done it in the past. Your track record is set out. You've done it. So, [8:08] if you choose not to do it, if you want to vote it up or down, you're welcome to [8:11] do that. But like I said, I got the litigation on the airplane and there's a [8:16] good chance that, you know, [8:21] he's breached a contract and the contract says clearly that I get the [8:26] hanger. That's on him. Had a deposition two days ago. [8:31] And I think this body [8:35] needs to look at the repercussions on down the road and [8:40] and then there could be some because you all have got federal guidelines you got [8:46] to follow and trust me I've read federal guidelines so I'm blew in the face but [8:52] I'll take your vote. You guys decide what you want to do. We'll take it up [8:57] with the city attorney and and uh but before I leave the podium, I want to [9:03] give you all something. And uh Mr. Koger, I had asked you a couple weeks [9:08] ago, I sent you an email. You said you never got it. [9:14] And >> were you addressing me? [9:17] » Yes. >> Okay. My name is not Mr. Coker, but go [9:19] ahead. >> What's your name? I'm sorry. [9:21] » Mr. Cawer. >> Cer. I'm sorry. Apologize. [9:25] And I told you it was an FOR request and you had mentioned to me that you're not [9:30] going to answer it. So I'm going officially today give you a FOI request [9:36] and I think you would be advised to listen to the city attorney what an FOI [9:41] request is. You may have never got one, but I'm going to give every one of you [9:45] one and you got three days to comply. So thank you. [9:50] » Thank you. Thank you for your time. So, uh, [9:56] just to follow up on that, how we have, uh, [10:02] handled these in the past, it's a little different than what Mr. Dodson is [10:05] saying. From the FBO standpoint, there was new lease agreements made through [10:12] them to the individuals. how we've ruled in the past from someone buying an [10:19] aircraft from an individual [10:23] that that does not come to us then that voids that lease and that's how we've [10:28] represented that all along. So >> if that would have been on your website [10:35] you might it was not >> any discussion from the commission on [10:40] this >> uh I got a question when did Dr. Makavoy [10:44] terminate his rent on that hanger >> October 22nd I believe. [10:49] » Yes. >> Of 25. [10:52] » So he turned his turn it in. So we should have had it here for reassignment [10:59] to the next person on the list. >> Well, [11:02] » so that's when the airplane was sold or was it a year back? [11:06] » No. Um the that's when Dr. Makavoy stopped paying the rent. the plane is [11:12] still in the hanger. So, it would take an eviction [11:16] proceedings if if uh in order we can't just go in there and it's like a house, [11:22] you know, if you rent a house, you can't just go on there and take the tenant [11:25] out. You have to go through a specific procedure to evict someone from the [11:29] hanger. >> That's my understanding. [11:31] » Which we had started, but >> in reviewing, and I'll take the blame [11:35] for that, we didn't actually take a vote on Mr. Dodson's request in October. So, [11:38] that's why he's back today. So, when did the plane actually sell? [11:50] » From memory, at the October meeting, Mr. Dodson said he bought it over a year [11:55] ago. >> I've got the bill of sale. It was sold [11:58] on April 4th of 2024. >> So, my understanding is that's when we [12:05] voided the lease agreement with the hanger. Mhm. [12:08] » And if we' have known at that point, we would have asked him to vacate at that [12:11] point. >> Well, I think Well, I don't I don't know [12:15] that I if Mr. Dodson My understanding is Mr. Dodson was the when he bought the [12:22] plane, it was represented to him that the lease came with the plane. Now, [12:25] whether that was right or not is a different story. If if [12:32] the lease agreement that was in effect at the time stated that Mr. Dodson would [12:36] have had the right to come to this commission before he consummated the [12:40] sale to ask to have the lease transferred. That that's what should [12:43] have happened and you know I obviously wasn't privy to [12:48] all the conversations that took place but again that's that's what's prompted [12:52] this litigation was that that representation was made [12:55] and relied upon and here we are you know almost two years later. James, can you [13:01] tell us where if instead of uh just taking over that lease incorrectly, if [13:08] he had at that point been put on the hanger list, what number he would be on [13:12] the hanger list from that April of 24? [13:17] » I was going to say that would be almost to the end of the list. [13:22] My my thinking with that is that um we have always when [13:28] a a lease has been terminated because of subleasasing we have always ended that [13:32] lease unless they have come before us and asked with the exception of the [13:37] recent issue that we had with summit aviation and if I would say that we've [13:41] ever deviated from our policy of the way we handle things um that was the when we [13:47] have made the change for that and our change was that if that was [13:51] misrepresented by Summit that they could lease those hangers to uh Dr. Sh Dr. [13:57] Adams is one that's in my head. Um then we saw that if he had known that wasn't [14:02] an option, he would have been on the hanger lease or hanger list [14:06] » and we would have put him on that list. So that's that's what we chose to do in [14:10] in that specific case. Now, it's a little different of taking over a lease [14:14] and there's no paperwork exchange with the city versus Summit having an actual [14:19] paper lease that those folks signed saying that they had a space. So, I [14:23] don't know if I I could see going both directions [14:26] that he definitely out of the hanger, but secondly, we could put him on the [14:30] hanger list where he would have been if instead of getting that hanger [14:35] incorrectly, he would have asked to be on the list. [14:40] Keep in mind when we're approaching this that the precedent has been set and if [14:46] we're going to make a change here then we need to look towards the future on [14:50] how we're going to address these as well. [14:55] You mentioned the plane was in litigation um or some sort of dispute is [15:02] do we know when that might be does that void the sale? That's the question I [15:06] have. Does it void the sale because it's still in litigation? [15:10] » The the relief requested by Mr. Dodson in the pending litigation could [15:16] theoretically involve the recision of the sale. Yes. [15:22] » But that is not >> I can't speak for Mr. Dodson and his [15:25] legal strategy, but I do know that that is one of the possible outcomes in the [15:30] litigation. >> But that's not what's on the table [15:33] today. If we have to address that, we can address that. [15:38] » It looks to me like Dr. Makavoy is the one that's in error here because he [15:42] transferred the lease of the airplane without us giving us authority to he has [15:49] no authority to transfer the lease with the airplane. [15:54] » Pursuant to the language of the lease agreement, I agree with you. It it it's [15:58] worth mentioning that Mr. I'm sorry, Dr. Makavoy was actually transferred the [16:03] lease from Mr. Storm in 2002. Just thought I'd put that out there. [16:15] » So, you're saying this lease agreement has been transferred twice? No, [16:19] » it was transferred once by permission of the airport commission from Mr. Storm to [16:23] Dr. Makavoy in 2002. [16:28] Any [16:33] more discussion? [16:38] I'd ask for a motion. [16:42] » I'd make a motion that we consider that at least null and void and we put hanger [16:46] 5-01 back up on the um list for the first [16:51] available person. >> I'll second. [16:56] Have a motion and a second. Roll call vote, please. [17:03] » Omar, >> yes. [17:05] » McCarron, >> yes. [17:07] » Smith. >> Thomasson. [17:11] » Yes. >> Smith's here. [17:12] » Oh, Thomas. >> I was going to ask if I could abstain, [17:15] but I What's the vote? Yes or no? [17:21] » Okay. Yes. >> Collier. [17:24] » Yes. Gardner. >> Yes. [17:27] » G. >> Yes. [17:29] » Okay. Ruling has been made. Thank you. Thank you, Mr. Dodson, for your time [17:33] coming in. >> Ernest, do you need anything from us? [17:38] » No, sir. >> Mr. Dodson is aware of his appeal [17:42] rights. >> And then if I can ask just uh how long [17:48] um does Mr. Dodson have to go ahead and have the plane removed from the hanger? [17:52] He has 30 days to appeal this body's decision to Washington County Circuit [17:57] Court if he chooses to do so. >> Outstanding. Thank you. [18:01] » And if he does not, >> then we will begin the proceedings to [18:07] have him removed from the hanger at the due to the vote today [18:12] » all over again. >> Yes, sir. [18:14] » Okay. >> All right. Just one question on the 30 [18:16] days. Um I felt like two months ago we made it a change to that rule and [18:21] extended it to 60 days. Is that right? Do you remember that? [18:25] » Giving people opportunity to >> This is totally different. [18:28] » Okay. Different situation. [18:35] » Okay. Moving on. Number six update from Summit. Brian, [18:45] » good afternoon. Um, so you can see, um, our, uh, January 26 fuel sales uh, are [18:53] down from December, 4% and our 100 lowled sales are down 16% from December. [19:00] Um, I don't really have a have a reason for [19:05] that. It's just nature of the business. Um, and I also included in uh in our [19:11] packet this time um a a price list of our of our services that we provide um [19:18] just for just transparency and everybody can see what's going on and [19:24] that sort of thing. So other than that, uh do you have any [19:29] questions for me? >> Do you guys have the um aircraft [19:33] services posted in numerous places throughout the terminal? Um, yes, we [19:38] have we have a uh our fuel prices listed and the the services listed on the [19:42] counter. And then we've also got a copy behind the the counter that that our u [19:47] our customer service folks and our line guys used when we ring up people. That's [19:51] if you'll note the numbers that are listed on the left hand in the left mo [19:55] left most column. Those are all of our uh codes that we input into our our [19:59] point of sale system just so our so it knows what what we're charging. So [20:04] that's what those numbers are. So, this is a direct reflection of what we keep [20:07] behind the the counter. [20:13] » Any other questions? >> Thank you, Brian. Appreciate you. [20:17] » Thank you. >> All right. Port from Mr. Kate. [20:22] » I just have one thing. You probably already know this already, but I made [20:26] the announcement after the week after the last airport commission meeting that [20:29] I'm retiring at the end of April. And the city council has already passed a [20:35] resolution appointing Garrett Harlland, city attorney, effective May 1st. He's [20:39] already started working uh with me, started last week. And so you will be [20:44] left in fantastic hands. I think many of you know Garrett already. He worked in a [20:49] city attorney's office previously. Uh he most recently was serving on the city [20:53] planning commission. So, and he's running for city attorney, [20:57] and I think he'll do a great job. >> All right. Thank you. Welcome, Garrett. [21:03] » More. [21:06] » All right, Austin. Operation report. >> Okay. Well, I don't have too much to [21:12] touch on today, but I'll go ahead and start with Mr. Steve Clark from last [21:16] month's meeting. Steve Clark was able to keep his hanger. So, the few people that [21:21] are above him did pass on that hanger, and he's now the new lease holder [21:24] effective February 1. So, we're happy about that. Uh, we also did have, as far [21:30] as rent goes, we had three past due tenants and they were contacted, so they [21:34] should be working on getting paid up. And, uh, I guess the last thing I'll [21:38] talk about, so a couple of months ago, James and I had reached out to our fire [21:43] department. We figured that with everything going on and big things [21:46] happening here at the airport that it would be a good idea to, you know, [21:51] reconnect and restrengthen that relationship with our fire department. [21:55] So, and as well as update making sure that our emergency plan is current. So, [22:00] we kicked that off with airport tours. We brought the whole department through. [22:04] We did six individual tours to do that and uh we had a good time. It was very [22:09] informative for everybody and it was it was it was a very good deal. Next steps [22:13] in that will be running tabletop discussions and scenarios and then [22:18] hopefully after that we'll be running some active training exercises out on [22:22] the airfield. So, but in saying all that, I'd like to take a minute real [22:26] quick to thank Joel Gardner and his team at OT. You know, we appreciate Joel [22:30] supplied a a bus for us to go up and down the taxiways and the runways and go [22:36] look at the proposed National Guard facility. So, we thank you for that. And [22:40] uh I'd also like to thank Brian over here. So, Brian played a played a pretty [22:45] big role in that too, helping out on the tours. And boy, I tell you, we were a [22:48] pair of a couple of master tour guides by the end of all that. So, but it was [22:53] fun. But anyways, I just wanted to fill y'all in on that. I'm pretty excited [22:56] about that. And that's all I got. >> Any questions for Austin? [23:04] Thank you, Austin and James. Activity report? [23:08] » Yes, sir. I don't know if anybody's noticed, but we've had the guard u out [23:12] in the field for the last couple weeks. So, it's been nice seeing those [23:16] helicopters flying around. So, um, Austin is working on more insurance [23:21] claim from lightning strike we had a month or so back. So, apparently it's [23:25] taking out more than just our approach and papies. It's hit some of our sign [23:29] boxes. So, he's working with Saber in the city clerk's office to get that all [23:35] back up and running. Um, operations were still up from last year a little bit. [23:40] Um, like I said, fuel sales is down. Other than that, everything's still [23:44] going great. >> Awesome. Thank you, James. [23:46] » Can I add to that? Uh, sure, Mr. Chairman. So, James, uh, some numbers [23:50] from yesterday. So, we were talking to the tower yesterday and, um, 80 counts [23:57] per clock hour um, getting over that. They consider that a little bit of um, [24:02] safety issue with only having one person in the tower. Yesterday, they hit 77 [24:09] multiple times per clock hour yesterday. And due to the military being there, [24:13] nice weather, all that stuff. So, you know, the traffic is increasing big time [24:19] up there. So, [24:23] » anything for James? Thank you. And Greg, the Garver update. [24:31] » Good afternoon, everyone. Let me just see if I can get this plugged in really [24:34] quick. Uh, I don't have too too large of an update for you all today. Um, we've [24:39] got two active projects, the uh, strategic plan and the tower [24:42] rehabilitation. Here it comes. Um I'll talk about the strategic plan real [24:47] quick. Um this one we we kicked it off in September with the visiting session. [24:50] Had another meeting in uh in January. Our second meeting was in January. Um [24:55] where we compared uh the the we compared Springdale's airport to to other [25:00] existing airports. Looked at their facilities. Looked at other businesses [25:03] on the airport. Um we also started to to brainstorm what type of businesses and [25:08] facilities we'd like to bring to the airport. um and also looked at uh the [25:12] land use um in and around the airport and how we could potentially utilize [25:16] that to uh to grow. And so um with our next meeting which is scheduled for [25:20] March, we're planning on bringing um exhibits on land use alternatives. So [25:25] this will be really what the strategic plan, this is going to be the meat of [25:28] the strategic plan. We'll start to see, hey, where can we start looking to build [25:32] new hangers? Where can we infill and maybe utilize some of the unused space [25:36] um at the airport now? So, um, March 20th is when that next meeting is. So, [25:41] um, I should be able to have some exhibits ready, um, for, you know, [25:44] feedback, um, for that meeting. Any questions about the strategic plan or or [25:48] what we've accomplished so far? >> Awesome. So, for the tower [25:53] rehabilitation project, um, you know, it's been ongoing for for quite a while [25:57] now. Back in December, um, I reported some, uh, quality issues with, um, a lot [26:02] of the mill work, a lot of the cabinetry um, in in the tower. Um, we we worked [26:08] with the contractor. I know Micah was there. We also James and Austin, we [26:11] worked with the contractor to put together a plan to get a lot of that uh [26:15] quality issue um sorted out. Um, and we were able to to [26:20] get the contractor to uh clear up all of the cabinet issues by uh January 22nd, [26:25] which is when we had a final inspection and punch list walk with the contractor. [26:30] We we identified a handful of items um in that January 22nd meeting. uh most of [26:34] them related to um some of the the drawers and plexiglass that goes along [26:39] the bottom of the tower. And I can actually show you some pictures of that [26:43] real quick. Um these are the these are the final or [26:47] these are pictures from earlier today of the tower. So there's some plexiglass [26:50] down here that that was a little um wobbly that that we were able to get [26:55] sized correctly. Um otherwise the only outstanding punch list item is an [26:59] emergency radio. Um that's just on back order right now with with the [27:03] manufacturer. We expect that to be delivered in March. So that clears up [27:07] the whole phase one of the project, the FAA money. Um we also talked about a [27:11] second phase of the project with um some of the state grant that we received for [27:16] uh a generator, emergency generator and also um HVAC. Um in this meeting with uh [27:22] the the tower and the controllers, we also identified a few other items. We're [27:25] going to pick up some new chairs for them um as well as make some lighting [27:28] adjustments and give them a nice dimmer switch so that they can make adjustments [27:32] um for some of their evening operations. So, um that phase two is under contract. [27:38] Um right now we're working on on getting them scheduled. Um and we do expect a [27:42] little bit of a of a lead time on that generator as it's something that's [27:45] probably going to be six to eight weeks out is what we is what we anticipate. [27:49] But I'll I'll continue kind of scrolling through some of these pictures um here, [27:53] but I'm happy to answer any questions that you have about the project. [27:58] » Is there anything we can do about the windows? [28:04] » About I I've heard reports of them leaking. Is that what you're referring [28:07] to? >> Leaking? Um they're sealed with duct [28:09] tape on several spots. We have uh wasps that make pretty frequent visits in the [28:15] summertime. and >> air flow. You can just feel air blowing [28:19] through the duct tape that we've used to seal those. [28:22] » I can go ahead and answer that one, Greg. So, with our insurance, with the [28:25] company that we have coming in to put a new roof on the tower, they have agreed [28:30] to seal all the windows at no extra cost. So, they're going to go ahead and [28:34] do that while they're up there doing the work. [28:37] Do you I think we after that then we need to talk to Mike or be there during [28:42] a good rainstorm and see if we're still having a lot of water intrusion because [28:46] obviously walking up through there there's a lot of if you go in the rain [28:49] it's dripping all around you and if uh you look around at some of the wood the [28:54] plywood or whatever they used I guess just to kind of stop some of the rain [28:58] that's even rotted through that. So, I know I know James has tried in the past [29:02] and we've had other people come look and we're just not able to figure out how to [29:06] seal this thing. Um, maybe window sealant will help. It's just hard when [29:11] it's a metal building. But, um, and I think we are, haven't we resealed the [29:16] tower before? I think, and I want to, of course, I don't want to get to speak, [29:21] but I think the contractor is also going to seal the tower before they repaint it [29:25] as well. So, I think they're going to go through and seal the whole entire tower. [29:28] I know for sure they're doing the windows, but I'm I'm kind of leaning on [29:32] them to do that. I'm trying to get as as much little extra stuff out of them as [29:36] we can. [29:42] » I take it that Mike is pleased with everything. [29:46] Uh yes, from the final inspection, we we really pestered him about, hey, let's [29:49] let's make sure we get everything addressed here. Um and he gave us those [29:52] list of items. Uh, we also had an architect there that was the architect [29:55] for this project and so they did a good job generating the punch list. Um, I I [30:00] haven't spoken to Mike probably in the last couple weeks. Have you heard [30:02] anything from him, Austin? >> Okay. I'll I'll make sure to follow up [30:06] with him, make sure he's happy and and if he has any residual issues, we'll [30:10] make sure to get them addressed. >> Perfect. Thank you. Anything else for [30:14] Greg? >> All right. Thank you, Greg. [30:17] » Thank you. >> Any old business? [30:22] So, this was brought to our attention uh as far as airport rules, regulations, [30:28] and the emergency plan. James, do you want to speak to this real quick and [30:31] then I'll follow up? >> You bet. So, I was digging through some [30:34] old folders and I found our old rules and rags and I thought, well, we haven't [30:38] touched it in a few years since 95. So, I thought, well, probably want to look [30:44] it over. And I know our emergency plan, we've been updating that periodically [30:47] coming up. So, um, Austin's been updating the contacts and phone numbers [30:52] in it, but working with the fire department, we wanted to make sure [30:54] everything was correct. So, I thought it'd be a great time to update update [30:58] the rules and regs. >> And I would think most of those probably [31:02] haven't changed, but they probably need to have eyes on them at least. [31:05] » Correct. So, I think what I would ask is a couple [31:10] of commission members working together on this to review them and then bring [31:15] back to the commission if there's any volunteers to do that. [31:20] » Review them separately, >> not at the same time. Okay. Just making [31:24] sure >> unless it's recorded, right? [31:26] » Correct. [31:32] » They are in your packet, I believe, too. Does everyone have a copy of the rules [31:35] and rags in your packet today? >> I'm I'm happy to review them. We just [31:38] need by next meeting. >> I think so. We're we're a week late this [31:45] month, so we Is that going to give me enough time? [31:51] Do we need uh legal counsel to review any of this as well or um That's what I [31:57] was thinking. >> We'll be happy to. [31:59] » So, how do you want us to do that? review, make notes of what we think [32:03] concerns are, and then give that to you to help us write. [32:06] » Sure. If you want to just have it brought back to the next airport [32:10] commission meeting, which I believe is March 19th, [32:14] that should be time for us to [32:18] unless you think we need another another 30 days, James or Austin, [32:22] » I think that be fine. >> Let's let's do that. Let's shoot for [32:26] next meeting. Bring it to the commission and then we can discuss it and then let [32:31] city attorney take it from there. So, we need one more volunteer. Anyone [32:36] else willing to help with that? >> I'll volunteer. [32:39] » Thank you, Mike. James, can they uh get with you with any [32:45] questions they may have as well that might expedite some of that? [32:48] » Yes. >> All right. Any questions on that? [32:55] All right. Comments from commissioners. [33:00] Mr. Kate, I have a question. These folders that were given to us, can we [33:05] just give those to you? How does that work? [33:09] » Well, um I don't know what the contents of all I don't know if the contents are [33:14] the same in every folder. So, it depends. Um if they if some of those [33:19] pertain to you personally as an airport commissioner, then uh if you need some [33:25] advice on perhaps answering some of these, I'm happy to [33:30] provide advice on any indiv any individual [33:35] uh items in the list of requests. So I I've looked at this, but I don't know if [33:41] they're all the same. So, [33:47] » Ray, are all these the same? >> I I'll just note it's it's dated [33:52] February 3rd, but we received it today. So, just for the record. [34:02] » Any other comments? >> I'll ask um who officially is the [34:06] custodian of the records? >> I guess that would be the city. depends [34:11] on what the record is. Some will be the city clerk, some will [34:17] be the airport. It depends on what the specific request may be. [34:26] » I mean, a copy of the waiting list. We're not going to have that. The city's [34:29] going to have that, right? >> Correct. [34:37] » Let me ask you another question. Are are we [34:42] if this request is the same for every person, it's a the FOI is to the city or [34:48] is it to the each individual person? >> It does appear that it's addressed to [34:53] each individual airport commissioner. There are some items on here that are [34:58] going to be probably not something that you have. It will be the city that's [35:01] actually the custodian, but there may be a couple of item on items on here that [35:05] may pertain specifically to you in your role as an airport commissioner. [35:16] And just a reminder to kind of for you 101, [35:21] uh, a public records request is for public records. You're not required to [35:27] generate a record that you don't already have. It's not for like, you know, how [35:32] many times did you have a phone call? That's not on this piece of paper, but [35:37] for someone to say, how many times did you have a phone call with someone? If [35:40] there's not a record that shows that, then you don't it's not like, you know, [35:45] true or false kind of things. That's not what Foy is for. It's for public [35:49] records. I I haven't looked at this in great [35:53] detail yet, but obviously we'll respond to according to the law. [36:01] So, so the question we have three days to answer this back. [36:07] » Sorry. >> We have three days to answer this. Is [36:10] that correct? >> It It's not three days. I mean, if you [36:12] have it in front of you, you technically have to give it over as soon as you can, [36:17] but if you can take up to three days because sometimes it does take time to [36:22] get the information together. And there may be instances, I had two this [36:26] morning, where I made the individual aware that we're still still gathering [36:29] documents because sometimes it's impossible to get those within three [36:33] three business days, but we at least respond to let the person know that [36:37] we're still working on the the request. [36:44] » So, we're talking about calendar days. >> I'm sorry. [36:47] » Calendar days. >> Business days. [36:49] » Business days. >> Yes, sir. [36:55] Can you open it and look at it? Looks like the first first item is something [36:59] that James will have. >> Second item is something that um would [37:04] be available in the airport minutes that are published online. [37:10] » Third item, uh we all fill out financial disclosures annually. That would be in [37:14] that that's already published, >> right? [37:18] Fourth item, it would be answered in that same [37:21] financial disclosure. Fifth item, same financial disclosure. [37:32] There's the financial disclosure. [37:39] You know, I guess again, James, you know, the answer to seven is zero. We [37:43] don't. That's part of the rule. [37:49] And again, the city's going to have number eight on file for all of those. [37:53] So, I guess everything's already available out there for [37:57] » public view. >> Public view. I don't I don't know that [38:00] there's anything we any of us have to reply with this. Is that am I misreading [38:05] it? >> As we go through to identify documents [38:08] which may be responsive to the request, we may be reaching out to you [38:12] individually. I don't want to do this in the public forum. Any [38:21] other comments from commissioners today? >> All right. Thank you so much. We are [38:25] adjourned. >> Greg, [38:28] » sorry, I didn't know exactly when to come up. I I wanted clarification on [38:32] something and I I was as I was sitting back there, I heard that uh you're [38:38] you're going to have a Are you setting up a committee to look at rules and [38:42] Okay. All right. And what's the what's the time what what's the expectation of [38:47] that committee and when will they >> they they're going to individually meet [38:51] or they're going to individually review them and bring them back to the [38:54] commission next month for us to review together. [38:57] » Okay, good. Um I just I I feel the city should be in [39:02] tune with that. Not necessarily. I mean I and I didn't know at what point we [39:07] would want to be involved in the process. So, [39:10] » if whoever wants to come next month when we review them. [39:13] » Okay. Y'all will be reviewing them in your meeting. Yes. And then Okay. All [39:17] right. We'll do that. That That sounds good. We just uh you know, with all [39:21] that's going on at the airport, we we want to all be on the same page and we [39:24] want to make sure that that uh that we're all we're we're look the city will [39:29] be looking in the future at at acquiring property. Uh as you know, as we've [39:33] talked about and I've been open with on the council. Um, so we're looking at [39:38] significant investments out of the city budget for this and we want to be sure [39:42] that that we're all on the same page as y'all as y'all make your decisions. [39:46] Okay. >> Sure. [39:47] » All right. That's all I needed. Thank you. [39:48] » All right. Thank you. Thank you everyone.
