[0:14] Um [0:16] the administrative hearing officer is [0:18] Brian Patterson. I'm Niall Connolly, the [0:21] director of community development, and [0:22] I've been authorized to read the ruling. [0:27] Uh the application for the variance was [0:32] relating to lots eight eight and 11 in [0:35] the Watchman subdivision. And the [0:37] applicant is Wendell Burnett. [0:41] I'll just read a summary um summarizing [0:44] the um [0:46] the ruling. [0:47] The full detailed write-up will be [0:50] posted on the town's website later [0:52] today. [0:54] This matter is before the administrative [0:56] hearing officer [0:58] on an application for variance under [1:01] Springdale ordinance 10-6-5. [1:04] The variance application seeks relief [1:06] from Springdale town code 10-15-B-9-A, [1:11] which prohibits disturbance of slopes [1:13] with grades of 30% or more. [1:16] A hearing on the application was held on [1:18] April 2nd, 2026. Applicant, Wendell [1:22] Burnett, was represented at the hearing [1:25] by his engineer, Jared Bates. [1:28] The administrative hearing officer has [1:30] considered the statements and [1:32] presentation at the hearing, reviewed [1:34] and considered the application, the [1:37] documents submitted with the application [1:39] and the memorandum and accompanying [1:41] attachments from the town's principal [1:43] planner, [1:44] conducted a site visit of the property, [1:47] and reviewed the supplemental [1:49] information provided by the applicant [1:51] specific to the ruling of unreasonable [1:54] hardship. [1:55] Based thereon, the hearing officer makes [1:58] the following findings and ruling. [2:08] Uh the variance is granted. [2:12] Uh applicant must comply with all the [2:15] ordinances and standards applicable to [2:18] the development and building process [2:20] for the proposed improvement, including [2:23] the grading standards in chapter 10-15-B [2:26] of the Springdale ordinances. [2:28] Applicant must also make every effort to [2:31] minimize and mitigate any visual impacts [2:33] of the improvements as the town may [2:36] require.
