motion [1:06] carries item number four consent [1:11] agenda second I would like to pull item four I just for further explanation from [1:19] Randy if he could do that for us uh all those in favor of approving the consent [1:27] agenda except for 4 I I say I I all those [1:35] opposed so carried Randy could you expand upon for I the approval [1:40] resolution and amending resolution for the El Street East extension I think [1:45] we're at least in conert between Lori and I uh I believe this is in response [1:49] to feedback from the city's Bond Council uh typically when we're conducting [1:54] improvements under the 429 process um there are Provisions with [1:59] that are somewhat that are time sensitive with respect to certain [2:03] actions from the council um after the public Improvement hearing after [2:08] presentation of the feasibility report and so considering that the Elm Street [2:12] improvements were delayed uh in this case due to to write ofo acquisition [2:16] concerns I think the Bond Council had recommended to to the council that or to [2:21] the city that they amend the resolution reflecting that it's taking longer than [2:26] a year uh from our original action and and so that's uh the purpose for that [2:32] that language modification or I summarize that accurately that's exactly [2:37] the recommendation from Bond council is just to extend it that the bids will be [2:42] let no later than such a period of time and [2:47] we based on the information that we have best estimate would be June 30th of [2:52] 2025 for that project okay so the the statute does provide for [2:59] instance like this when it does take longer uh longer than a year but we want [3:04] it memorialized in in the resolution so that's why it's being brought [3:09] back okay well thank you for the clarity Adam can I make a comment yeah [3:16] just for the audience and people watching on Zoom so what we're talking [3:20] about is that we thought earlier in the year that [3:24] roundabout by Cashwise in the McDonald's we thought that would be [3:29] happening the construction and it's not going to happen because of right of way [3:34] issues so that won't be constructed until 2025 correct is that accurate [3:42] that's accurate yeah because I don't think that's been reported in the news [3:45] leaders or anything it's just been in our own minutes and stuff it's my [3:49] understanding Stern County may have published it on their website right but [3:53] but I don't know that it's been in print per se sh on our Facebook [3:57] page okay I just item number five from engineer reports public hearing the [4:21] special assessment hearing for the 2024 Street improvements in 2024 Elm Street [4:25] East improvements believe you got that cover [4:30] Randy I I'll start and U my colleague Bryce will will will follow up so good [4:34] evening uh my name is Randy sabart I'm the city engineer with me this evening [4:39] is Bryce Johnson also on the engineering team uh as the uh as Adam had indicated [4:46] uh tonight we're starting the what we call the special assessment hearing uh [4:50] when the city proposes public improvements under the chapter 429 uh [4:55] statute we're required to conduct two public Improvement hearings the first [5:00] and or public hearings I should say the first hearing was conducted mid January [5:04] January 16th which is what's referred to as the public Improvement hearing at [5:09] that hearing the city presents uh the nature of its proposed public [5:13] improvements provides an opportunity for the residents to um provide input or [5:19] questions on the nature of the project at that point we provide a preliminary [5:23] estimate of the costs uh the preliminary estimate of the impacts from a special [5:27] assessment perspective uh the second hearing which is tonight is what we [5:32] refer to as the special assessment hearing so at this at this hearing the [5:36] city presents uh what are anticipated to be the final costs associated with that [5:42] particular public Improvement and so we have a a brief slideshow this evening [5:47] that that Bryce will will get into and then there'll be a period for uh uh for [5:51] questions so with that I'll turn it over to my colleague here Bryce Johnson [5:55] that'll work through the uh the slides if you didn't notice uh uh at the table [6:00] outside the door there's a CO a hard copy of these slides so that you could [6:04] follow along all right thank you Randy again [6:09] I'm Bryce Johnson with SE I will be presenting the slides here for the 2024 [6:15] Street improvements so the project locations we [6:20] have are Kiwi Court kale Court 295th Street from Kiwi Court to 91st Avenue [6:28] Pearl Drive and 30 Fourth Street from botser drive to Coler Court uh the [6:34] kleinfelter Park Trail and the Liberty Point Trail this is a map showing those [6:44] locations within the city these are the projected final total [6:51] project costs so um the second column from the left is [6:57] the estimated cost at the public hearing now there after the public [7:04] hearing there was a change an amendment to the scope of the project so again the [7:11] that First Column with numbers is the the estimated cost at the public hearing [7:15] after that scope changed that middle column shows our estimated cost at the [7:20] public hearing just of that amended scope which is smaller which will be uh [7:25] detailed later and then on the on the right we have [7:30] the projected final cost of the project as we sit tonight after the project has [7:36] been bid so our con as we sit tonight our construction total is [7:42] $786,500 we then have $3,000 for the feasibility report [7:48] $181,000 of design and construction engineering $115,000 of soil borings [7:55] $63,000 of legal fiscal and administrative costs for a grand total [8:00] of 1,75 th000 $75,900 [8:08] so again this this is the project area based on the original scope so you can [8:14] see the project [8:17] costs get my laser pointer here you can see the estimated costs here in this [8:23] column and then again our our proposed final cost here so this morning Side [8:29] neighborhood leaf road and polar Circle are no longer part of the project [8:34] area for this year's project for this year's project yep they've simply been [8:40] delayed um so here this is the the same column just with these these uh delayed [8:47] areas deleted out so you can see the kind of the the Apples to Apples [8:51] comparison so um originally we had an estimated cost of roughly $1.3 [8:57] million and here we sit at 1 Point [9:03] 1.75 so Project funding again the original the original scope here we see [9:09] the preliminary special assessment Revenue um we were projected to be at [9:15] $1.46 million with a city subsidy of 1.29 [9:20] million again for a total of [9:27] 2.75 with these areas deleted those numbers drop to 530 roughly [9:32] $535,000 of special assessment Revenue that's the estimate at the public [9:37] Hearing in January a preliminary City subsidy of [9:42] $782,000 for that same total of roughly 1.3 million and on the bottom we have [9:50] the the projected numbers as we sit tonight so [9:56] in the Forest Manor subdivision we we have roughly [10:00] $120,000 of special assessment revenue and in the industrial park east which [10:05] would be um um Pearl Drive sorry Pearl Drive we have 200 roughly [10:13] $210,000 so here you can see the city subsidies and the proposed totals uh the [10:18] Klein felter Park Trail and the Liberty Point Trail none of those costs are [10:23] assessed so those that's a 100% City subsidy so we end up with roughly 31 % [10:29] of the cost being borne by the assessments and uh the balance being [10:34] borne by the [10:37] city some some information on the special assessments um so we are [10:41] following the city's special assessment policy it has been and continues to be [10:45] the policy of the city of St Joseph that when infrastructure improvements are [10:49] constructed provided benefit to a particular area those costs shall be [10:54] levied against benefiting properties selected assessment basis or methodology [10:59] is meant to balance equity and distribution of special [11:03] assessment the city commissioned a special assessment benefit report by a [11:07] third party to identify a range of Market benefit by the project so that's [11:12] what gives as we'll see later that gives a a maximum assessment value a cap to [11:17] each to each area or each lot um that's determined differently based on the type [11:22] of the type of property uh that we are looking at so [11:27] here we have those numbers uh Again by the third [11:31] party third party uh special assessment benefit report so for Kiwi Court kale [11:38] court and 295th Street for all of these areas a single family residential home [11:44] the maximum Market benefit the cap as it were for the assessments is $10,000 per [11:51] lot uh for areas AB budding those project areas with raw land that maximum [11:58] Market benefit was found to be $500 per acre in the industrial park Pearl Drive [12:05] 304th Street Industrial Lots greater than five acres in lot size the maximum [12:12] Market benefit is 5 cents per square foot for industrial Lots under five [12:19] acres in lot size that that maximum Market benefit is 25 cents per square [12:24] foot and for vacant industrial properties the maximum Market Ben [12:29] benefit was found to be 15 cents per square [12:34] foot more information [12:38] here these specially assessed benefits are derived from [12:44] surface improvements the city's policy is that [12:48] up to 60% of Street overlay and reconstruct costs can be assessed 100% [12:54] of the street costs are typically assessed to Annex properties with no pre [12:59] assessment unless Council determines otherwise and up to 100% of New Street [13:04] curb and gutter costs could be assessed as well as 100% of new sanitary storm [13:10] sewer water main costs so that leaves roughly 40% or more [13:15] of the cost to be subsidized by the city um as we saw in that previous slide that [13:20] number is typic typically higher than 40% special assessments for the [13:25] subsurface improvements are calculated on a per per unit basis [13:29] we do not have any of those here special assessments for the surface [13:36] improvements are calculated on the basis of Frontage per lineal per lineal foot [13:40] so that is the the Frontage that your property AB buts to the [13:45] street so for regular interior Lots 100% of your budding footage for the [13:51] Improvement is assessed uh on a rectangular corner lot the sum of 100% [13:58] of the short side footage and 50% of the longside footage is assessed we'll see a [14:04] we'll see an example of that later and for irregular sized Lots 100% of the [14:09] average width of the lot AB buding the Improvement is [14:16] assessed these are the assessment rates again we have the estimated preliminary [14:22] assessment rates from our public Hearing in [14:25] January and then our proposed final special assessment rate here on the [14:30] right so you see the Forest Manor subdivision the original estimate was [14:36] $497 cents per linear linear foot we came to [14:42] 4385 tonight for the industrial park the original estimate was [14:49] $852 per linear foot of Frontage and here tonight we sit at $863 [14:59] these special assessments may be paid in annual installments over time the that [15:05] typically is a market rate uh for this for this year the term is 10 years and [15:11] the interest rate is 5% no interest will be charged if that [15:15] special assessment is paid in full within 30 days of the adoption of the [15:19] assessment role so assuming that the assessment role be adopted tonight if [15:24] you pay that full amount within 30 days you won't be charged interest for this [15:28] first year so that date that deadline would be September 4th of 2024 of this [15:34] year the first installment is payable honor before the first Monday in January [15:40] of the following year so January 2025 would be when that first payment is [15:50] due you must pay the pay city the entire remaining amount with acred interest or [15:55] sorry you may pay you may pay off your assessment full at any time that in that [16:02] assessment that interest acrs up to December [16:06] 31st so that needs to be paid before November 15th or the interest will be [16:12] charged through December 31st of the succeeding Year and that is based on the [16:17] Minnesota 429 statute you may also partially prepay [16:22] the assessment with any balance being certified to the county auditor for the [16:26] collection under the terms previously described in the other [16:32] slides there there is an opportunity for deferrals if uh certain criteria are met [16:37] if you are a senior disabled or on active duty military and the assessment [16:43] is over $3,000 you can request a deferral um this is this doesn't this [16:49] doesn't um wi get rid of any of the assessment it's it simply defers it for [16:55] a set amount of time [17:01] uh this is just the process for those for that deferral one would need to [17:06] apply apply with the city fill out Financial disclosure form within 30 days [17:12] of the assessment at which time the city [17:16] council would Grant or deny that [17:20] deferral all right assessment appeals no appeal may be taken as to the [17:27] amount of an assessment unless a written OB rection by the affected property [17:30] owner is filed with the municipal clerk prior to the hearing or presented to the [17:36] presiding officer at the hearing so if if you do want to appeal your assessment [17:42] you need to do so in writing either at tonight's [17:46] hearing or to the municipal clerk Council may consider the objection [17:52] at an adjourned meeting uh the owner May appeal an assessment to The District [17:57] Court and they must serve notice upon the [18:01] mayor or city clerk within 30 days after the adoption of the assessment and file [18:06] such notice with the district court within 10 days after service upon the [18:11] mayor or the city clerk okay so here we have the special [18:17] assessment example if you remember the the example of the corner lot 100% of [18:21] the short side and 50% of the long side so say we on Kiwi Court if you have an [18:28] 80 foot spot so our assessment rate of 4385 * 80 ft gets us to an assessment of [18:38] 358 and here we have an example from the industrial park 863 times a 100t [18:46] lot gets us to an assessment of $863 now we don't have this situation [18:52] here but if if we had a corner lot that was [18:57] that was on an intersecting street that had these two different assessment rates [19:02] on them we would assess 100% of the short side which is the 80 foot side and [19:09] then we would take half of the footage of the long side and multiply that out [19:15] so that total assessment would be $753 [19:23] 50 finally we have a schedule again we had our we [19:30] wrote our feasibility report in December and that was approved by [19:34] Council December 18th we conducted our public Improvement hearing on January [19:38] 16th where Council ordered preparation of plans and [19:42] specifications the original the original bid the original scope of the project [19:47] bids were opened on May 13th after which bids were uh the project scope was [19:52] amended so Count Council authorized the advertisement for bids for this scope [19:58] scope the amended scope on June 17th Council declared the cost to be [20:04] assessed on July 15th the public bid opening for this this project was on [20:11] July 11th here tonight we are conducting the special assessment [20:16] hearing uh Council May award the Construction contract and adopt the [20:20] assessment role tonight if that happens construction will start September of [20:25] this year and be complete substantially complete and October of this year and [20:31] final construction will be complete in by May of [20:36] 2025 with that I can take any questions uh from from anybody at this [20:49] time you live within the city and uh respect to anybody else that might be [20:54] speaking tonight we want to try and keep it to around three minutes or less so [20:58] any anybody would like to speak or have questions for them you're welcome to [21:02] step up a separate issue question just step [21:08] up to the podium to State your [21:13] question my name is Dan rat here and I represent our Family Trust uh which [21:20] involves eight children and we own the farm uh with land along 295 [21:29] and I guess just I I wanted to keep this really short so I just had one question [21:34] we going through the uh how you figure the assessment [21:40] so 49 Acres along a road times 500 that's what it how it [21:48] comes to what it is then or yeah yes sir so if the field was going the other way [21:54] and it was 100 acres it would be done the same way well I should back [22:00] up the the the $500 per acre is the maximum Market benefit so what we do [22:09] initially is we'll take the Frontage the Frontage that you have that abuts the [22:13] road and multiply that by by that rate that 40 40 [22:20] 49485 4385 so then from there if I remember [22:25] correctly your lot in particular did did breach that maximum [22:30] Market benefit it was over you know 49 Acres multiplied by $500 so you you pay [22:38] that max amount that's that's the assessment value the rest of it [22:42] is covered by the city subsidy okay so yes if you had if if what you're asking [22:48] is if you had a a a longer skinnier lot where you had more front edge your your [22:53] original assessment rate would be higher if the field [22:58] I don't want I my question is more like if the field went away from the road [23:04] didn't butt up to the road anymore would it' be a bigger [23:08] assessment if you had less footage along 295 then then potentially your [23:13] assessment would be less right so we're we're comparing two things the [23:17] assessment rate is looking at the the abing footage along [23:22] 295 and then the subsidy or the the the maximum cap to the assessment is based [23:27] on the times uh the $500 per [23:32] acre okay uh so anyway um The Family Trust would like to [23:41] politely ask for um what you would call a [23:47] deferment um they did this for us when they put the water man along our land [23:52] for the apartment building and we had it was 15 years or if we sell any land we'd [23:59] have to pay the assessment and it was interest [24:03] free um and we'd like to be considered for that I it sounds like what you were [24:10] we'd have to put that all in writing the request or you'd need to have Chang [24:14] since last time we did this you need to have that in writing written out and [24:20] signed this evening and either deliver to the mayor the mayor is not here I'm [24:24] the acting mayor so either deliver to myself or David the city administrator [24:29] so tonight you need something in writing that asking for the [24:34] deferral what and okay and then I have another [24:40] question do the microphones in here only record or they supposed to amplify [24:48] voices they're supposed to do both okay thank you but I guess um as far as um my [24:56] experience in with with taking appeals um it can be something that you can you [25:01] can handr write it's just you need to appear uh ask for the ask for what you [25:05] want and then um you can just put it in a piece of paper you know it doesn't [25:10] have to be overly complete or formal it can be fairly informal last time we did [25:15] this we just did it at a meeting like this may SCH took a okay it's possible [25:22] the 429 rules might have changed I because the process we're following is [25:26] through the 429 process but well I'm understanding there's maybe two [25:29] questions here uh the deferral versus appeal two different things so the [25:34] deferral would be we not we know over the bar yeah so then the deferral can [25:40] occur after Council action tonight so the there isn't a Time sensitivity if [25:46] you're not appealing if you're seeking a deferral there's a separate form that [25:50] that staff can provide you after after the close of business here for you to [25:55] submit your deferral request okay So yeah thank you if I may sure So Randy [26:01] thanks for that clarification so on the deferral um Bryce you had that slide up [26:06] on deferral parameters and it said a senior a senior [26:11] citizen or person that's considered a senior can request a deferral what's [26:17] senior is that age 65 I think it's age 655 it's that's defined in statute as [26:22] well but yeah and then Bryce you said deferral is you said something like time [26:29] to be determined or I mean how long can a deferral [26:34] last so the the statute would Define the maximum deferral of 30 years okay and so [26:40] there are conditions for which then the deferral would have to be paid often [26:44] times it's sale of the property so that that'll be something that the council [26:48] considers but the statute by itself defines certain conditions for how long [26:53] uh the deferral would last a person requesting a deferral would go to City [26:57] administ minator or city clerk correct but then the council has to approve it [27:02] correct so they'll make application uh you know build their case [27:06] as to why there's a hardship and why a deferral is being requested and then the [27:11] council makes the determination of whether a hardship exists or or not but [27:17] under 429 it sounds like the state says if you're a senior why wouldn't you be [27:22] granted a deferral you well there's still and even and on Bryce's slide for [27:28] example the principle has to be rise to a certain level uh in terms of how much [27:34] of the assessment is owed so for example it has to be over $3,000 I believe is [27:38] what the ordinance describes is is is a hardship so depending on the conditions [27:46] um for some that that there may not be an actual [27:50] hardship well if it's only the 3,000 but if if the person's a senior are other [27:56] factors enter in like net worth or income exactly so I mean just because [28:01] they're a senior doesn't necessarily mean that the assessment represents a [28:05] hardship some some seniors may have the resources to to to pay the assessment [28:10] what if they're a veteran Sim similarly though the the [28:14] veterans case or or active duty case if they a way on active duty uh that's [28:20] typically where the hardship might might come into play I think there's some [28:24] discretion on the council's part for for this and I believe and I believe this [28:28] statute references active duty versus veteran okay all right that's all I [28:33] had my name is Jacob frame I'm at 29436 scale [28:38] courtt you plan on repaving our road uh we we have no Services we were [28:44] annexed in 18 at some point services will be brought out will the road be [28:52] substantially destroyed through that process will we have to go through [28:56] another system like this and P more money for a road that is perfectly fine [29:01] as it sits today so that that is one of the challenges that the city has to to [29:07] to reconcile or you know with respect to a road that has deteriorated to the [29:12] degree that we we're seeing in in kale court or [29:16] 295th um so the answer to your first question is potentially and potentially [29:22] I say because it depends on the timing ideally um the city wouldn't have to [29:28] entertain extending Municipal Utilities for for some time into the future and [29:32] and the road is aged uh if we're presented with petitions to install [29:38] sewer and water because well and septics have have failed or or some [29:43] environmental issue like that we'll have to cross that bridge when we get to it [29:47] but that is certainly one of the challenges that the council had to [29:50] consider with the nature of this Improvement is how do we continue to [29:55] maintain a street in in the condition that we're seeing in kale court or 295 [30:01] you keep I'm sorry to interrupt but you keep saying kale and Q as they're the [30:05] same condition there's they're in similar conditions but I beg to [30:10] differ it's not even close so but that that's the the nature [30:17] of it is is we have to consider whether or not the road in its present condition [30:22] is still serviceable and the council's we've made [30:26] the conclusion that that it was time to make that Improvement at the same time [30:30] as 295th so to be clear City Council [30:35] Members you agree and approve that qwi and kale are at the same deterioration [30:42] level we weren't in agreement that they're at the same deterioration level [30:46] but in previous meetings we've looked at the Integrity of them the quality of [30:50] them and we agreed that they both need replacing we we didn't agree that like [30:56] they were equal and Det [31:00] do you take into account the fact that we're at a dead end street we have very [31:04] little [31:08] traffic was that taken into account I can't hear you was it taken into account [31:14] that we're on a dead end street we have no [31:19] traffic no that wasn't considered was a good uh I believe I'm going off to the [31:25] engineer's recommendation on the conditions of the [31:31] court I I think we'd accept that if if if your point is there's not through [31:35] traffic or other traffic from other parts of the community coming through [31:38] yes we we we recognize that kale and kiwi in the end of 16th Avenue serves [31:45] your neighborhood P predominantly that we don't have other traffic coming [31:48] through your neighborhood solely we would AC predominantly solely pardon me [31:53] solely so solely yes unless someone's lost or you've got deliveries [31:58] uh yes the traffic in your neighborhood is limited to the people that live back [32:06] there thank [32:15] you my name is Sher langth I live at 29457 kale Court [32:22] uh my neighbors and I most of us um we have brand new neighbors three homes in [32:27] tale Court have just sold since January 1st we have someone who just put over [32:33] $30,000 into a brand new septic system our septic system is very new majority [32:38] of the septic systems there are very new uh the neighbors that I have spoken with [32:43] we're all very against this project because we feel that our court uh the [32:49] pavement there is fine especially for the small amount of traffic that we get [32:54] uh against what we're being levied and assessed uh there's there's also here my [33:00] question uh is as far as kale Court uh for a maximum Market benefit what is [33:05] that based on for $10,000 per lot because that's saying I believe if I'm [33:10] not mistaken having been in real estate for quite some time that that's the the [33:17] benefit that each lot could see but what is that based on and what is I mean [33:22] that's the very maximum and yet many of us are seeing well Corner Lo are going [33:28] to be considerably more ours is almost $7,000 in assessments uh we do not have [33:34] we've gotten bills recently they've been talking about we don't we don't have [33:38] street lights we don't have city sewer or water people have spent a lot of [33:44] money to keep themselves on septic to keep themselves uh I think and the [33:51] majority of people who have now recently bought in uh were unaware that lot of [33:58] these things were even in the works are coming we bought our house just a few [34:01] years ago and you know we had a newer septic system we weren't even aware that [34:08] there had been some sort of annexation uh that we would [34:12] be uh possibly uh facing uh we don't have city [34:18] garbage service um these are the things that they want to try talk to us about [34:22] we don't have city garbage we don't have sewer we don't have water we don't have [34:26] street lights uh I believe the majority of the people [34:30] that live there find it very unfair that we should have to bear any of that [34:34] burden when we don't have any of those services and to come in and do a Paving [34:40] project and then talk about if you're if it's not being down that time then again [34:44] later on coming in to do these things will rip things up again um this just [34:49] puts kind of an unfair burden on us uh for I mean if we were to show I mean if [34:56] we were to bring in pictures um and take a look at our road is in [35:01] relatively good condition in kale Court I don't spend a lot of time in Kiwi [35:05] Court uh but I know as far as kale court and even most of the road on [35:11] 295th there's one corner that looks uh somewhat worn but the rest of [35:18] it is in relatively good condition especially when we don't have any of [35:22] these services and but I guess back to my question is what is this Mar maximum [35:28] Market benefit um because some of the people that are having Corner lots are [35:33] going to be well over their assessment is going to be well over what the [35:37] maximum Market benefit that they're looking at could be so to address that [35:42] question so the the third party that the city engages that that provides the [35:46] opinion takes a look at similar types of property as as yours in Ko and kiwi [35:53] court so rural rural properties with similar condition stream Street and they [35:58] look at before and after and so they offer an opinion as what is the increase [36:02] in market value that a parcel like yours would see before or after such an [36:09] improvement and so the $10,000 is their opinion of what that increase in market [36:13] value if you were to sell your property tomorrow after the Improvement by [36:18] comparison to what it was worth prior to the Improvement but that's a maximum [36:22] what is the actual I mean is there an like more of an actual Market value [36:27] versus um like what it would be versus what the maximum is because most of us [36:33] are going to be looking at being close to the very maximum when that's the [36:38] maximum so so the maximum is saying the city or what the city would be able to [36:42] Levy would be an assess a special assessment up to $110,000 in your case I [36:47] think in your example you said the assessment was close to 7,000 7,000 so [36:50] there in their opinion that parcel could bear an assessment even higher based on [36:56] the Improvement that's proposed by the city so that's why in the case of when [37:01] we talk about a a city subsidy or the difference if your assessment was [37:07] $113,000 for example for a corner lot then it would have been capped at [37:12] 10,000 in this case you're you're under the $10,000 cap so but for somebody who [37:17] is on a on a corner lot then their cap is [37:20] $10,000 yes corre so correct and there there are three um there are three [37:27] thoughts out there that the proposed assessment was higher than the than the [37:31] cap and so then they were limited at the [37:35] $10,000 okay yeah I just I don't the other aspect that you asked that that [37:41] doesn't come into the appraisers analysis is whether or not uh there was [37:46] a street light or city refuge service or those types of things those are [37:50] independent of of the Assessor's evaluation of the property so they're [37:54] looking at before and after conditions yeah we don't I mean we can't even get [37:59] decent internet out there because nobody will come out there so we [38:04] are I mean that's it's [38:10] it's it's difficult because the amount that you're asking from everybody you [38:17] know is is you know for most of them are going to be fairly close to that cap and [38:23] I don't know that everyone's just going to see [38:28] in real estate we can just tack on $10,000 because that road that's like [38:33] everyone's going to have an expectation when you go in and you buy a house that [38:38] there's going to be toilets there it's not that versus a working one versus a [38:42] non-working one the the pavement is in as not a bad a shape [38:48] that the amount that we're getting back out of it I just it it doesn't make [38:53] sense uh especially seeing as how it's not [38:58] it's it's really you know it's in pretty decent shape and there's no way we're [39:03] going to realize a $10,000 um Market benefit on having um [39:09] new Pavement in [39:18] there can't we need you to come to the podium so it can be recorded [39:27] three three of our neighbors sold in the last year and they ended up giving the [39:32] new buyers money so this is not a positive improvement from a from [39:41] a property value it's a reduction so it's difficult for us to [39:48] address that we have no idea where they listed their property whether it was [39:51] above or below market conditions and admittedly they're selling with the [39:55] street in the condition that it's that it's in so the market was it sounds like [40:00] in those instances determined that they were asking for too [40:03] much no there was discussion within the agreement knowing that there was going [40:10] to be a special assessment and the buyer said that's nice but you're going to [40:15] take a certain amount of money off of the cost of the house because of the [40:19] assessment and that's typical in in real estate or transactions that the the real [40:25] estate agent for the buyers will usually approach the city to find out if there [40:30] are what's called pending special assessments so there's a process to [40:33] understand if there's a public Improvement that's pending and so I [40:37] think the question that you asked or someone had asked new buyers how do they [40:41] become aware of a project if they weren't weren't there there's a process [40:45] built in for which they can find out whether or not pending special [40:50] assessments would apply then how can it be considered a positive [40:55] Improvement I'm maybe not following your the the nature so they've they've [40:59] accounted in the they would pay more money for the property so what it sounds [41:03] like they did the property would have increased they have accounted for the [41:08] Assessments in the transaction is what it what it sounded [41:13] like [41:25] okay my name is Kevin afin develop it all if it's or you going to wait until this development [42:07] comes in first before before they would start to uh s [42:14] uh sell land or whatever and build h Homes out there that's what I can't [42:19] figure out why you would want all this uh maintenance done now when down [42:27] the road that's going to happen and it could be 10 years down the [42:33] road could be 15 by that then we'll have to redo everything again and I don't [42:40] understand your your ideas of uh why you want to get everything done now that's [42:48] totally insane it's going to take cost us like all these people that are on [42:54] this that are on this for our um paying for this we Improvement it's over almost [43:02] a half a million dollars you think we got half a million dollars just to throw at 29410 kale Court uh I am one of the the new [43:37] folks to the neighborhood and um I guess I'm kind of getting up to speed on this [43:42] when you say uh these improvements can you just explain is this just repaving [43:46] are you tearing up the road are you resurfacing can you just explain what [43:49] you are doing yes we they they'll it's a reclaim and repave so what they'll do is [43:54] bring in a machine and grind the existing bis bituminous surfacing with [43:58] the underlying aggregate base so they'll blend those materials and then they'll [44:02] grade that and and PVE pave new pinus on top of that so it's not a widening [44:09] project it's not uh we're not improving kale or kiwi or 295th to City standards [44:15] which would typically be an urban section uh so we're we're attempting to [44:21] rebuild what what is essentially there and and the nature or the width of those [44:25] streets do not meet standards uh they're they're much more narrow but we're [44:30] looking to put back as close as we can the conditions that that are in kale and [44:34] Kiwi Court in 295th today so the approach was to be mindful of the fact [44:40] that Municipal Utilities are are are not present uh city is quite honestly Trying [44:46] to minimize its investment in in Rec reconstructing the street those that are [44:51] in the neighborhood you know we've likely observed we've had a patch uh a [44:55] couple of areas already on on the street we have concerns about the longevity of [45:00] being able to continue winter maintenance and plowing without peeling [45:03] up much more of the road so that's the Genesis behind what the council was [45:08] considering in terms of improving it now uh because of we've already had to [45:12] invest in patching uh to try to hold it together so you said it's deteriorated [45:18] to the point you can't provide the city's [45:21] Services those city services as we said are not storm water management [45:27] they're not garbage pickup it's snow removal is that the only city service [45:32] that you're considering that needs to improv that's been maintained or that's [45:35] been provided so the neighborhood hasn't petitioned the city to the best of my [45:39] knowledge for Municipal Utilities uh certainly their Municipal Utilities are [45:44] nearby but but not what we would consider at the doorstep of of the [45:49] subdivision so I think the question was asked about other property that that may [45:54] or may not develop that that wasn't uh the council's consideration in terms of [45:59] whether to proceed with um the street improvements um I ideally those two [46:05] things can time together that the availability of sewer and water and the [46:09] deterioration of the street or the Improvement in the street could time [46:12] together um oftentimes we're faced with just this very condition that the road [46:17] is something needs to be done with the road before we're ready it sounds like [46:21] the Improvement needs to happen for City Services not necessarily for the [46:25] residents living there uh as as I'm hearing some of my neighbors say and I [46:32] in the two short months I've been there would agree it's fine for the low amount [46:36] of traffic so if it's deteriorated to a point uh is that the are you comparing [46:41] that is the is it just a Citywide standard you're trying to meet [46:46] there and if so you know the traffic is so much lower out there should we be [46:51] holding that at the same standard as city streets that may much higher [46:55] traffic right the standard has been can can we maintain can we can the city [47:00] conduct winter maintenance activities without causing further damage and and [47:04] so we've already seen where uh winter maintenance activities are picking up uh [47:10] pieces of of of the street because it's it's deteriorated to a point and so when [47:15] the city now has to invest additional funds to patch or or pay P or pay for [47:21] binus patching multiple times and we're Beyond just pothole patching there's [47:27] cost Effectiveness question that the cities have to address is is it [47:30] continuous is it continuing to be cost effective for them to patch areas of [47:35] Street as it gets peeled up by by winter maintenance [47:39] activities okay uh thinking more long term is it sounds like we may have to re [47:46] think about this again or or come to this um this idea again down the road if [47:51] other services is there long-term planning for the Forest Manor what what [47:56] things are we thinking about there is this so there there certainly has been [48:00] long-term planning since well even 2008 uh when we look at our our Municipal [48:05] utility service areas the the the annexation that occurred in [48:10] 2018 all those things are are are considered but typically when we're [48:14] looking at extending utilities it can be for as I mentioned earlier failing of [48:19] well and septics so there's a health and safety issue that that has to be [48:23] addressed that could be one development activity nearby where utilities are even [48:28] closer to the subdivision that that's another consideration um but certainly [48:33] that area has been planned for the eventual uh extension of utilities but [48:38] uh just because it's been planned doesn't mean that it that the extension [48:43] of those utilities are imminent so there's a lot of factors that would go [48:45] into play as to whether or not the city makes the decision to to invest in [48:51] extending the utilities sure so it seems that the only really imminent thing is [48:56] the potential damage to a snow plow that's not even so much the snow plow [49:00] it's the damage to the road okay it seems yeah I guess just [49:06] hearing all this it seems that there's longer term planning that needs to occur [49:10] before a short-term project like this that may be uh may be moot or obsolete [49:17] in in a not very distant [49:23] future may I so in my thank you for your comments thanks for your comments and to [49:32] the other [49:34] residents in my four years on the council as I've wrapped my brain around [49:39] these hearings and Street improvements the city has a standard [49:44] Street Improvement program [49:48] which I embrace it it's it's not a short term it's building a road [49:56] that is planned to last or or improving a street that's planned to last for is [50:03] it up to 20 years P you know with maintenance we get past 20 so we our [50:08] goal is to get to at least 30 so we've had in my experience [50:15] other hearings where residents and I totally understand it they're looking at [50:20] the road saying my Road's fine why in the heck are you GNA redo it charge me [50:27] an assessment it's because 5 years down the [50:31] road pun intended that street if it wasn't [50:35] improved then could get worse and then you have to do do it then and it's going [50:43] to cost more money so we just have a standard in St Joseph to keep our [50:50] roads um up to date and I know for people on Kale you [50:58] compare it to 295th or kiwi uh no one here I don't think [51:04] there's anyone here from kiwi if for good reason because their road is turned [51:08] into a asphalt Beach um so it's it's not [51:15] easy it's hard to look at these assessments but it it's not a short-term [51:21] fix this is for the longterm and we don't know when develop m is going to [51:27] occur out there uh that's an unknown is it 5 years 10 years 20 years that that [51:34] area where Field Street terminates and going Beyond is just you [51:39] know it's it's not nothing's happening in that area as far as we know so that's [51:44] my comment Street Improvement program am I right yes so the city is [51:53] we're actually on our third third update to uh a street maintenance program uh [51:59] which is intended to improve the longevity of of St Joseph streets and so [52:04] what what council member cluser is referring to particularly when we're [52:07] dealing with overs I mentioned the original design of [52:12] binous streets typically accounts for a 20-year life cycle and we stretch that [52:18] to 30 years or more with maintenance that is involving crack sealing what we [52:24] call aggregate ship seals and overlays and so what councelor cluser is [52:28] referring to is when we have an assessment for an overlay that overlay [52:32] may occur at year 15 of that street age uh and people look at their street and [52:38] they say gez I don't see potholes I don't see it all cracked up the reason [52:42] for the overlay at that point is that we have to time these so that we stretch [52:47] the life of that street to get to 30 years if we try to do it at year 25 once [52:52] the potholes and the cracking show up it's too late and so the city has its [52:57] third generation of Street Maintenance improvements with the intention that we [53:02] stretch the life out of our streets hopefully to 30 35 years with properly [53:07] timed improvements and D kiwi uh um did kale [53:13] and K Court just have it resurfaced about five seven years ago I've been [53:20] working with the city since 2007 in in kiwi and K Court in 295th certainly [53:25] weren't part of the city as that early but there hasn't been [53:29] an investment from an overlay perspective unless the township did [53:34] something prior to the annexation I'm almost positive I've been there 42 years [53:39] and it has been done I'm almost positive has been done a couple times and then it [53:46] was also where the cracks were filled in with that tape and that yep I've seen [53:51] that so that's that's to prevent the moisture from getting in but with the [53:55] degree of cracking and Det deterioration that we see out there now if if if [53:59] anybody told you that that could be overlaid and you'd see the life out of [54:03] an overlay uh you were misled uh the conditions have deteriorated to the [54:08] point that we can no longer do a inexpensive overlay and what we're [54:12] proposing with the reclaim and pave is the next next most economical thing that [54:18] could be done to improve that road okay so then we improve this road now and [54:25] then you're saying we pay everybody pays whatever their [54:29] amount of money it is and then nothing gets done out there no building gets [54:35] done out there no sewer lines or anything getting done out there either [54:41] just the road in terms of what's proposed this evening correct it's it's [54:47] just the pavement and similar with $10,000 just for my little stretch Road [54:54] there so now you now you're also appreciating the point if if we were [54:58] talking sewer water storm sewers carbon gutter Street reconstruction we'd be [55:03] talking cost much more significant than what we're talking about this evening [55:08] it's all the more reason why it's a challenge for the city that's that's [55:12] totally insane to do it that way put the road down and then come back and do [55:17] sewer and water later and all that and you got to tear up the road again no [55:23] come on we're not say but we're not saying that sir even if the property [55:27] adjacent develops that isn't a precursor to extending sewer and water into 295th [55:33] or kiwi or kale they're mutually exclusive so the rasier property could [55:37] develop if if that happens in the next 10 years that doesn't doesn't it isn't a [55:43] precursor to utilities having to come to likely Levy assessments for Street improvements again because it [57:21] is so such a short period of time they wouldn't do it [57:26] they they wouldn't be able to Levy special assessments for the street [57:30] improvements again if it occurred with years correct we wouldn't be able to [57:34] prove the benefit we wouldn't be able to yeah you'd still have a a newlook street [57:39] we wouldn't be able to do the same kind of analysis and demonstrate that there [57:43] was an increase in benefit in in your example now I hope I'm not around to [57:48] have to entertain extending sewer and water in in five years if that question [57:53] came up but right but that's legal [58:03] would that number would drop say it's $10,000 now if the road was in better [58:08] condition that Max benefit would be maybe it would be$ 1,000 or or you [58:14] wouldn't even be able to assign a Max benefit to it but that number would be [58:18] lower if if at all right yes yes if if at all [58:30] assessment benefit report um for their [59:50] property it's got to be some algebraic equation with a bunch of different [59:54] factors do we get to know what those factors are are and then who is the [59:57] third party that does that um and can we contact them um I'm just wondering [1:00:03] because I have an agricultural parcel and I want to know how the different [1:00:07] zoning applies to my parcel which is pie-shaped [1:00:11] crazy as we talked about before um but I'd love to know exactly why I'm [1:00:16] assessed exactly what I'm [1:00:20] assessed we we contract with a third party appraiser uh certif residential [1:00:26] appraiser that that does this and takes a look at what the proposed benefit is [1:00:31] the name of of thatan Nel Nel appraisals Nel was escaping me at the moment um and [1:00:37] they do issue a report that report is public um public [1:00:42] data actually it's presented to the attorney so I I believe it's it is [1:00:46] privileged what is okay sorry this is I apologize this is a new process here for [1:00:51] me where we we do the appraisals beforehand in the all the cities have [1:00:54] worked at before we if there was an objection we did it afterwards so so my [1:00:59] mistake but um but yes we do and we get that report and then we from there we we [1:01:05] determine what that overall benefit is okay and do I ever get a copy of that [1:01:12] report I I don't know if I don't know the I I I was making assumption it was I [1:01:18] I guess if this goes to a district a district proceeding uh I I anticipate [1:01:23] that that will be available right now the City attorney commissions that [1:01:28] report so that it in the event that there are appeals it's treated as [1:01:32] privileged privileged information okay so just for [1:01:37] my everybody else here uh so am I wrong when I say that we don't get unless we [1:01:43] hand a letter to you like I just did we never get a chance to see the breakdown [1:01:48] of how not the factors that go [1:02:33] into that and the and the factors that go into the into the cost so all of that [1:02:38] information the cost information is is publicly available the Appraiser's which a big chunk was torn out and that was because of one of the city snow [1:05:29] plows and I watched them he just kicked it off into the ditch did the city come [1:05:34] back out to fix that nope so now you're going to assess us for the [1:05:40] damage but I don't need to know how old this road [1:05:44] is if if someone can produce a record of of the original construction uh [1:05:50] unfortunately there isn't one available U I'd love to know that too I'd love to [1:05:55] know what what's underlying it um what the original construction was but there [1:06:00] was no documentation that the city had available to [1:06:04] it so when you do this Overland say three five years down the [1:06:10] road then you want want to run out the utilities and stuff are they going to [1:06:14] widen the road out then and put curbs and gutters in that's a decision that [1:06:19] the city will make it that time I I guess I can't answer that question for [1:06:22] you sir so we're just going to go ahead and repave this without any future [1:06:27] plans we don't know what's going to happen yet [1:06:30] right I mean it could be next year two years 10 years nobody knows right the [1:06:35] council could commission or or order an improvement if if it deemed necessary uh [1:06:41] so improvements can be conducted two ways one by petion of the neighborhood [1:06:45] or two by the council's own action so certainly a c a seated council could [1:06:50] make the decision to improve or widen um none of us seing here can [1:06:57] can say with certainty whether that would happen five years from now or two [1:07:01] years from now so nobody really knows them so you're telling me that that's [1:07:06] fair I I don't know how I I could answer that question for [1:07:10] you so down the road are we going to have a chance to vote on if we want [1:07:15] these water out there because we've had the water tested compared to the city [1:07:19] and our water out there is much better with the whales well I guess I [1:07:24] me and it it we you can't bind a future Council to what they can or can't do but [1:07:30] typ with the the council at least in the short time I've been here with the city [1:07:34] has taken the the approach or the opinion that um as far as the the sewer [1:07:38] and water out there that that would be a by a petition purpose is because it's [1:07:43] not right up to it right now so you'd have to extend it to go out there so um [1:07:48] at this point then there's been no um there's been no push to to I guess for [1:07:54] to extend it out there and force the residents to do that um you know what a [1:07:59] future Council might do um it's it's hard you can't predict that um but all I [1:08:05] say is in my experience with working City C with City councils on a situation [1:08:09] like that it would be either a comparing a compelling reason meaning something's [1:08:13] out there's really failing like it's contaminating a water system or [1:08:17] something along those lines or the residents out there have had um issues [1:08:21] with it and they petition to have sewer and water extended to them [1:08:26] on a personal note I know I'm sitting as a council [1:08:30] member but I live on 17th Aven of Southeast and I was Township when we [1:08:36] moved in and now we are City and actually what's happening to you guys it [1:08:42] happened with my husband and I um all I can say in concur with is you have to go [1:08:49] with every situation as it's coming and take care of how you want to approach it [1:08:54] as it's happening happening because we can't we can't my husband and I didn't [1:08:59] know I mean compared to what we were dealing with with the council at the [1:09:02] time and then we had a situation you know approximately 15 years after that [1:09:09] completely different Council completely different mayor um and so I I would just [1:09:14] say you know make sure you have all your information and if you need to move [1:09:20] forward then take the appropriate steps that the city and following letters and [1:09:26] making sure that the communication is between uh the residents and the city [1:09:31] and hopefully following the ordinances and that we have that we can support we [1:09:36] don't want to have this happen to you but we have to be able to look at both [1:09:40] sides of the fence and be able to make sure that we are watching out for [1:09:45] everyone concerned and I I hear you I understand [1:09:51] exactly what you're going through um and so moving forward we're trying to the to be generated through the [1:12:32] assessments um and then parallel to that you have the ability if if you wanted to [1:12:38] to proceed with awarding the Construction contract that would in [1:12:41] essence start uh the construction activity or initiate the construction [1:12:46] activity but there wouldn't be a a another or third public Improvement [1:12:51] hearing or public hearing um after tonight's proceeding [1:12:56] and that' be two separate votes they would be two separate votes uh and yes [1:13:02] two separate votes and And to clarify on the [1:13:06] resolution for the adopting the final assessment that to clarify that does [1:13:11] exclude the Elm Street Extension because that was [1:13:16] postponed pending you know those RightWay Acquisitions and being able to [1:13:20] move forward on that project so because the um [1:13:25] notification in the publication included the Elm [1:13:29] Street um assessment I just wanted to clarify that the resolution does exclude [1:13:34] that so when we get into bonding that's critical that we understand that the [1:13:39] cost is less because of that piece of it okay with that being heard I'll make a [1:13:46] be held on [1:15:37] September 8th um from 1: to 8:30 p.m. staff has reviewed the request and chief [1:15:43] onstein is requiring that two Off Duty Officers um attend the event this year [1:15:47] um they did increase the number of attendees or expected attendees which [1:15:51] resulted in the increase um from one to two officers a map of the event is [1:15:55] included in the packet um and the request um recommended action is to move [1:16:01] forward with the that special event permit move to approve [1:16:07] second with a motion a second is there any other [1:16:11] discussion Kelly all those in favor signify by I I [1:16:18] all those opposed motion does carry on to item [1:16:23] number seven and up update from [1:16:29] connectic good evening members of the St Joseph [1:16:33] Council and interested bystanders thank you I'm Scott jig with [1:16:39] Kinetic and there are some updates that I want to make the council aware of um [1:16:45] per our agreement we had some very specific things that we kinetic is your [1:16:51] uh partner in fundraising for the community center [1:16:55] uh that we needed to do as part of our agreement with you it's Our [1:16:59] obligation those some of those things are in the last memorandum of [1:17:05] understanding that that we agreed to one of the things that we had to do was was [1:17:11] conduct additional training for the members of the Capitol Campaign [1:17:16] Committee those volunteers serving on The Campaign Committee that would be [1:17:21] going out and participating in solicitations and in explain in the um [1:17:28] the project to interested participants and interested [1:17:32] donors on July 18th uh we did that session at Gan um we [1:17:39] had good attendance from the committee had it over lunch and had about two and [1:17:44] a half hours worth of training um for all the members and we also had it uh [1:17:49] available online via zoom and we did have members attend via Zoom as well [1:17:54] well so that that obligation that we uh took on for additional training we did [1:18:01] that on July 18th um one of the other things that we [1:18:05] said that we would do is is in our agreement uh our agreement between [1:18:13] connetic and the city council is that we would provide up to 80 hours worth of [1:18:18] consulting services on any given month understanding that the holiday [1:18:23] seasons in around Thanksgiving and Christmas New Year's inside our our [1:18:30] current contract that those holiday seasons are not uh time periods excuse [1:18:36] me are not are not prime fundraising time with [1:18:41] people gone in the holidays so what we've done is rather than dividing [1:18:47] those 80 hours per month evenly over each of the months we've taken hours [1:18:55] from December and hours from November that are not going to be as productive [1:19:01] in November December because of the holidays and we're moving those hours [1:19:05] into July August and September where we do have an opportunity to be more [1:19:11] productive and provide more services um but but we're maintaining the same [1:19:18] contract terms and billing spread evenly so that way the city is not paying extra [1:19:24] for us to to do extra work in July August September you're paying the same [1:19:28] period throughout the the terms of the contract it's just this gives us an [1:19:33] opportunity to give you more value without you spending more money for that [1:19:38] additional value and that's that's already started and it's and it started [1:19:43] in uh in July August and September um I personally am coming in um two days per [1:19:53] week typically as what it ends up happening and then the rest of the team [1:19:57] is coming in in addition to the two days on a weekly basis I'm coming in to meet [1:20:02] with donors and to meet with the committee the committee itself um [1:20:08] decided that providing leadership the volunteer leadership for [1:20:13] the campaign was too much work to [1:20:17] expect a an individual in a volunteer capacity to do so the committee creat [1:20:24] ated what they are calling the St Joseph YMCA campaign [1:20:31] chair committee and it's a leadership group made up of five individuals with [1:20:39] one additional um advisor and counselor on this the five individuals are that [1:20:45] are taking this leadership role and assuming this leadership [1:20:49] responsibilities Patty wling um Amy [1:20:53] bonfig Carol breze Corey ellt and reasner additionally uh mayor Rick [1:21:01] Schultz has has agreed to come on an ad hoc episodic basis and provide advice [1:21:07] and councel to the leadership committee as needed um we had the first meeting of [1:21:15] that Committee in in a formal Fashion on August 1st and I attended as your [1:21:22] councel on uh that committee meeting and we started making assignments for each [1:21:27] of the leadership committee members so that we could actually start calling on [1:21:31] donors and fulfilling the the asks that are necessary to move forward with [1:21:37] fundraising on the campaign so those assignments have been made this today [1:21:42] tomorrow and Wednesday are my followups to work on individual scheduling with [1:21:49] each of those each of those members so that's happening the committee has [1:21:53] decided it's going going to meet the leadership committee is going to meet [1:21:57] every other week on Thursday um and they'll meet in the [1:22:04] morning at 10: here at the government center and I'll be present for those [1:22:09] meetings um while the committee is meeting and then the full Campaign [1:22:15] Committee will meet the third Thursday um it's basically the same day [1:22:21] as the leadership group leadership group will me in the morning the full [1:22:25] committee will meet in the afternoon at 3:30 in the afternoon the 3:30 time [1:22:29] period is so that the committee will those committee members that have [1:22:33] obligations during the day that keep them from meeting during the daytime [1:22:38] would have a better opportunity to meet at 3:30 in the afternoon so so we're [1:22:42] moving forward with that um I will be present at each of those meetings as [1:22:47] well to make sure that that we keep that moving [1:22:50] forward the rest of my team that are working alongside me [1:22:55] Janelle Johnson has been taking Point um with doing our foundations requests [1:23:03] we've identified three foundations that we believe that kinetic [1:23:08] believes uh would be good partners to help fund this [1:23:14] request um we're not in a position right now to to to share who those are but I [1:23:21] can assure you that we're going through the application process we're starting [1:23:25] to to meet with the funders themselves each of those three foundations will be [1:23:31] specific requests for the St Joe Community Center [1:23:36] YMCA they are not requests to be shared this from these particular three are not [1:23:42] shared between us and the St Cloud Y and any other projects they're specific to [1:23:47] St Joseph and each of those three funders have the potential [1:23:54] it it's not defined yet but has the potential of being six figure [1:23:58] contributions to the campaign and one of those three has a potential of being a [1:24:03] seven figure contribution to the campaign so we're moving forward with [1:24:07] that paperwork right now um and we've worked with the St Cloud y to make sure [1:24:15] that we have the proper EIN number uh employee identification number tax ID [1:24:21] number so that that way those found s can actually contribute to the St Joseph [1:24:27] Community Center project and have it be designated for this project and solely [1:24:31] for this project so we're working forward with that that was something [1:24:35] that the council specifically asked us to do and we're moving forward with that [1:24:41] one of the other things that the council asked for us to do is create a [1:24:45] systematic approach to communicating where we are with the [1:24:50] status of the campaign and what's happening uh both good bad and ugly in [1:24:56] terms of that and we've drafted our first [1:25:01] internal copy the the the the words the content of what a a monthly newsletter [1:25:09] might look like for the campaign and we're going through the editing process [1:25:14] on that and then now the design process to make sure that it looks good and [1:25:20] attractive and folks will want to be a part and want to receive it and that's [1:25:24] happening we still anticipate that being able to to start uh being disseminated [1:25:30] as soon as SE uh September so we feel really good about that [1:25:36] um this next these next three days and then uh a week later I'm going to be [1:25:42] spending most of my time my Consulting days working with individual committee [1:25:47] members to make sure that we've secured individual commitments from the [1:25:53] committee members are in a position to make commitments and then [1:25:58] frankly um to [1:26:02] revitalize those committee members that that may have for one reason or another [1:26:08] stepped back from an active role in the the committee we've had a few members [1:26:14] that have have said you know I'm really busy I'm not certain that this is the [1:26:19] project for me right now and and we interpret that [1:26:24] as as um I'm not particularly ready to move forward with this campaign so we've [1:26:32] got to go back and meet with those individual committee members and kind of [1:26:35] reactivate them as part of part of a role in the committee and that's going [1:26:39] to have to be done on an individual basis so we're we're moving forward with [1:26:45] that as well those are the action items that we committed to to the council as [1:26:50] per the memorandum of understanding so far we're following through with that [1:26:55] um Bob council member loo I will tell you I'm feeling better about my [1:27:02] commitment to you that if it comes time to come back with a proposal I'm feeling [1:27:10] that I can defend it to you at that point I'm not there yet but I'm on the [1:27:14] pathway sir the jury's still out on you yeah thank you sir any other [1:27:20] questions I I do I do have a question yes um so you said you have three that [1:27:27] you're just particularly asking for St Joel why isn't that across the board for [1:27:32] any asking is the is the St Cloud still asking St Cloud is still going through [1:27:39] their Grant application process because there are some [1:27:43] foundations that frankly will fund the broader Regional scope more than they [1:27:49] will fund either a specific project for St Cloud on its own or specific project [1:27:55] for St Joe on its own but if they look at the project as a regional [1:28:02] impact um we both will get more money than we would if we tried to get it on [1:28:07] our [1:28:14] own thank you and we're communicating really closely on that to make sure that [1:28:20] that that those points are clarify do you have a total figure you [1:28:29] can throw at us tonight I don't because I've had two additional contributions [1:28:34] and I'm not certain that Lori has received yet so um I'll have that for [1:28:39] the next meeting but uh we did item eight we have a County Road 121 [1:29:02] crosswalk Improvement update uh thank you acting mayor um council members so [1:29:08] uh I was hoping to have something on your agenda for tonight for Action uh [1:29:11] however um it is not quite ready yet um as you remember uh staff Council [1:29:17] authorized staff to submit an application for safe road Zone funds for [1:29:21] the crossing out there at uh cter Road 121 and Lanigan um so that so [1:29:29] the city along with the county applied for the safe road excuse me safe roads [1:29:33] Zone fund Grant earlier this year and we have been notified that we were approved [1:29:37] for $95,000 um so the state is currently [1:29:41] processing the award to generate the grant agreement I was hoping to have [1:29:44] that ready for tonight for authorization um but looks like it was not quite ready [1:29:48] so it will be um before you at the next council meeting for official action so [1:29:53] this is more of a information on that so that um the application anticipates [1:29:58] roughly 127,000 of construction and that Grant is an 8020 split which leaves an [1:30:03] estimated City cost of roughly 32,000 plus any additional soft costs so no [1:30:09] action required at this time but we will take any questions yeah the the cost is [1:30:14] 127,000 out of 95 so there's 32,000 left isn't the county participating in this [1:30:21] at all and it's all our cost [1:30:26] uh it is all of the city's costs what the county had committed to would have [1:30:30] been uh any additional striping or or improvements at the at the road but they [1:30:36] lended the support uh to to the uh to to the city's application so there was a [1:30:41] letter of support from the county but uh this was the city's pursuit in terms of [1:30:46] the improvements um in terms of the safety [1:30:50] Improvement okay so the county just gave us a go get him [1:30:56] guy okay [1:31:02] correct so just to reiterate Dennis because I know that's why you're here [1:31:06] tonight the state's currently processing the $95,000 grant award and they need to [1:31:11] create a grant agreement once they create that then that's something that [1:31:16] can be given to us and we can vote to approve it so we're slowly working can I [1:31:23] question it's up to the presiding officer it's [1:31:27] fine with [1:31:30] me just I I appreciate I appreciate all it's been [1:31:35] done had a couple more people here one of our gentlemen in our group just had [1:31:40] electrodes put in his brain and he had to go home he was having some issues he [1:31:45] was so that's why they left early so I apologize for Tom Scher uh he wanted to [1:31:52] be here um but I appreciate what you've done I don't know who wrote the grant [1:31:56] that's obviously time was about 20 pages I read it all very well done I we [1:32:02] appreciate that to me it seems like a deal at an 820 so we appreciate I [1:32:07] appreciate that the only thing I ask can added it very good very um keeping us [1:32:12] informed just keep us informed at the Timeline I had a goal like before the [1:32:16] snow flies but I know you've got a bidding process you know you've you know [1:32:21] I you have probably have to pour concrete before it freezes too but just [1:32:26] keep us informed that's I don't know do you answer how long the process [1:32:33] takes um we're hoping the procurement is actually fairly quick um what what there [1:32:39] may be more of a delay uh is is actually ordering the equipment so uh [1:32:45] availability for the council's clarification the what's been considered [1:32:50] as part of the scope would have been two speed zone feedback back displays so the [1:32:54] things that show how fast drivers uh are are driving so so the budget included [1:33:00] two of those in each Direction uh LED and crusted kind of push button signs [1:33:05] similar to what we see right across the street here by by the College of St [1:33:08] Benedicts so there's often lead times with getting getting those equipment so [1:33:14] that I'm is probably more of a variable for us than ordering and getting it here [1:33:19] get getting it here um since we have the county support in [1:33:24] terms of the permitting and working within the right of way that that's [1:33:27] likely not going to be very time consuming so the only the other thing [1:33:31] that's going to take some time is actually putting together the the [1:33:34] construction documents uh to to be able to solicit the quotes So the design uh [1:33:40] solicitation of the quotes and then the actual execution of the work so um the [1:33:45] grant agreement uh we the time frame has it has to be spent by the end of June uh [1:33:51] next year so yeah okay that's so we have so we have time um but our goal would be [1:33:57] to start the process as soon as the grant agreement uh is presented to the [1:34:01] city and the council we well we appreciate all you've done thanks to I [1:34:05] guess it's acting mayor just for tonight just or you hope [1:34:10] I guess so but we appreciate all you've done especially I know it takes time the [1:34:15] people that actually write the grants go through the process I know jod Tesh was [1:34:20] part of it too and we we appreciate it uh it was was kind of an interesting [1:34:25] Summer with the council at your [1:35:25] next meeting in August here uh one of them is a Knife River interm use permit [1:35:30] uh they're just proposing to do portable crushing of asphalt and concrete and [1:35:34] then storage of that Associated material this is for that site that is east of [1:35:38] the Tropic site um so their parcel that they purchased maybe about a year ago um [1:35:43] we also have the American Legion um who's redoing the western side of their [1:35:48] building uh because we have a allowance on the um total percent of metal um and [1:35:54] they're proposing to exceeded that uh that does require Planning Commission [1:35:58] recommendation and Council approval similar to when bad habit Brewery [1:36:02] expanded their operation and expanded some of that metal facade um they'll [1:36:06] follow that same process and then we'll have our final draft readings of the [1:36:11] short-term rental ordinance and the honeybee ordinance at the Planning [1:36:14] Commission level so anticipate that um we'll have those drafts and finalized [1:36:21] and presented to Council in September with the public public hearing at the [1:36:24] Planning Commission in September and then lastly our Eda had been reviewing [1:36:29] and updating some business subsidy policies uh those are required to go to [1:36:34] the council um so we anticipate that will hold a public hearing um [1:37:31] there's also um WR home company is having like an extension brand or [1:37:36] extension company they're starting WR Littles and Co so like pregnancy and [1:37:41] baby things probably something my wife and I should go since she's [1:37:46] pregnant that's a store opening groundbreaking happening in a couple [1:37:50] weeks and Rhonda left us but her along with the CVB and I think uh mayor Rick [1:38:01] uh Mary Bruno they had all noticed the pop- of Splash Pad occur in St Cloud and [1:38:05] they very quickly scrambled to get the fire department involved and we had a [1:38:10] splash pad this weekend on Saturday and I thought it was very well attended [1:38:15] probably a hundred kids and parents together and everybody that came is held [1:38:20] from 1 to 3 just east of City Hall here of everybody that came they stayed the [1:38:26] entire time it wasn't anybody popped in for a couple minutes like it was very [1:38:30] well attended it was great to see and St Joe's so Sandy that wasn't very muddy it [1:38:35] just all sank in only thing I'll say about that is it [1:38:39] was interesting to see those kids didn't really seem to be affected by the [1:38:42] temperature of the water coming out of that hydrant at all I would call that a [1:38:46] cold plunge they thought that was a good day but that's all I [1:38:52] got if that's all we have then item
