[1:32] I pledge allegiance to the flag of the United States of America. And to the [1:36] republic for which it stands, one nation under God, [1:40] indivisible, with liberty and justice for all. [1:46] » Good evening. [1:49] Roll call. >> H [1:50] » Here. >> Peters [1:51] » Here. >> Peters [1:52] » Here. >> Wolford Storm [1:53] » Here. >> Adams [1:54] » Here. [1:57] » All right. We have no proclamations or [2:00] appointments. Is there anybody wanting to speak? [2:04] See anybody >> [laughter] [2:06] » address the board. Uh [2:08] » Chair. [2:12] » Consent agenda. You have the minutes from the August 11th meeting, approval [2:16] of bills in the amount of $83,098.49. [2:20] Consideration possible approval of right-of-way permit 07 for video. [2:25] And consideration of possible possible approval of right-of-way permit 08, uh [2:31] also stadium. And lastly, consideration and possible [2:34] approval of special event permit Rock Street Party. [2:39] Exhibit five. Are there any questions or issues with the consent agenda? [2:45] » And then there is this other permit that was submitted after the deadline. She's [2:50] unable to be formally approved since it wasn't on the agenda, but [2:54] you want to give it a soft okay, then I can bring it back for the next [2:58] » Does anybody have any objection to that? [3:03] Okay, that's a soft okay. [3:08] Is there a motion to accept the consent agenda? [3:10] » So moved. >> I'll second. [3:12] » I'll second. >> Peters. [3:15] » Yes. >> Childers. [3:17] » Yes. >> Burgess Meyer. [3:18] » Yes. >> Kelly. [3:19] » Yes. >> Motion passed four [3:22] » All right, new business. Consideration and possible approval of agreement [3:25] between the village and IDOT for a grant program under the Safe [3:28] Routes to Schools grant program, local highway safety [3:32] improvements. And we got uh [3:37] grant to study or to plan. >> Plan. [3:40] » That hopefully in the next [3:44] version of that. Is that a Is that an annual program? [3:49] Annual. >> Every two years. Every two years. [3:51] » Uh understanding. Um [3:54] And yes, this is a non-infrastructure grant, which will help us create a safe [3:59] routes to school master plan. Um which my understanding talking with [4:05] RPC and certain IDOT representatives, it seems [4:08] that that's it shows that we are Um it'll make us look a little bit more [4:12] competitive and that there's a plan that's got merit that we're trying to [4:15] execute upon. But they US is that good investment. [4:20] Um so >> To do those plans, do we have to do [4:24] anything? >> Hm? [4:26] » Okay. >> Okay. We should do that. [4:28] » We should do the things that they put in there. Okay. [4:30] » So yes, we should do the what's in the plan and that as we submit every two [4:35] years for grant dollars for the infrastructure [4:39] side showing that we're making [4:41] » progress >> Progress is important to the score card. [4:44] » Okay. >> Um [4:46] So our recommendation would be to approve [4:50] » Need a motion. >> Yep. [4:52] » I'll make a motion to approve. >> How much was that for? 49 29? [4:57] » 136 >> Okay. [5:01] » And then we'll be bringing in a vendor agreement with RPC to help do that plan [5:06] for us I'm hoping sometime in September. [5:11] » Ready second. >> Yeah, I'll second. [5:15] » Joe Mercy >> Kelly Stein [5:20] » Yes. >> Yes. [5:22] » Yes. [5:30] » All of the non-votes yay. Good and vote anyway. He just voted. [5:35] Just have to put it on the record. I don't know that you needed that, but I [5:38] thought you put it in. >> Okay. What was the roll call? [5:42] » 301 >> Oh, 301. [5:43] » Or 401? >> Yeah. [5:46] » 401 >> All right. [5:49] Uh the next item is consideration possible [5:53] for approval of a resolution authorizing the construction of a public facility to [5:58] be constructed and operated by the St. Joseph Recreation Foundation subject to [6:02] the attached terms and conditions in exhibit seven. [6:07] I think I have everything here. I'm going to step down [6:10] due to a conflict of a potential conflict of interest. [6:15] Uh so I'm asking you Mayor Pro Tem Terry [6:19] Cummings to [6:21] run the meeting and discussion of the >> Okay. [6:26] » And we have representatives from the foundation [6:28] » You're not going to talk. You're just going to answer questions. So, okay. [6:32] Okay. So, um again, we're just bringing this before us to discuss it. Um again, [6:38] we've talked about it before. Um I think some of the main points that we've [6:42] talked about are that we want to consider all the specifics, which I [6:46] think are in there, um to ensure that the village is being financially [6:49] fiscally responsible with this. Um [6:55] we know that the village owns the property. We know the foundation does [6:58] not. Um we also know that the sewer plant is [7:02] not completely sold yet. Um and until this happens, we are uh assuming some [7:07] responsibility, but I think we're working on some things to [7:11] um make sure that, you know, that's minimized as much as possible. [7:16] Um so that we don't have to raise sewer rates if just because we don't need to [7:20] raise the sewer rates. Um [7:25] I understand just um personally that raising money is hard work, and I think [7:29] you guys have done an awesome job. Um I mean, no offense, but you're not [7:34] development people, and you just picked it up and ran with it. So, maybe you'll [7:38] have a new um job when you get done with your next job. Just kidding. [7:43] » [laughter] [7:46] » So, are there any questions? >> I can add [7:49] » Yes, please. >> So, what you have in front of you is [7:52] kind of similar to what you were alluding to is that we have this [7:56] operations agreement which governs about the [7:59] relationship between the village and the foundation which is trustee Cummings [8:03] mentioned is a village building and those terms have been [8:09] um I I would say it's fair it's fair to say [8:13] meticulously went through and both sides so I think it's a protects [8:18] the village's interest and also gives the um [8:21] recommendation enough flexibility to operate both facility. [8:25] It also outlines what area that the Rec Foundation will be responsible for. If [8:31] you go to the attachment directly after the operations agreement [8:36] called exhibit A, under exhibit A basically there's a 5 acre piece of [8:43] property where the Rec Center building will actually sit on. [8:47] If you approve this, we are going to work with Clark Cates actually a fix [8:52] permanent markers on the physical location so that staff is aware of who's [8:58] responsible for what, mowing contractors, etc. So, we can know [9:03] there's a um [9:05] where who's where duties stop and where they begin for both sides. [9:09] And there's also a building permit which is just makeshift off of our regular [9:15] building permit with all the details that are included there. If you have any [9:19] questions, the representatives will be happy to answer those. As well as you [9:23] have your site plan and all of the development [9:27] documents from Hillside Development Group and Fair Grant. [9:32] All the plans are included. Do you have any questions? [9:35] Um and then um, what you will be doing and actually [9:38] taking a formal action upon which the resolution [9:42] outlines is very last attachment um, which is from Clark Beats, which is a [9:49] site review document. This facility in this development is not in [9:56] full compliance with your, um, [9:59] zone zoning requirements and or development requirements, which is not [10:04] uncommon. It's not uncommon for there to be waivers, etc., different development [10:07] standards. And what Christopher Gekalski of Clark Beats has, um, put together for [10:13] you is what development standard is, um, being deviated from or a waiver [10:19] requested and what the recommended action is. As you'll see, if Barrett [10:23] Graham, the contractor builder, needs to deviate from any of these restrictions, [10:30] um, or conditions that are put in here, they will have to come back and request [10:34] a formal waiver or waiver, um, if it's already, um, recommended in here. But, [10:39] um, if you have any questions, I'm happy to answer or the group would be happy to [10:43] answer as well. [10:55] » Yeah, Graham, is that the main standard that you [10:57] They're, um, texting someone. [11:01] » Yeah, I Yeah, they probably [11:03] » Okay, it probably should be printed on 11 by 17. [11:15] » I can bring my monitor over and you know, and zoom in on it. Okay. [11:18] » I've got my I've got my glasses. >> Okay, you're good. All right. [11:21] » Good. >> I can get the, um, what's it called? [11:23] The, um, [11:25] Oh my gosh. >> The zoom? [11:27] » No, the what do you call it? >> Magnifying glass? [11:29] » The magnifying glass. Gosh, dang it. >> I feel it. [11:32] » Put it >> That is Thank you. [11:35] » Let's see if I got one. [11:38] I I really can't though bring my monitor over if there's something you're you're [11:42] in particular you want to zoom in on, but [11:44] um but most importantly the park like as an [11:47] example the parking lot is not going to be a um [11:51] is going to be mostly in a um if I understand correctly gravel [11:55] surface. So, it's not going to be some concrete [11:59] surface and they have to do certain things out of being realistic to keep [12:02] the cost controlled and a lot of those is where you're going to see waiver [12:06] request or deferrals and things like that. So, uh [12:10] » And some of that has to go to zoning? >> No. [12:13] » It all is handled by the chair. >> Yeah. [12:15] » Okay. [12:20] Do you want them to talk about that? The waivers? [12:24] Are you good with that? >> I'm I'm okay with that. [12:26] » Okay. I just didn't know if it had to go to zoning first. [12:30] Okay. >> It's sort of unique since it's [12:33] » It is. >> on our property. [12:35] » Yeah. >> Okay. [12:36] » Yeah. [12:42] » You don't have an issue with any of it? >> I don't. So, [12:46] I'll make a motion to approve this new >> And I'll second it. [12:53] » Mhm. >> Okay. [12:54] » Will first vote. >> Yes. [12:55] » Cummings. >> Yes. [12:56] » Peters. >> Yes. [12:57] » Childers. >> Yes. [12:58] » Motion passed four [13:07] » Next hurdle. Next hurdle, right? [13:10] » Yeah. [13:17] » I'm back. Thank you, trustee Cummings. You're welcome for that. [13:25] The last thing in new business that we have is [13:28] consideration consideration of possible approval of [13:32] sludge hauling contract renewal Metro AG. [13:35] Term expiring December 31st, 2027. [13:41] » So this is a service that we use every year at least once a year. [13:45] In your notes I outlined the last three years of data that we have on the price. [13:51] It's right in the $25,000 range. This is an increase [13:56] and I ran it by our sewer operator Ethan and he seemed that [14:02] he seemed to think that the increase was reasonable. [14:05] Um one um [14:08] note is the termination section. You all are under active consideration [14:13] of selling your sewer plant. And if you ultimately [14:18] decide to do that before the end of this contract, I [14:21] spoke with the um the owner of the old company about [14:27] making some type of amendment to the contract to give us an out [14:31] of it so to just to clean it up. And Mark has [14:36] all he did was provide that on his letterhead saying that they would hold [14:39] us accountable. Mark has prepared a um motion if you're okay with that. Um for [14:45] what we need to do to modify the agreement if necessary to [14:50] get this done. But anyway, point is I recommend approval. We need to do it. [14:54] It's a essential [14:56] service that we use. I don't know if somebody wanted to [14:59] review a motion if you if you're okay with it. [15:04] Excuse me. >> Is the dollar amount in here? [15:07] » It's on the last page. It's a unit It's a unit price per gallon. Yeah, per [15:12] gallon hauled and so that's been around 25,000 a year roughly. [15:16] » I read the notes. I just didn't I was looking for a number. Sorry. [15:19] » Sure. >> Yes. [15:22] All right, motion to approve the contract with Metro Ag for the Village [15:26] of St. Joseph Wastewater Treatment Plant as presented with direction [15:31] uh that it be modified to allow village termination in the event of sale of the [15:36] sewer system under terms satisfactory to the village president. [15:43] » Second. >> [laughter] [15:46] » Thank you. >> Thomas? [15:48] » Yes. >> Peters? [15:50] » Yes. Childers? >> Yes. [15:52] » Yes. >> And if you pass forward [15:56] » All right. Uh anything else, John? [15:59] » No, but we will be requesting >> Executive [16:02] » executive >> Right. [16:04] Anything? Mark, Mike [16:07] Anything else? Okay. Do you have your chief? [16:12] » I make a motion to enter into executive session for the limited purposes of [16:17] purchase of real real property and the sale of [16:21] village real property pursuant to 5 ILCS 120/2C5E6. [16:31] That's my motion. >> I'll second it. [16:34] » Thank you. >> Jacob? [16:35] » Uh >> Yes. [16:37] » Peters? >> Yep. [16:38] » Childers? You abstain? >> Yes. [16:41] » Thomas? >> Yes. [16:43] » Thomas? >> Yes.
