[0:01] Let us pray. Heavenly Father, uh we come to you tonight just to say thank you for [0:05] letting us serve. I hope you give us the wisdom and knowledge and capability to [0:10] make good decisions for the town. Uh since this is a political meeting, I [0:15] just want to take a moment to to just wish that you would put your hand on us. [0:19] I know the last few weeks have been very decisive in our uh larger community and [0:25] I just want you to take care of everybody. Uh just uh remember to to [0:31] love our neighbors wherever they may be. >> Uh I with that uh pray these things in [0:39] your son's holy name, Jesus Christ. Amen. [0:42] » Amen. >> Let's do the pledge of allegiance. [0:45] » I pledge >> pledge of allegiance [0:47] » to the flag of the United States of America and to the republic for which it [0:52] stands. One nation under God, indivisible, with liberty and justice [0:58] for all. [1:02] [clears throat] [1:06] » Call this meeting to order. [snorts] First on the agenda, [1:11] Chief Franks. Little presentation, please. [1:14] » Good evening, Mayor and Council. Um, I'd like to call up Officer Jacob Grimes up [1:18] here. Um, as you all know, uh, we like to recognize our police officers when [1:23] they, uh, do great things for our community, and this is one of those. [1:28] Tonight, I'd like to recognize Officer Grimes for a life-saving award. And I'm [1:32] going to read the memo. I think it, although it's a little cumbersome, it it [1:35] it says everything. Uh, the Stallings [clears throat] Police Department [1:38] believes in recognition of officers and their actions and service to the [1:42] community. In keeping with this belief, the Stallings Police Department [1:44] recognizes Officer Jacob Grimes for measures taken to save a life that [1:48] occurred on December 13th, 2025. [snorts] On that date, Grimes responded [1:54] to Atrium Hospital at 3 about 3:40 in the morning regarding a dog bite. Upon [1:59] arrival, he found a victim who had been bitten by a dog and subsequently had his [2:02] arm broken. Um, the victim related to Grimes that his mother had also been [2:06] bitten, but he had left her at the residence. Um, Officer Grimes made the [2:11] decision to go to the house to check on this elderly woman. When he got there, [2:14] he found her uh or he heard an elderly woman uh calling for help from inside [2:19] the garage. Um, Grimes made entry in the garage and located an elderly female on [2:24] the floor who'd been bleeding heavily and he realized that her foot had been [2:27] delved by the dog. Uh recognizing severe blood loss and injury along with the [2:32] fact that the female victim is sitting in the cold for unknown period of time [2:35] uh officer Grimes made the immediate decision to transport her to the [2:38] hospital here in Stallings. Uh due to her injuries, he picked her up and had [2:42] to carry her to his squad car as time was of the essence and place her inside [2:46] the car. Upon arrival of the hospital, the female victim was stabilized and [2:50] later transferred to Charlotte Hospital for potential amputation of her foot. Uh [2:55] and she is still currently in the hospital. Officer Grimes demonstrated [2:59] exceptional judgment, professionalism, and dedication to the preservation of [3:03] life. Had it not been for the decisive actions taken by Officer Grimes, the [3:06] victim would have succumbed to her injuries due to the continued blood loss [3:10] and shock. His actions reflect the highest standards of law enforcement [3:13] service and brings credit himself and the Stallings Police Department. And his [3:17] actions such as this and his sense of duty that helps continue to make our [3:20] community a safer place to work and live. So, I ask everybody to uh [3:24] congratulate him for a job well done. >> [applause] [3:34] [applause] >> Officer Grimes will have a certificate [3:37] and the memorandum of his actions that night and he will receive a life-saving [3:41] ribbon uh to put on his uniform. So, Jacob, congratulations. Thank you. [3:46] » Absolutely. [3:51] » Stand up. >> Come on over. [3:55] [clears throat] He always looks so happy. [laughter] [4:07] » You're in it. [4:12] [clears throat] >> Congrats. [4:19] Next up, we have public comments. The only person that signed up is [4:24] Clarence Alselbrooks. Hello, Clarence. >> Of course, that's going to be hard to [4:30] follow, but all right. Um, good evening, mayor and [4:35] council. My name is Clarence Als Brooks, Jr. I'm not a resident of Stalins, but I [4:40] uh come with a disclaimer. I'm a resident of Indian Trail. My disclaimer [4:44] is that I am also a council member in Indian Trail. So, my um my comments may [4:50] not necessarily reflect um or represent the town of Indian Trail. My statements [4:56] and opinions are my own and um [clears throat] [5:00] are my own. First, I'd like to congratulate your new mayor of Stalins. [5:04] You are the right person for the job and Stalins is blessed to have you. [5:09] Congratulations to Graham and Mayor Pro Tim Richardson. Um Stalins is known for [5:15] its excellence with civility on this board and I hope that you all work hard [5:21] to continue that. Um, I actually grew up in Indian Trail back when Indian Trail [5:25] was only 2,000 citizens. Back then, Stalins and Indian Trail were pretty [5:29] much one big community. As a matter of fact, I still have a lot of family [5:33] members and friends here in Stalins. With that said, I hope that Stalins and [5:38] Indian Trail can work together to make the western part of Union County a [5:42] better place. Also, with that said, tonight is my today is my wedding [5:47] anniversary, so I'm going to leave here so I can take my wife out. So, [5:51] [laughter] >> um, but with that, seriously, I, uh, you [5:54] know, I enjoy coming to your meetings, know most of you, hopefully to get to [5:59] know the rest of you. You have a great town attorney, um, along with everybody [6:04] else. So, um, I hope that we can work together in the future. So, [6:09] » y'all, thank you. [6:11] » All right, I want to introduce you to our two newest members, Mike Cousins and [6:16] John Vandere. >> Nice to meet you. [6:18] » Thanks for being here. Someone just shake their hand. [6:20] » Sure. >> Happy anniversary. [laughter] [6:23] » Happy anniversary. [6:29] [clears throat] [6:32] » These are Clarence was the only one that signed up ahead of time, but if there's [6:35] anyone else that would like to speak, this is public comments if you would [6:39] like to speak. All right, [6:44] moving on to the consent agenda. [6:50] May I move approval of the consent agenda A through D? [6:54] » I'll second. [snorts] [6:57] All in favor? >> I. [7:00] [clears throat] >> Excellent. That passes. [7:03] Reports. Reports from the mayor. [7:08] Been a quiet month. My holidays kept things kind of quiet, but um I did have [7:15] met with a number of constituents. wanted to get together and talk about [7:18] individual projects and um I met the uh president of sale ethics which is the [7:24] building up on Stallings Road that's being built and they are excited to be [7:28] moving into Stallings under one roof. They currently have about five or six uh [7:34] on a campus over in Matthews and they're looking forward to having like I said [7:38] one one building. He's looking very much forward to uh coming into Stallings and [7:44] hope to meet him here, bring him into a council meeting and introduce him to the [7:47] rest of y'all. That's all for the mayor. [7:52] » Pam, anything? >> No, sir. [7:55] » I've got two quick things. Um, one was we had a great uh town holiday party [8:00] last week. So, uh, want to thank uh the staff for putting that on. It was really [8:03] nice. Uh, the mayor uh allowed me to call a round of bingo, which I [8:07] appreciated. Um although I'm nervous speaking in front of crowds so it was a [8:11] little bit different for [laughter] me. Um and second was uh John and I attended [8:15] a resident led meeting yesterday at the Shannara HOA regarding the conditional [8:19] zoning um for Stevens Village at the corner of Stevens Mill and Idle Wild. We [8:24] were there two and a half hours or so. Um it was really well done. Jeannie [8:28] Lindsay, who's a resident of Shannara, put that on and it was a great way to uh [8:32] share information for folks who were not up to speed on everything that was going [8:35] on and uh for John and I to help answer some questions and uh get some new [8:39] questions that we're going to find answers to as well. [8:43] » John, he didn't leave much for you, but >> No, I'll agree with [8:48] » um No, nothing. >> Nope. No, thank you. Uh it's been a [8:53] quiet month. Nothing. >> All right. All right. [8:57] Agenda approval. Mayor, [9:00] » if you don't mind, I have I have several things to report on. [9:04] » Uh so again, want to echo the sentiments of Council Member Cousins. Thank you to [9:08] the council for your support and all the all the staff that went there and [9:11] Ununice for you and your team's work on that. Thank you. Um got the budget uh in [9:16] transfer list uh for y'all's consideration. It's front of you. You [9:20] don't need to make any decision, but it's more like a report. Um [9:25] secondly, the board last time expressed an openness to doing a team building [9:30] exercise with our new board members, our new board as a whole. Um just trying to [9:35] kind of grow and bond uh for the betterment of the [clears throat] town. [9:39] Uh the board asked for a couple things. One, didn't want it to go anywhere far [9:43] and wanted to keep the cost low. Uh if if we could do it for free, that'd be [9:49] the preference. So, uh, with Chief Franks's help, we're able to secure the, [9:54] uh, Matthews Police Department's police simulator, training simulator, uh, think [9:59] like, uh, uh, if a virtual reality video game grew up, got a job, and, uh, it's [10:06] very impressive, um, training process. So, it'd be a good, I think, bonding [10:11] experience for y'all to go through that together, and also learn about some of [10:15] the split decisions our police officers have to make. So, um, is is anyone [10:20] opposed to that? How does that sound to y'all? Open to it. Okay. If everybody's [10:24] good with that, then we'll send out some dates and try to get something that [10:28] works for the most people. Uh, also, one thing you'll notice is uh, one of the [10:33] initiatives we're trying to make here internally is try really bring up the [10:38] appearances of our facilities both from a cleanliness standpoint and an [10:42] appearances. We've had storm water issues out back. You'll notice now [10:45] there's some enhanced landscaping planning eventually. I would love to do [10:48] that out front to really set the tone for our citizens and for our developers [10:52] of the expectations we have here at the town. And also we've tried to expand our [10:59] um our contractor list of various janitorial janitorial work. So we're [11:04] going to work on that and hopefully that addresses and brings it up to the [11:07] standards that we would like. Um so that concludes uh staff's report. Appreciate [11:12] your time. Any other staff, [11:17] [cough] [clears throat] [11:18] » Alex? Any other staff? >> Yes, sir. [11:21] » All right. Um, agenda approval. >> I do have we received a request, mayor, [11:27] uh, from the developer regarding the Mil Creek uh, regarding the the process and [11:31] wanting to do the presentation earlier in the agenda. Um, the applicant is here [11:36] if you'd like to hear from them from their request. [11:40] » They're first down here. >> They're next. I believe they have a [11:43] request to to hear uh have the presentation done uh prior to the [11:49] decision on annexation, but they're here. I'll defer to them with their [11:53] request. >> Well, I think our normal procedure is [11:57] the annexation always goes first, >> followed by the presentation of the [12:01] project. And I don't think we need to add that to our agenda this evening or a [12:06] change in our agenda this evening. Let's proceed [12:10] as is. [12:13] I move that we approve the agenda as noted. [12:18] » I'll second. >> All in favor? [12:22] » I. [snorts] >> All right. Next up, annexation 58 Mil [12:29] Creek. >> Yes. Um, Mayor Shaw, um, this is an [12:34] annexation for a 12.571 acre parcel on Highway 74. council will be most [12:41] familiar with it near the cookout and Starbucks on Highway 74 in Indian Trail. [12:46] It's right on the edge of that. This is the final step in annexation where you [12:51] will adopt the ordinance that extends Stalling's boundaries. We just need to [12:57] open the public hearing, see if there's anyone here to speak on that, close it, [13:00] and then council can speak on whether or not you want to annex that parcel into [13:04] the town. >> All righty. So, I'll open the public [13:07] hearing. Anybody that would like to speak on this this annexation? [13:17] Well, one more time. No. All right. I'll close [13:22] the public hearing and uh move to council discussion. Lori, would you like [13:27] to lead us off? >> Um, [13:31] yeah. I you know I [clears throat] was thinking a lot about um what our our [13:36] role here is and we should be working to benefit the town [13:43] to make the town better and I I don't see how this annexation [13:49] fits into um making it better. I I mean I'm [13:55] talking a little bit about the um site plan also, but [14:01] you know what we're trying to do what we're trying to achieve is have less um [14:07] residential and more commercial. And when something like this comes along, [14:14] it it doesn't make any sense to me, especially that it's on Route 74 that, [14:19] you know, is mainly commercial except for, you know, a couple residents across [14:25] the street. Um, so I I'm feeling that I'm feeling [14:31] negative about this project, about the annexation [14:36] because it it's not going to benefit anybody in the town or the town. [14:40] » Okay. [clears throat] >> Itself, [14:43] » anybody else? [14:47] » Mayor, what's the staff? What's the what's the requested [14:53] annexation and what's the surrounding annexual [14:57] [clears throat] [15:01] 74? [15:05] » So the requested is >> the the request is just well first you [15:10] just >> I'm sorry we're not talking zoning we're [15:12] just talking >> yes sir we're just talking about [15:14] annexing the parcel into the town. >> Now withdraw my question. Well, wait a [15:17] minute. I thought when we annex something in, it does come in with a [15:21] zoning attached to it. >> That's what we're they're asking to. [15:35] » Okay. But for that brief sliver of moment as we move from four to five, it [15:42] gets some type of prezoning effectively. [15:57] Okay. Okay. [16:07] Any other comments? I tend to lean toward um what Lori was [16:13] thinking as well is that um upon introduction to the project, you know, [16:18] it's kind of like if you're walking down the street and you find $20 on the [16:20] ground, you go, "Oh, this is great. We didn't have this before. We have it [16:23] now." Um but thinking more about the surrounding area, the difficulty of [16:28] getting in and out of there. Um and the fact that as Lori said as well, it's [16:35] more residential than commercial. Um, so it would be an easy thing to say yes to. [16:40] Um, I think without deep consideration, but thinking about it more, I don't know [16:44] that it aligns with what we want to do. >> I think that's I'll just say it real [16:50] quick. I mean, I think that's it is that I mean, you kind of look at our [16:54] strategic goals and uh I think that's ultimately the problem. We all know here [17:00] that we're currently out of sync when it comes to a ratio between commercial, [17:06] industrial, and um residential. And with the limited capacity of sewer on this [17:15] side of town, uh this this particular project would eat up most of that [17:19] available sewer or and even the new sewer allocation that potentially is [17:24] coming to us for the 74 corridor. And I'm just not sure it it aligns best to [17:30] our goals to use that sewer capacity for a project that of this nature. [17:39] » There again, we're talking use, not annexation. That's the complicated [17:42] things. And I assume maybe that's why the developer wanted to or the applicant [17:46] wanted to do the presentation. [clears throat] [17:48] I guess the question would be is the landowner here? [17:52] » Landowner is not here. So the question would be to the landowner. [17:57] Oh, sorry. >> I guess my my question was is the land [18:00] owner here and would the land owner like to be annexed into the town of Stylings? [18:05] Um, and [18:08] » I can speak on behalf of land owner in this capacity if I'm able to. [18:13] » Well, I guess the question is would you like to be annexed into the town of [18:16] Stylings if um what seems like the Can I address an audience? I'm not sure what [18:22] protocol is, but if the council looks like we're proposed to say no to the uh [18:28] use, um [clears throat] would you like to be annexed into the town? [18:33] » I think they go together. That's why there's got [18:39] no [18:43] reason. >> Okay, [18:48] then I'll [snorts] make the motion to deny the annexation. Well, I did have a [18:51] comment. I >> Yeah, I think that's it's pretty obvious [18:53] what's happening. So, go ahead. >> Oh, I just wanted to say uh regard [18:58] without [clears throat] getting into the use, I [19:02] my position is that I I recently drove this I go over this area a lot for [19:09] trivia and that section of road is not conducive to pulling out. I just my [19:16] concern is anything that we add in that regardless of use. Uh anything that's [19:22] added there, it's going to create more congestion. It's going to potentially [19:26] create accidents. And I don't see how that adds value to our town when we've [19:30] annexed a lot of properties. So my my position is I think I would be [19:36] against the annexation for that those reasons regardless of whatever the use [19:42] it would be. based on Brad's question to the land [19:48] owner to the representative the land owner that if the board was not inclined [19:53] to approve the subsequent action on the CZ that we would be doing a disservice [19:57] to the land owner in annexation. So for that I would [20:04] that we do not [20:07] » All right. So there's Can I ask one question? [20:11] » I don't know. Well, >> I'm not you're not known for only asking [20:14] one question >> that ask as many questions as you guys [20:19] want. that is I mean and I might not [20:25] this may not be a good question so you may need to shut me down but I mean I [20:30] know that there's been discussions about this project now for several months and [20:37] there's been discussions in committee and within the staff about the fact that [20:42] this project probably was not very favorable. Um, and [20:48] I think there's even been some proposals uh given back to the the team working on [20:53] this particular project about a different layout, different components. [20:58] Was there is that still a consideration or we pretty much exactly what the plan [21:03] is that's being submitted tonight? [21:10] » Yeah. >> Yes. [21:14] Um Lisa Thompson, [clears throat] um Wendy's consultant with Morgan Van [21:17] Allen. Um from what I understand, you guys have 60 days to zone the property [21:23] after annexation. So that was one of the questions is um what what zoning do we [21:28] put on it if it's annexed and not zoned? Um no, if you're leaning towards not [21:33] approving the resoning, we would ask that we not be annexed. Um we would like [21:38] to be given the opportunity to present the the plan and and the development. Um [21:43] if you'll um postpone the decision for the annexation to at least um hear the [21:50] um the the presentation or vote favorably [21:55] and you you guys if you deny the reasonzoning, it's my understanding that [22:00] this evening you can resend the vote for annexation as well. So there's a few [22:05] options. Um, but if you don't even want to hear it, [22:10] » this is highly out of our norm. We don't [snorts] reverse the order. I can't [22:16] remember ever. >> Do we ever re No, don't need to answer. [22:20] » I mean, if >> So, we're going to vote for the [22:22] annexation. >> Okay. [22:24] » And then if need be, we will vote on the project. [22:29] » Hey, can I believe there's a motion on the floor? Brad, did you make the motion [22:33] or did somebody interrupt you? >> Yes. Assuming you close the public [22:38] hearing, then I had made the motion to um not approve the res. [22:43] » Second, >> excuse me, not approve the annexation. [22:46] Sorry. >> Second. [22:48] » All right. How's council [clears throat] vote on this? [22:54] » Call the >> All in favor? [22:55] » I >> I [22:57] » unanimous. No, I didn't hear all of them. I'm I'm going to be a n on that [23:02] one because I I felt like there was more questions that needed to be answered. [23:11] » All righty. So, we're not annexing this parcel. [23:16] Um [clears throat] there's no need to [23:22] uh Melanie, how do we deal with uh the next item? Seven, six, four. I mean, [23:27] » if it I mean, if it's not in the town, you can't zone it. [23:30] » Yeah. So, we're going to skip it or withdraw it from the [23:35] » Yeah. suspend the >> I'm I'm a little worried because right [23:39] when applications come in, we have a decision has to be made within a certain [23:43] period of time. [23:54] So we would would we suspend the rules and then remove it from the agenda? [24:03] » Should we make a motion? >> I mean it' be easy. I make a [24:10] Yeah. Just take a second. Okay. [24:19] Melony, do do we need a motion to make you most comfortable? [24:24] » I [clears throat] think you're better off hearing from the applicant because [24:28] my concern is is right. They've paid the application fee. They've done everything [24:33] we've asked them to do in terms of submitting the application and a [24:38] decision is supposed to be issued in a certain amount of time. So I understand [24:42] we can't do anything if it's not annexed. But at the same time um [24:48] we have heard this presentation at least once or twice already. They're [24:55] just putting less commercial in I guess with this last one. [25:06] So there was a I wasn't here at the July meeting. There was a public hearing in [25:09] the presentation. heard it from X meeting [25:16] and then we deferred it against January. >> So there's been a hearing on it. There [25:20] just is was not a vote on it. >> Correct. [25:23] » And the annexation was what? Just not on that agenda. [25:28] » Madam Attorney, I I feel pretty confident that the applicant would [25:32] withdraw their [25:38] that feels like that would solve your concern. Imagine [25:41] them not doing that. [25:58] We're confirming [26:16] Have you got a decision [26:20] » normally asked by somebody to pull application for the reason? [26:25] I >> only ask the question the way it should [26:27] be asked legally. Please [26:36] Oh yeah. Yeah. We can't >> we don't have jury. [26:40] » While all of that is true, we still have a process and procedure, right? When [26:44] developers submit applications and when decisions should be made at a within a [26:48] certain period of time. So we've never we've never had this decision. Normally [26:54] what happens is if it does not pass then someone who [27:00] voted for the annexation makes a motion to reconsider the vote before the end of [27:04] the meeting. Um and that [27:08] » reconsider the annexation. >> Correct. Okay. [27:11] » Correct. That's how I've seen that. We've done that at least two or three [27:14] times in the past. >> So you're saying let them present. [27:20] » I think that's the safer route. >> Okay. [27:23] But but you but you already voted on the annexation. [27:26] » We did. >> And [27:27] » as we always do, we do it in sequence. >> Okay. [27:31] » And so someone who voted no, [27:36] » which would be me. >> No, they they all voted no. [27:40] » Steve voted. Oh, I voted >> yes. Okay. [27:43] » Would have to make a motion to reconsider. [27:45] » Reconsider the annexation. >> Correct. [27:48] » When? Now. >> Right now. Yes. [27:50] » No. Why would we do that? We just voted no. [27:53] » Because I just wanted it to be clean and I don't want to leave the door open for [27:57] any >> legal challenges based on the process [28:02] and the procedure and >> how our rules are after the [28:07] presentation. You could re you could reconsider the annexation. [28:13] » Why would we need a presentation? We don't [28:19] » if I mean if you don't want to do the presentation [28:23] » I just I wasn't here in July so that's why I'm a little [28:26] » uneasy about the whole process and what's happened. So was there because if [28:32] it was presented in July y'all didn't vote on the annex there was [28:37] there an annexation on the agenda? >> Yeah they were both [28:42] » it was deferred. It was deferred. But was there a public hearing?
