really jump on one time a year and that's around daylight [11:25] savings time and that's our smoke detectors everybody check your batteries [11:28] change your batteries and stuff like that tonight I just wanted to hit on [11:31] something that sometimes we Overlook with those and that is [11:36] um checking them even more often but more so than that if you have a child or [11:41] young one in your house if you have someone elderly or if your parents are [11:44] out on their own and they happen to be elderly periodically test that thing so [11:49] they know what the sound is because in this day and age we have phones going [11:53] off we have all kind of electronic issues that make different sounds [11:57] different noises and just make them aware if they hear that what it what it [12:03] is um you know all you have to be around is [12:06] a group and you'll hear all kind of tones on phones and stuff like that and [12:09] somebody you know could very easily get confused but we want everybody to know [12:15] if you hear that in the middle of the night when you're already tired and [12:18] sleepy and you wake up to something like that going on and you know what it is [12:21] and we really stress with the young and with the elderly to make sure that that [12:28] they know what's going on and check those batteries more than one time a [12:31] year that's it thank you January 10th shooting at the 7 900 block [13:00] of Leicester Road detectives are still actively investing in that and on [13:05] January 19th we responded to an aggravated domestic assault in the 8 000 [13:10] block of Oak Creek Drive in which the offender was arrested on-site without [13:15] any incident um a couple other things just reminding [13:20] everybody again to make sure you don't leave anything locked up in your cars [13:24] overnight or leave your doors unlocked because your neighbors to the south of [13:27] Oak Ridge have recently had a few string of car break-ins and usually the [13:32] group if it's a group they'll move from one [13:34] town to the next so just a friendly reminder please don't keep any valuables [13:38] in your car if you come out and enjoy the park leave your valuables at the [13:41] house don't leave them in the car because we've had instances where people [13:45] are seeing backpacks or computer bags or anything and they'll [13:48] just an American Rescue [14:49] plan best practices management webinar on January 25th [14:55] um we had vandalism in the park we received the mirror replacement today so [15:00] we'll be getting that installed staff has assisted [15:05] um various agencies as well as staff in the town park Committee in [15:11] putting together the rfps for the playground Amphitheater basketball [15:16] courts and pickleball courts and the rfqs for Engineering Services for the [15:21] water line extension projects coming up staff has worked with various agencies [15:27] on the huge amount of paperwork that is [15:32] associated with each of these grants that will be ongoing for a while through [15:36] both the state budget office as well as Guilford County we have the 50 000 [15:41] Capital Improvement equipment Grant and the 1.1 Municipal Water System [15:46] Improvement Grant staff has also [15:50] completed necessary paperwork for the health insurance for our full-time [15:54] employees we had our recent renewal that takes effect February 1st [16:00] staff has worked on several developments and while we only had one meter [16:05] installed this time probably next month would be very different just wanted to [16:09] bring to your attention the number of subdivisions that's ongoing right now we [16:15] have North Ridge we've just finalized phase six [16:19] Treeline Trails is finishing up phase two but they have three and four that [16:24] will be working on the new subdivision out on Highway 158 they have named it [16:31] Nathaniel Ridge we have received plans for that so we'll [16:36] be starting reviews of that and Oak Level Church Road also submitted new [16:42] plans this week we'll be working on that one and then of course blacksmith is [16:48] still in phase one [16:53] every year we have to renew our application to the North Carolina [16:58] Wildlife office for the we are considered a dear Urban archery town and [17:05] every year that's renewed we just recently submitted that [17:10] um the upcoming elections this year we host we are an election site a Precinct [17:16] site here I just executed the documents with the Guilford County Board of [17:20] Elections this week to use the town hall for that for the all the elections [17:26] necessary for this year we have responded to public records requests for [17:32] the Happy Hill Road subdivision Mr Wagner has will be attending his first [17:37] clerk certification class next week so keep in mind he will not be here it will [17:43] just be pressed enough so be kind [17:49] um every year we are required to submit a survey to the league in regards to the [17:55] town benefits I just recently completed that and then every year we are also [18:01] required to submit to the state on our water system to reports the consumer [18:09] confidence report that's due June 1st and that's a lengthy process and priest [18:14] has already started working with Rural Water on that and then we have the 2022 [18:20] water supply report that's also required and that is due April 1st I believe so [18:26] we'll be working on that as well um and that's just a small list of what [18:31] we've done this for January the 23rd at which time the committee will review those [25:17] proposals and have further discussion and perhaps a recommendation the [25:23] construction of the amphitheater the sealed bid for that is due February the [25:29] 28th and we are anticipating that we will open those on March the 2nd the [25:36] basketball and pickleball court seal bids are due by March the first and [25:41] again we anticipate looking at those in the seal bid process on March the 2nd [25:47] that's certainly when those are received we'll have a lot more to talk about and [25:54] we'll be able to single family residential with 40 000 square foot lot sizes [36:48] the [36:52] so um just just a general note that the the reason that they have to come for [36:57] this rezoning is if they develop this property into any sort of major [37:00] subdivision which under stokesdale's ordinance is when there's a connection [37:04] to a public utility a newly dedicated public road or if there's more than four [37:10] Lots then they they must rezone to an RS District to be able to do a major [37:16] subdivision so the request tonight is not for subdivision that is handled [37:22] through the technical Review Committee of Guilford County which then refers it [37:26] to the planning board for final approval so that is an administrative process [37:30] this is a legislative hearing on whether this property is worthy of the rs40 [37:36] designation and whether that request is consistent with the future land use [37:41] plans and what the plans for Stokes Tales so currently this area is [37:46] primarily rural residential there is agricultural low density single-family [37:50] residential uses in this area uh there is one single family dwelling [37:55] on this property uh the surrounding land uses as I mentioned single family [37:59] residential and agricultural uh to the West it's undeveloped as of right now uh [38:04] and it's mostly forested land and it is adjacent to property the Fire Protection District for this [38:21] would be Stokesdale hits approximately 3.6 miles from the [38:25] nearest fire station the intent is to connect to Stokesdale [38:30] water if there's any major development of this property [38:33] and they would use private septic systems [38:36] the existing conditions on Happy Hill Road Happy Hill Road is a residential [38:40] street if there are proposed improvements it [38:43] would be subject to the North Carolina Department of transportation's driveway [38:47] permit requirements because it is a North Carolina DOT road [38:51] a traffic study could be required based upon the overall size of any sort of [38:58] large subdivision and this property according to North [39:02] Carolina Department of Transportation does not appear to be impacted by the [39:05] proposed u.s-158 Improvement project that's listed in the step project number [39:13] r-2577b and they have noted that the average daily traffic is estimated at [39:18] below 500 or 500. 500 cars a day for Happy Hill Road [39:24] there is no projected traffic generation at this time because we this is not a [39:28] subdivision proposal it's just a resulting proposal [39:31] and so uh School impacts uh they are projected upon a development of this [39:37] property at a 40 000 square foot density to be relatively minor with anywhere [39:42] between uh one to five extra students per School [39:47] uh environmental assessment on this property the Topography is gentle and [39:51] steeply sloping there is no regulated flood plain on this property however [39:55] there are uh there's floodplain and wetlands to the Western portion of this [40:01] property that lies within Oak Ridge and also within Forsyth County [40:05] uh the land use plan this is uh part of the Stokesdale land use plan and that [40:11] plan recommendation is residential and uh the requested action uh by the [40:17] applicant would be consistent with the recommendation of the Stokesdale future [40:20] land use plan and thus the action if approved would not require a future land [40:25] use plan Amendment and staff is recommending approval [40:28] because the proposed rezoning action is consistent with the recommendation of [40:32] the future land use plan and it is reasonable and in the public interest [40:35] because it is excuse me because it is adjacent to residential uses in the area [40:40] and would provide low-density housing opportunities for citizens in an area [40:44] that's served by Stokesdale Municipal Water or able to be served by Stokes to [40:48] a municipal water and I welcome any questions that you [40:53] might have [40:55] any questions by the council we want to do we're going to do that now [40:59] I thought y'all said something get the questions are [43:15] um my company had acquired 126 Acres um mostly well is to the west of the [43:23] subject site and in doing that we had a access [43:28] um onto Happy Hill through Duke Energy property and it was a it was an easement [43:35] and so we rezoned that and that was going to be access into my development [43:39] that's mostly on the lake since 2021 and and the details of [43:45] engineering it became very evident that there were other ways to um to access [43:53] the 126 acres and um actually through the rezoning process [43:58] for the 126 Acres I met the the current property owner of this the subject site [44:03] tonight and she had expressed interest in selling at some point and so we've [44:09] actually gotten together I'm under contract of course it's contingent upon [44:13] the rezoning of it the property Zone Agricultural and we're asking to be [44:18] zoned to rs40 which I understand is your least intense single family zoning [44:26] District in Stokesdale and even though this is just a general zoning I can tell [44:32] you because we've already done the detailed designing we're talking about [44:36] keeping the existing house on the property and adding six more houses to [44:41] to our development so the development that was approved by you guys with the [44:47] access and then Oak Ridge and the Lion's Share of the 126 acres is actually in [44:52] Forsyth County that development in 2021 equaled 94 homes and so tonight this new [45:02] access will allow us to go up to 101 101 Lots [45:07] again the 94 is already approved I've got access it's just not the the most [45:13] desirable access so I'd like to use this one instead of the Duke Energy the good [45:19] news for the town of Stokesdale and this is that we now have an entrance road [45:25] that will have homes on the entrance road that will be in your um pound [45:30] limits so those seven houses will be in the the town limits of Stokesdale [45:36] um I um I'm I'm sure some of you remember [45:41] this 2021 rezoning it was back and forth with Duke Energy on whether we needed an [45:48] easement or whether it needed to be fee simple we ultimately have ended up [45:52] getting the fee simple and that was zoned rs40 for this subdivision so [45:56] there's nothing you know that that can be done tonight that's going to stop our [46:00] ultimate subdivision we're just hoping to improve it with the better access [46:05] and so that's the reason for the the request tonight we do plan to extend [46:10] public water to the property it's about 2 700 feet from [46:16] um Highway 158 it's sending stokesdale's water line down Happy Hill Road and then [46:22] of course into the development the subdivision [46:26] um I um I I'm joined here by my civil [46:30] engineer as well as the current property owner [46:34] um we're here to answer questions should you have any [46:38] um I hope that you agree with your planning department and the planning [46:41] staff um that this is a consistent rezoning [46:46] request with your your future land use plans and you agree with them and vote [46:51] in favor for it tonight [46:55] thank you thank you thank you we'll have some chair when that was heard [48:20] you made an application for rezoning and then you subsequently withdrew your [48:25] application um it was on our agenda I made the most [48:30] necessary motion when you withdrew your application so we could get it off our [48:34] agenda I'm I've been here almost six years I'm not aware of you having [48:40] rezoned that property sir so if if there's you've got some evidence of this [48:44] or can point us where I'm mistaken here I'd appreciate it I I [48:50] was sitting there yeah I was on the council too and I don't recall rezoning [48:54] I do recall at the advice of our former attorney that this did not need to be [48:59] resigned because one the property owner wasn't asking for the rezoning and it [49:04] didn't need to be resigned because the access road was already there Duke [49:08] Energy granted the late family I believe access to this in 2008. [49:14] uh I okay excuse me I mean it's it's been a [49:19] couple years but uh uh regardless it's been a couple years for me too yeah so [49:25] regardless I I do want to take access at a different location which is the [49:31] subject property tonight sure sure no but you're saying that's rezoned now [49:37] and that even if you don't get this that you can go that way and still do the [49:42] project at the lake is that correct that's that is my understanding yes [49:46] all right I just don't remember I remember being pulled we had us back [49:49] when we were doing the uh Meetings online yeah and uh y'all kept having a [49:54] problem with the who was saying it was on who I mean you knew who owned it but [49:58] who was going to authorize y'all to go through there and it kept getting pulled [50:01] and back and forth and back never actually came to us and um they said [50:07] some kind of state law or something Chapman I don't even know that this is [50:10] true because it was just that you didn't catch come before so that we did no [50:15] rezoning right whatsoever so yeah like I said it's you know what you're saying is [50:21] it's it's irrelevant to you but it's relevant to us that's right it [50:26] absolutely is um what you're saying is whether this [50:30] project that you're asking for this zoning goes through or not you have your [50:36] that that project's going to happen that that's not going to stop it [50:40] that is what my attorneys have told me yes uh you know yeah [50:46] okay okay all right I just just want to make sure because we had I looked at [50:50] that several times the planning board meeting online you know where you said [50:54] that and uh I mean I was there so yeah there was a lot of yeah it was a big [51:00] confusion um ultimately I was told we got I know I [51:03] know I forget a lot of stuff but I don't think I'd forget that just to be clear [51:07] you're talking about the development in Forsyth County would proceed [51:11] mean in other words whether this property [51:25] rezones or not he has access in I just want the citizens to understand if that [51:30] if that's the case I don't know what to be the case and I'm not is just the rezoning um that we're discussing the rizzonia [54:16] tonight but eventually you know if it is approved there will be a development [54:20] there and there will be a lot more traffic and we live at the top of the [54:24] hill adjacent to the property and at that top [54:28] of the hill you can't see cars coming up so [54:32] even if it was approved we would um [54:38] highly recommend that there be some type of traffic analysis especially coming [54:42] from um Warner Road to like if you're coming [54:46] from Warner Road down Happy Hill Road some type of traffic analysis because [54:50] you can't see coming down over the hill when you're turning in [54:54] um another thing is the way our property is adjacent to [54:59] um 7577 we have concerns of encroachment I mean there are it's [55:05] I don't feel like the land the the space between our land and then [55:10] the land on the other side of 7577 is enough land for [55:15] uh a um a road or to safely put a road in there so those are are our concerns [55:24] and we just thank you for allowing us to be here and I'm sure we have several [55:30] um neighbors that will probably speak to it um but yeah we do have a lot of that little bottleneck that they're [56:23] talking about running through there [56:26] directly runs parallel with my driveway and that will hook you in the road is [56:32] going to end up being probably [56:35] 35 40 feet from my back drive my driveway entrance my garage [56:42] entrance it's um it's pretty [56:46] obvious if y'all would come and look and just see [56:50] what kind of predicament this is going to cause just for my life [56:56] um not not for the people around me not to [57:01] mention the traffic that's going to come through that come through that come [57:05] through there it's it's just not uh I don't think there's enough [57:09] laying there to do it I think there's going to be encroachment on both sides [57:13] because even if you have a 50 foot right away what about the utilities and [57:18] everything that's going to Encompass in those right-of-ways you know you've got [57:23] to have utility for power you've got to have a water line and the way I [57:28] understand that water line is going to be great big [57:30] so eight inch water line coming through there how much does it take to run an [57:35] eight inch water line 20 25 feet is that going to be another 25 feet and [57:42] I went today just out of pure curiosity for myself I measured from the center [57:46] line of the road to the ditch to the center of the ditch that's 25 [57:51] feet so that's already 50 feet for both sides [57:55] not to mention what the water line is going to be if it's another 25 feet this [58:02] power line going to be another 25 feet so I'm really I'm really [58:06] I'm really I guess I'm coming to you guys asking you to [58:10] just think about what you're doing and please come and look [58:14] I think this thing needs to be a little more time for you guys to see what [58:18] they're trying to push on us I mean this is something that we can't reverse once [58:23] it's done and I guess something else I want to [58:27] talk to you all about um I don't know if y'all have ever been [58:31] and seen houses built on Happy Hill Road uh every house on Happy Hill Road [58:39] have some kind of rock formation that ends up needing blasting [58:44] and I know the Shiloh up there when they built it just recently they rocked my [58:50] house um so this company coming in [58:54] not knowing what adverse conditions that they're going to encompass [58:59] they're going to jeopardize our homes with this you know if they mess up our [59:05] foundations on our homes who's going to repair them are they going to be [59:09] responsible for that and I wish if y'all did let them do it [59:13] you would make them responsible if they do come in there and blast rock out and [59:18] bust up our foundations because it's going to happen [59:22] it's going to happen those rock walls those uh cinder block walls in those [59:28] basements they aren't going to take but so much [59:31] they aren't going to take but so much these aren't fireworks they're Dynamite [59:36] they're explosives that they have to use get that rock out [59:41] God told me when uh we built my house he said y'all better off [59:47] just to build a rock quarry here instead of build a house [59:52] so I guess my thing is all the things that's going to happen to us [59:57] and to my family and to my friends and all my kin folk around me [1:00:04] who's going to be responsible for that will this developer be responsible is he [1:00:09] going to stand up and say hey I'll take care of that if I bust your wall you [1:00:14] know I'll fix it you know but then they've compromised the Integrity of our [1:00:19] homes even the value of our homes once they [1:00:23] tear it up who's going to fix it are they going to fix it and anybody that's [1:00:29] lived here knows that Happy Hill Road has been [1:00:34] forever and a day almost a rock quarry and now they're coming in here wanting [1:00:40] to build these homes without any kind of I don't know geological would that the [1:00:44] right word won't say studies or anything you know right across the holidays Tim [1:00:50] and Corey is a closed up rock quarry that ran for years [1:00:55] and now we're coming in getting ready to develop [1:00:58] on the top of another one it just don't make sense to me [1:01:02] and did they even study why the lake stops right there [1:01:07] where it stops and the lights still had all that land that they even study that [1:01:12] they didn't question why they still had all that land [1:01:16] no they didn't I guarantee they didn't but if they did [1:01:20] check it out in 1974 when they built that Lake why did they stop it there [1:01:26] that's a good question they'll find that one [1:01:30] and thank y'all for listening to me and I probably don't think they're going to come through [1:11:51] there because it's easier to get out to 158 [1:11:54] or go to Stokesdale so we're not just talking about seven [1:11:57] homes as they're trying to email from Oliver bass and Tom Medlin which Mr Wagner has [1:18:29] and it basically said that we didn't have to rezone that 60 years so you guys [1:18:36] are absolutely correct it was never rezoned because it was determined that [1:18:40] it didn't need to be rezoned for Access if there wasn't going to be any houses [1:18:45] off of it um so [1:18:48] I think we've cleared the air on that um [1:18:52] one of the reasons why we don't like that access as much is because there's a [1:18:58] lot more topography a lot more environmentally sensitive areas so we're [1:19:02] going to talk about the environment and Wildlife that is the least desirable [1:19:07] location to bring an Access Road in and and Mr Clayton can can testify to [1:19:14] that as he's tried he's done all the engineering for it and it's it's not [1:19:19] it's just not very environmentally friendly but it can be done [1:19:23] it can be done but it's it's gonna cost more so I don't want to do it I mean um [1:19:28] as far as the access issue is concerned I mean that is [1:19:33] ncdot's jurisdiction they will come out and make sure it's a safe condition [1:19:38] before they'll allow us to run that road I mean we have to go to them and apply [1:19:43] for a driveway permit so that will be something that will be worked out later [1:19:49] um as far as the rock goes [1:19:53] um I'm unfortunately familiar with having to blast Rock and [1:19:58] um therefore when I buy property I always do lots of geotechnical work up [1:20:04] front before buying property because you just don't want to have to move rock [1:20:09] around and blast however if you do incur so and we did not find there's lots of [1:20:15] surface Boulders but down underneath it is actually good dirt and it's [1:20:20] consistent with what the soil scientists found most of this land perks it's real [1:20:24] Rock Rocky you won't per property but should we encounter Rock we actually [1:20:30] have to hire a seismatologist and and do pre-pre and and post surveys to make [1:20:39] sure that property nearby properties are not impacted by our blasting efforts and [1:20:44] if they are then then we we or the blasting company typically has to make [1:20:49] it right and that's why they carry very high insurance [1:20:55] I believe I believe and of course Mr Clayton [1:20:59] addressed how there's enough room for us to construct a zoom in the outside of the utility easement does [1:31:51] encroach well it's implied that it'll encroach to the property to the South [1:31:57] into the property to the north uh [1:32:03] do you something like that to the [1:38:35] southern part through the Oak Ridge etj right some of the Lots from what [1:38:41] I've seen of course this hasn't been formally submitted to Guilford County so [1:38:45] I'm just you know talking subjectively about what [1:38:49] I've seen uh appear to go off of that entrance whereas other Lots will come [1:38:55] off of this entrance if they develop the property as from what I've seen if this [1:38:59] was done that road if if they decided to because they had a cut through I think [1:39:03] maybe they're going to cut it off or whatever but that can be changed all [1:39:07] these things can be changed depending on engineering their engineer would have to [1:39:11] determine you know ultimate Road layout and and how it best works for them and [1:39:15] and what works to meet stokesdale's ordinance and Dot's requirements [1:39:20] um I I think um [1:39:23] you know the the bigger questions would have to be answered by the technical [1:39:28] Review Committee as part of any review I think the main question tonight is do [1:39:32] you feel comfortable with this as an rs-40 zoning or would you feel it more [1:39:37] appropriate to remain as Agricultural and I know there's these these alternate [1:39:41] questions they're all great questions a lot of these questions [1:39:46] can't be answered right now without going through full engineering technical [1:39:51] review letting Watershed look at it letting dot look at it let planning look [1:39:55] at it because we'll look at all the easements we'll look at where the [1:40:00] utilities are we'll look at you know whether these Lots will perk all of [1:40:07] that's handled through that process and I just can't give you any definitive [1:40:10] answers on What ultimately it's going to look like until we've done a full review [1:40:14] that's not the point I'm trying to get to this is tough on me I've never I had [1:40:18] never voted no one will rezone I hope it don't scare anybody but but I haven't [1:40:23] I've always waited out everything out heavy I mean really heavy I lose a lot [1:40:28] of sleeping that's my wife she knows it um [1:40:32] my concern like I said none of that is in stone so if if we did that that's a [1:40:39] possibility of that road could go and actually could possibly service all [1:40:42] those houses I know they say what they're going to do but at one time [1:40:46] and we're going to go on on the other side I mean those things change and I do [1:40:50] understand that I understand that yeah and you're absolutely but but that could [1:40:55] happen is that that is a correct assumption [1:40:58] um anything can be engineered I I think that's the the takeaway anything but [1:41:02] once we do that then it's once we do that then it's out of our hands correct [1:41:08] really at that point that meets that ordinance it has to be approved what [1:41:12] we're doing then we're going to put a hundred and some if [1:41:15] that if that scenario came we would be putting 100 and some houses possibly [1:41:20] coming out on that hill right there right because if it was just I'll tell [1:41:25] you something I wouldn't even have it I would I wouldn't I know that people [1:41:29] wouldn't like it but if it was just seven houses on a little trailer land [1:41:32] rs40 it'd almost be a no-brainer for me but but that's just not the case I mean [1:41:38] I know maybe we're not supposed to look at this and look at that but but you [1:41:42] know you got to you got to look at the big picture or at least lot 33. [1:42:40] that's that is a um the water main would would go [1:42:46] cross-country at that point so just just to bring everybody up to [1:42:52] speed um this has been a quagmire in terms of [1:42:56] jurisdictions this is um [1:43:00] um it's confusing to me um but Forsyth County has already [1:43:05] approved the project as two separate projects so that what [1:43:11] would come out on Happy Hill with this subject site [1:43:16] um would [1:43:18] would only be 36 homes with what was originally approved was [1:43:24] all 94 Lots having access on Happy Hill through that right that 60-foot [1:43:30] right-of-way and we were connecting over to Bent Ridge Forest and so technically [1:43:36] in that scenario all 94 homes should they choose to go that way would come [1:43:42] out onto Happy Hill including the bent Ridge Forest folks [1:43:47] now that has been segregated and um [1:43:52] Mr Wagner if you could throw up that plan the the plan that he has [1:43:58] um is actually the proof Forsyth County um [1:44:02] special use map so this is you know what we're bound to [1:44:07] do and it shows a water line as you've already pointed out but it also shows [1:44:13] that we're no longer connecting the east side of the property to the west side [1:44:20] with a road with a road well is is that lot 33 are they going to [1:44:26] build a house there on the on the side of the easement yes [1:44:31] so they'll have a water main going through their backyard on the side yard [1:44:35] yes yep and we're going to be responsible for it [1:44:40] uh yeah so here is the approved plan if you could so this is the the basically [1:44:47] the western side of the project and you can see they're no longer connected [1:44:52] um and then the Eastern side actually shows this property subject [1:44:59] property as an alternative access [1:45:04] um and to the Duke Energy 60-foot right-of-way but up there if you could [1:45:09] pull that Eastern one up you can see that you've got in the top [1:45:13] right hand corner that is the approve County Commissioner seal and so you know [1:45:21] I know everyone's concerned that I could change up but I'm telling this this is [1:45:27] what we're now you know obligated to do but [1:45:32] could you change back to the not change back to the other one but keep the inner [1:45:36] the road and I mean I have there is there is zero [1:45:43] zero uh enticement for us to do that we we had Environmental [1:45:50] yep [1:45:53] I mean you know it's a lake and and there's a lot of you know tributaries [1:45:57] feeding into it and so we had by segregating the the two sides [1:46:05] um we were able to eliminate three stream Crossings [1:46:13] I don't know much about the water line installation how is that stream at the [1:46:17] bottom of a gully I'm trying to think in my head how our water line would yeah [1:46:22] I'll have to bring Mr Clayton up for that [1:46:37] yeah if you can bring up that playing again I can with the water lines [1:48:21] I know you're doing the engineering for it uh I heard there was some high level [1:48:25] conversations going on and I don't know anything about them and you know it's I [1:48:30] mean the original back in 21 we did we got to that point and who was you [1:48:35] talking to then I was on Council man I mean all of a sudden it got put up and [1:48:38] we said it was a great deal we're going to get a water line we thought the folks [1:48:41] in Happy Hill because for years they said that you know they wanted water and [1:48:45] I guess it was late because now the houses tore down that they needed it [1:48:48] with their shallow Wells and and they dug deep whales and they don't need the [1:48:52] water line yeah we may have done a test service instead of what we thought we [1:48:57] were doing and uh so we did vote on that because we've always extended water [1:49:02] lines in Stokesdale with the developers in 95 of the cases uh there's been a [1:49:07] couple of things and I just you know like I said I hadn't found anybody [1:49:11] that's been talking to anybody and um yeah there again this is the first [1:49:16] step in the process and yes we I mean we're counting on since we did it in 21 [1:49:22] we we would still continue that yeah because we have to take it we had to [1:49:27] eventually take that thing over and we're responsible when you're running [1:49:29] all up and down their Hills and Hollows and they start breaking it's just a [1:49:32] little yeah it's expensive um [1:49:35] so you just you're really not talking to [1:49:39] anybody in Stokesdale right now about that you're just in a planning phase [1:49:42] that's what you're saying and I know that don't really have anything else [1:49:45] originally we've taught we talked to the mayor at the time [1:49:49] and the Town Clerk and back in 21 okay yeah you're talking about now bringing [1:49:54] the water line up to the property [1:49:58] that you're Rob that we're trying to rezone tonight or [1:50:02] you're trying to rezone you're not talking about going across that 60 foot [1:50:07] right away going down that way are you down you'd have the 64 week we actually said we we again [1:51:26] publicly said we was going to put the water line in [1:51:29] you know uh Mr Winfrey I have a question here [1:51:33] based on past experience but if we close a public hearing portion of [1:51:39] this process won't this Council still be allowed to ask questions of those [1:51:44] gathered here whether they be you or the applicant or any citizen [1:51:51] I still ask questions after public hearings closed yeah yeah [1:51:56] what I'm interested in doing is getting emotion on the floor for Council to [1:52:01] discuss right now we don't have they [1:53:29] know that you can't do what you want to do with your own property [1:53:33] but again I do live in one and I'm the president of it but I do believe that [1:53:39] that a property owner should be able to do whatever they want to do with their [1:53:43] property [1:53:47] that's my discussion is there any other discussion [1:53:51] yes sir Mr Mayor I've got several points that I'm going to make here this is [1:53:56] going to take a while [Music] [1:54:00] um I'll try to be as brief as possible [1:54:05] observe this a previous Council [1:54:09] uh rezone the property off a cold water Road and this was the first time that [1:54:16] town at Stokesdale water had been extended back over into Forsyth County [1:54:21] we buy our water from Forsyth County I observe that Mayor John Flynn at the [1:54:27] time provided a letter to Forsyth County promising water to that particular [1:54:32] developer at that time he had no voter Council [1:54:36] to sign such a letter councils subsequently made a vote [1:54:43] I don't know how long it was after that letter was signed but subsequently the [1:54:47] council voted to provide water on cold water [1:54:50] I bring this up because of some technical points that the way our water [1:54:55] system operates the way our administrative process operates uh [1:55:00] the Cold Water Project there was no plan review so no Stokes still no engineer [1:55:07] looking at the plan on behalf of the town of Stokesdale reviewed that plan [1:55:11] and then there were no inspections done on that cold water Road water main [1:55:15] extension over in Forsyth County [1:55:19] that gets us to the Happy Hill there was a subsequent vote by [1:55:25] previous Council regarding an agreeing to provide allow RJ R.S Parker Holmes to [1:55:32] connect to their the town of Stokesdale water system [1:55:35] where I have I have several different issues pertaining to this uh like my [1:55:41] good friend Mr Landers pointed out if it was just a rezoning case about seven [1:55:45] Lots off of Happy Hill Road I I you know it would be a lot more simple as the [1:55:51] applicants pointed out there are multiple jurisdictions involved here and [1:55:55] that is unfortunate but that doesn't mean that I'm an automatic yes vote on [1:56:00] anything going across the county line the [1:56:06] town of Stokesdale currently has a cap of 300 000 gallons per day to buy water [1:56:10] from Forsyth County we're negotiating to raise that cap and and I think that will [1:56:15] be done relatively soon but I as a council member at the moment have to [1:56:19] consider that this still capped at 300 000 gallons a day [1:56:22] there's uh the usage that's going back over into Forsyth County I don't know [1:56:27] what that will when it's completely built out here's what's proposed I don't [1:56:31] know what that usage will be and I'm concerned about that [1:56:35] uh just like Mr Lander if I grew up in this area I've been up and down Happy [1:56:40] Hill Road countless times not sure if I can brag about having to rode my bicycle [1:56:45] up and down there but I've been up and down that road on tractors I have picked [1:56:49] up a rock on farms off of Happy Hill Road I have that merit badge [1:56:53] I'm well aware of the rock over there God made that corner of the Town a [1:56:59] little rougher than he did at rest of Stokesdale and the applicant can't help [1:57:02] that and those that are opposed to this rezoning King help that that's just a [1:57:06] fact it is Rocky over there especially along [1:57:10] the ridges pyramid Quarry rock quarries right [1:57:14] around the road excuse me right around the corner on Pyramid Quarry Road I I am [1:57:20] concerned that we would have a difficult time getting uh [1:57:24] town of Stokesdale water lines installed there [1:57:27] I don't like the idea of cross-country water lines without interfacing with the [1:57:33] town of Stokesdale engineer we have no memo of understanding or [1:57:39] interlocal agreement with Forsyth County Oak Ridge or anybody else here involved [1:57:45] regarding the administration of our water system in Forsyth County into this [1:57:51] development and that concerns me we would need to be able to collect the [1:57:57] a plan review fee and an inspection fee and then we need to provide those [1:58:03] services for this development and until the town of Stokesdale is satisfied [1:58:09] I wouldn't want to see the plot recorded and any Lots sold over in Forsyth County [1:58:14] right now we don't even have so much as one contact in Forsyth County that we're [1:58:18] discussing these procedural issues with [1:58:23] um again if it was about just seven Lots I [1:58:27] you know I couldn't really see much of a problem with that I I don't like that [1:58:31] little bottleneck I see going into this property 57 foot is not much [1:58:37] uh just like my friend Mr Landreth I generally vote for rezonans I I hope I [1:58:44] think property rights are a fundamental Freedom that we have in this country and [1:58:49] uh I would I'm always very careful how I consider [1:58:54] voting on a rezoning case as a planning board member and a council member and in [1:58:59] this case I have done a lot of pondering I've I've I have examined this several [1:59:04] different times over a period of time talk to various people [1:59:08] uh at the end of the day I'm elected to use my judgment [1:59:13] and uh Common Sense can't be defined [1:59:17] but this project from everything I can see [1:59:22] goes against my Common Sense goes against my judgment [1:59:26] uh [1:59:28] I'm not voting for it that's why I made the motion [1:59:33] okay um [1:59:35] I do want to say safety was brought up a couple times tonight and uh the folks [1:59:42] encouraged us to come out and see the the property I I have done that and I [1:59:48] can't I couldn't imagine that number of cars on what is now a [1:59:53] driveway as as you're coming from 158 [1:59:58] yeah coming from 158 down Happy Hill you kind of go over over a little hump so if [2:00:03] you're sitting here in the new subdivision trying to to pull out you [2:00:07] know one minute you look to the left you see nothing and then my goodness [2:00:12] it can change just like that and if you've got that many people coming out [2:00:17] of that it's uh it's just not a great spot for a subdivision I also believe in [2:00:22] property rights uh and then and I'll certainly stand with the two adjacent [2:00:28] neighbors that uh that where there's a utility easement on the uh public [2:00:33] document going into their property I just don't know how I could know that [2:00:37] and vote for that uh you know I've got some concerns about [2:00:42] the water I've I differ from Tim a little bit I my concerns are there's I [2:00:48] there's no binding document and please don't be [2:00:54] insulted uh I know you have said that and and but I think Jimmy made the point [2:00:59] what if the company is is sold or whatever there's no binding document [2:01:03] between uh the township and the developer [2:01:06] uh in this situation that would have y'all do water there was no condition in [2:01:11] the zoning request uh and and that's a really big deal uh given us you know the [2:01:16] the geographical challenges in that area I do want to uh Tim mention the other [2:01:21] subdivision that uh the town sells water to cold water uh when we were vetting [2:01:27] out that process in December of 2020 uh the the gentleman who developed that [2:01:32] property I mean point point blank told us that [2:01:36] Aqua who does community Wells was a cheaper option than running Town water [2:01:41] lines into his development but he thought the town Municipal Water would [2:01:46] be more of an assurance of water supply and I don't dispute that but but if you [2:01:51] know we're getting you know if we're in a situation where you know costs may be [2:01:55] cut and we know from a developer that has said Aqua is a cheaper option and [2:02:01] there's I get real concerned about tapping into [2:02:04] that the water table in that area but but my biggest concerns are are going to [2:02:09] be with the two property owners and the utilities and showing on their side [2:02:13] you know with respect to to the petitioners I'm I'm not going to vote [2:02:17] for this either [2:02:20] I'd like to Echo what Mr Floyd said as far as the two Property Owners on each [2:02:26] side in the easements for the utilities I mean we can talk about how wide the [2:02:30] road would be but we don't know until we lay the road out there and we lay the [2:02:33] utilities and how much you're going to have to be off that road you know that [2:02:37] road bed to have your utility and and I I just cannot imagine that you're not [2:02:42] going to be on top of both of those properties and especially the one on the [2:02:45] left driveway right there um [2:02:47] the uh my other concern is more of a going back to the spirit of the use of [2:02:52] the land is I sit here and just look and I take out the um subdivision behind you [2:02:57] know what's already been approved and I just look at that lot you know it just [2:03:00] does not to me does not fit the the land out there so you've got you know you've [2:03:05] got a long house here a long house here and right here in the middle you're [2:03:09] gonna have a bunch of little houses right here kind of in your backyard you [2:03:13] know and if you look at it from a from an aerial view which is I which I am you [2:03:18] know so like I said you're looking at you know a lot lot and all of a sudden [2:03:22] this lot's gonna have you know all this stuff only it just to [2:03:26] me it doesn't doesn't um it's not consistent with what's out [2:03:31] there and and I know we can't control what's what's going to be behind you [2:03:35] because that's out of our jurisdiction but what we can control is [2:03:39] um what's in our jurisdiction so that's that would be my comments [2:03:45] is there any other discussion Mr Mayor one one thing I should say and kind of [2:03:49] echo what Mr Snyder said earlier um this is a straight up resounding so [2:03:54] the question uh and you've been presented several [2:03:57] plans that show six or seven Lots on this ten acres but uh under if you [2:04:04] approve this resulting if they reconfigured it they could put as many [2:04:08] Lots as they could forty thousand foot Lots as they could as they wished [2:04:14] and the the proposed plan in front of you is not binding on the developer they [2:04:20] will be allowed to configure that any way they want to [2:04:23] so just to be clear it's not a conditional use something [2:04:30] um I'll tell you this is this is a this is [2:04:33] tough all reasons are tough I mean I'm going to tell you this [2:04:36] we've said on some it's this that's tough I mean you know nobody wants [2:04:40] anybody to build their room I don't blame them you know I wish we had to [2:04:43] build half hours we got here now um this is a [2:04:48] this is a um just a different circumstance though [2:04:52] um you know agricultural land [2:04:57] um people want to get rid of it they want [2:05:00] to sell it you know what are you going to do with [2:05:04] I mean is it you know we're sitting here in houses on property that was built on [2:05:08] agricultural land and then you know want other people to [2:05:12] leave our land alone that's one thing so that's what would [2:05:16] make it easy for me to vote for this if all the other variables [2:05:21] now yeah it only has one place to come in on [2:05:26] that property and uh you know like I say I sit up in [2:05:30] the liquidate hill today and um [2:05:34] once we rezone these if we did it's out of our hands you know [2:05:39] we got to rely on what D.O.T does uh I know they're they're experts but [2:05:45] um it's out of our hands the uh [2:05:49] how many houses are you know that end up coming through that road is out of our [2:05:54] hands completely out of our hands um [2:06:01] it's just it's a tough one to me I mean you know and I know I mean I know these [2:06:06] folks and and um you know that part could be easy [2:06:11] you know people do have property rights um [2:06:16] this may just be a different scenario so by the time it gets to me I'll make my [2:06:19] decision [2:06:23] yes sir one other thing I should say if the [2:06:27] across which decision the board makes if the if the board approves this resulting [2:06:32] it should make findings that this application is consistent with the [2:06:37] environs and the uses uh and the of the neighborhood if the board chooses to [2:06:44] uh denied they need to make findings that this requested use is not [2:06:49] consistent with the environments and the uses nearby [2:06:57] so are you saying that there's things that we can't take in consideration [2:07:01] I'm just saying you need to um the law says you have to base your [2:07:06] decision on your is this particular requested use is [2:07:12] it consistent or inconsistent with with other adjacent land uses and and is [2:07:20] it going to impact the quality of life of others in the neighborhood and make [2:07:24] findings that are support a decision to decline it or approve it [2:07:30] Mr Winfrey do you feel that I need to add a consistency statement to my motion [2:07:35] is that what you're I think that would recommend that yes [2:07:39] man what folks need to understand from what I've seen tonight and what I've [2:07:43] heard I don't know anything for a fact because [2:07:46] I'm not I don't have anything to fly candy but whether we [2:07:49] do this or not the the part at the lake and over to Van [2:07:55] Horn roads you want to be none because I mean from what they said and I don't [2:07:59] know about the uh the right-of-way the 60 [2:08:03] foot right away I mean like I say it never actually came before our accounts [2:08:06] so you know [2:08:10] this this won't this won't stop we don't have anything to do with that so you [2:08:14] know either way this goes don't you know [2:08:18] don't think that we're foreign [2:08:24] Property Owners everybody it's a tough decision [2:08:31] is there any further discussion [2:08:36] we have a motion and a second yes do we need a consistency statement um [2:08:42] an amendment to his motion well I think Mr Winfrey is telling us that this [2:08:48] motion has to be modified with a consistency statement of some sort uh [2:08:54] which which is tough our planning board looked at this just as seven lots and uh [2:09:00] they may have been told they had 70 foot at that bottleneck I can't ascertain [2:09:05] that and I haven't reviewed that particular the electronic recordings for [2:09:09] that particular meeting that may have impacted their decision somewhat [2:09:13] uh they have looked at it just from the [2:09:17] perspective of the the seven Lots it's my contention we're supposed to look at [2:09:22] whether or not a particular development is is consistent with a given area and [2:09:27] it's my contention that this area because of the topography from the from [2:09:32] the roads to the Rock to the to the the layout to the to the bottleneck that I'm [2:09:39] looking at that as as inconsistent with with good planning [2:09:44] uh and that that is my that's my consistency statement that I realize [2:09:51] staff has recommended approval of this but I just don't know if they're taking [2:09:56] into consideration all these factors uh again like Mr Lander if I'm very [2:10:02] familiar with Happy Hill Road been up down at I had lived there but I've been [2:10:06] down at all my life at one time or the other frequently and uh have have worked [2:10:10] on farms over there so it's not I don't have to go look I'm already familiar [2:10:16] with that area really and uh I think that that is that is my issue [2:10:21] this this area does not lend itself of being consistent with the previous [2:10:25] developments we've approved is that sufficient Mr Winfrey I think that's [2:10:29] right so you if you're amending your motion to incorporate that and then that [2:10:32] need a new second for that and then you'll be in business I'll keep my [2:10:37] second on the to remove the internal connection between Lakeside [2:11:52] Manor Drive and Benton Ridge Forest Drive has proposed a public Street [2:11:56] connection will be required between bent Ridge Forest Drive and the Guilford [2:12:00] County Line as shown in the previous site plan [2:12:03] which you know the previous site plan was just [2:12:07] one road and and I would like for Stokesdale to have a voice you know in [2:12:12] that feature because you know one it's our water line and I showed you [2:12:16] my concerns with with traversing right to the middle of of a lot [2:12:22] and all that so I mean you know with that I'm gonna make a motion the town [2:12:26] clerk Miss Dale Martin draft a resolution and obtain mayor Crawford's [2:12:30] signature in reference to the Forsyth County approved site plan F 1623 stating [2:12:36] that the town of stokesdale's governing board respectfully respectfully objects [2:12:40] to Forsyth County's decision to remove the internal Road connection between [2:12:44] Lakeside Manor Drive and bent Ridge Forest Drive that was originally [2:12:48] approved in rezoning case f-1597. into occlude and to include verbiage [2:12:54] that the resolution stating that we request to add back an internal Road [2:12:58] connection aligns with the requirement in the written conditions of zoning case [2:13:02] f-1623 pursuant to North Carolina General statute 160 d703 and that the [2:13:09] developer has signed off to agree to these conditions and this is where he is [2:13:14] signed off to do that and that removing the internal connection resulted in [2:13:18] Stokesdale municipal water lines going through three lots backyards and removes [2:13:23] the Practical connectivity desired in new subdivisions [2:13:31] I'll suck at the motion right that's it that's I just I don't [2:13:36] understand why there's one larger side going to Van Hoy and one [2:13:40] smaller side going to Happy Hill is there a new discussion [2:13:46] Mr Rigsby almost van [2:14:23] Hoy through bent Ridge Forest and then down Lakeside in front of the [2:14:29] Duke Energy property your concerns about the water line yeah it is [2:14:35] going through yards and my concern is about that [2:14:40] there's almost 70 homes going through bent Ridge Forest Drive that that with [2:14:46] one access point that seems it seems excessive to me it certainly that's not [2:14:52] what it seems excessive to me given our our [2:14:55] limit is 50 on an entrance well Oak ridge's limits 52 and it's in their [2:15:00] extra territorial jurisdiction and and actually their their ordinance [2:15:05] reads better than ours their ordinance says no single entrance to a residential [2:15:08] subdivision Shall Serve more than 50 Lots [2:15:11] uh the single interest is defined as the point where the local Street network of [2:15:15] a major subdivision or multiple subdivisions intersects the road Network [2:15:19] outside the major subdivision or multiple subdivision so what it's doing [2:15:23] is taking into account bent bridge forest as well now I'd be concerned [2:15:27] about the water line but [2:15:30] I don't know you know the uh [2:15:36] trying to tell Forsyth County what to do well well I mean that's going to be put [2:15:41] and if we do that we're going to be putting [2:15:44] I mean I know exactly where you're coming from on a water line because I'm [2:15:47] not for running water lines out through fields [2:15:51] but now you're going to put on 60 or 70 how whatever the number is [2:15:57] coming back over to Happy Hill Road which they may come out and go that way [2:16:01] anyway but um [2:16:04] it's gonna put all it would put them too I could put them all [2:16:08] I don't know if this is a place to see it or not but I'm for all stop on this [2:16:11] until the town of Stokesdale has a proper administrative procedures in [2:16:15] place to deal with having our water system extended over into Forsyth County [2:16:21] where I'm at I I don't have an issue with the water [2:16:25] system into Forsyth County it's more of how the lines well water mains are well [2:16:30] Mr Mr Floyd why would we treat our water system any differently in Forsyth County [2:16:34] than we do any other subdivision in in Stokesdale [2:16:38] we have a process in place where we charge a fee we have our engineer review [2:16:43] the plan if we approve that plan then when the this water infrastructure is [2:16:50] installed we have it inspected by our engineer or technical people correct and [2:16:55] uh this is a you know a very serious issue because once we take it over the [2:17:00] town of Stokesdale the town of Stokesdale citizens have to pay for the [2:17:03] maintenance on that from now to the end of time that's correct and so uh we we [2:17:09] we are not ready to do this in my judgment again we have no communication [2:17:15] with Forsyth County over these details [2:17:22] yeah I mean that's a good point I can't dispute [2:17:24] you know one of these details you can say why don't we get some of these loose [2:17:29] ends tied up and then I mean I see where you I see where you're coming from I [2:17:32] don't think no [2:17:36] this this motion I mean I I think the Forsyth County planning board [2:17:42] because they added this requirement in there they must have been thinking currently do inspections we're [2:19:26] we run a water system uh we we have to address that too because we are our [2:19:31] management for our water system has this come to us yet [2:19:35] I mean the part where the planning board Forsyth County what they're asking no [2:19:41] this is just to come to us yet has it it won't [2:19:47] come to us it won't come to us it you know there's [2:19:54] documents out there and if if we weren't aware of this document you know it just [2:19:58] nobody would have ever known is my guess I don't think we would have been [2:20:02] nobody from Forsyth County gave us a heads up like hey guys look this is [2:20:06] happening uh just a heads up your your municipality your town was called you [2:20:12] know in one of the requirements of a rezoning here and outright saying no we should never sell water outside of our jurisdiction [2:21:16] but it obviously is a different thing from selling water in Stokesdale [2:21:22] I think what we've already said that we do that but uh [2:21:28] is to do with the water system I think we've got to write I don't know that [2:21:31] we've got a right to uh [2:21:36] step in on you know what they do with the roads [2:21:41] I mean this is a requirement from Forsyth County that was signed off and [2:21:47] agreed to by by the company right I I disagree I think we have every right to [2:21:53] to look at how that water mains installed whether it goes down the side [2:21:56] of a road a sidewalk or cross country across the creek uh that that needs to [2:22:01] come to us for unless Forsyth county is going to biggest concern coming out of the last meeting was from staff that they [2:46:42] didn't feel like they could um pick the phone up and call call TCS if they had [2:46:47] an issue for that incurring I had a company this company [2:47:33] called it geek box I.T reach out to me based on the um Northwest Observer so [2:47:39] somebody's reading it Patty yeah one one person I got one person [2:47:44] down for you okay I've done that and I told the guy I hadn't read that [2:47:49] personally so so I can't comment on that but uh so uh [2:47:56] um so he he provided us a quote now I gave him the same you know same issues [2:48:00] that we wanted to look toward more of a managed [2:48:04] um support system for one fee per month so in short your two i t your two geek [2:48:10] box I.T quotes one's for good and once for better the better is 667.19 [2:48:17] but and that includes the three main staff members that are here every day [2:48:23] they're they're machines if something goes wrong they can they can pick the [2:48:27] phone up and call and and have support without incurring any additional cost [2:48:33] um I um the other quote for geekbox it is a little cheaper it's 427 but that [2:48:40] kind of gives us the same thing what we had before so it'll be like 75 an hour [2:48:45] every time we called um [2:48:48] So based on the the staff's recommendation I kind of compared the um [2:48:54] geekbox the better quote which is the the 667 to the TCS quote which is [2:49:00] 677.84 so monetarily there's not a lot of difference in the two [2:49:05] um both of them provide a backup solution [2:49:09] um storage offside in the cloud and and just like geekbox it TTS provided us a [2:49:17] package that will be um that will and I'll read it it says [2:49:21] full managed per full-time employee for three employees fully managed support [2:49:27] so that's remote only that means if they if they have to come out both and this [2:49:32] goes for both companies if they have to come out then they're going to charge us [2:49:35] you know the normal fees but if they can handle it off-site remotely then there [2:49:40] will not be any any additional cost to the town okay um [2:49:45] so I think I think based on you know everything that we we've talked [2:49:50] about I think the best option would be to go with one of these two packages [2:49:55] um I'll leave that up to council as far as the which uh the security and [2:50:00] maintenance and stuff is better that's probably not for me to say because I [2:50:04] can't get into that the weeds of the eyes but um so I you know I think both [2:50:08] of them are probably sufficient enough to provide us security and back up [2:50:14] um and both of them are going to be providing us some support for our three [2:50:17] employees without an additional cost so it's just [2:50:22] um at this point we just need to make a decision which if we want to stick with [2:50:25] TCS which is already in place or do we want to go to a new company [2:50:31] um all together and like I said Same Same services to [2:50:36] the difference in the cost is about 11 a month [2:50:40] difference um are you are you proposing the 667 [2:50:46] quote I'm not proposing I'm just putting it out there for discussion if anybody [2:50:49] has an opinion um that's our two options [2:50:53] um you know we can stay where we're at which which means basically No [2:50:59] Interruption in service at all and we continue moving forward or we can go to [2:51:04] dig deep box which that means TCS is going to have to pull all their stuff [2:51:08] off switch over to another server and so it's going to be a little bit of a [2:51:11] transitional period um I'm not personally I'm not sure that [2:51:15] that's worth 11 a month for me to have to go through all that trouble in town [2:51:19] staff time but I'll open it to y'all is Staff [2:51:23] unhappy currently with the service we're getting [2:51:27] oh I'm sorry that's okay no no we're satisfied with TCS the issue [2:51:32] that we run into with TCS is with our current contract anytime we call them [2:51:37] with issues it's an added cost uh the good thing about the the new contract [2:51:41] that Mr Rigsby has proposed is that it's unlimited uh Service as long as they [2:51:46] don't have to come out here now I've in my time here I don't know that they've [2:51:51] ever came particularly I don't know that they've ever done a town hall visit in [2:51:55] my time being here most of the the problems can be fixed over the telephone [2:51:59] honestly they remote in they fix it that way and it's done in no time if they [2:52:05] hurry up and fix it how much money have we spent with the [2:52:09] phone call last year does anybody have a clue [2:52:13] can you tell proposal to TCS provided us [2:52:44] last month without the support was still going to be around 670 or so because [2:52:50] they're going to a new security platform which is more secure what we've been [2:52:55] paying in the past was 426.53 a month that's going up regardless uh on what [2:53:02] just through negotiating with TCS they're willing to to keep the contract [2:53:07] they're willing to provide the the fully managed support as well within pretty [2:53:12] much within the same cost so um it satisfies what the town I think [2:53:17] the town needs and you know one call is 125 dollars uh two [2:53:22] calls is 250 or two hours 250. I know we've had that situation with with the [2:53:27] Facebook uh the Facebook page issue so it could happen [2:53:31] um but I think more than anything it gives [2:53:34] the town staff a piece of mind that they're not sitting there sweating [2:53:38] having a call and knowing they're going to incur a cost and when you have a and [2:53:42] we have a fixed a fixed cost going forward that we're not having to budget [2:53:47] you know an overage four if something does break we know what we're going to [2:53:50] be paying and we don't have to worry about having that fluctuation each month [2:53:54] because of you know somebody's called somebody's call because they [2:53:59] you know something the machine didn't need to be needed to be rebooted or [2:54:02] something like that a lot of times it's very simple stuff [2:54:06] that that they have many remote interfix and within 15 or 20 minutes but we still [2:54:10] incur about 125 dollars for this cost so if you've seen it yet [2:54:16] you're still looking yes I would just like to make cancel the where [2:54:21] um I did remind let you guys know that there would have to be a budget [2:54:24] amendment for this and I unfortunately did not see [2:54:29] these until this morning so therefore I was not sure what the price was going to [2:54:33] be because I knew the last meeting you guys had said you were going to reach [2:54:37] out to a couple of more people or what have you [2:54:39] um I would also like to let you know too I have also received an invoice [2:54:44] um number 86696 from TCS and it's for monitoring for March [2:54:50] so um I noticed on the terms on here that [2:54:54] this contract would begin March 1st 2023 at the sixth [2:55:00] um 77-84. um I would much rather [2:55:05] have that revised if possible for 4 123 because I had the invoice for March for [2:55:10] 426.53 already so [2:55:14] to me that you know I think that would be silly to [2:55:19] sign a contract for March one when we had the invoice for March already at 4 [2:55:23] 26. their service over so we don't have any any issues I [2:57:18] would just assume stay with TCS and and you know upgrade to the more secure the [2:57:23] more security platform in the um the service computer for [2:57:55] for sure and and I'm just wondering how I as a [2:58:00] council member are we as a council go through the process of evaluating [2:58:05] their competence and their integrity and you know [2:58:09] do we require them to have any specific kind of insurance to protect us [2:58:14] uh protect the towns you know computer system we spend a lot of money [2:58:20] on these computers between buying Hardware software and the I.T [2:58:25] maintenance it's sometimes it makes me wonder if we should just go back to [2:58:28] paper [2:58:31] um so to answer your question I I had two lengthy conversations with people [2:58:36] from geekbox I honestly cannot remember they they told me who you know several [2:58:41] companies they provide services for their local company [2:58:45] they are uh um that's all they're they're local [2:58:49] they're I mean they're not they're not a one guy operating out of his house [2:58:53] they're they're legitimate I.T company that uh some of their you know some of [2:58:57] their um some of their um employees are have [2:59:02] gone from TCS so they're the same level of of service providers I I was [2:59:07] wondering if they had at least two or three service people in case somebody [2:59:10] had the flu they do I believe I believe he told me six but don't quote me on [2:59:14] that I looked at their website and um okay so did I ask those specific [2:59:18] questions I can't say that I did or didn't but um I definitely looked at [2:59:22] their website to make sure there were not a a one-man operation and they [2:59:27] assured me they had enough support in place to you know to support us because [2:59:32] they support a lot larger clients than us the only one I've ever been involved [2:59:37] in really hiring here for I.T support was Tech Authority out of Reidsville [2:59:42] and I felt comfortable doing that at the time because I knew two different [2:59:45] companies I knew people that worked there the owners that that Tech [2:59:50] Authority was performing work for and so just somehow we have to figure [2:59:55] out some way to vet these folks whether it be asking for references or or [3:00:01] certifications I don't know the answer to this I I'm not uh [3:00:07] really up to speed on computer systems or computer period [3:00:12] enough to know what questions I should be asking Miss Martin Mr Jones we have [3:00:17] been with them for how long three years I believe it's a little at least three [3:00:22] years um and yeah with current tcx yeah other [3:00:27] than just the issues of calling recently say last six months [3:00:33] I think they've served us well yes well it just uh you would want us to be [3:00:38] careful what we do in regards to our computer system it would really impact [3:00:43] the staff negatively if we we had things go Haywire absolutely and from my [3:00:49] perspective if we switch which we can do but it would be significant downtime for [3:00:55] the staff while that's done but Miss Martin if you had to make the decision [3:01:01] yourself solely yourself which what would you do [3:01:05] I'm I'm satisfied enough with TCS I agree with Mr Rigsby that I would stay [3:01:10] with him on geek box has not given us a super super deal over and above what TCS [3:01:18] could provide so I don't have a problem with staying with TCS at all [3:01:23] all right thank you I'm going to make a motion now that the town enter into a [3:01:28] contract with TCS that matches a document that we have in our packet [3:01:31] dated two eight the quote number is t c s q 4744 [3:01:39] the monthly amount is going to be 653 dollars with the sales tax of 24.84 [3:01:45] cents for a total cash outlay of 677.84 a month and that this contract [3:01:52] become point in a [3:10:39] staging point I have a I have an alternative but um [3:10:44] my two issues with with them was one a couple times last year they mowed and [3:10:49] they left dead grass all over the soccer fields at least two occasions and I've [3:10:52] got pictures of it to a point where um a parent had to come out with a [3:10:58] blower and blow it off the soccer field for them to use it um and then also the [3:11:03] repair that they did to the um uh where they had to dig the hole for the water [3:11:07] repair I I just it's my opinion and and some [3:11:12] other professional opinions that that could have been done a little bit better [3:11:16] and um um so [3:11:20] you know not not saying that anything negative on them or anything but I'd be [3:11:25] open to um looking at some other vendors if [3:11:28] possible you don't have any options right now though because springtime's [3:11:32] getting ready to come up pretty quick yeah but um no I don't but I we can [3:11:37] certainly I had a couple people kind of reach out [3:11:41] one was the person that blew all the dead grass off hemos Angels Glen [3:11:45] subdivision now he's our contractor he asked me about it um and I told him I [3:11:50] said at that point we were still in the contract but if we put bids out you know [3:11:54] I'd reach out to him um also um [3:12:00] our current regular mower um [3:12:05] Excellence you know that would be another option but but unless we decide [3:12:09] to like rebid it I mean there was no reason to go out and you know try to [3:12:13] rebid it until we talked about it as Council but I'm just saying I'm not I [3:12:18] don't know that I'm in lockstep to to just give them another year without at [3:12:22] least talking about it well Mr Rigsby that turf grass business is a whole [3:12:27] nother world it's a special real mower it is but everything most landscapers [3:12:33] don't have the the sprayers and access to the chemicals no certifications and [3:12:39] what have you but you know if Council wants to look at that fine by me but I I [3:12:44] would hope that we would bring our concerns to Hunter and let him know [3:12:48] those those two issues so that he can address them or at least be aware of [3:12:52] them we we did on the dead grass and correct and you can let we can let the [3:12:58] staff get there we'll see were they responsive Mr Wagner [3:13:05] yeah I will um I I know I can think of at least two [3:13:10] different instances where I was at the park mainly after that repair was made [3:13:14] you know I would go down there and water in the mornings had a couple residents [3:13:17] that would come up and and uh make a comment about the dead grass on the [3:13:21] field and I wanted to know if that was going to be fixed and if I'm not [3:13:26] mistaken uh Mr Rigsby had actually been down here I think you might have gave [3:13:30] him a call and they said that sometimes they do that they mow it's early in the [3:13:34] mornings they wait for it to dry out and then they come and blow it off now [3:13:37] whether or not they would have came back without him calling I don't know but at [3:13:40] some point they did come back and blow it off but it wasn't until after Mr [3:13:45] Rigsby called them and and asked them to do so well this fellow has all the [3:13:52] necessary specialized equipment to service Athletic Field the turf grass so [3:13:58] that that would be my concern if you know if you can find a competitor that [3:14:02] wants to give us a quote that that is in that business and we can verify that I'm [3:14:07] fine by that you know great let me let me just give you and I don't have [3:14:11] anybody in mind right this second but that was what I had been told for all [3:14:16] this time um as well however um [3:14:22] every I've used Northwest High School as an example of their football field is as [3:14:27] in good a shape as this right here he is and it's done by an athletic coach with [3:14:31] a John Deere with an attachment and um so I you know I don't I think I think um [3:14:39] from equipment standpoint I think anybody could go out and buy the [3:14:43] equipment they needed to do it now from a spray-in and a chemical standpoint [3:14:47] most any any certified by this mowing it's going to [3:14:52] have those those you know those um uh access to those because they're [3:14:57] already you know using them on if they're a commercial mower they're going [3:15:01] to have access to chemicals and and spraying license so I don't I don't know [3:15:04] that that's that big of a hurdle I'm just saying you know if we want to at [3:15:09] least take a look and see what kind of bid we could you know could get to [3:15:12] somebody that's comfortable I mean I don't want to certainly don't want to [3:15:15] reduce our requirement in any way as far as equipment or or licensing or [3:15:20] insurance or anything like that I just wanna just proposed do we want to look [3:15:24] at and at least give some other vendors a chance to look at it well [3:15:28] just speaking for me I would want them to be able to demonstrate to me that [3:15:33] they are in the business of taking care of turf grass and they've been [3:15:36] successful at it um [3:15:38] don't know what's going on with the dead grass but [3:15:41] certainly if we're having surface service issues then that's what we're [3:15:45] having I um I agree with you I would just I [3:15:50] mean I you know I like to continue to like I said the repair that they made [3:15:55] down there I I consulted with um probably the biggest [3:16:00] turf grass company in the in the Triad and was very you know adamantly told [3:16:06] that that was not done properly and and pointed out in many ways why it wasn't [3:16:10] done properly and uh and like here's the history here's a picture of it [3:16:15] Mr Jones I thought I don't mess that up um and I'll just give you I mean let me [3:16:21] approach it is it show you this is this picture when the repair was done or now [3:16:26] both no no no so there's the the dead grass yeah that we're talking about and [3:16:32] here's the repair and you can see the lip that was left [3:16:35] how that should have been done you can see it again it should have been [3:16:40] tapered the sand it should have been used more sand it should have been [3:16:42] tapered down to where it was more level and flat [3:16:46] um and you can see The Ridges that you know the unlevelness of it [3:16:51] there's a good picture you can see where you know they left the edges and stuff [3:16:56] so you're going to have some transition period it could could have used more [3:17:00] sand right there um but then again there's some more of [3:17:04] the dead grass well you know so that's just concerns please notify them and [3:17:09] tell you know tell them your concerns maybe they'll come out and [3:17:12] I do a warranty repair add some sand and blend it in a little better [3:17:18] in the past we haven't experienced a lot of service issues with Hunter I will say [3:17:23] that you know and I agree I'm not familiar with any at all just like I [3:17:28] said the dead grass um and I don't you know I mean you and I [3:17:32] both know mud grass many times it could have been a lot of reasons it happened [3:17:36] but I think it happened more than once because it happened the day I saw it and [3:17:40] I going back on that time period I think we're talking to staff they had had an [3:17:45] issue the week previous with the same thing and and like I said I've had a [3:17:49] parent as well come up and say he went out there and blew all the grass off so [3:17:53] they could play on the fields so and there was another issue and I don't know [3:17:58] who did I don't want to throw shade but just the movement of some equipment that [3:18:01] occurred on those fields that damaged some equipment [3:18:04] that um you know that they tied a mower to it and supposedly pulled it I had to [3:18:09] complain about that from the citizen as well [3:18:11] so um but I don't know that they did it or not [3:18:15] but you know just it happened the the goal got damaged we [3:18:19] do know that much so you know we've got a lot of people coming out here in the [3:18:23] evenings too that I think might move some stuff you know I mean well my [3:18:26] understanding was it was done with a chain oh well it was a chain was tied to [3:18:30] the goal and it was pulled with a machine and it damaged the goal I've [3:18:35] seen citizens out on those fields with pickup trucks doing various things it's [3:18:40] hard to police [3:18:44] um one of these days about I'll talk about putting the fence around this [3:18:47] thing I could have an oak Creed people can't drive up on them [3:18:51] we might should have done that this time when we were and I just didn't think [3:18:55] about it true that uh we don't have any [3:18:59] um maybe we should pursue getting the contract and um [3:19:05] I mean we don't we don't have a uh alternative right now if you want to try [3:19:08] to find some um I mean we could we're going to do something because it's going [3:19:12] to be spraying time I'm not sure it says in the contract that uh Miss Martin [3:19:17] uh when they when they spray is it that's your question in the [3:19:23] contract doesn't it say uh when they when they spray and all [3:19:29] I can't remember [3:19:36] I mean this thing's paid quarterly so we won't be able to if they do anything [3:19:41] hate [3:20:19] for us to back up it's uh there's gold in that grass [3:20:25] yes it is that repair was gold uh I think that we got we've got a year we we [3:20:32] can even though it might not have been 100 [3:20:35] percent uh we may just be too late to uh [3:20:40] um you know to get somebody in I think he's [3:20:44] does it say s [3:20:48] a proposal that was submitted in March of 2 2022 February March they're already [3:20:54] applying Ron star whatever it is they probably already started doing something [3:20:58] so they are prepared already to probably start doing maintenance on it assumption that we're going [3:22:33] to pay as we were under contract which is a big assumption if it was told we [3:22:38] hadn't told them nothing I mean it's just I mean I I don't know the man you [3:22:43] know and I don't have a problem with Mr Grimes he's doing it he's trying to keep [3:22:46] the fields up and I'll tell you I really appreciate if he's doing it because [3:22:50] um but we just need to have some Community [3:22:52] if you know he needs to you know provide us a proposal because I think he went up [3:22:56] on the price last year if I'm not mistaken he did so we don't need to be [3:23:00] shocked if he's going to plan on going up on the price again this year and then [3:23:04] we you know we get halfway through the spray-in season and he gives us a [3:23:08] proposal for 14 000. do we not have a proposal now [3:23:12] well let's be sure we ask him for an updated proposal and then we'll go from [3:23:18] there I don't have to call special call Newton to take care of this because we [3:23:21] don't want to let this I mean whatever um can we can we get a [3:23:28] you can now get in contact with him get a proposal [3:23:31] and let's see where it is and if it's something we can put off the next next [3:23:35] month but we've got to make sure these soccer fields are taken care of I just [3:23:38] checked I think I still got his cell number if you all [3:50:35] fees related to the inspection process and that way we're not shorting [3:50:39] ourselves or overcharging not a bad idea Mr Rick just do it but you know we have [3:50:46] to turn it over to Mr Winfrey if we don't get the money if we get the money [3:50:49] first then we got the money first that's a [3:50:53] good point I don't want to charge folks I'm going [3:50:56] to pay their way well you could do a deposit and then [3:51:00] well due to deposit into their responsible the other issue would be [3:51:04] with that there'd be make it difficult for you know a developer that's in [3:51:07] business to determine what their you know their costs are going to be uh if [3:51:12] if we just say well hey you know we're going to have this service provided and [3:51:16] you're going to pay the bill and they're going to say well how much you think [3:51:19] it'll be and we're going to say well we don't know but here's what the last one [3:51:23] cost you see what I mean [3:51:26] yeah there's no predictability though those are both good points however [3:51:31] um [3:51:34] I don't know what could the engineering firm not tell us [3:51:37] you know could they not look at and say okay this is going to cost you [3:51:41] I don't know I mean I kind of think we need to get get some kind of um [3:51:47] cost basis from the engineering firm to base this [3:51:50] proposal off of how they base their fee to us and we should base our fee to them [3:51:55] we're spending uh three four five thousand dollars a pop [3:52:02] basically right I don't I don't disagree I'm just saying whatever whatever logic [3:52:07] that the engineering firm charges we need to pass that same logic and down [3:52:11] and and time is passing here where we're losing money progressively so this won't [3:52:17] fix it but but I feel like it's a shot in the right direction [3:52:23] one of the other things uh we're discussing with uh Hazen and Sawyer is [3:52:28] is using a uh one of their vendors that does technical [3:52:34] inspections so we would still pay Hazen and Sawyer but [3:52:38] they would hire a subcontractor basically at a cheaper rate that would [3:52:42] go out and do the inspection and provide us with a report and what have you so [3:52:45] we're hoping to to cut down on some cost in that direction hadn't happened yet [3:52:50] but you know we're hoping to get there [3:52:56] but I guess my my question is does Hazen and Sawyer have a method to how they [3:53:01] charge us is it by by the foot by the size of the development by the how they [3:53:06] come up with us our charge us engineering time by the hour [3:53:12] so and I have looked for other companies everybody out there in this business is [3:53:20] very busy they're always happy to talk about new work with us but they'll say [3:53:25] well you know we can't take anything else for six months eight months a year [3:53:30] you know that's what I've experienced um [3:53:35] I mean I called a number yeah I have no issues with Hayes and Sawyer I just [3:53:40] they've got to have some I don't know just maybe they could [3:53:44] advise us kind of a round number that they think would be more suitable so so [3:53:49] we're not still shorting ourselves two thousand dollars every time [3:53:53] maybe they could say hey you know the minimum is probably going to be around [3:53:56] 2500. they haven't indicated a willingness to provide a quote for for [3:54:02] each one of these subdivisions we could ask them I guess but just a round number [3:54:08] maybe that they think is a ballpark well I I really I really don't know if it's [3:54:12] our to our advantage to ask them to quote it because they're they're [3:54:16] basically writing insurance so they're going to make sure they don't [4:01:07] original installation we're in a citizen came to town hall received a [4:01:13] diagram a wooden stake with some blue flagging on it and they followed the [4:01:17] diagram and went out and put the wooden stake up where they wanted their meter [4:01:21] Vault located and on that diagram it requires a [4:01:25] certain separation from the driveway since I don't have it in hand I don't [4:01:30] know what that is Mr Babson has suggested that three foot [4:01:34] is uh an appropriate distance [4:01:38] what Mr Yates has suggested it excuse me Mr Roberson Gene has suggested is that [4:01:44] we send a notice to that property owner asking them to maintain a three foot [4:01:50] separation between their driveway and our [4:01:53] meter vault with some kind of stipulation that you
