[1:27] June 1st, the 10th, 17th, and the 24th, which the last two were executive [1:33] meetings. [1:49] And I have the allowance docket which is payroll $26,881.30. [1:55] 30 cents [2:00] » stock [2:10] vouchers for the month at 103,733.80. [2:17] I make my vouchers. Second favor. [2:25] Thank you. That's all I have. [2:46] is main street. [2:54] Last meeting we earn $12,000 short of the minimum bid. [3:13] as we know the plan is is that I plan on putting in the dirty peach at PK office [3:19] uh the historical society and the next building uh the storage unit will be [3:25] torn down um and then past this and that building [3:30] I'm not sure to this point yet might uh use that for a boutique if I can salvage [3:38] it. Um, but I do know that I have talked with Mass County Council of Governments [3:45] and um, so that $60,000 U grant, [3:53] you guys have not received any of that money, but I can't use any of that [3:57] money. And if I was to be charged and you guys were to charge me any amount [4:04] over that for that money, then you would be in trouble with state board of [4:09] accounts because that is a government entity and it's a government um [4:14] basically it's it's government document. So it has to go to you guys and it has [4:21] to go to tear down the buildings. If you guys do not wish to to lose that, I've [4:29] got it here on Billy's recording of what she told me. So, if you guys choose to [4:35] uh reapply for that and ask that that money be used for something different, [4:40] you can do that. But I cannot be charged more because you guys are going to was [4:47] wanting to think that I was going to be getting this grant because I can't use [4:51] that. Oh. So [4:57] that's what [5:00] who >> Susan and she works right under Jerry [5:04] Bridges. [5:07] » I don't but what you're saying is the city would get that money. You would [5:12] have zippity dozero access to it. >> Exactly. I just wanted to the city is [5:18] the only one that can take that money and it has to be used for tearing down [5:23] the buildings only. It cannot be used to revitalize the [5:28] which we got told something completely different. So on our end we would have [5:32] to >> yeah [5:35] her name is Susan Drinket. [5:43] That [6:24] and she's the one that oversees. She basically she's she's like the police [6:28] that comes in to make sure you've done what you've done with that money. [6:32] » Correct. >> So that's what that is. So, um, [6:36] you know, and I know that, um, I mean, I've been told through the grave [6:42] vine that some people were upset that I felt like I was lowballing the town to [6:48] buy those buildings. Um, I don't I don't feel that way. Um, not at all. And I'm [6:54] sorry you guys feel that way. And I apologize for my demeanor last month, [7:01] but or the last week ago, but it was just kind of like a cutthroat situation. [7:06] That's what I felt like. And um so and I do know that you guys said you [7:12] had $4,687 in attorney fees. I'd like to have uh [7:16] receipts proving that that was used for those buildings and not for something [7:21] else. if I'm gonna have to help split this cost on these attorney fees, which [7:25] I shouldn't, but so that's kind of where I'm at. I mean, I I offered 10,000 for [7:32] those. [7:35] And uh Pat's building was appraised at 45. [7:39] I offered you three for that because I don't know what I'm getting into. I [7:43] don't know if I can save it. Video building, it was appraised at [7:47] three. I offered you three. PK building was appraised at 34. I [7:53] offered you three. Storage building was appraised at 18 and I offered you a [7:59] thousand because I got to take that. So that came out to 10,000. [8:04] And then like I said from what telling me on these attorney keys I don't know [8:13] but I do know that you can't and Chad was often obviously incorrect [8:20] on that um because after you know looking into [8:25] it and doing some research but no you can't and it has to be a government [8:29] entity that you can use that grant. it. I I couldn't personally go get that [8:33] grade >> unless I went through the main street [8:36] organization. And I'm not going I'm not going through the main street [8:39] organization. It's just me person [8:56] is I guess. Um [clears throat] one being then did eight then half. So it wasn't [9:04] that >> what was the minimum bid [9:07] would be 22 was it? >> Yeah [9:09] » 22 [9:14] infrastructure purpose. I'm sorry. Say what? [9:17] » Did they say anything about using it for infrastructure purp? [9:38] » Yes. [9:42] » 13,300 for bid out of 10. [9:46] I think so. Down. You're going to have four lots, [9:52] empty lots worth less than $10,000. >> I don't think [10:00] » Yeah, the buildings build. >> There's no value in the building. [10:04] » It's probably hurting it more than it's helping it. If I'm being honest, [10:07] » it's their liability. >> Yeah. [10:10] » And I mean, and this was a lastditch effort by you, D, to try and save [10:14] building. So, >> I just tried to save our history for [10:17] downtown. >> That's where I'm at. [10:22] » Once your street skate's gone, it's gone. [10:28] » It's like I'm reading this document that we have in front of us. Right. [10:32] We have to take the appraised value. If we go the next step, we have to take [10:39] 13. We can't take anything less than the appraised value. Correct. [10:59] three. I'll have you get 133 then. [11:08] provide public. [11:12] One is you have to pass resolution or otherwise create a record explaining why [11:17] the original doesn't [11:34] Essentially, [11:40] they're giving members of the public chance to do something like maybe making [11:45] an offer themselves if because they they didn't know. [11:55] And it's just it's just saying you can't make a secret. If assuming no one does [12:00] then you go on to the next step which is to pass a res pass a resolution [12:12] does you have to consider it [12:18] an art [12:20] I'm just like what 78,000. [12:26] So then to the town tax [12:39] » seven >> seven [12:41] » that was for attorney fees that we don't know exactly. [12:45] » Some of it was attorney fees not all. Some of it was back tax was ra [12:49] » and all that will come back. You guys will have to get all that back. I [12:52] remember you saying that last time >> the appraisal [12:55] » appraisal I'm sorry that was the appraisal [13:01] » the appraisal fees [13:10] » uh the appraisal was 3,200 [13:23] Yeah, >> you got four [13:38] like Kyle was saying, you would tear him down. you're going to lose that money [13:43] and your taxpayers of the taxes and the attorney fees. [13:49] You sell it and we don't charge that to the seller. You're going to lose [13:56] the game. You don't know what you're going to sell for that cost. We have we [14:02] have to get to 133. We got to get 133. I'm saying it could be higher. It could [14:06] be less cost. [14:17] a shame. It's embarrassing to say from Summit. [14:21] What the Handy Andy get to [14:26] that building gets tore down then the whole place should be [14:33] more [14:45] deemed the building on the far end as unsafe. So that wasn't that wasn't us. [14:50] that was building commissioner and that's what started the whole process. [14:52] So then we looked at tearing down the building the um excuse me the storage [14:57] building the far end the bricks were falling off of we had to we had to rope [15:01] it off and so that's what started then it was we got um an amount to tear down [15:08] one building which ended up being just as cheap as you tear down all four which [15:11] are all not good buildings and they're just not so [15:15] I'd like to see why the hand like who said who's the building county [15:22] » well RD was our inspection and he was the one that deemed it as unsafe. [15:26] » How did this >> that come from further? There was in [15:30] other inspections done in state level. >> Yeah. You'll never see that again. [15:34] You'll never see the break point. This place kind of look like a dollar. That's [15:36] why maybe that should have been done 30 years ago, 20 years ago. If you're going [15:40] around trying to say I mean I'm not trying to be mean or rude. I'm just [15:43] saying like this is kind of dumpy art here. You guys need to do something with [15:47] this. And this is the cars were dealt with. I I don't make the meeting. [15:52] » This was all they missed the meeting. Circle K was here. [15:58] Their district and western managers were here and they they said the building was [16:05] unsafe and needed to come down. Circle case [16:08] » in their own not here. >> I didn't know that. [16:11] » Circle come to the meeting. There was like [16:15] three people. [16:19] Yeah, but they circles head said it needs to come down and they were going [16:23] to tear it down and build a new building and they changed their mind. [16:26] » What are we getting for our taxes out there? I took seventh street [16:32] on the way here. You can't even hardly walk on what's going on [16:39] in this part of the meeting. We'll move on. We're on one subject right now. [16:44] » All right. text must decision as we pay off 133 [16:56] tax whatever look at it. So I guess we [17:04] go plan a which is fair and balance. >> We need you to make a motion. Is that [17:10] what we need to do at the Is that what you're [17:13] » I'm Okay. Then I make a motion that we accept the offer of 13,300. [17:20] Um [17:26] the attorney fees and the appraisal fee. [17:32] » I mean or take off the extra fees that we were talking about. [17:37] You just said >> that's appraisal. The other fees was the [17:42] tax fees which we were getting back which we said we would take off which [17:45] makes sense. >> Make sure those come up. Yes. Um, [17:49] but the appraisal fee is what we incurred because we were sell [17:56] » I think the best thing to just say you're go accept the 133 [18:04] » that she offered. Yes. >> My [18:08] that is my motion. So on the floor right now [18:13] I'll second. [18:27] So, and we can still ain't done with it yet. [18:32] The appraisal fees is the only thing that really is incred [18:46] the appraisal fees. >> What's that? [18:48] » Can we split the appraisal piece? >> Yeah, we have some clarification. [18:54] » What was your vote on that? >> Nay. [18:56] » Yours is okay. Failed. [19:05] » What's What's the total you're thinking? >> Well, I mean total of the appraisal fees [19:10] and what we have to accept 65. I was just trying to make somewhere [19:14] between 13 and 16,000. [19:19] I mean, we would have incurred the appraisal fees [19:22] the interest of selling, >> right? You still have to do that anyway [19:26] if you go to sell it now. [19:29] » Well, that's true, too. But you're still going to have to raise the lots. That's [19:33] » fine. I mean, and we can do that if we decide we're going to sell them. But [19:36] either way, I [19:38] » mean, yeah, I'll split the appraisal fees. Okay. [19:41] » I'll do that. [19:48] The whole debate last. [20:20] Do you want this? >> Saved. [20:31] » I'll do 149. That's all I'm going to go though. [20:36] I got have a lot of money. just tearing tearing down the storage unit. And I [20:41] don't know what's per [21:05] second that again. [21:24] This is [21:28] a second. [21:45] Yeah, of just kind of getting in the middle of the road here. I'll [21:50] go for it back 149. [22:00] » That was three in favor and two against. I'm just making I can't hear so well. [22:07] » Sorry, we got a big air conditioning back here. Make noises. Sorry. [22:15] » But we could do this now. You need the task motion or something on the record [22:22] to explain why [22:26] soul [23:05] reasonable And it's great. [23:47] motion. What we just did [23:54] essentially explain why [24:04] here's my [24:12] Motion carried in favor for the 149. We're accepting [24:18] the 149 because the minimum bid 22 was not made. Uh 149 [24:24] was [24:28] » you want to explain why glassing. So, we didn't accept the 22 because it didn't [24:33] come in. Um, the price that I guess got offered didn't meet the appraised value. [24:56] Okay. All in favor? [25:04] LC [25:14] just [25:24] motion to send out notice uh for a two week [25:51] Okay. You need to [25:59] I know you said something about Robin. What' you say about Robin? [26:02] » Please. They got approved. They got >> approved. [26:18] Thank you. [26:29] They said you will just you you could still receive that money but you just [26:34] need to delegate it to a different project. [26:51] stated it doesn't. Yeah, what she told her, [26:55] » right? [27:31] She gets [27:43] your plan. [28:24] on you guys. I I'm ready to, you know, like I said, I got to get with my [28:27] contractor, but I mean, as far as like getting that, you know, storage building [28:31] down, I just hope that you guys aren't going to be like, "Okay, well, you got [28:35] to get it down in like 10 days because you guys have had it you guys have been [28:38] messing with it down for two years." And I and I'm I'm a person to get stuff [28:42] done. I mean, I'm I'm that way. >> When we first started talking, it was 30 [28:46] days was what we were, >> right? And I plan on trying to meet that [28:48] goal. >> Okay. [28:49] » Yeah. >> Yep. I just want to try to make sure I [28:52] can save some of the rafters that oversee that um ceiling over there on [28:59] that for like or whatever for seating for them. [29:20] resolution [29:29] speed limit at >> I I didn't know if you want to pass that [29:34] tonight. Do you know what point? I know originally it was 1550, but I going to [29:39] change. We left it blank so that we could write in wherever you decided [29:44] wanted. >> Yeah, I mean it was Mark. Mark [29:53] » so I think we we we came up spot that was [29:56] running around pond area. [30:06] It was right between RNR and center. [30:21] » Okay. >> You guys need anything else? [30:24] » No, you're good. [30:30] » That's already been passed, right? >> I thought we did. Yeah, but we were [30:33] waiting on the exact coordinates because there was a hangup of where exactly we [30:36] were going to put the sign. >> So that's why you and Richard went out [30:39] there and mapping it out. And so we just to verbage for the ordinance. Yeah, the [30:45] ordinance pass. It's just verbiage to put it in there so that we [30:50] » pass it [30:55] speed [31:00] out and coming in. Well, they voted to change it. You voted to change it. [31:03] » Yeah, they voted to change it to 1550. >> So, [31:11] from 55 to 30 [31:17] » that wasn't nothing was done for >> discussing the sign [31:22] back to 1550. So, it's not over the 30. That's [31:29] going to like [31:43] » way over here on a turn. [31:54] I think why they placed it. Yes. [31:59] » So semi driver would be clearly able to see where they [32:05] already put the signs up. [32:11] » We post the 40s to the 30s. >> Yeah, we took the 40 off. Put 30 on. [32:17] That's what I thought. That's what I thought we wanted. [32:21] Okay. >> Yeah, that's what we Okay, they're done [32:24] then. [32:30] We have polls discuss [32:39] » going north. [32:52] » That's that's on count. Yeah, right. >> And that's and that's all the way around [32:58] » after you pass 1550, every intersection you pass that's unmarked becomes an [33:02] unposted speed limit which then by state it's rural it's 55 mph. [33:09] It'll be good once you pass 1550 because it's unposted. [33:14] » You get to the post on the code. Then you have to follow that one. If it is [33:17] posted, but every intersection has to be posted or [33:26] not posted. Then you got urban roll. [33:35] » I'm I'm hearing what you said, right? You changed the 40 that was before [33:38] Dollar General when you're leaving town to a 30, right? [33:41] » Yes. We changed both north and southbounding [33:48] 40 signs that was there. We just took the 40 off at the 30 because I wasn't [33:52] aware we were going to which I'm fine with. We can do it. Not a big deal. [34:01] » One post 13 just after the RNR that way. 40 miles [34:07] hour. [34:12] » I wasn't part of that. So, >> you tell me where you want it. We'll put [34:15] it in the ground and make it happen. [34:19] » Go 55 40. >> I need to change that. [34:33] First, [34:40] not a suggestion. >> A suggestion. That's not a It's yellow. [34:44] It's not a law. It's a suggestion. [35:02] Next up is the trash ordinance. [35:10] And the motion to number the ordinance 2026-7 that it shall be placed on the [35:14] first reading by title only. And this is an ordinance admitting trash to the [35:18] council. [35:28] motion. >> I second that. [35:34] » All in favor? >> I [35:42] need a motion to read Hornets in its entirety by title only. [36:17] 2026-7 has been duly passed and adopted. [36:38] All right. [36:51] The academy goes, um, things like that. [36:57] uh he's got one more chance to do it. He actually got confused on the course. [37:03] It's a brand new course. It's the first academy that they've ran this course and [37:09] there's not a whole bunch of literature out there on on what they're doing. I [37:12] didn't know at the time because he got confused on the course and went the [37:16] wrong way or so. Anyways, they're going to let him go back down and try it [37:19] again. >> Um [37:22] » is this the precourse course? >> Yeah. So he's not passing the pre [37:26] » well there there's only one precourse and [37:30] » um yeah so he did not pass the pre to get in. So [37:36] again this is the first time that they've [37:40] done this new course. They have they had a course [37:45] for probably 25 years and this was the first academy that they changed to the [37:50] new. So going back [37:56] uh they haven't rescheduled his test date yet. Try that. [38:02] Um vehicles uh and shape we got with [38:11] back out to [38:16] reached out to me and I've not gotten anything back on rear yet on the tires. [38:23] Um the [38:28] cage, the evidence cage, we have it fabricated, but we've not had time to [38:33] come in here and do it with everything that's been going [38:41] on for the academy and then hired. We were trying to get them trained up [38:46] before the 4th of July so we could we did square in Daryl Hunter. [38:54] Most of you probably know Daryl Marshall from Arrest us. [39:01] He fired and then decided he would help us out for the fourth. Then when he got [39:06] out here, he was like, you know, I wouldn't mind going ahead and helping [39:09] you guys guys out permanently. So we swore him in. [39:17] We did good with Hellbreak part time. [39:22] Apologize. I just rolled in from the legs. I wasn't even didn't think we were [39:26] even going to make the meeting. There's not a whole lot on here. It's [39:31] going through my mind. Um [39:38] guys, sure the fourth rearranged for this coming weekend, this coming [39:42] Saturday. Uh we had everything set up, ready to go for last weekend. [39:48] Golf carts were great. Thank you. Uh serve two now for this coming weekend. [39:56] Okay. Because we're not going to have quite as many people able to help out [39:58] this weekend, but we'll be okay. and has [40:04] I don't know I guess are we expecting the same kind of crowd [40:08] like how how do you >> I heard this is the first time it's been [40:11] cancelled >> as far as I know [40:13] » that's what I was going to ask yeah ask >> how I mean I've lived here all my life [40:20] and I've never known fireworks to be host [40:24] » I've been thinking about you guys trying to figure out how do you go in not I [40:27] mean >> I don't know what [40:28] » it could be really busy it could be really not is [40:31] » I think it's more because everybody in the county is already having the [40:35] fireworks >> possibility [40:38] else. >> Yeah. [40:42] » You are getting two golf carts instead of the bors. That was [40:46] » Well, we had three for the first first weekend, but we've got a few less people [40:50] able to make it this weekend. Um so we just retain two for this coming weekend. [41:10] I do want to let you know that we >> had to talk and we are going to allow [41:16] people for extra parking to park at the big ball. [41:20] » Just let you know if you've noticed. >> Yeah, they kind of park where they want [41:24] right now. There's not a whole >> No. Yeah. [laughter] [41:27] » Uh, one thing we we we did do this time, >> we anybody putting up, you know, saving [41:33] their areas, >> they had rope, wire or cable put up, [41:38] » we took it down, right? >> Because somebody could come zipping [41:40] through there at night on an ebike or something and smack that stuff and get [41:45] injured. But we did go ahead and take our police tape, the ones we took down, [41:48] and put it up for them to save their area. Still, [41:52] » just call you up. We're going to go down there. That's not what [41:55] I mean. They weren't out there, so I didn't want to just take it down and [41:58] take their stuff down. So, we put police tape up to save their area, but uh [42:03] » we probably will have to do something about that some point. [42:11] » Maybe that's a good note. >> It would be a reasonable amount of space [42:17] because we've got people taping off. >> Oh, I know. [42:22] I mean, >> that's what we were talking about the [42:25] other day, right? Because if somebody rolls up there and gets in one of those [42:28] spots, there ain't nothing we can do about that's probably just because you [42:32] put a tape out doesn't mean >> Yeah. [42:37] » Start selling squares to make [laughter] [42:42] » certainly would. But then somebody go [43:02] continue doing the mowing. Um, sprayed weeds again for the third time [43:12] back to school. Got that completed. Question send Brendan in September. [43:19] Why? Uh we had two call outs in June for uh two different pits that failed. One [43:25] was his, another was on the other side of town. Um what's happened is the 3-in [43:31] couplings, the original product that come with those. It's a thin rubber [43:35] gasket and they just over time suck in. They fail. It's not good. So we ordered [43:41] 40 uh 3-in fern co. We've been replacing obviously replace the ones that failed. [43:47] And we we've been going through on Thursdays mostly or when we have time um [43:52] just every pit and eventually we will replace every pit and we'll get away [43:56] from using the original product in school. I spoke with them and the guy [44:03] that's our local area. [44:09] We raised our vacuum out at the plant. It was not set properly. [44:13] airvag gave us the parameters since we've ran [44:17] it up or two fails. We expect to see a few [44:21] more fails because the stuff's aging. Um, but we're going to get better [44:27] service running [44:32] 18 in of vacuum down to 13, which was causing us a low back alarm quite a bit [44:36] where you bring getting a bunch of phone calls. [44:42] So, you're supposed to be running 20 inches of vacuum down to 16 in. [44:50] Yeah. Well, it's a good deal. [44:55] Three compartment inside would have been crack seal and crack sealed today [45:00] benches scraped and painted and post on [45:08] branches throughout all the streets. [45:13] capacity [45:16] since spreading water side for mosquitoes. We have not sprayed yet a [45:21] big increase [45:26] that taken care of tires anything. [45:39] If anybody in the public has them >> mosquito issue, let us know. We'll [45:43] definitely try to come by. [45:59] » Change [46:06] oil on both trucks in the last week. If that made this game [46:13] still at both places [46:24] 321 South Clinton also had a loop done [46:31] street [46:35] I want to thank fair they come out with their jet truck. This is the second time [46:38] we've had they've come out no questions. Um it saved us a lot of headache, a lot [46:44] of time backs. [46:48] So I bud Bush and L [46:55] and just fix [47:05] just the one call probably cost $400. [47:16] Um, you clean the bush air back pumps and [47:21] the wastewater station, took them apart, did the screens, put them back together. [47:30] supposed to be here this week. [47:53] Um did have a sewage pump fail. The gear drive failed. We doing daily checks down [47:59] there. Excuse me. Went down. Went down there. Sewage pump one failed. Shaft [48:05] sheared off. The G connects the pump to the boat [48:11] designed to shear off when something happens. It's just olden [48:34] come out. the wastewater fund all put in. We have [48:38] an issue with one [48:43] fix. [48:48] Couple things I missed. [49:00] Our mission sending the paradise school in September with the date to be [49:03] determined. such. [49:14] » Yeah. So, they went to Arab school last year. Brendon only went for two days. [49:34] know about this on these pumps. I [49:44] doing great. We keep working obviously well together. [49:50] Thank you. [50:06] things change. They have new products. I wouldn't say we should be going every [50:11] three years. Everybody sends their own guys up every 3 to five. Makes them go [50:15] back to school. It's probably something. It's just they change products. say new [50:20] stuff is better for our system. Your system ages, you know, there's going to [50:25] be things they might worry [50:51] motion. [51:07] I'm just stay [51:12] um last thing I got. I need to purchase [51:18] PC pumps. So they come out original you guys $943 [51:24] to the lift station so we can run our motors out there not straight 60 Hz that [51:30] they'll be sell from 30 to 60 additional part [51:37] of that it's going to cost us an additional 500 [51:41] to get this proper. [51:44] Are those are those varying frequency drives? [51:47] » Yes. >> 260, but it doesn't have to. It's not [51:52] either or. [51:55] » It'll save money in the long run. It's easier on the pumps. We're gonna [51:59] eventually I'm going to probably come at you guys with the backstage pumps and do [52:02] the same thing because it's just >> Yeah. Well, I think it might have been [52:08] talked about. [52:33] motion. I'll make a motion to approve $1,493 for [52:40] DBC. [52:48] That's all I got. I I have one. [52:53] » Can I map to talk to you about this? [53:01] » Yeah. [53:09] This came in today. I spoke with uh [53:14] Consulting Group about the Pizza King parking lot. I guess new funds just got [53:19] approved groundwater project that we are involved [53:23] with on this. What's going on with that? I [53:26] know it's been an ongoing thing for quite some time. Um so they're going to [53:30] be coming tentatively. I believe he said August 10th. [53:35] My highlighted area is to put new volume [53:44] talk of selling selling the parking lot for the parking lot. [53:50] Let these guys come in and do what they do. [53:53] » Yeah, it's all great money. The guy told me I have his email. Um I just got it [53:58] when I was put leaving out putting this together. [54:01] off. You guys have [54:06] contact. [54:12] » Yeah. And Chad's usually the one that kind of [54:19] shoot [54:24] he was asking about the really question he had for us was in front of this [54:49] Thank you. Thank you. So I don't really think much are [54:55] Thank you. Um and then I have I do have one question. [55:00] What what do you guys want to do with the American flags? Obviously [55:05] this weekend you want to leave them up for the summer [55:10] want to take them down at a certain date certain date take them down the path. [55:15] Um I give you a recommendation in my opinion [55:20] pretty expensive. We spent $1,200 I think was this last time and that was [55:25] probably our flag. [55:34] I would recommend bringing them down after this weekend. We'll put them back. [55:51] I think you have it figured out. [55:59] » Dollar General. >> Yep. I went down there. Um [56:10] the general man was put in. I put outside. They mowed obviously a little [56:15] part of it. They explained to her, "Hey, this is all of y'all's property. [56:20] We'll get her this week. I'm going to follow up with him next week. We'll find [56:26] you is a property. So, >> so the guy that was the developer on [56:30] this, we'll have his name on it. >> You have it, his phone number. [56:35] » Yeah, he all he does is lease the Dollar General. So, that's who we need to be [56:38] contact. >> Correct. I told her it's supposed to be [56:41] fairly less. [56:52] » He was the one that said contact me. This was a big concern when they were [56:56] coming into town. It was going to be getting mowed and he said and then said [57:00] if it's not getting mode contact me. So that's [57:03] » probably to save you some headache of >> phone calling phone calling everybody [57:07] and trying to phone call everybody. I just go straight to [57:19] » I was just want to make sure on that. So [57:23] the wood the stand. [57:27] » Yes. You're okay if someone gets a piece of wood or anything? [57:31] » First, first [57:35] guy truck with a bunch of [57:41] » I've had multiple people ask. I told every one of them, you know, [57:45] » how big these are? >> There's manageable all the way up. [57:51] I mean, for me, I got liability issues. Someone rolls a log on their leg or [57:56] that's I'm sorry. I just put my mind that is [58:02] that a problem. [58:16] » I really don't think they permission. [58:21] » Well, they're trespassers. Okay. No, if they give information, if they go [58:28] down [58:32] advertising what is available, are they just stealing it? [58:36] » Right. So, they're trespassers. [58:41] » They're taking they have a right to be in the park. [58:45] Correct. Right. >> So, they're they're invitees. So, they [58:48] so you have to I guess the question is they they go on town property, right? [58:53] pick up a piece of wood and something happens. They roll a piece of wood on [58:57] their leg or something crazy happens. >> I think they would have exceeded their [59:02] invitation. >> Are we good? [59:03] » Okay. Yeah, that's all. >> That doesn't mean you're totally immune, [59:06] but if anybody sue anybody down there, we'll sue [59:11] » you. [59:23] Some do not guarantee, >> but some do. If they exceed that license [59:29] or invitation, which this is what that sounds like, then they're only owed a [59:35] duty to be protected from intentional injury. Can't shoot them necessarily. [59:40] But yeah, pretty much [1:00:06] I saw somebody down. Talk to them. They're starting again tomorrow morning. [1:00:13] Start tearing down again. So they might have to block the road. [1:00:21] He doesn't know if he's going to start in the front or the back or he's going [1:00:24] to start tearing down. >> Yeah. [1:00:27] But they are going to allow traffic flow. [1:00:31] Have a crew coming in tomorrow and starting. They said he didn't know how [1:00:34] long it's going to take. [1:00:45] All right. [1:01:07] Not sure he's going to do it this week. Take your picture next toart, [1:01:13] post it on maybe Facebook page, potentially get a free niche. [laughter] [1:01:20] They know anything about this work and they're like, "Why did you take a [1:01:23] picture of the golf?" [1:01:29] Yeah, for sure. >> You guys want to do it, passerformance [1:01:36] LLC is his Facebook page and there's sticker on [1:01:43] the sticker on side. >> Everybody should stop the police take [1:01:46] pictures. [laughter] [1:01:51] » Absolutely. >> He out of Union City. [1:01:54] » What's that? >> Union City. [1:01:56] » Union City. [1:02:09] I got a bunch of real quick. Oh, sorry. [1:02:13] » Um, don't forget this weekend is the farmers market. Um, [1:02:30] did let people know that um we do end at 1:00 because we do have [1:02:36] some vendors um and I do have a food truck coming in [1:02:41] since um it [1:02:47] not part of the fireworks. I did tell them that we do end at one o'clock and I [1:02:51] said if they wanted to stay after the one o'clock they would have to get in [1:02:54] contact with the fire department because that's not through me. No, it's just I [1:03:00] wouldn't allow them to do that. Um that was with the food truck. [1:03:05] Um we had a I had the parade and I had 22 entries. [1:03:13] Um the streets were lined. It was wonderful. I was very excited. Um, we [1:03:18] had four I had four winners. The float went to uh Kelly's Crazy Deals. Um, the [1:03:26] old car and it was a truck. It was Dan Newbie. [1:03:31] The golf cart um went to Somerville Garden Club and the kids bike was Jacob [1:03:39] Singer. Jacob Senior Jr. So, I got with most of them to give that prize. I have [1:03:45] one more prize to give away on that. Um, so really excited about that. I'm [1:03:54] thinking that next year we can get it later. [1:04:00] Like I said, we are going to open the ballpark up for parking. So [1:04:05] extra person here [1:04:19] forget upcoming events would be we have 350 coming October [1:04:34] October Bible and then I'm still going to work on trying to get [1:04:39] something else another event planned. [1:04:53] Oh yes it will >> set date time on [1:05:02] » that date and time >> that time that they have to leave does [1:05:05] the permit that we give out say a time on [1:05:09] » the issues >> we don't [1:05:14] through the food >> it's just saying they're [1:05:19] » I don't do that because I they're has come and I just let them know that [1:05:24] » or you said you did so that's why I was asking [1:05:26] » they're either going to have an annual permit or they will have a one day [1:05:30] permit. >> Yes. [1:05:31] » Yes. But the reason I'm asking is because several people were wanting to [1:05:35] set up little things in their yards and they were told by several people they [1:05:38] couldn't do it >> and we discussed that in one of the [1:05:41] meetings a while back if it's a little like a tomato stand or whatever they're [1:05:46] allowed to do it. Some of these people were told they couldn't. So if we have a [1:05:50] permit, if we have a food truck set up out there, I can see me getting question [1:05:54] on why we can do it, they can't do it, and so on. [1:05:57] » Right. The the food trucks have to have >> special event permit [1:06:04] » through the county and they have to have that in [1:06:09] it's by county, I think. Pretty sure on that. And the other people, if they're [1:06:13] selling food at their house or whatever they're doing, they have to have the I [1:06:18] think it's called food safety certification. [1:06:21] » You got to have a commercial history. >> Yeah. [1:06:24] » Well, at one point, like he was talking about a lemonade stand or a fruit stand. [1:06:29] They don't necessarily need anything. >> You're not suing cooked food. [1:06:35] » Exactly. >> Yeah. We had private property people, [1:06:40] the church and so on that had stuff set up that sold certain things by certain [1:06:46] people and I was asked about it and you don't need a I believe you don't need a [1:06:51] business license for selling it off your own. [1:06:54] » That's what I'm getting. Yeah. And and the health thing. [1:06:59] » Yeah. Yeah, >> but like if they had the if they're at a [1:07:02] farmers market, that's different than the [1:07:07] » But they still have to have their fruits certificate certification. [1:07:13] » Yeah, >> they can because they show me that and [1:07:17] then they can have their stuff there. [1:07:23] » She has to go if it's on town property, >> right? [1:07:26] on public property. If somebody's serving something, [1:07:33] public property, private property, [1:07:39] it seems to me, I'm sorry, I wasn't prepared for this, but I think that what [1:07:43] I found out last time when I checked was that there are [1:07:48] there are there's a statute that allows you to do some things that aren't [1:07:52] strictly speaking. fruits, vegetables growing on your property, but you've got [1:07:58] like canned goods, jellies, jams, but you've got to label it. [1:08:04] » Yeah, [1:08:08] » there are restrictions, but they're not You don't need to pull go through and [1:08:11] get [1:08:14] » it off your private property. Probably not. [1:08:22] That's my farmers market time. [1:08:26] » The concern is people are taking prepared food to farmers markets. Is [1:08:30] that it? >> No, he's saying that like people are [1:08:34] saying it's the fireworks and they know there a bunch of people here and for [1:08:38] instance the say the fire department say no we have our trucks that we want. We [1:08:44] don't need any more trucks and they'll say well I just know Joe Blow so I'll [1:08:48] just set up in their yard or something. permit. My question is if they've got a [1:08:52] permit and there's no time that they have to leave, they paid Madison County [1:08:57] for a permit to be here and if they want to be here all day as long as they're [1:09:01] not on >> the fire department's property, [1:09:03] » right? Yeah. >> They can be on town property with your [1:09:06] all's approval. >> Perfect. Yeah. [1:09:08] » Yeah. bedroom. [1:09:19] » I think it has >> I'm experiencing that myself with the [1:09:23] historical society as we speak. >> Um they've invited other food vendors [1:09:30] from outside of the town instead of supporting the people in the town. [1:09:37] So I I understand that. [1:09:46] But yeah, the 1:00 is just because that's just what time [1:09:50] » if they wanted to. There's nothing I can do about it. [1:09:53] » If they want to stay [1:09:57] food truck show up at the ball field, >> they have to have a permit to be on [1:10:02] » public property. [1:10:06] Yeah, they're a mask coming permit. [1:10:10] » Yeah, [1:10:15] » completely after the farmers. >> Yeah. [1:10:18] » Oh, >> I know a lot. [1:10:34] just saying >> I just if it's on [1:10:39] our property they would don't we require a permit of some sort to allow them to [1:10:43] do it on >> so isn't it kind of the same as the door [1:10:46] to door thing because don't we tell people that are going door to door they [1:10:48] got to have a permit to be in town solicit we say we don't allow solicitors [1:10:54] that fall under the same that's the only question I [1:10:58] » because if not all this comes up >> yeah no no I get I get where you're [1:11:20] I can see what he's saying. And then everybody comes up to the ball field and [1:11:24] says, "Oh, I've got a farm. I've got like you say 20 food trucks show up. [1:11:31] That's a problem. >> I mean, I don't think there's anything [1:11:34] that could beat you regulating [1:11:47] space for this many don't want to crowd that. But I think question is do do we [1:11:52] have anything and I'm sorry that I I don't know that we have anything in our [1:11:55] town bylaws ordinance >> because we do from doortodoor sales. [1:12:00] Right. Yeah. Right. So what is the difference between that and someone [1:12:03] coming in and setting up a business is that way you're getting that [1:12:06] » yeah just for a day. I have to have some type of right like like you said there [1:12:11] could be 30 vendors just show up from Indianapolis. They can't we got to have [1:12:15] some idea who's coming in and coming. Well, then my thinking is all the people [1:12:19] that we shoe out of here because they're going door to door, you know, the roof [1:12:21] companies do, [1:12:24] » right? >> So, yeah. So, we got to have some sort [1:12:26] of >> Well, I mean, [1:12:30] I don't have my book or I don't I couldn't think of it exactly [1:12:37] address, but I I just think you have the inherent power to control how the land [1:12:42] is used. As long as you're not discriminated with [1:12:46] say first come first serve or you have to apply have to pay this nominal fee or [1:12:51] whatever >> I don't think you're obligated to let [1:13:04] that >> as far as door thing I don't think [1:13:07] that's on the same notific [1:13:18] You guys can no point anybody you want to [1:13:23] regulate that. You just it can't be willy-nilly. It's a matter. It's the [1:13:27] same as the concerts of the park in Fairmont. The lines the council [1:13:32] appointed the Lions Club to manage the food trucks. So they get the say who's [1:13:37] there on that day and there's nobody showing up at the park without the say [1:13:40] of the Lions Club. >> So she can have the say because she's [1:13:44] having her >> she's having her thing one she has to [1:13:48] say nobody can come in there because it's public property. [1:13:50] » Absolutely. >> I get it's always been a courtesy of the [1:13:54] town and that way before I even came on board. Yeah. It's always been understood [1:13:58] that the fourth belongs kind of to the township and they do the fire department [1:14:02] stuff because they're raising money for fireworks for the next year and they're [1:14:05] doing Yeah. >> And so as a courtesy I think it's been [1:14:07] before the council just always stayed out of it. [1:14:09] » Yeah. >> In the town. So now I mean now the [1:14:12] question down there which is fine. You can just [1:14:16] say hey like we're >> going to make a person ahead. [1:14:21] » You have to go through them so that you can verify that they have their [1:14:25] somebody's got to verify they have their permit. They just can't show up. Oh, [1:14:28] yeah. Yeah. >> So, that's I mean, the question is, do [1:14:30] you want [1:14:39] » It's just a matter of you want to step up. [1:14:42] » My opinion is no. I mean, if you were asking me what I think, no. cuz I the [1:14:49] lady asked me today and I knew had a feeling what this lady was doing because [1:14:54] I don't know if she's already talked to the fire department or what and been [1:14:58] told that we don't want anymore. We got our vendors that we want and we already [1:15:03] know what they're doing. And so, but I said, "You're welcome to [1:15:08] set up from 9 to 1 at our at our farmers market and have your food truck." And [1:15:14] she's like, "Absolutely." She'll pay her $20 and they'll be excited. [1:15:24] » Tell her to shut down. She can stay there all day. That's what he's doing. [1:15:30] » Call 50 food trucks. Have 50. >> You can stop it right now and just make [1:15:33] a motion. We're not going to allow food trucks Saturday after 1:00 in public [1:15:37] property. You can fix that right now. >> They're they're I think they're No, [1:15:42] they're pretty nice. I don't think I've never had any problems with nobody. [1:15:46] Never. [1:15:51] » I mean, if I had >> Everybody's nice till they're told no. [1:15:59] » Nice. >> A legality way to remove them. [1:16:04] » That's not enough for me to make them leave. [1:16:08] » Like he said, >> I'm going to make a motion. Saturday, [1:16:12] July the 8th at the [1:16:19] » July 11th. [1:16:24] Food trucks at the Summit Bowl softball diamond old softball diamond are allowed [1:16:31] from 9 to 1:00. anything up for that is not on [1:16:38] » the double makes [1:16:43] not under the [1:16:50] » be during a farmers market time is what I'm [1:16:54] saying they have not checked with the I think you're getting the farmers [1:17:00] market isolated [1:17:05] Yes. >> What to do about that? That's what [1:17:08] that's what we need to do about [1:17:20] let's say let's say the 4th of July market [1:17:34] » it encompasses the whole town just not just not the pounds behind [1:17:40] » farmers market >> and at this point I do I think it's kind [1:17:44] of late to do that count >> no these people are already designated [1:17:48] » this weekend >> talking about going forward [1:17:51] » forward next year yes absolutely >> anytime someone wants to come in [1:17:56] » dollar [1:18:06] Now let me just make a general statement but mostly you discuss so [1:18:13] I don't it's it's likely that you cannot regulate health and safety issues [1:18:19] because that field is occupied by the state and the [1:18:24] but you control of summit bill public say no food trucks I don't think it's [1:18:33] it's not you can say any food trucks or you can say something in between and set [1:18:38] standards that are not related to help directly. So I don't see any [1:18:43] constitutional issue. I don't see any conflict with law issue. I think it's [1:18:48] strictly what you want to do with your I would say just make sure that they have [1:18:53] a county permit. It's a food serving place. Make sure [1:18:57] they're legit. And if they not saying we're checking into their We're not [1:19:02] going to go inspect their kitchen. >> No. But just say that they have that [1:19:06] they as long as they've got their permit and they have prior approval of permit [1:19:10] through the town that controls like he's saying 500 trucks showing up. [1:19:15] » You can be free. >> Yeah. You can do whatever you want to [1:19:18] do. >> Yes, you can. [1:19:19] » But at least we kind of got an idea what's coming, where they're going to be [1:19:22] set up at, so on if they're on public property. [1:19:32] That's what I'm saying. Yeah. The whole thing. Well, [1:19:42] » I couldn't trespass him from there. From from my point of view, I could trespass [1:19:50] » versus someone, >> right? [1:19:56] probably mean that the town has to oversee how [1:20:01] many food trucks the fire department brings in. That's what that's where I [1:20:04] was going with that. [1:20:08] Yeah. [1:20:22] » I'm not saying this food truck particular, but I did want to know. [1:20:28] » I'm looking into I'll be down there. I'll [1:20:32] not beg them leave, but take that motion off the table. [1:20:39] I'm just saying if if you know something could get physical like that, I want to [1:20:42] know why. >> I agree with you, but I've never had [1:20:45] issues with any of my if I had something public with anybody or something. I've [1:20:50] questioned a few things that you think you're going to call me. [1:20:54] » If you do, you're gonna call me. >> Absolutely. I also care put a fair amount of time at the beginning of the month into [1:21:40] finishing up the contract. So we have a detailed sales contract may need to be [1:21:47] modified now but it's it's useful for whenever we [1:21:52] want to this deal [1:21:57] what I've been think substance has been [1:22:03] have the one case um my understanding talking to officer Brooks today is that [1:22:11] I think you and I talked about this is that he's working on a report to you [1:22:16] that will possibly enable us to get an order from the court to remove the [1:22:21] abandoned vehicle that correct without necessarily pursuing the ordinance [1:22:27] violation itself [1:22:33] property remaining [1:22:37] a copy of it. will send you and we are we will decide then whether we have [1:22:43] enough evidence to pursue the ordinance violation or we just get the vehicle. [1:22:50] That's where [1:23:04] public citizens. Anybody have anything? Terry [1:23:09] things [1:23:12] I'll talk about 2011 South second. Uh I just want to [1:23:17] thank you for working with D. [1:23:36] » You really don't have money. >> Yeah, we still have to do [1:23:39] » Yeah. I mean, we still had to do >> Well, yeah, but you you took them off [1:23:42] the tax rules. [1:23:46] You're losing money on them because they're not on the tax rules. So, at [1:23:50] least they're getting back on the tax rules. [1:23:51] » Sure. and and they're going to look so much better for the town, for the people [1:23:56] coming into town, you know, [1:24:01] the plus all the way around. And I know you're divided on it, but hey, I think [1:24:06] it's great to get them back on the tax. So, [1:24:11] that's really all I got is just thank you for working with D. I think she's [1:24:15] going to do it for better for the town. Thank Mark [1:24:21] we'll make constant circles out of department my [1:24:24] spot. So, go buy a ticket. I'm glad I don't sell Kirby sweepers [1:24:30] anymore. [laughter] [1:24:35] » The rest of us do [1:24:43] the trespass. [1:24:47] » Oh, yeah. go first to be polite. Age before [1:24:52] beauty. >> Okay. Tamblin Bailey. Uh 208 South [1:25:00] Second Street. Okay. And now I'm seeing [1:25:17] mice and rats. So I'm going to get charged with a firearm in the city if [1:25:23] y'all don't get something done about the trash pile. [1:25:27] Okay. Item number two. The charity box up town. Mrs. Sears fell last week [1:25:35] onto the pavement from the step. Can we get that moved down to ground level, [1:25:42] like parking lot level along that railroad tie where the tree bed is on [1:25:49] Main Street, so we can still use it without endangering anyone else's [1:25:54] safety. I do my mom's donations there because she's afraid she's going to [1:25:59] fall. >> And now with Dorothy having fallen, it's [1:26:05] that fear. I'm so I'm not sure who put that. Who do you know who put that [1:26:08] there? >> The high school did. [1:26:12] » Yeah. [1:26:17] » I mean, it's not our property. I mean, it's on our property, I guess. So, [1:26:20] » yeah. But what are we going to do [1:27:02] about the trash pile? [1:27:06] Say, I'm not Is it the house on the floor? [1:27:09] » Yeah, the brick house where the trash was at Christmas time. Yeah. [1:27:12] » It's now gotten twice that size >> out by the garage. [1:27:16] » Yeah. Almost all the way to the street. [1:27:22] And it's starting to smell really bad. >> Well, it started out a year ago when I [1:27:29] moved in as a love seat. Now we've got trash cans, kitty litter buckets, [1:27:36] um bags of trash, a dresser with no drawers, an old ironing board. [1:27:44] » It just that just keeps getting bigger and bigger.
