[2:17] So, in the ordinance that we drafted, there is a [2:25] section entitled administrative requirements [2:28] and that says all requests for a truck stop shall be accompanied by the [2:32] following items. A site plan, a traffic impact study, a water runoff and [2:39] drainage study, a lighting plan, and I have added in there a security camera [2:44] plan. That make sense? [2:47] Yeah. [5:43] Now, they are required to submit a preliminary plat. They don't have that [5:47] plat tonight. So tonight we're just approving the site plan. They'll have to [5:52] come back in January with the preliminary plat and they're looking at [5:56] doing five duplexes. Um [6:00] I have had a phone call about inquiries about what they were going to put there, [6:04] but I've not had anyone formally complain about it. Uh, I'm [8:03] actually the my wife actually is now co-owner with the heirs of the property [8:08] immediately to the south. Uh, was formerly JW Lingo 3417 East Street. I [8:14] don't think the family, the whole family is not opposed to certainly increasing [8:18] the area, proper development in the area, all of those things. We've just [8:23] been through estate planning, just had an estate sale. I do know that the roads [8:27] across the street are present here and I have not conversed with them. I don't [8:31] know about their feelings and certainly want to let the developers know we're [8:35] not here to like oppose or say hey absolutely not. We can't reszone it. The [8:40] only the only thing I would request because I don't feel like that the [8:43] family feels we have sufficient information to say yes we're fully in [8:49] favor. Yes, we oppose it because we don't really have the ramifications. We [8:54] had the house up for sale and we actually had a contract on the house uh [8:59] that the individuals I think were concerned about. Uhoh, you know, now [9:03] we're reszoning this. We don't know whether we need to go forward or not. It [9:07] certainly that aspect of the delay negatively affected the family. Of [9:11] course, in that regard of what our potential future was, it has nothing to [9:16] do with being for or against the property. In fact, anything will look [9:20] better than a burned out hole of a house and what's developed there there. So, [9:24] we're not at all opposed to that the improvement of the property. I think [9:27] it's just important to know what the future does hold for the residential [9:31] homes in the area. I'm very familiar with the PUD. I know that that is [9:36] restrictive to exactly what they are saying they're going to build. They have [9:40] to build whatever the PU So, that's not a problem. I don't I'm not concerned [9:43] about it being wide open on development and all that. I think my biggest concern [9:47] would be we don't have the internet up. I don't have a printed plat in front of [9:51] me as far as what actually that's going to look like or [9:54] » I don't have a plat. I have >> But that's what I heard you say. And so [9:58] I'm wondering about the plat if I'm just wondering about that. I know if I'm [10:03] them, I want to get this approved right now for the first of the year. So I'm in [10:06] no way trying to be antagonistic and saying, "Hey, you guys got to wait [10:10] another month." But the thing that does concern me is don't have the platform. [10:14] And would love to have a conversation with you guys about kind of what that [10:17] looks like. be thrilled to do that. Um, but really I'm respectfully going to ask [10:23] that you consider a yay or nay vote on it to approve it as [10:28] far as the reasoning until we have the plaid in front of us and can properly [10:32] respond to what that actually looks like on access and egress and since the [10:37] borderland absolutely specifically borders to the south the 4 acres that [10:43] you know is now in the estate. It would it would def defin definitely [10:49] impact I guess the access egress of a a person that's buying a single family [10:54] dwelling and what does all that look like? So I just respectfully ask not [10:57] that you deny or you know approve it either way. I mean I don't know that [11:01] we're even opposed to it. It's just that I don't think without the plat we have [11:05] the information to say we can properly speak to [11:10] whether or not we would be opposed at the impact on the personal residence. Um the concerns that I have is is just the inconsistency with the the [13:40] disharmony of the the two zonings. The the R1 being single family uh budded [13:46] right up next to the PED um you know effectively multif family. I just I [13:50] don't want to make this a those people these people kind of thing, but um just [13:56] in essence, you know, the people that live there now or are interested in [14:00] their property values selling in the future, just as just as Mr. Harris said, [14:04] the sale being held up because of this possibility. Um the people in the area [14:08] there do have some concerns. I've spoken with several of them about the way that [14:12] may affect things. Um, now I'm a landlord and I have single family home [14:19] and multif family as well, both. And so, like I say, there's nothing to say that [14:25] inherently this is worse than that. But there, you know, if you're the homeowner [14:31] and the resident, you're going to you're going to take care of a property better. [14:35] If you're a landlord and not living there, you're you have a financial [14:39] vested interest in taking care of the property, but you're still not going to [14:42] take care of it as good as you do your house. And if you are not the owner and [14:46] you live there, you have a very temporary uh connection to that [14:51] property. Um I have a great relationship with many of my tenants. Um it's not [14:56] about the it's not about the situation uh that but it just in general that has [15:01] been my experience for 20 years as I've been doing it for 20 years. So I kind of [15:06] have onhand experience about this. I got a call just on the way here tonight. As [15:09] a matter of fact, one one of the tenants and one of my f multifamilies was [15:15] yelling at a tenant from two doors down and they were having a big fight about [15:21] whatever it was going on. got a third tenant involved and those kind of [15:25] things, you know, they don't happen because it's multif family, but when you [15:29] have people close together, they can have it. And so when people have been [15:33] living in a single family or one for years and years, you can see how this [15:38] would concern the neighborhood. I mean, I I hope you could at least see that [15:43] possibility. Um, it's not about what it looks like now. Probably be beautiful [15:47] once they build it. I don't know what their plans are. Like I say, I'd like to [15:51] see it as well. Uh but you know if it changes hands, how will the next [15:55] landlord take care of it? What's it going to look like in 20 years? Those [15:58] things will affect the neighborhood. If the wrong landlord comes in and doesn't [16:02] take care of the property, it will definitely affect those homes. And so [16:06] there is a concern there. A resident owner will always take care of a [16:10] property better than any any of the either two situations. So that's kind of [16:16] what I have to say. [17:40] » Ordinance revision. request by planning and zoning to approve an accessory [17:44] dwelling ordinance to reflect rules and regulations recently adopted by the [17:48] state of Arkansas. >> So [17:52] in an attempt to solve the affordable housing issue, the state [17:59] senate or state legislature has passed a law that basically says we have to allow [18:06] it only it's only addressing accessory dwelling units. We're not talking about [18:10] garages. We're not talking about shops. We're not talking about workshops. We're [18:14] talking about what we've always called mother-in-law's quarters or um guest [18:20] houses. And so the new law basically says that we have to allow at least one [18:27] by right on every piece of property that has a single family home. Now, we have [18:33] always required a conditional use permit. [18:37] Um, so this ordinance is simply to bring us [18:41] into compliance with Arkansas's new law. Um, [18:47] and I've given you a copy of the actual law. [18:52] There's several things we cannot do. Um, [18:58] we cannot require that a member of their family live there. We cannot require any [19:04] kind of family relationship with the person that lives in the main house. We [19:08] cannot require that the accessory dwelling unit match the house in design [19:15] if it's an unattached. So the accessory dwelling unit can be either external [19:21] attached to it like an attached apartment or it can be internal. [19:26] » Internal. >> That's what it says. [19:30] So if it is external or attached, it can't be more than 75% of the foot space [19:37] or the space of the primary home. We cannot require that it have its own [19:42] utility meters. [19:46] » We cannot regulate it as a um rental unit. They can rent it out if [19:53] they want to, >> but it can be only up to a,000 square [19:57] feet. It has to be the lesser amount. So the This is a thousand, right? The way I [20:01] read it because I was mathing at my house before I came up here. [20:05] » Probably it says that somewhere. >> Design number three. A [20:12] » not more than 75% or a,000 square feet. Whichever is less. [20:16] » Yes. Whichever is less. >> So you got a 2,000 square foot house. [20:32] That's 1500 square feet. So it still would be smaller. It would still only be [20:36] a thousand. >> We cannot require that it has additional [20:40] parking. [20:44] We cannot require that the single family dwelling or the accessory dwelling unit [20:48] is occupied by the owner. So, somebody could have a single family home and [20:53] they're renting it out and that's and they can still put an accessory dwelling [20:58] unit in their backyard >> and rent that one out too. [21:00] » And rent that one out too. >> Um, [21:04] » what's the rule for parking on the street? [21:07] » Do we have an ordinance for that? They are not required to have additional [21:10] parking. [21:18] » What about a single family home with an accessory? [21:26] » Make no mistake, we're not happy about this law. And another another hiccup [21:32] that we've run into with this law is this applies to historic districts, too. [21:39] So where we have typically been able to regulate [21:44] structures in historic districts, we now cannot do that. [21:55] » Okay. What's an A1 zone? >> A1 is the mixed use zone. It's the only [22:01] zone. So several years ago, we realized that we had people with large pieces of [22:06] land that wanted to like build an additional home on it or build a shop on [22:12] it. And there was really no reason that they couldn't except it was our [22:16] ordinance. So we created the A1 zone. It's the only or zone where you can [22:21] build a shop before you build your primary home. [22:23] » That's right. Okay. >> Yeah. And you can have two houses on [22:26] there. So the [22:30] » now we have >> so that's excluding A1 zone. So that's [22:34] the only caveat is that you can do this. >> Yeah. But if you build an accessory [22:40] dwelling unit in A1 and you have no primary house there then basically your [22:44] accessory dwelling unit is your primary house. [22:47] » Now we have confirmed that you cannot use an RV or a single [22:52] » trailer >> single single wide trailer as an [22:54] accessory dwelling unit. We have confirmed that. We have put it in here [22:58] that it cannot be in the side yard or the front yard. So, it has to be behind [23:03] the rear build line, which is how far back? [23:06] » Depends on the zone. >> Okay. The ordinance does not prohibit restrictive [23:52] covenants. >> So if you have a homeowners association [23:55] and they have a covenant that says you cannot have [23:58] » guest houses, this doesn't preclude that. [24:02] » Okay? >> So you can if if two private parties [24:07] » if your homeowners association and the homeowner if they have a covenant that [24:11] says you cannot have an accessory dwelling unit in your backyard, then [24:16] then you can't. This doesn't preclude a covenant. HOA stand. [24:19] » We can't require a covenant. We can't we can't say you have to have a covenant. [24:25] But if the homeowners association on their own goes in with their homeowners [24:30] and they agree to that, this doesn't preclude that. [24:40] » This law been challenged by anybody. I have not seen that and I read all my [24:47] municipal league notices. [24:52] » This came in in effect for the last legislative session. [24:55] » Yes, >> several challenged. [clears throat] So, [28:51] we um had a workshop, a joint workshop with the board of directors on November [28:55] the 12th. I think most of y'all were there. Um, it was heavily attended by [29:00] the downtown business owners. And while there was much discussion back [29:05] and forth, in the end, we did agree on three things that we felt needed to be [29:10] changed in the entertainment um, district ordinance. Um, and those are [29:16] the only three things that I have added to this ordinance. Actually, I've added [29:20] four. The other one is administrative. But um the three things were banning the [29:27] consumption of alcohol purchased outside the entertainment district because [29:33] beforehand we had people bringing in their own alcohol. Businesses were [29:36] losing money. Um so banning the consumption of alcohol purchased outside [29:43] the entertainment district. So, if Bobby has been fishing and he has a [29:49] cooler full of beer in the back of his truck and he's not drinking it, that's [29:53] fine. But you can't bring in alcohol from outside and drink it. The second [29:59] thing was to remove the block containing the Rock liquor store. remove that block [30:05] from the entertainment district because it was in the entertainment district [30:08] which meant you could buy alcohol there and still be buying it in the [30:13] entertainment district and walk out the door and drink it. So to remove that [30:17] block from the entertainment district >> the third thing was to restrict the [30:24] hours for open drinking from 11:00 a.m. to 12:00 a.m. 11:00 a.m. to midnight. It [30:30] was previously two o'clock in the morning. [30:34] And the only other thing we added um which Boots brought up is we're supposed [30:38] to review the entertainment district every year as needed, but no one had the [30:44] responsibility of doing that. So we have put that responsibility on my position [30:49] to make sure that it gets reviewed every six months. [30:53] » Every six months instead of every year. >> Well, every year. Right now we're [30:57] reviewing it in January again. So um those are the only three changes that I [31:04] have put in there. Those are the three that we agreed on at that workshop.
