[33:30] >> So I said earlier in committee an analyst Allison
[33:34] Smith she took a woman's life that was as big as this building
[33:41] and she got it down on this paper So about 20 years ago
[33:53] as a hair client she really poured into me how much she
[34:03] became a client and then a mentor come in then a friend got
[34:10] my part of who I am when I show up to these meetings
[34:13] because of the influence and The impact that she had on my life.
[34:21] Was just such an amazing woman she poured into me
[34:24] and she poured into my son and she supported me
[34:29] professionally and personally.
[34:32] And I'm just really glad that I could do something
[34:37] like this for her.
[34:42] Memphis City Council resolution when
[34:46] were they circumstances arise on the Memphis City Council
[34:50] has seen fit to name certain public roads in honor
[34:57] of citizens who have served this community and the life legacy
[35:02] and contributions of Gladys and Hunter Sawyer.
[35:07] Born in Memphis Tennessee in 1949
[35:11] was a devoted daughter to my wife and mother,
[35:15] and family member whose life reflected
[35:18] leadership, philanthropy, service, in distinction.
[35:23] And whereas Gladys Sawyer attended Memphis State
[35:27] University and due to her beauty,
[35:30] popularity, and scholarship she was crowned the first Miss Black
[35:36] Memphis State and became a member of Alpha Kappa Alpha
[35:41] sorority later earning her bachelor's degree from Roosevelt

[36:25] at Hunter Greenfield also known as HGF incorporated a marketing
[36:32] and project management firm serving governmental
[36:36] and nonprofit agencies across the nation from and whereas
[36:41] Gladys Sawyer who is deeply committed to community service
[36:45] serving on the board of the Women's Foundation of Greater
[36:49] Memphis, and Girls Inc..
[36:52] Of Greater Memphis.
[36:54] And whereas a member of the Lynx incorporated,
[37:00] and Where's Gladys and Hunter Sawyer
[37:03] was a devoted wife to her husband Andrew Benjamin Sawyer
[37:10] Jr now a proud mother to her son Michael Anthony Brooks Jr
[37:16] and to her daughter Tamara Ashley Sawyer.
[37:20] And the cherished grandmother cum a lovingly called Nana. --
[37:28] chairs grandmother, and a loving grandmother called Nana.
[37:35] Much is required and whereas the Memphis City Council which
[37:40] to honor Gladys and Hunter Sawyer
[37:44] for her extraordinary life and lasting impact
[37:48] on the city of Memphis come on now
[37:51] therefore be it resolved that the Memphis City Council deems
[37:54] it fitting and proper that decay history between Bond
[38:00] Avenue and Jackson Avenue B designated
[38:03] and forever remembered as Gladys and Sawyer Street,
[38:09] be it further resolved that the city engineer is requested
[38:15] to affix suitable signs to designate such public road
[38:22] in honor of Gladys and Hunter Sawyer for her commitment
[38:26] and contribution to the City of Memphis given by my hand under
[38:31] this great seal of the City of Memphis on this 14th day
[38:36] of April 2026 and yours truly Memphis City Councilwoman
[38:41] District, and I so move.
[39:03] City council thank you so much for your support council
[39:07] and and to all council members who have supported this.
[39:13] My mother is a part of Memphis history and the portion
[39:18] of Decatur Avenue that the street is being named for in her
[39:22] honor it is where she was born in 1949 where she was brought
[39:27] from the segregated hospital John Gadsden and it is a very
[39:32] important to me that this history is recognized and she
[39:37] was also a member of the Memphis State 109 where she served
[39:42] as their secretary 109 students were arrested for locking
[39:47] themselves in the provost office and campaigning for equal
[39:52] facilities and equal access for black students at Memphis State
[39:57] University Kimberly I have with my family and friends I love
[40:02] my mother on behalf of my brother Michael Junior
[40:06] and my father
[40:07] Andrew Sawyer who cannot be here today come on we're very
[40:10] grateful come on my brother did raise us to believe that to whom
[40:15] is given much is required and she always taught us to use
[40:19] our voice and to fight for what we believe in.
[40:22] She was an activist how much was a writer,
[40:26] she raised children, she raised adults come everyone
[40:31] you see standing here my mother had a huge impact
[40:35] on from when she was very well known for her red pen
[40:38] I don't think there's anyone standing behind me that
[40:42] hasn't heard a document whether it's
[40:44] a symbol cookout by my mother.
[40:47] She was like aka she was a believer
[40:52] that we have a beautiful home come
[40:54] a beautiful city for which we have to continue to fight for.
[40:58] When I told my parents that I was running for office
[41:01] my mother said that she felt like she
[41:04] had given the community enough and she
[41:06] didn't want to give the community her only daughter.
[41:09] And then she reconsidered that my brother had also served city
[41:13] and she realized that she could not
[41:15] ignore the fact that her children were walking
[41:18] in her footsteps and that is why I used
[41:21] my full name on my office's because she did name me Tamara
[41:25] Ashley Sawyer and named him Anthony Marks Junior come
[41:30] and stand in our very grateful that my niece is
[41:34] her grandchildren will drive down Jackson Avenue
[41:37] and be able to see the exact home where their grandmother was
[41:40] born I know that they are legacy of people who have been
[41:44] key for justice much like the people sitting behind us
[41:47] today come a thank you.
[41:55] >> Thank you and congratulations.
[41:56] Nation that that has been approved.
[43:02] Madam controller if you will please call item number two.
[43:08] It is to Liquor Council about 4-4 and four dash 12
[43:18] of the scent of Memphis of ordinance code that is held
[43:23] for March 24th.
[43:26] >> Thank you Madam Controller.
[43:29] You are recognized.
[43:46] >> Thank you Madam Chairman I believe the representative here
[43:49] is to give us a staff report .
[44:00] >> If you give us your name for the record and then we will
[44:03] proceed.
[44:11] Yes sir.
[44:12] You give us your name for the record and then we will proceed.
[44:18] >> Thank you I am with Memphis Thompson to give a report
[44:25] in history how this report came before the Memphis City Council
[44:29] the applicant submitted an application for their liquor
[44:32] store on December the 15th of 2025 along with that application
[44:38] were three surveys conducted by professional engineers.
[44:42] These surveys come all the surveys showed that there is
[44:46] residential property that is zoned R6 within 200ft
[44:50] of the proposed location of this liquor store.
[44:55] Pursuant to section 4-5 of the 1985 Code of Ordinances Liquor
[45:01] Store cannot be located within 200ft of property that is zoned
[45:06] R6 the application was considered with the Memphis
[45:12] County meeting in 2026 at this meeting the commissioners looked
[45:18] at the application and the survey submitted with it
[45:21] and observed that there was property zoned R6 within 200ft
[45:27] of the proposed location of this liquor store?
[45:31] The attorney for the applicants acknowledged that the survey
[45:35] showed this, however it was his position that according
[45:40] to the narrative on the survey there was no actual residences
[45:44] within 200ft complement the Memphis Alcohol Commission
[45:49] looked at the language of the ordinance saying that no
[45:52] property zoned R6 can be within 200ft of a liquor store
[45:56] and decline the issue of the certificate of compliance
[46:00] on that basis.
[46:02] And so that was all the proof submitted at the Alcohol
[46:06] Commission meeting since that time the applicants have
[46:10] submitted additional declarations in a professional
[46:15] survey set forth in his declaration that there are
[46:19] actually two homes within 200ft of the proposed liquor store
[46:24] location also submitted were letters from the owners of those
[46:29] two homes simply stating they do not have an objection
[46:32] to a liquor store being open their.
[46:35] I'm happy to answer any questions but that in a nutshell
[46:39] is what has happened upon commission.
[46:46] >> Did the liquor store receive a permit before September 7th
[46:49] 1968?
[46:56] >> I don't believe so but this was not a liquor store at this
[47:00] location previously that license lab was not renewed which
[47:04] required the applicant to submit an entirely new application
[47:08] so this is not a renewal of an application that could be
[47:12] grandfathered in prior to 1968, it is a new application with
[47:17] a new applicant.
[47:20] >> Okay Councilman suppose you recognized
[47:25] >> I guess who was there first the liquor store there first
[47:28] and the homes were built?
[47:29] Or the homes were built and then the liquor store?
[47:34] >> I believe sir, it's not a matter of when the homes were
[47:39] built I think it's more of a matter--
[47:46] >> I understand but I want to know which one was their first.
[47:51] >> I think it's more of an issue of whether it was zoned Ar6
[47:54] before the houses were built come on it is my understanding
[47:57] that the residential zoning predated the liquor store,
[48:02] otherwise this would be grandfathered in to come in it
[48:06] could be grandfathered in through the 1968 provision
[48:11] there, however again this is a new application not a renewal
[48:16] of an existing application.
[48:19] >> In the R6 zoning terminology that's all old as well?
[48:24] Or is that knew what that company?
[48:31] >> In the original 1968 ordinances it did not use
[48:33] the term R-6 zoning however in the 1985 it specifically states
[48:40] R6 as a prohibited zoning type within 200ft of a liquor store.
[48:49] >> Just to try and boil it down, so liquor store exists if this
[48:53] location beginning in what year?
[48:57] >> I would have to defer to the applicant on that I apologize I
[49:00] don't have that information.
[49:03] >> I love being called Your Honor,
[49:05] but I'm gonna stop you there.
[49:07] I'm just trying to boil it down and look at it common sense.
[49:12] Just trying to understand that coming so you don't understand
[49:16] when it was necessarily there to begin with can you make it
[49:20] sounds like the neighbors were cool with it
[49:29] >> Your honor, sorry sir force of habit.
[49:33] They said they had no objection that was not
[49:37] submitted until after the Memphis Alcohol Commission,
[49:41] those are not on the record of appeal
[49:44] here, however those two homeowners did provide a letter
[49:48] saying they had no objection.
[49:51] >> Okay so the letters came after the ruling was made?
[49:59] >> Yes.
[50:00] >> Okay, that's interesting.
[50:03] >> Councilwoman you are recognized.
[50:09] >> So he's a new applicant you're saying came back has he
[50:12] been running the liquor store he renewing?
[50:15] Has he been in this liquor store is that the Applicant there?
[50:26] >> I believe he has been there but it's a new LLC that is being
[50:30] made under, so a different LLC was operating the prior liquor
[50:36] store.
[50:37] >> But he has been running this liquor store?
[50:45] >> I'm sorry?
[50:48] >> You said this was a new LLC, so he has two letters from
[50:54] the resident, I'm looking at some stuff from his two letters
[50:58] already from residents and they're okay with it?
[51:02] Did you say that?
[51:04] Fahmym yes there were letters after which is not part
[51:10] of the record of appeal, but it is a letter of the owners from
[51:14] the two homes that are within 200ft of this proposed location,
[51:19] the owners of those two homes do not have an objection is what
[51:23] the letter says fourth.
[51:25] Is there --
[51:32] >> So you all brought this before us to make a decision
[51:35] when he's already in the liquor store running the liquor store
[51:38] Kwamek was he already in the liquor store running the liquor
[51:42] store Kyantech
[51:47] >> If I could come forward to address the council.
[51:55] >> Let me see if I can bring some --
[51:57] I think the proper protocol for them
[52:01] to make their case first and then ask your questions,
[52:04] same way we would do in any zoning case,
[52:08] we receive the report from the staff,
[52:11] then the applicant will be held in presents their case
[52:16] and then you ask your question to that person.
[52:20] This person just giving you a status update.
[52:26] The hold your power until after.
[52:30] >> Hold my power?
[52:31] Okay I'll hold my power.
[52:34] >> I'm with Quinn Silica LLC which is the current palette
[52:37] in this story is a lot more detailed than what has been
[52:40] represented by the board, this appeal represents a very simple
[52:45] but very interesting in June of 2023 approved the location
[52:50] as 4565 so on June of 2023 shortcut to it I'm assuming you
[52:57] guys have the brief that has been filed they sent
[53:00] for the board game and the record can be comprised of what
[53:03] this board decides,
[53:05] out what they decide based on what I've been provided so we
[53:08] submitted the documents and our prior to the record should be
[53:11] submitted to the council and making a determination as set
[53:15] forward in the briefing of the file on June 23rd,
[53:18] or June 13th 2023 they applied for a permit come among
[53:25] the documents that have been submitted there is a survey
[53:28] in the very last page of that survey it was exhibit one
[53:33] to exhibit A to our documents as a canvas survey ,
[53:41] from Campbell's survey company that document says
[53:44] there's a reference that there is no residence within a 200
[53:47] foot radius.
[53:49] Exhibit two to our documents are the minutes from the alcohol
[53:55] board meeting on June of 2025.
[53:57] As set forth in those meeting minutes on June 21st of 2025 is
[54:03] the item number five on page two of commercial or Po moved
[54:07] and the mail recommend approval and a seconded and the motion
[54:13] passed.
[54:13] So on June 21st 2023 the board from the same survey that
[54:19] we're going to hear about in a minute basically approved
[54:22] and recommended that it be issued,
[54:25] the exhibit three to our documents is in fact that
[54:29] compliance.
[54:31] 2023.
[54:33] So it's subsequently obtained a license from the Beverage
[54:39] Commission and began lawfully operating a retail liquor
[54:43] store at this location that is an issue.
[54:47] Ran from July 1st until 2023 until October 22nd 2025.
[54:53] What happened that day?
[54:54] That was the day the state sent him
[54:57] a letter saying that his license had
[54:59] expired for failure to renew.
[55:01] That occurred on October 22nd and set forth the declaration
[55:05] of this appeal within days of receiving the notice comment
[55:10] they reapplied for a new permit.
[55:12] They didn't try to get grandfathered in they
[55:16] applied for a new permit.
[55:19] And there's a copy of that application signed in 2025,
[55:23] the third page of this application
[55:24] includes a new survey from Campbell.
[55:26] And as you can see the survey from Campbell on the 2025
[55:31] application is identical to the one that
[55:34] was approved and submitted with the June 2023 application come
[55:38] the same survey from Campbell.
[55:40] Same location same residence, same diagrams,
[55:44] same wording pretty much at some point subsequent to October 27th
[55:50] it is that they received a second permit section from
[55:55] Engineer David Bray that is labeled exhibit six
[55:58] to the documents that had been presented in our brief from like
[56:02] the survey from Campbell it references the fact that there
[56:07] are no residences within the 200 foot radius.
[56:10] Based on this information and the November to Quinoline liquor
[56:19] at that point at the November meeting
[56:22] assume that it would get approved
[56:26] since the documentation was the same as had been presented
[56:29] in June of 2023 which was approved,
[56:33] neither the candle or Brie survey
[56:35] showed that the approves location
[56:38] it had not been moved or altered the distances were the same.
[56:43] So not only had nothing changed with the surrounding premises
[56:47] but the new application relied on the same survey,
[56:51] and same use.
[56:52] Since it's enacted in 1985 section 4-5 of the Code
[56:57] of Ordinance was in effect on both dates that the applications
[57:01] were applied in both June of 2023 and October of 2025.
[57:08] For the same location in 2023.
[57:12] The Alcohol Board reach an exact opposite conclusion
[57:16] of both November of 2025 when rejected the October 2025
[57:21] location.
[57:22] And the Queensland Library reopened so Queensland Liquor
[57:27] retain the underside com I applied at the January hearing
[57:33] which is the appellate and as previously stated
[57:39] it was objected for the same reason
[57:41] as before that it is a violation of the 200 foot radius.
[57:45] Which of these actions are arbitrary appreciation
[57:51] they were arbitrary because they lack direct log.
[57:57] And regarding the right to operate a liquor
[58:03] store at this location whether it may be questions
[58:05] over the precise standard of the board that is not in the rules
[58:09] by the way there is no standard that they must comply
[58:12] with administrative bodies are not
[58:14] free to apply the rule one way in 2023
[58:17] and a completely different way in 2025 without explanation.
[58:21] And a applies standard rules consistently
[58:24] and reliably so conclusions based on identical facts
[58:28] without explanation.
[58:29] Simply put the alcohol board must be consistent.
[58:32] It's not only good practice but required
[58:36] by the law because of these the arbitrary and capricious
[58:40] the board should be reversed.
[58:43] In addition to the lack of consistency in these decisions
[58:46] the board the doctrine of equitable stoppable
[58:50] I don't necessarily believe in this thing
[58:54] but it would apply in this case.
[58:57] The government body takes affirmative action
[58:59] in a private party reasonably applies to its detriment.
[59:06] In the case of Queensland Liquor they relied on the June 2023
[59:10] in a very real way.
[59:13] Entered into a long term lease and began operating a business
[59:17] at this location pretty much the affidavit of the landlord is
[59:21] also attached to the materials as exhibit C and a court of that
[59:27] affidavit from our declaration Queensland has not been able
[59:32] to operate since October of 2025 like cannot operate
[59:39] at the facility the landlord will have no right to evict them
[59:44] and will incur costs doing so so basically I would both argue are
[59:51] satisfied we move action by the Commission approval in the 2023
[59:55] action in a recommending issue of Certificate of Compliance
[59:58] and I think it's important that this was not a silent action
[1:00:02] to the contrary of express determination of June of 2023
[1:00:07] the board that it applied with section 4.5.
[1:00:11] Don't you want dashboard alliance of a long term lease
[1:00:16] invested money in the store combined more importantly based
[1:00:19] on the decision of the board since 2025
[1:00:22] has been unable to operate his business
[1:00:25] and faces potential eviction and significant financial loss.
[1:00:28] Points line with never agree to the the financial obligation
[1:00:34] if it had not been approved for a license in June of 2023.
[1:00:39] For reasons not answered there strictly requiring underfoot
[1:00:44] in a way that can produce its own in 2023.
[1:00:50] Because these facts represent the exact type
[1:00:53] of detrimental alliance of the event it should be equitable
[1:00:57] and stopped at reversing its position.
[1:01:00] Yet another reason for reversal is
[1:01:04] what appears to be the board's newfound strict
[1:01:06] and technical enforcement annual interpretation of section 4.5.
[1:01:12] Exhibit D to the brief isn't a declaration from David..
[1:01:16] Is an individual that submitted the October 2025 survey and he
[1:01:22] is opined regarding that survey stating among other things that
[1:01:26] there are two parcels, 1457C on the road and one at 14561
[1:01:32] and there are photographs attached to that that show
[1:01:37] a little bit of the set of those parts those.
[1:01:42] But basically what Mr. Gray is opined
[1:01:45] in its declaration among other things
[1:01:47] is that the property is seven feet inside the 200 foot
[1:01:52] radius while the C L foot and the physical separation
[1:01:57] between the store and see our road separate
[1:02:00] the properties as a functional equivalent
[1:02:02] of a radius restriction.
[1:02:04] And the intent purpose of 4.5 and the mitigation
[1:02:09] of any adverse impact on any residential uses
[1:02:12] is satisfied under the existing conditions.
[1:02:16] Basically the way rear of these homes face the shopping center
[1:02:20] and they can't even see each other these two parcels.
[1:02:23] For those reasons Mr. Broker says that the plots
[1:02:28] have been reached.
[1:02:29] Lays the board denial is an obligation of the 200 foot rule
[1:02:35] and the statutes and ordinances that are consistent with
[1:02:40] legislative intent and not technicalities paramedical
[1:02:44] section 4.5 was enacted in 1985 it's maintained distance between
[1:02:53] residences, parks, schools, churches, etc..
[1:02:59] There's also evidence that other similar situated businesses
[1:03:04] are currently operating in violation of sections 1.5
[1:03:08] that the board is now strictly applying against this client.
[1:03:14] This selective enforcement in a particular of a case like this
[1:03:18] when it was previously approved under identical circumstances
[1:03:22] same situation further underscores the arbitration
[1:03:26] of the board's decision.
[1:03:28] The final reason frankly is set forth in E
[1:03:34] to the materials which is support
[1:03:36] from the local community.
[1:03:38] Both residences have no objection
[1:03:41] to the parcel being utilized as a retail liquor store
[1:03:44] as it had been and there's a petition as well for support.
[1:03:49] For all these reasons Queenslander
[1:03:51] requested the decision of the board
[1:03:54] denied the recommendation be reversed
[1:03:58] and the additional compliance Board the Ternatively
[1:04:04] that such--
[1:04:10] >> Thank you we have another councilperson in the queue.
[1:04:14] >> Thank you chair thank you so much for the presentation I just
[1:04:17] want to make sure I understand your points so are you saying
[1:04:23] that basically your client petition for a liquor store was
[1:04:28] granted a liquor store later had to reapply for the liquor store
[1:04:33] and was denied because it violated a law and now
[1:04:38] they're here to ask if they could come in if we could
[1:04:42] approve it because of the technicality initially
[1:04:46] or the oversight when they applied initially but they are
[1:04:50] within 200ft of homes where whether there's one coming
[1:04:55] to come a 3 or 50 coming is that what you submit?
[1:05:01] I'm just trying to understand is that what you're saying?
[1:05:05] >> In June of 2023 the board approved of the location to run
[1:05:11] a liquor store--
[1:05:16] >> So they had to reapply and now you all are coming here
[1:05:20] to help us determine whether or not that should be appealed.
[1:05:23] I'm just trying to understand is that what you're submitting.
[1:05:28] >> The law has been since 1985.
[1:05:32] >> I'm just trying to understand got my user I just need to know
[1:05:38] the facts because you were going through a long process and I
[1:05:41] need to understand I appreciate you clarifying, thank you.
[1:05:47] >> The same law was ineffective June of 2023 as it is today.
[1:05:52] >> Floor was ineffective for whatever reason they
[1:05:55] didn't abide by the law but those comments was still yes
[1:05:59] that we follow the rules of law to protect neighborhoods
[1:06:04] commerce schools for my children my family so I just want to make
[1:06:08] sure I understood what you were asking so I can vote
[1:06:11] accordingly.
[1:06:21] >> Yes Ma'am thank you.
[1:06:37] >> If you state your name and then you can proceed.
[1:06:46] >> Martinez Gomez said they broke down a procedure
[1:06:49] by the law let me tell you something about this
[1:06:54] court's number two, that I know personally,
[1:06:57] that people don't know but it doesn't make the news,
[1:07:01] that doesn't get justified or talked about.
[1:07:03] Since I met this young man they've
[1:07:05] done a lot for their careers.
[1:07:07] Gang wars have got my young men who do not have home were
[1:07:13] employed by the city of Memphis to talk to Paul Young about
[1:07:18] these they were around his store with guns Thomas over to talk
[1:07:23] about it we keep it 1000, operate from the first name
[1:07:29] and by closing the store the store being closed I've got it
[1:07:34] from .
[1:07:39] He helped people.
[1:07:40] Not a bad person come on give him the shirt off my back.
[1:07:44] I had a lot to do today could have been a whole lot of places.
[1:07:48] And I chose to come up in here because when I heard from him
[1:07:52] he helped someone else.
[1:07:54] That's more than some people in the city of Memphis
[1:07:58] do that have been here their whole life.
[1:08:00] You want to talk about it come on let's talk about it.
[1:08:03] He's a good dude.
[1:08:05] Anyone who knows me personally knows I don't come in grandma
[1:08:11] but when it's time to speak up and it's
[1:08:15] going to help the community and start of tear down I'm
[1:08:20] going to speak up for my I know mission we all know vendetta.
[1:08:28] Will let God deal with it.
[1:08:30] But they know why they have a problem with this man?
[1:08:33] I don't want to say the money is a ruler of all evil villain
[1:08:38] someone has a good word they float.
[1:08:42] Enjoy the rest of your evening.
[1:08:49] >> And now you're recognized.
[1:08:52] >> In a case like this I had I struggle with cases like this is
[1:09:00] that at one point this location was legal common was not I
[1:09:06] don't know how he is up on Shirley when we know that other
[1:09:12] stores are in violation of the same?
[1:09:14] I don't know how we arbitrarily pick and choose ,
[1:09:19] I would like to hear from come after our colleagues have spoken
[1:09:24] I would like to hear from our attorney about this matter.
[1:09:29] >> Okay Councilwoman Walker.
[1:09:38] And then we'll go to.
[1:09:40] >> Madam chair so depending on what our attorney says I would
[1:09:47] like to support this business being able to reopen come I
[1:09:55] don't know what that looks like look forward to hearing what
[1:10:03] attorney Wade has to share.
[1:10:06] Thank you.
[1:10:12] >> Attorney Wade and then I'll come back to you Councilwoman
[1:10:15] okay go ahead Councilwoman Kramer
[1:10:27] --.
[1:10:28] >> Sitting here listening to this and missing parts I know
[1:10:30] this law has been in place since 1968 and for my understanding
[1:10:33] the survey has been done and it is within I'm with you I
[1:10:44] don't know how but however take care that you have been
[1:10:52] supporting the community to hear that and I can't verify any
[1:11:03] of that and no one has the-- to hear that you have been
[1:11:10] supporting the community and been intervening for gangs
[1:11:14] or shootings come on we know how prevalent that is coming
[1:11:18] in so I'm gonna say this.
[1:11:22] I'm gonna say I'm gonna support you.
[1:11:24] I'm gonna support you.
[1:11:26] I'm going to support it.
[1:11:30] Because it should have been done right at the beginning
[1:11:34] and then you bring it here before us and you put us
[1:11:38] in the position comment and if you got these voices
[1:11:42] they can't do their to do their job just.
[1:11:47] And then let everything come to us if you the final decision.
[1:11:53] I don't know if this is taking food out of his mouth
[1:11:56] and I don't know that but I know this,
[1:12:01] there's a dead cat on somewhere and there's a big gap somewhere
[1:12:14] It should be before us.
[1:12:32] >> Councilwoman Logan you.
[1:12:34] I just want to make it clear I don't know anyone they own part
[1:12:39] of this other than the case that is before us that I've heard it
[1:12:43] said how do we pick and choose we shouldn't pick and choose we
[1:12:47] just follow the law so we're following a lot of should always
[1:12:54] be what we do to discuss to get together if we should start
[1:13:01] a nonprofit for the work that he's doing in the community be
[1:13:06] a part of speaking to us about how to help people but in terms
[1:13:12] of the cases before us it is to protect the homes in the area
[1:13:19] come with the churches and the schools in the area come
[1:13:22] in the young
[1:13:22] people who are subjected to what sometimes happens at liquor
[1:13:26] stores we're Talking about the case at the moment what stores
[1:13:31] that I will contact things like that your insurance out
[1:13:36] on the street playing on their bike and we have things
[1:13:41] happening and wrong things happening you have to think
[1:13:44] about that as well not just the person before us and the owner
[1:13:47] but the homeowners the neighborhood we have to take it
[1:13:55] all under consideration and that's why considering
[1:13:57] the neighborhoods and the people involved I don't know the person
[1:14:01] and I wanted to make that very clear that I'm just basing it
[1:14:06] on the wall and in the books because we should not be picking
[1:14:10] and choosing
[1:14:10] we should be following the law.
[1:14:19] Thank you Madam Chair I do have a question
[1:14:23] I want to ask the attorney just to clarify I think for all of us
[1:14:28] this is frustrating to me because it appears to me
[1:14:32] that they had a license and had a license for a long time
[1:14:37] but they never should have.
[1:14:39] Is that correct?
[1:14:42] We're not supposed to enter capacity
[1:14:45] do think about that pretty much is my understanding coming right
[1:14:49] Kaitlyn Based on the laws that exist
[1:14:58] today they shouldn't be there.
[1:15:00] I guess for me I'm frustrated of how did they
[1:15:02] get a permit in the first place I
[1:15:05] don't know I'm looking for alcohol commission
[1:15:07] how did they get a permit in the first place comment
[1:15:11] I don't know if that's an answerable question
[1:15:15] comment that's frustrating to me because I want to support this
[1:15:19] but I feel like I can't comment so I'm not
[1:15:23] going to because we have to abide by what the law says
[1:15:26] and that's frustrating and I want
[1:15:27] to share that with the body to say that on the record.
[1:15:30] My question is how did they get a permit in the first place?
[1:15:43] >> Are you ready for me confirming
[1:15:44] >> I've tried to be agnostic about all of this
[1:15:48] and I'm feeling kind of confused by the case comment there is
[1:15:55] a limit of 173 liquor stores that can be allowed to operate
[1:16:01] within the city.
[1:16:03] This distance requirement dates back to 1950 Franklin County
[1:16:09] used to say it couldn't be in close proximity of schools
[1:16:16] churches liquor stores and then it was amended in the 67th code
[1:16:24] to be more specific to be a 1500 foot restriction between
[1:16:31] schools, liquor stores come at churches and then it had
[1:16:35] a residential component that it couldn't be more than a 200 foot
[1:16:38] radius of certain residential districts come in 2023 I believe
[1:16:52] the UDC changed the names of those districts
[1:16:55] but the substance was the same and we amended the ordinance
[1:16:58] to change the names and the name of those zoning districts
[1:17:03] but they are essentially the same.
[1:17:07] And R6 is one of them.
[1:17:08] I think that is a small district size homes within a district.
[1:17:17] In the 50 it went to court and the code
[1:17:26] was written so that you had to have approval of the city
[1:17:33] commissioner.
[1:17:34] The city commission at that time was
[1:17:36] the mayor in the commissioners there
[1:17:41] were five of them in the air and the commissioners
[1:17:44] were in the same body there wasn't a separate council
[1:17:48] so when we went to Home Rule we separated those things
[1:17:52] but we never changed the language
[1:17:55] that said that the commission had to approve it.
[1:17:58] And in certain iterations of the code since 67
[1:18:02] it seems to require the mayor and the council
[1:18:07] to approve the location the commission doesn't approve
[1:18:17] anything there like the language like the powers that
[1:18:20] be to make a decision and that power to be it
[1:18:24] was for commissioners under one name
[1:18:26] and now it has been separated and there are some uncertainty
[1:18:31] in our language, but the cause this appeal thing was in the I
[1:18:37] think that we deferred to the mayor
[1:18:40] to make the decision unless someone appealed to it
[1:18:43] and then you had to concur with them,
[1:18:46] that is where we are today.
[1:18:49] Now, there's another step that the applicant can change
[1:18:59] to caught in the law says he has to go to change the court
[1:19:04] so that's how the hierarchy works.
[1:19:09] What your job is is to determine, and interpret the law
[1:19:15] and determine does it comply.
[1:19:18] All these things about inputting and will somebody
[1:19:23] else approved it last time, they were wrong in this
[1:19:28] and as council Logan pointed out directly it was an oversight.
[1:19:33] It was people make mistakes, government makes mistakes.
[1:19:37] That does not create an unstoppable contrary
[1:19:41] to what that gentleman told you where he has the ability to read
[1:19:44] the law just like you do.
[1:19:47] And that's what 11 B says is that it has to be something that
[1:19:56] he himself , the argument is the question is does it violate
[1:20:04] the language of the laws, the ordinance has no equity
[1:20:09] in income it has no discretion, this is a non-discretionary
[1:20:13] viewpoint your mechanism in cases that needs to be made
[1:20:17] the requirements we are required to approve the, if you
[1:20:22] don't come away or not we do not have the discretion to pick
[1:20:26] and choose as Councilwoman Espinosa says go to interpret
[1:20:33] the law and apply to the circumstances and if it
[1:20:37] doesn't apply your duty is to slow it down if it does apply
[1:20:42] then your duty is to roll it up.
[1:20:45] And then he can take equitable arguments elsewhere.
[1:20:48] The question was how did this happen can you --?
[1:20:59] We know of 6 or 7 instances where the Alcohol commission
[1:21:04] was stuck, habits.
[1:21:06] They are an engineer.
[1:21:08] We don't give them the equipment that we
[1:21:13] give our PD from our land use control stuff
[1:21:16] those guys are experts.
[1:21:18] They read surveys come and they know
[1:21:21] how if this thing had gone to them
[1:21:23] you would have had a rejection bam just like that.
[1:21:28] Because they are experts.
[1:21:30] These guys miss the ball.
[1:21:38] Orlando with liquor stores that shouldn't be there.
[1:21:41] That's one example of how this happens another example is
[1:21:46] these people that release these Don't have to check it out
[1:22:00] when they get approved, they should go to jail.
[1:22:04] That's how that happens.
[1:22:05] So just because someone has a license doesn't give them
[1:22:14] you have to apply the law, that's
[1:22:20] another word, this is a prime example can be corrected,
[1:22:26] is going to have the entire system
[1:22:29] to do that these are the two, new if the city wants to review
[1:22:39] all of them they can go and say you don't the same thing come
[1:22:44] on just tell them that your job is done because if you don't it
[1:22:51] goes to change for the Chancellor
[1:22:53] I said you have to adjust your interpretation from the.
[1:23:04] So just giving you the requirements and the sheet
[1:23:13] if you answered no then it doesn't comply.
[1:23:18] So.
[1:23:19] And I'm not trying to be punitive to this guy come
[1:23:24] you're just going for the citizens can't wait for them
[1:23:31] come what are you here for if they can play
[1:23:34] for us that's the way it is.
[1:23:41] You have to do the duty that's just
[1:23:44] my humble opinion I know that's adverse possibly
[1:23:48] of the arguments that he's making about equity
[1:23:54] in discriminatory treatment company
[1:23:57] can make those to a court, that's my humble opinion.
[1:24:04] Amen thank you attorney we
[1:24:12] >> Thank you attorney wade.
[1:24:18] And then the railyard was in violation
[1:24:23] they got approved they got approval there's some type of I
[1:24:35] don't know finer penalty that's what you may need to think of.
[1:24:46] >> You made a good point we don't let used car salesman
[1:24:49] operate near residential neighborhoods can we have one
[1:24:54] district where they just have a sell their cars.
[1:24:57] With that apartment without anything and then we had to shut
[1:25:00] it down they sued us and lost because they weren't following
[1:25:04] the law given so this is a liquor store but it could happen
[1:25:09] at gas stations it could happen at car loans and they can have
[1:25:13] to salvage it make it happen a lot of things so where are you
[1:25:17] going to draw the for you to follow the law across the board
[1:25:22] or Grant used to someone who quite frankly I understand is
[1:25:28] uneasiness because he was allowed to go home when they
[1:25:32] come have a he allowed his license to expire pages were up
[1:25:37] and when it comes to you and you have to make a
[1:25:41] decision.
[1:25:46] Fahmym all right so yes it's proof the appeal?
[1:25:54] And I know is to go against the appeal.
[1:26:02] Can you please peel the screen so yes
[1:26:08] as to approve it come in and no is to remove it, right?
[1:26:20] Okay this is the way it should work,
[1:26:24] somebody should move to approve the appeal and then
[1:26:28] the vote yes on both appeal and vote no or not if he would allow
[1:26:36] him to operate, a yes vote would say he applies with the statue
[1:26:44] and no vote would say he does not all right are
[1:26:51] we ready for a motion?
[1:26:56] If I cancel on the green ready for the vote.
[1:27:08] Are you making a motion to--?
[1:27:15] Yes they are 413 I'm going to , this is a motion to approve
[1:27:22] the appeal.
[1:27:24] And I'll be voting no.
[1:27:34] I don't like voting no for the record at all, but I am, --.
[1:28:01] Councilwoman forman doesn't have the screen.
[1:28:23] Carlisle 40s, Mama >> Please show who is voting yes on this
[1:28:49] item.
[1:28:49] Please show Councilwoman Canali as an extension
[1:29:01] >> That item failed.
[1:29:02] Madam controller if you recall item number 18.
[1:29:13] >> Item number 18 is a resolution to improve interlocal
[1:29:16] agreement between the city of Memphis and the Memphis Area
[1:29:22] transit this resolution is sponsored by the administration
[1:29:26] and there is a request
[1:29:35] >> You were recognize.
[1:29:40] >> No recommendations has been moved forward by Councilwoman
[1:29:54] and Madam controller if you would please prepare the screen.
[1:30:08] Council members please cast your votes. >> Nala yes,
[1:30:39] Sutton yes please show Council Spinoza
[1:30:47] is yes on this item and chairwoman.
[1:30:55] >> That one passes and the Division of Planning
[1:30:57] and Development.
[1:31:10] >> Item number three is a resolution for 7-6
[1:31:12] of the Memphis and Shelby County Building code approving a plan
[1:31:17] development in the subject of zero Ikea with this resolution
[1:31:22] is sponsored by the Division of Planning and Development as p d
[1:31:28] 20 601
[1:31:36] >> Thank you you are recognized.
[1:31:43] >> We set this down without a recommendation so we would like

[1:52:41] >> Yes Ma'am.
[1:52:48] >> Madam controller for you please put the time
[1:52:50] on the screen.
[1:52:52] >> Yes good evening to you all I operate scooters barbecue food
[1:53:00] truck vending and I would like to speak with you all I got
[1:53:05] a couple of questions I got an invite and then I would like
[1:53:08] to get an invite from you all and the committee the thing
[1:53:13] about the food truck business first of all I wanted to let you
[1:53:18] guys know that I knew your predecessors about 15 years ago
[1:53:22] passed this ordinance it was about 15 years ago around this
[1:53:26] time I'm very proud of that that I got one of the first food
[1:53:30] truck permits when it was passed.
[1:53:32] I've been operating for quite a while I
[1:53:35] have some concerns about what the ordinance is today.
[1:53:44] What's the as of right now the ordinance
[1:53:50] I was presented with a copy of an ordinance
[1:53:54] from a city official while I was operating
[1:53:57] and it had a lot of red lines in it
[1:54:00] and I would think that is not an ordinance.
[1:54:02] I had my original copy from 2011 and it
[1:54:08] has a signature on it I have heard of and reached out
[1:54:14] to different council people and even the mayor
[1:54:21] but there's a little confusion in the ordinance
[1:54:26] and also I would like to know about there's some new food
[1:54:30] rules that are posted that it seems
[1:54:33] as if the ordinance dictates where food trucks can operate
[1:54:37] and I was wondering why do we need signs to say that we can't
[1:54:42] operate on the streets and I'm talking about in the downtown
[1:54:45] area.
[1:54:45] It's a lot to try and unpack in two minutes
[1:54:49] but I would really like to speak with you all more on the subject
[1:54:56] if possible.
[1:54:57] And get some clarity.
[1:55:03] Council Member Smiley you were recognized.
[1:55:06] So you want a copy of the?
[1:55:12] >> I have a copy but my copy is this.
[1:55:14] And then I have on the phone line
[1:55:17] the latest version that had been updated
[1:55:20] and I hadn't been a minute or anything by the council other
[1:55:23] than some suppression stuff came out.
[1:55:28] But even with like you all had to be 50ft from a restaurant
[1:55:34] in the downtown Memphis area it says 300ft I was presented with
[1:55:40] this copy right here from someone come in it says--
[1:55:53] >> Will get you information and make sure you have clarity on it
[1:55:56] >> Yeah we're gonna get you information on it if you have
[1:55:58] any questions you can get it to me.
[1:56:03] >> This is Mrs. Keith here.
[1:56:06] >> I just want to say this to Mr.
[1:56:09] Zena can you raise your hand?
[1:56:12] Turn around come by that guy right there
[1:56:17] and I have had several conversations
[1:56:20] about food truck and the zoning.
[1:56:24] And he is the expert that we would all
[1:56:27] ask I'm going to recommend that you reach out to him
[1:56:33] he works for Mayor Harris and he I'm sure
[1:56:36] he has a business card on him and he'd
[1:56:38] be happy to answer your questions come in
[1:56:41] if not you can reach out to cancel and Smiley
[1:56:45] or myself and we will get withdrawn
[1:56:48] Zainab with your concerns.
[1:56:52] >> Okay.
[1:56:54] >> Okay he's going to get your information thank you sir.
[1:56:59] >> Thank you.
[1:57:06] >> Johnson .
[1:57:21] Please state your name .
[1:57:27] >> And through 1 p.m.
[1:57:29] I received from Veronica Cooper that
[1:57:33] is the majority of judges they were relieving me
[1:57:36] from my duties.
[1:57:37] On April 8th I received a signed letter from Mayor Young removing
[1:57:42] me from the position of City Court Clerk.
[1:57:45] The city charter states that I have
[1:57:48] ten days to appeal to Council the final determination.
[1:57:52] On April 8th I sent my appeal request and council to be
[1:57:57] a certified mail on my end via email with the inclusion of HR
[1:58:01] compliance come on April 9th I received another letter from
[1:58:05] at this time the letter was from George Veronica Cooper
[1:58:08] and stating that they asked the majority of City Court judges
[1:58:14] were removing me from the position of City Court clerk
[1:58:18] and I have witnessed an employee also appointed received
[1:58:22] the administrative leave with pay for more than a year without
[1:58:26] being removed, so I can not understand the urgency to remove
[1:58:31] me without cause.
[1:58:33] Today I am here to put on the record
[1:58:36] that I am still requesting to appeal as the termination was
[1:58:41] wrongful.
[1:58:42] I look forward to appearing before this board
[1:58:46] to defend my name, character, and right to return
[1:58:51] to serving the city as serving as court clerk.
[1:58:57] >> Thank you Miss Johnson.
[1:59:13] >> Miss Johnson you will be allowed to write to have
[1:59:16] the appeal process.
[1:59:17] You will be notified.
[1:59:25] Okay all right thank you for coming
[1:59:28] in we will now have (Indistinct) can do thumbs up
[1:59:41] or thumbs down please.
[1:59:44] >> My name is Amber Sherman we have a policing problem
[1:59:49] in Memphis and it's really annoying to me that unless
[1:59:52] someone is killed the people make noise about police officers
[1:59:57] being violent we get an answer there multiple orders of plus
[2:00:02] that have sent a list of demands asking for basic information
[2:00:05] like the officer's names who are pepper spraying people
[2:00:09] and tossing them to the ground who are tossing him
[2:00:11] to the ground after necessarily I was still have got no answers.
[2:00:17] The police officers are public employees
[2:00:19] of the city they don't get to hide and disappear
[2:00:22] when they do violent things pretty much people in Memphis
[2:00:25] should know that the people they attack folks
[2:00:28] in the middle of the street who are almost on the sidewalk that
[2:00:32] have done almost nothing wrong because they need
[2:00:36] excellent in raising voices about issues they
[2:00:40] don't care that they're doing that they just want
[2:00:42] to be in control of the moment.
[2:00:44] Anytime we had a protest it became violent
[2:00:47] because of the police coming there are multiple council
[2:00:51] members that were there at the protest that saw what happened.
[2:00:54] Smiley had release folks from being arrested
[2:00:59] that were unjustly arrested because the police were
[2:01:02] in the wrong room hands getting the body to do the right thing
[2:01:05] and answer the questions we're asking I was at the Public
[2:01:08] Safety Committee this morning the police chief wasn't there
[2:01:11] no one was asking him the questions
[2:01:13] we were wondering around with the officers are why they fired
[2:01:16] are they going to snatch their pensions solely paid
[2:01:20] or unpaid coming there's four officers
[2:01:22] but I say about 23 pictures out here I don't know where
[2:01:26] the other officers came why are they still on duty
[2:01:30] and have access when they get hurt or killed for no reason.
[2:01:35] We don't have time for you guys to pretend you're not sure what
[2:01:38] happened because nobody died how many people were traumatized
[2:01:42] they were hurt they were jailed they lost time from work they
[2:01:45] had to go to court are you guys going to pay their court costs
[2:01:48] and fees can you make we need answers now. -- fees?
[2:01:58] We need answers now.
[2:02:01] >> Thank you, Abraham.
[2:02:12] >> Hello LJ Abraham I'm quite disheartened to be back here
[2:02:15] about three years after you guys approved ordinances from police
[2:02:21] violence in the city.
[2:02:23] Furthermore the fact that MPD was as violent
[2:02:27] as they were in front of news cameras come in front of people
[2:02:31] who were recording in front of children in front
[2:02:34] of elderly people come also breaks my heart
[2:02:36] but it makes me wonder what happened
[2:02:38] to Daniel Mmaxwell during the traffic stop
[2:02:40] because there were no cameras there to catch that.
[2:02:44] We've been requesting the release of the video which
[2:02:46] we were told wouldn't be released because it's still
[2:02:49] under investigation.
[2:02:50] So, in that I'm asking for it to be released because we know what
[2:02:55] happened to Tyrene Nichols gum I don't
[2:02:57] think I need to remind you while I was here for that you all
[2:03:00] were here for that.
[2:03:02] I just want to know why we continue
[2:03:04] to allow CJ Davis to oversee this police force if she
[2:03:08] is already set out her face that they have a culture problem.
[2:03:12] When she was reappointed as police chief all of you
[2:03:16] voted unanimously to keep her even
[2:03:18] though you guys knew yourself that she was a problem.
[2:03:21] She continues to be a problem kind of three years
[2:03:24] and we're still up here begging you guys to look into MPD
[2:03:27] to hold the mayor accountable, it's
[2:03:29] not fair to people who are at exercising their First Amendment
[2:03:34] rights to be violently attacked for simply doing what they're
[2:03:38] allowed to do.
[2:03:39] It was uncalled for it was aggressive it was violent,
[2:03:43] it was embarrassing it was harmful,
[2:03:45] again I need to remind you guys that the were children
[2:03:48] out there that had to witness this who will now believe
[2:03:51] that MPD is violent and I've been in contact with
[2:03:56] and they're also wondering what happened to him
[2:04:00] during the traffic stop that caused
[2:04:02] him to have to defend himself it's not fair
[2:04:04] that we have to come up here and beg this body
[2:04:06] all the time to prevent police violence it is not
[2:04:09] our responsibility to keep tabs on them
[2:04:12] and find out who they are because CJ Davis aren't doing
[2:04:15] their jobs.
[2:04:25] >> Christine Fox.
[2:04:45] >> Christine Fox I'm here today to speak about the Memphis
[2:04:47] Police Department use of unnecessary and excessive force
[2:04:51] at the end of the no Kings March and there's young refusal
[2:04:55] to take meaningful steps to hold officers involved accountable.
[2:04:59] That was doing my best when I was
[2:05:02] in Texas attending to peaceful no Kings events while they
[2:05:08] watched what was happening here through a friend's social media
[2:05:11] sharing it in real time with people around me
[2:05:14] they were shocked and horrified from what
[2:05:18] we saw were police officers tagging spraying people
[2:05:23] in the face and close range with pepper spray on a brutalizing
[2:05:27] citizens and exercising their constitutional rights.
[2:05:31] What happened is not an isolated incident
[2:05:35] it is part of a documented pattern
[2:05:38] of unconstitutional policing in Memphis.
[2:05:41] If I had been here I would have been
[2:05:44] serving as a safety Marshal I would
[2:05:46] put on my orange vest locked arms with others
[2:05:52] and I would have been the target for the same violence inflicted
[2:05:57] on my friends.
[2:05:58] My mother was watching with me she
[2:06:01] knows what I do and she knows that next time it
[2:06:04] could be me thrown to the ground pepper sprayed
[2:06:07] brutalized by the very people sworn to protect us.
[2:06:10] She does not want to see her daughter harmed yet
[2:06:14] she knows that what I do come home
[2:06:17] you're doing one way to stand when we
[2:06:20] and speak out and stand against unchecked
[2:06:23] authority is absolutely critical and necessary in this moment.
[2:06:28] What are you going to do about what Marion Coleman City
[2:06:34] Council of making statements is not enough silence
[2:06:41] is not it a message that this behavior is
[2:06:46] acceptable Memphis deserves better we deserve better.
[2:06:51] Thank you.
[2:06:59] >> Alexa Pouncey .
[2:07:05] After miss Pouncey will have Jessica Miller.
[2:07:09] >> I Melissa Palacios last year about their police violence here
[2:07:18] in Memphis we really do have a lack of transparency with
[2:07:24] the police department and also citizens and we're really over
[2:07:29] it.
[2:07:29] And we're asking you guys to do your jobs
[2:07:32] and give us the transparency and accountability from CJ Davis
[2:07:38] and Mary Young for us as the citizens of Memphis.
[2:07:43] That's all to say.
[2:07:47] Thank you miss Allison Miller.
[2:07:53] Alice Miller here 38 Walker Avenue
[2:07:58] I gotta be a witness at this and this was the third case that
[2:08:03] happened nationally and all over the nation
[2:08:05] come up millions come as increased it every different
[2:08:10] no kings activity.
[2:08:13] It is exponentially standing up against the wannabe dictator
[2:08:18] that is what going on.
[2:08:20] Memphis was one of the only places that
[2:08:24] had violent action taken against people following their First
[2:08:29] Amendment rights it was despicable.
[2:08:31] People were clearing the road at the end
[2:08:34] of the thing no warnings were given as I've seen it
[2:08:37] many other protests coming none were given
[2:08:40] a were made women were tackled stand there comment
[2:08:48] last coming around were the elderly
[2:08:52] and those who had to walk slower come just
[2:08:56] got rid of her crutches and she was
[2:08:58] tackled to the ground kind of fortunately JB Smiley fought
[2:09:02] to have her release but it was ridiculous that she was tackling
[2:09:06] and she was saying I'm disabled and another woman friend of mine
[2:09:11] was watching and just absolutely in shock with what
[2:09:15] was happening to people.
[2:09:16] We're all coming back to be witness to this we had
[2:09:20] our cameras and she also was tackled and strong armed
[2:09:24] and pushed down she had to be coming so the violence that went
[2:09:30] on of Springer in the face of that person was wearing
[2:09:33] a vigilante signal coming on him as a police officer these kinds
[2:09:39] of things happening and it happened to be on the same day
[2:09:43] March 28th that the same thing had happened with my making down
[2:09:49] the same street that's when we lost that young 18 year old
[2:09:54] Larry Pinkham it could have happened again.
[2:09:57] He could have easily happened again
[2:09:59] and it will happen unless you all take these actions
[2:10:02] and with the demands made were reasonable follow
[2:10:05] those demands by the citizen and please have a backbone.
[2:10:09] Thank you.
[2:10:15] >> Jessica Miller.
[2:10:22] My name is Jessica Miller I'm one of the organizers that
[2:10:27] helped organize the No Kings protest I'm here
[2:10:31] to speak because I was part of the coalition of 27
[2:10:36] organizations that sent a letter to this body
[2:10:39] and who the mayor is as well we have still not gotten
[2:10:42] a response on that letter just wondering
[2:10:46] where the accountability is at.
[2:10:48] Because the only thing that was responded to
[2:10:50] was from this city body talking about the paperwork
[2:10:54] that was filed by myself for this event.
[2:10:58] I filed the paperwork and there could
[2:11:00] have been mistakes made but in PD then illegally leaked
[2:11:04] my information unredacted to NPA and posted it on Facebook
[2:11:11] so I have white nationalists sending me
[2:11:14] threats to my children at my home at this point.
[2:11:17] Do you all even know what the kindred Consent decree
[2:11:21] is can you make because that is a completely against it
[2:11:26] and I should be scared to file a permit for people
[2:11:29] to have First Amendment rights because I
[2:11:32] might be put in danger.
[2:11:33] I just don't understand with my time left I just
[2:11:38] want to ask when we write letters come in multiple letters
[2:11:41] that go unanswered when we come to state of the city meetings
[2:11:44] we're told that we're too loud and it's inappropriate,
[2:11:47] when we write emails they ignored coming when you showed
[2:11:51] up to city council meetings some council members
[2:11:54] don't want to speak it out.
[2:11:56] The same ones that got banned from the meetings
[2:11:59] before they were elected.
[2:12:01] When we marched in the streets we
[2:12:03] should have filed better paperwork so
[2:12:05] when something happens because people feel like they're not
[2:12:08] being heard and they're bleeding out in front of you
[2:12:11] and something else happens come on what are we going to do then
[2:12:14] can you make because people have got to be heard in this city
[2:12:17] for any kind of change to be made.
[2:12:26] >> Thank you Miss Miller.
[2:12:32] Marceliano.
[2:12:43] >> What did you say Kyantech --?
[2:12:50] >> My name is Leona Venezia I work as a public health official
[2:12:56] and Shelby County I have the pleasure to be able to speak
[2:12:59] to parents and children throughout the city to increase
[2:13:02] their health literacy come in I am now hearing parents tell me
[2:13:07] that they are afraid to let their children leave the house
[2:13:10] unsupervised they are not sure what to tell their children
[2:13:15] of what to do if something should happen while
[2:13:18] they're outside because having seen the footage of it violent
[2:13:24] response to peaceful protests they no longer trust the police
[2:13:29] to respond in an appropriate manner when it comes
[2:13:32] to their children.
[2:13:33] And so I really am hearing this and feeling
[2:13:38] very concerned for the people that I serve.
[2:13:41] And I want the city government to know
[2:13:44] that their response to this matter is.
[2:13:47] We are watching to see how you will respond
[2:13:50] come on we've made our demands known
[2:13:52] and we need to see accountability.
[2:13:55] If this administration is as concerned
[2:13:58] as it claims to be when it comes to addressing crime
[2:14:01] in the city of Memphis we need to be
[2:14:05] able to trust law enforcement to handle situations appropriately.
[2:14:09] If we cannot trust law enforcement there's absolutely
[2:14:13] no way in crime in this city.
[2:14:18] Again I must say please respond prioritize this
[2:14:26] as it needs to be prioritized come and thank you.
[2:14:41] >> Sean Pearson 38109 it has been three weeks since I heard
[2:15:04] the scream still echo in my dreams.
[2:15:07] A peaceful protest was full of love and spirit
[2:15:12] and it was a full unmedicated hormone
[2:15:17] the police department Marshall the elderly and children who
[2:15:22] marched at a slower pace were attacked it is not a crime
[2:15:29] to march for freedom for lack of procedure justice
[2:15:32] is by mothers and fathers were tackled to the ground
[2:15:36] and arrested Cavalier terrorized because there
[2:15:39] is a poor leadership that believes protesting is a right.
[2:15:43] Several police officers committed
[2:15:45] acts of violence grabbing ambushing
[2:15:48] countless toxic chemicals in our faces in our lungs
[2:15:52] this is violence against the humanity
[2:15:55] and the dignity of the people of Memphis.
[2:15:58] My own brother the representative
[2:16:00] of Tennessee District 87 was shoved pushed and assaulted.
[2:16:06] Instead of building a platform we need leadership
[2:16:12] that prioritizes people and also Memphis Police Department
[2:16:16] accountable let's talk about facts
[2:16:18] not fear we're standing in our First Amendment right
[2:16:22] and we realizing where is this energy for Elon Musk when he was
[2:16:26] breaking the law for you we got it incompetent judge
[2:16:30] well instead he got a cheerleader.
[2:16:33] We demand that the officers are relieved of duty
[2:16:36] and all footage is released and we get a clear timeline
[2:16:39] of accountability.
[2:16:40] Marching and protesting is not wrong
[2:16:45] as a part of our right to march against oppressive
[2:16:50] regimes even if that regime is led by your city's leadership.
[2:16:55] It is not a crime to march for justice.
[2:16:57] And we will not be intimidated for doing
[2:17:00] so as we know that the unconstitutional policing
[2:17:03] of the police department it has to end and it has to end now.
[2:17:11] >> Thank you Shirley Anderson.
[2:17:13] Shirley Anderson.
[2:17:20] All right after Shirley Anderson is Richard Massey.
[2:17:48] Are you ready? >> Yes Ma'am 62,000 views on my post I took
[2:18:04] all his and they called me everything except for child
[2:18:07] of God.
[2:18:10] I was hit by the claim black man from a black woman with the n
[2:18:18] a double CP that asked him to check on Mr. Maxwell
[2:18:22] because we know how tiring late in that hospital bed
[2:18:27] and all the evidence against him that they were coming up
[2:18:31] with if he's a correct coming he's on drugs,
[2:18:34] he wasn't on shit.
[2:18:36] Where is Mr. Maxwell?
[2:18:40] He was depending on me he doesn't live in Memphis
[2:18:45] they live in New Orleans they were washed here by the storm
[2:18:48] you and they got them again.
[2:18:52] They got the baby again got her on the job that don't nobody
[2:19:02] want.
[2:19:02] He wanted that job to work at 9:00 can you got a cop to all
[2:19:09] you gotta do is look at my page.
[2:19:11] I have every complaint that that police officer had on him.
[2:19:18] 67,000 views, don't play with me.
[2:19:24] Because I wouldn't put up an effort
[2:19:27] to find out what happened God damn it I need to know
[2:19:31] is Mr. Maxwell alive?
[2:19:34] That's what I want to know.
[2:19:36] Is he dead?
[2:19:37] Or is he alive?
[2:19:40] Somebody gotta tell me. (Indistinct)
[2:19:53] and I want to know is my son alive or is he dead
[2:20:00] for human did they kill him?
[2:20:09] Why do we have to ask? (Indistinct) God damn it I be
[2:20:27] damned (Indistinct) .
[2:20:43] We want to know 67,000 views.
[2:20:50] >> Mrs. Massey thank you.
[2:20:54] >> Is he alive kwamek is he alive?
[2:21:07] >> Thank you.
[2:21:12] >> Mr. MacY come on up. >> (Indistinct) >> Yes Ma'am thank
[2:21:37] you so much for coming down? >> If you'll just state your name
[2:21:47] and then you can proceed as Richard Mason three weeks ago
[2:21:52] the committee members are missing the list of demands I
[2:21:55] would hold these rogue officers accountable with Memphis Police
[2:22:00] Department those demands include publicly identifying officers
[2:22:03] and disclosing the procedure that led to this violence
[2:22:07] and confirmation that all the footage from this incident has
[2:22:10] been preserved.
[2:22:27] >> Just give her a couple more seconds okay go ahead.
[2:22:30] >> Okay so the members came through the body the list
[2:22:33] of demands that established accountability within
[2:22:36] the Memphis Police Department.
[2:22:38] Those demands include disclosing the decision
[2:22:42] that all the violence from this incident
[2:22:45] has been preserved unclear timeline
[2:22:47] for an independent investigation outside of MPD
[2:22:50] and publicly identifying the officers involved
[2:22:53] in the violence that unfolded.
[2:22:55] 58 years ago March 28th of 1968 Doctor Martin Luther King Jr
[2:23:02] joined sanitation workers that boldly put it on the line
[2:23:06] the courageous march took a violent turn (Indistinct) where
[2:23:12] Memphis officers released canisters fast forward 58 years
[2:23:17] later on the same day on the same street
[2:23:20] the constitutionalize their right involving 8 million
[2:23:25] Americans only to be met with police officers some of whom
[2:23:30] bearing 3% badges which is an anti-immigrant anti organization
[2:23:36] with weapons violations and terrorist plots.
[2:23:41] The pepper spray terrorist marshals of Robert Archer's will
[2:23:45] violently deterring protesters in attendance one
[2:23:50] is Lucy channel is behind me.
[2:23:53] She broke two bones in her leg after helping elders
[2:23:57] during an ice storm when ice stormed our city.
[2:24:03] That she would be violently detained by four plus officers
[2:24:07] and intentionally contained before she even understood what
[2:24:12] she was being arrested for.
[2:24:13] These are the same practices that led to the MPD
[2:24:18] being under an investigation I find it ironic and ignorant
[2:24:22] that she had praise doctor King on the same date
[2:24:27] in the same protest that there are no kings
[2:24:31] but there is something you could do cancel
[2:24:33] and that is making those demands read your emails
[2:24:36] and meet the community where they are.
[2:24:38] Thank you.
[2:24:49] >> David Ray
[2:25:05] >> Number 3017 Fahmym I'm sorry I didn't get your name
[2:25:18] >> First article of our Constitution says verbatim
[2:25:21] the right of the people peaceably to assemble
[2:25:25] and to petition the government for a redress of grievances,
[2:25:31] noahh believe in our Constitution there are a lot
[2:25:36] of issues in this country a lot of difficult things that need
[2:25:40] fixed and they've been going back hundreds and hundreds
[2:25:43] of years, the Constitution says some good things and this is one
[2:25:50] of them.
[2:25:50] I believe in it so I volunteer without pay come on my own time
[2:25:59] to protect the people that assemble to let their government
[2:26:05] become a city, whatever their grievances , that is our right.
[2:26:16] So that no King three happens and I'm
[2:26:21] one of the folks that I got my vest on now I'm
[2:26:26] trying to protect the people knowing that there are dangers
[2:26:29] out there and they might be people in cars trying
[2:26:34] to hit them they might be counter-protesters they
[2:26:38] might be somebody on the roof with a gun they
[2:26:41] might be police officers.
[2:26:45] That's who attacked us that day coming up from the front,
[2:26:49] but from behind we didn't see him
[2:26:52] while we were doing everything we were asked to do
[2:26:55] and us marshals were just trying to slow things
[2:26:58] down so that those people who were in the back of the march
[2:27:02] could get to a place of safety.
[2:27:04] I was thrown down tackled from behind and tossed in a police
[2:27:09] cruiser , and checked out by an EMT and driven to 201 poplar
[2:27:20] and spent about 27 hours in there, that was difficult, okay?
[2:27:25] But look at me I'm a six foot four white guy.
[2:27:28] It's going to be difficult to do too much to make.
[2:27:32] There are plenty of other people that would be much much easier
[2:27:37] to hurt to suppress, so I do the difficult thing and I use
[2:27:42] my voice and my skin, I'm looking at you all ,
[2:27:51] there are a lot of difficult things that we need to do
[2:27:54] together and that's the only way we're going to make it out
[2:28:00] of this.
[2:28:01] I've seen a lot of easy things happen in the city council over
[2:28:06] this past year , I've seen a lot of difficult things not
[2:28:14] happening here Maguire we make it easy for these billionaires
[2:28:18] like Elon Musk to come in here and build what they want come
[2:28:22] on why are we making it easy for our mayor to ignore us,
[2:28:27] for all of our elected officials to ignore us.
[2:28:30] We the people are getting real tired of it.
[2:28:36] And we need all of y'all no matter what color you got
[2:28:40] on your skin to work with us because you all are people too.
[2:28:45] We elected y'all come in we can vote for somebody >> Thank you
[2:28:58] Councilwoman green you are recognized.
[2:29:00] >> I'm gonna wait till all the comments are done.
[2:29:07] >> Okay, Brandi price.
[2:29:08] You are recognized.
[2:29:22] Brandi price Emily Pearson.
[2:29:43] >> My name is Brandi Price I have come to tell you that
[2:29:46] the people of Memphis are living in fear from it average everyday
[2:29:50] people are afraid to come and out of crime,
[2:29:53] one of those people in the back the police officer says is
[2:29:57] the truth.
[2:29:57] I am one of the protestors of no kings
[2:30:03] and I do activism around the city I try to help my city
[2:30:07] and my community with every time I can
[2:30:09] and every time I'm out my mother says
[2:30:12] please don't let them get you.
[2:30:13] There's only one thing on my mom's mind
[2:30:17] it's don't let them get you grandma don't stand out too much
[2:30:21] Mama don't let anything happen to my baby.
[2:30:23] And it's like a lot of babies go missing in this city
[2:30:26] and a lot of people get hurt and just because they come
[2:30:30] across law enforcement on whatever bad day they're
[2:30:33] going through I'm in reality is that if you always really
[2:30:36] so concerned about crime you would address it in your policy.
[2:30:40] Your policy dictates the living economics of the everyday people
[2:30:45] we have to live with the choices that you make
[2:30:47] and essentially instead of your fighting poverty
[2:30:50] coming you're fighting the people that you depend
[2:30:53] on for your taxes you have all these flock cameras that
[2:30:55] take everyone's information and sell and trade it and make money
[2:31:00] off of it meanwhile people are every day starving
[2:31:03] and you're like what's up with crime
[2:31:05] come be hungry that's what's going on.
[2:31:10] We're starving and we put out.
[2:31:13] What happened at no Kings as miss Christina
[2:31:17] said it is a pattern of practice that is what you all do
[2:31:21] I was a victim of it as well.
[2:31:24] A few years back where officers literally used force
[2:31:30] and we inactive constitutional rights of free speech literally
[2:31:36] legal for putting chokeholds with strictly
[2:31:39] prohibited in your policy and nothing
[2:31:43] had been done they left the Academy left
[2:31:46] the department with honors coming
[2:31:48] so I got this comment telling people how they want
[2:31:51] their information if there's any information they're missing
[2:31:54] from you I would say see you all in court
[2:31:56] for my that's how I got this.
[2:32:01] To discover a motion to appeal there you go.
[2:32:07] >> Y'all want to look at this guy and then go ahead and pass
[2:32:11] this on up.
[2:32:12] Lethal force.
[2:32:16] >> Thank you.
[2:32:18] Doctor Pearson
[2:32:35] >> Okay , several people came up and they were presented Jane
[2:32:45] Pearson he was there with all the other protesters
[2:32:49] in the activists and it broke my heart I don't see how the people
[2:32:55] are using their First Amendment right who are fighting to be
[2:33:00] heard and fighting for what's right would become the enemy's.
[2:33:05] I don't understand grammar and then the silence of CJ Davis
[2:33:11] and Paul Yung is .
[2:33:21] You're trying to decide what's wrong instead of calling
[2:33:24] about call a spade a spade.
[2:33:26] We have family or police we have loved ones and friends it isn't
[2:33:31] all the police but the ones that are bad take care of them
[2:33:35] can take care of it.
[2:33:37] And I think it is a courageous and appalling
[2:33:43] I didn't hear a lot of people speak up or speak out.
[2:33:48] Both positions entitled.
[2:33:50] Are represent their constituents.
[2:33:53] You stayed silent.
[2:33:56] Commissioners, said Councilman, everybody mayor in nothing
[2:34:04] has punkish and cowardly.
[2:34:06] Speak up for your.
[2:34:09] They didn't do nothing wrong come on their not
[2:34:11] committing any crime.
[2:34:16] I punishment accountability they need to be fired
[2:34:22] or their pensions taken there is always
[2:34:26] this they're on live with pay that's a vacation.
[2:34:31] Leave with pay is a vacation payment they literally come on
[2:34:38] they push, baby listen let me tell you
[2:34:44] you can't stop the crime when you want
[2:34:48] to push the people aren't doing anything wrong their jobs taken
[2:34:52] and I want to see them lined up, why do they
[2:34:56] keep being inconspicuous can who are they line them up and say
[2:35:01] who did wrong and we're going to go the extra training we lost
[2:35:04] our jobs but we're gonna do this again something Kramer this
[2:35:08] makes no sense my appear time and time again
[2:35:12] like you all don't see us or as if we're doing nothing
[2:35:16] but fighting for what is right.
[2:35:19] Do what's right.
[2:35:20] And hold them accountable..
[2:35:33] Thank you so much doctor Owens Pearson.
[2:35:36] Representative Justin Pearson Fairfield?
[2:35:48] Fairfield (Indistinct)
[2:36:06] >> Representative Pearson Italy he tried to yield his time to me
[2:36:09] if that's >> Thank you so much he's A3123 council
[2:36:16] y'all probably know him here eggs I want to use a facility
[2:36:19] that's been put on indefinite pause before I go into that I do
[2:36:23] want to acknowledge the great group of folks that are here
[2:36:26] today speaking, I was also at the protest but and this was
[2:36:32] an unfortunate day all made this very clear this is a normal
[2:36:37] practice PG PG is probably one of the biggest gangs I have ever
