[0:00] a few times. My daughter lives in Candy [0:01] so [0:10] my goal keeps [0:14] driving down [0:16] this [1:52] » [cough and clears throat] [1:52] [snorts] [3:45] » Good. How are you? Don't [4:50] I just wanted to see what was on the [4:51] agenda. [4:53] I could look at the phone I got. [4:56] It looks like we just got one. Good to [4:58] show you. [5:07] » [snorts] [5:58] » All right, Andrew ready to go. [6:01] [cough and clears throat] [6:15] There we go. Ready to rock. All right. [6:17] We'll go ahead and call this TWA City [6:19] Planning Commission meeting to order [6:20] this Wednesday, April 8th, 2026 at the [6:24] hour of 7 p.m. here in City Council [6:25] Chambers. And number one on our agenda [6:28] tonight is our pledge of allegiance. If [6:29] you'll please rise and remove your hats. [6:33] I pledge algiance to the flag of the [6:36] United States of America and to the [6:39] republic for which it stands. One nation [6:42] under God, indivisible, with liberty and [6:45] justice for all. [6:53] Just a disclaimer for everybody tonight. [6:55] There is a significant increase in [6:57] fraudulent fishing requests using [6:58] information from the public notices that [7:00] are use issued concerning the [7:02] applications being heard during our [7:04] planning commission meetings here at [7:06] Twilla City. Twilla City collects fees [7:08] only at the time of application submitt [7:11] city will never ask for funds to be sent [7:13] over wire transfers. Uh legitimate [7:15] Twilla City emails always end with [7:17] twillis.gov. [7:19] Remember there's always misspellings in [7:20] these fishing emails, so look out for [7:22] those. If you receive a request [7:24] requiring you to pay an additional fees [7:26] for an application in an email that does [7:28] not end in twill city.gov, this will be [7:30] after your application has been [7:32] submitted. This is potentially fraud. Uh [7:35] if you receive such a request, please [7:37] contact Twilla City Community [7:38] Development uh department immediately. [7:40] And always if you have questions, Andrew [7:42] and um and are there to help you. So [7:46] please call them with any questions you [7:48] have before giving out any money. All [7:50] right. Number two on our agenda tonight [7:52] is our roll call. Commissioner Hammer [7:54] >> here. [7:54] >> Commissioner Lynford [7:55] >> here. [7:56] >> Commissioner Proer [7:57] >> here. [7:57] >> Commissioner Cordova here. [7:58] >> Commissioner Jensen [7:59] >> here. [8:00] >> Commissioner Anderson here. And [8:01] Commissioner Faircloth [8:02] >> here. [8:02] >> Let's please excuse Commissioner Sloan, [8:04] Council Members Gosset and Hansen. [8:07] Please welcome Councilman McCall joining [8:09] us tonight. And we got staff members [8:11] Miss Young, Miss England, Mr. Agard, and [8:14] Mr. Johnson in the room tonight. Uh [8:16] brings us on to number three on our [8:18] agenda is a public hearing and a [8:20] decision from Steve Muros in behalf of [8:22] Suzanne Jameson, property owner to [8:25] authorize the use of automobile service [8:27] and repair to occur at the property [8:29] located at 397 North Main Street in the [8:31] general commercial GC zoning district on [8:35] 26 acres. [8:38] Miss [8:41] >> Yes. So, um we did do uh go through a [8:45] conditional use approval uh like last [8:48] month for a car rental uh of [8:53] or car dealership here. And um they are [8:57] the property owners, but they have [8:59] decided to go ahead and lease this [9:02] property to an automotive auto [9:05] automotive repair and service um [9:08] business instead. Um and so we do have [9:12] to go through the conditional use [9:13] process again because it is not the use [9:16] we did approve um with the dealership. [9:21] Um so as you can see this is in the [9:24] general commercial zoning district [9:27] uh and all surrounding uh properties are [9:32] zoned GC but there are some [9:34] non-conforming residential uses that are [9:37] adjacent to this property as well. [9:41] Um, [9:44] again, the proposed business hours are [9:47] Monday through Friday, 8:00 a.m. to 6:00 [9:49] p.m. and Saturday 8 to 3:00 p.m. Um, and [9:54] the reason why I bring that up is [9:56] because automotive services are going to [9:59] be a little bit louder than a car [10:01] dealership because there's going to be [10:03] constant [10:04] um noise from um cars being repaired and [10:09] tools being used and that type of thing [10:12] there. And so, [10:15] uh, one of the things that we are [10:17] recommending is that we put, um, a limit [10:22] on the time frame as far as them using [10:25] the louder, um, tools and that type of [10:28] thing with the card, uh, auto repair [10:30] shop. And so, um, that is one condition [10:35] of approval that we, uh, that the staff [10:38] is recommending. And then this is also [10:42] again the auto repair shop. We've got um [10:49] Okay, we've got the um [10:53] site where they're going to be storing [10:56] the um vehicles that are getting ready [10:59] to be repaired on uh the west side of [11:03] the building. Um, it is currently there [11:07] is a like a rod iron fence across the [11:10] front of it and I'll get to that and [11:12] show that to you a little bit later. Um, [11:15] this is also the front side or the main [11:18] street side of the building. There is um [11:23] parking that is available there. There's [11:25] a handicap stall along with [gasps] [11:28] a couple additional um off- streetet [11:31] parking spaces. On the original [11:33] approval, we did uh put in the condition [11:37] that uh there's no on street parking for [11:41] their customers and I was just going to [11:43] carry through with that or carry that on [11:45] to this condition of approval as well. [11:48] Um [11:49] this is an aerial view of all of it. Um [11:57] and then again on the prior approval we [12:00] did uh say that or put on the condition [12:04] to help reduce any issues with lighting [12:07] that all any new lighting that is [12:10] installed does need to be completely [12:13] covered and shining downward and onto [12:16] the property. So that was another [12:18] condition of approval with this again [12:20] that was carried over. Um [12:22] [clears throat] [12:25] and then this is going to be site [12:27] fencing. Um [12:31] I did get the opportunity to go in and [12:34] take a couple of um [12:38] pictures here. the first one. This is [12:40] the one that is across the street from [12:44] the um automotive repair shop and it's [12:48] just showing the fence that is there [12:50] right now. That's the rot iron fencing. [12:52] And then this is um the fencing that is [12:56] facing westward. And so um that is not [13:02] an a a solid fence just so you guys are [13:06] aware. And then there is also um some [13:09] fencing towards the west and then um [13:13] south portion of the property that does [13:16] have solid fencing. There is also [13:19] fencing or this is from inside the the [13:24] um [13:25] parking area looking on 400 north and um [13:31] that's just showing you the view of the [13:33] rod iron fencing as well. This is a view [13:37] of the [13:40] backside of the property showing the um [13:44] [snorts] type of fencing. It's not [13:46] really quite fencing. Again, it's not um [13:50] it's not really a permanent fencing. [13:52] It's more like a I don't know, like a [13:54] chicken wire type of thing, a fence. And [13:57] then this is also a better closeup. And [14:01] this is right next to the auto repair [14:03] shop. [14:05] And so one of the things that we are [14:08] recommending or staff is recommending is [14:10] that they put a solid fence in the areas [14:14] that um do not have one. So that is the [14:19] other condition of approval. [snorts] So [14:22] recommended uh motion is to approve the [14:26] conditional use with the conditions of [14:29] approval that I discussed. So, if [14:32] there's any questions, please let me [14:34] know. [14:36] >> Perfect. Let's bring this back to the [14:37] commission for questions or comments. [14:40] >> Yes, Commissioner Lford. When you're [14:42] saying to put more permanent fencing in, [14:44] is that to replace the chicken wire that [14:46] is pre-existing or just in certain areas [14:48] where the fencing is lacking? Um well [14:52] the certain areas which is the chicken [14:54] wire where the fencing is l lacking [14:57] because our ordinance does say that um [15:02] there should be I'm sorry let me look [15:04] this up again. Um, our ordinance does [15:08] require fencing and buffer against [15:12] properties that are commercial that are [15:14] against residential zones, but it [15:17] doesn't really um cover if it's all in [15:20] the general commercial zone and it's up [15:22] against residential uses. But since this [15:25] is a condition a conditional use, that [15:28] could be something that we would need to [15:30] do to mitigate any kind of issues that [15:33] would arise with the commercial being [15:36] next to residential. [15:38] So, [15:39] >> and does staff find the the iron fencing [15:41] that they've put in recently sufficient [15:43] to meet that requirement as well? [15:46] >> I feel they carried that forward. So the [15:48] um the thing with that is that it's so [15:51] close to the street, it would be better [15:54] for it to have some visibility. And I [15:57] think that the rod of iron fence where [15:59] that is located right now does make [16:01] sense [16:04] » around the rest of the property. It [16:05] needs to be sight obscuring, right? Um, [16:09] that's really up to yours. My you guys, [16:12] but my recommendation is that we do put [16:14] the side obscuring fencing there in the [16:17] areas that don't have it. [16:19] >> Perfect. [16:24] » Any other questions, concerns, comments [16:26] from the commission? [16:28] >> Chairman, I have a comment. [16:30] >> I have a concern actually with the [16:32] parking. We did talk about customers um [16:35] not parking on the street. Mhm. [16:37] >> Um but with this being an automobile um [16:41] auto service and repair, there will be a [16:45] lot of cars probably. [16:47] What should we think about including no [16:50] employee parking off on streets? Also, [16:55] I've seen some of these um service [16:57] repair places be just full of cars that [17:01] I'm concerned that there won't be places [17:03] for their employees to park. So, I did [17:06] speak with the applicant about that and [17:09] he did he did say that um there is like [17:13] a time limit on how long the cars that [17:17] are waiting to be repaired can be on [17:20] site. So, um I can let him go into [17:24] details. I believe he is here right now [17:27] on how he is planning on doing that. Um, [17:31] I think looking at the lot, it looks [17:34] like there's [17:36] um there's a bit of room onsite and then [17:40] really it wouldn't make sense to do off [17:43] offsite parking. Um, it just would be [17:47] really dangerous off of 400 North and [17:49] then um up in front of Main Street. All [17:53] of that is just approach and you know [17:56] like drive in and drive out areas. [18:00] that are right next to the building. It [18:03] just it wouldn't really be intuitive for [18:06] people to park on the street there [18:08] really. So, [18:10] >> I just know there were concerns with the [18:11] homeowner nearby that [18:14] >> um in the previous business that they [18:16] were parking [18:17] >> in front of their road. Yeah. Or in [18:19] front of their house. Yeah. Um, and that [18:22] is a condition of approval that we did [18:25] carry over so we can still keep that in [18:28] place and that was a part of the [18:30] recommendation as well. [18:32] >> Thank you. [18:33] >> Yeah. [18:35] Just looking at this picture right [18:36] here, it's a turn lane right there [18:37] anyway. So there should be no on street [18:39] parking period. [18:40] >> Yeah. [18:43] >> I think to your point though, I think [18:45] that we should add customer and employee [18:49] [snorts] [18:52] It was a concern before. [18:54] >> Yeah. [18:55] >> Or problem. Not a concern, but problem. [18:57] >> No. Good point. [19:00] >> Yes. Commission. [19:00] >> The only other concern that I'm going to [19:03] bring back up is I recall that we had [19:05] another um [clears throat and cough] [19:07] conditional use permit for an auto [19:09] repair facility. And part of that [19:11] included towing, getting vehicles to the [19:13] property, and how many vehicles could be [19:15] on the property. Um, I just bring that [19:18] up more as a as a comment and a [19:20] refresher from our previous meetings, [19:22] but I would withhold any questioning on [19:24] that until the the owner is up [19:26] >> for questions and available for those as [19:28] well. [19:29] >> So, the applicant has not covered towing [19:31] any kind of towing details, but he is [19:33] here to answer those questions. So, [19:36] >> perfect. Thank you. [19:39] >> In our previous cup, we actually limited [19:43] the number of vehicles to 10 on site. So [19:47] maybe we might want to continue continue [19:50] that forward with this. [19:56] Great questions, comments, concerns. [19:59] Any other ones from the commission? [20:05] Perfect. We'll let you guys marinate on [20:07] it a little bit. The way this is going [20:08] to work is I'm going to open the public [20:09] hearing, give the public an opportunity [20:11] to speak, and then when I close the [20:12] public hearing, I'll invite the [20:13] applicant up. then you can address [20:15] whatever questions the public and we [20:17] have with the best of your knowledge. [20:19] How about that? [20:20] >> Perfect. Great. All right. With that [20:22] being said, we'll go ahead and open the [20:23] public hearing now and invite the public [20:25] up to uh please address us with your [20:27] concerns. [20:30] When you come up, please state your name [20:31] for the record and then write your name [20:33] on the paper for the record as well, [20:34] please. [21:00] Oops. [21:03] Uh, my name is Lorine Mascerinius. I am [21:06] I own the property west of the the [21:11] building right there next to the [21:13] parking. Um [21:16] many of my questions were already [21:18] answered with what she has said, but um [21:22] so so this is going to override the [21:26] other which we already did the other [21:30] week. So um [21:33] does this mean that we're going to have [21:35] like early morning dumpster pickup and [21:38] how often uh are they going to put a [21:40] dumpster in there? Um [21:44] let's see. Um and my my biggest concern [21:49] really is um environmentally what does [21:52] this mean about the waste management? [21:55] Like are there floor drains that have [21:57] the that have the required uh that are [22:02] equipped with the oil grease traps or [22:04] how is that going to be cleaned up? [22:05] because I noticed that when they were [22:06] cleaning out their bay the other day, [22:08] the water was just being washed out to [22:10] the road and to the um [snorts] into the [22:14] gutters, water was coming down through [22:15] the gutters. So, I'm just curious as to [22:17] where where is this waste going to go [22:21] like and is [snorts] it where is it [22:23] going to be stored while it's waiting to [22:26] be picked up if they're doing a pickup [22:28] type [22:30] thing? Um, [22:33] and I know that years prior when there [22:35] was a a building that had um there was a [22:40] auto repair, we had issues with um with [22:43] the the oil and stuff not being uh [22:46] disposed of properly. So, that's like [22:49] one of my big concerns right there. And [22:51] then um also I just want to um [22:56] give a reminder about the American [22:58] Disabilities Act about the no parking on [23:00] the sidewalks because I've seen that [23:02] happen a lot with the businesses. In [23:04] fact, the other business up on Main [23:06] Street has I've seen some of their cars [23:09] parked there. So, but these guys are not [23:11] going to be displaying cars and stuff. [23:13] So, um I I know that it has to be [23:16] whether it be customer or or business [23:19] cars that they're not to be parked on [23:22] the driveway. Um I didn't realize how [23:25] much that affected people until my mom [23:28] was in a wheelchair and had to wheel her [23:30] around and had to backtrack so many [23:32] times just to get around vehicles. So, [23:34] it's really important that that's noted [23:37] and make sure that their vehicles are [23:39] not on the sidewalks. A lot of traffic [23:41] comes down that sidewalk. So [23:44] just that's pretty much all I have right [23:46] now. So [23:47] >> thanks. [23:48] >> Thank you, Miss Mr. [23:49] >> Thank you. [24:01] [snorts] [24:06] » [snorts] [24:21] » Hi, my name is Kip Mner and I live to [24:24] the [clears throat] north across the [24:26] street. Here's a picture of some of the [24:27] vendors. They're on the sidewalk [24:32] and this is because they had cars in [24:34] their parking lot in the front. So, you [24:37] know, number one is nobody can walk on [24:40] the sidewalk. [24:42] Uh, [24:45] I'd like to see it stay at 10 cars [24:49] and, you know, have it have that limited [24:52] for the for the lot because [24:56] if they can't if they don't have room in [24:57] there to work on cars, so many cars, [25:01] they're going to have to park them on [25:02] the streets to get in and out. It's a [25:05] congested area. [25:07] Bad. [25:09] Uh, [25:11] [clears throat] I'd like to see some [25:12] privacy stuff on the rod iron fence, [25:15] too. [25:17] And they're right across the street. And [25:19] I don't want to look at like the old [25:21] mess that used to be there, [25:24] which was supposed to have a fence [25:26] before, but they never did do it. That [25:28] was uh [25:30] 11 12 years ago. It was Main Street Auto [25:33] Garage Repair, whatever. It was a mess. [25:38] Uh [25:40] guess that's about it. Main concerns the [25:43] parking and [25:45] vendors and stuff where they got to get [25:48] in the lot their lot. They can't do [25:50] their business in the street. So [25:56] that's about it I guess. [snorts] [25:58] >> Thank you. Appreciate that, Mr. Mutter. [26:13] » [snorts] [26:14] >> Okay, seeing no one else approach, I'll [26:16] go ahead and close the public hearing, [26:18] invite the applicant up to come address [26:20] the commission, and maybe address some [26:22] of the questions that we may have for [26:24] you. [26:36] I need to sign this, right? [26:37] >> Yes, please. And then state your name [26:38] for the record. [26:50] [snorts] [26:53] Hey, my name is Steve Morose. [27:01] And then I guess yeah, if you guys have [27:03] got some questions for me, I can get [27:05] those answered and then I can kind of go [27:06] off of [clears throat] some of the notes [27:08] that we've taken and stuff. [27:10] >> Okay, perfect. Bring it to the [27:11] commission. You got any questions for [27:12] the applicants? [27:14] >> Yes, Commissioner Lford. [27:16] >> So, I'm just going to come back to some [27:18] of the questions on the public hearing [27:20] and then go to my own if that's all [27:22] right. The first one is going to be that [27:23] waste management. Do you know is the [27:25] building already equipped to handle [27:27] waste or do you have a plan in place for [27:29] I mean if you guys are doing auto [27:30] repairs, engines, transmissions, and [27:32] heavier repairs like that. I know that leaks all over the floor. Do you [27:36] have a a spill plan in place? Do you [27:38] have drains or is this going to be kind [27:40] of a repeat of of past situations that [27:42] the public has brought up where it's [27:44] going to be leaked out into into the [27:46] gutters and rainwater and such? [27:48] >> Yeah. Yeah. So, uh, actually as of the [27:51] other day, [clears throat] right, like [27:52] there was no oil, you know, it was just [27:54] we were washing the floor like the, you [27:56] know, dust and stuff off the floor so it [27:57] wasn't getting trapped in the office. [27:59] But yes, I do, um, you know, they make [28:01] the, uh, oil absorbent socks, you know, [28:03] stuff. So, if there is, you know, spill [28:04] or anything like that, that absorbs [28:06] them. Um, I mean, every shop that I've [28:09] ever ran and been at, um, you know, we, [28:12] uh, we've got bags of floor dry on site, [28:15] you know, you get all that up. We have a metal dumpster, a metal bin, you know, [28:20] you put all that stuff in and then [28:22] dispose of that. Um, I do have a oil [28:24] company that I'm working with that it's [28:26] all going to be contained. The waste oil [28:28] will be contained. Um, the new oil will [28:30] have a containment system and stuff as [28:33] well. [28:34] With the previous limit on the previous [28:37] uh conditional use permit of 10 [28:39] vehicles, is that going to still be [28:40] enough space to get those oil trucks in [28:43] and out and be able to get um which [28:46] brings me up to my next question. Are [28:48] you planning on towing vehicles in? Um [28:50] and if so, do you have a plan on how [28:52] long those will be on property? [28:54] >> Yep. Exactly. So, um yes, we [28:56] [clears throat] will have plenty of uh [28:58] plenty of space. Um, I asked that I mean [29:01] 11 spots because if you look at that uh [29:04] right by the front door, that bay right [29:06] there. Um, we're not going to be doing [29:09] too much work out of that bay. So, it'll [29:12] typically just be my truck that is [29:14] parked there. U, but I totally [29:16] understand and agree. Yeah, I mean, with [29:17] the parking, you're crazy if you're [29:19] parking out on the street there. I mean, [29:21] you're asking for problems [snorts] and [29:23] that's something that me and my staff [29:24] will have to, you know, mitigate and [29:26] continue to get cars pulled back and [29:30] talking with customers of, hey, you [29:31] know, we can't park there. Definitely [29:33] mindful of that. I mean, first and [29:34] foremost is safety is everything to me. [29:38] So, and that's everywhere I've been. [29:41] >> And then, are you guys going to be [29:43] utilizing different tow companies or [29:44] have your own tow truck on site? No, we [29:47] would just uh so it's just customers if [29:49] they need their car towed in, you know, [29:50] to be towed in. Um that depends, you [29:53] know, of how the length of time, you [29:55] know, that'll be there depending on, you [29:57] know, repairs. But any car that gets [29:59] towed in, especially if it's overnight [30:01] or anything, we will get it moved, get [30:02] it uh moved around to the back lot, you [30:05] know, is pretty much um how that works. [30:07] But as to um the point that you were [30:10] talking about is any cars, so I've got a [30:12] very strict limit, and this has been at [30:14] every shop I've ever been at. I don't [30:16] like clutter and I don't like stuff [30:18] building up. I am very OCD about that [30:21] stuff. Um, and so what my thing is on [30:26] that for any customer and I hang signs [30:27] up saying it, any car that is left there [30:30] for, you know, more than, you know, 4 [30:33] days to a week, um, I charge a fee, [30:36] right, of how long it is there, it's a [30:38] $50 fee each day that the vehicle is [30:41] there. And then at that point, I have it [30:42] towed and impounded. So, I don't have [30:45] cars because to me that's money that's [30:47] sitting in my lot that I'm not being [30:50] able to do anything with it. I can't [30:52] have it. [clears throat] So, and it's [30:53] also space that I can't use. So, [30:56] >> and then with the concern of vendors, I [30:58] mean, he showed a believe it was a [31:00] Cornwell truck that was parked up on the [31:02] sidewalk there and the concerns of ADA [31:04] and access on that sidewalk. Um, my [31:07] first question is, will there be ample [31:10] space for your vendors to be able to [31:11] pull in if they need to be on property? [31:14] Or if I just look pulling up the a [31:18] little bit wider map of the area, looks [31:20] like there might be some space across [31:21] the street over by Janna's Java that you [31:24] could have employees just walk to [31:26] potentially. That way, we're not [31:28] creating that ADA concern. [31:30] >> Yeah. Um, but where ADA law is concerned [31:34] just to [31:35] >> prevent that from happening again. [31:37] >> For sure. So, like this is the stuff [31:38] that you guys aren't wanting, right? [31:40] Like their vehicles that are parked on [31:42] the sidewalk. [31:43] >> I apologize. That's just a little too [31:44] far for me to see personally. [31:47] >> Please. [snorts] [31:48] >> This is their cars currently. They're [31:52] parked on the sidewalk and on the [31:54] street. [31:55] >> Correct. So, that's that's what we're [31:56] trying to mitigate. That's what that's [31:58] what we don't want. And so he the the [32:01] >> show that [32:01] >> Yes, I'll show. So I've [clears throat] [32:03] got two pictures here. [32:06] >> Correct. That that would be [32:07] >> so that's kind of what I'm saying. [32:10] >> I agree with that though. And I don't [32:12] think those cars should be parked right [32:13] there either. You know, [32:15] >> that is a safety constant up and down [32:18] the sidewalk. [snorts] [32:20] >> And and I would agree with with [32:22] emphasizing that concern in general as [32:25] well. um where the gentleman showed the [32:27] Cornwall truck blocking the sidewalk [32:29] right in front of the shop and that [32:31] being more in your control rather than [32:33] the residential's control. Y [32:35] >> um that that's why I make that comment [32:37] and why [32:38] >> I I try not to bring up a problem [32:40] without some kind of solution. And I [32:42] just noticed that we have that big dirt [32:44] lot just across and I know [32:46] [clears throat] it might be a little [32:47] inconvenient to walk across the street [32:49] but that might also be a better [32:50] solution. [32:52] >> Um just as making sure we're all [32:54] thinking about and making sure that the [32:56] public questions are are being concerned [32:58] uh being brought up and validated as [33:00] well. [33:00] >> Yes. [33:02] >> That that concludes my questions. [33:04] >> And so for your point, the reason he was [33:06] parked out there, he pulled up for a few [33:07] minutes and I actually told him he's [33:08] like I'm just gonna be here for just a [33:10] second. And I said, "Okay, well, next [33:11] time you come in, I didn't have the gate [33:13] unlocked." When we're there and our [33:15] operation is going, that gate will be [33:17] unlocked and open for, you know, those [33:19] bigger trucks, oil trucks or, you know, [33:21] the Cornwall truck to be able to pull in [33:23] through the back stage right there, do [33:25] whatever they need to do and then go. [33:27] But as to your point, yes, I was also [33:29] I've already been, you know, in contact [33:31] of using some of the parking, you know, [33:33] over there in staging, you know, [33:35] especially for employees or anything [33:37] else. [33:38] >> Actually, I lied. I do have one more [33:39] question. Are you planning on tearing [33:41] down anything outside of the building on [33:43] property as well, or are we going to [33:45] limit the the tear downs and such to [33:47] inside the base? [33:49] >> Oh, yeah. That will all be inside the [33:50] base. I don't like working outside. I [33:53] did that for many. [33:53] >> Most people don't, but I just want to [33:55] thinking about the concern about noise [33:57] as well. I mean, I I can imagine what an [33:59] impact drill is going to sound like [34:00] outside right next to someone's house. [34:02] So, that's why I just want to clarify [34:04] that as well. [34:04] >> Yeah, of course, there is going to be [34:06] times to get a vehicle in. you know, the [34:08] bay. We're going to have to take some [34:10] tires off or something like that to be [34:12] able to move it into the bay. So, yes, [34:14] there will be some times that I do have [34:16] to take, but as far as like full tear [34:19] downs, you know, or uh, you know, [34:21] lengthy hourly jobs, no, I I do [34:23] everything inside. [34:26] >> That's all my questions. [34:27] >> Thank you, Commissioner Liford. [34:32] » Any other questions from the commission? [34:37] So, [clears throat] just to be clear, [34:40] the gate will be open during hours of [34:42] operation. [34:43] >> Yes. Okay. [34:44] >> Yep. [34:45] >> I think that has to be I mean that's [34:46] definitely a rule of mine that's going [34:47] to have to be because I mean that's also [34:49] a safety thing. You know, if somebody [34:50] needs to get back there in a hurry, you [34:52] have to be able to get through that [34:54] gate. [34:57] >> So, that might answer the question about [34:58] the dumpster pickup. They're not going [35:00] to be able to get in there without the [35:01] gate open anyway. So, exactly. [35:02] >> They're going to have to do it during [35:03] business hours. And I already talked to [35:04] the waste management. They're good to [35:06] work with. [35:07] >> Yeah, they were super cool about it. [35:08] They said yes, definitely. You know, [35:10] they can just come in during business [35:11] hours. [35:12] >> Perfect. Good. [35:14] >> I think that's all the questions I had [35:15] from the public. Any other questions [35:18] from the commission? [35:22] » All right. [35:24] >> Thank you, Mr. Mayor. Members, [35:26] >> Mr. Chairman, [35:28] >> I if I could offer just a little insight [35:29] on the [35:31] >> parking on the sidewalk concerns. [35:34] >> Dwell city already has ordinances that [35:37] prohibit vehicles from being parked or [35:39] obstructing the sidewalk, and those are [35:41] subject to enforcement by the city's [35:43] police department. So, if that situation [35:46] does occur, we encourage the public to [35:48] contact the city and we will have the [35:50] police department engage that and remove [35:52] that vehicle from the public rideway. [35:55] >> Perfect. [35:56] That's for everybody's everybody's [35:58] information in here. So, [36:00] >> and then I just had a couple things as [36:03] well. [36:03] >> Absolutely. [36:04] >> So, I guess uh my one question is the [36:07] lights on the building um that are are [36:10] currently up. Um I've been, you know, [36:13] there late at night, you know, kind of [36:15] getting everything ready and trying to [36:17] do as much as I could before this [36:18] hearing. Um the lighting doesn't seem [36:21] to, you know, go out, especially towards [36:23] the house to the west. Um, no, sorry, to [36:27] the south. Um, and then the lighting to [36:30] the west. Um, I just need to know like [36:32] exactly, you know, what we're wanting. [36:35] Um, because it doesn't seem to, you [36:37] know, like be super bright over there [36:39] and stuff. I don't maybe somebody else [36:41] might have a different opinion. Um, but [36:43] I've been out. I don't see anything with [36:46] the existing lights and how it is going [36:47] right now. And we do not plan on, you [36:50] know, upgrading the lights, making them [36:52] brighter or anything else. we are very [36:54] limited on the stuff that we, you know, [36:56] can do. Um, so we were just wondering [36:59] about the lighting situation and if it's [37:03] okay the way it's is right now and the [37:06] way it has been for it looks some time. [37:08] Um, that was my one question I guess or [37:13] kind of concern. And then the loud [37:15] noises. Um, again, yeah, we will be, you [37:18] know, doing as much work as we can [37:20] inside, you know, the bays and stuff. Um [37:22] but it wouldn't it's what we're doing [37:24] isn't going to be any more or less loud, [37:26] you know, than the the um car lot, you [37:31] know, that got approved and or the body [37:33] shop that's just a couple of buildings [37:35] down. You know, it's it's all right [37:37] there within, you know, proximity. It's [37:39] not going to be any more or less loud [37:42] than what we were going to be doing in [37:45] general. So, [37:47] >> perfect. So, with the lighting, Miss [37:49] England and Miss Agard, I'll have to [37:50] help you with that as soon as we're done [37:52] with this. But we're what we're looking [37:53] for is just lighting that points down [37:54] rather than out. [37:55] >> Okay. [37:56] >> To keep it out of the residents yards [37:58] and more focused on your yard. [37:59] >> Yeah. I wouldn't want that either if [38:01] that was my house. [38:01] >> Yep. [38:02] >> So, you'll have to ask them what is [38:03] there if that's going to be legit [38:04] enough. Uh they'll have those answers [38:06] for you. [38:07] >> Okay. [38:07] >> That was also applied to new lighting, [38:11] additional lighting. [38:12] >> New lighting. Okay. So, lighting is [38:13] there now. [38:14] >> Yeah. You don't need [38:16] >> Okay. Yep. And we have no plans on doing [38:18] anything with that. [38:21] And so, and to be clear, the number of [38:24] vehicles on site would be 10, but 11 if [38:27] I can, you know, it'd be my personal [38:30] vehicle that' be parked in front of that [38:32] one bay door. So, that would be the 11. [38:34] >> You're just pretty much creating another [38:35] parking spot for you. So, I don't think [38:37] it'd be complaining too much. [38:39] >> Okay. [38:40] >> Yep. [38:45] » Perfect. What I like about our job [38:47] tonight is just to explain to the public [38:49] when it comes to a conditional use [38:50] permit, we have to find uh reasons for [38:53] safety issues to we can mitigate. If we [38:54] cannot mitigate it, uh then there's a [38:56] possibility that we deny it. Um but [38:58] tonight we we've kind of gone through [39:00] the list and the city's actually gone [39:01] through and put that in our packet with [39:02] us. Uh so the issues you guys are [39:04] talking about tonight are noise of [39:05] course, uh lighting, it's been [39:08] addressed, [39:10] parking on the street and the sidewalk [39:12] of course has been addressed. uh [39:14] customers visiting visiting. That's [39:16] going to take some time to get customers [39:17] to understand not to park there, but it [39:19] sounds like they're going to do their [39:20] due diligence to get that done. Um [39:22] business hours and minimize the [39:25] visibility from the uh wrecked yards in [39:28] the in the yard there or cars in the [39:31] yard there. So, is there anything else [39:32] that the commission can think of [39:34] findings of fact and things we need to [39:35] mitigate or find issues for? I [39:37] >> just need to add in that limit on car [39:41] limit on cars. Okay. [39:45] That's not in there right now. Perfect. [39:49] Any other thoughts, questions, opinions? [39:56] » Great. I'll entertain a motion on this [39:58] one. [39:59] >> I'll make a motion. [40:00] >> Yes, Commissioner Lynford. [snorts] I [40:02] move to approve the conditional use [40:04] permit request by Steve Morose to [40:06] authorize the use of the automotive [40:09] service and repair to occur at the [40:10] subject property [snorts] application [40:13] number 202623 [40:16] based on the findings and subjects to [40:18] the conditions listed in the staff [40:20] report dated April 3rd, 2026 with the [40:23] additional con uh condition of parking [40:27] no more than 11 vehicles. [40:30] I'll second. [40:32] >> Okay. I have a motion to approve the [40:34] conditional use permit with the [40:35] condition to park no more than 11 [40:37] vehicles on the property. Uh from [40:39] Commissioner Lynford and a second from [40:42] Commissioner Anderson. Is there any [40:43] discussion before we take this to a [40:45] vote? [40:48] » Commissioner Hammer, how do you vote? [40:50] >> I. [40:50] >> Commissioner Lynford, [40:51] >> I. [40:52] >> Commissioner Proctor, [40:53] >> I. [40:53] >> Commissioner Cordova, [40:54] >> I. [40:54] >> Commissioner Jensen, [40:55] >> I. [40:56] >> Commissioner Anderson, [40:57] >> I am Chairman Hamilton. I also vote I. [40:59] That one passes 7 to zero. Uh, next on [41:02] our agenda tonight is a city council [41:04] reports. [41:06] I love how they threw you under the bus [41:08] there, Councilman. [41:09] >> Oh, no. That's that's totally totally [41:12] okay. I'm prepared. [41:13] >> I'm happy to be here. [41:16] Um Um, as far as the the council, the [41:18] last time I was here, which seemed like [41:20] it was the last meeting once for Ed, now [41:23] for John. I think they're just playing [41:25] with me. Um, but I mentioned I mentioned [41:28] an ordinance that was coming up and uh [41:31] that was a public hearing and a motion [41:33] uh on ordinance 2026-08 [41:37] an ordinance of the Twilla City Council [41:39] amending section 7-4-7 [41:42] of the T of the Tilla City Code [41:44] regarding parking of operable motorized [41:48] vehicles [41:50] in the front and side yards of [41:53] residential properties in a single [41:55] family residential zoning district. And [41:59] um I mentioned it to you the last time [42:02] and if you didn't know, it did pass. [42:05] Um and that was one that um [42:09] it is, as I said before, it's an [42:12] interesting ordinance. Um um because it [42:15] is, [42:18] you guys basically touched on a few [42:19] minutes ago when you was talking about [42:21] parking on the street and parking in [42:23] front of people houses. And if you um go [42:26] around town, and I I asked you to do [42:28] that when you're riding around, just [42:30] take a look at some of the yards. And um [42:33] it's it's kind of sort of shame that a [42:35] few basically dictate what the rest of [42:38] us have to do because they're they're homes with 8 n 10 cars parked in [42:44] the front yard and the neighbors are the [42:47] ones that are getting beat up for that. [42:50] You know what I mean? They the the value [42:52] of their homes are going down. They [42:54] can't sell it like they want to because [42:55] of that eyesore. So, I totally [42:58] understand where you guys are coming [43:00] from and I hope you guys live up to your promise. But, um, that's all I got [43:06] big guy. Oh, I'm sorry. [43:09] Commissioners, [43:11] [laughter] [43:12] I'll answer the big guy. That's okay. [43:16] [laughter] [43:17] >> Great. Any questions for Councilman [43:19] McCall from the commission? [43:22] We appreciate you joining us. Join us [43:24] anytime. [43:25] >> I'm sure I'll be back. [43:27] >> Good. We won't complain. All right. [43:29] Moves us on to number five on our [43:31] agenda. This is a review and decision on [43:32] the March 25th, 2026 planning commission [43:35] meeting minutes. Are there any [43:37] corrections or additions that need to be [43:38] made? [43:41] >> I'll entertain a motion. [43:42] >> I move we accept the minutes as [43:44] prepared. [43:45] >> Motion to approve from Commissioner [43:47] Proctor. Do I have a second? [43:48] >> I'll second. and a comm and second from [43:50] commissioner Lynford. Any discussion [43:52] before we vote? Commissioner Hammer, how [43:55] do you vote? [43:55] >> I. [43:56] >> Commissioner Lynford, [43:56] >> I. [43:57] >> Commissioner Proctor, [43:58] >> I. [43:58] >> Commissioner Cordova, [43:59] >> I. [43:59] >> Commissioner Jensen, [44:00] >> I. [44:01] >> Commissioner Anderson, [44:02] >> I. [44:02] >> Chairman Hamilton also votes I. Those [44:04] pass seven to zero. Moves us on to [44:06] number six on our agenda. I'll entertain [44:09] a motion to adjurnn. [44:10] >> Please do. No, we are adjourned at 7:38
