um [5:05] front [5:07] yard [5:09] reduction uh and permitted projections [5:11] in the required [5:15] yards we have done a roll call um so the [5:19] order of the uh this presentation will [5:22] be [5:23] uh incorporation uh into the file and [5:26] record provided by staff [5:31] which we can I guess we formally we [5:34] formally do [5:36] that inate the memo from [5:39] staff well staff will make a [5:42] presentation before before we get there [5:44] I think uh the CLK need to advise the [5:47] board of compliance with the notice [5:52] requirements in the matter of the [5:54] several steps [7:05] we will hear from the [7:07] partitioner uh then I have testimony of [7:11] Staff uh and then public uh testimony if [7:15] there is [7:16] any uh summary statements [7:19] cross-examination summary statements and [7:21] the closing of the meeting public [7:23] hearing and then deliberations [7:30] so the case [7:35] summary not sure how much this we need [7:38] to [7:52] read again the summary I believe is as [7:56] we as I uh described it earlier 20 [8:01] 20242 consider an application for [8:04] Michael and Beverly Fulmer owners of [8:06] real property at 3905 27th Street in [8:10] ches big beach for a variance to Article [8:13] 5 section [8:30] into well required yards including side [8:37] yards at this point um we will hear from [8:42] the [8:43] petitioner and do we need to swearing in [8:48] yes you can set just raise your right [8:52] hand you Solly affirm under the penalty [8:55] of perjury that the testimony you're [8:57] about to give will be the truth the [8:58] whole truth and nothing but the [9:00] truth thank [9:03] you I let the record reflect that both [9:06] Mr and Mrs Fulmer were sworn [9:11] in my wife Beverly and I are here to [9:14] request a variance to replaced our [9:15] existing porch and steps with a new [9:17] front porch and steps I've remodeled our [9:19] home except for the front porch we [9:22] submitted our plans with our original [9:24] permit request which was denied due to [9:26] encroachment in the required yard areas [9:28] we thought that width was the problem at [9:30] the time so we had modified our request [9:33] for a smaller width front porch um but [9:36] we were denied then due to the font [9:38] front yard requirements specifically the [9:41] side requirements are 8 feet from the [9:42] neighbor's property and 15 fet from the [9:44] sidewalk our front door our home is 15 [9:47] feet from the sidewalk um we cannot [9:51] replace the porch under these [9:52] circumstances because we're not required [9:55] we're [9:56] not allowed to build in the 15 ft to the [9:59] sidewalk so we are requesting a variance [10:03] um to increase the lot area for our [10:07] front porch and steps um originally we [10:10] had [10:11] requested um a front porch 21 feet by [10:15] six feet that would extend to the width [10:17] of the house so very similar to our [10:19] neighbors to our left and our right um [10:23] but then that was rejected we thought [10:24] because of the 15 because of the side [10:28] requirements um so then we had uh [10:31] submitted a uh I guess a another uh [10:35] option uh which was 15 feet width with a [10:39] six foot uh coming out from the house um [10:43] uh we weren't sure then we were denied [10:45] that because of the 15ot requirement um [10:48] so then we just re went to if at all [10:51] possible just replace the porch that we [10:53] had which is quite smaller than the ones [10:55] that we're requesting we would like to [10:57] have the first option which is to the [10:59] width of the house um option um so we're [11:03] going to leave it up to the board to I [11:05] guess decide what we can do with our [11:06] property at this point um our property [11:10] our lot is going to be 30 by 100 and it [11:12] seems that majority of the houses maybe [11:15] not a majority but about 30% of the [11:16] houses in the neighborhood have this 15 [11:18] feet problem um not sure if you [11:22] had seen that in the past um or are [11:27] thinking about having problems in the [11:28] future [11:30] um but I'm sure we're not the only ones [11:32] who have a problem with this um [11:40] requirement do we have any questions [11:43] from the [11:45] board after the board has questions if [11:48] they do I [11:50] have I don't have a question at this [11:54] time I I have one I have one question um [11:58] there there there were several options [12:00] that were [12:02] proposed and the the depth that you're [12:06] proposing in one option I think was six [12:09] feet Yes the other option was I believe [12:11] it was four and A2 feet yeah but that [12:13] did not include the step so I apologize [12:15] for putting that air or having that [12:17] error in our write up um the front porch [12:21] presently is four feet uh and then the [12:24] steps come out to about six foot well [12:27] six foot total [12:29] okay so you say the present porch is [12:32] four feet yes and then another and then [12:36] the four feet [12:37] wide I see the picture and then four [12:41] feet in depth the front porch and then [12:43] the steps come at the Landing I'd say [12:45] and how far out does the do the steps go [12:47] to a full six foot yeah you include the [12:49] steps include the steps in the landing [12:51] it's six [12:53] foot so I guess it would leave [12:54] approximately 9 ft from the porch [12:57] landing and that's the dimensions of [12:59] present our present is 4 and a half uh [13:04] by six foot with the [13:08] steps all right that's that's the only [13:10] question presently we do not have any [13:11] rails on the porch either so you know we [13:14] want to have it safe yeah okay ask a [13:18] follow on then so with the two proposals [13:21] that you did make six feet and 4 and 1/2 [13:24] ft they would actually extend what two [13:26] more feet out or three more how much the [13:28] one with the four put Dimension the 15 [13:30] by4 that would be actually 15 [13:34] by6 six being the the step part [13:37] including the step that was an error in [13:40] our part we should have said I don't [13:42] know if we included pictures or not okay [13:44] and then the six by 21 foot did that [13:46] incorporate steps into that six feet [13:50] already [13:53] okay so so the only difference between [13:56] the two options then is just the width [13:57] the the length of the porch exactly you [14:00] know if if you have a problem with us [14:02] encroaching on the sides because our [14:04] house is 3 feet on one side presently [14:06] and maybe four or five feet on the other [14:08] side um it would come to the edge of the [14:10] house it wouldn't encroach past the [14:12] house we had a similar situation with a [14:15] back porch that we had constructed last [14:17] year where we had to ask for a variance [14:19] for the width [14:21] okay and Council has a [14:25] question in reading your materials I saw [14:28] something about railings railing part of [14:31] this proposal are railings included [14:34] within the uh width or depth yes because [14:38] they would be uh the porsch and then the [14:40] railings would be along the porsch you [14:42] know to help to be there for stepping [14:46] down off the porch [14:48] or or being on the [14:50] porch [14:52] and the whole width of the uh the of the [15:00] uh deck [15:02] caller is that four feet deep along the [15:06] uh width of the house yeah four feet [15:09] deep plus uh landing and steps that go [15:14] six [15:16] yes thank you for the clarification oh [15:19] sure but if we um you know whichever [15:21] option that you all approve of course we [15:23] would prefer the wider one um but it's [15:26] you know whatever you approve for us [15:27] we're willing to accept we just we want [15:29] to get going finish this it's been a [15:31] long [15:35] process are there any other questions [15:37] from from the panel from the uh board or [15:41] the [15:43] council uh at this time we'll hear from [15:46] uh uh [15:51] staff thank you um so Michael and [15:55] Beverly Fulmer requested the permit um [15:57] as they described [15:59] um and [16:02] initially there is a there is a [16:04] provision in the code that allows an [16:07] encroachment into the front yard setback [16:09] if your neighbors are encroached into [16:11] the front yard I'm not loud [16:14] enough if you can speak into the Bic yes [16:17] so there's a there's a provision in the [16:18] code that allows you to encroach into [16:20] your front yard setback if either of [16:22] your side neighbors are encroaching into [16:24] the front yard setback um and we did try [16:27] to apply that but but we're unable to so [16:29] that just so you understand why there's [16:31] the two option how the two options got [16:33] generated um the property is at 3905 [16:39] 27th Street it's a pre-existing [16:41] non-conforming lot um and the lot is [16:44] about 3,000 square feet where your [16:47] minimum lot size is 7500 square feet um [16:50] this means that it is very narrow about [16:53] 30t wide and 100t deep so either [16:57] proposed deck can be [16:59] constructed in a way that still meets [17:01] minimum or is still underneath the [17:04] maximum lot coverage and creates [17:07] impervious [17:10] surfaces in looking at this there's a [17:12] few relevant sections of the zoning [17:14] ordinance [17:16] 20290 d9a sets lot size and setbacks and [17:19] this is where we get into the first [17:22] piece which is the encroachment into the [17:25] front and side yards um in option number [17:31] one they would need a variance of six [17:34] feet into the front yard set [17:37] back and the side setbacks of 6 inches [17:41] on the west side and two feet on the [17:42] East Side in option [17:46] two it would just need a variance for [17:50] the front yard setback which is 4 feet 6 [17:53] in in the front yard set back and this [17:54] is the difference between the [17:56] deck going along the full edge of the [17:59] house versus the deck being slightly [18:03] narrower section 29 [18:07] 299d is the part I was talking about [18:09] that allows exceptions for [18:11] non-conforming Lots if their neighboring [18:13] houses have [18:16] um or sorry it allows for the [18:18] construction of single family dwellings [18:20] so we can't apply that because it's not [18:21] a single family dwelling it's a deck um [18:25] and so the setbacks still apply so it's [18:27] 2909 e that allows to reduce the front [18:30] yard setbacks for buildings based on the [18:33] average of the properties on either side [18:36] although the two lots to the east of the [18:38] fer lot encroach into the front setback [18:42] the one lot to the West does not and [18:46] because the way the code is written you [18:49] have to average either side of them um [18:53] they weren't able to encroach under that [18:57] regulation so and [18:59] 2919 f it limits the size of a deck in [19:02] the front yard setback to 35 square ft [19:05] or less um because the requested porch [19:09] is larger than that it would need a [19:12] variance if it was to be allowed so they [19:15] can there's a couple of different [19:16] numbers there's a couple of different [19:18] options and I don't want to confuse [19:19] Everyone by reading them all [19:21] off um so in 29019 G that allows um the [19:28] deck to encroach into side yard setbacks [19:32] as long as you maintain a five foot side [19:34] yard setback so those are all the [19:36] relevant [19:38] pieces of the um code so to look at them [19:45] in um consideration of variance [19:48] standards we see that this [19:53] variance it has extenuating [19:55] circumstances there's pre-existing the [19:57] pre-existing front setback of the house [20:00] there's the condition that three out of [20:01] four houses on the Block have a smaller [20:04] setback than for their porches than this [20:08] one so they're encroaching into the 15 [20:10] ft so those are unusual conditions then [20:13] when we go under to conditions um with [20:17] the granting of the variants being in [20:18] harmony with the general purpose and [20:20] intent of the chapter and not injures to [20:22] the neighborhood or detrimental to [20:23] Public [20:24] Welfare um in this case the porch would [20:27] really be detrimental if it was coming [20:29] right up to the street or if it was [20:30] impacting storm water runoff because it [20:32] can be um installed with spaces in [20:36] between the boards or other mitigations [20:38] and because it's very small it won't [20:40] have a negative impact on storm water [20:42] runoff um additionally because this is a [20:45] front yard deck and because the filmers [20:47] are asking for enough space to sit on [20:50] their front yard deck it actually [20:52] improves the neighborhood by allowing [20:54] them to sit on their deck and interact [20:56] with their neighbors uh which is [20:58] something that is supported in the [21:02] code the granting of the variants does [21:05] not permit anything that's not generally [21:08] allowed in the [21:10] district with regard to special [21:12] circumstances or conditions fully [21:13] described um I'm going to come to the [21:15] end of this that say that the strict [21:17] interpretation and the provisions of [21:19] this chapter would deprive the applicant [21:20] of reasonable use of such land or [21:22] buildings um the strict interpretations [21:25] don't deprive the applicant of [21:27] reasonable use of land or buildings but [21:28] they do deny the residents the [21:30] opportunity for social interaction and [21:31] Community [21:33] Connection [21:35] um in the next question is is there an [21:38] unnecessary hardship and the proximity [21:42] of non-conforming house to the front of [21:44] the property has eliminated that [21:47] possibility of the front year porch the [21:49] neighborhood around their home contains [21:52] similar non-conforming front setbacks [21:56] so they are exper experiencing a [21:59] hardship compared to their neighbors [22:01] because their decks were there first [22:03] before the [22:05] Cod is the granting the granting of the [22:09] variance necessary for Reon use of land [22:11] or the building granted with the board [22:13] is the minimum variance that will [22:15] accomplish this [22:16] purpose um and this is where we get into [22:19] the different options so option [22:23] one is going into your both your front [22:27] and your side yard back so it's a little [22:29] more option two is a smaller more [22:32] minimum variance um because it's not [22:35] going into the side [22:36] setbacks so option one is larger than [22:39] option [22:40] two I'm going to say some more about [22:43] that after we evaluate the critical area [22:45] um because if you think about the visual [22:48] character of the [22:49] neighborhood [22:51] um the the width [22:54] matters so with regard to critical area [22:57] because this is in the critical area we [22:58] have to consider um a few other factors [23:02] uh which is is there an unwarranted [23:05] hardship that the applicant would be [23:07] deprived of reasonable or significant [23:09] use of the parcel or lot without this [23:13] request um so we you the applicant would [23:17] still have reasonable use of the [23:19] property but they lose that Community [23:21] Connection and [23:23] because this deck isn't impacting the [23:26] critical area elements through storm [23:28] water because it can be considered [23:31] pervious surface through slots in the [23:33] deck um it doesn't this section doesn't [23:36] have to apply to [23:38] it um the Lal interpretation of the [23:42] critical area [23:44] program dep would deprive the applicants [23:46] of the rights commonly enjoyed by other [23:48] properties in similar areas within the [23:50] critical area district and this would [23:53] because even their neighbors have this [23:56] ability to be on their front porch um um [23:59] that the granting of the variance [24:00] doesn't confer any special privileges it [24:03] does not confer any special privileges [24:05] and that the granting of the variance [24:07] doesn't adversely affect water quality [24:10] um even if the porch was impervious [24:12] surface it is a very small porch and it [24:14] can be easily mitigated storm water but [24:17] it it can also be constructed with gaps [24:19] and not be considered impervious [24:22] surface all of that is to say that this variance request meets all of your [24:27] variance standards [24:31] in in [24:32] conclusion we staff recommends that you [24:37] provide a variance to the property owner [24:40] um what we were recommending is that or [24:43] what I'm recommending is that you not [24:45] give option one or option two but a [24:48] third option which is to allow the porch [24:53] to enter into the side setbacks and Go [24:55] the whole length of the front build of [24:57] the building but not come out quite as [25:00] far as their initial [25:01] request is my understanding now that [25:04] they needed to come out a little further [25:06] for the [25:07] steps um so I can I can try and do some [25:12] quick math and phrase that for y'all I [25:15] can do do some quick math as to how that [25:18] would look but I think one of the [25:20] questions for yall to consider is are [25:23] the steps going to be the full length or [25:27] are they going to be a small small [25:30] entrance um as to how you're going to [25:34] grant that variance because when we go [25:36] to option [25:38] number hold on a [25:42] second option [25:44] number one we're encroaching [25:49] into the side setback I got to go back [25:52] and find [25:56] it I don't is she allowed I don't know [25:59] she's allowed sorry um in option number [26:05] one we're going six feet into the front [26:09] setback and in option number two we're [26:10] only going four and a half feet into the [26:12] front setback the board can [26:15] choose to allow can choose to allow [26:18] option number one or it can choose to [26:21] allow this option number three that I [26:23] provided [26:24] you and additionally allow the stairs to [26:29] encroach 3 feet you know we can say how [26:33] wide would we want the stairs you would [26:35] we allow the stairs to be they can go [26:37] three foot feet in and this wide you [26:40] guys can add that to your [26:44] decision [26:46] um have I covered every there's a couple [26:49] of other sections they requesting [26:51] variances to but if you provide it to [26:54] the front um if you just provide the [26:57] variance to 29019 that will cover [27:00] everything and you don't need to provide [27:01] the other [27:05] variances all right thank you okay uh [27:08] any questions Miss [27:10] Franklin the from the [27:15] board and the applicant had a question [27:19] Sor we just want to let you know it is [27:21] going to be a small entrance that was [27:24] the original attent the steps are not [27:26] going to com out the door and [27:29] down and and how wide do you anticipate [27:33] the steps will be I I guess pretty [27:37] wouldn't [28:10] extend it's not going to extend it's [28:12] just going to come out the door probably [28:14] about a 4 foot width and come down to [28:16] the sidewalk so we're not we're not [28:20] planning on steps out of the whole [28:22] farewell steps yeah sorry how high is [28:26] this front porch going to to be like I'm [28:28] just wondering how many steps does it [28:30] require because each step is an extra [28:32] foot correct I think presently we have [28:33] two steps and then the landing that's [28:35] what we're gonna do and it's gonna be at [28:37] the exact same height yes okay so this [28:39] is kind of like a ground level yes front [28:41] porch not a [28:43] de porch we call it a porch okay that [28:47] makes a difference with how much it [28:48] would then but out [28:51] so so you were saying when you can I ask [28:54] a question now so in this back and forth [28:59] so the first ask was the length of the [29:02] house 6 feet out including the steps [29:05] correct and then the second one was [29:07] shorter or was was shorter but the steps [29:10] buted out and it didn't include the [29:12] steps okay so do the [29:14] steps are you walking up two steps and [29:17] on the side it's graduating up to the or [29:21] a sidewalk comes up you would walk up [29:22] two steps then you're on the landing and [29:24] that's our front door we've always had a [29:26] small entrance no matter the length of [29:28] the house was going to be it's always [29:30] going to be the same small entrance yeah [29:33] we were never going to have the the [29:34] steps go across the [29:41] side also extend [29:44] the the porch out yeah I'm just trying [29:47] to figure out how it comes out six [29:49] feet anybody else confused by [29:53] that right we should have worded it that [29:56] way on both of the thank you documents [29:59] right but to the left and right of the [30:01] steps the first one asks for six feet [30:04] out you see we were asking for the full [30:07] length of the house and the other one [30:09] was the half length and then but she's [30:11] talking about the sorry I'm just trying [30:14] to actually picture I'm confusing just [30:16] making sure it's not six and eight you I [30:17] don't know I guess that's included I'll [30:19] just take it as six so [30:21] okay I believe if I understand correctly [30:24] the steps and both options would be the [30:26] same yes same width same yes same [30:31] length did I understand you mentioned [30:34] another option was to have the side [30:36] steps that I I Envision in that no so um [30:40] so because what we were trying to do [30:43] was make the codes exception for front [30:46] yards work for them so they didn't have [30:48] to go through the lengthy [30:49] process we tried say what happens if we [30:52] reduce the sidey yards rate um but [30:56] because of that one neighbor with the [30:58] big front setback we couldn't apply that [31:01] I think for their use and for the look [31:04] of the street and how the other porches [31:06] are that it makes sense to allow the [31:09] encroachment into the side yard [31:13] setbacks in your scenario [31:16] the porch itself the for the width or [31:20] length of the house would be four [31:23] feet and then the steps would be another [31:26] two feet yeah four and a half feet four [31:29] and a half feet um and so I think if I [31:32] mean I can read in what option three is [31:34] for you all but just if you accept [31:37] option three and then also allow you [31:41] know 3 feet by four feet for the [31:45] stairs I I think rather than talking [31:47] about options the board should consider [31:50] what does it feel is reasonable in terms [31:52] of a width and in terms of a depth right [31:57] seems like uh in options one and three [32:01] the width of the uh porch is the same as [32:05] 4 [32:06] feet the depth so the the depth the [32:09] depth is is it sounds like um the [32:13] intention of option one was also 4 and a [32:16] half foot so that the the porch deck is [32:19] always a depth of four and a half feet [32:21] it's actually steps that are encroaching [32:25] that extra little bit I don't know if [32:27] that's correct but I think okay oh see [32:30] that makes more sense to me then I [32:37] was so yeah option number one is [32:40] probably fine because it's smaller than [32:42] I measured it to [32:45] be are there any other comments um I [32:48] might have a question hang on one [32:52] second [32:55] so you actually brought up the option [32:58] three but now it sounds like option [33:01] three is actually option one yes so [33:04] we're really just choosing between two [33:06] if we want to choose either or whatever [33:08] right [33:10] okay thank you
