Um, [4:04] you know, for those who aren't aware there, we have a we had a complaint come [4:08] in regarding a dog that was barking uh excessively [4:14] um in all hours of the night allegedly and our uh animal control officer went [4:21] out. He gave us a report um basically he contacted the dog owner. [4:28] Uh they denied that uh it was their dog and uh since then we have received uh [4:36] two emails from neighbors that uh also state that they did not hear any dog [4:43] barking. Uh do we have the complaint in here? Okay. Uh would you like to give us [4:49] a little history? >> Sure. I've um been on that road for [4:53] about five years now. >> Okay. the past um three years um I've [4:58] had dogs um barking um at all hours. I mean 4:45 in the morning, 12:09 at [5:06] night, 5:50 in the morning, 5:35 in the morning. I don't have air conditioning, [5:11] so anybody that has air conditioning might not hear them. It's short, sharp [5:16] um sparks and it's almost like an alarm going off and a couple times it's on [5:21] like a Saturday morning and I mean the 4:45 on a Saturday morning when you have [5:25] company and everybody in the whole house is up is totally unacceptable. I mean I [5:30] think towns usually have ordinances of sometimes that you know 7 to 10 kind of [5:35] um you know I mean 10 to 7 in the morning are quiet hours normally. Um I [5:40] mean you know five uh 650. I mean, I wouldn't be complaining, but I mean, I [5:47] had my windows open and it's just been disruptive for a couple years. [5:53] And a lot of people have dogs on that road and I don't hear anything at that [5:56] time of the morning. >> You're Gail, but uh could you just [6:01] identify yourself so we have for record? >> Yeah. Um my dogs [6:30] sleep in front of us. I have two young kids so they're also in bed with the [6:35] kids. My kids actually sleep till 7 or 8. Even this morning, I had to like wake [6:40] them up. My kids don't get my dogs don't get up until we get up in the morning. [6:45] Um, definitely not up at 4 in the morning with my kids or my dogs. Um, [6:52] occasionally I let them out around 11, maybe 12 if they have to go to the [6:57] bathroom, but it's no more than five minutes and then they're back inside. [7:01] just enough time for me to pee and them to pee and they go back to bed. Um, I [7:06] know there's a, as she said, there's a lot of dogs on our road. I actually took [7:10] a v video on Sunday of someone's dogs barking in the distance that were not [7:15] mine with a video of my dogs and I don't mind presenting that. [7:18] » Okay. >> Um, as there is other dogs in the [7:20] neighborhood, not just mine. >> If you want to hear it, you guys can [7:25] hear a dog howling. Well, I think the next Well, we'll get to the next step [7:28] because I don't think we're going to resolve it tonight, but [7:31] » So, are you Samantha? So, um, and then I come home, they're [8:00] outside, they bark if someone's walking by, they bark if there's a bear in the [8:04] property, they bark if there's a deer, which is not a very, you know, not like [8:09] it happens every day. >> Okay. [8:12] » Well, for the record, both uh parties were notified on August 5th by the town [8:16] to to appear at tonight's meeting. We we do appreciate you coming tonight. Um [8:21] there there is a a dog ordinance in the town that's available online, but I'll [8:28] just kind of hit the highlights of what we're talking about tonight. And section [8:33] 4 talks about disturbances and nuisances. Um no person shall keep or [8:37] harbor a domestic pet which disrupts the quiet comfort and response of others by [8:43] frequent habitual or persistent barking or howling. So, that's kind of the um [8:49] thing that we're talking about here. Um there are penalties. Um if if found uh [8:56] that it's a problem, there's a the first offense is a warning. The second offense [8:59] is uh a $50 fine or empoundment. And the third uh which hopefully we never get to [9:06] is empoundment or $100. In addition, there's other fees. So, um how do we [9:12] resolve this? Well, the select board [9:18] um is the enforcer of local ordinances. Um we can issue formal warnings, impose [9:23] civil fines, uh authorize an animal control officer [9:28] to seize or impound the dog if it violates a noise ordinance. So hopefully [9:33] we don't get there. Um and most importantly, we can hold hearings uh and [9:38] issue orders. So, we have received a written complaint which kind of follows [9:43] everything that we're supposed to have. You gave the times, you gave all the [9:46] information. So, that's good. So, we don't have to go back in time. So, the [9:51] next step would be to hold a hearing uh and order the owners to take remedial [9:57] action if necessary. Uh so, we need to convene a meeting and [10:07] we could set a time and date for that. It'll be a public meeting. It won't be [10:11] in this format. It'll just be for uh for that issue. So, if if you guys want to [10:17] give us a time and we can see if we can work out an evening or whenever works [10:21] for everybody. Um then you can present your case and the select board will make [10:26] a decision um of what to do. [10:31] So, with that being said, um I think that's the next step because I don't [10:35] think it's going to get resolved tonight. [10:38] Correct. Um I mean that it doesn't sound like it. And some of these are [11:27] actually before school was even out and the kids [11:30] were even there. [27:24] um process was [27:29] really just to go back over um they they were all there, all four of [27:34] them. They um spoke um about their experience, about why they wanted to be [27:42] on the board, about um their backgrounds and where they're coming from. Um [27:49] all of them had something definitely to bring forth. Um [27:58] and we made the this these decisions um based on all [28:05] that information. We [28:14] had four really great candidates and they all um all but one um had submitted [28:21] their letter of interest prior to the meeting last month and everyone had [28:27] really great qualifications and things to bring to the board um for the select [28:31] board to decide and that's what we came with our recommendation. It wasn't easy. [28:35] Uh we were lucky to have so many great applicants. [28:41] » Okay. Could could we get the names of all of the [28:45] » Yeah, I'm going to go through that. Um, in addition to the EPC recommendation, [28:51] uh, which we all received, the select board has reviewed the verbal [28:54] introductions by each of the candidates. Um, we also, uh, reviewed the recording [29:00] of the EPC meeting. We all watched it. Um, the letters of interest were [29:06] submitted by Brian Evans, Warren West, and Betsy Perez. [29:13] Um, so we had that uh Colin Reynolds uh gave [29:19] a verbal introduction uh after asking the EPC and other [29:24] candidates if they would be amendable to u him um speaking because he didn't [29:31] submit a letter prior to the deadline of which they all said yes that was fine. [29:35] So, uh he is on the recording. Um before making a final decision, the uh [29:42] select board will and it's on our agenda. We'll enter into an executive [29:46] session to discuss this matter prior to making a final decision. And so here's what I'm going [38:24] to do, which is what I did last month as well. I'm going to um take his email and [38:29] I'm going to just give you some highlights from the email and then the [38:33] entire email will be in the minutes attached to you know the record which [38:38] will go on the website. Okay. So here is the view from 10,000 ft. All right. [38:46] Upgrading of the unimproved segment of Elmoretown Highway 29. All of the road [38:52] work intended for this summer on the Elmertown rightway has been completed [38:57] and there are some bullets that fall under that. Roadway has been constructed [39:02] using all the required Vermont state and wetland regulatory requirements. On-site [39:09] blasting created riff wrap ledge material and gravel that has replaced [39:13] the need to truck an additional plus or minus 100 loads of gravel on the town [39:20] neighbors. So that is a savings um you know in terms of found and um effort. [39:28] Blasting reduced the overall need for gravel since the blasting has eliminated [39:33] the ledge impediments. Blasting enabled the installation of [39:38] ditches and drainage structures that will provide the long-term stability of [39:42] the town road. This blasting has environmental benefits [39:47] in preparing a roadway that will be stable and in compliance with all AM and [39:52] wetland rules. With the completion of the road past the [39:57] wetlands, all blasting has been completed. [40:01] We have continued to coordinate with Rick Dwire FPNR for several inspections. [40:09] Further forestry operations have also been inspected by the Loyal County [40:14] Forester Emily Sers. The Elmore Road foreman has also made [40:20] several additional visits to the site to ensure town road improvements meet with [40:25] his approval. That's Michelle. As noted previously, an internal road [40:32] will be constructed on EL ELT LLC. The route plans for that road have been [40:39] reviewed and approved by in the field by both Richard Dwire and Jocelyn Stelto [40:46] of FPNR. New road is entirely on the land of ELT LLC. We are noting this for [40:54] information purposes so as to be as transparent as possible. [40:59] We continue to have members of the public visiting and commenting on the [41:03] project. Timber harvesting update. [41:08] Harvesting continues on the land of Wildwood Ventures LLC and has been [41:13] initiated on the land of ELT LLC. As a reminder, Wildwood Ventures LLC has [41:22] received approval from the Vermont Land Trust that the harvest complies with the [41:28] terms and condition of the VLT easement. Harvesting will continue on Wildwood [41:35] Ventures and ELT LLC. Harvesting will likely continue through [41:42] the fall until the fall mud season prevents us from operating without [41:47] damage. This is likely that then it is likely that we will return for winter [41:53] operations. We anticipate maximum weekly logging [41:58] truck traffic to be 5 to 10 trucks. There will be days without trucks at all [42:05] and possibly days with more depending on logging conditions, availability of [42:11] trucks and other considerations. That concludes Richard's report to me [42:17] and I will include in the minutes the entire report. I just gave you, you [42:23] know, the thumbnail sketch of it now. >> Okay. [43:47] This is in all in black so I can't see the [43:52] difference here but it was basically just keeping that consistent [43:57] um that authority that is shared by the select board or the highway [44:02] commissioner. So the way I think it reads is that um the slice board does [44:07] have the authority but the private commissioner is also granted that [44:10] authority but the um [44:16] written uh request still needs to be submitted [44:20] to the select board. So we've contacted a second engineer, [55:04] uh Dwolf, uh came out. We met with them and they're going to give us a proposal [55:09] to evaluate the site whether it's wetlands or not. We're hoping it's not [55:14] and then we'll uh come up with a course of action. Uh if you're not familiar [55:19] with the subject, uh it's it's at the town garage. Um we need to have more [55:26] space for storage of stone and sand. Uh we created a yard up there and it may or [55:33] may not be in wetlands. So this this is what I had to find [55:46] out to get to the new engineer. And I found out that preconstruction there was [55:51] never a study for wetlands. If it hit the windshield on the tractor, it [58:18] got trimmed back. Um went around with a loader and the [58:23] sweeper, cleaned up the beach road. I mean, we're way behind on that. Uh town [58:28] aprons on the black top uh town offices. We also completed a nice culbert project [58:35] on the Elmore Mountain Road. Um one culbert is crossing the intersection of [58:40] Sterling View and Elmore NLES and the other one was placed under Sterling View [58:45] itself. Um these culberts are 24 in in diameter and certainly we got a nice new [58:50] road sign and a stop sign. So um little more rules over there. Um before the [58:59] inter the cart used to cross through the intersection on an angle [59:03] » and we were losing the side of the road. So now having it going through Sterling [59:08] View, we've got some nice headers, concrete headers. So we were able to add [59:11] almost 4 ft to the road. So they widened it out in a narrow section there. Um [59:18] mountain road was graded and chlorideed. Um we're presently working on Simmons [59:22] Mill Road. We're putting down some new gravel on the entire length [59:26] equipment. The grater was out of service July 16th through the 23rd. We had a [59:32] nice little noise in the front right wheel. Um we had Elijah Cley come up and [59:39] help us. Um, he tore apart the planetary. We shims were added to [59:44] realign the gears and the bearings so they wouldn't rub on the outside casing. [59:48] So, there's they're starting to have some wear, but it's just normal wear. [59:51] Um, oil is drained out, planted air was flushed out, and new oil was added. On [59:57] the other stuff, FEMA, um, I put in well over 30 hours this past month um, in the [1:00:03] office working on Puma. Finally got everything approved over there on Earl [1:00:08] Grey Road. our engineers design, our new change in scope, which is interesting [1:00:13] because they're the one that changed the scope of work because they didn't accept [1:00:17] our port order. So, we got to write all new work orders and and scopes for this [1:00:24] new culvert. Our permits are in place. Um, Army Corps of Engineers state [1:00:29] permit. I think I've met all their criteria. I haven't heard from them for [1:00:33] a week or two now. So, I believe we're going to move forward on this project [1:00:37] next year. Um, we'll be changing a large culbert on [1:00:41] Simmons Mill in the next two weeks. I have not set a date because the culbert [1:00:45] has not showed up yet in my yard. Um, grant and aid work. Um, that's a one of [1:00:51] the grants from the state of Vermont. We'll be working on Hardwood Flats Road [1:00:55] on the Kirect Hill Per portion of the road. We'll be doing ditching, stone [1:01:00] lining, cover work, and that will be done in the month of September. [1:01:06] I guess you know the the covert that we got to go back and replace. Are they [1:01:09] going to pay for that or how did >> Yeah. So um Yeah. So FEMA is going to [1:01:14] pay 75% of it. We're going to end up paying 25% of it. Um so we're looking at [1:01:21] almost $230,000 project. >> Wow. [1:01:24] » So um it's a long ways from the $12,000 fix that we put in during the flooding. [1:01:32] Um, but I mean engineer cost, I mean they don't accept my my design. It's got [1:01:38] to be approved engineers and stuff. So, um, that all adds up and it's got to go [1:01:42] through a bid process since it's federal money. [1:04:52] just as I don't know if you're aware of it but uh I test the water every two [1:04:56] weeks give it to the state and they do a a caffeine test which picks up septic [1:05:03] issues here in the lake and uh we should have the results of this year so I mean [1:05:07] if it's something you'd be interested so >> yeah I did it pinpoint any [1:05:13] » very very low >> very very low [1:05:17] » but the caffeine um the theory behind behind it is animals don't drink [1:05:21] caffeine. So if that gets into the water, it [1:05:24] doesn't show up. But um fortunately people do drink caffeine. [1:05:29] » Even decaf is picked that up. >> Decaf does not. No. So if you drink [1:05:33] decaf in your systemic system doesn't work. It doesn't show up. No. But uh [1:05:38] this is what the state has found. Said I do every two weeks. Um, and then the other one of the other things was just been [1:10:14] working with Michelle on looking at some options for uh heating systems at the [1:10:19] town garage uh as an alternative to the electric um boilers that we have that um [1:10:28] yeah uh the electric boilers and also reduce the uh electrical demand for the [1:10:34] town garage in the winter. uh which would reduce the size of the needed [1:10:39] generator for the emergency shelter. That's the big issue right now is that [1:10:43] the heavy load of the electric boilers really makes the generator a very big [1:10:50] purchase way bigger than it really is for lights um in the the rest of the [1:10:56] building. >> So working with a couple um firms on [1:11:01] getting some estimates. We have one. We're going to meet another one on [1:11:04] Monday. Uh and also getting estimates for generators for the new potential um [1:11:11] boilers that could be supplementary um to take advantage of the electric [1:11:16] heaters when it makes sense to um but could also support the building um if [1:11:22] the power was out, right? >> Could be supported by the generator. [1:11:25] » Can I ask a curious question? Um, why aren't they oil or [1:11:30] » Well, that's a long story. >> Okay, then don't go there. Go ahead. [1:11:34] » But to make a long story short, when we tried to go green on building with solar [1:11:38] panels and in discussions >> way before design during design, uh [1:11:44] there was a lot of discussion about going solar, keeping the building green [1:11:47] and that avoided the oil situation. Was it the right decision looking back on it [1:11:52] now? Probably not. But >> um but it they do work [1:11:57] » right >> and you know it's you know all summer [1:12:00] long I mean we're not burning any electric over there but in the winter [1:12:03] we're uh >> you credited like six grand so far this [1:12:07] summer burn in one month >> right so we we just don't have [1:12:11] » so if we can get some supplemental heat in there through propane or whatever we [1:12:16] decide to do >> we can cut back on the electrical usage [1:12:19] and still kind of stay green But that's making it short. Um the current generator [1:13:45] there is 30 kows and it covers most of it but not all of it. Um so the 30 [1:13:51] kowatt generator donated by concept 2 is available and up for grabs. Um that [1:13:57] probably wouldn't be a very good fit for the town hall. It's not going to cover [1:14:00] those boilers >> garage. [1:14:02] » So the sorry the garage not the town hall. So the let me just finish uh [1:14:07] thought is that we can put the 30 kowatt generator at the fire department which [1:14:13] is the primary emergency shelter and emergency operations center. [1:14:17] » That'd be good. >> The power goes out. It'll have an ATS. [1:14:19] It'll switch on. The building will run. We can open and close the doors. Our [1:14:23] compressors will run. >> Um and the benefactor has agreed to [1:14:29] cover the installation costs of both the store and the fire department. [1:14:32] » Great. So the 60 kilowatt generator that's going into the um Elmore store [1:14:43] will also we have a spare automatic transfer switch and it has more than [1:14:48] enough capacity if we wanted to.
